1That Article 50 of the Political Constitution provides that it is the obligation of the State to procure the greatest well-being for all the inhabitants of the country, organizing and stimulating production and the most adequate distribution of wealth. Likewise, it incorporates the right of every person to a healthy and ecologically balanced environment.
2That Article 56 of the Political Constitution establishes that it is a right of the individual and that the State must guarantee, dignified, honest, and useful work for society.
3That the Law of Creation of the Costa Rican Institute of Fisheries and Aquaculture, Law No. 7384, establishes as a function of this state public entity, to regulate the rational use of fishery resources to achieve greater economic returns, and the protection of marine and aquacultural-use species.
4That it is the responsibility of INCOPESCA as the Governing Institution of the fisheries and aquaculture sector of our country, to establish management measures for the sustainable use of hydrobiological resources, which allow for the protection of reproduction, recruitment, and feeding areas, which favor the increase of species and the increase of their biomass, so as to guarantee their sustainability for the benefit of ecosystems and fishers.
5That the Code of Conduct for Responsible Fisheries, Decreto Ejecutivo No. 27919-MAG recognizes in its Article 6, the important contribution of small-scale artisanal fishing to the generation of employment, income, and food security. Hence the need for the State to appropriately guarantee the right of fishers, adopting regulatory measures that favor the use of fishery resources in waters of national jurisdiction.
6That scientific studies are available through which it has been demonstrated that the regulation of fishing gear and methods, as well as fishing effort in certain strategic areas, will contribute to the increase of biomass and populations.
7That the measures indicated in the preceding considering, also represent a viable alternative for the generation of economic, social, and environmental benefits for fishing communities and for the ecosystems on which fishers depend for fishing.
8That in accordance with the Fisheries and Aquaculture Law No. 8436, Articles 34, 35, 37, 38, 40, and 41, INCOPESCA may establish, according to technical, scientific, economic, and social criteria, closed zones or seasons, whether by area or by specific species.
9That in accordance with the Rio Declaration on Environment and Development, environmental issues are best handled with the participation of all concerned citizens, at the relevant level, this principle being accepted by the FAO in recognizing the relationship between fishing communities and the way they understand, use, and conserve the resources on which they depend. Therefore,

AGREES:

To approve the following, REGULATIONS FOR THE ESTABLISHMENT OF MARINE AND CONTINENTAL AREAS FOR RESPONSIBLE FISHING(*) (*)(Thus amended its name by point 1) of Agreement No. AJDIP/236-2015 of June 12, 2015. Previously indicated "Marine Areas for Responsible Fishing") (Thus eliminated the phrase "IN ACCORDANCE WITH DECRETO EJECUTIVO No. 27919-MAG" from the previous title, by point 3) of Agreement No. AJDIP/236-2015 of June 12, 2015)

Considering:

For the purposes of these regulations, the following shall be understood as:

a)Marine and Continental Areas for Responsible Fishing: Marine and/or continental areas with important biological, fishery, or sociocultural characteristics, which shall be delimited by geographic coordinates and other mechanisms that allow for identifying their limits, and in which fishing activity is regulated in a particular manner to ensure the long-term use of fishery resources, and for whose conservation, use, and management Incopesca may have the support of coastal communities and/or communities near the banks of rivers, lakes, and lagoons, as well as other institutions.

(Thus amended the preceding subsection by point 2) of Agreement No. AJDIP/236-2015 of June 12, 2015) b) Fishing Organization: legal entities made up by fishers, or by natural or legal persons, dedicated to activities related to fishing and aquaculture, with current legal status and duly registered before the Registry of Organizations of INCOPESCA, that pursue an improvement in the quality of life of their members and their community.

c)Code of Ethics for Responsible Fishing: a voluntary instrument developed by communities or organizations dependent on fishing activity, for the management of said activity so as to guarantee a sustainable use of fishery resources.
d)Responsible fishing: is a sustainable use of fishery resources in harmony with the environment; the utilization of fishing and aquaculture practices that are not harmful to ecosystems, the resources, or their quality.
e)Participatory zoning: The planning and regulation of fishing is carried out in consensus with the fishers of the organizations with a legitimate interest in the process, with the objective of managing fisheries in a sustainable manner. The rules are established specifically for each zone, in accordance with a Fisheries Management Plan that must be carried out as part of the process, which is approved by INCOPESCA.

b)Profile of the organization (year of foundation, list of fishers or aquaculturists or others who carry out related activities, including name, identification number, name of the vessel, registration number, fishing license, and objectives of said organization).
c)Photocopy of the legal identification and current legal status.
d)Records and historical information that demonstrate the biological, fishery, socio-cultural, and environmental importance that supports the creation of said figure and its regulatory mechanisms in a specific marine area.
e)Baseline of the socioeconomic condition of the members of the interested organization.
f)Map on which the geographic coordinates of the proposed zone are indicated in accordance with the Instituto Geográfico Nacional.
g)Participatory zoning with the support of INCOPESCA or another institution or organization, of the areas designated for fishing, and areas of total or partial closure; detail on the types of fishing (commercial, sport, tourist, among others), quantity, number, and type of gear, vessel modalities, minimum landing sizes, or any other information relevant to the viability of the proposal.

a. Ensure that all its members refrain from fishing without having the respective license, permit, or authorization to carry out their activities.

b. Develop and apply a Code of Ethics for Responsible Fishing as a voluntary instrument which becomes binding for the members of this organization once approved.

c. Ensure compliance with all applicable legislation and regulations, including the provisions established in the Fisheries Management Plan.

d. Exercise a duty of oversight over its members. In the event that a complaint is duly filed against any member of the organization, for any infraction of the pertinent laws or regulations, the member shall respond in accordance with the applicable administrative or criminal sanctions and shall abide by what is provided in the Code of Ethics for Responsible Fishing adopted by the organization.

e. Persons authorized to fish shall be responsible before INCOPESCA for any fee or fine to be paid in compliance with this agreement, in accordance with current legislation.

f. Cooperate and manage additional financial and technical support for the placement of buoys, acquisition of radiocommunication equipment, and any other materials necessary for the use, conservation, and management of the area.

The exercise of fishing activity within these areas shall be permitted both for those members of the requesting Organization and for any other fisher provided that they have a current fishing license and comply with the regulations set forth in the Fisheries Management Plan defined for each area.

a. Two representatives of INCOPESCA who shall act as coordinators, principal and alternate of the commission respectively.

b. A principal representative, who in their absence may be substituted by an alternate, both appointed by the requesting fishing community.

c. A representative of the Programa Marino Costero of MINAE.

The identification of permitted fishing gear and methods.

b. The identification of total or partial closure areas.

c. A program for the application and compliance of current legislation.

d. A program for registration and information.

e. A program for training and extension.

f. A program for monitoring and research.

Those sanctions established in the Fisheries and Aquaculture Law, No. 8436, shall apply, as well as any other provided by applicable regulations.

1Que el artículo 50 de la Constitución Política dispone que es obligación del Estado procurar el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Asimismo, incorpora el derecho de toda persona a un ambiente sano y ecológicamente equilibrado.
2Que el artículo 56 de la Constitución Política establece que es un derecho del individuo y que el Estado debe garantizar, el trabajo digno, honesto y útil para la sociedad.
3Que la Ley de Creación del Instituto Costarricense de Pesca y Acuicultura, Ley Nº 7384, establece como función de este ente público estatal, normar el aprovechamiento racional de los recursos pesqueros para lograr mayores rendimientos económicos, y la protección de las especies marinas y de uso acuícola.
4Que corresponde al INCOPESCA como Institución Rectora del sector pesquero y acuícola de nuestro país, establecer medidas de ordenamiento para el aprovechamiento sostenible de los recursos hidrobiológicos, que permitan proteger áreas de reproducción, reclutamiento y de alimentación, que favorezcan el incremento de las especies y el aumento de su biomasa, de manera que se garantice su sostenibilidad en provecho de los ecosistemas y de los pescadores.
5Que el Código de Conducta para la Pesca Responsable, Decreto Ejecutivo Nº 27919-MAG reconoce en su artículo 6, la importante contribución de la pesca artesanal en pequeña escala a la generación de empleo, ingresos y seguridad alimentaría. De ahí la necesidad de que el Estado garantice apropiadamente el derecho de los pescadores y pescadoras, adoptando medidas de regulación que favorezcan el aprovechamiento de los recursos pesqueros en las aguas de jurisdicción nacional
6Que se cuenta con estudios científicos mediante los cuales se ha logrado demostrar que la regulación de las artes y métodos de pesca, así como del esfuerzo pesquero en determinadas áreas estratégicas, contribuyera al aumento de la biomasa y de las poblaciones.
7Que las medidas señaladas en el considerando anterior, representan también una alternativa viable para la generación de beneficios económicos, sociales y ambientales para las comunidades pesqueras y para los ecosistemas de los que los pescadores dependen para la pesca.
8Que de acuerdo con la Ley de Pesca y Acuicultura Nº 8436 artículos 34, 35, 37, 38, 40 y 41 el INCOPESCA podrá establecer conforme a criterios técnicos, científicos, económicos y sociales, las zonas o épocas de veda, sea por áreas o por especies determinadas.
9Que de acuerdo con la Declaración de Río sobre el Medio Ambiente y el Desarrollo, el mejor modo de tratar las cuestiones ambientales es con la participación de todos los ciudadanos interesados, en el nivel que corresponda, siendo este principio aceptado por la FAO al reconocer la relación entre las comunidades pesqueras y la forma en que entienden, aprovechan y conservan los recursos de los que viven. Por tanto,

ACUERDA:

Aprobar el siguiente, REGLAMENTO PARA EL ESTABLECIMIENTO DE ÁREAS MARINAS Y CONTINENTALES PARA LA PESCA RESPONSABLE(*) (*)(Así modificada su denominación por el punto 1) del acuerdo N° AJDIP/236-2015 del 12 de junio del 2015. Anteriormente indicaba "Áreas Marinas para la Pesca Responsable) (Así eliminada la frase "DE CONFORMIDAD CON EL DECRETO EJECUTIVO Nº 27919-MAG" del título anterior, por el punto 3) del acuerdo N° AJDIP/236-2015 del 12 de junio del 2015)

Considerando:

Para efectos del presente reglamento entiéndase por:

a)Aéreas Marinas y Continentales de Pesca Responsable: Áreas marinas y/o continentales con características biológicas, pesqueras o socioculturales importantes, las cuales estarán delimitadas por coordenadas geográficas y otros mecanismos que permitan identificar sus límites y en las que se regula la actividad pesquera de modo particular para asegurar el aprovechamiento de los recursos pesqueros a largo plazo y en las que para su conservación, uso y manejo el Incopesca podrá contar con el apoyo de comunidades costeras y/o de las cercanías a las riberas de ríos, lagos y lagunas, así como de otras instituciones.

(Así reformado el inciso anterior por el punto 2) del acuerdo N° AJDIP/236-2015 del 12 de junio del 2015) b) Organización Pesquera: entidades jurídicas conformadas por pescadores, o por personas físicas o jurídicas, dedicadas a actividades afines a la pesca y la acuicultura, con personería jurídica vigente y debidamente inscritas ante el Registro de Organizaciones del INCOPESCA, que persigan un mejoramiento de la calidad de vida de sus miembros y de su comunidad.

c)Código de Ética para la Pesca Responsable: instrumento voluntario elaborado por comunidades u organizaciones dependientes de la actividad pesquera, para el ordenamiento de dicha actividad de modo que se garantice un aprovechamiento sostenible de los recursos pesqueros.
d)Pesca responsable: es un aprovechamiento sostenible de los recursos pesqueros en armonía con el medio ambiente; la utilización de prácticas de pescay acuicultura que no sean nocivas para los ecosistemas, los recursos o la calidad de los mismos.
e)Zonificación participativa: La ordenación y regulación de la pesca se realiza en consenso con los pescadores de las organizaciones con interés legítimo en el proceso, con el objetivo de manejar las pesquerías en forma sostenible. Las normas se establecen específicamente para cada zona, de acuerdo con un Plan de Ordenamiento Pesquero que debe ser realizado como parte del proceso, el cual es aprobado por el INCOPESCA.

b)Reseña de la organización (año de fundación, listado de pescadores o acuicultores u otros que realizan actividades afines, que incluya nombre, número de cédula, nombre de la embarcación, número de matrícula, licencia de pesca y objetivos de dicha organización).
c)Fotocopia de la cédula jurídica y personería jurídica vigente.
d)Registros e información histórica que demuestren la importancia biológica, pesquera, socio cultural y ambiental que sustente la creación de dicha figura y sus mecanismos de regulación en un área marina determinada.
e)Línea base de condición socioeconómica de los miembros de la organización interesada.
f)Mapa en el cual se señalen las coordenadas geográficas de la zona propuesta de acuerdo con el Instituto Geográfico Nacional.
g)Zonificación participativa con el apoyo del INCOPESCA u otra institución u organización, de las áreas destinadas para la pesca, y áreas de veda total o parcial; detalle sobre los tipos de pesca (comercial, deportiva, turística, entre otros), cantidad, número y tipo de artes, modalidades de embarcación, tallas de primera captura o cualquier otra información relevante para la viabilidad de la propuesta.

a. Asegurar que todos sus miembros se abstengan de pescar, sin contar para ello con la respectiva licencia, permiso o autorización para realizar sus actividades.

b. Elaborar y aplicar un Código de Ética para la Pesca Responsable como un instrumento voluntario el cual se hace vinculante para los miembros de esta organización una vez aprobado.

c. Asegurar el cumplimiento de toda la legislación y normativa aplicable, incluyendo las disposiciones establecidas en el Plan de Ordenamiento Pesquero.

d. Ejercer un deber de vigilancia de sus miembros. En el evento de que una denuncia sea debidamente presentada en contra de algún miembro de la organización, por cualquier infracción a las leyes o reglamentaciones pertinentes, el miembro responderá de acuerdo a las sanciones administrativas o penales aplicables y se sujetará a lo que disponga el Código de Ética de Pesca Responsable adoptado por la organización.

e. Las personas autorizadas a pescar serán responsables ante el INCOPESCA por cualquier canon o multa a ser pagado en cumplimiento de este acuerdo, según la legislación vigente.

f. Cooperar y gestionar apoyo adicional financiero y técnico para la colocación de boyas, adquisición de equipos de radiocomunicación, y cualesquiera otros materiales necesarios para el aprovechamiento, conservación y manejo del área.

El ejercicio de la actividad pesquera dentro de estas áreas, estará permitido tanto para aquellos miembros de la Organización solicitante, como para cualquier otro pescador siempre y cuando éste cuente con licencia de pesca vigente y se ajuste a las regulaciones dispuestas en el Plan de Ordenamiento Pesquero definido para cada área.

a. Dos representantes del INCOPESCA que actuarán como coordinadores, propietario y suplente de la comisión respectivamente.

b. Un representante propietario, quien en su ausencia podrá ser suplido por un suplente, ambos nombrados por la comunidad pesquera solicitante.

c. Un representante del Programa Marino Costero del MINAE.

b. La identificación de las áreas de veda total o parcial.

c. Un programa de aplicación y cumplimiento de la legislación vigente.

d. Un programa de registro e información.

e. Un programa de capacitación y extensión.

f. Un programa de monitoreo e investigación.

Se aplicarán aquellas sanciones establecidas en la Ley de Pesca y Acuicultura, Nº 8436, así como cualquier otra que disponga la normativa aplicable.

Regulation for the Establishment of Marine and Continental Areas for Responsible FishingReglamento para el establecimiento de áreas marinas y continentales para la pesca responsable

Artículo 1 — Definitions.

Artículo 4 — The requesting Organization shall support and respect the management measures established in the Fisheries Management Plan approved by INCOPESCA for the established area.

Artículo 5 — Terms and conditions: INCOPESCA shall establish the terms and conditions for the management of said areas, as well as the responsibilities of the Organizations involved, such as:

Artículo 6 — Exercise of fishing.

Artículo 8 — Without prejudice to the provisions of Article 7, INCOPESCA shall promote within these organizations, the formation, training, and implementation of Surveillance Committees in order to achieve the management and development objectives of these areas.

Artículo 9 — The establishment of Marine Areas for Responsible Fishing shall not impede free access to beaches, nor related activities such as tourism among others, unless there are restrictions in the Fisheries Management Plan that are legally supported.

Artículo 10 — The Executive Presidency of INCOPESCA shall appoint a Follow-up Commission for each area in order to provide continuity to the objectives pursued by each of these, and which shall be composed of:

Artículo 11 — The function of the Follow-up Commission shall be to propose the necessary regulations for the sound management of the Marine and Continental Area for Responsible Fishing(*), which must have a Fisheries Management Plan, which shall include at least:

Artículo 12 — Said Follow-up Commission shall ensure the sound management of the Marine and Continental Area for Responsible Fishing(*) and shall keep the Executive Presidency of INCOPESCA informed through at least semi-annual reports.

Artículo 13 — Sanctions.

Artículo 14 — Shall take effect upon its publication.

Artículo 1 — De las definiciones.

Artículo 4 — La Organización solicitante apoyará y respetará las medidas de manejo establecidas en el Plan de Ordenamiento Pesquero aprobado por el INCOPESCA para el área establecida

Artículo 5 — De los términos y condiciones: El INCOPESCA establecerá los términos y condiciones para la gestión de dichas áreas, así como las responsabilidades de las Organizaciones involucradas, tales como:

Artículo 6 — Del ejercicio de la pesca.

Artículo 8 — Sin detrimento de lo establecido en el artículo 7, el INCOPESCA promoverá dentro de estas organizaciones, la conformación, capacitación y puesta en funcionamiento de Comités de Vigilancia a fin de alcanzar los objetivos de manejo y desarrollo de estas áreas.

Artículo 9 — El establecimiento de Áreas Marinas para la Pesca Responsable, no impedirá el libre acceso a las playas, ni actividades conexas corno el turismo entre otras, salvo que existan restricciones en el Plan de Ordenamiento Pesquero, jurídicamente sustentadas.

Artículo 10 — La Presidencia Ejecutiva del INCOPESCA nombrará una Comisión de Seguimiento para cada área a efectos de darle una continuidad a los objetivos que persigue cada una de éstas, y las cuales estarán integrada por.

Artículo 11 — La función de la Comisión de Seguimiento será proponer las regulaciones necesarias para el buen manejo del Área Marina y Continentales para la Pesca Responsable(*), que deberá contar con un Plan de Ordenamiento Pesquero, el cual incluirá al menos:

Artículo 12 — Dicha Comisión de Seguimiento velará por el buen manejo del Área Marina y Continentales para la Pesca Responsable(*) y mantendrá informada a la Presidencia Ejecutiva del INCOPESCA mediante al menos informes semestrales.

Artículo 13 — De las sanciones.

Artículo 14 — Rige a partir de su publicación.
