CRIMINAL CASSATION TRIBUNAL. SECOND JUDICIAL CIRCUIT OF SAN JOSÉ, GOICOECHEA. At twelve o'clock noon on the eighth of May, two thousand and three.

CASSATION APPEALS (RECURSOS DE CASACION) filed in the present case brought against [Nombre1], adult, married, farmer, Costa Rican, born on the twenty-fourth of September, nineteen sixty-one, resident of Santa María de Dota, bearing identity card number CED1, for the offense of ILLEGAL LOGGING (TALA ILEGAL), to the detriment of NATURAL RESOURCES. Participating in the decision on the appeal are judges [Nombre2], Ronald Salazar Murillo, and Jorge Luis Arce Víquez. Appearing before the Cassation Tribunal were Lic. [Nombre3], representing the State, and Lic. [Nombre4], as Prosecutor of the Public Ministry.

BACKGROUND:

1) The Trial Court (Tribunal de Juicio) of Cartago, by resolution issued at nine fifteen in the morning on the fourth of September, two thousand and two, ruled: "POR TANTO: In accordance with the foregoing and articles 36, 39 and 41 of the Political Constitution, numerals 1, 21, 22, 23, 30, 31, 45, 59 et seq., 71 et seq. of the Penal Code, 1, 3.d, 19, 27, 61 paragraphs a and c of the Ley Forestal number 7575, numerals 265 et seq., 324 et seq., 341 et seq., 368 of the Code of Criminal Procedure, [Nombre1] is found to be the responsible author of the offense of ILLEGAL LOGGING AND ANOTHER OFFENSE OF LAND-USE CHANGE (CAMBIO DE USO DE LA TIERRA), committed in MATERIAL CONCURRENCE (CONCURSO MATERIAL) to the detriment of NATURAL RESOURCES, and as such, is sentenced to ONE YEAR AND SIX MONTHS OF IMPRISONMENT FOR EACH OFFENSE, FOR A TOTAL OF THREE YEARS of imprisonment to be served in the manner and at the facilities determined by the prison regulations. The eradication (desarraigo) of the coffee crop is denied; however, the convicted person must allow the regrowth of the re-sprouted oak tree (Roble encino rebrotado), and the use of agrochemicals is prohibited, with the convicted person being required to use only organic fertilizers for the coffee planted. The convicted person may be granted the benefit of a suspended sentence (ejecución condicional de la pena) for a period of five years, with the understanding that if another offense carrying a sentence of more than six months of imprisonment is committed, the benefit shall be revoked. Likewise, this benefit will be forfeited and the sentence must be served if the convicted person prunes, fells, or in any way cuts the re-sprouted oak, or uses fertilizers other than organic ones. Registration in the criminal record registry (registro judicial de delincuentes) and the corresponding notifications to the sentence enforcement court (juzgado de ejecución de la pena) are hereby ordered. Court costs are to be borne by the defendant. Upon reading, the parties are duly notified." (sic)
  • 2)Against the foregoing ruling, Licenciados [Nombre3] and [Nombre4] filed a cassation appeal.
  • 3)Having conducted the corresponding deliberation in accordance with the provisions of article 450 of the Code of Criminal Procedure, the Tribunal addressed the questions raised in the appeal.
  • 4)The relevant legal requirements have been observed throughout the proceedings.

The opinion is drafted by Cassation Judge [Nombre5]; and,

CONSIDERING:

I.The cassation appeals filed by Attorney General (Procurador) [Nombre3] and Prosecutor (Fiscal) [Nombre4] meet the threshold requirements, and therefore, in accordance with §§ 445 and 447 of the C.p.p., they are admitted for adjudication.

II.The second ground of each of the appeals, which are identical, alleges non-observance of §§ 19 of the Ley Forestal and 52 of the Law on Land Use, Management and Conservation of Soils. The appellants contend that the trial court judge committed a judicial error when he denied the request for eradication of the coffee crop used to replace the forest, arguing that this failure to act does not reverse the land-use change made by the defendant, prevents forest regeneration, and damages the Parrita river through the infiltration of agrochemicals. The claim is upheld. Upon examining the lower court judgment in order to resolve the grievances presented by Attorney General [Nombre6] and Prosecutor [Nombre7], this criminal cassation court identifies the error in iudicando committed by the trial judge—that is, an error in the application of substantive law—in the present case consisting of non-observance of §§ 50 and 74 of the Const.Pol., 52 of the Law on Land Use, Management and Conservation of Soils, 2, 6, 10.c, 19 and 38.f of the Ley Forestal, 53, 54 and 55 of the Organic Law on the Environment, and 53 and 54 of the Biodiversity Law.

From the cited body of law derives the principle of forest irreducibility (principio de irreductibilidad del bosque), which establishes the necessary reparation of damages caused to the environment, so that there is no option but to order that the forested land involved in the land-use change offense be restored to forest. Notwithstanding the finding of the offense and the conviction of the defendant, the trial court judge decided "… to allow the continuation of the defendant's coffee-growing activity, which must be carried out in a manner that does not significantly affect the environment…"; the reasoning underlying that decision states that "… it does not seem just, although it may be legal, for the Prosecutor to request the eradication of the coffee under article 140 of the Code of Criminal Procedure, which constitutes a jurisdictional power. Such a request, in this case, does not appear to be commensurate with the wrongfulness of the willful act committed, and could even run contrary to the theory of sentencing based on the measure of the defendant's culpability.

It would affect not only the defendant but also his family… Taking into account that the law mandates such an order, and in view of the expert evidence and statements to the effect that coexistence of coffee and the oak tree is possible, and that if organic fertilizer is applied in the area, it has been said that given the planting method, the river and streams would not be significantly affected…." However, this reasoning is flawed because matters of restitution are independent of the criminal sentence; the same act—for example, an employee stealing from his employer's assets—gives rise to a criminal conviction and imposition of a sentence for simple theft, the restitution of the property, civil compensation for damages, and dismissal from employment, that is, it generates criminal, civil, and labor liability. In the case of environmental offenses, the situation is no different: they generate various forms of liability.

The reasoning set forth in the lower court judgment does not withstand an apagogical analysis (examen apagógico): if the economic hardship of the convicted person's family is a valid reason for not ordering the restoration of the forest, then it is equally valid as a reason to deny civil reparations arising from any other offense. It bears repeating: the criminal aspects and those related to restitution are distinct. Failing to order forest restoration and allowing coffee cultivation on the land at issue in this case is a violation of § 50 of the Const.Pol., as it fails to guarantee a healthy and balanced environment for all human beings on the planet, and disregards the aforementioned principle of forest irreducibility. Furthermore, to consider restitution as discretionary on the part of the court is a gross error; on the contrary, whenever there is an evidentiary basis and restitution is required by law—as in the present case under §§ 52 of the Law on Land Use, Management and Conservation of Soils, 2, 6, 10.c, 19 and 38.f of the Ley Forestal, 53, 54 and 55 of the Organic Law on the Environment, and 53 and 54 of the Biodiversity Law—criminal court judges must order the restoration of things to their original state.

In the present case, the restoration of the forest is required and there is no discretion whatsoever to postpone or deny this ruling; the elimination of the coffee crop and the restoration of the forest must be ordered, without granting or recognizing the defendant any right derived from his offense.

It has already been established that the protection of forest soils enshrined in the repeatedly cited provisions does not end or become suspended when, whether through human actions (deliberate arson, illegal logging, etc.) or natural events (floods, earthquakes, fires, etc.), the forest is diminished; on the contrary, such circumstances require the State to adopt a more aggressive approach to the recovery and conservation of the forest. To think that the duty to protect forest soil and other forest resources ends with any of the aforementioned events would encourage unlawful activities harmful to the environment—replacing ecological resources with agricultural or other forms of exploitation—thereby rendering protection meaningless; that is, the land occupied by forests is irreducible for these reasons, and therein lies the essence of the principle of forest irreducibility. Accordingly, anyone who harms the forest through logging or arson with the purpose of changing the land's designated use, or anyone who seeks to profit from natural disasters that damage forest soil, must understand that there is no possible way to change the land's designated use, and that the State will do whatever is necessary to restore the forest.

That is to say, in the present case the agricultural activity must be removed from the area where the forest must be regenerated. This tribunal reiterates its position that this manner of resolving the matter by the trial court judge reaffirms the normative value of the Const.Pol., which in §§ 50 and 74 guarantees to all of humanity, as a non-waivable right, the right to a healthy and ecologically balanced environment. While what is now being decided does not involve a civil damages action (acción civil resarcitoria), it is nonetheless true that it does not exceed the intent of the law, which requires reparation of damages whenever an offense is committed, regardless of intent or negligence. The restoration of things to their original state is a necessary ruling that must be included in the judgment, whether or not a civil damages action exists; for this very reason, § 361 of the C.p.p. in its paragraph "d)" requires the court of merit to rule on the restitution of things, while paragraph "e)" provides for a ruling on civil matters only when such an action has been filed.

In view of the foregoing, the grievances presented by the Attorney General and the Prosecutor must be upheld, the lower court judgment must be partially reversed insofar as it ordered "… the eradication of the coffee crop is denied; however, the convicted person must allow the regrowth of the re-sprouted oak tree and the use of agrochemicals is prohibited, with the convicted person being required to use only organic fertilizers for the coffee planted…," and in its place the immediate removal of the crops from the land related to this criminal case is ordered, along with the restoration of the forest as soon as possible. The challenged judgment remains in force in all other respects not mentioned herein.

III.No ruling is made with respect to the other grounds of the appeals filed by Attorney General [Nombre6] and Prosecutor [Nombre7], as they revolve around the elimination of the crops planted by the convicted person after illegally logging the forest and changing the land's designated use, an interest that is fully addressed by the ruling in the preceding considerando.

POR TANTO:

The second ground of the appeal (recurso) filed by the Procuraduría General de la República, and the second ground of the appeal filed by the Ministerio Público, are hereby granted. The lower court judgment under review (sentencia venida en alzada) is partially reversed insofar as it provided: "… Denying the uprooting (desarraigo) of the coffee; however, the convicted person must allow the resprouted Roble encino to regrow, and the use of agrochemicals (agroquímicos) is prohibited, the convicted person being obligated to use only organic fertilizers (abonos orgánicos) for the coffee that he planted…"; and in its place, the immediate removal of the crops on the land connected to this criminal case is ordered, along with restoration of the forest as soon as possible. In all matters not mentioned herein, the challenged judgment remains final and binding. No ruling is issued on the remaining grounds of the appeals filed by Procurador [Nombre6] and Fiscal [Nombre7], as those grounds revolve around the removal of the crops planted by the convicted person through the illegal felling of the forest and the land-use change (cambio de uso del suelo) — an interest that is fully satisfied by the decision reached herein.

TRIBUNAL DE CASACION PENAL. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSE, GOICOECHEA. A las doce horas del ocho de mayo del dos mil tres.- RECURSOS DE CASACION interpuestos en la presente causa seguida contra [Nombre1], mayor, casado, agricultor, costarricense, nació el veinticuatro de setiembre de mil novecientos sesenta y uno, vecino de Santa María de Dota, con cédula de identidad numero CED1, por el delito de TALA ILEGAL, en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, los jueces [Nombre2], Ronald Salazar Murillo y Jorge Luis Arce Víquez. Se apersonaron en Casación, el Lic. [Nombre3] en representación del Estado y el Lic. [Nombre4], como Fiscal del Ministerio Público.

RESULTANDO:

1) Que el Tribunal de Juicio de Cartago, mediante resolución de las nueve horas quince minutos el cuatro de setiembre de dos mil dos, resolvió: “POR TANTO: De conformidad con lo expuesto y artículos 36, 39 y 41 de la Constitución Política, numerales 1, 21, 22, 23, 30, 31, 45, 59 y siguientes, 71 y siguientes del Código Penal, 1, 3.d, 19, 27, 61 incisos a y c de la Ley Forestal número 7575 numerales 265 y siguientes 324 y siguientes, 341 y siguientes, 368 el Código Procesal Penal, se declara a [Nombre1] autor responsable de un delito de TALA ILEGAL Y OTRO DELITO DE CAMBIO DE USO DE LA TIERRA cometidos en CONCURSO MATERIAL en perjuicio de LOS RECURSOS NATURALES y como tal, se le impone una pena de UN AÑO Y SEIS MESES DE PRISIÓN POR CADA DELITO, PARA UN TOTAL DE TRES AÑOS de prisión que deberá descontar en la forma y los lugares que determinen los reglamentos penitenciarios. Sin lugar el desarraigo del café, pero deberá el condenado permitir el crecimiento del Roble encino rebrotado y se le prohibe el uso de agroquímicos, quedando obligado sólo al uso de abonos orgánicos para el café que sembró. Se le puede otorgar el beneficio de ejecución condicional de la pena por espacio de cinco años bajo el entendido de que si comete otro delito con pena superior a seis meses de prisión, le será revocado el beneficio. Igualmente perderá este beneficio y tendrá que descontar la pena si poda, tala o de alguna manera corta el encino rebrotado o si utiliza otros abonos que no sean los orgánicos. Se ordena su inscripción en el registro judicial de delincuentes y las comunicaciones respectivas al juzgado de ejecución de la pena. Las costas son a cargo del imputado. Con la lectura, las partes quedan debidamente notificadas.” (sic)
  • 2)Que contra el anterior pronunciamiento, los Licenciados [Nombre3] y [Nombre4], interpusieron Recurso de Casación.
  • 3)Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 450 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el Recurso.
  • 4)Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el Juez de Casación [Nombre5]; y,

CONSIDERANDO:

I.Los recursos de casación planteados por el Procurador [Nombre3] y el Fiscal [Nombre4], cumplen con los requisitos de entrada, por lo que de conformidad con lo preceptuado por los §§ 445 y 447 del C.p.p., se admite para su substanciación.

II.El segundo motivo de cada uno de los recursos, que son idénticos, denuncia la inobservancia de los §§ 19 de la Ley Forestal, y 52 de la Ley de Uso, Manejo y Conservación de Suelos. Opinan los impugnantes que el juzgador de mérito cometió un error judicial, cuando rechazó la petición de desarraigo del cultivo de café con que se sustituyó el bosque, pues con ello no se revierte el cambio de uso del suelo hecho por el imputado, se impide la regeneración del bosque y se daña el río Parrita por la infiltración de los agroquímicos. Se declara con lugar el reclamo. Examinado el fallo de mérito con la finalidad de resolver los agravios expuestos por el Procurador [Nombre6] y por el Fiscal [Nombre7], da cuenta esta corte de casación penal del error in iudicando cometido por el juez de juicio, esto es de un yerro en la aplicación de la ley sustantiva, en el presente caso por inobservancia de lo establecido por los §§ 50 y 74 de la Const.Pol., 52 de la Ley de Uso, Manejo y Conservación de Suelos, 2, 6, 10.c, 19 y 38.f de la Ley Forestal, 53, 54 y 55 de la Ley Orgánica del Ambiente, y 53 y 54 de la Ley de Biodiversidad.

No obstante la comprobación del delito y la condena al imputado, el juzgador de instancia decidió «… permitir la continuidad de la actividad cafetalera del imputado la cual debe realizarse de manera tal que no afecte de manera significativa al medio ambiente…»; el razonamiento en que fincó tal decisión, señala que «… no pareciera ser justo, aunque si podría ser legal, la petición del señor Fiscal del desarraigo del café con base en el artículo 140 del Código Procesal, lo cual constituye una potestad jurisdiccional. Tal petición, en este caso, no pareciera corresponder al disvalor de la acción dolosa cometida, y podría ser hasta atentatorio en contra de la teoría de la determinación de la pena, a partir de la medida de la culpabilidad del encausado.

Que abarcaría o sólo al imputado, sino también a su familia… Tomando en cuenta que la ley obliga a tal imposición y en vista de las pericias y de las manifestaciones en torno a que es posible la coexistencia del café y del roble encino y si se aplican en la zona abono orgánico se ha dicho que por la forma de la siembra el río y las quebradas no resultarían significativamente afectadas…». Sin embargo, el razonamiento es equivocado porque los aspectos de la restitución son independientes de la pena; un mismo hecho, por ejemplo el hurto del empleado al patrimonio de su empleador, genera una condena e imposición de una pena por hurto simple, la restitución de la cosa, la indemnización civil por perjuicios y el despido, es decir, causa responsabilidad penal, civil y laboral. En el caso de los delitos contra el medio ambiente no sucede cosa distinta: generan diversas formas de responsabilidad.

El razonamiento expuesto en la sentencia de instancia no resiste un examen apagógico: si es el sufrimiento económico de la familia del condenado, es razón válida para no ordenar la restitución del bosque, también lo es para denegar la reparación civil derivada de cualquiera otro delito. Se repite: los aspectos penales y los relacionados a la restitución son distintos. No ordenar la restitución del bosque y permitir la explotación cafetalera en el terreno involucrado en esta causa, es violatorio del § 50 de la Const.Pol. porque deja de garantizar un ambiente sano y equilibrado a todos los seres humanos del planeta, amén de ignorar el mencionado principio de irreductibilidad del bosque. Por otra parte, considerar que la restitución es potestativa del tribunal es un error grosero; por el contrario, siempre que exista base probatoria y corresponda de acuerdo a la ley como en el presente caso de acuerdo los §§ 52 de la Ley de Uso, Manejo y Conservación de Suelos, 2, 6, 10.c, 19 y 38.f de la Ley Forestal, 53, 54 y 55 de la Ley Orgánica del Ambiente, y 53 y 54 de la Ley de Biodiversidad los jueces penales deben ordenar la restitución de las cosas a su estado original.

En el presente caso, corresponde restituir el bosque y no hay discrecionalidad alguna para postergar o denegar esta resolución; corresponde ordenar la eliminación del cultivo del café y restablecimiento del bosque, sin conceder o reconocer al imputado derecho alguno derivado de su delito.

Ya se ha dicho que la protección del suelo de los bosques consagrada en las normas de repetida cita, no termina o se suspende cuando por actos de seres humanos (incendios provocados, talas ilegales, etc.) o por hechos de la naturaleza (inundaciones, terremotos, incendios, etc.) el bosque viene a menos; todo lo contrario, esas situaciones imponen al Estado mayor agresividad en la recuperación y conservación del bosque. Pensar que el deber de protección del suelo forestal y de otros elementos del bosque termina por cualquiera de los hechos indicados, estimularía actividades ilícitas lesivas del medio ambiente, para sustituir la ecología por explotaciones agrícolas o de otra naturaleza, con lo que no habría protección verdadera; es decir, el espacio ocupado por los bosques es irreductible por esas, en eso consiste el principio de irreductibilidad del bosque. De este modo, cualquiera que lesione el bosque con tala o incendios con el propósito de cambiar el destino del terreno, o cualquiera que pretenda obtener provecho de desastres naturales que dañen el suelo forestal, debe comprender que no hay forma posible de cambiar el destino del suelo, y que el Estado hará cuanto sea para recuperar el bosque.

Esto es, en el caso de autos deben desaparecer la actividad agrícola del lugar donde corresponde regenerar el bosque. Se reitera el criterio de este tribunal, en punto a que esta forma de resolver por parte del juez de juicio, reafirma el valor normativo de la Const.Pol., que en sus §§ 50 y 74 garantizan a la humanidad entera, con carácter de irrenunciable, el derecho a un ambiente sano y ecológicamente equilibrado. Si bien lo que ahora se resuelve no corresponde a la existencia de una acción civil resarcitoria, es lo cierto que no sobrepasa la voluntad de la ley, que exige la reparación de los daños cuando se cometa delito, con independencia del dolo o de la culpa. La restitución de las cosas a su estado original, es una resolución necesaria que debe disponerse en sentencia, exista o no acción civil resarcitoria; por esta última razón es que el § 361 del C.p.p. en su inciso “d)”, impone al tribunal de mérito pronunciarse acerca de la restitución y las cosas, mientras en el inciso “e)” establece la resolución de los civil solamente cuando exista la acción de tal naturaleza.

Así las cosas, corresponde acoger los agravios expuestos por los señores Procurador y Fiscal, revocar parcialmente la sentencia venida en alzada en cuanto dispuso «… Sin lugar el desarraigo del café, pero deberá el condenado permitir el crecimiento del Roble encino rebrotado y se le prohibe el uso de agroquímicos, quedando obligado sólo al luso de abonos orgánicos para el café que sembró…», y en su lugar se ordena la inmediata exclusión de los cultivos en el terreno relacionado con esta causa penal y restituir el bosque lo antes posible. En lo que no se menciona queda firme la sentencia impugnada.

III.Se omite pronunciamiento acerca de los otros motivos de los recursos del Procurador [Nombre6] y del Fiscal [Nombre7], por gravitar en torno a la exclusión de los cultivos realizados por el condenado, al talar ilegalmente el bosque y cambiar el destino del suelo, interés que se colma con lo resuelto en el considerando anterior.

POR TANTO:

Se declaran con lugar el segundo motivo del recurso formulado por la Procuraduría General de la República, así como el segundo motivo del recurso interpuesto por el Ministerio Público. Se revoca parcialmente la sentencia venida en alzada en cuanto dispuso «… Sin lugar el desarraigo del café, pero deberá el condenado permitir el crecimiento del Roble encino rebrotado y se le prohibe el uso de agroquímicos, quedando obligado sólo al luso de abonos orgánicos para el café que sembró…», y en su lugar se ordena la inmediata exclusión de los cultivos en el terreno relacionado con esta causa penal y restituir el bosque lo antes posible. En lo que no se menciona queda firme la sentencia impugnada. Se omite pronunciamiento acerca de los otros motivos de los recursos del Procurador [Nombre6] y del Fiscal [Nombre7], por gravitar en torno a la exclusión de los cultivos realizados por el condenado, al talar ilegalmente el bosque y cambiar el destino del suelo, interés que se colma con lo aquí resuelto.
