in the entirety of the text - Complete Text of Regulation 126 Reform Decree Establishes Closed Season in the Gulf of Nicoya Complete Record Text: AA6A8 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/126-2007.—Puntarenas, on the twenty-seventh day of the month of April, 2007.
1st— That in accordance with Law No. 7384, the Law Creating INCOPESCA, and Law No. 8436, the Fisheries and Aquaculture Law, it is the responsibility and competence of INCOPESCA to protect and conserve hydrobiological resources, in order to guarantee for future generations the living resources of the sea.
2nd—That through agreement AIDIP/074-2007, this Board of Directors established the applicable regulations during the closed season of 2007.
3rd—That this Board of Directors has analyzed requests submitted by various fishing sectors and has determined it necessary to modify the aforementioned agreement.
Therefore, it is agreed:
1. To add to Agreement AJDIP/074-2007, Article 3 on fishing by the Small-Scale Artisanal Fleet, a subsection F), which shall read as follows:
"F, On the Fishing of Tuna and Mackerel (small pelagics) with drifting gillnet.
The area authorized for the use of this type of fishing is hereby established as the area between the imaginary straight line running from the Puntarenas Cruise Ship Pier (84°49'51" West Longitude, 9°58'26" North Latitude) to the easternmost part of Isla de Cedros (84°51'59" West Longitude, 9°51'00" North Latitude) and from those two imaginary lines outward into the waters of the Gulf of Nicoya. Said net must have a minimum mesh size of 3½ inches, a maximum length of 500 meters, and a maximum height of 100 meshes, and must be equipped with buoys, gallon jugs, or any other device that allows the competent authorities to identify it.
Those permit holders engaged in this type of fishing shall make their vessels available so that officials of INCOPESCA may obtain onboard information on their catches and the characteristics of the fishing gear used, when so designated by the Institution." Non-compliance with this regulation shall be sanctioned according to the provisions of the article of Law No. 8436.
2. Modify Agreement AJDIP/074-2007, Article 4, on sardine fishing by the Semi-Industrial Sardine Fleet with purse seine, so that it shall henceforth read as follows:
"During the period comprised of the months of May, June, and July of each year, sardine fishing with purse seine shall be permitted on Mondays, Tuesdays, and Wednesdays of each week in the internal zone comprised between an imaginary straight line running from Punta Torres, known as Peñón (84°43'52" West Longitude, 09°53'31" North Latitude) to the Lighthouse of Islas Negritos Afuera (84°49'35" West Longitude, 09°49'14" North Latitude) and from there, in an imaginary straight line running to the Cruise Ship Pier in the City of Puntarenas (84°49'51" West Longitude, 09°58'26" North Latitude).
Those permit holders engaged in this type of fishing shall make their vessels available so that officials of INCOPESCA may remain and obtain onboard information on their catches, according to the possibilities of the Institution.
Prior to the arrival of the sardine boat in port, the permit holder must notify the Protection and Registration Department for the purpose of inspecting all unloadings.
If the permit holder fails to comply with the provisions of this article, the agreed authorization shall be terminated..."
Considering:

Por tanto, se acuerda:
1. Adicionar al Acuerdo AJDIP/074-2007, artículo 3º de la pesca por parte de la Flota Artesanal en Pequeña Escala, un inciso F), que se leerá de la siguiente manera:
"F, De la Pesca de Atún y Macarelas (pequeñas pelágicas) con red agallera a la deriva.
Se establece como zona autorizada para el uso de este tipo de pesca el área comprendida entre la línea recta imaginaria que va desde el Muelle de Cruceros de Puntarenas (84°49551" Longitud Oeste, 9°58'26" Latitud Norte) hasta la parte más Oriental de la Isla de Cedros (84°51'59" Longitud Oeste, 9°51'00" Latitud Norte) y de esas dos líneas imaginarias aguas hacia afuera del Golfo de Nicoya. Dicha red deberá tener una luz de malla mínima de 3½ pulgadas, una longitud máxima de 500 metros y una altura máxima de 100 mallas y deberá estar provista de boyas, galones o cualquier otro dispositivo que permita a las autoridades competentes su identificación.
Aquellos permisionarios que se dediquen a este tipo de pesca facilitarán sus embarcaciones para que funcionarios del INCOPESCA, puedan obtener a bordo de éstas información de sus capturas y de las características del arte de pesca utilizada, cuando así lo designe la Institución".
El incumplimiento a esta normativa será sancionada, según lo estipulado en el articulo de la Ley N° 8436.
2. Modifíquese el Acuerdo AJDIP/074-2007, artículo 4º, de la pesca de sardina por parte de la Flota Semi-Industrial sardinera con red de cerco, para que en lo sucesivo se lea de la siguiente manera:
"Durante el periodo comprendido entre los meses de mayo, jumo y julio de cada año, se permitirá la pesca de la sardina con red de cerco, durante los días lunes, martes y miércoles de cada semana en la zona interna comprendida, entre una línea recta imaginaria que va desde Punta Torres, conocida como Peñón (84°43'52" Longitud Oeste, 09°53'31" Latitud Norte) hasta el Faro de las Islas Negritos Afuera (84°49'35" Longitud Oeste, 09°49'14" Latitud Norte) y de aquí, en línea recta imaginaria que va hasta el Muelle de Cruceros en la Ciudad de Puntarenas (84°49'51" Longitud Oeste, 09°58'26" Latitud Norte).
Aquellos permisionarios que se dediquen a este tipo de pesca facilitarán sus embarcaciones para que funcionarios del ESTCOPESCA, puedan permanecer y obtener a bordo de éstas, la información de sus capturas, de acuerdo a las posibilidades cíe la Institución.
Previo a la llegada del barco sardinero a puerto, el permisionario deberá de notificar al Departamento de Protección y Registro para efecto .de inspeccionar todas las descargas.
Si el permisionario no cumpliera lo estipulado en este artículo, se dará por terminada la autorización acordada..."
