Law to Regulate the Marketing, Storage and Transport of Fuel in Marine and Fluvial ZonesLey para Regular la Comercialización, el Almacenamiento y el Transporte de

This law is a matter of public order and regulates the commercialization, storage, and transport of fuel through marine and fluvial zones subject to the jurisdiction of the Costa Rican State, as well as the infractions and sanctions applicable to the prohibited conducts described in this law.

Excluded from the application of this law are the permits and authorizations granted to foreign vessels, ships, or craft for entry into and stay within the national territory, by the Legislative Assembly of the Republic of Costa Rica, in accordance with the provisions of subsection 5) of Article 121 of the Political Constitution.

This law shall be governed by the following guiding principles:

• a)Respect for human life, health, and safety.
• b)Fight against drug trafficking and organized crime.
• c)Prevention, prosecution, and punishment of crime.
• d)Control and oversight of all activities carried out in the jurisdictional marine zones of the Costa Rican State (internal waters, territorial sea, contiguous zone, exclusive economic zone, and continental shelf).

This law shall have the following purposes:

• a)To monitor the environment and prevent environmental disasters due to fuel contamination.
• b)To strengthen the State's capabilities to combat drug trafficking and organized crime.
• c)To provide greater protection and legal certainty in our marine territory and to enforce the laws of the Republic in marine and fluvial zones subject to the jurisdiction of the State.
• d)To provide greater resources to the National Coast Guard Service, for the control of these zones.

For the purposes of this law, the terms set forth below shall be understood as follows:

• a)Marine and fluvial zones subject to the jurisdiction of the Costa Rican State or jurisdictional marine zones: are comprised of the following areas:

Likewise, according to the provisions of the United Nations Convention on the Law of the Sea, it corresponds to the area situated beyond and adjacent to the territorial sea; it is subject to the specific legal regime under which the rights and jurisdiction of the coastal State, as well as the rights and freedoms of other States, are governed by the relevant provisions of that Convention. In this zone, international law and the Political Constitution recognize and grant the Costa Rican State a special jurisdiction, in order to protect, conserve, and sustainably utilize all the natural resources and wealth existing in the waters, the soil, and the subsoil.

It includes the insular territory, such as Isla del Coco, with the respective implications set forth in the United Nations Convention on the Law of the Sea.

• b)Vessel, ship, or craft: any ship, boat of any type, personal watercraft, as well as any submersible or submarine apparatus. Outboard motors and any category of implements or navigation equipment, as well as any attachment carried by the vessel, whether or not necessary for its movement, shall be considered part of it.
• c)Maximum autonomy range: maximum distance that a vessel may travel from the coastline. This range is determined by the Maritime Port Division of the Ministry of Public Works and Transport, in view of the characteristics of the ship and the certificate of navigability that it annually issues for each of the vessels, ships, or craft of the national fleet.
• d)Base salary: base salary is understood to mean the concept used in Article 2 of Law No. 7337, of 5 May 1993.

The Ministry of Environment and Energy, in coordination with the Board of Port Administration and Economic Development of the Atlantic Slope (Japdeva), the Costa Rican Institute of Pacific Ports (Incop), the Ministry of Health, the Costa Rican Institute of Fisheries and Aquaculture (Incopesca), the Ministry of Agriculture and Livestock (MAG), the Costa Rican Oil Refinery (Recope), and the respective municipality, shall design, provide, and execute a strategic plan to establish the specific points and conditions for the provision of supply and sale services of fuel for vessels, ships, or craft.

All requirements established by the institutions involved, in accordance with their competencies, must be met.

The sale of fuel from a vessel, ship, or craft is prohibited.

Transporting fuel, of any type whatsoever, by water, fluvial, or marine route, using any type of vessel, in quantities exceeding those authorized by the Costa Rican Institute of Fisheries and Aquaculture, is prohibited, except where those responsible for the vessel have previously obtained and demonstrate that they possess the special authorization to transport greater quantities of fuel specifically for reserve purposes or any other legally permitted use.

To transport fuel in quantities exceeding those required by the vessel, ship, or craft for its navigation at maximum range, the person responsible for the vessel must previously request special authorization from the Costa Rican Institute of Fisheries and Aquaculture, which shall be responsible for establishing the technical requirements and conditions for transport and the assessment of the grounds for the request, which may be granted for the exclusive purpose of reserve for that ship or to carry out some permitted activity. Additionally, this authorization must be communicated to the National Coast Guard Service, by the Costa Rican Institute of Fisheries and Aquaculture.

To determine the violation of the maximum autonomy range authorized for each vessel, the respective criminal court processing the case shall order the Maritime Port Division of the Ministry of Public Works and Transport to appoint an Vessels, ships, or craft without a flag, ship registry, registration, permits, license, or authorization that engage in the conducts criminalized in this law shall be confiscated (decomisados) and placed in judicial deposit with the National Coast Guard Service, in accordance with the provisions of Article 10 of this law.

Storing fuel in locations and conditions not authorized by the strategic plan established in Article 5 of this law is prohibited.

Property confiscated as a result of this law shall be delivered in judicial deposit to the National Coast Guard Service, which may use them for the exclusive fulfillment of its purposes, after securing them, until their final legal status is determined.

In the case of fuel, it shall be delivered in custody to the Costa Rican Oil Refinery, which shall determine whether the confiscated product is fit for consumption. If not, it shall proceed with its destruction. In the case of usable fuel, Recope shall create a credit for the amount that results after deducting the corresponding transport and analysis costs, which shall be placed at the order of the respective court processing the case.

In the event of acquittal, the respective court shall assign the credit to its legitimate owner.

In the event of conviction, the court shall deliver the credit in favor of the National Coast Guard Service for carrying out its operations.

If, after one year from the confiscation (decomiso) of the property, the identity of the perpetrator or participant in the act cannot be established, or the latter has abandoned the property, the competent authority shall order the definitive forfeiture (comiso) of it, which shall pass to the order of the National Coast Guard Service.

Likewise, when more than three months have elapsed after the conclusion or closure of the criminal proceedings without those who may claim a legitimate legal interest in the property of economic interest used in the commission of the offenses provided for in this law having taken any steps to retrieve it, the interested party's action to file any claim shall expire, and the National Coast Guard Service may dispose of the property, upon prior authorization of the court that heard the case.

Shall be sanctioned with a fine of five base salaries, as well as with the forfeiture (comiso) in favor of the National Coast Guard Service of the transshipped fuel, anyone who, without having the respective authorization, engages in any of the following conducts:

• a)Transports, through any marine zone subject to the jurisdiction of the Costa Rican State, fuel other than that used by the vessel, ship, or craft for its normal propulsion.
• b)Transports, through any marine zone subject to the jurisdiction of the Costa Rican State, fuel of the same type used by the detained vessel, ship, or craft for its optimal propulsion and navigation, when it carries a quantity greater than the maximum autonomy range authorized by the Ministry of Public Works and Transport, compared with the respective certificate of navigability.

Shall be sanctioned with a fine of ten base salaries, anyone who commercializes, transships, or supplies unauthorized fuel from a vessel, ship, or craft located in any of the areas that make up the marine and fluvial zones subject to the jurisdiction of the Costa Rican State, without the respective license, authorization, or permit, duly issued by the Costa Rican Institute of Fisheries and Aquaculture.

Shall be sanctioned with a fine of twelve base salaries, anyone who stores fuel in locations or conditions not authorized by the strategic plan established in Article 5 of this law.

Shall be sanctioned with a fine of fifteen base salaries, as well as with the forfeiture (comiso) of the transshipped fuel, in favor of the National Coast Guard Service, the person responsible for or in charge of any ship flying a foreign flag in the territorial sea or the exclusive economic zone of Costa Rica, or of any ship flying the national flag that is captured in jurisdictional waters of other States or in international waters, when they are found transporting fuel other than that used by their vessel or of the same type but in quantities exceeding those authorized by the Costa Rican Institute of Fisheries and Aquaculture.

When the responsibility of an offender for the commission of the conducts prohibited in this law has been proven and a conviction exists, the judge shall place in forfeiture (comiso) the vessels, ships, or craft captured, if any, and shall order, when applicable, the cancellation of the fishing licenses that exist in the name of the convicted persons, as well as their disqualification from being concessionaires of this type of license for a period of five years.

When, within a period of ten years, counted from the date on which any of the sanctions established in this law are imposed, the offender is sanctioned for the second time for committing any of the conducts prohibited in this law, the vessel shall fall into forfeiture (comiso) in favor of the National Coast Guard Service, which may dispose of it in accordance with the provisions of Article 36 of Law No. 8000, of 5 May 2000, and its amendments.

In cases of forfeited property subject to registration in the National Registry, the order of the competent judicial authority shall suffice for the respective section of said Registry to proceed with the registration or transfer of the property in favor of the National Coast Guard Service.

Immediately after the conviction becomes final, the competent authority shall send the registration or transfer order, to which the respective security slip must be attached.

The proceeds from fines collected in compliance with this law shall be deposited in the Special Fund of the National Coast Guard Service, created in Article 26 of Law No. 8000, of 5 May 2000, and its amendments.

SOLE TRANSITORY PROVISION.- Within six months after the date of publication of this law, the strategic plan established in Article 5 of this law must enter into execution.

It shall be effective as of its publication.

La presente ley es de orden público y regula la comercialización, el almacenamiento y el transporte de combustible por las zonas marinas y fluviales sometidas a la jurisdicción del Estado costarricense, así como las infracciones y sanciones aplicables a las conductas prohibidas descritas en esta ley.

Se exceptúan de la aplicación de esta ley, los permisos y las autorizaciones otorgados a embarcaciones, buques o navíos extranjeros para el ingreso y la permanencia en el territorio nacional, por parte de la Asamblea Legislativa de la República de Costa Rica, de conformidad con lo dispuesto en el inciso 5) del artículo 121 de la Constitución Política.

Esta ley se regirá por los siguientes principios rectores:

• a)Respeto a la vida, la salud y la seguridad humanas.
• b)Lucha contra el narcotráfico y la delincuencia organizada.
• c)Prevención, persecución y sanción del delito.
• d)Control y fiscalización de todas las actividades que se realizan en las zonas marinas jurisdiccionales del Estado costarricense (aguas interiores, mar territorial, zona contigua, zona económica exclusiva y plataforma continental).

Esta ley tendrá los siguientes fines:

• a)Vigilar el medio ambiente y evitar desastres ambientales por contaminación con combustible.
• b)Fortalecer las capacidades del Estado para combatir el narcotráfico y la delincuencia organizada.
• c)Brindar mayor protección y seguridad jurídica en nuestro territorio marino y hacer respetar las leyes de la República en las zonas marinas y fluviales sometidas a la jurisdicción del Estado.
• d)Dotar de mayores recursos al Servicio Nacional de Guardacostas, para el control de estas zonas.

Para los propósitos de la presente ley, los términos que se indican a continuación deberán entenderse de la siguiente manera:

• a)Zonas marinas y fluviales sometidas a la jurisdicción del Estado costarricense o zonas marinas jurisdiccionales: están conformadas por las siguientes áreas:

1.- Aguas interiores: aguas marinas situadas en el interior de la línea de base del mar territorial y hasta donde el agua marina puede ingresar, tales como dársenas (puertos), manglares, esteros, lagunas costeras, golfos, bahías, desembocaduras o deltas comunicados permanente e intermitentemente con el mar, siempre que sean accesibles o navegables para buques de navegación marítima.

2.- Mar territorial: anchura hasta un límite que no exceda de doce millas marinas medidas a partir de líneas de bajamar, a lo largo de las costas, donde el Estado costarricense ejerce su soberanía completa y exclusiva.

3.- Zona contigua: área marina que se extiende veinticuatro millas náuticas contadas a partir de la línea de base de mar territorial que se aplique a cada segmento de la costa.

Asimismo, según lo establecido en la Convención de las Naciones Unidas sobre el Derecho del Mar, corresponde al área situada más allá del mar territorial y adyacente a este; está sujeta al régimen jurídico específico, según el cual los derechos y la jurisdicción del Estado ribereño, así como los derechos y las libertades de los demás Estados, se rigen por las disposiciones pertinentes de esta Convención. En esta zona, el derecho internacional y la Constitución Política reconocen y dan al Estado costarricense una jurisdicción especial, a fin de proteger, conservar y aprovechar, sosteniblemente, todos los recursos y las riquezas naturales existentes en las aguas, el suelo y el subsuelo.

5.- Plataforma continental: área que comprende el territorio continental, dentro del cual se reconoce soberanía costarricense. Incluye el territorio insular, como lo es la Isla del Coco, con las respectivas implicaciones establecidas en la Convención de las Naciones Unidas sobre el Derecho del Mar.

• b)Embarcación, buque o navío: cualquier buque, bote de todo tipo, motos acuáticas, así como cualquier aparato sumergible o submarino. Los motores fuera de borda y cualquier categoría de implementos o equipo de navegación, así como todo aditamento que porte la embarcación, sean o no necesarios para su desplazamiento, serán considerados parte de esta.
• c)Rango máximo de autonomía: distancia máxima a la que una embarcación puede separarse de la línea de la costa. Este rango se determina por parte de la División Marítimo Portuaria del Ministerio de Obras Públicas y Transportes, con vista en las características de la nave y en el certificado de navegabilidad que anualmente otorga a cada una de las embarcaciones, buques o navíos de la flota nacional.
• d)Salario base: se entiende por salario base el concepto usado en el artículo 2 de la Ley N.º 7337, de 5 de mayo de 1993.

El Ministerio de Ambiente y Energía, en coordinación con la Junta de Administración Portuaria y Desarrollo Económico de la Vertiente Atlántica (Japdeva), el Instituto Costarricense de Puertos del Pacífico (Incop), el Ministerio de Salud, el Instituto Costarricense de Pesca y Acuicultura (Incopesca), el Ministerio de Agricultura y Ganadería (MAG), la Refinadora Costarricense de Petróleo (Recope) y la municipalidad respectiva deberán diseñar, proporcionar y ejecutar un plan estratégico para establecer los puntos específicos y las condiciones para la prestación del servicio de abastecimiento y venta de combustible para embarcaciones, buques o navíos.

Deberán cumplirse todos los requisitos que establezcan las instituciones involucradas, de conformidad con sus competencias.

Queda prohibida la venta de combustible desde una embarcación, buque o navío.

Se prohíbe transportar combustible, de cualquier tipo que sea, por vía acuática, fluvial o marina, utilizando cualquier tipo de embarcación, en cantidades superiores a las autorizadas por el Instituto Costarricense de Pesca y Acuicultura, salvo que los responsables de la embarcación hayan obtenido previamente y demuestren que poseen la autorización especial para transportar mayores cantidades de combustible con fines, específicamente, de reserva o cualquier otro uso que esté legalmente permitido.

Para transportar combustible en cantidades superiores a las que requiere la embarcación, el buque o el navío, para su navegación en rango máximo, el responsable de la embarcación deberá solicitar, de previo, la autorización especial ante el Instituto Costarricense de Pesca y Acuicultura, al que le corresponderá establecer los requisitos y las condiciones técnicas para el transporte y la valoración de las causas de la solicitud, la cual se podrá otorgar con el fin exclusivo de reserva para ese navío o para realizar alguna actividad permitida. Asimismo, esta autorización deberá ser comunicada al Servicio Nacional de Guardacostas, por parte del Instituto Costarricense de Pesca y Acuicultura.

Para determinar la violación del rango máximo de autonomía, autorizado para cada embarcación, el juzgado penal respectivo que tramite la causa ordenará a la División Marítimo Portuaria del Ministerio de Obras Públicas y Transportes la designación de un perito que determine esa variable técnica.

Las embarcaciones, los buques o los navíos sin bandera, registro de buque, matrícula, permisos, licencia o autorización, que incurran en las conductas tipificadas en la presente ley, serán decomisados y puestos en depósito judicial del Servicio Nacional de Guardacostas, de conformidad con lo dispuesto en el artículo 10 de esta ley.

Se prohíbe almacenar combustible en lugares y condiciones no autorizados por el plan estratégico establecido en el artículo 5 de esta ley.

Los bienes decomisados producto de esta ley serán entregados en depósito judicial al Servicio Nacional de Guardacostas, el cual podrá utilizarlos para el cumplimiento exclusivo de sus fines, previo aseguramiento, hasta que se defina su situación jurídica final.

En el caso del combustible, este será entregado en custodia a la Refinadora Costarricense de Petróleo, la cual determinará si el producto decomisado es apto para su consumo. En caso negativo, procederá a su destrucción. Tratándose de combustible utilizable, Recope creará un crédito por la cantidad que resultara después de deducir los gastos de transporte y análisis correspondientes, el cual será puesto a la orden del juzgado respectivo que tramita la causa.

En caso de absolutoria, el juzgado respectivo asignará el crédito a su legítimo propietario.

En caso de condenatoria, el juzgado entregará el crédito a favor del Servicio Nacional de Guardacostas para la realización de sus operaciones.

Si transcurrido un año del decomiso de los bienes no se puede establecer la identidad del autor o partícipe del hecho, o este ha abandonado los bienes, la autoridad competente ordenará el comiso definitivo de estos, los cuales pasarán a la orden del Servicio Nacional de Guardacostas.

Asimismo, cuando transcurran más de tres meses de finalizado o cerrado el proceso penal sin que quienes puedan alegar interés jurídico legítimo, sobre los bienes de interés económico utilizados en la comisión de los delitos previstos en esta ley, hayan hecho gestión alguna para retirarlos, la acción del interesado para interponer cualquier reclamo caducará y el Servicio Nacional de Guardacostas podrá disponer de los bienes, previa autorización del tribunal que conoció de la causa.

Será sancionado con una pena de multa de cinco salarios base, así como con el comiso a favor del Servicio Nacional de Guardacostas del combustible trasegado, quien, sin contar con la autorización respectiva, incurra en alguna de las siguientes conductas:

• a)Transporte, por cualquier zona marina sometida a la jurisdicción del Estado costarricense, combustible distinto del que utiliza la embarcación, el buque o el navío para su propulsión normal.
• b)Transporte, por cualquier zona marina sometida a la jurisdicción del Estado costarricense, combustible del mismo tipo que utiliza la embarcación, el buque o el navío detenido para su propulsión y navegación óptimas, cuando acarree una cantidad mayor al rango máximo de autonomía autorizado por el Ministerio de Obras Públicas y Transportes, confrontado con el certificado de navegabilidad respectivo.

Será sancionado con una pena de multa de diez salarios base, quien comercialice, transborde o suministre combustible no autorizado desde una embarcación, buque o navío ubicado en alguna de las áreas que integran las zonas marinas y fluviales sometidas a la jurisdicción del Estado costarricense, sin contar con la licencia, la autorización o el permiso respectivo, debidamente emitido por el Instituto Costarricense de Pesca y Acuicultura.

Será sancionado con una pena de multa de doce salarios base, quien almacene combustible en lugares o condiciones no autorizados por el plan estratégico establecido en el artículo 5 de esta ley.

Será sancionado con una pena de multa de quince salarios base, así como con el comiso del combustible trasegado, a favor del Servicio Nacional de Guardacostas, quien sea el responsable o encargado de cualquier buque con bandera extranjera en el mar territorial o en la zona económica exclusiva de Costa Rica, o de cualquier buque con bandera nacional que sea capturado en aguas jurisdiccionales de otros Estados o en aguas internacionales, cuando se encuentren transportando combustible distinto del que utiliza su embarcación o del mismo tipo pero en cantidades superiores a las autorizadas por el Instituto Costarricense de Pesca y Acuicultura.

Cuando se haya demostrado la responsabilidad de un infractor por la comisión de las conductas prohibidas en esta ley y exista una sentencia condenatoria, el juzgador pondrá en comiso las embarcaciones, los buques o los navíos capturados, si los hubiera y ordenará, cuando sea procedente, la cancelación de las licencias de pesca que existan a nombre de los condenados, así como la inhabilitación para ser concesionario de este tipo de licencias por un período de cinco años.

Cuando dentro del plazo de diez años, contado desde la fecha en que se imponga alguna de las sanciones establecidas en esta ley, el infractor sea sancionado por segunda ocasión cometiendo alguna de las conductas prohibidas en esta ley, la embarcación caerá en comiso a favor del Servicio Nacional de Guardacostas, el cual podrá disponer de ella de acuerdo con lo dispuesto en el artículo 36 de la Ley N.° 8000, de 5 de mayo de 2000, y sus reformas.

En los casos de bienes comisados sujetos a inscripción en el Registro Nacional, bastará la orden de la autoridad judicial competente para que la sección respectiva de dicho Registro proceda a la inscripción o el traspaso del bien a favor del Servicio Nacional de Guardacostas.

Inmediatamente después de que la sentencia condenatoria se encuentre firme, la autoridad competente enviará la orden de inscripción o traspaso, a la cual deberá adjuntársele la respectiva boleta de seguridad.

El producto de las multas cobradas en cumplimiento de la presente ley deberá depositarse en el Fondo Especial del Servicio Nacional de Guardacostas, creado en el artículo 26 de la Ley N.º 8000, de 5 de mayo de 2000, y sus reformas.

Dentro de los seis meses posteriores a la fecha de la publicación de la presente ley, deberá entrar en ejecución el plan estratégico establecido en el artículo 5 de esta ley.

Rige a partir de su publicación.
