13.1. Semiannually request the incorporation of their crop plans into the Irrigation Plan (Plan de Riego) of the District using the corresponding form, before April 15 and October 15 of each year. SENARA will attend to the requests for each semester by defining the Irrigation Plan of the District, which will be adjusted to water availability, soil conditions, and crop requirements.
If the user does not provide the data in due time, SENARA will proceed to estimate them discretionally based on the information it has available.
13.2. Pay the tariffs for irrigation service within the established deadlines.
13.3. Build the necessary works within their property to drain surface and subsurface waters, to avoid damage to their property or adjacent properties, to irrigation and drainage infrastructure, roads, and other public works, as well as maintain in good condition and repair when appropriate, the distribution channels, drainage, and other infrastructure at the parcel level, necessary to efficiently use the irrigation service.
13.4. Build within their property the necessary works for the efficient distribution, use, and evacuation of water, following the technical recommendations that SENARA officials issue in this regard, such as: furrow length and slope, border height, terrace slopes and maximum dimensions, water circulation within the parcel. Prior to the registration of the crop in the Irrigation Plan of the District, SENARA must verify that the infrastructure built by the user at the parcel level meets the necessary requirements for rational use of irrigation water.
13.5. Service Request: Confirm to the corresponding Ditch Rider (Canalero), directly or through a person authorized for this purpose, their irrigation requirements, with two days' notice, previously completing the water request form available at the offices or through the electronic means authorized or enabled by SENARA, in accordance with the schedule established in the District's Irrigation Plan. If the Ditch Rider detects any anomaly in the parcel infrastructure, the user must correct it before receiving the service.
13.6. Use the water received only on the property of the requesting user and eventually allow the disposal of excess water to be used on other farms, in cases where the system operation requires a multiple in-series use of the water.
13.7. The user or the authorized person must be present at the respective diversion structure (toma), on the day and time when they are scheduled to receive the irrigation service.
13.8. Properly manage the water, starting from its respective diversion structure, avoiding waste or contamination and any other activity that negatively affects the environment.
13.9. Not alter, construct, or destroy any District works that affect the irrigation service and the interests of other users.
13.10. Communicate any transfer, segregation, or division of the property registered in the User Registry (Padrón de Usuarios), submitting the pertinent documentation to the District authorities, within a period not exceeding 3 months after the transfer or segregation has been finalized. Such documentation consists of the following:
- a)Copy of the cadastral plan.
- b)Copy of the deed by which the segregation or division of properties was effected.
- c)Indicate the easements (servidumbres) considered and the designs for the construction of the new channels that will supply all the segregated areas.
13.11. Build at their own expense the required distribution and drainage infrastructure, in those cases where the property undergoes a segregation or division, so that the entire area of the original property, registered in the User Registry, maintains its status as an area enabled with the irrigation service. Prior to its construction, the design of said infrastructure must be approved by the District authorities. The infrastructure and easements necessary to bring water to each property must be transferred to SENARA at no cost.
During the construction of those works, the obligation to pay the corresponding tariff will not be suspended. The user will notify SENARA of the start of construction, so that its execution can be inspected. SENARA will have a period of 30 calendar days to carry out the final inspection of the work and make the service connection, as long as the work meets the required technical conditions. 13.12. Respect the easement rights of SENARA, and the infrastructure with which the irrigation service is provided, and refrain from actions that may endanger said infrastructure, or harm its normal operation and maintenance.
The user must keep the sections of their property in front of these easements clean.
13.13. Maintain in good condition the dividing fences of their properties with SENARA's irrigation channels.
13.14. Comply with all the provisions issued by the District aimed at achieving the best use of water and the most efficient operation and conservation of the works, as well as the provisions issued on the use and handling of agrochemicals.
13.8. Properly manage the water, starting from its respective diversion structure, avoiding waste or contamination and any other activity that affects 13.15. Cooperate by providing information on production costs, yields, technological package, and market prices, when formally required by SENARA, for the purpose of keeping statistical records of the results of the different productive activities carried out in the Irrigation Districts (Distritos de Riego).
13.16. Provide cooperation to SENARA by reporting those actions that harm the normal provision of the service.
