in the entirety of the text - Complete Text of Regulation 32511 Declares the condition of fishers and their assistants accredited by the Costa Rican Institute of Fisheries and Aquaculture affected by the closed season to be in a situation of temporary poverty Complete Text of record: 916CA No. 32511 No. 32511 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF LABOR AND SOCIAL SECURITY Exercising the powers conferred by articles 140, subsections 3), 8), and 18) of the Political Constitution and 25, 26, and 27 of the General Law of Public Administration.

1That in accordance with the provisions of article 2, subsections e), f), and g) of the Organic Law of the Ministry of Labor and Social Security, No. 1860 of April 21, 1955, and its amendments, it is the function of said Ministry to ensure that national policy in the field of social welfare has adequate regulation guaranteeing effective assistance to Costa Ricans, their families, and the community.
2That in accordance with Law No. 8436, published in the Official Gazette La Gaceta No. 78 of April 25, 2005, it is the responsibility of the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA) to protect and conserve hydrobiological resources, in order to guarantee living marine resources for future generations, promoting a sustainable exploitation of resources through the establishment of closed season periods and areas, for which agreement No. AJDIP / 274-2005, published in the Official Gazette La Gaceta of May 26, 2005, is issued.
3That in the cited agreement and based on article 34 of Law 8436, INCOPESCA prohibits artisanal fishers in the province of Puntarenas and in the communities of the Gulf of Nicoya, Guanacaste, from carrying out fishing operations during the periods from June 1 to July 31 and from October 1 to 31 of the year 2005.
4That the cited agreement prevents fishers who use "trasmallo" from performing their remunerated activity and therefore from earning income from this source, affecting the satisfaction of their basic needs.
5That the Law Creating the Joint Institute of Social Aid (Instituto Mixto de Ayuda Social) No. 4760 of May 4, 1971, establishes in its article 2 the purpose of solving the problem of extreme poverty in the country, and in its article 4, subsection e), establishes among its purposes "to attend to the needs of social groups or persons who must be provided with means of subsistence when they lack them."
6That article 4 of the Regulation for the Provision of Services and the Granting of Benefits of the Joint Institute of Social Aid (Instituto Mixto de Ayuda Social), published in La Gaceta No. 102 of May 29, 2000, defines the concept of poverty as: "A complex phenomenon or situation of a temporary or structural nature, multifaceted and heterogeneous, which affects people and is characterized by their precarious housing and sanitary conditions, low educational levels, unstable insertion in the productive system, conditions of social risk, with little or no incorporation into mechanisms of social participation, insufficient resources to satisfy basic needs (nutritional, health, education, and housing), and in some cases absence or insufficiency of skills, aptitudes, tools, and opportunities to generate and accumulate income."
7That in article 21, subsection h) of the cited Regulation, the following is indicated regarding the subjects of institutional services: "In duly documented exceptional cases and with the corresponding technical social report authorized by the respective Regional Management, benefits may be granted to persons or families presenting a situation of temporary poverty (pobreza coyuntural) not necessarily registered as such in the SIPO (Information System of the Target Population), or who, through a specific decree or law, are considered beneficiaries of institutional action."
8That there is no compensatory fund to provide an economic subsidy to fishers affected by the closed season (veda), and this circumstance causes a situation of temporary poverty (pobreza coyuntural), due to the lack of income of fishers during the closed season (veda).
9That article 36 of Law No. 8436 provides: "...The Executive Branch may authorize the allocation of funds from the National Budget in favor of INCOPESCA for conducting studies on closed seasons, and in favor of the Joint Institute of Social Aid (Instituto Mixto de Ayuda Social, IMAS), for the purpose of developing socioeconomic assistance programs specially designed for this purpose, in favor of fishers who are affected during closed season periods, provided it is proven that they have no other sources of income and are in a condition of poverty. These programs will necessarily involve community work services by the beneficiaries, in accordance with the corresponding regulation or for conducting studies on the matter."

THEY DECREE:

Considering:

JDIP-274-2005 of the INCOPESCA Board of Directors, and who lack other complementary income, is hereby declared to be in a situation of temporary poverty (pobreza coyuntural). Consequently, the Joint Institute of Social Aid (Instituto Mixto de Ayuda Social) is authorized to grant economic benefits in the form of subsidies to these persons, in compliance with the conditions established in this decree.

IMAS shall attend to these persons based on a duly reasoned resolution approved by the Regional Manager determining compliance with the requirements established in this decree, in conformity with the refined list that INCOPESCA must present to it, which shall contain the following requirements:

a)Full name of the beneficiary.
b)Identification card number.
c)Exact address of the beneficiaries.
d)Photocopy of the valid fishing license issued by INCOPESCA.

IMAS professionals shall be empowered to request from potential beneficiaries the requirements established in article 2 of this decree and shall not require that they be registered in the Information System of the Target Population (SIPO). To make effective the delivery of the economic amount corresponding to the second closed season period, IMAS may request INCOPESCA and/or the beneficiaries to verify and update the information provided based on this decree.

In these cases, the immediate revocation of the authorized benefit shall proceed, and concomitantly, the participation of these beneficiaries in future benefits they might receive from IMAS on this account shall be affected.

1Que de conformidad con lo dispuesto en el artículo 2º incisos e), f) y g) de la Ley Orgánica del Ministerio de Trabajo y Seguridad Social, N° 1860 del 21 de abril de 1955 y sus reformas, es función de dicho Ministerio velar porque la política nacional en el campo del bienestar social, cuente con una reglamentación adecuada que garantice una asistencia efectiva a los costarricenses, sus familias y la comunidad.
2Que de conformidad con la Ley N° 8436, publicada en el Diario Oficial La Gaceta N° 78 del 25 de abril de 2005, es atribución del Instituto Costarricense de Pesca y Acuicultura (INCOPESCA) proteger y conservar los recursos hidrobiológicos, en aras de garantizar a las generaciones venideras, los recursos vivos del mar, promoviendo una explotación sostenible de los recursos mediante el establecimiento de periodos y áreas de veda, para lo cual se emite el acuerdo N° AJDIP / 274-2005, publicado en el Diario Oficial La Gaceta del 26 de mayo de 2005.
3Que en el acuerdo citado y con base en el artículo 34 de la Ley 8436, INCOPESCA prohíbe faenar a los pescadores artesanales en la provincia de Puntarenas y en las comunidades del Golfo de Nicoya, Guanacaste, en los periodos que van del 1º de junio al 31 de julio y del 1º al 31 de octubre del año 2005.
4Que el acuerdo citado impide a los pescadores que utilizan "trasmallo", desempeñar su actividad remunerada y por ende percibir ingresos por este concepto, afectando la satisfacción de sus necesidades básicas.
5Que la Ley de Creación del Instituto Mixto de Ayuda Social N° 4760 del 4 de mayo de 1971, establece en su artículo 2° la finalidad de resolver el problema de la pobreza extrema en el país y en su artículo 4° inciso e) establece dentro de sus fines "atender las necesidades de los grupos sociales o de las personas que deban ser provistas de medios de subsistencia cuando carezcan de ellos".
6Que el artículo 4° del Reglamento para la Prestación de Servicios y el Otorgamiento de Beneficios del Instituto Mixto de Ayuda Social, publicado en La Gaceta N° 102 del 29 de mayo del 2000, define el concepto de pobreza como: "Fenómeno o situación compleja de índole coyuntural o estructural multifacético y heterogéneo, que afecta a las personas y que se caracteriza por sus precarias condiciones de vivienda y sanitarias, bajos niveles educacionales, inserción inestable en el sistema productivo, condiciones de riesgo social, con poca o ninguna incorporación en mecanismos de participación social, recursos insuficientes para satisfacer necesidades básicas (nutricionales, salud, educación y vivienda) y en algunos casos ausencia o insuficiencia de destrezas, aptitudes, herramientas y oportunidades para generar y acumular ingresos".
7Que en el artículo 21 inciso h) del citado Reglamento, se señala en cuanto a los sujetos de los servicios institucionales, lo siguiente: "En casos de excepción debidamente documentados y con el correspondiente informe técnico social autorizados por quien ejerza la Gerencia Regional respectiva, se podrá otorgar beneficios a personas o familias que presenten una situación de pobreza coyuntural no necesariamente registrada como tal en el SIPO, o que mediante algún decreto o ley especí.ca, se considere beneficiarios de la acción institucional".
8Que no se cuenta con un fondo compensatorio para brindar un subsidio económico a los pescadores afectados por la veda y esta circunstancia provoca una situación de pobreza coyuntural, por la carencia de ingresos de los pescadores en época de veda.
9Que el artículo 36 de la Ley Nº 8436, dispone: "...El Poder Ejecutivo podrá autorizar el destino de fondos del Presupuesto Nacional a favor de INCOPESCA para la realización de los estudios sobre vedas, y a favor del Instituto Mixto de Ayuda Social (IMAS), con el propósito de desarrollar programas de asistencia socioeconómica diseñados especialmente con tal propósito, a favor de los pescadores que se vean afectados en los períodos de veda, siempre que se compruebe que no tienen otras fuentes de ingresos y se encuentran en condición de pobreza. Estos programas implicarán necesariamente servicios de trabajo comunal por parte de los beneficiarios, conforme al reglamento correspondiente o para la realización de estudios sobre la materia".

Considerando:

DECRETAN:

Por consiguiente, se autoriza al Instituto Mixto de Ayuda Social a otorgar beneficios económicos en calidad de subsidios a estas personas, en apego a las condiciones que se establecen en el presente decreto.

El IMAS procederá a la atención de estas personas con base en la resolución debidamente fundamentada y aprobada por la Gerente Regional que determine el cumplimiento de los requisitos establecidos en este decreto, de conformidad con el listado depurado que deberá presentarle INCOPESCA, el cual contendrá los siguientes requisitos:

a)Nombre completo del beneficiario.
b)Número de cédula de identidad.
c)Domicilio exacto de los beneficiarios.
d)Fotocopia de la licencia de pesca vigente extendida por INCOPESCA.

Los profesionales del IMAS estarán facultados para solicitar a los potenciales beneficiarios los requisitos establecidos en el artículo 2° del presente decreto y no requerirán que los mismos se encuentren registrados en el Sistema de Información de la Población Objetivo (SIPO). Para hacer efectiva la entrega del monto económico correspondiente al segundo periodo de veda, el IMAS podrá solicitar al INCOPESCA y/o a los beneficiarios la verificación y actualización de la información suministrada con base en este decreto.

En estos casos se procederá a la revocatoria inmediata del beneficio autorizado y concomitantemente se afectará la participación de estos beneficiarios sobre los beneficios futuros que pudieren recibir por este concepto de parte del IMAS.

Artículo 2 — —The beneficiaries of the IMAS action shall be considered to be the fishers and their assistants who are duly accredited as such before INCOPESCA and hold a valid fishing license.

Artículo 4 — —The subsidies shall be processed by the IMAS Regional Managements of the Puntarenas and Guanacaste zones.

Artículo 6 — —It shall enter into force upon its publication.

Artículo 2 — Se considerarán beneficiarios de la acción del IMAS los pescadores y sus ayudantes que se encuentren debidamente acreditados como tales ante el INCOPESCA y ostenten licencia de pesca vigente.

Artículo 4 — Los subsidios serán tramitados por las Gerencias Regionales del IMAS de las zonas de Puntarenas y Guanacaste.

Artículo 6 — Rige a partir de su publicación.
