Ordinary proceeding (proceso ordinario) brought before the Contentious-Administrative and Civil Treasury Court of the Second Judicial Circuit of San José by Nombre126758, married, doctor of bacteriology, against the STATE, represented by Environmental State Attorney José J. Barahona Vargas. Also appearing as the plaintiff’s special judicial attorneys-in-fact (apoderados especiales judiciales) are Lic. Antonio Biolley Riotte and María Gabriela Biolley Aymerich, both of unspecified domicile. The natural persons are of legal age and, subject to the qualifications stated, are attorneys, residents of San José, and of unspecified marital status.

WHEREAS

1. Based on the facts he alleged and the legal provisions he cited, the plaintiff filed an ordinary action, the amount in controversy being set as incapable of estimation, seeking a judgment declaring: “1. That the plaintiff, Nombre126758, has held under concession for approximately 35 years a parcel of land located in Playa Guiones, Barrio Nosara, Nicoya, Second Canton of the Province of Guanacaste. 2. That the plaintiff acquired said land by purchase and sale, together with the rights of possession, use, and occupancy, which he acquired from its previous owners, Nombre126759 and Ramón Esquivel Esquivel, now deceased. 3. That the plaintiff applied to the Municipality of Nombre14358 for a leasehold right (derecho de arrendamiento) and always duly paid the corresponding concession fee (canon). 4. That the plaintiff remodeled an old swimming pool located on the leased property, adding a jacuzzi, a pump, and filters to purify the water, acts for which he was Tried (sic) in criminal court for the offense of violating the Ley Sobre la Zona Marítimo Terrestre, a proceeding in which he was acquitted of all punishment and liability, with that judgment becoming formally and substantively res judicata (cosa juzgada). 5.

That, during the Carazo Administration, the Municipality of Nombre14358 attempted, without exception, to remove the homes and structures belonging to the transient population of Playa Guiones, an attempt it abandoned by virtue of a contrary pronouncement issued by the Executive President of the I.C.T., which was itself based on a binding opinion issued by the Attorney General of the Republic, then Lic. Francisco Villa Jiménez; according to that pronouncement, the agencies with jurisdiction determined that the Ley de la Zona Marítimo Terrestre did not generally apply to the area of Guiones occupied by the transient population, including the plaintiff, Nombre126758. In addition to resolving the issue, that pronouncement led the Municipality of Nicoya thereafter to issue new construction permits, as well as permits for the renovation of structures, and to grant concessions for private use within the 50-meter strip adjacent to the sea. 6.

That, once the dispute was submitted to the I.C.T. for decision, that agency sent an inspector to prepare a report, and the inspector recommended the following: ‘Observations: PARCEL ON A CLIFF 10 M ABOVE SEA LEVEL. STRUCTURE WITHIN THE PUBLIC ZONE AT AN ELEVATION OF 7 M, EMBEDDED IN A CUT INTO THE CLIFF. DOES NOT INTERFERE WITH FREE PASSAGE.’ ‘Suggestions: Due to its cliff-like topography and because it does not interfere with the free passage of pedestrians and vehicles or the enjoyment of the beach, application of article 21 of ley 6043 is suggested.’ 7. That the I.C.T. decided the dispute through a final administrative decision in which it adopted the binding opinion of the Office of the Attorney General of the Republic and the report and recommendation of its Inspector, declaring that the exception contained in article 21 of the Ley de la Zona Marítimo Terrestre applied to the disputed area—Playa Guiones—under which said Law does not apply to that part of the national territory. 8.

That, because more than four years elapsed after the decision or administrative act issued by the I.C.T. became final without the State declaring it injurious to the public interest and/or challenging it before the contentious-administrative courts, said act or decision created ‘acquired rights’ (derechos adquiridos) in favor or for the benefit of the plaintiff—Nombre126758—of which he may not be deprived because any State right contrary to the I.C.T.’s decision had lapsed, the I.C.T. then being the only public agency with jurisdiction to decide the matter at the administrative level. 9. That, because the plaintiff was tried—in criminal proceedings before a court of competent jurisdiction—and was acquitted of all punishment and liability, that judgmet (sic) became formally and substantively res judicata, such that the Administration could not deprive the plaintiff of his leasehold, use, and occupancy rights over the property located in Playa Guiones, which rights remain in force, nor may it charge him again for those same acts. 10.

That, as a result of the maritime-terrestrial phenomenon known as erosion, which affects the mainland coast bordering the Pacific Ocean, the public zone corresponding to Nombre238504 disappeared, causing the so-called maritime mile or maritime-terrestrial zone (zona marítimo terrestre) to lose the 50 meters adjacent to the sea, a phenomenon affecting the State as owner and not the plaintiff, Nombre126758, or his land. 11. That, by virtue of the constitutional principle of non-retroactivity of the law, the Ministry of Environment and Energy (MINAE) may not retroactively apply to the plaintiff, Nombre126758, Decreto Ejecutivo # 16531-MAG del 18 julio 1985, ley de conservación de la vida silvestre (sic) # 7317 and its Regulations, or laws numbers 7554 and 7788. 12. That, under the same principle of non-retroactivity of the law, neither the State nor its agencies (Area de Conservación del Tempisque and the Ministry of Environment and Energy) may disregard or decline to apply to Playa Guiones the designation of ‘beaches of tourist interest’ granted by the I.C.T. through a final resolution that was duly promulgated and published in the official newspaper La Gaceta, a designation made in accordance with the law and which the State has neither declared injurious to the public interest nor challenged through contentious-administrative proceedings. 13.

That, for the reasons stated, the following decisions are absolutely null and void, and are hereby so declared: Number 079-ACT-DR, issued by the Área de Conservación Tempisque at dieciséis horas con treinta y cinco minutos del día 11 septiembre dos mil. Number 094-ACT-DR, issued by the Área Conservación Tempisque at diez horas con quince minutos del día catorce noviembre del dos mil. Number 006-2002-MINAE, issued by the Minister of Environment and Energy at once horas del tres enero del año dos mil dos. Number R-220-002-MINAE, issued by the Minister of Environment and Energy at ocho horas cuarenta minutos del diecinueve de abril de dos mil dos. 14. The Ministry of Environment and Energy is ordered to extend the residential-use permit issued to Nombre126758 for the property at issue in this litigation, located in Playa Guiones, respecting the possession, use, and occupancy he has maintained for more than thirty years. 15.

That the State is ordered to pay all litigation costs.” 2. The State’s representative answered as set forth at folios 319 to 378, raising the preliminary defenses (defensas previas) of expiration of the action and non-challengeable act, which were partially resolved by interlocutory decision. The representative also asserted the defenses of lack of legal right and lack of standing ad causam (legitimación ad causam).

3. The State filed a counterclaim against the plaintiff, seeking a judgment declaring that: “1) The maritime-terrestrial zone (zona marítimo terrestre) of Nombre238504, or the two-hundred-meter-wide strip along the coastlines, measured horizontally from the ordinary high-tide line, is owned by the State and consists of two sections: the Public Zone (Zona Pública), a fifty-meter-wide strip measured from the ordinary high-tide line, and the Restricted Zone (Zona Restringida), comprising the adjacent one hundred and fifty meters toward the interior of the country. The Public Zone may not be occupied under any title or under any circumstances, and no one may claim any right over it.

  • 2)Decreto 16531-MAG of July 18, 1985, while respecting the concept of the maritime-terrestrial zone, its two sections—the Public Zone and Restricted Zone—and its status as public domain (dominio público), as recognized by the SALA CONSTITUCIONAL in vote 5976 at 15 hours 42 minutes on November 16, 1993, when it dismissed the constitutional challenge against that Decree, expanded the Refugio Nacional de Vida Silvestre Ostional to include the two-hundred-meter-wide area measured from the ordinary high-tide line, extending from the left bank of the mouth of the Río Nosara to Punta Guiones, and placed its protection under the responsibility of the Departamento de Vida Silvestre, now the Area de Conservación Tempisque, Sistema Nacional de Áreas de Conservación (SINAC), of the Ministerio del Ambiente y Energía Refugio Nacional de Vida Silvestre Ostional. From that point forward, this entailed, by operation of law, a change in the administration and management of the maritime-terrestrial zone of Playa Guiones, while preserving State ownership of the property, which became subject to new public purposes.
  • 3)National Wildlife Refuges are protected wilderness areas (áreas silvestres protegidas) in the public domain that form part of the State Natural Heritage (Patrimonio Natural del Estado), in which possession by private parties creates no right in their favor, and where the State may conduct and authorize only research, training, and ecotourism activities, subject to any required environmental impact assessments (evaluaciones de impacto ambiental). Furthermore, as a consequence of the principle of inalienability (principio de inalienabilidad), private possession may not be exercised over public-domain property, as has been broadly recognized in constitutional case law.
  • 4)Although areas of the maritime-terrestrial zone within National Wildlife Refuges are generally excluded from the application of Ley 6043 under the designation of ‘equivalent reserves’ (reservas equivalentes) (Article 73), the Ley de Conservación de la Vida Silvestre Nº 7317 of October 30, 1992, restored the applicability of the concept of the maritime-terrestrial zone in its two segments: the Public Zone, dedicated to common use insofar as compatible with the purposes of the Refuge, and the Restricted Zone, by conferring upon the Dirección General de Vida Silvestre, now incorporated into the Sistema Nacional de Áreas de Conservación, the powers and duties established by Ley 6043 for each of those sections. The State’s public-domain ownership (titularidad demanial) of the Public Zone, designated for common use, is reaffirmed by the Ley de Aguas, which grants that status to beaches (Articles 1, subsections I and VIII; 3, subsection I; 69; and 70), and by the Ley de Tierras y Colonización, Article 7, subsection b), as well as by the SALA CONSTITUCIONAL, which has deemed the Public Zone, or fifty-meter-wide strip measured from the ordinary high-tide line, an ‘immovable core’ and ‘untouchable by the legislature,’ and stated that ‘as such, not only is it impossible to appropriate it by any means, but it has also been placed at the service of all persons, without exception’ (Voto 5210-97, at 16 hours on September 2, 1997, Considerando IV).
  • 5)The exception provided for in Article 21 of Ley 6043 of March 2, 1997, is an exception to the common-use designation of the Public Zone established in Article 20 ibidem, which prohibits the creation of private rights over it or its exclusive occupation; it does not, however, exempt the sector from the application of the remaining provisions of that Law, and it operates subject to the conditions established therein, as clarified by the Procuraduría General de la República in opinion C-026-2001, namely: a) that the areas are under municipal administration; b) that they have natural characteristics preventing public use because of their geographic or topographic configuration or other factors, a factual condition that must be sufficiently substantiated, including through technical criteria; c) that the interested party apply for and obtain the duly reasoned administrative authorizations required from the Junta Directiva del Instituto Costarricense de Turismo and the Concejo Municipal of the locality; ch) that the applicant apply for and, after satisfying all legal requirements, obtain the corresponding concession (concesión), from which there is no reason to exempt the applicant (Ley 6043, Articles 39 and 21); d) that those areas of the Public Zone not be privatized in practice, that a free-transit area be established for the use and enjoyment of the public areas referred to in Article 21 ibid, and that pedestrian safety be guaranteed; e) that no harm be caused to concession holders or owners of adjoining land; and f) that, additionally, pursuant to the constitutional mandate (Article 50), the environment must be protected as a limit on discretion in granting public-domain authorizations and concessions.
  • 6)During the period in which the Municipalidad de Nombre14358 administered the maritime-terrestrial zone of Playa Guiones pursuant to Ley 6043, the counterclaim defendant neither applied for nor obtained from that Municipality, nor registered in the Registro Público de Concesiones de la Zona Marítimo Terrestre, a preferential concession (concesión privilegiada) to occupy the Public Zone of Playa Guiones under Article 21 of Ley 6043 by fulfilling the legal requirements stated above.
  • 7)Furthermore, the property held by Mr. Nombre126758 in the Public Zone of Nombre238504 would not satisfy the conditions required by that provision (Article 21, Ley 6043), because it has flat topography, is not situated on rock formations, crags, or cliffs, has land access by road, fronts a sandy beach available for public use at low tide, and effectively privatizes the location at high tide because it would completely obstruct public access to the sector.
  • 8)The counterclaim defendant has no municipal concession granted and registered in the Registro General de Concesiones authorizing him to occupy the maritime-terrestrial zone of Playa Guiones, nor does he have a lease agreement (contrato de arrendamiento) over that zone, granted pursuant to prior laws and legalized under Transitorio II of Ley 6043, registered in that Registry. The mere concession application that he once submitted to the Municipalidad de Nombre14358 gives him no right to occupy the property he currently holds in the Public Zone of Playa Guiones or the Restricted Zone, or to build in either of them, as the Sal Constitucional has repeatedly held.
  • 9)Because the counterclaim defendant has no lease agreement over property in the maritime zone of Playa Guiones granted pursuant to prior laws and legalized under Transitorio II of Ley 6043, he may derive no right from the declaration of tourism suitability (declaratoria de aptitud turística) issued for that beach by the Instituto Costarricense de Turismo for the purposes of the now-repealed Ley 4558 of April 22, 1970.
  • 10)The counterclaim defendant has no building permits (permisos de construcción) issued by the Municipalidad de Nombre14358 to perform work—construction or remodeling—in the Public Zone and Restricted Zone (maritime-terrestrial zone) of Playa Guiones. Such permits are not replaced by the isolated payment of sixteen thousand colones made on January 8, 1993, receipt Nº 8047, proof of which he submitted to the record, nor did that payment authorize him to erect structures in that Public Zone.
  • 11)The effects of judgment Nº NP 155-93-2 of the Juzgado Penal de Nombre14358, issued at 13 hours 50 minutes on October 18, 1994, in summary proceeding Nº226/93 T, which acquitted Mr. Nombre126758 of building in the maritime-terrestrial zone of Nombre238504, are limited to the criminal violation and imputability of the acts, authorship, and the elements required to apply the criminal law under which he was tried. It does not, however, grant him a private possessory title over the Public Zone of Playa Guiones, which does not permit such a title; doing so would violate its legal regime and common-use designation, would entail a withdrawal from the public domain (desafectación) that may be effected only by law (Sala Constitucional, vote 5226-97, among others), and the granting of enabling titles (títulos habilitantes) to occupy the maritime-terrestrial public domain is an act inherent to the agency that administers it, not to the Criminal Courts. Nor does it legitimize his indefinite presence in that Public Zone.
  • 12)Given the public nature of the property, the counterclaim defendant may not exercise private possession, as understood under Civil Law, over the Restricted Zone, much less over the Public Zone of Playa Guiones.
  • 13)The counterclaim defendant lacks any title enforceable against the State that would legitimize his exclusive holding of the property he occupies in the Public Zone of Playa Guiones.
  • 14)The special holding or use that Mr. Nombre126758 has exercised and continues to exercise in the Public Zone of the maritime-terrestrial zone of Playa Guiones, canton of Nicoya, is unlawful because it contravenes the zone’s Public Law regime and common-use designation, presently insofar as compatible with the purposes of the Refugio Nacional de Vida Silvestre Ostional, of which it forms part.
  • 15)The structures erected by that gentleman in the Public Zone of Playa Guiones, between boundary markers 11 and 12 of the Instituto Geográfico Nacional, are also unlawful and consist of two cabin sections with several rooms or units, a kitchen, a roofed oven, a swimming pool, a Jacuzzi, a terrace, a garage, a concrete slab, and a retaining wall near the sea.
  • 16)Mr. Nombre126758 must vacate the Public Zone of Nombre238504, demolish the structures built there, and restore the property to its prior condition within the reasonable period granted to him in the judgment, with notice that, should he fail to do so, the eviction, demolition of the structures, and restoration will be enforced coercively at his expense, with the assistance of the police authority, in coordination with the Área de Conservación Tempisque of the Sistema Nacional de Áreas de Conservación of MINAE, the agency administering the Refugio Nacional de Vida Silvestre Ostional, and using such MOPT heavy machinery as may be required to remove the structures. The foregoing is without prejudice to any separate claims that may be brought against him for damages caused by his use of the property, in proportion to the duration of his unlawful holding and the site’s privileged location in relation to the sea.
  • 17)Because the intended use conflicts with the common-use designation of the Public Zone of Playa Guiones, insofar as that designation is compatible with the purposes of the Wildlife Refuge, and because it does not conform to the activities permitted within the State Natural Heritage, the decisions of the Director del Área de Conservación Tempisque and the señora Ministra del Ambiente y Energía denying Mr. Nombre126758 Nombre126758 a use permit (permiso de uso) to remain in the Public Zone of that Refuge, which he challenges as unlawful in this proceeding, are valid.
  • 18)The counterclaim defendant must pay both categories of costs in this proceeding.” 4. The plaintiff against whom the counterclaim was filed denied it and raised the defenses of lack of a legal right, lack of interest, res judicata (cosa juzgada), and lack of active and passive standing, as well as the general plea of “sine actione agit”.

5. Judge Billy Araya Olmos, in judgment no. 3029-2010 of 13 horas del 30 de julio de 2010, ruled: “FIRST: The defenses of lack of legal entitlement (falta de derecho) and lack of active standing to sue (falta de legitimación ad causam activa), both raised by the State, are sustained. SECOND: The ADMINISTRATIVE LITIGATION claim (demanda CONTENCIOSO ADMINISTRATIVA) in the proceeding brought by Nombre126758 against THE STATE is dismissed in its entirety. THIRD: The counterclaim (contrademanda) filed by the Representative of the Ente Público Mayor is granted. FOURTH: The defenses of sine actione agit, lack of legal entitlement, lack of standing in both of its forms, and substantive res judicata (cosa juzgada material), raised by the plaintiff-counterdefendant, are denied. FIFTH: It is declared that possession (tenencia) of the property located between boundary markers 11 and 12, placed by the Instituto Geográfico Nacional in Playa Guiones and consisting of two cabin areas, a garage, and a retaining wall, is unlawful.

SIXTH: The following ruling is issued regarding the aforementioned COUNTERCLAIM, so that once this Judgment becomes final, the appropriate legal action may be taken: a) Voluntary eviction (desalojo voluntario) by the counterdefendant from the aforementioned property located in the Public Zone (Zona Pública) of Playa Guiones. To comply with this order, a period of dos meses is granted as a reasonable period under the doctrine of section 261 of the Ley General de la Administración Pública; b) Once the foregoing has been completed, he shall demolish the aforementioned structure, including the indicated retaining wall, by his own means, all within the stated period; c) Otherwise, the demolition shall be ordered at his expense, with the assistance of the police authority, in coordination with the Área de Conservación Tempisque of the Sistema Nacional de Áreas de Conservación of MINAE, and with the aid of the heavy machinery and operators provided for that purpose by the Ministerio de Obras Públicas y Transportes.

Anything not expressly granted shall be deemed denied. Both sets of costs shall be borne by Mr. Nombre126758 .” 6. Both parties requested supplementation and clarification (adición y aclaración) of judgment no. 3029-2010 of 13 horas del 30 de julio de 2010; and Judge Billy Araya Olmos, in judgment no. 3029-2010 BIS of 9 horas del 6 de setiembre de 2010, ruled: “In accordance with the foregoing factual and legal grounds, the request for supplementation and clarification submitted by the parties regarding judgment number 3029-2010, issued by this Court at 13:00 hrs. del 30 de julio del 2010, is declared PARTIALLY GRANTED.” 7. The plaintiff-counterdefendant appealed, and the Tribunal Contencioso Administrativo, Sección Sétima, composed of Judges Isaac Guillermo Amador Hernández, Sandra Quesada Vargas, and Francisco Jiménez Villegas, in judgment no. 148-2012-VII of 11 horas del 30 de octubre de 2012, ordered: “The evidence for the better resolution of the matter (prueba para mejor resolver) offered by the plaintiff is rejected.

The motion to introduce a new document (incidente de documento nuevo) filed by the State’s representative is rejected as procedurally improper. With respect to the matters challenged, the appealed judgment is affirmed.” 8. Attorney María Gabriela Biolley Aymerich, acting in the stated capacity, files an appeal in cassation (recurso de casación), expressly stating the grounds on which she relies to refute the position of the lower court.

WHEREAS

I.Mr. Nombre126758 sued the State in July 2007. He stated that, for more than seven five-year periods before Ley no. 4558, Ley de Urbanización Turística de la Zona Marítimo Terrestre (hereinafter Ley 4558) entered into force, his father, Nombre126759, had owned land that he purchased from Mr. Ramón Esquivel Esquivel, in Nombre238504 de Nosara, Nicoya, together with the rights of possession, use, and habitation. He asserted that, under the Republic’s administrative territorial division (Decreto Ejecutivo no. 6672-G de 23 de diciembre de 1976, and Ley 4366 de 19 de agosto de 1969), Nombre238504 is a settlement with a stable local population. He noted that, along its seafront, Nombre238504 has crags and cliffs with rock formations and small sandy inlets that prevent and/or limit their use for bathing and landing because of the danger involved. He alleged that, when the land was acquired, overland access was limited to the summer because there were no bridges or roads.

He stated that other owners were private pilots who traveled by small plane to nearby beaches. He observed that, before the end of the 1960s, all the shoreline land at “Playa Nombre238504 Sur” belonged to three local families. Nevertheless, he added, only Nombre238505 (known as Nombre238506) obtained title to his possession extending to the 50-meter line under Ley 4558. He argued that Nombre238504 has formed part of the Refugio Nacional de Vida Silvestre de Ostional (hereinafter RNVSO) since the enactment of Ley de Vida Silvestre, Ley 7317 de 7 de diciembre de 1992 (hereinafter LCVS). He noted that, although the RNVSO predates 1992 (17 de noviembre de 1983), its former boundaries did not include the maritime-terrestrial zone (zona marítimo terrestre) southwest of the mouth of the Río Nosara. He added that it was not until 1992 that the boundaries were expanded to include the Playa Guiones sector.

Thus, he stated that, during the period between the entry into force of Ley de la Zona Marítimo Terrestre no. 6043 del 2 de marzo de 1977 (hereinafter Ley 6043) and December 1992, when Nombre238504 became part of the RNVSO, the legal rules applicable to the area were Ley 6043 and, before that, the laws that preceded it. He asserted that, although Nombre238504 formed part of the RNVSO, it was not until mid-1998 that the Dirección de Vida Silvestre and, specifically, the Área de Conservación Tempisque del SINAC (hereinafter ACTSINAC), took effective control of the area. He added that, before then, dealings were conducted with the Municipalidad de Nicoya, which continued collecting fees (cánones) as though Ley 6043 remained applicable. He argued that Mr. Nombre126759 continued occupying the houses and huts located on the land at issue, including those situated on crags and cliffs in an area without a beach.

He stated that Mr. Hernán transferred a portion of that land to him more than 30 years ago, together with rights of use and habitation, making him the successor-in-interest (causahabiente) of Mr. Ramón Esquivel Esquivel. He stated that, from that time onward, he carried out construction work, improved the existing structures, built the house he still maintains there—with the relevant municipal permits—and built a small-boat shelter (“lanchera”). Nombre572, the authorities never lodged any complaint; he acted publicly in the capacity of a lessee (arrendatario), a status confirmed by the administrative and judicial authorities. He argued that, when Ley 6043 was enacted, he brought his status into legal compliance by applying to the Municipalidad for a concession (concesión), which assessed a fee that he paid faithfully. Nombre635, Nombre238504 has approximately 20 houses. He added that his house is built on crags and cliffs, and part of it occupies the 50 meters immediately adjoining the high-tide line (pleamar).

He stated that, although the Corporación de Nombre14358 attempted to remove houses and structures from the area during the years 1978-1982, it abandoned the effort in light of a binding opinion from the Procuraduría General de la República (hereinafter PGR). He explained that this occurred because the PGR and the Instituto Costarricense de Turismo (hereinafter ICT) decided not to apply Ley 6043 to areas consisting of crags and cliffs. From that point forward, he said, the Nicoya municipal government issued construction permits and permits for the renovation of structures and granted concessions within that strip. He explained that, in January 1993, he requested permission from that municipal authority to remodel an old swimming pool built before Ley 6043 entered into force, and permission was granted. He stated that, in June of that year, he received a summons from the Agencia Fiscal de Nicoya ordering him to give a statement as a defendant (imputado) in summary proceeding (sumaria) 226/93 T (expediente 155-1-93), before the Juzgado Penal de Nicoya, for the offense of violating Ley 6043 in connection with those structures.

Nevertheless, he noted, he was acquitted. He transcribed portions of the case file relating to the evidence. He argued that, although his possession had been challenged on several occasions, both administratively and judicially, the decisions had always been in his favor. He maintained that, in addition to the judgment of acquittal (no. 155-93-2 de las 13 horas 50 minutos del 18 de octubre de 1994) in the criminal proceedings, numerous precedents confirmed his right. He complained that, when he asked the Nicoya municipal government for the amount of the fee for the year 2000 so that he could pay it, he was told that, in the future, he would have to complete that procedure before the Ministerio de Ambiente y Energía (hereinafter MINAE), Área de Conservación Tempisque. He stated that, through resolutions 079-ACT-DR de las 16 horas con 35 minutos del 11 de setiembre de 2000, and 094-ACT-DR de las 10 horas 15 minutos del 14 de noviembre de 2000, that authority denied him the use permit (permiso de uso).

He explained that MINAE based its decision on the finding that one house was located within the public zone (zona pública), and therefore granted him a use permit only for residential purposes on the property located in the restricted zone (zona restringida), provided that he complied with the requirements of the LCVS. He stated that the officials who conducted the inspection were neither topographers nor land surveyors and that, consequently, in his view, their reports could not determine whether the property was located in the public or restricted zone; moreover, the reports did not identify the type of instrument used to take the measurements. He added that they also failed to establish whether a topographer accompanied them, where the high-tide line reached, how long the property had been occupied, whether construction permits existed, whether fees had been paid, and other matters he considered necessary.

He recounted that resolution 006-2002-MINAE de las 11 horas del 3 de enero de 2002 upheld the challenged acts and declared the administrative remedies exhausted (agotada la vía administrativa). Likewise, through resolution R-220-2002-MINAE de las 8 horas 40 minutos del 19 de abril de 2002, his motion for reconsideration (recurso de reposición) was denied. He asserted that, pursuant to Ley Orgánica del ICT, the beaches designated as being of tourist interest remained under the authority and administration of that Institute. He explained that, on 26 de agosto de 1970, the ICT designated 43 beaches as areas of tourist interest and conducted a topographical survey of each occupant. He emphasized that, in this manner, the Administration prepared a scaled plan bearing the seal of the Registro General de Concesiones (hereinafter RGC). That plan, he said, shows a distance of 33 meters between stations 1 to 4 and 2 to 3, meaning that the entire lot lies within the 150-meter restricted zone, while the public zone was eroded by the sea.

He added that this evidence demonstrates that the land has been eroded by the action of the sea and that the affected area must therefore be established to determine whether the remainder forms part of the public zone. He further stated that, pursuant to the authority referred to in section 2 of Ley 6043, on 25 de setiembre de 1981, the RGC sent an inspector, whose report stated: “Lot on a cliff 10 meters above sea level. Structure within the Public Zone at a height of 7 meters, embedded in a cut in the cliff. It does not interfere with free passage.” “Suggestions: Because of its cliff topography and because it does not interfere with the free passage of pedestrians and vehicles or with the enjoyment of the beach, application of Article 21 of Ley 6043 is recommended.” He stated that this provision contains an exception for areas whose topography prevents public use, in which case their use for tourism may be authorized subject to certain conditions.

He argued that a concession is an act declaring rights (acto declarativo de derechos) that may be set aside only through proceedings for a declaration of harm to the public interest (proceso de lesividad). He considered this to involve a vested right (derecho adquirido) and a settled legal situation (situación jurídica consolidada). He specified that, although the LCVS (published in La Gaceta del 7 de diciembre de 1992) created the RNVSO in Transitorio I, that designation does not have retroactive effect to the detriment of settled legal situations.

II.He requests that the judgment declare that: a) he has possessed the referenced property under a concession for 35 years; b) he acquired said property by purchase and sale, together with the rights of possession, use, and habitation, from its previous owners, Nombre126759 and Ramón Esquivel Esquivel; c) he applied to the Municipalidad de Nicoya for a leasehold right (derecho de arrendamiento) and always paid the fee to it; d) he remodeled an old swimming pool located on the property, acts for which he was tried and acquitted of all punishment and liability in criminal proceedings for the offense of violating Ley 6043, and that judgment became res judicata (cosa juzgada); e) although, during the Carazo Administration, the aforementioned Municipal Government attempted to eradicate the dwellings and structures of the transient population of Playa Guiones, it abandoned that policy pursuant to a binding opinion of the PGR, under which the competent bodies determined that Ley 6043 did not apply to the area in question, a pronouncement that resolved the issue and led the Corporación de Nicoya to issue new construction and renovation permits and grant concessions for private use within the 50-meter strip adjacent to the sea; f) the ICT sent an inspector to the area, who recommended the following: “Observations: lot on cliff 10 m above sea level.

Structure within the public zone at a height of 7 m, embedded in a cut in the cliff. Does not interfere with free passage.” “Suggestions: Given its cliff-topography configuration and because it does not interfere with the free passage of pedestrians and vehicles or with enjoyment of the beach, application of Article 21 of Ley 6043 is suggested”; g) the ICT adopted the binding opinion of the PGR and the report and recommendation of its inspector, declaring that the exception contained in Article 21 of Ley 6043 applied to the disputed area—Playa Guiones; h) because more than four years elapsed after the ICT decision became final without any declaration that it was injurious to the public interest (declaración de lesividad), that act created “vested rights” (derechos adquiridos) in his favor; i) because he was acquitted of all punishment and liability in the referenced criminal proceeding, by a judgment that became formal and substantive res judicata, the Administration may not deprive him of his leasehold, use, and habitation rights; j) because of the erosion affecting the Pacific coast, the public zone (zona pública) of Nombre238504 disappeared, since it lost the 50 meters adjacent to the sea, a phenomenon that affects only the State, not him or his land; k) MINAE may not retroactively apply Decreto Ejecutivo no. 16531-MAG del 18 julio 1985, the LCVS and its Regulations, or laws no. 7554 and 7788 to him; nor may ACTSINAC disregard or fail to apply to Playa Guiones the classification of “beach of tourism interest” assigned to it by the ICT in accordance with the law, which the State has neither declared injurious to the public interest nor challenged in contentious-administrative proceedings (vía contencioso administrativa); m) the following decisions be declared absolutely null and void: no. 079-ACT-DR; no. 094-ACT-DR, no. 006-2002-MINAE; no. R-220-002-MINAE; n) MINAE be ordered to renew his residential-use permit for the property at issue in this litigation, respecting the possession, use, and habitation that he has maintained for more than 30 years; and o) the State be ordered to pay all costs.

The State denied the allegations. It raised the preliminary defenses (defensas previas) that the action was time-barred and that decision no. 220-2002-MINAE was not subject to judicial review, which were upheld by interlocutory ruling. It raised the defenses of lack of a legal right and lack of standing in both its forms. It filed a counterclaim (reconvención). It requested declarations that: a) the maritime-terrestrial zone (zona marítimo terrestre) of Nombre238504 is publicly owned and therefore may not be occupied under any title, nor may any right over it be asserted; b) Decreto 16531-MAG, while respecting the concept of the maritime-terrestrial zone and its status as public-domain property (dominio público), as recognized by the Sala Constitucional in voto 5976 de las 15 horas 42 minutos del 16 de noviembre de 1993, expanded the RNVSO to include the area 200 meters wide, measured from ordinary high tide (pleamar ordinaria), from the left bank of the mouth of Río Nosara to Punta Guiones, and assigned its protection to ACTSINAC, thereby effecting by operation of law a change in the administration and management of that area while preserving public ownership and subjecting the property to new public purposes; c) National Wildlife Refuges (Refugios Nacionales de Vida Silvestre) are protected public-domain areas that form part of the State Natural Heritage (Patrimonio Natural del Estado), where private possession creates no right in favor of private parties and where the State may only conduct and authorize research, training, and ecotourism activities, subject to the environmental impact they generate.

Furthermore, as a consequence of the principle of inalienability (principio de inalienabilidad), private possession may not be exercised over public-domain property, as constitutional case law has extensively recognized; d) even though areas of the maritime-terrestrial zone within National Wildlife Refuges are generally excluded from the application of Ley 6043 under the classification of “equivalent reserves” (article 73), the LCVS restored the applicability of the concept of the maritime-terrestrial zone in its two segments: the Public Zone, dedicated to common use insofar as compatible with the purposes of the Refuge, and the Restricted Zone (Zona Restringida), by granting the Dirección General de Vida Silvestre, now incorporated into the Sistema Nacional de Áreas de Conservación, the powers and duties established by Ley 6043 for each of those sections. The State’s public-domain ownership (titularidad demanial) of the Public Zone, designated for common use, is reaffirmed by the Ley de Aguas, which grants beaches that status (numerals 1º, subsection I and VIII, 3 subsection I, 69 and 70), and by the Ley de Tierras y Colonización, in article 7, subsection b).

Likewise, the Sala Constitucional has deemed the Public Zone, or 50-meter-wide strip measured from ordinary high tide, an “immovable core” and “untouchable by the legislature,” and “as such, not only is it impossible to appropriate it by any means, but it has been placed at the service of all persons, without exception” (Voto 5210-97, de las 16 horas del 2 de septiembre de 1997, Considerando IV); e) the proviso set forth in Article 21 of Ley 6043 concerns the designation of the Public Zone for common use established by article 20 ibidem, with a prohibition against creating private rights over it or occupying it exclusively, but does not except the area from the application of the remaining provisions of that Law, and operates subject to the requirements established therein and clarified by the PGR in opinion C-026-2001; namely: i) that they are areas under municipal administration; ii) that they have natural characteristics that prevent public use because of their geographic or topographic configuration or otherwise, a factual requirement that must be sufficiently substantiated, including through technical criteria; iii) that the interested party apply for and obtain the duly reasoned administrative authorizations required from the ICT and the local Concejo Municipal; iv) that the applicant obtain the respective concession (Ley 6043, arts. 39 and 21); v) that those areas of the Public Zone not be privatized in practice and that an area of free passage be established for the use and enjoyment of the public areas identified in the aforementioned provision 21, thereby ensuring pedestrian safety; vi) that concession holders or owners of adjoining land not be harmed; vii) additionally, pursuant to constitutional provision 50, the environment must be protected as a limit on discretion in granting public-domain authorizations and concessions; f) during the period when the Municipalidad de Nombre14358 administered the maritime-terrestrial zone of Playa Guiones pursuant to Ley 6043, the counterclaim defendant neither applied for nor obtained from that Municipality, nor registered in the Registro Público de Concesiones de la Zona Marítimo Terrestre, a privileged concession to occupy the Public Zone at issue under the terms of provision 21 of Ley 6043; g) the property held by the plaintiff in the Public Zone of Nombre238504 would not meet the requirements imposed by that provision (article 21, Ley 6043), because its topography is flat, it is not situated on rock formations, crags, or cliffs, it has land access by road, and it fronts a sandy beach available for public use at low tide, while at high tide the site is effectively privatized because public access to the area is completely obstructed; h) the counterclaim defendant has no municipal concession registered in the RGC to occupy the area in question, nor any lease agreement over it based on prior laws and legalized pursuant to Transitory Provision II of Ley 6043.

The mere concession application that he once submitted to the Municipalidad de Nombre14358 gives him no right to occupy the property he currently holds or to build there, as the Sala Constitucional has held; i) because he lacks a lease agreement over property in that area based on and legalized under laws predating Ley 6043, he may derive no right from the declaration of tourism suitability that the ICT issued for that beach for purposes of the now-repealed Ley 4558; j) the counterclaim defendant has no construction or remodeling permits granted by that municipal corporation for the maritime-terrestrial zone at issue, and such permits are not replaced by the isolated payment of ¢16.000,00 made el 8 de enero de 1993, nor did that payment authorize him to erect structures in said Public Zone; k) the effects of judgment no. 155-93-2 of the Juzgado Penal de Nombre14358 are limited to the criminal violation and criminal culpability for the acts, without granting him any title of private possession over the repeatedly referenced area, an infringement of which would entail removal from the public domain (desafectación), which may be accomplished only by law (Sala Constitucional, voto 5226-97, among others), while granting legal instruments authorizing occupation of the maritime-terrestrial public domain is an act inherent to the body that administers it, not to the Criminal Courts.

Nor does that judgment legitimize his indefinite presence in that Public Zone; l) because of the public nature of the property, the counterclaim defendant may not exercise private possession, as understood under Civil Law, over the Zone in question; m) the counterclaim defendant lacks any title enforceable against the State that would authorize him to hold the property exclusively; n) the possession or special use that the plaintiff has exercised and continues to exercise in that zone is unlawful because it contravenes its Public Law regime and its designation for common use, currently insofar as compatible with the purposes of the RNVSO, of which it forms part; o) the structures erected by that gentleman in the Public Zone between IGN boundary markers 11 and 12 are unlawful; p) the plaintiff must vacate the Public Zone of Nombre238504, demolish the structures built there, and restore the property to its prior condition within the reasonable period granted to him in the judgment, with the warning that, should he fail to do so, the eviction, demolition of the structures, and restoration will be forcibly carried out at his expense, with the assistance of the police authority, in coordination with ACTSINAC, and using such MOPT machinery as may be required.

The foregoing is without prejudice to other claims for damages; q) the decisions of the Director of ACT and the Ministra de Ambiente y Energía denying the claimant a use permit to remain in the Public Zone of that Refuge are valid; and the counterclaim defendant must pay all costs of these proceedings. The plaintiff/counterclaim defendant raised the general plea of sine actione agit. The Court upheld the defenses of lack of a legal right and lack of standing to sue (legitimación ad causam activa) asserted by the State. It dismissed the complaint. It upheld the counterclaim. It denied the defenses asserted by the plaintiff/counterclaim defendant.

It declared that possession of the property located between el Dirección25676 in Playa Guiones is unlawful. It ordered the counterclaim defendant to vacate voluntarily, granting him two months to do so, and required him to demolish the structure by his own means; otherwise, demolition shall be ordered at his expense, with the assistance of the police authority, in coordination with ACTSINAC, and with the aid of heavy machinery and MOPT personnel. Any relief not expressly granted shall be deemed denied. Both court costs and attorney’s fees shall be borne by the plaintiff and counterclaim defendant. The Tribunal affirmed. The dissatisfied plaintiff appeals in cassation.

Appeals on Procedural Grounds

III.In the sole challenge of this nature that was admitted, the appellant alleges the improper application of subsections 2 and 3 of Article 575 of the Code of Civil Procedure (Código Procesal Civil; hereinafter, CPC), and the failure to apply the rules contained in Articles 5, 330, and the first paragraph of 575 of that body of law. The appellant argues that Article 575 of the CPC, in subsections 2 and 3, allows an appellant to submit documentary evidence (prueba documental) with the statement of grounds for appeal (escrito de expresión de agravios) when an event giving rise to a supervening defense (excepción superviniente) has occurred, or when an absent defendant for whom a guardian ad litem (curador) has been appointed enters an appearance in the proceedings after the deadline for submitting evidence at first instance. The appellant states that, pursuant to Article 5 of that procedural code, this rule is a matter of public policy and is mandatory.

The appellant contends that none of the circumstances established in the cited subsections 2 and 3 applies to this specific case and that the Court therefore erred in applying them in recital II of the challenged judgment. The appellant adds that, in the statement of grounds for appeal, documentary evidence was submitted that, as stated therein, did not exist when the complaint was filed and was therefore unknown to the appellant. Accordingly, the appellant contends that, under those provisions, the judges could only assess the evidence in accordance with the principles of sound judicial assessment (sana crítica) when rendering judgment, rather than rejecting the documentary evidence submitted, as they did. The appellant emphasizes that the Court erred in treating it as evidence to assist adjudication (prueba para mejor resolver). The appellant asserts that the materials offered include two judicial decisions, one of them binding, in which violations of the Law Governing Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional; hereinafter, LJC) are alleged.

The appellant further asserts that, in recital II of their judgment, the judges again referred to those evidentiary materials as evidence to assist adjudication, even though they had arisen after the issues had already been joined (trabado la litis) and were indispensable to resolving the dispute. The appellant therefore argues that Article 330 of the CPC was violated through failure to apply it, by finding that the evidence was not indispensable to resolving the matter. The appellant concludes that this placed the appellant in a state of defenselessness (indefensión), curtailing the right of defense.

IV.Regarding the evidence to assist adjudication, the rejection of which is challenged by the appellant in cassation (casacionista), in Judgment 383-2008 at 15 horas 50 minutos on 6 de junio de 2008, this Chamber stated: “In this regard, this Chamber has repeatedly held that evidence to assist adjudication belongs to the judge, not to the parties, and that the judge determines whether it is appropriate and necessary. This is a power that allows the judge, after the evidentiary phase, when the matter is ready for judgment, to introduce evidentiary materials deemed relevant to the proper resolution of the proceedings. This may occur even at the appellate stage (Article 575 of the cited Code)—where applicable—and, potentially, in cassation (Article 609 thereof). In this respect, it is clear that this mechanism is not intended to correct the parties’ omissions, negligence, or carelessness regarding their respective burdens of proof (carga probatoria), or to remedy deficiencies in their defense strategies, because that would seriously impair equality between the litigants and compromise the judge’s impartiality.

Accordingly, when ordering such evidence, the right of each party to a defense in court must be respected. On this subject, see this Chamber’s Judgment no. 703 at 10 horas 30 minutos on 27 de septiembre del 2007. From this standpoint, although it permits the introduction of evidence that was rejected during the proceedings or declared inadmissible, void, or incapable of being taken, the decision to obtain it is discretionary for the judicial body; accordingly, it is subject to the judge’s discretionary assessment, and the judge may dispense with it without issuing an express ruling. Regarding the criteria governing its application, see this collegiate body’s Decision no. 268 at 16 horas 10 minutos on 3 de abril del 2002.” (See, to similar effect, Judgments no. 728 at 10 horas 5 minutos on 4 de octubre de 2007, no. 555 at 9 horas con 50 minutos on 6 de mayo de 2010, and no. 622-2011 at 9 horas 25 minutos on 26 de mayo de 2011.)

V.The Court stated that, during the processing of the appeal, the plaintiff offered, as evidence to assist adjudication, a series of documents that the plaintiff claimed not to have known about previously and identified at folio 1138 of Volume II of the judicial case file. In this regard, it opined that the admission criterion rests exclusively with the judge or court hearing the case, depending on whether the evidence has a decisive bearing on the proceedings (Article 331 CPC) or is considered indispensable (Article 575, paragraphs two and three, CPC). It added that this followed from Article 103 of the Law Governing Administrative Litigation Jurisdiction (Ley Reguladora de la Jurisdicción Contencioso Administrativa; hereinafter, LRJCA). Along those lines, it stated that, except for the lease agreement (contrato de arrendamiento) executed on 27 de setiembre de 1973, all the documentary evidence submitted by the claimant at second instance should be rejected because it did not have a “decisive bearing” on the resolution of the appeal filed, since, in light of its contents, it was not indispensable for that purpose.

It added that the reopening of the proceedings for the taking of evidence at second instance, as though the case were being heard “ex novo” at first instance and no evidence had been taken or judicial judgment rendered, is prohibited because a judgment by the court below (A quo) already exists and has been challenged. To proceed otherwise would entail reopening virtually the entire proceeding, contrary to the nature of the appeal and the law, because matters that procedural law requires both instances to adjudicate as a guarantee of due process would have to be resolved in a single instance. Thus, it reasoned, any evidence the parties choose to offer pursuant to the authority provided by Article 575 CPC must be directed toward demonstrating the relevance and legitimacy of the relief sought at that stage of the proceedings. It asserted that such evidence must therefore not be superfluous or inconclusive, duplicative of matters already proved, or excessively cumulative.

It further stated that the Court may neither order nor admit evidentiary materials abandoned by the offering party, materials revealing an intent to delay the proceedings, or materials relating to facts not at issue. The same applies, it argued, to testimonial evidence (prueba testimonial) offered at this stage concerning facts on which testimony was received at first instance. Accordingly, in the judges’ view, any evidence admitted must be indispensable to deciding the matter at second instance—that is, to ruling on the appeal filed. The Court continued that, under the cited procedural provisions, the decision to admit evidence at second instance, particularly evidence offered to assist adjudication, must rest on criteria of indispensability, a power vested exclusively in the collegiate body. It must be borne in mind that evidence submitted to assist adjudication belongs to the judge—or, as applicable, the Court—not to the parties, as provided in the final clause of the cited Article 575 CPC.

Accordingly, it deemed it proper to reject the documentary evidence offered by the plaintiff at second instance because it did not consider that evidence indispensable to deciding the appeal. The judges additionally noted that the documentary evidence consisted of certified copies of Constitutional Chamber decisions no. 2020-2009 and 13655-2008; Judgment no. 98-2010 of the Trial Court of the Second Judicial Circuit of Guanacaste; documents from case file 08-8554-007-CO processed before the Constitutional Chamber; and official letters issued by the Instituto Geográfico Nacional dated enero del 2003. Although these documents relate directly or tangentially to environmental matters—or, more specifically, to the Refugio de Vida Silvestre Ostional—and concern that subject in the manner and to the extent addressed by the Constitutional Chamber, which is in any event a matter extraneous to these proceedings, they are not essential to resolving the appeal filed.

The Court continued that special mention should be made of the copy of the lease agreement executed at the time by the plaintiff’s father and the Municipalidad de Nicoya. It emphasized that this agreement identifies the western boundary of the land leased to the plaintiff’s father by that municipality as the inalienable 50-meter zone, thereby demonstrating that the physical location of the land leased at that time to Mr. Nombre126759 does not coincide with the location where the structures inspected during the judicial inspection (reconocimiento judicial) conducted on 25 de Junio de 2009 by Judge Claudia Salazar are currently shown to be situated. It emphasized that this infrastructure lies within the high-tide area, as shown by the record of the proceeding contained in the case file at folios 695 through 699 of Volume I of the main record, as well as by the photographs on the compact disc.

Based on the foregoing, it is evident that the evidence under review was offered as evidence to assist adjudication, a circumstance that, pursuant to Article 594 CPC, does not constitute a ground for cassation based on procedural defects because it does not involve the rejection of admissible evidence. In addition, this Chamber has stated on numerous occasions that an appeal in cassation (recurso de casación) is extraordinary in nature and lies only against certain decisions and, in cases of procedural violations, only on the grounds previously established by the legislature. Accordingly, the principle that grounds for challenge are exhaustively prescribed by law (taxatividad impugnaticia) applies. (Judgment no. 1013-2006 at 15 horas on 21 de diciembre de 2006.) The rejection of evidence to assist adjudication does not constitute one of the procedural grounds for appeal provided for in the cited Article 594 of the civil procedural legislation.

Therefore, for the reasons stated, this claim must be rejected. Notwithstanding the foregoing, and as an additional basis, the Court committed no violation because it was not required to admit the documents proposed by the plaintiff as evidence to assist adjudication. Thus, by expressly rejecting most of them, it exercised a power granted to it by law.

Appeal on Substantive Grounds

VI.The appellant in cassation (casacionista) raises four challenges on the merits. In the first, he argues that the judges rely on nonexistent provisions, namely those contained in Ley 6043 of 2 de marzo de 1977. He contends that the entire matter hinges on the application and interpretation of section 73 of that legislation, which he claims was violated. He states that the provision establishes: “This Law does not apply to maritime-terrestrial zones (zonas marítimo terrestres) included within national parks and equivalent reserves, which shall be governed by the respective legislation.” He maintains that, etymologically, the phrase “does not apply” admits of no interpretation; on the contrary, it is categorical and absolute. He adds that the provision also states at the end that such zones shall be governed by the respective legislation, which is obviously not Ley 6043. He cites opinions of the PGR in support of his position.

Consequently, he alleges that Ley 6043 was violated through the improper application of sections 1, 2, 3, 9, 10, 11, 12, 13, 18, 19, 20, 21, 26, 29, 34, 35, 36, 37, 38, and 73, as well as sections 62 and 63 of the Regulations to that Law. In the second ground, he alleges a breach of the rules governing substantive res judicata (cosa juzgada material). He states that the judges violated res judicata by reconsidering a matter that had already been resolved by another judicial authority. He notes that, in early junio de 1993, he was charged with violating the Ley de la Zona Marítimo Terrestre in connection with the structures he maintains on the land at issue in these proceedings, including the swimming pool. He asserts that, by judgment 155-93-2 issued at 13 horas 50 minutos on 18 de octubre de 1994, he was acquitted of that charge. He transcribes the facts found proven in the cited criminal proceedings.

He alleges that, despite his acquittal, the State instituted a second criminal proceeding against him (summary proceeding (sumaria) 98-001385-042-PE) for unlawful occupation of public-domain property (usurpación de bienes de dominio público), in which it also sought the demolition of the structures erected on that land, this time on the basis of unlawful occupation of the public domain, since it is clear that Ley 6043 does not apply in the area. He adds that judgment 98-2010 was issued in those proceedings at 16 horas 30 minutos on 9 de agosto de 2010; according to him, it is not final with respect to restitution of the public zone (zona pública) to the State, although it is final with respect to the criminal conviction, because it was appealed. He reproduces recital IV (considerando IV) of judgment 98-2010 issued at 16 horas 30 minutos on 9 de agosto de 2010. He considers it obvious that the State is attempting for a third time to obtain a declaration that the structures erected on the land encroach upon the maritime-terrestrial zone and must therefore be demolished.

Hence, he contends that, by granting the counterclaim (contrademanda), both the Court and the Ad quem violated, through failure to duly apply them, the rules governing res judicata contained in section 162 of the CPC, section 42 of the Constitución Política, and paragraph 4 of the Convención Americana sobre Derechos Humanos (Pacto de San José). He also considers the procedural principle or guarantee of substantive res judicata to have been violated. He argues that, before MINAE took possession of the territory that came to constitute the expanded RNVSO pursuant to the LCVS, the Municipalidad de Nicoya, the entity responsible for administering the maritime-terrestrial zone within its jurisdiction, did not accuse him of occupying the public zone. On the contrary, he asserts, it charged him with having built on land that he had occupied quietly, openly, peacefully, and continuously for more than 20 years at that time (1992).

He states that the judges did not consider the foregoing. He answers that this was because the aforementioned municipal corporation, the entity responsible for administering the zone at that time, had authorized him to possess the parcel he occupied. Thus, he argues, the cited judgments of the Tribunales Penales de Nicoya recognized his possession and acquitted him, finding that he had acted in good faith, facts which, in his opinion, became final and binding. He asserts that his possession was adjudicated by a Court of the Republic and that ruling became final, thereby constituting substantive res judicata that cannot be challenged without impairing his rights and violating the law. He believes that this also demonstrates a violation of section 34 of the Constitución Política through the retroactive application of a provision. He concludes that lis pendens (litis pendencia) also exists because judgment 98-2010 was issued in a proceeding commenced earlier and is not yet final.

In his third ground, he alleges infringement of section 261 of the Código Civil (hereinafter CC), section 73, and Transitorio VII of Ley 6043 through improper application and failure to apply them. He argues that, in this specific case, the law establishing that the maritime-terrestrial zone is public is Ley 6043. He adds that this legislation defines that concept, as well as the concepts of public and restricted zones (zona pública y restringida). He maintains that, under section 261 of the CC, only property owned by the State and designated by law for public use constitutes public property; and, in the case of the maritime-terrestrial zone, the only provision declaring it public is Ley 6043. He asserts that, in view of the exclusion established by section 73 of that legislative text, no other legal provision establishes the public-domain status (demanialidad) of the maritime-terrestrial zone within National Parks, Wildlife Refuges, or equivalent areas in this specific case.

He considers relevant the right of possession (derecho de posesión) that he exercised before the enactment of Ley 6043, as well as his payment of the applicable fee (canon) in consideration for exercising possession over the maritime-terrestrial zone, a provision that supports that right in his favor. In the fourth challenge, he alleges improper application of section 221 of the CPC and failure to apply section 222 of that body of law, because he litigated in good faith and therefore should not have been ordered to pay costs (costas), but instead should have been exempted from them. He contends that there can be no doubt that he constructed the structures in proper reliance on legislative provisions contained in Leyes 4558 and 6043, and that he also received possession from his father, who had obtained a lease agreement (contrato de arrendamiento) from the competent authorities. Thus, he emphasizes, he acted under the authority of the ICT and the Municipalidad de Nicoya, which granted him permits, and he paid the taxes assessed for that purpose, as well as the fee charged by the Ayuntamiento de Nicoya for a considerable period.

Nombre9272 was also tried with the force of res judicata for the alleged invasion of the maritime-terrestrial zone in various cases concerning the structures erected on that land. Accordingly, he concludes that he had more than sufficient legal grounds to be regarded as a good-faith litigant.

VII.Before proceeding to analyze the claims, it is appropriate to clarify the nature of public-domain property (bienes demaniales). In this regard, this Chamber has stated: “…it is essential to address the concept of the public domain (dominio público), and in particular the scope of Article 261 of the Código Civil, which distinguishes between public and private property (bienes públicos y privados), as well as the criteria on the basis of which the two may be distinguished. In this regard, it provides: ‘Public things are those that, by law, are permanently devoted to any service of general utility, and those that everyone may use because they have been made available for public use. / All other things are private and subject to private ownership, even if they belong to the State or the Municipalities, which, for this purpose, as civil persons, do not differ from any other person.’ As may be inferred, private property is defined residually; that is, this category includes everything that lacks any of the characteristics specified for public-domain property.

Constitutional case law, taking into account the provisions of the cited rule, has described property comprising the public domain in the following terms: ‘it is property having a nature and legal regime different from that of private property—which is governed by property law under the terms of Article 45 of the Constitución Política—inasmuch as, by the express will of the legislature, it is dedicated to the special purpose of serving the community, that is, the public interest, and therefore cannot be privately owned, meaning that it is outside the stream of commerce and thus cannot belong individually either to private parties or, strictly speaking, to the State, since the latter is limited to its administration and protection. […] Thus, this is property to which the State holds title in its capacity as administrator; it must be understood as property belonging (sic) to the “Nation,” and therefore forming part of the public patrimony (patrimonio público); and which, by virtue of its special legal nature, has the following attributes: it is not subject to prescription (imprescriptible), meaning that the passage of time cannot confer ownership of it, or even mere possession; that is, it cannot be acquired by adverse possession (usucapión), nor can it be lost by prescription.

For this reason, use permits (permisos de uso) granted over it by the Administration are always precarious in nature, which means that they may be revoked by the Administration at any time for reasons of expediency or convenience—under the terms provided in Articles 154 and 155 of the Ley General de la Administración Pública—and concessions (concesiones) granted over it for its use may likewise be canceled through the corresponding procedure; it is immune from attachment (inembargable), meaning that it cannot be subject to any encumbrance or attachment, whether by private parties or by the Administration; and it is inalienable (inalienable), meaning that it is outside the stream of commerce; accordingly, it cannot be transferred, sold, or acquired, whether gratuitously or for consideration, by private parties or by the State, and is therefore excluded from commerce and subject to a special and reinforced legal regime.

Moreover, its use and exploitation are subject to the police power (poder de policía), inasmuch as, because it is property that cannot be possessed, much less owned, its use and exploitation are possible only through duly authorized acts, whether by concession or use permit granted by the competent authority, and under the constant oversight of the Public Administration. It therefore comprises immovable property having a nature and legal regime virtually opposite to private property, as follows from Article 45 of the Constitution.’ (Ruling 2007-2408 of 16 horas 13 minutos del 21 de febrero de 2007. To the same effect, see decision no. 189-2011, of 9 horas 15 minutos del 3 de marzo de 2011). Section 9 of the Ley de la Zona Marítimo Terrestre, no. 6043, of 3 de marzo de 1977, states that the maritime-terrestrial zone (zona marítimo terrestre): ‘…is the strip two hundred meters wide along the entire Atlantic and Pacific coastlines of the Republic, regardless of its nature, measured horizontally from the ordinary high-tide line, together with the land and rocks uncovered by the sea at low tide.’ Likewise, section 10 of the cited law provides that the maritime-terrestrial zone: ‘…consists of two sections: the PUBLIC ZONE (ZONA PUBLICA), which is the fifty-meter-wide strip measured from the ordinary high-tide line, together with the areas uncovered during low tide; and the RESTRICTED ZONE (ZONA RESTRINGIDA), consisting of the remaining one-hundred-and-fifty-meter strip, or the remaining land in the case of islands.

Islets, crags, and other small areas and natural formations protruding from the sea belong to the public zone.’ Similarly, pursuant to section 6 of the cited law: ‘The provisions of this law shall not apply to areas of cities located on the coastlines, to properties lawfully registered in the names of private parties, or to those whose lawful status is recognized by law.’ Likewise, pursuant to section 7 of Ley 6043: ‘Land located in the maritime-terrestrial zone may not be the subject of possessory title proceedings (informaciones posesorias), and private parties may not appropriate it or have it legalized (sic) in their names by this or any other means.’ It must also be added, pursuant to section 20 of this Law, that: ‘Except for the exceptions established by law, the public zone may not be occupied under any title or under any circumstances. No one may claim any right over it. It shall be devoted to public use and especially to the free transit of persons (…).’ Nevertheless, section 20 establishes an exception to its application by stating: ‘The foregoing does not apply to sections that, because of their geographical configuration, topography, or special conditions, cannot be used for public purposes, in which case their development shall be authorized by the respective municipality and the Instituto Costarricense de Turismo, provided that they are not transferred, that a free-transit zone is established to facilitate public use and enjoyment of the beaches, cliffs, and estuaries, and that pedestrian safety is guaranteed.’ For its part, the second paragraph of section 83 of the LCVS includes maritime-terrestrial zones within the scope of that legislation and grants SINAC authority over such zones when they include Refugios de Vida Silvestre, providing: ‘The Sistema Nacional de Áreas de Conservación shall have the powers and duties established by Law no. 6043 with respect to Refugios Nacionales de Vida Silvestre that include areas of the maritime-terrestrial zone.’ Equally important, Transitory Provision I of the LCVS creates the RNVSO and subjects it to this legislation by stating: ‘The Refugio de Vida Silvestre Ostional is hereby created and, for the purposes of this Law, shall be located within the two hundred meters of the maritime-terrestrial zone extending from Punta India to Punta Guiones, Cantón de Nicoya, Provincia de Guanacaste.

The Executive Branch shall demarcate the Refuge within thirty days following publication of this Law.’ Section 32 of the Ley Orgánica del Ambiente no. 75754 (hereinafter LOA) establishes a classification of protected wild areas (áreas silvestres protegidas), stating: ‘(…) The Executive Branch, through the Ministerio del Ambiente y Energía, may establish protected wild areas under any of the management categories (categorías de manejo) that may be established and those listed below: a) Forest reserves. b) Protective zones. c) National parks. d) Biological reserves. e) National wildlife refuges. f) Wetlands. g) Natural monuments. Those management categories and any created in the future shall be administered by the Ministerio del Ambiente y Energía, except for those established in Article 33 of this law. Municipalities must cooperate in preserving these areas.’ Likewise, section 34 of the LOA reiterates the authority of MINAE bodies over protected wild areas by providing: ‘Article 34.—Preventive measures.

In State-owned protected wild areas, the Ministerio del Ambiente y Energía shall adopt appropriate measures to prevent or eliminate, as soon as possible, exploitation or occupation throughout the area and to ensure respect for the ecological, geomorphological, and aesthetic characteristics that led to its establishment.’ Evidently, under the cited laws, protected wild areas located within the maritime-terrestrial zone are property dedicated to the public domain, over which SINAC and MINAE possess broad authority, including the control, prevention, or elimination of sources of danger in the management of such zones to ensure their proper exploitation and occupation.

VIII.As to the substance of the first claim, the Court held that, given its location and characteristics, possession (posesión) such as that alleged by the plaintiff is ineffectual with respect to public lands. It added that, although mere holding (detentación) or authorized use—a use permit (permiso de uso)—is a legal mechanism that could be recognized within the framework of the plaintiff’s allegations, it cannot be equated with civil possession (posesión civil) for purposes of establishing title (título) such as that claimed by the plaintiff. The adjudicatory body noted that section 9 of Ley 6043 describes the natural features of the coastal zone that comprise such public property, including the physical location identified by the plaintiff as his own. Along the same lines, it held that the claimant is incorrect in alleging a lack of statutory provisions governing the demarcation (demarcación) of the maritime-terrestrial zone (zona marítimo terrestre), because sections 9 and 10 of the aforementioned legislation provide a precise description of the physical area it encompasses.

In any event, it observed that sections 62 and 63 of the Regulations to Ley 6043 establish rules concerning the demarcation of the public zone (zona pública), and this does not constitute a legal impediment to determining the location of the appellant plaintiff’s property in these proceedings. It reasoned that, although there is some merit to his assertion that, prior to the enactment of Ley 6043, the legislation “was more permissive in recognizing possession,” under the principle that no one has a right to the immutability of the law, even if rules may previously have existed that could have supported the holding of the land, the fact remains that those rules changed substantially, rendering the basis now asserted untenable. It stated that the argument that Ley 6043 does not apply in Nombre238504 Sur because it is an area declared a Wildlife Refuge (Ostional) is unfounded, since section 73 of the cited Law actually produces a substantial increase in the degree of regulation applicable to that area, never an exempting effect as the appellant claims.

It asserted that, under the LCVS, declaring the site a refuge protects the natural resource involved, before which all other competing interests must yield. In that regard, it found that the declaration of Playa Guiones as a National Wildlife Refuge creates an ecologically significant area governed by rules of “enhanced legal protection” (derecho reforzado), to which all provisions designated by the Legal System as applicable to the site must be observed. It continued that the exclusionary effect which the plaintiff attributes to section 73 of Ley 6043 does not arise as a matter of law; rather, its effect is inclusive and comprehensive of the legislation governing the various biological and ecological phenomena occurring at the site and in the “surrounding and supporting ecosystems” that enable its continued existence and sustainability. It emphasized that the cited section 73 has a different meaning from that alleged by the appellant.

It stated that the dissatisfied party is incorrect in asserting that the public zone had not been demarcated when he built, because—as it reiterated—according to the language of the lease agreement (contrato de arrendamiento) entered into with the Municipalidad de Nicoya, the western boundary of the right granted to Mr. Nombre126758 is precisely the 50-meter “Inalienable Zone.” It explained, therefore, that the granted right was indeed delimited and extended only to that boundary, without prejudice to the rights of the remaining adjoining landowners or to the State’s rights over those properties. It likewise stated that, regarding whether the lot at issue in this litigation is situated on a cliff, the fact remains that there is no conclusive evidence demonstrating that it is, while the judicial inspection (reconocimiento judicial) conducted by the court below constitutes evidence to the contrary, as shown by the photograph obtained by the judge who conducted it.

Accordingly, it held that the argument concerning application of the exception provided for in section 21 of Ley 6043 must be rejected because, as reiterated, the proceedings do not establish that the factual circumstances consist of a structure erected on a cliff. It therefore rejected the substantive argument advanced by the appellant, now the petitioner in cassation (casacionista), alleging that the structures are physically situated on a cliff and that Ley 6043 is consequently inapplicable. It further indicated that this position lacks statutory support because the cited Law does not establish that circumstance as a ground for exclusion; moreover, the position is undermined by the opinion rendered by expert Nombre80055 (folios 767-768 of Volume I of the principal record), to the effect that the reduction in the beach area caused by the zone’s tidal dynamics confirms the site’s status as public-domain property (demanialidad), where the structures at issue in these proceedings are located.

This Chamber finds it undeniable that the petitioner in cassation bases his claim on an alleged improper interpretation of section 73 of Ley 6043. That section provides verbatim: “This Law does not apply to maritime-terrestrial zones included within national parks and equivalent reserves, which shall be governed by the applicable legislation.” Plainly, the provision under review exempts certain designated sections of the maritime-terrestrial zone that are included within national parks or reserves equivalent thereto from the application of Ley 6043 and emphasizes that those sections shall be governed by their own laws. In this regard, the Court interpreted the provision at issue as not creating the exempting effect alleged by the appellant but, instead, as having an inclusive effect that is “comprehensive” of the legislation governing the various biological and ecological phenomena present in such protected wilderness areas (áreas silvestres protegidas), as is the RNVSO; this interpretation is persuasive.

Far from excluding the maritime-terrestrial zone from the application of Ley 6043, the section in question provides that, when such zones are also located within national parks or equivalent reserves—which include national wildlife refuges—they shall be subject to their special laws. Thus, far from being exempt from regulation, as the dissatisfied party appears to claim, those sections of the maritime-terrestrial zone are subject to the applicable special laws and, therefore, to the LCVS, the LOA, and Ley 6043 itself. This adjudicatory body further notes that the appellant fails to appreciate the consequences of his assertion, because section 73 of Ley 6043, far from excluding protected zones or wildlife refuges from the public domain (dominio público), instead subjects those areas to the aforementioned legislation, which in many respects expands the State’s authority over such property.

Under no circumstances could it be found that the imposition of even greater public-law restrictions (afectación) upon areas within the public domain could convert areas lying within 200 meters of the high-tide line (pleamar) into private property. Consequently, the petitioner in cassation’s assertions are insufficient to discredit the Court’s analysis. They therefore lack the force necessary to overturn the judgment, since the judges’ reasoning concerning the enhanced statutory protection afforded by the regulations applicable to the areas under review is sound. Those areas are plainly subject to the provisions of the LCVS, the LOA, and, where pertinent, Ley 6043 itself; accordingly, the claim must be rejected.

IX.In the second ground, the appellant asserts a violation of material res judicata (cosa juzgada material). Material res judicata consists of the bar against relitigating, on a subsequent occasion, a dispute already resolved by the court of competent jurisdiction, meaning that the decision is immutable and final. It is a doctrine that applies to the substantive legal relationship, and it requires complete identity between the dispute decided and the dispute subsequently brought, that is, identity of parties, subject matter, and cause of action. Thus, this Chamber has stated that it arises when “[…] between two proceedings conducted before the courts there is identity as to the parties, the subject matter, and the cause of action. From the subjective standpoint, the final judgment binds and obligates the parties involved, who are legally barred from submitting the dispute again to another body.

For their part, the subject matter and the cause of action are the objective criteria on the basis of which it must be determined whether material res judicata exists in a particular case. The former consists of what is claimed; that is, it comprises ‘the right recognized, declared, or modified in the judgment, in relation to one or more specific things, or the legal relationship declared, as applicable’ (judgment 740 of 14 hours 45 minutes on 1 de diciembre de 1999, reiterated by citation in judgments 933 of 9 hours 40 minutes on 24 de noviembre de 2006 and 710 of 14 hours 15 minutes on 23 de octubre de 2008). The latter, also known as causa petendi, is identified as the basis of the relief sought; it is ‘the factual reason stated in the complaint as the basis of the claim. It [sic] is composed of the set of facts alleged as the basis of the complaint’ (See judgments no. 985-F-S1-2009 of 11 hours 5 minutes on 18 de setiembre de 2009 and 1-2013 of 9 hours 30 minutes on 17 de enero de 2013).” The appellant maintains that material res judicata exists in relation to two criminal proceedings brought against him, summary proceeding 226/93 T (case file 155-1-93), and no. 98-001385-042-PE.

He contends that, in those matters, he was acquitted of the accusation by judgment 155-93-2 of 13 hours 50 minutes on 18 de octubre de 1994; likewise, he asserts that the judgment of 9 de agosto de 2010, issued in the second proceeding, which he says is not final with respect to the restoration of the public zone (zona pública) to the State, did become final with respect to the criminal conviction, since it was not appealed. Those proceedings sought to establish the plaintiff’s criminal liability, in the first for violation of Ley 6043 and, in the second, for usurpation of public-domain property (bienes del dominio público). In both cases, it is clear that, to establish his culpability, it was essential to prove the subjective element of the offense (elemento subjetivo del tipo penal), namely, the criminal intent (dolo) required to constitute the conduct. It is therefore indisputable that there is no identity between that subject matter and that of the present case, understood as the right recognized, declared, or modified in the criminal judgments in relation to one or more specific things, or the legal relationship disputed in this proceeding.

Although, through punitive action, the first judgment (judgment no. 155-93-2 issued by the Criminal Court of Nombre14358 at 13 hours 50 minutes on 18 de octubre de 1994) absolved the claimant of all criminal liability for the offenses charged, this was due to the absence of the subjective element of the offense, namely, the absence of criminal intent because he was unaware of the unlawfulness of constructing the rustic swimming pool on property in the Public Zone without any permit. Indeed, it is clear that there was no doubt in that proceeding that the possession exercised or the construction undertaken was located partly within the Public Zone. In the second proceeding, based on similar underlying facts, the requested relief is a declaration that his possession in the area is lawful, the nullification of administrative acts, and the issuance of the corresponding permits so that he may remain in possession of the property.

However, exoneration from criminal liability does not entail an automatic right to claim the relief sought in the present proceeding. This is particularly so because, in this case, the acquittal resulted from the absence of criminal intent, after the Criminal Court determined that the boundary markers (mojones) had not yet been installed when the structures were built. Moreover, it was expressly declared that structures did in fact exist within the Public Zone. Accordingly, neither the lawfulness of the possession exercised by the plaintiff, nor the nullification of the administrative acts and decisions sought in the present matter, nor the granting of the permit at issue were matters adjudicated by the criminal courts. Consequently, because there is no identity of subject matter, those judgments are not recognized as having material-res-judicata effect in relation to the matter disputed in this proceeding. It follows that the violation of res judicata alleged by the cassation appellant (casacionista) has not been established.

X.In the third ground, the appellant alleges violation of section 261 of the Civil Code (CC), section 73 and Transitory Provision VII of Ley 6043, through improper application and failure to apply them, essentially because he contends that only the latter legislation declares the maritime-terrestrial zone (zona marítimo terrestre) to be public; hence, because it is not applicable to this particular case by virtue of the frequently cited section 73, there is no other legal provision applicable to this case that establishes the public-domain status (demanialidad) of that zone within National Parks and Wildlife Refuges. This adjudicatory body considers the cassation appellant’s argument untenable. As outlined in considerando VII of this judgment, the definition of private property (bienes privados) set forth in section 261 CC is residual; that is, only property that does not possess the characteristics specified for public-domain property (bienes demaniales) falls within that category.

That classification derives not only from the cited provision but also from the case law of the Constitutional Court and this Chamber, according to which public-domain property is property that has a nature and legal regime distinct from private property because, by the legislature’s express intent, it is dedicated to a special purpose of service to the community that is plainly in the public interest and, for that reason, is not susceptible to private appropriation. It is, in fact, State-owned property of a special legal nature and is therefore not subject to acquisitive prescription (imprescriptibles), attachment (inembargables), or alienation (inalienables). Moreover, its use and exploitation are subject to the police power (poder de policía); hence, its use and exploitation are possible only under legal instruments granted by the competent authority and under the strict oversight of the Public Administration.

(Judgment 2007-2408 of 16 hours 13 minutes on 21 de febrero de 2007. To the same effect, see judgment no. 189-2011, of 9 hours 15 minutes on 3 de marzo de 2011). It follows that the appellant’s claim is unacceptable, because it is not valid to interpret, with respect to property whose particular characteristics have been extensively developed by both the Constitutional Court and this Chamber, that its public nature derives solely and expressly from the application of Ley 6043. In addition to the definitions that this legislation provides for the concepts of maritime-terrestrial zone, public zone, and restricted zone (zona restringida), the second paragraph of section 83 of the Wildlife Conservation Law (LCVS), sections 32 and 34 of the Organic Environmental Law (LOA), and section 3(i) of Ley Forestal, no. 7575 of 16 de abril de 1996, also define and subject areas with certain characteristics to treatment as special areas under State control, vesting broad powers for that purpose, in this particular case, in MINAE.

With regard to the cassation appellant’s citation of section 20 of Ley 6043, it is beyond dispute that, although it creates an exception, that exception applies only to land with a certain geographical configuration whose topography or special conditions mean that it “…cannot be used for public purposes….” Contrary to the assertion made, the provision under review does not exempt areas of “rocky outcrops or cliffs.” Instead, what it actually provides is that, in exceptional cases in which the topography or particular conditions of the land prevent public use, the legislation will not apply. In such cases, section 20 states that “…its development shall be authorized by the respective municipality and the Costa Rican Tourism Institute…,” not indiscriminately, but only provided that “…it is not alienated…” and that a free-transit zone is established to facilitate public use and enjoyment of the beaches, rocky outcrops, and estuaries.

It is evident from the foregoing that the legislation at issue—without this entailing removal from the public domain (desafectación), since an express provision is required for that purpose—provides that, where natural conditions make the development of coastal properties impossible, ICT or the corresponding Municipal Government may be authorized to develop them. Nothing in the wording of the provision supports the conclusion that private parties are authorized to undertake development directly. It should also be noted that no evidence was submitted in this case that would establish the existence of a statutory exception because the area is inaccessible to the public and Ley de la Zona Marítimo Terrestre therefore does not apply. On the contrary, it was shown that structure no. 1, for which a permit was requested from MINAE, was not built on rocky outcrops or cliffs and, likewise, that it was erected within the Public Zone because it encroaches upon boundary marker no. 11 of the Public Zone of Playa Guiones, which is in turn demarcated by boundary markers 10, 11 and 12.

(facts deemed proven 16, 17 and 18). It is therefore indisputable that this is not an exceptional case and that this is not the only statutory provision from which the public character of public-domain property such as that located in the area at issue may be inferred; accordingly, the challenge must be rejected.

XI.Section 221 of the Code of Civil Procedure (CPC) provides that the losing party shall be ordered to pay attorney’s fees and procedural costs (costas personales y procesales). The cassation appellant alleges that it should have been established that he acted in good faith and that the award of costs against him is therefore improper. However, for the majority of the members of this adjudicatory body, an award of costs against the losing party follows merely from the fact that the party lost, that is, from losing the litigation, without this implying either an absence of good faith or that the party’s grounds for litigating were insufficient. Thus, exemption is within the judge’s discretion; accordingly, if the judge does not exercise that discretion, the alleged violation does not arise, because the Court merely applied the provision, which mandatorily requires the party who lost the litigation to pay the costs, as occurred in this case. The objection must therefore be rejected (See judgments no. 306-2006, of 10 hours 20 minutes on 25 de mayo de 2006 and 1325-2011 of 9 hours 15 minutes on 20 de octubre de 2011).

XII.In view of the foregoing, the appeal shall be denied, and its costs shall be assessed against the appellant pursuant to section 611 of the Code of Civil Procedure.

THEREFORE (POR TANTO) The appeal is denied. Its costs shall be borne by the party who filed it.

I.The undersigned member does not share the view expressed by the majority of this Chamber in recital VII (considerando VII) of the foregoing judgment, insofar as it denies cassation review (control casacional) in cases where only the general rule requiring the losing party to pay both categories of legal costs (costas) is applied, that is, where no provision concerning exemption from such costs is invoked or applied. Indeed, the majority’s jurisprudential rationale is based on the premise that exemption from the payment of legal costs is discretionary and that no error or violation of law occurs when that discretion is not exercised or applied; therefore, it is said, if there is no legal violation, the cassation court cannot assess or modify the ruling ordering the losing party to pay costs because, it bears repeating, for the majority of this Chamber, a legal violation can occur only when the corresponding exemption provision is applied (among many others, see judgments of this Chamber no. 1001- F-2002, at 11 hours 50 minutes on 20 de diciembre de 2002; 249-F-2003, at 11 hours 45 minutes on 7 de mayo de 2003; and 306-F-2006, at 10 hours 20 minutes on 25 de mayo de 2006).

At first, this chain of reasoning appears logical because, under this premise, if exemption constitutes a discretionary power, the judge is not required to grant it; and therefore, if the judge does not order or grant such exemption, the provisions governing the matter are not violated. Consequently, if no violation of legal provisions occurs, cassation review is unavailable (see the decisions of this Chamber no. 765 at 16 hours on 26 de septiembre de 2001 and 561-F-2003, at 10 hours 30 minutes on 10 de septiembre de 2003). This line of reasoning enables them to conclude that, in that specific situation (the mere award of costs or the failure to apply the exemptions), the matter “cannot be reviewed at this level” (judgment n° 419-F-03, at 9 hours 20 minutes on 18 de julio de 2003, issued by this same adjudicative body), because it is a situation “not subject to cassation” (judgment n° 653-F-2003, at 11 hours 20 minutes on 8 de octubre de 2003).

Thus, in the opinion of my distinguished colleagues, a cassation appeal (recurso de casación) is unavailable when the discretionary power to grant an exemption is not exercised (see, a contrario sensu, recitals III and VIII, respectively, of decisions 541-F-2003, at 11 hours 10 minutes on día 3, and 563-F-2003, at 10 hours 50 minutes on día 10, both from septiembre de 2003). Accordingly, the majority has held that “… the order requiring the losing party to pay legal costs, as occurred here, is not reviewable at this level, given that the Court merely applied the provision in accordance with its terms” (See recital X of decision no. 68-F-2005, at 14 hours 30 minutes on 15 de diciembre de 2005). In notarial matters, it has been stated even more emphatically: “…the Court required the complainant to pay the costs associated with the claim for damages, a ruling which, it bears repeating, is not subject to cassation.” (recital X of judgment n° 928-F-2006, at 9 hours 15 minutes on 24 de noviembre de 2006).

II.Nevertheless, in the view of the undersigned, the improper failure to apply the provisions allowing exemption from legal costs unquestionably violates the Legal System (Ordenamiento Jurídico) and, specifically, the provisions authorizing such exemption, whether due to error or an improper assessment by the female judges in the particular dispute. To that extent, although it is a discretionary power, it is certainly not immune from cassation review, because a violation of law may occur both in its exercise and in the failure to apply it; accordingly, an improper omission is not, and must not be, synonymous with arbitrariness committed, in such a case, by the Judge himself. This is especially so where the judge has been granted authority subject to specific conditions that limit judicial discretion in this area. Consequently, on this particular issue, I consider that merely applying the general rule of artículo 221 del CPC (requiring the losing party to pay both categories of legal costs) does not foreclose a cassation appeal; on the contrary, the matter is admissible for review on the merits (provided that the statutory requirements are met) in the event of a defect of omission arising from the failure to apply the legal provision authorizing exemption from those costs (precepto 222 del CPC).

Notwithstanding the foregoing, in the specific case under review, this member agrees with the Court’s ruling on the merits insofar as it required the losing party to pay those costs, because the rejection of all arguments challenging the judgment leaves the ruling unchanged and therefore makes it impossible to analyze this issue, a circumstance that leads us to reject the ground of challenge (agravio) and, with it, the appeal filed in this respect.

Proceso ordinario establecido en el Juzgado Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José, por Nombre126758 , casado, doctor en bacteriología; contra el ESTADO, representado por su procurador ambiental José J. Barahona Vargas. Figuran además, como apoderados especiales judiciales del actor, el Lic. Antonio Biolley Riotte y María Gabriela Biolley Aymerich, ambos de domicilio no indicado. Las personas físicas son mayores de edad y, con las salvedades hechas, abogados, vecinos de San José y de estado civil no indicado.

RESULTANDO

1. Con base en los hechos que expuso y disposiciones legales que citó, el actor estableció demanda ordinaria, cuya cuantía se fijó como inestimable, a fin de que en sentencia se declare: “1. Que el actor, Nombre126758 tiene alrededor de 35 años de poseer en concesión, un terreno cito en Playa Guiones, Barrio Nosara, Nicoya, Cantón Segundo de la Provincia de Guanacaste. 2. Que dicho terreno lo adquirido el actor por compra-venta junto con los derechos de posesión uso y habitación, los cuales adquirido de sus anteriores propietarios señores Nombre126759 y de don Ramón Esquivel Esquivel, hoy fallecidos. 3. Que el actor solicitó el derecho de arrendamiento al municipio de Nombre14358 y siempre canceló cumplidamente el canon correspondiente. 4. Que el actor remodeló una antigua piscina existente en el inmueble arrendado, dotándola de un jacuzzi, una bomba y filtros para purificar el agua, hechos por los cuales fue Juzgado (sic) en vía penal por el delito de infracción a la Ley Sobre la Zona Marítimo Terrestre, proceso del cual resultó absuelto de toda pena y responsabilidad, fallo éste que pasó en autoridad de cosa juzgada, formal y material. 5.

Que el Municipio de Nombre14358 en la Administración Carazo intentó quitar -sin excepción- las viviendas y construcciones de la población flotante de Playa Guiones, intento que abandonó en virtud de un pronunciamiento contrario emitido por el Presidente Ejecutivo del I.C.T., fundado a su vez en un dictamen vinculante emitido por el Procurador General de la República, entonces Lic. Francisco Villa Jiménez, pronunciamiento ése conforme al cual los órganos con competencia resolvieron que la Ley de la Zona Marítimo Terrestre no se aplicaba, en general, a la zona de Guiones, ocupada por la población flotante, entre las cuales se encuentra la del actor don Nombre126758 , pronunciamiento que, además de acabar con el problema, dio lugar a que con posterioridad al mismo, el Municipio Nicoyano extendiera nuevos permisos de construcción, así como de renovación de construcciones y otorgara concesiones de uso particular en la faja de 50 metros aledaña al mar. 6.

Que sometido el conflicto a la decisión del I.C.T., este órgano envió a un inspector para que informara quién recomendó lo siguiente: "Observaciones: LOTE SOBRE ACANTILADO A 10 M SOBRE EL NIVEL DEL MAR. CONSTRUCCIÓN DENTRO DE LA ZONA PÚBLICA A 7 M DE ALTURA INCRUSTADA EN CORTE EN EL ACANTILADO. NO INTERFIERE LIBRE TRÁNSITO". "Sugerencias: Por su configuración topográfica de acantilado y por no interferir el libre tránsito de peatones y vehículos, ni el disfrute de la playa se sugiere la aplicación del artículo 21 de la ley 6043”. 7. Que el conflicto lo decidió el I.C.T. mediante resolución firme en la que acogió el pronunciamiento vinculante de la Procuraduría General de la República y el informe y recomendación de su Inspector, declarando que a la zona en conflicto-- Playa Guiones- le era de aplicación la excepción contenida en el artículo 21 de la Ley de la Zona Marítimo Terrestre conforme a la cual dicha Ley no es aplicable a esa parte del territorio nacional. 8.

Que por haber transcurrido más de cuatro años desde que adquirió firmeza la resolución o acto administrativo dictado por el I.C.T. sin que el Estado lo declarara lesivo a los intereses públicos y/o impugnará en sede contencioso administrativa, dicho acto o resolución generó "derechos adquiridos" a favor o en beneficio del actor -Nombre126758 - de las cuales no puede privársele por haber caducado cualquier derecho estatal contrario a lo resuelto por el I.C.T. que para entonces era el único órgano público con competencia para resolver en sede administrativa. 9. Que por haber sido juzgado el actor -en sede penal ante autoridad judicial competente- y por haber resultado absuelto de toda pena y irresponsabilidad, ese falló (sic) paso en autoridad de cosa juzgada, formal y material, de tal modo que la administración no pudo privar al actor en su derecho de arrendamiento, uso y habitación sobre el inmueble ubicado en Playa Guiones, derechos que prevalecen y no puede acusarlo nuevamente por esos mismos hechos. 10.

Que con motivo del fenómeno marítimo terrestre denominado erosión, que afecta la costa continental que baña el Océano Pacífico, la zona pública correspondiente a Nombre238504 desapareció, dando ello lugar a que la llamada milla marítima o zona marítimo terrestre haya perdido los 50 metros aledaños al mar, fenómeno que afecta al Estado como propietario y no al actor Nombre126758 , ni a su terreno. 11. Que en virtud del principio constitucional relativo a la irretroactividad de la Ley, el Ministerio de Ambiente y Energía (MINAE), no puede aplicar al actor Nombre126758 , con efecto retroactivo el Decreto Ejecutivo # 16531-MAG del 18 julio 1985 y la ley de conservación de la vida silvestre (sic) # 7317 y su Reglamento, así como las leyes números 7554 y 7788. 12. Que por el mismo principio de irretroactividad de la ley no pueden el Estado ni sus órganos (Area de Conservación del Tempisque y el Ministerio de Ambiente y Energía) desconocer ni dejar de aplicar a Playa Guiones, el calificativo de “playas de interés turístico” que le diera, mediante acuerdo firme, el I.C.T. y que fuera debidamente promulgado y publicado en el periódico oficial La Gaceta, calificativo que se hizo conforme a la ley y que el Estado no ha declarado lesivo a los intereses públicos ni tampoco lo ha impugnado en la vía contencioso administrativa. 13.

Que en razón de lo expuesto, son nulas, por nulidad absoluta, y así se declara, las siguientes resoluciones: Número 079-ACT-DR, dictada por el Área de Conservación Tempisque a las dieciséis horas con treinta y cinco minutos del día 11 septiembre dos mil. Número 094-ACT-DR, dictada por el Área Conservación Tempisque, a las diez horas con quince minutos del día catorce noviembre del dos mil. Número 006-2002-MINAE dictada por la Ministra de Ambiente y Energía a las once horas del tres enero del año dos mil dos. Número R-220-002-MINAE, dictada por la Ministra de Ambiente y Energía a las ocho horas cuarenta minutos del diecinueve de abril de dos mil dos. 14. Se ordena al Ministerio de Ambiente y Energía prorrogar el permiso del uso bajo la modalidad habitacional al señor Nombre126758 , en cuanto al inmueble objeto de esta litis, sito en Playa Guiones, respetando su posesión, uso y habitación que ha mantenido por más de treinta años. 15. Que se condena al estado al pago de ambas costas del juicio".

2. La representación estatal contestó conforme a folios 319 a 378 interponiendo las defensas previas de caducidad de la acción y acto no impugnable, las cuales fueron resueltas interlocutoriamente de manera parcial. Asimismo, opuso las excepciones de falta de derecho y falta de legitimación ad causam.

3. El Estado planteó reconvención contra el actor, para que en sentencia se declare: “1) Es titularidad pública estatal la zona marítimo terrestre de Nombre238504 o franja de doscientos metros de ancho a lo largo de los litorales, medidos horizontalmente a partir de la línea de pleamar ordinaria, en sus dos secciones: la Zona Pública o faja de cincuenta metros de ancho a contar de la pleamar ordinaria, y Zona Restringida de ciento cincuenta metros aledaños a ésta, hacia el interior del país. La Zona Pública no puede ser objeto de ocupación bajo ningún título, ni en ningún caso, y nadie puede alegar derecho alguno sobre ella.

  • 2)El Decreto 16531-MAG del 18 de julio de 1985, respetando el concepto de zona marítimo terrestre, en sus dos secciones de Zona Pública y Zona Restringida, y su carácter de dominio público, reconocidos por la SALA CONSTITUCIONAL, en el voto 5976 de las 15 horas 42 minutos del 16 de noviembre de 1993, al desestimar la acción de inconstitucionalidad contra ese Decreto, amplió el Refugio Nacional de Vida Silvestre Ostional con el área de doscientos metros de ancho, contados a partir de la pleamar ordinaria, comprendida desde la margen izquierda de la desembocadura del Río Nosara hasta Punta Guiones, y puso su protección bajo responsabilidad del Departamento de Vida Silvestre, hoy Area de Conservación Tempisque, Sistema Nacional de Áreas de Conservación (SINAC), del Ministerio del Ambiente y Energía Refugio Nacional de Vida Silvestre Ostional. Lo que implicó en adelante un cambio, de pleno derechos en la administración y manejo de la zona marítimo terrestre de Playa Guiones, preservando la titularidad pública estatal de los bienes, los cuales quedaron sujetos a nuevos objetivos públicos.
  • 3)Los Refugios Nacionales de Vida Silvestre son áreas silvestres protegidas de dominio público, que integran el Patrimonio Natural del Estado, donde la posesión de los particulares no causa derecho alguno a su favor, y el Estado sólo puede realizar y autorizar en él labores de investigación, capacitación y ecoturismo, con dependencia a las evaluaciones de impacto ambiental que se requieran. Además, a consecuencia del principio de inalienabilidad, no cabe ejercer posesión particular sobre bienes del dominio público, como lo ha reconocido ampliamente por la jurisprudencia constitucional.
  • 4)Aun cuando las áreas de la zona marítimo terrestre de los Refugio Nacionales de Vida Silvestre, en términos generales, se excluyen de la aplicación de la Ley 6043 con el calificativo de “reservas equivalentes” (artículo 73), la Ley de Conservación de la Vida Silvestre Nº 7317 de 30 de octubre de 1992 restituyó la vigencia del concepto de zona marítimo terrestre, en sus dos segmentos: Zona Pública, dedicada al uso común, en tanto sea compatible con los fines del Refugio, y Zona Restringida, al conferir a la Dirección General de Vida Silvestre, hoy refundida en el Sistema Nacional de Áreas de Conservación, las facultades y deberes que para cada una de esas secciones establece la Ley 6043. Reafirman la titularidad demanial del Estado sobre la Zona Pública, con destino a uso común, la Ley de Aguas, al otorgar esa condición a las playas (arts. 1º, inciso I y VIII, 3 inciso I, 69 y 70), y la Ley de Tierras y Colonización, en el artículo 7, inciso b), y asimismo la SALA CONSTITUCIONAL, que ha considerado la Zona Pública o franja de cincuenta metros de ancho a partir de la pleamar ordinaria “núcleo inamovible” e “intangible para el legislador”, y “como tal, no solamente es imposible apropiársela por ningún modo, sino que ha sido puesta al servicio de todas las personas, sin excepción” (Voto 5210-97, de las 16 horas del 2 de septiembre de 1997, Considerando IV).
  • 5)La salvedad contemplada en el Artículo 21 de la Ley 6043 de 2 de marzo de 1997 lo es del destino a uso común de la Zona Pública que fija el artículo 20 ibidem, con prohibición de constituir derechos particulares sobre ella u ocuparla de manera privativa, más no excepciona la aplicación del resto del articulado de esa Ley al sector, y opera bajo los presupuestos ahí establecidos, aclarados por la Procuraduría General de la República en el dictamen C-026-2001; a saber: a) Que se trata de áreas bajo administración municipal; b) con características naturales que impidan el uso público, por su configuración geográfica, topográfica u otras, presupuesto de hecho que debe quedar suficientemente fundado, incluso con criterios técnicos; c) que el interesado tramite y obtenga las autorizaciones administrativas debidamente razonadas que se exigen en la Junta Directiva del Instituto Costarricense de Turismo y del Concejo Municipal del lugar; ch) que el solicitante tramite y, previo cumplimiento de todos los requisitos legales, obtenga la respectiva concesión, de la cual no hay motivo para eximirlo (Ley 6043, arts. 39 y 21); d) que no se privaticen de hecho esas áreas de la zona pública y se establezca una zona de libre tránsito para uso y disfrute de las áreas públicas que el artículo 21 ibid señala y se garantice la seguridad de los peatones; e) que no se dañe a los concesionarios o propietarios de terrenos colindantes; f) además, por mandato constitucional (artículo 50) debe protegerse el ambiente, como límite a la discrecionalidad en el otorgamiento de las autorizaciones y concesión demaniales.
  • 6)En la época que la Municipalidad de Nombre14358 administró la zona marítimo terrestre de Playa Guiones, conforme a la Ley 6043, el contrademandado no tramitó, ni obtuvo de esa Municipalidad e inscribió en el Registro Público de Concesiones de la Zona Marítimo Terrestre, concesión privilegiada para ocupar la Zona Pública de Playa Guiones, en los términos del artículo 21 de la Ley 6043, cumpliendo los requisitos legales que antes se indicaron.
  • 7)Además el inmueble que detenta el señor Nombre126758 en la Zona Pública de Nombre238504 no reuniría los presupuestos exigidos por esa norma (artículo 21, Ley 6043) porque es de topografía plana, no está sobre formaciones rocosas, riscos o acantilados, tiene acceso terrestre, a través de camino, frente a playa de arena para uso público, aprovechable en marea baja, y se privatiza de hecho el lugar en marea alta en razón de que obstruiría por completo el acceso público al sector.
  • 8)El contrademandado no cuenta con concesión municipal otorgada e inscrita en el Registro General de Concesiones para ocupar la zona marítimo terrestre de Playa Guiones, ni tiene contrato de arrendamiento sobre la misma inscrito en ese Registro, otorgado con fundamento en leyes anteriores y legalizado según el Transitorio II de la Ley 6043. La simple solicitud de concesión que en su momento presentó ante la Municipalidad de Nombre14358 no le da derecho alguno a ocupar el inmueble que hoy detenta en la Zona Pública de Playa Guiones, o la Zona Restringida, ni a construir en éstas, conforme lo ha sostenido con reiteración la Sal Constitucional.
  • 9)Al no tener el contrademandado contrato de arrendamiento sobre inmuebles en la zona marítimo de Playa Guiones, otorgado con fundamento en leyes anteriores y legalizado según el Transitorio II de la Ley 6043, no puede derivar ningún derecho de la declaratoria de aptitud turística que de esa Playa hizo el Instituto Costarricense de Turismo para los fines de la ya derogada Ley 4558 de 22 de abril de 1970.
  • 10)El contrademandado no cuenta con permisos de construcción otorgados por la Municipalidad de Nombre14358 para realizar obras (construir o remodelar) en la Zona Pública y Zona Restringida (zona marítimo terrestre) de Playa Guiones, los que no sustituye el pago aislado por dieciséis mil colones hecho el 8 de enero de 1993, recibo Nº 8047, cuyo comprobante aportó a los autos, ni le autorizaba a levantar construcciones en dicha zona pública.
  • 11)Los efectos de la sentencia del Juzgado Penal de Nombre14358 Nº NP 155-93-2 de las 13 horas 50 minutos del 18 de octubre de 1994, dictada en la sumaria Nº226/93 T, que absolvió al señor Nombre126758 por construir en la zona marítimo terrestre de Nombre238504 se limitan a la infracción e imputabilidad penal de los hechos, autoría y caracteres requeridos para aplicar la ley penal bajo la que se le juzgó. Pero no le otorga título de posesión particular sobre la Zona Pública de Playa Guiones, que no lo consiente, transgrediría su régimen jurídico y destino común, implicaría una desafectación que sólo puede hacerse por ley (Sala Constitucional, voto 5226-97, entre otros), y el otorgamiento de títulos habilitantes para ocupar el dominio público marítimo terrestre es un acto inherente al órgano que lo administra; no de los Tribunales Penales. Tampoco legitima su permanencia indefinida en esa Zona Pública.
  • 12)Por la índole pública de los bienes, el contrademandado no puede ejercer posesión particular, a la manera del Derecho Civil, sobre la Zona Restringida, ni menos sobre la Zona Pública de Playa Guiones.
  • 13)El contrademandado carece de título oponible al Estado que le legitime para detentar en forma privativa el inmueble que ocupa en la Zona Pública de Playa Guiones.
  • 14)Es ilegal la detentación o uso especial que ha ejercido y ejerce el señor Nombre126758 en la Zona Pública de la zona marítimo terrestre de Playa Guiones, cantón de Nicoya, por contrariar su régimen de Derecho Público y destino de uso común, hoy en tanto sea compatible con los fines del Refugio Nacional de Vida Silvestre Ostional, del que forma parte.
  • 15)También son ilegales las construcciones que dicho señor ha levantado en esa Zona Pública de Playa Guiones, entre el mojón 11 y 12 del Instituto Geográfico Nacional, consistentes en dos sectores de cabinas, con varios aposentos o módulos, cocina, horno techado, piscina, yacuzzi, terraza, garaje, planchet y muro de contención cercano al mar.
  • 16)El señor Nombre126758 debe desalojar la Zona Pública de Nombre238504 y demoler las construcciones realizadas en la misma y restituir el inmueble a su estado anterior, dentro del plazo prudencial que se le conceda en sentencia, apercibido de que si lo omite se procederá a ejecutar en forma coactiva el desalojo y derribo de obras y restitución, a cuenta suya, con auxilio de la autoridad de policía, en coordinación con el Área de Conservación Tempisque, del Sistema Nacional de Áreas de Conservación del MINAE, órgano administrador del Refugio Nacional de Vida Silvestre Ostional, y con empleo de la maquinaria pesada del MOPT que se requiera para remover las construcciones. Lo anterior, sin perjuicio de las reclamaciones que en vía aparte puedan hacérsele por daños y perjuicios irrogados con motivo del aprovechamiento del inmueble, en proporción al tiempo de su ilícita detentación y la privilegiada ubicación del sitio respecto al mar.
  • 17)Por ir contra su destino de bien de uso común de la Zona Pública de Playa Guiones, en cuanto se concilie con los fines del Refugio Nacional de Vida Silvestre, y no ajustarse el uso que se pretende a las actividades que pueden realizarse dentro del Patrimonio Natural del Estado, son válidas las resoluciones del Director del Área de Conservación Tempisque y de la señora Ministra del Ambiente y Energía, que denegaron al señor Nombre126758 Nombre126758 el permiso de uso para permanecer en la Zona Pública de ese Refugio e impugna en este proceso por ilegalidad.
  • 18)El contrademandado debe pagar ambas costas de este proceso.” 4. El actor reconvenido contestó negativamente y opuso las excepciones de falta de derecho, falta de interés, cosa juzgada, falta de legitimación activa y pasiva; así como la expresión genérica de “sine actione agit”.

5. El juez Billy Araya Olmos, en sentencia n.° 3029-2010 de las 13 horas del 30 de julio de 2010, resolvió: “PRIMERO: Se acoge la excepción de falta de derecho y falta de legitimación ad causam activa, ambas, interpuestas por el Estado. SEGUNDO: Se declara SIN LUGAR en todos sus extremos la demanda CONTENCIOSO ADMINISTRATIVA, en el proceso promovido por Nombre126758 contra EL ESTADO. TERCERO: Se declara CON LUGAR la contrademanda interpuesta por el Representante del Ente Público Mayor. CUARTO: Se deniegan, las excepciones de sine actione agit, falta de derecho, falta de legitimación en sus dos acepciones y cosa juzgada material, interpuestas por el actor -reconvenido. QUINTO: Se declara que la tenencia del inmueble situado entre el mojón 11 y 12, colocados por el Instituto Geográfico Nacional en Playa Guiones, compuesta de dos sectores de cabinas, garaje y muro contención, es ilegal. SEXTO: Se formula el siguiente pronunciamiento, respecto a la antedicha RECONVENCIÓN, para que una vez firme esta Sentencia, se proceda como en Derecho corresponda: a) El desalojo voluntario, por parte reconvenido del antes citado inmueble, situado en la Zona Pública de Playa Guiones.

Para acatar este mandato, se concede un lapso de dos meses, como plazo razonable bajo la doctrina del ordinal 261 de la Ley General de la Administración Pública; b) Una vez hecho lo anterior, deberá derribar la referida construcción, incluido el muro de contención que se indica, por sus propios medios; todo ello dentro del plazo anotado; c) Caso contrario, se ordenará a cuenta suya, realizar dicha demolición con el concurso de la autoridad policial, en asocio con el Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación del MINAE, con auxilio de la maquinaria pesada y operarios que preste al efecto, el Ministerio de Obras Públicas y Transportes. En lo no expresamente concedido entiéndase así denegado. Son ambas costas a cargo del señor Nombre126758 .” 6. Ambas partes solicitaron adición y aclaración de la sentencia n.° 3029-2010 de las 13 horas del 30 de julio de 2010; y, el juez Billy Araya Olmos, en sentencia n.° 3029-2010 BIS de las 9 horas del 6 de setiembre de 2010, resolvió: “De conformidad con los motivos de hecho y derecho precedentes, se declara, PARCIALMENTE CON LUGAR, la solicitud de adición y aclaración, gestionada por las partes respecto de la sentencia número 3029-2010, dictada por este Despacho a las 13:00 hrs. del 30 de julio del 2010.” 7.

El actor reconvenido apeló y, el Tribunal Contencioso Administrativo, Sección Sétima, integrada por los jueces Isaac Guillermo Amador Hernández, Sandra Quesada Vargas y Francisco Jiménez Villegas, en sentencia n.° 148-2012-VII de las 11 horas del 30 de octubre de 2012, dispuso: “Se rechaza la prueba para mejor resolver proveída por la parte actora. Se rechaza por improcedente el incidente de documento nuevo interpuesto por la representación del Estado. En lo que ha sido objeto de impugnación, se confirma la sentencia recurrida.” 8. La licenciada María Gabriela Biolley Aymerich, en su expresado carácter, formula recurso de casación indicando expresamente las razones en las que se apoya para refutar la tesis del Tribunal de instancia.

9. En los procedimientos ante esta Sala se han observado las prescripciones de ley. Interviene en la decisión de este asunto el magistrado suplente Jorge Alberto López González.

CONSIDERANDO

I.El señor Nombre126758 demandó al Estado en julio de 2007. Esbozó, por más de siete lustros antes de que entrara a regir la Ley no. 4558, Ley de Urbanización Turística de la Zona Marítimo Terrestre (en adelante Ley 4558), su padre Nombre126759 , fue dueño de un terreno que compró a don Ramón Esquivel Esquivel, en Nombre238504 de Nosara, Nicoya, con los derechos de posesión, uso y habitación. Afirmó, conforme a la división territorial administrativa de la República, (Decreto Ejecutivo no. 6672-G de 23 de diciembre de 1976, y Ley 4366 de 19 de agosto de 1969), Nombre238504 es un poblado, con una población estable de lugareños. Señaló, en su frente al mar, Nombre238504 presenta riscos y acantilados con formaciones rocosas y pequeñas entradas de arena, que no permiten y/o limitan su uso para bañarse y desembarcar, por el peligro que implican. Alegó, cuando fue adquirida, el acceso por tierra se limitaba al verano, porque no había puentes ni carretera.

Aseguró, otros propietarios eran pilotos privados, quienes se transportaban en avioneta a playas cercanas. Apuntó, antes del final de los años 60, la totalidad de las tierras ribereñas de “Playa Nombre238504 Sur”, pertenecía a tres familias de la zona. No obstante, agregó, solo Nombre238505 , (conocido como Nombre238506) tituló su posesión hasta los 50 metros al amparo de la Ley 4558. Adujo, Nombre238504 forma parte del Refugio Nacional de Vida Silvestre de Ostional (en adelante RNVSO), desde la promulgación de la Ley de Vida Silvestre, Ley 7317 de 7 de diciembre de 1992 (en lo sucesivo LCVS). Anotó, aunque el RNVSO es anterior a 1992, (17 de noviembre de 1983), sus límites anteriores no comprendían la zona marítimo terrestre, al suroeste de la desembocadura del Río Nosara. Agregó, no fue sino hasta 1992, cuando se ampliaron los límites incluyendo el sector de Playa Guiones. Así, esbozó, en el periodo entre la entrada en vigencia de la Ley de la Zona Marítimo Terrestre no. 6043 del 2 de marzo de 1977, (en lo subsecuente Ley 6043), y diciembre de 1992, cuando Nombre238504 pasó a formar parte del RNVSO, la normativa jurídica aplicable a la zona era la Ley 6043, y con anterioridad, las leyes que le precedieron.

Afirmó, aunque Nombre238504 formaba parte del RNVSO, no es sino hasta mediados de 1998, que la Dirección de Vida Silvestre y concretamente el Área de Conservación Tempisque del SINAC (en adelante ACTSINAC), tomó un control efectivo de la zona. Adicionó, con anterioridad, se entendían con la Municipalidad de Nicoya, que mantenía vigente el cobro de cánones como si continuara vigente la Ley 6043. Arguyó, don Nombre126759 , continuó ocupando las viviendas y ranchos que existían en el terreno de examen, incluso los ubicados sobre riscos y acantilados en un área sin playa. Mencionó, don Hernán le cedió una porción de ese terreno hace mas de 30 años, con derechos de uso y habitación, de modo que resulta ser causahabiente de don Ramón Esquivel Esquivel. Manifestó, desde entonces, realizó construcciones, mejorando las antiguas, construyó la casa que ahí mantiene, para lo cual contó con los permisos municipales y construyó una “lanchera”, para pequeñas embarcaciones.

Nombre572, nunca hubo queja de las autoridades, realizó sus actuaciones en forma pública, a título de arrendatario, carácter que fue confirmado por las autoridades administrativas y judiciales. Argumentó, al promulgarse la Ley 6043, puso a derecho su situación, solicitando la concesión a la Municipalidad, la cual le fijó un canon que pagó religiosamente. Nombre635, Nombre238504 cuenta con unas 20 casas. Adicionó, la suya está construida sobre riscos y acantilados, parte de ella ocupa los 50 metros inmediatos a la pleamar. Expresó, aunque en los años 1978-1982, la Corporación de Nombre14358 intentó eliminar viviendas y construcciones en la zona, no obstante, ante dictamen vinculante de la Procuraduría General de la República (en adelante PGR), desistió de ello. Comentó, ello debido a que la PGR y el Instituto Costarricense de Turismo (en lo subsiguiente ICT), decidieron no aplicar la Ley 6043 a las áreas de riscos y acantilados.

De ahí en adelante, dijo, el municipio nicoyano, ha extendido permisos de construcción, de renovación de construcciones y otorgado concesiones en esa faja. Explicó, en enero de 1993, solicitó permiso a esa corporación para remodelar una antigua piscina, edificada con antelación a la entrada en vigencia de la Ley 6043, el cual le fue extendido. Aseveró, en junio de ese año recibió cédula de citación de la Agencia Fiscal de Nicoya, donde se le previno declarar como imputado, en la sumaria 226/93 T (expediente 155-1-93), del Juzgado Penal de Nicoya, por el delito de infracción a la Ley 6043, en relación con las referidas construcciones. No obstante, apuntó, fue absuelto. Transcribió piezas del expediente relativas a la prueba. Arguyó, aunque en diversas oportunidades se ha querido cuestionar su posesión, tanto administrativa o judicialmente, siempre se le ha dado la razón. Sostuvo, además de la sentencia absolutoria (no. 155-93-2 de las 13 horas 50 minutos del 18 de octubre de 1994), en sede penal, numerosos antecedentes confirman su derecho.

Acusó, cuando solicitó al ayuntamiento de Nicoya, el monto correspondiente al canon del año 2000, para cancelarlo, se le indicó que en el futuro, debía realizar ese trámite ante el Ministerio de Ambiente y Energía (en lo sucesivo MINAE), Área de Conservación Tempisque. Comentó, mediante resoluciones 079-ACT-DR de las 16 horas con 35 minutos del 11 de setiembre de 2000, y 094-ACT-DR de las 10 horas 15 minutos del 14 de noviembre de 2000 dicha instancia le denegó el permiso de uso. Para ello, indicó, el MINAE sostuvo que una casa se localiza dentro de la zona pública, por lo que solo le otorgó permiso de uso bajo la modalidad habitacional en el inmueble sito en zona restringida, siempre y cuando cumpliera con los requisitos de la LCVS. Relató, los funcionarios, quienes realizaron la inspección no son topógrafos ni agrimensores, de ahí que sus informes, en su criterio, no puedan determinar si se encontraba o no en la zona pública o restringida, además, no indican el tipo de aparato utilizado para las mediciones.

Adicionó, tampoco establecen si los acompañó un topógrafo, donde llegó la pleamar, antigüedad de la ocupación, existencia de permisos de construcción, pago de cánones, entre otros aspectos que estima necesarios. Narró, la resolución 006-2002-MINAE de las 11 horas del 3 de enero de 2002, confirmó los actos impugnados y dio por agotada la vía administrativa. Igualmente, mediante resolución R-220-2002-MINAE de las 8 horas 40 minutos del 19 de abril de 2002, fue rechazado su recurso de reposición. Afirmó, conforme a la Ley Orgánica del ICT, la administración de las playas de interés turístico se mantuvo bajo el dominio y administración de ese Instituto. Explicó, el 26 de agosto de 1970, el ICT declaró 43 playas como zonas de interés turístico, realizando un levantamiento topográfico de cada ocupante. Subrayó, de esa manera, la Administración levantó un plano a escala, el cual aparece sellado por el Registro General de Concesiones (en lo sucesivo RGC).

Ahí, dijo, consta que entre las estaciones 1 a 4 y 2 a 3, hay una distancia de 33 metros, de ahí que la totalidad del lote se ubica en la zona restringida de 150 metros, mientras que la zona pública fue erosionada por el mar. Adicionó, éste permite evidenciar, que el terreno se ha visto erosionado por la acción del mar, por lo que debe establecerse, cuál es el área afectada para determinar si el resto forma parte de la zona pública o no. Añadió, conforme a la potestad que refiere el numeral 2 de la Ley 6043, el 25 de setiembre de 1981, el RGC, envió un inspector, quien en su informe indicó: “Lote sobre acantilado de 10 metros sobre el nivel del mar. Construcción dentro de la Zona Pública a 7 metros de altura inscrustada en corte en el acantilado. No interfiere el libre tránsito” “Sugerencias: Por su configuración topográfica de acantilado y por no interferir el libre tránsito de peatones y vehículos, ni el disfrute de la playa se sugiere la aplicación del Artículo 21 de la Ley 6043”.

Esbozó, dicho numeral contiene una excepción para zonas cuya topografía impida el uso público, caso en el cual, bajo ciertas condiciones, autorizará su uso turístico. Invocó, la concesión es un acto declarativo de derechos, que solo puede ser eliminado a través del proceso de lesividad. Estimó, se está ante un derecho adquirido y situación jurídica consolidada. Precisó, aunque la LCVS, (publicada en La Gaceta del 7 de diciembre de 1992); creó en su Transitorio I el RNVSO, tal declaratoria no posee efecto retroactivo en perjuicio de situaciones jurídicas consolidadas.

II.Solicita en sentencia se declare que: a) tiene 35 años de poseer en concesión, el terreno de cita; b) adquirió dicho fundo por compraventa junto a los derechos de posesión, uso y habitación, de sus anteriores propietarios; Nombre126759 y Ramón Esquivel Esquivel; c) solicitó el derecho de arrendamiento a la Municipalidad de Nicoya, a quien siempre canceló el canon; d) remodeló una antigua piscina existente en el bien, hechos por los cuales fue juzgado y absuelto de toda pena y responsabilidad en sede penal, por el delito de infracción a la Ley 6043, fallo que pasó en autoridad de cosa juzgada; e) aunque durante la Administración Carazo, el Ayuntamiento de cita, intentó erradicar las viviendas y construcciones de la población flotante de Playa Guiones, abandonó esa política en virtud de un dictamen vinculante de la PGR, conforme al cual los órganos con competencia resolvieron que la Ley 6043 no era aplicable a la zona de interés, pronunciamiento que, acabó con el problema y dio lugar a que la Corporación de Nicoya, extendiera nuevos permisos de construcción y renovación y otorgara concesiones de uso particular en la faja de 50 metros aledaña al mar; f) el ICT envió un inspector a la zona, quien recomendó lo siguiente: "Observaciones: lote sobre acantilado a 10 m sobre el nivel del mar.

Construcción dentro de la zona pública a 7 m de altura incrustada En corte en el acantilado. No interfiere libre tránsito". "Sugerencias: Por su configuración topográfica de acantilado y por no interferir el libre tránsito de peatones y vehículos, ni el disfrute de la playa se sugiere la aplicación del artículo 21 de la ley 6043”; g) el ICT acogió el pronunciamiento vinculante de la PGR y el informe y recomendación de su inspector, declarando que a la zona en conflicto-- Playa Guiones- le era de aplicación la excepción contenida en el precepto 21 de la Ley 6043; h) por haber transcurrido más de cuatro años desde que adquirió firmeza la resolución del ICT, sin que mediara declaración de lesividad, dicho acto generó "derechos adquiridos" a su favor; i) por haber sido absuelto de toda pena y irresponsabilidad en el proceso penal de referencia, fallo que pasó en autoridad de cosa juzgada, formal y material, la Administración no puede privarle de su derecho de arrendamiento, uso y habitación; j) en virtud de la erosión que afecta la costa Pacífica, la zona pública de Nombre238504 desapareció, pues perdió los 50 metros aledaños al mar, fenómeno que solo afecta al Estado; no a su persona ni a su terreno; k) el MINAE no puede aplicarle con efecto retroactivo el Decreto Ejecutivo no. 16531-MAG del 18 julio 1985, la LCVS y su Reglamento, ni las leyes no. 7554 y 7788; tampoco puede el ACTSINAC desconocer ni dejar de aplicar a Playa Guiones, el calificativo de “playa de interés turístico” que le diera el ICT, que se hizo conforme a la ley y que el Estado no ha declarado lesivo a los intereses públicos ni impugnado en la vía contencioso administrativa; m) se declare la nulidad absoluta de las resoluciones: no. 079-ACT-DR; no. 094-ACT-DR, no. 006-2002-MINAE; no. R-220-002-MINAE; n) se ordene al MINAE prorrogarle el permiso de uso bajo la modalidad habitacional, en cuanto al inmueble objeto de esta litis, respetando su posesión, uso y habitación que ha mantenido por más de 30 años; y, o) se condene al Estado al pago de ambas costas.

El Estado contestó negativamente. Opuso las defensas previas de caducidad de la acción y acto no impugnable en la vía jurisdiccional respecto de la resolución no. 220-2002-MINAE, las cuales fueron acogidas interlocutoriamente. Opuso las excepciones de falta de: derecho y legitimación en su doble modalidad. Reconvino. Solicitó declarar: a) que la zona marítimo terrestre de Nombre238504 es de titularidad pública, por lo que no puede ser objeto de ocupación bajo ningún título, ni se puede alegar derecho alguno sobre ella; b) que el Decreto 16531-MAG, respetando el concepto de zona marítimo terrestre y su carácter de dominio público, reconocidos por la Sala Constitucional en el voto 5976 de las 15 horas 42 minutos del 16 de noviembre de 1993, amplió el RNVSO con el área de 200 metros de ancho, contados a partir de la pleamar ordinaria, desde la margen izquierda de la desembocadura del Río Nosara hasta Punta Guiones, cuya protección asignó al ACTSINAC, lo cual implicó un cambio de pleno derecho en la administración y manejo de la zona señalada, preservando la titularidad pública y sujetando los bienes a nuevos objetivos públicos; c) que los Refugios Nacionales de Vida Silvestre son áreas protegidas de dominio público, que integran el Patrimonio Natural del Estado, donde la posesión de los particulares no causa derecho alguno a su favor, y, el Estado sólo puede realizar y autorizar en él labores de investigación, capacitación y ecoturismo, sujetas al impacto ambiental que generen.

Además, a consecuencia del principio de inalienabilidad, no cabe ejercer posesión particular sobre bienes del dominio público, como lo ha reconocido ampliamente la jurisprudencia constitucional; d) aún y cuando las áreas de la zona marítimo terrestre de los Refugio Nacionales de Vida Silvestre, en términos generales, se excluyen de la aplicación de la Ley 6043 con el calificativo de “reservas equivalentes” (artículo 73), la LCVS restituyó la vigencia del concepto de zona marítimo terrestre, en sus dos segmentos: Zona Pública, dedicada al uso común, en tanto sea compatible con los fines del Refugio, y Zona Restringida, al conferir a la Dirección General de Vida Silvestre, hoy refundida en el Sistema Nacional de Áreas de Conservación, las facultades y deberes que para cada una de esas secciones establece la Ley 6043. Reafirman la titularidad demanial del Estado sobre la Zona Pública, con destino a uso común, la Ley de Aguas, al otorgar esa condición a las playas (numerales 1º, inciso I y VIII, 3 inciso I, 69 y 70), y la Ley de Tierras y Colonización, en el artículo 7, inciso b).

Asimismo, que la Sala Constitucional ha considerado la Zona Pública o franja de 50 metros de ancho a partir de la pleamar ordinaria “núcleo inamovible” e “intangible para el legislador”, y “como tal, no solamente es imposible apropiársela por ningún modo, sino que ha sido puesta al servicio de todas las personas, sin excepción” (Voto 5210-97, de las 16 horas del 2 de septiembre de 1997, Considerando IV); e) la salvedad contemplada en el precepto 21 de la Ley 6043, refiere el destino a uso común de la Zona Pública que fija el artículo 20 ibidem, con prohibición de constituir derechos particulares sobre ella u ocuparla de manera privativa, más no excepciona la aplicación del resto del articulado de esa Ley al sector, y opera bajo los presupuestos ahí establecidos, aclarados por la PGR en el dictamen C-026-2001; a saber: i) Que se trata de áreas bajo administración municipal; ii) con características naturales que impidan el uso público, por su configuración geográfica, topográfica u otras, presupuesto de hecho que debe quedar suficientemente fundado, incluso con criterios técnicos; iii) que el interesado tramite y obtenga las autorizaciones administrativas debidamente razonadas que exige el ICT y del Concejo Municipal del lugar; iv) que el solicitante obtenga la respectiva concesión, (Ley 6043, arts. 39 y 21); v) que no se privaticen de hecho esas áreas de la zona pública y se establezca una zona de libre tránsito para uso y disfrute de las áreas públicas que el mandato 21 citado señala, garantizando la seguridad de los peatones; vi) que no se dañe a los concesionarios o propietarios de terrenos colindantes; vii) además, por el ordinal 50 Constitucional debe protegerse el ambiente, como límite a la discrecionalidad en el otorgamiento de las autorizaciones y concesión demaniales; f) en la época que la Municipalidad de Nombre14358 administró la zona marítimo terrestre de Playa Guiones, conforme a la Ley 6043, el contrademandado no tramitó, no obtuvo de esa Municipalidad, ni inscribió en el Registro Público de Concesiones de la Zona Marítimo Terrestre, concesión privilegiada para ocupar la Zona Pública de examen en los términos del mandato 21 de la Ley 6043; g) el inmueble que detenta el actor en la Zona Pública de Nombre238504 no reuniría los presupuestos exigidos por esa norma (artículo 21, Ley 6043) porque es de topografía plana, no está sobre formaciones rocosas, riscos o acantilados, tiene acceso terrestre a través de camino, frente a playa de arena para uso público, aprovechable en marea baja, privatizándose de hecho el lugar en marea alta al obstruir por completo el acceso público al sector; h) el contrademandado no cuenta con concesión municipal inscrita en el RGC para ocupar la zona de interés, ni contrato de arrendamiento sobre aquella con fundamento en leyes anteriores y legalizado según el Transitorio II de la Ley 6043.

La simple solicitud de concesión que en su momento presentó ante el Ayuntamiento de Nombre14358 no le da derecho a ocupar el inmueble que hoy detenta ni a construir en ese lugar, conforme lo ha sostenido la Sala Constitucional; i) al carecer de contrato de arrendamiento sobre inmuebles en dicha zona fundamento y legalizado conforme a leyes anteriores a la Ley 6043, no puede derivar ningún derecho de la declaratoria de aptitud turística que de esa Playa hizo el ICT para los fines de la ya derogada Ley 4558; j) el contrademandado no cuenta con permisos de construcción o remodelación otorgados por esa corporación en la zona marítimo terrestre de examen, los que no sustituye el pago aislado por ¢16.000,00 hecho el 8 de enero de 1993, ni le autorizaba a levantar construcciones en dicha zona pública; k) los efectos de la sentencia del Juzgado Penal de Nombre14358 no. 155-93-2 se limitan a la infracción e imputabilidad penal de los hechos, sin otorgarle título de posesión particular sobre la zona de cita reiterada, cuya transgresión implicaría una desafectación que sólo puede hacerse por ley (Sala Constitucional, voto 5226-97, entre otros), y el otorgamiento de títulos habilitantes para ocupar el dominio público marítimo terrestre es un acto inherente al órgano que lo administra; no de los Tribunales Penales.

Tampoco legitima su permanencia indefinida en esa Zona Pública; l) por la índole pública de los bienes, el contrademandado no puede ejercer posesión particular, a la manera del Derecho Civil sobre la Zona en cuestión; m) el contrademandado carece de título oponible al Estado que le legitime para detentar en forma privativa el inmueble; n) es ilegal la detentación o uso especial que ha ejercido y ejerce el actor en esa zona, por contrariar su régimen de Derecho Público y destino de uso común, hoy en tanto sea compatible con los fines del RNVSO, del que forma parte; o) son ilegales las construcciones que dicho señor ha levantado en esa zona pública entre el mojón 11 y 12 del IGN; p) el actor debe desalojar la Zona Pública de Nombre238504 y demoler las construcciones realizadas en ella y restituir el inmueble a su estado anterior, dentro del plazo prudencial que se le conceda en sentencia, apercibido de que si lo omite se procederá a ejecutar en forma coactiva el desalojo y derribo de obras y restitución, a cuenta suya, con auxilio de la autoridad de policía, en coordinación con el ACTSINAC, y con empleo de la maquinaria del MOPT que se requiera.

Lo anterior, sin perjuicio de otras reclamaciones por daños y perjuicios; q) son válidas las resoluciones del Director del ACT y de la señora Ministra de Ambiente y Energía, que denegaron al accionante el permiso de uso para permanecer en la Zona Pública de ese Refugio; y, que el contrademandado debe pagar ambas costas de este proceso. La actora reconvenida opuso la expresión genérica de sine actione agit. El Juzgado acogió la falta de derecho y falta de legitimación ad causam activa, interpuestas por el Estado. Declaró sin lugar la demanda. Acogió la contrademanda. Denegó las excepciones del actor -reconvenido. Declaró que la tenencia del inmueble situado entre el Dirección25676 en Playa Guiones, es ilegal. Ordenó el desalojo voluntario del reconvenido, para lo cual le concedió dos meses, quien debe derribar la construcción por sus propios medios; caso contrario, se ordenará la demolición a cuenta suya con el concurso de la autoridad policial, en asocio con el ACTSINAC, con auxilio de la maquinaria pesada y operarios del MOPT. En lo no expresamente concedido debe entenderse denegado. Son ambas costas a cargo del actor reconvenido. El Tribunal confirmó. El actor inconforme acude a casación.

Recursos por motivos procesales

III.En la única censura admitida de esta naturaleza, el recurrente endilga indebida aplicación de los incisos 2 y 3 del precepto 575 del Código Procesal Civil (en adelante CPC), y falta de aplicación de las reglas contenidas en los ordinales 5, 330 y 575 párrafo primero de ese cuerpo normativo. Esboza, el numeral 575 del CPC en sus incisos 2 y 3, establece la posibilidad para el apelante de ofrecer prueba documental con el escrito de expresión de agravios, cuando hubiere ocurrido algún hecho que importe excepción superviniente, o cuando el demandado ausente a quien se le hubiere nombrado curador, se apersone en el proceso después de la oportunidad para ofrecer prueba en primera instancia. Dice, acorde al cardinal 5 de ese texto procesal, dicha regla es de orden público y acatamiento obligatorio. Considera, ninguno de los supuestos que establecen los incisos 2 y 3 citados, son aplicables al caso concreto, de ahí que haga mal el Tribunal al aplicarlos en el considerando II del fallo impugnado.

Agrega, en su escrito de expresión de agravios ofreció prueba documental que según indicó, no existía al momento de la presentación de la demanda, por ende no la conocía. De conformidad, estima, a la luz de dichas normas los juzgadores solo podían apreciar las probanzas, con base en los principios de la sana crítica al momento del dictado de la sentencia, no como lo hicieron al rechazar la prueba documental que aportaron. Enfatiza, el Tribunal se equivoca al considerar que se trataba de prueba para mejor resolver. Asevera, entre lo ofrecido figuran dos sentencias judiciales, una de ellas vinculante, donde se alegan violaciones a la Ley de la Jurisdicción Constitucional (en lo sucesivo LJC). Asimismo, asegura, en el considerando II de su fallo, los jueces se refieren nuevamente a dichos elementos demostrativos como prueba para mejor resolver, a pesar de que habían surgido cuando ya se había trabado la litis, la cual resulta indispensable para dirimir el conflicto.

De esa manera, aduce, se viola el mandato 330 del CPC por falta de aplicación, al considerar que no es indispensable para la resolución del asunto. Concluye, se le ha colocado en estado de indefensión, cercenando su derecho de defensa.

IV.En lo pertinente a la prueba para mejor resolver, cuyo rechazo objeta el casacionista, en el fallo 383-2008 de las 15 horas 50 minutos del 6 de junio de 2008, este Órgano expresó: “En relación, esta Sala ha señalado de forma reiterada que la prueba para mejor resolver es del juez y no de las partes, siendo él quien decide su conveniencia y necesidad. Se trata de una facultad que le permite incorporar luego de la fase probatoria, cuando el asunto se encuentra listo para dictar el fallo, elementos demostrativos que considere relevantes para la correcta resolución del proceso, lo que puede suceder incluso en instancia de apelación (artículo 575 del Código de cita) –cuando corresponda- y eventualmente, en casación (609 ibídem). En este sentido, resulta claro que no se trata de corregir las omisiones, negligencias o descuidos de las partes en cuanto a la carga probatoria que les incumbe o bien subsanar deficiencias en las técnicas de defensa, dado que en esta hipótesis se vería seriamente lesionada la igualdad entre los litigantes y comprometería la imparcialidad del juzgador.

De ahí que al ordenarla, deba respetarse la garantía de defensa en juicio de cada uno de los involucrados en el litigio. Sobre el tema, de esta Sala, véase sentencia no. 703 de las 10 horas 30 minutos del 27 de septiembre del 2007. Desde este plano, si bien permite incorporar probanzas que fueron rechazadas en el proceso, declaradas inadmisibles, nulas o inevacuables, ciertamente, la decisión de recabarla es facultativa del órgano jurisdiccional, ergo, corresponde a una valoración discrecional del juzgador, quien puede prescindir de ella sin necesidad de resolución expresa. En torno a los parámetros que determinan su aplicación, de este órgano colegiado, véase resolución no. 268 de las 16 horas 10 minutos del 3 de abril del 2002”. (Consúltense en sentido similar las sentencias no. 728 de las 10 horas 5 minutos del 4 de octubre de 2007, no. 555 de las 9 horas con 50 minutos del 6 de mayo de 2010, y no. 622-2011 de las 9 horas 25 minutos del 26 de mayo de 2011)

V.El Tribunal indicó, al sustanciar la apelación, la actora ofreció con el carácter de prueba para mejor resolver, una serie de documentos que alegó no haber conocido con anterioridad y que detalló a folio 1138 del Tomo II del expediente judicial. Al respecto, opinó, el criterio de admisión reside exclusivamente en el Juez o Tribunal de la causa, dependiendo de si es de influencia decisiva para el proceso (artículo 331 CPC), o que la considere indispensable (artículo 575 párrafos dos y tres del CPC). Agregó, lo anterior en virtud de lo dispuesto en el canon 103 de la Ley Reguladora de la Jurisdicción Contencioso Administrativa (en adelante LRJCA). En esa línea, dijo, con excepción del contrato de arrendamiento suscrito el 27 de setiembre de 1973, procede rechazar en su totalidad la documental aportada en segunda instancia por la accionante, por no ser de “decidida influencia” para la resolución del recurso de apelación interpuesto, pues, habida cuenta de su contenido, no resulta indispensable para ese propósito.

Agregó, en segunda instancia está vedada la reapertura del juicio a pruebas como si se tratare de un asunto “ex novo”, en primera instancia, en el que no se haya practicado prueba o en el que no haya recaído sentencia jurisdiccional, pues ya existe la del A quo, la cual ha sido objeto de impugnación, ya que hacerlo implicaría reabrir el proceso prácticamente en su totalidad, contrariando la naturaleza del recurso de apelación y del derecho, porque se tendrían que resolver en única instancia aspectos que por ley procesal requieren del pronunciamiento de ambas como garantía del debido proceso. Así, arguyó, las probanzas que las partes decidan ofrecer, de conformidad con la facultad que prevé el canon 575 CPC, debe dirigirse a demostrar la pertinencia y legitimidad de lo pretendido en esa instancia del proceso. Aseveró, no se trata entonces de una prueba superflua o dubitativa ni que redunde en lo ya probado o de sesgo superabundante.

Aseguró, tampoco puede el Tribunal ordenar ni admitir elementos probatorios abandonados por la parte proponente, o que revele la intensión de retrasar la tramitación o referente a hechos que no son materia de debate. Lo mismo, adujo, en cuanto a la testimonial que se ofrezca en esta instancia, sobre hechos respecto a los cuales se haya recibido en primera instancia. En esa línea, a juicio de los juzgadores, la que se admita ha de ser la indispensable, para fallar el asunto en segunda instancia. Es decir, para resolver el recurso de apelación interpuesto. Continuó el Tribunal, acorde a las citadas normas procesales la decisión de admitir prueba en segunda instancia, y especialmente, la que se ofrece para mejor resolver, debe sustentarse en criterios de indispensabilidad, potestad radicada en y del exclusivo resorte del cuerpo colegiado, teniéndose presente que la prueba aportada para mejor resolver es del Juez (en su caso, del Tribunal), no de las partes, según lo dispone el citado numeral 575 in fine del CPC.

Así las cosas, consideró procedente rechazar la documental ofrecida por la parte actora en segunda instancia por no estimarla indispensable para fallar el recurso de alzada. Adicionalmente, denotaron los jueces que se trata de prueba documental consistente en la certificación de votos de la Sala Constitucional no. 2020-2009, 13655-2008, sentencia no. 98-2010 del Tribunal de Juicio del Segundo Circuito de Guanacaste; piezas del expediente 08-8554-007-CO tramitado ante la Sala Constitucional y oficios emitidos por el Instituto Geográfico Nacional fechados en enero del 2003; documentos que si bien se relacionan directa o tangencialmente con la temática ambiental –o más concretamente con el tema del Refugio de Vida Silvestre Ostional-, circundante al tema en la forma y con los alcances que lo ha tratado la Sala Constitucional –lo cual en todo caso es tema ajeno a este proceso-, no son esenciales para resolver la apelación interpuesta.

Continuó, mención especial tiene la copia del contrato de arrendamiento suscrito en su momento por el padre del actor y la Municipalidad de Nicoya, respecto al cual destacó que consigna la colindancia oeste del terreno arrendado al padre del actor por el citado ayuntamiento, con la zona inalienable de los 50 metros, lo que permite demostrar que la localización material del terreno arrendado por aquel entonces al señor Nombre126759 no coincide con el lugar donde a la fecha demuestran estar ubicadas las construcciones que fueron objeto del reconocimiento judicial practicado en fecha 25 de Junio de 2009 por la Jueza Claudia Salazar. Enfatizó, dicha infraestructura está inmersa dentro del área de la pleamar como lo muestra lo consignado en el acta de la diligencia constante en autos de folios 695 al 699 en Tomo I del principal (y fotografías en el disco compacto). Acorde a lo anterior, es evidente las probanzas de examen fueron ofrecidas como prueba para mejor resolver, supuesto que acorde al precepto 594 CPC, no constituye una causal de casación por defectos procesales pues no se ajusta al rechazo de prueba admisible.

Adiciónese a lo anterior, esta Sala ha señalado en múltiples ocasiones que el recurso de casación es de naturaleza extraordinaria, el cual cabe solo contra determinadas resoluciones y en el caso de violaciones procesales por los motivos previamente establecidos por el legislador. Opera en ese tanto un principio de taxatividad impugnaticia. (Fallo no. 1013-2006 de las 15 horas del 21 de diciembre de 2006) El rechazo de la prueba para mejor resolver no constituye una causal del recurso por razones procesales de las previstas en el citado canon 594 de la normativa procesal civil. De este modo, en virtud de lo señalado, el cargo debe ser rechazado. Sin perjuicio de lo anterior y a mayor abundamiento de razones, el Tribunal no incurrió en infracción alguna, porque no estaba obligado a admitir como prueba para mejor resolver los documentos propuestos por el demandante, así que al rechazarlos en su mayoría de manera expresa, lo hizo en ejercicio de una facultad que la ley le brinda.

Recurso por razones sustantivas

VI.El casacionista esgrime cuatro reparos por el fondo. En el primero, arguye, los jueces se basan en normas inexistentes, a saber, las comprendidas en la Ley 6043 de 2 de marzo de 1977. Considera, todo estriba en la aplicación e interpretación del numeral 73 de dicha normativa, cuya violación acusa. Dice, la disposición establece que: “La presente Ley no se aplica a las zonas marítimo terrestres, incluidas en los parques nacionales y reservas equivalentes, las cuales se regirán por la legislación respectiva”. Aduce, etimológicamente la frase “no se aplica”, no admite interpretaciones, por el contrario, es un término categórico y absoluto. Agrega, dicha disposición indica además al final, que se regirán por la legislación respectiva, que obviamente no es la Ley 6043. Cita dictámenes de la PGR en apoyo de su tesis. En consecuencia, acusa violada la Ley 6043, por indebida aplicación de los preceptos 1, 2, 3, 9, 10, 11, 12, 13, 18, 19, 20, 21, 26, 29, 34, 35, 36, 37, 38 y 73, así como los numerales 62 y 63 del Reglamento a dicha Ley.

En el segundo motivo, esgrime quebranto de las reglas relativas a la cosa juzgada material. Refiere, los jueces lesionan la cosa juzgada, al volver a conocer de un asunto que ya había sido resuelto por otra autoridad judicial. Señala, a principios de junio de 1993, se le imputaron cargos por infracción a la Ley de la Zona Marítimo Terrestre, relacionadas con las construcciones que mantiene en el terreno objeto de este proceso, incluida la piscina. Aduce, mediante sentencia 155-93-2 de las 13 horas 50 minutos del 18 de octubre de 1994 fue absuelto de dicha acusación. Transcribe los hechos probados en el proceso penal de cita. Alega, a pesar de haber sido absuelto, el Estado planteó un segundo proceso penal en su contra, (sumaria 98-001385-042-PE), por usurpación de bienes de dominio público, donde también intentó el derribo de las construcciones levantadas en ese terreno, esta vez como usurpación del dominio público, pues tiene claro que en la zona no se aplica la Ley 6043.

Añade, en ese proceso se dictó la sentencia del 9 de agosto de 2010, la cual dice, no se encuentra firme en cuanto a la restitución de la zona pública a favor del Estado, no así en cuanto a la condenatoria penal, que si adquirió firmeza, toda vez que fue apelada. Copia el considerando IV del fallo 98-2010 de las 16 horas 30 minutos del 9 de agosto de 2010. Considera obvio que el Estado intenta por tercera vez, se declare que las construcciones levantadas en el terreno, usurpan la Zona Marítimo Terrestre y por ende deben ser demolidas. De ahí que al acoger la contrademanda, esboza, tanto el Juzgado como el Ad quem, violen por falta de la debida aplicación, las reglas relativas a la cosa juzgada, contenidas en los ordinales 162 del CPC, 42 de la Constitución Política y párrafo 4 de la Convención Americana sobre Derechos Humanos (Pacto de San José). También estima violado el principio o garantía procesal de cosa juzgada material.

Arguye, antes de que el MINAE tomara posesión del territorio que vino a conformar la ampliada RNVSO, conforme a la LCVS, la Municipalidad de Nicoya, ente encargado de la administración de la Zona Marítimo Terrestre en su jurisdicción, no le acusó de ocupar la zona pública. Por el contrario, afirma, le imputó haber construido en el terreno que ocupaba en forma quieta, pública y pacífica, ininterrumpida, desde hacía mas de 20 años en aquel momento (1992). Expresa, los juzgadores no se han cuestionado lo anterior. Responde, ello se debe a que la corporación de cita, ente encargado de la administración de la zona en aquella época, le había autorizado a poseer la parcela que ocupaba. Así, esgrime, las sentencias citadas de los Tribunales Penales de Nicoya, conocieron su posesión y le absolvieron, declarando su buena fe, hechos que en su opinión causaron estado. Asevera, su posesión fue conocida por un Tribunal de la República y ese pronunciamiento adquirió firmeza, lo cual constituye cosa juzgada material, que no puede ser rebatida, sin menoscabo de sus derechos y sin violentar la ley.

Concibe, de ello también se colige el quebranto del numeral 34 de la Constitución Política, al aplicar una norma en forma retroactiva. Concluye, también existe litis pendencia, pues la sentencia 98-2010 se dictó dentro un proceso iniciado con anterioridad, la cual no está firme aún. En su tercer motivo, alega infracción de los numerales 261 del Código Civil (en adelante CC), ordinal 73 y Transitorio VII de la Ley 6043, por indebida aplicación y desaplicación. Aduce, para el caso concreto, la ley que determina que la zona marítimo terrestre es pública es la Ley 6043. Agrega, dicha legislación define tal concepto, así como los de zona pública y restringida. Asegura, acorde al ordinal 261 del CC, solo son públicos los bienes propiedad del Estado que están destinados por ley al uso público; y en el caso de la zona marítimo terrestre, la única disposición que la declara pública, es la Ley 6043.

Asevera, en vista de la desaplicación que ese texto legislativo hace en su ordinal 73, no existe para el caso concreto ninguna otra disposición normativa que establezca la demanialidad de la zona marítimo terrestre, en los Parques Nacionales y Refugios de Vida Silvestre o zonas equivalentes. Considera de importancia el derecho de posesión que ha ejercido con anterioridad a la promulgación de la Ley 6043, asimismo, el pago que ha realizado del canon respectivo, como contraprestación al ejercicio de la posesión ejercida sobre la zona marítimo terrestre, norma que respalda tal derecho a su favor. En el cuarto reproche, reclama indebida aplicación del precepto 221 del CPC y desaplicación del numeral 222 de ese cuerpo normativo, por cuanto ha litigado de buena fe, de ahí que no procediera la condenatoria en costas, sino mas bien su exoneración. Estima, no hay duda de que realizó las construcciones en recta aplicación de disposiciones legislativas contenidas en las Leyes 4558 y 6043, además que recibió la posesión de parte de su padre, quien había obtenido un contrato de arrendamiento de las autoridades competentes.

Así, enfatiza, actuó al amparo del ICT y de la Municipalidad de Nicoya, quienes le otorgaron permisos, pagando además los impuestos que para ello le fijaron, cancelando además por mucho tiempo el canon del Ayuntamiento de Nicoya. Nombre9272, además fue juzgado con autoridad de cosa juzgada, por supuesta invasión de la zona marítimo terrestre, en diversas causas, por las construidas levantadas en ese terreno. Así las cosas, concluye, tenía sobrados fundamentos legales para ser considerado litigante de buena fe.

VII.Previo a ingresar al análisis de los cargos, conviene precisar la naturaleza de los bienes demaniales. Al respecto, esta Cámara ha indicado: “…resulta fundamental referirse al concepto de dominio público, y en particular, a los alcances del artículo 261 del Código Civil, el cual diferencia entre bienes públicos y privados, así como los criterios con base en los cuales se puede distinguir entre ambos. Al respecto establece: “Son cosas públicas las que, por ley, están destinadas de un modo permanente a cualquier servicio de utilidad general, y aquellas de que todos pueden aprovecharse por estar entregadas al uso público. / Todas las demás cosas son privadas y objeto de propiedad particular, aunque, pertenezcan al Estado o a los Municipios, quienes para el caso, como personas civiles, no se diferencian de cualquier otra persona.” Como se extrae, la definición de los bienes privados se hace en forma residual, es decir, pertenecen a esta categoría todos aquellos que no presenten ninguna de las características señaladas para los demaniales.

La jurisprudencia constitucional, tomando en cuenta lo preceptuado por la norma citada, se ha referido sobre los bienes que integran el dominio público en los siguientes términos: “son aquellos que tienen una naturaleza y régimen jurídico diverso de los bienes privados –los cuales se rigen por el derecho de propiedad en los términos del artículo 45 de la Constitución Política–, en tanto, por expresa voluntad del legislador se encuentran afectos a un destino especial de servir a la comunidad, sea al interés público, y que por ello, no pueden ser objeto de propiedad privada, de modo que están fuera del comercio de los hombres, por lo cual, no pueden pertenecer individualmente a los particulares, ni al Estado, en sentido estricto, por cuanto éste se limita a su administración y tutela. […] Así, se trata de bienes cuya titularidad ostenta el Estado en su condición de administrador, debe entenderse que se trata de bienes que pertenecen (sic) la "Nación", con lo cual, conforman parte del patrimonio público; y que, por su especial naturaleza jurídica, presentan los siguientes atributos: son imprescriptibles, lo cual implica que por el transcurso del tiempo, no puede adquirirse el derecho de propiedad sobre ellos, ni siquiera de mera posesión, es decir, no pueden adquirirse mediante la usucapión, así como tampoco pueden perderse por prescripción; motivo por el cual los permisos de uso que la Administración conceda sobre ellos, siempre tienen un carácter precario, lo cual hace que puedan ser revocadas por motivos de oportunidad o conveniencia en cualquier momento por la Administración –en los términos previstos en los artículos 154 y 155 de la Ley General de la Administración Pública–; y las mismas concesiones que se otorguen sobre ellos para su aprovechamiento, pueden ser canceladas, mediante procedimiento al efecto; son inembargables, que hace que no pueden ser objeto de ningún gravamen o embargo, ni por particulares, ni por la Administración; y son inalienables, lo que se traduce en la condición de que están fuera del comercio de los hombres; de donde no pueden ser enajenados, vendidos o adquiridos, ni a título gratuito ni oneroso, ni por particulares, ni por el Estado, de modo que están excepcionados del comercio los hombres y sujetos a un régimen jurídico especial y reforzado.

Además su uso y aprovechamiento está sujeto al poder de policía, en tanto, por tratarse de bienes que no pueden ser objeto de posesión, y mucho menos de propiedad, su utilización y aprovechamiento es posible únicamente a través de actos debidamente autorizados, sea mediante concesión o permiso de uso, otorgado por la autoridad competente; y al control constante de parte de la Administración Pública. De manera que comprende bienes inmuebles que tienen una naturaleza y régimen jurídico virtualmente opuesto a la propiedad privada, que deriva de lo dispuesto en el artículo 45 constitucional.” (Fallo 2007-2408 de las 16 horas 13 minutos del 21 de febrero de 2007. En el mismo sentido, consúltese resolución no. 189-2011, de las 9 horas 15 minutos del 3 de marzo de 2011). El numeral 9 de la Ley de la Zona Marítimo Terrestre, no. 6043, de 3 de marzo de 1977, refiere que la zona marítimo terrestre: “… es la franja de doscientos metros de ancho a todo lo largo de los litorales Atlántico y Pacífico de la República, cualquiera que sea su naturaleza, medidos horizontalmente a partir de la línea de la pleamar ordinaria y los terrenos y rocas que deja el mar en descubierto en la marea baja”.

Asimismo, el precepto 10 de la ley de cita, establece que la zona marítimo terrestre: “… se compone de dos secciones: La ZONA PUBLICA, que es la faja de cincuenta metros de ancho a contar de la pleamar ordinaria, y las áreas que quedan al descubierto durante la marea baja; y la ZONA RESTRINGIDA, constituida por la franja de ciento cincuenta metros restantes, o por los demás terrenos en caso de islas. Los islotes, peñascos y demás áreas pequeñas y formaciones naturales que sobresalgan del mar corresponden a la zona pública”. De igual manera, acorde al canon 6 de la ley de cita: “Las disposiciones de esta ley no se aplicarán a las áreas de las ciudades situadas en los litorales, ni a las propiedades inscritas, con sujeción a la ley, a nombre de particulares, ni a aquellas cuya legitimidad reconozcan las leyes”. Asimismo, conforme al cardinal 7 de la Ley 6043: “Los terrenos situados en la zona marítimo terrestre no pueden ser objeto de informaciones posesorias y los particulares no podrán apropiarse de ellos ni legalizados (sic) a su nombre, por éste u otro medio”.

Debe agregarse a lo anterior, conforme al mandato 20 de esta Ley, que: “Salvo las excepciones establecidas por la ley, la zona pública no puede ser objeto de ocupación bajo ningún título ni en ningún caso. Nadie podrá alegar derecho alguno sobre ella. Estará dedicada al uso público y en especial libre tránsito de las personas (…)”. Ahora bien, el numeral 20, excepciona su aplicación, al indicar: “Se exceptúan de lo anterior aquellas secciones que por su configuración geográfica, su topografía o sus condiciones especiales, no puedan aprovecharse para uso público, en cuyo caso se autorizará su desarrollo por la municipalidad respectiva y el Instituto Costarricense de Turismo, siempre que no se enajenen y se establezca una zona de libre tránsito que facilite el uso y disfrute públicos de las playas, riscos y esteros y se garantice la seguridad de los peatones”. Por su parte, el párrafo 2º del precepto 83 de la LCVS, incluye dentro del ámbito de cobertura de esa normativa y otorga facultades al SINAC sobre las zonas marítimo terrestres, cuando en estas se incluyan Refugios de Vida Silvestre, al disponer: “El Sistema Nacional de Áreas de Conservación tendrá las facultades y deberes que establece la Ley no. 6043, respecto de los Refugios Nacionales de Vida Silvestre que incluyen áreas de la zona marítimo terrestre”.

De igual importancia, el Transitorio I, de la LCVS, crea el RNVSO, el cual sujeta a esta normativa, al indicar: “Créase el Refugio de Vida Silvestre Ostional que, para los efectos de esta Ley, estará ubicado en los doscientos metros de la zona marítimo terrestre que se extiende desde Punta India hasta Punta Guiones, Cantón de Nicoya, Provincia de Guanacaste. El Poder Ejecutivo demarcará el Refugio dentro de las treinta días siguientes a la publicación de esta Ley”. Ahora bien, el cardinal 32 de la Ley Orgánica del Ambiente no. 75754, (en lo sucesivo LOA) establece una clasificación de las áreas silvestres protegidas, al referir: “(…) El Poder Ejecutivo, por medio del Ministerio del Ambiente y Energía, podrá establecer áreas silvestres protegidas, en cualquiera de las categorías de manejo que se establezcan y en las que se señalan a continuación: a) Reservas forestales. b) Zonas protectoras. c) Parques nacionales. d) Reservas biológicas. e) Refugios nacionales de vida silvestre. f) Humedales. g) Monumentos naturales.

Esas categorías de manejo y las que se creen en el futuro, serán administradas por el Ministerio del Ambiente y Energía, salvo las establecidas en el artículo 33 de esta ley. Las municipalidades deben colaborar en la preservación de estas áreas”. Asimismo, el precepto 34 de la LOA, reitera la potestad de los órganos del MINAE sobre las áreas silvestres protegidas, al establecer: Artículo 34.- Medidas preventivas. En las áreas silvestres protegidas propiedad del Estado, corresponde al Ministerio del Ambiente y Energía, adoptar medidas adecuadas para prevenir o eliminar, tan pronto como sea posible, el aprovechamiento o la ocupación en toda el área y para hacer respetar las características ecológicas, geomorfológicas y estéticas que han determinado su establecimiento”. Evidentemente, al tenor de lo dispuesto por las leyes de cita, las áreas silvestres protegidas ubicadas en la zona marítimo terrestre son bienes afectados al dominio público, respecto de los cuales, el SINAC y el MINAE poseen amplias facultades que incluyen el control, prevención o eliminación de focos de peligrosidad en el manejo de tales zonas para su adecuado aprovechamiento y ocupación.

VIII.En lo medular, referente al primer cargo, el Tribunal indicó, dada su ubicación y características, la posesión como la que alega la actora no resulta útil sobre terrenos públicos. Agregó, si bien la simple detentación o el uso autorizado –permiso de uso-, es una figura que podría reconocerse en el marco de lo aducido por el accionante, ésta no resulta asimilable a la posesión civil para efectos constitutivos de un título como el que alega el actor. Advirtió, dicho órgano decisor el numeral 9 de la Ley 6043, describe los elementos naturales de la zona costera que conforman ese patrimonio público, incluyendo la ubicación física que describe el actor como su ubicación. En igual sentido, afirmó, no le asiste la razón al demandante en cuanto reclama falta de normativa con rango de ley sobre la demarcación de la zona marítimo terrestre, puesto que los ordinales 9 y 10 del citado cuerpo normativo, formulan una descripción precisa del ámbito físico que comprende.

En todo caso, apuntó, los preceptos 62 y 63 del Reglamento a la Ley 6043, establecen regulaciones en punto a la demarcación de la zona pública, lo que no constituye un obstáculo jurídico para dilucidar la ubicación de la propiedad del actor apelante en este proceso. Argumentó, si bien tiene sentido lo que reclama en cuanto a que antes de la promulgación de la Ley 6043, la legislación “era más permisible para aceptar la posesión”, acorde al principio de que nadie tiene derecho a la inmutabilidad del derecho, aún cuando otrora existiesen normas que pudieren haber sustentado la detentación del terreno, es lo cierto que esa normativa mutó sensiblemente, generando la insubsistencia del fundamento que ahora pretende. Manifestó, carece de acierto lo aducido en cuanto a que la Ley 6043 no es de aplicación en Nombre238504 Sur, por ser un área declarada Refugio de Vida Silvestre (Ostional), dado que en la realidad el cardinal 73 de la Ley de cita, produce un incremento sustancial en el nivel regulatorio que pesa sobre dicha zona, nunca un efecto liberatorio como lo afirma el recurrente.

Aseveró, de acuerdo a la LCVS, al declarar el sitio como refugio, se protege el recurso natural involucrado, frente al cual han de ceder los demás intereses concurrentes. En ese sentido, consideró, la declaratoria de Refugio Nacional de Vida Silvestre recaída sobre Playa Guiones, crea un ámbito ecológicamente relevante, con base en normas de “derecho reforzado”, para el cual se han de observar todas las disposiciones que el Ordenamiento Jurídico prescribe como aplicables al sitio. Continuó, el efecto excluyente que aduce el actor como contenido en el numeral 73 de la Ley 6043, no se produce desde un ángulo jurídico, sino que este es mas bien inclusivo, omnicomprensivo de la legislación respecto de los distintos fenómenos biológicos y ecológicos que se suscitan en el sitio y en los “ecosistemas circundantes y propiciantes” de su permanencia y sostenibilidad. Destacó, el precepto 73 citado tiene otro contenido que no es el aducido por el apelante.

Dijo, no tiene razón el inconforme cuando afirma que al edificar, no estaba delimitada la zona pública, puesto que –reitera-, de acuerdo a la letra del contrato de arrendamiento suscrito con la Municipalidad de Nicoya, el límite oeste del derecho concedido al señor Nombre126758, es precisamente la “Zona Inalienable” de los 50 metros. De tal manera, explicó, sí se delimitó el derecho concedido, el cual llegaba hasta el referido límite, sin perjuicio de los derechos de los restantes colindantes y del que posee el Estado sobre esos fundos. Igualmente, enunció, en punto a si el lote objeto de esta litis se ubica sobre un risco, es lo cierto que no existe prueba contundente que así lo demuestre, siendo el reconocimiento judicial practicado por el A quo, prueba de lo contrario, como lo muestra la fotografía recabada por la jueza que lo practicó. De esa manera, adujo, se rechaza lo alegado en cuanto a la aplicación del régimen de excepción previsto en el ordinal 21 de la Ley 6043, por cuanto se reitera, no está acreditado en el proceso que la especie fáctica esté constituida por una construcción levantada sobre un risco.

Así, rechazó el argumento de fondo que sostiene el apelante, aquí casacionista, cuando alega que las construcciones se ubican materialmente en un risco, motivo por el cual no resulta aplicable la Ley 6043. Dicho criterio, indicó, carece además de respaldo normativo, pues en efecto, la ley de cita no establece ese evento como causal de exclusión, por el contrario, se ve además atenuado por la opinión que rinde el perito Nombre80055 , (folios 767-768 del Tomo I del principal), en el sentido de que el fenómeno de reducción del área de playa por efectos de la dinámica mareal de la zona, reafirma la demanialidad del sitio en que se encuentran las construcciones objeto del proceso. Para esta Sala resulta innegable, el casacionista sustenta su reclamo en una supuesta interpretación indebida del canon 73 de la Ley 6043. Dicho numeral a la letra establece: “La presente ley no se aplica a las zonas marítimo terrestres, incluidas en los parques nacionales y reservas equivalentes, las cuales se regirán por la legislación respectiva”.

Evidentemente, el mandato de examen excepciona la aplicación de la Ley 6043, a ciertas secciones calificadas de la zona marítimo terrestre, que se encuentren incluidas en parques nacionales o reservas equiparadas a éstas, las cuales, subraya, estarán regidas por sus propias leyes. Al respecto, el Tribunal interpretó que la disposición de marras, no crea el efecto liberatorio que aduce el recurrente, por el contrario, posee un efecto incluyente, “omnicomprensivo” de la legislación respecto de los distintos fenómenos biológicos y ecológicos presentes en ese tipo de áreas silvestres protegidas, como lo es el RNVSO, tesis que resulta de recibo. Lejos de excluir la zona marítimo terrestre de la aplicación de la Ley 6043, el canon de referencia dispone que cuando tales zonas estén además comprendidas en parques nacionales o reservas equivalentes, entre las cuales cabe señalar los refugios nacionales de vida silvestre, estos estarán sometidos a sus leyes especiales.

De ahí que tales secciones de la zona marítimo terrestre, lejos de quedar exentas de regulación, como parece, reclama el inconforme, estarán sometidas a las leyes especiales del caso, de ahí que les sea aplicables la LCVS, la LOA y la propia Ley 6043. Ahora bien, nota este órgano decisor que el recurrente no se percata de las consecuencias de su afirmación, pues claramente, el ordinal 73 de la de la Ley 6043, lejos de excluir del dominio público a las zonas protectoras o refugios silvestres, por el contrario, sujeta dichas áreas a la aplicación de la legislación anteriormente citada, la cual agrava en muchos sentidos las potestades estatales sobre tales bienes. En ningún modo podría estimarse que una afectación aún mayor respecto de zonas del dominio, pudiese dejar al dominio privado, zonas contenidas en los 200 metros de la pleamar. En consecuencia, las afirmaciones del casacionista no alcanzan para desacreditar el análisis que realiza el Tribunal.

De esa manera, no posee la fortaleza para quebrar el fallo, toda vez que son valederas las argumentaciones de los juzgadores, en cuanto al refuerzo normativo que posee la regulación aplicable a las zonas de examen, las cuales, evidentemente, se encuentran sometidas a las disposiciones de la LCVS, de la LOA y en lo tocante, a la propia Ley 6043, de ahí que el cargo deba ser rechazado.

IX.En el segundo motivo, el recurrente esgrime el quebranto de la cosa juzgada material. La cosa juzgada material consiste en el impedimento para discutir, en una nueva ocasión, una contienda ya resuelta por el órgano jurisdiccional competente, lo que significa que esa decisión tiene carácter inmutable y definitivo. Es un instituto que recae sobre la relación sustancial, requiere coincidencia plena entre la controversia decidida y la ulteriormente planteada, esto es, identidad en los sujetos, el objeto y la causa. Así, esta Sala ha señalado que se produce cuando “[…] entre dos procesos tramitados en sede judicial existe identidad respecto de las partes, del objeto y de la causa. Desde el plano subjetivo, el fallo firme vincula y obliga a los intervinientes, quienes se hayan impedidos, jurídicamente, para someter, de nuevo, la disputa ante otro órgano. Por su parte, el objeto y la causa son los criterios objetivos con base en los cuales se debe determinar si en un caso concreto existe cosa juzgada material.

El primero consiste en aquello que se reclama, es decir, se encuentra constituido por “el derecho reconocido, declarado o modificado en la sentencia, en relación con una cosa o varias cosas determinadas, relación jurídica declarada, según el caso” (sentencia 740 de las 14 horas 45 minutos del 1 de diciembre de 1999, reiterada mediante cita en los fallos 933 de las 9 horas 40 minutos del 24 de noviembre de 2006 y 710 de las 14 horas 15 minutos del 23 de octubre de 2008). La segunda, también denominada causa petendi, se identifica como el fundamento de lo pretendido, es “la razón de hecho enunciada en la demanda como fundamento de la pretensión. Esta [sic] conformada por el conjunto de hechos alegados como base de la demanda” (Consúltense las sentencias no. 985-F-S1-2009 de las 11 horas 5 minutos del 18 de setiembre de 2009 y 1-2013 de las 9 horas 30 minutos del 17 de enero de 2013). Sostiene el recurrente, existe cosa juzgada material con relación a dos procesos penales seguidos en su contra, sumaria 226/93 T (expediente 155-1-93), y la no. 98-001385-042-PE.

Reclama, en dichos asuntos, mediante sentencia 155-93-2 de las 13 horas 50 minutos del 18 de octubre de 1994 fue absuelto de dicha acusación, asimismo, por sentencia del 9 de agosto de 2010, dictada en el segundo proceso, la cual dice, no se encuentra firme en cuanto a la restitución de la zona pública a favor del Estado, si adquirió firmeza en cuanto a la condenatoria penal, toda vez que no fue apelada. En dichos procesos se pretendió establecer la responsabilidad penal del actor, en el primero, por infracción a la Ley 6043, y, en el segundo, por usurpación de bienes del dominio público. En ambos casos, es claro, a fin de establecer su autoría, resultaba esencial acreditar el elemento subjetivo del tipo penal, esto es, el dolo necesario para configurar la conducta. Luego, resulta incontestable, no existe coincidencia entre ese objeto, y el del presente asunto, entendido como el derecho reconocido, declarado o modificado en las sentencias penales, en relación con una cosa o varias cosas determinadas, o la relación jurídica discutida en este proceso.

Si bien, mediante acción punitiva, en el primer fallo (sentencia no. 155-93-2 dictada por el Juzgado Penal de Nombre14358 a las 13 horas 50 minutos del 18 de octubre de 1994) se exoneró de toda responsabilidad penal al accionante por los delitos imputados, ello se debió a una falta del elemento subjetivo del tipo, esto es, ausencia del dolo, por desconocimiento de la ilicitud, respecto de la construcción sin mediar ningún permiso de la piscina rústica sobre el inmueble de la Zona Pública. En efecto es claro, en dicho proceso no existió duda en cuanto a que la posesión ejercida, o la construcción realizada, se encontraran en parte sobre la Zona Pública. En el segundo, con similares hechos de base, se peticiona la declaratoria de legitimidad de su posesión en la zona, la nulidad de actos administrativos y se otorguen los permisos correspondientes a efecto de mantenerse en la posesión del inmueble.

Sin embargo, la exoneración de la responsabilidad penal, no implica el derecho automático a reclamar lo peticionado en el presente proceso. Particularmente por cuanto, en la especie, la absolutoria se ha presentado como consecuencia de la ausencia de dolo, al determinar el Tribunal Penal, que al momento de realizarse las construcciones, no habían sido colocados aún los mojones. Mas aún, por el hecho de que efectivamente se declaró, existían construcciones sobre la Zona Pública. Así las cosas, ni la legitimidad de la posesión ejercida por el actor, ni la nulidad de los actos administrativos y resoluciones reclamada en el presente asunto y el otorgamiento del permiso en cuestión, fueron aspectos declarados por la jurisdicción penal. Por consiguiente, al no existir identidad en el objeto, no se reconoce el efecto de cosa juzgada material a dichos fallos en relación con el asunto que se discute en este proceso. Como corolario, no se verifica la violación a la cosa juzgada que alega el casacionista.

X.En el tercer cargo, el recurrente alega infracción de los numerales 261 del CC, canon 73 y Transitorio VII de la Ley 6043, por indebida aplicación y desaplicación, básicamente por cuanto aduce, solo esta última normativa declara pública a la zona marítimo terrestre, de ahí que, al no ser aplicable al caso concreto, en virtud del precepto 73 de amplia cita, no existe para el caso concreto ninguna otra disposición normativa que establezca la demanialidad de esa zona, en los Parques Nacionales y Refugios de Vida Silvestre. Estima éste órgano decisor, la tesis del casacionista no es de recibo. Tal y como se esboza en el considerando VII de este fallo, la definición hecha por el numeral 261 CC respecto de los bienes privados, es residual, esto es, que solo pertenecen a esta categoría los bienes que no presenten las características señaladas para los demaniales. Dicha categorización no solo deriva de la disposición de cita, sino también de la jurisprudencia constitucional y de esta Sala, acorde a la cual, son bienes del dominio público aquellos que poseen una naturaleza y régimen jurídico diverso de los privados, en tanto, por expresa voluntad del legislador se encuentran afectos a un destino especial de servicio a la comunidad, de claro interés público, y que por esa razón, no son susceptibles de apropiación.

Se trata en efecto de bienes de titularidad estatal y de una naturaleza jurídica especial, razón por la cual, son imprescriptibles, inembargables, e inalienables. Además su uso y aprovechamiento está sujeto al poder de policía, de ahí que su utilización y aprovechamiento solo sea posible a través de títulos otorgados por la autoridad competente; bajo el estricto control por parte de la Administración Pública. (Fallo 2007-2408 de las 16 horas 13 minutos del 21 de febrero de 2007. En el mismo sentido, consúltese el fallo no. 189-2011, de las 9 horas 15 minutos del 3 de marzo de 2011). De lo anterior resulta, no es aceptable el reclamo esbozado por la recurrente, pues no es válido interpretar, respecto de bienes cuyas características particulares han sido ampliamente elaboradas tanto por el Tribunal Constitucional como por esta Cámara, que su naturaleza pública solo derive en forma expresa, de la aplicación de la Ley 6043.

Aparte de las definiciones que ese texto legislativo ofrece sobre los conceptos de zona marítimo terrestre, zona pública y zona restringida, también el párrafo 2º del precepto 83 de la LCVS, los cardinales 32 y 34 de la LOA, y 3 inciso i) de la Ley Forestal, no. 7575 de 16 de abril de 1996, definen y someten zonas de ciertas características como áreas especiales bajo control del Estado, depositando en en el caso concreto, en el MINAE, amplias facultades para ello. Referente a la cita hecha por el casacionista, del numeral 20 de la Ley 6043, es inobjetable, si bien crea un supuesto de excepción, es claro que ésta solo opera respecto de terrenos de cierta configuración geográfica, en los cuales su topografía o condiciones especiales: “…no puedan aprovecharse para uso público…”. La norma de examen, no excepciona, como se ha pretendido hacer ver, las áreas de “riscos o acantilados”. De manera diversa, lo que en efecto dispone, es que ante casos excepcionales en los cuales la topografía o condiciones particulares del terreno, impidan el uso público, la normativa no será aplicable.

En dichos casos, el numeral 20 refiere, que; “…se autorizará su desarrollo por la municipalidad respectiva y el Instituto Costarricense de Turismo…”, no de manera indiscriminada, sino, siempre y cuando “…no se enajenen…”, y, se establezca una zona de libre tránsito que facilite el uso y disfrute públicos de las playas, riscos y esteros. De lo expuesto es evidente, del texto legislativo en cuestión, sin que ello implique una desafectación, puesto que para ello se necesita una norma expresa, se desprende que ante casos de imposibilidad natural para el desarrollo de fundos costeros, podrá autorizarse al ICT o al Ayuntamiento correspondiente, para su desarrollo. No hay alusión alguna en la letra de la disposición que permita concluir, una autorización para el desarrollo directo por parte de sujetos privados. Nótese que tampoco se aportaron a la especie elementos probatorios que permitan establecer que se está ante un escenario de excepción normativa, por tratarse de una zona de imposible acceso al público, en el cual no resulta de aplicación la Ley de la Zona Marítimo Terrestre.

Por el contrario, se demostró que la construcción no. 1 para la cual se solicitó el permiso al MINAE, no está construida sobre riscos o acantilados, igualmente, que está edificada en la zona pública, pues invade el mojón no. 11 de la zona pública de Playa Guiones, a su vez delimitada por los mojones 10, 11 y 12. (hechos tenidos por demostrados 16, 17 y 18). De esa manera, resulta incontestable, no se está ante un caso de excepción, ni es esta la única disposición legislativa de la cual pueda desprenderse el carácter público de bienes demaniales como los comprendidos en la zona de referencia, razón que impone el rechazo de la censura.

XI.La norma 221 del CPC, establece la condena al vencido al pago de las costas personales y procesales. El casacionista alega, debió establecerse que actuó de buena fue, de ahí que la condena en ese extremo resulte improcedente. Sin embargo, para la mayoría de los integrantes de este órgano decisor, la condenatoria en costas al vencido procede por el sólo hecho de serlo, es decir, por perder el litigio, sin que ello signifique que no haya habido buena fe ni que su motivo para litigar haya sido insuficiente. Así, la exoneración es una facultad del juzgador; que como tal, si no hace uso de ella, no incurre en la violación señalada, puesto que el Tribunal se limitó a actuar la norma, que de manera imperativa impone el pago de las costas a quien perdió el litigio, tal y como en la especie sucedió, por lo que debe rechazarse el reproche (Consúltese votos no. 306-2006, de las 10 horas 20 minutos del 25 de mayo de 2006 y 1325-2011 de las 9 horas 15 minutos del 20 de octubre de 2011).

XII.En mérito de lo expuesto, procederá denegar el recurso, y establecer sus costas a cargo de la recurrente conforme al canon 611 del Código Procesal Civil.

POR TANTO

Se declara sin lugar el recurso. Son sus costas a cargo de quien lo interpuso.

I.La suscrita integrante no comparte el criterio plasmado por la mayoría de esta Sala en el considerando VII del fallo anterior, en cuanto deniega el control casacional para aquellos casos donde sólo se hace uso de la regla general de la condena al vencido en el pago de ambas costas, es decir, cuando no se actúa o aplica ninguna norma atinente a la exoneración de ellas. En efecto, el fundamento jurisprudencial de mayoría, parte de que la exoneración en el pago de las costas es una facultad, en la que no se produce yerro ni infracción normativa cuando no se ejercita o aplica; por ello, se dice, si no hay violación legal, no es posible en casación entrar a valorar o modificar lo resuelto sobre la condena al vencido, pues se repite, para la mayoría de esta Sala, sólo puede haber infracción jurídica cuando se actúa la norma correspondiente a la exoneración (entre muchas pueden verse las sentencias de esta Sala no. 1001- F-2002, de las 11 horas 50 minutos del 20 de diciembre de 2002; la 249-F-2003, de las 11 horas 45 minutos del 7 de mayo de 2003 y la 306-F-2006, de las 10 horas 20 minutos del 25 de mayo de 2006).

La concatenación parece en principio lógica, pues con esta premisa, si la exoneración constituye una facultad, el juzgador no está obligado a exonerar; y por ende, si no ordena o realiza tal exoneración, no viola las normas que corresponden al tema. En consecuencia, si no se da violación de normas, no puede haber revisión casacional (consúltense las resoluciones de esta Sala no. 765 de las 16 horas del 26 de septiembre de 2001 y 561-F-2003, de las 10 horas 30 minutos del 10 de septiembre de 2003). Esta relación de ideas, les permite concluir, que en ese supuesto específico (la simple condena o la inaplicación de las exoneraciones) “no puede ser objeto de examen en esta sede” (de este mismo órgano decisor, sentencia n° 419-F-03, de las 9 horas 20 minutos del 18 de julio de 2003), pues se trata de una hipótesis “no pasible de casación” (fallo n° 653-F-2003, de las 11 horas 20 minutos del 8 de octubre de 2003).

Así, en opinión de los distinguidos compañeros: no tiene cabida el recurso de casación cuando no se hace uso de la facultad exoneratoria (véanse a contrario sensu los considerandos III y VIII, por su orden de las resoluciones 541-F-2003, de las 11 horas 10 minutos del día 3 y 563-F-2003 de las 10 horas 50 minutos del día 10, ambas de septiembre de 2003). De esta forma se ha estimado por la mayoría que “… la condena en costas al vencido, como aquí sucedió no es revisable en esta Sede, habida cuenta de que el Tribunal se limitó a actuar la norma en los términos por ella dispuestos” (Véase el considerando X del voto no. 68-F-2005, de las 14 horas 30 minutos del 15 de diciembre de 2005). Y en materia notarial, con mayor contundencia, se ha señalado: “…el Tribunal le impuso el pago de las costas de la pretensión resarcitoria a la denunciante, pronunciamiento que, se repite, no tiene casación”. (considerando X de la sentencia n° 928-F-2006, de las 9 horas 15 minutos del 24 de noviembre de 2006).

II.Sin embargo, en parecer de la suscrita, la indebida inaplicación de los preceptos que permiten la exoneración de costas, infringe, sin duda, el Ordenamiento Jurídico y, en concreto, las normas que la autorizan, ya sea por error o inadecuada apreciación de las juezas en el conflicto específico. En ese tanto, aunque se trate de una facultad, es lo cierto que no se encuentra inmune al control casacional, pues tanto en su ejercicio como en su inaplicación, puede operar una violación de ley, y en esa medida, la indebida omisión no es ni debe ser, sinónimo de arbitrariedad, en tal caso, cometida por el propio Juzgador. Máxime si se trata de un apoderamiento al juez otorgado con supuestos específicos que limitan su poder discrecional en esta materia. En consecuencia, en este particular aspecto, estimo que con la sola aplicación de la regla general del artículo 221 del CPC (condenatoria al vencido al pago de ambas costas), no se cierran las puertas al recurso de casación, pues al contrario, el asunto es admisible para su examen de fondo (siempre y cuando se cumplan los requisitos de ley) ante un eventual vicio omisivo en la aplicación de la disposición legal que autoriza la exoneración de dichas costas (precepto 222 del CPC).

No obstante lo anterior, en el caso concreto de examen, esta integrante comparte lo dispuesto en el fondo por el Tribunal, en cuanto se impuso a la parte vencida el pago de ellas, porque al denegarse todos los argumentos para impugnar la sentencia, no se varía lo resuelto y por ende no les es posible entrar al análisis de este extremo, circunstancia que nos lleva a rechazar el agravio, y con él, el recurso que en este sentido se formula.
