32611-MINAE of June 28, 2005, the Ara Macao National Wildlife Refuge was declared, of mixed ownership, located in district one Jacó, canton Garabito, province of Puntarenas.

Therefore, THE SUPERIOR DIRECTOR OF THE NATIONAL SYSTEM OF CONSERVATION AREAS,

ZONING REGULATION Recommended Land Use: In the geographical space occupied by the Ara Macao Mixed Wildlife Refuge, forest areas are combined, both on private land and in the Maritime Terrestrial Zone. In the terrestrial areas, the land-use vocation is conservation, since 93.3% of the area is covered by forest (cobertura boscosa). Only the 6.6% of the total area where no forest cover exists is considered as an area suitable for management. In the marine sector, the public zone maintains the vocation that the law establishes for the free transit of people.

Objectives: The Management Plan of the Ara Macao Wildlife Refuge seeks the development of management programs that facilitate the conservation and increase of the presence of the biological diversity that characterizes the area. The activities permitted for its development shall be only those indicated in the identified management programs, namely: Resource Administration and Protection, Research, and Public Use; establishing for each one of them the regulatory conditions under which each one is considered sustainable.

The Management Plan materializes in a zoning the land uses, based on the technical analyses carried out. Said zoning locates the permitted activities in the areas or sectors where their development is optimal, considering sustainability in the Management of the Refuge. The zoning is accompanied by a set of rules of mandatory compliance for the administrators of the Refuge, which guarantee that the activities or projects to be developed do not threaten the established management objectives.

. Wilderness Zone (Zona Silvestre, ZS) (Area 71.03 ha Percentage: 91.2) . Moderate Use Zone (Zona de uso Moderado, ZUM) (Area 1.68 ha Percentage 2.1) . Management Zone (Zona para Manejo, ZPM) (Area 5.16 ha Percentage 6.6)

Wilderness Zone (ZS) Purpose: In this zone, the aim is to maintain the area of the Refuge that has forest cover as a zone where natural processes follow their course with the least possible intervention by humans in terms of infrastructure.

Location. This zone corresponds to the sector identified by the acronym (ZS), which is located in the Zoning Map.

Permitted Uses. Scientific research and trails that allow safe enjoyment and learning by visitors; visitation shall be in low numbers and with a guide to sites of natural attraction. Additionally, the extraction of groundwater for human consumption will be permitted.

Moderate Use Zone (ZUM).

Purpose. The use of two forest sectors that have slopes of less than 40% is intended for the development of modules with basic infrastructure that facilitates tourists' appreciation of the natural dynamics of the forest both during the day and at night.

Location. This zone corresponds to the sector identified by the acronym ZUM, which is located in the Zoning Map.

Permitted Uses. Trails, viewpoints, shelters, rustic bridges, camping modules, and sanitary services with their respective wastewater treatment systems.

Land use dosage. The land use dosage shall be a maximum of one camping module per every 3000 m2.

Construction limitations:

a. Construction in this zone must be dispersed so that the camping units are scattered throughout the entire zone. The foregoing is established with the objective of maintaining the environment, promoting a distribution of the constructions that minimizes the visual and environmental impact. The works must be developed adapting to the morphology of the terrain and, if roofed, their height shall not exceed five meters.

b. Earthworks (movimientos de tierra) that alter the topography are not permitted; only excavations for burying structures such as: foundations, pipes, and tanks will be allowed. The works must adapt to the topography by means of piles, avoiding at all times the modification of the shape of the terrain.

c. The earth residues obtained from the excavations authorized herein must be spread over the terrain of the same property from which they were excavated, in a single uniform layer no greater than 30 centimeters. Under no circumstances will it be permitted to conserve them in a single volume or in layers greater than the 30 centimeters mentioned above.

d. The modules that are developed must be inserted within the canopy; the cutting of trees is not permitted.

Management Zone (ZPM) Purpose. This zone is the least sensitive within the Refuge, as it is devoid of forest, and therefore it will be used for enrichment with species that produce fruits, thereby facilitating food for the birdlife, without intending to develop a natural or induced succession towards forest. The recommended species are:

Location. It corresponds to the zone identified by the acronym ZPM of the Zoning Map.

Permitted Uses. Trails, rustic bridges, roadways, viewpoints, shelters, and enrichment with shrub and tree species that produce edible fruits for birds.

Construction limitations See article 5 on trails and roadways.

Environmental Viability (Viabilidad Ambiental): All works that are developed must have, prior to commencement, in addition to the authorization of the Refuge Administration, the Environmental Viability from SETENA, without prejudice to any other procedure that the activity demands. Construction of Trails and roadways:

• a)Trails: It is understood that the construction of trails, given the topographical conditions of the Refuge, seeks to facilitate safe enjoyment for visitors; therefore, when these are elevated above ground level, their width shall not be greater than 2 meters and their construction shall be lightweight (certified wood or recycled plastic).
• b)Roadways: The roadways that are constructed, in the zones where permitted, will seek interconnection between zones already existing within the Refuge or with its adjacent properties, in any of the cases, they shall have a maximum road width of 5 meters.

The three management programs shall be financed by the proponent, in such a way that the State will not incur, with the creation and maintenance of the Ara Macao Refuge, additional expenditures to those already contracted for the current protected wild areas.

For the management of the Refuge, in compliance with the provisions of Art. 80 of the Regulation of the Wildlife Law No. 7317, a commission shall be established made up of the property owners and MINAE.

Said commission shall oversee the performance of the management programs, make the corresponding adjustments in compliance with the management objectives identified for each of the zones, and perform the biannual review of the Management Plan.

It is worth clarifying that the foregoing does not imply that the responsibility of MINAE for authorizing use permits on state lands is delegated.

Administration and Protection Program:

Objective: Operationally consolidate the Refuge, as well as facilitate the protection of its resources. Notable among these are the coordination efforts with MINAE and the consolidation of the same in aspects of infrastructure and personnel for its operation.

Administration Actions:

• a)Construction of a Surveillance Post at the entrance of the Refuge in the private sector.
• b)Construction of a Surveillance Post at the entrance of the state sector.
• c)Construction of a viewpoint in the ZPM for the enjoyment of the scenic beauty of the Refuge by visitors.
• d)Demarcation by means of lanes of the boundaries of the Refuge with adjacent private lands.
• e)Placement of signs containing at least the management category, its name, and the limitations on hunting and extraction of organisms.
• f)Demarcation by means of lanes of the boundaries between the private land of the Refuge and the restricted zone of the maritime terrestrial zone (between coordinates 463.142E-184.500N and 463.159E- 183.772N).
• g)Demarcation by means of lanes of the boundary between the public zone or boundary marker line and the restricted zone of the maritime terrestrial zone. (between coordinates 463.058E-181311N and 463016E- 183878N).
• h)Maintenance of the lanes to be constructed in activities f), h) and i) every 3 months or with the operational frequency that allows them to be easily identifiable at all times.
• i)Construction of at least one interpreted trail that is safe for visitors in the Wilderness Zone on private land.
• j)Construction of a safe interpreted trail for visitors in the state sector.
• k)Have at least one trained guide to accompany visitors on the trail.
• l)Determination of the budget required for the management of the Refuge during the first five years of operation.
• m)Preparation of operational reports for MINAE, one every four months.
• n)Conduct the review of the Management Plan on a biannual basis.

Protection Actions:

• a)Have at least two guards available 24 hours a day for the protection duties of the Refuge.
• b)Conduct patrols on a weekly basis along the lanes of the external boundaries to verify their condition.
• c)Conduct surveillance in the tide pool sector to prevent the extraction of organisms.
• d)File complaints with MINAE in the event that illegal activities are identified within the limits of the Refuge.
• e)Submit reports to the Refuge Administration, one every four months.

Research Program:

Objective: Expand the knowledge that currently exists about the Refuge, allowing for the improvement or adjustment of the management actions developed within it. Likewise, facilitate knowledge for its visitors.

Research Actions:

• a)Provide training to the operational personnel of the Refuge so that they develop the capacity to identify the typical animals of the same, so that they can keep a record of sightings thereof.
• b)Keep a logbook of birdlife and mammal sightings based on the training from the preceding point, with the purpose of guiding researchers on the visiting seasons of the different organisms and their frequency.
• c)Develop enrichment with shrub and tree species in the ZPM zone, providing maintenance to them to guarantee their viability.
• d)Develop a quarterly follow-up on the behavior of the birdlife in the ZPM zone to evaluate the benefits of the enrichment developed in the preceding point.
• e)Develop a follow-up on the phenology of (Phyllocarpus riedelii Caesalpionoidea) given that it is a species found in the Refuge and is very rare and little known.
• f)Publish the results of the Phenological study mentioned in the preceding point as a contribution to Costa Rican floristic knowledge.
• g)Develop a monitoring program on a biannual frequency, regarding the behavior of the tide pools located in the public zone.
• h)Submit reports to the Refuge administration, one every four months.
• i)Establish a link with MINAE to implement a project of artificial nests for Lapas in the ZPM Zone.

Public Use Program:

Objective: Develop an operational installed capacity that facilitates a successful experience for visitors without detriment to the natural dynamics that develop within it. Actions for Public Use:

• a)Develop a collection of fruits and flowers of the most representative trees of the ZS with the objective that visitors can have a closer approach to the floristic diversity of the Refuge and learn about its importance.
• b)Develop a guide to the most common birdlife, mammals, amphibians, reptiles, and marine organisms of the Refuge so that visitors can identify with its importance and it facilitates their behavior during the visit.
• c)Have at least two guides trained in environmental interpretation, so that they are the ones who conduct the prior induction for the Refuge visitors, warning them about its importance and the behavior they must maintain within it for their safety and that of the organisms that live in it.
• d)Document visitor satisfaction through exit surveys, to provide feedback on the program's performance.
• e)Submit reports to the Refuge Administration, one every four months.
• f)Define the carrying capacity for the sector of the Public Zone of the Refuge.

Por tanto, EL DIRECTOR SUPERIOR DEL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN,

REGLAMENTO DE ZONIFICACIÓN Uso Recomendable del Suelo: En el espacio geográfico que ocupa el Refugio de Vida Silvestre Mixto Ara Macao, se combinan áreas de bosque, tanto en terreno privado como en la Zona Marítimo Terrestre. En las áreas terrestres, la vocación de uso es conservación, pues un 93.3% del área está cubierta por bosque. Únicamente se considera el 6.6% del área total donde no existe cobertura boscosa, como un área apta para el manejo. En el sector marino, la zona pública mantiene la vocación que la ley establece para el libre tránsito de las personas.

Objetivos: El Plan de Manejo del Refugio de Vida Silvestre Ara Macao, procura el desarrollo de los programas de manejo que faciliten la conservación y el aumento de la presencia de la diversidad biológica que caracterizan el área. Las actividades permitidas para su desarrollo serán únicamente las indicadas en los programas de manejo identificados, a saber: Administración y Protección del Recurso, Investigación y Uso Público; estableciendo para cada uno de ellos las condiciones reglamentarias bajo las cuales cada uno se considera sostenible.

El Plan de Manejo plasma en una zonificación los usos del suelo, con base en los análisis técnicos efectuados. Dicha zonificación ubica las actividades permitidas en las áreas o sectores donde su desarrollo es óptimo considerando la sostenibilidad en el Manejo del Refugio. La zonificación se acompaña de un conjunto de normas de acatamiento obligatorio para los administradores del Refugio, las cuales garantizan que las actividades o proyectos por desarrollar no atenten contra los objetivos de manejo planteados.

. Zona Silvestre (ZS) (Área 71.03 ha Porcentaje: 91.2) . Zona de uso Moderado (ZUM) (Área 1.68 Porcentaje 2.1) . Zona para Manejo (ZPM) (Área 5.16 ha Porcentaje 6.6)

Zona silvestre (ZS) Propósito: En esta zona se procura mantener el área del Refugio que cuenta con cobertura boscosa como una zona en donde los procesos naturales siguen su curso con la menor intervención posible por parte del hombre en materia de infraestructura.

Localización. Esta zona corresponde al sector identificado por las siglas (ZS), que se ubica en el Mapa de Zonificación.

Usos permitidos. Investigación científica y Senderos que permitan un disfrute y aprendizaje seguro por parte de los visitantes, la visitación será en bajo número y con guía a los sitios de atractivo natural. Se permitirá adicionalmente la extracción de agua del subsuelo para consumo humano.

Zona de uso moderado (ZUM).

Propósito. Se pretende la utilización de dos sectores de bosque que presentan pendientes menores al 40% para el desarrollo de módulos con infraestructura básica que facilite a los turistas la apreciación de la dinámica natural del bosque tanto durante el día como durante la noche.

Localización. Esta zona corresponde al sector identificado por las siglas ZUM, que se ubican en el Mapa de Zonificación.

Usos permitidos. Senderos, Miradores, Escampaderos, Puentes Rústicos, Módulos para Acampar y Servicios Sanitarios con sus respectivos sistemas de tratamiento de aguas residuales.

Dosificación de uso del suelo. La dosificación de uso del suelo será de un módulo de acampar por cada 3000 m2 como máximo.

Limitaciones constructivas:

a. La construcción en esta zona debe ser dispersa de manera que las unidades de acampar se encuentren disgregadas por toda la zona. Se establece lo anterior, con el objetivo de mantener el entorno, propiciando una distribución de las construcciones que minimicen el impacto visual y ambiental. Las obras deben desarrollarse adaptándose a la morfología del terreno y en caso de ser techadas su altura no sobrepasará cinco metros.

b. No se permite el movimiento de tierra que altere la topografía, sólo se permitirá hacer excavaciones para enterrar estructuras como: cimientos, tuberías, y tanques. Las obras deberán adaptarse a la topografía por medio de pilotes, evitándose en todo momento la modificación de la forma del terreno.

c. Los residuos de tierra obtenidos de las excavaciones aquí autorizadas, deberán extenderse sobre el terreno de la misma propiedad de donde fueron excavados, en una única capa uniforme no mayor a 30 centímetros. Bajo ninguna circunstancia se permitirá el conservarlos en un único volumen o en capas superiores a los 30 centímetros arriba mencionados.

d. Los módulos que se desarrollen deben estar insertos dentro del dosel, no se permite la corta de árboles.

Zona para manejo (ZPM) Propósito. Esta zona es la menos sensible dentro del Refugio, por encontrarse desprovista de bosque, por lo que se usará para el enriquecimiento con especies que produzcan frutos, facilitando con ello alimentación para la avifauna, sin pretender desarrollar una sucesión natural ni inducida hacia bosque. Las especies recomendadas son:

Localización. Corresponde a la zona identificada por las siglas ZPM del Mapa de Zonificación.

Usos permitidos. Senderos, puentes rústicos, vialidad, miradores, escampaderos y enriquecimiento con especies arbustivas y arbóreas que produzcan frutos comestibles para las aves.

Limitaciones constructivas Ver artículo 5 sobre senderos y vialidad.

Viabilidad Ambiental: Todas las obras que se desarrollen, deberán contar previo al inicio, además de la autorización de la Administración del Refugio con la Viabilidad Ambiental de la SETENA, sin menoscabo de cualesquiera otro procedimiento que la actividad demande. Construcción de Senderos y vialidad:

• a)Senderos: Se entiende que la construcción de senderos dadas las condiciones de topografía del Refugio, buscan facilitar un disfrute seguro a los visitantes, por lo anterior, cuando estos sean elevados sobre el nivel del terreno su ancho no será mayor a 2 mts y su construcción será liviana, (madera certifícada o plástico reciclado).
• b)Vialidad: La vialidad que se construya, en las zonas en que sea permitido buscará la interconexión entre zonas ya existentes dentro del Refugio o con sus colindancias, en cualesquiera de los casos tendrán un máximo de 5 mts de calzada.

Los tres programas de manejo serán financiados por el proponente, de manera tal que el Estado no incurrirá con la creación y mantenimiento del Refugio Ara Macao en erogaciones adicionales a las ya contraídas con las áreas silvestres protegidas actuales.

Para el manejo del Refugio en acatamiento a lo establecido en Art. 80 del Reglamento de la Ley de Vida Silvestre No 7317, se establecerá una comisión conformada por los dueños de la propiedad y el MINAE.

Dicha comisión verá el desempeño de los programas de manejo, realizará los ajustes correspondientes en acatamiento de los objetivos de manejo identificados para cada una de las zonas y realizará la revisión bianual del Plan de Manejo.

Valga aclarar que lo anterior no implica que se delegue la responsabilidad del MINAE para la autorización de los permisos de uso en los terrenos estatales.

Programa de Administración y Protección:

Objetivo: Consolidar operativamente el Refugio, así como facilitar la protección de sus recursos. Destaca dentro de éstas las labores coordinación con el MINAE y la consolidación del mismo en aspectos de infraestructura y personal para su operación.

Acciones de Administración:

• a)Construcción de una Caseta de Vigilancia a la entrada del Refugio en el sector privado.
• b)Construcción de una Caseta de Vigilancia a la entrada del sector estatal.
• c)Construcción de un mirador en la ZPM para disfrute de la belleza escénica del Refugio por los visitantes.
• d)Demarcación por medio de carriles de las colindancias del Refugio con los terrenos privados aledaños.
• e)Colocación de rótulos conteniendo al menos la categoría de manejo, su nombre y las limitaciones de caza y extracción de organismos.
• f)Demarcación por medio de carriles de las colindancias entre el terreno privado del Refugio y la zona restringida de la zona marítimo terrestre (entre las coordenadas 463.142E-184.500N y 463.159E- 183.772N).
• g)Demarcación por medio de carriles de la colindancia entre la zona pública o línea de mojones y la zona restringida de la zona marítimo terrestre. (entre las coordenadas 463.058E-181311N y 463016E- 183878N).
• h)Mantenimiento de los carriles a construir en las actividades f), h) e y i) cada 3 meses o con la frecuencia operativa que permita que en todo momento sean fácilmente identificables.
• i)Construcción de al menos un sendero interpretado que sea seguro para los visitantes en la Zona Silvestre en terreno privado.
• j)Construcción de un sendero interpretado con seguridad para los visitantes en el sector estatal.
• k)Contar con al menos un guía capacitado para acompañar a los visitantes del sendero.
• l)Determinación del presupuesto requerido para el manejo del Refugio durante los primeros cinco años de operación.
• m)Elaboración de informes operacionales al MINAE, uno cada cuatrimestre.
• n)Realizar la revisión del Plan de Manejo en forma bianual.

Acciones de Protección:

• a)Contar con al menos dos vigilantes durante las 24 horas para las labores de protección del Refugio.
• b)Realizar patrullajes con una periodicidad semanal por los carriles de las colindancias externas para verificar el estado de las mismas.
• c)Realizar una vigilancia en el sector de las posas entre mareas para evitar la extracción de organismos.
• d)Realizar las denuncias ante el MINAE en caso de identificarse actividades ilícitas dentro de los límites del Refugio.
• e)Rendir informes a la Administración del Refugio, uno cada cuatrimestre.

Programa de Investigación:

Objetivo: Ampliar el conocimiento que actualmente existe sobre el Refugio, permitiendo mejorar o ajustar las acciones de manejo que en él se desarrollen. Así mismo facilitar el conocimiento para los visitantes del mismo.

Acciones de Investigación:

• a)Realizar la capacitación con el personal operativo del Refugio para que desarrollen la capacidad de identificar los animales típicos del mismo, de manera que puedan llevar un registro de avistamiento de los mismos.
• b)Llevar una bitácora de avistamientos de la avifauna y mamíferos con base en la capacitación del punto anterior, con el propósito de orientar a los investigadores en las épocas de visita de los diferentes organismos y la frecuencia de los mismos.
• c)Desarrollar un enriquecimiento con especies arbustivas y arbóreas en la zona ZPM, dando mantenimiento a los mismos para garantizar su viabilidad.
• d)Desarrollar un seguimiento trimestral del comportamiento de la avifauna en la zona ZPM para evaluar los beneficios del enriquecimiento desarrollado en el punto anterior.
• e)Desarrollar un seguimiento sobre la fenología del (Phyllocarpus riedelii Caesalpionoidea) dado que es una especie que se encuentra en el Refugio y es muy escasa y poco conocida.
• f)Publicar los resultados del estudio Fenológico mencionado en el punto anterior como una contribución al conocimiento florístico costarricense.
• g)Desarrollar un programa de monitoreo con una frecuencia bianual, sobre el comportamiento de las pozas de marea ubicadas en la zona pública.
• h)Rendir informes a la administración del Refugio, uno cada cuatrimestre.
• i)Establecer el enlace con el MINAE para implementar un proyecto de nidos artificiales para Lapas en la Zona ZPM.

Programa de Uso Público:

Objetivo: Desarrollar una capacidad instalada operativa que facilite a los visitantes una Uso Público:

• a)Desarrollar una colección de frutos y flores de los árboles más representativos de la ZS con el objetivo de que los visitantes puedan tener más acercamiento con la diversidad florística del Refugio y conocer su importancia.
• b)Desarrollar una guía de la avifauna, mamíferos, anfibios, reptiles y organismos marinos, más comunes del Refugio de manera que los visitantes se puedan identificar con la importancia del mismo y facilite su comportamiento durante la visita.
• c)Contar con al menos dos guías capacitados en interpretación ambiental, de manera que sean los que realicen la inducción previa a los visitantes del Refugio, advirtiéndoles sobre su importancia y el comportamiento que deben mantener dentro del mismo para seguridad de ellos y de los organismos conviven en él.
• d)Documentar la satisfacción de los visitantes mediante encuestas de salida, para retroalimentarse el desempeño del programa.
• e)Rendir informes a la Administración del Refugio, uno cada cuatrimestre.
• f)Definir la capacidad de carga para el sector de la Zona Pública del Refugio.
