Complete Text of Record: 116AC5 INSTITUTO COSTARRICENSE DE PESCA INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA (This regulation was repealed by Article 14 of agreement No. AJDIP/166-2017 of April 21, 2017, "Regulación para el cumplimiento del servicio de trabajo comunal por parte del pescador inscrito en veda") No. A.J.D.I.P./274.—Puntarenas, on the twentieth day of May, two thousand five.
I.—That in accordance with Law No. 7384, the Law Creating INCOPESCA, and Law No. 8436, the Fisheries and Aquaculture Law, it is the attribution and competence of INCOPESCA to protect and conserve hydrobiological resources, in order to guarantee the living resources of the sea for future generations.
II.—That it is technically considered that one of the means of conserving hydrobiological resources and guaranteeing a sustainable exploitation of the resources is the establishment of closed seasons and closed areas, which it is appropriate to define for application in the present year.
III.—That after analyzing the technical criteria and recommendations issued by the Closed Season Commission, as well as the criteria of the Technical Directorate of INCOPESCA, it is considered appropriate to adopt the recommendation provided by said Commission. Therefore:

The Semi-Industrial shrimp trawler Fleet is prohibited from operating from June 1st to July 31st and between October 1st and 31st of 2005, in the area between an imaginary straight line running from Punta Torres, known as Peñón (84° 43' 52'' W, 09° 53' 31'' N), to the Lighthouse of the Islas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N), and from that line, inshore to the mouth of the Río Tempisque.
A. Fishing with gillnets or trammel nets: during the period between June 1st and July 31st and from October 1st to 31st, 2005, the use of gillnets or trammel nets of any mesh size is prohibited in the area between a straight imaginary line running from Punta Torres, known as Peñón (84° 43' 52'' W, 09° 53' 31'' N), to the Lighthouse of the Islas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N), and from that line, inshore to the mouth of the Río Tempisque.
B. Fishing with handlines: during the period between June 1st and July 31st and from the 1st to the 31st of October, 2005, any permit holder with a valid Commercial Fishing License, regardless of the type of fishing and the fishing gear authorized therein, may use a handline with a No. 6 hook, in the area between an imaginary straight line running from Punta Torres, known as Peñón (84° 43' 52'' W, 09° 53' 31'' N), to the Lighthouse of the Islas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N), and from that line inshore to the mouth of the Río Tempisque.
C. Fishing with flatline in the area protected by the closed season: during the period between June 1st and July 31st and from October 1st to 31st, 2005, any permit holder with a valid Commercial Fishing License for line fishing in the inner zone of the Golfo de Nicoya may use one flatline per vessel, with a maximum length of 500 meters and also a maximum of 300 No. 6 hooks, in the area comprised within the triangle formed by an imaginary straight line running from the Puntarenas Cruise Ship Dock (84º 49' 51'' W, 09º 58' 26''N) to Punta Gigante in Paquera (84º 55' 00'' W, 09º 52' 30'' N), and from there another imaginary straight line to the Lighthouse of Isla Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N), and from there another imaginary straight line to the Puntarenas Cruise Ship Dock (84º 49' 51'' W, 09º 58' 26''N).
D. Fishing with flatline in the offshore area of the Golfo de Nicoya: during the period between June 1st and July 31st and from October 1st to 31st, 2005, any permit holder with a valid Commercial Fishing License for line fishing in the outer zone of the Golfo de Nicoya may use one flatline per vessel, with a maximum length of 5000 meters and 2000 circular hooks, only in the area between an imaginary straight line running from Punta Torres, known as Peñón (84° 43' 52'' W, 09° 53'31'' N), to the Lighthouse of Isla Negritos Afuera (84º 49' 35'' '57, 09º 49' 14'' N), and from that line offshore of the Golfo de Nicoya.
A. Fishing with beach seine net: during the period between June 1st and July 31st and from the 1st to the 31st of October, 2005, the capture of bait with beach seine net will be permitted. Said net must have a mesh size of ¾ of an inch, a maximum length of 20 meters, a maximum height of 2 meters, and must not have a bag. INCOPESCA shall be responsible for granting provisional permits for this purpose during the closed season, in accordance with the requirements for bait in each of the fishing communities.
B. Fishing with lampara net: during the period between June 1st and July 31st and from the 1st to the 31st of October, 2005, the capture of bait with lampara net will be permitted. Said net must have a mesh size of ¾ of an inch, a maximum length of 40 meters, a maximum height of 8 meters respectively, with or without a bag. INCOPESCA shall be responsible for granting provisional collective permits for this purpose during the closed season, in accordance with the requirements for bait and the number of fishers with a valid Commercial Fishing License.
During the period between June 1st and July 31st, sardine fishing with purse seine net will be permitted for 3 days per week, in the area between an imaginary straight line running from Punta Torres, known as Peñón (84° 43' 52'' W, 09° 53' 31'' N), to the Lighthouse of the Islas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N), and from there inshore to the imaginary straight line running to the Cruise Ship Dock in the City of Puntarenas (84º 49'51'' W, 09º 58' 26'' N).
The owners of the sardine vessels with purse seine nets shall agree upon and submit to the Department of Protection and Registration of INCOPESCA, before April 30th, a schedule comprising the 3 days per week they will fish during this closed season.
During the remaining 4 days of the week of this closed season, this fleet may fish offshore of the imaginary straight line comprising from Punta Torres, known as Peñón (84° 43' 52'' W, 09° 53' 31'' N), to the Lighthouse of the Islas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N).
During the period between October 1st and 31st, sardine fishing with purse seine net is prohibited in the area between an imaginary straight line running from Punta Torres, known as Peñón (84° 43' 52'' W, 09° 53' 31'' N), to the Lighthouse of the Islas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N), and from there inshore to the imaginary straight line running to the Cruise Ship Dock in the City of Puntarenas (84º 49' 51'' W, 09º 58' 26'' N).
During the period between June 1st and July 31st and from October 1st to 31st, 2005, fishing for jaiba crab with traps will be permitted, only to any permit holder with a valid Commercial Fishing License for this type of fishing and in the zone for which they have a permit.
Fishers found carrying out fishing activities in zones and with fishing gear not permitted will have the corresponding administrative or legal procedures initiated against them. The economic subsidy granted and the benefit of fuel at a preferential price will be immediately suspended for them, for which purpose they must reimburse the money or the differential granted for that end.
It shall be in force as of June 1st, 2005.

Texto Completo acta: 116AC5 INSTITUTO COSTARRICENSE DE PESCA INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA (Esta norma fue derogada por el artículo 14 del acuerdo N° AJDIP/166-2017 del 21 de abril del 2017, "Regulación para el cumplimiento del servicio de trabajo comunal por parte del pescador inscrito en veda") N° A.J.D.I.P./274.-Puntarenas, a los veinte días del mes de mayo del dos mil cinco.
I.-Que de conformidad con la Ley N° 7384, Ley de Creación del INCOPESCA, y la Ley Nº 8436, Ley de Pesca y Acuicultura, es atribución y competencia del INCOPESCA proteger y conservar los recursos hidrobiológicos, en aras de garantizar a las generaciones venideras, los recursos vivos del mar.
II.-Que está considerado técnicamente, que una de las formas de conservación de los recursos hidrobiológicos y garantizar una explotación sostenible de los recursos, es el establecimiento de períodos y áreas de vedas, lo cual resulta conveniente definir para su aplicación en el presente año.
III.-Que luego de analizar los criterios técnicos y recomendaciones emanadas por la Comisión de Veda, así como el criterio de la Dirección Técnica del INCOPESCA, se considera acoger la recomendación brindada por dicha Comisión. Por tanto:

Se prohíbe a la Flota Semi-Industrial camaronera de arrastre faenar del 1º de junio al 31 de julio y entre el 1º al 31 de octubre de 2005, en el área comprendida entre una línea recta imaginaria que va desde Punta Torres, conocida como Peñón (84° 43' 52'' W, 09° 53' 31'' N) hasta el Faro de las Islas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N) y de esa línea, aguas adentro hasta la desembocadura del Río Tempisque.
A. Pesca con redes agalleras o trasmallos: durante el período comprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de octubre de 2005, se prohíbe la utilización de redes agalleras o trasmallos de cualquier luz de malla, en el área comprendida entre una línea recta imaginaria que va desde Punta Torres, conocida como Peñón (84° 43' 52'' W, 09° 53' 31'' N) hasta el Faro de las Islas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N) y de esa línea, aguas adentro hasta la desembocadura del Río Tempisque.
B. Pesca con cuerdas de mano: durante el período comprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de octubre del 2005, todo aquel permisionario con Licencia de Pesca Comercial vigente e independientemente del tipo de pesca y las artes de pesca autorizada en la misma, podrá utilizar cuerda de mano con anzuelo Nº 6, en el área comprendida entre una línea recta imaginaria que va desde Punta Torres, conocida como Peñón (84° 43' 52'' W, 09° 53' 31'' N) hasta el Faro de las Islas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N) y de esa línea aguas adentro hasta la desembocadura del Río Tempisque.
C. Pesca con línea planera en la zona protegida por la veda: durante el período comprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de octubre del 2005, todo aquel permisionario con Licencia de Pesca Comercial vigente para pesca con línea en la zona interna del Golfo de Nicoya, podrá utilizar una línea planera por embarcación, con un máximo de 500 metros de largo y también un máximo de 300 anzuelos Nº 6, en el área comprendida en el triángulo formado por una línea recta imaginaria que va desde el Muelle de Cruceros de Puntarenas (84º 49' 51'' W, 09º 58' 26''N) a Punta Gigante de Paquera (84º 55' 00'' W, 09º 52' 30'' N) y de ahí otra línea recta imaginaria hasta el Faro de la Isla Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N) y de ahí otra línea recta imaginaria hasta el Muelle de Cruceros de Puntarenas (84º 49' 51'' W, 09º 58' 26''N).
D. Pesca con línea planera en la zona aguas afuera del Golfo de Nicoya: durante el período comprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de octubre del 2005, todo aquel permisionario con Licencia de Pesca Comercial vigente para pesca con línea en la zona externa Golfo de Nicoya, podrá utilizar una línea planera por embarcación, con un máximo de 5000 metros de largo y 2000 anzuelos del tipo circular, solamente en el área comprendida entre una línea recta imaginaria que va desde Punta Torres, conocida como Peñón (84° 43' 52'' W, 09° 53'31'' N) hasta el Faro de la Isla Negritos Afuera (84º 49' 35'' '57, 09º 49' 14'' N) y de esa línea aguas hacia afuera del Golfo de Nicoya.
A. Pesca con chinchorro de barrer playa: durante el período comprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de octubre de 2005, se permitirá la captura de carnada con chinchorro de barrer en playa. Dicha red deberá tener una luz de malla de ¾ de pulgada, una longitud máxima de 20 metros, una altura máxima de 2 metros y no deberá de tener bolsa. Corresponderá al INCOPESCA el otorgamiento de permisos provisionales para este efecto durante la veda, de conformidad con los requerimientos de carnada en cada una de las comunidades pesqueras.
B. Pesca con red bolichera: durante el período comprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de octubre de 2005, se permitirá la captura de carnada con red bolichera. Dicha red deberá tener una luz de malla de ¾ de pulgada, una longitud máxima de 40 metros, una altura máxima de 8 metros respectivamente, con o sin bolsa. Corresponderá al INCOPESCA el otorgamiento de permisos colectivos provisionales para este efecto durante la veda, de conformidad con los requerimientos de carnada y la cantidad de pescadores con Licencia de Pesca Comercial vigente.
Durante el período comprendido entre el 1º de junio y el 31 de julio, se permitirá la pesca de la sardina con red de cerco, durante 3 días por semana, en la zona comprendida entre una línea recta imaginaria que va desde Punta Torres, conocida como Peñón (84° 43' 52'' W, 09° 53' 31'' N) hasta el Faro de las Islas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N) y de ahí aguas adentro hasta la línea recta imaginaria que va hasta el Muelle de Cruceros en la Ciudad de Puntarenas (84º 49'51'' W, 09º 58' 26'' N).
Los propietarios de las embarcaciones sardineras con red de cerco, se pondrán de acuerdo y presentarán ante el Departamento de Protección y Registro del INCOPESCA, antes del 30 de abril, un cronograma que comprenda los 3 días por semana que pescarán durante esta veda.
Durante los 4 días restantes de la semana de esta veda, esta flota podrá pescar aguas afuera de la línea recta imaginaria comprendida desde Punta Torres, conocida como Peñón (84° 43' 52'' W, 09° 53' 31'' N) hasta el Faro de las Islas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N).
Durante el período comprendido entre el 1º al 31 de octubre, se prohíbe la pesca de la sardina con red de cerco, en la zona comprendida entre una línea recta imaginaria que va desde Punta Torres, conocida como Peñón (84° 43' 52'' W, 09° 53' 31'' N) hasta el Faro de las Islas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N) y de ahí aguas adentro hasta la línea recta imaginaria que va hasta el Muelle de Cruceros en la Ciudad de Puntarenas (84º 49' 51'' W, 09º 58' 26'' N).
Durante el período comprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de octubre de 2005, se permitirá la pesca del cangrejo jaiva con nasas, únicamente a todo aquel permisionario con Licencia de Pesca Comercial vigente para este tipo de pesca y en la zona que tenga permiso.
A los pescadores que se les encuentre realizando labores de pesca en zonas y con artes de pesca no permitidos, se les iniciará los procedimientos administrativos o legales correspondientes. De forma inmediata se le suspenderá el subsidio económico otorgado y el beneficio del combustible a precio preferencial, para lo cual tendrán que reintegrar el dinero o el diferencial otorgado para tal fin.
Rige a partir del 1º de junio del 2005.
