1. 1That through Board of Directors Agreement AJDIP-225-2006, it approved the corresponding closed season periods for the current year 2006.
2. 2That said agreement establishes the conditions and regulations under which the application of the various fisheries will be governed during the closed season periods.
3. 3That the Board of Directors considers it pertinent and necessary to make reforms to subsections C, D, and E of Article 3, to subsection C of Article 4, and to Article 7, of the text approved through the supra agreement. Therefore,

THE BOARD OF DIRECTORS OF INCOPESCA, AGREES:

1º-To modify subsections C, D, and E of Article 3, and subsection C of Article 4 of the Closed Season Agreement No. AJDIP-225-2006, as follows:

Add:

• I)In subsections C, D, and E, after the phrase Commercial Fishing License, the phrase must be added: for the zone.
• II)In subsections C and D after Tempisque River, and subsection E, after Golfo de Nicoya, must be added "Those who opt for this alternative must notify the Department of Protection and Registration." III) In subsection C of Article 4, it must be added in the first paragraph after where it says each week). "It shall be the responsibility of INCOPESCA to grant, at the request of the permit holders, the provisional permits for this purpose during the closed season, in accordance with the bait requirements in each of the fishing communities.", Correct instead of 100 meshes, read 150 meshes. The rest remains the same.

Delete:

• I)In subsections C, D, and E, after the word "for the zone", the phrase "Current and regardless of the type of fishing and the fishing gear authorized therein".
• II)Delete the second paragraph of the text of Article 7, where it says ". Based on what is established in Law 8436, only those fishermen who are affected by the closed season shall enjoy that benefit, provided that it is proven that they have no other source of income. Those persons who carry out fishing activities according to the conditions permitted and authorized through this regulation, shall not be beneficiaries of the pertinent economic subsidy from IMAS, however, they may manage the granting of fuel at a preferential price." 2º-Notify the Executive Presidency so that it may issue the corresponding instructions.

3º-Firm agreement. Publish in the Official Gazette.

Considering:

1. 1Que mediante Acuerdo de Junta Directiva AJDIP-225-2006 aprobó los correspondientes periodos de veda para el presente año 2006.
2. 2Que dicho acuerdo establece las condiciones y regulaciones bajo las cuales regirá la aplicación de las diversas pesquerías durante los periodos en veda.
3. 3Que la Junta Directiva considera pertinente y necesario realizar reformas a los incisos C, D y E del artículo 3. Al inciso C del artículo 4 y al artículo 7, de texto aprobado por medio del acuerdo supra. Por tanto,

LA JUNTA DIRECTIVA DEL INCOPESCA, ACUERDA:

1º-Modificar los incisos C, D y E del artículo 3 e inciso C del artículo 4 del Acuerdo de Veda N° AJDIP-225-2006, de la siguiente manera:

Agregar:

• I)En los incisos C, D y E, después de la frase Licencia de Pesca Comercial, se debe agregar la frase: para la zona.
• II)En los incisos C y D después de río Tempisque, e inciso E, después de golfo de Nicoya, debe agregarse "Quienes opten por esta alternativa deberán comunicarlo al Departamento de Protección y Registro." III) En el inciso C del artículo 4, se debe agregar en el primer párrafo después de donde dice cada semana). "Corresponderá al INCOPESCA el otorgamiento a solicitud de parte de los permisionarios, paralos permisos provisionales para este efecto durante la veda, de conformidad con los requerimientos de carnada en cada una de las comunidades pesqueras.", Corregir en lugar de 100 mallas léase 150 mallas. El resto se mantiene igual.

Eliminar:

• I)En los incisos C, D y E, después de la palabra "para la zona", la frase "Vigente e independientemente del tipo de pesca y las artes de pesca autorizadas en la misma".
• II)Eliminar el segundo párrafo del texto del artículo 7, donde dice ". Con sustento en lo establecido en la Ley 8436 únicamente gozarán de ese beneficio aquellos pescadores que se vean afectados por la veda, siempre y cuando se compruebe que no tienen otra fuente de ingresos. Aquellas personas que realicen actividades de pesca de acuerdo a las condiciones permitidas y autorizadas a través de esta regulación, no serán beneficiarias del subsidio económico pertinente por parte del IMAS, sin embargo, podrán gestionar el otorgamiento de combustible a precio preferencial." 2º-Comuníquese a la Presidencia Ejecutiva para que gire las instrucciones correspondientes.

3º-Acuerdo firme. Publíquese en el Diario Oficial.
