Of the members of the volunteer program for state-owned protected wild areas

• a)Costa Rican citizens.
• b)Foreigners who meet all the requirements that Costa Rican laws demand to legally enter the country.

They shall provide their services on an honorary basis (ad-honorem), motivated solely by the interest of contributing to the protection and management of resources existing in wild areas.

Once appointed, the organization responsible for recruiting volunteers must coordinate with the Directorate of SINAC the preparation of the respective identifications, thus acquiring the respective rights and obligations inherent to their condition. The validity of the identification card shall be one year for nationals and residents in the country; in the case of foreign citizens, it shall be according to the permit to remain in the country granted by the Immigration Authorities. However, it may not exceed three months.

The Directorate of the respective Conservation Area reserves the right to revoke the card if any of the grounds contemplated in this Regulation are proven.

• a)Be Costa Rican or have the condition of resident or tourist, in which case the permit of stay issued by the Directorate of Immigration and Foreign Affairs must be provided.
• b)Be of legal age.
• c)Complete the application form that the Directorate of each Conservation Area will provide for this purpose.
• d)Satisfactorily conclude the instruction and practical aspects that the National System of Conservation Areas determines.
• e)Demonstrate knowledge of the provisions of this Regulation.
• f)Join the existing volunteer program in each Conservation Area.
• g)Cover from their own funds the costs of transportation, food or any other expense during the time they remain in the program.
• h)Have an occupational risk insurance policy that covers at least the time they will be providing services within the program.

• a)Have a permit to remain in Costa Rica for a period longer than the validity of the card.
• b)Have fulfilled all the migratory requirements that Costa Rican legislation establishes.
• c)Have the endorsement of some foreign institution: University, NGO, or State, of recognized moral, ethical, social and economic standing.
• d)Cover from their own funds the costs of transportation, food or any other expense during the time they remain in the program.
• e)Be of legal age in accordance with Costa Rican legislation.
• f)Complete the application form that the Directorate of each conservation area will provide for this purpose.
• g)Satisfactorily conclude the instruction and practical aspects that the National System of Conservation Areas determines.
• h)Demonstrate knowledge of the provisions of this Regulation.
• i)Join the existing volunteer program in each Conservation Area.
• j)Provide the Immigration permit indicated in the previous article.
• k)Have an occupational risk insurance policy that covers at least the time they will be providing services within the program.

• a)Comply with the legal provisions in force, as well as with the guidelines that for this purpose are issued by the National System of Conservation Areas.
• b)Collaborate with competent public officials in the tasks of supervision, cleaning, ornamentation, maintenance, care and surveillance of the resources existing within the state-owned protected wild areas.
• c)Obey the orders given by the Administrator of the corresponding protected wild area, provided they conform to the legal system and this Regulation.
• d)Prepare a weekly report of the work carried out, which must be delivered at the end of the week to the head of the respective Wild Area or to whoever acts in their place, so that the latter may forward it to the Director of the Conservation Area.
• e)Notify the respective head of the protected Wild Area of any irregularity committed by officials or private individuals within these areas.
• f)Maintain, in the exercise of the work as a member of the program, a permanent attitude of seriousness, prudence and attentiveness, as well as courtesy and kindness with their program colleagues, public officials and the general public.
• g)If required, must provide faithful testimony of everything they may have seen, heard and done during the time they were in the program.
• h)Faithfully comply with the provisions of this Regulation.
• i)Have life habits and personal conduct consistent with those that the State demands of public officials, as well as have principles consistent with the conservation and protection of natural resources and the environment.
• j)Cooperate with the civil society institutions and organizations adjacent to the protected Wild Area, in carrying out awareness-raising and environmental education activities that allow increasing the support of citizens for the work carried out by the program.
• k)Carry the proper identification when providing service.
• l)Request, fifteen days before its expiration, the renewal of the card that accredits them as a member of the program.

• a)Receive training and advice on the functions in which they will assist public officials, as well as on the protection of the natural resources existing within the Protected Wild Area.
• b)Request reports on how to better perform their function from the respective head of the Protected Wild Area.
• c)Request support and collaboration from the public officials of the Protected Wild Area in order to effectively perform their function.
• d)Receive the proper identification before entering the Areas.

• a)Acting against Costa Rican legislation or the guidelines issued by the National System of Conservation Areas, or against this regulation.
• b)Assuming functions specific to public officials.
• c)Assuming police authority functions.

Of the organizations

Therefore, no organization or institution may carry out its actions or use the logos, names or other identifications of MINAE or SINAC if it does not have an agreement signed with MINAE and countersigned by the General Comptroller of the Republic (Contraloría General de la República).

• a)Submit to SINAC, before its members are accepted into the program, the respective copy of the recruitment application including a photo, as well as the evaluation of the personality traits of the candidates, both national and foreign.
• b)Elaborate the respective identifications of each member with the official logos, so that the same may be signed by the Directorate of SINAC or the person designated by it.
• c)Must present an annual work plan to the Directorate of SINAC on the first business day of the month of December each year. Likewise, they must present three quadrimestrial progress and work reports in the months of April, August and December.
• d)Each Organization or Institution must have a basic insurance policy from the National Insurance Institute (Instituto Nacional de Seguros), which would cover any accident that its members might suffer.
• e)Must cover the costs of food, transportation, if required, as well as any other situation that may arise.
• f)Maintain an updated record of the roster of all volunteers both nationally and internationally, which will be presented to the coordinator monthly.
• g)Notify the Directorate of SINAC of the cancellation or suspension of any person on the roster of registered volunteers.
• h)Cancel the membership before the organization when SINAC so requests for disciplinary reasons or of another nature.
• i)Train the volunteers of each organization on the objectives and tasks in which they will assist in the Protected Wild Areas (ASP), as well as regarding their rights.
• j)Comply with the legal provisions governing Protected Wild Areas in legal and administrative matters, as well as any other guideline issued in this matter by the respective Authorities.

Of the Ministry's property

In the event of replacement, there must be a prior appraisal issued by the Patrimony office of the Ministry.

Of the structure of the Volunteer Program for Protected Wild Areas

• a)The Directorate of the National System of Conservation Areas shall be responsible for issuing the guidelines to be applied in the program, in addition to observing, implementing and applying this regulation, for which it may appoint a national coordinator.
• b)In each Conservation Area there shall be a volunteer program that shall be responsible for implementing and applying the guidelines issued by SINAC, in each of the State Protected Wild Areas where there are members of the program. It shall be in charge of the Director of the Area or whoever they designate.
• c)In each State Protected Wild Area where there is one or more members of this program, the person responsible for the application and observance of this regulation and the guidelines issued by SINAC through the Conservation Area directorate shall be the Administrator of the respective Wild Area.

Of offenses and sanctions

• a)Repeated non-compliance with the duties and responsibilities assumed as a member of the program.
• b)Exceeding the attributions or powers contemplated in this Regulation.
• c)Violating legal provisions of any nature during the time they remain as a member of the program.
• d)Receiving gifts, rewards, favors or payments of any kind, during the time they remain within the program, which intend that they not assume their duties and obligations as a member of the program.
• e)Acting under the influence of liquor or other illegal drugs while carrying out their functions within the program.
• f)Verbally or physically assaulting any person.
• g)Illegally retaining or not reporting to the leadership of the corresponding Wild Area, articles or objects belonging to visitors, officials or third parties that may have been lost or forgotten.

De los y las integrantes del programa de voluntariado para las áreas silvestres protegidas propiedad estatal

• a)Ciudadanos y ciudadanas costarricenses.
• b)Extranjeros y extranjeras que cumplan con todos los requisitos que las leyes costarricenses exigen para poder ingresar legalmente al país.

Prestarán sus servicios ad-honoren, motivados (as) por el único interés de coadyuvar en la protección y manejo de los recursos existentes en las áreas silvestres.

Una vez nombrados la organización que se encargue del reclutamiento de los voluntarios (as) deberá coordinar con la Dirección del SINAC la elaboración de las identificaciones respectivas, adquiriendo así los respectivos derechos y obligaciones inherentes a su condición. La vigencia del carnet de identificación será de un año para los nacionales y residentes en el país; en caso de ciudadanos (as) extranjeros (as) será de acuerdo con el permiso de permanencia en el país otorgado por las Autoridades de Migración. No obstante, el mismo no podrá exceder de tres meses.

La Dirección del Área de Conservación respectiva se reserva el derecho de revocatoria del carnet de comprobarse alguna de las causales contempladas en este Reglamento.

• a)Ser costarricense o tener la condición de residente. o turista, en cuyo caso se deberá aportarse el permiso de permanencia emitido por la Dirección de Migración y Extranjería.
• b)Ser mayor de edad.
• c)Llenar el formulario de solicitud que al efecto facilitará la Dirección de cada Área de Conservación.
• d)Concluir satisfactoriamente los aspectos de instrucción y prácticas que el Sistema Nacional de Áreas de Conservación determine.
• e)Demostrar conocimiento de las disposiciones de este Reglamento.
• f)Incorporarse al programa de voluntariado existente en cada Área de Conservación.
• g)Costear de su propio patrimonio los gastos de traslado, alimentación o cualquier otro gasto durante el tiempo que permanezca en el programa.
• h)Contar con una póliza de riesgos del trabajo, que cubra como mínimo el tiempo que estará prestando los servicios dentro del programa.

• a)Tener permiso de permanencia en Costa Rica por un plazo mayor al de la vigencia del carné.
• b)Haber cumplido con todos los requisitos migratorios que la legislación costarricense establece.
• c)Contar con el respaldo de alguna institución extranjera: Universidad, ONG, o Estado, de reconocida solvencia moral, ética, social y económica.
• d)Costear de su propio patrimonio los gastos de traslado, alimentación o cualquier otro gasto durante el tiempo que permanezca en el programa.
• e)Ser mayor de edad de conformidad con la legislación costarricense.
• f)Llenar el formulario de solicitud que al efecto facilitará la Dirección de cada área de conservación.
• g)Concluir satisfactoriamente los aspectos de instrucción y prácticas que el Sistema Nacional de Áreas de Conservación determine.
• h)Demostrar conocimiento de las disposiciones de este Reglamento.
• i)Incorporarse al programa de voluntariado existente en cada Área de Conservación.
• j)Aportarse el permiso de Migración indicado en el artículo anterior.
• k)Contar con una póliza de riesgos del trabajo, que cubra como mínimo el tiempo que estará prestando los servicios dentro del programa.

• a)Cumplir con las disposiciones legales vigentes, así como con las directrices que al efecto dicte el Sistema Nacional de Áreas de Conservación.
• b)Colaborar con los funcionarios públicos competentes, en las labores de supervisión, aseo, ornato, mantenimiento, cuidado y vigilancia de los recursos existentes dentro de las áreas silvestres protegidas estatales.
• c)Acatar las ordenes que le gire el Administrador del Área silvestre protegida correspondiente, siempre y cuando se ajusten al ordenamiento jurídico y a este Reglamento.
• d)Efectuar un informe semanal de las labores efectuadas, el cual deberá ser entregado al final de la semana al jefe de la respectiva Área Silvestre o a quién este en su lugar, para que sea este quién lo haga llegar al Director del Área de Conservación.
• e)Notificar al respectivo jefe del Área Silvestre protegida de cualquier irregularidad cometida por funcionarios o particulares dentro de estas áreas.
• f)Mantener en el ejercicio de la labor de miembro del programa, una actitud permanente de seriedad, prudencia y atención, así como de cortesía y amabilidad con sus compañeros de programa, los funcionarios públicos y el público en general.
• g)En caso de requerirse, deberá brindar testimonio fiel de todo cuanto hubiere visto, oído y actuado durante el tiempo que estuvo dentro del programa.
• h)Cumplir fielmente las disposiciones de este Reglamento.
• i)Tener hábitos de vida y una conducta personal acordes con los que el Estado exige a los funcionarios públicos, así como tener principios acordes con la conservación y protección de los recursos naturales y del ambiente.
• j)Cooperar con las instituciones y organizaciones de la sociedad civil aledañas al Área Silvestre protegida, en la realización de actividades de concientización y de educación ambiental que permitan aumentar el apoyo de los y las ciudadanas al trabajo que realiza el programa.
• k)Portar la debida identificación cuando se encuentre prestando servicio.
• l)Solicitar quince días antes a su vencimiento la renovación del carné que lo acredita como miembro del programa.

• a)Recibir capacitación y asesoría sobre las funciones en que coadyuvarán con los funcionarios públicos, así como en protección de los recursos naturales existentes dentro del Área Silvestre Protegida.
• b)Pedir informes de como realizar mejor su función al respectivo jefe del Área Silvestre Protegida.
• c)Solicitar apoyo y colaboración a los funcionarios públicos del Área Silvestre Protegida para poder desempeñar eficazmente su función.
• d)Recibir la debida identificación antes de ingresar a las Áreas.

• a)Actuar en contra de la legislación costarricense o las directrices que dicte el Sistema Nacional de Áreas de Conservación, o del presente reglamento.
• b)Asumir funciones propias de los funcionarios públicos.
• c)Asumir funciones de autoridad de policía.

De las organizaciones

Por lo tanto, ninguna organización o institución podrá desarrollar sus acciones o utilizar los logos, nombres u otras identificaciones del MINAE o SINAC si no cuenta con convenido firmado con el MINAE y refrendado por la Contraloría General de la República.

• a)Presentar al SINAC de previo a que sus miembros sean aceptados en el programa, la respectiva copia de la solicitud de reclutamiento incluyendo foto, así como la evaluación de los rasgos de la personalidad de los concursantes tanto nacionales como extranjeros.
• b)b-Elaborar las identificaciones respectivas de cada miembro con los logotipos oficiales, a efecto de que las mismas sean firmadas por la Dirección del SINAC o la persona designada por ésta.
• c)Deberán presentar un plan anual de trabajo a la Dirección del SINAC el primer día hábil del mes de Diciembre de cada año. Asimismo tendrán que presentar tres informes cuatrimestrales de avances y de labores en los meses de Abril, Agosto y Diciembre.
• d)Cada Organización o Institución deberá contar con una póliza básica del Instituto Nacional de Seguros, que cubriría cualquier accidente que pudieran sufrir sus miembros.
• e)Deberán cubrir los gastos de alimentación, transporte, en caso de que se requieran así como cualquier otra situación que se presente.
• f)Mantener un registro actualizado de la nomina de todos los voluntarios (as) a nivel nacional como internacional, el cual será presentado al coordinador mensualmente.
• g)Comunicar a la Dirección del SINAC la cancelación o suspensión de cualquier persona que integre la nomina de voluntarios inscritos.
• h)Cancelar la membresía ante la organización cuando el SINAC lo solicite según los motivos disciplinarios o de otra índole.
• i)Capacitar a los voluntarios de cada organización sobre los objetivos y labores en que coadyuvarán en las ASP, así como en lo relativo a sus derechos.
• j)Acatar las disposiciones legales que rigen en materia legal y administrativa las Áreas Silvestres Protegidas, así como cualquier otra directriz que dicten en esta materia las Autoridades respectivas.

De los bienes del Ministerio

En caso de reposición se contará de previo con un avalúo emitido por la oficina de Patrimonio del Ministerio.

De la estructura del Programa de Voluntariado para las Áreas Silvestres Protegidas

• a)La Dirección del Sistema Nacional de Áreas de Conservación, será quién dicte las directrices a aplicar en el programa, además de observar, implementar y aplicar este reglamento, para lo que podrá nombrar un coordinador nacional.
• b)En cada Área de Conservación habrá un programa de voluntariado que se encargará de implementar y aplicar las directrices emanadas del SINAC, en cada una de las Áreas Silvestres Protegidas Estatales en donde existan miembros del programa. Estará a cargo del Director del Área o quién este designe.
• c)En cada Área Silvestre Protegida Estatal donde exista uno o más miembro de este programa, el responsable de la aplicación y observancia de este reglamento y las directrices dictadas por el SINAC a través de la dirección de Área de Conservación será el Administrador del Área Silvestre respectiva.

De las faltas y sanciones

• a)Incumplimiento reiterado a los deberes y responsabilidades asumidas como miembro del programa.
• b)Excederse en las atribuciones o potestades contempladas en este Reglamento.
• c)Violar las disposiciones legales de cualquier naturaleza dentro del tiempo que permanezca como miembro del programa.
• d)Recibir dádivas, recompensas, favores o pagos de cualquier tipo, durante el tiempo que permanezca dentro del programa, y que pretendan que no asuma sus deberes y obligaciones como miembro del programa.
• e)Actuar bajo los efectos del licor u otras drogas ilegales durante la realización de sus funciones dentro del programa.
• f)Agredir verbal o físicamente a cualquier persona.
• g)Retener ilegalmente o no reportar a la jefatura del Área Silvestre correspondiente, artículos u objetos pertenecientes a los visitantes, a los funcionarios o a terceras personas y que hayan quedado perdidos u olvidados.
