VOTO N° 459-F-2014 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At seventeen hours and twenty-five minutes on veintiocho de mayo de dos mil catorce.- POSSESSORY INFORMATION PROCEEDING filed by CORPORACIÓN [Nombre1] SOCIEDAD ANÓNIMA, corporate identification number CED1- - , represented by its general attorney-in-fact with unlimited authority (apoderado generalísimo sin límite de suma), Wang Shih Hung Cheng, of legal age, married once, resident of Puntarenas, holder of identification card number CED2- - . The INSTITUTO DE DESARROLLO AGRARIO, legal-entity identification number CED3, represented by attorney Carmelina Vargas Hidalgo, of legal age, divorced once, Attorney-at-Law, identification card CED4- - , resident of Guachipelín de Escazú, acting as general judicial attorney-in-fact (apoderado general judicial) for said Institute, and THE STATE, represented by Attorney Lydiana Rodríguez Paniagua, acting as Agrarian Counsel for the State (Procuradora Agraria), were parties to the proceeding. Attorney Carlos Fernando Cubero Rojas acts as special judicial attorney-in-fact (apoderado especial judicial) for the petitioner. The proceeding is being heard by the Juzgado Agrario del Segundo Circuito Judicial de Guanacaste.-
WHEREAS:
1° The applicant company brings this proceeding so that the property described as follows may be registered in its name in the Registro Público de la Propiedad: “NATURE: Pastureland, located in la Balsa, [Dirección1] , First Canton of the province of Puntarenas, which, according to the attached registered survey plan (plano catastrado) N° P-1522602-2011, has an area of EIGHTY-TWO THOUSAND EIGHT HUNDRED EIGHTY SQUARE METERS, whose boundaries are: NORTH: Quebrada Balsa and Quebrada Salto; SOUTH and EAST: Corporación H.C.F.P. Sociedad Anónima; and WEST: [Dirección2], with three linear meters and fifty centimeters of frontage thereon, and [Nombre2], both in part. It claims to have exercised quiet, peaceful, and continuous possession (posesión) as owner for more than forty years, including the possession of its prior transferors. It further declares that the property has no encumbrances, co-owners, or real burdens, and that through this proceeding it does not seek to evade the consequences of probate proceedings (proceso sucesorio)…” (see folios 117 to 119).- 2° The representatives of Instituto de Desarrollo Rural and The State entered appearances in the proceeding without objecting, pursuant to Articles 5 and 8 of the Ley de Informaciones Posesorias (see the I.D.A filing at folio 38 and the P.G.R filing at folios 35 to 36).
3° Attorney Walter Ávila Quirós, judge of the Juzgado Agrario del Segundo Circuito Judicial de Guanacaste, in the judgment issued at fifteen hours and nineteen minutes on veinticinco de marzo del dos mil catorce, ruled: “THEREFORE: The possessory information proceeding instituted by CORPORACION (sic) H.C.F.P. SOCIEDAD ANONIMA (sic), legal-entity identification number CED5 - , domiciled in Puntarenas, [Dirección3] , represented by [Nombre3] , of legal age, married once, merchant, resident of Puntarenas, [Dirección3] , holder of the valid identification card presented, number eight-zero seventy-four-four hundred thirteen, is denied” (folios 117 to 119).- 4° Attorney Carlos Fernando Cubero Rojas, special judicial attorney-in-fact for the petitioner, filed an appeal (recurso de apelación) against the judgment at fifteen hours and nineteen minutes on veinticinco de marzo del dos mil catorce. (See filing at folio 123).- 5° The legally prescribed formalities have been observed in the proceedings, and no errors or omissions capable of rendering the judgment null and void are apparent.- Drafted by Judge Vargas Vásquez; and,
CONSIDERING:
I.The findings of fact (hechos tenidos por probados) are affirmed because they are consistent with the evidence contained in the case file, subject to the following clarifications: The first finding is supplemented to state that, in addition to pastureland, the nature of the property is forest, with sixteen point seventy-four percent of its area consisting of pasture and the remaining eighty-three point twenty-six percent consisting of forest, and to include as evidence the certification at folio 8, the testimony of witnesses [Nombre4] at folio 41, [Nombre5] at folio 41, and [Nombre6] at folio 42; the photographs at folios 88 to 91; and the record of the judicial inspection (reconocimiento judicial) at folio 92. The second finding is supplemented to state that the possession transferred was also exercised without interruption, based on the same evidence cited therein and the testimony of witnesses [Nombre4] at folio 41, [Nombre5] at folio 41, and [Nombre6] at folio 42; the photographs at folios 88 to 91; and the record of the judicial inspection at folio 92.
The following findings of fact are added at this stage: 9° The property is duly demarcated by fences along its boundaries (testimony of witnesses [Nombre4] at folio 41, [Nombre5] at folio 41, and [Nombre6] at folio 42; and record of the judicial inspection at folio 92). 10° The petitioner company and the person who transferred the possessory rights (derechos posesorios) to it have protected the forest resource, as well as the protective zone (zona protectora) of the rivers that form boundaries of the property (testimony of witnesses [Nombre4] at folio 41, [Nombre5] at folio 41, and [Nombre6] at folio 42; and record of the judicial inspection at folio 92). 11° The public road bordering the property on the southern side has a width of 8.50 meters on the plan, with provision being made for a future road widening of 5.25 meters on each side (folios 3, 73, and 74). 12° The Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria recommended maintaining forest cover (cobertura boscosa) in areas with highly rugged topography, as has been done to date, and making appropriate use of the pastures by rotating the herd so that the area is not overgrazed (folio 8).-
II.The sole finding deemed unproven (hecho tenido por indemostrado) in the judgment is not affirmed, because evidence to the contrary exists in the proceeding.-
III.Attorney Carlos Fernando Cubero Rojas, special judicial attorney-in-fact for Corporación H.C.F.P. Sociedad Anónima, filed an appeal against the judgment, expressing disagreement on the following grounds: 1° He argues that the judge did not properly assess the evidence when stating that the petitioner failed to prove the exercise of possession ten years before the creation of the Península de Nicoya protected wildlife area (área silvestre protegida), on 10 de marzo de 1994. He asserts that all witnesses testified that they had known the property for more than forty years, dating back to 1973, and clearly described the chain of possession through the present; that the property is duly demarcated; and that the natural resource is protected from fires and hunting is prohibited. He similarly asserts that the land-use certificate (certificado de uso de suelos) proves that the land has been used in accordance with its designated use, with 16.74% allocated to grassland and 83.26% to forest protection, and that the record of the judicial inspection demonstrates that the natural resource has been adequately protected. 2° He objects to the trial judge’s assertion that the location of the property is unclear, because it is depicted on a plan identifying that location.
Moreover, two judicial inspections were scheduled, and although the first was not conducted because, due to an error by the person guiding them, it took place on another property belonging to the petitioner, during the second the judge stated that it conformed in every respect to the physical reality of the property, that the right-of-way (derecho de vía) was respected, that the property was demarcated, and that the natural resource had been protected. He argues that if the trial judge was not going to give credence to this second judicial inspection, he should have denied the request so as not to cause either the petitioner or the Poder Judicial to incur the expense of transporting a judge and a judicial technical officer. Regarding the clearing of the firebreaks (rondas), he states that the witness testimony establishes that they were maintained; therefore, the fact that this could not be verified during the judicial inspection is attributable to its having been conducted on 17 de mayo de 2013, by which time the rainy season had already begun, making it logical that the firebreaks were no longer necessary because fire does not spread through green vegetation.
As legal support, he cites the decisions issued by this Court in votes 840-F-09 at 14 hours 5 minutes on 11 de noviembre and 928-F-09 at 10 hours 32 minutes on 8 de diciembre, both in 2009, concerning sustainable agro-environmental possession (posesión agroambiental sostenible).-
IV.Article 7 of the Ley de Informaciones Posesorias authorizes the titling (titulación) of real property located within protected areas (áreas protegidas), provided that possession (posesión) for ten years prior to the effective date of the law or decree creating them is established, and it is shown that the forest resource (recurso forestal) has been protected and the parcel (fundo) kept properly demarcated. In this proceeding, the applicant’s representative seeks to have a property located in La Balsa de Lepanto de Puntarenas, measuring 8 hectares 2.880 square meters and depicted on cadastral survey plan (plano catastrado) 6-1522602-2011, registered in the applicant’s name (folio 3). Both that topographic survey and the certification issued by the Oficina Subregional de Lepanto y Paquera del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservaciones state that the property lies entirely within the Zona Protectora Península de Nicoya, sector Carmona, which was created by Decreto Ejecutivo D-22968-MIRENEM dated 10 de marzo de 1994 (folios 3 and 4).
Accordingly, the applicant’s representative was required to demonstrate possession prior to 10 de marzo de 1984, protection of the forest resource, and proper demarcation of the property with fences or cleared boundary lines (carriles), in addition to the other requirements imposed by the Ley de Informaciones Posesorias. As documentary evidence, a deed dated 6 de octubre de 2011 was submitted, stating that [Nombre7] transferred to [Nombre3], acting on behalf of Corporación H.C.F.P. Sociedad Anónima, the possessory rights (derechos posesorios) exercised publicly, peacefully, continuously, and as owner for more than twenty years over the property depicted on cadastral survey plan P-1522602-2011, which [Nombre7] stated had been acquired through a purchase from [Nombre8] (folio 6). In the initial filing, which has the status of a sworn statement (declaración jurada), the applicant’s representative asserted that the property had been possessed for forty years, including the possession exercised by its previous owner, [Nombre7] (folio 13).
To establish possession, as required by article 6 of the Ley de Informaciones Posesorias, testimony was taken from three witnesses on 31 de julio de 2012. The witness [Nombre4] stated that he had known the property for 50 years and identified the parcel’s owners as [Nombre8], who sold it to [Nombre7], who in turn sold it to the applicant. He stated that the property consists of “brushland” (charral), is fenced along all its boundaries, and is maintained by clearing the perimeter strips and repairing the fences; branches have been cut for fence posts, and therefore no resources are being extracted from the property (folio 41). The witness [Nombre5], for his part, stated that he had known the parcel for 40 years and that it initially belonged to [Nombre8], who held it for twenty years and then sold it to [Nombre7], who in turn sold it to the applicant. He added that the property is used as pastureland and for conservation, that it is maintained through clearing and fence repairs, and that the protected area surrounding the stream is being safeguarded, with no environmental damage reported on the parcel.
Likewise, [Nombre6] stated that he knew in detail the area where the investigation conducted against [Nombre9], referred to in the judgment, originated (reverse of folio 41). Finally, [Nombre6] stated that he had known the property for forty years and that its owners had been [Nombre8] and subsequently [Nombre7]. He added that maintenance, such as clearing the perimeter strips, is performed, and that the property is therefore demarcated along its boundaries (folio 42). A judicial inspection (reconocimiento judicial) of the property was conducted at 9 hours 30 minutes on 5 de octubre de 2012, and the record stated: “...after the aforementioned gate, an unfenced track continues to a pasture in very good cleared condition, which cannot be identified as belonging or not belonging to the property to be titled because there are no fences or boundary markers (mojones) separating it... in general, the property as it physically exists does not conform to the site description shown on the survey plan...” (folio 52).
In view of that situation, the applicant’s representative informed the Court that a person had been designated to accompany the Court staff on the date scheduled for the evidentiary hearing, but that, owing to that person’s “simplicity and lack of information,” the person showed them land that also belongs to the applicant (folio 84). The Court scheduled a new judicial inspection for 20 de mayo de 2013, the record of which stated: “The property consists mostly of forest or secondary brushland (tacotal), with a smaller portion consisting of pasture. The eastern boundary is fenced with living and dead posts and three strands of wire in good condition. Along the western boundary up to the quebrada Saltos, there is a fence of living and dead posts with two strands of wire extending to the quebrada Salto (sic), which appears to be in a good state of conservation; the streams located along the northern and western boundaries appear to be protected by trees native to the area, including guácimos and chapermo, among others...
The property conforms to the site description shown on cadastral survey plan N° 6-1522602-2011.” (folio 92). Photographs of the property showing the existence of fences and forest were attached (folios 88 to 91). Finally, the certification issued by the Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria certified that the property’s land use (uso del suelo) for the activity conducted there complies with the approved methodology (folio 8). The foregoing demonstrates that, contrary to the finding of the trial judge, the applicant’s representative did establish possession of the property for ten years prior to the effective date of the regulation that created the Zona Protectora Península de Nicoya, sector Carmona, through Decreto Ejecutivo D-22968-MIRENEM dated 10 de marzo de 1994, because the witnesses testified on 31 de julio de 2012 that they had known the property for more than 50, 40, and 30 years, respectively, and stated that since that time it had already been in the possession of the person who subsequently transferred the possessory rights to the title claimant (titulante); that is, they had known the property since before 10 de marzo de 1984.
Likewise, the protection of the forest resource and the proper land use for the activity conducted in accordance with the approved methodology were established, while preserving the forested areas and the protected zone adjacent to the streams; moreover, the second judicial inspection recorded the existence of fences demarcating the parcel along its boundaries. In this Court’s view, the fact that the first judicial inspection was conducted on a different parcel is explained by the applicant’s representative’s assertion that the person designated to accompany the Court staff mistook the property and took them to another property belonging to the title claimant. It is important to note that, although the public road must be 14 meters wide pursuant to article 2 of the Ley General de Caminos Públicos, and in this case the survey plan specifies a width of 8.50 meters, as confirmed by the study conducted by the Municipalidad de Lepanto (folios 73 and 74), provision was made for a future road widening of 5.25 meters on each side (folio 3). The applicant cannot be required to indicate the mandated width because that road is not part of the parcel, but rather ends where the parcel begins at its southwestern boundary.-
V.Based on the foregoing and pursuant to articles 45 and 50 of the Constitución Política; 1, 2, 6, 7, and 11 of the Ley de Informaciones Posesorias; and 1, 2, 6, 26, 54, and 79 of the Ley de Jurisdicción Agraria, the judgment must be reversed and, in its place, the possessory information proceeding (proceso de Información Posesoria) approved. The Registro Nacional de la Propiedad shall register the aforementioned property as an independent property in the applicant’s name, without prejudice to third parties having superior rights.-
I disagree with the majority Opinion approving the possessory information proceeding (información posesoria) concerning land of biological conservation importance, as in the present case, in which the property being titled is forest land located entirely within the Zona Protectora de la Península de Nicoya. The purpose of its designation as a protected zone (zona protectora) is to create a biological corridor (corredor biológico), given the importance of protecting the biodiversity existing in that area. A property with such forest characteristics is part of the State’s natural heritage (patrimonio natural del Estado), and in this case, ten-year possession (posesión decenal) exercised before that property was designated as public-domain property (bien demanial) was not demonstrated.- The Public Domain (Dominio Público)—for purposes of the case before us—is the body of publicly owned property belonging to the State, lato sensu, devoted to the direct or indirect public use of the inhabitants and subject to a special public-law regime that therefore lies outside private law.
The public domain consists of four elements: subjective, objective, normative, and teleological. The subjective element refers to the holder of the right—the State—; the objective element refers to or consists of the property or properties over which the public domain extends—in this case, the real property at issue in the litigation—; the normative element determines when property meets the statutory requirements for it to be considered public-domain property and consists of the body of rules governing it—the set of rules discussed below—; and the teleological element refers to the purpose pursued by including a particular property within the public domain, namely, the public purpose assigned to the property—in this case, the protection of natural resources—. Public-domain property is subject to a special legal regime and to police power (poder de policía), and is characterized essentially by its inalienability (inalienabilidad) and immunity from acquisitive prescription (imprescriptibilidad).
By its nature, such property is intended to satisfy public needs, which prevents private individuals or persons from holding or possessing it; it lies outside private-law commerce. Article 121, subsection 14), of our Constitución Política refers to public-domain status (Demanialidad), identifying which properties may be subject to that public-ownership regime and even establishing different degrees of dedication to public use (afectación pública) in that article, ranging from an intense and absolute degree of public dedication (publicatio) to less intense degrees, while reconciling the rights of private parties subject to the Administration (administrados) with the powers of the Administration. Our current Código Civil, which dates from abril de mil ochocientos ochenta y seis, regulates the principal foundations concerning public-domain property, specifically in Articles 261 through 263.
Article 262 of the aforementioned Código Civil refers to two important characteristics of public-domain property: a- public things are outside commerce, and b- removal from public-domain status (desafectación) is established by providing that such property may not enter private commerce unless legally authorized. As may be observed, dedication to the public-domain regime does not depend on the nature of the property, but on the legislature’s intent. In Opinion number 447-91 of quince horas treinta minutos del 21 de febrero de 1991, the Sala Constitucional states that the designation of property as part of the public domain is established by law and that this designation does not constitute a restriction on ownership under Article 45 of the Carta Magna, because that article concerns private property, whereas public-domain property is not subject to private ownership. The State Forest Heritage (Patrimonio Forestal del Estado) is public-domain property governed by an extensive body of rules that, historically and through the present, prohibits private parties from carrying out any type of activity within properties having that characteristic and, consequently, denies them the right of possession, subject to an exception in a specific situation discussed below.
Land constituting National Reserves (Reservas Nacionales) containing Forests is considered State Heritage (Patrimonio Estatal)—in its capacity as Public Domain (Demanio Público), which entails the principles of immunity from acquisitive prescription, inalienability, and immunity from attachment (inembargabilidad)—. The foregoing is developed in the following provisions: 1) The Código Fiscal de 1865, which contains a chapter concerning forests and was repealed by the Ley General de Terrenos Baldíos Número trece del 6 de enero de 1939, which incorporated virtually the same provisions. For example, Article 1 stated: “Land located within the boundaries of the Republic that has not been acquired or registered as property by private parties under lawful title is presumed to be vacant public land (baldíos) and belongs to the State.” This law generally regulates the prohibition against possessing and registering, through possessory information proceedings, National Reserves that constitute Forest Heritage; in other words, they may not be appropriated by private parties.- The Ley de Tierras y Colonización Número 2825 del 14 de octubre de 1961 maintained the same approach and has remained in force from that date to the present.
Thus, Article 8 of that Ley de Tierras y Colonización provides: “Except in the cases provided for in this law, private parties are prohibited from enclosing land designated as National Reserves with fences, cleared boundary strips (carriles), or by any other means; clearing woodland; establishing structures and crops; or extracting firewood, timber, vines, palm, or other products from such land for purposes of exploitation. Any act of that kind carried out without first completing the legal procedures and obtaining the corresponding authorization shall be deemed, as applicable, usurpation of the public domain (usurpación de dominio público) or trespass (merodeo), and the authorities shall order the destruction and removal of the fences and prevent the use of such land, without compensation or claims for the value of improvements and without prejudice to any other liability that may be incurred by those committing such offenses.”- It should be noted that this article criminally punishes anyone who enters a National Reserve to carry out any activity on that land; therefore, such activity cannot be considered an act of possession because it would be unlawful.- Article 11 of that same Law establishes that the following belong to the State as National Reserves: “a) All land within the boundaries of the Republic that is not registered as the private property of individuals, Municipalities, or Autonomous Institutions. b-) Land not protected by ten-year possession.- c-) Land that has not been allocated by special laws to the formation of agricultural colonies.- d-) In general, all land that, while not privately owned, is not occupied for public services.”- Article 19 of the repealed Ley Forestal número 4465 del veintitrés de noviembre de mil novecientos sesenta y nueve, for its part, provided: “All forests and forest land (terrenos forestales) located in the following areas are dedicated to the purposes of this law: ‘a-) Land considered National Reserves...’” Article 25 of that same law stated: “Possession of land located in the National Reserves and State-owned properties referred to in Article 19 of this Law shall create no rights of any kind, and the State’s action to recover ownership (acción reivindicatoria) thereof is not subject to prescription; the Dirección General Forestal, using the lawful means at its disposal, shall proceed to evict from such land the persons who occupy it in whole or in part where the land consists of protected zones, National Parks, Forest Reserves, or Biological Reserves.”- These provisions afford the forests referred to therein twofold protection: first, by virtue of their status as National Reserves, in which any act of possession is prohibited, and second, because they constitute State Forest Heritage, in which no act of possession creates rights of any kind.
This is confirmed by Article 8 of the regulations under that law, which states: “National lands located within areas designated as Forest Reserves are inalienable, meaning that they may not leave State ownership, and possession thereof shall create no rights of any kind, pursuant to Articles 25, 49, and 57 of the Ley Forestal.”- Article 80 of the aforementioned repealed Ley Forestal stated: “The invasion and occupation of land in National Parks, Forest Reserves, and Protected Zones is prohibited. This prohibition extends to National Reserves until their classification and transfer have been determined...” Article 6 of that same law provided: “Any person who: a-) Exploits a forest belonging to the forest heritage without the corresponding legal authorization... b-) Invades a National Park, Biological Reserve, Protected Zone, or Forest Reserve... shall be punished by imprisonment from seis meses a dos años or by a fine of quince a cien días.
If the invasion occurs in National Reserves, it shall be subject to Article 227 of the Código Penal.-” As may be observed, acts of possession carried out in a forest belonging to the State’s heritage are unlawful and therefore cannot confer any right of possession.- Upon the entry into force of Ley Forestal Número 7174 del 28 de junio de 1990, this same approach continued. Article 32 of the aforementioned law provides: “The State’s forest heritage consists of all forests and forest land in the National Reserves...” Article 33 of that same law provides: “The forest land and forests constituting the State’s Forest Heritage, as detailed in the preceding article, shall be immune from attachment and inalienable; their possession by private parties shall create no rights in their favor, and the State’s action to recover that land is not subject to prescription.- Consequently, they may not be registered in the Registro Público through a Possessory Information Proceeding, and their invasion and occupation shall be punished in accordance with this Law.”- The currently effective Ley Forestal número 7575 del 5 de febrero de 1996 regulates, in Title II, a single chapter devoted exclusively to the State’s Natural Heritage, following the same approach initiated in 1865 with the Código Fiscal.
This new legislation therefore reiterates that the State’s Natural Heritage consists of the forests and forest land of the national reserves, areas designated as inalienable, and properties registered in the name of the Administración Pública. Article 14 of that same currently effective Ley Forestal emphatically states that the forest land and forests constituting the State’s natural heritage are not subject to prescription, are immune from attachment, and are inalienable, and that their possession by private parties shall create no rights in their favor. The Ley de Conservación de la Vida Silvestre Número 7317 del 21 de octubre de 1972, in Articles 3 and 4, in addition to designating wild fauna and flora, respectively, as part of the public domain and as matters of public interest (interés público), states that wild flora and fauna are part of the National Heritage. Similarly, Article 6 of the Ley de Biodiversidad número 7788 del 30 de abril de 1998 designates the elements of biodiversity as part of the public domain, while Article 46 of the Ley Orgánica del Ambiente establishes the State’s sovereignty over biological diversity.
In light of the foregoing, it is legally imperative to deny possessory rights to persons who engage in any activity on land not subject to private ownership and consisting of forests within National Reserves. This mandatory prohibition is subject to an exception under Ley Forestal Number 7575 of 1996, which amends Article 7 of the Ley de Informaciones Posesorias and departs from the rationale set out thus far by permitting title to forestland where what is understood as ecological possession (posesión ecológica) has been exercised. The land that is the subject of this possessory title proceeding (información posesoria) is State Natural Heritage (Patrimonio Natural del Estado), because it consists of forest cover (cobertura boscosa), as shown by the soil study appearing at folios 8 and 9 and the judicial inspection recorded at folio 92, which indicates that, according to the technical soil study, the land consists predominantly of forest, with the remainder consisting of pasture; this means that the land as a whole is predominantly forested, at 83%.
It is clear that this land has constituted State Natural Heritage since before those Decrees were issued, as already explained in the legislative history above. When possession of a public-domain asset (bien demanial) is at issue, such a dispute may arise only when the right was acquired before the asset was declared part of the public domain (dominio público). Likewise, ownership rights in such cases may be obtained only where the holder has demonstrated ten-year possession (posesión decenal), exercised for at least ten years prior to the effective date of the law declaring the property to be State Natural Heritage. As the legislative chronology protecting State Natural Heritage has already been set out, the law that must be taken into account when calculating the ten-year possession of private parties is Ley de Tierras y Colonización number 2825 of 14 October 1961, which remains in force.
Código Fiscal of 1865 and Ley de Terrenos Baldíos of 1939 should not be considered, because they addressed the subject only in general terms and, moreover, are no longer in force; it was not until the current Ley de Tierras y Colonización that State Property or State Natural Heritage (Propiedad o Patrimonio Natural del Estado) was clearly defined and regulated. Subsequent laws, such as Ley Forestal and others cited in this recital (considerando), supplement the aforementioned Ley de Tierras y Colonización. In this specific case, the testimonial evidence gathered does not establish such ten-year possession under the legislation set out herein. It is for this reason that this dissenting opinion (voto salvado) is entered: to state that the petitioner was required to prove ten years of possession predating Ley de Tierras y Colonización; accordingly, the possessory title proceeding should have been denied and the judgment under appeal reversed.
POR TANTO:
The judgment is reversed. In its place, the Possessory Information Proceeding is approved. The National Real Property Registry shall register as an independent property, in the name of Corporación [Nombre1]. Sociedad Anónima, legal entity identification number CED6- , without prejudice to third parties with a superior right, the property described as follows: It is located in La Balsa de Lepanto, [Dirección4] , first canton of the province of the same name, with an area of eighty-two thousand eight hundred eighty square meters; bounded to the north and west by the protected area of the Salto stream, to the south and east by another property belonging to the titleholder, and to the south by a public road three meters and fifty linear centimeters wide, with provision for a future road widening of five meters and twenty-five linear centimeters on each side; depicted on cadastral plan six-one five two two six zero two-two zero one one, in the name of the petitioner.
The property is devoted to pasture on sixteen point seventy-four percent of its area and to forest on the remaining eighty-three point twenty-six percent, and land use on the property conforms to the activity conducted there in accordance with the approved methodology, as certified in the technical report issued by the National Institute for Agricultural Innovation and Technology Transfer. On the recommendation of that Institution, areas with highly rugged topography must remain under forest cover, as they have been to date; and the pastureland must be used appropriately by rotating the herd so that the area is not overgrazed. The property is located entirely within the Zona Protectora Península de Nicoya, Carmona sector, which was created by Decreto Ejecutivo D-dos dos nueve seis ocho-MIRENEM del diez de marzo de mil novecientos noventa y cuatro. The titleholding company has been in public, peaceful, uninterrupted possession of said property, as owner and in good faith, since before diez de marzo de mil novecientos ochenta y cuatro, tacking the possession exercised under those conditions by [Nombre7] , identification number CED7 - , pursuant to public deed number two hundred sixty-three-fourteen, appearing on the reverse of folio one hundred forty-one of volume fourteen of the notarial protocol of Notary Public Carlos Fernando Cubero Rojas.
In addition, the petitioner has undertaken to maintain the boundary fences and protect the forest resources existing on the property. Judge Alvarado Paniagua filed a dissenting opinion.- [Nombre11] - JUDGE DECISION-MAKER [Nombre12] - JUDGE DECISION-MAKER [Nombre10] - JUDGE/DECISION-MAKER
VOTO N° 459-F-2014 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las diecisiete horas y veinticinco minutos del veintiocho de mayo de dos mil catorce.- PROCESO DE INFORMACIÓN POSESORIA planteada por CORPORACIÓN [Nombre1] SOCIEDAD ANÓNIMA, con cédula jurídica número CED1- - , representada por su apoderado generalísimo sin límite de suma Wang Shih Hung Cheng, mayor, casado una vez,vecino de Puntarenas, con cédula de identidad número CED2- - . En el proceso se tuvo como parte al INSTITUTO DE DESARROLLO AGRARIO, cédula de persona jurídica número CED3, representado por la licenciada Carmelina Vargas Hidalgo, quien es mayor, divorciada una vez, Abogada, cédula CED4- - , vecina de Guachipelín de Escazú, en el carácter de apoderado general judicial de dicho Instituto y EL ESTADO, representado por la Licenciada Lydiana Rodríguez Paniagua, en el carácter de Procuradora Agraria. Actúa como apoderado especial judicial de la promovente el licenciado Carlos Fernando Cubero Rojas. El proceso se tramita en el Juzgado Agrario del Segundo Circuito Judicial de Guanacaste.-
RESULTANDO:
1° La sociedad titulante plantea el presente proceso a fin de que se inscriba a su nombre en el Registro Público de la Propiedad la finca que se describe así: "NATURALEZA: Potrero, Situada en la Balsa, [Dirección1] , Cantón Primero de la provincia de Puntarenas, que según el plano catastrado adjunto N° P-1522602-2011, posee una extensión de OCHENTA Y DOS MIL OCHOCIENTOS OCHENTA METROS CUADRADOS, cuyos linderos son: NORTE: Quebrada Balsa y Quebrada Salto; SUR y ESTE: Corporación H.C.F.P. Sociedad Anónima y al OESTE: [Dirección2] con un frente a ella de tres metros cincuenta centímetros lineales e [Nombre2] ambos en parte. Afirma haber poseído en forma quieta, pacifica, continua y a título de dueño por más de cuarenta años sumando la de sus anteriores transmitentes. Declara a su vez el fundo no tiene gravámenes, condueños ni cargas reales y que con este proceso no pretende evadir las consecuencias de un proceso sucesorio..." (ver folios 117 a 119).- 2° Las personas representantes de Instituto de Desarrollo Rural y de El Estado, se apersonaron al proceso sin oponerse en los términos dispuestos por los artículos 5 y 8 de la Ley de Informaciones Posesorias (ver escrito del I.D.A de folio 38 y de la P.G.R a folios 35 a 36).
3° El licenciado Walter Ávila Quirós, juez del Juzgado Agrario del Segundo Circuito Judicial de Guanacaste, en sentencia de las quince horas y diecinueve minutos del veinticinco de marzo del dos mil catorce, resolvió: "POR TANTO: Se imprueba la información posesoria establecida por CORPORACION (sic) H.C.F.P. SOCIEDAD ANONIMA (sic), con cédula de persona jurídica CED5 - , domiciliada en Puntarenas, [Dirección3] , representada por [Nombre3] , quien es mayor, casado una vez, comerciante, vecino de Puntarenas, [Dirección3] , portador de la cédula de identidad vigente que exhibe número ocho- cero setenta y cuatro- cuatrocientos trece" (folios 117 a 119).- 4° El Licenciado Carlos Fernando Cubero Rojas, apoderado especial judicial de la promovente, interpuso recurso de apelación contra la sentencia a las quince horas diecinueve minutos del veinticinco de marzo del dos mil catorce. (ver escrito folio 123).- 5° En los procedimientos se han observado las formalidades de ley, sin que se note la existencia de errores u omisiones capaces de generar la nulidad de la sentencia.- Redacta la jueza Vargas Vásquez; y,
CONSIDERANDO:
I.Se comparten los hechos tenidos por probados al ser acordes con las probanzas constantes en el expediente, con las siguientes aclaraciones: Se adiciona al primero que la naturaleza del bien aparte de potrero es de bosque, distribuyéndose en pasturas el dieciséis punto setenta y cuatro por ciento de su área y a bosque el restante ochenta y tres punto veintiséis por ciento, así como la certificación de folio 8, la declaración de los testigos [Nombre4] de folio 41, [Nombre5] de folio 41 y [Nombre6] de folio 42; las fotografías de folios 88 a 91 y el acta de reconocimiento judicial de folio 92, como prueba. Se agrega al segundo que la posesión que se transmitió también fue ejercida en forma ininterrumpida con base en la misma prueba ahí citada y la declaración de los testigos [Nombre4] de folio 41, [Nombre5] de folio 41 y [Nombre6] de folio 42; las fotografías de folios 88 a 91 y el acta de reconocimiento judicial de folio 92.
Se adicionan en esta instancia los siguientes hechos probados: 9° El inmueble se encuentra debidamente delimitado mediante cercas en sus colindancias (declaración de los testigos [Nombre4] de folio 41, [Nombre5] de folio 41 y [Nombre6] de folio 42; y acta de reconocimiento judicial de folio 92). 10° La sociedad promovente y la persona que le transmitió los derechos posesorios han protegido el recurso forestal, así como la zona protectora de los ríos que le sirven de colindancia al inmueble (declaración de los testigos [Nombre4] de folio 41, [Nombre5] de folio 41 y [Nombre6] de folio 42; y acta de reconocimiento judicial de folio 92). 11° El ancho de la calle pública que sirve de colindancia al inmueble por el sector sur tiene un ancho de 8.50 metros en el plano, dejándose la previsión de una futura ampliación vial de 5.25 metros a cada uno de los lados (folios 3, 73 y 74). 12° El Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria recomendó mantener con cobertura boscosa las áreas con topografía fuertemente accidentadas, tal y como se ha tenido hasta la actualidad; y dar un uso apropiado a los repastos mediante la rotación del hato de manera que no se produzca un sobrepastoreo del área (folio 8).-
II.No se prohíja el único hecho tenido por indemostrado en la sentencia, al existir prueba en el proceso en sentido contrario a lo ahí indicado.-
III.El licenciado Carlos Fernando Cubero Rojas, apoderado especial judicial de Corporación H.C.F.P. Sociedad Anónima, interpuso recurso de apelación contra la sentencia, mostrándose inconforme por lo siguiente: 1° Alega, el juez no valoró adecuadamente la prueba al afirmar que no logró acreditar el ejercicio de la posesión diez años antes de la creación del área silvestre protegida Península de Nicoya, de 10 de marzo de 1994. Afirma, todos los testigos declararon que conocen el bien desde hace más de cuarenta años, lo cual se remonta a 1973, y detallan en forma clara la cadena de posesión hasta la actualidad, que el bien está debidamente delimitado y que se protege el recurso natural de incendios y se prohíbe la cacería. De igual forma, afirma, con el certificado de uso de suelos se acredita que sobre el bien se ha ejercido el uso conforme del suelo, destinándose el 16.74% a pastizales y el 83.26% a protección de bosque; y con el acta de reconocimiento judicial se demuestra que se ha protegido de manera adecuada el recurso natural. 2° Objeta el argumento del juzgador al señalar que no está claro el lugar donde se ubica el inmueble, pues está representado por un plano en el que se indica cuál es ese lugar.
Aunado a ello, se programaron dos reconocimientos judiciales, y si bien el primero no se realizó porque se hizo en otra finca de su representada por error de la persona que les guió; en el segundo la jueza afirmó que se ajustaba en un todo a la realidad física del inmueble, se respetaba el derecho de vía, estaba delimitado y se ha protegido el recurso natural. Aduce, si el juzgador no le iba a dar credibilidad a este segundo reconocimiento judicial, debió rechazar la solicitud para no hacer incurrir en gastos a su representada ni al Poder Judicial en el traslado de una jueza y una persona técnica judicial. En relación con la limpieza de las rondas indica, en las declaraciones testimoniales se afirma que a éstas se les daba mantenimiento; de ahí, el hecho de que en el reconocimiento judicial no se pudiera constatar ese hecho, es porque se realizó el 17 de mayo de 2013, época para la cual ya había iniciado la época de lluvia, siendo lógico que para ese momento las rondas ya no eran necesarias, pues no corre el fuego en una vegetación verde.
Cita como fundamento las resoluciones emitidas por este Tribunal mediante votos 840-F-09 de las 14 horas 5 minutos del 11 de noviembre y 928-F-09 de las 10 horas 32 minutos del 8 de diciembre, ambas de 2009, referidas a la posesión agroambiental sostenible.-
IV.El artículo 7 de la Ley de Informaciones Posesorias autoriza la titulación de inmuebles ubicados dentro de áreas protegidas, siempre que se acredite el ejercicio de la posesión diez años antes de la vigencia de la ley o decreto que las crea, y demuestre se ha protegido el recurso forestal y mantenido el fundo debidamente delimitado. En este proceso, el representante de la promovente pretende se inscriba a su nombre una finca ubicada en La Balsa de Lepanto de Puntarenas, con una medida de 8 hectáreas 2.880 metros cuadrados, representado por el plano catastrado 6-1522602-2011 (folio 3). Tanto en ese levantamiento topográfico como en la certificación emitida por la Oficina Subregional de Lepanto y Paquera del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservaciones, se indica que el bien se ubica en su totalidad dentro de la Zona Protectora Península de Nicoya, sector Carmona, la cual fue creada mediante Decreto Ejecutivo D-22968-MIRENEM del 10 de marzo de 1994 (folios 3 y 4).
De acuerdo a lo anterior, el representante de la promovente debió demostrar el ejercicio de la posesión antes del 10 de marzo de 1984, haber protegido el recurso forestal y tener el inmueble debidamente delimitado con cercas o carriles; aparte de los demás requisitos que exige la Ley de Informaciones Posesorias. Como prueba documental se aportó escritura fechada 6 de octubre de 2011, en la cual se consignó que [Nombre7] transmitió a [Nombre3] en representación de Corporación H.C.F.P. Sociedad Anónima, los derechos posesorios ejercidos en forma pública, pacífica, ininterrumpida y a título de dueño, por más de veinte años en la finca representada por el plano catastrado P-1522602-2011, los cuales dijo haber adquirido mediante compra que hiciera a [Nombre8] (folio 6). En el escrito inicial, que tiene carácter de declaración jurada, el representante de la promovente afirmó haber poseído el bien desde hace cuarenta años, sumando la posesión ejercida por su anterior dueño, [Nombre7] (folio 13).
Para acreditar la posesión, conforme lo exige el artículo 6 de la Ley de Informaciones Posesorias, se recibió la declaración de tres testigos el 31 de julio de 2012. El deponente [Nombre4] afirmó, conoce la propiedad desde hace 50 años y citó como dueños del fundo a [Nombre8] , quien le vendió a [Nombre7] , y éste a la promovente. Afirmó, el inmueble está destinado a ³charral´, cercado en todos sus rumbos, se hacen chapeas a las rondas y arreglo de cercas, se han cortado ramas para postes por lo que no hay extracción del bien (folio 41). Por su parte, el deponente [Nombre5] dijo conocer el fundo desde hace 40 años, siendo inicialmente propiedad de [Nombre8] quien lo tuvo por veinte años y luego lo vendió a [Nombre7] y éste a la promovente. Agregó, el bien se destina a pastizales y a la conservación, dándole mantenimiento de limpieza y de arreglo de cercas, y el área protegida alrededor de la quebrada está siendo protegida, sin que se reporten daños ambientales en el fundo.
Así mismo, [Nombre6] , dijo conocer en detalle el área donde se gestó la investigación seguida contra [Nombre9] en la sentencia (folio 41 vuelto). Finalmente, [Nombre6] señaló, conoce el bien desde hace cuarenta años, siendo los dueños [Nombre8] y luego [Nombre7] . Agregó, se le da mantenimiento como chapeas en las rondas, por lo que se encuentra delimitada en sus rumbos (folio 42). Se practicó un reconocimiento judicial del bien a las 9 horas 30 minutos del 5 de octubre de 2012 en el que se consignó: "...luego del portillo antes mencionado continúa una trocha sin cercas a los lados que llega a un potrero en muy buenas condiciones de limpieza el cual no se puede identificar si corresponde a no a la finca a titular debido a la inexistencia de cercas o mojones que la separen... en general la finca en la materialidad no se ajusta a la descripción del sitio que se hace en el plano..." (folio 52).
Ante esa situación, el representante del promovente afirmó al Juzgado que se designó a una persona para que acompañara al Despacho el día programado para la audiencia de prueba, pero que ante su "sencillez y falta de información" mostró un terreno que también es del promovente (folio 84). El Juzgado programó un nuevo reconocimiento judicial el 20 de mayo de 2013, en cuya acta se indicó: "El inmueble se encuentra compuesto en su mayoría por bosque o tacotal y en menor proporción por pasturas. La colindancia este se encuentra cercada con postería viva y muerta a tres hilos de alambre en buen estado. Por la colindancia oeste hasta llegar a la quebrada Saltos, hay una cerca de postes vivos y muertos a dos hilos hasta llegar a la quebrada Salto (sic), la cual se observa en buen estado de conservación, las quebradas ubicadas en la colindancia norte y oeste, se observan protegidas con árboles propios de la zona, guácimos y chapermo, entre otros« La finca se ajusta a la descripción del sitio que se hace en el plano catastrado N° 6-1522602-2011." (folio 92).
Se adjuntaron fotografías del inmueble en las que se evidencia la existencia de cercas y de bosque (folios 88 a 91). Finalmente, en la certificación emitida por el Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria se hizo constar que en la finca se ha ejercido el uso conforme del suelo para la actividad que realiza de acuerdo con la metodología aprobada (folio 8). De lo expuesto se desprende que, contrario a lo señalado por el juez de primera instancia, el representante de la promovente sí logró acreditar el ejercicio de la posesión sobre dicho bien diez años antes de la vigencia de la normativa que creó la Zona Protectora Península de Nicoya, sector Carmona, mediante Decreto Ejecutivo D-22968-MIRENEM del 10 de marzo de 1994, pues los testigos declararon el 31 de julio de 2012 que tenían más de 50, 40 y 30 años de conocer el bien, respectivamente, afirmando que desde ese tiempo ya estaba en posesión de quien luego transmitiera los derechos posesorios a la titulante; es decir, conocen el bien desde antes del 10 de marzo de 1984.
Así mismo, se acreditó la protección del recurso forestal y el uso de suelo para el uso del suelo para la actividad que se realiza de acuerdo a la metodología aprobada, conservando las áreas de bosque y la zona protectora aledaña a las quebradas; además, se hizo constar en el segundo reconocimiento judicial que en las colindancias existen cercas que delimitan el fundo. En criterio de esta Sede, el hecho de que el primer reconocimiento judicial se hiciera en un fundo diferente se justifica con el argumento expuesto por el representante de la promovente al afirmar que la persona a quien se le designó acompañar al Despacho se equivocó de finca y los llevó a otra propiedad de la titulante. Es importante advertir que si bien el ancho de la calle pública debe ser de 14 metros conforme al artículo 2 de la Ley General de Caminos Públicos y en este caso se cita un ancho de 8.50 metros en el plano, lo cual se verifica en el estudio que hizo la Municipalidad de Lepanto (folios 73 y 74), se dejó la previsión de una futura ampliación vial de 5.25 metros a cada uno de los lados (folio 3). No podría exigirse al promovente la consignación del ancho requerido debido a que dicha calle no es parte del fundo, sino que culmina donde éste inicia en la colindancia suroeste.-
V.Por lo expuesto, con fundamento en lo dispuesto por los artículos 45 y 50 de la Constitución Política; 1, 2, 6, 7 y 11 de la Ley de Informaciones Posesorias y 1, 2, 6, 26, 54 y 79 de la Ley de Jurisdicción Agraria, deberá revocarse la sentencia y en su lugar, aprobar el proceso de Información Posesoria. Ha de proceder el Registro Nacional de la Propiedad a inscribir como finca independiente, a nombre de la promovente, el inmueble citado, sin perjuicio de terceras personas con mejor derecho.-
No se comparte el Voto de mayoría al aprobar la información posesoria sobre terrenos de importancia de protección biológica, como el presente caso que el inmueble que se titula es terreno de bosque está totalmente dentro de la Zona Protectora de la Península de Nicoya, el objetivo de la declaratoria como zona protectora es la creación de un corredor biológico dada la importancia de la protección de la biodiversidad que existe en esa zona, un inmueble con tales características de bosque, es parte del patrimonio natural del Estado y en este caso no se demostró una posesión decenal ejercida con antelación a la afectación de ese bien como demanial.- El Dominio Público -para el caso que nos interesa- es el conjunto de bienes propiedad pública del Estado, lato sensu, afectados al uso público directo o indirecto, de los habitantes, y sometido a un régimen especial de derecho público y, por tanto, exorbitante del derecho privado.
El dominio público se encuentra conformado por cuatro elementos: subjetivo, objetivo, normativo y teleológico. El elemento subjetivo se refiere al titular del derecho -El Estado-; el elemento objetivo se refiere o se constituye por el bien o los bienes sobre los cuales recae el dominio público -para este caso el inmueble objeto de litigio- ; el elemento normativo determina cuando un bien reúne los requisitos señalados por ley para considerarlo dominical, es el conjunto de normas que lo rigen -elenco de normas que en adelante se dirán-; y el elemento teleológico que se refiere a la finalidad que se persigue al incluir determinado bien dentro del dominio público, qué finalidad pública es asignada al bien -en este caso la protección de los recursos naturales-. Los bienes de dominio público están sometidos a un régimen jurídico especial, se encuentran sujetos a un poder de policía, y se caracterizan esencialmente por su inalienabilidad e imprescriptibilidad.
Por su naturaleza están dirigidos a satisfacer necesidades públicas, este hecho impide que sobre ellos exista tenencia o posesión por parte de particulares o personas privadas, están fuera del comercio del derecho privado. Nuestra Constitución Política en su artículo 121 inciso 14) hace referencia a la Demanialidad indicando qué bienes son susceptibles de ese régimen de propiedad pública, incluso estableciéndose en ese artículo diferentes grados de afectación pública dándose un grado de publicatio intenso y absoluto hasta otros grados menos intenso y se armonizan los derechos de los administrados con las potestades de la Administración. Nuestro Código Civil vigente que data desde el mes de abril de mil ochocientos ochenta y seis, regula las bases más importantes en materia de bienes de dominio público, concretamente en sus artículos 261 al 263. El artículo 262 del citado Código Civil, hace referencia a dos características importantes de los bienes de dominio público: a- las cosas públicas están fuera del comercio, y b- se establece la desafectación al decir que esos bienes no pueden entrar en el comercio privado, mientras legalmente no se disponga así.
Como puede observarse la afectación al régimen de dominio público no depende de la naturaleza del bien, sino de la voluntad del legislador. Mediante voto número 447-91 de las quince horas treinta minutos del 21 de febrero de 1991 la Sala Constitucional manifiesta que la declaración de dominio público del bien se establece por ley, esta declaración no constituye una limitación a la propiedad, de acuerdo con el artículo 45 de la Carta Magna, pues éste artículo se refiere a propiedad privada, y los bienes de dominio público no están sujetos a propiedad privada. El Patrimonio Forestal del Estado, es un bien Demanial regulado en un amplio conjunto normativo en el que históricamente hasta la actualidad se prohíbe a los particulares realizar cualquier tipo de labor dentro de los inmuebles con esa característica y como consecuencia negándoles el derecho de posesión, haciéndose una salvedad en una situación específica que más adelante se dirá.
Se considera como Patrimonio Estatal, -en su condición de Demanio Público que implica los principios de imprescriptibilidad, inalienabilidad, e inembargabilidad-, los terrenos que constituyen Reservas Nacionales que tengan Bosques. Lo anterior encuentra su desarrollo normativo en las citas que a continuación se exponen: 1) El Código Fiscal de 1865 el cual contempla un capítulo referido a los bosques, el cual fue derogado por la Ley General de Terrenos Baldíos Número trece del 6 de enero de 1939 la cual incorporaba prácticamente las mismas disposiciones. Por ejemplo el artículo primero indicaba: "Que los terrenos comprendidos en los límites de la República, que no hayan sido adquiridos o inscritos en propiedad mediante título legítimo por particulares, se presumen baldíos y pertenecen al Estado."Esta ley en general regula la prohibición para poseer e inscribir mediante el trámite de informaciones posesorias las Reservas Nacionales que sean Patrimonio Forestal, en otras palabras no son susceptibles de apropiación por parte de particulares.- La Ley de Tierras y Colonización Número 2825 del 14 de octubre de 1961 mantuvo la misma orientación y se encuentra vigente en la actualidad desde aquella fecha.
Así el artículo 8 de esa Ley de Tierras y Colonización establece: "Exceptuado los casos previstos en esta ley es prohibido a los particulares encerrar con cercas, carriles, o cualquier otra forma los terrenos declarados Reservas Nacionales, derribar montes, establecer construcciones y cultivos o extraer de ellos leña, madera, bejuco, palma, y otros productos con fines de explotación. Todo acto de ese genero, si de previo no se han llenado los trámites legales y obtenido la autorización correspondiente será considerado, según el caso como usurpación de dominio público o merodeo, debiendo las autoridades ordenar la destrucción y remoción de las cercas e impedir el uso de esas tierras, sin lugar a indemnización ni a reclamos por el valor de las mejoras y sin perjuicio de otras responsabilidades que pudieran caber a quienes incurrieren en tales faltas".- Nótese que este artículo sanciona penalmente a aquel que se introdujere a una reserva Nacional para realizar cualquier actividad en esas tierras, por lo que no se le pueda considerar a ésta acto de posesión pues su actividad sería ilegítima.- El artículo 11 de esa misma Ley, establece que pertenecen al Estado en carácter de Reservas Nacionales: "a) Todos los terrenos comprendidos entre los límites de la República que no estén inscritos como propiedad particular, de las Municipalidades o de las Instituciones Autónomas. b-) Los que no estén amparados por la posesión decenal.- c-) Los que por leyes especiales, no hayan sido destinados a la formación de colonias agrícolas.- d-) En general todo los que, no siendo de propiedad particular, no estén ocupados en servicios públicos."- Por su parte el artículo 19 de la Ley Forestal derogada número 4465 del veintitrés de noviembre de mil novecientos sesenta y nueve dispuso: "Quedan afectados a los fines de la presente ley todos los bosques y terrenos forestales ubicados en: "a-) Las tierras consideradas Reservas Nacionales..." Y el artículo 25 de esta misma ley señalaba: "La posesión de los terrenos situados en las Reservas Nacionales y fincas del Estado a que se refiere el artículo 19 de esta Ley, no causará derechos de ninguna especie y la acción reivindicatoria del Estado, por los mismos, es imprescriptible, y la Dirección General Forestal con los medios legales a su disposición, procederá a desalojar de tales terrenos a las personas que los ocupan total o parcialmente, en el caso de que se trate de zonas protectoras, Parques Nacionales, Reservas Forestales, y Reservas Biológicas".- Con estas normas se otorga a los bosques allí mencionados una doble tutela: Primero por su condición de Reserva Nacional, en las que es prohibido realizar cualquier acto posesorio y segundo por constituir Patrimonio Forestal del Estado en el que ningún acto de posesión causará derecho de ninguna especie.
Este aspecto se ve confirmado con el artículo 8 del reglamento a esa ley que dice: "Los terrenos Nacionales comprendidos dentro de las áreas declaradas Reservas Forestales son inalienables, es decir no podrán salir del dominio del Estado, y su posesión no causará derecho de ninguna especie de conformidad con lo dispuesto por los artículos 25, 49 y 57 de la Ley Forestal".- El artículo 80 de la citada Ley Forestal derogada indicaba: "Queda prohibido la invasión y ocupación de terrenos en los Parques Nacionales, Reservas Forestales y Zonas Protectoras. Esta prohibición se extiende hasta las Reservas Nacionales, hasta tanto no se haya determinado su clasificación y transferencia..." El artículo 6 de esta misma ley disponía: " Será sancionado con prisión de seis meses a dos años o con multa de quince a cien días, la persona que: a-) Explote un bosque de patrimonio forestal sin autorización legal correspondiente... b-) Invada un Parque Nacional, Reserva Biológica, Zona Protectora o Reserva Forestal...Si la invasión es en Reservas Nacionales, estará sujeta a lo estipulado en el artículo 227 del Código Penal.-" Como puede observarse los actos posesorios realizados en un bosque patrimonio Estatal resultan ser ilegítimos por lo que no pueden conferir ningún derecho de posesión.- Con la entrada en vigencia de la Ley Forestal Número 7174 del 28 de junio de 1990, se continúa con esta misma filosofía.
En el artículo 32 de la citada ley establece: "El patrimonio forestal del Estado esta constituído por todos los bosques y terrenos forestales de las Reservas Nacionales...". El artículo 33 de esa misma ley dispone: "Los terrenos forestales y bosques que constituyen el Patrimonio Forestal del Estado detallados en el artículo anterior, serán inembargables e inalineables, su posesión por los particulares no causará derecho alguno a su favor y la acción reinvidicatoria del Estado por esos terrenos es imprescriptible.- En consecuencia, no son susceptibles de inscripción en el Registro Público mediante Información Posesoria, su invasión y ocupación será sancionados conforme lo dispuesto en esta Ley".- Con la actual Ley Forestal vigente número 7575 del 5 de febrero de 1996, en su título II regula un capítulo único referido exclusivamente al Patrimonio Natural del Estado, siendo la misma filosofía que se había iniciado desde 1865 con el Código Fiscal, por lo que se reitera en esta nueva normativa que el Patrimonio Natural del Estado estará constituído por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, y las fincas inscritas a nombre de la Administración Pública.
El artículo 14 de la misma ley forestal vigente es enfática en indicar que los terrenos forestales y bosques que constituyen el patrimonio natural del Estado son imprescriptibles, inembargables e inalienables y su posesión por los particulares no causará derecho alguno a su favor. La Ley de Conservación de la Vida Silvestre Número 7317 del 21 de octubre de 1972, en sus artículos 3 y 4, además de la declaratoria como de dominio público e interés público, a la fauna y flora silvestre respectivamente, se indica que la flora y fauna silvestre es parte del Patrimonio Nacional. En este mismo sentido la Ley de Biodiversidad número 7788 del 30 de abril de 1998 en su artículo 6 declara los elementos de la biodiversidad como de dominio público, así como la Ley Orgánica del Ambiente en su artículo 46 que establece la soberanía del Estado sobre la diversidad biológica. Por lo expuesto resulta un imperativo legal negar el derecho de posesión a aquellas personas que realizaran cualquier actividad en terrenos no sometidos a propiedad privada y que estén constituídos por bosques en reservas Nacionales.- A esa prohibición imperativa mediante la Ley Forestal Número 7575 del año 1996, que reforma el artículo 7 de la Ley de Informaciones Posesorias, establece una salvedad a la filosofía que hasta ahora se ha expuesto, y es que se posibilita la titulación de bosques cuando dentro de los mismos se haya desarrollado lo que se entiende como posesión ecológica.
El terreno objeto de esta información posesoria, es Patrimonio Natural del Estado, pues está compuesto por cobertura boscosa, según se desprende del estudio de suelos visible a folios 8 y 9 y reconocimiento judicial de folio 92, en el que se indica el terreno está conformado mayoritariamente por bosque según estudio técnico de suelos y el resto de pastos, lo que implica la naturaleza total del terreno es predominantemente bosque en un 83% - Es es claro dicho terreno es Patrimonio Natural del Estado, desde antes de que se crearan esos Decretos como ya se expuso en el historial normativo supra. Cuando se discute la posesión sobre un bien demanial, sólo cabrá esa discusión cuando se haya adquirido el derecho antes de que se haya declarado el bien como de dominio público. Así mismo, el derecho de propiedad en tales casos sólo podrá obtenerse cuando el titular haya demostrado una posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley que declara el objeto como Patrimonio Natural del Estado.
Como ya se ha expuesto la cronología legal que tutela el Patrimonio Natural del Estado, la ley que debe tomarse en consideración para realizar el cómputo de la posesión decenal de los particulares, es la Ley de Tierras y Colonización número 2825 del 14 de octubre de 1961, normativa actualmente vigente. No debe considerarse el Código Fiscal de 1865 y la Ley de Terrenos Baldíos de 1939, pues fueron normas que hacían referencia al tópico en forma genérica, además que no son disposiciones vigentes en la actualidad, no es sino hasta con la actual Ley de Tierras y Colonización que se viene a definir y regular en forma clara la Propiedad o Patrimonio Natural del Estado. Las leyes posteriores como Ley Forestal y otras que se han citado en este considerando, son complementarias a la referida Ley de Tierras y Colonización. Para el caso concreto, de la prueba testimonial recabada no se demuestra esa posesión decenal en los términos de la normativa aquí expuesta, pues en este sentido es que se consigna este voto salvado, para indicar el promovente debió demostrar diez años de posesión antes de la Ley de Tierras y Colonización, por lo que debió declararse sin lugar la información posesoria revocando el fallo venido en apelación.-
POR TANTO:
Se revoca la sentencia. En su lugar, se aprueba la Información Posesoria. Proceda el Registro Nacional de la Propiedad Inmueble a inscribir como finca independiente, a nombre de Corporación [Nombre1]. Sociedad Anónima, cédula jurídica CED6- , sin perjuicio de terceras personas con mejor derecho, la finca que se describe así: Se ubica en La Balsa de Lepanto, [Dirección4] , cantón primero de la provincia del mismo nombre, con una medida de ochenta y dos mil ochocientos ochenta metros cuadrados; colinda al norte y oeste con la zona protegida de la quebrada Salto, al sur y este con otra finca de la titulante y al sur con calle pública con un ancho de tres metros con cincuenta centímetros lineales y previsión para una futura ampliación vial de cinco metros con veinticinco centímetros lineales a cada lado; graficada en el plano catastrado seis- uno cinco dos dos seis cero dos- dos cero uno uno, a nombre de la promovente.
El inmueble se encuentra destinado a pasturas en un dieciséis punto setenta y cuatro por ciento de su área y a bosque en el restante ochenta y tres punto veintiséis por ciento, ejerciéndose en el fundo el uso conforme del suelo para la actividad que realiza de acuerdo a la metodología aprobada, según certificación de informe técnico emitido por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria. Por recomendación de dicha Institución deben mantenerse con cobertura boscosa las áreas con topografía fuertemente accidentada, tal y como se ha tenido hasta la actualidad; y dar un uso apropiado a los repastos mediante la rotación del hato de manera que no se produzca un sobrepastoreo del área. El inmueble se ubica en su totalidad dentro de la Zona Protectora Península de Nicoya, sector Carmona, la cual fue creada mediante Decreto Ejecutivo D-dos dos nueve seis ocho-MIRENEM del diez de marzo de mil novecientos noventa y cuatro.
La sociedad titulante ha estado en posesión pública, pacífica, ininterrumpida, a título de dueño y de buena fe sobre dicha propiedad desde antes del diez de marzo de mil novecientos ochenta y cuatro, aprovechando la posesión ejercida en esas condiciones por [Nombre7] , cédula CED7 - , mediante escritura pública número doscientos sesenta y tres- catorce del folio ciento cuarenta y uno vuelto del tomo catorce el protocolo del Notario Carlos Fernando Cubero Rojas. Además, la promovente se ha ocupado de mantener cercas en las colindancias y de proteger el recurso forestal existente en el bien.
