A.J.D.I.P./074-2007.—Puntarenas, on the sixteenth day of the month of March, 2007.
Considering:
7384, the Law Creating INCOPESCA, and Law No. 8436, the Fisheries and Aquaculture Law, it is the authority and competence of INCOPESCA to protect and conserve hydrobiological resources, in order to guarantee the living resources of the sea for future generations.
Therefore, IT IS AGREED:
A- Fishing with gillnets or entangling nets (redes agalleras o red de enmalle): During the months of May, June, and July of each year, the use of gillnets or trammel nets (trasmallos) of any mesh size (luz de malla) is prohibited in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52" West Longitude, 09º53'31" North Latitude) to the Faro de las Islas Negritos Afuera Lighthouse (84º49'35" West Longitude, 09º49'14" North Latitude) and from there to Punta Cuchillo (84º52'23" West Longitude, 09º49'39" North Latitude), from that imaginary line, inland waters up to the mouth of the Tempisque River.
B- Fishing with Taiwanese line (línea taiwanesa): During the period comprised of the months of May, June, and July of each year, the use of a Taiwanese line is prohibited in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52" West Longitude, 09º53'31" North Latitude) to the Faro de las Islas Negritos Afuera Lighthouse (84º49'35" West Longitude, 09º49'14" North Latitude) and from there to Punta Cuchillo (84º52'23" West Longitude, 09º49'39" North Latitude), from that imaginary line, inland waters up to the mouth of the Tempisque River.
C- Fishing with handlines (cuerdas de mano): During the period comprised of May, June, and July of each year, any permit holder (permisionario) with a Commercial Fishing License for the inner part of the Gulf of Nicoya may use, at any time of day, handlines with a No. 6 hook, in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52" West Longitude, 09º53'31" North Latitude) to the Faro de las Islas Negritos Afuera Lighthouse (84º49'35" West Longitude, 09º49'14" North Latitude) and from there to Punta Cuchillo (84º52'23" West Longitude, 09º49'39" North Latitude), from that imaginary line, inland waters up to the mouth of the Tempisque River.
D- Fishing with longline (línea planera) in the inland water zone of the Gulf of Nicoya: During the period comprised of the months of May, June, and July of each year, any permit holder (permisionario) with a Commercial Fishing License for the inner part of the Gulf of Nicoya may use, at any time of day, one longline per vessel with a maximum of 500 meters in length and also a maximum of 300 No. 6 hooks, in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52" West Longitude, 09º53'31" North Latitude) to the Faro de las Islas Negritos Afuera Lighthouse (84º49'35" West Longitude, 09º49'14" North Latitude) and from there to Punta Cuchillo (84º52'23" West Longitude, 09º49'39" North Latitude), from that imaginary line, inland waters up to the mouth of the Tempisque River.
E- Fishing with longline (línea planera) in the offshore water zone of the Gulf of Nicoya: Those who opt for the provisions in points C and D may catch their own bait using a beach seine net (chinchorro de barrer playa) and/or a purse seine net (red bolichera). Those who opt for this alternative must notify the Department of Protection and Registry.
F, Of Tuna and Mackerel (small pelagics) Fishing (Pesca de Atún y Macarelas (pequeñas pelágicas)) with drifting gillnet (red agallera a la deriva).
The area authorized for the use of this type of fishing is established as the area between the imaginary straight line running from the Puntarenas Cruise Ship Pier (84°49'51" West Longitude, 9°58'26" North Latitude) to the easternmost part of Isla de Cedros (84°51'59" West Longitude, 9°51'00" North Latitude) and from those two imaginary lines towards the offshore waters of the Gulf of Nicoya.
Said net must have a minimum mesh size (luz de malla) of 3½ inches, a maximum length of 500 meters, and a maximum height of 100 meshes, and must be equipped with buoys, floats, or any other device that allows the competent authorities to identify it.
Those permit holders (permisionarios) engaged in this type of fishing shall make their vessels available so that INCOPESCA officials may obtain information on board about their catches and the characteristics of the fishing gear used, when so designated by the Institution.
Non-compliance with this regulation shall be sanctioned, as stipulated in the article of Law No. 8436.

Those permit holders (permisionarios) engaged in this type of fishing shall make their vessels available so that INCOPESCA officials may remain on board and obtain information about their catches, according to the Institution's capabilities.
Prior to the sardine boat's arrival at port, the permit holder must notify the Department of Protection and Registry for the purpose of inspecting all landings.
If the permit holder fails to comply with the stipulations of this article, the agreed-upon authorization shall be terminated.

The General Technical Directorate must take the pertinent actions so that, within a period not exceeding 30 calendar days counted from the publication of this regulation, it submits to the administrative and competent bodies of IMAS the preliminary list of fishermen subject to the restrictions and conditions of the closed season (veda) for the Gulf of Nicoya, so that they may be granted the corresponding economic subsidy, once they have fulfilled the obligation of communal work service.
Based on the provisions of Law 8436, only those duly legalized fishermen who are affected by the closed season (veda) shall enjoy this benefit.
8436, to all those permit holders (permisionarios) who, during the present closed season (veda), are found by the competent authorities to be infringing the provisions established in this agreement, INCOPESCA, through each of its competent offices, shall proceed to suspend, as a precautionary measure from the moment the infraction is committed until the conclusion of the sanctioning administrative process, the granting of fuel at a preferential price and shall request the Joint Institute of Social Assistance (Instituto Mixto de Ayuda Social, IMAS) that both the permit holders and their assistants be automatically excluded from the lists submitted as potential beneficiaries of the economic aid that this Institution grants during the closed seasons (vedas) established in the Gulf of Nicoya.

Por tanto, SE ACUERDA:
A- Pesca con redes agalleras o red de enmalle: Durante los meses de mayo, junio y julio de cada año, se prohíbe la utilización de redes agalleras o trasmallos de cualquier luz de malla, en el área comprendida entre una línea recta imaginaria que va desde Punta Torres, conocida como Peñón (84º43'52" Longitud oeste, 09º53'31" Latitud norte) hasta el Faro de las Islas Negritos Afuera (84º49'35" Longitud oeste, 09º49'14" Latitud norte) y de aquí hasta Punta Cuchillo (84º52'23" Latitud oeste, 09º49'39" Latitud norte), de esa línea imaginaria, aguas adentro hasta la desembocadura del Río Tempisque.
B- Pesca con línea taiwanesa: Durante el período comprendido entre los meses de mayo, junio y julio de cada año, se prohíbe la utilización de la línea taiwanesa, en el área comprendida entre una línea recta imaginaria que va desde Punta Torres, conocida como Peñón (84º43'52" Longitud oeste, 09º53'31" Latitud norte) hasta el Faro de las Islas Negritos Afuera (84º49'35" Longitud oeste, 09º49'14" Latitud norte) y de aquí hasta Punta Cuchillo (84º52'23" Longitud oeste, 09º49'39" Latitud norte) de esa línea imaginaria, aguas adentro hasta la desembocadura del Río Tempisque.
C- Pesca con cuerdas de mano: Durante el período comprendido entre mayo, junio y julio de cada año, todo aquel permisionario con Licencia de Pesca Comercial para la parte interna del Golfo de Nicoya, podrá utilizar a cualquier hora del día las cuerdas de mano con anzuelo Nº 6, en el área comprendida entre una línea recta imaginaria que va desde Punta Torres, conocida como Peñón (84º43'52" Longitud oeste, 09º53'31" Latitud norte) hasta el Faro de las Islas Negritos Afuera (84º49'35" Longitud oeste, 09º49'14" Latitud norte) y de aquí hasta Punta Cuchillo (84º52'23" Longitud oeste, 09º49'39" Latitud norte) de esa línea imaginaria, aguas adentro hasta la desembocadura del Río Tempisque.
D- Pesca con línea planera en la zona aguas adentro del Golfo de Nicoya: Durante el período comprendido entre los meses de mayo, junio y julio de cada año, todo aquel permisionario con Licencia de Pesca Comercial para la parte interna del Golfo de Nicoya, podrá utilizar a cualquier hora del día una línea planera por embarcación con un máximo de 500 metros de largo y también un máximo de 300 anzuelos Nº 6, en el área comprendida entre una línea recta imaginaria que va desde Punta Torres, conocida como Peñón (84º43'52" Longitud oeste, 09º53'31" '4Catitud norte) hasta el Faro de las Islas Negritos Afuera (84º49'35" Longitud oeste, 09º49'14" Latitud Norte) y de aquí hasta Punta Cuchillo (84º52'23" Longitud oeste, 09º49'39" Latitud norte), de esa línea imaginaria, aguas adentro hasta la desembocadura del Río Tempisque.
E- Pesca con línea planera en la zona aguas afuera del Golfo de Nicoya: Quienes opten por lo dispuesto en los puntos C y D, podrán capturar su propia carnada utilizando chinchorro de barrer playa y/o red bolichera. Quienes opten por esta alternativa deben comunicarlo al Departamento de Protección y Registro.
F, De la Pesca de Atún y Macarelas (pequeñas pelágicas) con red agallera a la deriva.
Se establece como zona autorizada para el uso de este tipo de pesca el área comprendida entre la línea recta imaginaria que va desde el Muelle de Cruceros de Puntarenas (84°49551" Longitud Oeste, 9°58'26" Latitud Norte) hasta la parte más Oriental de la Isla de Cedros (84°51'59" Longitud Oeste, 9°51'00" Latitud Norte) y de esas dos líneas imaginarias aguas hacia afuera del Golfo de Nicoya.
Dicha red deberá tener una luz de malla mínima de 3½ pulgadas, una longitud máxima de 500 metros y una altura máxima de 100 mallas y deberá estar provista de boyas, galones o cualquier otro dispositivo que permita a las autoridades competentes su identificación.
Aquellos permisionarios que se dediquen a este tipo de pesca facilitarán sus embarcaciones para que funcionarios del INCOPESCA, puedan obtener a bordo de éstas información de sus capturas y de las características del arte de pesca utilizada, cuando así lo designe la Institución ".
El incumplimiento a esta normativa será sancionada, según lo estipulado en el articulo de la Ley N ° 8436.

Aquellos permisionarios que se dediquen a este tipo de pesca facilitarán sus embarcaciones para que funcionarios del ESTCOPESCA, puedan permanecer y obtener a bordo de éstas, la información de sus capturas, de acuerdo a las posibilidades cíe la Institución.
Previo a la llegada del barco sardinero a puerto, el permisionario deberá de notificar al Departamento de Protección y Registro para efecto .de inspeccionar todas las descargas.
Si el permisionario no cumpliera lo estipulado en este artículo, se dará por terminada la autorización acordada.

La Dirección General Técnica deberá realizar las acciones pertinentes a fin de que en un plazo no mayor a 30 días naturales contados a partir de la publicación de esta regulación, presente ante las instancias administrativas y competentes del IMAS, el listado preliminar de pescadores sujeto a las restricciones y condiciones de veda para el Golfo de Nicoya, a fin de que se les otorgue el subsidio económico correspondiente, una vez que haya cumplido con la obligación del servicio de trabajo comunal.
Con sustento en lo establecido en la Ley 8436, únicamente gozarán de ese beneficio aquellos pescadores debidamente legalizados que se vean afectados por la veda.
