The following Offices, with their respective functions, are attached to the Office of the Minister. Their control and direction shall correspond to the Minister, unless expressly delegated by the superior hierarch in favor of the Vice-Minister:
- a)(Thus repealed by Article 1 of Executive Decree N° 34204 of November 23, 2007).
- b)(Thus repealed by Article 1 of Executive Decree N° 34204 of November 23, 2007).
- c)Press and Public Relations Office, whose functions are the following:
Implement the Ministry's dissemination policy towards the media and the general public.
Prepare press releases regarding inquiries made and about which the public must be informed.
Review and submit for approval to the Minister or Vice-Minister all official Ministry communications, brochures, bulletins, videos, and any other communication instrument.
- d)Internal Audit Office, whose functions are the following:
Contribute with the MINAE administration to maintain an efficient, effective, and economical administration, through recommendations derived from studies and reports prepared to improve the existing internal control and communicate said results to those internal or external entities deemed pertinent.
Carry out internal audits and special studies in any of MINAE's Dependencies in a timely, independent manner, subsequent to the financial accounting, administrative, and other operations within the Institution.
Analyze contracts between MINAE and other public or private Dependencies, with the purpose of verifying the legality of their issuance and execution.
Legalize the accounting books and minute books legally required and those that, at the Auditor's discretion, are considered pertinent, for all the bodies and Dependencies that comprise MINAE.
Ensure compliance with what is established in the regulations governing this Ministry, in the General Law of Public Administration, the Administrative Contracting Law and Regulation, the Law of Financial Administration and Public Budgets, the Organic Law of the Comptroller General of the Republic, and other provisions of public entities.
Carry out subsequent control of the execution and liquidation of the budget and the special funds managed by the entity.
Verify the compliance, sufficiency, and validity of the Institution's Internal Control System.
This dependency may not be delegated to the direction and control of the Vice-Minister.
- e)Planning Directorate, whose functions are the following:
Advise the Office of the Minister and other administrative units on planning matters.
Coordinate the formulation and ensure the execution of short, medium, and long-term plans, within the spheres of competence of MINAE.
Propose and participate in the definition of objectives, technical guidelines, policies, and development strategies for environment and energy, water resources, mining, hydrocarbons and fuels, forest resources, protected wilderness areas, wildlife, biodiversity, marine resources in protected areas, environmental services, watersheds, wetlands, meteorological and oceanographic services, and any other natural resources, in coordination with MINAE's administrative units.
- f)International Cooperation Directorate, whose functions are the following:
Advise the Office of the Minister on matters of planning, negotiation, obtaining, and use of external cooperation to facilitate the fulfillment of institutional objectives and based on the approved work plans for each of MINAE's various dependencies.
Coordinate and plan, with the various international cooperation liaisons of MINAE's dependencies, the external cooperation plan.
Actively participate with the Office of the Minister and MINAE's dependencies in the definition of policies and the planning of external cooperation; as well as in the preparation, negotiation, execution, and monitoring of projects that have External Cooperation.
Maintain updated and quality information on project proposals, projects under negotiation and execution, and sources of external cooperation, in close coordination and collaboration with MINAE's dependencies.
Maintain updated information on the proposals of the Costa Rican Government related to compliance with international environmental conventions that have been ratified by the State.
Serve as the focal point or institutional liaison before all regional and international Conventions, Agreements, Agencies, and Organizations. The foregoing without prejudice to specific responsibilities that may be assigned to other dependencies as technical, scientific, and/or administrative focal points, as appropriate.
- g)Office for the Execution of the Physical Infrastructure Investment Plan of the Ministry of Environment and Energy, whose functions, in accordance with Executive Decree N° 29735-MINAE, of August 6, 2001, published in La Gaceta N° 166, of August 30, 2001, are the following:
Directly attend to, in accordance with the policies established by the Office of the Minister, the development, expansion, remodeling, and general conditioning of the Ministry's physical plant, in any of its projects, properties, and conservation areas.
Supervise and authorize physical infrastructure constructions carried out through projects and international cooperation.
- h)Office of the Environmental Comptroller, whose functions are detailed in Chapter X of this Regulation.
- i)Office of the Services Comptroller, whose functions are detailed in Chapter XI of this Regulation.
- j)Environmental Education Office, which has the following functions:
Advise on environmental education matters to the Office of the Minister and other MINAE dependencies.
Implement the Ministry's environmental education policies.
Serve as the official liaison with governmental and non-governmental, national and international institutions working in the field of environmental education.
Promote and collaborate with the Ministry of Public Education and higher education institutions in the environmentalization of study programs at different educational levels.
Coordinate the Ministerial Commission on environmental education.
Prepare and coordinate the Ministry's Environmental Education Program with the support of the various MINAE dependencies represented in the Ministerial Commission.
Contribute so that all environmental education initiatives developed within the Ministry incorporate a gender perspective.
- k)The Sectoral Directorate of Energy (DSE), which shall act as the Energy Subsectoral Technical Secretariat, according to the provisions of Executive Decree 21351-MIRENEM-PLAN published in La Gaceta N° 133 of July 14, 1992, which shall be composed of:
1. The Sectoral Director of Energy.
2. The Sectoral Deputy Director of Energy.
3. A Coordinator for each of the following areas: Information, Development, Planning, and Administrative Assistance.
It shall have the following functions:
Prepare the National Energy Plan, based on the guidelines emanating from the Ministry of National Planning and Economic Policy and from the respective Governing Minister of the Sector.
Prepare studies, diagnoses, and others concerning energy matters.
Technically support the efforts of the Energy Subsectoral Council.
Carry out the respective programming, evaluation, and control of energy policies.
Submit quarterly, semi-annual, and annual reports to the Energy Subsectoral Council.
Analyze, evaluate, and supervise everything related to technical cooperation, investments, and external financing, as well as the management carried out by the agencies or experts of the Energy Subsector.
Establish adequate means of communication with the member institutions of the Energy Subsector, as well as public and private entities and, in general, with all organizations related to it.
Create and maintain a documentation and information center that allows the supply of periodic statistics to the member institutions of the Energy Subsector.
Provide permanent technical support to the member institutions of the Subsector and supply them with all the necessary information for decision-making in the energy field.
Develop energy planning instruments.
Carry out comprehensive studies for the development and application of energy options.
Investigate substitute sources for conventional energies.
Promote the execution of pilot projects with new energy sources.
Other functions assigned by the Energy Subsectoral Council.
Advise and recommend to the Governing Minister the granting of public service concessions for electric power supply, as established by Article 5, subsection a) of the Law of the Regulatory Authority for Public Services.
Advise and recommend to the Governing Minister the establishment of technical norms and regulations related to the rational use of energy.
Advise and recommend to the Governing Minister the granting of tax exemptions, application of sanctions, and the approval of rational energy use programs within the framework of the Law Regulating the Rational Use of Energy.
Complementary attributions of the described offices and directorates shall be defined in the laws, executive decrees, and directives issued by the Office of the Minister.
