in the entirety of the text - Full Text of Regulation 417 Temporary regulations for the performance of communal work service by fishers and helpers receiving subsidies during closed-season periods Full Text acta: 116AC6 INSTITUTO COSTARRICENSE DE PESCA Y ACUACULTURA INSTITUTO COSTARRICENSE DE PESCA Y ACUACULTURA (This regulation was repealed by article 14 of agreement N° AJDIP/166-2017 of April 21, 2017, "Regulation for the fulfillment of communal work service by fishers registered during closed season") AJDIP/417.-Puntarenas, on the eighteenth day of August, two thousand five.
Therefore, it is agreed to issue the following:
Temporary regulations for the performance of communal work service by fishers and helpers receiving subsidies during Closed-Season Periods
Considering:
Within a reasonable period prior to the start of the established closed-season periods, the Organizations and different beneficiary entities must submit for review by INCOPESCA and IMAS their STC proposals and activities in each of the fishing communities.
For the presentation of their proposals as well as for the control, registration, and individual reporting of the different activities and weighted hours completed by each fisher, the forms established for these purposes must be used.
Once the competent authorities of INCOPESCA and/or IMAS have analyzed the different proposals submitted, they shall promptly notify the Organizations and different beneficiary entities of the respective authorization so that STC activities can begin in each fishing community; these shall be supervised at any time jointly and in a coordinated manner by the competent authorities of INCOPESCA and IMAS, according to the availability of human and budgetary resources in each of those institutions.
Given the administrative timelines required by the competent authorities of INCOPESCA and IMAS for carrying out the supervision and control processes regarding compliance with the STC by fishers, as well as the processing of procedures for the formulation, issuance, and delivery of the economic aid granted by IMAS, STC activities may begin 7 calendar days before the start of the closed-season periods.
Once a fisher has completed the activities and the total weighted hours per month for a specific calendar month, those other activities and weighted hours that are performed shall be allowed to be recognized and counted as valid for the subsequent calendar month, provided they also began 7 calendar days before the start of the corresponding calendar month.
According to their competencies, the authorities of INCOPESCA and/or IMAS may establish mandatory participation activities for fishers, especially those aimed at training.

For the purposes of fulfilling the Communal Work Service by the beneficiaries of the temporary aid from IMAS, during the closed-season periods, duly documented, accredited, and justified cases of permit holders and beneficiaries who, during the closed-season periods, are or have been unable to perform the work, and who submit said documentation to the Department of Extension and Training (Departamento de Extensión y Capacitación) of INCOPESCA, shall be considered as exceptions for exempting them from this requirement.

The obligation defined above does not release the beneficiary fishers and helpers, nor exempt them from their responsibility to inform themselves, at the Department of Extension and Training (Departamento de Extensión y Capacitación) and the Regional Offices of INCOPESCA, of the fulfillment and the manner of execution of their STC.
In cases involving training (courses, workshops, etc.), only those given by a public entity shall be permitted, but prior to their execution, they must be evaluated and have the approval of the Department of Extension and Training (Departamento de Extensión y Capacitación).
In supervisions carried out by Incopesca or by IMAS when the fisher is not present during the hours they previously scheduled for fulfilling their Communal Work Service, it shall be interpreted as an absence unless the interested party presents a justification that complies with the provisions established in the first paragraph.
Any other type of justification different from those indicated above must be analyzed by the STC Evaluation Commission (Comisión de Valoración del STC), which in turn shall have the authority to order the interested party to complete the unfulfilled hours.
Said STC Evaluation Commission (Comisión de Valoración del STC) shall be composed of three officials from INCOPESCA appointed by the Executive Presidency and two officials from IMAS appointed by the Authorities of that Entity.

Por tanto, se acuerda emitir las siguientes:
Regulaciones temporales para la realización de servicios de trabajo comunal por parte de los pescadores y ayudantes beneficiares de subsidios durante los Periodos de Veda
Considerando:
Dentro de un plazo prudencial previo al inicio de los períodos de vedas establecidos, las Organizaciones y diferentes entes beneficiarios, deberán presentar para conocimiento del INCOPESCA y del IMAS, sus propuestas y actividades de STC en cada una de las comunidades pesqueras.
Tanto para la presentación de sus propuestas como para el control, registro y reporte individual de las diferentes actividades y horas ponderadas realizadas por cada pescador, deberán de utilizarse los formularios establecidos para esos efectos.
Una vez que las autoridades competentes del INCOPESCA y/o el IMAS, hayan analizado las diferentes propuestas presentadas, comunicarán de manera oportuna a las Organizaciones y diferentes entes beneficiarios, la respectiva autorización para que puedan iniciarse las actividades del STC en cada comunidad pesquera, las cuales serán supervisadas en cualquier momento de forma conjunta y coordinada, por las autoridades competentes del INCOPESCA y el IMAS, conforme a la disponibilidad de recurso humano y presupuestario en cada una de esas instituciones.
Dados los plazos administrativos requeridos por las autoridades competentes del INCOPESCA y el IMAS para realizar los procesos de supervisión y control sobre el cumplimiento del STC por parte de los pescadores, así como la realización de los trámites para la formulación, emisión y entrega de las ayudas económicas otorgadas por el IMAS, será permitido que las actividades del STC puedan iniciarse 7 días calendario antes del inicio de los períodos de veda.
Cumplidas las actividades y el total de horas ponderadas por mes por parte del pescador para un determinado mes calendario, se permitirá reconocer y sumar como válidas para el mes calendario posterior, aquellas otras actividades y horas ponderadas que se realicen, siempre y cuando hayan dado inicio también 7 días calendario antes del inicio del mes calendario correspondiente.
Conforme a sus competencias las autoridades del INCOPESCA y/o el IMAS, podrán establecer actividades de participación obligatoria para los pescadores, especialmente aquellas orientadas a la capacitación.

A los efectos del cumplimiento del Servicio de Trabajo Comunal, por parte de los beneficiarios de la ayuda temporal del IMAS, durante los períodos de veda, se consideraran como casos de excepción a los efectos de eximir de dicho requisito, aquellos casos debidamente documentados, acreditados y justificados los permisionarios y beneficiarios que durante los períodos de veda se encuentren o hayan estado incapacitado para realizar las labores, y presenten dicha documentación al Departamento de Extensión y Capacitación del INCOPESCA.

La obligatoriedad definida anteriormente no libera a los pescadores y a los ayudantes beneficiarios, ni les exime de su responsabilidad de informarse ante el Departamento de Extensión y Capacitación y las Oficinas Regionales del INCOPESCA, del cumplimiento y de la forma de realización de su STC.
En aquellos casos que se trate de capacitaciones (cursos, talleres, etcétera), únicamente serán permitidas las que sean impartidas por una entidad pública, pero previo a su realización deberá ser valorada y contar con el visto bueno del Departamento de Extensión y Capacitación.
En las supervisiones realizadas por el Incopesca o por el IMAS cuando el pescador no se encuentre en las horas que previamente programó para el cumplimiento de su Servicio de Trabajo Comunal, se interpretará como ausente salvo que el interesado presente una justificación que cumpla con las disposiciones establecidas en el párrafo primero.
Cualquier otro tipo de justificación diferente a las indicadas anteriormente, deberá ser analizada por la Comisión de Valoración del STC, misma que a su vez tendrá la facultad de ordenarle al interesado la realización de las horas no cumplidas.
Dicha Comisión de Valoración del STC, estará integrada por tres funcionarios del INCOPESCA nombrados por la Presidencia Ejecutiva y dos funcionarios del IMAS nombrados por las Autoridades de esa Entidad.
