  6. 6The statutory requirements were observed in the conduct of the proceeding, and there are no apparent errors or omissions capable of rendering the judgment null and void.-

CONSIDERATIONS:

I-Proven facts (hechos probados). The proven facts set forth in the judgment under appeal are affirmed because they are supported by evidence.

II- The Office of the Attorney General files an appeal (recurso de apelación) (virtual desk/filings/date 24/06/2016 01:45:00 p.m.) against Judgment N. 2016000087 issued at 14:26 hours on 17 de junio del 2016 (digital case file/documents/date 17/06/2016 02:26:03 p.m.). It raises the following objections:

  • 1)In case files 07-1000209-295-295-CI, 08--100411-295-CI and EXPN1, the petitioner was denied title to the land for which the issuance of a registrable title (título inscribible) is sought in this matter. The property currently has survey plan A-1879582-2016, but in the prior proceedings the property was divided into two sections reflected in survey plans A-1101643-2006 and A-1215271-2008. It states that, in the first two proceedings cited, his claim was rejected because he had failed to demonstrate through testimonial evidence the required possession of the property, which lies within the protected zone (zona protectora). It indicates that a decision of the Agrarian Court affirmed that ruling and partially quotes Voto N. 480-F-10. It argues that a judgment on the merits (resolución de fondo) in proceedings of this nature may be reversed only in plenary proceedings (proceso de conocimiento) or through a motion for nullity (incidente de nulidad), and it invokes decision N. 49-2012-11 of the Contentious-Administrative Court. It objects that the statements made by the petitioner in each of the proceedings he has initiated were made as sworn declarations (declaración jurada) and that he has provided differing accounts. In that regard, it states that in proceedings EXPN2 and EXPN3, in which survey plan A- 1101643-2006 was used, he indicated that he had acquired the property as a gift from his father on 24 de octubre del 2006 and submitted a certified copy of public deed (testimonio de escritura pública) [Nombre8]. It states that, in case file EXPN1 involving survey plan A- 1215271-2008, he claimed to have acquired it as a gift from his father on 29 de setiembre del 2008 and attached a certified copy of public deed [Nombre1]. 227. It argues on appeal that, in this proceeding, it was stated that the entire parcel (14.589 metros cuadrados) was acquired by private gift (donación privada) from [Nombre2] on 2 de diciembre del 2014, and public deed [Nombre1] is provided. 268-25. It notes that the contradictions were identified in the final-hearing brief of 5 de mayo de los corrientes, without the issue being analyzed.
  • 2)The property is located in Zona Protectora Río Toro, created by Decreto Ejecutivo N. 22838- MIRENEN of 9 de febrero de 1994. According to the initial filing and the certified copies of deeds CED10. and 268-25, [Nombre9] remained on the property until 1991 and [Nombre2] (the petitioner’s father) until diciembre del 2014. That is, an occupancy of 23 years. In a submission dated 3 de marzo del 2015, the petitioner indicated that his personal possession had lasted 2 months and 8 days. It alleges that the witnesses’ statements are inconsistent with what the petitioner indicated in this proceeding or the prior ones. It specifies that [Nombre10] and [Nombre11] place the transferor, [Nombre2], in possession for 40 years. It adds that [Nombre12] did not even state how many years the prior possessors had been on the land, and that he alone referred only briefly to the petitioner’s occupancy, stating that “he has possessed it for several years.” It contends that, according to the Court, all elements of the proceeding (filings, testimony and submitted documents) must be consistent for transferred possession (posesión transmitida) to be given effect and deemed credible by the adjudicator. It partially excerpts decisions of this Court on the subject.
  • 3)According to the description of the land in survey plan A-1879589-2016, most of the property lies within the spring protection zone (zona de protección de la naciente) (Article 33 subsection a of the Ley Forestal), and the land-use study (estudio de uso del suelo) describes it as one hundred percent pastureland. This prevents the petitioner from acquiring property rights because the natural resource was not protected. It partially quotes decisions of this Court. It argues that petitioners must be required to protect the resources throughout the entire period of possession, rather than only during the period in which the proceeding is pending. The protected zone has been adversely affected since 1984; nevertheless, by 2010, when the aforementioned decision N. 480-F-10 was issued, no acts consistent with the requirements of Article 7° of the Ley de Informaciones Posesorias had been performed. It requests that the judgment be reversed.

III- As of its entry into force on 13 de febrero de 1996 through the amendment introduced by Ley Forestal N. 7575., Article seven of the Ley de Informaciones Posesorias expressly allowed title to be obtained for land located within protected wildlands (áreas silvestres protegidas), provided that possession for ten years prior to the creation of that zone under any management category (categoría de manejo) is demonstrated. That article has been challenged twice before the Constitutional Chamber, and requests for a declaration of its unconstitutionality have been denied, thereby leaving that provision in force, and no judicial body may disregard its validity. Regarding possession, the representative of the Procuraduría General de la República argues on appeal that the witness statements are not useful for demonstrating the possession exercised by the petitioner and his transferors.

It objects that there are contradictions between the initial filing and the witnesses’ testimony, which does not mention the duration of the petitioner’s possession. It further asserts that there were two prior proceedings in which processing of the application was denied because the required possession could not be demonstrated through testimonial evidence. In light of those arguments, this Chamber will proceed to analyze the testimonial evidence presented and compare it with the initial filing. The record shows that, at the evidentiary hearing (audiencia de recepción de prueba) of 11 de junio del 2015 (digital case file/documents/date 11/06/2015 0143:23 p.m., statements in images 1 through 4), minutes were taken of the witness testimony of [Nombre10] (image 1), [Nombre11] (image 2) and [Nombre12] (image 3). The witness [Nombre10] testified that he was 61 years old and had known the property all his life.

He explained that, from the age of 5, he regularly visited the property to play. He added that he owns a property at [Dirección4], and therefore knew that the parcel had belonged to the petitioner’s father, whose name is also [Nombre2]. He is still alive and has owned adjoining properties for more than 40 years. He also testified that [Nombre9], the title applicant’s grandfather, had possessed the land since the early 1950s and that the transfers had been made by gift. He stated that around 60 years ago the property had been pastureland, like all the others in the area, and that cattle had been kept there. He knows that since the petitioner, [Nombre2], acquired it, the petitioner has instead devoted a substantial portion of it to protecting natural resources. One part, he states, has been allowed to regenerate naturally, and [Nombre13] and [Nombre14] trees have been planted, although the latter have not grown sufficiently because of the climate and elevation and subsequently dry out.

He knows that there is a spring (naciente) at the rear of the land that dries up during the summer and is well protected by trees and plants around it. There are no structures; the land is entirely enclosed with concrete posts and barbed wire, and its frontage along the public road has a wooden fence. He identified the adjoining landowners and stated that he had never observed the petitioner, his father or his grandfather having any dispute concerning this land; possession has been continuous for more than ten years, and [Nombre2] is recognized as the owner. This testimony describes an unbroken chain of possession (cadena posesoria) dating from the 1960s, initially in favor of [Nombre9] (the petitioner’s grandfather), subsequently [Nombre2] (the petitioner’s father), and currently his son, [Nombre2]. In addition, it was stated that the title applicant has undertaken forest regeneration (regeneración boscosa) on part of the property, changing its prior land use (uso del suelo) from cattle raising to regeneration, and that the spring, which he described as seasonal, is protected around its perimeter.

The witness [Nombre11] identified himself as the petitioner’s uncle and stated that he was 79 years old. He testified that he had known the property all his life because it had belonged to his father, [Nombre9], who in turn acquired it from [Nombre15]. He explained that his father divided the property among his children and that [Nombre2], his brother, received the area for which registration is sought. He stated that his brother possessed it for 40 years and used it for cattle raising. He then gave it to his son, [Nombre2], although he understands that the deed was executed years later. He states that the acquirer has devoted it to reforestation and retains a small grassy area where a pair of horses feed. He knows that [Nombre2] has planted young trees of various species. He knows that there is a spring at the rear that dries up during the summer, and he has observed him planting trees around it.

He stated that the property has fences made of dead posts, living posts and barbed wire. It also has a wooden fence facing Calle [Dirección5]. He stated that in his 79 years there had never been any dispute concerning possession of the land. In this Court’s view, this witness establishes that possession of the property has been exercised continuously and peacefully, initially through cattle-raising activities, but that the petitioner has changed its use to reforestation, with only a minimal portion used to graze two horses. A longer chain of possession than that described by the prior witness was recounted, namely: [Nombre15], who sold it to [Nombre9], who possessed it for 40 years and gave it to his son [Nombre2], who in turn gave it to his son [Nombre2], the person seeking title. Importantly, the witness testified that acts to protect the spring—which dries up during the summer—and to reforest the land are being performed.

The prior witness stated the same. Finally, the witness [Nombre12] testified that he was 57 years old and had known the property since he was 12 years old (that is, since 1970). He stated that he knew that the father, [Nombre2], had possessed it for many years and later gave it to the son, [Nombre2]. He stated that the property had previously been used as pastureland and is currently devoted to reforestation and conservation of the spring, for which advice has been sought from MINAE. The property is fully fenced, [Nombre2] is the sole owner, and no disputes concerning the land have ever arisen. The foregoing witness establishes possession exercised since 1970, that the property was possessed by the petitioner’s father and subsequently by his son, the petitioner. He also records that acts to conserve the forest and the seasonal spring located on the land are being performed. It bears repeating that, because the property lies within Zona Protectora Río Toro, created by decree N. 22838 of 9 de febrero de 1994, Article 7 of the Ley de Informaciones Posesorias requires proof of possession respectful of natural resources for at least 10 years before the creation of that protected wildland.

In other words, qualifying possession (posesión idónea) prior to 1984 must be established. Having analyzed these statements, this Court observes that the three witnesses consistently and congruently describe qualifying possession sufficient to obtain title, dating from a period more than ten years before 1994. This satisfies the requirement of Article 7 ibídem concerning the period of possession that must be demonstrated when the property for which title is sought is located within a protected wildland or includes forested land (terrenos boscosos).

IV- Regarding the appellant’s second ground for appeal, which challenges contradictions in the witnesses’ testimony, the contents of public deeds N. 48 and 265-25 submitted as evidence, and statements concerning the applicant for title’s (titulante) period of possession. After analyzing the witness testimony (declaraciones testimoniales) given in these proceedings, the Court compares it with the statements in the initial pleading and the public deeds in order to verify the contradictions alleged by the appellant entity. In the initial pleading (expediente digital/ escritos/ fecha 10/02/2015 01:19:28 p.m.. imagen a 6), [Nombre2] stated that he seeks to register the property shown on survey plan A-1771.919-2014, because he had possessed the parcel since 2 de diciembre del año 2014 pursuant to the deed of gift submitted as evidence, and because the previous possessors had held it under their control for 63 years.

The described acts of possession (actos de posesión) consisted of maintaining fences, clearing undergrowth, and activities related to the operation of the farm. He stated that it had been acquired from [Nombre2], who had acquired it from [Nombre9]. Deed N. 268-25, executed at 17:10 horas del 2 de diciembre del 2014 before a notary public, states that [Nombre2] gives [Nombre2] 63 years of possession over the property for which title is sought. For its part, in deed N. 48 del 15 de enero del 1991, [Nombre9] gives [Nombre2] possession and improvements over the parcel at issue. These gratuitous conveyance documents are consistent with the chain of possession (cadena posesoria) described by the witnesses, insofar as the property was possessed by [Nombre9], who gave it to his son [Nombre2], who in turn gratuitously conveyed it to his son [Nombre2], the petitioner. With respect to the applicant for title’s period of possession stated in the initial pleading (2 meses y 8 días), and the testimony of the witnesses, who referred to much longer periods, based on a comprehensive analysis consistent with the rules of artículo 54 de la Ley de Jurisdicción Agraria, this Court finds that the witnesses’ descriptions show that the petitioner’s period of actual possession (posesión material) did, in fact, begin many years earlier.

This is inferred from their description of the possessory acts (actos posesorios), as well as from the reforestation activities and the protection of the spring (naciente) that they identified and attributed to the applicant for title. This Court does not find any actual contradiction concerning the chain of possession described by the witnesses, because their statements were clear and did not contradict one another. In the initial pleading, the petitioner stated that he had possessed the property for 2 meses y 8 días (expediente digital/ escrito inicial y memorial en documento asociado el 03/03/2015 08:55:33 a.m.). Deed of gift N. 268-25, submitted by the petitioner and through which his father gave him the property, is dated 2 de diciembre del 2014, and these proceedings were filed with the court on 10 de febrero del 2015 (sello de recibido en escrito inicial asociado el 10/02/2015 01:19:28 p.m.).

In other words, [Nombre2] understood that his legal possession (posesión legal) began when his father executed the deed of gift in his favor, whereas the record shows that his actual possession began much earlier. This was stated by the witnesses already cited and analyzed when they referred to the petitioner’s real and actual possession of the land through the performance of conservation and reforestation activities. Note that the witness [Nombre11] expressly stated that his brother [Nombre2] possessed the farm for 40 years and used it for cattle ranching, after which he gave it to his son [Nombre2], although he understands that the deed was executed years later. The appellant’s ground for appeal concerning the applicant for title’s period of possession and the alleged contradiction in that regard is therefore rejected. The argument that survey plan A-1101643-2006 was used in expediente N. EXPN2 y EXPN3, where it was stated that the property had been acquired by gift on 24 de octubre del 2006 and deed CED11. was submitted, and that in proceeding 09- 100240-295-CI title was sought under survey plan A- 21527-2008, where it was stated that the property had been acquired by gift from his father on 29 de setiembre del 2008 and deed CED12. was submitted, is rejected.

In these proceedings, succession of possession (sucesión posesoria) in the chain of conveyance was established, and the deed of gift executed before a notary public was submitted; its legality has not been challenged, nor has any falsity been proven. In the prior proceedings, which were decided based on the contents of each respective case file, registration was denied for the reasons set forth in each judgment on the merits (sentencia de fondo). The gifts submitted in those proceedings were intended to obtain title to land that had been divided into two parcels and depicted on different survey plans, and it is unknown whether any form of transaction was entered into between those parties after the execution of those earlier deeds of gift and before the execution of the deed submitted here. What matters for purposes of these proceedings is that the chain of possession has been established and that possession sufficient to obtain title (posesión idónea para titular) has been demonstrated.

The witness evidence established who successively exercised possession and the absence of any dispute over it throughout so many years. In addition, the deed of gift was submitted for purposes of tacking the possession (aprovecharse la posesión) of the transferors, pursuant to ordinal 1 de la Ley de Informaciones Posesorias. These matters have not been challenged. They have therefore been established before this Court in these proceedings. The judgment under appeal in these proceedings analyzes in depth the legal doctrine of the right to property (instituto del derecho de propiedad), its constitutional implications, and the fact that these proceedings revealed a factual situation different from that involved in the prior proceeding in which the application was denied under expediente [Nombre1]. 09- 100240-295-CI; accordingly, the application was approved.

V - Regarding the third ground of appeal concerning the nature of the land affected by the spring protection area (área de protección de naciente), which the soil study identifies as one hundred percent pastureland. Regardless of their management category (categoría de manejo), protected wildlife areas (áreas silvestres protegidas) must be understood as zones subject to a particular and specific administrative and regulatory regime and governed by management plans (planes de manejo) that ensure the protection, conservation, and rational use of natural resources. Their administration, management, and protection fall to MINAET, unless a special Law provides otherwise. Article 58 of the Biodiversity Law defines them as geographically delimited zones consisting of lands, wetlands, and portions of the sea that are so designated because they possess special significance and because there is an interest in protecting and conserving the environment and its ecosystems, as well as their historical and cultural features.

This provision expressly refers to the Organic Environmental Law regarding the regulation of the requirements and mechanisms for establishing or reducing these areas. By Law, their administration falls exclusively to the Ministerio de Ambiente, Energía y Telecomunicaciones, except for Natural Monuments. The Ley Forestal, in turn, provides that when a state-owned protected wildlife area is declared, it must immediately become part of the State Natural Heritage (Patrimonio [Nombre1] atural del Estado), governed by Article 13 of the aforementioned statute, which expressly states that its administration corresponds to MINAET. That body of law must be interpreted together with Article 58 in fine of the Biodiversity Law, which recognizes the rights acquired by Indigenous and rural communities and by natural or legal persons over lands declared to be protected wildlife areas and their management categories.

This is supplemented by Article 7 of the Possessory Information Law (Ley de Informaciones Posesorias), which states: “When the property to which the possessory title proceeding (información posesoria) refers lies within a protected wildlife area, regardless of its management category, the applicant for title (titulante) must demonstrate that he or she holds legal rights arising from ten-year possession (posesión decenal), exercised for at least ten years before the effective date of the law or decree that created that protected wildlife area.” In this specific case, the land for which title is sought is located within the Zona Protectora Río Toro, created by Decreto Ejecutivo N.22838 MIRENEM del 9 de febrero de 1994. This means that, for the property to be registered, possession dating back to at least February 1984 must be established. The Protected Zone management category was incorporated as such in subsection b) of Article 32 of the Organic Environmental Law.

That legislation omitted to define each of the management categories governed by that provision, and the current Ley Forestal numero 7575 likewise contains no legal definition. The Ministerio de Ambiente, Energía y Telecomunicaciones, for its part, has defined them as: “lands, most of which are suitable for forestry, appropriate for timber production, on which management measures are carried out in accordance with sustainability criteria.” (Table on management categories, as defined by MINAE-SINAC, 2000). As a statutory antecedent, the repealed Ley Forestal número 4465 del 25 de noviembre de 1969 defined a protected zone in Article 83 as: “...those forest areas or forestlands (terrenos forestales) which, established by provisions of law or by decree of the Executive Branch, are intended to protect soils, maintain and regulate the hydrological regime, or act as regulators of the climate or environment.” Subsequently, Ley Forestal 7174 defined it in the same terms, while, as noted, the current Ley Forestal vigente número 7575 del 13 de febrero de 1996 refers neither to this management category nor to any other.

The Procuraduría General de la República, for its part, stated the following regarding the objective or purpose assigned to this management category: “The Ley Forestal número 4465, both before and after its comprehensive amendment, assigned protected zones a clear environmental purpose, since they were established to protect vital natural resources such as soil and water through the conservation and protection of forest resources. The environmental legislation currently in force assigns this same objective to protected zones as a management category for protected wildlife areas, although it does not define the term.” (Dictamen C-323-2004). Likewise, Dictamen C-16-2002 defined it as follows: “The term ‘Protected Zone’ has been used in our legal system as a management category for protected wildlife areas whose primary purpose has been associated with protecting soil resources and the hydrological regime (springs, protection zones, watersheds, etc.).” This Court finds, based on the record to be assessed in this and the following recitals (considerandos), the statutory and technical references, and the testimony of the witnesses, that it cannot be concluded that the petitioner, merely because his property contains pastureland, has failed to exercise possession in accordance with Article Seven of the Possessory Information Law, because he has protected the soil resource, maintains it under forest succession (sucesión forestal), has received advice from MINAE regarding the management of the spring located on his property, and has demonstrated the period of lawful possession.

As stated, the property lies within the aforementioned protected zone. In the case under review, the July 2015 land-use study (estudio de uso de suelo) (expediente digital/ documentos/ fecha 08/07/2015 04:25:40 p.m) recorded that the land was pastureland under forest succession, without livestock use, and located at a high altitude. During the judicial inspection (reconocimiento judicial), the judge described finding land properly demarcated around its entire perimeter, with grass in the sector located between vertices 1 and 5 of survey plan (plano) A- 771919-2014, through which they entered, and vegetation and trees characteristic of high mountain areas farther north. The soil was found to be damp, with heavy fog. The spring was located, and a large number of trees were observed around it. No structures, animals, signs, or traces of timber extraction were observed. It was noted that the water resource was protected, and photographs were taken showing what was observed during the proceeding.

Those photographs are contained in the digital case file, and from them it may be concluded that the lower court’s description is consistent with the physical condition of the land observed. (expediente digital/escritos/ fecha 11/06/2015 08:45:37 a.m.). In addition, Informe N. SB-AID-GA-2015-1188 del 15 de octubre del 2015 states that the spring located on the property has no records of aqueduct intakes and that no use whatsoever is made of its water, nor are there plans or projects that would justify requesting the reservation of the water resource for incorporation into any supply system. (expediente digital/ escritos/ 12/11/2015 02:23:08 p.m.). In other words, the spring protection area is not subject to the public-domain regime (régimen de dominio público) established in Article 31, subsection a), of Ley de Aguas N. 276. Neither the judge’s description nor the observations of the land-use certifier, who recorded finding pastureland under forest succession, reveal any harm to the soil or water resources.

The foregoing must be supplemented by the witnesses’ statements that the petitioner’s father had used the land for cattle and that the applicant for title allowed it to regenerate as forest and conserved the spring located there. Furthermore, a filing submitted to the record contains official communication N. OG-1088 del 16 de junio del 2015, issued by the Sistema Nacional de Áreas de Conservación, Área de Conservación Cordillera Volcánica Central del MINAE, responding to the petitioner’s inquiry regarding management practices for his property in view of the presence of a spring. It sets forth a series of recommendations in that regard. First, it stated that a visit by officials from the Area de Conservación Cordillera Volcánica Central determined that not all of the property lies within the spring protection area, although it does lie within the boundaries of the Zona Protectora Río Toro.

That document states verbatim: “In view of the foregoing, it is important to note that the portion of your property located outside the protection area extending 100 meters in radius around the spring, which is currently used as grazing pasture on flat land alongside the road, is not subject to any legal restriction, except that, if you wish to construct any infrastructure, you must apply to SETENA for environmental approval (Viabilidad Ambiental), because the property is located within the Zona Protectora Toro. The situation is otherwise with the portion of your property located within the 100-meter radius of the protection area surrounding the permanent spring, because it is subject to the provisions of Ley Forestal 7575 and Ley de Conservación de Vida Silvestre 7317..... within those 100 meters, there are restrictions on cutting vegetation, cutting trees, and constructing infrastructure of any kind; therefore, protection practices within this area will consist primarily of fencing off the sector in question to prevent cattle from entering and allowing a process of natural regeneration to occur, which will provide the best protection for the spring, particularly given the wealth of plant life existing at that location. ...” (expediente digital/ escritos/ fecha 24/06/2015 10:10:57 a.m.).

Neither the soil study nor the judicial inspection described any activity that contravened the technical and environmental recommendations issued by the competent MINAE office. Nor has the appellant entity or any interested party submitted any evidence that the petitioner or previous possessors had been warned, sanctioned, or found responsible for violating national environmental protection laws, from which it could be inferred that they breached their obligation to exercise possession in a manner respectful of natural resources when possessing property subject to environmental restrictions because of the nature of that property. In this regard, it should be added that none of the three witnesses stated that timber had been felled or the spring harmed during the period in which they had known the property, which extended more than ten years before 1984. In other words, there was never any land-use change (cambio de uso del suelo) on the properties for which title is sought to the detriment of the environment, from before the creation of the Protected Zone management category at issue through the present, or at least no evidence to that effect appears in the record.

Accordingly, this claim cannot be sustained. It should be noted that each management category has its own technical and scientific purposes, and the existence of any such category cannot be understood as absolutely excluding human production or recreational activities. Those activities are defined in the respective land-use plans (planes de ordenamiento territorial) for each category. In this case, the ground of appeal under review lacks proper substantiation as to why the appellant believes that the existing activities, through the acts currently being carried out, impair the purposes of that zone, and which guidelines, orders, or provisions of the area’s management plan have been violated. It must not be forgotten that, pursuant to Article 82 of the Ley de Conservación de Vida Silvestre and regarding its use and exploitation, Voto N. 144-96 de las 16:51 horas del 9 de enero de 1996.

the Sala Constitucional de la Corte Suprema de Justicia ruled: “Where forest reserves (reservas forestales), protected zones (zonas protectoras), and national wildlife refuges (refugios nacionales de vida silvestre) are established, the owner is given the option of retaining the land because, by following the management plan (plan de manejo), the owner may continue to derive economic benefit from it; that is, the restrictions imposed are not so extensive as to prevent the owner from exploiting the property and therefore do not render the owner’s right meaningless.” In this case, the petitioner has demonstrated use of the property with respect to land use (uso del suelo); the witnesses did not establish that any timber harvesting activities occurred or that any water resources (recursos hídricos) were harmed, nor has it been shown that any environmental damage was caused. The claim of error (agravio) is rejected.

VI- The argument concerning the impossibility of ruling on this proceeding because the applicant’s prior proceedings involving the property had been dismissed is inadmissible. Copies of the decisions in the possessory title proceedings (procesos de información posesoria) previously dismissed as to the applicant seeking title appear in the record. (expediente digital/escritos/fecha 17/06/2015 09:55:32 a.m). Regarding number EXPN4, the first-instance judgment of the Juzgado Civil de Trabajo de Mayor Cuantía de Grecia (image 10) appears in the record, in which the application was dismissed because suitable testimonial evidence had not been submitted to establish the exercise of possession (posesión) for a ten-year period preceding the creation of the Zona Protectora Río Toro, issued at 15 :00 hours on 9 de mayo del 2008. One of the witnesses stated that, one year before the statement given in that proceeding, the applicant had acquired the land from his father.

Those statements are supplemented by those received in this proceeding. There is no contradiction or inconsistency whatsoever regarding the testimony given by the witnesses in this new proceeding. The proceeding conducted under case file EXPN3 was dismissed because the property contained pastureland; in this case, however, that issue was remedied through the submission of technical materials (soil study, MINAE technical recommendations regarding spring (naciente) management and land use) and the findings from the judicial inspection (reconocimiento judicial) conducted in this proceeding, which establish the exercise of possession consistent with the requirements of Article 7 of the Ley de Informaciones Posesorias. (image 18). It should be noted that this property became subject to the protected-zone management category in the year 1994, and the possession exercised up to that date could not be penalized as violating the provisions of section 7 of the Ley de Informaciones Posesorias because the land had pasture and was used for productive livestock farming, since it was only subsequently designated as a protected zone.

The possessor did not violate requirements that were not yet in force in the year 1994, nor was it shown in any way that he had made abusive use of the property or of the natural resources it contains to such an extent as to defeat his right of agricultural ownership (propiedad agraria), which had been consolidated more than forty years ago. It would not be possible to deny him recognition of the longstanding possession that this proceeding established had been exercised by him, his father, and even his grandfather, because the declaration is always made without prejudice to ownership rights already consolidated through acquisitive prescription (usucapión). Nevertheless, as stated, no evidence indicates that there had been any land-use change (cambio de uso de suelo), logging, or harm to the spring after or before the referenced declaration, since the land was said to consist of pasture for cattle and that spring was protected.

It is apparent that the applicant has instead adapted the activity (pasture undergoing forest succession, reforestation, and protection of the spring) to the restrictions imposed on his property when it was incorporated into the Zona Protectora Río Toro in the year 1994. The proceeding in case file EXPN1 was likewise dismissed because the statements were insufficient regarding the length of time for which the witnesses were required to have known the property, but not because anything significantly different from what was verified in this proceeding had been established; thus, far from being conflicting, the evidence from both proceedings is complementary. We do not agree with the appellant’s position that, because the application to register the property through this procedure had already been dismissed, that application may not again be heard through this non-contentious jurisdiction (jurisdicción no contenciosa).

On this issue, this specialized agrarian jurisdiction has ruled: “The judge could not assume powers such as declining to receive the evidence and, in the interest of achieving supposed efficiency for the Judiciary and, paradoxically, also for the applicants, immediately issue a judgment on the merits. The Court must not overlook the fact that the ruling could potentially be appealed, as indeed it was, in which case the Tribunal would not necessarily be required to agree with its reasoning; accordingly, the evidence offered must be received so that, for purposes of issuing the second-instance judgment, it may determine whether the reasoning stated in the appealed decision is or is not well founded. Moreover, and above all, the applicant has the right to attempt to establish through this procedure the possession required by law, and that avenue is not barred merely because another Possessory Title Proceeding was previously denied, since regardless of how many times such an application is filed, it will never acquire the effect of substantive res judicata (cosa juzgada material).

To conclude otherwise would constitute a denial of justice because, as the appellant correctly states, Article 822 of the Código Procesal Civil, applied supplementarily pursuant to section 79 of the Ley de Jurisdicción Agraria, provides the following with respect to judgments issued in non-contentious proceedings: ‘... This decision shall not produce res judicata, even when it has been the subject of a ruling by the higher court, except as expressly provided for probate proceedings and divorce or separation by mutual consent.’”(Voto N. 1033-F-07). Accordingly, the first ground of her appeal is rejected pursuant to Article 822 of the Código Procesal Civil, applied supplementarily, and the effects of formal res judicata (cosa juzgada formal) that it grants to decisions issued in non-contentious judicial proceedings (procesos de actividad judicial no contenciosa).

VII- For the foregoing reasons, pursuant to Articles 1 and 2 of the Ley de Jurisdicción Agraria, 6 and 1 of the Ley de Informaciones Posesorias, and 822 of the Código Procesal civil, the appealed judgment is affirmed as to the matters challenged on appeal.

VIII- DISSENTING OPINION OF JUDGE [Nombre16]: We do not agree with the majority opinion because the applicant did not demonstrate that the natural resource had been protected during the years asserted as valid possession for purposes of acquisitive prescription. That type of ecological possession (posesión ecológica) is what the applicant was required to demonstrate under Article 7 of the Ley de Informaciones Posesorias, in conjunction with Ley Forestal 4465 of 25 de noviembre de 1969 and subsequent regulations governing the public-domain status of forests (demanialidad de los bosques); this becomes even more relevant when the forests perform a function of protecting an ecosystem that gives rise to the designation as a Refugio de Vida Silvestre or Zona Protectora, as in this case, in which the property is located within the Zona Protectora Rio Toro. Remedying the defects in possession after three attempts at possessory title proceedings, by demonstrating care for the resource at the end of the period of possession for which recognition is sought, does not negate the fact that the ten-year possession now to be counted must be valid; at the relevant time it was not, because the water and forest resources had been left unprotected, particularly in an area of high hydrological fragility, as indicated by the Acueductos y Alcantarillados technical study, and one that is difficult to restore—as the applicant itself states.—

POR TANTO

  1. 1La parte promovente interpuso la presente informaci ón posesoria para que por medio de esta vía se proceda a inscribir en el Registro Público de la Propiedad la finca que se describe [Nombre1] así: "...terreno de pasto, en sucesión forestal, con naciente, situado en Alto Palomo, [Dirección1] ° , , Provincia de Alajuela, con un área de CATORCE MIL QUINIENTOS OCHENTA Y NUEVE metros cuadrados, según plano catastrado número A- 1879589- 2016, tiene actualmente a los siguientes linderos: NORTE: [Nombre2] ; SUR: calle pública con un frente de 92.36 metros lineales; ESTE: [Nombre2] , [Nombre3] y [Nombre4] ; y al OESTE: [Nombre5] y [Nombre6] , situado en 100% en Zona Protectora Río Toro, creada mediante Decreto Ejecutivo 22838 MIRENEM del 9 de febrero de 1994. " , ( Ver Escritorio Virtual del Juzgado Agrario del Tercer Circuito Judicial de Alajuela, San Ramón, escritos, de las trece horas diecinueve minutos con veintiocho segundos del diez de febrero del dos mil quince, Asociar Demanda Inicial/Incorporar Documento Externo - 10-02-2015 13:19:28, de las ocho horas cincuenta y cinco minutos con treinta y tres segundos del tres de marzo del dos mil quince, Escrito Electrónico/Mar 3 2015 8:55AM/NI, y de las diez horas quince minutos con veintiuno segundos del dos de marzo del dos mil dieciséis, Incorporar Escrito - ESCRITO PRINCIPAL DE 1 F, SOLICITUD CANC PLANO, FOTOC PLANO/Agregar documento - 02 Mar 2016 10:15AM; y documentos asociados, de las catorce horas veintiséis minutos con tres segundos del diecisiete de junio del dos mil dieciséis, Sentencia primera instancia (plantilla) (actualiza fase conclusiva)/EV=17/06/2016 14:27 ).-
  2. 2La Procuraduría General de la República , el Instituto de Desarrollo Rural y la Municipalidad de Valverde Vega se aperson aron al proceso (Ver Escritorio Virtual del Juzgado Agrario del Tercer Circuito Judicial de Alajuela, San Ramón, escritos; de las catorce horas treinta y dos minutos con treinta y cinco segundos del diecinueve de mayo del dos mil quince, Incorporar Escrito - ESCRITO PGR-[1,36MB] /Agregar Documento -May 19 2015 2:32PM; de las ocho horas veinte minutos con cinco segundos del veintiséis de mayo del dos mil quince, Incorporar Escrito - ESCRITO INDER-[1,13MB] /Agregar Documento -May 26 2015 8:20AM; y de las quince horas quince minutos con veintiuno segundos del cinco de octubre del dos mil quince, Incorporar Escrito - ESCRITO PRINCIPAL 01 FOLIO, APORTA: CERTIF DE PERSONERÍA JURÍDICA DEL ALCALDE, FOTOCOPIAS 05 FOLIOS/Agregar documento - 05 Oct 2015 03:15PM, respectivamente).-

3 .- El juez Carlos Eduardo González Mora, del Juzgado Agrario del Tercer Circuito Judicial de Alajuela , San Ramón, mediante la sentencia N° 2016000087, de las catorce horas veintiséis minutos del diecisiete de junio del dos mil dieciséis , resolvió: “POR TANTO: De acuerdo a lo expuesto y citas de ley SE APRUEBAN las presentes diligencias de información posesoria; trámite que se cumplió apegado a la Ley de Informaciones Posesorias Nº 139 del catorce de julio de 1941, sus reformas y adiciones, Ley de Jurisdicción Agraria Nº 6734 del veinticinco de marzo de 1982 y sus reformas. En consecuencia, libre de gravámenes y cargas reales, sin condueños y sin perjuicio de terceros de mejor derechos, proceda el Registro Público, Sección Propiedad Inmueble, a inscribir a nombre de [Nombre7] , mayor, casado en primeras nupcias, comerciante (SIC), cédula de identidad número CED9 - - , vecino de Sarchí Norte, el inmueble que se describe así: terreno de pasto, en sucesión forestal, con naciente, situado en Alto Palomo, [Dirección2] ° , [Dirección3] Vega, Provincia de Alajuela, con un área de CATORCE MIL QUINIENTOS OCHENTA Y NUEVE metros cuadrados, según plano catastrado número A- 1879589- 2016, tiene actualmente a los siguientes linderos: NORTE: [Nombre2] ; SUR: calle pública con un frente de 92.36 metros lineales; ESTE: [Nombre2] , [Nombre3] y [Nombre4] ; y al OESTE: [Nombre5] y [Nombre6] , situado en 100% en Zona Protectora Río Toro, creada mediante Decreto Ejecutivo 22838 MIRENEM del 9 de febrero de 1994.- El terreno se adquirió por donación.

Se estimó el inmueble en doscientos cincuenta mil colones. Queda afecto el inmueble a las reservas en cuanto a derechos de vía que disponen los artículos 4 de la Ley General de Caminos Públicos y 19 inciso a) de la Ley de Informaciones Posesorias. El área contigua a las corrientes constituye área de protección según el artículo 33, lnciso b) de la Ley Forestal N° 7575 y queda prohibida la corta o eliminación (SIC) de árboles (artículo 34 ibídem). El cauce y las aguas de esa corrientes son de dominio público (Ley de Aguas, artículos 1, inciso IV, y 3, inciso III; artículo 50 Ley Orgánica del Ambiente). Firme esta resolución, expídase la certificación correspondiente.", ( Ver Escritorio Virtual del Juzgado Agrario del Tercer Circuito Judicial de Alajuela, San Ramón, documentos asociados, de las catorce horas veintiséis minutos con tres segundos del diecisiete de junio del dos mil dieciséis, Sentencia primera instancia (plantilla) (actualiza fase conclusiva)/EV=17/06/2016 14:27 ). - 4 .- E l Juzgado Agrario del Tercer Circuito Judicial de Alajuela , San Ramón, mediante la resolución de las quince horas cuatro minutos del veintiuno de junio del dos mil dieciséis, se corrige el error material de la sentencia N° 2016000087, de las catorce horas veintiséis minutos del diecisiete de junio del dos mil dieciséis, en cuanto el nombre correcto del promovente es [Nombre2] , y no [Nombre7], como por error se consignó, (Ver Escritorio Virtual del Juzgado Agrario del Tercer Circuito Judicial de Alajuela, San Ramón, documentos asociados, de las quince horas cuatro minutos con cincuenta y siete segundos del veintiuno de junio del dos mil dieciséis, Corrige error material/EV=21/06/2016 15:06).- 5 .- La licenciada Susana Fallas Cubero, en su condición de procuradora, interpuso recurso de apelación con indicación expresa de las razones en que se fundamenta para refutar la tesis del juzgado de instancia, (Ver Escritorio Virtual del Juzgado Agrario del Tercer Circuito Judicial de Alajuela, San Ramón, escritos, de las trece horas cuarenta y cinco minutos con cero segundos del veinticuatro de junio del dos mil dieciséis, y de las quince horas treinta y siete minutos con nueve segundos del veintiocho de junio del dos mil dieciséis, REUBICADO->Incorporar Escrito - ESCRITO DE PROCURADURÍA-[2,88MB] /Agregar Documento -Jun 24 2016 1:45PM; Incorporar Escrito - ESCRITO PGR-[6,96MB] /Agregar Documento -Jun 28 2016 3:37PM).- 6 .- En la substanciación del proceso se han observado las prescripciones legales, y no se nota la existencia de errores u omisiones capaces de producir la nulidad del fallo.- Redacta la jueza Castro García;y,

CONSIDERANDOS:

I-H echos probados . Se avalan los hechos probados de la sentencia recurrida por contener prueba que les da sustento.

II- El ente procurador interpone recurso de apelación ( escritorio virtual/ escritos/fecha 24/06/2016 01:45:00 p.m.) contra la sentencia N. 2016000087 de las 14:26 horas del 17 de junio del 2016 ( expediente digital/ documentos/fecha 17/06/2016 02:26:03 p.m). Como reproches invoca:

  • 1)En los expedientes 07-1000209-295-295-CI, 08--100411-295-CI y EXPN1, al promovente se le denegó la titulación del terreno que en este asunto se solicita expedir título inscribible. ACtualmente el fundo cuenta con el plano A-1879582-2016, pero en los procesos anteriores la finca estaba dividida en dos secciones reflejadas en los plano A-1101643-2006 y A-1215271-2008. Menciona, en los dos primeros procesos citados se rechazó su pretensión por no haber demostrado con prueba testimonial su posesión requerida de la finca que esta inmersa en la zona protectora. Indica, en voto del Tribunal Agrario se confirmó esa resolución y cita parcialmente el Voto N. 480-F-10. Aduce, la resolución de fondo de un proceso de esta naturaleza puede ser revertido solamente en proceso de conocimiento o por un incidente de nulidad e invoca voto del Tribunal Contencioso Administrativo N. 49-2012-11. Reprocha, las manifestaciones en cada uno de los procesos que ha instado el promovente lo han sido con el carácter de declaración jurada y ha dado versiones diversas. Al respecto señala que en proceso EXPN2 y EXPN3 donde se utilizó el plano A- 1101643-2006 indicó haber adquirido por donación de su padre el 24 de octubre del 2006 y aportó testimonio de escritura pública [Nombre8]. Menciona, en el expediente EXPN1 con plano A- 1215271-2008 afirmó haber adquirido por donación de su padre el 29 de setiembre del 2008 y adjuntó testimonio de escritura pública [Nombre1]. 227. Apela, en este proceso se manifestó que todo el terreno (14.589 metros cuadrados) se adquirió por donación privada de [Nombre2] el 2 de diciembre del 2014 y suministra la escritura pública [Nombre1]. 268-25. Apunta que las contradicciones fueron advertidas en el escrito de audiencia final del 5 de mayo de los corrientes sin que analizara el punto.
  • 2)El inmueble se ubica en la Zona Protectora Río Toro, creada por Decreto Ejecutivo N. 22838- MIRENEN del 9 de febrero de 1994. Según es escrito inicial y testimonios de la escritura CED10. y 268-25 [Nombre9] se mantuvo en el fundo hasta 1991 y [Nombre2] (padre del promovente) hasta diciembre del 2014. Es decir, una ocupación de 23 años. En memorial del 3 de marzo del 2015 el promovente indicó que su posesión personal había sido de 2 meses y 8 días. Acusa, los testigos no son congruentes con lo indicado por el promovente en este proceso o los anteriores. Detalla, [Nombre10] y [Nombre11] ubican al transmitente [Nombre2] en una ocupación de 40 años. Agrega, [Nombre12] ni siquiera declaró los años en que estuvieron en el terreno los anteriores poseedores y solo él se refiere someramente a la ocupación del promovente, manifestando que "lo posee hace varios años." Recrimina, acorde con el Tribunal debe mediar congruencia entre todos los elementos del proceso (escritos, testimonios y documentos aportados) para poder hacer valer la posesión transmitida y merezcan credibilidad a la persona juzgadora. Extracta parcialmente votos de este Tribunal sobre el tema.
  • 3)Según la descripción del terreno con plano A-1879589-2016 la mayor parte del fundo se ubica dentro de la zona de protección de la naciente (artículo 33 inc. a de la Ley Forestal) y el estudio de uso del suelo lo describe en un cien por ciento como potrero. Lo que le impide al promovente adquirir derechos de propiedad por no haberse protegido el recurso natural. Cita parcialmente votos de este Tribunal. Argumenta, la protección de los recursos debe exigirse a las personas promoventes durante toda la posesión y no restringirse al periodo en que se tramita el proceso. Se afectó la zona protectora desde 1984, sin embargo al 2010 cuando se dictó el voto N. 480-F-10 citado inicialmente, no se habían ejercido actos acordes con lo exigido en el artículo 7° de la Ley de Informaciones Posesorias. Pide sea revocada la sentencia.

III- El artículo sétimo de la Ley de Informaciones Posesorias estableció a partir de su entrada en vigencia el 13 de febrero de 1996 por reforma de la Ley Forestal N. 7575., la posibilidad expresa de titular terrenos ubicados dentro de áreas silvestres protegidas siempre que se demuestre la posesión diez años antes de la creación de esa zona en cualquiera de las categorías de manejo. Dicho artículo ha sido, en dos ocasiones, cuestionado ante la Sala Constitucional y se ha rechazado la declaratoria de su inconstitucionalidad dejando vigente así esa norma, sin que ningún órgano judicial pueda desconocer su vigencia. (ver última consulta constitucional en Sentencia N.01667 del 27/01/2010 de las 15:11: de la Sala Constitucional). Sobre la posesión, el representante de la Procuraduría General de la República apela, las declaraciones de las personas testigas no resultan útiles a fin de demostrar la posesión ejercida por el promovente y sus transmitentes.

Reprocha, debido a contradicciones con el escrito inicial y lo declarado por los testigos donde no se hace mención del tiempo de posesión del promovente. Además de invocar han mediado dos procesos anteriores donde se ha denegado el tramite por la imposibilidad de demostrar con prueba testimonial la posesión requerida. Dados esos alegatos, se avocará esta Cámara analizar la prueba testimonial vertida y contrastarla con el escrito inicial. Consta que en audiencia de recepción de prueba del 11 de junio del 2015 (expediente digital/documentos/fecha 11/06/2015 0143:23 p.m. declaraciones en imágenes 1 a 4), se levantaron actas de las declaraciones testimoniales de [Nombre10] (imagen 1), [Nombre11] (imagen 2) y [Nombre12] (imagen 3). El testigo [Nombre10] declaró tener 61 años y conocer el fundo de toda su vida. Explica, desde que tenía 5 años de edad frecuentaba el inmueble para ir a jugar. Agrega, tiene una finca a [Dirección4] y por ello le constaba que la heredad le perteneció al padre del promovente cuyo nombre es también [Nombre2] .

Que aún vive y posee propiedades colindantes desde hace más de 40 años. Depuso, a su vez [Nombre9] , abuelo del titulante había poseído el terreno desde principio de los años 50 y los traspasos se han efectuado por donación. Afirmó, hacia 60 años la finca había sido un potrero, al igual que todas las demás de la zona y había ganado. Le consta que desde que el promovente [Nombre2] la adquirió, más bien ha dedicado buena parte a la protección de los recursos naturales. Una parte, señala, se ha dejado regenerar de forma natural y se han sembrado árboles de [Nombre13] y [Nombre14], aunque en el caso de éstos últimos por razones de clima y altura no han crecido lo suficiente y luego se secan. Sabe que al fondo del terreno hay una naciente que se seca en verano y esta bien protegida con árboles y plantas a su alrededor. No hay construcciones, se encuentra el terreno cercado en su totalidad con postes de cemento y alambre de púas, y al frente a calle pública con cerca de madera.

Identificó a las personas colindantes y señaló nunca haber observado que el promovente, su padre y abuelo hubieran tenido problemas por este terreno; siendo una posesión continua por más de diez años y al que se conoce como el dueño es a [Nombre2]. Este testimonio describe una cadena posesoria de forma contínua desde los años 60, primero a favor de [Nombre9] (abuelo del promovente), en forma posterior [Nombre2] (padre del promovente) y actualmente por su hijo [Nombre2] . Aunado a lo anterior, se indicó que ha sido desarrollada por el titulante una actividad de regeneración boscosa en parte de la finca, cambiando el uso anterior del suelo de ganado a regeneración y estar la naciente que calificó de inverniz protegida a su alrededor. El testigo [Nombre11] , se identificó como tío del promovente e indicó tener 79 años. Declaró conoce el fundo toda su vida, pues eran de su padre [Nombre9] ; que a su vez la adquirió de [Nombre15] .

Describió, su padre procede a dividir el fundo entre sus hijos y a [Nombre2] , su hermano, le correspondió la zona que se pretende inscribir. Indicó, su hermano la poseyó por 40 años y la dedicó a la ganadería. Luego se la donó a [Nombre2] su hijo, pero entiende que se suscribió la escritura años después. Menciona, el adquirente la ha dedicado a la reforestación y tiene un pequeño sector de pasto donde se alimentan un par de caballos. Sabe, [Nombre2] ha sembrado arbolitos de diversas especies. Le consta, existe una naciente al fondo que se seca en verano y lo ha observado cultivando árboles a su alrededor. Señaló, la finca tiene cercas de postes muertos, vivos y alambre de púas. Además de una cerca de madera frente a la calle [Dirección5]. Manifestó que en sus 79 años nunca ha habido problema alguno por la posesión del terreno. Para este Tribunal, este testigo acredita que se ha ejercido posesión sobre el fundo de forma contínua, pacífica y ejerciendo en primer lugar actividades de ganadería, pero que el promovente ha cambiado a reforestación y una mínima parte al pastoreo de dos caballos.

Se describió una cadena posesoria mayor que la citada por el anterior testigo, a saber [Nombre15] que lo vendió a [Nombre9] que la poseyó por 40 años, quién le donó a su hijo [Nombre2] y éste a su hijo [Nombre2] ; que solicita titular. De importancia, se declaró que se ejercen actos de protección de la naciente que se seca en verano y de reforestación. Lo mismo indicó el testigo anterior. Finalmente, el testigo [Nombre12] , depuso tener 57 años y conocer el fundo desde que tenía 12 años de edad (sea desde el año 1970). Indicó saber que [Nombre2] padre poseyó por muchos años y luego le donó a [Nombre2] hijo. Mencionó, anteriormente la finca se dedicó a potrero y en la actualidad a reforestación y conservación de la naciente y para ese fin se ha buscado para ello asesoría por el MINAE. El fundo se encuentra cercado totalmente, [Nombre2] es el único dueño y nunca se han suscitado problemas por el terreno.

El anterior declarante acredita la posesión ejercida desde el año 1970, haber sido poseída por el padre del promovente y luego por su hijo, el promovente. Además de consignar se ejercer actos de conservación del bosque y la naciente inverniz que se ubica en el terreno. Cabe reiterar que al estar inmersa la finca dentro de la Zona Protectora Río Toro creada por decreto N. 22838 de 9 de febrero de 1994, acorde con el artículo 7 de la Ley de Informaciones Posesorias, se debe acreditar una posesión en respecto de los recursos naturales al menos 10 años antes de la creación de esa área silvestre protegida. Es decir, se debe acreditar una posesión idónea anterior al año 1984. Analizadas estas declaraciones, observa este Tribunal que los tres testigos son coincidentes y congruentes en describir una posesión idónea para titular que data de un periodo mayor al decenal antes de 1994. Cumpliendo con la exigencia del artículo 7 ibídem respecto del tiempo a demostrarse en posesión en caso de ubicarse el fundo a titular dentro de un área silvestre protegida o con terrenos boscosos.

IV- Sobre el agravio segundo del apelante que ataca contradicciones de lo declarado por los testigos, el contenido de las escrituras públicas aportadas N. 48 y 265-25 y manifestaciones del período de posesión del titulante. Analizadas las declaraciones testimoniales vertidas en este proceso, se procede a contrastarlas con las manifestaciones del escrito inicial y las escrituras públicas a fin de verificas las contradicciones acusadas por el ente apelante. En el escrito inicial (expediente digital/ escritos/ fecha 10/02/2015 01:19:28 p.m.. imagen a 6), se indicó por [Nombre2] que solicita inscribir finca reflejada en plano A-1771.919-2014 por haber poseído el fundo desde el 2 de diciembre del año 2014 por donación que aporta y que los anteriores poseedores la mantuvieron bajo su dominio por 63 años. Los actos de posesión descritos lo fueron mantenimiento de cercas, chapea, y lo relacionados con el funcionamiento de la finca.

Describió, fue adquirida de [Nombre2] y éste de [Nombre9] . La escritura N. 268-25 de las 17:10 horas del 2 de diciembre del 2014 otorgada ante notario público, consigna que [Nombre2] dona a [Nombre2] una posesión de 63 años sobre la finca a titular. Por su parte, en la escritura N. 48 del 15 de enero del 1991, [Nombre9] le dona la posesión y mejoras a [Nombre2] el fundo de interés. Estos documentos de traspaso a título gratuito se muestran coincidentes con la cadena posesoria descrita por los testigos, en cuando se poseyó la heredad por [Nombre9] , que le donó a su hijo [Nombre2] y éste a su vez le transmite a título gratuito a su hijo [Nombre2] , el promovente. Respecto al tiempo de posesión indicado en el escrito inicial del titulante ( 2 meses y 8 días) y lo manifestado por las personas testigas que refieren a períodos mucho mayores, bajo un análisis integral y acorde con las reglas del artículo 54 de la Ley de Jurisdicción Agraria, estima este Tribunal que de lo descrito por las personas testigas se nota que efectivamente el plazo de posesión material del promovente data de muchos años antes.

Ello se deduce de la descripción que hacen de los actos posesorios, así como de la actividad para reforestación y protección de naciente que identifican y endilgan al titulante. No entiende esa Cámara medie una contradicción real en cuanto a la cadena posesoria que describen los testigos pues fueron claros en sus afirmaciones, sin que se contradijeran entre ellos. En el escrito inicial se citó por el promovente que se tenía de poseer 2 meses y 8 días ( expediente digital/ escrito inicial y memorial en documento asociado el 03/03/2015 08:55:33 a.m.). La escritura de donación N. 268-25 aportada por el promovente donde le dona su padre, tiene fecha el 2 de diciembre del 2014 y este proceso se presenta ante estrados judiciales el 10 de febrero del 2015 (sello de recibido en escrito inicial asociado el 10/02/2015 01:19:28 p.m.). Es decir, que [Nombre2] entendió que su posesión legal inició cuando su padre suscribe a su favor la escritura de donación, cuando de los autos se deduce que su posesión material inició mucho antes.

Así lo indicaron los testigos ya citados y analizados, cuando refieren a una posesión real y material del promovente en el terreno ejerciendo actos de conservación y reforestación. Nótese que el testigo [Nombre11] , de forma expresa manifestó que su hermano [Nombre2] poseyó la finca por 40 años y la dedicó a la ganadería, luego se la donó a [Nombre2] su hijo, pero entiende que se suscribió la escritura años después. Por lo que se rechaza el agravio de la apelante en cuanto al periodo de posesión del titulante y la contradicción al respecto. Sobre lo argumentado respecto a que en el expediente N. EXPN2 y EXPN3 se utilizó el plano A-1101643-2006 y se manifestó fue adquirida por donación el 24 de octubre del 2006 y se aportó escritura CED11. y en proceso 09- 100240-295-CI se pretendió titular bajo el plano A- 21527-2008 y se manifestó haber adquirido por donación de su padre el 29 de setiembre del 2008 y se aportó la escritura CED12. , se rechaza.

En este proceso, se acreditó la sucesión posesoria en la cadena de transmisión y se aportó el titulo de donación suscrito ante notario público que no ha sido cuestionada su legalidad ni se ha demostrado falsedad alguna. En los procesos anteriores en los cuales se resolvió con lo que en autos constaba en cada uno de los expedientes se resolvió denegar la inscripción por lo expuesto en cada sentencia de fondo. Las donaciones ahí aportadas lo eran para la titulación del terreno que estaba separado en dos fundos y con otros planos, sin saber si entre la suscripción de esas anteriores donaciones y la aquí aportada se celebró alguna forma de negociación entre esas partes. Lo que interesa a efectos de este proceso, es tener por acreditada la cadena posesoria y por demostrada la posesión idónea para titular. Con prueba testimonial se demostró quienes han ejercido la posesión de forma sucesiva y la ausencia de conflicto alguno por la misma a lo largo de tantos años.

Además de haberse aportado el documento de donación a efectos de aprovecharse la posesión de los transmitentes, al tenor del ordinal 1 de la Ley de Informaciones Posesorias. Mismos que no ha sido cuestionado. Lo que para esta sede en este proceso esta demostrado. En la sentencia recurrida en este proceso se analiza a profundidad el instituto del derecho de propiedad, sus implicaciones constitucionales y el hecho de que en este proceso se ha encontrado una realidad material diversa a la relacionada con el proceso anterior donde se denegó el proceso bajo expediente [Nombre1]. 09- 100240-295-CI, por lo que se procedió a su aprobación.

V - Sobre el agravio tercero respecto a la naturaleza del terreno afectado a área de protección de naciente y que el estudio se suelo lo identifica como cien por ciento de potrero. Sobre las áreas silvestres protegidas, independientemente de su categoría de manejo, deben ser entendidas como zonas con un régimen de administración y normativa particular y específica, supeditadas a planes de manejo que aseguran su protección, conservación y uso racional de los recursos naturales. Recae en el MINAET su administración, manejo y tutela, salvo Ley especial que indique otra situación. El artículo 58 de la Ley de Biodiversidad, las define como zonas geográficas delimitadas, que se forman de terrenos, humedales y porciones de mar, declaradas como tales por representar una significancia especial, un interés de tutela y conservación del ambiente y sus ecosistemas, así como históricos y culturales. Esta norma hace una remisión expresa a la Ley Orgánica del Ambiente sobre la regulación de los requisitos y mecanismos para el establecimiento o reducción de estas áreas.

La administración por Ley recae en forma exclusiva sobre el Ministerio de Ambiente, Energía y Telecomunicaciones, salvo los Monumentos Naturales. Por su parte, la Ley Forestal prevé que cuando se declare un área silvestre protegida de propiedad estatal, ésta debe pasar en forma inmediata a formar parte del P atrimonio [Nombre1] atural del Estado, regulado por el artículo 13 de la citada norma que expresamente señala que su administración corresponde al MINAET. Ese conjunto normativo debe interpretarse con lo prescrito en el artículo 58 in fine de la Ley de Biodiversidad, que reconoce los derechos adquiridos por poblaciones indígenas, campesinas, personas físicas o jurídicas, sobre los terrenos que sean declarados áreas silvestres protegidas y sus categorías de manejo. Ello se complementa con el artículo 7 de la Ley de Informaciones Posesorias cuando indica: "Cuando el inmueble al que se refiera la información posesoria esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser el titular de los derechos legales sobre posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre." En el caso concreto estamos ante un terreno que se piden titular, ubicado dentro de la Zona Protectora Río Toro creada por decreto ejecutivo N.22838 MIRENEM del 9 de febrero de 1994.

Lo que conlleva a entender que para poder ser inscrito debe acreditarse una posesión al menos desde el mes de febrero de 1984. La categoría de manejo de Zona Protectora, se incorporó como tal en el inciso b) del artículo 32 de la Ley Orgánica del Ambiente. Dicha normativa omitió definir el concepto de cada una de las categorías de manejo que reguló dicho numeral y la actual Ley Forestal numero 7575 tampoco cuenta con una definición legal. Por su parte, el Ministerio de Ambiente, Energía y Telecomunicaciones las ha definido como: " como terrenos, en su mayoría, de aptitud forestal, apropiados para la producción de madera, en los cuales se ejecutan acciones de manejo con criterios de sostenibilidad.” (Cuadro sobre categoría de Manejo, definidas por MINAE-SINAC, 2000). Como antecedente normativo, la Ley Forestal número 4465 del 25 de noviembre de 1969, derogada, definió a la zona protectora en el artículo 83 como: “….aquellas áreas de bosques o terrenos forestales que, establecidas por disposiciones de la ley o por decreto del Poder Ejecutivo, sean destinadas a proteger los suelos, mantener y regular el régimen hidrológico, o actúen como agentes reguladores del clima o medio ambiente.”.

Posteriormente, la Ley Forestal 7174 la definió en los mismos términos indicados, mientras que, como fue señalado, la Ley Forestal vigente número 7575 del 13 de febrero de 1996, no hace referencia ni a esta categoría de manejo, ni a ninguna otra. Por su parte, la Procuraduría General de la República, indicó sobre el objetivo o propósito asignado a esta categoría de manejo: "Ahora bien, la Ley Forestal número 4465, antes y después de su reforma integral, asignaban a las zonas protectoras un claro propósito ambiental, pues la mismas se constituían con el objetivo de proteger recursos naturales vitales como el suelo y el agua mediante la conservación y protección de los recursos forestales. La legislación ambiental actualmente vigente asigna este mismo objetivo a las zonas protectoras, como categoría de manejo de las áreas silvestres protegidas, aunque no defina el término.”(Dictamen C-323-2004).

En igual sentido, por dictamen C-16-2002 se definió : “El t é rmino de “Zona Protectora” ha sido usado en nuestro ordenamiento jurídico como una categoría de manejo de áreas silvestres protegidas cuyo fin primordial ha estado asociado con la protección del recurso suelo y del régimen hidrológico (nacientes, zonas de protección, cuencas hidrográficas, etc).” Estima esta sede, de lo que consta en autos a valorarse en los siguientes considerandos y éste , las referencias normativas y técnicas y lo declarado las personas testigas no se concluye el promovente, al contener zona de pastos en su fundo, ha incumplido el ejercicio de la posesión en los términos del numeral sétimo de la Ley de Informaciones Posesorias, pues ha protegido el recurso suelo , lo tiene en sucesión forestal y ha sido asesorado por el MINAE en su manejo en cuanto la naciente existente en su fundo, y demostrar el periodo de posesión legal.

Como se citó, el fundo esta dentro de la zona protectora aludida. En el caso en estudio, en el estudio de uso de suelo de julio del 2015 (expediente digital/ documentos/ fecha 08/07/2015 04:25:40 p.m) se consignó el terreno es de potrero en sucesión forestal, sin uso pecuario y ubicado a una gran altitud. En el reconocimiento judicial se describió por el juzgador, haber encontrado un terreno debidamente delimitado en todo su contorno, con pasto en el sector ubicados en los vértices 1 a 5 del plano A- 771919-2014 por donde ingresaron y al avanzar al norte, contiene vegetación y árboles propios de las zonas montañosas altas. Se encontró el suelo húmedo con mucha neblina. La naciente se ubicó y observó a su alrededor con gran cantidad de árboles. No se observaron construcciones, animales, ni señas o rastros de extracción de madera. Se anotó haber observado el recurso hídrico protegido y se tomaron fotografías que muestran lo visualizado en el acto.

Mismas que constan en el expediente digital y de las cuales se logra concluir que lo descrito por el A quo es coincidente con la materialidad del terreno observado. (expediente digital/escritos/ fecha 11/06/2015 08:45:37 a.m.). Aunado a lo anterior existe Informe N. SB-AID-GA-2015-1188 del 15 de octubre del 2015 donde se indica que la naciente ubicada en el fundo no tiene registros de captaciones de acueductos y sobre tal no existe aprovechamiento alguno de agua, o planes o proyectos que justifiquen solicitar la reserva del recurso hídrico para incorporarlo a algún sistema de abastecimiento. (expediente digital/ escritos/ 12/11/2015 02:23:08 p.m.). Es decir, el área del protección de la naciente no le afecta el régimen de dominio público establecido en el artículo 31 inciso a) de la Ley de Aguas N. 276. De lo descrito por el juez y lo observado por el certificador de uso de suelo que consignó encontrar un potrero en sucesión forestal, no se nota ningún daño ocasionado al recurso suelo o hídrico.

Lo citado debe ser complementado por lo descrito por las personas testigas cuando afirman que el padre del promovente tenía el terreno dedicado a ganado, y el titulante el dio un uso de regeneración forestal y conservación de la naciente ubicada en el sitio. Por otra parte, en memorial aportado a los autos se observa un oficio emanado por el el Sistema Nacional de Áreas de Conservación, Área de Conservación Cordillera Volcánica Central del MINAE N. OG-1088 del 16 de junio del 2015, en donde se evacúa consulta del promovente sobre practicas de manejo de su fundo dada la existencia de una naciente. En la que se emiten una serie recomendaciones al respecto. En primer orden se indicó que de visita realizada por funcionarios del Area de Conservación Cordillera Volcánica Central se determinó que no toda la finca se ubica dentro del área de protección de la naciente, pero si dentro de los límites de la Zona Protectora Río Toro.

Cita ese documento de forma literal: " En razón de lo anterior, es importante indicar, que la parte de su propiedad que se localiza fuera del área del protección de los 100 metros de radio alrededor de la naciente, cuyo uso actual es repasto, sobre terrenos planos a orillas del camino, no cuenta con ninguna limitación legal, excepto que si desea construir cualquier infraestructura, debe tramitar ante la SETENA la Viabilidad Ambiental, por encontrarse dentro de la Zona Protectora Toro. Caso contrario sucede con el sector de su propiedad, que se localiza dentro de los 100 metros de radio dell la ( sic) área del protección de la naciente permanente, por ahí se ve afectada por lo establecido en la Ley Forestal 7575 y la Ley de Conservación de Vida Silvestre 7317..... dentro de esos 100 metros existe limitación de corta vegetación, corta árboles y de construcción de cualquier tipo de infraestructura, por lo que las prácticas de protección dentro de esta área, consistirán básicamente en cercar el sector en cuestión para evitar el ingreso de ganado, y permitir que se de un proceso de regeneración natural, lo cual le dará la mejor protección a la naciente, máxime con la riqueza florística que existe en ese sitio. ...

" .(expediente digital/ escritos/ fecha 24/06/2015 10:10:57 a.m.). En el estudio de suelos y el reconocimiento judicial no se describió actividad alguna que transgrediera las recomendaciones técnico ambientales dictadas por la oficina competente del MINAE. Tampoco ha aportado el ente apelante o cualquier interesado, prueba alguna de que el promovente o los anteriores poseedores hubieran sido prevenidos, sancionados o culpados de haber transgredido la normativa nacional tutelar del ambiente, de donde se pudiera inferir han transgredido su obligación de ejercer una posesión en respeto de los recursos naturales la ejercer posesión de un inmueble con limitaciones de orden ambiental dada la naturaleza de esa finca. Al respecto se agrega, los tres testigos, no manifestaron que desde que conocieron el fundo en un periodo mayor al decenal antes de 1984 se talara madera o se lesionara la naciente.

Es decir, nunca medió un cambio de uso de suelo en las fincas a titular en perjuicio del ambiente, desde antes de la creación de la categoría de manejo de Zona Protectora en cuestión hasta la actualidad, o al menos no consta ninguna prueba al respecto. Por lo que su reclamo no es atendible. Nótese, que cada categoría de manejo tiene sus propios fines técnico científicos, sin que pueda entenderse que la existencia de alguna de ella excluye en forma absoluta actividades humanas de producción o recreo. Lo que se define en los respectivos planes de ordenamiento territorial de cada una. En este caso el agravio en estudio esta ayuno de fundamentación debida, en cuanto al motivo por el cual estima el apelante las actividades existentes lesionan los fines de esa zona con los actos actuales y cuales directrices, órdenes o normas del plan de manejo de esa área se han incumplido. No debe olvidarse que según el artículo 82 de la Ley de Conservación de Vida Silvestre y sobre su uso y aprovechamiento en voto N. 144-96 de las 16:51 horas del 9 de enero de 1996. resolvió la Sala Constitucional de la Corte Suprema de Justicia: " En el caso de establecerse reservas forestales, zonas protectoras y refugios nacionales de vida silvestre, se da la opción de que el propietario conserve su tierra, ya que, siguiendo el plan de manejo puede continuar aprovechándola en términos económicos, es decir, las limitaciones impuestas no son de tal magnitud que le impidan explotar su propiedad, por lo que no hacen nugatorio su derecho." En este caso, la parte promovente ha demostrado un uso del fundo en respecto del uso del suelo, los testigos no acreditaron actividades de extracción de madera o que lesionen recurso hídrico alguna, ni se ha demostrado que se hubiere causado daño al ambiente alguno. Se rechaza el agravio.

VI- No resulta de recibo el alegato referido a la imposibilidad de resolver este proceso al haber mediado a un rechazo de procesos anteriores del promovente sobre el fundo. Constan en autos copias de las resoluciones de los expedientes de los procesos de información posesoria previamente rechazados al titulante. (expediente digital/escritos/fecha 17/06/2015 09:55:32 a.m). Respecto al número EXPN4 consta la sentencia de primera instancia del Juzgado Civil de Trabajo de Mayor Cuantía de Grecia (imagen 10), donde se rechazó por no haberse aportado prueba testimonial idónea para demostrar el ejercicio de la posesión en un plazo decenal anterior a la creación de la Zona Protectora Río Toro de las 15 :00 horas del 9 de mayo del 2008. Pues uno de los testigos indicó que un año antes de la declaración emitida en ese proceso el promovente adquirió el terreno de su padre. Esos testimonios se complementan con los que fueron recibidos en este proceso.

No existe contradicción alguna ni discordancias respecto a lo depuesto por los testigos en este nuevo proceso. En el proceso tramitado bajo expediente EXPN3 se rechazó por contener el fundo zona de potrero, lo que en este caso también se logra subsanar al aportarse los elementos técnicos (estudio de suelos, recomendaciones técnicas de MINAE sobre gestión de naciente y uso del suelo) y lo observado en el reconocimiento judicial de este proceso, que acredita el ejercicio de una posesión acorde con las exigencias del artículo 7 de la Ley de Informaciones Posesorias. (imagen 18). Cabe anotar, que en el caso de este fundo recayó la afectación a categoría de manejo de zona protectora en el año 1994 y la posesión ejercida hasta esa fecha no podría ser castigada como violatoria a lo regulado por el numeral 7 de la Ley de Informaciones Posesorias por haber tenido pasto y haber ejercido una actividad productiva ganadera, pues es posteriormente que se afecta como zona protectora.

El poseedor no incumplió lo que no estaba aún vigente para el año 1994, ni tampoco se demostró de ninguna manera que hubiese hecho un uso abusivo del bien ni de los recursos naturales que contiene, de tal magnitud que pueda enervar su derecho de propiedad agraria consolidada hace más de cuarenta años. No sería posible invalidarle el reconocimiento de la posesión de vieja data que se acreditó en este proceso había ejercido él, su padre y aún su abuelo, pues la declaratoria se hace siempre sin perjuicio de los derechos de propiedad ya consolidados por la usucapion. No obstante, como se indicó, ningún elemento de prueba denota que mediara un cambio de uso de suelo, tala o lesión a la naciente, a partir de la declaratoria referida o antes, pues se señalaba era de pastos para ganado, y se protegía esa naciente. Se observa que el promovente más bien ha ajustado la actividad (pastos en sucesión forestal, reforestación y protección de naciente) a las limitaciones impuestas a su inmueble al integrarla a la Zona Protectora Río Toro en el año 1994.

En proceso con expediente EXPN1 igualmente se rechazó por insuficiencia de las declaraciones en cuanto al tiempo que debía de tener los testigos de conocer el fundo, pero no porque se hubiese acreditado algo significativamente distinto a lo que se verificó en este proceso, de manera que el material probatorio de ambos lejos de ser antagónicos resultan complementarios. No se comparte la tesis de la apelante, cuando indica que al haber sido ya rechazada la pretensión de inscribir por este trámite el fundo no procede volver a conocer por esta vía de jurisdicción no contenciosa esa solicitud. Sobre el tema, en esta jurisdicción especializada agraria se ha resuelto: " No podría el juzgador atribuirse potestades tales como para dejar de recibir la prueba y en aras de procurar una supuesta economía al Poder Judicial, y paradógicamente también a los promoventes, dictar de una vez sentencia de fondo.

No debe perder de vista el Juzgado que el fallo eventualmente podía ser objeto de apelación, como en efecto lo fue, supuesto en el cual el Tribunal no necesariamente tendría que compartir su criterio, de manera tal que es preciso sea evacuada la prueba ofrecida a fin de poder analizar la procedencia o no del criterio esgrimido en la resolución recurrida para dictar la sentencia de segunda instancia. Aunado a ello y sobre todo, la promovente tiene derecho a tratar de acreditar la posesión exigida por ley mediante este trámite, sin que le esté vedada tal vía por el simple hecho de que ya una vez se les denegó otra Información Posesoria, pues independientemente de la cantidad de veces que la planteen, nunca adquirirá eficacia de cosa juzgada material. Considerar lo contrario, implicaría una denegación de justicia, pues como bien lo señala la recurrente, el artículo 822 del Código Procesal Civil aplicado supletoriamente conforme al numeral 79 de la Ley de Jurisdicción Agraria, refiriéndose a las sentencias dictadas en procesos no contenciosos, lo siguiente: "...

Esta resolución no producirá cosa juzgada ni aún cuando haya existido objeto de pronunciamiento del superior, salvo lo dispuesto expresamente para el proceso sucesorio y el de divorcio o separación por mutuo consentimiento."(Voto N. 1033-F-07). Por lo que se rechaza el agravio primero de su apelación, con fundamento en el artículo 822 del Código Procesal Civil aplicado supletoriamente, y los efectos de cosa jugada formal que otorga a las resoluciones emitidas dentro de los procesos de actividad judicial no contenciosa.

VII- Por las razones expuestas, con fundamento en los artículos 1 y 2 de la Ley de Jurisdicción Agraria, 6 y 1 de la Ley de Informaciones Posesorias, 822 del Código Procesal civil, en lo apelado se confirma la sentencia recurrida.

VIII- VOTO SALVADO DE LA JUEZA [Nombre16] : No se comparte el voto de mayoría al considerar la parte promovente no demostró haber protegido el recurso natural durante los años que aduce como posesión válida para usucapir. Ese tipo de posesión ecológica es la que debió demostrar conforme lo dispone el artículo 7 de la Ley de Informaciones Posesorias, en asocio a la Ley Forestal 4465 del 25 de noviembre de 1969 y normativa posterior, que regula la demanialidad de los bosques, y adquiere mayor relevancia si cumplen una función de protección de algún ecosistema que da origen al motivo de declaratoria de Refugio de Vida Silvestre o Zona Protectora como en este caso, en que el inmueble se encuentra dentro de la Zona Protectora Rio Toro. El haber subsanado los yerros en su posesión después de tres intentos de informaciones posesorias, demostrando cuido del recurso al final de la posesión que se pretende sea reconocida, ello no deja sin efecto el hecho que la posesión decenal que se debe contabilizar ahora sea válida, pues en su momento no lo fue ya que se había desprotegido el recurso agua y bosque, máxime en una zona de alta fragilidad hídrica como lo indica el estudio técnico de Acueductos y Alcantarillados y de difícil recuperación -como lo indica la misma parte promovente.-

POR TANTO

En lo apelado, se confirma la sentencia número dos mil dieciséis cero cero cero cero ochenta y siete de las catorce horas y veintiséis minutos del diecisiete de junio del dos mil dieciséis. Voto Salvado de la Jueza Alvarado Paniagua.
