Proceeding declared expedited (trámite preferente), brought by Ms. Nombre139473 and Ms. Nombre139472, both surnamed Nombre139472, the former married once and holder of identity card CED110016, the latter holder of identity card CED110017, both Indigenous and residents of Bijagual de Buenos Aires, Puntarenas, represented by their special counsel of record (apoderado especial judicial), Walter Brenes Soto, unmarried, attorney, identity card CED32840, and resident of Alajuela, against INSTITUTO COSTARRICENSE DE ELECTRICIDAD (hereinafter ICE), represented by its special counsel of record, Nombre82313, unmarried, attorney, identity card CED30335, resident of Heredia, and Nombre82381, married, attorney, identity card CED84178, resident of San José, and ESTADO, represented by government counsel (procurador) Alonso Arnesto Moya, married, attorney, identity card CED683, and resident of San José. Mr. Nombre96534 participates as an interested third party without independent claims (tercero interesado sin pretensiones propias); he is twice divorced, a farmer, holder of identity card CED74010, and resident of Dirección16763, Puntarenas, represented by his special counsel of record Guido Humberto Rojas Sánchez, attorney, identity card CED90961, and resident of Qutirrisí.
FINDINGS OF PROCEDURAL HISTORY (RESULTANDO)
CONSIDERING
I.Necessary clarification. For a better understanding of what will be decided, the Tribunal deems it necessary to state the following. By way of background, and as indicated above, these proceedings were initially brought by the ADI de Térraba, fundamentally challenging the validity of a series of formal acts and material conduct by ICE and the State relating to the PHD which, in its view, were carried out unlawfully within that Reserva Indígena and infringed the legal interests of that community. During the course of the proceedings (iter procesal), the Nombre139472 sisters filed a third-party intervention asserting independent claims (tercería con pretensiones propias), which at that time included declarations of nullity concerning a series of formal acts issued by Nombre139474 in connection with the environmental proceeding conducted by ICE to obtain the corresponding environmental viability permit (licencia de viabilidad ambiental) for implementation of the PHD.
They subsequently withdrew the aforementioned annulment claims, limiting their requests to those set forth in the seventh recital of this judgment. Thereafter, in the aforementioned Judgment No. 127-15-VI, the withdrawal submitted by the president of the ADI was accepted, and these proceedings were terminated with respect to the action brought by that corporate entity against ICE, the State, and Nombre136636, without a special award of costs. Likewise, given the ancillary nature of the supporting intervention filed by the Comisión Nacional de Asuntos Indígenas in favor of the Association, and by virtue of the accepted withdrawal, that intervention was deemed concluded. In light of these developments, and considering that the claims asserted by Nombre139472 were their own and independent of those pursued up to that point by the claimant, the continuation of the proceedings with respect to their requests was ordered.
Accordingly, as explained in rulings issued after the aforementioned withdrawal was accepted and during the second phase of the single hearing held in octubre de este año, although Nombre139472 had participated in this case as third parties asserting independent claims, their procedural status must now be clarified because the claimant’s withdrawal of the action was accepted by this Tribunal and, at present, the subject matter of this case encompasses only the claims asserted by them. Accordingly, Nombre139472 are the sole parties bringing this action, and their claims are those to be decided in this dispute (litis). In view of the foregoing and the manner in which the claims to be decided herein were framed, any complaint or challenge concerning the scope of the consultation established in artículo 6 del convenio No. 169 “Sobre Pueblos Indígenas y Tribales en Países Independientes”, approved in our country by Ley No. 7316, de 3 de noviembre de 1992, must from the outset be excluded from the legality review to be conducted.
As relevant here, that provision states: “(...) 1. In applying the provisions of this Convention, governments shall: a) Consult the peoples concerned, through appropriate procedures and particularly through their representative institutions, whenever consideration is being given to legislative or administrative measures that may affect them directly (...)”. Furthermore, it must be reiterated that no claim for annulment has been asserted in this case that would authorize this Tribunal to conduct a legality review of the formal acts and material conduct undertaken thus far by the defendant public entities. As will be seen below, this clarification is essential in determining the scope of the legality review to be conducted with respect to the relief sought.
II.Proven facts (Hechos probados). The following facts of importance to the matter being decided are deemed proven:
(...) The additional geotechnical and topographic investigations to be conducted during the next stage will make it possible to determine in greater detail the scope of the excavations for the plinth foundation, the rock’s permeability characteristics in order to estimate the grouting treatments more accurately, and a more detailed quantification of the dam’s excavation and fill volumes. The layout of the side spillway was developed on the basis of the results of the geophysical investigation conducted by ICE, the topographic surveys, and the geological surveys jointly conducted by ICE and INGETEC during this stage of the studies. (...) Environmental and Social Aspects. (...) The only issue requiring special attention, which could potentially hinder the bidding processes and the development of the project through amparo proceedings (recursos de amparo) and international-law procedures, would be the improper handling of indigenous matters, particularly in relation to the replacement of specially protected lands and the cultural identity of these communities.
It is recommended, above all, that the consultation provisions established at the national and international levels be fully pursued and, ultimately, that framework agreements negotiated with the affected communities be reached. The environmental study for the Veraguas option is at a preliminary stage, in which the important issues identified at this stage indicate that, with the introduction of appropriate management measures, which are presented at this phase as proposals, the project may be environmentally viable. The comprehensive Environmental Impact Study (Estudio de Impacto Ambiental) will examine in greater depth those matters requiring the collection and analysis of field data through investigations designed and scheduled for that purpose, which will make it possible to assess and quantify the impacts that could not be described in detail using the existing information, thereby allowing the most appropriate management measures to be designed.
(...)". As recommendations, it stated the following: "(...) In accordance with the terms of the Contract, the Consultant has reviewed the existing information supplied by ICE and supplemented certain aspects directly or in collaboration with ICE officials. Based on the foregoing, and also applying its judgment and experience, the Consultant has prepared the project layouts presented in this report. Notwithstanding the foregoing, some of the information required to prepare the Final Feasibility Report is still outstanding because ICE is either in the process of obtaining it or has not yet begun to do so. In the future, this information will allow certain aspects of the layouts presented in this report to be further refined and, consequently, the layouts to be optimized. The following is a list of the investigations that the Consultant recommends conducting to supplement the Feasibility Study presented in this report.
The locations and implementation details of the investigations have previously been discussed with ICE personnel. (...) •Geological investigations: Complete geological surveys of the conveyance system, underground powerhouse, and outlet; conduct geological surveys of the material-source area and disposal areas; and investigate the genesis of the Paso Real and Valle del General formations. (...) • Boreholes (perforaciones): Five hundred meters of boreholes (4 boreholes) in the dam area, four hundred meters of boreholes (5 boreholes) at the spillway, two hundred meters of boreholes in the diversion tunnels, one hundred meters of boreholes (2 boreholes) at the intake and gate shaft, one hundred fifty meters of boreholes (2 boreholes) at adit 1 of the conveyance tunnel, seven hundred meters of boreholes (5 boreholes) in the conveyance tunnel, one thousand five hundred meters of boreholes (3 boreholes) in the underground powerhouse and surge shaft, one hundred fifty meters of boreholes (2 boreholes) at Adit 2 and the access tunnel to the powerhouse, and three hundred fifty meters of boreholes (3 boreholes) in the outlet tunnel.
In addition, two galleries, each one hundred meters long, must be constructed in the dam area, along with test pits and trenches in the material-source areas, and open-tube piezometers must be installed in boreholes reaching the water table. • Geotechnical tests (ensayos geotécnicos): permeability tests in boreholes in the dam area; measurement of water temperature during the drilling of the conveyance system; point-load tests on outcrops; point-load, plate-load, and direct-shear tests in exploration galleries; laboratory tests on materials from outcrops, galleries, and borehole cores; and hydraulic-fracturing tests in the powerhouse area. (...)" (statement of Nombre139477, compact disc labeled Informe INGETEC, which is included in the case file).
· The typical cross-section of the low-level outlet tunnels will be horseshoe-shaped, with an excavation diameter of 8,7 m and full lining in conventional concrete 0,45 m thick, resulting in a usable section 7,8 m in diameter. There will be a steel-lined section upstream of the gates approximately 52 m long, and the cross-sections in that section will vary. Up to approximately 40 m downstream of the radial gate, there will be a horseshoe-shaped section with a flattened crown. · The purpose of the low-level outlet is to divert the river during construction of the plug for diversion tunnel 1, allow inspection and maintenance of most of the upstream face of the dam (especially between elevations 250 masl and 200 masl) and other submerged works, and allow passage of the compensation flow during filling of the reservoir. · The process of closing the diversion tunnels may begin in any month except August, September, and October, which are the rainiest months of the year, or July if it is estimated that one month is required for construction of the plug and commissioning of the low-level outlet; that is, the low-level outlet must be operational no later than August (...)".
(compact disc labeled "Basic Design of Diversion Works, declaration of Nombre139477). 17) On July 16, 2009, ICE requested from Nombre139474 an extension of the environmental viability granted for the Geological Studies at the Térraba and Cañablancal Site project (case No. 366-2005-SETENA), because it needed to expand the collection of geological data relating to the locations of the works for said project in order to gather information essential for the engineering designs, which it had not been possible to obtain through the explorations conducted to date. It stated that, in summary, the additional activities requested were: "(...) 1. Various geological exploration drillings at the Cañablancal and Térraba sites (covering both banks of the General River) and Ceibo. 2. Development of a geological exploration adit at the Térraba site (on the right bank of the General River) for the future diversion tunnels. 3.
Development of a geological exploration adit at the Colinas site to evaluate a geological fault that may eventually be crossed by the alignment of the future conveyance tunnel. (...)". It further stated that the proposed additional research activities and their environmental impacts did not differ in any respect from those originally proposed in that case. Attached to the request were a DJCA and a series of appendices detailing the requested works (folios 222 through 495, volumes I and II of the Nombre139474 administrative case No. 366-2007). 18) On September 28, 2009, ICE submitted to Nombre139474 an addendum to the request for extension of the environmental viability in case No. 366-2005-SETENA, providing a technical justification based on the recent changes to the adits requested in the extension application. It attached two technical reports signed by Engineer Nombre139475, PHD Underground Works Coordinator.
The first stated that "(...) Following the recommendations of ICE’s expert designers, the company INGETEC reviewed the proposed combination of cofferdam height and tunnel size to ensure a return period of at least 100 years for the diversion. This analysis concluded that the cofferdam would have a height of 30 m (with a concrete volume of 100000 m3), and the diversion tunnels would have an excavation diameter of 14 m and a floor width of 14 m, for a total excavation area of 175 m2. In addition, the lengths of the diversion tunnels were optimized and reduced. The new lengths of the diversion tunnels would be 675 m and 789 m. (...)". It was also noted that "(...) Because the diversion tunnels have a larger diameter, provision must be made for two ventilation ducts 2 m in diameter to be installed through the access tunnel and for larger equipment to enter for the subsequent diversion-tunnel construction process.
Having analyzed the foregoing points, it was determined that the dimensions the access tunnel should have to ensure optimal operation would be 6 m in height and 6 m in floor width, for an excavation area of 32.14 m2. (...) Under the new design of the diversion tunnels, the excavation diameter would be 14 m, entailing an excavation area of 175 m2. The excavation represented by the proposed access tunnel, as a percentage of the area of the diversion tunnels (recently proposed), is only 18%. (...) 4. Modification of the excavation diameter of the investigation adit. (...) To maintain the required level of safety when installing the steel ribs and avoid removing them during the process of enlarging the adit to the final cross-section of the prospective diversion tunnel, the excavation of the investigation adit must be adapted to the upper cross-section of the future 14 m-diameter diversion tunnel.
The proposed new investigation adit would have an excavation cross-section of 42.73 m2, with a height of 4.5 m and a floor width of 13.08 m. (...) Under the proposed new design for the diversion tunnels, the excavation diameter would be 14 m and the floor width 14 m, entailing an excavation area of 175 m2. The excavation represented by the proposed new investigation adit, as a percentage of the area of the diversion tunnels, is 24% (...) In summary, although the proposed cross-section of the new investigation adit has larger dimensions, increasing from an excavation area of 27.52 m2 in the original adit to 42.73 m2, it is much smaller as a percentage of the excavated area relative to the final cross-section of the diversion tunnels, since the proposed new investigation adit represents 24% of the final excavation cross-section, whereas the original adit represented 30%. (...). 6. Summary.
Due to the change in the basic design proposed by the consulting firm INGETEC, which is extensively justified in point 2 of this report, the diversion tunnels would now have an excavation diameter of 14 m, for an excavation area of 175 m2. With this modification to the final size of the diversion tunnels, it would be necessary to provide an access tunnel in which the 2 ventilation ducts, each 2 m in diameter, that will be required at a subsequent stage of diversion-tunnel construction can be installed, and which also allows larger specialized equipment to enter. Accordingly, it is proposed that the diameter of the access tunnel be changed from 4.8 m (Figure 1) to an excavation diameter of 6 m (Figure 2). If the access tunnel is not excavated to a diameter of 6 m, the excavation cross-section would subsequently have to be enlarged, which would not be ideal from a construction standpoint because the temporary support would have to be removed to enlarge the tunnel, entailing an additional financial cost; above all, and most importantly, it would entail a significant construction risk for workers, since they would be vulnerable to falling rock fragments.
With regard to the investigation adit, for construction-safety reasons, the crown of the adit excavation must coincide with the final crown of the diversion tunnels so that removing the crown of the rib is unnecessary, thereby preventing material from falling. Accordingly, it is necessary to modify the size of the investigation adit, which was originally proposed as 3.76 m high and 9.92 m wide, for an excavation area of 27.52 m2 (Figure 5). The proposed investigation adit would have a height of 4.5 m and a floor width of 13.08 m, for an excavation area of 42.73 m2 (Figure 7). (...)". (folios 12 through 27 of the administrative folder corresponding to the Addendum submitted in administrative case No. 366-2005-SETENA). 19) By resolution No. 2766-2009-SETENA issued at 10:25 a.m. on November 18, 2009, the Plenary Commission of Nombre139474 approved the new DJCA submitted for evaluation by ICE on the basis of the aforementioned request for extension of environmental viability and addendum, within administrative case No. 366-2005-SETENA.

FIRST: The new Sworn Declaration of Environmental Commitments submitted for evaluation (...) is approved on the basis of the Request for Extension of Environmental Viability (License) and the Addendum to the Request for Extension of Environmental Viability (License) in Administrative Case No. 366-2005-SETENA. (…)FOURTH: The interested party is hereby informed that, pursuant to Articles 17, 18 and 19 of the Organic Law of the Environment, the Environmental Assessment Process has been completed for the Project: Project Name: GEOLOGICAL STUDIES AT THE TÉRRABA SITE. Case No.: 366-2005-SETENA. Owner: Costa Rican Electricity Institute. Location: Province: Puntarenas. Canton: Buenos Aires. District: Potrero Grande and Palmar. Topographic Map Sheet: General and Changuena Scale: 1:50.000. Coordinates: 337.006.337.351 North/ 540.053. 540.054 East. 326.767 North/ 521.662 East.

Geological exploration at the Térraba site: The construction of a small-scale power plant for electricity generation (28MW) is planned there, requiring an investigation by means of a borehole 75.7 mm in diameter and 50 m deep to determine the geomechanical characteristics of the structure’s foundation site. 2.1 Borehole PHED-49-MC 2.2 Plinth boreholes: (1) PHED-50-PL. (2) PHED-51-PL, (3) PHED-52-PL, (4) PHED-53-PL, (5) PHED-54-PL, (6) PHED-55-PL, (7) PHED-56-PL, (8) PHED-57-PL, (9) PHED-58-PL, (10) PHED-59-PL The plinth constitutes the base where the dam structure (the face that retains the water) would be anchored to the rock mass on which the structure would be founded; geological investigation must therefore be conducted at the foundation sites. It consists of ten boreholes 75.7 mm in diameter and 12º m deep. (…) 2.3 Borehole PHED-60-PZ: Construction of the dam requires building two diversion tunnels for the General River.
Geological investigation is required to determine the characteristics of the material present at this site through a borehole 100 m deep and 75.7 mm in diameter. 2.4 Geophysics at the plinth, the small-scale power plant, and its conveyance system: The design of the plinth structure requires technical information supported by extensive geological investigation and entails geophysical surveys along 1500 m of the plinth axis for alignment of the foundation. The tests would be conducted along a strip no more than 05 m wide and 1500 m long. Existing access routes will be used to transport equipment and personnel. 2.5 Anchor tests at the spillway: The overflow spillway requires anchors for the concrete slab. A series of short boreholes is required for ten anchor tests, ranging from 3 to 11 m deep and 5 cm in diameter. 2.6 Geological exploration gallery for the diversion tunnels: This refers to the river diversion tunnels required to protect the dam construction area, which will consist of two underground excavations at elevation 141 meters above sea level.
The characteristics and dimensions of the tunnels were modified in the proposal contained in the Addendum to the request for expansion of environmental approval (viabilidad ambiental) (see item 1). 2.6.1 Protective dike with gabion wall: Intended to provide a safe working terrace and protect operating personnel during periods of heavy rain by helping contain river water in the event of flooding. It is 6 m high and 110 m long, and its width varies with its height, ranging from three to one meter wide, with approximately 1540 m3 of stone. 2.6.2 Maneuvering terrace for excavation of the access adit and gallery: Preparation of an area measuring 2152 m2 in which to place machinery, equipment, tools, and supplies to facilitate opening the gallery portal and its eventual excavation. It must also accommodate the facilities needed for personnel: a dining hall, clinic, warehouses, offices, etc. 2.6.3 Rehabilitation of the existing internal road on the property: Given the road’s characteristics and the dimensions of the construction equipment, it must be improved using 12.398 m3 of earthworks (movimientos de tierra), which would be placed in the spoil-disposal sites and on the working terrace.
The road will be widened to provide a 5 m roadway surface. 2.6.4 Preparation and management of spoil-disposal sites (escombreras): The spoil-disposal sites are located 1.5 km from the terrace of the gallery access adit. These areas are used for livestock farming and have sparse vegetation cover. They have a storage capacity of 51039 m3. An access track to the spoil-disposal sites exists and must be improved. There is no evidence of archaeological features, and the presence of wild animals is scarce (sic). 2.6.5. Rehabilitation of access to the spoil-disposal sites: Access will be provided via the existing public road, whose roadway surface must be improved. 2.6.6 Installation of an electrical service connection to supply the construction works: Approximately 819 m of distribution line with a capacity of 3450 volts must be constructed to supply the excavation equipment for the exploratory gallery. 2.6.7 Construction of a warehouse-and-materials-yard facility: The buildings required for the gallery works will (sic) be constructed on the portal terrace: a medical clinic, dining hall, sanitary facilities, warehouses, plants and compressors, transformers, stove-cement-aggregates, and offices.
(886 m2 of construction). Other yard and material-storage areas must be prepared: a roofed area (sic) for cement, an area (sic) for aggregates, a materials warehouse, and a materials yard. 2.6.8 Cutting of trees in a pasture area: Before the trees are cut, the permits will be processed with MINAET. According to the forest inventories, the selected sites contain pastures and riparian vegetation (21 trees with diameters greater than 15 cm were identified), while the spoil-disposal sites contain no trees more than 15 cm in diameter. (….) 2.6.9 Trenches for geological investigation of the Térraba-Águila road: Suitable roads must be constructed; the road from the entrance to Térraba to the community of El Águila, which leads to the future intake, must be upgraded as a national route and will connect the community of Pacuar with Nombre265 and continue to Térraba de Buenos Aires. Eight geological investigation points have been identified along this road section, consisting of eight trenches (…) b. Through memorandum PHED-78100-0384-2009 dated 9 de setiembre del 2009 from Engineer Franklin Ávila Pérez, Director and Attorney-in-Fact by Substitution of Power of Attorney for the Developer Instituto Costarricense de Electricidad, which forms part of the document Addendum to the Request for Expansion of Environmental Approval (License) for the Project: Geological Studies at the Térraba and Cañablancal Sites, File No. 366-2005-SETENA, addressing the matter: “Technical justification for the recent changes to the galleries requested in the application to expand and adjust the current environmental license, Administrative File No. Nombre139483, entitled: Geological studies of the Térraba and Cañablancal Sites,” for the purpose of proposing, on the basis of two technical reports, changes to the content of the proposal requesting an expansion of environmental approval submitted on 16 de julio del 2009, requesting: 1.
Modification of the size of the exploratory gallery for the diversion tunnels. 1.1 Background: On 30 de julio, the consulting firm INGETEC submitted Report Code PHDQ-HDR-002-007 containing the Basic Design for the Diversion Works and Bottom Outlet, which presents several significant (sic) modifications to the diversion works (sic) and a (sic) variation in the length and cross-section of the excavation of the future diversion tunnels (sic). 1.2 Justification for increasing the size of the diversion tunnels: The principal objective of diverting (sic) river water through the tunnels is to dewater the work area for the foundation and construction of the dam. The size of the diversion tunnels (sic) is determined by the volume of water to be conveyed and the height of the cofferdam (ataguía). It was concluded that the cofferdam would have a height of (sic) 30 m (with a concrete volume of 100.000 m3), and the diversion tunnels (sic) would have an excavation cross-sectional area of 175 m2; the lengths of the diversion tunnels (sic) were reduced to 675 m and 789 m. 1.3 Modification of the excavation diameter of the access adit: It was initially proposed that access to the diversion-tunnel gallery (sic) would require an access adit 130 m long, with an excavation diameter of 4.8 m and an excavation area of 21.1 m2.
Based on the studies cited, the optimal dimensions of the access adit would be 6 m high and 6 m wide at floor level, for an excavation area of 32.14 m 2. Under the new design for the diversion tunnels (sic), the excavation diameter (sic) would be 14 m (sic), with a floor width of 14 m and an excavation area of 175 m2. 1.4 Modification of the excavation diameter of the investigation gallery: It was originally to have an excavation cross-sectional area of 27.5 m2, corresponding to the minimum constructible cross-section needed to accommodate the specialized excavation equipment. For operational safety reasons, the use of steel arches as temporary reinforcement is proposed, and according to the basic design submitted by INGETEC, the dimensions of the diversion tunnels (sic) would consist of an excavation diameter of 14 m and a floor width of 14 m, entailing an excavation area of 175 m2. The new proposed investigation gallery would have an excavation cross-sectional area of 42.73 m2, with a height of (sic) 4.5 m and a floor width of 134.08 m. 1.5 Analysis of excavation volumes: The volume of loose material generated by the excavations and to be placed in the spoil-disposal sites from the originally proposed access adit would be 3703 m3, and the volume from the proposed investigation gallery would be 33413 m3, for a total of 37106 m3.
With the modifications, the volume from the access adit currently proposed would be 5641 m3, and the volume from the current investigation gallery would be 38938 m3, for a total of 44578 m3; however, the proposed spoil-disposal sites have a capacity of 51039 m3, and it would not be necessary to prepare another spoil-disposal site. (…) Accordingly, ENVIRONMENTAL APPROVAL is granted to the project, thereby opening the Environmental Management phase. (…)” (folios 522 through 534 of Volume II of Administrative File No. 366-2005-SETENA).
That process continued during March and April, and on 22 de mayo de ese mismo año it was recorded that filling the gabions (gaviones) was completed during the night shift. Those entries were signed by Engineer Nombre139475 and Nombre139484 (folios 01, 02,03, 05, 06, 10 and 13 of the administrative record labeled “Site Logbook”).
In the cited 2766-2009-SETENA, ICE carried out research activities and construction works associated therewith on the right bank of the General River and in the Térraba Indigenous Reserve, such as: drilling, geological research, investigation and excavation along the axis of one of the future diversion tunnels, construction of a gabion wall, earthmoving, excavation of the portal, the access adit, the intersection and the research gallery, and temporary facilities (such as a dining hall, clinic, warehouses, and offices) (logbook, judicial inspection, statement by Nombre139475, folios 2225 and 2226 of the court record).
III.Unproven facts. Relevant to these proceedings, and because there is no evidence in the case file supporting them, the following are deemed unproven: 1) That the work or activities of the research phase, or the construction works associated therewith, carried out by ICE within the indigenous territory of Térraba in connection with expediente No. Nombre139483, caused environmental damage. 2) That ICE had applied to the competent public entities or bodies for the authorizations or permits required for tree felling (corta de árboles), earthworks (movimientos de tierra), excavations, and the construction of the gabion wall (muro de gaviones) on the right bank of the right-hand channel of the Río General. 3) That ICE had carried out activities or work pertaining to the investment or implementation phase of the PHD in the indigenous territory of Térraba. 4) That, prior to the amendment authorized by resolución No. 2766-2009-SETENA, Nombre139474 had conducted a visit to the area of the “Estudios Geológicos Sitio Térraba” project.
IV.Subject matter of the proceedings. In this case, the claimants essentially seek a series of orders requiring that:
V.The specific case. The first claim made by the petitioners seeks an order requiring ICE to immediately undertake a complete and comprehensive environmental impact assessment (evaluación de impacto ambiental, EIA) for the area of the Reserva Indígena de Térraba, under the supervision and oversight of SETENA, which must even be conducted using the environmental instrument known as a Strategic Environmental Assessment (Evaluación Ambiental Estratégica, EAE), or alternatively by processing an Environmental Impact Study (Estudio de Impacto Ambiental, EsIA) for the investment stage (construction and operation) in that area of the PHD. To determine whether this claim should be granted, it is necessary to analyze several matters concerning the point at which ICE must comply with the requirement to assess the environmental impact of the activities or works that it carries out within the indigenous territory of Térraba for the investigation and development of the PHD, as well as the type of instrument it must request for those purposes.
This latter issue must also be linked to the nature of the works or activities being performed. In this regard, and in relation both to the subject matter of this litigation and to the facts deemed proven, it is appropriate to begin by recalling that, in connection with the PHD, ICE initiated two proceedings before Nombre139474 aimed at obtaining environmental approval (viabilidad ambiental) for various activities with environmental impacts that it intended to undertake. The first was conducted under expediente No. Nombre139483 for the project “Geological Studies at the Térraba Site.” In essence, the activities with environmental impacts for which assessment was requested were related to geological investigation or exploration. According to the testimony of geologist Nombre139476, the fundamental purpose of geological and geotechnical investigations is to determine how the physical environment—in this case, the rock mass—will behave in relation to the works to be undertaken; the parameters that will make it possible to determine how the works should be constructed, such as the strength and deformability of the environment; and the potential risks that may be encountered during project implementation, such as water pressure, temperature, gas pressure, or the presence of explosive and flowing rock.
He stated that this type of investigation may be conducted through drilling or the excavation of shafts or galleries, and that criteria such as efficiency, technology, timing, safety, and geological uncertainty or risks are weighed when determining the scope and nature of such investigations. The information obtained from the investigation is essential for other stages of the project, such as engineering design, the construction process, and the risk-management plan. It was deemed proven that, through the cited resolution No. Nombre139474, Nombre139474 approved the sworn declaration of environmental commitments (declaración jurada de compromisos ambientales, DJCA) submitted for assessment by ICE within the cited expediente No. Nombre139483 and informed it that the environmental-assessment process had been completed for the project “Geological Studies at the Térraba Site,” which, insofar as relevant, it described as follows: “(...) Investigative drilling from the geological, hydrogeological, and geophysical perspectives at the sites identified for the prefeasibility phase of a future hydroelectric project.
The work to be carried out consists of core-sample drilling at the two sites, with greater detail or a larger number of boreholes at the site known as Térraba, on the banks of the Río General, supplemented by the drilling of galleries on each bank (...) The work to be carried out consists of core-sample drilling at the two sites, with greater detail or a larger number of boreholes at the site known as Térraba, on the banks of the Río General, (...)” (emphasis not in the original); granting the corresponding environmental approval and leaving the environmental-management stage open (folios 55 through 84 of volume I of administrative expediente Nombre139474 No. 366-2005). Subsequently, in July 2009, ICE requested that Nombre139474 extend the environmental approval granted for the aforementioned project because it needed to obtain additional geological data relating to the sites of the project works in order to gather information essential to the engineering designs that it had not been possible to obtain through the explorations conducted up to that point.
Insofar as relevant, it stated that the additional activities requested included “(...) 1. Various geological-exploration boreholes at the Cañablancal, Térraba (covering both banks of the Río General), and Ceibo sites. 2. Preparation of a geological-exploration gallery at the Térraba site (on the right bank of the Río General) for the future diversion tunnels. (...)” It further stated that the proposed additional investigative activities and their environmental impacts did not differ in any respect from those originally proposed in that expediente. It attached to the request a sworn declaration of environmental commitments and a series of annexes detailing the requested works (folios 222 through 495 of volumes I and II of administrative expediente Nombre139474 No. 366-2007) (emphasis not in the original). On 28 de setiembre de ese mismo año, ICE submitted to Nombre139474 an addendum to the request to extend the environmental approval in expediente No. 366-2005-SETENA, providing technical justification based on recent changes to the galleries requested in the extension application and attaching two technical reports signed by Engineer Nombre139475, PHD Underground Works Coordinator (folios 12 through 27 of the administrative file corresponding to the Addendum submitted in administrative expediente No. 366-2005-SETENA).
Ultimately, through the cited resolution No. 2766-2009-SETENA, Nombre139474 approved the new DJCA submitted for assessment by ICE on the basis of the aforementioned request to extend the environmental approval and the addendum, within administrative expediente No. 366-2005-SETENA. The operative portion of that resolution describes and authorizes a series of additional activities related to geological investigation and, as will be discussed further in a subsequent Whereas clause (Considerando), certain construction works associated with it, on the right bank of the Río General and in the Reserva Indígena de Térraba. These included drilling, geological investigation, investigation and excavation along the centerline of one of the future diversion tunnels, construction of a gabion wall, excavation of the portal, the access window, the intersection and the investigation gallery, and temporary facilities (such as a dining hall, clinic, warehouses, and offices), which were carried out during 2010 and through May 2011 (folios 522 through 534 of volume II of administrative expediente No. 366-2005-SETENA, logbook, judicial inspection, statement by Nombre139475).
Finally, it should be added that, by order of project management, the technical closure work for the exploration gallery on the right bank of the Río General began on 3 de mayo del 2011 (folio 43 35 42 of the administrative expediente labeled “Logbook”). Then, on 23 de junio del 2011, Mr. Víctor Mauricio Guzmán Arguedas, an official of Nombre139474, appeared and conducted an inspection at the location where the project “Geological Studies at the Térraba Site” was being carried out in order to officially close the Investigation Gallery Site; and through official letter SG-ASA-1072-2011-SETENA, dated 18 de julio del 2011, Nombre139474 informed ICE and the project’s environmental officer that, based on the corresponding technical report, no instances of noncompliance had been identified, and the works carried out by ICE on the downstream right bank of the Río General Superior within the Territorio Indígena de Térraba were therefore closed.
It further stated that the other work fronts, as well as the downstream left-bank sector of the Río General Superior outside the Territorio Indígena de Térraba, remained active for that Secretariat (emphasis not in the original) (folios 612 and 613 of volume III of administrative expediente No. 366-2005-SETENA). Separately, in July 2007, ICE also initiated the environmental-assessment procedure for the project known as Proyecto Hidroeléctrico El Diquís, using a D1 form, so that Nombre139474 would provide the terms of reference required for the environmental impact study of a project of that magnitude. That request was assigned expediente number 843-2007-SETENA (folios 1 through 25 of volume I of administrative expediente Nombre139474 No. 843-2007). Through the previously cited resolution No. 2174-2007-SETENA, the Plenary Commission of Nombre139474 approved the proposed terms of reference submitted by ICE and granted it a maximum period of two years to submit an EsIA for the PHD (folios 36 through 48 of volume I of administrative expediente Nombre139474 No. 843-2007).
Subsequently, in the cited resolution No. 1526-2009-SETENA, the proposed terms of reference submitted by ICE were approved following modifications requested by ICE in March 2009 in connection with observations made by the Banco Interamericano de Desarrollo (folios 122 through 125 of volume I of administrative expediente Nombre139474 No. 843-2007 and the administrative expediente labeled Anexo Términos de Referencia, testimony of Nombre139478). The two-year period granted by Nombre139474 to ICE for submitting the EsIA was extended by one year in December 2009 (folios 141 through 144 of volume I of administrative expediente Nombre139474 No. 843-2007). However, in December 2010 ICE requested a second extension from Nombre139474 for submission of the study, and in May 2011 it requested suspension of that deadline because it was impossible to conduct the consultation with the indigenous populations that would be affected by the PHD and because that matter was required to be included in the study in question (testimony of Nombre139478).
Ultimately, through resolution No. 2278-2012-SETENA, issued at 8 hours on 5 de setiembre del 2012, the Plenary Commission of Nombre139474 agreed to suspend the deadline for ICE to submit the complete EsIA in the PHD expediente, imposing upon it the duty to submit semiannual reports to Nombre139474 stating, in appropriate detail, the status of the efforts to resolve the conditions on which the inability to provide the study had been based. The recitals of that resolution stated that the request to suspend the deadline was justified because full compliance with Convention 169 of the Organización Internacional del Trabajo required the resolution of a series of essential requirements before the participatory and mutually agreed consultation process with the indigenous peoples directly affected by the project could be undertaken. In addition, it was also considered that the Sala Constitucional, through Voto No. 2975-2011, of 23 de setiembre del 2011, ordered ICE to conduct prior consultation (consulta previa) with the indigenous communities where the project would be carried out, which meant that ICE was unable to submit the environmental impact study until that consultation had taken place (folios 536 through 545 of volume III of administrative expediente Nombre139474 No. 843-2007).
To date, expediente No. 843-2007-SETENA remains suspended, and the indigenous consultation with the peoples that will be affected by the PHD has not been conducted (testimony of Nombre139478). From the foregoing account, we may conclude that the project granted environmental approval in expediente No.
Nombre139483 (for geological research at the Térraba site) has already been closed and terminated, at least insofar as the geological research to be conducted in the Térraba indigenous territory is concerned. In addition, the environmental assessment procedure relating to the PHD, processed under expediente No. 843- 2007-SETENA, has been suspended since setiembre del 2012 because consultation with the indigenous populations that would be affected by the development and implementation of the project (including Térraba) must imperatively be conducted, and that aspect constitutes a component of the environmental impact study (estudio de impacto ambiental, EsIA) that ICE must submit to SETENA. Because the aforementioned consultation has not been conducted, the suspension remains in effect to this day. In light of the foregoing, we consider it materially and legally unfeasible to order ICE to comply immediately with the duty to complete a full and comprehensive environmental impact assessment (evaluación de impacto ambiental, EIA) for the Térraba Indigenous Reserve area.
That assessment cannot be completed in a geological research proceeding that has already concluded, was technically closed, and was terminated; nor in a PHD implementation proceeding that is suspended precisely because ICE has been unable to submit the environmental impact study requested by SETENA. To date, an essential component of that assessment remains outstanding, namely, the indigenous consultation (consulta indígena) pursuant to the mandate of Article 6 of the aforementioned Convention No. 169. Now, this Court has no doubt whatsoever as to the importance that the right to a healthy and ecologically balanced environment holds within our legal system. This right is protected under Article 50, paragraphs 2º and 3º, of the Constitution and has been the subject of extensive statutory, regulatory, and jurisprudential development in a field that has also been addressed by international treaties to which Costa Rica is a signatory State.
In this regard, it is appropriate to recall that Article 17 of the Organic Law of the Environment (Ley Orgánica del Ambiente, hereinafter LOA) provides that: “Human activities that alter or destroy environmental elements or generate waste or toxic or hazardous materials shall require an environmental impact assessment by the Secretaría Técnica Nacional del Ambiente created by this law. Prior approval by this body shall be an indispensable requirement for commencing the activities, works, or projects. Laws and regulations shall specify which activities, works, or projects require an environmental impact assessment.” Accordingly, the need for instruments that measure the environmental variable (variable ambiental) in the various forms of human conduct and activities that may be considered intrusive to the environment is established as a general rule. The Environmental Impact Assessment thus constitutes a procedure involving a complex convergence of legal, technical, and administrative variables, whose purpose is none other than to measure, identify, predict, or project the impacts that a particular human activity will probably produce on the environment if it is carried out or materially implemented.
That procedure serves as the basis for a prior authorization procedure (procedimiento autorizatorio), through which the effects and consequences that a construction project or human activity will generate in the environment are assessed, and it constitutes an important mechanism for implementing environmental policy, with direct and immediate application to productive activities, so as to harmonize and make those economic or social undertakings compatible with preservation of the environment, within a vision of sustainability or sustainable development. We therefore consider it necessary to caution that, if ICE, as the developer of the PHD, decides to resume the geological research phase of this project, it must clearly comply with the environmental regulations currently in force (particularly Article 17 of the LOA) and request, within a new proceeding, the corresponding environmental impact assessment, which must be appropriate to the type of activities or works required during that research phase, as we shall explain below.
VI.Taking into account the foregoing in relation to the clarifications made regarding the subject matter of these proceedings, the Court understands that the claimants’ first prayer for relief seeks an order requiring ICE, should it carry out construction works or enter the investment or operational phase of the project, to conduct the corresponding environmental impact assessment. This is because, as may be inferred from the arguments presented by the claimant, some of the environmentally authorized activities having an impact under expediente No. 366-2005-SETENA go beyond geological research, insofar as they constitute construction works more closely associated with an investment or operational phase of the project, without having been evaluated using the environmental instrument required in light of their true nature. On this point, it bears reiterating that no claim for annulment has been asserted in these proceedings that would empower the Court to review the legality of the actions and decisions through which Nombre139474 granted the corresponding environmental approvals for the “Geological Studies at the Térraba Site” project.
Nevertheless, it may indeed be inferred from the claimants’ arguments and substantive claim that they allege an omission by Nombre139474 in failing to require compliance with environmental regulations and in allowing, pursuant to an environmental approval based on a DJCA, the performance of works or activities characteristic of a construction or investment phase, which required a different environmental instrument, such as, in the claimants’ view, a Strategic Environmental Assessment or an Environmental Impact Study. From this perspective, the manner in which the claim was framed allows this Court to analyze the nature of the authorized activities having an impact, as authorized at the time by Nombre139474, in order to determine whether they constitute merely geological research activities or construction works associated with that phase or with an investment stage that would have required an environmental assessment instrument different from the one authorized at the time.
This is not for the purpose of annulling the actions taken because, we reiterate, such relief was not requested by the claimant, but solely to establish the limits and rules imposed by the legal system and the facts for the lawful exercise of the administrative powers that, in this case, ICE and Nombre139474 would exercise if a new phase of geological research for the PHD were reopened. This is, of course, without prejudice to the discretion retained by that entity and agency, as follows from subsection f) of articles 42 and 122 of the CPCA, as well as sections 15, 15 and 158, subsection 4), of the General Law of Public Administration. In that regard, and for purposes of delimiting the examination to be conducted, we must begin by noting that it was not shown in these proceedings that ICE had carried out activities or work characteristic of the investment, operational, or implementation phase of the PHD in the Térraba Indigenous Territory.
In the Court’s view, sufficient and necessary evidence to establish that fact with the requisite degree of certainty was not submitted. On the contrary, the evidence gathered tends much more strongly to confirm that the work and activities performed by ICE under expediente No. Nombre139483 until approximately May 2011 were, in general, characteristic of the geological research, exploration, and experimentation required prior to its implementation, that is, implementation of the PHD. This may be inferred from the testimony given by Nombre139477, who held the position of Coordinator of ICE’s Geotechnical Engineering Division and stated, in essence, that the report issued by INGETEC in November 2005 did not entail the commencement of construction works and did not include the final plans or designs. Engineer Nombre139475, who had served as Coordinator of Underground Works, for his part, insisted that the activities performed in connection with the aforementioned expediente were geological research activities and had been authorized by SETENA, both as to the works and their dimensions.
Nombre139478, a Forestry Engineer who held the position of Environmental Coordinator for the PHD, stated that the activities carried out under expediente No. Nombre139483 were research activities and associated works. Finally, Nombre139479, an Environmental Audit and Monitoring analyst for Nombre139474, stated that the activities described in the aforementioned expediente were characteristic of the research stage and, although their scale was unclear, did not appear to constitute the commencement of works. The only witness who differs on this point is Nombre139485, a geologist and construction engineer who stated that, in his opinion, the PHD was in the construction phase. As he explained, he reached that conclusion based on various indicators, such as the organizational structure that ICE still maintains on the official Diquís website, the type of works being performed, and the volume of resources and materials handled.
On this point, however, the Court is inclined to credit the testimony given by Nombre139477, Nombre139475, Nombre139478, and Nombre139479 over that of Mr. Nombre139485, for the following reasons. Although the latter worked for ICE on various hydroelectric projects, such as Arenal and Corobicí, and we do not doubt his experience in the field of hydroelectric projects, the fact remains that he had almost no involvement with the PHD because he ceased working for that entity in 2006. Consequently, he had no direct involvement with the work carried out under expediente No. Nombre139483, nor was he at the site where it was performed. His assessments regarding the organization surrounding the project are based primarily on the information provided on the site’s official webpage, which, in our opinion, is not compelling evidence from which to conclude that the project was in a construction or investment phase.
This is because nothing precludes the possibility that the organizational chart was intended for use once the project had reached all of its phases or that it is not up to date. Furthermore, the witness’s statements concerning the number of personnel and amount of resources involved are not supported by appropriate sources. Adding to the foregoing the fact that Mr. Nombre139485 was not at the site while the works were being performed, the only possible conclusion is that these are subjective assessments lacking certainty. With respect to the works performed, and as we shall analyze infra, we also consider that they are not a distinguishing feature of the investment phase, since there are research activities that are inherently construction-related, such as excavation, as Mr. Nombre139485 himself stated. Having ruled out that the activities carried out under expediente No. Nombre139483 corresponded to an investment or operational phase, it is necessary to determine whether construction-related works were performed during the geological research phase to which we have been referring and, if so, which environmental instrument was appropriate for evaluating those activities having an impact.
It has been established that, under the environmental approval granted in the cited decision No. 2766-2009-SETENA, ICE carried out activities of a geological research nature, such as drilling and exploration, on the right bank of the Río General and within the Térraba Indigenous Reserve; however, it also carried out construction works associated with that research, such as earthmoving, excavations (of the portal, access window, intersection, and research gallery located along the axis of one of the future diversion tunnels), and construction of a gabion wall. This conclusion is reached after assessing, in accordance with the rules of sound rational judgment, various items of evidence, including the field logbook, the judicial inspection, and the statements of Nombre139486, Nombre139478, Nombre139475, and Nombre139479. Let us examine them. The first construction-related work carried out during that research phase was the gabion wall, authorized in decision No, 2766-2009-SETENA as follows: “(...) 2.6.1 Protective dike with gabion wall: For the purpose of providing a safe work platform and ensuring the safety of operating personnel during periods of heavy rain, while helping to contain river water in the event of flooding.
It is 6 m high and 110 m long, and its width varies according to its height, ranging from three to one meter wide, with approximately 1540 m3 of stone (...).” From the beginning of the entries contained in the administrative expediente entitled “Field Logbook,” it was noted that a decision had been made to intensify the filling of gabions in the area upstream of the wall in order to create a defense in the event that the river rose (folio 01). That process continued until May 22, 2010, when it was completed, after which concrete was sprayed onto the face of the wall facing the river (folios 13 and 15). The Court confirmed the existence of that gabion wall during the judicial inspection, as reflected in the corresponding recording. We consider it to be a construction work for which the corresponding construction permit is required, as may be inferred from articles 1, 2, and 74 of the Construction Law.
This is aggravated by the fact that the work was carried out on the right bank of the Río General riverbed, a matter regarding which, notwithstanding the statement of Engineer Nombre139478 (who omitted any reference to the construction of the gabion wall as work carried out in the riverbed), the Court has no doubt, given what was observed during the judicial inspection. The location where that gabion wall was built made it necessary to obtain the authorization referred to in articles 33 and 34 of the Ley Forestal. There is no evidence in the record that ICE applied for or obtained the corresponding construction permit to erect that wall or the authorization referred to in the Ley Forestal. Other construction-related works carried out during the research phase were earthmoving activities performed in at least two instances. The first is the one described by Forestry Engineer Nombre139478, who, in response to a question from the Court, stated that such activities had indeed occurred and were associated with improving access roads, particularly the existing trails on the property, and were necessary to allow the drilling machinery to enter.
Once again, it was not shown that such earthmoving had the municipal permits required under sections 1, 2, and 74 of the Construction Law. Engineer Nombre139478 stated that, as he understood it and for ICE’s purposes, movements of this kind undertaken by that institution neither call for nor require such permits. The Court does not share that position. As we have stated on other occasions, including judgment No. 115 -2011-VI, issued at 15 hours 15 minutes on May 3, 2011, we cannot accept that ICE enjoys a form of special treatment allowing it to avoid compliance with the permits or authorizations imposed by the legal system for the performance of construction works or the exploitation or use of public-domain property; nor does this follow even from the provision creating it, namely Decree-Law No. 449.
That legislation creates powers (powers-duties) in favor of ICE, including directing the development of hydroelectric energy in order to strengthen the national economy and promote the greater well-being of the country’s inhabitants; a situation that does not entail per se an exemption from or exclusion of the authorizations or permits that the legal system itself establishes for specific activities, nor does it confer a right to use the Nation’s waters. On the contrary, a comprehensive interpretation of Decree-Law No. 449 in relation to the legal system, especially the provisions regulating urban planning, the environment, the right to build, the protection of water resources, and regulations concerning the provision of public services, supports the conclusion that this power must be exercised within the limits established by the legal system itself, one of which is precisely obtaining these permits, authorizations, or concessions, as applicable depending on the activity performed.
Article 2 of the Decree-Law states that this institution must seek the rational use of natural resources, avoiding their destructive and wasteful exploitation. It is likewise charged with conserving and defending the country’s water resources by protecting watersheds, springs, and the channels of rivers and streams. Thus, a proper interpretation of Decree-Law No. 449 cannot lead us to conclude that the legal provisions imposing conditions and limits on construction activities do not apply, much less that ICE is exempt from requesting the respective authorizations for such purposes. Rather, it is essential that ICE comply with all regulations protecting the environment and natural resources, which requires that the aforementioned authorizations be requested and approved. This Court is not unaware of the need to develop and execute hydroelectric projects that facilitate the fulfillment of the purposes entrusted to ICE.
This type of activity is undoubtedly in the public interest; however, its statutory purposes cannot be achieved outside the regulations and conditions established by law for such purposes. This is because ICE is subject to the legal system and therefore, before carrying out activities of this kind (work in a river channel, earthmoving, and excavation), it must obtain the respective authorizations. On this subject, reference may also be made to judgment No. 0001309-F-S1-13, issued by the First Chamber of the Supreme Court of Justice at 14 hours 5 minutes on primero de octubre del 2013, which affirmed the aforementioned decision No. 115-2011-VI. The second context in which we identify earthmoving is the activity involving excavation, as we shall now analyze. In his testimony, Mr. Nombre139485 explained that, in the case of tunnels, there are two construction stages, namely excavation and lining.
Then, in response to a question from this Court, Mr. Nombre139479 stated that any excavation constituted construction work. This is consistent with Article 55 of the Construction Decree-Law, which provides that, before any excavation work is carried out, an Engineer must obtain prior permission from the Municipality, which shall grant it upon prior approval of the project or safety memorandum. Article 56 of the same Decree-Law, for its part, provides that precautions must be taken to prevent ground movements at the excavation site from causing damage to nearby buildings and public services. Now, from the outset of his testimony, Mr. Nombre139478 stated that investigative activities and associated works were authorized in expediente No. Nombre139483. Upon careful examination, the administrative file labeled “Logbook” concerns oversight of the works related to the exploratory gallery on the right bank of the dam site (folio 00 of the logbook) and expressly refers to the excavation of the exploratory gallery itself.
The daily entries made in the construction logbook reflect the entire process followed for those purposes, which began with the excavator’s arrival at the portal site, the portal being understood as the protective structure constructed to enter the rock mass (testimony of Nombre139475). It was recorded that the material appeared highly unstable when excavation began and that the excavation of the first bench was deepened in order to find more stable ground at a greater depth (folio 11 of the logbook). This excavation process continued until 21 de junio del 2010, the day on which the drilling process for the fourth and final bench used to form the portal was completed (folio 18 of the logbook). Subsequently, installation of the arches outside the slope began in order to form the portal and commence excavation of the gallery (folio 19 of the logbook). The underground excavation process continued using blasting methods.
First, the access adit was excavated, which is the distance or corridor between the portal and the investigation site and constitutes the means of access to the exploratory gallery (testimony of Engineer Nombre139475). Excavation of the access adit progressed using rock bolts and shotcrete as temporary reinforcement (folio 24 of the logbook). According to the testimony of Engineer Nombre139475, these temporary supports are used because blasting leaves the material exposed; it decompresses, tends to fall, and requires support until the adit is lined. Mr. Nombre139485 stated that when excavations were carried out, if the rock fell, bolts had to be installed to hold it in place. He added that if the material was poor, another temporary support, such as arches, was used. Both witnesses agree that they are called temporary supports not because they are tied to a particular period or are subsequently removed, but because they remain until the lining is applied.
Excavation of the adit ended after advancing 145.15 meters, and the next step was to begin excavating the enlarged intersection (folio 28 of the logbook). Engineer Nombre139475 explained that the intersection is the junction between the adit and the gallery, and that upon entering through the adit, a point is reached where the gallery runs perpendicular to it and space is needed for incoming machinery to turn. The intersection is therefore enlarged so the equipment can turn. Temporary steel-frame supports were not used for this enlargement because the material was sound and stable (as also stated in folio 28 of the logbook). Once the intersection had been enlarged, excavation proceeded along the alignment of the exploratory gallery, using temporary supports consisting of welded wire mesh, rock bolts, and shotcrete (folios 29 and 30 of the logbook). It should be emphasized that, as excavation of the gallery advanced, certain measures directly related to the construction of the diversion tunnels and their crowns were taken.
This may be inferred from folios 30, 31, and 37 of the logbook and is a point we will analyze infra. Excavation also continued through the enlarged section of the gallery and in the opposite direction, that is, downstream (folios 37, 38, and 39), until the technical closure of the exploratory gallery on the right bank of the Río General, by which time 215,5 meters had been excavated upstream and 166,7 meters downstream, for a total of 382, 23 excavated meters (folio 43). In the Court’s view, the foregoing makes clear that the excavations performed in the access adit and the investigation gallery do constitute construction works that do not lose that character merely because they were authorized by SETENA, were performed during the investigation phase, and were necessary for that phase. That characterization is important, particularly for environmental purposes, as we shall see supra. Moreover, it was also established that, through excavation of the investigation gallery, ICE also excavated approximately 43 square meters (corresponding to the area of the investigation gallery located along the centerline of one of the future diversion tunnels) out of the 175 square meters that one of the future diversion tunnels would have (testimony of Nombre139475, administrative expediente labeled “Logbook”).
In this regard, we must bear in mind that the aforementioned decision No. 2766-2009-SETENA and the technical reports supporting it authorized the expansion of activities within the investigation phase of the “Estudios geológicos Sitio Térraba” project. One of the additional activities authorized was the “(...) Development of a geological exploratory gallery at the Térraba site (on the right bank of the río General) for the diversion tunnels. (...) 2.6 Geological exploratory gallery for the diversion tunnels: This refers to the river diversion tunnels required to protect the dam construction area, which will consist of two underground excavations at elevation 141 m .s.n.m. The characteristics and dimensions of the tunnels were modified in the proposed Addendum to the application for expansion of environmental viability (see point 1). (...)”. As can be seen, from the time the expansion of and addendum to the environmental viability granted in the aforementioned expediente No. Nombre139483 were requested, ICE knew that the gallery to be developed at the Térraba site would be used for the geological investigation of the future diversion tunnels.
Engineer Nombre139475 stated that it was always specified that the investigation gallery had to be located along the centerline of the future diversion tunnels, and justified that decision on the ground that if the purpose was to investigate those tunnels, the investigation had to be conducted along that centerline, because otherwise the information obtained would not be representative. The logbook, for its part, supports the inference that there came a point at which, as excavation of the investigation gallery advanced, excavation of at least one of the future diversion tunnels also advanced. For example, on 13 de octubre del 2010 it was recorded that “(...) It was decided not to pour the floor because the invert would be removed during construction of diversion tunnel 2, such that the floor invert will not be poured until absolutely necessary (...)” (folio 30); on 21 de octubre de ese mismo año it was stated that “(...) Excavation continues without problems.
Next week a decision will be made as to where (sic) the full-section excavations of the crowns of the diversion tunnels will be carried out for geological and geotechnical investigations. (...)” (folio 31); and on 14 de diciembre it was stated that “(...) On 03 de diciembre, the process of enlarging the gallery from station 223,04 onward began in order to investigate the behavior of the ground with the arch of the permanent diversion tunnel. (...)” (folio 37). Engineer Nombre139475 reinforced this position when he stated that if the diversion tunnels were built, that portion was already excavated because the investigation had been conducted, and that this was an additional benefit, although not an excavation as such. He then explained that the gallery had an area of 43 square meters and the future diversion tunnel an area of 175 square meters, meaning that simply 24% of the future area of the diversion tunnels had been excavated.
It was also stated that two parallel twin diversion tunnels, each measuring 14 meters, had been planned, for which approximately 250.000 cubic meters of material would be excavated in total, and that the amount excavated by the time of the technical shutdown was 12.000 to 13.000 cubic meters, corresponding to less than 6% of the total excavation. From the evidence examined, we conclude that, in excavating the geological investigation gallery, ICE also excavated a portion of what would eventually become one of the PHD diversion tunnels; this further confirms that construction work was indeed carried out during that investigation phase, some of it involving the crown of one of the future diversion tunnels. We find that the decision adopted by ICE was not necessarily improper, nor was the approved modification intended to make the dimensions of that investigation gallery match those of the future diversion tunnels.
On the contrary, the testimony of Mr. Nombre139476 and Mr. Nombre139475 demonstrated the importance of geological investigations or explorations in developing a hydroelectric project of the nature and scale of Diquís. Accordingly, if it was possible to investigate the behavior of the rock mass (macizo rocoso) at the exact site, or as close as possible to the axis of the diversion tunnels, while also advancing the excavation of those tunnels through the excavation of the gallery, everything indicates that, from a technical standpoint, this should have been done in order to determine the quality and characteristics of the material and its stability, achieve greater cost efficiency and safety by minimizing risks, and make more appropriate use of technology. Nevertheless, we find that if part of the diversion tunnels was excavated in conjunction with the geological investigation, even if only a small percentage, this should have been disclosed to Nombre139474 because of the environmental implications it may have entailed, as we shall examine below.
VII.Specifically, in their arguments, the plaintiffs allege an omission by Nombre139474 when establishing the environmental instrument on the basis of which the activities described in the preceding Whereas clause (Considerando) were authorized for the “Estudios Geológicos en el Sitio Térraba” project. Although no claim seeking annulment of any actions (formal or material) taken by Nombre139474 in the environmental proceeding conducted under expediente No. 366-2005-SETENA has been asserted in this case, the plaintiffs’ requests seek an order requiring the public entities involved to adopt certain corrective environmental measures so that, should the project resume or continue, it complies with the environmental regulations in force, considering that it will be carried out, at least, within the Térraba indigenous territory, where they reside. In that regard, we deem it necessary to make certain observations concerning the actions taken by Nombre139474, to serve as parameters for ruling on the relief requested.
As we have been indicating, resolución No. Nombre139474 granted environmental viability (viabilidad ambiental) for the “Estudios Geológicos en Sitio Térraba” project, whose developer was ICE. Fundamentally, that resolution authorized activities such as geological drilling, excavation of exploratory galleries, and the opening of trails and paths (as may be inferred from the administrative conduct itself and from the testimony of Nombre139478). In that expediente, ICE submitted a FEAP, and the environmental assessment instrument (instrumento de evaluación ambiental) on the basis of which the aforementioned environmental viability was ultimately authorized was an Environmental Commitments Sworn Declaration (Declaración Jurada de Compromisos Ambientales, DJCA). This was pursuant to resoluciones No. 587-1997-SETENA and No. 693-1997-SETENA, which were in force on the date the FEAP was filed. Subsequently, in the year 2009, ICE applied to Nombre139474 for an expansion of the environmental viability granted through resolución No. Nombre139474 cited above and submitted an addendum to that application for expansion.
The first application (the expansion) was based on the need to obtain geological data relating to the sites of works for the aforementioned project in order to gather information essential to the engineering designs that had not been obtainable through the exploratory work carried out up to that time. It further stated that the proposed additional research activities and their environmental impacts did not differ in any respect from those originally proposed in that expediente (folios 222 al 495 tomos I y II del expediente administrativo Nombre139474 No. 366-2007). The request for an addendum to the expansion application was technically justified by recent changes to the galleries requested in the expansion application, and two technical reports signed by Engineer Nombre139475, PHD Underground Works Coordinator, were attached (folios 12 al 27 de la carpeta administrativa correspondiente a la Adenda planteada en el expediente administrativo No. 366-2005-SETENA).
Through resolución No. 2766-2009-SETENA, Nombre139474 approved the new DJCA submitted for assessment by ICE on the basis of the application to expand the environmental viability and the addendum to that application. As relevant here, that expansion of the environmental viability authorized activities such as:
Verification of the change in these conditions shall be endorsed by Nombre139474 on the basis of an administrative decision (resolución administrativa), within a maximum period of ten business days, in order to maintain the validity of the Environmental License (Licencia Ambiental). In the Court’s view, Nombre139474 should have assessed these matters to determine whether the expansion entailed changes to the environmental category initially granted to the project, in order to maintain environmental balance, given the impacts that the additional activities could cause. This is because it has been established that, under the environmental viability (viabilidad ambiental) granted in the cited resolution No. 2766-2009-SETENA, ICE carried out research activities (such as drilling and geological exploration), as well as related construction work, on the right bank of the Río General and within the Reserva Indígena de Térraba, including earthworks (movimientos de tierra), construction of a gabion wall, excavation of the portal, the access window, the intersection, and the research gallery (logbook, judicial inspection, testimony of Nombre139475 ); it was even established that, under that same environmental viability, ICE excavated approximately 43 square meters (corresponding to the area of the research gallery located along the axis of one of the future diversion tunnels) out of the 175 square meters that one of the future diversion tunnels would encompass (testimony of Nombre139475 , administrative file labeled “Bitácora”).
It should be recalled that every environmental impact (impacto ambiental) must be measured, which is accomplished through various instruments, including environmental impact studies (estudios de impacto ambiental), for the purpose of granting the corresponding environmental viability license (licencia de viabilidad ambiental). In this regard, subsection 37 of section 3 of the cited regulations defines Environmental Impact Assessment (Evaluación de Impacto Ambiental) as the scientific and technical administrative procedure that makes it possible to identify and predict the effects that an activity, work, or project will have on the environment, quantifying and weighing them to guide decision-making. In general, Environmental Impact Assessment encompasses three essential constituent phases: a) the first is the Initial Environmental Assessment (Evaluación Ambiental Inicial), b) the second is the preparation of the Environmental Impact Study (Estudio de Impacto Ambiental) or any other applicable environmental assessment instruments, and c) the third concerns the environmental monitoring and oversight (Control y Seguimiento ambiental) of the activity, work, or project through the established environmental commitments.
For its part, subsection 18 of Article 7 of the Ley de Biodiversidad defines environmental impact studies as follows: “A scientific and technical procedure that makes it possible to identify and predict the effects that a specific action or project will have on the environment, quantifying and weighing them to guide decision-making. It includes the specific effects, their overall assessment, the alternatives providing the greatest environmental benefit, a program for controlling and minimizing adverse effects, a monitoring program, a restoration program, and an environmental compliance guarantee.” It follows from the foregoing that an environmental license or environmental viability, as stated in subsection 63 of section three of the aforementioned Regulations, represents a condition of acceptable harmony and balance between the development and execution of human works and their potential environmental impacts on the environment of the geographic area where they are to be implemented.
From an administrative and legal standpoint, it corresponds to the act approving the Environmental Impact Assessment process, whether at the initial assessment phase, through the study itself, or through another impact document. The implications of human works for the environment justify and require an assessment of their impact on it. We consider that the construction-related activities carried out by ICE in this matter (earthworks, construction of a gabion tunnel, and excavations), although performed during a research phase, could have greater environmental significance than activities involving only research or geological exploration (such as drilling), particularly because they also relate to a major undertaking such as a hydroelectric power plant. This matter could have been assessed had the regulations in force when the expansion of the already-granted environmental viability was requested been applied.
Indeed, between the activities originally assessed and those included through the expansion of the environmental viability, the project underwent relevant and substantial changes in construction works, surface area, and drilling. In this regard, it was established that, between the research-related construction works authorized by resolution No. Nombre139474 (two galleries, each 150 m long) and those authorized by resolution No. 2766-2009-SETENA (an access window 130 m long and a research gallery 675 m long), within the Térraba indigenous territory, the project authorized under expediente No. Nombre139483 underwent a 168% modification in construction works; that the percentage change between the surface area authorized by resolution No. Nombre139474 and that authorized by resolution No. 2766-2009-SETENA within the Térraba indigenous territory, in both comparable and non-comparable areas, was 427%; and that the percentage change between the drilling authorized by resolution No. Nombre139474 (one borehole 100m deep and another 250 m deep) and that authorized by resolution No. 2766-2009-SETENA (five boreholes totaling 540 m in depth in MD) within the Térraba indigenous territory was 50% (certification appearing at folios 2225 and 2226 of the court record).
In conclusion, it is evident, as established in these proceedings, that the expansion did entail a substantial modification, in terms of both scale and the works to be performed, to the initially authorized “Estudios Geológicos en Sitio Térraba” project; this consideration is important solely as a guiding principle for the actions that both ICE and Nombre139474 undertake in the short, medium, or long term for the investigation and implementation of the PHD.
VIII.At this level of analysis, we consider it important to note the following. As explained, case file No. Nombre139483, concerning geological research studies at the Térraba site, was closed and archived, at least insofar as the Térraba site is concerned. However, in response to a question from the Court as to whether that phase had been completed for environmental purposes, Forestry Engineer Nombre139478 stated, in essence, that in principle it had, but that if any additional relevant element concerning this matter emerged during the Indigenous consultation, it would have to be considered and, if necessary, that phase could be reopened. The same would apply to pending matters that were not considered during that research phase, such as archaeological matters. If, in addition to the foregoing, we consider the time that has elapsed between the date on which ICE completed that research in Térraba (June 2011) and today, it is evident that the research, the geological risks weighed at that time, and the environmental aspects assessed at that time may have changed.
This could lead ICE to deem it necessary to reopen or resume the geological research phase before implementing the PHD. In that event, and within the scope of the relief sought by the plaintiffs, we consider it necessary to establish certain limits on the exercise of the powers of both ICE and the environmental authorities, so that their actions comply with the legal system. This is, of course, without prejudice to the discretion inherent in each of them. Accordingly, if ICE decides, in the short, medium, or long term, to resume the geological research phase of the PHD at the Térraba site, it must initiate the corresponding environmental assessment proceeding (procedimiento de evaluación ambiental), which shall be processed under a new case file—not as a modification or expansion—and shall be governed by the regulations in force at the time of its submission. Those regulations shall govern the determination of the project classification, the level of environmental significance (significancia ambiental), and the instrument that must be required.
With respect to this last issue, the plaintiffs seek to have the environmental assessment in the Territorio Indígena de Térraba conducted through a strategic environmental assessment (Evaluación Ambiental Estratégica, EAE) or an environmental impact study (Estudio de Impacto Ambiental, EsIA). At the outset, it must be noted that determining the environmental assessment instrument is a power vested exclusively in Nombre139474, subject, of course, to the specific requirements imposed by the regulations in force for each case. Nevertheless, we consider it appropriate to note that, based on the evidence gathered, the EAE does not appear to be the appropriate instrument for those purposes. Under the Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental, the EAE is the environmental impact assessment process (proceso de evaluación de impacto ambiental) applied to policies, plans, and programs.
Given its characteristics and nature, this type of process may also be applied to projects of national, binational, or Central American regional significance, or pursuant to multilateral agreements, as established by the regulations in force. Regarding this instrument, Forestry Engineer Nombre139478 stated that its advantage is that it allows a set of potentially impactful situations to be planned, but that, strictly speaking, it is intended for environmental analysis concerning policies, plans, and programs and that, in any event, it neither eliminates nor precludes the application of an environmental impact study if circumstances make one necessary. He explained that it does not make much sense for a specific territory or small areas, since other, more appropriate environmental instruments exist. Nombre139479, in turn, stated that the rigor of an EAE is not comparable to that of an EsIA because they are instruments of a different nature and that, in any event, conducting the former would not exempt the proponent from submitting an environmental impact study, since at most it would provide baseline information for the latter.
IX.Ultimately, the Court finds that the plaintiffs’ first claim must be granted in part. For the reasons set forth in the preceding Recitals (Considerandos), we find that it is not appropriate to order ICE to immediately complete the environmental impact assessment (evaluación de impacto ambiental, EIA) in the area of the Reserva Indígena de Térraba, because one of the case files has already been closed and archived insofar as the geological research in Térraba is concerned, while proceedings in the other, No. 843-2007-SETENA, have been stayed. Nor is it appropriate to specify the environmental instrument that must be applied or to require that it apply solely to the area of the Reserva Indígena de Térraba. We do, however, consider it appropriate to advise ICE that, if it decides, in the short, medium, or long term, to reopen or resume the geological research phase at the Sitio Térraba before implementing the PHD, it must initiate the corresponding environmental assessment proceeding under the regulations in force when its application is submitted.
Nombre139474 must determine the environmental assessment instrument to be required, taking into account the parameters established by the legal system for that classification, as well as the environmental significance of the potentially impactful works or activities to be carried out. ICE must also obtain from the competent entities and bodies the authorizations or permits required by the legal system to carry out activities such as tree felling (corta de árboles), earthworks (movimiento de tierras), excavations, and the construction of works within a river channel (obras en cauce de río), such as dikes or gabion walls.
X.Analysis of the merits of the second claim (pretensión). The claimants request that the State and ICE be ordered to prepare a comprehensive remediation, remedial, and compensatory-measures plan addressing all environmental impacts and damage caused by the defendants’ acts or omissions in the Reserva Indígena de Térraba, whether directly or indirectly resulting from the failure to have an environmental impact assessment instrument (instrumento de evaluación de impacto ambiental) specific to the project’s construction and operational stages, which must be supervised and approved by SETENA. After careful analysis, we find that the request is unfounded for the following reasons. First, it rests on the assumption that ICE did not have an environmental assessment instrument (instrumento de evaluación ambiental), although it has already been established that environmental viability (viabilidad ambiental) was granted in Resolutions No. Placa26572 and No. 2766-2009-SETENA.
It also assumes that the PHD was in the construction, investment, or operational stage, a matter that was not proven in these proceedings. What was demonstrated was that ICE carried out construction works and activities while in the geological investigation stage. Whether or not the environmental instrument authorized by Nombre139474 for those activities was the appropriate one under the regulations in force does not, in itself, bear upon whether the construction works performed by ICE caused damage or adverse impacts on the environment. Second, what is requested—the comprehensive remediation, remedial, and compensatory-measures plan—is intended to remedy the alleged environmental damage or impacts that, according to the claimants, were caused by the defendants’ acts and omissions in the Reserva Indígena de Térraba. However, although it has been established in these proceedings that ICE performed construction works during the investigation stage corresponding to the Estudios Geológicos en Sitio Térraba, the claimants have not proven that those works caused environmental damage or adverse environmental impacts within the Territorio Indígena de Térraba.
Article 3 of the Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental defines environmental impact (impacto ambiental) as the effect that an activity, work, or project, or any of its actions and components, has on the environment or its constituent elements. It may be positive or negative, direct or indirect, cumulative or non-cumulative, reversible or irreversible, extensive or limited, among other characteristics. It also defines environmental damage (daño ambiental) as an adverse environmental impact that was neither foreseen, controlled, nor planned in an environmental impact assessment (evaluación de impacto ambiental, EIA) process—assessed ex ante—and that is caused directly or indirectly by an activity, work, or project affecting any or all environmental components, for which no prevention, mitigation, or compensation measure was contemplated, and which entails an alteration assessed as having high Environmental Impact Significance (Significancia de Impacto Ambiental, SIA).
The provision distinguishes an adverse impact from environmental damage insofar as an environmental impact is assessed through an ex ante process, allowing prevention, mitigation, and compensation measures to be considered in order to reduce its effects on the environment. In applying the foregoing provision, according to Forestry Engineer Nombre139478, an environmental impact is any alteration caused by human action in the surroundings that modifies the factors comprising the environment. Such impacts are caused by human beings, are potential insofar as they may be projected over time, and may be positive or negative. They arise from a situation that can be planned, are controllable, and, to that extent, corrective measures may be established and compliance with them verified through on-site monitoring (monitoreo in situ) or environmental auditing and follow-up (auditoría y seguimiento ambiental).
According to the witness, the criterion distinguishing environmental impacts from environmental damage is that impacts are situations arising from prior authorization, whereas the latter—environmental damage—consists of adverse impacts that have no prior approval or classification and are not subject to control. Other characteristics of environmental damage are that it is actual and measurable, both before and after; it is adverse and highly significant; its origin is unplanned; and, once it has occurred, restoration, remediation, and compensation are required. In Mr. Nombre139478’s opinion, environmental damage either lacks prior authorization or may result from noncompliance with assumed environmental commitments. In view of the foregoing, this Court deems it appropriate to draw attention to the fact that the conceptual definition established in the cited regulation entails the risk of treating serious harm to the environment and its various components as lawful and legitimate.
Indeed, this Panel of Judges finds it impossible to distinguish between the concepts of an “adverse impact on the environment” and “damage to the environment” solely on the basis of the existence of prior authorization—issued by the competent body, in this case SETENA—for the activity generating the impact and the purported assessment—which must necessarily be based on objective, that is, technical and/or scientific, criteria—of its effects on environmental components. It should be noted that when national legal scholarship and legislation refer generically to damage, they mean the harm, loss, or detriment occurring within the injured party’s legal sphere, an impairment that gives rise to a duty to provide reparation. Thus, in the case of the legally protected interest (bien jurídico) of the “environment,” the definition of which—under the case law developed by the Sala Constitucional, at least in Judgments No. Placa26573 and No. 2003-3656—is not limited to the elements and/or resources of nature (soil, water, air, marine and coastal resources, minerals, forests, biological biodiversity, and landscape), but extends to the concept of “surroundings” (including aspects of urban planning and protection of historical, architectural, and archaeological heritage), the degree of harm to or alteration of its constituent elements (biotic and abiotic) is significant, insofar as it may disrupt the ecological balance and endanger human health and life (the anthropocentric approach to environmental protection).
In this regard, a characteristic feature of damage to the environment is that it results from human conduct, whether by act or omission; accordingly, it could be reasoned that all human conduct on the planet—in any setting—has an impact on the environment, most often with adverse effects. The impact must therefore meet a threshold of material significance, as contemplated in environmental protection regulations—the normative standard—which regulate and permit allowable limits of “pollution” or harm, beyond which conduct becomes illegitimate or unlawful. Consequently, attempting to legitimize adverse environmental impacts merely because they were previously subjected to the control and assessment of the technical authority in the field (SETENA), through the various environmental assessment instruments established in our legal system, poses a serious risk to the effective protection of the environment, which is established as a fundamental right and a public power vested in the entire State apparatus—including the Judiciary through the exercise of its adjudicative function—under the terms imposed by Article 50 of the Constitution.
This is not only inconsistent with the guiding principles of environmental protection, such as the precautionary principle (principio precautorio)—codified in Article 15 of the United Nations Conference on Environment and Development (known as the Declaración de Río) and canon 11 of the Ley de Biodiversidad—but also openly conflicts with the principle of objective environmental protection (principio de la objetivación de la tutela del ambiente), which arises from incorporating the rules of science and technology into the body of legality (bloque de legalidad), pursuant to Articles 16, subsection 1), and 158, subsection 4), of the Ley General de la Administración Pública, thereby plainly distorting the nature of environmental assessment instruments in our country. As relevant to these proceedings, it must be noted that the claimants did not demonstrate the existence of environmental damage in the Territorio Indígena de Térraba originating from the activities authorized in the environmental-viability resolutions issued in expediente No. 366-2005-SETENA.
The only evidence submitted by the claimants in an attempt to substantiate the alleged environmental damage or impacts is the document entitled “Environmental Compliance Assessment of the El Diquís Hydroelectric Project, as Regards Its Geological Studies at the Térraba and Cañablancal Sites, with Emphasis on the Reserva Indígena de Térraba Sector,” signed, among others, by Engineer Nombre39189. In the Court’s view, however, the document is insufficient for those purposes. First, as we noted during the single hearing (audiencia única), because it constituted the opinion of an expert in the field, it was essential that its contents be subjected to adversarial examination (contradictorio). To that end, Mr. Nombre39189 was admitted as an expert witness (testigo perito), so that the defendants could question him regarding the conclusions he reached therein. The Court, however, declared that his testimony could not be taken after the claimant stated that it had been unable to bring him into the proceedings and had not requested that this Court summon him for that purpose.
The Court therefore could not assign credibility to evidence of this nature that had not been contested by the parties. In addition, the document was extensively challenged by other expert witnesses who testified. For example, Engineer Nombre139478 stated that one of the document’s shortcomings was that it proceeded from the premise that no environmental impact assessment had been conducted, when in fact one had been conducted, and that it characterized future effects on the environment—if the dam were built—as environmental damage, without providing evidence capable of establishing that such damage existed. He further stated that the qualitative assessment of the alleged damage used a predictive methodology, which is not the proper method for assessing damage. He added that the identification and quantification of the impacts were based on technical reports that had not been verified in the field.
The witness emphasized that there was no evidence that ICE had failed to comply with the corrective measures and that the alleged damage identified in the document concerned activities or works that were future and uncertain because they pertained not to an investigation stage but to an implementation stage: for example, the creation of the reservoir, which pertains to expediente No. 843-2007-SETENA. Along similar lines, witness Nombre139479 stated that the aforementioned assessment was a theoretical exercise that assumed damage had occurred even though no actions had been carried out. He emphasized that the PHD had not been implemented, making it impossible to speak of damage, and that, with respect to the works that had been performed, ICE had complied with the environmental requirements imposed on it. He concluded that it was impossible to assess future damage from works that had not been performed and that, at most, such matters would constitute environmental risks (riesgos ambientales).
Finally, Víctor Guzmán Arguedas, an official of Nombre139474 who performed the technical closure (cierre técnico) of the PHD with respect to the right bank of the Río General and the Reserva Indígena de Térraba, stated that he had no personal knowledge of the alleged damage listed therein. He further stated that it was unknown which parameters had been used to determine whether pollution or erosion had occurred and that the assessment was not accurate because there were no data available for comparison.
For the Court, those shortcomings made it necessary to subject the evidence (probanza) to adversarial examination (contradictorio), and because this was not possible (since, due to the inattention of the plaintiff that offered it, the testimony of one of the document’s authors was declared unable to be taken), those shortcomings prevent it from being deemed credible. Instead, there is evidence supporting the conclusion that, at the time of the technical closure and archiving of expediente No. 366-2005-SETENA, the competent officials found no environmental damage or adverse environmental impacts (impactos ambientales negativos), nor any nonconformity (inconformidad) in that regard. For example, through official letter ASA- 1290-2011, dated 18 de julio del 2011, Nombre139474 issued a technical report on the environmental monitoring (seguimiento ambiental) of the “Estudios geológicos en el sitio Térraba” project.
As relevant here, it stated that “(...) 4. The Instituto Costarricense de Electricidad (ICE) has complied with the submission of environmental reports and the appointment of the environmental officer (responsable ambiental), as required by resolutions No. Nombre139474 and 2766-2009-SETENA issued by this Secretariat. Conclusions 1. The Instituto Costarricense de Electricidad (ICE) has fulfilled the environmental commitments (compromisos ambientales) undertaken before this Secretariat during the construction stage of the ‘Estudios Geológicos en el Sitio Térraba’ project, expediente Administrativo 366-2005-SETENA, specifically at Sitio Térraba, within Territorio Indígena Térraba. 2. No significant impacts requiring mitigation (mitigación) before the work front at Sitio Térraba may be deemed closed are observed in the project area, on the right bank downstream of Río General Superior, within Territorio Indígena Térraba.
(...)” (folios 595 al 610 del tomo III del expediente administrativo No. 366-2005-SETENA). Subsequently, through official letter SG-ASA-1072-2011-SETENA, dated 18 de julio del 2011, Nombre139474 informed ICE and the environmental officer for that project that, based on the corresponding technical report, no nonconformities had been identified and that the works performed by ICE on the right bank downstream of Río General Superior, within Territorio Indígena de Térraba, were therefore closed (folios 612 y 613 del tomo III del expediente administrativo No. 366-2005-SETENA). This was confirmed by Mr. Víctor Guzmán Arguedas, the Nombre139474 official responsible for the technical closure inspection (visita de cierre técnico) of expediente No. Nombre139483, who stated, in essence, that on that occasion he verified that the activities and works were those authorized by Nombre139474 and that the developer had complied with what had been proposed to SETENA.
It must also be borne in mind that the plaintiffs did not challenge the administrative acts (actos) establishing that there were no material environmental nonconformities. Lastly, we consider that determining whether the alleged damage existed is an issue that could not be deferred to the judgment-enforcement phase (fase de ejecución de sentencia), for two fundamental reasons. First, because the claimants did not request this. At no time did they frame their requested relief (pretensión) so that this issue would be determined in the judgment. They raised that point only at the trial stage, when it was no longer procedurally timely to do so. Second, the Court does not find even any evidence that such damage occurred. The burden of proving (carga de demostrar) that issue rested with the claimants, pursuant to artículos 317 del Código Procesal Civil in relation to ordinal 82 del CPCA. Accordingly, they must bear the procedural consequences of their inattention.
Because the alleged damage or impacts have not been proven, the Court finds no justification for requiring the adoption of a Remedial Plan (Plan Remedial) or compensatory measures (medidas compensatorias). For the reasons stated, the claim must be denied, as it hereby is.
XI.Analysis of the merits of the third claim (pretensión). The plaintiffs request that ICE and the State be ordered to refrain from engaging in any administrative conduct (conducta administrativa) that, by act or omission, could affect environmental interests or the biodiversity located within the project area and could affect the reserve until the corresponding environmental assessment (evaluación ambiental) has been obtained. In this regard, we must state the following. As explained supra, the geological investigation phase at the Térraba site has concluded, and the case file has been archived (No. 366-2005-SETENA), while the case file concerning the environmental assessment of the PHD (No. 843-2007-SETENA) has been stayed. However, the testimony received does not support the conclusion that ICE has lost interest in continuing with the PHD. For example, the testimony of Nombre139477, Nombre139475, and Nombre139478 supports the inference that new geological investigation studies may be required because the possibility has been raised that a third diversion tunnel may need to be built or that the diameter of the two tunnels originally planned may need to be increased.
Indeed, the witness Nombre139478 stated that, once the Indigenous consultation (consulta indígena) had been conducted, unforeseen issues could arise that would make a new investigation necessary, for example, regarding archaeological matters. That same witness recounted the history of case file No. 843-2007-SETENA, which shows that ICE has continued taking action and submitting semiannual reports to SETENA. He also stated that the PHD is a large-scale project whose area of influence includes, among others, the Reserva Indígena de Térraba, and that the activities conducted there—whether the investigations themselves, construction work during the investigation phase, or activities associated with an investment or implementation phase—have a greater or lesser impact on the environment. The Court therefore finds it necessary to establish rules governing the exercise of administrative powers (potestades administrativas) in at least two general and unavoidable respects, so that those powers are exercised in accordance with the legal system.
Thus, for example, before ICE engages in any administrative conduct relating to the investigation, investment, or implementation phases of the PHD in the Indigenous reserve in question, that entity must have the environmental assessment required for each phase of the project, depending on the impact of the activities planned there. It must also conduct the prior, free, and informed Indigenous consultation required by Article 6 of the aforementioned Convention No. 169. It must be borne in mind that, under the case law of the Inter-American Court of Human Rights, the State must ensure the effective participation of the members of the Indigenous community, in accordance with their customs and traditions, in connection with any plan or decision affecting their traditional lands that could entail restrictions on the use and enjoyment of those lands, so as to prevent such restrictions from denying their subsistence as an Indigenous people (Case of Comunidad Indígena Nombre139487 v. Paraguay, judgment of 24 de agosto de 2010, Merits, Reparations and Costs).
The Court has also addressed the point at which such consultation must begin, stating, for example, that “(...) 133. First, the Court has stated that, in guaranteeing the effective participation of the members of the Nombre14492 people in development or investment plans within their territory, the State has a duty to consult actively with that community in accordance with its customs and traditions (supra para. 129). (...) Consultations must be conducted in good faith, through culturally appropriate procedures, and must be aimed at reaching an agreement. Furthermore, the Saramaka people must be consulted, in accordance with their own traditions, during the earliest stages of the development or investment plan (...) Early notice provides time for internal discussion within the communities and for an adequate response to the State. The State must also ensure that the members of the Nombre14492 people are aware of the potential risks, including environmental and health risks (...) Case of the Nombre14492 People v. Suriname.
Judgment of 28 de noviembre de 2007. (Preliminary Objections, Merits, Reparations and Costs).” Finally, regarding the prior nature of the consultation, the Court has held that “(...) 181. In this regard, when examining a complaint alleging Colombia’s failure to comply with ILO Convention No. 169, the ILO Committee of Experts established that the prior-consultation requirement means that consultation must be conducted before adopting a measure or carrying out a project that may affect the communities, including legislative measures, and that the affected communities must be involved in the process as early as possible (...) 184. In this regard, it has not been disputed that the State did not conduct any form of consultation with Nombre41947, through its own institutions and representative bodies, during any phase of the implementation of the oil-exploration activities. In particular, the People were not consulted before heliports were built, trails were cut, explosives were planted, or areas of great value to their culture and worldview were destroyed.
(...)” PUEBLO INDÍGENA KICHWA DE Nombre41947 V. ECUADOR, JUDGMENT OF 27 DE JUNIO DE 2012, (Merits and Reparations). For all the foregoing reasons, the Court is inclined to grant the plaintiffs’ claim and therefore orders Nombre139474 and ICE, until the prior, free, and informed Indigenous consultation with the Indigenous people of Térraba has been conducted and the environmental assessment instrument (instrumento de evaluación ambiental) corresponding to the activities to be performed has been obtained, to refrain from engaging in any administrative conduct relating to either the investigation phase or the investment phase of the PHD that could affect the environment or biodiversity of that Reserva Indígena.
XII.Third-party intervention without independent claims (tercería sin pretensiones propias). Mr. Nombre96534 filed a third-party intervention in which he asserted no claim. His participation was based on the possession he allegedly exercised over property No. 145342-000, recorded in the Puntarenas registry district, which is located within the Reserva Indígena de Térraba and which, he alleged, ICE had leased at the relevant time to gain access to the site where the PHD investigation phase was conducted. Having analyzed the grounds on which the third-party intervenor based his application, the Court finds that it must be summarily dismissed. Strictly speaking, his participation may have had some relevance to the complaint originally filed by the ADI, which sought the invalidation of the contract entered into between ICE and Nombre136636. However, no connection can be discerned between his interest and the claims in the third-party intervention and its amendment, since none of the claims asserted and granted affects him or has any direct bearing on him.
Accordingly, with respect to his participation, we must declare that his current interest has subsequently ceased to exist and summarily dismiss his application. The foregoing makes it unnecessary to rule on the defenses raised by counsel for the third-party intervenor. Costs shall be governed by the ruling set forth infra. Given the manner in which this matter is resolved, it bears no relation to the subject matter of this litigation. The third-party intervention must therefore be dismissed.
XIII.Concluding remarks. There can be no doubt that the decision whether to implement a hydroelectric project such as the PHD lies with the active Administration (Administración activa). The role of this Court is limited solely to reviewing the legality of the actions taken during the various phases of the project’s implementation. Within that framework, the Court must state the following. The testimony received supports the inference that the PHD is necessary for the country to address the energy crisis that could arise in future years. It also establishes that the conditions required to develop it exist. The public interest in developing hydroelectric projects of this kind is likewise undeniable, but all such development must comply with the legal system. It is precisely in that respect that deficiencies have been identified that could frustrate a project of such magnitude and importance. By way of example, an investigation phase was conducted that entailed a substantial investment of public resources.
The evidence considered showed that, ever since the INGETEC reports were submitted, ICE knew that it was required to conduct the prior, free, and informed Indigenous consultation mandated by Article 6 of the aforementioned Convention 169 with the Indigenous peoples who would be affected by the development and implementation of the PHD. In any event, because this requirement derives from a legal rule ranking above statutes, ICE’s legal officers should have been aware of it. There is also a well-defined and consistent line of case law from the Inter-American Court of Human Rights holding that such consultation must be conducted beginning in the planning and investigation phases of projects, rather than once implementation is already underway. Despite this, ICE failed to ensure compliance with that indispensable condition for safeguarding the rights of the Indigenous populations involved. It conducted geological investigation activities and work, as well as related construction work, without satisfying that requirement and without obtaining the permits, authorizations, and concessions required by the legal system for each of the activities performed during that investigation phase.
If the project is resumed, it must comply with the legal system. To ensure that neither the investment of resources already made nor the experience gained from the investigation already conducted is wasted, the present circumstances require both the State and ICE to examine their actions, renew their efforts, and assess whether, in view of the public interest—understood as the expression of the coinciding individual interests of the governed (article 113 of the LGAP)—implementation of the PHD should continue. If the answer is affirmative, there can be no doubt that this must occur with absolute respect for the legal system and the rights of the Indigenous populations that may be affected by the geological investigation, investment, development, and implementation of the PHD. This review and decision fall exclusively and urgently to ICE and the State, each within the scope of its powers; but, we reiterate, the decision must be made in strict compliance with the body of applicable law (bloque de legalidad) and must always be directed toward satisfying the interests of the community.
XIV.Regarding the defenses (excepciones). ICE did not raise any defense on the merits (excepción de fondo) in the third-party intervention (tercería), but in the supplemental pleading it asserted lack of legal entitlement (falta de derecho). Bearing in mind that standing (legitimación) and interest (interés) are substantive prerequisites for the judgment, which the judges may even examine sua sponte, we shall begin by addressing both requirements. The Court finds that the women identified as Nombre139472 have sufficient standing to bring this action, pursuant to Article 10 of the CPCA. On the one hand, they claim to be Indigenous persons residing in the Reserva Indígena de Térraba, and, on the other, their action is legitimized by their pursuit of environmental protection, there being a popular action (acción popular) for the protection of that right under Article 50 of the Constitución Política.
ICE, in turn, has the necessary standing as a defendant (legitimación pasiva) because, pursuant to Article 12 of the CPCA, it is one of the entities accused of a series of omissions specifically related to environmental harm in the Reserva Indígena de Térraba arising from the investigation and implementation of the PHD, and against which a series of claims for relief is sought. Likewise, it is evident that the matter presents an interest because environmental harm is alleged. The defense of lack of legal entitlement must be partially sustained, solely insofar as it is not appropriate to order an environmental assessment (evaluación ambiental) of the PHD either immediately or exclusively within the Indigenous territory of Térraba, nor is it appropriate to order one by means of a Strategic Environmental Assessment (Evaluación Ambiental Estratégica). It is also sustained insofar as it is improper and unnecessary to order the adoption of a Remedial Plan (Plan Remedial) or Compensatory Measures (Medidas Compensatorias), because the existence of environmental impacts or damage in the Reserva Indígena de Térraba arising from ICE’s actions concerning the PHD has not been demonstrated.
It is otherwise rejected, because this Court finds that ICE must be ordered, if it decides in the short, medium, or long term to reopen or resume the geological investigation phase at Sitio Térraba prior to implementing the PHD, to initiate the corresponding environmental-assessment procedure under the regulations in force when its application is filed, and that Nombre139474 must determine the environmental-assessment instrument that is to be required, taking into account the parameters established by the legal system for that classification, as well as the environmental significance of the potentially harmful works or activities to be carried out. ICE must also obtain from the competent entities and bodies the authorizations or permits required by the legal system for activities such as tree cutting (corta de árboles), earthworks (movimiento de tierras), excavations, and the construction of works in a river channel, such as dikes or gabion walls.
We also find it necessary to establish limits on ICE’s exercise of administrative authority and to order it, until the prior, free, and informed Indigenous consultation (consulta indígena previa, libre e informada) with the Indigenous people of Térraba has been conducted and the appropriate environmental-assessment instrument for the activities to be undertaken has been obtained, to refrain from engaging in any administrative conduct, whether related to the investigation phase or the investment phase of the PHD, that could affect the environment or biodiversity of that Reserva Indígena. The State, in turn, raised defenses of lack of standing as a claimant (falta de legitimación activa), which must be rejected for the same reasons stated supra regarding ICE; lack of standing as a defendant (falta de legitimación pasiva), which must likewise be rejected because omissions are alleged against the body with jurisdiction over environmental assessments and an order requiring the State to undertake specific conduct and imposing specific relief is sought; and lack of interest (falta de interés), which we also reject for the reasons stated supra.
The defense of lack of legal entitlement is sustained, except insofar as Nombre139474 is ordered, should ICE decide in the short, medium, or long term to resume the PHD investigation phase, to determine the environmental-assessment instrument that ICE must be required to obtain, taking into account the parameters established by the legal system for that classification, as well as the environmental significance of the potentially harmful works or activities to be carried out; and insofar as, until the prior, free, and informed Indigenous consultation with the Indigenous people of Térraba has been conducted and the appropriate environmental-assessment instrument for the activities to be undertaken has been obtained, it must refrain from engaging in any administrative conduct, whether related to the investigation phase or the investment phase of the PHD, that could affect the environment or biodiversity of that Reserva Indígena. Consequently, the complaint must be partially granted on the terms already stated.
XV.Regarding costs (costas). Pursuant to Article 193 of the CPCA, procedural costs and attorney’s fees (costas procesales y personales) constitute a burden imposed upon the losing party by virtue of having lost. Waiver of such an award is permissible only when, in the Court’s judgment, there was sufficient cause to litigate or when the judgment is rendered based on evidence whose existence was unknown to the opposing party. The same waiver applies when the case involves the so-called excessive claim (plus petitio), that is, pursuant to Article 194.1 of the CPCA, when the difference between the relief sought and that obtained exceeds 15%, unless the bases of the complaint are provisional or their determination depends on judicial discretion or expert opinion. In this case, the Court finds that these proceedings must be concluded without a special award of costs for several reasons. First, because the parties prevailed in part and lost in part; and also in view of the technical and legal complexity of the matter.
These proceedings involved a significant number of hearings and evidence that had to be presented and evaluated, and the issues involved required extensive analysis. Additionally, we find that the positions advanced by each party involved—both the claimants and the defendants, as well as the third party that participated without asserting claims of its own—reflect good faith and sufficient cause to defend their respective positions. Consequently, for the reasons stated, this Chamber finds that this matter should be resolved without a special award of costs, as is hereby done.
POR TANTO
On its own motion, the Court declares that the third-party intervention without independent claims filed by Nombre96534 lacks a current interest, and that filing is summarily rejected. The defenses of lack of standing as a claimant and as a defendant, as well as lack of current interest, raised by the Instituto Costarricense de Electricidad and the State are rejected. The defense of lack of legal entitlement raised by both defendants is sustained solely insofar as it is not appropriate to order an immediate environmental assessment of the Proyecto Hidroeléctrico El Diquís, or one exclusively covering the Indigenous territory of Térraba, nor is it appropriate to order such an assessment by means of a Strategic Environmental Assessment. It is also sustained insofar as it is improper and unnecessary to order the adoption of a Remedial Plan or Compensatory Measures, because the existence of environmental damage in the Reserva Indígena de Térraba arising from actions by the Instituto Costarricense de Electricidad or the State concerning the Proyecto Hidroeléctrico El Diquís has not been demonstrated. It is otherwise rejected. Consequently, the complaint is partially granted on the following terms, and is deemed denied insofar as relief is not expressly granted:

Proceso declarado de trámite preferente formulado por las señoras Nombre139473 y Nombre139472, ambas de apellidos Nombre139472 , la primera casada una vez y portadora de la cédula de identidad CED110016, la segunda portadora de la cédula de identidad CED110017, ambas indígenas y vecinas de Bijagual de Buenos Aires, Puntarenas, representadas por su apoderado especial judicial Walter Brenes Soto, soltero, abogado, cédula de identidad CED32840 y vecino de Alajuela, contra el INSTITUTO COSTARRICENSE DE ELECTRICIDAD (en adelante ICE) representado por sus apoderados especiales judiciales Nombre82313 , soltera, abogada, cédula de identidad CED30335, vecina de Heredia y Nombre82381 , casado, abogado, cédula de identidad CED84178, vecino de San José, y el ESTADO representado por el procurador Alonso Arnesto Moya, casado, abogado, cédula de identidad CED683 y vecino de San José. En condición de tercero interesado sin pretensiones propias participa el señor Nombre96534 , divorciado dos veces, agricultor, cédula de identidad CED74010 y vecino de Dirección16763 , Puntarenas, representado por su apoderado especial judicial Guido Humberto Rojas Sánchez, abogado, cédula de identidad CED90961 y vecino de Qutirrisí.
RESULTANDO
CONSIDERANDO
I.Precisión necesaria. Para una mejor compresión de lo que se resolverá, el Tribunal estima necesario señalar lo siguiente. A modo de antecedente y tal cual se anticipó supra, este proceso fue inicialmente interpuesto por la ADI de Térraba cuestionando, en lo fundamental, la validez de una serie de conductas formales y materiales del ICE y del Estado relacionadas con el PHD que, estimaban, se llevaron a cabo dentro de esa Reserva Indígena de manera ilegítima y lesionaron la situación jurídica de ese pueblo. En el iter procesal, las hermanas Nombre139472 presentaron una tercería con pretensiones propias que incluían, en su momento, declaraciones de nulidad de una serie de conductas formales dictadas por la Nombre139474 con ocasión del procedimiento ambiental seguido por el ICE para obtener la correspondiente licencia de viabilidad ambiental para la ejecución del PHD. Luego, ellas desisten de las pretensiones anulatorias referidas, limitando sus pedimentos a los que se establecieron en el Resultando sétimo de esta sentencia.
Posteriormente, en la sentencia No. 127-15-VI citada, se acogió el desistimiento que formulara el presidente de la ADI y se dio por terminado este proceso respecto de la demanda que esa entidad corporativa formuló en contra del ICE, el Estado y Nombre136636 , sin especial condenatoria en costas. Asimismo, dado el carácter accesorio que ostentaba la coadyuvancia activa que formuló la Comisión Nacional de Asuntos Indígenas en favor de la Asociación y en virtud del desistimiento acogido, se tuvo por finalizada ésta. Dado lo acontecido y considerando que las pretensiones formuladas por las señoras Nombre139472 eran propias e independientes de las que ejerció, hasta ese momento, la parte actora, se ordenó la continuación del proceso respecto de los pedimentos que formularon. Así las cosas, tal y como se explicó en resoluciones dictadas con posterioridad a que se acogió el desistimiento indicado y durante la segunda fase de la audiencia única celebrada en el mes de octubre de este año, si bien las señoras Nombre139472 habían venido participando en esta causa como terceras con pretensiones propias, lo cierto es que en virtud del desistimiento de la demanda que presentó la parte actora y que fue acogido por este Tribunal, es necesario precisar su situación procesal ya que, a la fecha, el objeto de esta causa abarca, únicamente, las pretensiones que ellas dirimen.
Así las cosas, las señoras Nombre139472 se constituyen en las únicas que formulan esta acción y sus pretensiones serán las que se resolverán en esta litis. Tomando en cuenta lo anterior y la forma en que se fijaron las pretensiones que aquí se van a resolver es necesario, desde ya, excluir del análisis de legalidad que se efectuará cualquier reclamo o cuestionamiento referido a los alcances de la consulta establecida en el artículo 6 del convenio No. 169 "Sobre Pueblos Indígenas y Tribales en Países Independientes", aprobado en nuestro país mediante Ley No. 7316, de 3 de noviembre de 1992 que señala, en lo que interesa que "(...) 1. Al aplicar las disposiciones del presente Convenio, los gobiernos deberán: a) Consultar a los pueblos interesados, mediante procedimientos apropiados y en particular a través de sus instituciones representativas, cada vez que se prevean medidas legislativas o administrativas susceptibles de afectarles directamente (...)".
Pero, además, debe reiterarse que en esta causa no se está formulando ninguna pretensión anulatoria que habilite a este Tribunal a ejercer un control de legalidad de lo actuado (formal y materialmente) hasta el momento por los entes públicos demandados. Como se verá infra, esta precisión es fundamental a efectos de determinar el alcance del examen de legalidad que se efectuará en relación con lo pedido.
II.Hechos probados. De importancia para lo que se resuelve se tiene por demostrado lo siguiente:

Exploración geológica en el sitio Térraba: Se proyecta construir ahí una minicentral de producción de energía eléctrica (28MW) donde se requiere una investigación por medio de una perforación de 75.7 mm del diámetro y 50 m de profundidad con el fin de determinar las características geomecánicas del sitio de fundación de la estructura. 2.1 Perforación PHED-49-MC 2.2 Perforaciones del plinto: (1) PHED-50-PL. (2) PHED-51-PL, (3) PHED-52-PL, (4) PHED-53-PL, (5) PHED-54-PL, (6) PHED-55-PL, (7) PHED-56-PL, (8) PHED-57-PL, (9) PHED-58-PL, (10) PHED-59-PL El plinto constituye la base donde se anclaría la estructura de la presa (la cara que sostiene el agua) con el macizo rocoso donde la estructura se fundaría, por lo que se debe hacer investigación geológica en los sitios de fundación.
Consiste en diez perforaciones de 75.7 mm y 12º m de profundidad. (…) 2.3 Perforación PHED-60-PZ: Para la construcción de la presa es necesario construir dos túneles de desvío del río General. Se requiere investigación geológica para determinar las características del material presente en este sitio a través de una perforación de 100 m de profundidad y 75.7 mm de diámetro. 2.4 Geofísica: en el plinto, la minicentral y su conducción: El diseño de la estructura del plinto requiere de información técnica respaldada por una amplia investigación geológica e implica sondeos geofísicos en 1500 m sobre el eje del plinto para el alineamiento de la fundación. La ejecución de los ensayos sería sobre un carril que no supera el 05 m de ancho y una longitud de 1500 m. Se utilizarán accesos ya existentes para el traslado del equipo y personal. 2.5 Ensayos de anclaje en el vertedero: El vertedero de excedentes requiere de anclajes para la losa de concreto.
Se requiere de una serie de perforaciones cortas, para diez pruebas de anclaje, entre los 3 y los 11 m de profundidad 5 cm de diámetro. 2.6 Galería de exploración geológica de los túneles de desvío: Se refiere a los túneles de desvío del río, requeridos para la protección del área de construcción de la presa, y consistirán en dos excavaciones subterráneas sobre la cota 141 m.s.n.m. Las características de los túneles y sus dimensiones fueron modificadas en la propuesta de la Adenda a la solicitud de ampliación de la viabilidad ambiental (ver punto 1). 2.6.1 Dique de protección con muro de gaviones: Con el fin de brindar una terraza de trabajo segura y dar seguridad al personal operativo en la época de lluvias fuertes, ayudando a la contención del agua del río en caso de crecientes. Tiene 6 m de altura, 110 m de longitud y el ancho varía según la altura, entre tres y un metro de ancho, con unos 1540 m3 de volumen de piedra, 2.6.2 Terraza de maniobras para la excavación de la ventana y la galería: Habilitar un área de 2152 m2 de espacio para colocar la maquinaria, el equipo, las herramientas y los suministros, que permitan facilitar la apertura del portal de la galería y la eventual excavación.
Además, debe ubicar las instalaciones necesarias para atender al personal: comedor, dispensario, bodegas, oficinas, etc. 2.6.3 Rehabilitación de camino interno existente en la finca: Dadas las características del camino y las dimensiones de los equipos de la obra, se hace necesario mejorarlo con el movimiento de tierra de 12.398 m3 de que se dispondría en las escombreras y en la terraza de trabajo. Se ampliará el camino a una superficie de rodamiento de 5 m. 2.6.4 Habilitación y manejo de escombreras: Los sitios de escombreras se ubican a 1.5 km de la terraza de la ventana de acceso a la galería. Son áreas dedicadas a la ganadería y con poca cobertura vegetal. Tienen una capacidad de almacenamiento de 51039 m3. Existe una trocha de acceso al sitio de escombreras que debe mejorarse. No hay evidencia de rasgos arqueológicos y la presencia de animales silvestres es escaza (sic). 2.6.5. Rehabilitación de acceso a las escombreras: El acceso se realizará por el camino público existente, que requiere mejorar la superficie de rodamiento. 2.6.6 Instalación de una acometida eléctrica que abastezca la obra: Es necesario la construcción de aproximadamente 819 m de línea de distribución con una capacidad de 3450 voltios para abastecer los equipos de excavación de la galería exploratoria. 2.6.7 Construcción de un plantel tipo bodega-patio de materiales: En la terraza del portal de (sic) construirán los edificios necesarios par (sic) las obras de la galería: un consultorio médico, comedor, servicios sanitarios, bodegas, plantas y compresores., transformadores, fogón-cemento-agregados y oficinas.
(886 m2 de construcción). Es necesario habilitar otras zonas de patio y almacén de materiales: area (sic) techada para cemento, area (sic) para agregados, almacén de materiales y patio de materiales. 2.6.8 Corta de árboles en un área de potrero: Previo a la corta de árboles se tramitará los permisos ante el MINAET. Según los inventarios forestales hay en los sitios seleccionados potreros y vegetación riparia (se ubicaron 21 árboles con diámetro mayor a los 15 cm) y sobre los sitios de escombreras no hay árboles mayores a los 15 cm de diámetro. (….) 2.6.9 Trincheras para investigación geológica del camino Térraba-Águila: Es necesario la construcción de caminos adecuados; el camino desde la entrada de Térraba hasta la comunidad El Águila que lleva a la futura boca toma, debe ser habilitado como ruta nacional y comunicará a la comunidad de Pacuar con Nombre265 hasta Térraba de Buenos Aires.
Para este tramo del camino se han ubicado ocho puntos de investigación geológicas a través de ocho trincheras (…) b. Mediante nota PHED-78100-0384-2009 del 9 de setiembre del 2009 del Ing. Franklin Ávila Pérez, Director y Apoderado por Sustitución de Poder del Desarrollador Instituto Costarricense de Electricidad y que forma parte del documento Adenda a la solicitud de Ampliación de Viabilidad (Licencia) Ambiental del Proyecto: Estudios Geológicos en los sitios Térraba y Cañablancal, Expediente No. 366-2005-SETENA, donde se plantea el asunto: “Justificación técnica sobre los recientes cambios en las galerías pedidas en la solicitud de ampliación y ajuste de la licencia ambiental vigentes, Expediente Administrativo No. Nombre139483 denominado: Estudios geológicos de los Sitios Térraba y Cañablancal”, con el fin de plantear en base a dos informes técnicos cambios al contenido de la propuesta de solicitud de ampliación de la viabilidad ambiental planteada el pasado 16 de julio del 2009, donde se solicita: 1.
Modificación al tamaño de la galería exploratoria de los túneles de desvío. 1.1 Antecedentes: La empresa consultora INGETEC presentó el pasado 30 de julio el Informe Código PHDQ-HDR-002-007 con el Diseño Básico de las Obras de Desvío y la Descarga del Fondo, que presentan varias modificaciones del (sic) importancia a la (sic) obras de desvió (sic) y un (sic) variación en la longitud y sección de la excavación de los futuros túneles de desvió (sic). 1.2 Justificación de incremento en el tamaño de los túneles de desvío: el objetivo principal del (sic) desviar el agua del río por los túneles es secar el área de trabajo para la cimentación y construcción de la presa. El tamaño del (sic) los túneles de desvío está determinado por el volumen de agua a transportar y por la altura de la ataguía. Se concluyó que la ataguía tendría una altura del (sic) 30 m (con un volumen de concreto de 100.000 m3) y los túneles de desvió (sic) tendrían un diámetro de excavación de 175 m2; la longitud de los túneles de desvió (sic) se redujo a 675 m y 789 m. 1.3 Modificación en el diámetro de excavación de la ventana de acceso: inicialmente se planteó que para acceder a la galería de los túneles de desvió (sic), sería necesaria una ventana de acceso de 130 m de longitud con un diámetro de excavación de 4.8 m y un área de excavación de 21.1 m2.
Con base en los estudios indicados, las dimensiones de la ventana de acceso para su funcionamiento óptimo serían de 6 m de altura y 6 m de ancho del piso para un área de excavación de 32.14 m 2. Con el nuevo diseño de los túneles de desvió (sic), del (sic) diámetro de excavación sería de 14 m de (sic) y el ancho del piso de 14 m, con un área de excavación de 175 m2. 1.4 Modificación en el diámetro de excavación de la galería de investigación: originalmente tendría una sección de excavación de 27.5 m2, correspondiente a la sección mínima constructiva para que ingresen los equipos especiales de excavación. Debido a una razón de seguridad operativa se propone usar arcos de acero como refuerzo temporal y de acuerdo con el diseño básico presentado por INGETEC, la dimensión de los túneles de desvió (sic) presentaría un diámetro de excavación de 14 m y un ancho de piso de 14 m, que implica un área de excavación de 175 m2.
La nueva galería de investigación propuesta tendría una sección de excavación de 42.73 m2 con una altura del (sic) 4.5 m y un ancho de piso de 134.08 m. 1.5 Análisis de los volúmenes de excavación: El volumen de material suelto producto de las excavaciones a colocar en las escombreras producto de la ventana de acceso planteada originalmente sería de 3703 m3 y el volumen de la galería de investigación planteada sería de 33413 m3 para un total de 37106 m3. Con las modificaciones, el volumen de la ventana de acceso propuesta en la actualidad sería de 5641 m3 y el volumen de la galería de investigación actual sería de 38938 m3 para un total de 44578 m3, sin embargo, las escombreras propuestas tienen una capacidad de 51039 m3 y no sería necesario habilitar otro sitio para escombreras. (…) Por lo que se le otorga la VIABILIDAD AMBIENTAL al proyecto, quedando abierta la etapa de Gestión Ambiental. (…)” (folios 522 al 534 del tomo II del expediente administrativo No. 366-2005-SETENA).
III.Hechos no probados. De relevancia para el presente proceso y por no haber prueba en el expediente que lo sustente, se tiene por indemostrado lo siguiente: 1) Que las labores o actividades de la fase de investigación o las obras constructivas asociadas a ésta, ejecutadas por el ICE dentro del territorio indígena de Térraba con ocasión del expediente No. Nombre139483 hubiera causado daños ambientales. 2) Que el ICE hubiese gestionado ante los entes u órganos públicos competentes, las autorizaciones o permisos requeridos para la corta de árboles, los movimientos de tierra, excavaciones y para la construcción del muro de gaviones en la margen derecha del cauce derecho del Río General. 3) Que el ICE hubiese ejecutado actividades o labores propias de la fase de inversión o ejecución del PHD en el territorio indígena de Térraba. 4) Que de previo a la modificación autorizada mediante resolución No. 2766-2009-SETENA, la Nombre139474 hubiese realizado una visita al área del proyecto "Estudios Geológicos Sitio Térraba".
IV.Objeto del proceso. En esta causa, las accionantes formulan, en lo medular, una serie de pretensiones de condena para que:
V.Sobre el caso concreto. La primera pretensión que formulan las accionantes es para que se ordene al ICE cumplir con el deber de tramitar de inmediato una completa e integral evaluación de impacto ambiental para la zona de la Reserva Indígena de Térraba, todo bajo la supervisión y fiscalización de la SETENA, la cual incluso debe realizarse mediante la utilización del instrumento ambiental denominado Evaluación Ambiental Estratégica (en adelante EAE), o en su lugar mediante la tramitación de un Estudio de Impacto Ambiental (en adelante EsIA) para la etapa de inversión (constructiva y operativa) en esa zona del PHD. Para definir la procedencia o no de este extremo petitorio es necesario analizar varios aspectos que tienen que ver con el momento a partir de cual el ICE debe de cumplir con el requisito de la evaluación del impacto ambiental de las actividades u obras que, para la investigación y el desarrollo del PHD, lleve a cabo dentro del territorio indígena de Térraba y el tipo de instrumento que, para tales efectos, debe solicitar.
Este último punto debe vincularse, además, con la naturaleza de las obras u actividades que se ejecuten. En este sentido y en relación tanto con el objeto de esta litis como con los hechos que se han tenido por acreditados, conviene iniciar recordando que con ocasión del PHD, el ICE gestionó ante la Nombre139474 dos procedimientos tendentes a obtener la viabilidad ambiental para diferentes actividades impactantes que ejecutaría. El primero de ellos lo fue bajo el expediente No. Nombre139483 para el proyecto "Estudios geológicos en el Sitio Térraba". En lo medular, las actividades impactantes que se solicitaba evaluar estaban relacionadas con la investigación o exploración geológica. Conforme al testimonio del geólogo Nombre139476 , la finalidad de las investigaciones geológicas y geotécnicas es, en lo fundamental, conocer como se va comportar el medio físico, en este caso el macizo rocoso, en relación con la obra que se va a ejecutar, los parámetros que van a permitir definir cómo construir la obra, por ejemplo, la resistencia, la deformabilidad del medio, así como los eventuales riegos que se puede enfrentar en la ejecución del proyecto, por ejemplo, las presiones de agua, temperatura, presiones de gases o la presencia de roca explosiva y fluyente.
Señaló que este tipo de investigaciones puede efectuarse a través de perforaciones, la excavación de pozos o galerías y que para definir el alcance y la naturaleza de este tipo de investigaciones se ponderan criterios como la eficiencia, la tecnología, la oportunidad, la seguridad y la incertidumbre o riesgos geológicos. La información que se obtenga de la investigación resulta fundamental para otras etapas del proyecto como el diseño de obra, el proceso constructivo y el plan de manejo de riesgos. Pues bien, se tuvo por acreditado que mediante la resolución No. Nombre139474 citada la Nombre139474 aprobó la DJCA sometida a evaluación por el ICE dentro del expediente No. Nombre139483 citado y le comunicó que se había cumplido con el proceso de evaluación ambiental para el proyecto "Estudios Geológicos en el Sitio Térraba", el cual, en lo que interesa, describió de la siguiente manera: "(...) Perforaciones de investigación desde el punto de vista geológico, hidrogeológico, y geofísico de los sitios indicados para la fase de prefactibilidad de un futuro proyecto hidroeléctrico.
Los trabajos a realizar son la perforación con recuperación de núcleo en los dos sitios con mayor detalle o cantidad de perforaciones en el sitio denominado Térraba, en las márgenes del Río General, completándose con la perforación de galerías en cada margen (...) Los trabajos a realizar son la perforación con recuperación de núcleo en los dos sitios, con mayor detalle o cantidad de perforaciones en el sitio denominado Térraba, en las márgenes del Río General, (...)" (los resaltados no corresponden al original); otorgándole la viabilidad ambiental respectiva y dejando abierta la etapa de gestión ambiental (folios 55 al 84 del tomo I del expediente administrativo Nombre139474 No. 366-2005). Posteriormente, en julio del 2009, el ICE solicitó a la Nombre139474 una ampliación de la viabilidad ambiental otorgada en el referido proyecto, ya que debían ampliar la obtención de datos geológicos relacionados con los sitios de obras del referido proyecto a efectos de recabar información fundamental para los diseños ingenieriles y que no había sido posible obtener con las exploraciones efectuadas hasta el momento.
En lo que interesa, manifestó que dentro de las actividades adicionales que se solicitaban estaban "(...) 1. Perforaciones varias de exploración geológica de los sitios de Cañablancal, Térraba (contemplando ambas márgenes del río General y Ceibo. 2. Habilitación de una galería de exploración geológica en el sitio Térraba (en la margen derecha del Río General) para los futuros túneles de desvío. (...)". Además, manifestó que las actividades adicionales de investigación que se planteaban y sus impactos ambientales no diferían en nada de lo planteado originalmente en ese expediente. Adjuntó a la solicitud una declaración jurada de compromisos ambientales y una serie de anexos que detallaban las obras solicitadas (folios 222 al 495 tomos I y II del expediente administrativo Nombre139474 No. 366-2007) (el resaltado no corresponde al origina). El 28 de setiembre de ese mismo año, el ICE presentó a la Nombre139474 una adenda a la solicitud de ampliación de viabilidad ambiental del expediente No. 366-2005-SETENA, justificándola técnicamente en los recientes cambios en las galerías pedidas en las solicitud de ampliación, adjuntando dos informes técnicos suscritos por el Ingeniero Nombre139475 , Coordinador de Obras Subterráneas del PHD (folios 12 al 27 de la carpeta administrativa correspondiente a la Adenda planteada en el expediente administrativo No. 366-2005-SETENA).
Y, en definitiva, mediante la resolución No. 2766-2009-SETENA citada, la Nombre139474 aprobó la nueva DJCA sometida a evaluación por el ICE con base en la solicitud de ampliación de viabilidad ambiental y a la adenda referidas, dentro del expediente administrativo No. 366-2005-SETENA. En la parte dispositiva de esa resolución se describen y autorizan una serie de actividades adicionales relacionadas con la investigación geológica y, según ampliaremos en un Considerando posterior, algunas obras constructivas asociadas a ésta, en la margen derecha del Río General y en la Reserva Indígena de Térraba. Entre ellas destacan perforaciones, investigación geológica, investigación y excavación en el eje de uno de los futuros túneles de desvío, construcción de muro de gaviones, excavación del portal, la ventana de acceso, la intersección y la galería de investigación e instalaciones provisionales (como comedor, dispensario, bodegas, oficinas), las que fueron efectuadas durante el año 2010 y hasta mayo del 2011 ( folios 522 al 534 del tomo II del expediente administrativo No. 366-2005-SETENA, cuaderno de bitácora, reconocimiento judicial, declaración de Nombre139475 ).
Finalmente, cabe agregar que, por orden de la dirección del proyecto, el 3 de mayo del 2011 se comenzó con las labores de cierre técnico de la galería de exploración del margen derecho del Río General (folio 43 35 42 del expediente administrativo rotulado "Bitácora"). Luego, el 23 de junio del 2011, el señor Víctor Mauricio Guzmán Arguedas, funcionario de la Nombre139474 se apersonó y realizó una inspección en lugar donde se llevaba a cabo el proyecto "Estudios geológicos en el sitio Térraba", para realizar el cierre oficial del Sitio Galería de Investigación y mediante oficio SG-ASA-1072-2011-SETENA, de 18 de julio del 2011, la Nombre139474 comunicó al ICE y a la responsable ambiental del proyecto que con base en el informe técnico respectivo, no se determinaron no conformidades, quedando de esta forma clausuradas las obras realizadas por el ICE en la margen derecha aguas abajo del Río General Superior dentro del Territorio Indígena de Térraba.
Además indicó que los demás frentes de trabajo, así como el sector o margen izquierdo aguas abajo del Río General Superior fuera del Territorio Indígena de Térraba, se encontraban activos para esa Secretaria (el resaltado no corresponde al original) (folios 612 y 613 del tomo III del expediente administrativo No. 366-2005-SETENA). Por otra parte, en julio del año 2007, el ICE también gestionó el procedimiento de evaluación ambiental para el proyecto denominado Proyecto Hidroeléctrico El Diquís, a través de un formulario D1, a efectos de que la Nombre139474 brindara los términos de referencia requeridos para el estudio de impacto ambiental de una obra de esa magnitud. A esa solicitud se le asignó el número de expediente 843-2007-SETENA (folios 1 al 25 del tomo I del expediente administrativo Nombre139474 No. 843-2007). Mediante la resolución No. 2174-2007-SETENA ya citada la Comisión Plenaria de la Nombre139474 aprobó la propuesta de los términos de referencia presentada por el ICE y le otorgó un plazo máximo de dos años para la presentación de un EsIA para el PHD (folios 36 al 48 del tomo I del expediente administrativo Nombre139474 No. 843-2007).
Luego, en la resolución No. 1526-2009-SETENA citada, se aprobó la propuesta de términos de referencia presentada por el ICE, con ocasión de modificaciones solicitadas por el ICE en marzo del 2009 relacionadas con observaciones del Banco Interamericano de Desarrollo (folios 122 a 125 del tomo I del expediente administrativo Nombre139474 No. 843-2007 y el expediente administrativo rotulado Anexo Términos de Referencia, testimonio de Nombre139478 ). El plazo de dos años que otorgara la Nombre139474 al ICE para la presentación del EsIA fue prorrogado, en diciembre del 2009, por un año (folios 141 a 144 del tomo I del expediente administrativo Nombre139474 No. 843-2007). Sin embargo, en diciembre del 2010 el ICE solicitó a la Nombre139474 una segunda prórroga para la presentación del referido estudio y en mayo del 2011 le pidió la suspensión de ese plazo en virtud de la imposibilidad de efectuar la consulta a las poblaciones indígenas que se verían afectadas con el PHD y la exigencia de que este aspecto esté comprendido en el estudio en cuestión (testimonio de Nombre139478 ).
En definitiva, mediante resolución No. 2278-2012-SETENA, de las 8 horas del 5 de setiembre del 2012, la Comisión Plenaria de la Nombre139474 acordó suspender el plazo para que el ICE entregara el EsIA completo en el expediente del PHD, imponiéndole el deber de presentar informes semestrales a la Nombre139474 en los cuales indique, con apropiado detalle, el estado de resolución de las condiciones sobre las que se ha sustentado la imposibilidad de aporte del referido estudio. En la parte considerativa de esa resolución se señaló que la solicitud de suspensión de ese plazo se justificó en que para cumplir a cabalidad con el Convenio 169 de la Organización Internacional del Trabajo era necesario resolver una serie de requerimientos indispensables para poder desarrollar el proceso participativo y concertado de consulta a los pueblos indígenas directamente afectados por el proyecto. Aunado a lo anterior, también se consideró que la Sala Constitucional, mediante el Voto No. 2975-2011, de 23 de setiembre del 2011, ordenó al ICE realizar la consulta previa a las comunidades indígenas donde se llevará a cabo el proyecto, lo que implicaba que existía una imposibilidad del ICE para presentar el estudio de impacto ambiental hasta tanto no se concrete esa consulta (folios 536 al 545 del tomo III del expediente administrativo Nombre139474 No. 843-2007).
A la fecha, el expediente No. 843-2007-SETENA se mantiene suspendido y la consulta indígena a los pueblos que se verán afectados por el PHD no se ha efectuado (testimonio de Nombre139478 ). Del recuento anterior, podemos concluir que el proyecto al cual se le otorgó viabilidad ambiental en el expediente No. Nombre139483 (para la investigación geológica en el sitio Térraba) ya se cerró y fue clausurado, al menos, en lo que refiere a la investigación geológica a efectuar en el territorio indígena de Térraba. Aunado a lo anterior, el procedimiento de evaluación ambiental relativo al PHD que se tramita bajo el expediente No. 843- 2007-SETENA, se encuentra suspendido desde el setiembre del 2012 en virtud de que es imperativo que se realice la consulta a las poblaciones indígenas que se verían afectadas con el desarrollo y ejecución del proyecto (entre ellas, la de Térraba) y ese aspecto constituye un componente del EsIA que el ICE debe presentar a la SETENA.
Como la referida consulta no se ha efectuado, la suspensión se mantiene al día de hoy. En virtud de lo expuesto, estimamos que resulta material y jurídicamente inviable, ordenar al ICE cumplir, de inmediato, con el deber de completar una completa e integral evaluación de impacto ambiental para la zona de la Reserva Indígena de Térraba. No es posible completar esa evaluación en un expediente de investigación geológica que ya concluyó, se cerró técnicamente y fue clausurado; ni en un expediente de ejecución del PHD que está suspendido, precisamente, porque el ICE no ha podido entregar el estudio de impacto ambiental que fuera solicitado por la SETENA. A la fecha, falta un componente esencial de esa evaluación, a saber, la consulta indígena onforme al mandato del artículo 6 del Convenio No. 169 citado. Ahora, para este Tribunal se encuentra fuera de toda duda la relevancia que el derecho al ambiente sano y ecológicamente equilibrado ostenta en nuestro régimen jurídico.
Se trata de un derecho tutelado en el ordinal 50 párrafos 2º y 3º de la Carta Magna que ha sido objeto de un prolijo desarrollo legal, reglamentario jusrisprudencial, dentro de una materia que ha sido objeto de tratamiento además por tratados internacionales de los cuales, Costa Rica es Estado signatario. En ese sentido, conviene recordar que el artículo 17 de la Ley Orgánica del Ambiente (en adelante LOA) , señala que “ Las actividades humanas que alteren o destruyan elementos del ambiente o generen residuos, materiales tóxicos o peligrosos, requerirán una evaluación de impacto ambiental por parte de la Secretaría Técnica Nacional del Ambiente creada en esta ley. Su aprobación previa, de parte de este organismo, será requisito indispensable para iniciar las actividades, obras o proyectos. Las leyes y los reglamentos indicarán cuáles actividades, obras o proyectos requerirán la evaluación de impacto ambiental.”.
Bajo esta línea, se establece como regla común la necesidad de contar con instrumentos de medición de la variable ambiental en las diversas conductas y actividades humanas que puedan considerarse intrusivas al ambiente. La Evaluación de Impacto Ambiental se constituye, entonces, como un procedimiento que ostenta una compleja convergencia de variables jurídico-técnico-administrativas, cuya finalidad no es otra que la medición, identificación, predicción o proyección de los impactos que una determinada actividad humana producirá, con probabilidad, en el ambiente, caso de que sea llevado a cabo o se concretice su ejecución material. Dicho procedimiento se emite como base en un requerimiento previo de un procedimiento autorizatorio, en el cual se estiman los efectos y consecuencias que un proyecto de obra o actividad humana va a generar en el ambiente y constituye un importante mecanismo de ejercicio de política ambiental, que tiene una aplicación directa e inmediata en las actividades productivas, de manera que logre la armonía y compatibilidad de esas explotaciones económicas o sociales, con la preservación del medio, dentro de una visión de sostenibilidad o desarrollo sostenible.
Es por ello que estimamos necesario advertir que, si el ICE como desarrollador del PHD decide retomar la fase de investigación geológica de este proyecto, evidentemente deba de ajustarse a lo dispuesto por la normativa ambiental vigente (en especial, el artículo 17 de la LOA) y solicitar, dentro de un nuevo expediente, la evaluación de impacto ambiental respectiva, la cual deberá corresponder al tipo de actividades u obras que, en esa fase de investigación, se requiera desarrollar, según explicaremos de seguido.
VI.Tomando en cuenta lo expuesto supra en relación con las precisiones efectuadas en torno al objeto de este proceso, el Tribunal entiende que la pretensión primera de las demandantes se orienta a que se le ordene al ICE que, en caso de ejecute obras constructivas o ingrese a la fase de inversión u operativa del proyecto, cumpla con efectuar la evaluación de impacto ambiental que corresponda. Lo anterior porque, según se infiere de las argumentaciones expuestas por la parte actora, algunas de las actividades impactantes autorizadas ambientalmente en el expediente No. 366-2005-SETENA, van más allá de la investigación geológica, en tanto constituyen obras constructivas que se corresponden más con una fase de inversión u operativa del proyecto; sin que éstas fueran evaluadas con el instrumento ambiental exigido tomando en cuenta su verdadera naturaleza. Sobre este punto, cabe reiterar que en este proceso no se ha formulado ninguna pretensión anulatoria que habilite al Tribunal a revisar la legalidad de las actuaciones y actos mediante los cuales la Nombre139474 otorgó las viabilidades ambientales correspondientes para el proyecto "Estudios geológicos en el Sitio Térraba".
Sin embargo, de las argumentaciones y la pretensión material de las actoras, sí se infiere que se reclama una conducta omisiva de la Nombre139474 al no exigir el cumplimiento de la normativa ambiental y permitir que, con una viabilidad ambiental sustentada en una DJCA, se permitiera la ejecución de obras u actividades propias de una fase constructiva o de inversión, que requerían de un instrumento ambiental diferente, como lo sería, a juicio de las demandantes, una Evaluación Ambiental Estratégica o un Estudio de Impacto Ambiental. Desde esta perspectiva, la forma en que se fijó la pretensión permite a este Tribunal analizar la naturaleza de las actividades impactantes autorizadas, en su momento, por la Nombre139474 para establecer si las mismas corresponden a actividades meramente de investigación geológica o a obras constructivas asociadas a esta fase o una etapa de inversión que hiciesen necesario un instrumento de evaluación ambiental diverso al que, en su momento, se autorizó.
Lo anterior no para anular lo actuado porque, insistimos, ese extremo no fue pedido por la parte actora; sino únicamente para fijar los límites y reglas impuestas por el ordenamiento jurídico y los hechos, para el ejercicio legítimo de las potestades administrativas que, en este caso, el ICE y la Nombre139474 ejercerían en el supuesto de que se reabriera una nueva fase de investigación geológica del PHD. Lo anterior, claro está, sin perjuicio del margen de discrecionalidad que ese ente y órgano conserven, tal cual se deriva del inciso f) de los artículos 42 y 122 del CPCA, así como los numerales 15, 15 y 158 inciso 4) de la Ley General de la Administración Pública. En ese sentido y para efectos de delimitar el examen que se efectuará, debemos iniciar señalando que en este proceso no se demostró que el ICE hubiese ejecutado actividades o labores propias de la fase de inversión, operativa o de ejecución del PHD en el territorio indígena de Térraba.
Para el Tribunal, no se allegaron los elementos demostrativos suficientes y necesarios que permitieran establecer, con la contundencia debida, ese hecho. Por el contrario, las probanzas recabadas se orientan mucho más a confirmar que las labores y actividades ejecutadas por el ICE dentro del expediente No. Nombre139483 hasta aproximadamente mayo del 2011 eran, en general, propias de la investigación, exploración y experimentación geológica requerida previo a aquella, sea, la ejecución del PHD. Así se infiere de los testimonios rendidos por Nombre139477 , quien ocupaba el cargo de Coordinador del Área de Ingeniería Geotécnica del ICE, y en lo medular, señaló que el informe rendido por INGETEC en noviembre del 2005 no suponía el inicio de las obras constructivas ni contemplaba los planos o diseños finales. Por su parte, el Ingeniero Nombre139475 , quien fuera Coordinador de Obras Subterráneas, insistió en que las actividades ejecutadas con ocasión del referido expediente fueron de investigación geológica y estaban autorizadas por la SETENA, tanto para las obras como para sus dimensiones.
Nombre139478 , Ingeniero Forestal quien ocupó el cargo de Coordinador Ambiental del PHD, manifestó que las actividades efectuadas en el expediente No. Nombre139483 fueron investigativas y de obras asociadas. Finalmente, Nombre139479 , analista de Auditoría y Seguimiento Ambiental de la Nombre139474 señaló que las actividades que se describían en el referido expediente eran propias de la etapa de investigación y, aunque en lo referido a la magnitud no estaba claro, no parecían ser de inicio de labores. El único testigo que difiere sobre este aspecto es Nombre139485 , quien es geólogo e ingeniero en construcción e indicó que, en su criterio, el PHD se encontraba en la fase constructiva. Según expuso, llega a esa conclusión por distintos indicadores como lo eran la organización que el ICE mantiene aún en la página oficial del Diquís, por el tipo de obras que se ejecutaban, así como por la cantidad de recursos y material que se manejó.
Sin embargo, en este punto el Tribunal se inclina por dar credibilidad al testimonio rendido por Nombre139477 , Nombre139475 , Nombre139478 y Nombre139479 por encima del de don Nombre139485, por las siguientes razones. Aún y cuando este último trabajó para el ICE en distintos proyectos hidroeléctricos como el de Arenal y el de Corobicí y no dudamos de la experiencia que, en el tema de proyectos hidroeléctricos, posee; lo cierto es que casi no mantuvo relación con el PHD dado a que dejó de laborar para ese ente en el año 2006. Por ende, no tuvo relación directa con las labores efectuadas al amparo del expediente No. Nombre139483 ni estuvo en el sitio en que se ejecutaron éstas. Sus apreciaciones sobre la organización que rodea al proyecto se basan, en lo fundamental, en lo que señala la página oficial del sitio la que, en nuestro criterio, no es un elemento contundente para concluir que se corresponde con una fase constructiva o de inversión.
Lo anterior por cuanto nada obsta que ese organigrama fuese proyectado para cuando el proyecto hubiese alcanzado todas sus fases ni que esté actualizado. Por otra parte, los datos que brindó el deponente referidos a la cantidad de personal y recursos que se manejaron, no se sustentan en fuentes idóneas. Si a lo anterior se le agrega que el señor Nombre139485 no estuvo en el sitio mientras se ejecutaron las obras, solo es posible concluir que se trata de apreciaciones subjetivas que carecen de certeza. En relación con las obras que se ejecutaron y conforme analizaremos infra, estimamos que tampoco es un elemento distintivo de la fase de inversión toda vez que existen actividades de investigación que, por sí, tienen una naturaleza constructiva como lo es la excavación, según lo manifestó el propio don Nombre139485. Ahora bien, descartando que las actividades efectuadas en el expediente No. Nombre139483 correspondan a una fase de inversión u operativa, corresponde analizar si dentro de la fase de investigación geológica a la que hemos venido hacienda referencia se ejecutaron obras de naturaleza constructiva y, en caso de que así se hubiera hecho, cuál es el instrumento ambiental idóneo para evaluar esas actividades impactantes.
Pues bien, se ha tenido por acreditado que al amparo de la viabilidad ambiental otorgada en la resolución No. 2766-2009-SETENA citada, el ICE llevó a cabo, en la margen derecha del Río General y en la Reserva Indígena de Térraba, actividades cuya naturaleza es de investigación geológica como perforaciones y exploraciones; pero también ejecutó obras constructivas asociadas a esa investigación, tales como movimientos de tierra, excavaciones (del portal, de la ventana de acceso, de la intersección y de la galería de investigación que se situaba en el eje de uno de los futuros túneles de desvío) y la construcción de muro de gaviones. A esa conclusión se llega luego de valorar, con base en las reglas de la sana crítica racional, distintos elementos probatorios como lo son el cuaderno de bitácora, el reconocimiento judicial y las declaraciones de Nombre139486 , Nombre139478 , Nombre139475 y Nombre139479 .
Veamos. La primera de las obras de naturaleza constructiva efectuada en esa fase de investigación fue el muro de gaviones, autorizado en resolución No, 2766-2009-SETENA de la siguiente manera "(...) 2.6.1 Dique de protección con muro de gaviones: Con el fin de brindar una terraza de trabajo segura y dar seguridad al personal operativo en la época de lluvias fuertes, ayudando a la contención del agua del río en caso de crecientes. Tiene 6 m de altura, 110 m de longitud y el ancho varía según la altura, entre tres y un metro de ancho, con unos 1540 m3 de volumen de piedra (...). Desde el inicio de las anotaciones que constan en el expediente administrativo denominado "Bitácora", se indicó que se había tomado la decisión de intensificar el llenado de gaviones en la zona de aguas arriba del muro para generar una defensa en caso de que río creciera (folio 01). Ese proceso continúa hasta el 22 de mayo del 2010, fecha en la que finaliza y posteriormente se lanza concreto en la cara del muro que da al río (folios 13 y 15).
La existencia de ese muro de gaviones la constató el Tribunal durante el reconocimiento judicial, tal cual consta en la grabación respectiva. Consideramos que se trata de una obra de naturaleza constructiva para la cual se requiere, incluso, el permiso de construcción respectivo tal y como se infiere de los artículos 1,2 y 74 de la Ley de Construcciones. Lo anterior se agrava si se toma en cuenta que se trata de una obra efectuada en la margen derecha del cauce del Río General, aspecto sobre el cual, y pese a la declaración del Ingeniero Nombre139478 (que omite referirse a la construcción del muro de gaviones como una obra efectuada en el cauce del río), el Tribunal no tiene ninguna duda, dado a lo que se observó en el reconocimiento judicial. El lugar donde se construyó ese muro de gaviones hacía necesario que se gestionara la autorización a la que hacen referencia los artículos 33 y 34 de la Ley Forestal.
Pues bien, no consta en autos que el ICE hubiese gestionado u obtenido el permiso de construcción respectivo para levantar ese muro ni la autorización a la que refiere la Ley Forestal. Otra de las obras de naturaleza constructiva efectuada en la fase de investigación son los movimientos de tierras efectuados, al menos, en dos supuestos. El primero de ellos es el que refiere el Ingeniero Forestal Nombre139478 , quien ante una pregunta del Tribunal señaló que sí los hubo y que estaban asociados al mejoramiento de las vías de acceso, particularmente en relación con los trillos existentes en la finca y porque se requerían para el ingreso de la maquinaria perforadora. Nuevamente, tampoco se demostró que ese movimiento contara con los permisos municipales que se derivan de los numerales 1, 2 y 74 de la Ley de Construcciones. El Ingeniero Nombre139478 manifestó que, hasta donde él entendía y para los efectos del ICE ese tipo de movimientos que realizara esa institución no demandan ni requieren este tipo de permisos.
El Tribunal no comparte esa posición. Como ya hemos indicado en otras ocasiones, entre ellas, la sentencia No. 115 -2011-VI, dictada a las 15 horas 15 minutos del 3 de mayo de 2011, no concebimos que el ICE ostente una suerte de tratamiento especial que le permita no sujetarse a los permisos u autorizaciones que el ordenamiento jurídico impone para ejecutar obras constructivas, explotar o aprovechar bienes de dominio público; y ello no se deriva, ni siquiera, de la norma que lo crea, a saber, el Decreto Ley No. 449. Esa normativa lo que crea son potestades (poderes-deberes) en favor del ICE, entre ellos encauzar el aprovechamiento de la energía hidroeléctrica con el fin de fortalecer la economía nacional y promover el mayor bienestar de los habitantes del país; situación que no conlleva persé una exención o exclusión de las autorizaciones o permisos que el mismo ordenamiento establece para actividades específicas, ni tampoco confiere un derecho de aprovechamiento de las aguas de la Nación.
Por el contrario, una interpretación integral del Decreto Ley No. 449 en relación con el ordenamiento jurídico, en especial, de las normas que regulan la planificación urbana, el medio ambiente, el derecho a edificar, la protección el recurso hídrico y las regulaciones referidas a la prestación de los servicios públicos, permiten concluir que esa potestad debe ejercerse dentro de los límites que el propio ordenamiento dispone, siendo uno de ellos, precisamente, la obtención de estos permisos, autorizaciones o concesiones, según corresponda dependiendo de la actividad que se realice. El artículo 2 del Decreto Ley señala que esa institución debe procurar la utilización racional de los recursos naturales, evitando una explotación destructiva y desperdiciada de los mismos. Asimismo, se le encomienda conservar y defender los recursos hidráulicos del país, protegiendo las cuencas, las fuentes y los cauces de los ríos y corrientes de agua.
Así, una correcta hermenéutica del Decreto Ley No. 449 no puede llevarnos a afirmar que existe una desaplicación de la normas legales que imponen condiciones y limites al ejercicio de actividades constructivas y menos aún que se exima al ICE de solicitar las respectivas habilitaciones para tales efectos. Más bien, es indispensable que el ICE se someta a toda la normativa de tutela del ambiente y de los recursos naturales, lo que implica que se solicite y apruebe las referidas autorizaciones. No ignora este Tribunal la necesidad de desarrollar y ejecutar proyectos hidroeléctricos que faciliten el cumplimiento de los fines encomendados al ICE. Sin duda este tipo de actividad es de interés público, sin embargo, los fines legales que persigue no pueden ser logrados al margen de las regulaciones y condiciones establecidas por normas legales para tales efectos. Lo anterior porque el ICE está sometido al ordenamiento jurídico por lo que, previo al ejercicio de este tipo de actividades (obras en cauce de río, movimientos de tierras y excavaciones) debe contar con las autorizaciones respectivas.
Sobre este tema, puede consultarse también, la sentencia No. 0001309-F-S1-13, dictada por la Sala Primera de la Corte Suprema de Justicia a las 14 horas 5 minutos del primero de octubre del 2013, que confirmó la resolución No. 115-2011-VI citada. El segundo supuesto en el que identificamos los movimientos de tierras es en la actividad referida a la excavación, según analizaremos de seguido. En su deposición Don Nombre139485 explicó que, tratándose de túneles, existen dos etapas constructivas, a saber, la excavación y el revestimiento. Luego, ante una pregunta de este Tribunal, don Nombre139479 manifestó que cualquier excavación era una obra constructiva. Lo anterior resulta conteste con el artículo 55 del Decreto Ley de Construcciones, norma que establece que para llevar a cabo cualquier trabajo de excavación deberá recabarse por un Ingeniero el permiso previo de la Municipalidad la que lo concederá previa aprobación del proyecto o memoria sobre precaución.
Por su parte, el ordinal 56 del mismo Decreto Ley establece que se deberán tomar precauciones para impedir que los movimientos del terreno en donde se excava, causen perjuicios a las construcciones y a los servicios públicos situados en su inmediación. Pues bien, ya desde el inicio de su declaración, Don Nombre139478 indicó que en el expediente No. Nombre139483 se autorizaron actividades investigativas y obras asociadas. Si se observa con cuidado, el expediente administrativo rotulado como "Bitácora" refiere al control de las obras relacionadas con la galería exploratoria en la margen derecha del sitio de presa (folio 00 de la bitácora) e indica expresamente la excavación de la galería exploratoria propiamente dicha. Si se observan las anotaciones diarias efectuadas en el cuaderno de bitácora de obra, se refleja todo el proceso seguido para tales efectos, que inició con el ingreso de la excavadora hasta el sitio del portal, entendiendo por éste la protección que se hace para ingresar al macizo rocoso (declaración de Nombre139475 ).
Se anotó que el material se mostraba muy inestable cuando se inició con la excavación y que se profundizó la excavación del primer banco con el fin de buscar un terreno más estable a una profundidad mayor (folio 11 de la bitácora). Ese proceso de excavación continúa hasta el 21 de junio del 2010, día en que se finalizó el proceso de barrenación del cuarto y último banqueo para la conformación del portal (folio 18 de la bitácora). Posteriormente, se inició con la colocación de los arcos en el exterior del talud para la conformación del portal e iniciar con la excavación de la galería (folio 19 de la bitácora). Se continúa con el proceso de excavación subterránea aplicando el método de voladuras. Primero se excavó la ventana de acceso, que es la distancia o el corredor que existe entre el portal y el sitio de investigación, y que constituye el medio de acceso a la galería exploratoria (declaración del Ingeniero Nombre139475 ).
Se avanzó con la excavación de la ventana de acceso, utilizando como refuerzo temporal pernos de anclaje y concreto lanzado (folio 24 de la bitácora). Conforme a la declaración del Ingeniero Nombre139475 , esos soportes temporales se utilizan porque al realizar las voladuras el material queda expuesto, se descompresiona, trata de caerse y requieren de un soporte hasta que que se haga el revestimiento de la ventana. Don Nombre139485 manifestó que cuando se hacen excavaciones, si la roca se cae era necesario colocar pernos que la sostuvieran. Agregó que si el material era malo, se utilizaba otro soporte temporal como por ejemplo arcos. Ambos testigos coinciden en que se les denomina soportes temporales, no porque estén ligados a un tiempo determinado o luego se quiten; sino porque se mantienen hasta que se aplica el revestimiento. El proceso de excavación de la ventana finalizó con un avance de 145.15 metros y lo que seguía era iniciar el proceso de excavación de la ampliación de la intersección (folio 28 de la bitácora).
Explicó el Ingeniero Nombre139475 que la intersección es el entronque entre la ventana y la galería; y que cuando se ingresa por la ventana llega un momento en que la galería es perpendicular y se ocupa que la maquinaria que ingrese pueda girar. Por eso se hace la ampliación de la intersección, para que el equipo pueda girar. Para esa ampliación no se utilizaron soportes temporales de marcos de acero, porque el material era bueno y estable (así se indica también en el folio 28 del cuaderno de bitácora). Una vez ampliada la intersección, se avanzó en la excavación sobre el alineamiento de la galería exploratoria, utilizando soportes temporales de malla electrosoldada, pernos de anclaje y concreto lanzado (folios 29 y 30 de la bitácora). Cabe resaltar que durante el avance de la excavación de la galería, se tomaron algunas previsiones relacionadas directamente con la construcción de los túneles de desvío y la corona de éstos.
Así se infiere de los folios 30, 31, 37 del cuaderno de bitácora, y será un punto que analizaremos infra. La excavación continúa, también, a la sección ampliada de la galería y en dirección opuesta, sea, río abajo (folios 37, 38 y 39) hasta el cierre técnico de la galería de exploración de la margen derecha del Río General cuando se había excavado 215,5 metros en el sentido aguas arriba y 166,7 metros en el sentido aguas abajo, para un total del 382, 23 metros excavados (folio 43). Para el Tribunal, lo expuesto deja en evidencia que las excavaciones efectuadas en la ventana de acceso y la galería de investigación sí constituyen obras constructivas que, aunque se hubiesen autorizado por la SETENA, se hubieran efectuado en la fase de investigación y fuesen necesarias para ésta, no pierden esa naturaleza. Y esa condición es importante, sobre todo, para efectos ambientales, según veremos supra.
Pero, además, también se acreditó que con la excavación de la galería de investigación, el ICE también excavó aproximadamente 43 metros cuadrados (correspondientes al área de la galería de investigación ubicada en el eje de uno de los futuros túneles de desvío) de los 175 metros cuadrados que tendría uno de los futuros túneles de desvío (declaración de Nombre139475 , expediente administrativo rotulado "Bitácora"). En este sentido, debemos tener presente que con la resolución No. 2766-2009-SETENA citada y los informes técnicos que le sirven de sustento, se autorizó la ampliación de actividades dentro de la fase de investigación del proyecto "Estudios geológicos Sitio Térraba". Una de las actividades adicionales que se autorizó fue la "(...) Habilitación de una galería de exploración geológica en el sitio Térraba (en la margen derecha del río General) para los túneles de desvío. (...) 2.6 Galería de exploración geológica de los túneles de desvío: Se refiere a los túneles de desvío del río, requeridos para la protección del área de construcción de la presa, y consistirán en dos excavaciones subterráneas sobre la cota 141 m .s.n.m.
Las características de los túneles y sus dimensiones fueron modificadas en la propuesta de la Adenda a la solicitud de ampliación de la viabilidad ambiental (ver punto 1). (...)". Como se observa, desde el momento en que se solicitó la ampliación y adenda a la viabilidad ambiental otorgada en el expediente No. Nombre139483 citado, el ICE conocía que la galería que se habilitaría en el sitio Térraba lo sería para la investigación geológica de los futuros túneles de desvío. El Ingeniero Nombre139475 manifestó que siempre se indicó que la galería de investigación tenía que ser en el eje de los futuros túneles de desvío y justificó esa decisión porque si lo que se necesitaba era investigar los referidos túneles, se tenía que hacer en ese eje, porque si no la información obtenida no sería representativa. Por su parte, del cuaderno de bitácora puede inferirse que hubo un momento a partir del cual con el avance de la excavación de la galería de investigación, se avanzó también en la excavación de, al menos, uno de los futuros túneles de desvío.
Por ejemplo, el 13 de octubre del 2010 se anotó que "(...) Se decide no realizar chorreas de piso ya que la solera sería removida durante la construcción del túnel de desvío 2, de tal modo que no se colará la solera en el piso hasta tanto no sea absolutamente necesario (...) (folio 30); el 21 de octubre de ese mismo año se indicó que "(...) La excavación continúa sin problemas. La próxima semana se tomará la decisión de donde (sic) se realizarán las excavaciones a sección completa de la corona de los túneles de desvío para las investigaciones de geología y geotecnia. (...)" (folio 31); y el 14 de diciembre se señaló que "(...) El 03 de diciembre se comenzó con el proceso de ampliación de la galería desde la estación 223,04 en adelante, esto para investigar el comportamiento del terreno con el arco del túnel definitivo de desvío. (...)" (folio 37). El Ingeniero Nombre139475 refuerza esta posición cuando señaló que si los túneles de desvío se hacen ya eso está excavado porque se hizo investigación, y que era una ganancia adicional aunque no una excavación como tal.
Luego, explicó que el área de la galería era de 43 metros cuadrados y la del futuro túnel de desvío era de 175 metros cuadrados, por lo que se había excavado simplemente un 24% del área futura de los túneles de desvío. También, que se habían previsto dos túneles de desvío gemelos, paralelos de 14 metros cada uno para lo que se excavaría en total aproximadamente 250.000 metros cúbicos de material, y que lo se excavó hasta el momento del cierre técnico fue de 12.000 a 13.000 metros cúbicos, lo que corresponde a menos de un 6% de la excavación total. De las probanzas analizadas, concluimos que con la excavación de la galería de investigación geológica, el ICE también excavó un porcentaje de lo que en el futuro sería, uno de los túneles de desvío del PHD; lo que refuerza que sí se efectuaron obras de naturaleza constructiva en esa fase de investigación, algunas referidas a la corona de uno de los futuros túneles de desvío.
Y estimamos que esa decisión adoptada por el ICE no necesariamente es indebida, como tampoco lo es la modificación aprobada para que las dimensiones de esa galería de investigación coincida con la de los futuros túneles de desvío. Por el contrario, del testimonio de don Nombre139476 y don Nombre139475 se evidenció la importancia de las investigaciones o exploraciones geológicas en el desarrollo de un proyecto hidroeléctrico de la naturaleza y dimensiones del Diquís. Por ende, si era posible investigar el comportamiento del macizo rocoso en el sitio exacto o lo más aproximado al eje de los túneles de desvío y que con la excavación de la galería se avanzara con la de los túneles; todo parece indicar que técnicamente era debido hacerlo para conocer la calidad y características del material, su estabilidad, lograr que una mayor eficiencia en los costos, una mayor seguridad, en tanto se minimizan los riesgos así como un uso más adecuado de la tecnología.
Sin embargo, estimamos que si junto a la investigación geológica se excavó parte de los túneles de desvío, aunque fuese en un porcentaje pequeño, así debió indicarse a Nombre139474 por las implicaciones ambientales que ello puedo haber traído, según analizaremos de seguido.
VII.Precisamente, en sus argumentaciones la parte actora reclama una conducta omisiva de Nombre139474 a la hora de establecer el instrumento ambiental con base en el cual se autorizó la ejecución de actividades como las señaladas en el Considerando anterior en el proyecto "Estudios Geológicos en el Sitio Térraba". Si bien en este proceso no se formula ninguna pretensión anulatoria de actuaciones (formales o materiales) de la Nombre139474 en el procedimiento ambiental tramitado bajo el expediente No. 366-2005-SETENA, lo cierto es que los pedimentos de las actoras se dirigen a que se ordene a los entes públicos involucrados adoptar algunas acciones correctivas en materia ambiental, para que en el supuesto de que el proyecto se reanude o continúe se cumpla con la normativa ambiental vigente y considerando que su desarrollo lo será, al menos, en el territorio indígena de Térraba, donde ellas habitan.
Bajo esa línea, estimamos necesario efectuar algunas consideraciones respecto de lo actuado en Nombre139474 para que sirva de parámetro a efectos de resolver lo pedido. Como hemos venido señalando, mediante la resolución No. Nombre139474 se autorizó la viabilidad ambiental para el proyecto "Estudios Geológicos en Sitio Térraba", cuyo desarrollador era el ICE. En lo fundamental, en esa resolución se autorizaron actividades como perforaciones geológicas, excavación de galerías de investigación y la habilitación de trillos y senderos (así se infiere de la propia conducta administrativa y de la declaración de Nombre139478 ). En ese expediente el ICE aportó un FEAP y el instrumento de evaluación ambiental con base en el cual, en definitiva, se autorizó la viabilidad ambiental indicada fue una DJCA. Lo anterior conforme a lo establecido en las resoluciones No. 587-1997-SETENA y No. 693-1997-SETENA, vigentes a la fecha de presentación del FEAP.
Posteriormente, en el año 2009 el ICE gestionó ante la Nombre139474 una ampliación a la viabilidad ambiental otorgada mediante la resolución No. Nombre139474 citada y una adenda a la solicitud de ampliación referida. La primera solicitud (ampliación) se fundamentó en la necesidad obtener datos geológicos relacionados con los sitios de obras del referido proyecto a efectos de recabar información fundamental para los diseños ingenieriles y que no había sido posible obtener con las exploraciones efectuadas hasta el momento. Además, manifestó que las actividades adicionales de investigación que se planteaban y sus impactos ambientales no diferían en nada de lo planteado originalmente en ese expediente (folios 222 al 495 tomos I y II del expediente administrativo Nombre139474 No. 366-2007). La solicitud de adenda a la de ampliación se justificó técnicamente en los recientes cambios en las galerías pedidas en la solicitud de ampliación, adjuntando dos informes técnicos suscritos por el Ingeniero Nombre139475 , Coordinador de Obras Subterráneas del PHD (folios 12 al 27 de la carpeta administrativa correspondiente a la Adenda planteada en el expediente administrativo No. 366-2005-SETENA).
Mediante la resolución No. 2766-2009-SETENA, la Nombre139474 aprobó la nueva DJCA sometida a evaluación por el ICE con base en la solicitud de ampliación de viabilidad ambiental y a la adenda a la solicitud de ampliación referida. En lo que interesa, con esa ampliación a la viabilidad ambiental se autorizaron actividades como:
VIII.A este nivel de análisis, estimamos importante señalar lo siguiente. Como explicamos, el expediente No. Nombre139483 referido a los estudios de investigación geológica en el sitio Térraba fue cerrado y archivado, al menos en lo que refiere al sitio Térraba. Sin embargo, ante una pregunta del Tribunal sobre si esa fase se encontraba terminada para efectos ambientales, el Ingeniero Forestal Nombre139478 manifestó, en lo medular, que en principio sí lo estaba, pero que si cuando se efectuara la consulta indígena surgiera algún elemento adicional de relevancia en esta materia, habría que considerarlo y, de ser necesario, se podría reabrir nuevamente esa fase. Lo mismo sucedería respecto de aspectos pendientes que no fueron considerados en aquella fase de investigación como por ejemplo, los arqueológicos. Si a lo anterior le agregamos el tiempo transcurrido entre la fecha en que el ICE concluyó esa investigación en Térraba (junio del 2011) hasta el día de hoy; resulta evidente que tanto la investigación como los riesgos geológicos que en ese momento se ponderaron, y los aspectos ambientales que en aquel momento fueron valorados podrían haber cambiado; lo que puede llevar a que el ICE estime necesario reabrir o retomar la fase de investigación geológica previo a la ejecución del PHD.
En ese supuesto y dentro del marco de lo pedido por las demandantes, estimamos necesario establecer algunos límites al ejercicio de las potestades tanto del ICE como de las autoridades ambientales, con la finalidad de que su actuación se ajuste al ordenamiento jurídico. Lo anterior, claro está, sin perjuicio del margen de discrecionalidad que resulta propio de cada uno de ellos. En ese sentido, si el ICE decide, a corto, mediano o largo plazo, retomar la fase de investigación geológica del PHD en el sitio Térraba deberá iniciar el procedimiento de evaluación ambiental correspondiente, el cual se tramitará bajo un nuevo expediente (no como una modificación o ampliación) y se regirá por la normativa vigente al momento de su presentación, conforme a la cual deberá determinarse la calificación del proyecto, el nivel de significancia ambiental y el instrumento que deberá exigirse. Respecto de este último aspecto, la pretensión de la parte actora propone que la evaluación ambiental en el Territorio Indígena de Térraba lo sea a través de una Evaluación Ambiental Estratégica o un Estudio de Impacto Ambiental.
De inicio, hay que advertir que la definición del instrumento de evaluación ambiental es una potestad que corresponde, en exclusiva, a la Nombre139474 conforme, claro está, a las particularidades que para cada caso impone la normativa vigente. No obstante, estimamos conveniente advertir que, conforme a la prueba recabada, la EAE no parece ser el instrumento idóneo para tales efectos. Conforme al Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental, la Evaluación Ambiental Estratégica es el p roceso de evaluación de impacto ambiental aplicado a políticas, planes y programas. Por su característica y naturaleza, este tipo de proceso, se puede aplicar, además, a los proyectos de trascendencia nacional, binacional, regional centroamericano, o por acuerdos multilaterales, conforme a lo establecido en la normativa vigente. Respecto de este instrumento, el Ingeniero Forestal Nombre139478 manifestó que tiene como ventaja que permite planificar un conjunto de situaciones impactantes pero que, en rigor, sirven para el análisis ambiental orientado a políticas planes y programas y que, en todo caso, no elimina ni descarta la aplicación de un estudio de impacto ambiental si las condiciones lo hicieran necesario.
Explicó que no tiene mayor sentido en un territorio específico ni para espacios pequeños, ya que existen otros instrumentos ambientales más idóneos. Por su parte, Nombre139479 manifestó que la rigurosidad de una EAE no es comparable con la del EsIA ya que son instrumentos de diferente naturaleza; y que, en todo caso, la realización del primero no eximiría de la presentación de un estudio de impacto ambiental ya que, a lo sumo, dotaría de información de base a este último.
IX.En definitiva, el Tribunal estima que la primera pretensión de las demandantes debe ser acogida parcialmente. Por las razones expuestas en los Considerandos precedentes, estimamos que no es procedente ordenarle al ICE que, de inmediato, complete la evaluación de impacto ambiental en la zona de la Reserva Indígena de Térraba (porque uno de los expedientes ya está cerrado y archivado en cuanto a la investigación geológica en Térraba refiere y la tramitación del otro, el No. 843-2007-SETENA, se encuentra suspendida), así como tampoco lo es definir el instrumento ambiental que debe aplicarse ni que lo sea únicamente para la zona de la Reserva Indígena de Térraba. Sin embargo, sí estimamos procedente advertir al ICE que, si decide, a corto, mediano o largo plazo, reabrir o retomar la fase de investigación geológico en el Sitio Térraba previo a la ejecución del PHD deberá iniciar el procedimiento de evaluación ambiental respectivo bajo la normativa vigente al momento de la presentación de su solicitud y que la Nombre139474 deberá definir el instrumento de evaluación ambiental que deba exigirse tomando en cuenta los parámetros que para efectos de esa clasificación establezca el ordenamiento jurídico, así como la significancia ambiental de las obras o actividades impactantes que se vayan a realizar.
Asimismo, el ICE deberá gestionar ante los entes y órganos competentes las autorizaciones o permisos que el ordenamiento jurídico exige para realizar actividades como la corta de árboles, movimiento de tierras, excavaciones, construcción de obras en cauce de río como diques o muros de gaviones.
X.Sobre el análisis de la procedencia de la segunda pretensión. Las demandantes piden que se ordene al Estado y al ICE la generación de un plan de reparación integral, remedial y de medidas compensatorias de todos los impactos y daños ambientales causados por las acciones u omisiones de las demandados ocasionadas en la Reserva Indígena de Térraba, sea por efecto directo o indirecto de la omisión de contar con un instrumento de evaluación de impacto ambiental propio de la etapa constructiva y operativa del proyecto, lo cual debe ser fiscalizado y aprobado por la SETENA. Luego de un mesurado análisis, estimamos que lo pedido es improcedente por las siguientes razones. La primera, es que parte del supuesto de que el ICE no contó con un instrumento de evaluación ambiental, cuando ya se ha establecido que sí se otorgó la viabilidad ambiental en las resoluciones No. Placa26572 y No. 2766-2009-SETENA.
Además, parte de que el PHD estaba en etapa constructiva, de inversión u operativa, aspecto que no fue demostrado en esta litis. Lo que se demostró fue que, estando en fase de investigación geológica, el ICE llevó a cabo obras y actividades constructivas. Si el instrumento ambiental autorizado por Nombre139474 para éstas era o no el que correspondía conforme a la normativa vigente, ello en si mismo no incide enla producción de daños o impactos negativos en el ambiente, con ocasión de la obras constructivas realizadas por el ICE. Segundo, lo que se solicita (el plan de reparación integral, remedial y de medidas compensatorias) lo es para reparar los supuestos daños o impactos ambientales que, se afirma, ocasionaron las acciones y omisiones de los demandados en la Reserva Indígena de Térraba. Pues bien, aún y cuando en este proceso se ha establecido que dentro de la fase de investigación correspondiente a los Estudios Geológicos en Sitio Térraba el ICE ejecutó obras constructivas, lo cierto es que las accionantes no prueban que éstas hayan provocado daños o impactos negativos ambientales dentro del Territorio Indígena de Térraba.
El artículo 3 del Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental define el impacto ambiental como el efecto que una actividad, obra o proyecto, o alguna de sus acciones y componentes tiene sobre el ambiente o sus elementos constituyentes. Puede ser de tipo positivo o negativo, directo o indirecto, acumulativo o no, reversible o irreversible, extenso o limitado, entre otras características. También, define el daño ambiental como aquel impacto ambiental negativo, no previsto, ni controlado, ni planificado en un proceso de evaluación de impacto ambiental (evaluado ex –ante), producido directa o indirectamente por una actividad, obra o proyecto, sobre todos o cualquier componente del ambiente, para el cual no se previó ninguna medida de prevención, mitigación o compensación y que implica una alteración valorada como de alta Significancia de Impacto Ambiental (SIA).
La norma diferencia el impacto negativo del daño ambiental, en la medida en que el impacto ambiental es evaluado en un proceso ex – ante, de forma tal que puedan considerarse aspectos de prevención, mitigación y compensación para disminuir su alcance en el ambiente. En aplicación de la anterior disposición, el Ingeniero Forestal Nombre139478 , el impacto ambiental es cualquier alteración de una acción humana en el medio, que modifica los factores que componen el ambiente. Son causados por el ser humano, son potenciales en el tanto pueden proyectarse en el tiempo y pueden ser positivos o negativos. Devienen de una situación planificable, son controlables y en ese tanto se pueden establecer medidas correctoras a través de la verificación de su cumplimiento ya sea por monitoreo in situ o auditoría y seguimiento ambiental. Conforme al testigo, el criterio diferenciador con el daño ambiental, es que los impactos son situaciones derivadas de una autorización previa; mientras que el primero (daño ambiental) son impactos negativos que no cuentan con un aval previo, calificación ni tiene control.
Otras características del daño ambiental es que es real y medible, antes y después, es negativo y tiene alta significancia, su origen es no planificado y lo que procede, una vez ocurrido es restaurar, reparar y compensar. A criterio del señor Nombre139478 , en el daño ambiental no hay autorización previa o bien puede provenir de un desacato a los compromisos ambientales adquiridos. En atención a lo indicado, estima pertinente este Tribunal llamar la atención en que la definición conceptual establecida en la regulación de cita conlleva el riesgo de tener como lícito y legítimo afectaciones graves al ambiente y sus diversos componentes. En efecto, para esta Cámara de Juzgadores, no resulta posible distinguir entre los conceptos "impacto negativo al ambiente" de "daño al ambiente", desde la óptica de la mera existencia de una autorización previa -emanada de parte del órgano competente, en este caso la SETENA- de la actividad generadora generadora del impacto y de la supuesta valuación (que necesariamente debe sustentarse en criterio objetivo, esto es, técnico y/o científico) de sus efectos en los componentes del ambiente.
Nótese que cuando en la doctrina jurídica y normativa nacional en sentido genérico se habla de daño, se atiende al menoscabo, pérdida o detrimento que se produce en la esfera jurídica del damnificado, afectación que genera el deber de su reparación. Así, tratándose del bien jurídico "ambiente", cuya definición -al tenor del desarrollo de la jurisprudencia de la Sala Constitucional, al menos en las sentencias No. Placa26573 y No. 2003-3656-, no está limitado a los elementos y/o recursos de la naturaleza (suelo, agua, aire, recursos marinos, costeros, minerales, bosques, biodiversidad biológica y paisaje), sino que se extiende al concepto de "entorno" (comprendiendo aspectos de planificación urbana, tutela del patrimonio histórico arquitectónico y el arqueológico); es que reviste de importancia el grado de afectación o alteración en sus elementos conformadores (bióticos y abióticos), en tanto con ello se puede quebrar el equilibrio ecológico y poner en riesgo la salud y vida de las personas (criterio antroporcentrista de la tutela del ambiente).
En este sentido, un rasgo característico del daño al ambiente es que deriva de la conducta humana, tanto por acción, como por omisión; y tal virtud, podría elucubrarse que toda conducta humana en el planeta -en cualquier medio- genera un impacto en el ambiente, la mayoría de veces, de connotación negativa. Por ello, se requiere del factor de la trascendencia en ese impacto, lo que está contemplado en las regulaciones de tutela del ambiente -deber ser-, en donde se regulan y permiten límites permisibles de "contaminación" o afectación, superados o pasados los cuales, se está ante conductas ilegítimas o ilícitas. Consecuentemente, resulta un grave riesgo para la efectiva tutela del ambiente establecida como un derecho fundamental y una potestad pública para todo el aparato estatal -incluido el Poder Judicial a través del ejercicio de la función jurisdiccional-, en los términos impuestos en el artículo 50 de la Carta Fundamental, intentar legitimar impactos negativos en el ambiente, por la sola consideración de que los mismos han sido previamente sometidos al control y evaluación de la autoridad técnica de la materia (SETENA), a través de los diversos instrumentos de valuación ambiental establecidos en nuestro ordenamiento.
Ello no sólo no resulta conforme con los principios rectores de la tutela del ambiente, tales como el precautorio -positivizado en el artículo 15 de la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo (conocida como Declaración de Río) y el canon 11 de la Ley de Biodiversidad-; sino que riñe de manera abierta contra el principio de la objetivación de la tutela del ambiente, que deriva de la incorporación al bloque de legalidad de las reglas de la ciencia y de la técnica, conforme a lo dispuesto en los artículos 16 inciso 1) y 158. inciso 4) de la Ley General de la Administración Pública; en franca desnaturalización de los instrumentos de valuación ambiental en nuestro país. Pues bien, en lo que viene relevante a este proceso, es menester señalar que las actoras no demostraron la existencia de un daño ambiental en el territorio indígena de Térraba que tenga como origen las actividades autorizadas en las resoluciones de viabilidad ambiental autorizadas en el expediente No. 366-2005-SETENA.
La única prueba que aportan las actoras para intentar acreditar los supuestos daños o impactos ambientales es el documento denominado "Diagnóstico de Cumplimiento Ambiental del Proyecto Hidroeléctrico El Diquís en su componente de estudios geológicos en los sitios de Térraba y Cañablancal, con énfasis en el sector de la Reserva Indígena de Térraba"; suscrito, entre otros, por el Ingeniero Nombre39189 . Sin embargo, en criterio del Tribunal, el documento es insuficiente para tales efectos. Por una parte, tal y como lo advertimos durante la audiencia única, por tratarse de un criterio de un experto en la materia, era indispensable que su contenido fuese sometido al contradictorio. Para ello, se admitió como testigo perito al señor Nombre39189 , a efectos de que los demandados pudiesen interrogarlo respecto de las conclusiones a las que ahí arribaba. Sin embargo, el Tribunal declaró inevacuable su testimonio ante la manifestación de la parte actora de que no había podido traerlo al proceso, así como que tampoco había requerido la citación de este Tribunal para tales efectos.
Así, el Tribunal no podría otorgar credibilidad a una prueba de esta naturaleza que no ha sido debatida por las partes. Aunado a lo anterior, lo cierto es que se trata de un documento que fue ampliamente cuestionado por otros de los testigos peritos que declararon. Por ejemplo, el Ingeniero Nombre139478 señaló que entre las falencias del documento en cuestión es que partía de la premisa de que no existió evaluación de impacto ambiental, cuando en realidad sí la hubo y que calificaba los futuros impactos en el medio -de construirse la represa- como daños al ambiente, sin que se aportara elementos que permitieran acreditar su existencia. Además, que en la valoración cualitativa de los presuntos daños se usó una metodología de carácter predictivo, que no es el método para valorar daños. Agregó que la determinación y cuantificación de los impactos partía de informes técnicos no constatados en el campo.
El testigo insistió en que no hay prueba de que el ICE haya incumplido las medidas correctoras y que los supuestos daños que enuncia son actividades u obras que son futuras e inciertas porque no corresponden a una fase de investigación sino de ejecución: por ejemplo, la creación del embalse, que corresponde al expediente No. 843-2007-SETENA. En una línea similar, el testigo Nombre139479 manifestó que el referido diagnóstico era un ejercicio teórico, que asumía que había un daño cuando no se han ejecutado acciones. Insistió en que el PHD no ha bía sido ejecutado por lo que no era posible hablar de daños y que p ara las obras a realizadas, el ICE ha bía cumplido con lo los requerimientos ambientales le ha pedido. Concluyó que no era posible valorar daños futuros por obras no ejecutadas y que, a lo sumo, se trataría de riesgos ambientales. Finalmente, Víctor Guzmán Arguedas, funcionario de la Nombre139474 que efectuó el cierre técnico del PHD en la parte relativa al margen derecho del Río General y la Reserva Indígena de Térraba manifestó que a él no le constaban los supuestos daños que ahí se enlistaban.
Además, que no se sabe cuáles parámetros se utilizaron para saber si hubo contaminación o erosión y que no era exacto porque no se tienen datos para comparar. Para el Tribunal, esas falencias son las que hacían necesario someter la pr obanza al contradictorio y, al no haber sido posible (porque debido a la desatención de la parte actora que lo propuso, el testimonio de uno de los autores del documento fue declarado inevacuable) son las que impiden darle credibilidad. Más bien, existen elementos demostrativos que permiten concluir que al momento del cierre técnico y archivo del expediente No. 366-2005-SETENA, los funcionarios competentes no encontraron daños o impactos ambientales negativos, ni ninguna inconformidad en esa materia. Así por ejemplo, mediante oficio ASA- 1290-2011, de 18 de julio del 2011, la Nombre139474 rindió informe técnico sobre el seguimiento ambiental al proyecto "Estudios geológicos en el sitio Térraba".
En lo que interesa, señaló que "(...) 4. El Instituto Costarricense de Electricidad (ICE) ha cumplido con la presentación de informes ambientales, el nombramiento del responsable ambiental, según lo solicitado en las resoluciones No. Nombre139474 y 2766-2009-SETENA otorgadas por esta Secretaría. Conclusiones 1. El Instituto Costarricense de Electricidad (ICE), ha cumplido con los compromisos ambientales asumidos ante esta Secretaría durante la etapa constructiva del proyecto "Estudios Geológicos en el Sitio Térraba", expediente Administrativo 366-2005-SETENA, específicamente en el Sitio Térraba, dentro del Territorio Indígena Térraba. 2. No se observan en el área del proyecto impactos significativos que requieran ser mitigados antes de dar por cerrado el frente del Sitio Térraba, al margen derecho aguas abajo del Río General Superior, dentro del Territorio Indígena Térraba. (...)" (folios 595 al 610 del tomo III del expediente administrativo No. 366-2005-SETENA).
Luego, mediante oficio SG-ASA-1072-2011-SETENA, de 18 de julio del 2011, la Nombre139474 comunicó al ICE y a la responsable ambiental del referido proyecto que con base en el informe técnico respectivo, no se determinaron no conformidades, quedando de esta forma clausuradas las obras realizadas por el ICE en la margen derecha aguas abajo del Río General Superior dentro del Territorio Indígena de Térraba (folios 612 y 613 del tomo III del expediente administrativo No. 366-2005-SETENA). Lo anterior fue confirmado por el señor Víctor Guzmán Arguedas, quien fue el funcionario de la Nombre139474 encargado de la visita de cierre técnico del expediente No. Nombre139483 y quien indicó , en lo medular, que en esa oportunidad corroboró que las actividades y obras fueran las autorizadas por la Nombre139474 y que el desarrollador cumplió con lo propuesto a la SETENA. Debe tenerse presente, además, que las actoras no impugnaron los actos mediante los cuales se estableció que no existían inconformidades ambientales de relevancia.
Como último aspecto, es menester señalar que somos del criterio de que la determinación de la existencia de los daños que se alegaban es un aspecto que no podría dejarse para la fase de ejecución de sentencia por dos motivos fundamentales. Primero, porque así no fue pedido por las accionantes. En ningún momento su pretensión se fijó para que ese aspecto se determinara en sentencia. Ese punto lo propone hasta la fase de juicio cuando ya no es el momento procesal oportuno para tales efectos. Segundo, el Tribunal no encuentra siquiera evidencia de que esos daños se hubieran producido. La carga de demostrar ese aspecto correspondía a los accionantes, de conformidad con los artículos 317 del Código Procesal Civil en relación con el ordinal 82 del CPCA. Por ende, deberán asumir las consecuencias procesales de su desatención. Como no se han demostrado los supuestos daños o impactos , el Tribunal no encuentra ninguna justificación que permita obligar a que se adopte un Plan Remedial o medidas compensatorias. Por las razones expuestas, lo debido es rechazar la pretensión como en efecto se hace.
X I.- Sobre el análisis de procedencia de la tercera pretensión. Las actoras piden que se ordene al ICE y al Estado que se abstengan de adoptar cualquier conducta administrativa que por acción u omisión pueda afectar los intereses del medio ambiente o la biodiversidad ubicada en el área del proyecto y que pueda afectar la reserva, hasta tanto no cuente con la evaluación ambiental correspondiente. Al respecto debemos señalar lo siguiente. Como explicamos supra, a la fecha la fase de investigación geológica en el sitio Térraba se cerró y el expediente se encuentra archivado (No. 366-2005-SETENA); mientras que el expediente relativo a la evaluación ambiental del PHD (No. 843-2007-SETENA) se encuentra suspendido. Sin embargo, de los testimonios evacuados, no se concluye que el ICE haya perdido interés en continuar con el PHD. Así por ejemplo, del testimonio de Nombre139477 , Nombre139475 y Nombre139478 se puede inferir la posibilidad de que se requiera realizar nuevos estudios de investigación geológica debido a que se han planteado la posibilidad de que sea necesario construir un tercer túnel del desvío o ampliar el diámetro de los dos previstos originalmente.
Incluso, el testigo Nombre139478 manifestó que, una vez que se efectuara la consulta indígena, podrían surgir nuevos elementos no previstos originalmente que hiciesen necesaria una nueva investigación, por ejemplo en aspectos arqueológicos. Ese mismo testigo hizo un recuento de la evolución temporal del expediente No. 843-2007-SETENA del que se desprende que el ICE ha estado llevando a cabo acciones y que se han estado rindiendo informes semestrales a la SETENA. También, que el PHD es una obra de grandes dimensiones, cuya área de influencia incluye, entre otras, a la Reserva Indígena de Térraba; así como que las actividades (de investigación propiamente dichas, de naturaleza constructiva en fase de investigación o propias de una fase de inversión u ejecución) que ahí se realicen son impactantes, en mayor o menor medida, del medio ambiente. Por ello, el Tribunal estima que es necesario fijar reglas que orienten el ejercicio de las potestades administrativas, al menos en dos aspectos generales e ineludibles, para que estas resulten conformes con el ordenamiento jurídico.
Así, por ejemplo, es necesario que previo al ejercicio de cualquier conducta administrativa del ICE que se relacione con las fases de investigación, inversión o de ejecución referidas al PHD, en la reserva indígena en cuestión, ese ente cuente con la evaluación ambiental que requiera cada una de las fases del proyecto, dependiendo del impacto que ocasionen las actividades ahí previstas. Además, es necesario que efectúe la consulta indígena previa, libre e informada que exige el numeral 6 del Convenio No. 169 citado. Debe tenerse presente que conforme a la jurisprudencia de la Corte Interamericana de Derechos Humanos, el Estado debe asegurar la participación efectiva de los miembros de la comunidad indígena, de conformidad con sus costumbres y tradiciones, en relación con todo plan o decisión que afecte sus tierras tradicionales y que pueda conllevar restricciones en el uso, goce y disfrute de dichas tierras, para así evitar que ello implique una denegación de su subsistencia como pueblo indígena (Caso Comunidad Indígena Nombre139487 vs Paraguay, sentencia de 24 de agosto de 2010, Fondo, Reparaciones y Costas).
También, se ha manifestado sobre el momento a partir del cual debe efectuarse la esa consulta indicando, por ejemplo, que "(...) 133. Primero, la Corte ha manifestado que al garantizar la participación efectiva de los integrantes del pueblo Nombre14492 en los planes de desarrollo o inversión dentro de su territorio, el Estado tiene el deber de consultar, activamente, con dicha comunidad, según sus costumbres y tradiciones (supra párr. 129). (...) Las consultas deben realizarse de buena fe, a través de procedimientos culturalmente adecuados y deben tener como fin llegar a un acuerdo. Asimismo, se debe consultar con el pueblo Saramaka, de conformidad con sus propias tradiciones, en las primeras etapas del plan de desarrollo o inversión (...) El aviso temprano proporciona un tiempo para la discusión interna dentro de las comunidades y para brindar una adecuada respuesta al Estado. El Estado, asimismo, debe asegurarse que los miembros del pueblo Nombre14492 tengan conocimiento de los posibles riesgos, incluido los riesgos ambientales y de salubridad (...) Caso del Pueblo Nombre14492 vs. Surinam.
Sentencia del 28 de noviembre de 2007. (Excepciones Preliminares, Fondo, Reparaciones y Costas). Finalmente, respecto del carácter previo de la consulta, la Corte ha señalado que "(...) 181. Al respecto, el Comité de Expertos de la OIT ha establecido, al examinar una reclamación en que se alegaba el incumplimiento por Colombia del Convenio Nº 169 de la OIT, que el requisito de consulta previa implica que ésta debe llevarse a cabo antes de tomar la medida o realizar el proyecto que sea susceptible de afectar a las comunidades, incluyendo medidas legislativas y que las comunidades afectadas sean involucradas lo antes posible al proceso (...) 184. En este sentido, no ha sido controvertido que el Estado no realizó alguna forma de consulta con Nombre41947, en ninguna de las fases de ejecución de los actos de exploración petrolera y a través de sus propias instituciones y órganos de representación.
En particular, el Pueblo no fue consultado antes de que se construyeran helipuertos, se cavaran trochas, se sembraran explosivos o se destruyeran zonas de alto valor para su cultura y cosmovisión. (...)" PUEBLO INDíGENA KICHWA DE Nombre41947 VS. ECUADOR, SENTENCIA DE 27 DE JUNIO DE 2012, (Fondo y Reparaciones). Por todo lo expuesto, el Tribunal se inclina por acoger la pretensión que plantean las actoras, razón por la cual se ordena a la Nombre139474 y al ICE que, mientras no se haya efectuado la consulta indígena previa, libre e informada al pueblo indígena de Térraba ni se cuente con el instrumento de evaluación ambiental que corresponda según las actividades que se efectúen, se abstengan de adoptar cualquier conducta administrativa, ya sea referida a la fase de investigación o a la de inversión del PHD, que pueda afectar el medio ambiente o la biodiversidad de esa Reserva Indígena.
XII.Sobre la tercería sin pretensiones propias. El señor Nombre96534 formuló una tercería en la que no ejerció ninguna pretensión . Su participación se justificó en la supuesta posesión que ejercía sobre la finca No. 145342-000, inscrita en el partido de Puntarenas, inmueble que está dentro de la Reserva Indígena de Térraba y que, alegaba, el ICE arrendó en su momento para ingresar al sitio en el cual se llevó a cabo la fase investigativa del PHD. Analizados los motivos en los que el tercerista funda su gestión, el Tribunal estima que ésta debe ser rechazada de plano. En rigor, su participación pudo tener alguna relevancia para la demanda originalmente planteada por la ADI, en la que se pedía la nulidad del contrato suscrito entre el ICE y Nombre136636 . Pero en relación con las pretensiones de la tercería y su ampliación, no se observa que su interés guarde alguna relación ya que ninguna de las pretensiones que se formulan y las que han sido acogidas le afecta o incide de manera directa.
Así, respecto de su participación debemos declarar una falta de interés actual sobrevenida y rechazar de plano su gestión. Lo anterior hace innecesario que nos pronunciemos sobre las defensas que fueran alegadas por el apoderado del tercerista. En relación con las costas, deberá estarse al pronunciamiento que efectuaremos infra. Por la forma que se resuelve no tiene ninguna relación con el objeto de esta litis. Por ende, debe rechazarse la tercería interpuesta.
XIII.A modo de cierre. Sin lugar a dudas, la decisión de ejecutar o no un proyecto hidroeléctrico como el PHD le corresponde a la Administración activa. La función de este Tribunal se limitaría, únicamente , a controlar la legalidad de las actuaciones que en las diferentes fases para la ejecución del proyecto se efectúen. Y es en este marco que el Tribunal debe manifestar lo siguiente. De los testimonios evacuados es posible inferir que el PHD es necesario para que el país pueda enfrentar la crisis energética que podría presentarse en los años futuros. Además, que existen las condiciones requeridas para desarrollarlo. También es innegable el interés general en que se desarrolle ese tipo de proyectos hidroeléctricos, pero todo ello conforme al ordenamiento jurídico. Y precisamente en ese punto se han observado falencias que podrían frustar un proyecto de esa magnitud y relevancia. A modo de ejemplo, tenemos que se realizó una fase de investigación que supuso una cuantiosa inversión de recursos públicos.
De las probanzas ponderadas se advirtió que el ICE conocía desde que se rindieron los informes de INGETEC que debía efectuar la consulta indígena previa, libre e informada que exige el numeral 6 del Convenio 169 citado, a los pueblos indígenas que se verían afectados por el desarrollo y ejecución del PHD. Se trata de un aspecto que en todo caso, como deriva de una norma jurídica con rango superior a la ley, no debería ser desconocida para los operadores jurídicos del ICE. Hay también una línea definida y constante en la jurisprudencia de la Corte Interamericana de Derechos Humanos en relación con que esa consulta debe efectuarse desde las fases de planeación e investigación de los proyectos y no cuando éste ya se esté ejecutando. Pese a ello, el ICE omitió constatar que se cumpliera con esa condición ineludible en tutela de los derechos de las poblaciones indígenas involucradas. Efectuó actividades y labores de investigación geológica y obras de naturaleza constructiva asociadas a ésta sin que se hubiese cumplido con ese requerimiento y sin obtener los permisos, autorizaciones y concesiones que el ordenamiento jurídico exige para cada una de las actividades que efectuó en esa fase de investigación.
Si el proyecto se reanuda, debe ajustarse al ordenamiento jurídico. A efectos de que no se dé al traste con la inversión de recursos en la que se incurrió ni con la experiencia adquirida de la investigación ya realizada, la coyuntura actual exige que tanto el Estado como el ICE examinen sus actuaciones, retomen sus esfuerzos y valoren la necesidad de que, en atención al interés público entendiendo por tal la expresión de los intereses individuales coincidentes de los adminsitrados (artículo 113 de la LGAP) se decida si debe o no continuarse con la implementación del PHD. Si la respuesta fuera afirmativa, no cabe duda de que ello debe serlo en absoluto respeto del ordenamiento jurídico y de los derechos de las poblaciones indígenas que puedan ser afectadas con la investigación geológica, la inversión, el desarrollo y la ejecución del PHD. Se trata de un examen y una decisión que corresponde, en forma exclusiva e impostergable, al ICE y al Estado, cada uno dentro del marco de sus competencias; pero que reiteramos debe adoptarse con estricto apego al bloque de legalidad y orientada siempre hacia la satisfacción de los intereses de la colectividad.
XIV.Sobre las excepciones. El ICE no opuso ninguna excepción de fondo en la tercería, pero en la ampliación formuló una falta de derecho. Teniendo presente que la legitimación y el interés son presupuestos de fondo de la sentencia, cuyo análisis es, incluso, oficioso para los juzgadores; iniciaremos refiriéndonos a ambas condiciones. Para el Tribunal las señoras Nombre139472 cuentan con suficiente legitimación activa para formular esta acción, de conformidad con el artículo 10 del CPCA. Por una parte, alegan ser indígenas que habitan la Reserva Indígena de Térraba y por otra su acción se legitima en procura de la defensa del ambiente, existiendo en relación con la tutela de ese derecho una acción popular al tenor del artículo 50 de la Constitución Política. Por su parte, el ICE cuenta con la necesaria legitimación pasiva en tanto, conforme al numeral 12 del CPCA, es uno de los entes a los que se les imputa una serie de omisiones, específicamente relacionadas con una afectación del ambiente en la Reserva Indígena de Térraba con ocasión de la investigación y ejecución del PHD, y contra el cual se pide una serie de pretensiones de condena.
Asimismo, es evidente que el asunto reviste interés, en tanto lo que se alega son afectaciones al ambiente. La excepción de falta de derecho debe ser acogida parcialmente y solo en cuanto no resulta procedente ordenar una evaluación ambiental del PHD ni de inmediato ni únicamente en el territorio indígena de Térraba, así como que tampoco es procedente ordenarla mediante una Evaluación Ambiental Estratégica. También se acoge en cuanto es improcedente e innecesario ordenar que se adopte un Plan Remedial o Medidas Compensatorias porque no se ha demostrado la existencia de impactos o los daños ambientales en la Reserva Indígena de Térraba con ocasión a las actuaciones del ICE referidas al PHD. En lo demás se rechaza, en tanto es criterio de este Tribunal que debe ordenarse al ICE que, si decide, a corto, mediano o largo plazo, reabrir o retomar la fase de investigación geológico en el Sitio Térraba previo a la ejecución del PHD deberá iniciar el procedimiento de evaluación ambiental respectivo bajo la normativa vigente al momento de la presentación de su solicitud y que la Nombre139474 deberá definir el instrumento de evaluación ambiental que deba exigirse tomando en cuenta los parámetros que para efectos de esa clasificación establezca el ordenamiento jurídico, así como la significancia ambiental de las obras o actividades impactantes que se vayan a realizar.
Asimismo, el ICE deberá gestionar ante los entes y órganos competentes las autorizaciones o permisos que el ordenamiento jurídico exige para realizar actividades como la corta de árboles, movimiento de tierras, excavaciones, construcción de obras en cauce de río como diques o muros de gaviones. También, estimamos que es necesario fijar los límites al ejercicio de la potestad administrativa del ICE y ordenarle que, mientras no se haya efectuado la consulta indígena previa, libre e informada al pueblo indígena de Térraba ni se cuente con el instrumento de evaluación ambiental que corresponda según las actividades que se efectúen, deberá abstenerse de adoptar cualquier conducta administrativa, ya sea referida a la fase de investigación o a la de inversión del PHD, que pueda afectar el medio ambiente o la biodiversidad de esa Reserva Indígena. Por su parte, el Estado formuló las excepciones de falta de legitimación activa, la cual debe ser rechazada por las mismas razones expuestas supra respecto del ICE; falta de legitimación pasiva que debe, igualmente, ser rechazada toda vez que se reclaman omisiones del órgano competente en materia de evaluaciones ambientales y se pretende que se ordene al Estado conductas específicas y condenas concretas; y la falta de interés, la que también rechazamos por las razones indicadas supra.
La falta de derecho se acoge excepto en cuanto que se ordena a la Nombre139474 que en caso de que el ICE decidiera a corto, mediano o largo plazo retomar la fase de investigación del PHD, deberá definir el instrumento de evaluación ambiental que deba exigirse tomando en cuenta los parámetros que para efectos de esa clasificación establezca el ordenamiento jurídico, así como la significancia ambiental de las obras o actividades impactantes que se vayan a realizar; así como que mientras no se haya efectuado la consulta indígena previa, libre e informada al pueblo indígena de Térraba ni se cuente con el instrumento de evaluación ambiental que corresponda según las actividades que se efectúen, deberá abstenerse de adoptar cualquier conducta administrativa, ya sea referida a la fase de investigación o a la de inversión del PHD, que pueda afectar el medio ambiente o la biodiversidad de esa Reserva Indígena. En consecuencia, la demanda deber ser acogida parcialmente, en los términos ya expuestos.
XV.Sobre las costas. De conformidad con el numeral 193 del CPCA, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. Igual dispensa se impone cuando en el caso concurra el denominado plus petitio, sea, conforme lo estatuye el canon 194.1 del CPCA, cuando la diferencia entre lo reclamado y lo obtenido exceda del 15%, salvo que las bases de la demanda sean provisionales o su determinación dependa del arbitrio judicial o dictamen de peritos. En la especie, el Tribunal estima que este proceso debe terminarse sin especial condenatoria en costas por diversas razones. Primero, dado el vencimiento recíproco de las partes; pero además, atendiendo luego de la complejidad técnica y jurídica del asunto.
Se trata de un proceso que supuso una importante cantidad de audiencias y prueva que evacuar y valorar, así como que los temas involucrados obligaron a un amplio análisis. Adicionales, somos del criterio de que las posiciones vertidas por cada parte involucrada, tanto actoras como los demandados y el tercero que actuó sin pretensiones propias, reflejan buena fe y motivo suficiente para ejercitar la defensa de sus respectivas posiciones. En consecuencia, estima esta Cámara, por las razones expuestas, lo debido es resolver el presente asunto sin especial condenatoria en costas, como en efecto se hace.
POR TANTO
De oficio, se declara una falta de interés actual de la tercería sin pretensiones propias que formuló Nombre96534 y se rechaza de plano esa gestión. Se rechazan las defensas de falta de legitimación tanto activa como pasiva, así como la de falta de interés actual formuladas por el Instituto Costarricense de Electricidad y el Estado. Se acoge la defensa de falta de derecho opuesta por ambos demandados únicamente en cuanto no resulta procedente ordenar, de inmediato, una evaluación ambiental del Proyecto Hidroeléctrico El Diquís, ni únicamente para el territorio indígena de Térraba, así como que tampoco es procedente ordenarla mediante una Evaluación Ambiental Estratégica. También se acoge en cuanto es improcedente e innecesario ordenar que se adopte un Plan Remedial o Medidas Compensatorias porque no se ha demostrado la existencia de daños ambientales en la Reserva Indígena de Térraba con ocasión a las actuaciones del Instituto Costarricense de Electricidad ni del Estado referidas al Proyecto Hidroeléctrico El Diquís. En lo demás se rechaza. En consecuencia, se declara parcialmente con lugar la demanda en los siguientes términos, entendiéndose denegada en lo no concedido expresamente:
