in the entirety of the text - Complete Text of Regulation 32611 Declares "Ara Macao" National Wildlife Refuge Complete Text act: 9371E N° 32611 N° 32611 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In the exercise of the powers conferred upon us by article 140, subsections 3) and 18) of the Political Constitution and articles 7, 82, 84 and 87 of the Wildlife Conservation Law, N° 7317, of October 30, 1992, published in La Gaceta N° 235 of December 7, 1992, articles 32 and 38 of the Organic Law of the Environment N° 7554, of October 4, 1995, published in La Gaceta N° 215 of November 13, 1995, the Ley Forestal and its amendments, N° 7575, dated February 13, 1996, published in La Gaceta N° 72 of April 16, 1996 and articles 11, 27 and 28.2.b of the General Law of Public Administration, N° 6227, of May 2, 1978, and

1. 1That it is in the interest of the Costa Rican State to ensure that all of the country's ecosystems are represented within the system of protected wild areas, particularly within those management categories whose purpose is the protection, conservation and management of biodiversity.
2. 2That B & A Fiduciarios Sociedad Anónima, legal identification number N° 3-101-304702, registered in the Public Registry, Mercantile Registry volume 1340, is the owner of the farm that corresponds to cadastral plan N° P-927086-2004 and which has an area according to the plan of 64 hectares with 5 539.67 square meters, registered under Folio Real Nº 6020175-000, located in district one Jacó, canton Garabito, province of Puntarenas. That from this parent farm it separated a farm for tourism development with an area of 25 hectares 5,227.72 square meters, which corresponds to cadastral plan Nº P-982065-2005. The remainder of the farm, with an area of 38 hectares 8,965.15 square meters, is subjected to the Mixed Wildlife Refuge Regime.
3. 3That in the absence of demarcation, the boundaries were verified in the field, which correspond to the designated coordinates.
4. 4That adjacent to this farm is the strip of the Maritime-Terrestrial Zone, in accordance with the delimitation of the markers of the Instituto Geográfico Nacional between N° 452 and N° 499, which belongs to the State and which, being covered with forest, forms part of the Natural Heritage of the State.
5. 5That the rocky system of the indicated coastal zone is a natural littoral formation with geological, biological, ecological and scenic characteristics unique in Costa Rica, and must be subject to protection given its susceptibility and biological importance. In preliminary studies, several coral banks were identified with a diversity of species of algae, mollusks and echinoderms; as well as important banks of at least 35 species of fish.
6. 6That said area is mostly covered with primary and advanced secondary forest and scarce areas of pastureland (repastos).
7. 7That in preliminary inventories in the area, at least 159 plant species have been identified (98 species of trees, 21 species of shrubs, 21 species of vines (bejucos), 3 species of palms, 2 species of epiphytes and 14 species of herbs). Among the species found, Phyllocarpus riedelli stands out, a very rare species that had only been collected in the south of the country and that represents a new record for the Central Pacific. Other species in danger of extinction were also identified, such as Tachigali versicolor and ajillo (Caryocar costarricense); as well as a germplasm bank of species of forestry interest. Furthermore, 20 species of reptiles and amphibians were identified (7 species of frogs, 8 species of lizards and 5 species of snakes), 116 species of birds and 35 species of mammals.
8. 8That due to the current state of the natural resources of the region and the national opening towards the protection of wild areas and regional ecological diversity, it is necessary to preserve that zone in the region.
9. 9That the integrated rational management of the natural resources of the area (forests, flora, fauna); contributes to satisfying regional needs for research, recreation, environmental education, as well as the utilization of rationally exploited natural resources.

10.-That the administration of wildlife and the recommendation of measures that ensure the perpetuity of species is a function of the National System of Conservation Areas of the Ministry of Environment and Energy 11.-That the owner of the private land voluntarily agreed to join this protection regime for the flora and wild fauna for a period of ten years, renewable. Therefore, DECREET:

Considering:

1. 1Que es interés del Estado costarricense asegurar que todos los ecosistemas del país se encuentren representados dentro del sistema de áreas silvestres protegidas, particularmente dentro de aquellas categorías de manejo que tienen como fin la protección, conservación y manejo de la biodiversidad.
2. 2Que B & A Fiduciarios Sociedad Anónima, cédula jurídica N° 3- 101-304702, inscrita en el Registro Público, Registro Mercantil tomo 1340 es dueña de la finca que corresponde al plano catastrado N° P-927086- 2004 y que tiene una extensión según plano de 64 hectáreas con 5 539,67 metros cuadrados, inscrita al Folio Real Nº 6020175-000, sito en el distrito uno Jacó, cantón Garabito, provincia de Puntarenas. Que de esa finca madre separó una finca para desarrollo turístico con una extensión de 25 hectáreas 5 227,72 metros cuadrados, que corresponde al plano catastrado Nº P-982065-2005. El resto de la finca con una extensión de 38 hectáreas 8 965,15 metros cuadrados, lo somete al Régimen de Refugio Mixto de Vida Silvestre.
3. 3Que al no existir amojonamiento, se comprobaron en el campo los linderos, que corresponden a las coordenadas designadas.
4. 4Que adyacente a esta finca se encuentra la franja de la Zona Marítimo Terrestre, de conformidad con lo que delimitan los mojones del Instituto Geográfico Nacional comprendidos entre el N° 452 y el N° 499, que pertenece al Estado y que por estar cubierta de bosque forma parte del Patrimonio Natural del Estado.
5. 5Que el sistema rocoso de la zona costera indicada es una formación litoral natural con características geológicas, biológicas, ecológicas y paisajísticas únicas en Costa Rica, debe ser objeto de protección dada su susceptibilidad e importancia biológica. En los estudios preliminares se identificó varios bancos de corales con diversidad de especies de algas, moluscos y equinodermos; así como importantes bancos de al menos 35 especies de peces.
6. 6Que dicha área esta mayoritariamente cubierta de bosque primario y secundario avanzado y escasas zonas de repastos.
7. 7Que en los inventarios preliminares en el área se han identificado al menos 159 especies de plantas (98 especies de árboles, 21 especies de arbustos, 21 especies de bejucos, 3 especies de palmas, 2 especies de epífitas y 14 especies de hierbas). Entre las especies encontradas destaca Phyllocarpus riedelli, una especie muy rara que solo había sido colectada en el sur del país y que representa un nuevo registro para el Pacífico Central. Se identificaron además otras especies en vías de extinción como el Tachigali versicolor y el ajillo (Caryocar costarricense); así como un banco de germoplasma de especies de interés forestal. Además se identificaron 20 especies de reptiles y an.bios (7 especies de ranas, 8 especies de lagartijas y 5 especies de serpientes), 116 especies de aves y 35 especies de mamíferos.
8. 8Que debido al estado actual de los recursos naturales de la región y a la apertura nacional hacia la protección de las áreas silvestres y a la diversidad ecológica regional, es necesario preservar esa zona en la región.
9. 9Que el manejo racional integrado de los recursos naturales del área (bosques, flora, fauna); contribuyen a satisfacer las necesidades regionales para la investigación, recreación, educación ambiental, así como el aprovechamiento de los recursos naturales explotados racionalmente.

10.-Que la administración de la vida silvestre y la recomendación de medidas que aseguren la perpetuidad de las especies es función del Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía 11.-Que el propietario del terreno privado accedió voluntariamente a incorporarse a este régimen de protección de la flora y la fauna silvestre por un período de diez años prorrogables. Por tanto,
