IT IS AGREED:
Considering:
A. Fishing with gillnets or trammel nets (redes agalleras o trasmallos): during the period from June 1 to July 31 and from October 1 to 31, 2006, the use of gillnets or trammel nets of any mesh size is prohibited in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52" West Longitude, 09º53'31" North Latitude) to the Faro de las Islas Negritos Afuera Lighthouse (84º49'35" West Longitude, 09º49'14" North Latitude) and from that line, inshore to the mouth of the Tempisque River.
B. Fishing with Taiwanese longline (línea taiwanesa): during the period from June 1 to July 31 and from October 1 to 31, 2006, the use of the Taiwanese longline is prohibited in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52" West Longitude, 09º53'31" North Latitude) to the Faro de las Islas Negritos Afuera Lighthouse (84º49'35" West Longitude, 09º49'14" North Latitude) and from that line, inshore to the mouth of the Tempisque River.
C. Fishing with handlines (cuerdas de mano): during the period from June 1 to July 31 and from October 1 to 31, 2006, any permit holder with a Commercial Fishing License for the zone may use handlines with number 6 hooks at any time of day, in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52" West Longitude, 09º53'31" North Latitude) to the Faro de las Islas Negritos Afuera Lighthouse (84º49'35" West Longitude, 09º49'14" North Latitude) and from that line inshore to the mouth of the Tempisque River. Those who choose this alternative must notify the Protection and Registration Department.

D. Fishing with bottom-set longline (línea planera) in the inshore zone of the Gulf of Nicoya: during the period from June 1 to July 31 and from October 1 to 31, 2006, any permit holder with a Commercial Fishing License for the zone may use, at any time of day, one bottom-set longline per vessel with a maximum length of 500 meters and a maximum of 300 number 6 hooks, in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52" West Longitude, 09º53'31" North Latitude) to Punta Cuchillo (84º52'23" West Longitude, 09º49'39" North Latitude) and from that line inshore to the mouth of the Tempisque River. Those who choose this alternative must notify the Protection and Registration Department.

E. Fishing with bottom-set longline (línea planera) in the offshore zone of the Gulf of Nicoya: during the period from June 1 to July 31 and from October 1 to 31, 2006, any permit holder with a Commercial Fishing License for the zone may use one bottom-set longline per vessel with a maximum length of 5000 meters and a maximum of 3000 number 6 hooks, in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52" West Longitude, 09º53'31" North Latitude) to Punta Cuchillo (84º52'23" West Longitude, 09º49'39" North Latitude) and from that line seaward, outside the Gulf of Nicoya. Those who choose this alternative must notify the Protection and Registration Department.

A. Fishing with beach seine net (chinchorro de barrer playa): during the period from June 1 to July 31 and from October 1 to 31, 2006, the capture of bait (sardine and anchovy) with beach seine net on the beach is permitted. Said net must have a mesh size of ¾ of an inch, a maximum length of 20 meters, and a maximum height of 2 meters, and must not have a bag. It shall be the responsibility of INCOPESCA to grant provisional permits for this purpose during the closed season in accordance with the bait requirements in each of the fishing communities.
B. Fishing with lampara net (red bolichera): during the period from June 1 to July 31 and from October 1 to 31, 2006, the capture of bait (sardine and anchovy) with lampara net is permitted. Said net must have a maximum mesh size of ½ inch, a maximum length of 40 meters, a maximum height of 8 meters, with or without a bag. It shall be the responsibility of INCOPESCA to grant provisional permits for this purpose during the closed season, in accordance with the bait requirements in each of the fishing communities.
C. Fishing for tuna for bait: during the period from June 1 to July 31 and from October 1 to 31, 2006, the capture of tuna for bait with floating gillnets or trammel nets (redes agalleras o trasmallos a flote) is permitted. One floating gillnet or trammel net per vessel is permitted on Mondays, Tuesdays, and Wednesdays of each week from 4:00 p.m. to 6:00 a.m. (for this reason, the fishing operation must begin at 4:00 p.m. on Monday and end at 6:00 a.m. on Thursday of each week). It shall be the responsibility of INCOPESCA to grant, at the request of the permit holders, provisional permits for this purpose during the closed season, in accordance with the bait requirements in each of the fishing communities.

Said net must have a minimum mesh size of 3 1/2 inches, a maximum length of 500 meters, and a maximum height of 150 meshes, and must be equipped with buoys, gallon containers, or any other device that allows the competent authorities to identify it.

The area authorized for the use of this type of fishing is established as the area between the imaginary straight line running from the Puntarenas Cruise Ship Pier (84º49'51" West Longitude, 9º58'26" North Latitude) to the easternmost part of Isla de Cedros (84º51'59" West Longitude, 9º51'00" North Latitude) and from those two imaginary lines seaward, outside the Gulf of Nicoya.
Those permit holders who engage in this type of fishing shall make their vessels available so that INCOPESCA officials may obtain, on board these vessels, information on their catches and the characteristics of the fishing gear used.
They shall also be obliged to report the place, time, and date of each of their landings to the Protection and Registration Department, so that officials from the Research and Development Department or that same Unit may inspect said landings in situ.
Those permit holders who engage in this type of fishing shall make their vessels available so that INCOPESCA officials may obtain, on board these vessels, information on their catches.
They shall also be obliged to report the place, time, and date of each of their landings to the Protection and Registration Department, so that officials from the Research and Development Department or that same Unit may inspect said landings in situ.
During the remaining 4 days of the week of this closed season, this fleet may fish seaward of the imaginary straight line from Punta Torres, known as Peñón (84º43'52" West Longitude, 09º53'31" North Latitude) to the Faro de las Islas Negritos Afuera Lighthouse (84º49'35" West Longitude, 09º49'14" North Latitude).
The General Technical Directorate must take the pertinent actions so that, within a period not exceeding 30 calendar days from the effective date of this regulation, it submits to the pertinent administrative authorities of IMAS the list of fishers subject to the restrictions and conditions of the closed season for the Gulf of Nicoya, so that they are granted the corresponding economic subsidy.

8436, for all those permit holders whom the competent authorities find violating the provisions established in this agreement during the present closed season, INCOPESCA, through each of its competent offices, shall immediately suspend, from the time the infraction is committed through the remaining period(s) of the closed season, the provision of fuel at the preferential price, and both the permit holders and their helpers shall be automatically excluded from the lists sent to the Joint Institute for Social Aid (Instituto Mixto de Ayuda Social, IMAS) as potential beneficiaries of the economic assistance that that Institution grants during the closed seasons established in the Gulf of Nicoya.

SE ACUERDA:
Considerando:
A. Pesca con redes agalleras o trasmallos: durante el período comprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de octubre del 2006, se prohíbe la utilización de redes agalleras o trasmallos de cualquier luz de malla, en el área comprendida entre una línea recta imaginaria que va desde Punta Torres, conocida como Peñón (84º43'52" Longitud Oeste, 09º53'31" Latitud Norte) hasta el Faro de las Islas Negritos Afuera (84º49'35" Longitud Oeste, 09º49'14" Latitud Norte) y de esa línea, aguas adentro hasta la desembocadura del Río Tempisque.
B. Pesca con línea taiwanesa: durante el período comprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de octubre del 2006, se prohíbe la utilización de la línea taiwanesa, en el área comprendida entre una línea recta imaginaria que va desde Punta Torres, conocida como Peñón (84º43'52" Longitud Oeste, 09º53'31" Latitud Norte) hasta el Faro de las Islas Negritos Afuera (84º49'35" Longitud Oeste, 09º49'14" Latitud Norte) y de esa línea, aguas adentro hasta la desembocadura del Río Tempisque.

Quienes opten por esta alternativa deberán comunicarlo al Departamento de Protección y Registro (Así reformado el inciso anterior mediante acuerdo AJDIP/260 del 02 de junio del 2006).

Pesca con línea planera en la zona aguas adentro del Golfo de Nicoya: durante el período comprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de octubre del 2006, todo aquel permisionario con Licencia de Pesca Comercial para la zona podrá utilizar a cualquier hora del día una línea planera para embarcación con un máximo de 500 metros de largo y también un máximo de 300 anzuelos Nº 6, en el área comprendida entre una línea recta imaginaria que va desde Punta Torres, conocida como Peñón (84º43'52" Longitud Oeste, 09º53'31" Latitud Norte) hasta Punta Cuchillo (84º52'23" Longitud Oeste, 09º49'39" Latitud Norte) y de esa línea aguas adentro hasta la desembocadura del Río Tempisque.Quienes opten por esta alternativa deberán comunicarlo al Departamento de Protección y Registro (Así reformado el inciso anterior mediante acuerdo AJDIP/260 del 02 de junio del 2006).
E. Pesca con línea planera en la zona aguas afuera del Golfo de Nicoya: durante el período comprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de octubre del 2006, todo aquel permisionario con Licencia de Pesca Comercial para la zona podrá utilizar una línea planera por embarcación con un máximo de 5000 metros de largo y un máximo de 3000 anzuelos Nº 6, en el área comprendida entre una línea recta imaginaria que va desde Punta Torres, conocida como Peñón (84º43'52" Longitud Oeste, 09º53'31" Latitud Norte) hasta Punta Cuchillo (84º52'23" Longitud Oeste, 09º49'39" Latitud Norte) y de esa línea aguas hacia afuera del Golfo de Nicoya.Quienes opten por esta alternativa deberán comunicarlo al Departamento de Protección y Registro (Así reformado el inciso anterior mediante acuerdo AJDIP/260 del 02 de junio del 2006).

Pesca con chinchorro de barrer playa: durante el período comprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de octubre del 2006, se permitirá la captura de carnada (sardina y anchoveta) con chinchorro de barrer en playa. Dicha red deberá tener una luz de malla de ¾ de pulgada, una longitud máxima de 20 metros y una altura máxima de 2 metros y no deberá de tener bolsa. Corresponderá al INCOPESCA el otorgamiento de permisos provisionales para este efecto durante la veda de conformidad con los requerimientos de carnada en cada una de las comunidades pesqueras.
B. Pesca con red bolichera: durante el período comprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de octubre del 2006, se permitirá la captura de carnada (sardina y anchoveta) con red bolichera. Dicha red deberá tener una luz de malla máxima de ½ pulgada, una longitud máxima de 40 metros, una altura máxima de 8 metros, con o sin bolsa. Corresponderá al INCOPESCA el otorgamiento de permisos provisionales para este efecto durante la veda, de conformidad con los requerimientos de carnada en cada una de las comunidades pesqueras.
C. De la pesca de atún para carnada: durante el período comprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de octubre del 2006, se permitirá la captura de atún para carnada con redes agalleras o trasmallos a flote. Se permitirá una red agallera o trasmallo a flote por embarcación durante los días lunes, martes y miércoles de cada semana en el horario de las 16:00 horas a las 6:00 horas (por tal razón la faena de pesca deberá iniciar a partir de las 16:00 horas del día lunes y finalizar a las 6:00 horas del día jueves de cada semana). Corresponderá al INCOPESCA el otorgamiento a solicitud de parte de los permisionarios, paralos permisos provisionales para este efecto durante la veda, de conformidad con los requerimientos de carnada en cada una de las comunidades pesqueras.
(Así reformado el inciso anterior mediante acuerdo AJDIP/260 del 02 de junio del 2006).
Dicha red deberá tener una luz de malla mínima de 31/2 pulgadas, una longitud máxima de 500 metros y una altura máxima de 150 mallas y deberá estar provista de boyas, galones o cualquier otro dispositivo que permita a las autoridades competentes su identificación.

Se establece como zona autorizada para el uso de este tipo de pesca el área comprendida entre la línea recta imaginaria que va desde el Muelle de Cruceros de Puntarenas (84º49'51" Longitud Oeste, 9º58'26" Latitud Norte) hasta la parte más Oriental de la Isla de Cedros (84º51'59" Longitud Oeste, 9º51'00" Latitud Norte) y de esas dos líneas imaginarias aguas hacia afuera del Golfo de Nicoya.
Aquellos permisionarios que se dediquen a este tipo de pesca facilitarán sus embarcaciones para que funcionarios del INCOPESCA, puedan obtener a bordo de estas, información de sus capturas y de las características del arte de pesca utilizada.
Asimismo estarán obligados a informar el lugar, hora y fecha de cada uno de sus desembarques ante el Departamento de Protección y Registro, para que funcionarios del Departamento de Investigación y Desarrollo o de esa misma Dependencia fiscalicen in situ dichos desembarques.
Aquellos permisionarios que se dediquen a este tipo de pesca facilitarán sus embarcaciones para que funcionarios del INCOPESCA, puedan obtener a bordo de estas información de sus capturas.
Asimismo estarán obligados a informar el lugar, hora y fecha de cada uno de sus desembarques ante el Departamento de Protección y Registro, para que funcionarios del Departamento de Investigación y Desarrollo o de esa misma Dependencia fiscalicen in situ dichos desembarques.
Durante los 4 días restantes de la semana de esta veda, esta flota podrá pescar aguas afuera de la línea recta imaginaria comprendida desde Punta Torres, conocida como Peñón (84º43'52" Longitud Oeste, 09º53'31" Latitud Norte) hasta el Faro de las Islas Negritos Afuera (84º49'35" Longitud Oeste, 09º49'14" Latitud Norte).
La Dirección General Técnica deberá realizar las acciones pertinentes a fin de que en un plazo no mayor a 30 días naturales contados a partir de la vigencia de esta regulación, presente ante las instancias administrativas y competentes del IMAS, el listado de pescadores sujeto a las restricciones y condiciones de veda para el Golfo de Nicoya, a fin de que se les otorgue el subsidio económico correspondiente.
