1That it is in the interest of the Government to strengthen and consolidate administrative structures in the field of natural resources, in order to have defined policies that guarantee the rational use of said resources.
2That the Bosque Diriá National Wildlife Refuge was established as a protected wilderness area through Executive Decrees No. 20517-MIRENEM of June 5, 1991 and 21221-MIRENEM of March 3, 1992.
3That territorially, it is the largest continental protected wilderness area in the Tempisque Conservation Area and a site of great strategic importance in the formation of the Chorotega Biological Corridor.
4That technical studies (Merayo, 1999) have determined that it is of utmost importance to protect the upper basins of the Diriá, Enmedio, Tigre, and Verde rivers, located within the lands of this protected area, in order to guarantee the long-term supply of water resources for the province of Guanacaste, mainly for the canton of Santa Cruz.
5That this area constitutes a very important nucleus for the conservation of the natural resources of the Nicoya Peninsula, as reflected in the rapid ecological assessment carried out by Villarreal (2003) with resources from the INBio-SINAC Agreement.
6That there is a little-studied potential archaeological value concerning the indigenous settlements that were part of the dominions of Chief Diriá.
7That in addition to the above, the Bosque Diriá safeguards resources of great scenic value and sites suitable for the healthy enjoyment of its beauties, as has traditionally occurred since before its creation as a protected wilderness area.
8That the area comprised within its boundaries, as well as the lands that are intended to be added through this decree, constitute areas of vital importance for the protection of the existing aquifer mantles in the region and form a large hydrographic basin, with which it is intended to unify the area of the La Casona and San Juan sectors.
9That 90% of the properties that make up the wilderness area are currently Natural Heritage of the State and only 10% remains to be purchased to consolidate the area considered a priority.

10.-That since its creation as a wilderness area and mainly in recent years, the community of Santa Cruz through different instances such as the Municipality, the State Distance University, the Rural Guard, the Diriá Biological Corridor Commission, ACOBIGUA, the fire brigade groups, and others have carried out joint work in favor of the consolidation and conservation of Diriá.

THEY DECREE:

Considering:

23126-MIRENEM published in La Gaceta No. 79 of April 26, 1994, so that the management category of the Bosque Diriá National Wildlife Refuge is changed to that of the Diriá National Park, demarcated on the cartographic sheets of the National Geographic Institute, scale 1:50,000 Diriá and Cerro Brujo. The boundaries of the Diriá National Park shall be:

7788 of April 30, 1998, the Local Council of the Diriá National Park is created, which shall be composed of:

i. The Director of the Tempisque Conservation Area or the person he/she designates, ii. The Municipal Mayor of Santa Cruz or his/her representative, iii. The Municipal Mayor of Nicoya or his/her representative, iv. The Municipal Mayor of Carrillo or his/her representative, v. The Regional Administrator of the IDA in Santa Cruz, vi. The Head of the Agricultural Services Agency of the MAG in Santa Cruz, vii. The Administrator of the UNED University Center in Santa Cruz or his/her representative, viii. A representative of the environmentalist organizations of Santa Cruz, ix. A representative of the business sector.

7788 of April 30, 1998, shall promote the participation of local non-governmental organizations in the administration of non-essential services of this protected area, as well as for joint management and cooperation in the search for resources for its strengthening.

7554, shall be included within the Diriá National Park only from the moment payment or expropriation has been legally carried out, except when they voluntarily submit to the forest regime. The Executive Branch is empowered to carry out the of the Expropriations Law No. 7495 of May 3, 1995.

1Que es de interés del Gobierno fortalecer y consolidar las estructuras administrativas en el campo de los recursos naturales, a fin de contar con políticas definidas que garanticen el uso racional de dichos recursos.
2Que el Refugio Nacional de Vida Silvestre Bosque Diriá, se estableció como área silvestre protegida, mediante los decretos ejecutivos Nº 20517-MIRENEM del 5 de junio de 1991 y 21221-MIRENEM del 3 de marzo de 1992.
3Que territorialmente es el área silvestre protegida continental de mayor extensión del Área de Conservación Tempisque y sitio de gran importancia estratégica en la conformación del Corredor Biológico Chorotega.
4Que estudios técnicos (Merayo, 1999) han determinado que es de suma importancia proteger las cuencas altas de los ríos Diriá, Enmedio, Tigre y Verde, ubicadas dentro de los terrenos de esta área protegida, a fin de garantizar a largo plazo el suministro de recursos hídricos para la provincia de Guanacaste, principalmente para el cantón de Santa Cruz.
5Que dicha área constituye un núcleo muy importante para la conservación de los recursos naturales de la península de Nicoya, tal como lo refleja la evaluación ecológica rápida realizada por Villarreal (2003) con recursos del Convenio INBio-SINAC.
6Que existe un potencial valor arqueológico poco estudiado, acerca de los asentamientos indígenas que fueron parte de los dominios del Cacique Diriá.
7Que además de lo anterior, el Bosque Diriá resguarda recursos de gran valor escénico y sitios aptos para el disfrute sano de sus bellezas, como tradicionalmente ha ocurrido desde antes de su creación como área silvestre protegida.
8Que el área comprendida dentro de sus límites, así como los terrenos que mediante este decreto se piensan agregar, constituyen áreas de vital importancia para la protección de los mantos acuíferos existentes en la región y conforman una gran cuenta hidrográfica, con lo cual se pretende unificar el área de los sectores de La Casona y el de San Juan.
9Que el 90% de las fincas que conforman el área silvestre son en la actualidad Patrimonio Natural del Estado y solo resta comprar un 10% para consolidar el área considerada prioritaria.

10.-Que desde su creación como área silvestre y principalmente en los últimos años, la comunidad de Santa Cruz a través de diferentes instancias como la Municipalidad, la Universidad Estatal a Distancia, la Guardia Rural, la Comisión de Corredor Biológico Diriá, ACOBIGUA, los grupos de brigadas contra incendios y otras han realizado un trabajo conjunto en pro de la consolidación y conservación del Diriá.

Considerando:

DECRETAN:

Partiendo de un punto ubicado en el camino público entre las comunidades de San Juan y Cola de Gallo, con coordenadas 242375 Norte y 367010 Este, del sistema de coordenadas Lambert Costa Rica Norte. A partir de este punto, se sigue, en primera instancia hacia el este, por una serie de puntos con las siguientes coordenadas:

Se parte de un punto ubicado en el camino público entre las comunidades de San Juan y Cola de Gallo, con coordenadas 242690 Norte y 366585 Este, del sistema de coordenadas Lambert Costa Rica Norte. A partir de este punto, se sigue, en primera instancia hacia el este, por una serie de puntos con las siguientes coordenadas:

242775 N 367010 E 242695 N 367065 E (en este punto se cruza una quebrada sin nombre) 242375 N 367450 E 242055 N 367760 E (se cruza el río Tigre) 241970 N 367835 E 242015 N 367935 E 242015 N 368010 E 242060 N 368060 E 242060 N 368125 E 242255 N 368800 E 242085 N 368825 E 241965 N 368875 E 241740 N 368860 E 239055 N 358000 E Este último punto se localiza en una quebrada sin nombre afluente del río Agua. Luego se pasa al punto con coordenadas 238125 N y 357045 E; el cual se encuentra en la quebrada El Salto, afluente del río Agua. A partir de este punto, se sigue aguas abajo por esta quebrada y luego por el río Agua cuando confluyen, hasta el punto con coordenadas 240190 N y 355950 E. A partir de este punto se sigue hacia el este, por una serie de puntos indicados a continuación:

Luego el límite sigue hasta el punto 241105 N y 361135 E; luego al punto 241060 N y 361125 E, que se encuentra en el camino público entre Arado y Cabeceras. A partir de ese punto se sigue por este camino hasta el punto con coordenadas 239985 N y 361185 E. Luego se sigue al punto con coordenadas 240020 N y 361320 E, que se encuentra en el río Enmedio; por este río se sigue aguas abajo hasta el punto 240145 N 361400 E. A partir de este punto, el límite sigue por una serie de puntos que se indican a continuación:

El Poder Ejecutivo queda facultado para realizar las en la Ley de Expropiaciones Nº 7495 del 3 de mayo de 1995.

Artículo 1 — Amend Executive Decree No.

Artículo 2 — In order to biologically and geographically consolidate the Diriá National Park, according to this route, the total area shall be 5,426 ha.

Artículo 3 — The administration and protection of the Diriá National Park shall correspond to the Ministry of Environment and Energy, through the National System of Conservation Areas and more specifically to the Tempisque Conservation Area.

Artículo 4 — Based on Article 29 of the Biodiversity Law No.

Artículo 5 — The Tempisque Conservation Area, in order to comply with the stipulations of Articles 38 and 39 of the Biodiversity Law No.

Artículo 7 — The privately owned properties affected, according to the provisions of Article 37 of the Organic Law of the Environment No.

Artículo 8 — Decrees No.

Artículo 9 — It shall become effective upon its publication.

Artículo 2 — Con el fin de consolidar biológica y geográficamente el Parque Nacional Diriá, de acuerdo con este derrotero el área total será de 5 426 ha.

Artículo 3 — La administración y protección del Parque Nacional Diriá le corresponderá al Ministerio del Ambiente y Energía, a través del Sistema Nacional de Áreas de Conservación y más concretamente al Área de Conservación Tempisque.

Artículo 4 — Con fundamento en el artículo 29 de la Ley de Biodiversidad Nº 7788 del 30 de abril de 1998, crease el Consejo Local del Parque Nacional Diriá, el cual estará conformado por:

Artículo 8 — Deróguense los Decretos Nº 20517-MIRENEM del 5 de junio de 1991, Nº 21221-MIRENEM del 3 de marzo de 1992, Nº 22731-MIRENEM del 19 de noviembre de 1993, Nº 22821-MIRENEM del 6 de enero de 1994, Nº 23126MIRENEM del 7 de abril de 1994, y Nº 24311-MIRENEM del 8 de mayo de 1995.

Artículo 9 — Rige a partir de su publicación.
