Decrees:
"Article 17.-The Ministry of Environment, Energy and Telecommunications is authorized so that, by means of a reasoned and justified resolution and through a budget transfer, it finances research projects regarding groundwater (aguas subterráneas) that are included in the plans and programs of the National Groundwater, Irrigation and Drainage Service. Likewise, it shall be authorized to finance the development of management, conservation and protection projects for water resources submitted before the Water Directorate for its approval, by the Commission for the Management of the Upper Reventazón River Watershed (COMCURE) created through Law 8023. Both cases must be contemplated in the National Development Plan. In the first case, it is not permitted with these resources to cover administrative and operational expenses. In the case of COMCURE, it shall be permitted in a percentage less than or equal to fifteen percent of the assigned resources, provided it is justified and for the purpose of complying with the effective development of the approved projects."

Modificación al Artículo 17 del Decreto Ejecutivo Nº. 32868 -MINAE, Canon por concepto de aprovechamiento aguas, del 24 de agosto del 2005.
Decretan:
"Artículo 17.-Se faculta al Ministerio de Ambiente, Energía y Telecomunicaciones para que mediante resolución razonada y justificada y por medio de transferencia presupuestaria, financie los proyectos de investigación en materia de aguas subterráneas que se encuentren en los planes y programas del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento. De igual forma estará facultado a financiar el desarrollo de proyectos de manejo, conservación y protección del recurso hídrico planteados ante la Dirección de Agua para su aprobación, por la Comisión para el Manejo de la Cuenca Alta del Río Reventazón (COMCURE) creada mediante la Ley 8023.
