BACKGROUND:
Judge Álvarez Molina drafts the judgment, with the affirmative votes of Judges Mena García and Campos Hidalgo; and, C O N S I D E R I N G:
The following facts, which are relevant to these proceedings, are deemed duly established:
That subparagraph b) of point 2 of that resolution established that “…Within the defined Marine Area, vessels belonging to the semi-industrial shrimp-fishing sector shall be permitted to conduct fishing activities and operations using legally permitted fishing gear (artes de pesca); such operations may be conducted beginning at a measured bathymetric depth (profundidad barimétrica) of 60 meters from the coastline, starting at coordinates 09º59´00´´ north latitude, 85º45´50´´ west longitude, and from there along an imaginary straight line parallel to the coast in a northwesterly direction, ending at a depth of 75 meters, in accordance with the Official Nautical Chart of Costa Rica. For this purpose, and in order to determine the impact on fisheries in the area, an initial study shall be conducted for a period of one year from the date hereof to measure, quantify, and establish the impacts and recovery of hydrobiological resources (recursos hidrobiológicos), as well as the management measures (medidas de ordenación) that may be implemented, improved, or modified…” (folios 214, 215 of the administrative record; 24 and 25 of the judicial record); 17) That, in adopting subparagraph b) of point 2 of resolution number AJDIP/068-2013, the INCOPESCA Board of Directors departed from the recommendations grounded in scientific and technical principles issued by both the San Juanillo AMPR Interinstitutional Working Group and the General Technical Director of INCOPESCA, without any basis of the same nature capable of refuting them, both with respect to the use of unsustainable fishing methods, gear, or practices and with respect to the bathymetric depth at which vessels belonging to the semi-industrial shrimp-fishing sector could operate (folios 214, 215, 233, 232, 5 to 1, 94 to 70 of the administrative record; 1 to 25 of the judicial record; witness testimony given at trial by Nombre114309 and Nombre114307); 18) That, by judgment number 2013-10540, issued at fifteen hours and fifty minutes on siete de agosto del dos mil trece, the Constitutional Chamber of the Supreme Court of Justice, by majority vote, declared articles 2, subsection 27, point d); 43, subsection d); and 47, subsections a) and b), of Ley 8436 of 1º de marzo de 2005 contrary to Constitutional Law (Derecho de la Constitución), insofar as they recognized shrimp fishing using trawl nets (redes de arrastre) as lawful (see the digital version of that judgment on the website: www.poder-judicial.go.cr/scij).
The plaintiffs contend:
It must be noted that the statement of reasons (motivación) constitutes a substantive element of an administrative act (acto administrativo), requiring the specification of the factual and/or legal matters supporting the public authority’s intent in the particular case. The statement-of-reasons element is far from being a merely formal consideration; on the contrary, it is an indispensable element of public action, insofar as it enables an understanding of the reasons underlying the decision. This makes it possible, on the one hand, to review the legality of the act by comparing it with the legal system and determining whether it meets the requirements imposed by that system in terms of substantiating the grounds (motivo), the legitimacy of the content, and the reasonableness and proportionality between those two elements. Moreover, it becomes a fundamental prerequisite for the addressee to exercise the right to appeal (derecho recursivo), since that right could not be fully exercised if the act did not state its legal and factual basis.
That duty to state reasons, as may be inferred from the aforementioned provision 136 of the General Law of Public Administration, may be satisfied directly or indirectly. In the first case, the act expressly sets forth the factual, technical, or legal arguments or precedents supporting the decision. In the second case (subsection 2 of the cited provision), the act refers to prior proposals, opinions, or decisions that actually determined its adoption, provided that a copy thereof is included when the act is communicated. A deficiency in this element entails a defect rendering the act null and void (vicio de nulidad), which may result in the annulment of the action. Notwithstanding the wording of subsection one of the aforementioned provision 136 of the previously cited General Law, a statement of reasons cannot be understood as a mere account of facts, a simplistic and isolated reference to legal rules deemed relevant to the case, or the mere transcription of opinions without details of the reasons for adopting them.
The importance of this requirement calls for an analysis connecting the factual and legal aspects relevant to the matter under examination (the doctrine of Article 132.1 LGAP); therefore, as a matter of principle, it entails determining the facts relevant to the decision (guided by the principle of objective truth (verdad real)—214, 308 ibídem—) and examining whether a particular legal consequence is or is not appropriate in light of the legal rules applicable to the case. This requires an assessment of the implications of the established factual circumstances within the framework of the applicable law, which assessment must be expressly set forth in the act, either directly or by reference, in order to state the reasoning that guided the administrative decision. Accordingly, it is not enough to conclude that a particular petition is inadmissible; the factual and legal grounds for that outcome must be stated.
In matters where the conditional consequence depends on compliance with certain requirements established beforehand by a formal source of law (fuente formal), the statement of reasons necessarily entails a clear explanation of why it was concluded that those requirements had not been met, as the basis supporting that outcome. The opposite would permit rejection on the basis of assertions that, irrespective of their underlying grounds, are not justified in the act itself, making it impossible to understand those grounds or to challenge the act on appeal.
This Court finds that subsection b) of point 2 of agreement AJDIP/068-2013, adopted by the Board of Directors of INCOPESCA at ordinary session number 10-2013 held on 15 de febrero del 2013, is affected by a defect of absolute nullity (nulidad absoluta), for the reasons set forth below: a) Although it is true that the establishment of a Responsible Marine Fishing Area (Área Marina de Pesca Responsable, AMPR) does not per se entail the exclusion of the various fishing sectors (Article 6 of Decreto Ejecutivo number 35502-MAG), it is also true that allowing the use of fishing methods, gear, or practices which, from a scientific and technical standpoint, lead to the deterioration of marine resources and, consequently, make it impossible to achieve sustainable development (desarrollo sustentable)—in this case to the detriment of the community of San Juanillo and its surrounding areas—is contrary to the preventive principle (principio preventivo) and the principles of reasonableness and proportionality (principios de razonabilidad y proporcionalidad).
In this regard, the Code of Conduct for Responsible Fisheries of the Food and Agriculture Organization of the United Nations (FAO) establishes the need to refrain from using non-selective fishing methods, gear, or practices that entail the indiscriminate trawling and discarding of various marine species. This instrument has been incorporated into our domestic legal system through various sources of law, including, for example: Decreto Ejecutivo number N° 27919, in force since 14-06-1999; Ley 8436, in force since 25 de abril del 2005; and judgment 2013-10540 issued by the Constitutional Chamber of the Supreme Court of Justice at 15:50 hours on 07 de agosto del 2013; b) In light of the foregoing, it is not appropriate to state that the proposal submitted by the Interinstitutional Working Group of the San Juanillo AMPR (folios 1 to 23 of the judicial case file; 94 to 70 of the administrative case file) lacks a technical basis, since, among other sources, it is based precisely on the FAO Code of Conduct for Responsible Fisheries, which establishes the need to refine and apply selective and environmentally safe fishing gear and practices in order to maintain biodiversity and preserve population structures, aquatic ecosystems, and fish quality (Articles 6, subsections 5 and 6; 7, subsection 2, sub-subsection 2; and 8, subsection 5, sub-subsection 1).
This is evident not only from the San Juanillo Fisheries Management Plan (Plan de Ordenamiento Pesquero) proposal itself (folios 94 to 70 of the administrative case file; 1 to 23 of the judicial case file), but also from the testimony given at trial by Nombre114307, Coordinator of the Interinstitutional Working Group of the San Juanillo AMPR. Consequently, and without prejudice to the opinion that the Technical Director General of INCOPESCA might issue in order to reconcile the interests of the different fishing sectors, as reflected in agreements AJDIP-405-2012 of ordinary session 50-2012 of 07 de setiembre del 2012 and AJDIP/494-2012 of ordinary session 63-2012 of 14 de diciembre del 2012, adopted by the Board of Directors of INCOPESCA (folios 163 and 162, 188 to 186 of the administrative case file), it is not appropriate to claim that the technical recommendations proposed in the Fisheries Management Plan for establishing the San Juanillo AMPR lacked such technical character.
Under Articles 2 and 3 of Decreto Ejecutivo 35502-MAG, the basis for the Board of Directors of INCOPESCA to discuss and determine the feasibility of establishing a responsible marine fishing area and issuing the Fisheries Management Plan for that area is precisely that document, together with any input provided by the Technical Director General of INCOPESCA (folio 34 of the judicial case file; 163 and 162 of the administrative case file). To assert otherwise not only openly contradicts the provisions of sections 2 and 3 of Decreto Ejecutivo 35502-MAG, but also entails—as occurred in this case—departing from a recommendation grounded in scientific and technical principles without grounds of the same nature capable of rebutting it. This is contrary to Article 50 of the Ley de Biodiversidad and Article 59 of the Ley Orgánica del Ambiente, which provide that human activities, particularly those related to human settlements, agriculture, tourism, industry, or other activities that may affect vital ecological processes, must comply with the technical and scientific standards issued by the competent public entities; c) It is true that, in principle, it could be maintained that, pursuant to Article 159(1) of the Ley General de la Administración Pública, the challenged formal conduct became affected by a defect of absolute nullity, since, at the time that act was issued—specifically subsection b) of point 2 of agreement AJDIP/068-2013—the Constitutional Chamber of the Supreme Court of Justice had not declared Articles 2, subsection 27, point d); 43, subsection d); and 47, subsections a) and b), of Ley 8436 of 1º de marzo de 2005 to be contrary to Constitutional Law insofar as they recognized shrimp trawling gear (arte de pesca de camarón con redes de arrastre) as lawful.
This explains why the challenged agreement states that vessels belonging to the semi-industrial shrimp-fishing sector would be allowed to conduct fishing activities and operations within the defined Marine Area using legally permitted fishing gear. Nevertheless, Decreto Ejecutivo number 27919—which implements the provisions of section 6 of the Constitución Política—has been in force since 14 de junio de 1999 and established “…the official application by the Costa Rican State of the Code of Conduct for Responsible Fisheries, approved by the Food and Agriculture Organization of the United Nations (FAO) in Rome, Italy, on 31 de octubre de 1995, as an instrument of responsible practices intended to ensure the conservation, management, and effective development of aquatic resources…,” with INCOPESCA being “…responsible for monitoring and applying the provisions contained in the Code (sic) to Costa Rican fishing activity and required to promote and facilitate its dissemination and understanding through appropriate mechanisms for the national fishing sector, for which purpose the country’s Public Institutions shall provide it with the necessary cooperation within their respective fields of authority….” Furthermore, since its original version published in La Gaceta number 78 of 25 de abril del 2005—and in force since that date—Ley 8436 has established in Article 38, subsections j) and k), that the use of gillnets (redes agalleras) and high-seas pelagic trawl nets (redes de arrastre pelágicas de altura), as well as any practice that threatens the sustainability of fishery resources, is prohibited.
These provisions are supplemented by the technical standards contained in the FAO Code of Conduct for Responsible Fisheries, whose official application by the Costa Rican State has been in force since 14 de junio de 1999. d) At this juncture, it should be emphasized that INCOPESCA, in exercising the powers conferred upon it by Articles 12 and 38 of Ley 8436 as the authority responsible for implementing that same body of law and the Fisheries and Aquaculture Development Plan (Plan de Desarrollo Pesquero y Acuícola), is responsible for determining the prohibited fishing methods, techniques, equipment, and gear in order to safeguard, defend, and preserve marine biodiversity, fishery resources, and sustainable development. Accordingly, it is contrary to the principles of logic and reasonableness and to the preventive and precautionary principles (principios preventivo y precautorio) for the Board of Directors of the respondent entity, in subsection b) of point 2 of agreement AJDIP/068-2013, to have allowed vessels belonging to the semi-industrial shrimp-fishing sector to conduct fishing activities and operations within the San Juanillo Responsible Marine Fishing Area using methods that, from a scientific and technical standpoint, cause deterioration of marine resources and consequently create an obstacle to the sustainable development of the community of San Juanillo and its surrounding areas.
This was so even though the Board had both national and international technical inputs contained in treaty, statutory, and regulatory provisions that would have allowed it, at a minimum, to implement protective measures to help mitigate, at least in part, the lack of selectivity inherent in trawl fishing methods, as recommended by the Technical Director General of INCOPESCA in official letter DGT-A-180-10-2012 of 25 de octubre del 2012, which stated: “…With regard to trawl fishing, my recommendation is that it could be permitted beyond the 15-meter depth contour, provided that a fisheye-type TED is used on the upper portion of the codend with two floats…” (folio 232 of the administrative case file and testimony given at trial by Nombre114309). Consequently, the Costa Rican legal system already contained technical standards imposing upon INCOPESCA, as the implementing authority for Ley 8436 and the Fisheries and Aquaculture Development Plan (Article 12 of that same body of law), the duty not only to determine which fishing methods, gear, or practices were not contrary to the right to a healthy and ecologically balanced environment, but also to adopt the measures necessary to protect marine resources and the right to sustainable development of communities engaged in fishing and the exploitation of marine resources.
This was not done in the present case, where the objectives pursued through the creation of the San Juanillo AMPR are rendered ineffective by subsection b) of point 2 of the challenged agreement. e) Moreover, the technical reasons for which the Board of Directors of INCOPESCA departed both from the technical recommendations issued by the Interdisciplinary Working Group of the San Juanillo AMPR (folios 5 to 2 of the administrative case file) and from those contained in official letter DGT-A-180-10-2012 of 25 de octubre del 2012, signed by the Technical Director General of INCOPESCA (folios 233 and 232 of the administrative case file), regarding the depth at which vessels of the semi-industrial shrimp-fishing sector could operate, are likewise not apparent. The agreement merely provides that the “…operations may be conducted beginning at a measured bathymetric depth of 60 meters from the coastline, starting at coordinates 09º59´00´´ north latitude, 85º45´50´´ west longitude, and from there along an imaginary straight line parallel to the coast in a northwesterly direction, ending at a depth of 75 meters, in accordance with the Official Nautical Chart of Costa Rica…” (folio 215 of the administrative case file and 25 of the judicial case file).
In this regard, it bears noting that, in an official letter submitted to INCOPESCA on 28 de agosto del 2012 in response to agreement number AJDIP-352-2012, adopted by the Board of Directors of that entity at ordinary session number 41-2012 of 19 de julio del 2012, the Interinstitutional Working Group of the San Juanillo AMPR stated that “…trawling at depths of 40 meters and beyond would mean catching not only shrimp, but primarily snappers, carillas, and conger eels, which are the target species of artisanal fishers and which, because of their vital ecological and economic importance to them, are protected under the Fisheries Management Plan prepared for the responsible marine fishing area, encompassing a total of 5 nautical miles from the coast rather than the average of 0.74 nautical miles that the shrimp fishers’ proposal would entail (Anexo I).
It must be recalled that, under the regulations currently in force, which are based on scientific studies, the mesh size (luz de malla) of trammel nets (trasmallos) in Guanacaste may not be less than 4.5 inches; it is therefore contradictory to permit semi-industrial trawling (arrastre semi-industrial), which uses nets with a mesh size of 1 ¼ inches, particularly in an area proposed as a responsible fishing area (área de pesca responsable), where the artisanal fishers themselves are willing to use a mesh size of up to 5 1/8 inches…” (folios 5 a 1, 45, 144 y 143 del expediente administrativo and testimony given at trial by Nombre114307 ). For his part, the Technical Director General of INCOPESCA himself stated that “… With regard to trawling (pesca de arrastre), my recommendation is that it could be permitted beyond the 15-meter-depth bathymetric line (línea barimétrica), provided that fish-eye-type bycatch reduction devices (DET tipo de ojo de pescado) are used in the upper part of the codend (copo), with two floats…,” given that the 15-meter bathymetric line had already been applied with great success in other responsible fishing marine areas (áreas marinas de pesca responsable), such as Tárcoles, a provision which, according to his statement, also promotes the capture and subsequent marketing of white shrimp (folio 232 del expediente administrativo and testimony given at trial by Nombre114309 ); f) This situation is aggravated because, in evident contravention of the preventive principle (principio preventivo), precautionary principle (principio precautorio), in dubio pro natura principle (in dubio pro natura), and the environmental public interest (interés público ambiental) (artículo 11 de la Ley de Biodiversidad), the Board of Directors of INCOPESCA established in subsection b) of item 2 of agreement AJDIP/068-2013 that “… for purposes of determining the impact on fisheries in the area, an initial study shall be conducted for a period of one year from the present date, allowing the impacts and the recovery of hydrobiological resources (recursos hidrobiológicos) to be measured, quantified, and established, as well as the management measures (medidas de ordenación) that may be implemented, improved, or modified…” (folios 215 del expediente administrativo y 25 del expediente judicial).
In this regard, although numeral 13 of Decreto Ejecutivo número 35502-MAG establishes that a Monitoring Commission (Comisión de Seguimiento) shall ensure the proper management of the Responsible Fishing Marine Area (Área Marina para la Pesca Responsable) and shall keep the Executive Presidency of INCOPESCA informed through reports issued at least every six months, it is also true that the provision in the aforementioned passage of subsection b) of item 2 of agreement AJDIP/068-2013 does not constitute monitoring and verification work based on technical rules issued by the competent public entities—in this case, INCOPESCA—for the maintenance of vital ecological processes within and outside responsible fishing marine areas, since it does not even suggest the possibility of applying protective measures that would help partly minimize the problems arising from the trawling method’s lack of selectivity, such as fish-eye devices or turtle-exclusion devices. g) For all the foregoing reasons, this Court declares that subsection b) of item 2 of agreement AJDIP/068-2013, adopted at ordinary session number 10-2013 held by the Board of Directors of INCOPESCA on 15 de febrero del 2013, is vitiated by absolute nullity (nulidad absoluta), because it is manifestly and evidently contrary to the legal system, specifically to the provisions of artículos 16 y 136 de la Ley General de la Administración Pública; 11 y 50 de la Ley de Biodiversidad; 59 de la Ley Orgánica del Ambiente; 1 y 2 del Decreto Ejecutivo número 27919; 2, 3 y 13 del Decreto Ejecutivo 35502-MAG; the 1982 United Nations Convention on the Law of the Sea; the Inter-American Convention for the Protection and Conservation of Sea Turtles; the 1982 World Charter for Nature; the Convention on Biological Diversity; the Rio Declaration; and the FAO Code of Conduct for Responsible Fisheries, which require the adoption of selective fishing techniques, the conservation of marine resources and ecosystems, prohibit overexploitation, and mandate the application of fishing and commercial principles, techniques, and practices consistent with resource sustainability and with the precautionary and preventive principles inherent in Environmental Law (Derecho Ambiental).
The foregoing is without prejudice to the provisions of the Por Tanto of judgment number 2013-10540 issued by the Sala Constitucional, stating that “…In consideration of rights acquired in good faith, the permits, authorizations, and licenses currently in force shall remain valid and effective until the expiration of the term granted to each of them, provided that their holders conduct the activity in absolute compliance with the legal rules issued on the matter and on condition that they adopt, if scientifically possible, the most environmentally friendly technologies available, under the supervision of INCOPESCA; once the term of validity has expired, they may not be extended…”. For the reasons giving rise to the declaration of partial absolute nullity (nulidad absoluta parcial) of the aforementioned agreement, no ruling is made on the other arguments on which the plaintiff bases its claim for nullity and nonconformity with the legal system.
V.REGARDING CLAIMS 3 AND 4 OF THE COMPLAINT, AND THE SCOPE OF JUDGMENT NUMBER 2013-10540 OF THE SALA CONSTITUCIONAL IN THIS PARTICULAR CASE. First, it should be noted that, by majority vote, the Sala Constitucional of the Corte Suprema de Justicia, in judgment number 2013-10540 of fifteen hours and fifty minutes on siete de agosto del dos mil trece, held—insofar as relevant—that: “…Consequently, shrimp fishing with trawl nets, while no devices are available (sic) to reduce incidental catch (Bycatch Reduction Devices) that significantly reduce incidental catch (not all have the same effectiveness, and it is not enough that they save turtles), contravenes the principles enshrined in international instruments concerning marine resources, which are directly applicable in our jurisdiction pursuant to the provisions of Article 6, as already stated, without prejudice to the supplementary and subsidiary application of Article 7 of the Constitution.
Indeed, pursuant to Article 6 of our Constitution, the principles of International Law apply directly; therefore, Articles 2 subsection 27 point d), 43 subsection d), and 47 subsections a) and b) of Ley 8436 of 1º de marzo de 2005, insofar as they recognize shrimp fishing with trawl nets as a lawful fishing gear (arte de pesca), violate this constitutional provision and the principles of International Law governing the matter that the provision recognizes, which require the adoption of selective fishing techniques, the conservation of marine resources and ecosystems, prohibit overexploitation, and require the application of fishing and commercial techniques and practices consistent with resource sustainability and the precautionary and preventive principles inherent in Environmental Law…”. In view of the foregoing and pursuant to Articles 10 of the Constitución Política; 1, 2 subsection b), and 13 of the Ley de la Jurisdicción Constitucional, the petitioners shall abide by the ruling of the Sala Constitucional of the Corte Suprema de Justicia in the judgment partially transcribed above with respect to the relief sought in claim number 3 of the complaint.
Furthermore, this Court finds claim number 4, which seeks an order requiring INCOPESCA to bring subsection b) of point 2 of agreement AJDIP/068-2013 into conformity with point number 3.13.5 of the Plan de Ordenamiento Pesquero del Área de Pesca Responsable San Juanillo, to be inadmissible. That point provides: “…Throughout the entire area and year-round, the use of bottom trawl nets shall be prohibited, as shall the use of purse-seine sardine nets. The foregoing is due to the limited or nonexistent selectivity of this fishing gear and the resulting harm to the fishery and the economy of artisanal fishers in the area…” (folios 77 and 76 of the administrative case file (expediente administrativo); 18 of the judicial case file (expediente judicial)). This is because the Sala Constitucional itself, in the operative provisions (Por Tanto) of judgment number 2013-10540 of fifteen hours and fifty minutes on siete de agosto del dos mil trece, ordered: “…The foregoing does not preclude categories A and B, which have been annulled, from being reinstated in the future through the corresponding statutory amendment, provided that express reference is made to the obligation to use devices to reduce incidental catch (Bycatch Reduction Devices), with respect to which, prior to any statutory amendment and with the corresponding scientific and technological support, a significant reduction in such incidental catch must be demonstrated that is compatible with democratic sustainable development.
In this regard, it must be noted that, given the current state of technology, not every device of this type satisfies that requirement or has the same effectiveness…”. This is without prejudice to the fact that claim number 4 would entail a violation of vested rights acquired in good faith (derechos adquiridos de buena fe), which were recognized by the Sala Constitucional in the operative portion of judgment number 2013-10540 when it ordered that: “…In consideration of vested rights acquired in good faith, current permits, authorizations, and licenses shall remain valid and effective until the expiration of the term granted for each of them, provided that their holders conduct the activity in full compliance with the legal framework enacted on the matter and on the condition that they adopt, if scientifically possible, the most environmentally friendly technologies available, under the supervision of INCOPESCA; once their term of validity has expired, they may not be extended…”.
Consequently, because the Sala Constitucional did not exclude the possibility of using trawling techniques, provided that “…a significant reduction in such incidental catch is demonstrated that is compatible with democratic sustainable development…”, and because it recognized the vested rights of holders of current trawl-fishing licenses, which they may continue to use until expiration, provided that they apply devices effectively reducing the incidental catch caused by the trawling method, this Court orders the Junta Directiva del INCOPESCA to determine, on the basis of the corresponding technical and scientific support, the methods, gear, and practices that the semi-industrial shrimp-fishing sector might eventually use and the bathymetric depths (profundidades barimétricas) from which they may be used in the AMPR de San Juanillo, provided, of course, that this is technically possible. For this purpose, it is granted a period of 1 year from the date this ruling becomes final, during which it shall demonstrate every three months to the Judges responsible for the judgment-enforcement phase (fase de ejecución de sentencias) of this jurisdiction the progress made toward effective compliance with that order.
Likewise, at the end of that 1-year period, it shall submit to the Judgment-Enforcement Judges (Jueces de Ejecución de Sentencias) of this Court a complete report providing detailed evidence of the specific actions taken, in order to determine whether it is technically possible for the semi-industrial shrimp-fishing sector to conduct fishing operations in the AMPR de San Juanillo, the techniques under which it may do so, and the bathymetric depths from which it may do so. In any event, and to prevent the effects of this ruling from being rendered ineffective, the effects of the interim measure (medida cautelar) granted by the Jueza Tramitadora del Tribunal Contencioso Administrativo y Civil de Hacienda through ruling number 2013-002160 at 09:30 hours on 09 de octubre del 2013 shall remain in force until this judgment becomes final.-
This Court concludes that the plaintiffs have standing to bring suit (legitimación activa) in these proceedings pursuant to Article 105 of the Ley de Biodiversidad because, as residents of San Juanillo and, in some cases, fishers from that area, they bring this action in defense and protection of biodiversity. In addition, the action is properly directed against the Instituto Nacional de Pesca y Acuicultura, as provided in Article 12 subsection
Pursuant to Article 193 of the Código Procesal Contencioso Administrativo, court costs and attorneys’ fees (costas procesales y personales) constitute a burden imposed on the losing party by virtue of having lost. Waiver of such an award is permissible only when, in the Court’s judgment, there were sufficient grounds to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, this collegiate body finds no reason to apply the exceptions established by the applicable provisions and depart from the principle that costs are awarded against the losing party. Accordingly, both categories of costs are imposed on the State, and their amounts shall be assessed during enforcement of the judgment.-
POR TANTO.
The action filed by Nombre114292 against the Instituto Costarricense de Pesca y Acuicultura is partially granted on the following terms, and is deemed denied as to any matter not expressly indicated:

RESULTANDO:
Redacta la jueza Álvarez Molina, con el voto afirmativo de los jueces Mena García y Campos Hidalgo; y, C O N S I DE R A N D O:
Io.- HECHOS PROBADOS: Se tienen como debidamente acreditados los siguientes hechos que resultan relevantes para este proceso:
IIo.- OBJETO DEL PROCESO. La parte actora sostiene:
IVo.- RESPECTO A LA FALTA DE FUNDAMENTACIÓN TÉCNICA DE LA CONDUCTA FORMAL IMPUGNADA. Este Tribunal considera que el inciso b) del punto 2 del acuerdo AJDIP/068-2013, adoptado por la Junta Directiva del INCOPESCA, en sesión ordinaria número 10-2013 celebrada el 15 de febrero del 2013, adolece de un vicio de nulidad absoluta, por las razones que de seguido se exponen: a) Si bien es cierto, la constitución de una AMPR no implica per se la exclusión de los diversos sectores pesqueros (artículo 6 del Decreto Ejecutivo número 35502-MAG); también lo es, que resulta contrario a los principios preventivo, de razonabilidad y proporcionalidad, que se permita el uso de métodos, artes o formas de pesca que impliquen desde un punto de vista de la ciencia y de la técnica, una desmejora en los recursos marinos y por ende, en la imposibilidad de acceder a un desarrollo sustentable –en este caso- en perjuicio de la comunidad de San Juanillo y sus alrededores.
En ese sentido, el Código de Conducta para la Pesca Responsable de la Organización de las Naciones Unidas para la Agricultura y la Alimentación (FAO), establece la necesidad de no utilizar métodos, artes o formas de pesca no selectivas que impliquen el arrastre y descarte indiscriminado de diversas especies marinas, instrumento que ha sido incorporado a nuestro ordenamiento jurídico interno, mediante distintas fuentes de derecho, como por ejemplo: el Decreto Ejecutivo número N° 27919, vigente desde el 14-06-1999; la Ley 8436, vigente desde el 25 de abril del 2005; o la sentencia 2013-10540 dictada por la Sala Constitucional de la Corte Suprema de Justicia, a las 15:50 horas del 07 de agosto del 2013; b) En razón de lo anterior, no resulta procedente indicar que la propuesta presentada por el Grupo Interinstitucional de Trabajo del AMPR de San Juanillo (folios 1 a 23 del expediente judicial; 94 a 70 del expediente administrativo), carezca de fundamento técnico, pues precisamente y entre otras fuentes, se basa en el Código de Conducta para la Pesca Responsable de la FAO, en el cual, se establece la necesidad de perfeccionar y aplicar artes y prácticas de pesca selectivas, ambientalmente seguras a fin de mantener la biodiversidad y conservar la estructura de las poblaciones, los ecosistemas acuáticos y la calidad del pescado (artículos 6 incisos 5 y 6, 7 inciso 2 sub inciso 2, 8 inciso 5 sub inciso 1); aspecto que no sólo se desprende de la misma propuesta de Plan de Ordenamiento Pesquero de San Juanillo (folios 94 a 70 del expediente administrativo; 1 a 23 del expediente judicial), sino también de la propia declaración testimonial rendida en juicio por Nombre114307 , Coordinador del Grupo Interinstitucional de Trabajo del AMPR de San Juanillo.
En consecuencia y sin perjuicio del criterio que pudiera verter el Director General Técnico de INCOPESCA, a fin de conciliar los intereses de los diferentes sectores pesqueros, tal y como se desprende de los acuerdos AJDIP-405-2012 de la sesión ordinaria 50-2012 del 07 de setiembre del 2012 y AJDIP/494-2012 de la sesión ordinaria 63-2012 del 14 de diciembre del 2012, adoptados por la Junta Directiva del INCOPESCA (folios 163 y 162, 188 a 186 del expediente administrativo), no resulta procedente alegar que las recomendaciones técnicas propuestas en el Plan de Ordenamiento Pesquero para establecer el AMPR de San Juanillo, carecieran de ese carácter, pues de conformidad con lo dispuesto en los artículos 2 y 3 del Decreto Ejecutivo 35502-MAG, la base de discusión que tiene la Junta Directiva del INCOPESCA para determinar la viabilidad del establecimiento de un área marina de pesca responsable y de emitir el Plan de Ordenamiento Pesquero de esa zona, es precisamente ese documento, junto con lo que también pueda aportar el Director General Técnico de INCOPESCA (folios 34 del expediente judicial; 163 y 162 del expediente administrativo).
Afirmar lo contrario, no sólo contradice abiertamente lo dispuesto en los numerales 2 y 3 del Decreto Ejecutivo 35502-MAG, sino que además, implica –tal y como sucedió en este caso- apartarse de una recomendación sustentada en las reglas de la ciencia y de la técnica, sin un fundamento de la misma naturaleza que las desvirtúe, lo cual resulta contrario a lo dispuesto en los artículos 50 de la Ley de Biodiversidad y 59 de la Ley Orgánica del Ambiente, en el sentido de que las actividades humanas, especialmente las relacionadas con asentamientos humanos, agricultura, turismo, industria u otras que puedan afectar los procesos ecológicos vitales, deben ajustarse a las normas técnico-científicas emitidas por los entes públicos competentes; c) Cierto es, que en principio podría sostenerse que de conformidad con lo dispuesto en el inciso 1) del artículo 159 de la Ley General de la Administración Pública, sobrevino un vicio de nulidad absoluta de la conducta formal impugnada, toda vez que al momento en que se dictó dicho acto –específicamente el inciso b) del punto 2 del acuerdo AJDIP/068-2013-, la Sala Constitucional de la Corte Suprema de Justicia, no había declarado contrarios al Derecho de la Constitución los artículos 2 inciso 27 punto d), 43 inciso d) y 47 incisos a) y b) de la Ley 8436 de 1º de marzo de 2005, en cuanto reconocían como lícito el arte de pesca de camarón con redes de arrastre, lo cual explica que en el acuerdo cuestionado se indique, que se permitirá la realización dentro del Área Marina definida, actividades y faenas de pesca por parte de las embarcaciones del sector pesquero semi-industrial camaronero, con el uso de las artes de pesca permitidas legalmente.
No obstante lo anterior, también lo es, que desde el 14 de junio de 1999 se encuentra vigente el Decreto Ejecutivo número 27919 –que responde a lo dispuesto en el numeral 6 de la Constitución Política-, en el cual se estableció “…la aplicación oficial por parte del Estado Costarricense del Código de Conducta para la Pesca Responsable, aprobado por la Organización de las Nacionales Unidas para la Agricultura Alimentación (FAO) en Roma, Italia, el 31 de octubre de 1995, como un instrumento de prácticas responsables con miras a asegurar la conservación, la gestión y el desarrollo eficaz de los recursos acuáticos…”, siendo el INCOPESCA el “…encargado por el seguimiento y aplicación de las disposiciones contenidas en (sic) Código en la actividad pesquera costarricense debiendo proporcionar y facilitar su divulgación y conocimiento a través de mecanismos idóneos al sector pesquero nacional, para lo cual las Instituciones Públicas del país deberán brindarle la colaboración debida, o de sus respectivos campos de competencia…”.
Aunado a que la propia Ley 8436, desde su versión original publicada en La Gaceta número 78 del 25 de abril del 2005 –y vigente desde esa fecha-, establece en los incisos j) y k) del artículo 38, que se prohíbe emplear redes agalleras y redes de arrastre pelágicas de altura y realizar toda práctica que atente contra la sustentabilidad del recurso pesquero, lo cual, se complementa con las normas técnicas contenidas en el Código de Conducta para la Pesca Responsable de la FAO, cuya aplicación oficial por parte del Estado Costarricense se encuentra vigente desde el 14 de junio de 1999. d) En este punto, cabe resaltar que le corresponde al INCOPESCA, en ejercicio de las potestades que le confieren los artículos 12 y 38 de la Ley 8436, como autoridad ejecutora de ese mismo cuerpo legal y del Plan de Desarrollo Pesquero y Acuícola, determinar los métodos, las técnicas, los equipos y las artes de pesca prohibidos, a fin de garantizar, defender y preservar la biodiversidad marina, los recursos pesqueros y el desarrollo sustentable.
Por ello, resulta contrario a los principios de lógica, razonabilidad, preventivo y precautorio, que en el inciso b) del punto 2 del acuerdo AJDIP/068-2013, la Junta Directiva del ente demandado permitiera que dentro del Área Marina de Pesca Responsable de San Juanillo, se realizaran actividades y faenas de pesca por parte de las embarcaciones del sector pesquero semi-industrial camaronero, empleando métodos que desde un punto de vista de la ciencia y de la técnica, implican una desmejora en los recursos marinos y por ende, en un obstáculo para acceder a un desarrollo sustentable de la comunidad de San Juanillo y sus alrededores, a pesar de que contaba con insumos técnicos tanto nacionales como internacionales contenidos en normas convencionales, legales y reglamentarias, para al menos implementar medidas de protección que coadyuvaran a minimizar en parte, los problemas de falta de selectividad del método de pesca de arrastre, tal y como lo recomendó el Director General Técnico del INCOPESCA en el oficio DGT-A-180-10-2012 del 25 de octubre del 2012, al indicar: “…En relación a la pesca de arrastre, considero como recomendación, que podría permitirse después de la línea barimétrica de los 15 metros de profundidad, siempre y cuando utilicen DET tipo de ojo de pescado en la parte superior del copo con dos flotadores…” (folio 232 del expediente administrativo y declaración testimonial rendida en juicio por Nombre114309 ).
En consecuencia, ya existían en el ordenamiento jurídico costarricense, normas de carácter técnico que le imponían al INCOPESCA como ejecutor de la Ley 8436 y del Plan de Desarrollo Pesquero y Acuícola (artículo 12 de ese mismo cuerpo normativo), el deber de establecer no sólo cuáles métodos, artes o prácticas de pesca no resultaban contrarias al derecho a un ambiente sano y ecológicamente equilibrado, sino además, tomar las medidas que fueran necesarias para proteger los recursos marinos y el derecho a un desarrollo sustentable de las comunidades que se dedican al ejercicio de la pesca y a la explotación de los recursos marinos. Y no como en este caso, en que los objetivos que se persiguen con la creación del AMPR de San Juanillo, se tornan nugatorios con lo dispuesto en el inciso b) del punto 2 del acuerdo cuestionado. e) Aunado a lo anterior, tampoco se desprenden las razones técnicas por las cuales, la Junta Directiva del INCOPESCA se aparta, tanto de las recomendaciones técnicas emitidas por el Grupo Interdisciplinario de Trabajo del AMPR de San Juanillo (folios 5 a 2 del expediente administrativo), como de las contenidas en el oficio DGT-A-180-10-2012 del 25 de octubre del 2012, suscrito por el Director General Técnico del INCOPESCA (folios 233 y 232 del expediente administrativo), en cuanto a la profundidad en que podrían pescar los barcos del sector semi-industrial camaronero, puesto que únicamente se establece que las “…faenas que se podrán realizar a partir de una profundidad barimétrica medida de 60 metros a partir de la línea de la costa, iniciando en las coordenadas 09º59´00´´ latitud norte, 85º45´50´´ longitud oeste y de ahí en una línea recta imaginaria paralela a la costa en dirección noroeste, que finalice en una profundidad de 75 metros, de conformidad con la Carta Náutica Oficial de Costa Rica…” (folios 215 del expediente administrativo y 25 del expediente judicial).
En ese sentido valga destacar que el Grupo Interinstitucional de Trabajo de la AMPR de San Juanillo, indicó mediante oficio presentado ante el INCOPESCA el 28 de agosto del 2012, en respuesta a lo dispuesto en el acuerdo número AJDIP-352-2012 adoptado por la Junta Directiva de esa entidad, en sesión ordinaria número 41-2012 del 19 de julio del 2012, que “…el arrastrar de los 40 metros en adelante, significaría la captura no sólo de camarones, sino principalmente de los pargos, carillas y congrios que son las especies objetivo de los pescadores artesanales y que por su vital importancia ecológica y económica para los mismos, son protegidas mediante el Plan de Ordenamiento Pesquero que se realizó para el área marina de pesca responsable y que incluye un total de 5 millas náuticas desde la costa y no hasta las 0.74 millas náuticas promedio que significaría la propuesta de los camaroneros (Anexo I).
Debe recordarse que según normativa vigente, basada en estudios científicos, en Guanacaste, las dimensiones de luz de malla de los trasmallos, no puede ser inferior a las 4.5 pulgadas, por lo tanto resulta un contrasentido el permitir el arrastre semi-industrial que utiliza en sus redes 1 ¼ pulgadas de luz de malla, más aún tratándose de una zona propuesta como área de pesca responsable donde los mismos artesanales están dispuestos a utilizar luz de malla de hasta 5 1/8 pulgadas…” (folios 5 a 1, 45, 144 y 143 del expediente administrativo y declaración testimonial rendida en juicio por Nombre114307 ). Por su parte, el propio Director General Técnico del INCOPESCA, manifestó que “… En relación a la pesca de arrastre, considero como recomendación, que podría permitirse después de la línea barimétrica de los 15 metros de profundidad, siempre y cuando utilicen DET tipo de ojo de pescado en la parte superior del copo con dos flotadores…”, dado que la barimetría de 15 metros ya se había aplicado con gran suceso en otras áreas marinas de pesca responsable, como la Tárcoles, disposición que además y según su dicho, fomenta la captura y posterior comercialización del camarón blanco (folio 232 del expediente administrativo y declaración testimonial rendida en juicio por Nombre114309 ); f) Dicha situación se agrava porque en evidente contravención a los principios preventivo, precautorio, in dubio pro natura e interés público ambiental (artículo 11 de la Ley de Biodiversidad), la Junta Directiva del INCOPESCA estableció en el inciso b) del punto 2 del acuerdo AJDIP/068-2013, que “… a efectos de determinar el impacto en de las pesquerías en la zona, se establecerá una investigación inicial por un período de un año a partir del presente que permita mediar, cuantificar y establecer los impactos y la recuperación de los recursos hidrobiológicos, así como las medidas de ordenación que pueden ser implementadas, mejoradas o modificadas…” (folios 215 del expediente administrativo y 25 del expediente judicial).
En ese sentido, si bien es cierto el numeral 13 del Decreto Ejecutivo número 35502-MAG, establece que una Comisión de Seguimiento velará por el buen manejo del Área Marina para la Pesca Responsable y mantendrá informada a la Presidencia Ejecutiva del INCOPESCA mediante al menos informes semestrales; también lo es, que lo dispuesto en el aparte antes citado del inciso b) del punto 2 del acuerdo AJDIP/068-2013, no responde a una labor de fiscalización y verificación fundada en reglas técnicas emitidas por los entes públicos competentes –en la especie, el INCOPESCA- para el mantenimiento de los procesos ecológicos vitales dentro y fuera de las áreas marinas de pesca responsable, pues ni siquiera sugiere la posibilidad de aplicar medidas de protección que coadyuven a minimizar en parte, los problemas de falta de selectividad del método de pesca de arrastre, como el ojo de pescado o la exclusión de tortugas. g) Por todo lo expuesto, este Tribunal declara que el inciso b) del punto 2 del acuerdo AJDIP/068-2013, adoptado en la sesión ordinaria número 10-2013 celebrada por la Junta Directiva del INCOPESCA el 15 de febrero del 2013, adolece de un vicio de nulidad absoluta, por resultar manifiesta y evidentemente contrario al ordenamiento jurídico, específicamente, a lo dispuesto en los artículos 16 y 136 de la Ley General de la Administración Pública; 11 y 50 de la Ley de Biodiversidad; 59 de la Ley Orgánica del Ambiente; 1 y 2 del Decreto Ejecutivo número 27919; 2, 3 y 13 del Decreto Ejecutivo 35502-MAG; a la Convención de las Naciones Unidas sobre el Derechos del Mar de 1982; la Convención Interamericana para la Protección de las Tortugas Marinas; la Carta Mundial de la Naturaleza de 1982; la Convención sobre Diversidad Biológica; la Declaración de Río y el Código de Conducta para la Pesca Responsable de la FAO, que exigen la adopción de técnicas de pesca selectivas, la conservación del recurso y ecosistemas marinos, que prohíben la sobreexplotación e imponen la aplicación de principios, de técnicas y prácticas de pesca y comerciales acordes con la sostenibilidad de recurso y los principios precautorio y preventivo propios del Derecho Ambiental.
Lo anterior sin perjuicio de lo dispuesto en el Por Tanto de la sentencia número 2013-10540 dictada por la Sala Constitucional, en el sentido de que “…En consideración a los derechos adquiridos de buena fe, los permisos, autorizaciones y licencias vigentes conservarán su validez y vigencia hasta el vencimiento del plazo otorgado a cada una de ellas, siempre que los titulares de los mismos ejerzan la actividad con absoluta sujeción al ordenamiento jurídico que se dicten sobre la materia y condicionado a que adopten, si fuera científicamente posible, las tecnologías más amigables posibles con el ambiente bajo la supervisión del INCOPESCA; una vez expirado el plazo de vigencia, no podrán ser prorrogadas…”. Por las razones que dan lugar a la declaratoria de nulidad absoluta parcial del acuerdo antes indicado, se omite pronunciamiento sobre los demás alegatos en que la parte actora fundamenta su pretensión de nulidad y de disconformidad con el ordenamiento jurídico.
Vo.- EN CUANTO A LAS PRETENSIONES 3 Y 4 DE LA DEMANDA, Y LOS ALCANCES DE LA SENTENCIA NÚMERO 2013-10540 DE LA SALA CONSTITUCIONAL EN EL CASO CONCRETO. En primera instancia, cabe indicar que por voto de mayoría la Sala Constitucional de la Corte Suprema de Justicia, mediante sentencia número 2013-10540 de las quince horas y cincuenta minutos del siete de agosto del dos mil trece, consideró –en lo que interesa- que: “…En consecuencia, la pesca de camarón con redes de arrastre, mientras no se cuenta (sic) con dispositivos para la disminución de la captura incidental (Bycatch Reduction Devices) que significativamente disminuyan la captura incidental (no todos tienen la misma efectividad y no basta con lo que salvan a las tortugas), se opone a los principios consagrados en los instrumentos internacionales sobre los recursos marinos, aplicables en nuestro medio de forma directa al amparo de lo dispuesto en el artículo 6 como ya se dijo, sin perjuicio de la aplicación supletoria y subsidiaria del artículo 7 constitucional.
En efecto, de conformidad con lo dispuesto en el artículo 6 de nuestra Carta Magna, los principios del Derecho Internacional se aplican directamente, de manera que los artículos 2 inciso 27 punto d), 43 inciso d) y 47 incisos a) y b) de la Ley 8436 de 1º de marzo de 2005, en cuanto reconoce como lícita el arte de pesca de camarón con redes de arrastre, resultan violatorios de esta norma constitucional y de los principios del Derecho Internacional sobre la materia que la norma reconoce y que exigen la adopción de técnicas de pesca selectivas, la conservación del recurso y ecosistemas marinos, prohíben la sobreexplotación e imponen la aplicación de principios de técnicas y prácticas de pesca y comerciales acordes con la sostenibilidad de recurso y los principios precautorio y preventivo propios del Derecho Ambiental…”. En razón de lo anterior y de conformidad con lo dispuesto en los artículos 10 de la Constitución Política; 1, 2 inciso b) y 13 de la Ley de la Jurisdicción Constitucional, deberán estarse los accionantes a lo resuelto por la Sala Constitucional de la Corte Suprema de Justicia en la sentencia parcialmente transcrita con anterioridad, para efectos de lo solicitado en la pretensión número 3 de la demanda.
Por otra parte, considera este Tribunal que no resulta procedente la pretensión número 4, tendente a que se ordene al INCOPESCA readecuar el inciso b) del punto 2 del acuerdo AJDIP/068-2013, a lo dispuesto en el punto número 3.13.5 del Plan de Ordenamiento Pesquero del Área de Pesca Responsable San Juanillo, en el sentido de que “…En toda la zona y durante todo el año quedará prohibido el uso de redes de arrastre por el fondo igualmente quedará prohibido el uso de redes sardineras de cerco. Lo anterior por la poca o ninguna selectividad de estos aparejos de pesca y el consiguiente daño a la pesquería y a la economía de los pescadores artesanales de la zona…” (folios 77 y 76 del expediente administrativo; 18 del expediente judicial). Ello por cuanto, la propia Sala Constitucional en el Por Tanto de la sentencia número 2013-10540 de las quince horas y cincuenta minutos del siete de agosto del dos mil trece, dispuso: “…Lo anterior no obsta que mediante la correspondiente reforma legal, en el futuro se puedan reinstaurar las categorías A y B anuladas condicionado a que se haga referencia expresa a la obligación de utilizar dispositivos para la disminución de la captura incidental (Bycatch Reduction Devices), respecto de los cuales de manera previa a una reforma legal y con el correspondiente respaldo científico y tecnológico, se demuestre una reducción significativa de dicha captura incidental que sea compatible con un desarrollo sostenible democrático.
Al respecto, se debe advertir que en el estado actual de la tecnología, no todo dispositivo de este tipo cumple tal requerimiento ni tiene la misma efectividad…”. Sin perjuicio de que la pretensión número 4, implicaría una violación de los derechos adquiridos de buena fe, que fueron reconocidos por la Sala Constitucional en la parte dispositiva de la sentencia número 2013-10540, al ordenar que “…En consideración a los derechos adquiridos de buena fe, los permisos, autorizaciones y licencias vigentes conservarán su validez y vigencia hasta el vencimiento del plazo otorgado a cada una de ellas, siempre que los titulares de los mismos ejerzan la actividad con absoluta sujeción al ordenamiento jurídico que se dicten sobre la materia y condicionado a que adopten, si fuera científicamente posible, las tecnologías más amigables posibles con el ambiente bajo la supervisión del INCOPESCA; una vez expirado el plazo de vigencia, no podrán ser prorrogadas…”.
En consecuencia, al no excluir la Sala Constitucional la posibilidad de que se utilicen técnicas de arrastre, siempre que “…se demuestre una reducción significativa de dicha captura incidental que sea compatible con un desarrollo sostenible democrático…”, y al reconocer los derechos adquiridos de quienes tienen licencias de pesca por arrastre vigentes, las cuales podrán continuar utilizando hasta su vencimiento, siempre y cuanto apliquen dispositivos para la disminución efectiva de la captura incidental acaecida con el método de pesca de arrastre, este Tribunal ordena a la Junta Directiva del INCOPESCA, que deberá establecer con base en el correspondiente respaldo técnico y científico, los métodos, artes y prácticas que el sector semi-industrial camaronero podría eventualmente utilizar y a partir de qué profundidades barimétricas, en el AMPR de San Juanillo, claro está, si eso fuera técnicamente posible.
Para tal efecto, se le otorga el plazo de 1 año contado a partir de la firmeza de este pronunciamiento, período en el cual, deberán demostrar cada tres meses ante los Jueces de la fase de ejecución de sentencias de esta jurisdicción, los avances tendentes al cumplimiento efectivo de dicha orden. Asimismo y al término de dicho plazo de 1 año, deberán rendir ante los Jueces de Ejecución de Sentencias de este Tribunal, un informe completo en que de manera detallada se acrediten las acciones concretas adoptadas, a fin de establecer si técnicamente es posible que el sector semi industrial camaronero puede o no realizar faenas de pesca en el AMPR de San Juanillo, bajo qué técnicas y a partir de qué profundidades barimétricas. En todo caso y para no hacer nugatorios los efectos de este pronunciamiento, se dispone mantener los efectos de la medida cautelar otorgada por la Jueza Tramitadora del Tribunal Contencioso Administrativo y Civil de Hacienda, mediante resolución número 2013-002160 de las 09:30 horas del 09 de octubre del 2013, hasta que esta sentencia adquiera firmeza.- VIo.- SOBRE LOS PRESUPUESTOS FONDO.
Este Tribunal llega a la conclusión de que los actores cuentan con legitimación activa para participar en este proceso conforme al artículo 105 de la Ley de Biodiversidad, ya que en su condición de vecinos de San Juanillo y en algunos casos de pescadores de esa zona, accionan en defensa y protección de la biodiversidad. Además, la acción se dirige correctamente contra el Instituto Nacional de Pesca y Acuicultura, tal y como lo dispone el artículo 12 inciso
POR TANTO.
Se declara parcialmente con lugar la demanda interpuesta por Nombre114292 contra el Instituto Costarricense de Pesca y Acuicultura, en los siguientes términos, entendiéndose por denegada en lo que no se indique de manera expresa:
