6227 on Public Administration, the Municipality may allocate funds for the financing of the formal and budgetary incorporation of this office into the municipal structure; this must be addressed by the Financial Directorate of the Municipality of Naranjo, in the first budget document submitted to the Comptroller General of the Republic and which legally permits it.

• 1)In accordance with Article 1 of the Organic Environmental Law 7554, the duties of the Environmental Office shall be: to ensure the conservation of the natural and cultural resources of the canton, through duly planned, organized, implemented, supervised, and evaluated protection programs in order to progressively improve their effectiveness.
• 2)In accordance with Article 50 of the Political Constitution, it shall be the responsibility of the Environmental Office to ensure that every person has the right to a healthy and ecologically balanced environment. Therefore, it is authorized to report acts that infringe upon this right and to claim compensation for the damage caused.
• 3)To ensure the application of international treaties and the national legal framework in this field.
• 4)To guide, together with the Municipality's Environmental Commission, as an advisory body to the Council, the decision-making of the local Government on matters related to environmental issues.
• 5)To administer the trust or budget coming from the Cantonal Environmental Incentive, once created, as determined by the Municipal Code and the State Financial Administration Law and their respective regulations.
• 6)In accordance with Law No. 4240 on Urban Planning, the Environmental Office must actively participate in the preparation of the Territorial Zoning Plan prepared by the Municipality and its subsequent execution, as well as participate in the activities of the Local Emergency Committee.
• 7)Supported by Article 1 of the Biodiversity Law 7788, which establishes that the purpose of this law is to conserve biodiversity and the sustainable use of resources, as well as to fairly distribute the derived benefits and costs, the Environment Office of the Municipality of Naranjo must formulate and execute sustainable plans and programs aimed at protecting the environment and biodiversity.
• 8)Actively participate in the Regional Environmental Council and manage with the State Forest Administration the training for all Office personnel, as well as human and financial resources, if necessary, to meet the obligations established in Law No. 7575 and its respective Regulation.
• 9)Coordinate with the Municipal Aqueduct Department the management of water resources. Support all activities for the acquisition of the La Chiripa property, as well as other lands within the El Chayote Protective Zone, and other areas near drinking water catchment sources.
• 10)Address complaints, in accordance with the provisions of the General Water Law (1634), General Health Law (5395), Organic Environmental Law (7554), Wildlife Law (7317) and its Regulation (Decree 22545), Forest Law (7575), Biodiversity Law (7788), Animal Welfare Law (7451), and carry out the respective actions before the relevant bodies.
• 11)Inform the Municipal Council about the office's activities through an annual report to be submitted between the first and the eighth of May.

• 1)To learn about the environmental efforts carried out in the Canton by the local government, institutions, community organizations, and NGOs, and indicate the results achieved through these efforts in recent years. As well as to follow up on the projects established to date.
• 2)To know and update the procedures for granting permits that intervene in environmental conservation.
• 3)To seek and channel additional financial resources, both of national and foreign origin, to intensify actions that consolidate the office or department.
• 4)To promote greater citizen participation in the analysis and discussion of environmental policies that affect the canton and the region.
• 5)To analyze, discuss, and rule on the appropriateness and feasibility of activities, programs, and projects in environmental matters promoted by any public or private entity.
• 6)To develop and implement educational activities, programs, and projects that foster the basis for a new attitude towards environmental problems, and establish the foundations to consolidate an environmental culture.
• 7)To strengthen environmental education, outreach, and dissemination programs throughout the canton.
• 8)To execute and support technological training programs, studies, and scientific research in the environmental field in order to have greater knowledge for the adequate management of natural resources.
• 9)To recommend to MINAE the creation and/or expansion of protected wilderness areas of communal or national importance.
• 10)To establish coordination and cooperation mechanisms with other regional municipalities, the National Union of Local Governments, or with foreign municipalities that pursue similar objectives, as established by the Municipal Code in its Article Four, subsection f.
• 11)To prepare and keep updated a diagnosis of the canton's environmental situation, giving priority to everything related to water resources, as indicated in the Clean Rivers for Naranjo Program, developed by the Environmental Commission.
• 12)Establishment of pollution indicators: microbiological, industrial discharges, pig farms, poultry farms, stables, discharges of coffee waste, sugarcane, vegetables, discharges of fertilizers, insecticides, nematicides.
• 13)To establish an environmental sensitivity map that considers the degree of threat to local aquifers, as well as specific sources of pollution that may affect these springs (nacientes).
• 14)To improve information on groundwater, especially regarding geographical location, flow, and connection with micro-watersheds.
• 15)To promote the creation and strengthening of associations and organized groups for the development and protection of natural resources within the framework of sustainable development.
• 16)To ensure the control of pollution by anthropogenic waste substances (liquid, solid, and gaseous), sonic, and radioactive pollution.
• 17)To create a body of ad-honorem municipal inspectors of natural resources, to assist in the protection and conservation of the environment in the canton.

• 1)De acuerdo con el artículo 1º, de la Ley Orgánica del Ambiente 7554, los deberes de la Oficina Ambiental serán: asegurar la conservación de los recursos naturales y culturales del cantón, mediante programas de protección debidamente planeados, organizados, llevados a efecto, supervisados y evaluados a fin de mejorar progresivamente su efectividad.
• 2)De acuerdo con el artículo 50 de la Constitución Política, será responsabilidad de la Oficina Ambiental velar porque toda persona tenga derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado.
• 3)Velar por la aplicación de los tratados internacionales y el ordenamiento jurídico nacional en este campo.
• 4)Orientar, junto con la Comisión Ambiental de la Municipalidad, como órgano asesor del Concejo, la toma de decisiones del Gobierno local en asuntos relacionados con la temática medioambiental.
• 5)Administrar el fideicomiso o presupuesto proveniente del Incentivo Ambiental Cantonal, una vez creado, según lo determina el Código Municipal y la Ley de Administración Financiera del Estado y sus respectivos reglamentos.
• 6)De acuerdo con la Ley Nº 4240 de Planificación Urbana, la Oficina Ambiental deberá participar activamente en la elaboración del Plan de Ordenamiento Territorial que elabora la Municipalidad y su posterior ejecución, así como participar en las actividades del Comité Local de Emergencias.
• 7)Amparados en el artículo 1º de la Ley de Biodiversidad 7788, donde se establece que el objeto de la presente ley es conservar la biodiversidad y el uso sostenible de los recursos, así como distribuir en forma justa los beneficios y costos derivados, la Oficina del Ambiente de la Municipalidad de Naranjo deberá formular y ejecutar planes y programas sustentables dirigidos a la protección del medio ambiente y la biodiversidad.
• 8)Participar activamente en el Consejo Regional Ambiental y gestionar con la Administración Forestal del Estado la capacitación para todo el personal de la Oficina, así como recursos humanos y financieros, en caso necesario, para hacer frente a las obligaciones establecidas en la Ley Nº 7575 y su respectivo Reglamento.
• 9)Coordinar con el Dpto. de Acueducto Municipal la gestión del recurso hídrico. Apoyar toda actividad para la adquisición de la finca La Chiripa, así como otros terrenos dentro de la Zona Protectora El Chayote, y otras áreas cercanas a las fuentes de captación de agua potable.
• 10)Atender denuncias, de acuerdo con lo estipulado en la Ley General de Aguas (1634), Ley General de Salud (5395), Ley Orgánica del Ambiente (7554), Ley de Vida Silvestre (7317) y su Reglamento (Decreto 22545), Ley Forestal (7575), Ley de Biodiversidad (7788), Ley de Bienestar de los Animales (7451), y gestionar ante los órganos pertinentes las acciones respectivas.
• 11)Informar al Concejo Municipal sobre las actividades de la oficina mediante un informe anual que se presentará entre el primero y el ocho de mayo.

• 1)Conocer las gestiones ambientales realizadas en el Cantón por el gobierno local, instituciones, organizaciones comunales y ONG, e indicar los resultados logrados mediante estas gestiones en los últimos años. Así como dar seguimiento a los proyectos que se encuentran establecidos hasta el momento.
• 2)Conocer y actualizar los procedimientos para el otorgamiento de permisos que intervengan en la conservación del ambiente.
• 3)Buscar y canalizar recursos financieros adicionales, tanto de origen nacional como extranjero, para intensificar acciones que consoliden la oficina o departamento.
• 4)Promover la mayor participación ciudadana en el análisis y discusión de las políticas ambientales que afecten al cantón y a la región.
• 5)Analizar, discutir y pronunciarse sobre la conveniencia y la viabilidad de las actividades, los programas y los proyectos que en materia ambiental promueva cualquier entidad pública o privada.
• 6)Desarrollar y poner en práctica actividades, programas y proyectos de educación que fomenten las bases de una nueva actitud hacia los problemas ambientales, y establecer los fundamentos para consolidar una cultura ambiental.
• 7)Fortalecer los programas de educación ambiental, extensión y divulgación en todo el cantón.
• 8)Ejecutar y apoyar programas de capacitación tecnológica, estudios e investigaciones científicas en el campo ambiental con el fin de tener un mayor conocimiento para un manejo adecuado de los recursos naturales.
• 9)Recomendar al MINAE la creación y/o ampliación de áreas silvestres, protegidas de importancia comunal o nacional.
• 10)Establecer mecanismos de coordinación y cooperación con otras municipalidades regionales, la Unión Nacional de Gobiernos Locales, o con municipios extranjeros que persigan objetivos afines, como lo establece el Código Municipal en el Artículo Cuarto, inciso f.
• 11)Elaborar y mantener actualizado un diagnóstico de la situación ambiental del cantón, otorgando prioridad a todo lo referido con el recurso agua, señalado en el Programa Ríos Limpios para Naranjo, que desarrolla la Comisión Ambiental.
• 12)Establecimiento de indicadores de contaminación: microbiológico, descargas industriales, porquerizas, granjas avícolas, caballerizas, descargas de desechos de café, caña india, hortalizas, descargas de abonos, fertilizantes, insecticidas, nematicidas.
• 13)Establecer un mapa de sensibilidad ambiental que considere el grado de amenaza de los acuíferos locales, así como las fuentes puntuales de contaminación que puedan afectar estas nacientes.
• 14)Mejorar la información sobre aguas subterráneas, sobre todo en lo que se refiere a ubicación geográfica, flujo y conexión con microcuencas.
• 15)Promover la constitución y fortalecimiento de las asociaciones y grupos organizados para el desarrollo y protección de los recursos naturales en el marco del desarrollo sostentable.
• 16)Velar por el control de la contaminación por sustancias de desechos antopogénicos (liquidas, sólidas y gaseosas), la sónica y la radioactiva.
• 17)Crear un cuerpo de inspectores municipales ad-honorem de recursos naturales, que ayuden en la protección y conservación del ambiente en el cantón.
