Regulations of the Regional Council of the Guanacaste Conservation Area

General Provisions

These regulations govern the composition and functioning of the Regional Council of the Guanacaste Conservation Area (Consejo Regional del Área de Conservación Guanacaste, CORAC), in accordance with article 29 of the Biodiversity Law Nº 7788 of April 30, 1998 and section VI of the Regulations to the Biodiversity Law, Executive Decree Nº 34433-MINAE of March 11, 2008. The CORAC shall be composed of local representatives of non-governmental organizations, interested community organizations, municipalities and the public institutions present in the Guanacaste Conservation Area (Área de Conservación Guanacaste, ACG).

SINAC: National System of Conservation Areas (Sistema Nacional de Áreas de Conservación) ACG: Guanacaste Conservation Area (Área de Conservación Guanacaste).

CONAC: National Council of Conservation Areas (Consejo Nacional de Áreas de Conservación) CORAC: Regional Council of the Conservation Area (Consejo Regional de Área de Conservación) ASP: Protected Wild Area (Área Silvestre Protegida) (Santa Rosa, Guanacaste and Rincón de la Vieja National Parks) Agropaisaje: Territorial jurisdiction (Cantons of La Cruz, Liberia and Two districts of Upala: Aguas Claras and Dos Ríos).

• 1)To ensure the application of policies on the matter.
• 2)To ensure the integration of community needs into the plans and activities of the Guanacaste Conservation Area.
• 3)To promote the participation of the different sectors of the Guanacaste Conservation Area in the analysis, discussion and search for solutions to regional problems related to natural resources and the environment.
• 4)To submit to the National Council of Conservation Areas the proposal for the appointment of the Director of the Guanacaste Conservation Area, by means of a shortlist of three candidates (terna).
• 5)To approve the strategies, policies, guidelines, directives, plans and specific budgets of the Guanacaste Conservation Area, upon proposal of the Area Director and the Scientific-Technical Committee.
• 6)To define specific matters for the management of its protected areas, and submit them to the National Council for approval.
• 7)To recommend to the National Council of Conservation Areas the creation, modification or change of category of its protected wild areas (áreas silvestres protegidas).
• 8)To supervise the work of the Director and of the established financial administration body.
• 9)To approve, in the first instance, matters pertaining to concessions and service contracts established in article 39 of the Biodiversity Law.
• 10)Any other function assigned by national legislation or by the National Council.
• 11)To recommend to the National Council the appointment of the Commissioners of the Guanacaste Conservation Area, whether national or international.
• 12)To designate two full members (propietarios) and two alternates (suplentes) to integrate, together with the Director of the ACG and the representatives of the trust managing entity, the Trust Investment Committee, as well as to decide on matters concerning the administration thereof, in accordance with the respective contract.
• 13)To approve the creation and regulations of Local Councils.

Of the Administrative Structure

• a)Executive Committee (composed of the President, Vice President, Secretary, Treasurer and 5 Vocal Members) b) Fiscal.
• c)Executive Secretary.

Said call must be made one month prior to the holding thereof, by means of a notice published once, in a regional written communication medium.

The General Assembly (Asamblea) shall commence with the accredited representatives and the quorum for decision-making shall be by simple majority.

Each duly accredited full representative shall be entitled to voice and vote, as well as to elect and be elected as a representative in the CORAC. One municipal representative must always be elected, who must be accredited before the General Assembly by means of a Municipal Council agreement.

One member who shall be elected by the Assembly from among the representatives designated by the Municipalities, for a period of two years, and may be re-elected, and the Executive Secretariat, exercised by the Director of the Guanacaste Conservation Area. The swearing-in of the members shall be carried out by the Executive Secretary of the CORAC.

• a)To exercise the representation of the respective Regional Council of the Conservation Area before other public and private entities.
• b)To preside over the sessions of the Regional Council.
• c)To resolve any matter in case of a tie, in which case they shall have a double vote.
• d)To ensure that the Regional Council complies with the policies, laws and regulations relating to its function, as established by the legal and technical framework binding on SINAC.
• e)To render reports to the Regional Council, when required.
• f)To sign the minutes (actas) of the Regional Council.
• g)Any other function assigned by national legislation or by the Regional Council.

The functions established in article 42 of the Regulations to the Biodiversity Law are transcribed:

• a)To convene ordinary and extraordinary sessions.
• b)To prepare the agenda (orden del día), taking into account, where applicable, the requests of other members formulated at least three days in advance.
• c)To draft the minutes (actas) of the Regional Council sessions and keep the corresponding minute book updated.
• d)To sign the minutes of the Regional Council.
• e)To maintain an archive of all documentation issued or sent to the Regional Council.
• f)To convene the Assemblies referred to in article 29 of the Biodiversity Law, preside over them, and draft the minutes of these Assemblies.
• g)To maintain permanent communication with the Local Councils and other members of the CORAC.
• h)To facilitate the transfer of information among the entire structure of the AC.
• i)To prepare quarterly reports on the level of execution of agreements for submission to the CORAC.
• j)To execute the agreements and resolutions of the CORAC.
• k)Any other function assigned by the CORAC.

• a)To collaborate with the Executive Secretary in the execution of the agreements made by the CORAC.
• b)To maintain permanent communication with the Local Councils and other members of the CORAC.
• c)To collaborate in the drafting of the minutes.
• d)Any other function assigned by the CORAC.

Of the Obligations

The members of the CORAC may be removed at any time, upon prior request by the Organization or Sector they represent or for any of the following causes: breach of their duties, conduct contrary to the purposes and principles established in the Biodiversity Law and other related Laws, all by means of an agreement of the CORAC.

The agreement of the CORAC for the removal of any of its members must be adopted by qualified majority.

Those established in article 35 of the Regulations to the Biodiversity Law are transcribed:

• a)Being in default as a debtor to the public treasury.
• b)Being linked to another member of the Council, or to any of the Directors of SINAC, by consanguinity or affinity kinship, up to the third degree inclusive. As well as the cases provided for by the General Law of Public Administration in articles 230 to 238.
• c)Those declared disqualified from holding public office by virtue of a final judicial sentence.
• d)Those who have been sanctioned or convicted for environmental or economic infractions or crimes.
• e)Those public officials covered by the impediments and prohibitions established in the Law against Corruption and Illicit Enrichment in Public Service Nº 8422, published in La Gaceta Nº 212 of October 29, 2004.
• f)The same person may not be a member of two Regional Councils simultaneously; but an organization may be represented in more than two Regional Councils.
• g)Being an employee of the National System of Conservation Areas.

• a)To attend the ordinary and extraordinary meetings to which they are convened. In the event that the full member cannot attend due to reasons of force majeure (caso fortuito o fuerza mayor), they must arrange for the participation of their respective alternate.
• b)To submit reports to the Regional Council, when appropriate or when requested.
• c)To communicate to the sector or body they represent the agreements, decisions, policies, work plans, programs and everything decided by the CORAC and to render written reports, at least once a year or when requested by the sector or body.
• d)To execute the agreements and commitments assigned to them.
• e)To maintain confidentiality regarding the matters dealt with in the Regional Council in accordance with the legal framework.
• f)Any other duty assigned by national legislation or the Regional Council.

Of the Oversight Office (Fiscalía) of the Committee

The Fiscal must attend all sessions of the committee, with voice but no vote.

• a)To present to the Executive Committee all matters within their knowledge that affect the administration of the ACG.
• b)To recommend to the Executive Committee the application of sanctions against its members.
• c)To deliver an annual report to the General Assembly.
• d)To coordinate with the President of the Executive Committee the dissemination of activities and information to all bodies of the Council and to the organizations comprising the General Assembly.
• e)To keep the Committee's archive updated, to take and distribute the minutes (actas) and process the respective correspondence.

Of the Local Councils

In the Guanacaste Conservation Area, when deemed necessary, Local Councils may be created by agreement of the Regional Council, whose constitution shall be defined in the creation agreement.

The CORAC shall comply with the provisions of articles 45 and 46 of the Regulations to the Biodiversity Law, which are transcribed below:

For each session, the Executive Secretary of the CORAC shall draft digital or handwritten minutes (acta), which shall contain the indication of the persons attending, as well as the place and date of the session, the agenda (orden del día), aspects of the deliberation, the manner and result of the voting, and the content of the agreements. The minutes shall be approved at the next ordinary session. Prior to such approval, the agreements adopted in the respective session shall lack firmness (firmeza), unless the members present agree to their firmness by a vote of two-thirds of the total members present.

In the event of disagreement by any member of the Council on a specific topic, at the request of the same, the Executive Secretary of the CORAC must record it as such in the respective minutes and must proceed to affix the signatures of those members who are against what was agreed, thus complying with the provisions of articles Nº 56, subsection 3) and Nº 57, subsection 1) of the General Law of Public Administration Nº 6227; likewise, the Council member shall be exempt from any responsibilities that, in their case, could arise from the agreements. In all cases, the minutes shall be signed by the President and the Executive Secretary of the CORAC. Once the minutes are signed, the legend "last line" (última línea) must be included in the following space, so that anything subsequently written on that same folio shall lack validity.

Any internal or working document used in the Regional Council may be consulted by interested parties and shall be considered public and consultable without any limitation, except as indicated in article 273 of the General Law of Public Administration and the Law on Undisclosed Information, Nº 7975, published in La Gaceta Nº 12 of January 18, 2000.

The agreements of the Regional Council shall have an appeal for reversal before the same Council.

For anything not provided for herein, the provisions of articles 30 et seq. of the Regulations to the Biodiversity Law and the provisions of the General Law of Public Administration regarding collegial bodies shall apply.

Reglamento del Consejo Regional del Área de Conservación Guanacaste

El presente reglamento regula la conformación y funcionamiento del Consejo Regional del Área de Conservación Guanacaste (CORAC), de acuerdo al artículo 29 de la Ley de Biodiversidad Nº 7788 del 30 abril de 1998 y la sección VI del Reglamento a la Ley de Biodiversidad Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo del 2008. El CORAC estará integrado por representantes locales de las organizaciones no gubernamentales, comunales interesadas, municipalidades y las instituciones públicas presentes en el Área de Conservación Guanacaste.

CONAC: Consejo Nacional de Áreas de Conservación CORAC: Consejo Regional de Área de Conservación ASP: Área Silvestre Protegida (Parque Nacional Santa Rosa, Guanacaste y Rincón de la Vieja) Agropaisaje: Jurisdicción territorial (Cantones de La Cruz, Liberia y Dos distritos de Upala: Aguas Claras y Dos Ríos).

• 1)Velar por la aplicación de las políticas en la materia.
• 2)Velar por la integración de las necesidades comunales en los planes y actividades del Área de Conservación Guanacaste.
• 3)Fomentar la participación de los diferentes sectores del Área de Conservación Guanacaste, en el análisis, la discusión y la búsqueda de soluciones para los problemas regionales relacionados con los recursos naturales y el ambiente.
• 4)Presentar al Consejo Nacional de Áreas de Conservación, la propuesta para el nombramiento del Director del Área de Conservación Guanacaste, mediante una terna.
• 5)Aprobar las estrategias, las políticas, los lineamientos, las directrices, los planes y los presupuestos específicos del Área de Conservación Guanacaste, a propuesta del Director del Área y del Comité Científico- Técnico.
• 6)Definir asuntos específicos para el manejo de sus áreas protegidas, y presentarlos al Consejo Nacional para su aprobación.
• 7)Recomendar, al Consejo Nacional de Áreas de Conservación, la creación, modificación o el cambio de categoría de sus áreas silvestres protegidas.
• 8)Supervisar la labor del Director y del órgano de administración financiera establecidos.
• 9)Aprobar, en primera instancia, lo referente a las concesiones y los contratos de servicios establecidos en el artículo 39 de la Ley de Biodiversidad.
• 10)Cualquier otra función asignada por la legislación nacional o por el Consejo Nacional.
• 11)Recomendar al Consejo Nacional el nombramiento de los Comisionados del Área de Conservación Guanacaste, nacionales o internacionales.
• 12)Designar dos miembros propietarios y dos suplentes para integrar en conjunto con el Director del ACG y los representantes del ente administrador del fideicomiso, el Comité de Inversiones del Fideicomiso, así como decidir sobre lo concerniente a la administración del mismo, de acuerdo con el contrato respectivo.
• 13)Aprobar la creación y los reglamentos de los Consejos Locales.

De la estructura administrativa

• a)Comité Ejecutivo (integrado por el Presidente, Vicepresidente, Secretario, Tesorero y 5 Vocales) b) Fiscal.
• c)Secretario Ejecutivo.

Dicha convocatoria deberá realizarse con un mes de anterioridad a la celebración de la misma, mediante aviso publicado por una única vez, en un medio escrito de comunicación regional.

La Asamblea dará inicio con los representantes acreditados y el quórum para toma de acuerdos será por mayoría simple.

Cada titular debidamente acreditado tendrá derecho a voz y voto, así como a elegir y ser electo como representante en el CORAC. Siempre deberá elegirse un representante municipal que deberá ser acreditado ante la Asamblea General por medio de acuerdo de Concejo Municipal.

Un miembro que será electo por la Asamblea entre los representantes designados por las Municipalidades, por un periodo de dos años, pudiendo ser reelecto y la Secretaría Ejecutiva, ejercida por el Director (a) del Área de Conservación de Guanacaste. La juramentación de los miembros la realizará el Secretario Ejecutivo del CORAC.

• a)Ejercer la representación del Consejo Regional del Área de Conservación respectiva, ante los demás entes públicos y privados.
• b)Presidir, las sesiones del Consejo Regional.
• c)Resolver cualquier asunto en caso de empate, en cuyo caso tendrá doble voto.
• d)Velar porque el Consejo Regional cumpla las políticas, leyes y reglamentos relativos a su función, según lo establece el ordenamiento jurídico y técnico vinculante al SINAC.
• e)Rendir informes al Consejo Regional, cuando sean requeridos.
• f)Firmar las actas del Consejo Regional.
• g)Cualquier otra función asignada por la legislación nacional o por el Consejo Regional.

Se transcriben las funciones establecidas en el artículo 42 del Reglamento de la Ley de Biodiversidad:

• a)Convocar las sesiones ordinarias y extraordinarias.
• b)Confeccionar el orden del día, teniendo en cuenta en su caso, las peticiones de los demás miembros formuladas al menos con tres días de antelación.
• c)Levantar las actas de las sesiones del Consejo Regional y llevar actualizado el correspondiente libro de actas.
• d)Firmar las actas del Consejo Regional.
• e)Llevar un archivo de toda la documentación que emita o se envíe al Consejo Regional.
• f)Convocar las Asambleas a las que se refiere el artículo 29 de la ley de Biodiversidad y presidirlas y levantar las actas de estas Asambleas.
• g)Mantener una permanente comunicación con los Consejos Locales y demás integrantes del CORAC.
• h)Facilitar la transferencia de información entre toda la estructura del AC.
• i)Elaborar informes trimestrales del nivel de ejecución de los acuerdos para su presentación al CORAC.
• j)Ejecutar los acuerdos y resoluciones del CORAC.
• k)Cualquier otra función asignada por el CORAC.

• a)Colaborar con el Secretario Ejecutivo con la ejecución de los acuerdos que tome el CORAC.
• b)Mantener una permanente comunicación con los Consejos Locales y demás integrantes del CORAC.
• c)Colaborar en el levantamiento del acta.
• d)Cualquier otra función que le asigne el CORAC.

De las obligaciones

Los miembros del CORAC podrán ser removidos en cualquier momento, previa solicitud por parte de la Organización o del Sector que representa o por alguna de las siguientes causas: incumplimiento de sus funciones, conducta contraria a los fines y principios establecidos en la Ley de Biodiversidad y otras Leyes conexas, todo ello mediante acuerdo del CORAC.

El acuerdo del CORAC para la remoción de alguno de sus miembros, deberá tomarse mediante mayoría calificada.

Se transcriben las establecidas en el artículo 35 del Reglamento de la Ley de Biodiversidad a) Ser deudores morosos del fisco.

• b)Estar ligado entre sí con otro miembro del Consejo, o con alguno de los Directores de SINAC, por parentesco por consanguinidad o afinidad, hasta el tercer grado inclusive. Así como los casos previstos por la Ley General de la Administración Pública en los artículos del 230 al 238.
• c)Las declaradas inhabilitadas para ocupar cargos públicos en virtud de sentencia judicial firme.
• d)Aquellos que hayan sido sancionados o condenados por infracciones o delitos ambientales o económicos.
• e)Aquellos funcionarios públicos cubiertos por los impedimentos y prohibiciones establecidos en la Ley contra la Corrupción y el Enriquecimiento Ilícito en la Función Pública Nº 8422, publicada en La Gaceta Nº 212 del 29 de octubre del 2004.
• f)Una misma persona, no podrá ser miembro de dos Consejos Regionales simultáneamente; pero una organización sí podrá encontrarse representada en más de dos Consejos Regionales.
• g)Ser funcionario del Sistema Nacional de Áreas de Conservación.

• a)Asistir a las reuniones ordinarias y extraordinarias a las que se les convoque. En caso de que el miembro propietario no pueda asistir por motivos de caso fortuito o fuerza mayor, deberá gestionar la participación de su respectivo suplente.
• b)Presentar informes al Consejo Regional, cuando corresponda o le sea solicitado.
• c)Comunicar al sector o instancia a la que se represente, los acuerdos, decisiones, políticas, planes de trabajo, programas y todo aquello que decida el CORAC y rendir informes escritos, al menos una vez al año o cuando le sea solicitado por el sector o la instancia.
• d)Ejecutar los acuerdos y compromisos que se le asignen.
• e)Mantener confidencialidad sobre los temas tratados en el Consejo Regional de conformidad con el ordenamiento jurídico.
• f)Cualquier otro deber asignado por la legislación nacional o Consejo Regional.

De la fiscalía del comité

El Fiscal debe asistir a todas las sesiones del comité, con derecho a voz; pero sin derecho a voto.

• a)Presentar al Comité Ejecutivo todos los asuntos que sean de su conocimiento, que afecten la administración del ACG.
• b)Recomendar al Comité Ejecutivo la aplicación de sanciones a sus integrantes.
• c)Entregar un informe anual a la Asamblea General.
• d)Coordinar con el Presidente del Comité Ejecutivo la divulgación de actividades e información a todos los órganos del Consejo y a las organizaciones integrantes de la Asamblea General.
• e)Mantener actualizado el archivo del Comité, tomar y distribuir las actas y tramitar la correspondencia respectiva.

De los consejos locales

En el Área de Conservación Guanacaste, cuando se considere necesario, podrán crearse por acuerdo del Consejo Regional, Consejos Locales cuya constitución se definirá en el acuerdo de creación.

El CORAC cumplirá con lo establecido en los artículos 45 y 46 del Reglamento de la Ley de Biodiversidad, que de seguido se trascriben:

De cada sesión el Secretario Ejecutivo del CORAC levantará un acta digital o manuscrita, que contendrá la indicación de las personas asistentes, así como el lugar y fecha de la sesión, el orden del día, aspectos de la deliberación, la forma y resultado de la votación y el contenido de los acuerdos. El acta se aprobará en la siguiente sesión ordinaria. Antes de esa aprobación carecerán de firmeza los acuerdos tomados en la respectiva sesión, a menos que los miembros presentes acuerden su firmeza por votación de dos tercios de la totalidad de los miembros presentes.

En caso de desacuerdo de algún miembro del Consejo sobre algún tópico específico, a solicitud del mismo, el Secretario Ejecutivo del CORAC deberá hacerlo constar así en el acta respectiva y deberá proceder a estampar las firmas de aquellos miembros que estén en contra de lo acordado, cumpliendo así con lo indicado en los artículos Nº 56, inciso 3) y Nº 57, inciso 1) de la Ley General de la Administración Pública Nº 6227, asimismo el miembro del Consejo quedará exento de las responsabilidades que en su caso, pudieran derivarse de los acuerdos. En todos los casos las actas serán firmadas por el Presidente y el Secretario Ejecutivo del CORAC. Una vez firmadas las actas, en el siguiente espacio debe incluirse la leyenda "última línea", de esa manera, lo escrito posteriormente en ese mismo folio carecerá de validez.

Todo documento interno o de trabajo que se utilice en el Consejo Regional, podrá ser consultado por los interesados y se considerarán públicos y consultables sin limitación alguna, salvo lo indicado en el artículo 273 de la Ley General de la Administración Pública y la Ley de Información no divulgada, Nº 7975, publicada en La Gaceta Nº 12 del 18 de enero del 2000.

Los acuerdos del Consejo Regional tendrán recurso de revocatoria ante el mismo Consejo.

Para todo lo no establecido, aplica lo estipulado en los artículos 30 y siguientes del Reglamento a la Ley de Biodiversidad y lo dispuesto en la Ley General de Administración Pública con respecto a los órganos colegiados.
