Considering:
The fishing operations (faenas de pesca) of the national fishing fleet, using longline and live bait, especially with respect to areas and dates, are subject to the regulations of this Agreement.

Infractions of or non-compliance with this agreement will be sanctioned in accordance with the provisions established in the Fisheries and Aquaculture Law" (Ley de Pesca y Acuicultura).

The scientific name of the bait species authorized to be extracted as well as the approved fishing gears will be defined in the fishing license.
For the purposes of this agreement the following is considered:
Commercial fishing (Pesca comercial): That fishing activity carried out to obtain economic benefits from the sale of captured fishery products in port.
Sport fishing (Pesca deportiva): That fishing activity carried out without profit and for the purpose of sport, distraction, pleasure, recreation, tourism, or pastime.
Tourist fishing (Pesca turística): fishing activity carried out by national or foreign natural persons, with the aim of capturing, with a personal fishing tackle (aparejo de pesca) appropriate for the purpose, aquatic fishery resources in continental waters, jurisdictional waters, or in the exclusive economic zone, for commercial purposes and exclusively tourist purposes, carried out on a permanent basis.
Live bait (Carnada viva): Small-sized species that are used on floating longline for the purpose of promoting the capture of other species of commercial interest of larger size.
a. In the Golfo Dulce from an imaginary line between Cabo Matapalo and Punta Banco, and from this line inward to the end of the Golfo Dulce (towards Rincón de Osa), *for vessels that do not have a valid and specific fishing license authorizing the capture for commercialization of live bait in that zone, as well as the type of live bait authorized to be extracted.
(*) (Thus the final phrase of the preceding subparagraph was amended by agreement A.J.D.I.P.081-2014 of March 26, 2014) b. In the Golfo de Nicoya from an imaginary line between Punta Peñón and Isla Negritos, and from this line inward to the mouth of the Río Tempisque, for those vessels that do not have the respective valid fishing permits for that purpose. In the Golfo de Papagayo from an imaginary line between Cabo Velas to Punta Blanca, and from this line inward, *for vessels that do not have a valid and specific fishing license authorizing the capture for commercialization of live bait in that zone, as well as the type of live bait authorized to be extracted.

However, within the indicated 30 miles, vessels belonging to the commercial non-tourist fleet may capture and store in live wells live bait for use in the vessel's own fishing operations, but outside the 30 miles.
(Thus amended the previous paragraph by agreement A.J.D.I.P.081-2014 of March 26, 2014) Additionally, an imaginary straight line is established that goes from Punta Burica (08º 02' North Latitude and 82° 54' West Longitude) thirty nautical miles over the demarcation line of the marine border between Costa Rica and Panama to the position 07°28' North Latitude and 83° 10' West Longitude, and another imaginary straight line that goes from Punta Quepos (09° 24' North Latitude and 84° 11' West Longitude) thirty nautical miles to the position 09° 00' North Latitude and 84º 28' West Longitude.
Between these two imaginary lines, an area of thirty nautical miles perpendicular to the coast is established, in which, during the months of January to May of each year, in the first twelve miles, fishing with surface longline is prohibited for the national medium fleet (flota nacional media) and a provision of the thirty miles applies to the national advanced fleet (flota nacional avanzada).
Any vessel that violates the prohibition indicated in this article shall be subject to what was established in Law 8436, the Fisheries and Aquaculture Law, with respect to due process.
For the purposes of the above, the incidental catch may not exceed 15% (eviscerated weight) of the total catch of the vessel per non-tourist commercial fishing trip carried out.
Incopesca will not issue recommendations for the of this Article 8, a measure that will be reviewed annually after this provision comes into effect, to assess the impact of the results produced and determine if export recommendations are to be made again.

When during the unloading of the product, sailfish is detected that exceeds or surpasses the 15% of the total catch permitted as incidental catch, without this constituting, by the quantities close to the percentage, directed fishing for sailfish, the Incopesca official in charge of the inspection shall not authorize the commercialization of that surplus, and the interested party must proceed to authorize its donation to charitable institutions or, otherwise, dispose of it in accordance with the applicable legal provisions.

Transitory One.-The Executive Presidency is delegated so that within a period of eight days, it notifies the Tourist Fishing Fishing Organizations, the Ministry of Public Security (Ministerio de Seguridad Pública), and the Director of the National Coast Guard Service (Servicio Nacional de Guardacostas), of the designation of the representatives of their departments to the Local Monitoring and Follow-up Committees (Comités Locales de Vigilancia y Seguimiento), for the faithful compliance with this agreement.
Transitory Two.-INCOPESCA will carry out an inventory of the quantities of sailfish captured in storage facilities no later than December 28, 2008, it being understood that no further recommendations for sailfish exports may be authorized beyond what is already in storage facilities, according to the inventory established by the Institute.

Considerando:

Las infracciones o inobservancias a este acuerdo se sancionarán de conformidad con lo establecido en la Ley de Pesca y Acuicultura".

El nombre científico de las especies de carnada autorizadas para ser extraídas así como las artes de pesca aprobadas estarán definidas en la licencia de pesca.
Para efectos de este acuerdo se considera:
Pesca comercial: Aquella actividad pesquera que se realiza para obtener beneficios económicos producto de la venta en puerto de los productos pesqueros capturados.
Pesca deportiva: Aquella actividad pesquera que se realiza sin fines de lucro y con propósito de deporte, distracción, placer, recreo, turismo o pasatiempo.
Pesca turística: actividad pesquera que realizan personas físicas nacionales o extranjeras, con el fin de capturar, con un aparejo de pesca personal apropiado para el efecto, recursos acuáticos pesqueros en aguas continentales, jurisdiccionales o en la zona económica exclusiva, con fines comerciales y propósitos exclusivamente turísticos, llevados a cabo de forma permanente.
Carnada viva: Especies de tallas pequeñas que se utilizan en el palangre a flote con el objeto de propiciar la captura de otras especies de interés comercial de mayor tamaño.
a. En el Golfo Dulce a partir de una línea imaginaria comprendida entre Cabo Matapalo y Punta Banco, y de esta línea aguas adentro hasta el final del Golfo Dulce (hacia Rincón de Osa), *a embarcaciones que no cuenten con licencia de pesca vigente y específica que autorice la captura para comercialización de carnada en esa zona, así como el tipo de carnada autorizada a ser extraída.
(*) (Así reformada al frase final del inciso anterior por acuerdo A.J.D.I.P.081-2014 del 26 de marzo de 2014) b. En el Golfo de Nicoya a partir de una línea imaginaria comprendida entre Punta Peñón e Isla Negritos, y de esta línea aguas adentro hasta la desembocadura del Río Tempisque, a aquellas embarcaciones que no cuenten con los respectivos permisos de pesca vigentes para tal fin. En el Golfo de Papagayo a partir de una línea imaginaria comprendida entre Cabo Velas a Punta Blanca, y de esta línea aguas adentro, *a embarcaciones que no cuenten con licencia de pesca vigente y específica que autorice la captura para comercialización de carnada en esa zona, así como el tipo de carnada autorizada a ser extraída.

Sin embargo, en las 30 millas indicadas las embarcaciones pertenecientes a la flota comercial no turística sí podrán capturar y almacenar en viveros carnada viva para utilización en faenas de pesca propias de la embarcación, pero fuera de las 30 millas.
(Así reformado el párrafo anterior por acuerdo A.J.D.I.P.081-2014 del 26 de marzo de 2014) Adicionalmente se establece una línea recta imaginaria que va desde Punta Burica (08º 02' Latitud Norte y 82° 54' Longitud Oeste) treinta millas náuticas sobre la línea demarcatoria de la frontera marina entre Costa Rica y Panamá hasta la posición 07°28' Latitud Norte y 83° 10' Longitud Oeste y otra línea recta imaginaria que va desde Punta Quepos (09° 24' Latitud Norte y 84° 11' Longitud Oeste) treinta millas náuticas hasta la posición 09° 00' Latitud Norte y 84º 28' Longitud Oeste.
Entre estas dos líneas imaginarias se establece un área de treinta millas náuticas perpendiculares a la costa, en la cual, durante los meses de Enero a Mayo de cada año, en las primeras doce millas se prohíbe la pesca con palangre de superficie a la flota nacional media y una provisión de las treinta millas para la flota nacional avanzada.
Toda embarcación que infrinja la prohibición señalada en este artículo, se le aplicara lo estableció en la ley ochenta y cuatro treinta y seis ley de Pesca y Acuicultura con respeto al debido proceso.
Para efectos de lo anterior, la pesca incidental no podrá exceder el 15% (peso eviscerado) de la captura total de la embarcación por cada viaje de pesca comercial no turística realizado.
El Incopesca no emitirá recomendaciones para la de este artículo ocho, medida que será revisada anualmente, después de que entre en vigencia esta disposición, para valorar el impacto de los resultados producidos y determinar si se vuelve a recomendar la exportación.

Cuando en la descarga del producto se detecte pez vela que excede o sobrepasa el 15% de la captura total permitida como pesca incidental, sin que el mismo constituya por las cantidades cercanas al porcentaje, pesca dirigida a la captura del pez vela, el funcionario del Incopesca a cargo de la inspección no autorizará la comercialización de ese excedente, debiendo procederse por parte del interesado a autorizar su donación a instituciones de beneficencia o en caso contrario a disponer del mismo de conformidad con las disposiciones legales aplicables.

Transitorio Uno.-Deléguese en la presidencia Ejecutiva para que en un plazo de ocho días notifique a las Organizaciones Pesqueras de Pesca Turística, al Ministerio de Seguridad Pública y al Director del Servicio Nacional de Guarda Costas, la designación de los representantes de sus dependencias ante los Comités Locales de Vigilancia y Seguimiento, para el fiel cumplimiento de este acuerdo.
Transitorio Dos.-INCOPESCA hará un inventario de las cantidades capturadas en bodegas de pez vela a más tardar el día 28 de diciembre del 2008, siendo que no podrá autorizarse más recomendaciones de exportaciones de pez vela que lo que ya se encuentre en bodegas, según el inventario que establezca el Instituto.
