4465 of November 25, 1969, and its amendments, is hereby reformed, and its text shall read:

"LEY FORESTAL

General Provisions

Objectives and Definitions

TITLE ONE

139 of July 14, 1941, and its reforms, is hereby amended, and its text shall read:

"Article 7.- When the property to which the information refers is included within an area declared a national park, biological reserve, forest reserve, or protective zone, the title applicant must demonstrate having exercised decennial possession for at least ten years prior to the effective date of the respective law or decree that created the respective wilderness area.

Properties that are outside these areas and that have forests may only be titled if the petitioner demonstrates having possessed them for ten years or more and having protected said natural resource, on the understanding that the property must be duly demarcated with fences or clean lanes.

The cadastral plans provided in possessory information proceedings, without any exception, must be certified by the Dirección General Forestal and the Servicio de Parques Nacionales of the Ministerio de Recursos Naturales, Energía y Minas, which offices shall attest to whether the property sought to be titled is located within or outside those protected areas."

6184 of November 29, 1977, the second paragraph of the first subsection of Article 227 of the Penal Code, Article 57 of the Wildlife Conservation Law, the taxes on roundwood established in municipal patent laws, as well as any other provision that contradicts it.

7138 of November 16, 1989 (Amendment to the Ordinary Budget for 1988) is amended, in the sense that the acquisition of land by direct purchase or expropriation shall be carried out in accordance with the provisions of this law.

TRANSITORY PROVISIONS

New contracts may be granted, in accordance with the cited law, as long as the forest payment certificate (certificado de abono forestal, CAF) established in this law is not fully operational and covering the country's reforestation needs.

The beneficiaries of the contracts shall enjoy the tax incentive established in the final paragraph of Article 7 of Law No. 6184 of November 29, 1977. Beneficiaries of contracts based on the cited Law No. 4465 may not enjoy the advantages granted by this law for reforestation projects contemplated in Chapter III of Title III, except in the case provided for in Article 90, or when the interested party expresses a desire to change the system to new areas where reforestation has not yet begun.

Sawmills and other primary processing industries for roundwood that are operating with a permit from the Dirección General Forestal shall have a period of six months to comply with the provisions of this law.

10940. Said commission shall be composed of five members appointed by the President of the Legislative Assembly. It shall have a period of two months to render its report, which shall be recognized in the first place of the first debates, with priority over any other matter.

"LEY FORESTAL

Objetivos y definiciones

TÍTULO PRIMERO

Disposiciones generales

"Artículo 7º- Cuando el inmueble a que se refiere la información esté comprendido dentro de una zona declarada parque nacional, reserva biológica, reserva forestal o zona protectora, el titulante tendrá que demostrar haber ejercido la posesión decenal con por lo menos diez años de antelación a la fecha de vigencia de la respectiva ley o decreto en que se creó la respectiva área silvestre.

Las fincas que estén fuera de esas áreas y que tengan bosques, solo podrán ser tituladas si el promovente demuestra haberlas poseído por diez años o más y haber protegido dicho recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado con cercas o carriles limpios.

Los planos catastrados que se aporten en diligencias de información posesoria, sin excepción alguna, deberán ser certificados por la Dirección General Forestal y el Servicio de Parques Nacionales del Ministerio de Recursos Naturales, Energía y Minas, dependencias que darán fe de si el inmueble que se pretende titular se encuentra dentro o fuera de esas áreas protegidas."

DISPOSICIONES TRANSITORIAS

Se podrán otorgar nuevos contratos, conforme con la citada ley, mientras tanto el certificado de abono forestal (CAF) establecido en esta ley, no esté en pleno funcionamiento y cubra las necesidades de reforestación en el país.

Los beneficiarios de los contratos gozarán del incentivo fiscal establecido en el párrafo final del artículo 7º, de la ley Nº 6184 del 29 de noviembre de 1977. Los aserraderos y otras industrias de transformación primaria de la madera en rollo, que estén operando con el permiso de la Dirección General Forestal, tendrán un plazo de seis meses para cumplir con las disposiciones de la presente ley.

Dicha comisión estará integrada por cinco miembros de nombramiento del Presidente de la Asamblea Legislativa. Tendrá un plazo de dos meses para rendir el informe, el cual se reconocerá en el primer lugar de los primeros debates, con prioridad sobre cualquier asunto.
