13.1. To request semiannually the incorporation of their cultivation plans within the District's irrigation plan using the corresponding form, before April 15 and October 15 of each year. SENARA shall address the requests for each semester by defining the District's irrigation plan, which shall be adjusted to the availability of water, soil conditions, and crop requirements.
If the user does not provide the data in due time, SENARA shall proceed to estimate them discretionally based on the information it has available.
13.2. To pay the tariffs for the irrigation service within the established deadlines.
13.3. To construct the works necessary within their property to drain surface and subsurface waters, to prevent damage to their parcel or neighboring properties, to irrigation and drainage infrastructure, roads, and other public works, as well as to maintain in good condition and repair when appropriate, the distribution canals, drainage, and other infrastructure at the parcel level, necessary to efficiently use the irrigation service.
13.4. To construct within their property the works necessary for the distribution, efficient use, and evacuation of water, heeding the technical recommendations issued in this regard by SENARA officials, such as: length and slope of furrows, height of borders, maximum slopes and dimensions of terraces, circulation of water within the parcel. Prior to the registration of the crop in the District's irrigation plan, SENARA must verify that the infrastructure the user built at the parcel level meets the necessary requirements for the rational use of irrigation water.
13.5. Service Request: To confirm to the corresponding Canalero, directly or through a person authorized for this purpose, their irrigation requirements, two days in advance, previously filling out the water request form available at the offices or through the electronic means authorized or enabled by SENARA, in accordance with the schedule established in the District's irrigation plan. If the Canalero detects any anomaly in the parcel-level infrastructure, the user must correct it prior to receiving the service.
13.6. To use the water received only on the property of the requesting user and eventually to allow the disposal of surpluses for use on other farms, in cases where the system's operation requires a multiple, sequential use of the water.
13.7. The user or the authorized person must be present at the respective water intake, on the day and time when they are scheduled to receive the irrigation service.
13.8. To properly manage the water from their respective intake, avoiding waste or contamination and any other activity that negatively affects the environment.
13.9. To not alter, construct, or destroy any District works that affect the irrigation service and the interests of other users.
13.10. To communicate any transfer, segregation, or division of the property registered in the User Registry, forwarding the pertinent documentation to the District authorities, within a period not exceeding 3 months after the transfer or segregation is made. Said documentation consists of the following:
- a)Copy of the cadastral map.
- b)Copy of the deed through which the segregation or division of properties was carried out.
- c)Indicate the easements (servidumbres) considered and the designs for the construction of new canals that will supply all the segregated areas.
13.11. To construct at their own expense the required distribution and drainage infrastructure, in those cases where the farm undergoes a segregation or division, so that the entire area of the original farm, registered in the user registry, maintains its condition as an area enabled for the irrigation service. Prior to its construction, the design of said infrastructure must be approved by the District authorities. The infrastructure and easements necessary to convey water to each farm must be transferred to SENARA at no cost.
During the construction of these works, the obligation to pay the corresponding tariff shall not be suspended. The user shall notify SENARA of the start of construction, so that its execution can be inspected. SENARA shall have a period of 30 calendar days to conduct the final inspection of the work and make the service connection, provided the work meets the required technical conditions. 13.12. To respect the easement rights of SENARA, and the infrastructure used to provide the irrigation service, and to refrain from actions that may endanger said infrastructure, or harm its normal operation and maintenance.
The user must keep the sections of their farm bordering these easements clean.
13.13. To maintain in good condition the dividing fences of their properties adjacent to SENARA's irrigation canals.
13.14. To abide by all the provisions issued by the District aimed at achieving the best use of water and the most efficient operation and conservation of works, as well as the provisions issued regarding the use and handling of agrochemicals.
13.8. To properly manage the water from their respective intake, avoiding waste or contamination and any other activity that affects 13.15. To collaborate by providing information on production costs, yields, technological package, and market prices, when formally required to do so by SENARA, for the purpose of keeping statistical records of the results of the different productive activities carried out in the Irrigation Districts.
13.16. To provide collaboration to SENARA, reporting those actions that harm the normal provision of the service.
