in the entirety of the text - Complete Text of Norm 33509 Declares Chenailles Wildlife Refuge Private Category Complete Text of Act: 120DB8 No. 33509 No. 33509 (This executive decree was repealed by article 1 of executive decree No. 40989 of February 19, 2018) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred by subsections 3) and 18) of articles 140 and 146 of the Political Constitution, article 1 of the Forestry Law (Ley Forestal) and its amendments, No. 7575, of February 13, 1996, published in La Gaceta No. 72 of April 16, 1996, articles 82, 84, and 87 of the Wildlife Conservation Law (Ley de Conservación de la Vida Silvestre), No. 7317 of October 30, 1992, published in La Gaceta No. 235 of December 7, 1992, article 32 of the Organic Law of the Environment (Ley Orgánica del Ambiente), No. 7554 of October 4, 1995, published in La Gaceta No. 215 of November 13, 1995, article 27 of the General Law of Public Administration (Ley General de la Administración Pública), No. 6227, of May 2, 1978, and articles 150 and 151 of the Regulation to the Wildlife Conservation Law, Executive Decree No. 32633-MINAE, published in La Gaceta No. 180 of September 20, 2005, and
I.-That it is in the State's interest to strengthen the administrative structures in the field of natural resources, for the purpose of having defined policies that guarantee the rational use of said existing resources, as well as the adoption of the necessary measures for the conservation and sustainable development of natural resources.
II.-That the corporation Empresa Diecisiete Setenta y Seis Sociedad Anónima, registered before the Public Registry, at volume: eight hundred thirty-two, folio: two hundred eighty-eight, entry: three hundred eighty-four, legal identification number No. 3-101-155762, represented by Mrs. Marynell Baker Benson, of legal age, divorced, attorney, resident of San Ramón de Tres Ríos, with identity card number eight-zero thirty-five-one hundred seventy-two, has within its corporate purpose, environmental conservation and sustainable development of natural resources.
III.-That in order to contribute to the public and private environmental conservation efforts occurring in the country, the corporation Empresa Diecisiete Setenta y Seis S. A., has expressed its desire to voluntarily submit three properties of its ownership to the protection regime of a National Wildlife Refuge in the Private category.
IV.-That the Wildlife Conservation Law No. 7317 and the Organic Law of the Environment No. 7554 empower the Executive Branch to create Protected Wild Areas in those areas that present important or special ecological characteristics for their protection and conservation.
V.-That articles 82 and 87 of the Wildlife Conservation Law, No. 7317, establish as national wildlife refuges those that the Executive Branch declares as such, for the purpose of carrying out the protection and research of wild flora and fauna.
VI.-That the properties owned by Empresa Diecisiete Setenta y Seis S. A., to be submitted to the protection regime of a Private Category Wildlife Refuge, located in Bahía Junquillal, La Cruz district, La Cruz canton, Guanacaste province, are the following: Registration No. 5-088755-000, cadastral plan No. G-0218641-1994; Registration No. 5-097940-000, cadastral plan No. G-0342724-1996; and Registration No. 5-109535-000, cadastral plan No. G-0411759-1997.
VII.-That the described properties present forest cover (cobertura boscosa) in different stages of maturity, two small wetlands with mangrove vegetation, a great diversity of dry forest species, and marine and coastal resources that constitute the habitat of a great variety of wildlife.
VIII.-That the coastal zones of Guanacaste province present important dry forest ecosystems, whose biological richness has been threatened by accelerated urban and tourism development, which is why the conservation and environmental protection of said zones is necessary.
IX.-That the properties owned by the corporation Empresa Diecisiete Setenta y Seis S. A., border the Bahía Junquillal Wildlife Refuge, which means a coastal biological corridor of great scenic beauty and environmental value is being formed.
X.-That the establishment of this Private Refuge will strengthen the buffer zone (área de amortiguamiento) of the Bahía Junquillal Wildlife Refuge and the Maritime Terrestrial Zone (Zona Marítimo Terrestre) of the Northern Region of the country, thereby allowing the consolidation of the Bahía Junquillal Marine-Coastal Biological Corridor.
XI.-That studies carried out on the mentioned properties have recommended the creation of a private protected wild area, which would serve for the protection of biodiversity and to provide opportunities for environmental education, reforestation, research, and outreach in the zone. Therefore, THEY DECREE:

I.-Que es interés del Estado fortalecer las estructuras administrativas en el campo de los recursos naturales, con la finalidad de contar con políticas definidas que garanticen el uso racional de dichos recursos existentes, así como la adopción de las medidas necesarias para la conservación y el desarrollo sostenible de los recursos naturales.
II.-Que la sociedad Empresa Diecisiete Setenta y Seis Sociedad Anónima, inscrita ante el Registro Público, al tomo: ochocientos treinta y dos, folio: doscientos ochenta y ocho, asiento: trescientos ochenta y cuatro, cédula de persona jurídica Nº 3-101-155762, representada por la señora Marynell Baker Benson, mayor de edad, divorciada, abogada, vecina de San Ramón de Tres Ríos, y cédula de identidad número ocho-cero treinta y cinco-ciento setenta y dos, tiene dentro de su objeto social, la conservación ambiental y desarrollo sostenible de los recursos naturales.
III.-Que con el fin de coadyuvar con los esfuerzos públicos y privados de conservación ambiental que se suscitan en el país, la sociedad Empresa Diecisiete Setenta y Seis S. A., ha manifestado su deseo de someter voluntariamente tres fincas de su propiedad al régimen de protección de Refugio Nacional de Vida Silvestre en la categoría de Privado.
IV.-Que la Ley de Conservación de Vida Silvestre N° 7317 y la Ley Orgánica del Ambiente N° 7554, facultan al Poder Ejecutivo para crear Áreas Silvestres Protegidas en aquellas áreas que presenten características ecológicas importantes o especiales para su protección y conservación.
V.-Que los artículos 82 y 87 de la Ley de Conservación de la Vida Silvestre, Nº 7317, establecen como refugios nacionales de vida silvestre los que el Poder Ejecutivo declare como tales, con el fin de llevar a cabo la protección e investigación de la flora y la fauna silvestre.
VI.-Que las fincas propiedad de Empresa Diecisiete Setenta y Seis S. A., a someter al régimen de protección de Refugio de Vida Silvestre Categoría Privada, ubicadas en Bahía Junquillal, distrito La Cruz, cantón La Cruz, provincia de Guanacaste, son las siguientes: Matrícula Nº 5-088755-000, plano catastrado Nº G-0218641-1994; matrícula Nº 5-097940-000, plano catastrado Nº G-0342724-1996, y matrícula Nº 5-109535-000, plano catastrado Nº G-0411759-1997.
VII.-Que las fincas descritas presentan una cobertura de bosque en diferentes etapas de madurez, dos pequeños humedales con vegetación de manglar, una gran diversidad de especies del bosque seco y recursos marinos y costeros que constituyen el hábitat de una gran variedad de fauna silvestre.
VIII.-Que las zonas costeras de la provincia de Guanacaste presentan importantes ecosistemas de bosque seco, cuya riqueza biológica se ha visto amenazada ante un acelerado desarrollo urbano y turístico, razón por la cual se hace necesario la conservación y protección ambiental de dichas zonas.
IX.-Que las fincas propiedad de la sociedad Empresa Diecisiete Setenta y Seis S. A., colindan con el Refugio de Vida Silvestre Bahía Junquillal, lo cual hace que se esté conformando un corredor biológico costero de gran belleza escénica y valor ambiental.
X.-Que la constitución de este Refugio Privado fortalecerá el área de amortiguamiento del Refugio de Vida Silvestre de Bahía Junquillal y la Zona Marítimo Terrestre de la Región Norte del país, permitiendo de esa manera la consolidación del Corredor Biológico Marino-Costero Bahía Junquillal.
XI.-Que estudios efectuados en las mencionadas propiedades han recomendado la creación de un área silvestre protegida privada, que sirva para la protección de la biodiversidad y para brindar oportunidades de educación ambiental, reforestación, investigación y divulgación en la zona. Por tanto,

A., cédula de persona jurídica Nº 3-101-155762, las que se ubican en las Hojas Cartográficas Murciélago Nº 3048 I y Bahía Salinas Nº 3049 II, escala 1:50,000 del Instituto Geográfico Nacional.
Las siguientes coordenadas geográficas en Lambert Norte son los puntos de referencia de los vértices del Refugio Chenailles: partiendo del lindero más al sureste del Refugio Chenailles: 329581 N y 352079 E frente al camino que conduce de la comunidad de Soley al Refugio de Vida Silvestre Junquillal, 329165 N y 351837 E frente a una quebrada sin nombre que drena al Estero Quebrada Verde del Refugio de Vida Silvestre Junquillal, 329097 N y 351653 E que colinda con la propiedad de Fulvio Paniagua, 330332 N y 349503 E en el sector oeste en el acantilado contiguo a Playa Mostrencal, 332084 N y 350212 E en el sector al norte en la margen izquierda de una quebrada sin nombre pero llamada Buenaventura, 331361 N y 351804 E en el sector noreste frente al camino que conduce a la comunidad de Soley y en la margen derecha de la Quebrada Saltomojosa.

A., siguiendo estrictamente el Plan de Manejo aprobado por el Área de Conservación Guanacaste (ACG), para lo cual dicha área supervisará la ejecución del mismo y podrá solicitar informes de avance o emitir normas técnicas y científicas que deberá seguir la sociedad propietaria.
