1That in accordance with the considerations set forth by the Board of Directors through Agreement AJDIP/191-2010 of June 11, 2010; regarding the competence, need, and opportunity to safeguard the right to greater well-being for the inhabitants of the Republic, in communion with a just and adequate distribution of wealth; thereby also guaranteeing the right to dignified, honest, and useful work for society, within a healthy and ecologically balanced environment; to wit, articles 50 and 56 of our Magna Carta.
2That under that vision, the Board of Directors of INCOPESCA, through Agreement AJDIP/138-2008 of April 4, 2008, had already established the "Reglamento para el establecimiento de las Áreas Marinas para la Pesca Responsable".
3That for its part, the FAO Code of Conduct for Responsible Fisheries, Executive Decree Nº 27919-MAG, recognizes in its Article 6 the important contribution of artisanal small-scale fisheries to employment generation, income, and food security. Hence the need for the State to appropriately guarantee the rights of fishers men and women, adopting regulatory measures that favor the utilization of fishery resources in waters under national jurisdiction.
4That scientific studies are available through which it has been demonstrated that the regulation of fishing gear and methods, as well as fishing effort in certain strategic areas, contribute to the increase of biomass and species populations.
5That the measures indicated in the previous consideration also represent a viable alternative that enables the generation of economic, social, and environmental benefits for fishing communities and for the ecosystems on which fishers depend for fishing.
6That in this regard, the Executive Branch, through Executive Decree Nº 35502-MAG, published in the Official Gazette La Gaceta Nº 191, of October 1, 2009, in its Article 15, declares the establishment of Áreas Marinas para la Pesca Responsable to be of national public interest.
7That likewise, and in order to have above all the participation and support in decision-making of the fishers from the communities involved, the Executive Presidency, through official communication PESJ-33-1-2009, formed the Inter-institutional Group for the elaboration of the Fisheries Management Plan (Plan de Ordenamiento Pesquero) that will establish the particular characteristics and regulations for the establishment and start of operations of the Tárcoles Responsible Fishing Marine Area (AMPR-Tárcoles).
8That in accordance with the provisions of Article 2 of the "Reglamento para el establecimiento de las Áreas Marinas Para la Pesca Responsable", this Inter-institutional Working Group undertook to formulate the Fisheries Management Plan (Plan de Ordenamiento Pesquero) as a prerequisite for approving the establishment of the Tárcoles Responsible Fishing Marine Area.
9That in this sense, it was possible to secure the participation not only of the artisanal fishing sector, but also of the trawling shrimp fishers' Organizations, in order to establish by mutual agreement the Proposed Fisheries Management Plan (Plan de Ordenamiento Pesquero) for the Tárcoles Responsible Fishing Marine Area.

10.-That the Working Group, having fulfilled the formalities established by Regulation Nº 138-2008, presented, at Session Nº 30-2011 of the Board of Directors of INCOPESCA, held on May 27, 2011, the "Proposal for a Fisheries Management Plan (Plan de Ordenamiento Pesquero) for the establishment of the Tárcoles Responsible Fishing Marine Area." 11.-That likewise, the General Technical Directorate of INCOPESCA has endorsed and recommended to the Board of Directors the approval of the proposal presented, in accordance with the preceding consideration; therefore, the Board of Directors, in use of its attributions and competencies; therefore, AGREES:

TO ESTABLISH THE TÁRCOLES RESPONSIBLE FISHING MARINE AREA

Considering:

Likewise, it shall be determined if fishing is permitted in said zone and the conditions under which the fishery would be permitted, either totally or temporarily; without the foregoing being interpreted as an express, tacit, or indefinite exclusion of the trawling shrimp fleet, the purse-seine sardine fleet, or the small-scale commercial fleet from the closed area of the AMPR-Tárcoles, after the lapse of the year referred to in Agreement AJDIP/193-2011 (Thus added through Agreement AJDIP/333-2011 of September 16, 2011) (Note: Through Agreement A.J.D.I.P/377 of August 17, 2012, the following was established: ".A total closure (veda total) zone is maintained for one year in the Tárcoles Responsible Fishing Marine Area, in the zones defined as 1, 2, 3, and 4 in accordance with the Fisheries Management Plan (Plan de Ordenamiento Pesquero) of the Area, for trawl and small-scale artisanal fishing with gillnet (trasmallo), a period that will remain in effect until August 19, 2013. Within the indicated period, the Technical Directorate, through the Research Department of INCOPESCA, must continue with the studies that have been carried out and supplement them with research on biomass estimation of the shrimp resource, with the participation of both sectors, semi-industrial and artisanal, and must conduct daytime and nighttime sampling, using trawl gear used in semi-industrial fishing, in accordance with the technical parameters defined, and quarterly progress reports must be submitted to the Board of Directors.")

1Que de conformidad con las consideraciones vertidas por la Junta Directiva mediante Acuerdo AJDIP/191-2010 del 11 de junio de 2010; respecto a la facultad competencia, necesidad y oportunidad en cuanto a resguardar el derecho a un mayor bienestar de los habitantes de la República, en comunión con un justo y adecuado reparto de la riqueza; garantizando con ello además el derecho al trabajo digno, honesto y útil para la sociedad, dentro de un ambiente sano y ecológicamente equilibrado; verbigracia ordinales 50 y 56 de nuestra Carta Magna.
2Que bajo esa visión ya la Junta Directiva del INCOPESCA por medio del Acuerdo AJDIP/138-2008 del 04 de abril de 2008, había establecido el "Reglamento para el establecimiento de las Áreas Marinas para la Pesca Responsable".
3Que por su parte el Código de Conducta para la Pesca Responsable de la FAO, Decreto Ejecutivo Nº 27919-MAG reconoce en su artículo 6º, la importante contribución de la pesca artesanal en pequeña escala a la generación de empleo, ingresos y seguridad alimentaria. De ahí la necesidad de que el Estado garantice apropiadamente el derecho de los pescadores y pescadoras, adoptando medidas de regulación que favorezcan el aprovechamiento de los recursos pesqueros en las aguas de jurisdicción nacional.
4Que se cuenta con estudios científicos mediante los cuales se ha logrado demostrar que la regulación de las artes y métodos de pesca, así como el esfuerzo pesquero en determinadas áreas estratégicas, contribuyen al aumento de la biomasa y de las poblaciones de especies.
5Que las medidas señaladas en el considerando anterior, representan también una alternativa viable que posibilite la generación de beneficios económicos, sociales y ambientales para las comunidades pesqueras y para los ecosistemas, de los que los pescadores dependen para la pesca.
6Que en ese giro el Poder Ejecutivo mediante Decreto Ejecutivo Nº 35502-MAG, publicado en el Diario Oficial La Gaceta N 191, del 1º de octubre del 2009, en su artículo 15, declara de interés público nacional el establecimiento de las Áreas Marinas para la Pesca Responsable.
7Que igualmente y a efecto de contar ante todo con el concurso y asidero en la toma de decisiones de los pescadores de las comunidades involucradas, la Presidencia Ejecutiva por medio del oficio PESJ-33-1-2009 conforma el Grupo Interinstitucional para la elaboración del Plan de Ordenamiento Pesquero que establecerá las características y regulaciones particulares para el establecimiento y entrada en funcionamiento del Área Marina de Pesca Responsable de Tárcoles (AMPR-Tárcoles).
8Que de conformidad con lo que establece el artículo 2º del "Reglamento para el establecimiento de las Áreas Marinas Para la Pesca Responsable", éste Grupo Interinstitucional de Trabajo se abocó a formular el Plan de Ordenamiento Pesquero como requisito previo para aprobar el establecimiento del Área Marina Para la Pesca Responsable de Tárcoles.
9Que en ese sentido se logró contar con la participación no solo del sector de pesca artesanal; sino con las Organizaciones de pescadores camaroneros de arrastre, a fin de establecer de común acuerdo la Propuesta de Plan de Ordenamiento Pesquero del Área Marina de Pesca Responsable de Tárcoles.

10.-Que el Grupo de Trabajo habiendo cumplido con las formalidades que establece el Reglamento Nº 138-2008, presentó, en la sesión Nº 30-2011 de Junta Directiva del INCOPESCA, celebrada el 27 de mayo de 2011, la "Propuesta de Plan de Ordenamiento Pesquero para el establecimiento del Área Marina de Pesca Responsable de Tárcoles".

11.-Que asimismo la Dirección General Técnica del INCOPESCA ha avalado y recomendado a la Junta Directiva la aprobación de la propuesta presentada de conformidad con el considerando anterior; por lo que la Junta Directiva en uso de sus atribuciones y competencias; por tanto, ACUERDA:

ESTABLECER EL ÁREA MARINA DE PESCA RESPONSABLE DE TÁRCOLES

Considerando:

Igualmente se establecerá si se permite la pesca en dicha zona y las condiciones bajo las cuales se permitiría la pesquería, ya sea de manera total o temporal; sin que lo anterior se interprete como una exclusión expresa, tácita o indefinida a la pesca de la flota camaronera de arrastre, a la flota sardinera bolichera o a la flota comercial a pequeña escala del área vedada del AMPR-Tárcoles, después de transcurrido el año referido en el acuerdo AJDIP/193-2011 (Así adicionado mediante acuerdo AJDIP/333-2011 de 16 de setiembre del 2011) (Nota: Mediante acuerdo A.J.D.I.P/377 del 17 de agosto de 2012, se estableció lo siguiente: ".Se mantiene y establece una zona de veda total por un año en el Área Marina de Pesca Responsable de Tárcoles, en las zonas definidas como 1, 2, 3 y 4 de conformidad con el Plan de Ordenamiento Pesquero del Área, para la pesca de arrastre y artesanal a pequeña escala con trasmallo, plazo que se mantendrá vigente hasta el 19 de agosto del 2013. Dentro del plazo indicado la Dirección Técnica, a través del Departamento de Investigación del INCOPESCA, deberá continuar con los estudios que se han venido realizando y complementarlos con la investigación sobre estimación de biomasa del recurso camarón, con la participación de ambos sectores, semi-industrial y artesanal, debiendo realizarse muestreos diurnos y nocturnos, con la utilización de artes de arrastre, utilizados en la pesca semi-industrial de conformidad con los parámetros técnicos que sean definidos, y presentarse a la Junta Directiva informes trimestrales de avance.")

Tárcoles Responsible Fishing Marine AreaÁrea Marina de Pesca Responsable de Tárcoles

Artículo 1 — To approve the establishment of the Tárcoles Responsible Fishing Marine Area, in accordance with the provisions of Regulation A.J.D.I.P 138-2008 and Executive Decree Nº 35502-MAG, published in the Official Gazette La Gaceta, Nº 191 of October 1, 2009.

Artículo 2 — To approve, in accordance with the provisions of Regulation 138-2008 A.J.D.I.P., dated April 4, 2008, the proposal for the "Fisheries Management Plan (Plan de Ordenamiento Pesquero) for the establishment of the Tárcoles Responsible Fishing Marine Area."

Artículo 5 — Any breach of the established fishing regulations shall be sanctioned in accordance with the provisions of the current legal system.

Artículo 1 — Aprobar el establecimiento del Área Marina de Pesca Responsable de Tárcoles, conforme a lo establecido en el Reglamento A.J.D.I.P 138-2008 y el Decreto Ejecutivo Nº 35502-MAG, publicado en el Diario Oficial La Gaceta, Nº 191 del 1º de octubre del 2009.

Artículo 2 — Aprobar de conformidad con lo que establece el Reglamento 138-2008 A.J.D.I.P., de fecha 4 de abril del 2008, la propuesta del "Plan de Ordenamiento Pesquero para el establecimiento del Área Marina de la Pesca Responsable de Tárcoles".

Artículo 5 — Cualquier incumplimiento a las normas pesqueras establecidas será sancionado de conformidad con lo que señala el ordenamiento jurídico vigente.
