in the entirety of the text - Full Text Norm 333 Reform Establishes the Tárcoles Responsible Fishing Marine Area Full Text record: DE516 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE A.J.D.I.P./333-2011.-Puntarenas, on the sixteenth day of the month of September of 2011.
I.-That by means of Agreement AJDIP/193-2011, the Board of Directors approved the establishment of the Tárcoles Responsible Fishing Marine Area (Área Marina de Pesca Responsable de Tárcoles), under criteria of seeking a balance and safeguarding the right to greater well-being of the inhabitants of the Republic, in communion with a just and adequate distribution of wealth; thereby also guaranteeing the right to dignified, honest, and useful work for society, within a healthy and ecologically balanced environment; for example, articles 50 and 56 of our Magna Carta.
II.-That along this same line of thought, the Board of Directors has the vision that the development of this type of Responsible Fishing Marine Areas (Áreas Marinas de Pesca Responsable) will come to signify a stimulus for the development of a prosperous fishing activity, with direct benefits to Costa Rican fishing communities.
III.-In that sense, the Tárcoles AMPR must guarantee the suitable conditions, forms, and type for the exercise of the fishing activity, that make permissible its exploitation in a balanced, sustainable, and responsible manner.
IV.-It is for this reason that, as a result of the criteria that are finally established for the exercise of said activity, the undertaking of assessment studies on the biological information developed within the one-year period established in the aforementioned Agreement must at all times be guaranteed, in order to establish, on that basis, the appropriateness of maintaining the management measures or, failing that, whether these should be modified.
V.-In response to the concerns, assessments, and considerations expressed, the Board of Directors, therefore; AGREES:
1º-Let an Article 3 bis be added to Agreement AJDIP/193-2011; which shall read as follows:
"Article 3 bis-. The total closure zone (zona de veda total) for one year of the Tárcoles AMPR, for trawl fishing (pesca de arrastre) and small-scale artisanal fishing (pesca artesanal a pequeña escala), which entered into force upon publication in the Official Gazette La Gaceta of Agreement AJDIP/193-2011, shall be the subject of evaluation at the end of the indicated year, for the purpose of assessing, based on the biological information that is generated, whether it is maintained or another management measure is established. Likewise, it shall be established whether fishing is permitted in said zone and the conditions under which the fishery would be permitted, whether totally or temporarily; without the foregoing being interpreted as an express, tacit, or indefinite exclusion of fishing by the shrimp trawl fleet, the sardine purse-seine fleet (flota sardinera bolichera), or the small-scale commercial fleet from the closed area (área vedada) of the Tárcoles AMPR, after the year referred to in agreement AJDIP/193-2011 has elapsed." 2º-Let it be published. It takes effect upon its publication.

I.-Que mediante Acuerdo AJDIP/193-2011, la Junta Directiva aprobó en establecimiento del Área Marina de Pesca Responsable de Tárcoles, bajo criterios de búsqueda de un equilibrio y resguardo al derecho a un mayor bienestar de los habitantes de la República, en comunión con un justo y adecuado reparto de la riqueza; garantizando con ello además el derecho al trabajo digno, honesto y útil para la sociedad, dentro de un ambiente sano y ecológicamente equilibrado; verbigracia ordinales 50 y 56 de nuestra Carta Magna.
II.-Que bajo esa misma línea de pensamiento tiene la Junta Directiva la visión en cuanto al desarrollo que este tipo de Áreas Marinas de Pesca Responsable, vengan a significar un acicate para el desarrollo de una actividad pesquera próspera, con beneficios directos a las comunidades pesqueras costarricenses.
III.-En ese sentido el AMPR-Tárcoles deberá garantizar las condiciones, formas y tipo idóneas para el ejercicio de la actividad pesquera, que hagan permisiva su explotación de manera equilibrada, sostenible y responsable.
IV.-Es por ello que a las resultas de los criterios que finalmente se establezcan para el ejercicio de dicha actividad, deberá en todo momento garantizarse la realización de estudios de valoración sobre la información biológica que se desarrolle en el plazo de un año establecido en el Acuerdo supra, para sobre dicha base establecer la procedencia de mantener las medidas de ordenamiento o en su defecto si éstas deban modificarse.
V.-En atención a las inquietudes, valoraciones y consideraciones vertidas, la Junta Directiva, por tanto; ACUERDA:
1º-Adiciónese al Acuerdo AJDIP/193-2011, un Artículo 3 bis; el cual se leerá de la siguiente manera:
"Artículo 3 bis-. La zona de veda total por un año del AMPR-Tárcoles, para la pesca de arrastre y artesanal a pequeña escala, misma que entró a regir a partir de la publicación en el Diario Oficial La Gaceta del Acuerdo AJDIP/193-2011, será objeto de evaluación al término del año señalado, a efecto de valorar con base en la información biológica que se genere, si se mantiene o se establece otra medida de ordenamiento.
