Whenever there is water availability (disponibilidad de agua) in the area, the registered owner, possessor, or their authorized attorney-in-fact, guardian, curator, or executor of the property, or the legal representative thereof, may request the granting of potable water. For such purposes, they must present, in physical form, the following requirements:
- a)Application form provided by the Municipalidad de Grecia, fully completed and signed by the registered owner or their authorized attorney-in-fact, possessor, executor of the property, or the legal representative, which shall indicate the number of services required and the use that will be given to them, the registered folio number (número de folio real) and the cadastral plan number, and the exact address of the property requiring the water connection(s). If it is not the owner who manages the application, they must present a special power of attorney, general, generalísimo power of attorney, or authorization duly authenticated by a Notary Public, or a certificate from a judicial authority duly certified according to the case, which accredits them to carry out the procedure.
- b)Presentation of the identity card (cédula de identidad) or valid identification document of the owner or the applicant, as the case may be. When the applicant is a legal entity, they must provide the certificate of legal standing (personería jurídica), issued no more than 30 calendar days prior, and provide the identity card of the legal representative and the authorized applicant, as appropriate.
- c)Present the cadastral plan of the property where the water granting is requested. If the Municipalidad does not have the cadastral plan in its database, the taxpayer must provide a copy of it.
- d)Additionally, and in accordance with the provisions of Ley 8220 and 8990, the Municipalidad de Grecia shall verify, through the official and available virtual platforms, the following information; i. Literal study from the Registro de la Propiedad corresponding to the property (finca) with the registered folio number (folio real) for which the water availability (disponibilidad de agua) is requested, in which it will be verified that the applicant is the owner of the property.
ii. That the owner is up to date with formal and material duties with the Municipalidad de Grecia.
iii. The existence of the construction permit and the paid receipt of payment, linked to the real estate where the provision of potable water is requested, relating the infrastructure to the service application. If they do not have the construction permit, they must carry out the corresponding procedure to obtain it, prior to the application for the new water service.
When the official tools and/or digital platforms previously indicated are not available, whether temporarily or permanently, the interested parties must be requested to present all the documentation established in this numeral, as a condition for the admissibility of their request.
- e)The property (finca) or lot must have public roads for direct access or through an easement (servidumbre), on which exists or could be installed, if necessary, the distribution pipeline. If the public network does not reach the property in question, provided it is technically possible, the owner may carry out an extension of the branch line (ramal) in accordance with the technical requirements of the Municipalidad, for which the respective advice shall be provided. In that case, the applicant must cover the costs of labor and materials necessary to carry out the works.
- f)Payment of the corresponding amount for the new connection, which shall correspond to the amount that is in effect at the time of making the application.
In the case of old and consolidated constructions, with more than one occupancy unit (unidad ocupacional) and that already have water service, the following shall apply:
- g)Must comply with the previous subsections, except for point d) subsection iii.
- h)Provide a note requesting the installation of additional services, per occupancy units.
For the case of those properties that have several buildings and share the water service through a meter, and that due to the age of the building do not have the construction permit, they may substitute this requirement with a copy of the declaration of real estate (declaración de bienes inmuebles) for that property, provided it was made before the year 2010, in which it is verified that the building for which they are requesting the water service has been declared. Must also comply with the requirements established in the previous subsections.
All procedures and documentation related to this request must be submitted through the Municipal Services Platform for processing. The approval of each new service granting shall be given by the Aqueducts Department. Once approved, the established and approved procedure for its execution shall be followed.
All applications shall be duly registered and processed in order of date of submission, except in urgent cases by order of the immediate superior, the Concejo, or the Mayor's Office.
