SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At eight forty-eight a.m. on the twenty-ninth of April, two thousand sixteen.- POSSESSORY INFORMATION PROCEEDING instituted by AVENTURA ECOLÓGICA DEL NORTE SOCIEDAD ANÓNIMA, corporate identification number CED1- - . Participating in this proceeding as representative of the petitioner is Mr. [Nombre1][Nombre2], of legal age, businessman, married once, identity card number CED2 - - , and attorney Arturo Pacheco Murillo, bar association card number seven thousand two hundred seven, acting under a special judicial power of attorney (poder especial judicial) granted by [Nombre1]. The matter was heard before the Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, Guápiles.- BACKGROUND:

1 .- AVENTURA ECOLÓGICA DEL NORTE SOCIEDAD ANÓNIMA filed an application seeking registration in its name of forest land located at [Dirección1], , , Province of HEREDIA. The property is described in cadastral survey plan (plano catastrado) number H - one million six hundred fifty-four thousand eight hundred twenty - two thousand thirteen, with an area of forty-nine hectares and five thousand two hundred nine square meters, bounded on the North by: Caño Tamborcito; on the South by: [Nombre3]; on the East by: Aventura Ecológica del Norte Sociedad Anónima, a lagoon and a channel; and on the West by: Caño Tamborcito. (Plan at folio 50 and description of the land at folio 55) 2 .- The Procuraduría General de la República and the Instituto de Desarrollo Agrario were afforded an opportunity to participate, and neither opposed these proceedings, although the State Attorney did request that the proceedings be denied. (folios: 89, 200 to 204)

  1. 3Judge Ronald Rodríguez Cubillo of the Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, Guápiles, by judgment number 22-16, at nine thirty-five a.m. on the tenth of February of the year two thousand sixteen, ruled: “POR TANTO: In view of the foregoing, pursuant to LEY DE INFORMACIONES POSESORIAS N° 139 of 14 July 1941 and its amendments, these INFORMACIÓN POSESORIA proceedings brought by AVENTURA ECOLÓGICA DEL NORTE SOCIEDAD ANÓNIMA, corporate identification number CED5- - , domiciled in San José, San José Mata Redonda, [Dirección2] [Dirección3], , [Dirección4] , , ARE APPROVED; it is the possessor of a parcel described as follows: property consisting of forest, located in Tambor, [Dirección5] , [Dirección6] SARAPIQUÍ, Province of HEREDIA. The property is described in cadastral survey plan number H - one million six hundred fifty-four thousand eight hundred twenty - two thousand thirteen, with an area of forty-nine hectares and five thousand two hundred nine square meters, bounded on the North by: caño Tamborcito; on the South by: [Nombre3] ; on the East by: Aventura Ecológica del Norte Sociedad Anónima, a lagoon and a channel; and on the West by: Caño Tamborcito.This is because it has fulfilled all the requirements established for such purpose by the Ley de Informaciones Posesorias. The property was valued at ten million colones. A certified copy of this judgment shall serve to register the aforementioned property with the Registro de la Propiedad. Said registration is made with notice to the title applicant and its representatives that the area adjoining the [Dirección7] channel, lagoon, and channel bordering the property to be titled along its [Dirección8] and [Dirección9] boundaries, as well as any other ravines or watercourses that exist or may exist along the boundaries or on the property of AVENTURA ECOLÓGICA DEL NORTE SOCIEDAD ANÓNIMA, and which are identified in article 33 of Ley Forestal Nº 7575, constitute protected areas (áreas de protección), and the cutting or removal of trees is prohibited. It is likewise placed on record that the beds and waters of those watercourses are in the public domain (dominio público), as established in Ley de Aguas, article 1, subsection IV, and 3, subsection III.Also applicable are articles 1, 2, 3, 4, 5, 6, 7 of Ley de Informaciones Posesorias and 1, 2, 7 and 25 of Ley de Jurisdicción Agraria, Ley de Conservación de Vida Silvestre, and Ley Orgánica del Ambiente. Once this decision becomes final, the corresponding enforceable certified copy (ejecutoria) shall be issued and this matter shall be closed. The participants are hereby advised that this decision may be challenged; therefore, if any party intends to file an appeal against it, please also submit the appeal electronically to the address [...] This is due to the introduction of oral proceedings in agrarian matters. Furthermore, if a party wishes the appellate court to grant an oral hearing, it must state so in the same appellate brief. Likewise, the parties are advised to designate, as a matter of priority, an email address for receipt of notices, because documents recorded in audio or video format may be sent to them through that medium (oral judgment).- (folios 215 to 218)

4 .- Deputy State Attorney Susana Fallas Cubero filed an appeal expressly stating the reasons for challenging the trial court’s position. (folios 231 to 235). - 5 . - The statutory requirements were observed in the conduct of the proceeding, and no errors or omissions capable of rendering the judgment null and void are apparent. - Drafted by Judge FISHER GONZÁLEZ; and

CONSIDERING

I.The Court does not concur with established facts 1), 2), and 3), in view of what has been established at this level of review. Nor does it endorse facts 4, 6, 8, 9, 10, and 11, because they concern procedural matters that should not properly be listed as proven facts relevant to deciding the merits of the case. Fact 5) is adopted, with the following addition: “which was created by Decreto No. 3240-MINAE of 23 May 2005 and had previously been subject to Decreto No. 22965- MIRENEM of 15 February 1994, which created Humedal Lacustrino Tamborcito” (official letter No. SINAC- ACAHN-OTAT-013-2016 at folios 219 to 230). The following fact of the same nature shall also be added: 12) The property registered under record number CED6 in the Heredia Registry District, in the name of the petitioning company, was titled through a possessory information proceeding before the Juzgado Primero Civil de Heredia, approved by decision issued at eight forty-five a.m. on the fourth of June, nineteen eighty-six, based on cadastral survey plan H-22550-1974, and it currently borders the land at issue in this proceeding to the south. (certification at folio 8, cadastral survey plan at folio 6, copies of the possessory information proceeding at folios 10 to 14).

II.The Court finds the following fact unproven: That the petitioner acquired a possessory right (derecho de posesión) exercised by third parties over the area to be titled, dating back to at least the year 1984. (No documentary evidence was submitted, and the testimonial evidence is insufficient for this Court for the reasons to be stated in the analysis below.)

III.The Procuraduría General de la República bases its appeal on the following grounds:

  • 1)The State’s representative requested that JAPDEVA be served with notice so that its interests would not be adversely affected. This was because the land might be included within property No. 7-96658-000, according to the technical study submitted by INDER in this proceeding. It was also requested that INDER be ordered to submit the overlay showing the overlap. Those requests were denied, however.
  • 2)The property lies within Refugio de Vida Silvestre Mixto Maquenque, created by Decreto No. 32405.MINAE of 23 May 2005, and was subject to Decreto No. 22965- MIRENEM of 15 February 1994, which created Humedal Lacustrino Tamborcito, according to the attached official letter No. SINAC- ACAHN-OTAT-013-2016. Repealed law remains applicable to govern rights, situations, or legal relationships arising under it. In light of the foregoing, the petitioning company did not acquire the property until 1998.
  • 3)According to the initial application, the petitioning company did not acquire the property until 1998 from its representative, [Nombre2], who in turn acquired it from [Nombre4] in 1993. The witness testimony is inconsistent with the foregoing and does not even demonstrate ten-year possession (posesión decenal) predating the effective date of Decreto No. 32405-MINAE, because [Nombre5] knows only of [Nombre2]’s occupation during the last eleven years ([Telf1]) and has no knowledge of any earlier occupants; he even states that when he first became acquainted with the land, he did not know who owned it. Furthermore, [Nombre6] stated that when he first became acquainted with the land it was vacant public land (tierras baldías), and the date on which any occupant entered the property cannot be determined from his testimony; he also stated that [Nombre2] acquired it “15 years” ago (that is, in the year 2000, not in 1993) from [Nombre7]. For his part, [Nombre8] does not indicate how long he has known the land, but only how long ago he arrived in the area; nor does he identify [Nombre4] as the person who transferred it to [Nombre2], referring only to [Nombre9] and [Nombre7], without stating the dates during which each of them occupied the property to be titled. In this regard, the Tribunal Agrario has held that the length of time a person has lived in a place does not establish with precision how long that person has known the land, and that witness statements must be consistent with one another and with the allegations in the initial application in order for transferred possession (posesión transmitida) to be given effect and for those statements to be deemed credible by the adjudicator.
  • 4)According to official letter No. SINAC-ACAHN-OTAT-013-2016 attached to the appeal, plan No. H-1654820-2013 encompasses portions of a lagoon within the Tambor lagoon complex that are in the public domain.

IV.As to the first ground of appeal, it is without merit. This is because, although the Instituto de Desarrollo Rural appeared in the proceeding and stated that the parcel to be titled was included within the property registered in the Limón Registry District under record number [Placa1], owned by JAPDEVA (folio 89), the contrary was subsequently demonstrated. Thus, the report of the Área de Estudios Especiales de la División de Catastro, Registro Inmobiliario, prepared for purposes of this proceeding, categorically concluded that plan H-1654820-2013 does not overlap property 7-96658-000 (folios 171 and 172). The Catastro Nacional is the technical body with jurisdiction to determine that issue; therefore, this Court sees no need for JAPDEVA necessarily to be joined in the proceeding. Turning to the second and third grounds of appeal, the appellant is correct, because the petitioner did not conclusively prove that it exercised the possession necessary and sufficient to acquire by adverse possession (usucapir) the forest land at issue in this proceeding, for the reasons stated below.

V.First, the party explains in its initial filing that it owns a forest unit consisting of a registered property, registration number [Placa2], titled through a possessory information proceeding (información posesoria) (folios 8 to 14), based on survey plan H-22550-1974 (folio 6); and an adjacent unregistered property, depicted in cadastral plan H-1654820-2013 (folio 50), the latter being the property it seeks to title. It alleges that it purchased the land as a single property from [Nombre2] by public deed number 22-24 at 10 hours on 1 de agosto de 1998, before Notary Public Lázaro Broitman Feinzilber, but that, at the time, the plan used in that prior possessory information proceeding erroneously omitted the portion now sought to be titled. It states that “apparently, what happened was that the surveyor who measured the property treated the stream running through its center as though it were [Dirección10], thereby leaving that portion out of the possessory information proceeding and its corresponding registration.” Both portions are included in cadastral plan 4-1103035-2006 (folio 3).

After analyzing those plans and the documentation relating to the judgment in the possessory information proceeding, the conclusion is that the applicant company’s purchase in 1998 of property registration number [Placa2] does not mean that it also acquired a possessory right (derecho de posesión) over the additional unregistered area of forty-nine hectares and five thousand two hundred nine square meters located to the north, because the plan describing the property and serving as the basis for that prior titling did not encompass that area. A comparison of plans H-22550-1974 (the basis for that prior titling) and 4-1103035-2006 (which combines both portions) shows that the northern boundary (lindero) of the registered property was not the Tamborcito channel, but another channel or small stream that still exists. Note that vertex 12 of the 1974 plan coincides with vertex 133 of the 2006 plan; likewise, point 12 of that 1974 plan, near the “suampo,” corresponds to point 142 of the other 2006 plan; and similarly, vertices 26, 30 and 34 of the 1974 plan correspond to vertices 182, 116 and 130 of the other plan.

The judgment in the possessory information proceeding does indeed state that the property is bounded to the north, east and west by the Tamborcito channel, but this was an evident error, because the 1974 plan did not identify the boundary in that manner, that number of hectares was not titled, and it does not correspond to the natural configuration of that boundary. Based on the foregoing, the instrument by which the registered property was acquired cannot be regarded as the basis for acquiring the unregistered area; consequently, the applicant party’s possession of that section began in 1998, when it acquired the property (certification at folio 8). Second, it should be noted that although the property lies within what is now the Refugio Nacional de Vida Silvestre Mixto Maquenque, created by Decreto Ejecutivo No, 32405 of 13 de junio del 2005 (certification at folio 16), Article 3 of that Decree ordered the repeal of: “Decretos Ejecutivos 22990-MIRENEM creating the Reserva Forestal Cerro El Jardín, signed on 21 de febrero de 1994 and published in La Gaceta 53 on 16 de marzo de 1994; 23074-MIRENEM creating the Reserva Forestal Cureña, signed on 17 de marzo de 1994 and published in La Gaceta 67 of 7 de abril 1994; 22965-MIRENEM creating the Humedal Laguna de Tamborcito, signed on 15 de febrero de 1994 and published in La Gaceta 48 on 9 de marzo de 1994; and 22964-MIRENEM creating the Humedal Palustrito Laguna Maquenque, signed on 15 de febrero de 1994 and published in La Gaceta 48 on 9 de marzo 1994.

These protected wildlife areas (áreas silvestres protegidas) are reclassified as a Mixed National Wildlife Refuge as part of the Refugio Nacional de Vida Silvestre Mixto Maquenque.” Accordingly, as shown by report SINAC-ACAHN-OTAT-013-2016, dated 26 de febrero del 2016 (folio 224), the property lay within the area affected by Decreto No. 22965-MIRENEM Humedal Lacustrino Tamborcito, in force since 9 de marzo de 1994, which subjected that area to protection “because they are minimally altered lagoons of great biological and limnological interest and also constitute a remnant of habitat that is highly important for the manatee (Trichechus manatus), considered to be in imminent danger of extinction in Costa Rica.” Note that the Decree creating the Refugio de Vida Silvestre Mixto Maquenque reclassifies those areas but does not remove their protected status; consequently, the possession that must be proven must date back at least to 1984, that is, ten years before the declaration under the aforementioned 1994 Decree, as required by Article 7 of the Ley de Informaciones Posesorias.

Third, it must be considered that, according to the applicant entity, it acquired the aforementioned registered property from its own representative in 1998 (initial filing at folio 32); it must therefore be understood that its possession of the unregistered area began that year, when the area was already part of the public domain (dominio público), and it has not shown that it acquired the possessory rights of prior possessors over that area, since the only fact established with certainty in the record is that it acquired solely the registered area. Moreover, the testimonial evidence does not reliably establish that the possession exercised by [Nombre9] and [Nombre10] continuously extended, for forty years, to the area reaching [Dirección11], because their testimony is understood to mean that the property is now bounded by that channel to the north; however, because that area was not actually encompassed by the possessory information proceeding brought by [Nombre10], it cannot be presumed that possession was also exercised over the unregistered area.

Furthermore, insofar as the property is now bounded by the channel, this is attributable, at most, to the possession of that area begun by the applicant entity in 1998, which is not capable of giving rise to title by acquisitive prescription (usucapión), because the property has been subject to the public domain (demanio público) since 1994. [Nombre5] is unable to specify the size of the property and does not know from whom [Nombre2] obtained it, which means that [Nombre5] also cannot establish with certainty the specific possession of the area to be titled and that the testimony is not credible. No witness identifies Ms. [Nombre4] as a possessor, although according to the initial filing she transferred the property to [Nombre2] (folio 32), an issue that creates an inconsistency in the chain of transfers and that, together with the foregoing considerations, leads this Court to conclude that possession specifically exercised over the area to be titled since at least 1984 was not clearly established.

Even in the possessory information proceeding concerning the area that is now registered, brought by Mr. [Nombre11] before the Juzgado Primero Civil de Heredia and approved by a decision issued at eight hours and forty-five minutes on cuatro de junio de mil novecientos ochenta y seis (folios 11 to 13), it was stated that he acquired the property from [Nombre12], who was not mentioned by the witnesses who testified in this proceeding, thereby creating even greater doubt as to whether the true chain of transfers was established. .

VI.Based on the foregoing, the judgment must be reversed because the ten-year possession required by Article 7 of the Ley de Informaciones Posesorias was not clearly and sufficiently proven, and these proceedings must instead be dismissed.

VII. NOTE SET FORTH BY JUDGE [Nombre13]

The public domain (dominio público)—for purposes of the case before us—is the set of publicly owned assets of the State, lato sensu, designated for the direct or indirect public use of the inhabitants and subject to a special public-law regime and, therefore, one that exceeds the bounds of private law. The public domain consists of four elements: subjective, objective, normative, and teleological. The subjective element refers to the holder of the right—the State; the objective element refers to, or consists of, the asset or assets over which the public domain extends—in this case, the real property at issue in the litigation; the normative element determines when an asset meets the statutory requirements to be considered public-domain property (demanial), and consists of the body of rules governing it—the body of rules set forth below; and the teleological element refers to the purpose pursued by including a particular asset within the public domain, that is, the public purpose assigned to the asset—in this case, the protection of natural resources.

Public-domain assets are subject to a special legal regime and to the police power, and are essentially characterized by their inalienability and freedom from acquisitive prescription. By their nature, they are intended to meet public needs; this precludes their being held or possessed by individuals or private persons, and they are outside the stream of private-law commerce. Article 121, subsection 14), of our Political Constitution refers to public-domain status (Demanialidad), specifying which assets may be subject to that public-ownership regime and even establishing different degrees of public-use designation (afectación pública) in that article, ranging from an intense and absolute degree of public dedication (publicatio) to less intense degrees, thereby harmonizing the rights of private parties with the powers of the Administration. Our current Civil Code, dating from April eighteen eighty-six, establishes the most important foundations governing public-domain assets, specifically in Articles 261 through 263.

Article 262 of the aforementioned Civil Code refers to two important characteristics of public-domain assets: a- public things are outside the stream of commerce; and b- withdrawal from public use (desafectación) is established by providing that those assets may not enter private commerce unless legally so ordered. As may be seen, designation under the public-domain regime does not depend on the nature of the asset, but on the will of the legislature. In decision number 447-91, issued at fifteen hours thirty minutes on 21 de febrero de 1991, the Constitutional Chamber states that an asset is declared to be in the public domain by law; this declaration does not constitute a limitation on property under Article 45 of the Constitution, because that article refers to private property, and public-domain assets are not subject to private ownership. The State Forest Estate (Patrimonio Forestal del Estado) is a public-domain asset governed by a broad body of rules that, historically and through the present day, has prohibited private parties from performing any kind of work within properties having that status and has consequently denied them the right of possession, subject to an exception in one specific situation discussed below.

Lands constituting National Reserves (Reservas Nacionales) that contain forests are considered State Estate (Patrimonio Estatal)—in their capacity as public-domain property (Demanio Público), which entails the principles of freedom from prescription, inalienability, and immunity from attachment. The foregoing is developed in the legal provisions set forth below: 1) The Fiscal Code of 1865, which contains a chapter concerning forests and was repealed by General Vacant Lands Law Number thirteen of 6 de enero de 1939, which incorporated substantially the same provisions. For example, Article One stated: “Lands located within the boundaries of the Republic that have not been acquired or registered as property by private parties under lawful title are presumed to be vacant lands (baldíos) and to belong to the State.” In general, this law governs the prohibition against possessing and registering, through possessory-information proceedings (informaciones posesorias), National Reserves that form part of the Forest Estate; in other words, they are not susceptible to appropriation by private parties.

Land and Colonization Law Number 2825 of 14 de octubre de 1961 maintained the same approach and has remained in force since that date. Thus, Article 8 of that Land and Colonization Law provides: “Except in the cases provided for in this law, private parties are prohibited from enclosing lands declared to be National Reserves with fences, boundary paths, or by any other means; clearing woodland; erecting structures or planting crops; or extracting firewood, timber, vines, palm, or other products from them for purposes of exploitation. Any such act, unless the legal procedures have first been completed and the corresponding authorization obtained, shall be deemed, as applicable, usurpation of the public domain or unlawful taking, and the authorities shall order the destruction and removal of the fences and prevent the use of those lands, without any right to compensation or claims for the value of improvements and without prejudice to any other liabilities that may be incurred by those committing such offenses.” It should be noted that this article imposes criminal penalties on anyone who enters a National Reserve to carry out any activity on such lands; that activity therefore cannot be considered an act of possession because it would be unlawful.

Article 11 of the same Law establishes that the following belong to the State as National Reserves: “a) All lands located within the boundaries of the Republic that are not registered as the private property of individuals, Municipalities, or Autonomous Institutions. b-) Those not supported by ten-year possession. c-) Those that have not been designated by special laws for the establishment of agricultural colonies. d-) In general, all lands that, while not privately owned, are not occupied for public services.” Article 19 of repealed Ley Forestal number 4465 of veintitrés de noviembre de mil novecientos sesenta y nueve provided: “All forests and forest lands located in the following areas are hereby designated for the purposes of this law: ‘a-) Lands considered National Reserves…’” Article 25 of the same law stated: “Possession of lands located in the National Reserves and State properties referred to in Article 19 of this Law shall create no rights of any kind; the State’s action for recovery of those lands (acción reivindicatoria) shall not be subject to prescription; and the General Forestry Directorate, using the legal means at its disposal, shall proceed to evict from such lands any persons occupying them in whole or in part, when they are Protective Zones (Zonas Protectoras), National Parks (Parques Nacionales), Forest Reserves (Reservas Forestales), or Biological Reserves (Reservas Biológicas).” These provisions grant the forests mentioned therein dual protection: first, because of their status as National Reserves, in which any act of possession is prohibited; and second, because they form part of the State Forest Estate, in which no act of possession shall create a right of any kind.

This is confirmed by Article 8 of the regulations to that law, which provides: “National lands located within areas declared to be Forest Reserves are inalienable, meaning that they may not leave the ownership of the State, and possession thereof shall create no right of any kind, in accordance with Articles 25, 49, and 57 of the Ley Forestal.” Article 80 of the aforementioned repealed Ley Forestal stated: “The invasion and occupation of lands in National Parks, Forest Reserves, and Protective Zones are prohibited. This prohibition extends to National Reserves until their classification and transfer have been determined…” Article 6 of the same law provided: “Any person who: a-) Exploits a forest forming part of the forest estate without the corresponding legal authorization… b-) Invades a National Park, Biological Reserve, Protective Zone, or Forest Reserve… shall be punished by imprisonment for six months to two years or by a fine of fifteen to one hundred days.

If the invasion occurs in National Reserves, it shall be subject to Article 227 of the Criminal Code.” As may be seen, acts of possession carried out in a forest forming part of the State Estate are unlawful and therefore cannot confer any right of possession. Upon the entry into force of Ley Forestal Number 7174 of 28 de junio de 1990, this same approach continued. Article 32 of the aforementioned law establishes: “The State Forest Estate consists of all forests and forest lands within the National Reserves…” Article 33 of the same law provides: “The forest lands and forests constituting the State Forest Estate and specified in the preceding article shall be immune from attachment and inalienable; possession thereof by private parties shall create no right in their favor, and the State’s action for recovery of those lands shall not be subject to prescription. Consequently, they may not be registered in the Public Registry through possessory-information proceedings, and their invasion and occupation shall be punished in accordance with this Law.” The current Ley Forestal number 7575 of 5 de febrero de 1996, in Title II, governs a single chapter devoted exclusively to the State Natural Heritage (Patrimonio Natural del Estado), following the same approach that began in 1865 with the Fiscal Code; accordingly, this new body of law reiterates that the State Natural Heritage shall consist of the forests and forest lands of the National Reserves, areas declared inalienable, and properties registered in the name of the Public Administration.

Article 14 of the same current Ley Forestal emphatically states that the forest lands and forests constituting the State Natural Heritage are not subject to prescription, are immune from attachment, and are inalienable, and that possession thereof by private parties shall create no right in their favor. Wildlife Conservation Law Number 7317 of 21 de octubre de 1972, in Articles 3 and 4, in addition to declaring wild fauna and flora, respectively, to be in the public domain and of public interest, states that wild flora and fauna form part of the National Heritage. In the same vein, Biodiversity Law number 7788 of 30 de abril de 1998, in Article 6, declares the components of biodiversity to be in the public domain, as does the Organic Law of the Environment in Article 46, which establishes the State’s sovereignty over biological diversity. In view of the foregoing, it is legally imperative to deny the right of possession to persons who carry out any activity on lands that are not privately owned and that consist of forests within National Reserves.

As an exception to that mandatory prohibition, Ley Forestal Number 7575 of 1996, which amends Article 7 of the Possessory Information Law, permits title to forests when what is understood as ecological possession (posesión ecológica) has been exercised within them. The land at issue in this possessory-information proceeding forms part of the State Natural Heritage because it consists in part of forest located within Refugio Nacional de Vida Silvestre Maquenque; it is therefore clear that this territory has formed part of the State Natural Heritage since before the Refuge was created by Decree, as already explained in the legislative history supra.

When possession (posesión) of public-domain property (bien demanial) is disputed, such a dispute shall be permissible only where the right was acquired before the property was declared to be in the public domain (dominio público). Likewise, the right of ownership (derecho de propiedad) in such cases may be obtained only where the holder has demonstrated ten-year possession (posesión decenal), exercised for at least ten years before the effective date of the law declaring the property to be part of the State Natural Heritage (Patrimonio Natural del Estado). As the legal chronology protecting the State Natural Heritage has already been set forth, the law that must be considered in calculating private parties’ ten-year possession is Ley de Tierras y Colonización number 2825 of 14 de octubre de 1961, which is currently in force. The Código Fiscal of 1865 and Ley de Terrenos Baldíos of 1939 should not be considered, since they addressed the subject only in general terms and, moreover, are no longer in force; it was not until the current Ley de Tierras y Colonización that State Property or State Natural Heritage (Propiedad o Patrimonio Natural del Estado) was clearly defined and regulated.

Subsequent laws, such as Ley Forestal and others cited in this recital (considerando), supplement the aforementioned Ley de Tierras y Colonización. In this particular case, the testimonial evidence (prueba testimonial) obtained does not establish such ten-year possession under the legislation set forth herein; this note is entered to indicate that the petitioner (promovente) was required to prove ten years of possession prior to Ley de Tierras y Colonización, rather than prior to the Decrees cited, as stated in the preceding recitals.-

THEREFORE

VOTO N° 380-F-16 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las ocho horas y cuarenta y ocho minutos del veintinueve de abril de dos mil dieciséis.- INFORMACIÓN POSESORIA establecida por AVENTURA ECOLÓGICA DEL NORTE SOCIEDAD ANÓNIMA, cédula jurídica número CED1- - . Participan en este proceso como Representante de la accionante el señor [Nombre1][Nombre2] , mayor, empresario, casado una vez, cédula de identidad número CED2 - - , y el l icenciado Arturo Pacheco Murillo, carné número siete mil doscientos siete, r epresentación otorgada mediante p oder e special [Nombre1] udicial. En el trámite se han tenido como parte al INSTITUTO DE DESARROLLO RURAL, representado por su apoderada general judicial Licenciada Marjorie Madrigal Muñoz , mayor, casada, abogada, vecina de San Ramón, Alajuela, cédula de identidad CED3 - - ; y a la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por la Procuradora Adjunta Licenciada Susana Fallas Cubero, mayor, casada, abogada, vecina de San José, cédula de identidad CED4 - - . Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, Guápiles.-

RESULTANDO :

1 .- AVENTURA ECOLÓGICA DEL NORTE SOCIEDAD ANÓNIMA, plantea gestión a efecto de que a su nombre se inscriba un terreno de bosque, situado en [Dirección1], , , Provincia de HEREDIA. Inmueble descrito en el plano catastrado número H - un millón seiscientos cincuenta y cuatro mil ochocientos veinte - dos mil trece, con una extensión de cuarenta y nueve hectáreas con cinco mil doscientos nueve metros cuadrados, colinda al Norte: con C año Tamborcito; Sur: con [Nombre3] ; Este: con Aventura Ecológica del Norte Sociedad Anónima , Laguna y Caño, al Oeste: con Caño Tamborcito. (Plano a folio 50, y descripción del terreno a folio 55) 2 .- Se ha dado intervención a la Procuraduría General de la República y al Instituto de Desarrollo Agrario, quienes no se han opuesto a estas diligencias , aunque sí solicita la señora Procuradora que sean improbadas las diligencias . (folios: 89, 200 a 204)

  1. 3El juez Ronald Rodríguez Cubillo, del Juzgado Agrario de l Segundo Circuito Judicial de la Zona Atlántica, Guápiles, mediante sentencia número 22-16, de las nueve horas y treinta y cinco minutos del diez de febrero del año dos mil dieciséis , resolvió: " POR TANTO : Por lo expuesto, de conformidad con la LEY DE INFORMACIONES POSESORIAS N° 139 del 14 de julio de 1941 y sus reformas, SE APRUEBAN estas diligencia de INFORMACIÓN POSESORIA promovidas por AVENTURA ECOLÓGICA DEL NORTE SOCIEDA D ANÓNIMA, cédula jurídica número CED5- - , domiciliada en San José, San José Mata Redonda, [Dirección2] [Dirección3], , [Dirección4] , , es poseedor de un fundo que se describe así: finca cuya naturaleza es bosque, situada en Tambor, [Dirección5] , [Dirección6] SARAPIQUÍ, Provincia de HEREDIA. Inmueble descrito en el plano catastrado número H - un millón seiscientos cincuenta y cuatro mil ochocientos veinte - dos mil trece, con una extensión de cuarenta y nueve hectáreas con cinco mil doscientos nueve metros cuadrados, colinda al Norte: con caño Tamborcito; Sur: con [Nombre3] ; Este: con Aventura Ecológica del Norte Sociedad Anónima , Laguna y Caño, al Oeste: con Caño Tamborcito.Por cuanto ha cumplido con todos los requisitos que al efecto establece la ley de Informaciones Posesorias. Bien que fue estimado en la suma de diez millones de colones. Sirva la certificación de esta sentencia para inscribir en el Registro de la Propiedad la finca citada. Dicha inscripción se hace advirtiendo a la titulante y sus representantes, que el área contigua al caño [Dirección7], laguna y caño colindantes por los rumbos [Dirección8], y [Dirección9] de la propiedad a titular, así como a las demás quebradas o corrientes de agua que existen o puedan existir en las colindancias o en la propiedad de la empresa AVENTURA ECOLÓGICA DEL NORTE SOCIEDAD ANÓNIMA, y que señala el artículo 33 de la Ley Forestal Nº 7575, constituyen áreas de protección y queda prohibida la corta o eliminación de árboles. De igual forma se hace constar que el cauce y las aguas de esas corrientes son de dominio público, tal y como lo establece la Ley de Aguas, artículo 1, inciso IV, y 3, inciso III.Además artículos 1, 2, 3, 4, 5, 6, 7 de la Ley de Informaciones Posesorias y 1, 2, 7 y 25 de la Ley de Jurisdicción Agraria, Ley de Conservación de Vida Silvestre y Ley Orgánica del Ambiente. Una vez firme esta resolución, expídase la ejecutoria respectiva y archívese el presente asunto. Se les hace saber a los intervinientes que esta resolución es impugnable, por lo que si alguna de las partes va a presentar recurso de apelación contra la misma, favor remitir además, el recurso de apelación por formato electrónico a la dirección [...] Ello por motivo de la inserción de la oralidad en materia agraria. Además si es el deseo de la parte que el Tribunal de alzada les confiera una audiencia oral, deberán de hacerlo saber en el mismo escrito de apelación. En igual sentido se le recomienda a las partes señalar prioritariamente un correo electrónico donde recibir notificaciones, ello porque a través de este medio, se les puede enviar documentos grabados en audio o video (sentencia oral).- (folios 215 a 218)

4 .- La Procuradora Adjunta Susana Fallas Cubero formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia , (folio s 231 a 235 ). - 5 . - En la substanciación del proceso se han observado las prescripciones legales, y no se. nota la existencia de errores u omisiones en el fallo capaces de producir su nulidad. - Redacta la Jueza FISHER GONZÁLEZ y;

CONSIDERANDO

I.El Tribunal no comparte los hechos tenidos por demostrados 1), 2), 3) dado lo que se ha tenido por demostrado en esta instancia. Tampoco se avalan los hechos 4, 6, 8, 9, 10 y 11 por ser aspectos de trámite que no deben de enlistarse propiamente como hechos probados que sean relevantes para resolver el fondo del asunto. Se prohija el hecho 5) debiendo adicionarse lo siguiente: "el cual fue creado mediante Decreto No. 3240-MINAE del 23 de mayo del 2005, y estaba afectado anteriormente por el Decreto No. 22965- MIRENEM del 15 de febrero de 1994, creador del Humedal Lacustrino Tamborcito" (oficio No. SINAC- ACAHN-OTAT-013-2016 a folio 219 a 230). De esta misma naturaleza deberá de agregarse el siguiente: 12) La finca inscrita bajo la matrícula CED6, del Partido de Heredia, a nombre de la sociedad promovente, se tituló por medio de información posesoria ante el Juzgado Primero Civil de Heredia, aprobada en resolución de las ocho horas y cuarenta y cinco minutos del cuatro de junio de mil novecientos ochenta y seis, con base en el plano catastrado H-22550-1974, y colinda hoy día al sur del terreno objeto de este proceso. (certificación a folio 8, plano catastrado a folio 6, copias de información posesoria a folios 10 a 14).

II.Como hechos no probados el Tribunal tiene el siguiente: La parte promovente haya adquirido un derecho de posesión ejercido por terceros, sobre el área a titular, al menos desde el año 1984. ( no se aportó prueba documental y la testimonial no le resulta suficiente a este Tribunal por los motivos que se indicarán en la parte considerativa),

III.La Procuraduría General de la República fundamenta su recurso de apelación con base en los siguientes agravios:

  • 1)La representación del Estado solicitó notificar a JAPDEVA con el fin de que no se perjudicaran su intereses. Lo anterior porque existe la posibilidad de que el terreno pueda encontrarse comprendido dentro de la finca No. 7-96658-000 según el estudio técnico aportado por el INDER en este proceso. Además se solicitó se previniera al INDER que aportara el montaje sobre el traslape. Sin embargo, esas peticiones fueron rechazadas.
  • 2)El inmueble se encuentra dentro del Refugio de Vida Silvestre Mixto Maquenque creado mediante Decreto No. 32405.MINAE del 23 de mayo del 2005, y estuvo afectado por el Decreto No. 22965- MIRENEM del 15 de febrero de 1994, creador del Humedal Lacustrino Tamborcito, según oficio No. SINAC- ACAHN-OTAT-013-2016 se adjunta. El Deerecho abolido supervive para regular los derechos, situaciones, o relaciones jurídicas nacidas a su amparo. De acuerdo a lo expuesto, la sociedad promovente no adquirió sino hasta 1998.
  • 3)De acuerdo al escrito inicial la sociedad promovente no adquirió sino hasta 1998 de su representante [Nombre2] , quien a su vez adquirió de [Nombre4] en 1993. Las declaraciones testimoniales no son congruentes con lo anterior y no demuestran ni siquiera la posesión decenal con anterioridad a la fecha de vigencia del Decreto No. 32405-MINAE, por cuanto [Nombre5] únicamente conoce la ocupación de [Nombre2] de los últimos once años ([Telf1]) y desconoce anteriores ocupantes, incluso indica que cuando conoció el terreno no sabía de quién era. Además [Nombre6] manifestó que cuando conoció el terreno eran tierras baldías, y no se puede deducir de su declaración la fecha en que algún ocupante entró al inmueble, e indicó que [Nombre2] adquirió hace "15 años" ( o sea en el año 2000, no en 1993) de [Nombre7] . Por su parte, [Nombre8] no indica el tiempo que tiene de conocer el terreno, únicamente indica el tiempo que tiene de haber llegado a la zona, y tampoco cita como transmitente de [Nombre2] a [Nombre4] , únicamente hace referencia a [Nombre9] y [Nombre7] , sin indicar las fechas en las que cada uno de ellos estuvo ocupando el bien a titular. Al respecto ale Tribunal Agrario ha establecido que el tiempo de vivir en un lugar no implica exactitud en cuanto al tiempo de conocimiento del terreno, y que debe de existir congruencias entre las declaraciones testimoniales y entre éstas y lo indicado en el escrito inicial para poder hacer valer la posesión transmitida, y para que merezcan credibilidad al juzgador.
  • 4)Según el oficio No. SINAC-ACAHN-OTAT-013-2016 adjunto al recurso, el plano No. H-1654820-2013 comprende sectores de laguna del complejo lagunar Tambor, de dominio público.

IV.Tocante al primer agravio éste no resulta atendible. Lo anterior porque aunque el Instituto de Desarrollo Rural se apersonó al proceso indicando que el fundo a titular se encontraba comprendido dentro de la finca inscrita al Partido de Limón matrícula [Placa1], propiedad de JAPDEVA (folio 89), posteriormente se demostró lo contrario. Así en el informe del Área de Estudios Especiales de la División de Catastro, Registro Inmobiliario, elaborado para efectos de este proceso, se dictaminó en forma categórica que el plano H-1654820-2013 no traslapa con la finca 7-96658-000 (folio 171 y 172). El Catastro Nacional es el órgano técnico competente para dictaminar ese aspecto, de ahí que no observe este Tribunal, deba de traerse necesariamente al proceso a JAPDEVA. En otro orden de ideas, y en relación a los agravios segundo y tercero, lleva razón la apelante, toda vez la parte promovente no demostró en forma fehaciente que haya ejercido la posesión necesaria y apta para usucapir el terreno de bosque objeto de este proceso, por los motivos que a continuación se indican.

V.En primer término, la parte explica en su escrito inicial que es dueño de una unidad de bosque conformada por una finca inscrita, matrícula [Placa2], titulada mediante información posesoria (folios 8 al 14), con base en el plano H-22550-1974 (folio 6); y otra aledaña no inscrita, graficada en el plano catastrado H-1654820-2013 (folio 50) siendo la segunda la que pretende titular. Aduce que lo compró como una sola finca, a [Nombre2] mediante escritura pública número 22-24 de las 10 horas del 1 de agosto de 1998, ante el Notario Lázaro Broitman Feinzilber, pero que en su oportunidad el plano que se utilizó en esa información posesoria anterior, por error no incluyó la porción que hoy se pretende titular. Señala que "aparentemente lo que sucedió es que el topógrafo que midió tomó la quebrada que la atraviesa al centro como si esta fuere el [Dirección10] ; dejando por fuera del proceso de información posesoria y su respectiva inscripción registral esa porción".

Ambas porciones se encuentran comprendidas en el plano catastrado 4-1103035-2006 (folio 3). Una vez analizados esos planos y la documentación referida a la sentencia de información posesoria, se llega a la conclusión que al comprar la sociedad promovente, en el año 1998, la finca matrícula [Placa2], no implica que a su vez adquirió un derecho de posesión del área sin inscribir de cuarenta y nueve hectáreas cinco mil doscientos nueve metros de más ubicada al norte, pues el plano que la describe y que sirvió de base a esa titulación anterior no abarcaba ese sector. El cotejo del plano H-22550-1974 (base de esa anterior titulación) y 4-1103035-2006 (que reúne ambas porciones) permite apreciar que el lindero norte de la finca inscrita no era el caño Tamborcito sino otro caño o quebradita que todavía existe. Nótese que el vértice 12 del plano de 1974 coincide con el 133 del plano del 2006, y de igual modo el punto 12 de ese plano de 1974 cercano al "suampo" corresponde al punto 142 del otro plano del 2006, y en igual sentido los vértices 26, 30 y 34 del plano de 1974 con los 182, 116 y 130 del otro.

Ciertamente en la sentencia de información posesoria se consigna que la finca colinda al norte, este y oeste con el caño Tamborcito, pero ello fue un error evidente, pues ese plano de 1974 no identificó el lindero de esa manera, ni se titularon esa cantidad de hectáreas, ni corresponde con la forma natural de esa colindancia. De acuerdo a lo expuesto, el título de adquisición de la finca inscrita no se puede considerar como causa adquisitiva del área sin inscribir, de ahí que la posesión que haya ejercido la parte promovente sobre esa sección lo es a partir de 1998, que adquiere el inmueble (certificación a folio 8). En segundo lugar, debe indicarse que aunque el inmueble se encuentra comprendido dentro de lo que hoy es el Refugio Nacional de Vida Silvestre Mixto Maquenque creado mediante Decreto Ejecutivo No, 32405 del 13 de junio del 2005 (certificación a folio 16), en el artículo 3 de este Decreto se dispuso derogar: "Decretos Ejecutivos 22990-MIRENEM de creación de la Reserva Forestal Cerro El Jardín, firmado el día 21 de febrero de 1994 y publicado en La Gaceta 53 del día 16 de marzo de 1994, 23074-MIRENEM de creación de la Reserva Forestal Cureña, firmado el día 17 de marzo de 1994 y publicado en La Gaceta 67 del 7 de abril 1994, 22965-MIRENEM de creación del Humedal Laguna de Tamborcito, firmado el día 15 de febrero de 1994 y publicado en La Gaceta 48 del día 9 de marzo de 1994, y 22964-MIRENEM de creación del Humedal Palustrito Laguna Maquenque, firmado el día 15 de febrero de 1994 y publicado en La Gaceta 48 del día 9 de marzo 1994.

Estas áreas silvestres protegidas cambian a la categoría de Refugio Nacional de Vida Silvestre Mixto como parte del Refugio Nacional de Vida Silvestre Mixto Maquenque". Así las cosas si se observa el informe SINAC-ACAHN-OTAT-013-2016, de fecha 26 de febrero del 2016 (folio 224), el fundo se encontraba inmerso dentro del área que afectaba el Decreto No. 22965-MIRENEM Humedal Lacustrino Tamborcito vigente desde el 9 de marzo de 1994, el cual afectó esa zona "por ser lagunas poco alteradas, de una gran interés biológico y limnológico, y que además conforman un reducto de hábitat muy importante para el manatí (Trichechus manatus), considerado en inminente peligro de extinción en Costa Rica" . Nótese que el Decreto que crea el Refugio de Vida Silvestre Mixto Maquenque lo que hace es cambiar de categoría a esas áreas, pero no las desafecta, de ahí que deba de entenderse que la posesión que se debe de probar es al menos desde 1984, es decir, diez años antes de la declaratoria del citado Decreto de 1994, conforme lo exige el artículo 7 de la Ley de Informaciones Posesorias.

En tercer lugar, debe considerarse, que según lo que indica la entidad promovente, ésta adquiere la citada finca inscrita, de su propio representante en 1998, (escrito inicial a folio 32); por lo que debe de entenderse que inicia su posesión sobre el área sin inscribir desde ese año, cuando ya estaba afectada al dominio público, y no ha demostrado que haya adquirido el derecho de posesión de anteriores poseedores sobre esa área, pues la certeza que existe en el expediente es que adquirió únicamente el área inscrita. Por otro lado, con la prueba testimonial no se logra demostrar de manera fehaciente que la posesión ejercida por [Nombre9] y [Nombre10] lo fuera siempre durante cuarenta años hasta el área que llega al [Dirección11] , pues se entiende lo que refieren es que hoy colinda con ese caño por el norte, pero dado que en la información posesoria promovida por [Nombre10] esa área no estaba realmente abarcada, no es dable presumir que esa posesión se ejerció también sobre el área sin inscribir.

Además si hoy día colinda con el caño lo es a lo sumo por la posesión que iniciara la entidad promovente desde 1998 sobre esa área, la cual no es apta para usucapir por estar el bien afecto al demanio público desde 1994. [Nombre5] no logra precisar cuánto mide la propiedad, no sabe de quién obtuvo la finca [Nombre2] , lo que implica que tampoco puede acreditar con certeza la posesión específica del área a titular y no merezca fe su declaración. Ningún testigo refiere como poseedora a la señora [Nombre4] , que según el escrito inicial le transmitió a [Nombre2] (folio 32), aspecto que genera incongruencia en cuanto a la cadena de transmisión, y que sumado a las consideraciones anteriores, hace que este Tribunal considere no se demostró en forma clara esa posesión específicamente ejercida en el área titular al menos desde 1984. Incluso en la información posesoria del área hoy día inscrita, que promoviera el señor [Nombre11] , ante el Juzgado Primero Civil de Heredia, aprobada en resolución de las ocho horas y cuarenta y cinco minutos del cuatro de junio de mil novecientos ochenta y seis (folio 11 a 13) se indicó que éste adquirió de [Nombre12] , el cual no es referido por los testigos que declararon en este proceso, lo cual genera aún mayor duda en cuanto a la demostración de la verdadera cadena de transmisión. .

VI.De acuerdo a lo expuesto, lo procedente es revocar la sentencia, al no haberse probado en forma diáfana y suficiente la posesión decenal exigida en el artículo 7 de la Ley de Informaciones Posesorias y en su lugar procede rechazar las presentes diligencias.

VII. NOTA EXPUESTA POR LA JUEZA [Nombre13]

El Dominio Público -para el caso que nos interesa- es el conjunto de bienes propiedad pública del Estado, lato sensu, afectados al uso público directo o indirecto, de los habitantes, y sometido a un régimen especial de derecho público y, por tanto, exorbitante del derecho privado. El dominio público se encuentra conformado por cuatro elementos: subjetivo, objetivo, normativo y teleológico. El elemento subjetivo se refiere al titular del derecho -El Estado-; el elemento objetivo se refiere o se constituye por el bien o los bienes sobre los cuales recae el dominio público -para este caso el inmueble objeto de litigio- ; el elemento normativo determina cuando un bien reúne los requisitos señalados por ley para considerarlo demanial, es el conjunto de normas que lo rigen -elenco de normas que en adelante se dirán-; y el elemento teleológico que se refiere a la finalidad que se persigue al incluir determinado bien dentro del dominio público, qué finalidad pública es asignada al bien -en este caso la protección de los recursos naturales-.

Los bienes de dominio público están sometidos a un régimen jurídico especial, se encuentran sujetos a un poder de policía, y se caracterizan esencialmente por su inalienabilidad e imprescriptibilidad. Por su naturaleza están dirigidos a satisfacer necesidades públicas, este hecho impide que sobre ellos exista tenencia o posesión por parte de particulares o personas privadas, están fuera del comercio del derecho privado. Nuestra Constitución Política en su artículo 121 inciso 14) hace referencia a la Demanialidad indicando qué bienes son susceptibles de ese régimen de propiedad pública, incluso estableciéndose en ese artículo diferentes grados de afectación pública dándose un grado de publicatio intenso y absoluto hasta otros grados menos intenso y se armonizan los derechos de los administrados con las potestades de la Administración. Nuestro Código Civil vigente que data desde el mes de abril de mil ochocientos ochenta y seis, regula las bases más importantes en materia de bienes de dominio público, concretamente en sus artículos 261 al 263.

El artículo 262 del citado Código Civil, hace referencia a dos características importantes de los bienes de dominio público: a- las cosas públicas están fuera del comercio, y b- se establece la desafectación al decir que esos bienes no pueden entrar en el comercio privado, mientras legalmente no se disponga así. Como puede observarse la afectación al régimen de dominio público no depende de la naturaleza del bien, sino de la voluntad del legislador. Mediante voto número 447-91 de las quince horas treinta minutos del 21 de febrero de 1991 la Sala Constitucional manifiesta que la declaración de dominio público del bien se establece por ley, esta declaración no constituye una limitación a la propiedad, de acuerdo con el artículo 45 de la Carta Magna, pues éste artículo se refiere a propiedad privada, y los bienes de dominio público no están sujetos a propiedad privada. El Patrimonio Forestal del Estado, es un bien Demanial regulado en un amplio conjunto normativo en el que históricamente hasta la actualidad se prohibe a los particulares realizar cualquier tipo de labor dentro de los inmuebles con esa característica y como consecuencia negándoles el derecho de posesión, haciéndose una salvedad en una situación específica que más adelante se dirá.

Se considera como Patrimonio Estatal, -en su condición de Demanio Público que implica los principios de imprescriptibilidad, inalienabilidad, e inembargabilidad-, los terrenos que constituyen Reservas Nacionales que tengan Bosques. Lo anterior encuentra su desarrollo normativo en las citas que a continuación se exponen: 1) El Código Fiscal de 1865 el cual contempla un capítulo referido a los bosques, el cual fue derogado por la Ley General de Terrenos Baldíos Número trece del 6 de enero de 1939 la cual incorporaba prácticamente las mismas disposiciones. Por ejemplo el artículo primero indicaba: "Que los terrenos comprendidos en los límites de la República, que no hayan sido adquiridos o inscritos en propiedad mediante título legítimo por particulares, se presumen baldíos y pertenecen al Estado."- Esta ley en general regula la prohibición para poseer e inscribir mediante el trámite de informaciones posesorias las Reservas Nacionales que sean Patrimonio Forestal, en otras palabras no son susceptibles de apropiación por parte de particulares.- La Ley de Tierras y Colonización Número 2825 del 14 de octubre de 1961 mantuvo la misma orientación y se encuentra vigente en la actualidad desde aquella fecha.

Así el artículo 8 de esa Ley de Tierras y Colonización establece: "Exceptuado los casos previstos en esta ley es prohibido a los particulares encerrar con cercas, carriles, o cualquier otra forma los terrenos declarados Reservas Nacionales, derribar montes, establecer construcciones y cultivos o extraer de ellos leña, madera, bejuco, palma, y otros productos con fines de explotación. Todo acto de ese genero, si de previo no se han llenado los trámites legales y obtenido la autorización correspondiente será considerado, según el caso como usurpación de dominio público o merodeo, debiendo las autoridades ordenar la destrucción y remoción de las cercas e impedir el uso de esas tierras, sin lugar a indemnización ni a reclamos por el valor de las mejoras y sin perjuicio de otras responsabilidades que pudieran caber a quienes incurrieren en tales faltas".- Nótese que este artículo sanciona penalmente a aquel que se introdujere a una reserva Nacional para realizar cualquier actividad en esas tierras, por lo que no se le pueda considerar a ésta acto de posesión pues su actividad sería ilegítima.- El artículo 11 de esa misma Ley, establece que pertenecen al Estado en carácter de Reservas Nacionales: "a) Todos los terrenos comprendidos entre los límites de la República que no esten inscritos como propiedad particular, de las Municipalidades o de las Instituciones Autonómas. b-) Los que no esten amparados por la posesión decenal.- c-) Los que por leyes especiales, no hayan sido destinados a la formación de colonias agrícolas.- d-) En general todo los que, no siendo de propiedad particular, no estén ocupados en servicios públicos."- Por su parte el artículo 19 de la Ley Forestal derogada número 4465 del veintitrés de noviembre de mil novecientos sesenta y nueve dispuso: "Quedan afectados a los fines de la presente ley todos los bosques y terrenos forestales ubicados en: "a-) Las tierras consideradas Reservas Nacionales..." Y el artículo 25 de esta misma ley señalaba: "La posesión de los terrenos situados en las Reservas Nacionales y fincas del Estado a que se refiere el artículo 19 de esta Ley, no causará derechos de ninguna especie y la acción reivindicatoria del Estado, por los mismos, es imprescriptible, y la Dirección General Forestal con los medios legales a su disposición, procederá a desalojar de tales terrenos a las personas que los ocupan total o parcialmente, en el caso de que se trate de zonas protectoras, Parques Nacionales, Reservas Forestales, y Reservas Biológicas".- Con estas normas se otorga a los bosques allí mencionados una doble tutela: Primero por su condición de Reserva Nacional, en las que es prohibido realizar cualquier acto posesorio y segundo por constituir Patrimonio Forestal del Estado en el que ningún acto de posesión causará derecho de ninguna especie.

Este aspecto se ve confirmado con el artículo 8 del reglamento a esa ley que dice: "Los terrenos Nacionales comprendidos dentro de las áreas declaradas Reservas Forestales son inalienables, es decir no podrán salir del dominio del Estado, y su posesión no causará derecho de ninguna especie de conformidad con lo dispuesto por los artículos 25, 49 y 57 de la Ley Forestal".- El artículo 80 de la citada Ley Forestal derogada indicaba: "Queda prohibido la invasión y ocupación de terrenos en los Parques Nacionales, Reservas Forestales y Zonas Protectoras. Esta prohibición se extiende hasta las Reservas Nacionales, hasta tanto no se haya determinado su clasificación y transferencia..." El artículo 6 de esta misma ley disponía: " Será sancionado con prisión de seis meses a dos años o con multa de quince a cien días, la persona que: a-) Explote un bosque de patrimonio forestal sin autorización legal correspondiente... b-) Invada un Parque Nacional, Reserva Biológica, Zona Protectora o Reserva Forestal...Si la invasión es en Reservas Nacionales, estará sujeta a lo estipulado en el artículo 227 del Código Penal.-" Como puede observarse los actos posesorios realizados en un bosque patrimonio Estatal resultan ser ilegítimos por lo que no pueden conferir ningún derecho de posesión.- Con la entrada en vigencia de la Ley Forestal Número 7174 del 28 de junio de 1990, se continúa con esta misma filosofía.

En el artículo 32 de la citada ley establece: "El patrimonio forestal del Estado esta constituído por todos los bosques y terrenos forestales de las Reservas Nacionales...". El artículo 33 de esa misma ley dispone: "Los terrenos forestales y bosques que constituyen el Patrimonio Forestal del Estado detallados en el artículo anterior, serán inembargables e inalienables, su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por esos terrenos es imprescriptible.- En consecuencia, no son susceptibles de inscripción en el Registro Público mediante Información Posesoria, su invasión y ocupación será sancionados conforme lo dispuesto en esta Ley".- Con la actual Ley Forestal vigente número 7575 del 5 de febrero de 1996, en su título II regula un capítulo único referido exclusivamente al Patrimonio Natural del Estado, siendo la misma filosofía que se había iniciado desde 1865 con el Código Fiscal, por lo que se reitera en esta nueva normativa que el Patrimonio Natural del Estado estará constituído por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, y las fincas inscritas a nombre de la Administración Pública.

El artículo 14 de la misma ley forestal vigente es enfática en indicar que los terrenos forestales y bosques que constituyen el patrimonio natural del Estado son imprescriptibles, inembargables e inalienables y su posesión por los particulares no causará derecho alguno a su favor. La Ley de Conservación de la Vida Silvestre Número 7317 del 21 de octubre de 1972, en sus artículos 3 y 4, además de la declaratoria como de dominio público e interés público, a la fauna y flora silvestre respectivamente, se indica que la flora y fauna silvestre es parte del Patrimonio Nacional. En este mismo sentido la Ley de Biodiversidad número 7788 del 30 de abril de 1998 en su artículo 6 declara los elementos de la biodiversidad como de dominio público, así como la Ley Orgánica del Ambiente en su artículo 46 que establece la soberanía del Estado sobre la diversidad biológica. Por lo expuesto resulta un imperativo legal negar el derecho de posesión a aquellas personas que realizaran cualquier actividad en terrenos no sometidos a propiedad privada y que estén constituídos por bosques en reservas Nacionales.- A esa prohibición imperativa mediante la Ley Forestal Número 7575 del año 1996, que reforma el artículo 7 de la Ley de Informaciones Posesorias, posibilita la titulación de bosques cuando dentro de los mismos se haya desarrollado lo que se entiende como posesión ecológica.

El terreno objeto de esta información posesoria, es Patrimonio Natural del Estado, pues está compuesto en parte por bosque ubicado dentro del Refugio Nacional de Vida Silvestre Maquenque, lo que es claro dicho territorio es Patrimonio Natural del Estado, desde antes de que fuera creada mediante Decreto como ya se expuso en el historial normativo supra. Cuando se discute la posesión sobre un bien demanial, sólo cabrá esa discusión cuando se haya adquirido el derecho antes de que se haya declarado el bien como de dominio público. Así mismo, el derecho de propiedad en tales casos sólo podrá obtenerse cuando el titular haya demostrado una posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley que declara el objeto como Patrimonio Natural del Estado. Como ya se ha expuesto la cronología legal que tutela el Patrimonio Natural del Estado, la ley que debe tomarse en consideración para realizar el cómputo de la posesión decenal de los particulares, es la Ley de Tierras y Colonización número 2825 del 14 de octubre de 1961, normativa actualmente vigente.

No debe considerarse el Código Fiscal de 1865 y la Ley de Terrenos Baldíos de 1939, pues fueron normas que hacían referencia al tópico en forma genérica, además que no son disposiciones vigentes en la actualidad, no es sino hasta con la actual Ley de Tierras y Colonización que se viene a definir y regular en forma clara la Propiedad o Patrimonio Natural del Estado. Las leyes posteriores como Ley Forestal y otras que se han citado en este considerando, son complementarias a la referida Ley de Tierras y Colonización. Para el caso concreto, de la prueba testimonial recabada no se demuestra esa posesión decenal en los términos de la normativa aquí expuesta, pues en este sentido es que se consigna esta nota, para indicar el promovente debió demostrar diez años de posesión antes de la Ley de Tierras y Colonización, y no los Decretos que se indican, como se afirma en los considerandos que anteceden.-

POR TANTO

Se revoca la sentencia y en su lugar se rechazan las presentes diligencias de información posesoria. Hay nota de la Jueza Alvarado Paniagua.- [Nombre14] - JUEZ/A DECISOR/A [Nombre13] - JUEZ/A DECISOR/A [Nombre15] - JUEZ/A DECISOR/A
