Volunteer Actions Regulation for Protected Wild AreasReglamento de las Acciones de Voluntariado en las Áreas Silvestres Protegidas

• a)The Superior Directorate of the National System of Conservation Areas shall issue the guidelines to be applied regarding volunteering in protected wild areas, in addition to ensuring the effective application of this regulation.
• b)The Directorate of the Conservation Areas shall be responsible for implementing the guidelines issued by the Superior Directorate of SINAC, through close coordination with the administrators and those officials responsible for each of the protected wild areas under its charge.
• c)The Administrators of the protected wild areas or those officials in charge shall have the responsibility of applying and observing this regulation and the guidelines dictated by the Superior Directorate of SINAC and the respective Conservation Area Directorate.

• a)Issue national guidelines regarding volunteering in protected wild areas.
• b)Establish a permanent liaison with national and international organizations and institutions dedicated to volunteering in protected wild areas.
• c)Establish the mechanisms for monitoring and evaluating the volunteer actions carried out in the Protected Wild Areas.
• d)Keep the registry of all organizations and institutions dedicated to volunteering in protected wild areas updated.
• e)Manage financial resources for the operation of the volunteer plans of the protected wild areas.

• a)Coordinate permanently with the regional and local organizations and institutions that carry out volunteer actions in protected wild areas.
• b)Ensure the application of the monitoring and evaluation mechanisms defined at the national level and establish any control measures necessary for the smooth course of volunteer actions in the protected wild areas.
• c)Keep the registries of the regional and local organizations and institutions that carry out volunteer actions in protected wild areas updated.
• d)Manage financial resources for the operation of the volunteer plans of the protected wild areas located in the corresponding Conservation Area.

• a)Formulate, execute, and evaluate the volunteer plans of the protected wild areas under their charge.
• b)Coordinate permanently with organizations, local community groups, and individuals who carry out volunteer actions in the protected wild areas under their charge.
• c)Ensure that the volunteers have all the necessary conditions for their stay and optimal performance in the protected wild areas under their charge, including matters related to their lodging, food, equipment, transportation, identification, and work instructions.
• d)Provide the necessary induction for the volunteers received in the Protected Wild Areas under their charge and supervise their performance.
• e)Keep the registries of volunteers of the protected wild areas under their charge updated.
• f)Prepare the annual reports of the actions carried out by the volunteers in the protected wild areas under their charge and present them to the corresponding Conservation Area Directorates and the organizations referred to in article 9.
• g)Communicate the names of the volunteers who have been expelled from the protected wild areas under their charge to the Conservation Area Directorate and the Superior Directorate of SINAC, in accordance with the provisions of article 19 of this Regulation, for dissemination at the national level.

Categories of volunteers, their rights, duties, and prohibitions

They shall render their services ad-honorem, motivated by the interest and satisfaction of assisting in the conservation of the resources existing in protected wild areas.

The volunteers who provide their services in protected wild areas may belong to one of the following categories:

• a)Volunteers from organizations and institutions, international, national, and regional, that organize and execute volunteer actions in protected wild areas under the administration of SINAC.
• b)Members of local community organizations or groups that carry out volunteer actions in protected wild areas.
• c)Individuals who carry out volunteer actions in protected wild areas on an individual basis.

All Costa Rican citizens and resident foreigners, as well as non-resident foreigners who comply with all the requirements demanded by Costa Rican laws to enter the country legally, may be volunteers. Volunteers must be of legal age, in accordance with Costa Rican legislation. If they are minors, but aged 15 or older, they must have written authorization from their parents or guardians.

• a)Receive induction and guidance regarding their rights, duties, responsibilities, prohibitions, and the functions they will perform according to the work plan, as well as general information about the respective protected wild area.
• b)Request support and collaboration from the public officials working in the protected wild area in order to perform their functions effectively.
• c)Receive the corresponding identification upon entering the protected wild areas.
• d)Have all the necessary conditions for their stay and optimal performance in the protected wild areas, including matters related to their lodging, food, equipment, transportation, and work instructions.
• e)Receive courteous, kind, and respectful treatment from public officials, other volunteers, and private individuals during their stay in the protected wild area.

• a)Comply with the legal provisions in force, as well as with the guidelines issued for this purpose by the National System of Conservation Areas.
• b)Collaborate with the competent public officials in the tasks assigned to them, based on the work plan defined by the parties.
• c)Abide by the instructions issued by the Administrator or the official in charge of the corresponding protected wild area, provided they conform to the legal system, this regulation, and the work plan.
• d)Present periodic reports on the tasks carried out, in those cases where required.
• e)Notify the respective administrator of the protected wild area of any irregularity committed by public officials, other volunteers, or private individuals within said area.
• f)Maintain, during their stay in the protected wild area, a permanent attitude of seriousness, prudence, and attention, as well as courtesy and kindness towards other volunteers, officials, and the general public.
• g)If required, they must provide true testimony before the competent authority of everything they saw, heard, and acted upon during the time they remained in the protected wild area.
• h)Faithfully comply with the provisions of this Regulation and the related rules provided by the legal system.
• i)Wear the proper identification visibly and at all times when providing service in the protected wild area.
• j)Be liable for any damage, loss, or misplacement they cause to the facilities, equipment, and other State property during their stay in the protected wild areas, in accordance with the provisions of the applicable regulations. In case of replacement, an appraisal issued by the MINAE Heritage office shall be obtained beforehand.

• a)Acting against the regulations in force, the guidelines issued by the National System of Conservation Areas, and this regulation.
• b)Assuming police authority functions or others that are exclusively reserved for public officials, in accordance with the applicable regulations.
• c)Making use of facilities, equipment, and other State property without the proper authorization of the Administrator or the manager of the respective protected wild area.

Organizations

• a)Have an insurance policy covering any accident that the volunteers might suffer.
• b)If the volunteers are minors and meet the requirement established in article 5, final paragraph, they must be accompanied by the person responsible for the group, who must ensure compliance with the provisions of this regulation, as well as the safety of the minors.
• c)Cover the costs of food and transportation for volunteers if required, as well as any other costs arising from unforeseen circumstances.
• d)Keep an updated internal registry of all their volunteers.
• e)Notify the competent SINAC authorities of the exclusion of any person from the internal registry of volunteers.
• f)Train the volunteers on the objectives and nature of the work they will perform in the protected wild areas, as well as regarding their rights, duties, and prohibitions, in accordance with the provisions of this regulation.
• g)Abide by the regulations in force governing protected wild areas in legal and administrative matters, as well as any other guidelines issued in this matter by the respective authorities.
• h)Elaborate, jointly with the competent authority, a work plan for the period of the volunteers' stay in the protected wild areas. This plan must be prepared prior to the volunteers' entry into the area.

Individual volunteers

• a)Have an insurance policy covering any accident they might suffer.
• b)If they are minors, they must have written authorization from their parents or guardians.
• c)If required, they must cover the costs of food and transportation, or other costs arising from unforeseen circumstances.

Faults and sanctions

In the case of minors, the parents or guardians shall be the legal persons responsible for their actions before the State or third parties.

• a)Failure to comply with the tasks assigned in the work plan and with the duties, obligations, and prohibitions established in this regulation.
• b)Violating the applicable regulatory provisions during the time they remain in the protected wild area.
• c)Receiving gifts, rewards, favors, or payments of any kind during the time they remain in service in a protected wild area.
• d)Acting under the influence of alcohol or any illegal drug while performing their duties in the protected wild area.
• e)Physically, verbally, or psychologically assaulting any person.
• f)Illegally retaining, or failing to report to the administration of the corresponding protected wild area, articles or objects belonging to visitors, other volunteers, officials, or third parties, which have been lost or forgotten.
• g)Making use of facilities, equipment, and other State property without the proper authorization of the Administrator or the official in charge of the respective protected wild area.

Financing

Given at the Presidency of the Republic.-San José, on the first day of the month of March of two thousand five.

• a)La Dirección Superior del Sistema Nacional de Áreas de Conservación, será quien dicte las directrices a aplicar en materia de voluntariado en las áreas silvestres protegidas, además de asegurar la efectiva aplicación de este reglamento.
• b)La Dirección de las Áreas de Conservación se encargará de implementar las directrices emanadas de la Dirección Superior del SINAC, mediante una coordinación estrecha con los administradores (as) y aquellos funcionarios (as) responsables de cada una de las áreas silvestres protegidas a su cargo.
• c)Los Administradores (as) de las áreas silvestres protegidas o aquellos funcionarios (as) a cargo, tendrán la responsabilidad de aplicar y observar este reglamento y las directrices dictadas por la Dirección Superior del SINAC y la Dirección del Área de Conservación respectiva.

• a)Emitir los lineamientos nacionales en materia de voluntariado en las áreas silvestres protegidas.
• b)Establecer el enlace permanente con las organizaciones e instituciones nacionales e internacionales dedicadas al voluntariado en las áreas silvestres protegidas.
• c)Establecer los mecanismos de seguimiento y evaluación de las acciones de voluntariado realizadas en las Áreas Silvestres Protegidas.
• d)Mantener actualizado el registro de todas las organizaciones e instituciones dedicadas al voluntariado en las áreas silvestres protegidas.
• e)Gestionar recursos financieros para la operación de los planes de voluntariado de las áreas silvestres protegidas.

• a)Coordinar permanentemente con las organizaciones e instituciones regionales y locales que realizan acciones de voluntariado en las áreas silvestres protegidas.
• b)Velar por la aplicación de los mecanismos de seguimiento y evaluación definidos a nivel nacional y establecer las medidas de control que fueran necesarias para el buen curso de las acciones de voluntariado en las áreas silvestres protegidas.
• c)Mantener actualizados los registros de las organizaciones e instituciones regionales y locales que realizan acciones de voluntariado en las áreas silvestres protegidas.
• d)Gestionar recursos financieros para la operación de los planes de voluntariado de las áreas silvestres protegidas ubicadas en el Área de Conservación correspondiente.

• a)Formular, ejecutar y evaluar los planes de voluntariado de las áreas silvestres protegidas a su cargo.
• b)Coordinar permanentemente con las organizaciones, grupos comunitarios locales e individuos que realicen acciones de voluntariado en las áreas silvestres protegidas a su cargo.
• c)Procurar que los voluntarios (as) cuenten con todas las condiciones necesarias para su permanencia y óptimo desempeño en las áreas silvestres protegidas a su cargo, incluyendo lo relacionado con su alojamiento, alimentación, equipo, transporte, identificación e instrucciones de trabajo.
• d)Brindar la inducción necesaria para los voluntarios (as) que se reciben en las Áreas Silvestres Protegidas a su cargo y supervisar el desempeño de los mismos.
• e)Mantener actualizados los registros de voluntarios (as) de las áreas silvestres protegidas a su cargo.
• f)Elaborar los informes anuales de las acciones realizadas por los voluntarios (as) en las áreas silvestres protegidas a su cargo y presentarlos a las Direcciones de las Áreas de Conservación correspondientes y las organizaciones referidas en el artículo 9º.
• g)Comunicar a la Dirección del Área de Conservación y Dirección Superior del SINAC los nombres de los voluntarios (as) que han sido expulsados de las áreas silvestres protegidas a su cargo, de conformidad con lo establecido en el artículo 19 de este Reglamento, para su divulgación a nivel nacional.

De las categorías de voluntarios (as), sus derechos, deberes y prohibiciones

Prestarán sus servicios ad-honorem, motivados por el interés y la satisfacción de coadyuvar en la conservación de los recursos existentes en las áreas silvestres protegidas.

Los voluntarios (as) que brinden sus servicios en las áreas silvestres protegidas podrán pertenecer a alguna de las siguientes categorías:

• a)Voluntarios (as) de organizaciones e instituciones, internacionales, nacionales y regionales, que organizan y ejecutan acciones de voluntariado en las áreas silvestres protegidas bajo la administración del SINAC.
• b)Miembros de organizaciones o grupos comunitarios locales, que realizan acciones de voluntariado en las áreas silvestres protegidas.
• c)Particulares que realizan acciones de voluntariado en las áreas silvestres protegidas, de manera individual.

Podrán ser voluntarios todos los ciudadanos y ciudadanas costarricenses y extranjeros residentes, así como las personas extranjeras no residentes que cumplan con todos los requisitos que las leyes costarricenses exigen para poder ingresar legalmente al país. Los voluntarios (as) deberán ser personas mayores de edad, de conformidad con la legislación costarricense. En caso de ser menores de edad, pero con edad igual o superior a los 15 años, deberán contar con la autorización escrita de los padres o tutores.

• a)Recibir inducción y asesoría sobre sus derechos, deberes, responsabilidades, prohibiciones y sobre las funciones en que se desempeñarán de acuerdo al plan de trabajo, así como información general sobre el área silvestre protegida respectiva.
• b)Solicitar apoyo y colaboración a los funcionarios (as) públicos que laboran en el área silvestre protegida para poder desempeñar eficazmente sus funciones.
• c)Recibir la identificación que corresponde, al ingresar a las áreas silvestres protegidas.
• d)Contar con todas las condiciones necesarias para su permanencia y óptimo desempeño en las áreas silvestres protegidas, incluyendo lo relacionado con su alojamiento, alimentación, equipo, transporte e instrucciones de trabajo.
• e)Recibir un trato cortés, amable y respetuoso por parte de los funcionarios (as) públicos, otros voluntarios (as) y particulares, durante su permanencia en el área silvestre protegida.

• a)Cumplir con las disposiciones jurídicas vigentes, así como con las directrices que al efecto dicte el Sistema Nacional de Áreas de Conservación.
• b)Colaborar con los funcionarios (as) públicos competentes en las labores que se les asignen, con base en el plan de trabajo definido por las partes.
• c)Acatar las instrucciones que gire el Administrador (a) o el funcionario (a) a cargo del área silvestre protegida correspondiente, siempre y cuando se ajusten al ordenamiento jurídico, a este reglamento y al plan de trabajo.
• d)Presentar informes periódicos de las labores efectuadas, en aquellos casos que así lo requieran.
• e)Notificar al respectivo administrador (a) del área silvestre protegida de cualquier irregularidad cometida por funcionarios (as) públicos, otros voluntarios (as), o particulares dentro de dicha área.
• f)Mantener durante su estadía en el área silvestre protegida, una actitud permanente de seriedad, prudencia y atención, así como de cortesía y amabilidad con otros voluntarios, con los funcionarios (as) y el público en general.
• g)En caso de requerirse, deberán brindar testimonio .el ante la autoridad competente de todo cuanto hubieren visto, escuchado y actuado durante el tiempo que permanecieron en el área silvestre protegida.
• h)Cumplir fielmente las disposiciones de este Reglamento y las normas conexas que disponga el ordenamiento jurídico.
• i)Portar en forma visible y permanentemente la debida identificación cuando se encuentren prestando servicio en el área silvestre protegida.
• j)Responder por cualquier daño, pérdida o extravío que ocasionen a las instalaciones, equipo y otros bienes del Estado durante su permanencia en las áreas silvestres protegidas, de conformidad con lo que establezca la normativa aplicable. En caso de reposición se contará de previo con un avalúo emitido por la oficina de Patrimonio del MINAE.

• a)Actuar en contra de la normativa vigente, de las directrices que dicte el Sistema Nacional de Áreas de Conservación y del presente reglamento.
• b)Asumir funciones de autoridad de policía u otras que estén reservadas en forma exclusiva para los funcionarios (as) públicos, de conformidad con la normativa aplicable.
• c)Hacer uso de instalaciones, equipo y otros bienes del Estado sin contar con la debida autorización del Administrador (a) o del responsable del área silvestre protegida respectiva.

De las organizaciones

• a)Contar con una póliza de seguros que cubra cualquier accidente que pudieran sufrir los voluntarios.
• b)En caso de que los voluntarios (as) sean menores de edad, y cuenten con el requisito establecido en el artículo 5º, párrafo final, deberán ser acompañados por la persona responsable del grupo, la cual deberá velar por el cumplimiento de lo expuesto en este reglamento, como de la seguridad de los menores.
• c)Cubrir los costos de alimentación y transporte de voluntarios en caso de que se requiera, así como cualquier otro costo que surja conforme a circunstancias no previstas.
• d)Mantener un registro interno actualizado de todos sus voluntarios (as).
• e)Comunicar a las autoridades del SINAC que competa, la exclusión de cualquier persona del registro interno de voluntarios (as).
• f)Capacitar a los voluntarios (as) sobre los objetivos y la naturaleza de las labores que desempeñarán en las áreas silvestres protegidas, así como en lo relativo a sus derechos, deberes y prohibiciones, de acuerdo con lo establecido en este reglamento.
• g)Acatar las disposiciones vigentes que rigen las áreas silvestres protegidas en materia jurídica y administrativa, así como cualquier otra directriz que dicten en esta materia las autoridades respectivas.
• h)Elaborar conjuntamente con la autoridad que competa, un plan de trabajo para el período de permanencia de los voluntarios (as) en las áreas silvestres protegidas. Este plan debe ser elaborado previamente al ingreso de los voluntarios (as) al área.

De los voluntarios (as) particulares

• a)Contar con una póliza de seguros que cubra cualquier accidente que pudieran sufrir.
• b)En caso de ser menores de edad deberán contar con autorización escrita de sus padres o tutores.
• c)En caso de que se requiera, deberán cubrir los costos de alimentación y transporte, u otros que surjan conforme a las circunstancias no previstas.

De las faltas y sanciones

Para el caso de los menores de edad, los padres o tutores serán los responsables legales de sus acciones ante el Estado o ante terceros.

• a)Incumplir con las tareas asignadas en el plan de trabajo y con los deberes, obligaciones y prohibiciones establecidos en el presente reglamento.
• b)Violar las disposiciones normativas aplicables dentro del tiempo que permanezca en el área silvestre protegida.
• c)Recibir dádivas, recompensas, favores o pagos de cualquier tipo, durante el tiempo que permanezca en servicio en un área silvestre protegida.
• d)Actuar bajo los efectos del licor o de cualquier droga ilegal durante el desempeño de sus funciones en el área silvestre protegida.
• e)Agredir en forma física, verbal o psicológica a cualquier persona.
• f)Retener ilegalmente o no reportar a la administración del área silvestre protegida correspondiente, artículos u objetos pertenecientes a los visitantes, a otros voluntarios (as), a los funcionarios (as) o terceras personas, que hayan quedado perdidos u olvidados.
• g)Hacer uso de instalaciones, equipo y otros bienes del Estado sin contar con la debida autorización del Administrador (a) o del funcionario (a) a cargo del área silvestre protegida respectiva.
