IT IS AGREED:
To issue the following, MANAGEMENT MEASURES FOR THE ESTABLISHMENT OF RELATIONS BETWEEN COMMERCIAL FISHING AND SPORT FISHING ACTIVITIES
Considering
Commercial Fishing: That fishing activity carried out to obtain economic benefits from the sale in port of the captured fishery products.
Sport Fishing: That fishing activity carried out without profit and for the purpose of sport, distraction, pleasure, recreation, tourism, or pastime.
Tourist Fishing: Fishing activity carried out by national or foreign natural persons, with the aim of capturing, with appropriate personal fishing tackle for the purpose, aquatic fishery resources in continental, jurisdictional waters, or in the exclusive economic zone, for commercial purposes and exclusively tourist purposes, carried out on a permanent basis.
a. In Golfo Dulce from an imaginary line between Cabo Matapalo and Punta Banco, and from this line seaward, for vessels with a length overall exceeding eight meters.
b. In the Gulf of Nicoya from an imaginary line between Cabo Blanco to Isla Herradura, and from this line seaward, for vessels with a length overall exceeding ten meters.
c. In the Gulf of Papagayo from an imaginary line between Cabo Velas to Punta Blanca, and from this line seaward, for vessels with a length overall exceeding ten meters.
For the purposes of the foregoing, incidental catch shall not exceed 15% of the total catch of the vessel for each non-tourist commercial fishing trip conducted.
The export of sailfish is authorized for up to 30% of the total landings recorded in the immediately preceding quarter, according to the order of priority of the request. Understand that for the purposes of this measure, the year will have four chronologically defined quarters.
Violations of this regulation shall be sanctioned in accordance with the provisions established in the Fisheries and Aquaculture Law.

SE ACUERDA:
Emitir las siguientes, MEDIDAS DE ORDENAMIENTO PARA EL ESTABLECIMIENTO DE RELACIONES ENTRE LAS ACTIVIDADES DE LA PESCA COMERCIAL, LA PESCA DEPORTIVA
Considerando
Pesca Comercial: Aquella actividad pesquera que se realiza para obtener beneficios económicos producto de la venta en puerto de los productos pesqueros capturados.
Pesca Deportiva: Aquella actividad pesquera que se realiza sin fines de lucro y con propósito de deporte, distracción, placer, recreo, turismo o pasatiempo.
Pesca Turística: actividad pesquera que realizan personas físicas nacionales o extranjeras, con el fin de capturar, con un aparejo de pesca personal apropiado para el efecto, recursos acuáticos pesqueros en aguas continentales, jurisdiccionales o en la zona económica exclusiva, con fines comerciales y propósitos exclusivamente turísticos, llevados a cabo de forma permanente.
a. En el Golfo Dulce a partir de una línea imaginaria comprendida entre Cabo Matapalo y Punta Banco, y de esta línea aguas adentro, a embarcaciones cuya eslora sea superior a los ocho metros.
b. En el Golfo de Nicoya partir de una línea imaginaria comprendida entre Cabo Blanco a Isla Herradura, y de esta línea aguas adentro, a embarcaciones cuya eslora sea superior a los diez metros.
c. En el Golfo de Papagayo a partir una línea imaginaria comprendida entre Cabo Velas a Punta Blanca, y de esta línea aguas adentro, a embarcaciones cuya eslora sea superior a los diez metros.
Para efectos de lo anterior, la pesca incidental no podrá exceder el 15% de la captura total de la embarcación por cada viaje de pesca comercial no turística realizado.
Se autoriza la exportación de pez vela hasta por un 30% de los desembarques totales registrados en el trimestre inmediato anterior, de acuerdo al orden de prioridad de la solicitud. Entiéndase que para efectos de esta medida el año tendrá cuatro trimestres definidos cronológicamente.
La infracciones a este reglamento se aplicará de conformidad con lo establecido en la Ley de Pesca y Acuicultura.
Siguiendo para esto los procedimientos establecidos por el INCOPESCA.
Cuando ésta esté fraccionada en su venta.
