The Agrarian Court annulled the lower court's ruling that approved the possessory information claim, because it was issued prematurely and without resolving substantial objections regarding the nature of an access that could be a public domain asset.

SummaryResumen

The Agrarian Court annuls the lower court's judgment that approved a possessory information claim and ordered the registration of a property in Golfito. The Attorney General's Office (PGR) appealed, arguing that the judgment was issued before the deadline for the final hearing expired and that it was unclear whether the southern boundary access was a public road or an easement. The Court finds that the judgment was issued prematurely, denying the PGR the right to be heard, and that substantial objections remained unresolved. It further notes that clarifying the nature of the access (public road or easement) is essential due to potential public domain issues, and that the municipal report lacked a valid signature. Consequently, the judgment is annulled and the lower court is ordered to clarify these matters, ensuring due process before issuing a new ruling.

Key excerptExtracto clave

The appeal contains sufficient grounds to declare the requested annulment. Regarding the first ground, which complains that the judgment was issued prematurely, before the deadline for the final hearing regulated by Article 10 of the Possessory Information Law had expired, this deadline is indeed important, as the norm establishes it so that the judge may review the final objections the PGR may present, requiring an express ruling on whether they are well-founded or not. [...] Consequently, the PGR is correct in its complaint that the appealed judgment was issued prematurely, without granting the full deadline to respond to the final hearing. Moreover, the opposition raised in its appeal is based on the report contained in letter MG-UTV-436-2017 of September 10, 2017, issued by the Municipality of Golfito, which states that the access identified as a public road on the map is not considered as such by the Municipality because it does not meet the legal minimum, and is therefore classified as an easement [...]. This constitutes a due process violation for both parties, and despite this omission, the final hearing was held without determining the nature of the disputed access and a judgment was subsequently issued prematurely. This information is essential to be clarified, for due process and given the potential involvement of public domain assets.

CONSIDERING

I. In view of the manner in which this matter is resolved, no ruling is made regarding the proven facts

II.In the challenged judgment 22 of 12 febrero de 2018, the possessory title proceeding was approved and the recording of the property described in plan P-809373-2002 was ordered. The PGR appeals, concurrently seeking nullification, on the following grounds: 1) It maintains that the judgment was issued prematurely because the period granted at the final hearing had not expired; notice thereof was served on 5 de febrero, and the period therefore did not expire until the following day 16. It characterizes that hearing as a validity requirement for proceedings of this kind, considers that it is not a mere formality, and cites decision 942-2010 of this Court as judicial precedent. 2) It objects to the southern boundary of the land having been identified as a public road, which, it states, if it is indeed public, should have a minimum width of 8,50 metros. Moreover, it maintains that, according to the information provided in the proceeding, it is an easement (servidumbre).

It therefore argues that “if, in the Judge’s opinion, the southern boundary is a ‘public road,’ he should then have ordered… the submission of a new plan in which the area of the property was reduced by the percentage corresponding to the width of the road, a new description of the resulting area was prepared, and evidence of the cancellation of said plan before the Catastro Nacional was provided, so that State interests would not be affected. Otherwise, he should have rejected the proceeding pursuant to article 11 of the Ley dé Informaciones Posesorias because it sought the recording of land to the detriment of public-domain property (bienes demaniales).” However, if it is deemed not to be a public road but rather an easement, “neither could it be deemed established, because the Ley de Informaciones Posesorias is an improper and unlawful mechanism for creating it… In light of the foregoing, if it were an easement, the SOUTHERN boundary had to be corrected by identifying only the owner of the adjoining property on that side.” It requests that the judgment be annulled.

If it is not, it asks that it be clarified that on the [Dirección7] side the property adjoins the maritime-terrestrial zone (zona marítimo terrestre) (pleadings folder: file 20/02/2018 01:19:44).- Although, given the manner in which this matter is resolved, it is unnecessary to determine whether the appeal was filed within the statutory period, in view of the petitioner’s objection when responding to the appeal, it is clarified that the appeal was filed timely. It should be noted that the judgment was issued on 12 de febrero de 2018. The appeal was filed on the following martes 20 de febrero, within the 5 business days following that date, taking into account that the parties designated electronic means for service. Had all parties been served that same day through electronic means, the period would have expired later, and on a subsequent date if service occurred thereafter. Although the PGR’s appeal brief was mistakenly filed with another Court, the email forwarding it to the proper Court shows that it was received timely by the Court of Corredores, as provided in numeral 953 of the Código Procesal Civil, applied supplementally (see copy of email in pleadings folder: file 20/02/2018 01:19:44, image 1).

III.Numeral 592 of the Código de Trabajo, applicable by referral from article 60 of the Ley de Jurisdicción Agraria, provides that, before ruling on the grounds raised in an appeal, the Court must review the proceedings to determine whether there is any procedural defect or irregularity that should be cured where possible or, otherwise, sanctioned by procedural nullity (nulidad procesal). Likewise, article 26 of the Ley de Jurisdicción Agraria provides, insofar as relevant: “Where appropriate, the courts may, on their own initiative, declare nullities and order proceedings to be repeated in order to correct irregularities that could affect the validity of the proceeding.” Accordingly, if any formality capable of causing actual denial of the right to a defense (indefensión) is found to have been omitted, correction of the defect must be ordered if possible; otherwise, the acts or decisions must be declared null and void to the extent necessary to restore the normal course of the proceeding.

Under these provisions, this Court has consistently held that a declaration of procedural nullity is warranted only in extraordinary circumstances, when such a ruling is absolutely indispensable to prevent a denial of the right to a defense or to restore the normal course of the proceeding because essential procedural requirements were violated (articles 194 to 198 of the Código Procesal Civil, applied supplementally).

IV.The appeal (recurso de apelación) contains sufficient grounds to order the requested nullity (nulidad). Regarding the first ground, which claims that the judgment was issued prematurely, before expiration of the period for the final hearing (audiencia final) governed by Article 10 of the Ley de Informaciones Posesorias, this is indeed an important period, since that provision establishes it so that the judge may review any final objections that the PGR may submit, as to which it requires an express ruling on whether they are considered well-founded. However, this does not mean that in every case in which the period has not expired, a prematurely issued judgment must necessarily be declared null solely for that reason. Doing so will not be appropriate when, notwithstanding that circumstance, there is no well-founded objection that the PGR lacked an opportunity to submit. In this case, by order dated 2 de febrero del 2018, a final hearing was granted, which was communicated to all parties on 5 de febrero siguiente, and was therefore deemed served on martes 6 de febrero, since electronic means were used.

The eight-day period expired on viernes 16 de febrero (associated documents folder: file 02/02/2018 08:20:36 and notifications folder). Consequently, the PGR is correct in its claim that the appealed judgment was issued prematurely, without allowing it the full period in which to respond to the final hearing. Furthermore, the objection raised in its appeal is based on the report contained in official letter MG-UTV-436-2017 dated 10 de setiembre del 2017, issued by the Municipalidad de Golfito. It reports that the access shown on the survey plan (plano) as a public road by [Dirección8] is not considered as such by the Municipalidad because it does not meet the statutory minimum width and is therefore classified as a right-of-way easement (servidumbre de paso) (pleadings folder: file 16/11/2017 03:07:33 ). Since joining the proceeding in noviembre de 2017, the PGR raised objections to that access being considered a right-of-way easement, as recorded in submissions dated 11 de diciembre de 2017 and 29 de enero de 2018.

Moreover, although the Court notified the moving party of the aforementioned official letter by order dated 20 de noviembre de 2017 (associated documents folder: file 20/11/2017 13:13:12), that party did not respond, nor were any of the objections or observations submitted by the Procuraduría in that regard resolved. This constitutes a violation of due process (debido proceso) for both parties, and despite that omission, the final hearing was conducted without determining the nature of the disputed access, after which a judgment was issued prematurely. That information must be clarified as a matter of due process and because property that may be within the public domain (bienes de naturaleza demanial) is at issue. This is because, if the access is in fact a public road and not an easement, the procedures must be corrected so that it complies with the legally required minimum width, which currently requires a new survey plan correcting the relevant data, such as the area of the property to be titled (articles 2 of the Ley General de Caminos Públicos; 4 and 5 of the Ley de Construcciones; 2 of the Ley de Tránsito and decisions 2306-91 dated 6 de noviembre de 1991 and 1245 dated 8 de mayo de 1002 of the Sala Constitucional).

If it is an easement, then, in addition to a new survey plan specifying that circumstance, the trial court must request the relevant clarifications as to who owns that strip of land, in order to verify that the encumbrance (gravamen) was duly established and that the appropriate person is duly notified in connection therewith. Accordingly, the appealed decision was issued prematurely because all the evidence had not yet been received and all the unclear information appearing in the case file regarding [Dirección9] of [Dirección10] to be titled had not been clarified. The Court should also note that official letter MG-UTV-436-2017 dated 10 de setiembre del 2017 contains a formal defect that must also be cured before it may be considered validly issued by the Municipalidad de Golfito, a matter that it must also bear in mind when reviewing future cases. That official letter was neither signed nor validated by the person representing the state entity, a common error that the Courts cannot overlook given the nature of such reports.

The authority to make statements on behalf of an entity belongs solely to its legal representative; its officials may not do so, even if they possess the technical knowledge required to prepare the reports. As relevant to this case, Article 17 of the Código Municipal so provides: “The municipal mayor shall have the following powers and duties: ...n) To hold the legal representation of the municipality, with the powers granted thereto by this law and the Concejo Municipal.” Accordingly, this defect must be cured by requesting a new report or validation of the referenced report by the representative of the Municipalidad before the proceedings continue.

V.In accordance with the foregoing, and as requested by the PGR, the appealed judgment is vacated. Before issuing judgment, the A quo shall, in order to guarantee due process, issue the appropriate ruling on the nature of the access indicated by [Dirección9] on the base survey plan and, depending on that determination, proceed as legally required, as explained in the preceding recital (considerando). It must also cure the issue identified in the preceding recital concerning the report requested from the Municipalidad de Golfito.

POR TANTO

Judgment 22 dated 12 febrero de 2018 is vacated. Before issuing judgment, the trial judge must, in order to guarantee due process, issue the appropriate ruling on the nature of the access indicated by [Dirección9] on the base survey plan and, depending on that determination, order the corrections to the survey plan and to any other information that must be clarified or corrected, as explained in the penultimate recital. The judge must also take the necessary steps to ensure the validity of the report requested from the Municipalidad de Golfito.

Redacta la Jueza Alpízar Rodríguez, y;

CONSIDERANDO
