Res: 2007-0964 Res: [Telf1] CRIMINAL CASSATION COURT (TRIBUNAL DE CASACIÓN PENAL). Second Judicial Circuit of San José. Goicoechea, at ten o'clock in the morning on the thirtieth of August, two thousand and seven.

CASSATION APPEAL (recurso de casación) filed in the present case brought against [Nombre1], of legal age, United States citizen, married, [Identificacion1], son of [Nombre2] and [Nombre3], for the offense of VIOLATION OF THE LEY FORESTAL committed to the detriment of NATURAL RESOURCES. Participating in the decision on the appeal are judges Rafael Ángel Sanabria Rojas, Ronald Salazar Murillo, and [Nombre4]. Appearing in the cassation proceedings are attorney [Nombre5] [Nombre6], acting as private defense counsel (defensor particular) for defendant [Nombre1], attorney [Nombre7], Deputy Environmental Agricultural Prosecutor, and attorney Manuel Gómez Delgado of the Criminal Cassation Unit of the Second Judicial Circuit of San José.

RECITALS:

I.By means of judgment (sentencia) number 160-2007, issued at seven hours thirty minutes on the fourth of May, two thousand and seven, the Trial Court of Heredia ruled: "Por tanto: In accordance with the foregoing, articles 39 and 41 of the Political Constitution; 1, 4, 9, 140, 142, 265, 267, 360 through 367, 466, of the Code of Criminal Procedure, 1, 30, 31, 34, 35, 45, 50, 96 second paragraph and 140, of the Code of Criminal Procedure, 1, 30, 31, 34, 35, 45, 50, 96 final paragraph of the Ley Forestal, 99 subparagraph h) of the Ley del Ambiente, [Nombre1] is fully acquitted of all penalty and liability for the offense of Violation of the Ley Forestal with which he was charged by the Ministerio Público and the State as represented by the Procuraduría General de la República acting as private complainant (querellante). The offense was committed to the detriment of Natural Resources. Procedural and personal costs (costas procesales y personales) are to be borne by the State.

Within three months following the finality of this judgment, Mr. [Nombre1] must demolish and tear down all structures built within the protection zone (área de protección) of the Río Ángel (roadways, walls, fences, viewing platforms, and any other construction incompatible with the surrounding environment), at his own charge and expense. He must take all necessary precautions to avoid causing damage to the Río El Ángel and its protection zone. The foregoing is ordered under formal warning (apercibimiento) that failure to comply may result in charges being brought for contempt of authority. MINAE is hereby obligated to ensure full compliance with the foregoing. Notice by reading. [Nombre8], Judge." (sic)

II.Against the foregoing ruling, attorney [Nombre9], legal representative of Ana María López Retana in her capacity as private complainant and civil plaintiff (actora civil), filed a cassation appeal.

III.The deliberation having been carried out in accordance with article 450 of the Code of Criminal Procedure, the Court addressed the issues raised in the cassation appeal.

IV. The applicable statutory requirements have been observed throughout the proceedings

Opinion drafted by Judge [Nombre10]; and, REASONING:

I.The cassation appeal meets the admissibility requirements set forth in articles 422, 423, 424, 443, 444, and 445 of the Code of Criminal Procedure.

II.In the first procedural ground (motivo de casación por la forma), attorney [Nombre11], private defense counsel for defendant [Nombre1], alleges a lack of reasoning in the judgment. He cites as violated articles 142, 363, and 369 of the Code of Criminal Procedure, and articles 39 and 41 of the Political Constitution. The appellant considers that there is an absence of reasoning, since, although an acquittal (absolutoria) was entered in favor of his client, the demolition, removal, or tearing down of structures and other immovable property was also ordered. In his view, the judgment contains contradictory reasoning, because on the one hand, in Considerando V, it is deemed established that the constructions caused no environmental damage, from which it follows that there was no violation of the protected legal interest (bien jurídico tutelado), and that the Jardines de la Catarata Project is an Environmental Protection Sanctuary (Santuario de Protección del Medio Ambiente), now classified as a Private Wildlife Refuge (Refugio Privado de Vida Silvestre) by MINAE Executive Decree.

The appellant then states that the trial court holds that conservation areas constitute a general restriction on all owners of properties through which rivers of Costa Rica flow, with the purpose of preserving the natural environment, ecology, and what little can still be saved for the equilibrium of the planet. He adds that, after acknowledging the existence of permits and the absence of any violation of the protected legal interest, the court concludes that encroachment upon those areas is not permitted, much less the carrying out of constructions that produce environmental impacts, finding that there is indeed a transgression of the rules prohibiting human intrusion into those protection zones (zonas de protección). He contends that there is an irreconcilable contradiction in the ruling, since it cannot be maintained that there was no violation of the protected legal interest guarded by the provisions invoked by the Ministerio Público and then conclude that the constructions affect the protected area.

He asserts that, far from harming the zone, the works carried out in fact afforded greater protection to the environment. He further argues that carrying out demolition works would cause considerably more environmental harm than leaving the site in its current state. The ground is denied. The judgment does not contain the contradictions alleged in the cassation appeal. It must be borne in mind that a judgment is a unitary logical-legal instrument, and from the entirety of its text it is clear and precise that the works carried out on the property owned by the company represented by the defendant are situated within a conservation and protection area (área de conservación y protección), which constitutes a violation of what is established by article 58 subparagraph c) of the Ley Forestal. While it is true that an acquittal was entered in favor of defendant [Nombre12], that acquittal is grounded in the application of a direct mistake of law (error de prohibición directo) (article 35 of the Penal Code), inasmuch as it was not possible to rule out that he had acted under a mistake when ordering the works to be carried out, believing they did not constitute an infringement of the Costa Rican legal order, which he did not fully know by reason of his status as a citizen of the United States of America.

In other words, it was clearly established that there had been an encroachment upon a conservation and protection area, yet criminal liability on the part of the defendant could not be determined for the reasons stated. In Considerando V of the judgment (case-file pages [folios] 584 to 587), the reasons are set out for which the destruction of the structures built within the protection zone is warranted, notwithstanding the fact that the persons who carried out the work — among whom was a former MINAE employee — were fully aware of the infringement of the Costa Rican legal order, of which they had also been warned by officials of that institution. As is aptly stated in the judgment: "Conservation areas constitute a general restriction on all owners of properties through which rivers of Costa Rica flow, with the purpose of preserving the natural environment, health, ecology, and what little can still be saved for the equilibrium of planet Earth; such restriction on ownership is a regime that requires the portion of the property under State guardianship to remain intact, from which derives the possibility of carrying out therein only those acts permitted by that regime" (case-file page 585). The judgment is duly reasoned and contains no contradictions, and the ground for cassation must therefore be denied.

III.In the second ground, a lack of reasoning in the judgment is alleged, citing as violated articles 142, 363, and 369 of the Code of Criminal Procedure, and articles 39 and 41 of the Political Constitution. The appellant objects that the judgment fails to specify which constructions must be demolished. The complaint is rejected. In Considerando V of the judgment, the constructions that affect the conservation area and must be demolished are identified with precision, as follows: "on the right bank of [Dirección1] El Ángel, concrete slabs (lozas) and metal structures bolted into the rocks surrounding the gorge (cañón) of the protection zone of the Río El Ángel were installed. On top of that metal structure, an elevated walkway (sendero aéreo), also of metal, was built, approximately 600 m in length, on which six metal and concrete viewing platforms (balcones) were mounted: the first facing the drop of the Catarata Templo, the second facing the drop of the Catarata Magia Blanca, the third and fourth precisely in the zone between the Catarata Magia Blanca and the Catarata Encantada, the fifth facing the drop of the Catarata Escondida, and the sixth and last facing the drop of the Catarata La Paz.

The entire illegally constructed structure — that is, the concrete slabs and metal bases, the metal elevated walkway, and the 6 metal and concrete viewing platforms — was erected at a distance of 5 meters from the channel (cauce) of the Río El Ángel, that is, within the protection zone of that river, and it is precisely for this reason that the legislature decided to criminalize any encroachment upon that area, since the fragility of the ecological balance requires that it be protected against human intrusion and against the carrying out of any works that produce environmental impacts, as these affect and modify its components" (case-file page 585). As may be seen from the foregoing excerpt, the court specified the works constructed within the protection zone that must be demolished in the interest of environmental conservation. The foregoing demonstrates that the alleged defect does not exist.

IV.The appeal on the merits (casación por el fondo) alleges erroneous application of Articles 50 of the Political Constitution, 99(h) of the Ley del Ambiente, 96, 103(1) of the Penal Code, 122 and 123 of the Current Rules on Civil Liability of the 1941 Penal Code, and 140 of the Code of Criminal Procedure. The appellant argues that not even the State itself requested restitution (restitución) for the harm caused, as it was established that no environmental damage exists, and therefore Article 50 of the Political Constitution was inapplicable. Regarding Article 99 of the Ley Orgánica del Ambiente, the appellant contends that this provision establishes administrative sanctions, which are not applicable in criminal jurisdiction (sede penal). The appellant also challenges the application of Article 103 of the Penal Code, arguing that such application requires a request for restitution, which was not made by the Procuraduría General de la República.

Furthermore, the appellant argues that the acquittal of the defendant demonstrated the non-existence of a crime, and therefore it is not possible to order the demolition of the works. The appellant adds that the application of Articles 122 and 123 of the 1941 Penal Code requires the filing of a civil damages action (acción civil resarcitoria), which was not filed by the Procuraduría General de la República. Finally, the appellant argues that Article 140 of the Code of Criminal Procedure is likewise inapplicable, as it is a preventive measure, applicable prior to the issuance of a judgment. The claims are denied.

The issue at hand has already been addressed by this Chamber, among other rulings, in Judgment No. 193-02, issued at 9:00 a.m. on March 8, 2002, and Judgment No. 450-03, issued at 8:48 a.m. on May 22, 2003. The latter ruling stated the following on this matter: "Regardless of the principal or accessory penalty established by each criminal offense for the unlawful conduct, the commission of a crime entails a series of civil consequences, as set forth in Articles 103 of the Penal Code, 123 and 124 of the Current Rules on Civil Liability of the 1941 Penal Code, including restitution of the material object of the crime. Indeed, one of the effects of a criminal judgment is to order restitution to the victim in the full exercise of the infringed right, which is fundamental in nature by virtue of its regulation under Article 41 of the Political Constitution, which provides that 'Resorting to the laws, all persons shall find redress for the injuries or damages they have suffered in their person, property, or moral interests…' (Judgment 346-98, 9:30 a.m., 03-04-98, Third Chamber of the Supreme Court of Justice), which includes, among other aspects, restitution of the material object of the crime (Judgment 511-2000, 9:20 a.m., 19-5-00, Third Chamber of the Supreme Court of Justice).

Article 123 of the Current Rules on Civil Liability of the 1941 Penal Code, in its first two paragraphs, provides: 'The convicted person shall restore to the victim, with compensation for any deterioration or diminution, the thing that is the object of the punishable act (hecho punible); and if unable to do so, shall be obligated to pay its value in accordance with an expert appraisal referring to the date of the offense. If such appraisal is not possible because the thing has been destroyed or has disappeared, the judges shall fix the corresponding value based on the evidence in the record. Restitution shall be ordered even if the thing is in the possession of a third party, without prejudice to the rights that civil law confers upon such party.'; all of which may be ordered ex officio (de oficio), as the provisions of Articles 103, 123, and 124 cited above are mandatory, and does not require that a civil damages action have been filed, as case law has established to the effect that '… claims for damages and losses arising from the crime must be brought through a civil damages action, as required by the procedural rules; however, that same requirement does not apply when the matter concerns restitution of the material object of the crime.

This is so, as this same Chamber has previously held, because restitution does not constitute a form of compensation in the strict sense.' (Judgment No. 52-F, 10:35 a.m., January 31, 1990, Third Chamber of the Supreme Court of Justice, reiterated in Voto # 604-F-91, 9:25 a.m., November 7, 1991, and in Judgment 511-2000, 9:20 a.m., 19-5-2000). The right to the environment, classified as a third-generation human right, has been recognized in Costa Rica as a fundamental right, since Article 50 of the Political Constitution provides that: 'Every person has the right to a healthy and ecologically balanced environment,' and grants private individuals and the State the right and duty to guarantee and defend that right on behalf of all inhabitants; consequently, the commission of a crime makes the community the victim or aggrieved party and, from that perspective, gives rise to the right to reparation for the harm caused.

In the case of the criminal offense of Violation of the Ley de Uso y Conservación de Suelos (No. 7779 of 309 April 1998), Article 52 of that Act provides: 'Whoever contaminates or degrades the soil resource, regardless of the existence of negligence or willful misconduct or the degree of participation, shall be liable to compensate, through the appropriate judicial proceedings, and to repair the damages caused to the environment.', from which a specific regulatory obligation arises requiring the offender to compensate for damages and losses or to repair the harm caused. From a procedural standpoint, Articles 140 and 466 of the Code of Criminal Procedure oblige the judge to order the restoration of things to their state prior to the crime, which the appealed judgment failed to do, as the Procuraduría correctly notes in its brief, and therefore, since the judgment established the defendant's authorship of the act and the harm caused to the environment by the construction of a road through the forest to the river, it is appropriate to order the restoration of the affected area to its condition prior to the act, so that the offender does not benefit from the unlawful conduct committed and so that the environment altered by that conduct may be restored, in furtherance of the protection of the community's interests.

This Court has ruled similarly as follows: "Regarding the condition imposed itself, this court of cassation finds it rational and proportionate to the facts giving rise to the criminal conviction. It should be noted that § 28 of the Political Constitution establishes the impossibility of legal intervention against private actions that cause no harm, from which it follows that the limits of the State's response are defined by the magnitude or gravity of the injury or danger caused. In the present case, where the harm consists of the land-use change (cambio de uso del suelo) of forest land for agricultural purposes, the State's response is limited to repairing that harm, which in any case will not be completed within the three years of suspended sentence execution (ejecución condicional de la pena), since a forest is the product of years and years of birth, growth, and death of countless plant and animal organisms; however, the removal of crops and all other elements by which the forest has been replaced, as well as the reestablishment of plant species to the extent necessary to regenerate what was destroyed, represent a starting point for the reparation that will be achieved over the course of years.

It must be made clear that the protection of forest soil enshrined in §§ 2, 6, 10.c, 19, and 38.f of the Ley Forestal, Article 52 of the Ley de Uso, Manejo y Conservación de Suelos, Articles 53, 54, and 55 of the Ley Orgánica del Ambiente, and Articles 53 and 54 of the Ley de Biodiversidad does not end or is not suspended when, due to human acts (deliberate fires, illegal logging, etc.) or natural events (floods, earthquakes, fires, etc.), the forest is diminished; on the contrary, in those situations the State is required to act with greater resolve in the recovery and conservation of the forest. To think that the duty to protect forest soil and other forest elements ends as a result of any of the acts described would amount to the promotion of unlawful activities harmful to the environment, replacing the ecosystem with agricultural or other forms of exploitation, which would render any protection meaningless; that is to say, the area occupied by forests is subject to lifetime tenure (irreductibilidad) and may not be reduced through such means — the principle of forest lifetime tenure (principio de irreductibilidad del bosque).

Thus, anyone who harms the forest through logging or fires with the purpose of changing the designated use of the land, or anyone who seeks to profit from natural disasters that damage forest soil, must understand that there is no possible way to change the designated use of the soil, and that the State will do everything in its power to recover the forest. That is, in the case at bar, agricultural activity must be eliminated from the area where the forest is to be regenerated, whether by the convicted person in compliance with the condition under which the benefit of suspended sentence execution is granted almost as an incentive, or through State action; the officials responsible for enforcement shall ensure the effectiveness of this judgment. There is no disproportion or abuse in the condition imposed by the trial court. This manner of resolving the matter by the trial judge reaffirms the normative force of the Political Constitution, which in §§ 50 and 74 guarantees to all of humanity, as an inalienable right, the right to a healthy and ecologically balanced environment.

Moreover, the judicial order in this case is consistent with the legislative provision adopted in § 52 of the Ley de Uso, Manejo y Conservación de Suelos, N° 7779 of 30 April 1998…" (Judgment [Telf2], 11:54 a.m., May 5, 2003, authored by Judge [Nombre13]. This holding was reiterated in Judgment 2003-396).

With regard to the case at hand, the judgment did not provide for the restoration of things to their prior state as required by the cited provisions; however, since the judgment arose from an abbreviated procedure (procedimiento abreviado) and since restitution is a direct consequence of the commission of the crime and does not require a civil action, the appropriate course is to grant the appeal on the merits filed and to resolve the matter in this forum by ordering the restoration of the affected forest area to its condition prior to the events. Since the offense involves the construction of a trail or road (trocha o camino) through the mountains, which entailed violation of several provisions, it does not present the same characteristics as cases involving the erection of infrastructure where ordering demolition is the appropriate remedy; therefore, destruction of the road is not deemed feasible; likewise, it is not appropriate to impose the payment of damages and losses, since that would always allow use of the road in exchange for payment, to the benefit of the offender, and therefore restitution in this case must be directed toward the conservation of the forest area; accordingly, the closure of the road is ordered, use of the road in any form whatsoever is prohibited, and the restoration of the forest through the planting of species appropriate to that purpose is ordered, compliance with which may be monitored by the administrative or enforcement authorities.

In the case under study, it was established that a protected area (área de protección) was encroached upon through the construction of a series of works, which must be demolished or destroyed in order to preserve the balance of nature. The commission of a criminal act is not required for courts to order, even ex officio, the restoration of things to their state prior to alteration. It should be noted that Article 103 of the Penal Code itself requires only a punishable act, the scope of which is limited to a criminal wrong (injusto penal). In this case, the existence of the criminal wrong was established, since the act of ordering the construction works — the demolition of which is now ordered — was in violation of the Ley Forestal. Moreover, there was no legal provision authorizing those actions, and therefore the conduct was also contrary to law (antijurídica).

It was therefore the duty of the adjudicator to order the demolition or destruction of the series of structures mentioned in the ruling, as these were built within a protected area (área de protección). Consequently, the objection raised is without merit.

CED1 THEREFORE:

The cassation appeal (recurso de casación) is denied.

Res: 2007-0964 Res: [Telf1] TRIBUNAL DE CASACIÓN PENAL. Segundo Circuito Judicial de San José. Goicoechea, a las diez horas del treinta de agosto del dos mil siete.

RECURSO DE CASACIÓN interpuesto en la presente causa seguida contra [Nombre1], mayor, estadounidense, casado, [Identificacion1], hijo de [Nombre2] y [Nombre3], por el delito de INFRACCIÓN A LA LEY FORESTAL cometido en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, los jueces Rafael Ángel Sanabria Rojas, Ronald Salazar Murillo y [Nombre4]. Se apersonaron en casación el licenciado [Nombre5] [Nombre6] en condición de defensor particular del imputado [Nombre1], el licenciado [Nombre7], Fiscal Adjunto Agrario Ambiental y el licenciado Manuel Gómez Delgado de la Unidad de Casación Penal del Segundo Circuito Judicial de San José.

RESULTANDO:

I.Que mediante sentencia número 160-2007 de las siete horas treinta minutos del cuatro de mayo del dos mil siete, el Tribunal de Juicio de Heredia, resolvió: "POR TANTO: De conformidad con lo expuesto, artículos 39 y 41 de la Constitución Política; 1, 4, 9, 140, 142, 265, 267, 360 a 367, 466, del Código Procesal Penal, 1, 30, 31, 34, 35, 45, 50, 96 párrafo segundo y 140, del Código Procesal Penal, 1, 30, 31, 34, 35, 45, 50, 96 párrafo último de la Ley Forestal, 99 inciso h) de la Ley del Ambiente, se absuelve de toda pena y responsabilidad [Nombre1] del delito de Infracción a la Ley Forestal del que lo acusó el Ministerio Público y el Estado representado por la Procuraduría General de la República como Querellante. Ilícito cometido en perjuicio de los Recursos Naturales. Quedan a cargo del Estado las costas procesales y personales causadas. Dentro de los tres meses posteriores a la firmeza de este fallo, el señor [Nombre1]., debe derribar y demoler todas las obras que se construyeron dentro del área de protección del río Ángel (calzadas, tapias, mallas, miradores y demás construcciones ajenas al entorno), lo que queda a su cargo y costo.

Debe tomar todas las precauciones del caso a fin de evitar daños al río el Ángel y la zona protectora de éste. Lo anterior se dispone bajo apercibimiento de que en su omisión se le podrá abrir causa por desobediencia a la autoridad. Queda obligado el MINAE, a velar porque se de cabal cumplimiento a lo anterior. Mediante lectura notifíquese. [Nombre8], Juez." (sic)

II.Que contra el anterior pronunciamiento interpuso recurso de casación el Licenciado [Nombre9] representante legal de Ana María López Retana en su condición de querellante y actora civil.

III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 450 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de casación.

IV. Que en los procedimientos se han observado las prescripciones legales pertinentes

Redacta el Juez [Nombre10]; y,

CONSIDERANDO:

I . El recurso de casación reúne los requisitos de admisibilidad establecidos por los artículos 422, 423, 424, 443, 444 y 445 del Código Procesal Penal.

II.En el primer motivo de casación por la forma, el licenciado [Nombre11], defensor particular del imputado [Nombre1]., alega falta de fundamentación de la sentencia. Cita como violados los artículos 142, 363, 369 del Código Procesal Penal, 39 y 41 de la Constitución Política. Estima el recurrente que existe ausencia de motivación, pues a pesar de dictarse una absolutoria a favor de su cliente, se decreta la demolición, remoción o derribo de estructuras y otros inmuebles. A su juicio el fallo contiene una motivación contradictoria pues por un lado, en el considerando V, se tiene por acreditado que las construcciones no ocasionaron ningún daño ambiental, con lo cual no existe violación al bien jurídico tutelado y que el Proyecto Jardines de la Catarata es un Santuario de Protección del Medio Ambiente, siendo hoy un Refugio Privado de Vida Silvestres, por ordenarse así en Decreto Ejecutivo del MINAE.

De seguido, expresa el impugnante, el Tribunal de mérito sostiene que las áreas de conservación suponen una limitación genérica, a todo propietario de inmuebles por los que corren los ríos de Costa Rica, con la finalidad de preservar el ambiente natural, la ecología y lo poco que puede salvarse para el equilibrio del planeta tierra. Agrega que, luego de admitir que existen permisos y que no existe violación al bien jurídico, se concluye que no es permitido que se invadan dichas áreas y menos realizar construcciones que produzcan impactos en el ambiente, determinándose que sí existe una transgresión a las normas que prohíben la intromisión del ser humano en dichas zonas de protección. Estima que existe una contradicción insalvable en lo resuelto, pues no puede ser que se sostenga que no existe violación al bien jurídico protegido por los normas invocadas por el Ministerio Público y luego se concluya que las construcciones afectan el área protegida.

Afirma que lejos de afectar la zona, las obras realizadas protegieron en mayor medida el ambiente. Además, que realizar las obras de derribo afectaría considerablemente el ambiente, más que dejando el sitio tal y como está ahora. Sin lugar el motivo. El fallo no contiene las contradicciones que se reprochan en el recurso de casación. Debe tomarse en cuenta que la sentencia es una unidad lógico jurídica y de todo el texto se deriva, en forma clara y precisa que las obras realizadas en el predio propiedad de la empresa representada por el imputado se encuentran dentro de un área de conservación y protección, lo cual implica una violación de lo establecido por el artículo 58 inciso c) de La Ley Forestal. Si bien es cierto se ordenó una absolutoria a favor del acusado [Nombre12], ésta tiene su fundamento en la aplicación de un error de prohibición directo (artículo 35 del Código Penal), en el tanto no fue posible descartar que él hubiese incurrido en un error, cuando ordenó realizar las obras, pensando que no implicaban una infracción al ordenamiento jurídico costarricense, el cual no conocía a plenitud por su condición de ciudadano de los Estados Unidos de América.

Es decir, quedó claro que hubo una invasión a un área de conservación y protección, sin que pudiese determinarse la responsabilidad penal del imputado, por las razones referidas. En considerando V de la sentencia (folios 584 a 587), se exponen las razones por las cuales procede la destrucción de las construcciones realizadas en el área de protección, a pesar de que a las personas que realizan la obra, entre las cuales se encontraba un exempleado del MINAE, tenían pleno conocimiento de la infracción al ordenamiento jurídico costarricense, de lo cual también habían sido advertidos por funcionarios de dicha institución. Como bien se menciona en la sentencia "Las áreas de conservación suponen una limitación genérica, a todo propietario de inmuebles por los que corren los ríos de Costa Rica, con la finalidad de preservar el ambiente natural, la salud, la ecología y lo poco que pueda salvarse para el equilibrio del planeta Tierra, tal restricción al dominio es un régimen que obliga a mantener intacta la porción del inmueble bajo la tutela estatal, de donde deriva la posibilidad de realizar en aquella únicamente los actos permitidos por ese régimen" (folio 585). La sentencia se encuentra debidamente motivada y no se incurre en contradicciones, de ahí que deba declararse sin lugar el motivo de casación.

III.En el segundo motivo se invoca falta de motivación de la sentencia, citándose como violados los artículos 142, 363, 369 del Código Procesal Penal, 39 y 41 de la Constitución Política. Reprocha el recurrente que no se indican, en la sentencia, las construcciones que deben ser derribadas. Se rechaza el reclamo. En el considerando V del fallo se indica con exactitud las construcciones que afectan el área de conservación y que deben ser destruidas, a saber, "sobre la margen derecha del [Dirección1] el Ángel se fijaron lozas de concreto y estructuras de metal clavadas en las rocas que rodean el cañón de la zona de protección del río El Ángel. Sobre esa edificación de metal, se hizo un camino o sendero aéreo, también de metal, que presenta una longitud aproximada de 600 m y sobre el cual se montaron seis balcones de metal y concreto, el primero de estos frente a la caída de la catarata Templo, el segundo frente a la caída de la catarata Magia Blanca, el tercero y cuarto justo en la zona entre la catarata Magia Blanca y la Catarata Encantada, el quinto frente a la caída de la catarata Escondida y el sexto y último frente a la caída de la catarata La Paz.

Toda la estructura ilegalmente construida, es decir, las lozas y bases de metal, el sendero aéreo de mental y los 6 balcones de metal y cemento, se erigieron a una distancia de 5 metros del cauce del río El Ángel, es decir, dentro de la zona de protección de ese río, por lo que precisamente por esta razón es que el legislador decidió penalizar cualquier invasión de dicha área, ya que la fragilidad del equilibrio ecológico requiere que el mismo sea protegido contra intromisiones del ser humano y que se realice cualquier obra que produzca impactos en el ambiente, pues afecta y modifica factores de éste" (folio 585). Según se aprecia en la anterior transcripción, el juzgador mencionó las obras que se encuentran construidas dentro del área de protección y que deben ser derribadas, en aras de la conservación del ambiente. Se evidencia con lo anterior que no existe el vicio que se reclama.

IV.En la casación por el fondo se invoca errónea aplicación de los artículos 50 de la Constitución Política, 99 inciso h) de la Ley del Ambiente, 96, 103 inciso 1) del Código Penal, 122, 123 de las reglas vigentes de responsabilidad civil del Código Penal de 1941 y 140 del Código Procesal Penal. Afirma que ni el propio Estado solicitó la restitución del daño causado, pues se acreditó que no existe un daño ambiental, con lo cual no resultaba aplicable el artículo 50 de la Constitución Política. En cuanto al artículo 99 de la Ley Orgánica del Ambiente, estima que se trata de una norma con sanciones administrativas, no aplicables en sede penal. También reprocha la aplicación del artículo 103 del Código Penal, pues tal requiere una solicitud de restitución, que no fue planteada por la Procuraduría General de la República. Además, estima que al absolverse al imputado quedó demostrada la inexistencia de un delito y por ello no es posible ordenar el derribo de las obras.

Agrega que la aplicación de los artículos 122 y 123 del Código Penal de 1941 exigen la presentación de la acción civil resarcitoria, la cual no fue presentada por la Procuraduría General de la República. Finalmente, estima que el artículo 140 del Código Procesal Penal tampoco resulta aplicable, pues se trata de una medida preventiva, antes del dictado de la sentencia. Sin lugar los reclamos. El tema en cuestión ya ha sido objeto de pronunciamientos por esta Cámara, entre otros en las sentencias No. 193-02, de las 9:00 horas, del 8 de marzo del 2002 y No. 450-03, de las 8:48 horas, del 22 de mayo del 2003. En el último fallo se dispuso sobre el particular: "Independientemente de la pena principal o accesoria que establece cada tipo penal para la conducta delictiva, la comisión del delito conlleva una serie de consecuencias civiles, tal como lo establecen los artículos 103 del Código Penal, 123 y 124 de las Reglas Vigentes sobre Responsabilidad Civil del Código Penal de 1941, entre ellas la restitución del objeto material del delito.

Precisamente, uno de los alcances de la sentencia penal es ordenar la restitución al ofendido en el ejercicio pleno de su derecho lesionado, que tiene la naturaleza de un derecho fundamental por su regulación en el artículo 41 de la Constitución Política que establece que "Ocurriendo a las leyes, todos han encontrar reparación para las injurias o daños que hayan recibido en su persona, propiedad o intereses morales…" (Sentencia 346-98 de 9:30 hrs del 03-04-98 Sala Tercera de la Corte Suprema de Justicia), lo cual comprende entre otros aspectos la restitución del objeto material del delito (Sentencia 511-2000 de las 9:20 hrs. del 19-5-00 de la Sala Tercera de la Corte Suprema de Justicia). El artículo 123 de las Reglas Vigentes Sobre Responsabilidad Civil del Código Penal de 1941, en sus dos primeros párrafos establece que: "Deberá el condenado restituir al ofendido, con abono de todo deterioro o menoscabo, la cosa objeto del hecho punible, y si no pudiere hacerlo, estará obligado a satisfacer su valor conforme a estimación pericial referida a la fecha de la infracción.

Si tal estimación no fuese posible hacerla por haber sido destruida o haber desaparecido la cosa, los jueces fijarán el valor respectivo, ateniéndose a los datos del juicio. La restitución se ordenará aun cuando la cosa se hallare en poder de un tercero, dejando a salvo los derechos que la ley civil confiere a este."; todo lo cual puede ordenarse de oficio por ser imperativa la regulación del artículo 103, 123 y 124 antes citados, y no requiere que se haya instaurado la acción civil resarcitoria, como bien lo ha establecido la jurisprudencia en el sentido que “... el reclamo de los daños y perjuicios provenientes del delito debe hacerse por medio de la acción civil resarcitoria, porque así lo condiciona la normativa procesal; sin embargo esa misma condición no existe cuando se trata de la restitución del objeto material del delito. Ello es así, conforme lo ha interpretado anteriormente esta misma Sala, porque la restitución no constituye una forma de indemnización en sentido estricto." (Sentencia Nº 52-F 10:35 hrs. 31 enero 1990 de la Sala Tercera de la Corte Suprema de Justicia, reiterado en Voto # 604-F-91, de 9:25 horas del 7 de noviembre de 1.991 y en Sentencia 511-2000 de 9:20 hrs del 19-5-2000).

El derecho al medio ambiente, calificado como un derecho humano de la tercera generación, ha sido reconocido en Costa Rica como un derecho fundamental, pues el artículo 50 de la Constitución Política cuando dispone que: "Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado." y le otorga a los particulares y al Estado el derecho y el deber de garantizar y defender ese derecho en nombre de todos los habitantes, por lo que la comisión del delito convierte a la colectividad en víctima u ofendida con el hecho y desde esa perspectiva adquiere el derecho a la reparación del daño causado. Tratándose de un delito de Infracción a la Ley de Uso y Conservación de Suelos ( No. 7779 de 309 abril de 1998) el artículo 52 de dicha ley establece que: "Quien contamine o deteriore el recurso suelo, independientemente de la existencia de culpa o dolo o del grado de participación, será responsable de indemnizar, en la vía judicial que corresponda, y de reparar los daños causados al ambiente.", de donde se deriva una regulación específica que obliga al infractor a indemnizar los daños y perjuicios o a reparar los daños causados.

Desde la perspectiva procesal, el artículo 140 y 466 del Código Procesal Penal obligan al Juez a disponer la restitución de las cosas al estado anterior al delito, lo cual omite el fallo recurrido como bien lo apunta la Procuraduría en su gestión, por lo que establecido en la sentencia la autoría del hecho por parte del imputado y la lesión al medio ambiente por la apertura de un camino en el bosque hasta el río, es procedente ordenar la restitución del área afectada al estado anterior al hecho, a fin de que el infractor no derive provecho de la ilicitud realizada y se logre restaurar el medio ambiente alterado con su acción en pro de la tutela de los intereses de la colectividad. En sentido similar ha resuelto este Tribunal lo siguiente: "En cuanto a la condición impuesta en sí, esta corte de casación la encuentra racional y proporcionada a los hechos generadores de la condena penal. Obsérvese que el § 28 de la Constitución Política establece la imposibilidad de intervención legal ante acciones privadas que no causen daño, de donde deriva que el límite de la reacción estatal viene marcado por la magnitud o gravedad de la lesión o peligro causados.

En el presente caso, en que el daño es el cambio del uso del suelo del bosque para dedicarlo a agricultura, la reacción estatal tiene su límite en la reparación del daño, que de todas formas no se completará en los tres años de ejecución condicional de la pena, puesto que el bosque es producto de años y años de nacimiento, desarrollo y muerte de muchos seres vegetales y animales; sin embargo, la exclusión de los cultivos y de todo elemento con que se ha sustituido el bosque, así como el restablecimiento de especies vegetales en la medida adecuada para regenerar lo destruido, son un principio para la reparación que en algunos años se alcanzará. Debe quedar claro que la protección del suelo de los bosques consagrada en los §§ 2, 6, 10.c, 19 y 38.f de la Ley Forestal, 52 de la Ley de Uso, Manejo y Conservación de Suelos, 53, 54 y 55 de la Ley Orgánica del Ambiente, 53 y 54 de la Ley de Biodiversidad, no termina o se suspende cuando por actos de seres humanos (incendios provocados, talas ilegales, etc.) o por hechos de la naturaleza (inundaciones, terremotos, incendios, etc.) el bosque viene a menos; antes por el contrario, ante esas situaciones se impone al Estado mayor agresividad en la recuperación y conservación del bosque.

Pensar que el deber de protección del suelo forestal y de otros elementos del bosque termina por cualquiera de los hechos indicados, se traduciría en la promoción de actividades ilícitas lesivas del medio ambiente, para sustituir la ecología por explotaciones agrícolas o de otra naturaleza, con lo que no habría protección verdadera; es decir, el espacio ocupado por los bosques es irreductible por esas vías (principio de irreductibilidad del bosque). De este modo, cualquiera que lesione el bosque con tala o incendios con el propósito de cambiar el destino del terreno, o cualquiera que pretenda obtener provecho de desastres naturales que dañen el suelo forestal, debe comprender que no hay forma posible de cambiar el destino del suelo, y que el Estado hará cuanto sea para recuperar el bosque. Esto es, en el caso de autos deben desaparecer la actividad agrícola del lugar donde corresponde regenerar el bosque, ya sea que lo haga el condenado en cumplimiento de la cláusula por la que se le otorga casi como incentivo el beneficio de ejecución condicional de la pena, ya sea por la acción del Estado; los funcionarios responsables de la ejecución verán por la eficacia del fallo de mérito.

No hay desproporción o abuso en la condición impuesta por el juzgador. Esta forma de resolver por parte del juez de juicio, reafirma el valor normativo de la Constitución Política, que en sus §§ 50 y 74 garantizan a la humanidad entera, con carácter de irrenunciable, el derecho a un ambiente sano y ecológicamente equilibrado. Amén de lo anterior, la disposición judicial en este caso guarda identidad con la disposición legislativa adoptada en § 52 de la Ley de Uso, Manejo y Conservación de Suelos, N° 7779 de 30 de abril de 1.998…" (Sentencia [Telf2], de 11:54 hrs. del 5 de mayo del 2003 con redacción del Juez [Nombre13]. Este criterio fue reiterado en sentencia 2003-396). Referido al caso que nos ocupa, la sentencia no contempló la restitución de las cosas al estado anterior como ordena la normativa citada, no obstante, por provenir el fallo de un procedimiento abreviado y por ser la restitución una consecuencia directa de la comisión del delito y no requerir acción civil, lo propio es acoger el recurso de casación planteado y resolver en esta sede disponiendo la restitución del área de bosque afectada a su estado anterior a los hechos.

Por tratarse de la construcción de una trocha o camino en la montaña, que implicó infracción a varias normas, no presenta las mismas características que en casos de levantamiento de una infraestructura en que ordenar la demolición constituye una solución, por ello no se observa viable la destrucción del camino; de igual forma no resulta atinente imponer el pago de los daños y perjuicios, toda vez que ello siempre permitiría el uso del camino a cambio del pago con provecho al infractor, por lo que la restitución en este caso debe orientarse hacia la conservación del área de bosque y en atención a ello se dispone el cierre del camino y se prohibe el uso en cualquiera de las formas posibles y se ordena la restitución del bosque mediante la siembra de especies propias para tal fin, cuyo cumplimiento podrá vigilarse por las autoridades administrativas o de ejecución". En el caso en estudio quedó demostrado que se invadió un área de protección, mediante la construcción de una serie de obras, que deben ser derribadas o destruidas en aras de mantener el equilibrio de la naturaleza.

No se requiere la comisión de un hecho delictivo para que los tribunales, aún de oficio, decreten la restitución de las cosas al estado anterior a su modificación. Nótese que el propio artículo 103 del Código Penal únicamente exige un hecho punible, cuyos alcances se limitan a un injusto penal. En esta causa se acreditó la existencia del injusto, pues la acción de ordenar las construcciones, cuyo derribo ahora se acuerda, resultaban violatorias de la Ley Forestal. Además, no había una norma que autorizara dichas acciones, con lo cual la acción también resultaba antijurídica. De tal forma que era obligación del juzgador ordenar el derribo o destrucción de la serie de obras que se mencionan en el fallo, pues estas fueron construídas en un área de protección. Consecuentemente, no es atendible el reproche formulado.

CED1 TANTO:

Se declara sin lugar el recurso de casación.
