1. 1That in accordance with the provisions of Article 3 of Executive Decree No. 33151-MP, the stewardship of the Social Sector and Fight against Poverty is the responsibility of the Minister of Housing and Human Settlements.
2. 2That in accordance with Law No. 8436, published in the Official Gazette La Gaceta No. 78 dated April 25, 2005, it is an attribution of the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA) to protect and conserve hydrobiological resources, for the sake of guaranteeing to future generations the living resources of the sea, promoting sustainable exploitation of the resources through the establishment of closed season periods and areas, for which agreement No. A.J.D.I.P./074-2007 is issued, published in the Official Gazette La Gaceta No. 58- Thursday, March 22, 2007.
3. 3That the cited agreement, based on article 34 of Law 8436, prohibits INCOPESCA from allowing artisanal fishermen of the province of Puntarenas and in the communities of the Gulf of Nicoya in Guanacaste to fish, during the periods from May 1 to July 31 of the year 2007.
4. 4That this cited agreement prevents fishermen who use "trasmallo" nets from performing their remunerated activity and therefore from earning income from this source, affecting the satisfaction of their basic needs.
5. 5That in article 36 of Law 8436, it is expressed: "...The Executive Branch may authorize the allocation of funds from the National Budget in favor of INCOPESCA for conducting studies on closed seasons, and in favor of the Joint Institute for Social Aid (IMAS), with the purpose of developing socioeconomic assistance programs designed especially for this purpose, in favor of fishermen who are affected during closed season periods, provided it is proven that they have no other sources of income and are in a condition of poverty. These programs will necessarily involve community work services by the beneficiaries, in accordance with the corresponding regulation or for conducting studies on the matter.
6. 6That the Law Creating the Joint Institute for Social Aid, No. 4760 of May 4, 1971, establishes in its article 2 the purpose of solving the problem of extreme poverty in the country, and in its article 4, among its founding purposes, states "to attend to the needs of social groups or persons who must be provided with means of subsistence when they lack them."
7. 7That article 4 of the Regulation for the Provision of Services and the Granting of Benefits of the Joint Institute for Social Aid, published in La Gaceta No. 102 of May 29, 2000, defines the concept of poverty as: "Complex phenomenon or situation of a circumstantial or structural, multifaceted and heterogeneous nature, that affects persons and is characterized by their precarious housing and sanitary conditions, low educational levels, unstable insertion in the productive system, conditions of social risk, with little or no incorporation into mechanisms of social participation, insufficient resources to satisfy basic needs (nutritional, health, education, and housing) and in some cases absence or insufficiency of skills, aptitudes, tools, and opportunities to generate and accumulate income."
8. 8That in article 21, subsection h) of the cited Regulation, it is stated regarding the subjects of institutional services, the following: "In duly documented exceptional cases and with the corresponding social technical report authorized by the person exercising the respective Regional Management, benefits may be granted to persons or families that present a situation of circumstantial poverty not necessarily registered as such in the SIPO, or who, through a specific decree or law, are considered beneficiaries of the institutional action."
9. 9That there is no compensatory fund to provide an economic subsidy (subsidio económico) to the fishermen affected by the closed season.

10.-That the closed season period causes a situation of circumstantial poverty among fishermen due to the lack of income from this source. Therefore, THEY DECREE:

Considering:

1. 1Que de conformidad con lo dispuesto en el artículo 3º, del Decreto Ejecutivo Nº 33151-MP, la rectoría del Sector Social y Lucha contra la Pobreza está a cargo del Ministro de Vivienda y Asentamientos Humanos.
2. 2Que de conformidad con la Ley Nº 8436, publicada en el Diario Oficial La Gaceta Nº 78 de fecha 25 de abril del 2005 es atribución del Instituto Costarricense de Pesca y Acuicultura (INCOPESCA) proteger y conservar los recursos hidrobiológicos, en aras de garantizar a las generaciones venideras, los recursos vivos del mar, promoviendo, una explotación sostenible de los recursos mediante el establecimiento de periodos y áreas de veda, para lo cual se emite el acuerdo Nº A.J.D.I.P./074-2007, publicado en el Diario Oficial La Gaceta Nº 58- jueves 22 de marzo del 2007.
3. 3Que el acuerdo citado y con base en el artículo 34 de la Ley 8436, INCOPESCA prohíbe faenar a los pescadores artesanales de la provincia de Puntarenas y en las comunidades del Golfo de Nicoya en Guanacaste, en los periodos que van del 1º de mayo al 31 de julio del año 2007.
4. 4Que este acuerdo citado impide a los pescadores que utilizan "trasmallo", desempeñar su actividad remunerada y por ende percibir ingresos por este concepto, afectando la satisfacción de sus necesidades básicas.
5. 5Que en el artículo 36 de la Ley 8436, se expresa: "...El Poder Ejecutivo podrá autorizar el destino de fondos del Presupuesto Nacional a favor de INCOPESCA para la realización de los estudios sobre vedas, y a favor del Instituto Mixto de Ayuda Social (IMAS), con el propósito de desarrollar programas de asistencia socioeconómica diseñados especialmente con tal propósito, a favor de los pescadores que se vean afectados en los períodos de veda, siempre que se compruebe que no tienen otras fuentes de ingresos y se encuentran en condición de pobreza. Estos programas implicarán necesariamente servicios de trabajo comunal por parte de los beneficiarios, conforme al reglamento correspondiente o para la realización de estudios sobre la materia.
6. 6Que la Ley de Creación del Instituto Mixto de Ayuda Social, Nº 4760 del 4 de mayo de 1971, establece en su artículo 2º la finalidad de resolver el problema de la pobreza extrema en el país y en su artículo 4º dentro de sus fines de creación, se señala "atender las necesidades de los grupos sociales o de las personas que deban ser provistas de medios de subsistencia cuando carezcan de ellos."
7. 7Que el artículo 4º del Reglamento para la Prestación de Servicios y el Otorgamiento de Beneficios del Instituto Mixto de Ayuda Social, publicado en La Gaceta Nº 102 del 29 de mayo del 2000, define el concepto de pobreza como: "Fenómeno o situación compleja de índole coyuntural o estructural multifacético y heterogéneo, que afecta a las personas y que se caracteriza por sus precarias condiciones de vivienda y sanitarias, bajos niveles educacionales, inserción inestable en el sistema productivo, condiciones de riesgo social, con poca o ninguna incorporación en mecanismos de participación social, recursos insuficientes para satisfacer necesidades básicas (nutricionales, salud, educación y vivienda) y en algunos casos ausencia o insuficiencia de destrezas, aptitudes, herramientas y oportunidades para generar y acumular ingresos."
8. 8Que en el artículo 21 inciso h) del citado Reglamento, se señala en cuanto a los sujetos de los servicios institucionales, lo siguiente: "En casos de excepción debidamente documentados y con el correspondiente informe técnico social autorizados por quien ejerza la Gerencia Regional respectiva, se podrá otorgar beneficios a personas o familias que presenten una situación de pobreza coyuntural no necesariamente registrada como tal en el SIPO, o que mediante algún decreto o ley específica, se considere beneficiarios de la acción institucional."
9. 9Que no se cuenta con un fondo compensatorio para brindar un subsidio económico a los pescadores afectados por la veda.

10.-Que el período de veda, provoca una situación de pobreza coyuntural en los pescadores por la carencia de ingresos por este concepto. Por tanto,
