across the entirety of the text - Complete Text of Norm 29998 Declares "La Tirimbina Private Category Wildlife Refuge" Complete Text record: 446EC No. 29998-MINAE No. 29998-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Based on article 140, subsections 3) and 18) of the Political Constitution, and in accordance with article 1 of the Forestry Law (Ley Forestal), No. 7575, published in La Gaceta No. 16 of January 23, 1997, as well as articles 82, 84 and 87 of the Wildlife Conservation Law (Ley de Conservación de la Vida Silvestre), No. 7317 and articles 80 and 81 of the Regulation to the Law (Reglamento a la Ley), No. 26435-MINAE, as well as article 32 of the Organic Law of the Environment (Ley Orgánica del Ambiente), No. 7554.
Considering (Considerando):
1.—That it is in the Government's interest to strengthen administrative structures in the field of natural resources, in order to have defined policies that guarantee the rational use of said resources.
2.—That in the area of Río Cuarto, between the vertical coordinates 522000-525000 and horizontal 264000-267000, of the Lambert Projection System, in the community called Tirimbina, of the second district La Virgen, tenth canton Sarapiquí, province of Heredia, is located the property inscribed in the Real Estate Folio (Folio Real) number one hundred seventy-four thousand four hundred twenty-five - zero zero zero, with an area of two million fifty-nine square decimeters (296.37 Ha.) according to cadastral plan No. H-569810-99, which is an area of pastures, mountain, fruit trees, pepper and a building of eleven houses, owned by the company "Reserva Biológica La Tirimbina, Limitada", with legal identification number three - one hundred two - one hundred fifty-four thousand seven hundred ninety-four.
3.—That the area described above constitutes a very important core for wildlife conservation within the private wildlife refuge management category. That because forests and wildlife species continue to disappear from our environment and therefore from our planet, this management category allows them to be conserved and managed within sustainable development, serving at the same time as an environmental regulator, through the implementation of a management plan.
4.—That in the technical document submitted and carried out in the zone, it is demonstrated that it is a protected wild area for the protection of biodiversity and that it serves to provide opportunities for scientific research, recreation and education; the primary objectives of this refuge being to conserve and protect natural primary and secondary forest, as well as the perpetuation and protection of species with threatened and reduced populations of flora and fauna; the Tirimbina and Uno rivers cross the refuge; in addition, several streams that originate (nacientes) within the site as tributaries of the Sarapiquí river, and it has approximately 99.40% corresponding to forest, 0.40% to pasture and 0.20% is wetland; the lands are subject to payment for environmental services (Pago de Servicios Ambientales, PSA).
5.—Considering also that there are 304 species of flora belonging to 76 families and 186 genera, where 14% corresponds to the family Rubiaceae, 11% to the family Areacaceae, 8% to the family Fabaceae; as for fauna, there are 30 species of mammals and 196 species of birds, 23 species of reptiles, 20 species of amphibians, which is why it is considered important in the proposal of the Mesoamerican Biological Corridor (Corredor Biológico Mesoamericano).
6.—That integrated rational management of natural resources contributes to satisfying regional needs for research, recreation, environmental education, ecotourism, as well as the use of renewable natural resources exploited rationally; hence it has several agreements with different NGOs, as well as state institutions.
7.—That the owners of said property voluntarily agree to join this wildlife protection regime, committing not to develop any activity that endangers the fragility of the different ecosystems existing in the area. Therefore (Por tanto), DECREE (DECRETAN):
Likewise, it will provide all necessary collaboration to the officials of this Ministry, for the control and verification of environmental policies through the Área de Conservación Cordillera Volcánica Central of the Sistema Nacional de Áreas de Conservación, as well as to researchers, students and others who sporadically visit said area in the functions proper to their respective positions, studies and investigations. Likewise, they commit to comply with the provisions set forth for this purpose by the General Wildlife Law (Ley General de Vida Silvestre), the Forestry Law (Ley Forestal), their respective Regulations, as well as the other provisions in force regarding environmental legislation.
If they do not wish to maintain said management category, the owners must Conservación Cordillera Volcánica Central, one year in advance.

Considerando:
DECRETAN:
Asimismo, brindará toda la colaboración necesaria a los funcionarios de este Ministerio, para las labores de control y verificación de las políticas ambientales mediante el Área de Conservación Cordillera Volcánica Central del Sistema Nacional de Áreas de Conservación, así como a los investigadores, estudiantes y otros que esporádicamente visiten dicha área en las funciones propias de sus respectivos cargos, estudios e investigaciones. Asimismo se comprometen a cumplir con las disposiciones que al efecto señalan la Ley General de Vida Silvestre, la Ley Forestal, sus respectivos Reglamentos, así como las demás disposiciones vigentes en materia de legislación ambiental.
En caso de no querer mantener dicha categoría de manejo, los propietarios deberán de manifestar su deseo de desafectar las fincas mediante escrito presentado ante el Área de Conservación Cordillera Volcánica Central, con un año de anticipación.
