ARTICLE LXXV ARTICLE LXXV DOCUMENT No. 3912-13, 11945-14 At session No. 36-13 of April 16, 2013, Article LXXVII, the request submitted by the Environmental Affairs Commission (Comisión de Asuntos Ambientales), concerning the approval of an environmental manager (gestor ambiental) position (plaza), was referred to the Human Resources Management Directorate (Dirección de Gestión Humana) in order to determine the profile and the possible placement of the position within the structure of the Poder Judicial.
By means of memorandum No. CP-79-14 of May 12, 2014, Máster Francisco Arroyo Meléndez, Director of the Human Resources Management Directorate, communicated the decision taken by the Personnel Council (Consejo de Personal) at session No. 6-2014 held on April 10, 2014, Article VII, which reads verbatim as follows:

"Report SAP-023-2014 of the Position Analysis Section (Sección de Análisis de Puestos) is reviewed.
The conclusions and recommendations of the document are as follows:
For the purpose of bringing this matter to the attention of the Personnel Council, we hereby inform it that the Superior Council (Consejo Superior) at session No. 36-13 held on April 16 of this year, under Article LXXVII, resolved: 'To refer the foregoing communication to the Personnel Department so that it may determine both the profile and the possible placement of the environmental manager position within the structure of the Poder Judicial.' In order to comply with the foregoing directive, the following research was conducted to establish the profile for the corresponding position.
6. CONCLUSIONS Environmental management (gestión ambiental) is a matter of national interest of constitutional standing (Art. 50 Constitución Política), which is why every institution must have and implement an environmental management system (Art. 28 Ley para la Gestión Integral de Residuos). Accordingly, every institution is required by law to have an Institutional Environmental Management Program (Programa de Gestión Ambiental Institucional, PGAI) and an Institutional Environmental Manager position to ensure its implementation and sustainability (Art. 27 and 28 of the Reglamento General a la Ley para la Gestión Integral de Residuos, decreto ejecutivo N° 37567-S-MINAET-H).
The PGAI is a planning instrument that begins with a diagnostic assessment encompassing all aspects of the institution's activities (energy efficiency (eficiencia energética), waste, and climate change, among other environmental matters), with the purpose of establishing and implementing, over the short, medium, and long term, measures for the prevention, mitigation, compensation, or restoration of environmental impacts. This program or plan, as it has also been called, is a cyclical process of planning, implementation, review, and improvement of the procedures and actions carried out by the institution (Art. 2 Reglamento para la Elaboración de Programas de Gestión Ambiental Institucional en el Sector Público de Costa Rica, Decreto Ejecutivo Nº 36499-S-MINAET).
The Poder Judicial has had an Environmental Affairs Commission since September 8, 2009, fulfilling the corresponding legal mandate (Art. 7 Reglamento para la Elaboración de Programas de Gestión Ambiental Institucional en el Sector Público de Costa Rica, Decreto Ejecutivo Nº 36499-S-MINAET). This commission, with the aim of advancing the Poder Judicial's engagement with environmental matters, has prepared a PGAI comprising nine specific programs (wastewater (aguas residuales), drinking water, vehicle fleet management, natural disaster prevention and response, energy efficiency, ordinary solid waste (residuos sólidos ordinarios) management, procurement of environmentally friendly goods and services, review and updating of applicable environmental legislation, and public participation and training).
In accordance with the applicable regulations (Art. 8 Reglamento para la Elaboración de Programas de Gestión Ambiental Institucional en el Sector Público de Costa Rica, Decreto Ejecutivo Nº 36499-S-MINAET), the Institutional Commission's functions include: conducting diagnostic assessments or evaluations to determine the institution's status in the areas of environmental management, waste management, climate change, and energy efficiency; proposing an institutional environmental policy; preparing and implementing the PGAI; submitting reports requested by MINAET; and establishing quantifiable indicators for the PGAI.
It is concluded that, under the applicable regulations, the need for an Environmental Manager position is unquestionable, in order to provide the technical and specialized knowledge required for the preparation of the PGAI, the development of diagnostic assessments, and the implementation of projects on environmental matters; to provide the corresponding progress reports on the PGAI; and to offer recommendations for the prevention, mitigation, compensation, and restoration of environmental damage at the institutional level, among other functions to be established by the Environmental Affairs Commission of the Poder Judicial.
Based on information gathered from various institutions, it can be concluded that many do not have a specific Environmental Manager position, and the functions have been assumed on an additional-duties basis (por recargo) by various positions within the institution (Asamblea Legislativa, Procuraduría General de la República, Tribunal Supremo de Elecciones, Instituto Nacional de Aprendizaje, Municipalidad de San José); however, other institutions do have specific profiles equivalent to that of an Environmental Manager (Compañía Nacional de Fuerza y Luz, Municipalidad de Alajuela, Municipalidad de Santa Ana, Municipalidad de la Unión, and Municipalidad de Tibás).
Regarding the placement of Environmental Manager positions or the units responsible for this subject matter in the institutions consulted, they may be structured in the following ways: attached to a particular process or department (this being the lowest level in the organizational hierarchy and functional authority relationship), as is the case with Compañía Nacional de Fuerza y Luz and the Municipalidades de Alajuela, San José, and Tibás; at the staff level, as in the case of the Municipalidad de la Unión; attached to higher-level bodies within the institution, as occurs at the Instituto Nacional de Aprendizaje and the Municipalidad de Santa Ana; or directly within a specific Institutional Commission for environmental matters (a collegial body composed of representatives from various departments), as is the case at the Asamblea Legislativa and the Tribunal Supremo de Elecciones. It is therefore concluded that there is no specific pattern of organizational placement; rather, positions have been placed in accordance with the organization, needs, and policies of each institution, and the Environmental Manager position may be placed within a Directorate, a Department, at the staff level, or within an Institutional Commission.
In the case of the Poder Judicial, and according to the view of the President of the Environmental Affairs Commission, Justice (Magistrado) Oscar Gonzalez Camacho, consideration could be given to attaching the Environmental Manager position to the Office of the Presidency (Despacho de la Presidencia). However, it is the opinion of this department that there should be an administrative attachment to the Office of the Presidency and a functional attachment to the Environmental Affairs Commission, so that the occupant of the position may be appropriately empowered, as he or she will need to coordinate with many units of the institution in order to properly carry out the position's functions. It should be made clear, however, with respect to the foregoing conclusion, that it represents only a viewpoint resulting from the research conducted, with the understanding that this is not the department competent to make the final decision, which by virtue of its own responsibilities falls to the Planning Department (Departamento de Planificación).
Based on the consultations conducted at various institutions, it can be concluded that there is a similarity in the tasks or functions performed by Environmental Manager positions. For this reason, and taking into account what the law prescribes, the request of the Environmental Affairs Commission, DIGECA, and the information provided by Lic. Mauricio Chacón Hernández, Judicial Expert (Perito Judicial) who has actively participated in the preparation of the PGAI of the Poder Judicial, the functions to be included in the corresponding position profile must encompass the following: diagnostic and research work; establishing guidelines, plans, programs, projects, and lines of action aimed at consolidating public environmental policies; compliance with applicable regulations; preparation of environmental programs; environmental impact assessments (evaluaciones de impacto ambiental); preparation of management indicators; coordination and verification of the implementation of environmental projects; providing technical environmental advice to various units of the institution; waste inventory and management; electricity consumption, water consumption, and fuel consumption management; developing plans to ensure the proper channeling of stormwater (aguas pluviales), greywater, wastewater, and sewage, and their treatment; providing technical criteria and analysis of environmental clauses in public procurement (green procurement (compras verdes)); diagnosis and control of liquid, solid, atmospheric, and hazardous toxic emissions; recycling programs; on-site inspections; representing the institution on environmental matters; preparation, implementation, and monitoring of the PGAI and coordination thereof with DIGECA; providing training; conducting awareness-raising and information campaigns; and carrying out the institutional environmental oversight (regencia ambiental) function (preventing, controlling, and mitigating the environmental impacts generated by the institution).
Regarding the academic degrees that may be considered for this type of position, the following were evaluated: Environmental Management Engineering from the School of Environmental Sciences of the Faculty of Earth and Marine Sciences of the Universidad Nacional; the Bachelor's and Licentiate degrees in Environmental Engineering from the School of Chemistry of the Instituto Tecnológico de Costa Rica; and the Bachelor's and Licentiate degrees in Environmental Health from the School of Health Technologies of the Faculty of Medicine of the Universidad de Costa Rica. It was concluded that all three meet the knowledge requirements that an Environmental Manager professional for the Poder Judicial must have. Given that this professional will be initiating a specific program (environmental management), which involves the preparation, implementation, and monitoring of the PGAI and coordination thereof with DIGECA, it would be appropriate to classify the position in the broad class (clase ancha) of Professional 2 and the narrow class (clase angosta) of Environmental Manager.
7. RECOMMENDATIONS Based on the foregoing conclusions, the following is recommended:
7.1. That the Planning Department evaluate the creation of the Environmental Manager position, not only to comply with the legal requirement that every institution must have this type of position, but also to advance the institutional environmental policy developed by the Environmental Affairs Commission of the Poder Judicial.
7.2. Should the Environmental Manager position be created, it is recommended that the competent and expert administrative body in the subject matter — namely, the Planning Department — be responsible for determining its placement within the organizational structure of the Poder Judicial.
7.3. Should the Environmental Manager position be created by the Planning Department, it is recommended that the classification and grading of the position be in the broad class of Professional 2, narrow class of Environmental Manager.
7.4. The creation of the narrow class of "Environmental Manager" is recommended as presented in Annex No. 1 of this report.
It was resolved: To accept the report in all its aspects, with the indication that, where applicable, coordination shall be carried out with the Occupational Health Section (Sección de Salud Ocupacional) whenever relevant.
- 0 - In a memorandum dated October 13 of the current year, signed by Justice (Magistrada) Carmenmaría Escoto Fernández, in her capacity as Acting Chair (Presidenta interina) of the Comisión de Asuntos Ambientales, the following was communicated:
"Pursuant to the agreement adopted by the Comisión de Asuntos Ambientales of the Poder Judicial, in session No. CAA-06-2014, held on October 7 of the current year, I hereby convey to you the concern shared by all members of said Commission regarding the inability to follow up on the Institutional Environmental Management Plan (Plan de Gestión Ambiental Institucional, PGAI).
According to the "Reglamento para la elaboración de programas de gestión ambiental institucional en el sector público de Costa Rica" (hereinafter, the Reglamento), this instrument is based on "a cyclical process of planning, implementation, review, and improvement of the procedures and actions carried out by an institution in the conduct of its activities, with the purpose of guaranteeing compliance with its environmental objectives and thereby promoting better environmental performance across all institutions of the Public Administration." Because it is a dynamic process, it requires constant development and evolution, which has not yet been possible to achieve.
In the PGAI document, approved by Corte Plena in session N° 35-10 of December 6, 2010, the creation of a position for its oversight was recommended. However, to date, despite the plan having been approved, no such position exists.
On April 8, 2013, former Justice Oscar González and I submitted to the Consejo Superior a request for the creation of an environmental manager (gestor or gestora ambiental) position. That petition was taken up in Session No. 36-13 of April 16 of that same year, and the matter was referred to the Personnel Department so that it could determine the job profile as well as a possible placement for that position within the organizational structure of the Poder Judicial.
In the course of the Commission's follow-up on that agreement, the Dirección de Gestión Humana informed us that the report was recently submitted to you and is scheduled for the session next Thursday.
In this regard, I would like to offer the following reflections in view of the discussion to be held on this matter at that session.
In a conversation held with the Director of Planning, it was conveyed that the requested position was not included in the 2015 budget due to institutional priority considerations, without taking into account that the Institution had established environmental matters as a cross-cutting theme in its planning — both strategic and operational. However, she recommends taking the appropriate steps to ensure the position is included in the 2016 budget, which is to be prepared soon.
It is important to note that, as a monitoring mechanism, the Reglamento provides for the submission of semi-annual reports, with the head authority (jerarca) of each institution being responsible for that process before DIGECA. Likewise, at least one follow-up audit is conducted annually by that office to verify that the plan is being implemented appropriately. To date, the Poder Judicial has not submitted the reports corresponding to the year 2013 or the first half of 2014, given that there is no person responsible for operationalizing, monitoring, and reporting on the environmental programs to which the institution has been committed since the Institutional Environmental Management Plan was approved in 2010.
The foregoing was confirmed by the Auditoría Judicial in official document Nº 406-28-AEE-2214, dated April 7, 2014, which was reviewed by the Consejo Superior in session N° 34-14, where it concluded that the Environmental Management Program at the Institution is not being complied with, due to the absence of a person to coordinate the Program, administer it, and carry out the operational work of coordination, monitoring, and oversight across the various activities conducted under both this Plan and the tasks carried out by the Comisión de Asuntos Ambientales.
The Reglamento identifies as penalties for non-compliance "articles 98, 99, 100 and 101 of the Ley Orgánica del Ambiente; 98, 99 and 100 of the Ley General de la Administración Pública; and 54 and 57 of the Ley para la Gestión Integral de Residuos, without prejudice to other penalties arising from national legislation." Regarding the position and the recommendations made by the Dirección de Gestión Humana, we find it appropriate to note that during 2011 the Poder Judicial paid, for environmental management oversight (regencia ambiental), the sum of $22,160.00 (more than twelve million colones) to an external professional contracted on an hourly basis. Said professional attended, on average, the equivalent of 3 days per month to carry out administrative procedures on behalf of the Poder Judicial before SETENA and to be present during drug destruction operations, which at their peak occurred twice per week.
This took place using an incinerator that was donated to the Organismo de Investigación Judicial (OIJ), which from the outset presented operational and contamination problems. (As part of the operating requirements for an incinerator, emissions analyses are required, including for dioxins and furans, which are highly polluting and potentially carcinogenic chemical compounds. These analyses were conducted, revealing that emissions exceeded the permitted levels by more than tenfold.)
To address the situation, an agreement was thereafter renegotiated with HOLCIM, a facility where an initial agreement had previously been cancelled due to problems with the handling of drugs. That agreement remains in force for one more year (2015). For that same year, the OIJ has a budget allocation for the acquisition of a new incinerator, and it will therefore need to resume the matter of drug destruction operations, returning to the same dynamic as in 2011. For this reason, the creation of a position to handle environmental matters would allow these functions to be covered and would further justify the need for the position.
Furthermore, with respect to the job profile described in the Human Resources report, we would very respectfully like to offer an observation based on the experience of the Departamento de Ciencias Forenses regarding the definition of profiles and job classes for positions in the areas of basic and natural sciences: the academic requirements may be excluding other possible educational backgrounds that would equally be capable of filling the position, and the profile would effectively be restricted to only three basic fields of study. Thus, it is possible that a professional in the natural sciences (biologist, chemist, or similar), holding a postgraduate degree in environmental management or administration (currently offered by various universities in the country), would have sufficient qualifications to meet the position profile and responsibilities.
For the foregoing reasons, I hereby transmit to you the following resolutions adopted by the Commission:
"c. To request the Consejo Superior to evaluate the allocation of resources to appoint a professional to collaborate in the implementation, administration, and monitoring of the PGAI for the years 2014 and beyond, thereby enabling compliance with institutional commitments before MINAE while the study of the environmental manager position is being processed. The person designated as part of the requested human resources shall fulfill all the functions cited in point b) of this resolution. Furthermore, it is resolved to reiterate to the members of the Consejo Superior that this is a matter the Comisión de Asuntos Ambientales has previously raised, given the lack of specialized human resources to handle this work, which is of institutional interest. It is directed that a copy of this request be sent to the Presidency of the Poder Judicial and to Human Resources, given that the job profile is currently being developed." "d.
To inform the Presidency of the Poder Judicial, the members of the Consejo Superior, and the Auditoría Judicial that, in connection with the implementation, administration, and monitoring report for the PGAI corresponding to 2014, and given that no expert has yet been designated to issue said report, Ms. Magda Protty, a representative of DIGECA of MINAE, was summoned to be apprised of the difficulties the institution faces due to the absence of a position to manage the PGAI, with the aim of requesting an extension to the commitments assumed by the Poder Judicial that require an environmental specialist for their fulfillment. Furthermore, to communicate to her the data collected in this regard by the various offices represented by the members of the Comisión de Asuntos Ambientales. Should an extension of the deadline be granted, it will be communicated to the Presidency of the Poder Judicial and to the members of the Consejo Superior, for their respective action." Based on the foregoing, we respectfully request that the Consejo Superior accept the recommendations of the resolutions indicated, as well as the observations made regarding the profile and functions that the person hired for this purpose could fulfill.

Con la finalidad de que sea conocido por el Consejo de Personal, nos permitimos informarle que el Consejo Superior en sesión Nº 36-13 celebrada el 16 de abril del año en curso en su artículo LXXVII acordó: “Trasladar la comunicación anterior al Departamento de Personal a efecto de que determine tanto el perfil así como la posible ubicación de la plaza de gestor en materia ambiental dentro de la estructura del Poder Judicial.”.
Con el fin de cumplir la disposición anterior se procedió a realizar la siguiente investigación con el fin de establecer el perfil del puesto correspondiente.
6. CONCLUSIONES La gestión ambiental es un tema de interés nacional de orden constitucional (Art. 50 Constitución Política), razón por la cual toda institución debe contar e implementar un sistema de gestión ambiental (Art. 28 Ley para la Gestión Integral de Residuos). De tal forma que toda institución por imperativo legal debe tener un Programa de Gestión Ambiental Institucional (PGAI) y un puesto de Gestor Ambiental Institucional que garantice su implementación y sostenibilidad (Art. 27 y 28 del Reglamento General a la Ley para la Gestión Integral de Residuos, decreto ejecutivo N° 37567-S-MINAET-H).
El PGAI es un instrumento de planificación que parte de un diagnóstico que debe contener todos los aspectos relacionados del quehacer institucional (eficiencia energética, residuos y cambio climático, entre otros aspectos ambientales), con el propósito de establecer e implementar a corto, mediano y largo plazo, medidas de prevención, mitigación, compensación o restauración de los impactos ambientales. Este programa o plan como también se le ha denominado, es un proceso cíclico de planificación, implementación, revisión y mejora de los procedimientos y acciones que realiza la institución (Art. 2 Reglamento para la Elaboración de Programas de Gestión Ambiental Institucional en el Sector Público de Costa Rica, Decreto Ejecutivo Nº 36499-S-MINAET).
El Poder Judicial, desde el 8 de setiembre del 2009, cuenta con la Comisión de Asuntos Ambientales cumpliendo con el mandato legal correspondiente (Art. 7 Reglamento para la Elaboración de Programas de Gestión Ambiental Institucional en el Sector Público de Costa Rica, Decreto Ejecutivo Nº 36499-S-MINAET). Esta comisión con el fin de impulsar al Poder Judicial en el tema ambiental ha elaborado un PGAI compuesto por nueve programas específicos (aguas residuales, agua de consumo, control de la flota vehicular, prevención y atención de desastres naturales, eficiencia energética, gestión de los residuos sólidos ordinarios, adquisición de bienes y servicios amigables con el ambiente, revisión y actualización de la legislación ambiental vigente y participación ciudadana y capacitación).
De acuerdo a lo que establece la normativa correspondiente (Art. 8 Reglamento para la Elaboración de Programas de Gestión Ambiental Institucional en el Sector Público de Costa Rica, Decreto Ejecutivo Nº 36499-S-MINAET), la Comisión Institucional tiene como funciones la realización de diagnósticos o evaluaciones para determinar el estado de la institución en tema de gestión ambiental, gestión de residuos, cambio climático y eficiencia energética, proponer una política ambiental institucional, elaborar e implementar el PGAI, remitir informes solicitados por el MINAET y establecer indicadores cuantificables para el PGAI.
Se concluye que de acuerdo a la normativa vigente, es indubitable la necesidad de contar con un puesto de Gestor Ambiental, con el fin de que proporcione el conocimiento técnico y especializado en la elaboración del PGAI, la elaboración de diagnósticos y el desarrollo de proyectos en temas ambientales, brindar los informes de avance correspondientes del PGAI, así como de brindar recomendaciones de prevención, mitigación, compensación y restauración del daño ambiental a nivel Institucional, entre otras que establezca la Comisión de Asuntos Ambientales del Poder Judicial.
De la información recabada en diferentes instituciones se puede concluir que en muchas no se cuenta con un puesto específico de Gestor Ambiental y las funciones han sido asumidas por recargo por diferentes puestos de la institución (Asamblea Legislativa, Procuraduría General de la República, Tribunal Supremo de Elecciones, Instituto Nacional de Aprendizaje, Municipalidad de San José), sin embargo otras instituciones si cuentan con perfiles específicos y homólogos al Gestor Ambiental (Compañía Nacional de Fuerza y Luz, Municipalidad de Alajuela, Municipalidad de Santa Ana, Municipalidad de la Unión y Municipalidad de Tibás).
En cuanto a la ubicación de los puestos de Gestor Ambiental o las dependencias encargadas de ese tema en las instituciones consultadas, se tiene que pueden serlo de la siguiente forma: a un determinado proceso o departamento (siendo este el de menor nivel en la ubicación estructural y de relación de autoridad funcional) como lo es el caso de la Compañía Nacional de Fuerza y Luz y las Municipalidades de Alajuela, San José y Tibás; también a nivel de staff como en el caso de la Municipalidad de la Unión; adscrito a instancias superiores de la institución como sucede en el Instituto Nacional de Aprendizaje y la Municipalidad de Santa Ana o propiamente a una Comisión Institucional específica para el tema ambiental (órgano colegiado conformado por puestos de diferentes departamentos), como sucede en el caso de la Asamblea Legislativa y el Tribunal Supremo de Elecciones. Por lo tanto se concluye que no existe un patrón específico de adscripción organizacional, sino que los cargos han sido ubicados de conformidad con la organización, necesidades y políticas de cada institución, pudiéndose ubicar el puesto de Gestor Ambiental en una Dirección, Departamento, a nivel de staff o a una Comisión Institucional.
En el caso del Poder Judicial y según criterio del presidente de la Comisión de Asuntos Ambientales, Magistrado Oscar Gonzalez Camacho, se podría considerar la adscripción del puesto de Gestor Ambiental en el Despacho de la Presidencia. Ahora bien, es opinión de este departamento que debería de darse una adscripción administrativa al Despacho de la Presidencia y una adscripción funcional con respecto a la Comisión de Asuntos Ambientales, con el fin de que se pueda empoderar adecuadamente al ocupante del puesto, que deberá de coordinar con muchas instancias de la institución para el adecuado desarrollo de sus funciones. Ahora bien, se debe dejar claro sobre la conclusión anterior, que la misma es únicamente un criterio producto de la investigación realizada, a sabiendas que no es este el departamento competente para la decisión definitiva, que por competencias propias le corresponde al Departamento de Planificación.
Se logra concluir de las consultas realizadas a diferentes instituciones, que existe una similitud en cuanto a las tareas o funciones que realizan los puestos de Gestor Ambiental, razón por la cual y considerando lo que indica la ley, la solicitud de la Comisión de Asuntos Ambientales, el DIGECA y la información proporcionada por el Lic. Mauricio Chacón Hernández, Perito Judicial que ha participado activamente en la elaboración del PGAI del Poder Judicial, que las funciones que deben incluirse en el perfil correspondiente del puesto deben contener las siguientes: labores de diagnóstico e investigación, establecer directrices, planes, programas, proyectos y líneas de acción orientadas a la consolidación de las políticas públicas ambientales, cumplimiento de la normativa aplicable, elaboración de programas ambientales, evaluaciones de impacto ambiental, elaboración de indicadores de gestión, coordinación y verificación de la implementación de proyectos ambientales, asesorar con criterios técnicos ambientales diferentes dependencias de la institución, gestión e inventario de residuos, gasto eléctrico, gasto de agua y gasto de combustible, realizar planes para velar por la adecuada canalización de las aguas pluviales servidas, residuales, negras y el tratamiento de las mismas, brindar criterios y análisis técnico de cláusulas ambientales en contratación administrativa (compras verdes), diagnóstico y control de emisiones líquidas, sólidas, atmosféricas y tóxicos peligrosos, programas de reciclaje, inspecciones en sitio, representar a la institución en temas ambientales, elaboración, implementación y seguimiento del PGAI así como su coordinación con el DIGECA, brindar capacitación, hacer campañas de sensibilización e información y realizar la regencia ambiental de la institución (prevenir, controlar y mitigar los impactos ambientales que genere la institución).
En cuanto a las carreras que se pueden considerar para esta clase de puesto, se debe indicar que se valoraron las siguientes: Ingeniería en Gestión Ambiental de la Escuela de Ciencia Ambientales de la Facultad de Ciencias de la Tierra y el Mar de la Universidad Nacional, Bachillerato y Licenciatura en Ingeniería Ambiental de la Escuela de Química del Instituto Tecnológico de Costa Rica y el Bachillerato y Licenciatura en Salud Ambiental de la Escuela de Tecnologías en Salud de la Facultad de Medicina de la Universidad de Costa Rica; concluyéndose que las tres satisfacen las necesidades de conocimiento que debe tener un profesional en Gestor Ambiental para el Poder Judicial. Ahora bien, considerando que este profesional iniciará con un programa particular (gestión ambiental), el cual tiene asociado la elaboración, implementación y seguimiento del PGAI así como su coordinación con el DIGECA, lo pertinente sería ubicar el cargo en la categoría de clase ancha de Profesional 2 y clase angosta de Gestor Ambiental.
7. RECOMENDACIONES Producto de las conclusiones anteriores se recomienda:
7.1. Que el Departamento de Planificación valore la creación del puesto de Gestor Ambiental, no sólo para cumplir con el imperativo legal de que toda institución debe contar con esta clase de puesto sino para impulsar la política ambiental institucional elaborada por la Comisión de Asuntos Ambientales del Poder Judicial.
7.2. De crearse el puesto de Gestor Ambiental, se recomienda que sea la instancia administrativa competente y experta en la materia, es decir el Departamento de Planificación, la encargada de determinar su adscripción dentro de la estructura organizacional del Poder Judicial.
7.3. De crearse el puesto de Gestor Ambiental por parte del Departamento de Planificación, se recomienda que la clasificación y valoración del puesto lo sea en la clase ancha de Profesional 2, clase angosta Gestor Ambiental.
7.4. Se recomienda la creación de la clase angosta de “Gestor Ambiental” tal y como se presenta en el anexo Nº 1 del presente informe.
Se acordó: Acoger el informe en todos sus extremos, con la indicación de que en lo correspondiente se deberán hacer las coordinaciones con la Sección de Salud Ocupacional cuando eso sea pertinente.” - 0 - En nota de 13 de octubre en curso, suscrita por la Magistrada Carmenmaría Escoto Fernández, en carácter de Presidenta interina de la Comisión de Asuntos Ambientales, comunicó:
“Conforme lo acordado por la Comisión de Asuntos Ambientales del Poder Judicial, en sesión No. CAA-06-2014, celebrada el pasado 7 de octubre del presente año, me permito externar ante ustedes la preocupación compartida por todas las personas que integramos dicha Comisión en relación con la imposibilidad de dar seguimiento al Plan de Gestión Ambiental Institucional.
De acuerdo con el “Reglamento para la elaboración de programas de gestión ambiental institucional en el sector público de Costa Rica”, en adelante el Reglamento, este instrumento se basa en “un proceso cíclico de planificación, implementación, revisión y mejora de los procedimientos y acciones que lleva a cabo una institución para realizar su actividad; con el fin de garantizar el cumplimiento de sus objetivos ambientales y por ende, promover un mejor desempeño ambiental en todas las instituciones de la Administración Pública”, es por ello que al ser un proceso dinámico requiere de un constante desarrollo y evolución, lo cual actualmente no ha sido posible realizarlo.
En el documento del Plan de Gestión Ambiental Institucional (PGAI), aprobado por Corte Plena en sesión N° 35-10 del 6 de diciembre de 2010, se recomendaba la creación de una plaza para su seguimiento. Sin embargo, a la fecha a pesar de que el plan fue aprobado no se cuenta con dicha plaza.
El 8 de abril del año 2013, el exMagistrado Oscar González y la suscrita, presentamos ante el Consejo Superior una solicitud para la creación de una plaza de gestor o gestora ambiental. Esa petición fue conocida en la Sesión No. 36-13 del 16 de abril de ese mismo año, trasladándose la comunicación al Departamento de Personal a efecto de que ellos determinarán el perfil así como una posible ubicación de dicha plaza dentro de la estructura del Poder Judicial.
Del seguimiento realizado por parte de la Comisión a dicho acuerdo, de la Dirección de Gestión Humana se nos indicó que el informe fue presentado recientemente ante ustedes y está calendarizado para la sesión del próximo jueves.
Al respecto, me gustaría realizar las siguientes reflexiones de cara a la discusión que se dará sobre el tema en dicha sesión.
En conversación sostenida con la Directora de Planificación, la plaza solicitada no fue incluida dentro del presupuesto del 2015 por razones de prioridad institucional, sin tomar en consideración que la Institución estableció como un eje transversal del planeamiento (estratégico y operativo), la temática ambiental. Sin embargo recomienda hacer las gestiones correspondientes para que quede contemplada en el presupuesto del 2016 que prontamente será realizado.
Es importante señalar que como mecanismo de control, el reglamento tiene previsto la presentación de informes semestrales, siendo el responsable para dicha gestión ante el DIGECA el jerarca de cada Institución. De igual forma anualmente se realiza al menos una auditoría de seguimiento por parte de de dicha oficina para verificar que el plan se esté ejecutando de forma adecuada. A la fecha el Poder Judicial no ha presentado los informes correspondientes al año 2013 y el del primer semestre del 2014, dado que no se cuenta con una persona responsable de operativizar, controlar y reportar lo referente a los programas ambientales a los que la institución está comprometida desde el momento en que se aprobó el Plan de Gestión Ambiental en 2010.
Lo anterior fue ratificado por la Auditoría Judicial en oficio Nº 406-28-AEE-2214, con fecha 7 de abril de 2014, conocido por el Consejo Superior en la sesión N° 34-14, donde concluye que el Programa de Gestión Ambiental en la Institución, no se está cumpliendo, debido a que no dispone de una persona coordinadora del Programa que lo administre y que realice la labor operativa de coordinación, de control y de seguimiento en las diferentes actividades que se realizan tanto en este Plan, como de las tareas realizadas por la Comisión de Asuntos Ambientales.
En el reglamento se señalan como sanciones al incumplimiento “los artículos 98, 99, 100 y 101 de la Ley Orgánica del Ambiente; 98, 99 y 100 de la Ley General de la Administración Pública y 54 y 57 de la Ley para la Gestión Integral de Residuos, sin perjuicio de otras sanciones derivadas de la legislación nacional”.
En lo que respecta a la plaza y recomendaciones realizadas por la Dirección de Gestión Humana, nos parece oportuno señalar que durante el año 2011 el Poder Judicial pagó por concepto de regencia ambiental a una profesional externa contratada por horas un monto de $ 22160.00 (más de doce millones de colones). Dicha profesional asistía en promedio el equivalente a 3 días al mes para realizar trámites en nombre del Poder Judicial ante SETENA y estar presente durante las destrucciones de droga, que como frecuencia máxima llegó a ser de dos destrucciones por semana. Lo anterior en un incinerador que fue donado al Organismo de Investigación Judicial el cual desde el inicio presentó problemas de operación y contaminación (como parte de los requisitos de operación de un incinerador está en análisis de emisiones, entre ellos, dioxinas y furanos los cuales constituyen compuestos químicos altamente contaminantes y potencialmente cancerígenos. Estos análisis se realizaron obteniéndose que las emisiones excedían en más de diez veces los valores permitidos).
Para atender la situación a partir de entonces se renegoció un convenio con HOLCIM, sitio donde ya se había generado la cancelación inicial de un convenio por problemas con la manipulación de la droga. Dicho convenio tiene vigencia de un año más (2015). Para ese mismo año, el OIJ tiene presupuesto para la adquisición de un nuevo incinerador por lo que deberá retomar el tema de las destrucciones de droga, continuando la dinámica de 2011. Es por ello que la creación de una plaza para atender la materia ambiental permitiría cubrir estas funciones y justificaría aún más la necesidad del puesto.
Por otra parte en cuanto al perfil señalado en el informe de Gestión Humana, muy respetuosamente quisiéramos realizar una observación basados en la experiencia del Departamento de Ciencias Forenses respecto de la definición de perfiles y clases en cargos de áreas de ciencias básicas y naturales., en relación con los requisitos académicos pueden estar dejando por fuera otras posibles formaciones que igualmente estarían en capacidad de ocupar el cargo, y se estaría cerrando el perfil a sólo tres áreas de formación base. Así que es posible la contratación de un profesional en ciencias naturales (biólogo, químico u otro) con un posgrado en gerencia o gestión ambiental (que actualmente ofrecen en el país diversas universidades) tendría las calidades suficientes para cubrir el perfil de puesto y funciones.
Es por lo anterior que les transfiero los siguientes acuerdos tomados por la Comisión:
“c. Solicitar al Consejo Superior, valorar la dotación de un recurso para nombrar una persona profesional que colabore con la implementación, administración y seguimiento del PGAI correspondiente a los años 2014 y siguientes, con lo cual se lograría cumplir con los compromisos institucionales ante el MINAE, mientras se tramita el estudio de la plaza de gestor o gestora ambiental. La persona que se designe como parte del recurso humano solicitado, deberá cumplir todas las funciones citadas en el punto b) de este acuerdo. Además, se acuerda reiterar a las y los integrantes del Consejo Superior que esta es una gestión que la Comisión de Asuntos Ambientales ha planteado con anterioridad ante la carencia de talento humano especializado que se ocupe de esa labor, la cual es de interés institucional. Se dispone remitir copia de esta gestión a la Presidencia del Poder Judicial y a Gestión Humana, al estar elaborándose el perfil del puesto.” “d.
Informar a la Presidencia del Poder Judicial, a las y los integrantes del Consejo Superior y a Auditoría Judicial, que con ocasión del informe de implementación, administración y seguimiento del PGAI correspondiente al año 2014, al no haber aún una persona representante de DIGECA del MINAE, para exponerle la problemática que enfrenta la institución, debido a la ausencia de una plaza que gestione el PGAI, con el fin de solicitar una prórroga a los compromisos adquiridos por el Poder Judicial, que requieren de la persona especialista ambiental para su cumplimiento. Además, comunicarle los datos recopilados al respecto, por las diferentes oficinas representadas por las y los integrantes de la Comisión de Asuntos Ambientales. En caso de que se conceda una ampliación del plazo, se comunicará a la Presidencia del Poder Judicial y a las y los integrantes del Consejo Superior, para lo de su cargo.” De lo anterior solicitamos muy respetuosamente al Consejo Superior, acoger las recomendaciones de los acuerdos señalados, así como las observaciones realizadas en cuanto al perfil y funciones que podría desempeñar la persona contratada para esos efectos.
