  3. 3Judge Vanessa Fisher González, of the Juzgado Agrario del Segundo Circuito Judicial de San José, by judgment number 2018000097 issued at fifteen hours and six minutes on July eleventh, two thousand eighteen, ruled: “THEREFORE: In accordance with the foregoing and the cited statutory provisions, THESE CORRECTION-OF-AREA PROCEEDINGS ARE APPROVED, as instituted by [Nombre1] , of legal age, married once, custodian, identity card CED6, and [Nombre2] , of legal age, single, farmer, identity card CED7; both residents of El Llano de San Antonio de Alajuelita [Dirección1] . Consequently, without prejudice to any third party having a superior right, the Registro Público, Propiedad Inmueble shall CORRECT THE AREA of the property registered in the San José Section under registration number registration number [Placa1] , consisting of land used partly for agriculture and partly undergoing natural regeneration, located in Pozo Azul, [Dirección2] , Tenth Canton of Alajuelita, Province of San José, bounded on the north by [Nombre3] ; on the south by [Nombre4] ; on the east by Urbano Calderón Sandí and [Dirección3] , with a frontage of one hundred seven linear meters and ninety-eight centimeters, and on the west by [Nombre4] ; described in cadastral plan [Placa2] -2010; so that its true area of THREE HECTARES ONE THOUSAND ONE HUNDRED EIGHT SQUARE METERS may be recorded.The aforementioned property was valued at the sum of FIVE MILLION COLONES. Pursuant to Article 13 of the Ley de Informaciones Posesorias, this correction shall not prejudice any third party during the three years following registration.- The area adjacent to the small stream (yurro) that crosses the property constitutes a protection area (área de protección) pursuant to Article 33, subsection b), of Ley Forestal No. 7575, and the cutting or removal of trees is prohibited; it is likewise placed on record that the channel and waters of that watercourse are in the public domain (dominio público) pursuant to the Ley de Aguas. The corresponding notice (edicto) was published in Boletín Judicial No. 61 of March 27, 2013. Once this

decision becomes final, the corresponding certification shall be issued," (See Virtual Desktop of the Juzgado Agrario de Goicoechea, under Associated Documents, file 11/7/18 at 15:06:30 p.m.).-

  1. 4Attorney Susana Fallas Cubero, in her capacity as deputy attorney general, filed an appeal (recurso de apelación), expressly stating the reasons for challenging the trial court’s position, (See Virtual Desktop of the Juzgado Agrario de Goicoechea, in the Filings Inbox, file 18/7/18 at 3:09:57 p.m.).-

5. In the conduct of the proceeding, the statutory requirements have been observed, and the judgment contains no errors or omissions capable of rendering it void.- Drafted by Judge Castro García; and,

CONSIDERING

I. This Court endorses the list of facts deemed proven in the judgment under appeal.-

II- The State’s representative appeals judgment No. 2018000097 of 15 hours 6 minutes on July 11, 2018, setting forth the following grounds for disagreement:

  • 1)Before the same trial court, in case file No. EXPN1, the petitioners requested correction of the property’s area. That request was denied by judgment No. 317-2004 of 10:30 hours on November 8, 2004, due to the failure to prove the required ten years of possession (posesión decenal) over the land, or that such possession had been exercised continuously, publicly, peacefully, under a claim of ownership, and in good faith during the years preceding the creation of the Zona Protectora Cerros de Escazú. This Court denied the appeal by decision No. 0099-F-06 of 14: 45 hours on February 14, 2006. In view of the foregoing, she invokes judgments numbers 723-F-2017, 762-F-17, and 771-F-17 of this Court, in which the Court held that formal res judicata (cosa juzgada formal) applied because a prior application concerning the same property for registration through a possessory title proceeding had already been decided.
  • 2)The appellant asserts that the judgment now under appeal found that this proceeding was not a possessory title proceeding and therefore was not comparable to a correction of area. In response, she argued that the Tribunal Agrario has repeatedly reasoned that correction proceedings must fully satisfy the same requirements applicable to those seeking to register property for the first time. For that reason, she characterizes the rejection of formal res judicata as unfounded. She adds that, in order to correct the area and add it to the property that had been registered with a different area before 1930, the title applicants (titulantes) must prove ten years of environmentally compliant possession (posesión ecológica) through testimonial evidence (Articles 6 and 7 of the Ley de Informaciones Posesorias), and that the court could not limit itself merely to confirming that the boundaries had not been changed, as was done in the judgment.
  • 3)She states that consideration must be given to report No. DGA-RH-2004-508 of the Instituto Costarricense de Acueductos y Alcantarillados (certified copy), contained in the prior proceeding No. EXPN1, which deemed it necessary to reserve the water produced in and flowing through the area at issue in this proceeding for the supply of the populations of the northeastern foothills of the Cerros de Escazú, and which stated verbatim: " ( ) THE PROPERTY IS LOCATED ON THE NORTHEASTERN SLOPE OF THE CERROS DE ESCAZU, AND ITS LANDS FORM PART OF THE RIO LIMON MICRO-WATERSHED, WHICH IN TURN FORMS PART OF AND BELONGS TO THE COMPLETE HYDROLOGICAL SYSTEM OF THE RIOS TIRIBI-VIRILLA-GRANDE DE TARCOLES. THE SOUTHERN PORTION OF THE PROPERTY IS CROSSED BY A SMALL STREAM THAT CONTINUES PARALLEL TO THE SOUTHERN BOUNDARY AND FORMS PART OF THE HYDROLOGICAL MICROSYSTEM".. "( ) THEREFORE, IT IS NECESSARY TO PROTECT, RESERVE, AND SECURE THE SURFACE AND UNDERGROUND WATER RESOURCES THAT ARE PRODUCED AND PRESENT IN THAT AREA, SPECIFICALLY WHERE THE PROPERTY SUBJECT TO THE POSSESSORY TITLE PROCEEDING IS LOCATED". The appellant adds that the areas adjacent to drinking-water supply sources are in the public domain under Article 7, subsection c), of the Ley de Tierras y Colonización, Código Fiscal de 1926 (Article 510, subsection 3°), and Ley General sobre Terrenos Baldíos, No. 13 of January 10, 1939 (Article 7°). Section 31 of Ley de Aguas No. 276. She states that the statutory dedication (afectación) established by those provisions is not limited to the spring (naciente) or water source (manantial), but also encompasses their channels. She therefore rejects the characterization of the Procuraduría’s position as an expansive interpretation, as stated in the judgment. Rather, it is a statutory mandate that the judgment unjustifiably rejected. She mentions that Article 2° of Ley General de Agua Potable No. 1634 of September 18, 1953 reiterates the public-domain status of the lands necessary for an adequate drinking-water supply (Article 2, subsection h), of Ley Constitutiva Instituto Costarricense Acueductos y Alcantarillados, Ley No. 2726 of April 14, 1961, which replaces the ministries and municipalities identified in the Ley General de Agua Potable with that Instituto). In this regard, she outlines that the foregoing has constituted a statutory dedication since at least 1926, the date from which ten years of possession had to be proven in order to incorporate the excess area (demasía) into the land already registered with an area of only 1 ha 483.44 meters.
  • 4)She points out deficiencies in the testimonial evidence, which does not establish occupation prior to that statutory dedication or prior to the creation of the Zona Protectora Cerros de Escazú, (Decreto No. 6112-A, in force since July 17, 1976), where the property is located. Regarding the testimony, she states that although [Nombre5] acquired the property in 1984 from [Nombre6] Mora, it was not awarded to the petitioners until 2001. For his part, witness [Nombre7] testified that the petitioners had acquired it 55 years earlier (that is, in 1958), while deponent [Nombre8] stated that [Nombre5] had acquired it 40 years earlier (which takes us back to 1973). She asserts that witness [Nombre9] did not refer to the duration of possession by each transferor. She believes that the challenged judgment overlooks the deficiency in the testimony by attributing it to the witnesses’ advanced age. But given their ages, it would not have been possible to establish possession dating from before 1926, as required in this case. Furthermore, the Tribunal Agrario requires consistency among the witness statements and between those statements and the documents submitted, so that transferred possession (posesión transmitida) may be given effect and deemed credible. The witnesses must also establish the duration of occupation by each transferor, a requirement that was not met in this case. 6) She argues that decision No. 4587 of 15:45 hours on August 5, 1997, in its analysis of Article 7 of the Ley de Informaciones Posesorias, emphasized the importance of considering, when calculating the period for adverse possession (usucapión), the existence of provisions that had previously declared the lands inalienable. 5) Another objection asserts that the petitioners seek to increase the area of the property to three times the area registered in the Registro Público (from 1 ha 483.44 square meters to 3 ha 1108 square meters), without proving that those areas were already included in a prior registration or that ten years of possession had been exercised before those areas became subject to the statutory dedication. She emphasizes that, in deed No. 661 of 10 hours on November 8, 1984, [Nombre6] sold [Nombre5] the property with the area and boundaries shown in the Registry, without referring to any excess area (document incorporated on 08/09/2017 at 10:45 a.m.). This matter was not considered in the judgment, despite having been timely raised by this representation in our hearing submission of March 14, 2018.

III- These proceedings (diligencias) are brought for the purpose of correcting the registered area (cabida registral) of the property recorded in the Public Property Registry under folio [Placa3], rights 002 and 003. According to the Public Property Registry, its area is ten thousand four hundred eighty-three square meters and forty-four square decimeters, while cadastral plan [Placa2] -2010 reflects an area of three hectares and one thousand one hundred eight square meters. The property is used partly for agriculture and partly for natural regeneration (regeneración natural). It is located in [Dirección4] , , [Dirección5], Tenth District, Alajuelita, Province of San José. The foregoing is consistent with the statements made in the initial filing and subsequent pleadings (images 43 to 48, 54, 55 and 73), as well as the plan submitted (image 56 of the PDF case file), the registry certification (image 23), and the observations made during the judicial inspection (reconocimiento judicial) (document dated 29/08/2013 15:16:43).

Said property forms part of the protected wilderness area (área silvestre protegida) known as Zona protectora Cerros de Escazú, according to the certification issued by the Sistema Nacional de Áreas de Conservación and submitted into evidence (SINAC certification, image 28 of the case file in PDF format). It was created by Decreto No. 6112-A dated 17 de julio de 1976. (SINAC certification, image 28 of the case file in PDF format). The exercise of possession (posesión) in accordance with the conforming land use (uso conforme del suelo) for the activity conducted there has been certified pursuant to the approved methodology. (land-use certificate (certificado de uso de suelo), images 77 and 78 of the electronic case file in PDF format).

IV- Formal Res Judicata (Cosa Juzgada Formal). With respect to this issue, the ground for appeal (agravio) is rejected in view of the circumstances of this specific case. A review of the ruling cited by the appellant in support of this ground for appeal (voto 99-F-06, images 284 to 288 of the case file in PDF format) and the first-instance judgment issued in the prior proceeding (images 273 to 279 of the case file in PDF format) shows that it is indeed true that said decision affirmed the denial of the correction of area ordered in case number EXPN2. That first-instance denial states that the testimonial evidence submitted in that case failed to establish that possession had been exercised for 10 years before the creation of the management category (categoría de manejo) affecting the registered land. That decision was appealed on the ground that the testimony of [Nombre10] , [Nombre7] and [Nombre11] had not been assessed.

The appeal was rejected because it was filed out of time. In other words, there was no determination on the merits (análisis de fondo) of the matters now challenged in the appeal before this Court in the case sub judice, whereas the judgment under appeal provided an extensive determination on the merits of each point raised by the government legal representative (ente procurador). The rulings cited by the appellant regarding the application of formal res judicata between possessory-information proceedings (procesos de información posesoria) concern cases involving possessory-information proceedings proper, except for one; that is, properties lacking title and not recorded as such in the Registro Nacional. Given the particular circumstances of the present matter, the majority ruling finds that this is an application for correction of area which, because of the amount by which the area is sought to be increased, cannot be processed through notarial proceedings, and that the registered property originated in 1887.

For that reason, this non-contentious proceeding (procedimiento no contencioso) is used, as prescribed by Articles 13 and 14 of the Ley de Información Posesoria. The application, however, is different. It does not seek the issuance of a registrable title (título registrable) to land that was vacant or unregistered, but rather a legal solution to the situation of a parcel whose area is greater than the area registered in 1887 and which originally had no cadastral plan (plano catastrado). Regarding the distinct nature of correction-of-area proceedings as compared with possessory-information proceedings, see voto 808-F-16 of this Court. The government entity did not object to this proceeding under the terms of Article 8 of the Ley de Informaciones Posesorias. The ground for appeal based on formal res judicata is rejected.

V- With respect to the challenges to the testimonial evidence (prueba testimonial), it is established that three testimonies were received, on the basis of which the judgment under appeal found it proven that agricultural possession (posesión agraria), suitable for legal purposes, has been exercised over the property (fundo) measuring three hectares and one thousand one hundred eight square meters for more than seventy years, and that the area of the property has remained unchanged. Such possession was exercised through farming activities, occasional livestock raising in the past, and currently vegetable farming combined with the natural regeneration of pasture areas. (soil study and judicial inspection (reconocimiento judicial)). The chain of possession (cadena posesoria) of the registered property was established by all the witnesses: first in [Nombre6], subsequently in [Nombre12], and then in the applicants, who are the current registered titleholders and recognized possessors and are their children.

All belong to the same family unit. This Chamber agrees with the conclusion set forth in the judgment, by virtue of the comprehensive assessment of the evidence pursuant to Article 54 of the Ley de Jurisdicción Agraria. This system goes beyond the obsolete and superseded system of formally weighted evidence (prueba legal tasada). This is because that evidence demonstrated who had been the exclusive owners of the registered property with the area shown in the survey plan underlying this area correction (rectificación de medida), as well as the chain of possession exercised over the land encompassing the area sought to be added. Moreover, the property has been registered since 1887, and dominion was exercised as owners for a period far exceeding 10 years before 1976, when the land became subject to restrictions upon the establishment and entry into force of the protected wildlife area (área silvestre protegida) known as Zona Protectora Cerros de Escazú.

The record shows that the property at issue was first registered on 27 de julio de 1887, without a cadastral plan (plano catastrado) at that time and without having previously undergone an area correction. This conclusion follows from the information recorded in the Registry certification (images 241 to 242, digital case file in PDF format). Upon listening to the testimonies, which were subjected to exhaustive questioning by the trial judge who received the evidence, it is confirmed that [Nombre7], [Nombre9], and [Nombre8] (audio recordings in digital case file/documents/date 29/08/2013, times: 15:20:04, 15:21:05, and 15:10:13) agree in their statements regarding the identification of the property, given the permanence of the same boundaries marked by fencing. The witnesses identified the approximate area of the registered property in manzanas, a unit of measurement customarily used in the past by inhabitants of the national territory.

Thus, the first described an approximate area of 5 manzanas, the second witness 7 manzanas, and the third again referred to 5 manzanas. All clearly stated that the fences have remained in the same location and everything has remained unchanged. Applying sound judicial reasoning (sana crítica) and logic, this leads to the understanding that they are not experts in land measurement, but they do state, based on their own knowledge, that the property has not changed with respect to its physical boundaries; that is the central point to be proven regarding the existence of an area greater than the registered area, which in reality has always formed an integral part of the property. It is not whether they know its exact measurement, as alleged in the appeal. The inconsistencies identified by the appellant cannot be accepted insofar as the appellant asserts that the witnesses must specify exact areas.

The Ley de Informaciones Posesorias requires proof of actual possession (posesión real) through identification of the land (Article 6), and is applicable to area-correction proceedings. In this case, the witnesses clearly stated that the property has remained in its current condition throughout the entire period during which they have known it; it may therefore be inferred that possession has been maintained over the area observed during the judicial inspection, which described longstanding fences, and over the area shown in the cadastral plan underlying these proceedings. Furthermore, their testimony supports the inference that possession was exercised over an area greater than the registered area, given each witness’s calculation in manzanas, as noted above, just as the judgment reasoned. Accordingly, the contention on appeal that the evidence was not properly assessed in this respect cannot be accepted, because the judgment explained why, despite the differences between the areas stated by the witnesses (5 and 7 manzanas), which were neither exact nor identical, it could be established that the property had remained the same.

In this regard, the appealed judgment states: “It must be taken into account that they are all older adults, from whom it is unreasonable to demand an exact measurement; nevertheless, they ultimately agree that this property measured more than the registered ten thousand four hundred eighty-three square meters and forty-four square decimeters, considering that one manzana is equivalent to seven thousand square meters. Note that the property was registered as early as 1887, according to the Registry certification submitted as image 241, and it is well known that the measurement methods of that period were not the most accurate and that the property did not have a cadastral plan identifying it when it originated, or subsequently (except for those prepared since 2001 to correct its area), a factor that must be given particular weight in this case. Likewise, the aforementioned judicial inspection confirmed the age of the fences.

The precise purpose of Article 14 of the Ley de Informaciones Posesorias is to provide a means of curing title (saneamiento del derecho de propiedad), so that the physical reality may be made consistent with the Registry record, thereby more fully guaranteeing the exercise of the right and legal certainty itself.” Regarding, moreover, the period during which each declarant had known the property and its possession, [Nombre7] stated on the date of his testimony (29 de agosto del 2013) that he had known the property for 80 years, that is, since 1933. [Nombre9] stated approximately 60 years, that is, since 1953, and [Nombre8], who testified on 02 de setiembre del 2013, had known the property and its titleholder for the preceding 70 years, corresponding to 1943. The property became subject to a management category (categoría de manejo) in 1976, and therefore knowledge of the exercise of possession must date back at least to 1966; in this case, all the witnesses stated that they had known the property and its various titleholders for a period far exceeding that required by Article 7 of the Ley de Informaciones Posesorias.

The contention that this testimonial evidence fails to establish the required period of possession in cases involving restrictions arising from the creation of protected wildlife areas under any of the management categories, as in the case at bar, is rejected. It should be emphasized that this property has had an agricultural vocation (vocación agraria) since the decades of the 1930s, 1940s, and 1950s, without any land-use change (cambio de uso de suelo); it therefore cannot be said that ecological possession (posesión ecológica) has not been exercised, when the land is currently devoted to natural regeneration and to the use to which it was put more than 50 years ago. The exhaustive judicial inspection indicates that the property is currently used partly for agriculture and partly for natural regeneration by decision of its titleholders, as is also stated in the land-use study. This demonstrates an exercise of possession that safeguards soil and forest resources, consistent with the principles of sustainable development in human activities affecting the environment. For the reasons stated, the second numbered contention—that the procedures established by the Ley de Informaciones Posesorias and applicable to area corrections were not followed—is rejected, because this Court’s review confirmed full compliance with those procedures. The judgment also contained a broader and thorough analysis and was not limited merely to establishing that the current boundaries had not been altered. The testimony concerning the acts of possession (actos posesorios), their nature and age, and the chain of possession was thoroughly verified by the judge who conducted the hearing, as reflected in the audio recordings preserving those testimonies, as was the absence of acts harmful to the natural resources present, consistent with what was observed during the judicial inspection.

VI- The appellant (recurrente) states that the dates cited by the witnesses regarding [Nombre5]’s acquisition of the land do not coincide, since she acquired it from [Nombre6] in 1984, while the petitioners were not awarded it until 2001. She objects that the witness [Nombre7] testified that the petitioners had acquired it 55 years earlier (that is, in 1958); the witness [Nombre8] testified that [Nombre5] had acquired it 40 years earlier (that is, in 1973); and the witness [Nombre9] made no reference to the length of possession of each transferor. Listening to each witness’s testimony does not support the appellant’s assertion in this regard. Indeed, [Nombre9] stated in his testimony that he was 76 years and four months old and had known the land for 60 years, since he was 16 years old (that is, since 1953). He explained that he had been told that [Nombre13] was the owner of the property, but he did not know her.

Subsequently, it was acquired by [Nombre6], whom he did know and whom he personally helped on the land. That person held it for many years. He stated that he worked continuously with [Nombre6] for 14 years, left for a time to work elsewhere, and then returned. The farm consisted of pastureland, and coffee began to be planted in sections. He explained that, after [Nombre6], the farm was donated to [Nombre2]’s mother, Mrs. [Nombre14], who was his daughter and whose surnames he believes were [Nombre10]. When asked about the exact duration of the possession (posesión), he answered that it had been many years. He knows that she transferred the farm to her children, [Nombre1] and [Nombre2], who have possessed it for many years, which he estimated at approximately 25 years. He explained that when Mrs. [Nombre5] acquired it, the farm was worked by her husband, [Nombre15], while she performed domestic duties, and the father also brought his children—the petitioners—to work there.

He expressly stated that the farm had always been fenced along the same boundaries by which it is currently delimited. The possessory chain (cadena posesoria) begins with Urbino, who donated it to his daughter [Nombre5]. She, in turn, transferred it to her children [Nombre2] and [Nombre1]. Regarding bodies of water, he described a small stream whose banks remain protected by trees of various species native to the area. He personally observed poró and cuajiniquil trees used to shade the coffee. He stated that he had never become aware of any disputes with third parties or adjoining landowners over possession of that land and that it had never been abandoned. They had always worked it. The community recognizes [Nombre1] and [Nombre2] as the owners of that farm. This testimony establishes the continuous exercise of possession by the aforementioned members of that family group. The property was never abandoned and has retained the same area it currently has, as represented in the survey plan (plano) serving as the basis for this proceeding. [Nombre8] testified to the same effect, stating that he was 70 years old and had known the property (fundo) for as long as he could remember.

Its first owner was [Nombre13], who sold it to [Nombre6] approximately 60 years ago. He then donated it to [Nombre14]’s mother less than 40 years ago. The property was worked by her husband. It was later transferred to [Nombre2] and [Nombre1], although he does not clearly remember when. The farm had been worked by her husband, who died, and she thereafter transferred it to her children. The farm has retained the same fenced boundaries and the same size. Regarding the body of water, he stated that it exists and is protected. There are avocado trees, but he does not remember the others. As with the previous witness, he stated that there had never been any disputes over the farm, that everyone knew who its owners had been, that it had never been abandoned, and that it remained in use and was maintained. This likewise demonstrates the same possessory chain within that family unit from 1943 to the present.

As relevant here, the witness [Nombre7] testified that he was 85 years old, had known the farm since childhood, and, from an early age, had worked on his father’s farm and observed [Nombre6] acting as possessor. He gave it to his daughter [Nombre16], the mother of [Nombre2] and [Nombre1]. He did not specify exactly when [Nombre6] transferred it to [Nombre5]. [Nombre5] transferred it to her children. He stated that he became aware that it belonged to them when he was approximately thirty years old. He described the same possessory chain within that family unit and the chronological succession of its owners. He likewise described the body of water and its protection, the existence of agriculture as an activity, and the trees. Upon listening to this testimony and considering it together with the two previously mentioned testimonies, it can be determined that the discrepancies concerning exact dates do not disprove that the property has remained under the continuous possession of the family of [Nombre2] and [Nombre1], who currently possess it, and previously of their mother, [Nombre5], and their grandfather, [Nombre6].

There is no contradiction whatsoever regarding the possessors and owners of this registered farm, and the witnesses’ inability to provide identical exact dates for each person is attributable to the fact that they all belonged to the same family group and that succession of title (titularidad) is not readily apparent to third parties, even those close to the family. Regarding exact agreement on dates and the description of the possession exercised by each person who appeared as a possessor in the capacity of owner, what matters is that the property’s subjection to legally sufficient possession by private individuals can be established, particularly because the testimony describes periods and events spanning 7, 8, and 6 decades. It is logical that, after so much time, establishing exact dates becomes increasingly difficult, notwithstanding the appellant’s demand for them. The ground of appeal (agravio) alleging that the deficiencies in the testimony were overlooked by attributing them to the witnesses’ advanced age is rejected.

Although they are elderly persons, the issue is not their age as such, but rather that a great many years have passed, making it understandable that they cannot specify exact details as the appellant alleges. In view of the witnesses’ statements concerning the possessory chain and its duration with respect to this registered land, this Court finds that the continuous exercise of title and possession from 1943 to the present has been established for the persons who, in the chronological order stated, possessed the property as male and female owners according to the Registro Nacional, with an area greater than that reflected in the registry entry. Such possession was uninterrupted. Regarding the precision of dates for the possessors of an unregistered property, the Tribunal Agrario has held: “Furthermore, it is important to note that witnesses need not be so precise regarding the exact dates of possession of each transferor, nor must they know all of them, especially in cases such as this one, in which the property has had so many owners, because what matters is that there be some reference to the persons associated with the exercise of possession throughout all those years and to the measures being taken to protect the forest resource, given the requirements imposed by Article 7 of the Ley de Informaciones Posesorias, as well as to the proper use of the land in accordance with the certification at folio 179, among other legal requirements that have not been challenged by the appellant.-” (decision N. 874-F-08).

This criterion has been maintained in subsequent decisions and is shared by this Chamber. What matters for determining whether title registration (titulación) or rectification of area (rectificación de medida) is appropriate for land located within protected wildlife areas (áreas silvestres protegidas) or subject to some special condition is the knowledge that the witnesses can establish concerning the property, the sufficient age of the possessory chain, and the acts carried out on the property. This Court notes that this witness’s testimony establishes facts dating from at least 1943 onward. Nor is the ground of appeal asserting that the 1984 deed by which [Nombre6] transferred the farm to his daughter did not mention any excess area (demasía) persuasive, because such a reference is not a legal requirement for recognizing it, and the witnesses reliably establish that the farm has remained the same from at least 1943—which one of them personally recalls—to the present. The grounds of appeal are rejected.

VII- The objection that 1926 must be the year from which the period of possession (plazo posesorio) is calculated is rejected. According to the appellant, the property falls under the provisions of the Ley de Aguas, Ley de Tierras y Colonización, former Ley de Terrenos Baldíos, and Código Fiscal. First, the judicial inspection identified a rill (yurro), or protected stream, from which no water is being collected to supply any population. The appellant states that there is a report from the Instituto Costarricense de Acueductos y Alcantarillados, submitted in proceeding EXPN1, which indicated that the water resource (recurso hídrico) it contains should be reserved to supply the populations of Piedemonte, in [Dirección6]. She thus invokes Article 7(c) of the Ley de Tierras y Colonización, already regulated in the Código Fiscal de 1926 of 1926, as well as the Ley General de Terrenos Baldíos de 1939, Article 31 of Ley de Aguas No. 276 of August 27, 1942, and Article 2 of Ley General de Agua Potable, No. 1634 de 1953, which reiterates the public-domain status of land necessary for an adequate drinking-water supply.

That claim of error is unavailing because the 2004 report expressly states that there are no water uses, intake facilities, or concessions. The document indicates that this stream is part of a hydrological microsystem of Río Limón. That is the body of water from which water is collected elsewhere to supply populations. From its reading of the report, this Chamber understands that it is that body of water which must be reserved to supply populations. (report submitted at images 148 and 149 of the electronic case file). In addition, in this proceeding another report was requested from the Departamento de Cuencas Hidrográficas to state whether the rill depicted on plan SJ- 1413821-2010 supplies drinking water to any population or should be reserved. (image 202 of the digital case file in PDF format). The competent entity replied in official letter No. SUB-G-AID-UEN-AMB-2014-1571 of November 18, 2014 (images 209 and 210 of the case file in PDF format), stating that there are currently no uses, intake sites, or water-supply intakes associated with the rill that runs through the property.

It added that the property is located in the recharge area of Río Limón, from which the Instituto Costarricense de Acueductos y Alcantarillados collects water six hundred meters downstream to supply the Llanos de Alajuelita system. It also noted the existence of intake facilities belonging to the ASADAS of Poás de Aserrí and [Dirección7], located more than 800 meters from the property for which title is sought. As was concluded in the judgment under appeal, the intake facility is located on other properties and not on the rill that crosses the property. For this Chamber, in this particular case the public-domain regime does not apply to the rill in question: Article 7(c) of the Ley de Tierras Colonización establishes the public-domain status (demanialidad) of lands containing springs from which a population is supplied or which should be reserved for that purpose, together with a strip extending two hundred meters on each side.

Nor should Article 31 of the Ley de Aguas be applied, as it designates as a public zone a radius of no less than two hundred meters on lands surrounding intake sites or drinking-water supply intakes. As explained, in this case the body of water is not a spring (naciente), or water spring (manantial), from which water is collected to supply populations or which should be reserved for that purpose. It does not fall within the circumstances established in the provisions invoked by the appellant. This Chamber concurs with the relevant conclusions set forth in the judgment under appeal, which states that there is no intake site on the property, but rather that it is located far away. Regarding report DGA-RH2004-508 issued in the prior, rejected area-correction proceeding, this Court notes that it certified at that time that there were no concessions or intake facilities associated with the rill (image 156 in PDF format).

Furthermore, in response to the question whether it was important to reserve the water resource to supply rural populations, it stated that the property was located on the northeastern slope of Cerros de Escazú and that the land forms part of the Río Limón micro-watershed. That river, in turn, is part of the complex hydrological system of the Tiribí, Virilla, and Grande de Tárcoles rivers. The technical document adds that the property whose area is to be corrected is crossed in its southern sector by a rill that runs parallel to the southern boundary and forms part of the hydrological microsystem (upper section) of Río Limón; referring to Río Limón, it explains that water is collected from it at two different sites to supply the locality of El Llano de Alajuelita and another sector of Alajuelita as well. The report then details what it describes as certain characteristics of the two uses of Río Limón held by Acueductos y Alcantarillados, including their locations by degrees of latitude and longitude.

It states: Therefore, it is necessary to protect, reserve, and safeguard the surface and groundwater resources produced and occurring in that area, specifically where the property subject to possessory-information proceedings (información posesoria) is located, for the purpose of supplying drinking water to urban and peri-urban sectors of Alajuelita. It likewise states: “D. CONCLUSIONS.-THERE ARE NO WATER CONCESSIONS TO PRIVATE PARTIES. - THERE ARE NO WATER INTAKE FACILITIES FOR RURAL COMMUNITIES WITHIN THE PROPERTY BOUNDARIES. - THE PROPERTY IS CROSSED BY A RILL OR MICROCHANNEL THAT FORMS PART OF THE HYDROLOGICAL MICROSYSTEM OF RIO LIMON, FROM WHICH ACUEDUCTOS Y ALCANTARILTADOS COLLECTS AND DIVERTS WATER AT TWO SITES. AS DETAILED ABOVE, THIS IS DONE TO PROVIDE DRINKING WATER TO EL LIANO DE ALAJUELITA AND SECTORS OF ALAJUELITA. E. RECOMMENDATIONS. CONTINUE THE POSSESSORY-INFORMATION PROCEEDING.

PROTECT THE RESPECTIVE BANKS OF THE MICROCHANNEL OR RILL THAT CROSSES THE PROPERTY FROM WEST TO EAST, PARALLEL TO [Dirección8]. AS INDICATED AND REQUIRED BY THE ENVIRONMENTAL LEGISLATION IN FORCE. AYA CONSIDERS IT NECESSARY TO RESERVE THE WATER TO SUPPLY THE VARIOUS COMMUNITIES AND POPULATIONS LOCATED IN THE NORTHEASTERN FOOTHILLS OF CERROS DE ESCAZU.” (boldface does not appear in the original). This Chamber understands the report to establish for the record that there are no intake facilities, developed springs, or concessions within the registered property whose area is sought to be corrected. It further explains that the banks of the rill must be protected and that the rill forms part of the network of bodies of water of Río Limón, from which water is collected in another sector. It states that the proceeding should continue and that it is necessary to reserve the water for supply purposes (images 144 through 149 of the case file in PDF format).

A judicial inspection was conducted in this proceeding, recording that the stream is duly protected by plant and tree cover (minutes at image 182 and in the safeguarded audio forming part of the case file). This corroborates that possession is exercised in a manner that protects the water resource of the rill located in the southern sector of the registered property. A new study was requested from the Instituto Costarricense de Acueductos y Alcantarillados in this proceeding, and official letter SUB-G-AID-UEN-AMB-2014-1571 (image 209 of the case file in PDF format) stated, insofar as relevant: “For the lnstituto Costarricense de Acueductos y Alcantarillados, it is of the utmost importance to ensure the protection and conservation of surface water and groundwater having the potential to supply populations. The Dirección de Acueductos Rurales del AyA was consulted, and memorandum SUB-G-GSC-UEN-AP-EBD- 2O14-1213, dated 16/10/14, states that surface-water uses belonging to the ASADAS of Poás de Aserrí and [Dirección9] are located near the property.

Field verification is recommended. Attached. The indicated intake facilities are located more than 800 m southeast of the property, with no relationship whatsoever between them. According to the analysis conducted using our information system concerning water uses for supplying populations, there is currently no such use within the property identified in case file N O9-000062-0689-AG.” It may be inferred from this document that there are no intake facilities within the property whose area is to be corrected, and that the intake site on Río Limón, from which water is indeed collected in two sectors, is located more than 800 meters southeast of the petitioner’s property. What exists is a rill that feeds Río Limón, which is the body of water from which water is collected at a distance of 600 and 800 meters. Consequently, the legal circumstances contemplated by Articles 31(a) and 32 of the Ley de Aguas concerning the encumbrance of areas within a radius of no less than 200 meters do not exist.

If the appellant’s argument were accepted, given that the rivers of the national territory form part of an interconnected hydrological system and repeatedly flow into other rivers that form part of the watersheds covering the entire national territory, and that water is collected from most of those rivers in some geographic sector, all lands containing bodies of water would be subject to the public-domain conditions she alleges because they contain rills or rivers that feed other rivers from which water is ultimately collected. Without any flow study by the state entity, the appellant thus seeks to place within the public domain the entire territory containing bodies of water, on the ground that they feed those that are used to collect water resources in the watersheds. In this Court’s view, this exceeds the purpose of the statutory provisions cited above regarding the placement within the public domain (demanialización) of lands surrounding water intake sites or supply intakes, forest zones protecting lands where drinking water infiltrates, and lands containing watersheds and reservoir margins, water-supply sources, or permanent watercourses.

The right to water and its protection are guaranteed in this case. Here, the duty of those who have possessed the property is to protect the protection area (área de protección) of the rill in accordance with Article 33 of the Ley Forestal, and compliance with that duty was confirmed during the judicial inspection, which expressly described it, and by the referenced witnesses, who so testified. In this regard, it should be noted that the entire country is divided according to the watershed criterion, as follows: “According to the delineation performed, the country is divided into 34 watersheds, named as follows: 1. Río Sixaola (Costa Rican portion), 2. Río La Estrella, 3. Río Banano, 4. Río Bananito and others, 5. Río Moín and others, 6. Río Matina, 7. Río Madre de Dios and Others, 8. Río Pacuare, 9. Ríos Reventazón and Parismina, 10. Río Tortuguero and others, 11. Río Chirripó, 12. Río Sarapiquí, 13.

Río Cureña, 14. Río San Carlos, 15. Río Pocosol, 16. Río Frío, 17. Río Zapote and others, 18. Ríos Península de Nicoya and Costa Norte, 19. Río Tempisque 20. Río Bebedero, 21. Río Abangares and others, 22. Río Barranca, 23. Río [Nombre15] María, 24. Río Grande de Tárcoles, 25. Río Tusubres and others 26. Río Parrita, 27. Río Damas and others, 28. Río Naranjo, 29. Río Savegre, 30. Río Barú and others, 31. Río Grande de Térraba and others, 32. Ríos Península de Osa, 33. Río Esquinas and others, 34. Río CED8). These cover the entirety of the national territory. For its part, the Reglamento a la Ley de Uso, Manejo y Conservación de Suelos, decreto Nº 29375 MAG-MINAE-S-HACIENDA-MOPT, defines the following in Article 6: “Aquifer recharge areas (áreas de recarga acuífera). Land surfaces on which most water infiltration through the Earth’s crust occurs, feeding aquifers and river channels.” That same provision establishes: “Watershed (cuenca hidrográfica).

It is the geographical area whose surface waters drain into a common drainage system or hydrological network, in turn converging into a larger channel that may discharge into a main river, lake, swamp, marsh, reservoir, or directly into the sea. It is bounded by the watershed divide (línea divisoria de aguas) and may constitute a unit for the comprehensive planning of socioeconomic development and the use and conservation of water, soil, [Nombre5], and wildlife resources.” In the same vein, a hydrographic sub-basin (subcuenca hidrográfica) is classified as: “Each of the smaller basins belonging to the same drainage system or main basin.” As can be seen, these are technical concepts relating to the complex hydrological system existing within the national territory, and on the land where those basins are located there are properties devoted to various kinds of human activities. It should be noted that the Comisión Nacional de Emergencias has defined: “1.3 Current approach to basin programs.

Costa Rica has adopted the three categories used in most Latin American countries: basin, sub-basin, and micro-basin. A basin is considered the entire catchment area of a river; a sub-basin is a drainage unit smaller in area than a basin, of which it forms part and constitutes a tributary. In Costa Rica, those occupying an area of approximately 4000 to 5000 ha may be considered sub-basins. A micro-basin is the smallest territorial drainage unit within a basin and a tributary of a sub-basin. In Costa Rica, areas occupying less than 1000 ha are considered micro-basins. As can be seen, the concept in Article 31(b) of the Water Law (Ley de Aguas) declares the following to be reserved to State ownership (reserva de dominio a favor del Estado): “The forest area that protects or must protect the group of lands where drinking water infiltrates, as well as those containing hydrographic basins and the banks of reservoirs, water-supplying springs, or permanent watercourses.” It is considered that, for it to qualify as public-domain property (bien demanial), there must at least be a declaration identifying the areas encompassed within the basin network.

The foregoing follows from section 94 of the Regulations to the Ley Forestal, which provides, insofar as relevant: “Article 94: The designation of an aquifer recharge area (área de recarga acuífera) must be determined on a case-by-case basis and for each particular area, based on technical studies determining the direction of the [Dirección10] and the importance of the aquifer for human consumption.” In this regard, see judgment 319-F-2004 of the Sala Primera de la Corte Suprema de Justicia). For the reasons stated, the claim of error (agravio) in this regard is rejected. It should be noted that the corrected property will be subject to the restrictions imposed by the Ley de Aguas and the Ley General de Caminos Públicos, pursuant to article 19 of the Ley de Informaciones Posesorias. The scope of those restrictions regarding areas reserved to State ownership is analyzed below.

VIII- In this case, the matter concerns a correction of area measurement (rectificación de medida) of a parcel of land that was first recorded, without a survey plan, in 1887. This is not an unregistered property. The witnesses established that the property has physically maintained the same area, and that the portion not reflected in its registry entry when the property was first recorded is, for that reason, part of the unit; in reality, however, it has remained in the possession of those who have been its registered owners. Furthermore, although the State’s representative made the allegations cited supra in this correction proceeding, the State did not initiate opposition proceedings pursuant to Article 8 of the Ley de Informaciones Posesorias, although it was free to do so. Under those circumstances, it bears noting that Article 72 of the Ley de Aguas provides that judges responsible for issuing title to vacant or untitled lands must make the corresponding reservation regarding waters, alluvium deposits, or channels and beds of waters in the public domain, recording it in the adjudication judgment, and that the Public Registry must take note of the national reservations.

Omission of that requirement confers no resulting right whatsoever upon the claimant or possessor of the property. For its part, Article 7 of the Ley de Caminos Públicos provided: “Article 7.- For the construction of public roads, the State shall be entitled to use, without any compensation: a) The percentages designated as a reservation for that purpose in properties recorded or pending recordation in the Public Registry; and b) Up to twelve percent (12%) of the area of lands subsequently granted by the State or Municipalities by way of concession, land exchange, vacant lands, gratuitous grants, agricultural colonies, allotment of parcels on vacant lands, and any other rights or concessions granted by the State for any other reason involving national vacant lands. This reservation may be applied at any time to roads of any kind no more than twenty meters wide, to the development of hydroelectric power, to the passage of telegraph or telephone lines, to the construction of bridges, or to the use of watercourses necessary for supplying communities, watering livestock, irrigation, or any other public-purpose use.

Such restrictions and encumbrances shall attach to the recordation of the affected property, and the official responsible for executing the deed or signing the recordable writ shall be required to place them on record. The Public Registry shall not record the title unless those restrictions and encumbrances are stated therein.” That provision cites the following: “By Resolution N° 16629 of November 28, 2012, the Constitutional Chamber held that the preceding subsection is constitutional, provided it is interpreted to mean that the absence of compensation refers solely to the value of the strip or portion of land reserved by the State by reason of its original public-domain ownership.)” (source: Sinalevi). That constitutional consultation states: “For purposes of resolving this consultation, it must be clarified that the Chamber proceeds from the premise that real property not brought into private ownership belongs to the State, as expressly provided by Article 486 of the Civil Code.

Thus, the legal system has established a presumption in favor of the State, to the effect that it owns all real property not brought into private ownership. All of the foregoing is consistent with Article 11 of the Ley de Tierras y Colonización, which provides that ‘Until proven otherwise, the following belong to the State as national reserves: …b) Those not protected by ten-year possession.’ It is therefore more than evident that real property subsequently recorded through a possessory information proceeding (información posesoria) is subject to the reservation in favor of the State. Although this allows title to be obtained in order to guarantee access to agricultural property, the legislature has also made clear that such property remains subject to purposes of general public utility. Consequently, there is no real property capable of being categorized as ‘res nullius,’ because anything not brought into private ownership belongs to the State.

Among other practical effects, this presumption gives rise to the obligation, in proceedings to obtain title to land through a possessory information proceeding, to include as parties at least the Procuraduría General de la República, in its capacity as the State’s representative, and the Instituto de Desarrollo Agrario, as the body responsible for administering public agricultural property. The aforementioned provision therefore gives rise to an original State ownership predating any holding by private parties. This characteristic authorizes the State to impose special conditions for acquisitive prescription (usucapión), such as the public-domain reservation at issue here. Thus, when the State allows a private party to acquire real property by prescription, it does so on the understanding that a 12% portion is allocated to the public domain and is not subject to prescription.” This Chamber finds that the case under review concerns lands subject to the cited reservations, which the State retains despite their having been recorded and being under private possession. The ground of appeal is rejected.

IX- With respect to the land-tenure regime (régimen de tenencia de la tierra) in protected wild areas (áreas silvestres protegidas), it must be stated that, regardless of their management category, they must be understood as areas subject to a particular and specific administrative and regulatory regime, governed by management plans that ensure the protection, conservation, and rational use of natural resources. Their administration, management, and protection fall to MINAET, unless a special Law provides otherwise. Article 58 of the Ley de Biodiversidad defines them as delimited geographical areas consisting of land, wetlands, and portions of the sea, declared as such because they are of special significance and because there is an interest in protecting and conserving the environment and its ecosystems, as well as their historical and cultural features. This provision expressly refers to the Ley Orgánica del Ambiente with respect to regulation of the requirements and mechanisms for establishing or reducing these areas.

By Law, their administration falls exclusively to the Ministerio de Ambiente, Energía y Telecomunicaciones, except in the case of Natural Monuments. For its part, the Ley Forestal provides that when a State-owned protected wild area is declared, it must immediately become part of the State’s natural heritage (patrimonio natural del Estado), regulated by Article 13 of that statute, which expressly provides that its administration is the responsibility of MINAET. This body of law must be interpreted together with the provisions of Article 58 in fine of the Ley de Biodiversidad, which recognizes rights acquired by indigenous and rural populations and by natural or legal persons over lands declared to be protected wild areas and their management categories. This is supplemented by Article 7 of the Ley de Informaciones Posesorias, which states: “When the property addressed by the possessory information proceeding lies within a protected wild area, regardless of its management category, the applicant for title must demonstrate that he or she holds legal rights based on ten-year possession, exercised for at least ten years before the effective date of the law or decree that created that protected wild area.” In this case, the chain of possession from 1943 onward has been verified with respect to the property recorded since 1887, as exercised over the area shown in the survey plan underlying this proceeding; accordingly, the registered owners’ property right must be understood to support the request for correction of area measurement.

In this regard, the Constitutional Chamber of the Corte Suprema de Justicia, in decision 144-96- issued at 16:51 on January 9, 1996, held: “When forest reserves, protective zones, and national wildlife refuges are established, the owner is given the option of retaining the land because, by following the management plan, the owner may continue using it for economic purposes; that is, the restrictions imposed are not of such magnitude as to prevent the owner from exploiting the property and therefore do not nullify the owner’s right.” In this particular case, the exercise of ecological possession (posesión ecológica) was demonstrated in light of the soil study, the judicial inspection conducted for that purpose by the judge, and the testimony analyzed. (In this regard, see decisions 5-F-16 and 21-F-16 of this Court.) The ground of appeal concerning the consideration of laws dating from long ago when deciding these proceedings is therefore rejected because, as analyzed supra, this is a property recorded since the ninth century, and the requirement of Article 6 of the Ley de Informaciones Posesorias concerning proof of legally sufficient possession over the entire current area is deemed satisfied.

Such proof is supplemented by the land-use study (estudio de uso de suelos) and the judicial inspection conducted by the trial court, as analyzed above. In this case, the water resource of the stream (yurro) running through the land has not been harmed; instead, efforts have been made to conserve and protect it through observance of the protection area (área de protección) in accordance with the current Ley Forestal. Furthermore, pursuant to Articles 13 and 14 of the Ley de Informaciones Posesorias, the registered owner of a property is permitted to use the possessory information proceeding to demonstrate an increase in area exceeding the percentages stipulated in Article 13 ibídem. This is the legal solution provided by the legal system for situations such as the present one, in which part of the physical area of a recorded property has permanently remained part of that property. The area physically existing on the land has therefore been maintained at least since the 1940s, according to the witnesses in this proceeding; moreover, the property was recorded in 1887, contains no forests, and its land use (uso del suelo) has not been changed.

In addition to the verified conservation of the stream’s protection areas, the collection sites are located at [Dirección11], according to the judicial inspection and the reports of the Instituto Costarricense de Acueductos y Alcantarillados.

X- For the reasons set forth, it is concluded that, in compliance with the requirements of the Ley de Informaciones Posesorias, the Civil Code, the Ley de Manejo, Uso y Conservación de Suelos and its Regulations, and the Ley Forestal, the judgment under appeal must be affirmed and the correction-of-area-measurement proceeding concerning the recorded property must be approved. It is ordered that the property shall remain subject to the national reservations established in Article 72 of the Ley de Aguas and Article 7 of the Ley General de Caminos Públicos.

XI- DISSENTING OPINION OF JUDGE [Nombre17]: DISSENTING OPINION OF JUDGE [Nombre17]: I disagree with the majority’s decision to approve the rectification of area (rectificación de medida) requested by the applicant, essentially for two reasons: 1) The proposed rectification exceeds the original registered area sought to be corrected by more than 50%, and an area cannot be corrected beyond that percentage pursuant to Article 13 of the Ley de Informaciones Posesorias. The original registered area is ten thousand four hundred eighty-three square meters and forty-four square decimeters, and through these proceedings it is sought to increase the area to thirty-two thousand eighty-five square meters and forty square decimeters, that is, approximately 200% of the original property, in contravention of the 50% limit on increases in area established in the aforementioned Article 13. 2) The land being registered through the rectification of area is important for supplying water to two communities, as may be inferred from the reports issued by Acueductos y Alcantarillados and prepared by Engineers [Nombre18] and [Nombre19]; therefore, based on Article 7 of the Ley de Tierras y Colonización, which, in referring to State Assets (Patrimonio del Estado), provides that land that should be reserved to supply water to a community is in the public domain (dominio público), as is the case under review.

In possessory information proceedings (informaciones posesorias) and rectifications of area, it is evident from Articles 45 and 50 of the Constitución Política that judges are required to ensure that the title eligible for registration (título inscribible) in the Registro Público provides information aimed at generating the greatest well-being for all inhabitants of the country, promoting agricultural and agro-environmental production; encouraging the conservation and preservation of a healthy and ecologically balanced environment; and preventing harm that could affect future generations. In addition, the importance of judges ensuring that citizens and society have access to the environmental information they require or request, including information held by judicial bodies, is established. When possessory information proceedings and rectification-of-area proceedings are processed, the decision to be registered or corrected in the corresponding registry must provide the general public with accurate and transparent information.

Accordingly, it is important that everything concerning water resources (recurso hídrico), and potentially sources of drinking-water supply for communities, be clear and accurate. The supply of drinking water is a right to which all men and women must have access. This issue has been addressed by the Sala Constitucional de la Corte Suprema de Justicia as follows: “III.- Fundamental right to drinking water. In its case law, this Court has recognized that the rights to health and life are fundamental human rights that depend—to a large extent—on access to drinking water, and that the competent bodies have the inescapable responsibility to ensure that society as a whole does not see those rights diminished...” (decision Nº18633 of 21 December 2007) (decision 725 of 15 June 2012 of the Tribunal Agrario). In light of the foregoing, the land at issue in these proceedings should have been reserved as public domain and should not have passed into the sphere of private ownership (dominio privado) registered in the Registro Público; the rectification-of-area proceedings should therefore have been dismissed.

POR TANTO:

VOTO N° 837-F-18 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las quince horas y treinta y cuatro minutos del treinta de agosto de dos mil dieciocho.- RECTIFICACIÓN DE MEDIDA promovida por [Nombre1] , mayor, casado, conserje, cédula de identidad número CED1 - - ; y [Nombre2] , mayor, soltero, agricultor, cédula de identidad número CED2 - - ; ambos vecinos de El Llano de San Antonio de Alajuelita. Intervienen en el proceso, la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Susana Fallas Cubero, mayor, abogada, vecina de Puntarenas, cédula de identidad número CED3 - - , en su condición de procuradora adjunta; y el INSTITUTO DE DESARROLLO RURAL, cédula jurídica CED4 - - - , representado por Marjorie Mayela Madrigal Muñoz, mayor, casada, abogada, vecina de Alajuela, cédula de identidad número CED5 - - , en condición de presidenta ejecutiva con facultades de apoderada generalísima sin límite de suma. Actúa como abogada directora de los promoventes, la licenciada Aymará Fernández Madrid, carné nueve mil seiscientos cincuenta y uno. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de San José, con sede en Goicoechea.-

RESULTANDO:

  1. 1Los promoventes solicitan por medio de este proceso, la rectificación de la medida de la finca de su propiedad matrícula [Placa1] , la cual según el Registro Público de la Propiedad tiene una medida de diez mil cuatrocientos ochenta y tres metros con cuarenta y cuatro decímetros cuadrados, pero que de acuerdo al plano catastrado [Placa2] -2010; tiene una medida de tres hectáreas mil ciento ocho metros cuadrados," (Ver Escritorio Virtual del Juzgado Agrario de Goicoechea, en Bandeja de Escritos, archivo 6/2/13 de las 2:52:38 p.m., imágenes 1 a 3).-
  2. 2La Procuraduría General de la República se apersonó al proceso en los términos que corren en escrito incorporado al escritorio virtual, archivo del 23/4/13 de las 2:59:04 p.m.; a su vez el Instituto de Desarrollo Rural lo hizo en los términos que corren en el archivo del 7/5/13 de las 1:47:53 p.m., (Ver Escritorio Virtual del Juzgado Agrario de Goicoechea en Bandeja de Escritos).-
  3. 3La Jueza Vanessa Fisher González, del Juzgado Agrario del Segundo Circuito Judicial de San José, mediante sentencia número 2018000097 de las quince horas y seis minutos del once de julio de dos mil dieciocho, resolvió: “POR TANTO: De acuerdo a lo expuesto y citas de ley SE APRUEBAN LAS PRESENTES DILIGENCIAS DE RECTIFICACIÓN DE MEDIDA, establecidas por [Nombre1] , mayor, casado una vez, conserje, cédula CED6 y [Nombre2] , mayor, soltero, agricultor, cédula CED7; ambos vecinos de El Llano de San Antonio de Alajuelita [Dirección1] . En consecuencia proceda el Registro Público, Propiedad Inmueble sin perjuicio de tercero de mejor derecho a RECTIFICAR LA MEDIDA de la finca inscrita al Partido de San José, matrícula matrícula [Placa1] , que es terreno en parte de agricultura y en otra de regeneración natural, sito en Pozo Azul, [Dirección2] , Cantón Décimo Alajuelita de la Provincia de San José, linda al norte con [Nombre3] ; al sur con [Nombre4] ; al este Urbano Calderón Sandí y [Dirección3] con un frente de ciento siete metros con noventa y ocho centímetros lineales y al oeste con [Nombre4] ; descrita en el plano catastrado [Placa2] -2010; para que se consigne su verdadera medida de TRES HECTÁREAS MIL CIENTO OCHO METROS CUADRADOS.La finca citada fue estimada en la suma de CINCO MILLONES DE COLONES. De conformidad con el artículo 13 de la Ley de Informaciones Posesorias la presente rectificación no perjudicará a tercero durante los tres años posteriores a la inscripción.- El área contigua al yurro que atraviesa el inmueble, de conformidad con el artículo 33, inciso b) de la Ley Forestal No. 7575 constituye área de protección y queda prohibida la corta o eliminación de árboles, asimismo se hace constar que el cauce y las aguas de esa corriente son de dominio público conforme a la Ley de Aguas. El edicto relativo salió publicado en el Boletín Judicial No. 61 del 27 de marzo del 2013. Firme esta

resolución expídase la certificación respectiva," (Ver Escritorio Virtual del Juzgado Agrario de Goicoechea, en Documentos Asociados, archivo 11/7/18 de las 15:06:30 p.m.).-

  1. 4La licenciada Susana Fallas Cubero, en su condición de procuradora adjunta, formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia, (Ver Escritorio Virtual del Juzgado Agrario de Goicoechea, en Bandeja de Escritos, archivo 18/7/18 de las 3:09:57 p.m.).-

5. En la substanciación del proceso se ha observado las prescripciones legales, y no se da la existencia de errores u omisiones en el fallo capaces de producir su nulidad.- Redacta la jueza Castro García,y;

CONSIDERANDO

I. Este Tribunal avala el elenco de hechos tenidos por probados en el fallo recurrido.-

II- La representante del Estado, apela la sentencia No. 2018000097 de 15 horas 6 minutos del 11 de julio del 2018, exponiendo los motivos de disconformidad que a continuación se citan:

  • 1)Ante el mismo despacho de instancia con expediente No. EXPN1, se solicitó la rectificación de la finca por los promoventes. Petición rechazada en sentencia No. 317-2004 de las 10:30 horas del 8 de noviembre del 2004, debido a la falta de demostración del ejercicio de la posesión decenal requerida sobre el terreno, ni fuera ejercida forma continua, pública, pacífica, a título de dueño y de buena fe durante los años anteriores a la creación de la Zona Protectora Cerros de Escazú. Por voto de este Tribunal No. 0099-F-06 de 14: 45 horas del 14 de febrero del 2006 se rechazó el recurso de apelación. En virtud de lo anterior, invoca las sentencias de esta instancia números 723-F-2017, 762-F-17, 771-F-17, donde se resolvió la aplicación de cosa juzgada formal, por haberse resuelto ya una solicitud previa sobre el mismo inmueble de inscripción de información posesoria.
  • 2)Aduce la recurrente, en la sentencia que se apela ahora se consideró que el presente proceso no se trata de una información posesoria, por lo que no resulta equiparable a la rectificación de medida. Al respecto refutó que reiteradamente el Tribunal Agrario ha razonado que los procesos de rectificación deben cumplir a cabalidad los mismos requisitos de los que pretenden inscribir el bien por primera vez. Califica por esa razón de infundado el rechazo de cosa juzgada formal. Agrega al respecto, para rectificar la medida y adicionarla a la finca que fuera inscrita con otra área antes de 1930, los titulantes deben acreditar una posesión decenal y ecológica mediante prueba testimonial (artículos 6 y 7 de la Ley de Informaciones Posesorias) sin que pudiera limitarse a corroborar simplemente que no se hayan modificado los límites; como se realizó en el fallo.
  • 3)Señala, debe ser considerado que en el proceso anterior No. EXPN1 consta el informe No. DGA-RH-2004-508 del Instituto Costarricense de Acueductos y Alcantarillados (copia certificada), donde se consideró necesario reservar el agua que se produce y discurre por el área objeto de este proceso para el abastecimiento de las poblaciones de Piedemonte noreste de los Cerros de Escazú, donde se indicó textualmente: " ( ) LA PROPIEDAD SE SITÚA EN LA LADERA NORESTE DE LOS CERROS DE ESCAZU Y SUS TERRENOS FORMAN PARTE DE LA MICROCUENCA DEL RIO LIMON, EL CUAL A SU VEZ FORMA PARTE Y PERTENECE AL COMPLETO SISTEMA HIDROLOGICO DE LOS RIOS TIRIBI-VIRILLA-GRANDE DE TARCOLES. LA PROPIEDAD ES ATRAVESADA POR EL SECTOR SUR POR UN YURRO FUE SIGUE PARALELO AL lINDERO SUR Y QUE FORMA PARTE DEL MICROSISTEMA HIDROLOGICO".. "( ) POR LO TANTO, SI SE HACE NECESARIO PROTEGER, RESERVAR Y ASEGURAR LOS RECURSOS HIDRICOS SUPERFICIALES Y SUBTERRANEOS QUE SE PRODUCEN Y MANIFIESTAN EN DICHA ZONA Y ESPECIFICAMENTE DONDE SE UBICA LA PROPIEDAD QUE SE ESTA SOMETIENDO A PROCESO DE INFORMACION POSESORIA". Agrega la recurrente, las áreas contiguas a las fuentes proveedoras de agua potable tienen carácter de dominio público acorde con el artículo 7, inciso c), de la Ley de Tierras y Colonización, Código Fiscal de 1926 (artículo 510, inciso 3°) y Ley General sobre Terrenos Baldíos, No. 13 del 10 de enero de 1939 (artículo 7°). Ordinal 31 de la Ley de Aguas No. 276. Señala, la afectación establecida en esas normas no se limita a la naciente o manantial, sino que abarca también sus causes. Por lo que rechaza sea una interpretación extensiva de la Procuraduría, tal y como se indica en el fallo. Sino un imperativo legal que fue rechazado injustificadamente en sentencia. Menciona, el artículo 2° de la Ley General de Agua Potable No. 1634 del 18 de setiembre de 1953, reitera el carácter de dominio público de los terrenos necesarios para un abastecimiento adecuado de agua potable (el articulo 2 inciso h) de la Ley Constitutiva Instituto Costarricense Acueductos y Alcantarillados, Ley No. 2726 del 14 de abril de 1961 que sustituye a los ministerios y municipalidades indicados en la Ley General de Agua Potable por ese Instituto). Esboza al respecto, lo apuntado es una afectación desde al menos 1926, fecha desde la que debía comprobarse la posesión decenal en aras de lograr la incorporación de la demasía al terreno ya inscrito con apenas 1 ha 483.44 metros.
  • 4)Hace ver, existen carencias de la prueba testimonial, con la cual no se demuestra la ocupación previa a esa afectación y tampoco la previa a la creación de la Zona Protectora Cerros de Escazú, (Decreto No. 6112-A, vigente desde el 17 de julio de 1976), donde se sitúa el inmueble. Sobre los testimonios indica, si bien [Nombre5] adquirió el inmueble en 1984 de [Nombre6] Mora, los promoventes no se lo adjudicaron sino hasta el año 2001. Por su parte, el testigo [Nombre7] declaró que los promoventes adquirieron hacía 55 años (es decir en 1958), y el deponente [Nombre8] afirmó que [Nombre5] lo adquirió hace 40 años (lo que nos remonta a 1973). Aduce, el testigo [Nombre9] no hizo referencia al tiempo de posesión de cada uno de los transmitentes. Estima, en la sentencia impugnada se soslaya la deficiencia de los testimonios achacándola a la edad avanzada de los testigos. Pero con la edad que tienen no habría sido posible acreditar la posesión desde antes de 1926, como se requería en este caso. Y el Tribunal Agrario exige la congruencia entre las declaraciones testimoniales, y éstos con los documentos aportados para poder hacer valer la posesión transmitida y tengan credibilidad. Además que los testigos acrediten el tiempo de ocupación de cada transmitente y en este caso ello no fue cumplido. 6) Agravia, en el voto No. 4587 de 15:45 horas del 5 de agosto de 1997, en análisis del artículo 7 de la Ley de Informaciones Posesorias, destacó la importancia de contemplar, en el cálculo del tiempo para la usucapión, la existencia de normas que antaño declararan inalienables los terrenos. 5) Otro reproche de disconformidad se dirige a indicar que se pretende ampliar la cabida de la finca al triple del área inscrita en el Registro Público (de 1 ha 483.44 metros cuadrados a 3 ha 1108 metros cuadrados), sin que se demuestre que esas áreas ya estaban comprendidas en una inscripción previa, ni el ejercicio de una posesión decenal anterior a las mismas. Hace hincapié, en la escritura No. 661 de 10 horas del 8 de noviembre de 1984, [Nombre6] vendió a [Nombre5] la finca con la medida y linderos que indica el Registro, sin hacer referencia a demasía alguna (documento incorporado el 08/09/2017 a las 10:45 a.m.). Aspecto no valorado en sentencia, a pesar de haber sido oportunamente señalado por esta representación en nuestro escrito de audiencia del 14 de marzo del 2018.

III- Estas diligencias se formulan con la finalidad de rectificarla cabida registral la finca inscrita en el Registro Público de la Propiedad matrícula [Placa3] derecho 002 y 003. Con área según Registro Público de la Propiedad de diez mil cuatrocientos ochenta y tres metros con cuarenta y cuatro decímetros cuadrados, y según plano catastrado [Placa2] -2010 se refleja medida de tres hectáreas mil ciento ocho metros cuadrados. Finca de naturaleza en parte de agricultura y en otra de regeneración natural. Sito en [Dirección4] , , [Dirección5] Décimo Alajuelita de la provincia de San José. Lo anterior, acorde con lo mencionado en el escrito inicial y memoriales posteriores imagen 43 a 48, 54, 55 y 73), así como el plano aportado (imagen 56 expediente pdf), y la certificación registral (imagen 23) además de lo observado en el reconocimiento judicial (documento fechado 29/08/2013 15:16:43). Dicho bien es parte de área silvestre protegida Zona protectora Cerros de Escazú, según certificación emitida por el Sistema Nacional de Áreas de Conservación aportada.(certificación del SINAC imagen 28 del expediente modo pdf).

Creada por Decreto No. 6112-A del 17 de julio de 1976. (certificación del SINAC imagen 28 del expediente modo pdf). Se ha certificado el ejercicio de la posesión de acuerdo al uso conforme del suelo para la actividad que se realiza de acuerdo a la metodología aprobada. (certificado de uso de suelo imágenes 77 y 78 del expediente electrónico modo pdf) .

IV- Cosa Juzgada Formal. Respecto a este tema se rechaza el agravio en virtud de este caso concreto. De la lectura del voto invocado por la recurrente en el agravio (voto 99-F-06 en imagen 284 a 288 expediente modo pdf.) que se analiza, y la sentencia de primera instancia emitida en el proceso anterior (imagen 273 a 279 expediente modo pdf), se observa que resulta cierto que por esa decisión, se confirmó el rechazo de la rectificación de medida dictada dentro del expediente número EXPN2. Se indica en esa resolución de instancia denegatoria, que concluye no se acreditó la posesión ejercida 10 años antes de la creación de la categoría de manejo que afecto el terreno inscrito, mediante la prueba testimonial aportada en ese expediente. Lo que se apeló alegando la omisión de la valoración de los testimonios de [Nombre10] , [Nombre7] y [Nombre11] . Recurso que se rechaza por haberse presentado de forma extemporánea.

Es decir, no medió un análisis de fondo de aspectos que ahora se reprochan en el recurso de apelación que conoce esta sede dentro del subjúdice, y de los cuales se emitió un extenso análisis de fondo del fallo venido en alzada sobre cada punto alegado por el ente procurador. Los votos que invoca la apelante sobre la aplicación de la cosa juzgada formal entre procesos de información posesoria, corresponden a casos donde se discuten procesos propiamente de información posesoria salvo uno; es decir fincas que carecen de título y que no aparecen como tales en el Registro Nacional. El presente asunto bajo estas particularidades, el voto de mayoría determina que corresponde a la solicitud de rectificación de medida que por la cabida que se solicita aumentar, que no es posible realizarlo vía notarial y el antecedente de la finca inscrita nace en 1887. Motivo por el cual se acude a este procedimiento no contencioso, por así prescribirlo el artículo 13 y 14 de la Ley de Información Posesoria.

Sin embargo la solicitud es diversa. Pues no es se expida titula registrable de un terreno que fuera baldío o sin inscribir, sino la solución jurídica de la situación de la parcela que presenta un área mayor a la registralmente inscrita en 1887 y que en su origen carecío de plano catastrado. Sobre la naturaleza diversa del proceso de rectificación de medida respecto al de información posesoria, vease el voto 808-F-16 de este Tribunal. No se opuso el ente estatal a este proceso en los términos del artículo octavo de la Ley de Informaciones Posesorias. Se rechaza el agravio de la cosa juzgada formal.

V- Respecto a los cuestionamientos de la prueba testimonial, se constata que se recibieron tres testimonios con base en los cuales se tuvo en la sentencia apelada demostrado que sobre el fundo de tres hectáreas mil ciento ocho metros cuadrados, se ha ejercido la posesión agraria, idónea desde hace más de setenta años y que la cabida de la finca se ha mantenido inalterada. Posesión ejercida, mediante actos de agricultura, ganadería ocasional en el pasado y actualmente agricultura de hortalizas en combinación de regeneración natural de áreas de potrero. ( estudio de suelos y reconocimiento judicial). Acreditándose la cadena posesoria de la finca inscrita por todos los testigos primero en [Nombre6] , en forma posterior [Nombre12] , y luego las personas promoventes: actuales titulares registrales y poseedores reconocidos que son sus hijos. Todos del mismo núcleo familiar. Esta Cámara coincide con la conclusión vertida en sentencia, en virtud de la valoración integral de la prueba al tenor del artículo 54 de la Ley de Jurisdicción Agraria.

Sistema que va más allá del arcaico sistema superado de la prueba legal tasada. Lo anterior por demostrarse mediante ese medio probatorio, quienes han sido los dueños excluyentes del fundo inscrito con la cabida que refleja el plano base de esta rectificación, la cadena posesoria ejercida sobre el terreno con esa área que se pide aumentar. Amén de estar la finca inscrita desde 1887 y desarrollarse el dominio en condición de dueños en un periodo mucho mayor a 10 años antes del año 1976; cuando se afecta el terreno con la vigencia de la creación del área silvestre protegida Zona Protectora Cerros de Escazú. Consta en autos que la finca en cuestión se inscribe por primera vez el día 27 de julio de 1887, sin contar con plano catastrados en ese momentos y sin que hubiera sido objeto de rectificación de medida previa. Lo cual se concluye en lo consignado en la certificación registral (imágenes 241 a 242 expediente digital modo pdf).

De la escucha de los testimonios que fueron sometidos a un exhaustivo cuestionarios por el juez de instancia que recibió la prueba, se verifica que [Nombre7] , [Nombre9] y [Nombre8] (audios en expediente digital/documentos/fecha 29/08/2013, horas: 15:20:04, 15:21:05 y 15:10:13) coinciden en las manifestaciones sobre la identificación de la finca dada la permanencia de los mismas colindancias delimitadas con cerca. Testigos que identificaron el área de la finca inscrita en manzanas aproximadas; medida utilizada habitualmente en el pasado por los habitantes del territorio nacional. De tal forma que el primero describió una aproximación de 5 manzanas, el segundo deponente de 7 manzanas y el tercero refiere nuevamente a 5 manzanas. Todos señalan con claridad que las cercas han estado en el mismo sitio y todo ha permanecido igual. Ello conlleva a entender en aplicación de la sana crítica y lógica, no son expertos en el tema de la medición de terrenos, pero si mencionan y les consta que la finca no se ha variado en cuanto sus delimitaciones materiales; que es el punto medular a probar sobre la existencia de esa cabida mayor a la registral en la realidad siempre ha sido parte integral del fundo.

No si les consta la medida exacta; como lo agravia el recurso de apelación. Las inconsistencias apuntadas por la apelante no resultan de recibo en cuanto señalan deben indicar cabidas exactas. La Ley de Informaciones Posesorias exige la demostración de la posesión real mediante la identificación del terreno (articulo 6) aplicable a los procesos de rectificación de medida. En este caso, los testigos son claros en señalar que la propiedad se ha mantenido en las condiciones actuales durante todo el periodo de conocimiento que tienen de la misma; por lo que se deduce se ha mantenido la posesión sobre la cabida que se observó en el reconocimiento judicial que describe cercas de vieja data y la cabida que refleja el plano catastrado base de este proceso. Además, de sus testimonios se deduce que la posesión se ha desplegado sobre un área mayor a la registral, dado el cálculo por manzanas referido de cada uno que se mencionó supra; tal y como se razonó en el fallo.

Por lo que no es de recibo el agravio del recurso que indica no se valoró adecuadamente la prueba en ese aspecto, pues se expuso en la sentencia las razones por las cuales se consideró esas diferencias de cabidas (5 y 7 manzanas) de las que declaran los testigos, no siendo exactas o iguales, se logra acreditar que la finca ha sido la misma. Indica el fallo recurrido al respecto: " Debe de considerarse que todos son adultos mayores, a quienes no es razonable exigir que refieran una medida exacta, pero en definitiva concuerdan que esa finca ha medido más de los diez mil cuatrocientos ochenta y tres metros con cuarenta y cuatro decímetros cuadrados registrales, considerando que la manzana corresponde a siete mil metros cuadrados. Nótese que se trata de una finca que se inscribió desde 1887, según certificación registral aportada en imagen 241, siendo conocido que los métodos de medición de la época no eran los más exactos, y que la finca no tuvo un plano catastrado que la identificara en su orígenes, ni posteriormente (con excepción de los que se han levantado a partir del 2001 para rectificar su área), aspecto que debe de ser especialmente ponderado en este caso.

De igual modo, en el aludido reconocimiento judicial se constató la antiguedad de las cercas. Precisamente la finalidad del artículo 14 de la Ley de Informaciones Posesorias, es dotar de un instrumento de saneamiento del derecho de propiedad, a fin de hacer coincidir la realidad material con la registral, y así garantizar de una forma más plena el ejercicio del derecho y la misma seguridad jurídica." Por otra parte, en relación con el periodo de conocimiento del fundo y posesión de cada uno de los declarantes, se tiene que [Nombre7] manifestó el día en que rindió su declaración (29 de agosto del 2013) que tenía 80 años de conocer el fundo;sea desde 1933. [Nombre9] indicó hacia 60 años; es decir en el año 1953 y [Nombre8] que declara el 02 de setiembre del 2013 conocía el fundo y su titular 70 años antes; correspondiendo al año 1943. La afectación del fundo a categoría de manejo se da en el año 1976, por lo que el conocimiento del ejercicio de la posesión debe datar al menos desde 1966 y en este caso todos los testigos afirman conocer la finca y sus diversos titulares por un periodo mucho mayor al exigido por el artículo 7 de la Ley de Informaciones Posesorias.

Se rechaza el agravio referido a que no se logra demostrar con esa prueba testimonial el plazo necesario de posesión en casos de afectaciones por creación de áreas silvestres protegidas a través de alguna de las categorías de manejo, como en el subjúdice. Cabe destacar que en este asunto la finca es de vocación agraria desde la década de los años 30, 40 y 50 sin que mediara cambio de uso de suelo, por lo que no es posible indicar que no se ha ejercido una posesión ecológica, cuando más bien dedican actualmente el terreno para regeneración natural y el uso al que se destinó hace más de 50 años. Del exhaustivo reconocimiento judicial se indica que actualmente es en parte de agricultura y en otra de regeneración natural por decisión de sus titulares, y así se indica en el estudio de uso de suelos. (audio en expediente digital/documentos/ fecha 29/08/2013 15:16:43 y certificado de uso conforme del suelo en imágenes 77, 78 expediente digital modo pdf).

Lo anterior denota un ejercicio posesorio en resguardo de los recursos suelo y forestal, principios del desarrollo sostenible en las actividades humanas sobre el entorno. Por lo indicado se rechaza el agravio numerado segundo en cuanto se incumplió con los procedimientos de la Ley de Informaciones Posesorias aplicable a las rectificaciones de medida, al constatarse su total cumplimiento de la revisión en esta Instancia. Y que medió en la sentencia un análisis mayor y profundo, sin que se limitara el fallo a la mera constatación de la no modificación de los linderos actuales. La declaración testimonial respecto a los actos posesorios, su naturaleza y antiguedad, así como la cadena posesoria fue profundamente constatada por parte del juzgador que celebró la audiencia, según los audios donde se resguardaron esos testimonios, así como la constatación de la ausencia de actos que lesionen los recursos naturales presentes acorde con lo visualizado en el reconocimiento judicial.

VI- Indica la recurrente, no existe coincidencia en las fechas citadas por los testigos en cuanto la adquisición del terreno respecto a [Nombre5] , cuya adquisición ocurre en 1984 de [Nombre6] y los promoventes se lo adjudicaron hasta el año 2001. Reprocha, el testigo [Nombre7] declaró que los promoventes adquirieron hacía 55 años (es decir en 1958), el deponente [Nombre8] declaró que [Nombre5] lo adquirió hacía 40 años (sea 1973) y el testigo [Nombre9] no hizo referencia al tiempo de posesión de cada uno de los transmitentes. De la escucha de cada testimonio no se extrae lo que señala la recurrente al respecto. Pues [Nombre9] cita en su deposición contaba con 76 años y cuatro meses, y conoce el terreno desde hace 60 años cuando tenía 16 años (sea en 1953). Explicó, le habían indicado que la dueña del inmueble [Nombre13] pero no la conoció. En forma posterior, lo adquiere [Nombre6] a quien sí conoció, y al que él mismo le ayudó en el terreno.

Persona que lo mantuvo por muchos años. Indicó, él trabajó con [Nombre6] por 14 años de forma continua, se retiró por un tiempo a laborar a otro sitio y luego retornó. La finca era de potrero y se comenzó a sembrar café por partes. Detalló, la finca después de [Nombre6] se le donó a la madre de [Nombre2], la señora [Nombre14] que era su hija y cree es de apellidos [Nombre10] . El tiempo exacto de la posesión fueron muchos; según contestó. Sabe, se le pasó la finca por ella a [Nombre1] y [Nombre2] sus hijos, que lo poseen por muchos años; estimando un aproximado de 25 años. Explicó, cuando doña [Nombre5] lo adquiere la finca la trabajaba [Nombre15] su esposo y ella hacia las labores domésticas, y el padre llevaba a sus hijos (los promoventes) a laborar también. Indicó en forma expresa, la finca siempre estuvo cercada en el mismo lugar donde está actualmente delimitada. La cadena posesoria es Urbino, que la dona a su hija [Nombre5].

Misma que la traspasa a sus hijos [Nombre2] y [Nombre1]. Respecto a cuerpos de agua, describió existe una quebrada pequeña que se mantiene protegida con árboles de diferentes especies propios de la zona. Le consta árboles de sombra de café en especie de poró y cuajiniquil. Citó, nunca se percató de problemas por la posesión de ese terreno con terceros o colindantes y nunca se ha abandonada. Siempre la han trabajaban. Y la comunidad reconocen a [Nombre1] y [Nombre2] los reconocen como dueños de esa finca. De esta declaración se deduce un ejercicio de la posesión continua por los miembros citados de ese grupo familiar. Inmueble que nunca se abandonó y se ha mantenido en las mismas condiciones de cabida que la actual y que esta representado por el plano base de este proceso. En igual sentido depone [Nombre8] , que indicó tener 70 años y conocer el fundo desde que tiene uso de razón. La primera dueña era [Nombre13] que le vende a [Nombre6] hace unos 60 años.

Y luego se la donó a la madre de [Nombre14], hace menos de 40 años. Fundo que era trabajado por el esposo de ella. Luego se le traspasa a [Nombre2] y [Nombre1], pero no recuerda bien cuando. Pues la finca era trabajada por su esposo, que murió y a partir de ahí se los entregó a sus hijos. Finca que ha sido con los mismos linderos cercados y el mismo tamaño. Sobre el cuerpo de agua indicó existe y está protegido. Hay árboles de aguacate y los otros no los recuerda. Al igual que el anterior, nunca ha habido conflictos por la finca, todos saben quienes han sido sus dueños, nunca se ha abandonado y se mantiene con actividades y mantenimiento. Al igual, se demuestra la misma cadena posesoria en ese núcleo familiar desde 1943 hasta la actualidad. El testigo [Nombre7] , en lo de interés depuso tener 85 años de edad y conocer la finca desde pequeño y a corta edad ya trabajaba la finca de su padre y observaba a [Nombre6] como poseedor.

Se lo da a su hija [Nombre16] . Madre de [Nombre2] y [Nombre1]. No precisa cuando se lo pasó [Nombre6] a [Nombre5] exactamente. [Nombre5] se lo pasa a sus hijos. Indicó se percata que es de ellos cuando el tenía unos treinta años. Describe la misma cadena posesoria en ese núcleo familiar y sucesión cronológica de sus dueños. De igual forma describe el cuerpo de agua y su protección, la existencia de agricultura como actividad y árboles. De la escucha de este testimonio y relacionándolos con los dos previamente mencionados, se logra determinar que los aspectos en cuanto a fechas exactas en que difieren, no es motivo para tener por desvirtuado que el fundo ha estado sometido a posesión de forma continua por la familia de [Nombre2] y [Nombre1] actualmente. Antes su madre [Nombre5] y su abuelo [Nombre6]. No existe contradicción alguna entre los poseedores y dueños de esta finca inscrita y la falta de determinación de fechas exactas coincidentes de cada uno se debe a que son del mismo grupo familiar y la sucesión en la titularidad no es fácilmente palpable a la vista de terceros; aún los cercanos.

Respecto a la coincidencia exacta de fechas y descripción de la posesión de cada una de las personas que han figurados como poseedores en calidad de dueños, lo importante es que se logre constatar el sometimiento a la posesión idónea por los particulares, aunado que se describen plazos de hechos ocurridos a través de 7, 8 y 6 décadas. Resultando lógico que en tanto tiempo va dificultándose la ubicación con fechas exactas como lo reclama la apelante. Se rechaza el agravio al respecto de que se soslaya la deficiencia de los testimonios achacándola a la edad avanzada de los testigos. Pues si bien son personas de edad avanzada, no es a su edad por sí como condición, sino a que han transcurrido muchísimos años y es comprensible no se precisen datos exactos como lo acusa la apelante. Para esta Sede, en virtud de lo indicado por los declarantes en cuanto la cadena posesoria y su antiguedad sobre este terreno inscrito, se han acreditado un ejercicio continuo de titularidad y posesión desde 1943 a hoy, por las personas que en el orden cronológico citado han estado en posesión a título de dueños y dueña al tenor del Registro Nacional con la cabida mayor que la reflejada en el asiento registral.

Lo anterior de forma ininterrumpida. Con respecto a la precisión de fechas de los poseedores de un fundo sin inscribir, el Tribunal Agrario ha resuelto: " Además, es importante señalar que no es preciso que los testigos sean tan puntuales en cuanto a fechas exactas de posesión de cada uno de los transmitentes, o conozcan a todos éstos, menos aún en casos como el presente en el que el fundo ha tenido tantos dueños, pues lo importante es que exista una referencia a las personas vinculadas con el ejercicio de la posesión durante todos esos años y a la protección que se está haciendo del recurso forestal dadas las exigencias que plantea el artículo 7 de la Ley de Informaciones Posesorias y al uso conforme del suelo de acuerdo a la certificación de folio 179, entre otros requisitos legales que no han sido objetados por la apelante.-" (voto N. 874-F-08). Criterio que se ha sostenido en votos posteriores y que comparte esta Cámara.

Lo importante a fin de determinar si procede o no una titulación o bien rectificación de medida de un terreno ubicado dentro de áreas silvestres protegidas o con alguna condición especial, es el conocimiento que se logre acreditar por parte de los testigos del fundo, sobre la antigüedad suficiente de la cadena posesoria y los actos ejercidos en el inmueble. Nota esta Sede, lo declarado por este testigo acredita hechos que van al menos desde el año 1943 en adelante. Tampoco resulta de recibo el agravio respecto a que en el escritura de 1984 donde [Nombre6] le transmite a su hija la finca no se citó demasía alguna, pues no es un requisito legal para su reconocimiento y los testigos acreditan de forma fehaciente que la finca ha sido la misma de al menos 1943 que le consta a uno de ellos hasta la actualidad. Se rechazan los agravios.

VII- Respecto al reproche que debe ser el año 1926 sobre el que se debe computar el plazo posesorio se rechaza. Pues según la recurrente, se encuentra el fundo bajo el supuesto de la Ley de Aguas, Ley de Tierras y Colonización, antigua Ley de Terrenos Baldíos y Código Fiscal. En primer orden, en el reconocimiento judicial se identificó un yurro o quebrada protegida, sin que esté captada para surtir de agua a población alguna. Señala la impugnante, existe el informe del Instituto Costarricense de Acueductos y Alcantarillados, aportado dentro del proceso EXPN1, donde se citó se indicó, recurso hídrico que contiene debía reservarse para abastecer las poblaciones de Piedemonte, en [Dirección6] . Invocando de esta forma el artículo 7 inciso c) de la Ley de Tierras y Colonización, ya regulado en el Código Fiscal de 1926 de 1926, así como la Ley General de Terrenos Baldíos de 1939, articulo 31 de la Ley de Aguas No. 276 del 27 de agosto de 1942, artículo 2 de la Ley General de Agua Potable, No. 1634 de 1953 que reitera el carácter de dominio público de los terrenos necesarios para un abastecimiento adecuado de agua potable.

No resulta de recibo ese agravio, pues en ese informe del año 2004 se cita en forma expresa no existen aprovechamientos de agua, captaciones o concesiones. Se indica en ese documento que esa quebrada es parte de un microsistema hidrológico del Río Limón. Ese es el cuerpo de aguas que es captado en otro lugar para abastecer poblaciones de agua. Y entiende esta Cámara de la lectura del informe que ese es el que se debe reservar a fin de abastecer a poblaciones. (informe aportado en imágenes 148 149 del expediente electrónico). Además en este proceso se solicitó nuevamente el informe al Departamento de Cuencas Hidrográficas a fin de citar si ese yurro contenido en el plano SJ- 1413821-2010, surte de agua potable alguna población ó conviene reservarlo. (imagen 202 del expediente digital modo pdf), contestando el ente competente en oficio No. SUB-G-AID-UEN-AMB-2014-1571 del 18 de noviembre del 2014 (imágenes 209 y 210 expediente modo pdf)), que sobre ese yurro que discurre por el inmueble, no existen aprovechamientos, sitios de captación o tomas surtidoras actualmente.

Agregando que la finca se localiza en el área de recarga del Río Limón, captado por el Instituto Costarricense de Acueductos y Alcantarillados seiscientos metros aguas abajo que abastece al sistema de Llanos de Alajuelita. Así como la existencia de captaciones de las ASADAS de Poás de Aserrí y [Dirección7] , situadas a más de 800 metros del fundo a titular. Al igual que se concluye en la sentencia apelada, se determina que la captación se ubica en otras propiedades y no en el yurro que atraviesa la finca. Para esta Cámara en este caso particular, no resulta de aplicación el régimen de dominio público sobre el yurro en cuestión el artículo 7 inciso c) de la Ley de Tierras Colonización, establece la demanialidad de los terrenos donde broten manantiales de los cuales se surta alguna población o que convenga reservar para tal fin y el establecimiento de una franja de doscientos metros a cada lado.

Tampoco cabe considerar se deba aplicar el artículo 31 de la Ley de Aguas, que determina como zona pública un radio no menor de doscientos metros públicos en las tierras que circunden los sitios de captación o tomas surtidoras de agua potable. Como se razonó, en este caso, no corresponde el cuerpo de agua a una naciente o manantial que esté captada para abastecer poblaciones o que se deba reservarse a tal fin. No se ajusta a los supuestos establecidos en la normativa invocada por la apelante. Coincidiendo esta Cámara con las conclusiones vertidas al respecto en el fallo venido en alzada cuando esboza en la finca no hay un sitio de captación, sino que se ubica lejano. Sobre el informe DGA-RH2004-508 vertido dentro del proceso de rectificación de medida anterior que se rechazó, observado por esta Instancia se indica que certificó en aquella oportunidad no tener concesiones ni captaciones ese yurro (imagen 156 modo pdf).

Además en cuanto a la pregunta, si resultaba importante reservar el recurso hídrico para el abastecimiento a poblaciones rurales, se señaló que la finca se situaba en la ladera noreste de los Cerros de Escazú y los terrenos son parte de la microcuenca del Río Limón. Que a su vez es parte del complejo sistema hidrológico de los ríos Tiribí, Virilla y Grande de Tárcoles. Añade el documento técnico, la finca a rectificar es atravesada en el sector sur por un yurro que sigue parelelo al lindero sur y forma parte del microsistema hidrológico (sección superior) del Río Limón y refieréndose al Río Limón describe que se capta en dos sitios diferentes para abastecer a la localidad de El Llano de Alajuelita y otro sector de Alajuelita también. El informe, procede a detallar lo que cita son algunas características de los dos aprovechamientos del Río Limón que Acueductos y Alcantarillados posee, tales como su ubicación por grados en latitud y longitud.

Y se señala: Por lo tanto si se hace necesario proteger, reservar y asegurar, los recursos hídricos, superficiales y subterráneos que se producen y manifiestan en dicha zona y específicamente donde se ubica la propiedad que se esta sometiendo a procesos de información posesoria, con fines de abastecimiento de agua potable a sector urbanos y periurbanos de Alajuelita. De igual forma se indica: " D. CONCLUSIONES.-NO EXISTEN CONCESIONES DE AGUA PARA PARTICULARES. - DENTRO DE LOS LINDEROS DE LA PROPIEDAD NO EXISTEN CAPTACIONES DE AGUA PARA COMUNIDADES RURALES. - LA PROPIEDAD ES ATRAVESADA POR UN YURRO O MICROCAUCE QUE FORMA PARTE DEL MICROSISTEMA HIDROCLÓGICO DEL RIO LIMON, EL CUAL ES CAPTADO Y DERIVADO POR ACUEDUCTOS Y ALCANTARILTADOS EN DOS SITIOS. TAL Y COMO SE DETALLO ANTERIORMENTE CON EL FIN DE DOTAR CON AGUA POTABLE A EL LIANO DE ALAJUELITA Y A SECTORES DE ALAJUELITA. E. RECOMENDACIONES.

PROSEGUIR CON EL TRAMITE DE INFORMACIÓN POSESORIA. PROTEGER LAS MÁRGENES RESPECTIVAS DEL MICROCAUCE O YURRO QUE ATRAVIESA LA PROPIEDAD EN SENTIDO OESTE - ESTE, PARALELO AL [Dirección8] . TAL COMO LO INDICA Y ESTIPULA LA LEGISLACIÓN AMBIENTAL VIGENTE. EL AYA CONSIDERA A NEGESARIO RESERVAR EL AGUA PARA EL ABASTECIMIENTO DE AGUA PARA LAS DIVERSAS COMUNIDADES Y POBLACIONES QUE SE ASIENTAN EN EL PIEDEMONTE NORESTE DE LOS CERROS DE ESCAZU." (la negrita no corresponde al original). Lo que entiende esta Cámara de ese informe es dejar constancia dentro de la finca inscrita que se pide rectificar no existen captaciones o nacientes captadas, ni concesiones. Por otra parte, se explica que ese yurro debe ser protegido en sus márgenes y que es parte del entramado de cuerpos de agua del Río Limón que es el captado en otro sector. Se indica que se continúe con el procedimiento y que es necesario reservar el agua para abastecimiento (imagen 144 a 149 expediente modo pdf).

En este proceso se celebró el reconocimiento judicial en donde se consignó que la quebrada se encuentra debidamente protegida con cobertura vegetal y arbórea (minuta en imagen 182 y en audio resguardado parte del expediente). Corroborándose que se ejerce una posesión en protección del recurso hídrico del yurro que se ubica en sector sur del fundo inscrito. Se solicita un nuevo estudio del Instituto Costarricense de Acueductos y Alcantarillados dentro de este proceso y por oficio SUB-G-AID-UEN-AMB-2014-1571 (imagen 209 expediente modo pdf), en lo de interes se indicó: "Para el lnstituto Costarricense de Acueductos y Alcantarillados es de sumo interés garantizar la protección y conservación de las aguas superficiales y subterráneas que tengan potencial para el abastecimiento a poblaciones. Se realizó consulta a la Dirección de Acueductos Rurales del AyA, y en nota SUB-G-GSC-UEN-AP-EBD- 2O14-1213, con fecha 16/10/14, se indica que cerca de la propiedad se ubican aprovechamientos superficiales de las ASADAS de Poás de Aserrí y [Dirección9] .

Se sugiere comprobación de campo. Adjunto. Las captaciones indicadas se encuentran a más de 800 m al SE de la propiedad, sin que haya relación alguna entre ellas. De acuerdo al análisis que hemos realizado en nuestro sistema de información, sobre los aprovechamientos de agua para abastecimiento a poblaciones, dentro de la propiedad que se señala en el expediente N O9-000062-0689-AG no existe aprovechamiento alguno en la actualidad". De este documentos se infiere no existen captaciones dentro de la finca a rectificar, y el sitio de captación sobre el Río Limón que si esta captado en dos sectores se ubica a más de 800 metros de distancia al sureste del fundo del promovente. Lo que existe es un yurro que alimenta el Río Limón que es el cuerpo de agua captado a una distancia de 600 y 800 metros. Por lo que no existe el supuesto legal del artículo 31 inciso a) y 32 de la Ley de Aguas en cuanto la afectación de áreas en un diámetro no menor de 200 metros de radio.

Si se compartiera la tesis de la recurrente, siendo los ríos del territorio nacional parte de todo un sistema interconectado hidrológico que desembocan en otros de forma reiterada que son parte de las cuencas hidrográficas que cubren todo el territorio nacional, y que la mayoría de esos rios son captados en algún sector geográfico, todos los terrenos con cuerpos de agua serian afectados por las condiciones de dominio público que alega, al ser yurros o ríos que alimentan otros que finalmente son captados. Sin que se tenga estudio de flujos por parte del ente estatal, se pretende así demanializar todo el territorio que contiene cuerpos de agua con el argumento de que éstos alimentan a los que si son utilizados para la captación del recurso hídrico en las cuencas hidrográficas. Lo cual, en criterio de este Tribunal se escapa del espíritu de las normas legales citadas supra respecto a la demanialización de terrenos circundantes de los sitios de captación o tomas surtidoras de agua, zona forestal que protege los terrenos donde se produce la infiltración de aguas potables y los que dan asiento a cuencas hidrográficas y márgenes de depósito, fuentes surtidoras de agua o cursos permanentes de las aguas.

El derecho al agua y su resguardo esta en esta caso garantizado. En este caso, el deber de las personas que han poseído el fundo es proteger el área de protección del yurro acorde con el artículo 33 de la Ley Forestal y esa situación fue constatada en el reconocimiento judicial que expresamente lo describió y los testigos referidos que así lo declararon. En ese orden, cabe indicar que el país entero se encuentra dividido según el criterio de cuenca hidrológica, a saber: "Según la delimitación realizada, el país está dividido en 34 cuencas que se nombran a continuación: 1. Río Sixaola (parte de Costa Rica), 2. Río La Estrella, 3. Río Banano, 4. Río Bananito y otros, 5. Río Moín y otros, 6. Río Matina, 7. Río Madre de Dios y Otros, 8. Río Pacuare, 9. Ríos Reventazón y Parismina, 10. Río Tortuguero y otros , 11. Río Chirripó, 12. Río Sarapiquí, 13. Río Cureña, 14. Río San Carlos, 15. Río Pocosol, 16.

Río Frío, 17. Río Zapote y otros, 18.Ríos Península de Nicoya y Costa Norte, 19.Río Tempisque 20.Río Bebedero, 21.Río Abangares y otros, 22.Río Barranca, 23.Río [Nombre15] María, 24.Río Grande de Tárcoles, 25.Río Tusubres y otros 26.Río Parrita, 27.Río Damas y otros, 28.Río Naranjo, 29.Río Savegre, 30.Río Barú y otros, 31.Río Grande de Térraba y otros, 32.Ríos Península de Osa, 33.Río Esquinas y otros, 34.Río CED8). Tales cubren la totalidad del territorio nacional. Por su parte, el Reglamento a la Ley de Uso, Manejo y Conservación de Suelos decreto Nº 29375 MAG-MINAE-S-HACIENDA-MOPT, en su artículo 6 define: "Áreas de recarga acuífera. Superficies territoriales en las cuales ocurre la mayor parte de la infiltración del agua a través de la corteza terrestre, que alimenta acuíferos y cauces de los ríos.". Esa misma norma establece: "Cuenca hidrográfica. Es el área geográfica cuyas aguas superficiales vierten a un sistema de desagüe o red hidrológica común, confluyendo a su vez en un cauce mayor, que puede desembocar en un río principal, lago, pantano, marisma, embalse o directamente en el mar.

Está delimitada por la línea divisoria de aguas y puede constituir una unidad para la planificación integral del desarrollo socioeconómico y la utilización y conservación de los recursos agua, suelo, [Nombre5] y fauna.". En igual sentido la Subcuenca hidrográfica la cataloga como: " Es cada una de las cuencas menores que pertenecen a un mismo sistema de desagüe o cuenca principal.". Como se observa son conceptos técnicos del complejo sistema hidrológico que existe dentro del territorio nacional, y en el suelo donde se asientan esas cuencas existen fincas dedicadas a las actividades humanas de diversa índole. Cabe destacar que la Comisión Nacional de Emergencias ha definido: " 1.3 Enfoque actual de los programas de cuencas. Costa Rica ha adoptado las categorías que en la mayoría de los países Latinoamericanos se ha utilizado que son tres: cuenca, subcuenca y microcuenca. La cuenca se considera como la zona entera de afluencia de un río, la subcuenca como la unidad de drenaje de menor superficie que una cuenca y que forma parte de esta, constituyendo un tributario de la misma.

Pueden considerarse para Costa Rica aquellas que ocupan un área comprendida aproximadamente entre 4000 a 5000 ha. La microcuenca, mínima unidad territorial de drenaje dentro de una cuenca y tributaria de una subcuenca. En Costa Rica se consideran aquellas áreas que ocupan un área menor a 1000 ha. Como se observa el concepto del artículo 31 inciso b) de la Ley de Aguas declara como reserva de dominio a favor del Estado: "La zona forestal que protege o debe proteger el conjunto de terrenos en que se produce la infiltración de aguas potables, así como el de los que dan asiento a cuencas hidrográficas y márgenes de depósitos, fuentes surtidoras de agua o curso permanente de las mismas aguas. Se estima que para ser considerada bien demanial al menos debe existir una declaratoria de las zonas que dentro del entramado de la cuenca abarcan.

Lo anterior en aplicación del ordinal 94 del Reglamento de la Ley Forestal que establece en lo de interes: "Artículo 94: La declaración de un área de recarga acuífera, deberá ser determinada en cada caso y para cada área en particular basado en estudios técnicos, que determinen la dirección de los [Dirección10] y la importancia del acuífero para consumo humano." Al respecto ver voto 319-F-2004 de la Sala Primera de la Corte Suprema de Justicia). Por las razones expuestas, se rechaza el agravio al respecto. Cabe citar que la finca rectificada resultará afectada por las limitaciones de Ley de Aguas, Ley General de Caminos Públicos acorde con el artículo 19 de la Ley de Informaciones Posesorias. Cuyos alcances respecto a las reservas de dominio a favor del Estado, de seguido se analizan.

VIII- En este caso se trata de una rectificación de medida de un terreno que fue inscrito por primera vez y sin plano en el año 1887. No se trata de un fundo sin inscribir. Se acreditó por los testigos, la finca ha estado materialmente en las mismas condiciones de cabida y es parte por esa razón de la unidad esa área que no se reflejó en su asiento registral al nacer como finca inscrita la propiedad, pero que en la realidad ha estado bajo posesión de los que han sido sus titulares registrales. Por otra parte, dentro de este proceso de rectificación la representación del Estado si bien hace las alegaciones citadas supra al respecto, no acudió al proceso de oposición al amparo del artículo 8 de la Ley de Informaciones Posesorias; donde estuvo en libertar de hacerlo. Bajo esas condiciones, cabe reseñar que la Ley de Aguas en su numeral 72 establece que los jueces encargados de extender títulos de propiedad sobre tierras baldías o no tituladas, deberán hacer la reserva consiguiente en cuanto a las aguas, alaveos o cauces y vasos de las aguas que sean de dominio público, haciéndolo constar en la sentencia de adjudicación y debiendo el Registro Público tomar tomar nota de las reservas nacionales.

La omisión de ese requisito no confiere derecho alguno al denunciante o poseedor de los bienes lo consiguiente. Por su parte, la Ley de Caminos Públicos en su artículo artículo 7 dispuso: "Artículo 7º.- Para la construcción de caminos públicos el Estado tendrá derecho a utilizar, sin indemnización alguna: a) Los porcentajes señalados como reserva para tal fin en las propiedades inscritas o pendientes de inscripción en el Registro Público; y b) Hasta un doce por ciento (12%) del área de los terrenos que en adelante se otorguen por el Estado o las Municipalidades a título de concesión, canje de terrenos, baldíos, aplicaciones de gracia, colonias agrícolas, adjudicación de lotes en terrenos baldíos y todos aquellos otros derechos o concesiones que otorgue el Estado por cualquier otra causa en los baldíos nacionales. Esta reserva se aplicará en cualquier momento a caminos de cualquier naturaleza con un ancho no mayor de veinte metros, o al aprovechamiento de fuerzas hidroeléctricas o para el paso de líneas telegráficas o telefónicas, para construcción de puentes o utilización de cursos de agua que fueren necesarios para el abastecimiento de poblaciones, abrevaderos de ganado o irrigación, o para cualquier otra finalidad de utilidad pública.

Tales restricciones y cargas irán aparejadas a la inscripción de la finca afectada, quedando obligado el funcionario a quien corresponde otorgar la escritura o suscribir el mandamiento inscribible a dejar constancia de las mismas. El Registro Público no inscribirá el título si en éste no constan dichas restricciones y cargas". Se cita en ese ordinal: " La Sala Constitucional mediante resolución N° 16629 del 28 de noviembre de 2012, estableció que el inciso anterior es constitucional siempre y cuando se interprete que la no indemnización se refiere, únicamente, al valor de la franja o porción del terreno que el Estado se reserva, en razón de su dominio público originario.)" ( fuente Sinalevi). Esa consulta constitucional indica: " A efectos de resolver esta consulta, debe aclararse que la Sala parte de la premisa de que los inmuebles no reducidos a propiedad particular, pertenecen al Estado, como expresamente regula el artículo 486 del Código Civil.

De esta forma, el ordenamiento jurídico ha estatuido una presunción a favor del Estado en el sentido que este es propietario de todos aquellos inmuebles no reducidos a propiedad particular. Todo lo anterior es acorde con lo dispuesto en el artículo 11 de la Ley de Tierras y Colonización, en el cual se establece que “Mientras no se pruebe lo contrario, pertenecen al Estado en carácter de reservas nacionales: …b) Los que no estén amparados por la posesión decenal”. Por lo que resulta más que evidente que los inmuebles inscritos posteriormente mediante información posesoria, soportan la reserva a favor del Estado, que si bien permite su titulación, para garantizar el acceso a la propiedad agraria, también el legislador ha dejado claro que quedan afectos a los fines de utilidad pública de carácter general. Por consiguiente, no existen bienes inmuebles susceptibles de ser categorizados como “res nullius”, pues lo no reducido a propiedad particular es del Estado.

De tal presunción, entre otros efectos prácticos, deriva la obligación, en un proceso de titulación de terrenos, mediante el trámite de Información Posesoria, de tener como parte cuando menos a la Procuraduría General de la República en su condición de representante estatal y al Instituto de Desarrollo Agrario, como órgano encargado de administrar la propiedad agraria pública. Emana entonces del mencionado numeral un dominio primigenio estatal, anterior a cualquier detentación de particulares. Esta característica faculta al Estado a imponer condiciones especiales de usucapión, como en este caso la de reserva de dominio público. De esta forma, cuando el Estado permite a un particular prescribir positivamente un bien inmueble, lo hace bajo el entendido que una porción del 12% se encuentra afectada a dominio público y es imprescriptible." Para esta Cámara el caso en estudio corresponde a esos terrenos que son afectos por las reservas citadas y que el Estado ostenta a pesar de haber sido inscritas y estar sujeto a posesión privada. Se rechaza el agravio.

IX- Sobre el régimen de tenencia de la tierra en áreas silvestres protegidas, ha de indicarse, independientemente de su categoría de manejo, deben ser entendidas como zonas con un régimen de administración y normativa particular y específica, supeditadas a planes de manejo que aseguran su protección, conservación y uso racional de los recursos naturales. Recae el MINAET su administración, manejo y tutela, salvo Ley especial que indique otra situación. El artículo 58 de la Ley de Biodiversidad, las define como zonas geográficas delimitadas, que se forman de terrenos, humedales y porciones de mar, declaradas como tales por representar una significancia especial, un interés de tutela y conservación del ambiente y sus ecosistemas, así como históricos y culturales. Esta norma hace una remisión expresa a la Ley Orgánica del Ambiente sobre la regulación de los requisitos y mecanismos para el establecimiento o reducción de estas áreas.

La administración por Ley recae en forma exclusiva sobre el Ministerio de Ambiente, Energía y Telecomunicaciones, salvo los Monumentos Naturales. Por su parte, la Ley Forestal prevé que cuando se declare un área silvestre protegida de propiedad estatal, ésta debe pasar en forma inmediata a formar parte del patrimonio natural del Estado, regulado por el artículo 13 de la citada norma que expresamente señala que su administración corresponde al MINAET. Ese conjunto normativo debe interpretarse con lo prescrito en el artículo 58 in fine de la Ley de Biodiversidad, que reconoce los derechos adquiridos por poblaciones indígenas, campesinas, personas físicas o jurídicas, sobre los terrenos que sean declarados áreas silvestres protegidas y sus categorías de manejo. Ello se complementa con el artículo 7 de la Ley de Informaciones Posesorias cuando indica : "Cuando el inmueble al que se refiera la información posesoria esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser el titular de los derechos legales sobre posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre." En este caso, se ha verificado la cadena posesoria desde el año 1943 en adelante de la finca inscrita desde 1887 ejercida sobre la cabida que refleja el plano base de este proceso, por lo que debe ser entendido que el derecho de propiedad de los titulares registrales ampara la petición de rectificación de medida.

Al respecto, la Sala Constitucional de la Corte Suprema de Justicia en voto voto 144-96- de las 16:51 horas del 9 de enero de 1996, resolvió: " En el caso de establecerse reservas forestales, zonas protectoras y refugios nacionales de vida silvestre, se da la opción de que el propietario conserve su tierra, ya que, siguiendo el plan de manejo puede continuar aprovechándola en términos económicos, es decir, las limitaciones impuestas no son de tal magnitud que le impidan explotar su propiedad, por lo que no hacen nugatorio su derecho." Y en caso concreto se demostró el ejercicio de la posesión ecológica, a la luz del estudio de suelos, el reconocimiento judicial que al efecto celebró la persona juzgadora, así como los testimonios analizados. (al respecto ver los votos de este Tribunal número 5-F-16 y 21-F-16). Por lo que se rechaza el agravio de la consideración de normas de antigua data al momento de resolver estos procesos, pues como ha sido analizado supra, se trata de una finca inscrita desde el siglo IX, y se tiene por cumplido el requisito del ordinal 6 de la Ley de Informaciones Posesorias respecto a la demostración de la posesión idónea sobre toda la cabida actual.

Dicha comprobación se complementa con el estudio de uso de suelos y el reconocimiento judicial realizado por el juzgado de instancia ya analizado. En este caso no se ha lesionado el recurso hídrico del yurro que discurre por el terreno, sino que se ha tendido a su conservación y protección dado el respecto del área de protección acorde con la Ley Forestal vigente. Por otra parte, acorde con el artículo 13 y 14 de la Ley de Informaciones Posesorias se permite a la titular registral de un fundo, tramitar mediante el tramite de información posesoria demostrar el aumento de cabida sobre los porcentajes que estipula el ordinal 13 ibídem. Solución jurídica del ordenamiento jurídico a la situación dada en casos como el presente, cuando un fundo inscrito mantiene un área parte de la materialidad del fundo inscrito de forma permanente. Por lo que la cabida que existe en el terreno ha sido mantenida al menos desde la década de los años cuarenta según los testigos de este proceso, amén que la finca se inscribió en el año 1887, no contiene bosques ni se ha modificado el uso del suelo.

Aunado a la constatación de la conservación de las áreas de protección del yurro, los sitios de captaciones se ubican a [Dirección11] según el reconocimiento judicial y los informes del Instituto Costarricense de Acueductos y Alcantarillados.

X- Por los motivos expuestos se concluye, en cumplimiento de los requisitos de la Ley de Informaciones Posesorias, Código Civil, Ley de Manejo, Uso y Conservación de Suelos y su Reglamento, así como la Ley Forestal, se deberá confirmar la sentencia recurrida y aprobarse el proceso de rectificación de medida de la finca inscrita promovido. Se decreta que la finca queda sujeta a las reservas nacionales del artículo 72 de la Ley de Aguas y 7 de la Ley General de Caminos Públicos.

XI- VOTO SALVADO DE LA JUEZA [Nombre17] :VOTO SALVADO DE LA JUEZA [Nombre17] : No se comparte el criterio de mayoría para aprobar la rectificación de medida solicitada por el promovente básicamente por dos razones: 1) La rectificación que se pretende supera en más de un 50% la inscripción original que se pretende rectificar, no siendo posible rectificar mayor a ese porcentaje según lo dispuesto en el artículo 13 de la Ley de Informaciones Posesorias. La medida inscrita original es de diez mil cuatrocientos ochenta y tres metros con cuarenta y cuatro decímetros cuadrados, pretendiendo mediante este procedimiento subir la cabida a treinta y dos mil ochenta y cinco metros con cuarenta decímetros cuadrados, es decir un aproximado del 200% de la finca original, contraviniendo el límite para aumento de cabida de un 50% establecido en el citado artículo 13. 2) El terreno que se está inscribiendo por rectificación de medida es de importancia para el abastecimiento de agua a dos poblaciones, según se desprende de los dictámenes de Acueductos y Alcantarillados realizados por los Ings [Nombre18] y [Nombre19] , por lo que con base en el artículo 7 de la Ley de Tierras y Colonización al referirse al Patrimonio del Estado, indica son de dominio público los terrenos que conviene reservar para surtir de agua a una población, como lo es el caso bajo examen.

En el caso de las informaciones posesorias y rectificaciones de medida, es evidente, a partir de los numerales 45 y 50 de la Constitución Política, se impone a quien juzga velar porque el título inscribible en el Registro Público, suministre información tendiente a generar el mayor bienestar a todos los habitantes del país, estimulando la producción agraria y agroambiental; incentivando que se conserve y preserve un ambiente sano y ecológicamente equilibrado; evitando daños que puedan afectar a las futuras generaciones. Además, se establece la importancia que los jueces y las juezas velen para que la ciudadanía y la sociedad tengan acceso a la información ambiental que precisen o soliciten, incluyendo la información en poder de los órganos jurisdiccionales. Cuando se tramitan las diligencias de información posesoria y rectificación de medida, la decisión que se inscribirá o rectificará en el registro correspondiente, deberá suministrar a la ciudadanía en general información precisa y transparente.

Por lo anterior, es relevante que todo lo que concierne al recurso hídrico, y eventualmente a fuentes de abastecimiento de agua potable para las comunidades, sea diáfana y precisa. El suministro de agua potable es un derecho al que todos los hombres y mujeres deben tener acceso. Este tema ha sido abordado por la Sala Constitucional de la Corte Suprema de Justicia de la siguiente manera: ´ « III . - Derecho fundamental al agua potable. Este Tribunal ha reconocido en su jurisprudencia que el derecho a la salud y a la vida son derechos fundamentales del ser humano que dependen -en gran parte-del acceso al agua potable, y que los órganos competentes tienen la responsabilidad, ineludible, de velar para que la sociedad como un todo no los vea mermados..." (voto Nº18633 de 21 de diciembre de 2007) (voto 725 de 15 de junio de 2012 del Tribunal Agrario). Por lo expuesto, el terreno objeto de este proceso, debió reservarse como dominio público, y no pasar a la esfera del dominio privado inscrito en el Registro Público, debiéndose haber rechazado el proceso de rectificación de medida.

POR TANTO:
