En todo caso, si bien de conformidad con las regulaciones contenidas en los artículos 190 y siguientes de la Ley General de la Administración Pública, es admisible la reparación del daño futuro, según el artículo 196 Ibidem, el daño alegado habrá de ser cierto; real y efectivo, y no meramente eventual o hipotético y no puede estar fundado en realizaciones supuestas o conjeturales. RESULTS 1)- The amount in controversy having been set as unquantifiable, this action seeks a Judgment providing that: “(...) These Civil Proceedings against the Treasury be granted. - It be ordered that, should the documents submitted as evidence be challenged, their authentication by the party who signed them be permitted pursuant to Article 388 of the Código Procesal Civil.- Payment be awarded for the damages and losses (daños y perjuicios) caused as a direct and immediate consequence of the refusal by the (sic) Sistema Nacional de Áreas de Conservación, Área de Conservación: Cordillera Volcánica Central, subregión Grecia of MINAE, under resolution SRG/PP-106-2001, to authorize the (sic) removal of vegetation cover (cobertura vegetal) within the area approved and located by the surveyor of the Dirección de Geología y Minas for operation of the Mining Concession granted under resolution number: 458-200-MINAE, at thirteen hours on August 22, 2000.
And the following items be awarded: - Material damage (daño material) caused to our client’s assets in the amount of 544.373.270.00 (FIVE HUNDRED FORTY-FOUR MILLION THREE HUNDRED SEVENTY-THREE THOUSAND TWO HUNDRED SEVENTY COLONES AND NO CÉNTIMOS) be awarded. - The defendant be ordered to pay the procedural costs and attorneys’ fees (costas procesales y personales) of this matter. - Payment of the requested interest be awarded, based on INDEXATION (INDEXACIÓN), as set forth infra.” (Pages 45 to 53 of the principal case file) 2)- The defendant opposed the complaint, raising the defenses of failure to exhaust administrative remedies (falta de agotamiento de la vía administrativa) and acquiescence in the administrative act (acto consentido) (pages 114 to 116), which were decided by interlocutory ruling (pages 158 to 160), and the defenses of lack of legal entitlement (falta de derecho) and the general defense sine actione agit. (Pages 132 to 144 of the principal case file).
3)- Attorney Amy Miranda Alvarado, Judge of the Juzgado Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial, in Judgment No.199-98, issued at nine thirty a.m. on February 29, 2008, ruled: “POR TANTO: The defenses of Lack of Legal Entitlement and Sine Actione Agit raised by the defendant are denied. The ordinary civil action against the Treasury brought by Maquinarias Mora de Fraijanes, Sociedad Anónima against the State is partially granted. The amount of exactly One hundred million colones is awarded against the State as material damages.- As compensation for losses, legal interest on the amount awarded is granted from the date this decision becomes final until payment in full.-Both categories of costs in this action shall be borne by the State.-” (Pages 310 to 333 of the principal case file) 4)- Being dissatisfied with the ruling, both the plaintiff and the defendant appealed. The appeals were admitted by a ruling of the Juzgado Contencioso Administrativo y Civil de Hacienda issued at nine twenty-seven a.m. on May 27, 2008, by virtue of which this appellate Court has jurisdiction. 5)- The Ninth Section of the Administrative Litigation Court issued Judgment No.19-2009 at ten thirty a.m. on February 27, 2009, partially reversing Judgment No.199-98, issued by the Juzgado Contencioso Administrativo y Civil de Hacienda at nine thirty a.m. on February 29, 2008. (Pages 361 to 386 of the principal case file).
6)- The First Chamber of the Supreme Court of Justice, by vote No.618-F-SI-2010, issued at nine fifteen a.m. on May 20, 2010, vacated the ruling issued by this Court. (Pages 494 to 500 of the principal case file).

CONSIDERING
I.The list of proven facts and the unproven fact contained in the trial judgment are affirmed because they accord with the merits of the record and are consistent with the supporting evidence cited therein.
In his statement of grounds for appeal, the State representative maintains that the trial Judgment was rendered contrary to law and to what the record shows. He states that the ruling improperly finds the State civilly liable and orders it to pay the plaintiff the sum of one hundred million colones, plus interest and litigation costs, while denying the defenses raised. According to the reasoning of the appealed judgment, a lack of coordination among various bodies of the Ministerio del Ambiente y Energía caused damages and losses to the plaintiff that must be compensated; in reaching that decision, the Court relied on the fact that the Administration should have warned the plaintiff that authorization to remove vegetation cover was required. That alleged omission, which gives rise to State liability, was set forth as the sole unproven fact included in Considering II. In his view, the Court erred for the following reasons: The alleged omission reverses the principle governing the burden of proof (carga probatoria) established in Article 317 of the Código Procesal Civil, because, since his client does not appear as the claimant in these proceedings, it is under no obligation to prove that it did in fact warn the plaintiff company.
He further states that, in any event, the defendant is an established materials-extraction company and was also partially operating the quarry in the area that had been “cleared,” which necessarily means that it knew in advance that it could not extract materials from the remainder without proper authorization to remove the forest. He also contends that the trial ruling violates the principle of legality established in Articles 11 of the Constitución Política and 11 of the Ley General de la Administración Pública, insofar as it requires various administrative bodies to exceed their statutory and regulatory powers. He states that, as established by law, many procedures must be followed before mining operations may begin and several stages must be completed in that administrative process, and it is not the Administration’s responsibility to guide the regulated party through those procedures, since the rights are set forth in the legal system and are available to citizens, who may decide whether or not to exercise them.
He asserts that the Administration had no obligation to provide the warning that the judgment improperly finds lacking and upon which the judgment against the State is based. He argues that the State bears no liability whatsoever and likewise has no obligation to compensate the plaintiff for damages and losses; therefore, the ruling must be reversed and the defense of lack of legal entitlement sustained. He states that the damages and losses claimed are wholly improper because, even in the hypothetical event of State liability—which he does not concede—the plaintiff cannot claim “what it did not earn” from what it failed to extract, since this amounts to nothing more than an expectation concerning a future and, moreover, uncertain event. He emphasizes the absence of a causal connection between the denial of the forest-removal permit and the profits not earned from mining operations, given that the trial ruling itself acknowledges in Considering VII that the forested area could not be exploited without violating Ley Forestal; therefore, the company was never genuinely able to exploit it and consequently could not have received the projected amounts.
Despite the foregoing, the challenged judgment awards the plaintiff one hundred million colones for material damage, as though it were non-pecuniary damage (daño moral) awarded in re ipsa. That award lacks a technical basis and is inconsistent, since the ruling states that the claimant never had a genuine opportunity to exploit the forested area and then proceeds to order the State to compensate nonexistent damages arising from the plaintiff’s inability to operate the mining concession. He states that the award is supported by no technical benchmark and no reasoning—reflecting a lack of grounds (falta de fundamentación)—that would justify it; the ruling simply sets an amount that the adjudicator deemed “reasonable,” although the alleged material damage cannot legally be determined in that manner. He states that there is no compensable item owed to the plaintiff, even if State liability were assumed, which does not exist.
The plaintiff never submitted relevant and conclusive evidence in the proceedings that would support its claim, and the State’s representative warned of the lack of evidence and the irrelevance of the evidence offered by the plaintiff company. He requests that the appealed judgment be reversed and that the defenses raised instead be sustained, the action be dismissed, and the plaintiff be ordered to pay costs.
In the briefs setting forth the grounds for appeal (folios 340 to 344 and 353 to 360 of the main case file), the plaintiff requests that the judgment under appeal be reversed because it is partially contrary to law insofar as it denied part of the relief sought, invoking, by way of summary and insofar as relevant to the resolution of the appeal filed, the following arguments: It states that it fully agrees with the judgment under appeal insofar as the lack of coordination among the various offices of the Ministerio de Ambiente y Energía caused damage to the plaintiff’s assets that it had no duty to bear and that the State is obligated to compensate. It likewise agrees with the trial judgment insofar as it was established that the plaintiff complied with each and every step imposed by MINAE in the procedure for obtaining the mining concession; consequently, the failure to obtain a permit for land-use change (cambio de uso de suelo) was not its responsibility, but rather resulted from the Administration’s own error, thereby excluding the exemption from liability asserted by the defendant on the basis of contributory fault of the injured party (culpa de la víctima).
It further states that the trial judgment is contradictory in finding that the concession was improperly granted because the forest area could not be exploited without violating the Ley Forestal, such that the plaintiff was never effectively able to exploit it and, therefore, to receive the projected amounts. In its view, that statement disregards the legal nature of the mining concession, which grants its holder an individual right (derecho subjetivo) from which arises the right to extract minerals in accordance with the terms established in Article 28 of the Código de Minería, whereas, from a technical standpoint, exploitation was feasible without violating the Ley Forestal. It further notes that the environmental impact study (estudio de impacto ambiental) contained an entire chapter entitled Environmental Management Plan (Plan de Gestión Ambiental), which set out the activities intended to mitigate and minimize adverse environmental impact, as well as protection, restoration, and monitoring work.
It considers the judgment under appeal mistaken in stating that work was carried out under the concession, because the quarry’s (tajo) operational phase was never formally commenced. It states that, in accordance with the environmental impact study, three development phases were established: construction, operation, and technical closure. The construction phase commenced and consisted of constructing and preparing the infrastructure required for project operation (roads, an office and camper-type dining facility, processing plant, parking areas, and latrine). It also included part of the removal of vegetation cover (cobertura vegetal), soil, and overburden required to expose the deposit to be exploited. Installation of basic services (water, electricity, telephone), delineation of stockpiling areas, designation of waste-disposal locations, road rehabilitation, and construction of drainage systems for the discharge of surface water (pages 6 and 7 of the Environmental Impact Study).
It was never possible to proceed to the operational phase, or even to complete the construction phase, because a sine qua non requirement for proceeding to the operational phase and commencing exploitation of the quarry was the removal of the vegetation cover (clearing [destape]), which could not be carried out because the corresponding permit had not been granted. Submission of reports by the professionals responsible for the quarry was an obligation assumed by the plaintiff in response to a requirement contained in the decision approving the concession, and does not imply that the operational phase was underway. It states that it agrees with the judgment under appeal insofar as it indicates that the plaintiff had obtained the right to exploit the mining concession and not merely an expectancy. It considers the judgment under appeal mistaken in stating that the term for exploiting the concession was limited to 6 years, ending in abril del 2006, when it was in fact granted for a period of eight years under resolution R-458-2000 MINAE, which granted the mining concession and was signed by the Presidente de la República and the Ministra del ramo.
The lease agreement (contrato de arrendamiento) for the property where the plaintiff intended to operate the quarry was originally executed for a period of 10 years from its signing on 30 de abril de 1996; due to the excessive number of procedures and requirements, the review for granting the concession lasted more than 4 years (it began on 23 de setiembre de 1997), and the concession was not favorably decided until 3 de abril del 2001. It states that this was not a situation dependent upon the plaintiff’s actions and therefore cannot be attributed to it. It argues that the judgment under appeal errs in asserting that, when the denial was upheld, the plaintiff had secured an operating agreement for a term of 6 years, since the concession was granted for a term of 8 years, not 6, and the lease agreement was for a period of 10 years, not six. In its view, it would therefore be unlawful to transfer to the plaintiff—which timely complied with all the Administration’s requirements—the adverse effects of the pathological delay arising from inefficient and ineffective administrative management.
Reducing the amount of compensation to a term different from that granted by the concession, a matter within the Administration’s authority, would reward the Administration’s inefficiency at the expense of a litigant entitled to an efficient State and to full compensation for the damages and losses directly and immediately caused by improper and deficient administrative management. It states that, to date, all environmental commitments undertaken by the plaintiff when the requirements for approval of the environmental impact study were established continue to be fulfilled. It argues that it disagrees with the trial judgment insofar as it finds that the plaintiff’s claims concern expectations that are not real. The damages and losses (daños y perjuicios) arise from the inability to exploit the mining concession, which conferred an acquired right (derecho adquirido), not a mere expectancy of a right; the inability to exercise and exploit the concession therefore generated actual damages and losses—not contingent damages, but future damages that are real, actual, quantifiable, and compensable—which were technically established through the expert opinion (experticia) submitted in the case by Licenciada Laura Álvarez Corella, Contadora Pública, who determined that the compensation payable by the State for the damages and losses caused to the plaintiff as of 31 de enero del 2006 amounts to ochocientos cincuenta y ocho millones cuatrocientos veintinueve mil setecientos cuarenta y cuatro colones.
It maintains that the trial judge, without stating the reasons or the measurement criteria on which she relied and departing from the expert evidence (pericial), found that cien millones de colones covered the investment made by the plaintiff plus compensation for the damage caused. It disagrees with that amount because, in its view, it does not reflect the actual damages and losses caused; accordingly, that judgment must be brought into conformity with the law and full compensation must be granted on the basis of objective measurement criteria and the evidence contained in the case file, considering that, to date, more than 11 years have elapsed since the proceedings before MINAE began and the corresponding monetary outlay was made. It states that the trial judgment fails to rule on the timely request for indexation (indexación), and therefore requests that this omission be corrected. It states that the judgment under appeal errs insofar as it awarded as losses only future lost profits (lucro cesante futuro) (the loss sustained between the date of the judgment and the date on which the financial obligation giving rise to the compensation ends), excluding recognition of accrued or past-due lost profits (lucro cesante consolidado o vencido) (the loss of profit or gain sustained by the plaintiff’s assets as a result of deficient administrative action, from the date on which the land-use change permit was denied until the judgment imposing the obligation to compensate for damages and losses—that is, the net profits that the plaintiff failed to receive as a consequence of exploiting the mining concession).
It requests that the judgment under appeal be reversed insofar as relief was not granted, that the complaint be upheld in all respects, and that full compensation be awarded commensurate with the damages and losses caused to the plaintiff.
Pursuant to the strict administrative liability regime (régimen objetivo de responsabilidad administrativa) established in the Constitución Política de la República (Articles 9, first paragraph, 11, 18, 33, 34, 41, 45, 49 first paragraph, 139 subsection 4), 140 subsection 8), 148, 188 and 191) and the provisions contained in Articles 190 et seq. and related provisions of the Ley General de la Administración Pública, the Administration shall be liable for all damage caused by its lawful, unlawful, normal, or abnormal operation, except in cases of force majeure, fault of the victim, or an act of a third party. The lawfulness or unlawfulness of the Administration’s operation refers basically to legal conduct, whereas normality or abnormality refers primarily (though not exclusively) to material or technical conduct, represented, among other things, by the service-provision activity attributed to the State.
As stated by the Sala Primera de la Corte Suprema de Justicia in Judgment No. 000584-F-2005 of diez horas cuarenta minutos del once de agosto del 2005, abnormality concerns administrative conduct that, in itself, departs from sound administration (buena administración) (in accordance with the concept used by the Ley General de la Administración Pública in Article 102, subsection d), which includes, among other things, effectiveness and efficiency), from proper organization, or from the technical or scientific standards of expertise and prudent performance in carrying out its actions. Abnormality may manifest itself through malfunction, delayed operation, or a complete failure to operate. The Public Administration is also liable for damages caused by its administrative inaction (inactividad administrativa). Such passivity in fulfilling preexisting obligations is characterized, for purposes of non-contractual civil liability (responsabilidad civil extracontractual), as abnormal operation (insofar as it relates to a required material activity and unlawful conduct), to the extent that the failure to perform what is required contravenes the rules of sound administration or fails to exercise the functional administrative powers arising from the legal system.
In all cases, a finding of liability is subject to the existence of a causal link (nexo de causalidad) between the administrative conduct and the damage caused, which must be certain, actual, assessable, compensable, and not conjectural. Likewise, as stated in section 194.2 of the cited law, the Administration shall be liable for its lawful acts and normal operation when they cause special damage to the rights of the administered party (administrado), due to the small proportion of persons affected or the exceptional severity of the injury (no-fault liability or liability for special sacrifice (responsabilidad sin falta o por sacrificio especial)); in such a case, compensation must cover the value of the damage at the time of payment, but not lost profits (lucro cesante). In this regard and concerning the Public Administration’s liability regime, the Sección Sexta of this Tribunal has held as follows: “(....) ‘VI.-) STRICT LIABILITY OF THE PUBLIC ADMINISTRATION (RESPONSABILIDAD OBJETIVA DE LA ADMINISTRACIÓN PUBLICA): The liability of the Public Administration has its constitutional basis in Articles 9 and 41 of the Constitución Política, insofar as they provide as follows: “Article 9º—The Government of the Republic is popular, representative, participatory, alternating, and accountable.
It is exercised by the people and by three distinct Powers that are mutually independent: the Legislative, the Executive, and the Judicial.” (Emphasis added) “ARTICLE 41.- By resorting to the laws, everyone shall obtain redress for injuries or damage suffered to their person, property, or moral interests. Justice must be administered promptly and fully, without denial and in strict accordance with the laws.” Based on these constitutional provisions, since 1978 the Ley General de la Administración Pública has distinguished between two types of administrative activity giving rise to liability: first, the unlawful or abnormal activity of the Administration, insofar as it entails a violation of the legal system. In this regard, Articles 190, 191, and 192 of the Ley General de la Administración Pública provide as follows: “1 The Administration shall be liable for all damage caused by its lawful or unlawful, normal or abnormal operation, except in cases of force majeure, fault of the victim, or an act of a third party. 2.
The Administration shall be liable in accordance with this Article even when it cannot be held liable under the following sections of this Chapter; liability for a lawful act or normal operation, however, shall arise only under the terms of the following Third Section.” “The Administration must repair all damage caused to the subjective rights (derechos subjetivos) of others by misconduct of its personnel committed during the performance of their official duties or in connection therewith, using the opportunities or means provided by the office, even when undertaken for purposes, activities, or acts unrelated to that function.” “The Administration shall also be liable under the foregoing conditions when it extinguishes or restricts subjective rights by unlawfully exercising its powers for that purpose.” The unlawfulness of the conduct is linked to noncompliance with administrative rules, whereas abnormality arises from its material activity or provision of services.
In all cases, liability for this type of conduct is closely linked to the concept of service failure (falta de servicio) as an indispensable condition. Such service failure is defined as follows: “... any breach of preexisting administrative obligations, which brings into consideration the legal, technical, and scientific standards or criteria that public administrations must observe.” In accordance with the foregoing, a service failure may occur through the delayed or defective provision of a public service, the omission to provide a public service, the issuance of an unlawful or invalid administrative act (acto administrativo), or the omission of essential formalities in issuing an administrative act. Second, there is liability for lawful conduct and normal operation, pursuant to Article 194 of the Ley General, insofar as it provides: “1. The Administration shall be liable for its lawful acts and normal operation when they cause special damage to the rights of the administered party, due to the small proportion of persons affected or the exceptional severity of the injury. 2.
In this case, compensation must cover the value of the damage at the time of payment, but not lost profits. 3. The State shall be liable for damage directly caused by a law when such damage is special within the meaning of this Article.” With respect to the characteristics of the damage for both types of liability, the Ley General de la Administración Pública states: “In all cases, the alleged damage must be actual, assessable, and attributable to an individual or group.” “Liability may arise for damage to purely moral interests, as well as for emotional suffering and physical pain caused, respectively, by death or injury.” “The right to claim compensation from the Administration shall be subject to a four-year limitation period (prescribirá), counted from the event that gave rise to liability. The right to claim compensation from public servants shall be subject to a four-year limitation period from the date on which the harmful event became known.” Regarding the scope of the Administration’s liability, the Sala Primera de la Corte Suprema de Justicia, in its decision 000074-F-2007 of diez horas quince minutos del dos de febrero del dos mil siete, held: “... the financial (not civil) and non-contractual liability of the Public Administration falls within a predominantly strict-liability regime, grounded both in risk theory and in maintaining equilibrium in the financial equation.
Its essential purpose is to provide compensatory redress to a person who has suffered an injury attributable to a public organization acting as a center of authority. This purposive approach, in turn, fully transforms the central focus of liability itself, because it abandons analytical examination of the party who caused the damage and the characterization of that party’s conduct, and instead adopts the position of the victim, whose legal position has been impaired and who is relieved of proving any subjective criterion concerning the public agent involved (except insofar as the agent’s personal liability is concerned). This undoubtedly produces a radical shift in the approach to its underlying basis, because the State is liable whenever the victim has no duty to bear the damage, whether financial or non-financial in nature. From that point onward, the reversal of the doctrine’s components and effects is evident.
Both the essential prerequisites and the burden of proof acquire a new complexion, freeing the affected person from substantive as well as procedural constraints and placing upon the Administration the obligation to rebut the allegations and facts attributed to it. Within this framework, the markedly strict nature of liability dispenses with the analysis of subjective and individual factors concerning the agent who caused the damage when determining entitlement to reparation, shifting the focus to the injured party. When an injury has been suffered as a consequence of public conduct, whether by act or omission, which the injured party has no duty to bear, a duty to provide redress arises by virtue of the principle of full reparation (principio de reparación integral del daño) derived from section 41 of the Constitución Política. To the same effect, among many others, reference may be made to this Chamber’s judgments numbers 138 of 15 horas 5 minutos del 23 de agosto; 192 of 14 horas 15 minutos del 6 de noviembre, both from 1991; 48 of 14 horas 10 minutos del 29 de mayo de 1996 and 55 of 14 horas treinta minutos del 4 de julio de 1997.) In light of those precedents, and as the Tribunal correctly held, the Legal System, beginning with the Ley General de la Administración Pública, adopts, as stated, a predominantly strict-liability system.
Accordingly, the existence—and therefore proof—of intent or fault, or generally of a subjective breach attributable to public servants or officials, is unnecessary for the duty to compensate for damages caused by its operation to arise. Thus, section 190 of that body of law states with complete clarity that the State is liable for its lawful or unlawful, normal or abnormal operation, unless the exculpatory grounds exhaustively and expressly set out in that same provision are present in the specific case, namely force majeure, fault of the victim, and an act of a third party, with the burden falling upon the Administration to prove their existence. Judgments no. 589-F-99 of 14 horas 20 minutos del primero de octubre de 1999 and no. 252-F-01 of 16 horas 15 minutos del 28 de marzo del 2001, issued by this same Chamber, may be consulted. Along the same lines, section 194.3 of that same body of law establishes the legal foundations for the liability of the Legislative State (responsabilidad del Estado Legislador).
Sections 9, 11, 33, 41, and 154, all of the Carta Magna, constitute the basis and foundation for the liability of the Judicial State (responsabilidad del Estado Juez) for judicial error, or for the abnormal or unlawful operation of the judicial function.
Hence, the State cannot claim “impunity” on the ground that there is no statutory framework governing its liability, since that liability is established as a matter of principle within the constitutional framework; to hold otherwise would also violate legal certainty, the principle of equality, and the control of arbitrariness by public authorities. Viewed in this light, recognition of such liability is not contingent upon the existence of a statutory mandate regulating it. The aforementioned liability is governed by the provisions of the Fundamental Charter, that is, it constitutes a constitutionally grounded principle imposed by the cited provisions, which seeks to oversee the exercise of every function and form of conduct of the State in any of its spheres, as well as to protect the rights and interests of litigants. V.—Legal Attribution Parameters. Abnormal Operation (funcionamiento anormal).
Given the particular features of Public Administration liability, arising through its gradual evolution, as well as the objective nature it has attained, with a clear constitutional basis, it cannot be construed as an unrestricted and permanent duty to compensate, applicable invariably and to every instance of injury. A regime of that nature would be unheard of and materially unsustainable for any State with limited financial resources. Attribution criteria (criterios de imputación) have therefore been used to delimit, within that objective framework, the duty to compensate arising from public conduct. Accordingly, it may be stated that the national regime is one of objectively moderated financial liability (responsabilidad patrimonial) of the Public Administration, insofar as it does not dispense with attribution parameters or criteria, particularly with regard to abnormality and unlawfulness, through which, in one way or another, the conduct of the public apparatus is assessed and characterized.
These criteria are broader and different from fraud (dolo) and negligence (culpa), which are traditionally used in ordinary law; nevertheless, they still constitute attribution criteria that distance this institution from a mere automatic transfer of assets, without any assessment of the administrative conduct undertaken. Thus, section 190 of our Ley General de la Administración Pública refers to lawful or unlawful, normal or abnormal operation, where lawfulness or its antithesis refers essentially to the Administration’s legal conduct, while normality or abnormality refers primarily, though not exclusively, to the Administration’s material conduct, represented, among other things, by the provision of services attributed to the State as part of the social role also assigned to it in pursuit of the collective welfare. Note how Article 194 of the cited law refers to lawful acts, understood as legal activity, distinguishing them in the same provision from what it characterizes as normal operation, understood as material activity.
Accordingly, abnormality concerns administrative conduct that, in itself, departs from sound administration (in accordance with the concept used by the Ley General itself in Article 102(d), which includes, among other things, effectiveness and efficiency), from proper organization, from technical rules, or from the expertise and prudent performance required in carrying out its actions, thereby causing injury to the person. This makes it possible to state that abnormality may take the form of malfunctioning, delayed operation, or a complete failure to operate. Abnormality and unlawfulness must therefore not be treated as equivalent concepts, not even with respect to the situation in which operation, although proper or compliant with the aforementioned rules, produces a harmful result, referred to by some legal scholars as abnormal operation by reason of its result; in such a case, liability instead arises from normal operation having a harmful effect or result, which is compensable, of course, provided that the requirements expressly established in advance by the Legal System are met (see Article 194 of the Ley General de la Administración Pública).
Nor should abnormal operation and its illegitimacy be confused with the general, underlying wrongfulness (antijuricidad) essential to any civil remedy. Civil liability arises from wrongfulness, which in turn constitutes its basis (sometimes derived from a positive rule and, at other times, from the basic principle embodied in the duty not to harm another); in this particular area, it takes concrete form in the absence of a duty to bear the harm. Thus, if the victim has no duty to bear the harm, understood as the final, depriving consequence of public conduct, it is because the Administration was required to prevent it or, otherwise and under certain circumstances, to assume the remedial consequences of harm that it could not prevent, whether because it was unforeseeable or unavoidable. The contrary therefore constitutes a breach of the duty to preserve the person’s assets from harm, and to that extent the impairment of the victim’s legal sphere must be deemed wrongful and, consequently, subject to mandatory reparation.
Accordingly, it may be stated that only harm which, when assessed against the Legal System as a whole, may be deemed fundamentally wrongful is compensable; to hold otherwise would mean awarding compensation for a harmful act in response to an impairment that the Legal System does not condemn and that, on the contrary, it tolerates and accepts as normal and justified. It must therefore be reiterated that, for a legally required remedy to exist, there must be antecedent and underlying wrongfulness, which in no way concerns the nature—lawful or unlawful—of the conduct undertaken by the agent who caused the harm, or the result produced by that act or omission. Indeed, even in cases of lawful and normal operation, in which the conduct itself is not unlawful, a harmful consequence may occur which, if it possesses certain characteristics—exceptional intensity or a small proportion of affected persons—is deemed subject to mandatory reparation, which demonstrates its wrongfulness to such an extent that the financial obligation and the corresponding right of action arise upon the injury itself.
It may therefore be maintained that the underlying wrongfulness referred to as the foundation and indispensable general prerequisite for liability is separate and independent from the attribution parameter used by the Legal System, because even under an objective liability regime—which excludes the subjective elements of negligence and fraud in favor of a simple economic transfer intended to restore the imbalance created in the equal distribution of public burdens, section 194 of the Ley General de la Administración Pública—wrongfulness exists insofar as the rule declares the obligation to exist on the implicit premise of an injury contrary to law that the victim should not be required to bear. That repeatedly mentioned wrongfulness will always be present in compensable harm, whether arising from normal or abnormal, lawful or unlawful operation. In any event, those four attribution criteria used by the Ley General de la Administración Pública in Article 190 must be deemed constitutionally protected and supported, insofar as they give concrete effect to the delegation made by the constituent authority to the ordinary legislature in section 41 (“by resorting to the laws”) and implement the effective judicial protection guaranteed by the Constitution.
That being so, it must be concluded that such criteria apply to the financial liability of every public authority, whether administrative, legislative, or judicial.” In accordance with the foregoing, it is evident that administrative liability is objective par excellence; that is, it may be established on the basis of either lawful or unlawful conduct, without reference to the subjective criteria of negligence or fraud. What is relevant, therefore, is proof of the existence of harm linked by a causal connection (nexo de causalidad) to a public administration. Regarding the characteristics that such harm must possess in order to be compensable, the First Chamber of Cassation stated in Judgment No. 14, issued at 16 hours on March 2, 1993: “Harm, in the legal sense, consists of any impairment, loss, or detriment to the financial or non-financial legal sphere of a person (the injured party), resulting in the deprivation of a legal interest whose preservation could objectively have been expected had the harmful event not occurred.
Under this approach, there is no civil liability without harm, just as there is no harm without an injured party. Furthermore, only harm that is proven—its reality or existence—is compensable, this being a question of fact entrusted to the sound discretion of the adjudicator. In short, harm is the detrimental gap suffered by the victim, resulting from a comparison between the situation before the unlawful act and the situation afterward.(...) Harm constitutes the loss inflicted upon the injured party, whereas consequential loss (perjuicio) consists of the profit or benefit lost or not received (loss of profits (lucro cesante)), which could reasonably and probably have been expected had the unlawful act not occurred. (...) Not every harm gives rise to an obligation to provide compensation: For that purpose, the following characteristics must essentially coincide for harm to be compensable: A) it must be certain, real, and actual, rather than merely contingent or hypothetical, and it cannot be based on supposed or conjectural outcomes.
Harm does not lose this characteristic if its quantification is uncertain, undetermined, or difficult to assess or prove; nor should certainty be confused with present occurrence, since compensation for certain but future harm is permissible. Likewise, future harm should not be confused with loss of profits or consequential loss, since the former refers to harm that arises as a necessary consequence of the event causing or generating the harm, that is, where its repercussions have not yet materialized when the proceeding is commenced. As regards the magnitude or amount—the seriousness—of the harm, that is a matter solely within the subjective concern of the injured party; however, the law cannot entertain claims based on insignificant harm arising from excessive sensitivity. B) There must be injury to a legally relevant interest deserving of protection. There may therefore be a directly injured party and an indirectly injured party: the former is the victim of the harmful event, and the latter consists of the victim’s successors.
C). It must have been caused by a third party and must remain uncompensated; that is, if it has been remedied by the responsible party or by a third party, it no longer subsists. D) There must be a causal relationship between the unlawful act and the harm.” Analysis of the foregoing considerations as applied to the specific case makes it possible to determine whether a particular claim should be granted where the relevant party proves the existence of harm caused by the Administration’s abnormal or unlawful operation, regardless of whether the public servant responsible for it can be identified or whether that servant acted fraudulently or negligently. In the matter under analysis, this last subjective consideration is irrelevant for purposes of determining the Administration’s liability, since our legal system is oriented toward recognition of the duty to compensate when an illegitimate or abnormal act or omission by the Administration—except where liability for lawful conduct applies—causes harm having an actual causal connection to that act or omission.
This is the analysis that the adjudicator must conduct with respect to the conduct at issue in the proceedings, in order to determine whether a particular argument supporting an award of compensation should be accepted. (Tribunal Contencioso Administrativo, Sección Sexta No. 022-2008 at 10:30 on May 23, 2008). In this case, for the reasons set forth below, the claim brought by the plaintiff cannot be upheld in the judgment, since the challenged act (the denial of authorization to remove forest cover (cobertura boscosa)) constitutes a lawful and normal act, and the income not received constitutes damages in the form of lost profits (lucro cesante) that cannot be awarded, pursuant to the express provision of Article 194 of the Ley General de la Administración Pública. Furthermore, even if the Administration’s conduct were deemed unlawful or abnormal, the damages claimed constitute a future but uncertain event and therefore, under the current administrative liability regime (régimen de responsabilidad administrativa), could not be awarded in the judgment, all as detailed in the following recitals (considerandos).
The arguments made by the State’s representative concerning the impropriety of the pecuniary damages awarded in the Judgment and the impossibility of awarding the claimant the amount established in the expert appraisal submitted in the record as damages are well-founded. As pecuniary damages (daño material), the trial judge awarded the plaintiff the sum of one hundred million colones, limiting the quantification of such damages to the profits that the claimant would have received had the quarry been operated, but restricted to 6 years, considering that the Lease Agreement entered into by the claimant with the company owning the property for extraction from the quarry was valid until 30 de abril del 2006. The trial judge found that this sum covered the investment made by the plaintiff Company, plus compensation for the harm caused to it by the lengthy proceedings to which it was subjected.
As the State’s representative indicates, the challenged ruling is inconsistent and grants ultra petita relief (ultrapetita), insofar as it awards an amount for pecuniary damages based on a prudent assessment, disregarding the fact that pecuniary damages must be proven and that there is a legal bar to awarding this type of damages “in re ipsa” or at the judge’s sound discretion, since that possibility is established for the purpose of determining subjective non-pecuniary damages (daño moral subjetivo). Furthermore, the record contains no technical basis for the trial judge’s quantification of the pecuniary damages awarded; accordingly, as to the recognition of this item, the trial judgment must be reversed.
The plaintiff bases its claim on the irregularity and unlawfulness of the decision issued by the Grecia Sub-Regional Office denying the removal of forest cover (cobertura boscosa), which resulted in the de facto revocation of the administrative real right (derecho real administrativo) granted to the claimant through the mining concession (concesión de explotación minera), because that decision makes it impossible to exercise the right granted under the Concession. In its view, the challenged administrative action constitutes an irregular and unlawful act giving rise to the State’s obligation to compensate for the damages caused by that action, in this case limited to the amounts of lost income, totaling ¢544.363.270.00. Based on a detailed analysis of the record, this Chamber endorses the trial Judge’s findings concerning the existence of administrative conduct contrary to the principles governing public services in the processing of the claimant’s mining concession, because when the Environmental Impact Study (Estudio de Impacto Ambiental) was approved, the plaintiff was not advised that the forest layer could not be removed, even though such removal was necessary for authorization of the mining concession.
Indeed, as established by the First Chamber in Judgment No.584-2005, issued at 10:40 hours on 11 de agosto del 2005, under the rules set forth in Articles 139 subsection 4), 140 subsection 8), and 191 of the Political Constitution, interpreted a contrario sensu, persons subject to the Administration have a fundamental right to the proper functioning of public services, which imposes upon public entities the obligation to comply with the principles of efficiency and effectiveness in exercising their powers and providing public services. In accordance with the principles of efficiency and legal certainty (seguridad jurídica), persons subject to the Administration must know in advance the requirements imposed by administrative authorities for carrying out the various procedures and obtaining the various authorizations, in this case for the granting of a mining concession, the requirements for which are clearly set forth in the Mining Code (Código de Minería), enacted by Law No. 6797 of 4 de octubre de 1982, as amended.
The activities of public entities must be subject to the public-service principles of continuity, efficiency, and adaptation to all changes, pursuant to Article 4 of the General Law of Public Administration (Ley General de la Administración Pública). In this case, there was clearly a lack of coordination among the various divisions of the Ministerio de Ambiente y Energía (Dirección de Geología y Minas, Secretaría Técnica Nacional Ambiental, and Área de Conservación de la Cordillera Volcánica Central).
VII.The plaintiff complied with all the requirements imposed by MINAE for the granting of the Concession, and neither the terms under which SETENA authorized the Environmental Impact Study nor those under which the Concession was authorized imposed upon the plaintiff the condition that it apply to the Área de Conservación for the removal of the forested surface. This Court finds it contrary to the principles of logic and efficiency that SETENA failed to advise, when approving the Environmental Impact Study, of the need to obtain authorization to remove the forest layer, because, as shown by the plans submitted by the claimant, it was evident that approximately 60% of the Concession Area was covered by forest. As stated by the expert Nombre149350 (folios 178 to 191 of the main record), the Technical Closure Program (Programa de Cierre Técnico) that the plaintiff was required to submit to MINAE encompasses the measures to be taken to ensure the stable configuration of the topography resulting from extraction and the activities to be carried out for the future regeneration of vegetation cover (cobertura vegetal), the design for managing runoff and the erosion rate upon completion of extraction, as well as reforestation and vegetation-cover regeneration programs.
This demonstrates that the administrative record contained sufficient information for the officials responsible for reviewing the concession and SETENA personnel to have recognized that granting the mining concession requested by the plaintiff necessarily required authorization to remove the vegetation layer (capa vegetal). The Environmental Impact Study authorized by SETENA for the claimant should have considered this issue, which is a fundamental basis for approving such a study, but it did not do so. This constitutes the irregular administrative conduct identified by this Court; nevertheless, that conduct is not at issue in this litigation. Indeed, as established by Article 2 of the Mining Code, the Environmental Impact Study constitutes a comparative, technical, economic, social, cultural, financial, legal, and multidisciplinary analysis of a project’s effects on the environment, as well as a proposal of measures and actions to prevent, correct, or minimize such effects.
It is a decision-making instrument within the legal-administrative sphere that governs the assessment of the impact of various activities on the environment and for which operational and functional responsibility rests with the Secretaría Técnica Nacional Ambiental (SETENA), an agency with maximum administrative autonomy (organismo de desconcentración máxima) attached to the formerly named Ministerio de Ambiente y Energía (MINAE). Article 106 subsection a) of the Mining Code, in turn, provides that the environmental impact analysis (análisis de impacto ambiental) of mining activity shall include, among other matters, the effects on vegetation and the areas that will be affected by the activity. It is clear to this Court that, pursuant to the powers granted both by the Mining Code and by its enabling law, SETENA was responsible for establishing the necessary coordination with the Sistema Nacional de Áreas de Conservación and the Dirección de Geología y Minas in order to study the effects on the vegetation and the areas that would be deforested by the plaintiff’s activities, as a prerequisite for authorizing the Environmental Impact Study and, consequently, as a prerequisite for recommending that the concession be granted to the claimant.
The work of the Secretaría Técnica Nacional Ambiental must be coordinated and effective in relation to the other divisions of MINAE. The position maintained by the State’s representative regarding the existence of separate functional powers among the various divisions of that Ministry is unpersuasive, as is the assertion that, in this case, the victim’s fault constitutes a defense excluding liability (eximente de responsabilidad por culpa de la víctima). Likewise, the grievance raised by the State’s representative concerning an alleged reversal of the burden of proof (carga probatoria) in the matter under review and the violation of Article 317 of the Code of Civil Procedure (Código Procesal Civil) is unfounded, as are the arguments that, because the plaintiff was an established materials-extraction company, it should have known that compliance with the land-use change (cambio de uso de suelo) requirement was essential for the granted concession to become valid or effective.
Although the plaintiff company could not claim ignorance of that legal requirement under Article 129 of the Political Constitution, this does not cure the aforementioned State omission when the Environmental Impact Study was approved. Nor does this Chamber find a violation of the principle of legality (principio de legalidad) established in Articles 11 of the Political Constitution and 11 of the General Law of Public Administration, because the Administration’s duty to observe the principles of efficiency and effectiveness requires it to maintain constant interagency coordination (coordinación interorgánica), without this entailing disregard for the specific powers of each body comprising the public-sector structure.
VIII.As stated in the preceding Recitals (Considerandos), although the Administration acted irregularly in processing the approval of the Environmental Impact Study, contrary to the principles governing public services, by failing to advise the plaintiff of the need to obtain authorization from the appropriate office for the removal of forest cover, that omission is not challenged in this proceeding and therefore cannot support the claimant’s cause of action. Indeed, the plaintiff seeks compensation for the damages caused as an immediate and direct consequence of the refusal by the Grecia Sub-Region office of the Sistema Nacional de Áreas de Conservación to authorize the removal of vegetation cover within the area approved under the mining concession granted to the claimant, rather than for the omission in the process of obtaining the Concession. Accordingly, and contrary to the appellant’s argument, the denial by the Grecia Sub-Regional Office of authorization to remove the forest cover (clearing [destape]) constitutes lawful and proper administrative action, duly supported by the technical opinion issued by MINAE officials (Inspection Report No. Placa29897), which determined that authorization to remove the vegetation cover was legally impermissible because the area where the mining operations were to be conducted constituted a forest. Under the express provisions of Article 19 of the Ley Forestal, land-use change cannot legally be authorized under such circumstances, which precluded the issuance of the authorization.
IX.Although the denial of the permit for removal of forest cover (cobertura boscosa) constitutes a lawful act, pursuant to the provisions contained in article 194 of the General Public Administration Law (Ley General de la Administración Pública) and in the aforementioned Ley Forestal, the State would have the duty to compensate for the value of the damages caused by the administrative action, valued as of the time of payment, but not for lost profits (lucro cesante), by operation of law. This follows from the existence in this case of a special sacrifice (sacrificio especial) imposed upon the plaintiff, since it held a mining concession (concesión de explotación minera), which constitutes an act declaring rights in its favor, and the impossibility of removing the forest makes the exercise of that right impossible. In this case, the plaintiff states (folio 47) that the pecuniary damages (daños y perjuicios patrimoniales) claimed as a consequence of the challenged act consist of the material loss caused in the amount of ¢544.373.270.00, corresponding to the net profit not received during the eight-year term granted under the concession.
As is evident from the foregoing, although the plaintiff claims compensation for the damages caused, when specifying what they consist of, it limits its claim to recognition of the profits that did not enter its assets as a direct and immediate consequence of the challenged act, which amounts to recognition of lost profits or consequential loss (perjuicio); therefore, that item is not compensable, since under the cited statutory provision, where the Administration’s action is lawful and normal, the consequential losses caused by the administrative action could not be recognized, and thus the claim cannot be granted in the judgment.
X.In any event, although compensation for future damage (daño futuro) is admissible pursuant to the rules contained in articles 190 et seq. of the General Public Administration Law, under article 196 Ibidem the alleged damage must be certain, real, and actual, and not merely contingent or hypothetical, and it cannot be based on assumed or conjectural events. In this case, the consequential loss claimed by the plaintiff is based on mere expectations, since the projections of the potential net profits that the plaintiff might have received from operating the quarry during the term of the concession depend on a series of external variables, such as the market value of the material, demand for placement of the material with prospective purchasers, the existence of purchase contracts, and the actual possibilities of extraction. This Chamber considers that the concession cannot be regarded as having guaranteed that the plaintiff would receive those profits.
Similarly, the mathematical expert report (peritaje matemático) submitted in the proceedings by Mathematical Actuary Laura Alvarez Corella (folios 214 a 225) would not constitute suitable evidence to support the damages claimed by the plaintiff, because it is merely a projection of the net profits (earnings) that the plaintiff might have obtained had it operated the quarry according to the maximum probabilities of operation and extraction during the period from primero de junio del 2001 to 20 de octubre del 2008, which constitutes a future and uncertain event and is therefore not compensable, in accordance with the foregoing.
XI.Given the manner in which this matter is resolved, the plaintiff’s arguments that the appealed decision was mistaken in stating that the plaintiff performed work related to the concession have no bearing on the merits of the matter addressed in these proceedings and therefore cannot be accepted. Likewise, its arguments that the appealed decision was mistaken in stating that the concession’s operating term was limited to 6 years rather than 8 years, as established by the decision approving the concession, cannot be accepted. This is because, as stated in the preceding recitals (considerandos), there is no legal basis for recognizing in favor of the plaintiff the net profit that might have been generated from the possible sale of the material to be extracted from the quarry, even during the 6 years remaining under the Quarry Operation Agreement (Contrato de explotación de Tajo) entered into by the plaintiff with Hacienda Ganadera Poasito Sociedad Anónima; accordingly, the ground of appeal cannot be accepted.
XII.Regarding the plaintiff’s arguments concerning the trial judge’s failure to address the timely request for indexation (indexación), and that she excluded recognition of accrued or matured lost profits (lucro cesante consolidado o vencido), it must be stated that the ground of appeal cannot be accepted. Under the considerations set forth by this Court in the preceding Recitals, the plaintiff’s claim was limited to recognition of lost profits, which are not compensable in this matter pursuant to the provisions of article 194 of the General Public Administration Law; consequently, indexation of the amounts claimed cannot be recognized because there is no amount for which the plaintiff is to be compensated. The fact that the judge below (Jueza a-quo) omitted a ruling on the request for indexation does not constitute a defect warranting annulment of the judgment, since the request for indexation is an ancillary claim (pretensión accesoria), and because the principal claim—payment of the consequential losses claimed—was denied, the ancillary claim for indexation must also be denied. To hold otherwise would be to declare nullity for nullity’s own sake, contrary to the principles of effective judicial protection (tutela judicial efectiva), pro actione, and preservation of judgments (pro-sentencia); therefore, the ground of appeal cannot be accepted.
The trial judgment ordered the State to pay costs, finding no grounds for declining to apply the principle that costs are awarded against the losing party, established in article 221 of the Code of Civil Procedure (Código Procesal Civil), while the State’s representative seeks reversal of that award. In this case, this Chamber considers that sufficient grounds existed for litigation because of the nature of the issues debated and this Chamber’s partial reversal of the trial ruling; therefore, pursuant to the rules established in article 98 subsection c) of the Law Governing the Administrative Litigation Jurisdiction (Ley Reguladora de la Jurisdicción Contencioso-Administrativa), in conjunction with the provisions established in article 222 of the Code of Civil Procedure, applicable in this case by virtue of article 103 of the Law Governing this subject matter, the trial ruling must be reversed with respect to the award of costs against the State, and it is declared instead that this matter is decided without a special award of costs (sin especial condenatoria en costas).
In accordance with the considerations set forth, the challenged judgment must be reversed insofar as it ordered the State to pay the plaintiff the sum of one hundred million colones as material damages and to pay interest as consequential damages on the amount awarded, as well as with respect to the award of costs against the State. Instead, the defense of lack of a legal right (excepción de falta de derecho) raised by the State’s representative is sustained, and the complaint filed is dismissed. This matter is decided without a special award of costs.
POR TANTO
As to the matters appealed, the appeal filed by the State’s representation is granted, and the appeal filed by the plaintiff is denied. The challenged judgment is partially reversed and is affirmed insofar as it denied the defenses of lack of standing (falta de legitimación) and lack of interest (falta de interés). It is reversed insofar as it rejected the defense of lack of a legal right, which is hereby sustained, and insofar as it awarded costs against the State. The complaint is dismissed in all respects. FRANCISCO JIMÉNEZ VILLEGAS Nombre30512 JUDITH REYES CASTILLO Note of Judge Reyes Castillo I respectfully depart from the content of recitals VI, VII, and VIII of the judgment because, in my modest opinion, the concession is a complex act (acto complejo) that depends on a series of subsequent acts—for example, municipal permits, creation of easements (servidumbres), and technical studies, among others—in order to be implemented (articles 140, 145 of the General Public Administration Law, and 24 and 34 of the Mining Code (Código de Minería)). In the case under consideration, decision Nº R-458-2000-MINAE, point 12), clearly requires compliance with the recommendations of SETENA and the Mining Code. Moreover, decision Nº 211-2001 of nueve cuarenta horas del tres de abril de 2001, issued by SETENA, expressly establishes the possibility of ordering mandatory measures for the project. Accordingly, the lack of a permit to cut down or remove the forest constitutes an omission that deprives the concession act of enforceability (ejecutoriedad).
Consequently, there is neither unlawfulness nor abnormality in the Administration’s action—granting the concession—because it is unnecessary to include an express statement or warning regarding the subsequent procedures with which the concession holder must comply, particularly removal of the forested surface (article 19 of Ley Forestal Nº 7575), since these are statutory obligations of which private parties cannot claim ignorance, a prohibition having constitutional status (article 129). Nevertheless, I agree with the substance of the remaining considerations and, of course, with the operative portion (parte dispositiva).- JUDITH REYES CASTILLO

Proceso Ordinario Civil de Hacienda interpuesto por SERVICIOS DE MAQUINARIA MORA DE FRAIJANES SOCIEDAD ANÓNIMA, cédula de persona jurídica CED115929, representada por Nombre149348 , mayor, casado una vez, agricultor, vecino de Alajuela, portador de la cédula de identidad CED115930 y Nombre149349 , mayor, casado una vez, comerciante, vecino de Fraijanes, portador de la cédula de identidad CED115931, en su condición de apoderados generalísimos sin límite de suma contra EL ESTADO, representado por Nombre19952 , mayor, Abogado, cédula de identidad CED27483. RESULTANDO
1)- Que fijada la cuantía de este asunto como inestimable, la presente demanda es para que en Sentencia: " (...) Se declare con lugar el presente proceso Civil de Hacienda. - Se declare con lugar que en caso de impugnación de los documentos aportados como prueba, se permita su reconocimiento, por la parte que los suscribió, amparados en el artículo 388 del Código Procesal Civil.- Se declare con lugar el pago de los daños y perjuicios irrogados, como consecuencia directa e inmediata, de la negativa de la (sic) Sistema Nacional de Áreas de Conservación, Área de Conservación: Cordillera Volcánica Central, subregión Grecia del MINAE, según resolución SRG/PP-106-2001 de no autorizar del (sic) retiro de la cobertura vegetal, dentro del área aprobada y ubicada por el topógrafo de la Dirección de Geología y Minas; para la explotación de la Concesión de Explotación Minera otorgada según resolución número: 458-200-MINAE, de las trece horas del 22 de agosto del 2000.
Y se aprueben los siguientes rubros: -Se declare con lugar el perjuicio Material, causado al patrimonio de nuestra representada por la suma de 544.373.270.00 (QUINIENTOS CUARENTA Y CUATRO MILLONES TRESCIENTOS SETENTA Y TRES MIL DOSCIENTOS SETENTA COLONES SIN CÉNTIMOS) - Se condene al demandado al pago de las costas procesales y personales del presente asunto. - Se declare con lugar el pago de los intereses solicitados, teniendo como base la INDEXACIÓN, tal y como lo exponemos infra ." (Folios 45 a 53 del principal) 2)- El demandado contestó negativamente la demanda interponiendo las defensas de falta de agotamiento de la vía administrativa y acto consentido (folios 114 a 116), resueltas interlocutoriamente (folios 158 a 160) y las excepciones de falta de derecho y la genérica sine actione agit. (Folios 132 a 144 del principal).
3)-Que la Licenciada Amy Miranda Alvarado, Jueza del Juzgado Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial, en Sentencia No.199-98, dictada a las nueve horas y treinta minutos del veintinueve de febrero del dos mil ocho dispuso: "POR TANTO: Se rechazan las excepciones de Falta de Derecho y Sine Actione Agit interpuestas por la demandada. Se declara parcialmente con lugar la demanda ordinaria civil de hacienda interpuesta por la sociedad Maquinarias Mora de Fraijanes, Sociedad Anónima contra el Estado. Por concepto de daño material a cargo del Estado se concede la cantidad de Cien millones de colones exactos.- A título de perjuicios se le conceden intereses legales sobre la suma concedida a partir de la firmeza de esta resolución y hasta su efectivo pago.-Son a cargo del Estado ambas costas de esta acción.-". (Folios 310 a 333 del principal) 4)-Que inconformes con lo resuelto, apelaron el actor y el demandado, recursos que fueron admitidos mediante resolución del Juzgado Contencioso Administrativo y Civil de Hacienda dictada a las nueve horas y veintisiete minutos del veintisiete de mayo del dos mil ocho, en virtud de los cuáles conoce este Tribunal de alzada. (Folios 335 a 339 - 340 a 344 y 345 del principal).
5)- Que la Sección Novena del Tribunal Contencioso Administrativo, dictó la sentencia No.19-2009 de las diez horas treinta minutos del veintisiete de febrero del 2009, revocando parcialmente la sentencia No.199-98 dictada por el Juzgado Contencioso Administrativo y Civil de Hacienda a las nueve horas treinta minutos del 29 de febrero del 2008. (folios 361 a 386 del principal).
6)- Que la Sala Primera de la Corte Suprema de Justicia, mediante el voto No.618-F-SI-2010 dictada a las nueve horas quince minutos del 20 de mayo del 2010, anuló lo resuelto por éste Tribunal. (folios 494 a 500 del principal).
7)-Que en los procedimientos se han observado las prescripciones de ley y no se notan vicios u omisiones susceptibles de producir nulidad de lo actuado o indefensión de las partes, por lo que se procede a dictar el fallo de segundo grado dentro del plazo que permiten las labores del Despacho, previas las deliberaciones de rigor.

CONSIDERANDO
I.Se avala el elenco de hechos probados y el hecho no probado que contiene la sentencia de instancia, por corresponder al mérito de los autos y ser contestes con los elementos de convicción que en su apoyo se citan.
II.SOBRE LOS AGRAVIOS DEL REPRESENTANTE DEL ESTADO. El representante del Estado en su escrito de expresión de agravios considera que la Sentencia de instancia fue dictada al margen de la ley y contra lo que revelan los autos. Señala que el fallo en forma improcedente declara una responsabilidad civil contra el Estado a quién condena en reconocerle a la actora la suma de cien millones de colones, más intereses y costas del proceso, denegando las excepciones interpuestas. De acuerdo a la parte considerativa de la sentencia recurrida, se dio una falta de coordinación entre distintos órganos del Ministerio del Ambiente y Energía que irrogaron daños y perjuicios a la actora que deben ser reconocidos y para llegar a esa decisión el Despacho tomó como fundamento el hecho de que la Administración debió advertir a la demandante sobre la necesaria autorización de la remoción de la cobertura vegetal, supuesta omisión que genera la responsabilidad del Estado y que fue consignado como el único hecho no probado, incluido en el Considerando II, siendo que en su consideración yerra el Despacho por las siguientes consideraciones: La supuesta omisión hace invertir el principio de la carga probatoria que establece el artículo 317 del Código Procesal Civil, pues lo cierto es que no figurando su representada como sujeto activo en este proceso no tiene por qué comprobar que sí hizo una advertencia a la empresa demandante.
Señala que en todo caso, la demandada es una empresa consolidada en la extracción de materiales y por otro lado explotaba parcialmente el tajo en la parte que estaba "destapada", lo que implica que necesariamente sabía de antemano que no podía extraer materiales en el resto sin la debida autorización de remoción del bosque. Asimismo, considera que el fallo de instancia, violenta el principio de legalidad establecido en los artículos 11 de la Constitución Política y 11 de la Ley General de la Administración Pública, en el tanto hace disponer que distintos órganos de la Administración deben excederse en sus atribuciones legales y reglamentarias. Señala que conforme lo establece la legislación, son muchos los trámites que deben seguirse para iniciar una explotación minera y varias son las etapas que deben agotarse en esa tramitología y no es la Administración la que debe ir guiando al administrado en tales trámites, siendo que los derechos están consignados en el ordenamiento a disposición de los ciudadanos y ellos sabrán si los ejercen o no. Indica que la Administración no tenía porque haber hecho la advertencia que en forma impropia se echa de menos y en la que se fundamenta la condenatoria impuesta al Estado.
Manifiesta que no existe ninguna responsabilidad del Estado, como tampoco el tener que reconocer a la demandante daños y perjuicios, por lo que el fallo debe ser revocado, acogiéndose la defensa de falta de derecho opuesta. Señala que los daños y perjuicios que se reclaman son totalmente improcedentes, pues no puede la demandante en el hipotético caso de que exista una responsabilidad estatal que no admite, reclamar "lo que no se ganó", en cuanto a lo que no logró explotar, por cuanto no es más que una expectativa sobre un hecho futuro y por demás incierto, enfatizando en la falta de conexidad existente entre la denegatoria del permiso de remoción de bosque con las ganancias no obtenidas por una explotación minera, siendo que el mismo fallo de instancia en el Considerando VII, reconoce que el área de bosque no podía ser explotada sin violentar la ley forestal, por lo que la empresa nunca estuvo en una efectiva posibilidad de explotarla y por ende de recibir las sumas proyectadas.
A pesar de lo transcrito, la sentencia impugnada otorga a la actora la suma de cien millones de colones por daño material, tal y como si se tratara de daño moral (otorgado in re ipsa), siendo que tal condenatoria carece de base técnica y deviene en incongruente toda vez que el fallo indica que la accionante nunca tuvo una efectiva posibilidad de explotar la zona boscosa y luego procede a condenar al Estado a daños inexistentes, originados en la imposibilidad de explotación por parte de la actora de la concesión para la explotación minera. Señala que no hay en tal condenatoria un parámetro técnico que le de sustento y consistencia a ese extremo, ni razonamientos (falta de fundamentación) en los que se justifique la condena, simplemente el fallo consigna un monto que el juzgador consideró "prudente", sin que legalmente sea posible establecer un daño material, como el pretendido de esa manera.
Indica que no existe ningún renglón que deba ser indemnizado a la demandante aún cuando se asumiera una responsabilidad estatal que no la hay. La actora nunca hizo llegar al proceso prueba pertinente y contundente que le de acceso a la pretensión, siendo que esa representación advirtió de la carencia de pruebas y la impertinencia de las ofrecidas por la empresa demandante. Solicita revocar la sentencia recurrida y en su lugar acoger las defensas opuestas, declarando sin lugar la demanda, condenando en costas a la demandante.
En los escritos de expresión de agravios (folios 340 a 344 y 353 a 360 del principal), el actor solicita revocar la sentencia recurrida, por ser parcialmente contraria a derecho, al denegar parte de lo pretendido, invocando a manera de síntesis y en lo que interesa para la resolución del recurso formulado, los siguientes argumentos: Señala que coincide plenamente con la resolución recurrida en cuando a que la descoordinación existente entre las diferentes dependencias del Ministerio de Ambiente y Energía, causaron un daño al patrimonio de la actora, que no tenía el deber de soportar y que el Estado está en la obligación de resarcir. Asimismo coincide en el fallo de instancia en cuanto se demostró que la actora cumplió con todos y cada uno de los pasos impuestos por el MINAE en el procedimiento para la obtención de la concesión minera, por lo que no fue su responsabilidad el hecho de no obtener un permiso para cambio de uso de suelo, sino que el error provino de la propia administración, con lo que se excluye la causa eximente pretendida por la accionada de culpa de la víctima.
Asimismo indica que la sentencia de instancia es contradictoria al indicar que la concesión fue mal otorgada, pues la zona de bosque no podría ser explotada sin violentar la ley forestal, por lo que la actora nunca estuvo en posibilidad efectiva de explotarla y por ende de recibir las sumas proyectadas. En su consideración dicha afirmación desconoce la naturaleza jurídica de la concesión minera que otorga en favor del titular un derecho subjetivo del que surge el derecho de extraer los minerales conforme a los términos establecidos en el artículo 28 del Código de Minería, siendo que técnicamente si era viable la explotación sin violentar la ley forestal. Señala además que el estudio de impacto ambiental contemplaba un capítulo entero denominado Plan de Gestión Ambiental, donde se vislumbraban las actividades dirigidas a la mitigación y minimización del impacto ambiental negativo, así como las labores de protección, recuperación y monitoreo.
Considera equívoca la resolución recurrida cuando afirma que se trabajó en la concesión, pues realmente nunca se inició formalmente la etapa de operación del tajo. Señala que de conformidad con lo establecido por el estudio de impacto ambiental se establecieron tres fases de desarrollo: Construcción, operación y cierre técnico. Se inició la etapa de construcción que consistió en la construcción y acondicionamiento de la infraestructura requerida para la operación del proyecto (caminos, oficina, y comedor tipo camper, plantel de proceso, parqueos, letrina). También incluye en parte la remoción de cobertura vegetal, suelos y estériles requerida para dejar al descubierto el manto a explotar. Instalaciones de los servicios básicos (agua, electricidad, teléfono), delimitación de las zonas de apilamiento, ubicación de desechos, rehabilitación de caminos, así como la construcción de sistemas de drenaje para la evacuación de las aguas superficiales (páginas 6 y 7 del Estudio de Impacto Ambiental).
Nunca se pudo pasar a la etapa de operación, ni siquiera su pudo concluir la de construcción, pues un requisito "sine qua non" para pasar a la etapa de operación e iniciar la explotación del tajo lo era la remoción de la cobertura vegetal (destape), lo cual no se pudo realizar, al no haberse otorgado el permiso respectivo. La presentación de los informes de profesionales a cargo del tajo fue un compromiso que la actora adquirió ante el requerimiento de la resolución que aprobó la concesión, lo cual no implica que la fase de operación se estuviera ejecutando. Señala que coincide con la resolución recurrida en cuanto indica que la actora había obtenido el derecho a explotar la concesión minera y no sólo una expectativa. Considera equívoca la resolución recurrida en cuanto afirma que el plazo de explotación de la concesión se limitó a 6 años, concluyendo en abril del 2006, cuando lo correcto es que fue por un período de ocho años según la resolución R-458-2000 MINAE, donde se otorga la concesión minera, firmada por el Presidente de la República y la Ministra del ramo.
El contrato de arrendamiento de la finca donde la actora iba a operar el tajo se firmó originalmente por un período de 10 años a partir de la firma que se dio el 30 de abril de 1996 y por la cantidad excesiva de trámites y requisitos, el estudio para otorgar la concesión duró más de 4 años (inició el 23 de setiembre de 1997), siendo que la misma se resolvió favorablemente hasta el 3 de abril del 2001. Señala que ésta no es una situación que dependiera de la gestión de la actora, por lo que no le es un hecho imputable. Arguye que es un error afirmar como lo hace la resolución recurrida, que la accionante tenía asegurada al momento en que se confirmó la negativa, un contrato de operación por un plazo de 6 años, siendo que la concesión se otorgó por un plazo de 8 años y no de 6 y el contrato de arrendamiento se dio por un período de 10 años y no de seis, por lo que en su criterio, sería ilícito trasladar los efectos negativos de la lentitud patológica de la gestión administrativa ineficiente e ineficaz, a la actora que cumplió oportunamente con todos los requerimientos de la Administración.
Reducir el monto de la indemnización a un plazo distinto al que otorgó la concesión y que es resorte de la Administración, sería recompensar la ineficiencia de la Administración frente al justiciable que tiene el derecho a un Estado eficiente y el derecho a una indemnización íntegra de los daños y perjuicios irrogados a consecuencia directa e inmediata de una inadecuada e indebida gestión administrativa. Señala que a la fecha se siguen cumpliendo todos los compromisos ambientales a que se comprometió la actora cuando se establecieron los requisitos de aprobación del estudio de impacto ambiental. Argumenta que no comparte la sentencia de instancia en cuanto afirma que lo reclamado por la actora son expectativas no reales. Los daños y perjuicios se dan como consecuencia de la imposibilidad de explotar la concesión minera, la cual concedió un derecho adquirido no una simple expectativa de derecho, siendo que la imposibilidad del ejercicio y explotación de la concesión generó daños y perjuicios reales, no daños eventuales, sino daños futuros, reales, efectivos, evaluables e indemnizables, técnicamente demostrados por medio de la experticia rendida en autos por parte de la Licenciada Laura Álvarez Corella, Contadora Pública que determinó que la indemnización que le correspondía pagar al Estado por los daños y perjuicios ocasionados a la actora al 31 de enero del 2006, asciende a la suma de ochocientos cincuenta y ocho millones cuatrocientos veintinueve mil setecientos cuarenta y cuatro colones.
Sostiene que la jueza de instancia, sin indicar los motivos o en que parámetros de medición se fundamenta, apartándose de la pericial, considera que la suma de cien millones de colones cubre la inversión realizada por la actora, más una indemnización por el daño ocasionado. No comparte ese rubro, pues en su consideración no se ajusta a la realidad de los daños y perjuicios irrogados, por lo que dicha resolución debe ajustarse a derecho y conceder una indemnización completa ajustada a parámetros objetivos de medición, conforme a los elementos de convicción que obran en el expediente, considerando que a la fecha se computan más de 11 años de haber iniciado los trámites ante el MINAE y el correspondiente desembolso dinerario. Indica que la sentencia de instancia omite pronunciamiento en torno a la solicitud de indexación planteada oportunamente, por lo que solicita corregir dicha omisión. Indica que yerra la resolución recurrida en cuanto se limitó a otorgar como perjuicios únicamente el lucro cesante futuro (la pérdida sufrida entre la fecha del fallo y aquélla en la cual se finaliza la obligación económica que origina la indemnización), excluyendo el reconocimiento del lucro cesante consolidado o vencido (perdida de utilidad o ganancia que la actora experimentó en su patrimonio con ocasión de la deficiente actuación administrativa, desde la fecha de la denegatoria del permiso de cambio de suelo y hasta la sentencia que impuso la obligación de reparación de daños y perjuicios, es decir lo que dejó de ingresar a las arcas de la accionante como utilidades netas a consecuencia de la explotación de la concesión minera).
Solicita revocar la resolución recurrida en lo no concedido y se declare con lugar la demanda en todos sus extremos y se conceda una indemnización plenaria, acorde con los daños y perjuicios ocasionados a la actora.
De conformidad con el régimen objetivo de responsabilidad administrativa establecido en la Constitución Política de la República (artículos 9, párrafo primero, 11, 18, 33, 34, 41, 45, 49 párrafo primero, 139 inciso 4), 140 inciso 8), 148, 188 y 191) y las disposiciones contenidas en los artículos 190 siguientes y concordantes de la Ley General de la Administración Pública, la Administración responderá por todos los daños que cause su funcionamiento legítimo, ilegítimo, normal o anormal, salvo fuerza mayor, culpa de la víctima o hecho de un tercero. La legitimidad o ilegitimidad del funcionamiento de la Administración se refiere básicamente a las conductas jurídicas, mientras que la normalidad o anormalidad se refiere ante todo (pero no en forma exclusiva) a la conducta material o técnica, representada entre otras por la actividad prestacional que se atribuye al Estado. Conforme lo ha señalado la Sala Primera de la Corte Suprema de Justicia en la Sentencia No. 000584-F-2005 de las diez horas cuarenta minutos del once de agosto del 2005, la anormalidad atiende a aquellas conductas administrativas, que en sí mismas, se apartan de la buena administración (conforme al concepto utilizado por la Ley General de la Administración Pública en el artículo 102, inciso d) que entre otras cosas incluye la eficacia y la eficiencia) o de la organización, de las reglas técnicas o científicas de la pericia y el prudente quehacer en el despliegue de sus actuaciones.
La anormalidad se puede manifestar a través de un mal funcionamiento, un funcionamiento tardío o una ausencia total de funcionamiento. La Administración Pública también es responsable por los daños y perjuicios causados con su inactividad administrativa. Esa pasividad frente al cumplimiento de obligaciones preexistentes se emarca para efectos de la responsabilidad civil extracontractual como funcionamiento anormal (en tanto corresponda con una actividad material debida y con una conducta ilegítima), en la medida en que el incumplimiento de lo debido atente contra las reglas de la buena administración o incumpla las potestades administrativas funcionales que dimanan del ordenamiento jurídico. En todo caso, la determinación de responsabilidad queda sujeta a la existencia de un nexo de causalidad entre la conducta administrativa y el daño producido, el que deberá ser cierto, efectivo, evaluable, indemnizable y no conjeturable.
Asìmismo, conforme se señala en el numeral 194.2 de la ley de cita, la Administración será responsable por sus actos lícitos y por su funcionamiento normal cuando los mismos causen daño a los derechos del administrado en forma especial, por la pequeña proporción de afectados o por la intensidad excepcional de la lesión (responsabilidad sin falta o por sacrificio especial), siendo que en tal caso, la indemnización deberá cubrir el valor de los daños al momento de su pago, pero no el lucro cesante. En el sentido indicado y sobre el régimen de la responsabilidad de la Administración Pública, la Sección Sexta de éste Tribunal ha considerado lo siguiente: "(....) “VI.-) DE LA RESPONSABILIDAD OBJETIVA DE LA ADMINISTRACIÓN PUBLICA: La responsabilidad de la Administración Publica encuentra su fundamento constitucional, en los artículo 9 y 41 de la Constitución Política, en tanto establece lo siguiente: "Artículo 9º—El Gobierno de la República es popular, representativo, participativo, alternativo y responsable.
Lo ejercen el pueblo y tres Poderes distintos e independientes entre sí. El Legislativo, el Ejecutivo y el Judicial". (El destacado es nuestro) " ARTÍCULO 41 .- Ocurriendo a las leyes, todos han de encontrar reparación para las injurias o daños que hayan recibido en su persona, propiedad o intereses morales. Debe hacérseles justicia pronta, cumplida, sin denegación y en estricta conformidad con las leyes". Con base en estas disposiciones constitucionales, a partir de 1978, la Ley General de la Administración Pública, distingue dos tipos de actividad de la administración generadoras de responsabilidad: en primer término, la actividad ilícita o anormal de la Administración, en tanto que supone una transgresión del ordenamiento jurídico. En este sentido, los artículos 190, 191 y 192 de la Ley General de la Administración Pública indican lo siguiente: "1 La Administración responderá por todos los daños que cause su funcionamiento legítimo o ilegítimo, normal o anormal, salvo fuerza mayor, culpa de la víctima o hecho de un tercero. 2.
La Administración será responsable de conformidad con este artículo, aún cuando no pueda serlo en virtud de las secciones siguientes de este Capítulo, pero la responsabilidad por acto lícito o funcionamiento normal, se dará únicamente según los términos de la Sección Tercera siguiente". "La Administración deberá reparar todo daño causado a los derechos subjetivos ajenos por faltas de sus servidores cometidas durante el desempeño de los deberes del cargo o con ocasión del mismo, utilizando las oportunidades o medios que ofrece, aún cuando sea para fines o actividades o actos extraños a dicha misión". "La Administración será también responsable en las anteriores condiciones cuando suprima o limite derechos subjetivos usando ilegalmente sus potestades para ello". La ilicitud de la conducta se vincula al incumplimiento de normas administrativas, en tanto que la anormalidad se origina con motivo de la actividad material o de prestación de servicios de aquella.
En todo caso, la responsabilidad por este tipo de conducta se encuentra íntimamente ligada con el concepto de falta de servicio, como condición indispensable. Dicha falta de servicio es definida de la siguiente manera: "... toda violación de las obligaciones administrativas preexistentes, lo que trae a colación los estándares o canones jurídicos, técnicos y científicos que deben observar la administraciones públicas." De conformidad con lo anterior, se puede presentar una falta de servicio de conformidad, tanto por la prestación tardía o defectuosa del servicio público, como por la omisión de prestación del servicio público o por el dictado de un acto administrativo ilícito o inválido o por la omisión de formalidades sustanciales en el dictado de un acto administrativo. En segundo término está la responsabilidad por conducta lícita y funcionamiento normal, de conformidad con el articulo 194 de la Ley General, en tanto dispone: "1.
La Administración será responsable por sus actos lícitos y por su funcionamiento normal cuando los mismos causen daño a los derechos del administrado en forma especial, por la pequeña proporción de afectados o por la intensidad excepcional de la lesión. 2. En este caso la indemnización deberá cubrir el valor de los daños al momento de su pago, pero no el lucro cesante. 3. El Estado será responsable por los daños causados directamente por una ley, que sean especiales de conformidad con el presente artículo " Con respecto a las características del daño para ambos tipos de responsabilidad, la Ley General de la Administración Pública, señala: "En todo caso el daño alegado habrá de ser efectivo, evaluable e individualizable en relación con una persona o grupo". "Cabrá responsabilidad por el daño de bienes puramente morales, lo mismo que por el padecimiento moral y el dolor físico causados por la muerte o por la lesión inferida, respectivamente".
"El derecho de reclamar la indemnización a la Administración prescribirá en cuatro años, contados a partir del hecho que generó la responsabilidad. El derecho de reclamar la indemnización contra los servidores públicos prescribirá en cuatro años desde que se tenga conocimiento del hecho dañoso". Con respecto a los alcances de la responsabilidad de la Administración, la Sala Primera de la Corte Suprema de Justicia en su voto 000074-F-2007 de las diez horas quince minutos del dos de febrero del dos mil siete, dispuso: "... la responsabilidad patrimonial (que no civil) y extracontractual de la Administración Pública, se enmarca dentro de un régimen preeminentemente objetivo, que comprende en su base tanto la teoría del riesgo como el equilibrio en la ecuación patrimonial. Con ello se procura esencialmente, la reparación indemnizatoria a quien ha sufrido una lesión atribuible a la organización pública como centro de autoridad.
Este criterio finalista produce a su vez, una transformaciónn plena en el eje central de la responsabilidad misma, pues abandona la observación analítica del sujeto productor del daño y la calificación de su conducta, para ubicarse en la posición de la víctima, que menguada en su situación jurídica, queda eximida en la comprobación de cualquier parámetro subjetivo del agente público actuante (salvo en lo que a su responsabilidad personal se refiere). Esto ocasiona, sin duda, un giro radical en el enfoque propio de su fundamento, ya que habría responsabilidad del Estado siempre que la víctima no tenga el deber de soportar el daño, ya sea este de naturaleza patrimonial o extrapatrimonial. A partir de allá, es patente la reversión de los componentes y efectos del instituto en pleno. Tanto los presupuestos esenciales como la carga de la prueba, adquieren un nuevo matiz, que libera al afectado no solo de amarras sustanciales sino también procesales, y coloca a la Administración en la obligada descarga frente a los cargos y hechos que se le imputan.
En este marco, la responsabilidad marcadamente objetiva dispensa el análisis de factores de corte subjetivo e individual del agente productor para la determinabilidad de la reparación del daño, trasladándose a la esfera del lesionado. En tanto se haya sufrido una lesión como consecuencia de una conducta pública, sea esta activa u omisiva, que no tiene el deber de soportar, se impone el deber de resarcimiento, en virtud del principio de reparación integral del daño que se desprende del numeral 41 de la Constitución Política. En este mismo sentido, pueden consultarse, entre muchas otras, las sentencias de esta Sala números 138 de las 15 horas 5 minutos del 23 de agosto; 192 de las 14 horas 15 minutos del 6 de noviembre, ambas de 1991; 48 de las 14 horas 10 minutos del 29 de mayo de 1996 y 55 de las 14 horas treinta minutos del 4 de julio de 1997.) A la luz de lo dispuesto en dichos precedentes, y como bien lo dispuso el Tribunal, el Ordenamiento Jurídico, a partir de la Ley General de la Administración Pública, adopta, según se ha dicho, el sistema de responsabilidad preeminentemente objetiva.
Por ello, no es necesaria la existencia -y, por ende, su demostración-, del dolo o la culpa o, en general, una falta subjetiva imputable a los servidores o funcionarios públicos para que surja el deber de resarcir los daños y perjuicios causados por su funcionamiento. Por ello, el canon 190 de ese cuerpo legal dispone con meridiana claridad la responsabilidad del Estado por su funcionamiento legítimo o ilegítimo, normal o anormal, salvo que converjan en el caso concreto, las causas eximentes que esa misma disposición, de forma taxativa expresa, a saber; la fuerza mayor, la culpa de la víctima y el hecho de un tercero, correspondiéndole a la Administración acreditar su existencia. De este órgano colegiado, puede verse las sentencias de esta misma Sala no. 589-F-99 de 14 horas 20 minutos del primero de octubre de 1999 y no. 252-F-01, de las 16 horas 15 minutos del 28 de marzo del 2001.En esta misma línea, el canon 194.3 de ese mismo cuerpo legal sienta las bases legales de la responsabilidad del Estado Legislador.
Los numerales 9, 11, 33, 41 y 154, todos de la Carta Magna, constituyen el fundamento y sustento de la responsabilidad del Estado Juez por el error judicial, el funcionamiento anormal o ilícito de la función jurisdiccional. De ahí que no podrá sostenerse una "impunidad" del Estado, bajo el fundamento de que carece de desarrollo legal, pues aquella se encuentra establecida por principio, en el marco de la Constitución, a la vez que supondrá un quebranto a la seguridad jurídica, el principio de igualdad y al control de la arbitrariedad de los poderes públicos. Así visto, su reconocimiento no está condicionado a la existencia de mandato legal que la regule. La responsabilidad aludida se rige por lo estatuido en la Carta Fundamental, es decir, constituye un principio de base constitucional, impuesto por las normas referidas y que busca el control del ejercicio de toda la función y conducta del Estado en cualquiera de sus esferas, así como la tutela de los derechos e intereses de los justiciables.
V.-Parámetros de Imputación Legal. Funcionamiento anormal . Por las particularidades propias de la responsabilidad de la Administración Pública, generadas a través de su evolución gradual, así como el carácter objetivo alcanzado, con claro fundamento constitucional, no puede interpretarse como un deber resarcitorio, irrestricto y permanente, aplicable siempre y para todas las hipótesis de lesión. Sería inaudito un régimen de tal naturaleza y materialmente insoportable para cualquier Estado con recursos financieros limitados. Por ello se ha acudido a criterios de imputación que de alguna forma dimensionan, dentro de la objetividad dicha, ese deber indemnizatorio originado por la conducta pública. De allí que puede afirmarse que, el nacional, es un régimen de responsabilidad patrimonial de la Administración Pública de carácter objetivamente moderado , en tanto no renuncia a parámetros o criterios de imputación, sobre todo en lo tocante a la anormalidad e ilicitud, en la que de una u otra forma, valora y califica la conducta del aparato público.
Se trata de criterios amplios y diversos a los de dolo y culpa que tradicionalmente utiliza el derecho común, pero que no por ello, dejan de convertirse en criterios de atribución que alejan el instituto de una mera transferencia patrimonial y automática, sin valoración alguna de la conducta administrativa desplegada. De esta manera, el numeral 190 de nuestra Ley General de la Administración Pública refiere a funcionamiento legítimo o ilegítimo, normal o anormal, de donde la legitimidad o su antítesis, hace referencia básicamente a las conductas jurídicas de la Administración, mientras que lo normal o anormal, apunta, ante todo (pero no en exclusiva), a la conducta material de la Administración, representada entre otras, por la actividad prestacional que se atribuye al Estado como parte de la categoría social que también se le asigna en procura del bienestar general del colectivo. Nótese como el artículo 194 de la indicada ley, hace referencia a los actos lícitos, bajo la concepción de actividad jurídica, distinguiéndolos en la misma norma, de lo que califica como funcionamiento normal, entendido como actividad material.
De esta manera, la anormalidad atiende a aquellas conductas administrativas, que en sí mismas, se apartan de la buena administración (conforme al concepto utilizado por la propia Ley General en el artículo 102 inciso d., que entre otras cosas incluye la eficacia y la eficiencia) o de la organización, de las reglas técnicas o de la pericia y el prudente quehacer en el despliegue de sus actuaciones, con efecto lesivo para la persona. Esto permite señalar que la anormalidad puede manifestarse a través de un mal funcionamiento; un funcionamiento tardío, o una ausencia total de funcionamiento. Anormalidad e ilicitud, no deben por tanto adoptarse como conceptos equivalentes , ni siquiera en lo que corresponde a la hipótesis de aquel funcionamiento que siendo debido o conforme con las reglas antedichas, produce un resultado dañoso, denominado por algúnn sector doctrinal como funcionamiento anormal por resultado, pues en tal caso, lo que opera es una responsabilidad por funcionamiento normal con efecto o resultado lesivo , indemnizable, claro está, siempre que se cubran los requisitos preestablecidos expresamente por el propio Ordenamiento Jurídico (véase el mismo artículo 194 de la Ley General de la Administración Pública).
Tampoco debe confundirse esta anormalidad del funcionamiento y la ilegitimidad de éste, con la antijuricidad genérica y de base, imprescindible en toda reparación civil. En efecto, la responsabilidad civil nace de la antijuricidad, que a su vez se constituye en su fundamento (derivado algunas veces de una norma positiva, mientras que en otras, del principio básico traducido en el deber de no dañar a otro), y que para esta materia particular se concreta en la inexistencia de ese deber para soportar el daño. Así las cosas, si no existe para la víctima el deber de sobrellevar el daño, entendido como la consecuencia final ablativa de la conducta pública, es porque la Administración debía evitarla, o, en caso contrario y bajo ciertas circunstancias, asumir las consecuencias reparadoras de aquella que no pudo impedir, bien por imprevisible, bien por inevitable. Caso contrario produce entonces, el incumplimiento al deber de indemnidad patrimonial de la persona , y en ese tanto, habrá que reputar el detrimento a la esfera jurídica de la víctima como antijurídica, y por ende, de obligada reparación.
De esta manera, puede afirmarse que sólo es indemnizable la que confrontada con la globalidad del Ordenamiento, pueda reputarse como antijurídica en su base, pues lo opuesto será afirmar la compensación por acción dañosa frente a un menoscabo que el Ordenamiento no reprocha y que, por el contrario, tolera y conciente como normal y justificado. Ha de reiterarse entonces, que para la existencia en Derecho de una reparación debida, es menester que exista antijuricidad antecedente y de base, lo que en modo alguno apunta a la naturaleza (legítima o ilegítima) de la conducta desplegada por el agente productor del daño, ni por el resultado que produce dicha acción u omisión. En efecto, aún en los supuestos de funcionamiento legítimo y normal, en los que no existe ilicitud en el comportamiento, se produce una consecuencia dañosa, que con determinadas características (intensidad excepcional o pequeña proporción de afectados), se reputa como de obligada reparación, lo cual dice de su antijuricidad, tanto así, que con la lesión misma surge la obligación patrimonial y su consecuente derecho de accionar.
Se puede sostener entonces, que la antijuricidad de base, a la que se hace referencia como sustrato y presupuesto global e imprescindible para la responsabilidad, es cosa distinta e independiente del parámetro de imputación utilizada por el Sistema Jurídico, pues aún en el evento de un régimen objetivo (que excluya los elementos subjetivos de la culpa y dolo, para dar paso a una simple transferencia económica dirigida a restaurar el desequilibrio producido en la igualdad de las cargas públicas numeral 194 de la Ley General de la Administración Pública-), hay antijuricidad, en la medida en que la norma declara la obligación existente bajo el presupuesto implícito de una lesión contraria a Derecho, que no debe ser soportada por la víctima. Esa reiterada antijuricidad estará siempre presente en el daño indemnizable, bien sea por funcionamiento normal o anormal, legítimo o ilegítimo. Sea como fuere, esos cuatro criterios de imputación que utiliza la Ley General de la Administración Pública en el artículo 190, han de reputarse de cobijo y respaldo constitucional, en tanto concretan la transferencia que el constituyente realizá en el numeral 41 al legislador ordinario ("ocurriendo a las leyes") y concretan la tutela judicial efectiva que consagra la Constitución.
Y siendo ello así, habrá de concluirse que tales criterios aplican para la responsabilidad patrimonial de toda autoridad pública, sea administrativa, legislativa o jurisdiccional". De conformidad con lo anterior, se evidencia que la responsabilidad administrativa es objetiva por excelencia, sea, se determina por conducta lícita como por conducta ilícita, sin hacer referencia a los criterios subjetivos de la culpa o el dolo, por lo que relevante es la comprobación de la existencia de un daño ligado por un nexo de causalidad a una administración pública. Con relación a las características de dicho daño para ser indemnizable, la Sala Primera de Casación en sentencia número 14 de 16 horas del 2 de marzo de 1993, ha señalado: "El daño, en sentido jurídico, constituye todo menoscabo, pérdida o detrimento de la esfera jurídica patrimonial o extrapatrimonial de la persona (damnificado), el cual provoca la privación de un bien jurídico, respecto del cual era objetivamente esperable su conservación de no haber acaecido el hecho dañoso.
Bajo esta tesitura, no hay responsabilidad civil si no media daño, así como no existe daño si no hay damnificado. Por otra parte, sólo es daño indemnizable el que se llega a probar (realidad o existencia), siendo ello una cuestión de hecho reservada al prudente arbitrio del juzgador. En suma, el daño constituye la brecha perjudicial para la víctima, resultante de confrontar la situación anterior al hecho ilícito con la posterior al mismo.(...) El daño constituye la pérdida irrogada al damnificado, en tanto el perjuicio está conformado por la ganancia o utilidad frustrada o dejada de percibir (lucro cesante), la cual era razonable y probablemente esperable si no se hubiese producido el hecho ilícito. (...) No cualquier daño da pie a la obligación de resarcir: Para tal efecto, han de confluir, básicamente, las siguientes características para ser un daño indemnizable: A) debe ser cierto, real y efectivo, y no meramente eventual o hipotético, no puede estar fundado en realizaciones supuestas o conjeturables.
El daño no pierde esta característica si su cuantificación resulta incierta, indeterminada o de difícil apreciación o prueba; tampoco debe confundirse la certeza con la actualidad, pues es admisible la reparación del daño cierto pero futuro; asimismo, no cabe confundir el daño futuro con el lucro cesante o perjuicio, pues el primero está referido a aquel que surge como una consecuencia necesaria derivada del hecho causal o generador del daño, es decir, sus repercusiones no se proyectan al incoarse el proceso. En lo relativo a la magnitud o monto (seriedad) del daño, ello constituye un extremo de incumbencia subjetiva única del damnificado, empero el derecho no puede ocuparse de pretensiones fundadas en daños insignificantes, derivadas de una excesiva susceptibilidad. B) Debe mediar lesión a un interés jurídicamente relevante y merecedor de amparo. Así puede haber un damnificado directo y otro indirecto: el primero es la víctima del hecho dañoso, y el segundo serán los sucesores de la víctima.
C ). Deberá ser causado por un tercero, y subsistente, esto es, sí ha sido reparado por el responsable o un tercero resulta insubsistente. D) Debe mediar una relación de causalidad entre el hecho ilícito y el daño." Del análisis de las anteriores consideraciones para el caso concreto, se puede determinar la procedencia de acoger una pretensión concreta en la cual la parte correspondiente pruebe la existencia de daños con motivo del funcionamiento anormal o ilícito de la Administración, independientemente de si se puede determinar el servidor responsable de éstos o si lo realizado por él, fue hecho con dolo o culpa. En la materia de análisis, resulta irrelevante para efectos de determinar la responsabilidad de la Administración, este último aspecto subjetivo, en tanto que nuestro ordenamiento se encuentra orientado al reconocimiento del deber de indemnizar cuando concurre una conducta u omisión de la Administración ilegitima o anormal - salvo que operen los supuestos de responsabilidad por conducta legítima- que provoca un daño con un efectivo nexo de causalidad entre ambos.
Es este el análisis que debe realizarse por el juzgador con respecto a las conductas objeto del proceso, para así determinar si se acoge un determinado argumento que de base a un resarcimiento. (Tribunal Contencioso Administrativo, Sección Sexta No. 022-2008 de las 10:30 horas del 23 de mayo del 2008). En la especie, por las razones que se dirán, la reclamación formulada por la accionante no puede ser acogida en sentencia, toda vez que el acto impugnado (la denegatoria de autorización para remover la cobertura boscosa), constituye un hecho lícito y normal, siendo que las utilidades dejadas de percibir constituyen un perjuicio (lucro cesante) que no puede ser reconocido, por disposición expresa del artículo 194 de la Ley General de la Administración Pública. Además, aún cuando se considerara la existencia de una actuación ilegítima o anormal de la Administración, los perjuicios reclamados constituyen un hecho futuro pero incierto por lo que conforme al régimen de responsabilidad administrativa vigente, no podría ser reconocido en sentencia, todo lo cual, según se detalla en los considerandos siguientes.
Las argumentaciones el representante del Estado en torno a la improcedencia del daño material otorgado en Sentencia y la imposibilidad de otorgar a la accionante el monto establecido en el peritaje rendido en autos a título de daños y perjuicios, son de recibo. Por concepto de daño material, la juzgadora de instancia concedió a la actora la suma de cien millones de colones, limitando la cuantificación del daño material a las utilidades que hubiera percibido la accionante de haber sido explotado el tajo, pero limitado a 6 años, considerando que el Contrato de Arrendamiento que había suscrito la accionante para la extracción del tajo con la sociedad dueña del inmueble tenía una vigencia hasta el día 30 de abril del 2006. Consideró la jueza de instancia que dicha suma cubre la inversión realizada por la Empresa actora más una indemnización por el daño ocasionado en su contra, por el largo procedimiento al que se sometió.
Conforme lo indica el representante estatal, existe una incongruencia en el fallo impugnado, que deviene en una ultrapetita, toda vez que concede un monto por concepto de daño material conforme a una valoración prudente, desconociendo que el daño material debe ser demostrado, existiendo una imposibilidad legal a efecto de conceder este tipo de daño "in re ipsa" o conforme al prudente arbitrio del juez, toda vez que dicha posibilidad se encuentra establecida a los efectos de la determinación del daño moral subjetivo. Además, no constan las bases técnicas para la cuantificación del daño material concedido por parte de la jueza de instancia, por lo que en cuanto al reconocimiento de éste extremo, la sentencia de instancia debe ser revocada.
La parte actora fundamenta su demanda en la anormalidad e ilicitud del acto dictado por la Oficina Sub-Regional de Grecia que denegó la remoción de la cobertura boscosa, lo que generó la revocatoria de hecho del derecho real administrativo otorgado a la accionante mediante la concesión de explotación minera otorgada ya que dicho acto imposibilita el ejercicio del derecho otorgado en la Concesión. En su consideración la actuación administrativa impugnada constituye un acto anormal e ilegal que genera la obligación del Estado de indemnizar los daños y perjuicios irrogados con la actuación administrativa, en este caso supeditado a las sumas dejadas de percibir y que asciende a ¢544.363.270.00. De un análisis detallado de los autos, ésta Cámara avala las consideraciones de la Jueza de instancia en cuanto a la existencia de una actuación administrativa contraria a los principios del servicio público en la tramitación de la concesión de explotación minera efectuada por la accionante, toda vez que al aprobar el Estudio de Impacto Ambiental no se le indicó a la actora sobre la imposibilidad de remover la capa boscosa como requisito para autorizar la concesión de explotación minera.
En efecto, conforme lo ha establecido la Sala Primera en la Sentencia No.584-2005 de las 10:40 horas del 11 de agosto del 2005, de conformidad con las regulaciones establecidas en los artículos 139 inciso 4), 140 inciso 8) y 191, de la Constitución Política, interpretados a contrario sensu, existe un derecho fundamental de los administrados al buen funcionamiento de los servicios públicos que impone a los entes públicos la obligación de dar cumplimiento a los principios de eficiencia y eficacia en el ejercicio de sus competencias y la prestación de los servicios públicos. Atendiendo a principios de eficiencia y seguridad jurídica, el administrado debe conocer de antemano los requisitos que exigen las Administraciones para efectuar los distintos trámites y autorizaciones, en este caso para el otorgamiento de una concesión minera, cuyos requisitos se encuentran claramente determinados en el Código de Minería aprobado por ley No. 6797 del 4 de octubre de 1982 y sus reformas.
La actividad de los entes públicos debe estar sujeto a los principios del servicio público de continuidad, eficiencia y adaptación a todo cambio, conforme a los términos del articulo 4 de la Ley General de la Administración Pública. En la especie es clara la existencia de una descoordinación existente entre las diferentes dependencias del Ministerio de Ambiente y Energía (Dirección de Geología y Minas, Secretaría Técnica Nacional Ambiental y el Área de Conservación de la Cordillera Volcánica Central).
VII.La actora cumplió con todos los requisitos exigidos por el MINAE para el otorgamiento de la Concesión, siendo que ni de los términos en que se autorizó el Estudio de Impacto Ambiental por parte de SETENA, ni de los términos en que se autorizó la Concesión, se estableció como condición a la actora el gestionar la remoción de la superficie boscosa ante el Área de Conservación. Este Tribunal considera que atenta contra los principios de lógica y eficiencia el hecho de que el SETENA no hubiera advertido la necesidad de autorizar la remoción de la capa boscosa, al momento de aprobar el Estudio de Impacto Ambiental, toda vez que conforme consta en los planos que fueron aportados por la accionante, era evidente que aproximadamente un 60% del Área de la Concesión estaba cubierta por bosque. Según lo indicó el perito Nombre149350 (folios 178 a 191 del principal), el Programa de Cierre Técnico que debió aportar la actora al MINAE, comprende las medidas que se tomarán para la conformación estable de la topografía resultante de la extracción y las actividades que se llevarán a cabo para la futura regeneración de la cobertura vegetal, diseño del manejo de las escorrentías y la tasa de erosión al finalizar la extracción, así como los programas de reforestación y regeneración de cobertura vegetal, lo que evidencia que existían elementos dentro del expediente administrativo a efecto de que los funcionarios encargados del estudio de la concesión y los personeros de SETENA hubieran advertido que para el otorgamiento de la concesión para explotación minera solicitado por la actora, se requería necesariamente de la autorización para la remoción de la capa vegetal.
El estudio de impacto ambiental autorizado por SETENA a la accionante, debió haber considerado este aspecto, que constituye una base fundamental para la aprobación de dicho estudio, pero no lo hizo, lo cual constituye la conducta administrativa anormal que percibe éste Tribunal, pero sin embargo, ello no es objeto de ésta litis. En efecto, conforme lo establecido por el artículo 2 del Código de Minería, el Estudio de Impacto Ambiental constituye un análisis comparativo, técnico, económico, social, cultural, financiero, legal y multidisciplinario de los efectos de un proyecto sobre el entorno ambiental, así como la propuesta de medidas y acciones para prevenir, corregir o minimizar tales efectos; se trata de un instrumento de decisión dentro del campo jurídico-administrativo, que regula la evaluación del impacto de diferentes actividades sobre el ambiente y cuya responsabilidad operativa y funcional recae sobre la Secretaría Técnica Nacional Ambiental (SETENA), organismo de desconcentración máxima adscrito al anteriormente denominado Ministerio de Ambiente y Energía (MINAE).
Por su parte, el artículo 106 inciso a)- del Código de Minería, establece que el análisis de impacto ambiental de la actividad minera incluirá entre otros los efectos sobre la vegetación y áreas que se verán afectadas por la actividad. Es claro para este Tribunal que de conformidad con las competencias otorgadas tanto por el Código de Minería como por su ley de creación, le correspondía a SETENA, establecer la coordinación pertinente con el Sistema Nacional de Áreas de Conservación y la Dirección de Geología y Minas a efecto de realizar el estudio de los efectos sobre la vegetación y áreas que se verían deforestadas por la actividad que desplegaría la actora, como requisito previo a la autorización del estudio de impacto ambiental y por ende como requisito previo a recomendar la concesión a la accionante. La labor de la Secretaría Técnica Nacional Ambiental debe ser coordinada y eficaz con las demás dependencias del MINAE sin que sea de recibo la tesitura sostenida por el representante del Estado en cuanto a la existencia de competencias funcionales entre las distintas dependencias del citado Ministerio, ni en cuanto a la existencia en la especie de un eximente de responsabilidad por culpa de la víctima.
En este mismo sentido, carece de fundamento el agravio esbozado por el representante del Estado respecto de una supuesta inversión en el subjúdice de la carga probatoria y la violación del artículo 317 del Código Procesal Civil, ni las argumentaciones en punto a que la demandada al ser una empresa consolidada en la extracción de materiales debió haber sabido del cumplimiento del requisito de cambio de uso de suelo como requisito esencial a efecto de que la concesión otorgada pudiera adquirir validez o eficacia, pues aunque no podía la empresa actora alegar desconocimiento de dicho requisito legal, de conformidad con el artículo 129 de la Constitución Política, ello no subsana la omisión estatal referida al momento de aprobar el Estudio de Impacto Ambiental. Asimismo, no evidencia ésta Cámara violación del principio de legalidad establecido en los artículos 11 de la Constitución Política y 11 de la Ley General de la Administración Pública, toda vez que el deber de la administración en observar los principios de eficiencia y eficacia, le obligan a mantener una coordinación interorgánica constante, sin que ello implique el desconocimiento de la existencia de competencias específicas para cada uno de los órganos que conforma la estructura pública.
VIII.Conforme a lo señalado en los Considerandos anteriores, si bien existió una actuación anormal por parte de la Administración en el trámite de aprobación del Estudio de Impacto Ambiental, contraria a los principios del servicio público, al no advertir a la actora la necesidad de contar con la autorización de la oficina correspondiente para la remosión de la cobertura boscosa, lo cierto es que dicha omisión no es objeto de impugnación en el presente proceso, por lo que ésta actuación no podría fundamentar la pretensión de la accionante. En efecto, la actora reclama los daños y perjuicios irrogados como consecuencia inmediata y directa de la negativa del Sistema Nacional de Áreas de Conservación de la Sub-Región Grecia de no autorizar el retiro de la cobertura vegetal dentro del área aprobada en la concesión de explotación minera aprobada a la accionante y no de la omisión en el trámite para obtener la Concesión.
En el sentido indicado, y contrario a lo argumentado por el apelante, la denegatoria por parte de la oficina Sub-Regional de Grecia, de no autorizar la remosión de la cobertura boscosa (destape), constituye una actuación normal y lícita, debidamente fundamentada en el criterio técnico rendido por funcionarios del MINAE (Informe de Inspección No. Placa29897), en el que se determinó que existía una imposibilidad legal de autorizar la remosión de la cobertura vegetal, ya que el área sobre la cual se pretendía desarrollar la explotación minera, constituía un bosque, siendo que por disposición expresa del artículo 19 de la Ley Forestal, en tales circunstancias existe una imposibilidad legal de autorizar el cambio de uso de suelo, lo que impedía brindar la autorización.
IX.Si bien la denegatoria del permiso de remosión de la cobertura boscosa constituye un acto legal, conforme las disposiciones contenidas en el artículo 194 de la Ley General de la Administración Pública y en la Ley Forestal indicada, el Estado tendría el deber de indemnizar el valor de los daños irrogados con la actuación administrativa al momento de su pago, más no el lucro cesante, por imperio de ley. Lo anterior al existir en la especie un sacrificio especial generado a la accionante, toda vez que contaba en su favor con una concesión de explotación minera, que constituye un acto declaratorio de derechos en su favor y la imposibilidad de la remosión boscosa no hace posible el ejercicio de tal derecho. En la especie, señala el actor (folio 47) que los daños y perjuicios patrimoniales reclamados como consecuencia del acto impugnado, lo constituye el perjuicio material causado por la suma de ¢544.373.270.00, correspondiente a la utilidad neta dejada de percibir durante los ocho años de plazo que fueron otorgados por la concesión.
Según se evidencia de lo señalado, si bien la accionante reclama la indemnización de los daños y perjuicios irrogados, al momento de precisar en qué consisten, el actor limita su reclamo al reconocimiento de las utilidades no ingresadas al patrimonio de la actora como consecuencia directa e inmediata del acto impugnado, lo que constituye el reconocimiento del lucro cesante o perjuicio, por lo que dicho extremo no es indemnizable, toda vez que según la citada disposición legal, tratándose de una actuación lícita y normal de la administración, no se podría reconocer los perjuicios (lucro cesante) irrogados con la actuación administrativa, por lo que el reclamo no puede ser otorgado en sentencia.
X.En todo caso, si bien de conformidad con las regulaciones contenidas en los artículos 190 y siguientes de la Ley General de la Administración Pública, es admisible la reparación del daño futuro, según el artículo 196 Ibidem, el daño alegado habrá de ser cierto; real y efectivo, y no meramente eventual o hipotético y no puede estar fundado en realizaciones supuestas o conjeturales. En la especie el perjuicio reclamado por la actora, obedece a meras expectativas, toda vez que las proyecciones de las posibles utilidades netas que hubiera percibido la accionante por la explotación del tajo durante la vigencia de la concesión depende de una serie de variables ajenas, como el valor del mercado del material, la demanda en la colocación del material con los eventuales compradores, la existencia de contratos de compra, las posibilidades reales de explotación. Considera ésta Cámara que no podría considerarse que la concesión garantizara que la actora fuera a percibir dichas utilidades.
En este mismo sentido el peritaje matemático rendido en autos por la Actuaria Matemática Laura Alvarez Corella, (folios 214 a 225), no constituiría una prueba idónea para sustentar los daños y perjuicios reclamados por la actora, ya que constituye una mera proyección de las utilidades netas (ganancias) que hubiera podido obtener la actora de haber explotado el tajo conforme a las probabilidades máximas de explotación y extracción en el período que va del primero de junio del 2001 al 20 de octubre del 2008, lo que constituye un hecho futuro e incierto, y por ende, no indemnizable, al tenor de lo anteriormente expuesto.
XI.Por la forma en que se resuelve el presente asunto, las argumentaciones de la accionante en el sentido de que considera equívoca la resolución recurrida cuando afirma que la actora realizó trabajos relacionados con la concesión, no tienen ninguna incidencia respecto del fondo del asunto tratado en autos, por lo que no es de recibo. En este mismo sentido, no son de recibo sus argumentaciones en el sentido de que considera equívoca la resolución recurrida en cuanto afirma que el plazo de explotación de la concesión se limitó a 6 años y no se consideró por 8 años conforme lo establece la resolución que aprobó la concesión. Lo anterior toda vez que según se señalara en los considerandos precedentes, no existe fundamento de legalidad a efecto de reconocer a la accionante la utilidad neta que se hubiera generado con la posible venta del material a extraer del tajo ni durante los 6 años que le restaba al Contrato de explotación de Tajo suscrito por la actora con la empresa Hacienda Ganadera Poasito Sociedad Anónima, en razón de lo que el agravio no es de recibo.
XII.En cuanto a las argumentaciones de la parte actora referentes a la omisión por parte de la Juzgadora de instancia en torno a la solicitud de indexación planteada oportunamente y de que excluyó el reconocimiento del lucro cesante consolidado o vencido, debe indicarse que el agravio no es de recibo. Conforme a las consideraciones esbozadas por éste Tribunal en los Considerandos precedentes, el reclamo de la actora se limitó al reconocimiento del lucro cesante, mismo que no es resarcible en este asunto, conforme a las disposiciones del artículo 194 de la Ley General de la Administración Pública, por lo que en consecuencia no procede reconocer la indexación de las sumas reclamadas al no existir ninguna cantidad que indemnizar a la accionante. El hecho de que la Jueza a-quo omitiera pronunciamiento respecto de la solicitud de indexación, no constituye un vicio que amerite la anulación de la sentencia, toda vez que la solicitud de indexación constituye una pretensión accesoria y al denegarse la principal (pago de los perjuicios reclamados), se debe denegar la accesoria que es la indexación. Lo contrario sería determinar la nulidad por la nulidad misma, en contradicción con los principios de tutela judicial efectiva, pro actione y pro-sentencia, por lo que el agravio no es de recibo.
La Sentencia de instancia ordenó la condenatoria de costas por cuenta del Estado al considerar la inexistencia de motivos para desaplicar el principio de condena en costas al vencido, establecido en el artículo 221 del Código Procesal Civil, siendo que el representante estatal solicita la revocatoria de dicha condenatoria. En la especie, en criterio de ésta Cámara ha existido motivo suficiente para litigar por la naturaleza de las cuestiones debatidas y por la revocación parcial del fallo de instancia por parte de ésta Cámara, por lo que conforme a las regulaciones establecidas los artículos 98 inciso c) de la Ley Reguladora de la Jurisdicción Contencioso-Administrativa en concordancia con las disposiciones establecidas en el artículo 222 del Código Procesal Civil, aplicable en la especie por dispensa del artículo 103 de la Ley Reguladora de la materia, procede revocar el fallo de instancia respecto de la condenatoria en costas al Estado, declarando en su lugar que este asunto se falla sin especial condenatoria en costas.
Conforme a las consideraciones esbozadas, procede revocar la sentencia impugnada, en cuanto condenó al Estado al pago de la suma de cien millones de colones por concepto de daño material en favor de la actora y al pago de intereses a título de perjuicios sobre la suma concedida, así como respecto de la condenatoria en costas al Estado. En su defecto, se acoge la excepción de falta de derecho interpuesta por el representante estatal, declarando sin lugar la demanda interpuesta. Se falla el presente asunto sin especial condenatoria en costas.
POR TANTO
En lo que ha sido objeto de recurso, se acoge la apelación formulada por la representación estatal y se rechaza la apelación formulada por la actora. Se revoca parcialmente la sentencia impugnada, confirmándose en cuanto denegó la excepción de falta de legitimación y falta de interés. Se revoca en cuanto rechazó la excepción de falta de derecho la cual se acoge y en cuanto condenó en costas al Estado. Se declara sin lugar la demanda en todos sus extremos. Se falla el presente asunto sin especial condenatoria en costas. La jueza Reyes Castillo pone nota. NOTIFÍQUESE.
FRANCISCO JIMÉNEZ VILLEGAS Nombre30512 JUDITH REYES CASTILLO Nota de la Jueza Reyes Castillo De manera respetuosa me separo del contenido de los considerandos VI, VII y VIII de la sentencia, pues en mi modesta opinión estimo que la concesión es un acto complejo que depende de una serie de actos posteriores (por ejemplo: permisos municipales, constitución de servidumbres y estudios técnicos, entre otros) para poder ejecutarse (artículos 140, 145 de la Ley General de la Administración Pública, 24 y 34 del Código de Minería). En el caso bajo estudio, la resolución Nº R-458-2000-MINAE punto 12), claramente exige el cumplimiento de las recomendaciones de SETENA y del Código de Minería. También, en la resolución Nº 211-2001 de las nueve cuarenta horas del tres de abril de 2001, dictada por el SETENA se establece la posibilidad -expresa- de dictar medidas para el proyecto de acatamiento obligatorio.
Así las cosas, la falta de permiso para la tala o retiro del bosque, constituye una omisión que le resta la ejecutoriedad al acto de concesión. En consecuencia, no existe ilicitud ni anormalidad en lo actuado por la Administración (otorgamiento de la concesión), ya que resulta innecesario que se incluya la indicación expresa o prevención de los trámites posteriores que debe cumplir el concesionario, en particular el retiro de la superficie boscosa (artículo 19 de la Ley Forestal Nº 7575), por tratarse de obligaciones legales cuyo conocimiento no puede ignorarse por los administrados, prohibición que tiene rango constitucional (artículo 129). Concuerdo no obstante con el grueso de las consideraciones restantes y por supuesto con la parte dispositiva.- JUDITH REYES CASTILLO
