"REGULATION OF THE AQUEDUCT OF THE MUNICIPALITY OF MONTES DE ORO"

General objectives

CHAPTER 1

7794 of April 30, 1998, and in accordance with the provisions of Article 41 of the Ley de Aguas, No. 276-42, and Article 50 of the Ley General de Agua Potable, No. 1634-55.

For the purposes of this Regulation, the following terms shall be used:

Subscriber (Abonado): Natural or legal person who owns the property, building, or other, to which the service is provided.

Service disconnection (Corte de servicio): Definitive or temporary deprivation of the service.

New installation cost (Costo por nueva instalación): Amounts that the subscriber (abonado) must pay for the service of a new water connection (paja de agua) to the property, as well as those costs inherent to the installation.

Connection cost (Costo por conexión): Amount that the subscriber (abonado) must pay for the connection service of a water connection (paja de agua) to the property.

Reconnection cost (Costo por reconexión): Amount that the subscriber (abonado) must pay when the service is suspended for lack of payment and the person requests its reconnection.

Cost for relocation of connection (Costo por traslado de paja): Amount that the subscriber (abonado) must pay when requesting the relocation of the water connection (paja de agua) to another property.

Transfer cost (Costo por traspaso): Amount that the subscriber (abonado) must pay when requesting the transfer of a water connection (paja de agua).

Domiciliary installations (Instalaciones domiciliarias): Internal drinking water system of the domiciles.

Service connection (Prevista): Piping and accessories between the main pipe and the property boundary with the public road (water connection (paja de agua)).

Aqueduct service (Servicio de acueducto): Supply of drinking water provided by the Municipality to the user.

System (Sistema): The set of springs (nacientes), intakes (captaciones), pipes, storage tanks, treatment plant, distribution networks, and other assets necessary to provide the aqueduct service to the population.

User (Usuario): Any natural or legal person who uses the drinking water services, whether owner or authorized to do so.

Municipality (Municipalidad): Institution responsible for supplying the aqueduct service, on properties located facing the distribution networks.

Services

Otherwise, the Municipality assumes no responsibility for the malfunction of the aforementioned system.

Obtaining the service

CHAPTER III

The Municipality shall supervise the liquid conveyance works at the request of the interested party.

Said requests shall be registered and granted in chronological order when applicable.

The municipality shall proceed ex officio to install the water services that are necessary, so that each occupancy unit has its individual service.

If it proceeds, it shall be executed upon prior payment of the disconnection (desconexión) cost and any existing balance, both for water service and for other fees, taxes, contributions, or others.

Payment and suspension of service

CHAPTER IV

The categories are as follows:

Domiciliaria: For houses and apartment buildings intended exclusively for habitation, whether occupied by their owners or tenants.

Ordinaria: For offices, commercial and industrial businesses in which water use is similar to that of domiciles.

Reproductiva: For industries and businesses that use water as raw material or as an element for the production of their products or the provision of their services.

Preferencial: For use by charitable, educational, and religious institutions.

Gobierno: For offices and institutions of the Central Government, Public Powers, and Decentralized Government Institutions.

The Preferencial and Gobierno categories comprise only the indicated institutions. Any other installation belonging to the same institutions that is dedicated to other activities must be classified as corresponds to the use of the services.

Doing so will result in it being disconnected again and it will not be reconnected—if applicable—until the reconnection (reconexión) fee, the debt, and the corresponding fines have been paid.

The reconnection (reconexión) of the service shall be made only once the fines and the reconnection (reconexión) cost are paid.

a)Does not pay the service on time, once the grace period has expired, which consists of fifteen (15) calendar days after the last day of the month being billed.
b)Illegally interconnects pipes with other water services, the distribution system, or other supply sources.
c)When the user does not allow inspection of the intra-domiciliary installations.
d)When the subscriber's (abonado) installations are defective and the deficiencies are not corrected (if previously warned).
e)When the installations do not meet the necessary conditions to prevent damage to themselves or third parties.

"REGLAMENTO DEL ACUEDUCTO DE LA MUNICIPALIDAD DE MONTES DE ORO"

Objetivos generales

CAPÍTULO 1

Para los efectos del presente Reglamento, se utilizarán los siguientes términos:

Abonado: Persona física o jurídica propietaria de la finca, edificación u otra, a la que se presta el servicio.

Corte de servicio: Privación definitiva o temporal del servicio.

Costo por nueva instalación: Valores que debe pagar el abonado por el servicio de una nueva paja de agua a la propiedad, así como aquellos costos propios de la instalación.

Costo por conexión: Valor que debe pagar el abonado por el servicio de conexión de una paja de agua a la propiedad.

Costo por reconexión: Valor que debe pagar el abonado cuando el servicio es suspendido por falta de pago y la persona solicita su reconexión.

Costo por traslado de paja: Valor que debe pagar el abonado cuando solicita el traslado de la paja de agua a otra propiedad.

Costo por traspaso: Valor que debe pagar el abonado cuando solicita el traspaso de una paja de agua.

Instalaciones domiciliarias: Sistema interno de agua potable de los domicilios.

Prevista: Tubería y accesorios entre la tubería principal y el límite de la propiedad con la vía pública (paja de agua).

Servicio de acueducto: Suministro de agua potable que brinda la Municipalidad al usuario.

Sistema: Es el conjunto de nacientes, captaciones, tuberías, tanques de almacenamiento, planta de tratamiento redes de distribución y demás activos necesarios para prestar el servicio de acueducto a la población.

Usuario: Toda persona física o jurídica que utiliza los servicios de agua potable, sea propietaria o autorizada para ello.

Municipalidad: Institución encargada de suministrar el servicio de acueducto, en predios ubicados frente a las redes de distribución.

De los servicios

CAPÍTULO II

De lo contrario la Municipalidad no asume ninguna responsabilidad por el mal funcionamiento del sistema mencionado.

Obtención del servicio

CAPÍTULO III

La Municipalidad supervisará los trabajos de conducción del líquido a solicitud del interesado.

Dichas solicitudes serán registradas y conferidas en forma cronológica cuando ello proceda.

La municipalidad procederá de oficio a instalar los servicios de agua que sean necesarios, para que cada unidad de ocupación cuente su servicio individual.

Si la misma procede, se ejecutará previo pago del costo por desconexión y de cualquier saldo existente, tanto por servicio de agua como por otra tasa, impuestos, contribuciones u otros.

Pago y suspensión del servicio

CAPÍTULO IV

Las categorías son las siguientes:

Domiciliaria: Para casas y edificios de apartamentos destinados exclusivamente a habitación, sean ocupados por sus dueños o inquilinos.

Ordinaria: Para oficinas, negocios comerciales e industriales en los cuales se haga uso del agua similar al de los domicilios.

Reproductiva: Para industrias y comercios que utilicen el agua como materia prima o como elemento para la elaboración de sus productos o de la prestación de sus servicios.

Preferencial: Para uso de instituciones de beneficencia, educación y culto.

Gobierno: Para oficinas e instituciones del Gobierno Central, Poderes Públicos e Instituciones Descentralizadas del Gobierno.

Las categorías Preferencial y Gobierno comprenden solamente a las instituciones indicadas. Cualquier otra instalación perteneciente a las mismas instituciones que sea dedicada a otras actividades, debe ser clasificada según corresponda al uso de los servicios.

De hacerlo se procederá a desconectarlo de nuevo y no será reconectado- si fuera del caso- hasta tanto no se haya pagado el valor de la reconexión, la deuda y las multas correspondientes.

La reconexión del servicio se hará hasta tanto cancele, las multas y el costo de la reconexión.

a)No pague oportunamente el servicio, una vez vencido el período de gracia que consiste en quince (15) días naturales posteriores al último día del mes en cobro.
b)Interconecte de forma ilegal tuberías con otros servicios de agua, el sistema de distribución o a otras fuentes de abastecimiento.
c)Cuando el usuario no permita inspeccionar las instalaciones intradomiciliarias.
d)Cuando las instalaciones del abonado estén defectuosas y no se corrijan las deficiencias (si se ha prevenido anteriormente).
e)Cuando las instalaciones no reúnan las condiciones necesarias para evitar daños a si mismos o a terceros.

CAPÍTULO V

Disposiciones generales

Artículo 1 — This Regulation is issued pursuant to the provisions of Articles 4°, subsection a), 13, subsections e) and d), and 43 of the Código Municipal, Law No.

Artículo 2 — This Regulation shall govern the municipal organization and operation regarding the provision of drinking water service, as well as establish the rights and duties of both the subscribers (abonados) of the system and the Municipality.

Artículo 3 — Glossary of terms.

Artículo 4 — The Municipality is obliged to provide water service to all owners of real estate or those authorized by them, dedicated to work, residence of persons, or other uses, when the distribution networks pass in front of the property.

Artículo 5 — The Municipality shall provide its services in the most efficient manner that its resources and circumstances allow and shall take the necessary measures to ensure the sustainability, development, and expansion of the service.

Artículo 6 — The Municipality undertakes to provide users with adequate service in terms of quantity, continuity, and quality.

Artículo 9 — It is the responsibility and obligation of the subscriber (abonado) to maintain in good working condition the internal systems and installations.

Artículo 11 — The user must use the service in accordance with the category with which they were classified.

Artículo 12 — The Municipality shall grant water service to a property only upon request of the interested party or any person authorized by the owner.

Artículo 13 — Requests, to be considered, must have public roads for direct access, and the system must pass in front of the property that requests the service; otherwise, the interested party must provide the necessary materials for conveying the water to the site and the labor.

Artículo 15 — The applicant must always indicate the use they will give to the service requested, and the municipality may reject that request when technically or regulatorily it is not possible due to problems of liquid scarcity or other reasons.

Artículo 17 — Under no circumstances may users use one service (one connection (paja)) for two or more occupancy units.

Artículo 18 — Users who enjoy the water service may request in writing from the Municipality a change in the use of the service (different category), for which the local Government shall determine if the user's request is justified.

Artículo 19 — If the subscriber (abonado) considers that the water service is no longer necessary, they must make the respective request for disconnection of the service before the Municipality, with all the data required in Article 14 of this Regulation.

Artículo 21 — The temporary connection shall be made if accepted by the Mayor, upon prior payment of the corresponding fees, and the applicable rate shall be the reproductiva rate.

Artículo 22 — The Municipality may suspend the temporary service once the time for which it was requested has concluded, provided there is no request for extension by the interested party that was accepted by the Mayor.

Artículo 23 — The subscriber (abonado) who enjoys a temporary connection shall be obliged to notify the Municipality of the conclusion date of the event or the work.

Artículo 24 — The Municipality is not obligated to grant temporary connections for water service if it is not located facing the distribution network.

Artículo 25 — For the maintenance of the aqueduct, the Municipality shall charge a fee for the service, upon prior study of administration, operation, and maintenance costs.

Artículo 26 — The rates approved by the Municipality shall be charged to users thirty days after their publication in the Diario Oficial La Gaceta, as ordered by Article 74 of the current Código Municipal.

Artículo 27 — The service provided by the Municipality to subscribers (abonados) cannot be free; this applies to any public entity or other, unless a special law determines otherwise.

Artículo 28 — The water service shall be classified into categories, and for each of them, a specific rate shall correspond.

Artículo 29 — The income received from the provision of the water service shall be allocated for the operation, maintenance, improvement, monitoring, and administration of the drinking water supply system, the Municipality thereby being obligated to keep separate accounts of said funds.

Artículo 30 — The Municipality may suspend the service when the subscriber (abonado) does not meet their payment obligations for the service provided.

Artículo 31 — For late payment of the drinking water service, fines and interest shall be charged, in accordance with Article 69 of the Código Municipal.

Artículo 32 — The service charge shall be made monthly, once due.

Artículo 33 — Under no circumstances may subscribers (abonados) reconnect a service that has been suspended themselves.

Artículo 34 — A user who incurs in water waste in gardens, crops, defective pipes, vehicle washing, roofs, and other uses, shall be notified twice in writing, and if they ignore it, the service shall be suspended without further procedure than communication thereof by the administration.

Artículo 35 — The Municipality may order the suspension of the service when the subscriber (abonado):

Artículo 36 — Debts for the payment of drinking water service shall constitute a preferential legal mortgage on the respective property, in accordance with Article 70 of the current Código Municipal.

Artículo 38 — The Municipality is obliged to annually review the rate it charges for the drinking water service.

Artículo 40 — The potable waters of rivers and springs (vertientes), in any part of the national territory where they are found, shall be affected to the service of a drinking water system for the populations, as determined by the Poder Ejecutivo (Article 30 of the Ley de Aguas No.

Artículo 42 — Protection zones (zonas protectoras) are those established in the Ley de Aguas No.

Artículo 43 — Approved unanimously by the Municipal Council of Montes de Oro, in session No.

Artículo 44 — This regulation repeals any previous provision.

Artículo 45 — It shall take effect upon its publication in La Gaceta.

Artículo 2 — Este Reglamento regulará la organización y funcionamiento municipal, en cuanto a la prestación del servicio de agua potable, así como establecer los derechos y deberes tanto de los abonados del sistema como de la Municipalidad.

Artículo 3 — Glosario de términos.

Artículo 4 — La Municipalidad está obligada a prestar el servicio de agua a todos los propietarios de inmuebles o autorizados por estos, dedicados al trabajo, residencia de personas u otros, cuando las redes de distribución pasan frente a la propiedad.

Artículo 5 — La Municipalidad prestará sus servicios en la forma más eficiente que sus recursos y circunstancias lo permitan y tomará las medidas necesarias para asegurar el sostenimiento, desarrollo y ampliación del servicio.

Artículo 6 — La Municipalidad se compromete a dotar a los usuarios de un servicio adecuado en cuanto a cantidad, continuidad y calidad.

Artículo 9 — Es responsabilidad y obligación del abonado mantener en buenas condiciones de funcionamiento los sistemas e instalaciones internas.

Artículo 11 — El usuario deberá hacer uso del servicio, de acuerdo con la categoría con que fue calificado.

Artículo 12 — La Municipalidad concederá el servicio de agua a una propiedad, solamente a gestión de la parte interesada o cualquier persona autorizada por el propietario.

Artículo 15 — El solicitante deberá indicar siempre el uso que va a dar al servicio que solicita, y la municipalidad podrá rechazar esa solicitud cuando técnica o reglamentariamente no sea posible por problemas de escasez de líquido u otros.

Artículo 17 — En ningún caso los usuarios podrán utilizar un servicio (una paja), para dos o más unidades de ocupación.

Artículo 18 — Los usuarios que disfrutan del servicio de agua, podrán solicitar por escrito a la Municipalidad, el cambio en el uso del servicio (diferente categoría), para lo cual el Gobierno local determinará si se justifica la solicitud del usuario.

Artículo 19 — Si el abonado considera que ya no es necesario el servicio de agua, deberá hacer la respectiva solicitud de desconexión del servicio ante la Municipalidad, con todos los datos que se exigen en el artículo 14° de este Reglamento.

Artículo 21 — La conexión temporal se realizará si fuera acogida por el Alcalde, previo pago de las tasas que correspondan y la tarifa aplicable será la reproductiva

Artículo 22 — La Municipalidad podrá suspender el servicio temporal, una vez concluido el tiempo por el que fue solicitado; siempre y cuando no exista una solicitud de prórroga por parte del interesado y que fuera acogida por el Alcalde.

Artículo 23 — El abonado que disfruta de una conexión temporal, estará en la obligación de comunicar a la Municipalidad, la fecha de conclusión del evento o de la obra.

Artículo 24 — La Municipalidad no se encuentra obligada a conceder conexiones temporales de servicio de agua, si la misma no esta ubicada frente a la red de distribución.

Artículo 25 — Para el sostenimiento del acueducto, la Municipalidad cobrará una cuota por el servicio, previo estudio de costos de administración, operación y mantenimiento.

Artículo 26 — Las tarifas aprobadas por la Municipalidad se pondrán al cobro a los usuarios treinta días después de su publicación en el Diario Oficial La Gaceta, conforme lo ordena el artículo 74 del Código Municipal vigente.

Artículo 27 — El servicio que presta la Municipalidad a los abonados no puede ser gratuito; así se trate de cualquier entidad pública u otra; salvo que alguna ley especial determine lo contrario.

Artículo 28 — El servicio de agua se clasificará en categorías y para cada una de ellas corresponderá una tarifa determinada.

Artículo 30 — La Municipalidad podrá suspender el servicio, cuando el abonado no atendiera sus obligaciones de pago por el servicio prestado.

Artículo 31 — Por atraso en el pago del servicio de agua potable, se cobrará multas e intereses, de conformidad con el artículo 69 del Código Municipal.

Artículo 32 — El cobro del servicio se hará en forma mensual, una vez vencido.

Artículo 33 — En ningún caso podrán los abonados reconectarse un servicio que haya sido suspendido.

Artículo 35 — La Municipalidad podrá ordenar la suspensión del servicio cuando el abonado:

Artículo 36 — Las deudas por concepto de pago del servicio de agua potable, constituirán hipoteca legal preferente sobre el respectivo inmueble, de conformidad con el artículo 70 del Código Municipal vigente.

Artículo 38 — La Municipalidad está obligada a revisar anualmente la tarifa que cobra por el servicio de agua potable.

Artículo 42 — Son zonas protectoras las establecidas en a Ley de Aguas Nº 276 del 27 de agosto de 1942 y sus reformas.

Artículo 43 — Aprobado en forma unánime por el Concejo Municipal de Montes de Oro, en sesión Nº 26-06, del 26 de junio del 2006.

Artículo 44 — El presente reglamento deroga cualquier disposición anterior.

Artículo 45 — Rige a partir de su publicación en La Gaceta.
