For the purposes of this law, the following concepts are defined:
Person: Natural or legal person (persona física o jurídica).
Trademark (Marca): Any sign or combination of signs that allows distinguishing the goods or services of one person from those of another, because they are considered sufficiently distinctive or capable of identifying the goods or services to which they are applied from those of the same species or class.
Collective mark (Marca colectiva): A sign or combination of signs whose owner is a collective entity that groups together persons authorized by the owner to use the mark.
Certification mark (Marca de certificación): A sign or combination of signs that is applied to products or services whose characteristics or quality have been controlled and certified by the owner of the mark.
Trade name (Nombre comercial): A denominative or mixed sign that identifies and distinguishes a specific company or commercial establishment.
Emblem (Emblema): A figurative sign that identifies and distinguishes a company or establishment.
Distinctive sign (Signo distintivo): Any sign that constitutes a trademark, a trade name, or an emblem.
Well-known mark (Marca notoriamente conocida): A sign or combination of signs known in international trade, the relevant sector of the public, or business circles.
Commercial advertising expression or signal (Expresión o señal de publicidad comercial): Any legend, advertisement, slogan, phrase, combination of words, design, engraving, or any other similar means, provided that it is original, characteristic, and used to attract the attention of consumers or users to a specific product, service, company, establishment, or commercial premises.
Appellation of origin (Denominación de origen): A geographical name, designation, expression, image, or sign of a country, a region, or locality, useful for designating a good as originating from the territory of a country, a region, or locality of that territory, and whose quality or characteristics are exclusively due to the geographical environment, including natural and human factors.
Geographical indication (Indicación geográfica): An indication that identifies a product as originating from the territory of a country, or a region or locality of that territory, when a given quality, reputation, or other characteristic of the good is fundamentally attributable to its geographical origin. Any sign or combination of signs, in any form, shall be capable of constituting a geographical indication.
