Res. [Telf1] TRIBUNAL DE CASACIÓN PENAL. Segundo Circuito Judicial de San José. Goicoechea, at eleven hours and forty-eight minutes on the twenty-second of May, two thousand and three.
CASSATION APPEAL filed in the present case brought against [Nombre1], of legal age, married, Costa Rican, national identity card number CED1, for the offense of VIOLATION OF THE Ley Forestal in the modalities of ILLEGAL LOGGING (tala ilegal), LAND-USE CHANGE (cambio de uso de suelo), INVASION OF A PROTECTION ZONE (zona de protección), AND ILLEGAL CONSTRUCTION OF A TRAIL (trocha), to the detriment of NATURAL RESOURCES. The Judges Ronald Salazar Murillo, Rafael Ángel Sanabria Rojas, and [Nombre2] participated in the decision on the appeal. Licenciado [Nombre3], representing the State, appeared in the cassation proceedings.
RECITALS:
I.That by judgment number 69-02, issued at fourteen hours and twenty minutes on the ninth of October, two thousand and two, the Tribunal de Cartago, Sede Turrialba, ruled: POR TANTO: On the merits of the foregoing and in accordance with articles 39 and 41 of the Constitución Política, articles 1, 24, 30, 31, 45, 47, 50, 51, 59, 60, 71 through 74 of the Código Penal, and articles 373, 374, 375 of the Código Procesal Penal, articles 58 subparagraph a), 61 subparagraphs a) and c) in relation to Art. 19 and article 3, and article 62 of Ley 7575, [Nombre4] [Nombre5] IS DECLARED the responsible author of the offense of VIOLATION OF THE Ley Forestal in the modalities of ILLEGAL LOGGING, LAND-USE CHANGE, INVASION OF A PROTECTION ZONE, AND ILLEGAL CONSTRUCTION OF A TRAIL, committed to the detriment of NATURAL RESOURCES; in his capacity as author, he is sentenced to ONE YEAR OF IMPRISONMENT, a sentence which the convict shall serve in the place and manner determined by the applicable prison regulations (reglamentos carcelarios), with credit for any pretrial detention (prisión preventiva) already served in connection with these facts.
The costs of the criminal proceedings shall be borne by the State. The defendant [Nombre6] is granted the benefit of a suspended sentence (beneficio de ejecución condicional de la pena) for a period of five years, and at this time the statutory warnings are given to him to the effect that if within said period he were to commit an offense for which he is convicted and sentenced to more than six months of imprisonment, he shall be required to serve both the sentence imposed herein and that for the new offense. Once this judgment becomes final, it shall be recorded in the Registro Judicial; the customary certified copies (testimonios de estilo) shall be forwarded to the Juzgado de Ejecución de la Pena and the Instituto Nacional de Criminología. NOTIFY THE PARTIES.- Licda. [Nombre7]. JUDGE.-
III.That having conducted the respective deliberation in accordance with the provisions of article 450 of the Código Procesal Penal, the Court considered the issues raised in the cassation appeal.
The opinion is drafted by Cassation Judge [Nombre8]; and,
CONSIDERING:
In this matter, the Procuraduría General de la República was recognized as a party (f.6) and did not appear at the preliminary hearing at which the abbreviated procedure (procedimiento abreviado) was agreed upon (f.51), which was resolved by judgment No. 69-02 issued at 14:20 hours on October 9, 2002, by the Tribunal de Cartago, Sede Turrialba, in which the defendant [Nombre9] was convicted of the offenses of illegal logging, legal construction of a trail, land-use change, and invasion of a protection zone (zona protectora). Licenciado [Nombre10], Environmental Criminal Prosecutor (Procurador Penal Ambiental), representing the State, filed a cassation appeal against the aforementioned judgment; that entity has standing to file such an appeal, since article 3 of the Ley Orgánica de la Procuraduría General de la República expressly provides that it must be recognized as an independent party regardless of whether it has been constituted as a complainant (querellante) or civil plaintiff (actor civil), as this Court has repeatedly held. (Res: [Telf2], 11:25 hrs. of 5-09-02, Tribunal de Casación Penal). The appeal meets the formal requirements for admissibility, and therefore the grievances raised shall be considered.
Lack of reasoning due to failure to rule on the restitution of things to their prior state. Because both grounds relate to the same procedural aspect, they are addressed jointly. In the present case, the defendant [Nombre9] was found guilty of illegal logging (tala ilegal), land-use change (cambio de uso de suelo), encroachment upon the protection zone (zona de protección), and the illegal construction of a trail (trocha), and was sentenced to one year of imprisonment with the benefit of a suspended sentence (ejecución condicional) for five years. The appellant contends that Article 140 of the code of criminal procedure and Article 103 of the penal code establish that every punishable act entails the obligation to restore things and to repair the damages caused, as do Articles 122 and 123 of the Código Penal de 1941, which provide as a consequence the obligation to restore the victim in the full exercise of their right.
Furthermore, Article 52 of the Ley de Uso y Conservación de Suelos establishes that "Any person who contaminates or damages the soil resource (recurso suelo), regardless of the existence of negligence or criminal intent (culpa o dolo) or the degree of participation, shall be responsible for providing compensation through the appropriate judicial proceedings and for repairing the damages caused to the environment and to third parties." Under the foregoing legal framework, the only way to restore things to their prior state in cases of environmental damage such as the present one, in order to reverse the harm caused, is by ordering the restoration of the area to its prior state, as a remedy to prevent the effects of the damage from persisting.
Contrary to that duty, the judgment convicting the accused makes no ruling whatsoever in that regard, failing to observe Articles 103 of the penal code and 123 of the Código Penal de 1941, which required the court to declare in its judgment that the defendant was obligated to restore the area affected by the punishable act so that it could regenerate. The failure to order anything in that regard constitutes a benefit for the offender, who has thereby seen his conduct effectively legalized and will henceforth be able to exploit for his own benefit a forest area and a protection zone that he was legally required to preserve, all to the detriment of the legally protected interest (bien jurídico tutelado), not only under the legal system but also under the Constitución Política. The ground raised is hereby sustained and the matter is decided on the merits. Regardless of the principal or accessory penalty established by each criminal offense for the conduct in question, the commission of a crime entails a series of civil consequences, as provided by Articles 103 of the penal code, 123 and 124 of the Reglas Vigentes sobre Responsabilidad Civil del Código Penal de 1941, including the restitution of the material object (objeto material) of the crime.
Indeed, one of the effects of a criminal judgment is to order restitution to the victim in the full exercise of the right that was violated, which is a fundamental right by virtue of its regulation under Article 41 of the Constitución Política, which provides that "By recourse to the laws, all persons shall find reparation for the injuries or damages they have sustained in their person, property, or moral interests…" (Sentencia 346-98 de 9:30 hrs del 03-04-98 Sala Tercera de la Corte Suprema de Justicia), which includes, among other aspects, the restitution of the material object of the crime (Sentencia 511-2000 de las 9:20 hrs. del 19-5-00 de la Sala Tercera de la Corte Suprema de Justicia).
Article 123 of the Reglas Vigentes Sobre Responsabilidad Civil del Código Penal de 1941, in its first two paragraphs, provides that: "The convicted person shall restore to the victim, with allowance for all deterioration or diminishment, the thing that was the object of the punishable act; and if unable to do so, shall be obligated to pay its value according to expert appraisal (estimación pericial) made with reference to the date of the offense. If such appraisal is not possible because the thing has been destroyed or has disappeared, the judges shall establish the respective value based on the evidence at trial. Restitution shall be ordered even when the thing is in the possession of a third party, without prejudice to the rights that civil law confers upon such third party."; all of which may be ordered ex officio (de oficio) given the mandatory nature of Articles 103, 123, and 124 cited above, and does not require that a civil damages action (acción civil resarcitoria) have been filed, as established by case law in the sense that "… the claim for damages arising from the crime must be brought by means of the civil damages action, because the procedural rules so require; however, that same requirement does not apply when it comes to the restitution of the material object of the crime.
This is so, as this same Chamber has previously interpreted, because restitution does not constitute a form of compensation in the strict sense." (Sentencia Nº 52-F 10:35 hrs. 31 enero 1990 de la Sala Tercera de la Corte Suprema de Justicia, reiterado en Voto # 604-F-91, de 9:25 horas del 7 de noviembre de 1.991 y en Sentencia 511-2000 de 9:20 hrs del 19-5-2000).
The right to the environment, classified as a third-generation human right, has been recognized in Costa Rica as a fundamental right, as Article 50 of the Constitución Política provides that: "Every person has the right to a healthy and ecologically balanced environment." It grants both private individuals and the State the right and the duty to guarantee and defend that right on behalf of all inhabitants; therefore, the commission of the crime renders the community the victim of the act and, from that perspective, the community acquires the right to reparation of the harm caused. In the case of an offense of Violation of the Ley de Uso y Conservación de Suelos (No. 7779 of 309 April 1998), Article 52 of said law provides that: "Any person who contaminates or damages the soil resource, regardless of the existence of negligence or intent or the degree of participation, shall be responsible for providing compensation through the appropriate judicial proceedings and for repairing the damages caused to the environment.", from which a specific regulatory framework derives that obliges the offender to compensate for losses and damages or to repair the harm caused.
From a procedural standpoint, Articles 140 and 466 of the Código Procesal Penal require the judge to order the restoration of things to the state existing prior to the crime, which the appealed judgment omits, as the Procuraduría correctly notes in its submission; therefore, having established in the judgment the defendant's authorship of the act and the harm to the environment caused by the clearing of a road through the forest to the river, it is appropriate to order the restoration of the affected area to its state prior to the act, so that the offender does not derive benefit from the unlawful conduct and so that the environment altered by his actions may be restored in protection of the collective interest. This Court has ruled in a similar vein as follows: "Regarding the condition imposed itself, this cassation court finds it rational and proportionate to the acts giving rise to the criminal conviction.
Note that § 28 of the Const.Pol. establishes the impossibility of legal intervention in private actions that cause no harm, from which it follows that the limit of the State's response is defined by the magnitude or severity of the injury or danger caused. In the present case, where the harm consists of the land-use change of forest land for agricultural use, the State's response is limited to the repair of the damage, which in any event will not be completed within the three years of the suspended sentence, since a forest is the product of years and years of birth, growth, and death of many plant and animal organisms; nonetheless, the removal of crops and all elements with which the forest has been replaced, as well as the reestablishment of plant species to the extent appropriate to regenerate what was destroyed, constitute a starting point for the repair that will be achieved in years to come.
It must be made clear that the protection of forest soil enshrined in §§ 2, 6, 10.c, 19 and 38.f of the Ley Forestal, Article 52 of the Ley de Uso, Manejo y Conservación de Suelos, Articles 53, 54, and 55 of the Ley Orgánica del Ambiente, and Articles 53 and 54 of the Ley de Biodiversidad, does not end or become suspended when the forest is diminished by human acts (arson, illegal logging, etc.) or by natural events (floods, earthquakes, fires, etc.); on the contrary, in such situations the State is required to act with greater urgency in the recovery and conservation of the forest. To believe that the duty to protect forest soil and other elements of the forest comes to an end by reason of any of the acts described would translate into the promotion of unlawful activities harmful to the environment, aimed at replacing ecosystems with agricultural or other forms of exploitation, resulting in the absence of genuine protection; that is to say, the area occupied by forests is irreducible by such means (the principle of forest irreducibility (principio de irreductibilidad del bosque)).
In this way, anyone who damages the forest through logging or fires with the intent of changing the land's designated use, or anyone who seeks to profit from natural disasters that harm forest soil, must understand that there is no possible way to change the designated use of the land, and that the State will do whatever is necessary to restore the forest. That is, in the case at hand, all agricultural activity must cease in the area where the forest is to be regenerated, whether carried out by the convicted person in compliance with the condition under which the benefit of a suspended sentence is granted to him almost as an incentive, or through the action of the State; the officials responsible for enforcement shall ensure the effectiveness of the judgment on the merits. There is no disproportion or abuse in the condition imposed by the trial judge. This manner of resolution by the trial judge reaffirms the normative value of the Const.Pol., which in its §§ 50 and 74 guarantees to all of humanity, as an inalienable right, the right to a healthy and ecologically balanced environment.
In addition to the foregoing, the judicial order in this case is consistent with the legislative provision adopted in § 52 of the Ley de Uso, Manejo y Conservación de Suelos, N° 7779 de 30 de abril de 1.998…" (Sentencia [Telf3], de 11:54 hrs. del 5 de mayo del 2003, authored by Judge [Nombre11]. This holding was reiterated in sentencia 2003-396).
With regard to the case before us, the judgment did not contemplate the restoration of things to their prior state as required by the legal framework cited; however, given that the ruling arose from an abbreviated proceeding (procedimiento abreviado) and that restitution is a direct consequence of the commission of the crime requiring no civil action, it is appropriate to sustain the cassation appeal (recurso de casación) filed and to resolve in this venue by ordering the restoration of the affected forest area to its state prior to the acts in question. Because this case involves the construction of a trail or road through the mountains, which entailed violations of various legal provisions, it does not present the same characteristics as cases involving the erection of a structure, where ordering demolition constitutes a solution; therefore, destroying the road is not considered viable.
Likewise, it is not appropriate to impose the payment of damages, since doing so would always allow continued use of the road in exchange for payment, to the offender's benefit; therefore, restitution in this case must be directed toward the conservation of the forest area, and to that end the closure of the road is ordered, its use in any form whatsoever is prohibited, and the restoration of the forest through the planting of species appropriate for that purpose is ordered, compliance with which may be monitored by the administrative or enforcement authorities.
THEREFORE:
The cassation appeal (recurso de casación) filed is hereby granted. The complete closure of the road referred to in the present case is ordered, and its use in any form whatsoever is prohibited. Se otorga a favor del encartado [Nombre6] el Beneficio de ejecución condicional de la pena por un período de cinco años y en el acto se le hacen las advertencias de ley en el sentido de que si dentro de dicho plazo llegara a cometer delito en el cual se le condene y se le imponga sanción mayor a seis meses de prisión deberá descontar la pena aquí impuesta y la del nuevo delito. Una vez firme la sentencia inscríbase en el Registro Judicial, remítanse los testimonios de estilo ante el Juzgado de Ejecución de la Pena y el Instituto Nacional de Criminología. NOTIFÍQUESE.- Licda. [Nombre7]. JUEZA.-
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 450 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el Recurso de Casación.-
Redacta el Juez de Casación [Nombre8]; y,
CONSIDERANDO:
En este asunto la Procuraduría General de la República fue tenida como parte (f.6) y no compareció a la audiencia preliminar en donde se acordó el procedimiento abreviado (f.51) el cual fue resuelto por sentencia No. 69-02 dictada a las 14:20 horas del 9 de octubre del año 2002, dictada por el Tribunal de Cartago, sede de Turrialba, en que se condenó al encartado [Nombre9] por los delitos de tala ilegal, construcción legal de un atrocha, cambio de uso de la tierra e invasión de zona protectora. El Licenciado [Nombre10], Procurador Penal Ambiental, en representación del Estado, formula recurso de casación contra la sentencia referida, ostentando dicha entidad legitimación para interponer dicho recurso, pues el artículo 3 de la Ley Orgánica de la Procuraduría General de la República dispone expresamente que debe tenerse como parte independientemente de que se constituya en querellante o actor civil, tal como lo ha resuelto en forma reiterada este Tribunal. (Res: [Telf2], 11:25 hrs. del 5-09-02 Tribunal de Casación Penal). El recurso reúne los requisitos formales de admisibilidad por lo que procede conocer los agravios.
Falta de fundamentación por omisión de pronunciarse sobre la restitución de las cosas al estado anterior. Por referirse ambos motivos a un mismo aspecto de forma se conocen en forma conjunta. En el caso que se conoce, el imputado [Nombre9] fue declarado autor de tala ilegal, cambio de uso de suelo, invasión de la zona de protección y construcción ilegal de trocha y se le impuso un año de prisión con beneficio de ejecución condicional por cinco años. Señala el impugnante que el artículo 140 del código procesal y 103 del código penal, establecen que todo hecho punible conlleva la obligación de restituir las cosas y la reparación de los daños causados, al igual que lo establecen los artículos 122 y 123 del Código Penal de 1941 que contempla como consecuencia la obligación de restituir al ofendido en su derecho. Por otro lado, el artículo 52 de la Ley de Uso y Conservación de Suelos, establece que "Quien contamine o deteriore el recurso suelo, independientemente de la existencia de culpa o dolo o del grado de participación, será responsable de indemnizar, en la vía judicial que corresponda, y de reparar los daños causados al ambiente y a terceros." De acuerdo a la normativa anterior, la única forma de restituir las cosas al estado anterior en caso de daños al medio ambiente como el caso que se conoce, a fin de revertir el daño causado, es ordenando la restitución del área al estado anterior, como un remedio para impedir que se mantengan los efectos del daño.
Contrario a ese deber, la sentencia que condena al encartado no hace pronunciamiento alguno en tal sentido, inobservando los artículos 103 del código penal y 123 del Código Penal de 1941 que le obligaban a declarar en sentencia que el imputado estaba obligado a restituir el área afectada por el hecho punible a efecto de que pueda regenerarse. El no ordenar nada en ese sentido resulta un beneficio para el infractor que con ello ha visto legalizada su actuación y en lo sucesivo podrá usufructuar en beneficio propio un área de bosque y una zona de protección que estaba obligado por ley a preservar, todo en detrimento del bien jurídico tutelado, no sólo del ordenamiento jurídico sino de la Constitución Política. Se declara con lugar el motivo alegado y se resuelve por el fondo. Independientemente de la pena principal o accesoria que establece cada tipo penal para la conducta delictiva, la comisión del delito conlleva una serie de consecuencias civiles, tal como lo establecen los artículos 103 del código penal, 123 y 124 de las Reglas Vigentes sobre Responsabilidad Civil del Código Penal de 1941, entre ellas la restitución del objeto material del delito.
Precisamente, uno de los alcances de la sentencia penal es ordenar la restitución al ofendido en el ejercicio pleno de su derecho lesionado, que tiene la naturaleza de un derecho fundamental por su regulación en el artículo 41 de la Constitución Política que establece que "Ocurriendo a las leyes, todos han encontrar reparación para las injurias o daños que hayan recibido en su persona, propiedad o intereses morales…" (Sentencia 346-98 de 9:30 hrs del 03-04-98 Sala Tercera de la Corte Suprema de Justicia), lo cual comprende entre otros aspectos la restitución del objeto material del delito (Sentencia 511-2000 de las 9:20 hrs. del 19-5-00 de la Sala Tercera de la Corte Suprema de Justicia). El artículo 123 de las Reglas Vigentes Sobre Responsabilidad Civil del Código Penal de 1941, en sus dos primero párrafos establece que: "Deberá el condenado restituir al ofendido, con abono de todo deterioro o menoscabo, la cosa objeto del hecho punible, y si no pudiere hacerlo, estará obligado a satisfacer su valor conforme a estimación pericial referida a la fecha de la infracción.
Si tal estimación no fuese posible hacerla por haber sido destruida o haber desaparecido la cosa, los jueces fijarán el valor respectivo, ateniéndose a los datos del juicio. La restitución se ordenará aun cuando la cosa se hallare en poder de un tercero, dejando a salvo los derechos que la ley civil confiere a este."; todo lo cual puede ordenarse de oficio por ser imperativa la regulación del artículo 103, 123 y 124 antes citados, y no requiere que se haya instaurado la acción civil resarcitoria, como bien lo ha establecido la jurisprudencia en el sentido que “... el reclamo de los daños y perjuicios provenientes del delito debe hacerse por medio de la acción civil resarcitoria, porque así lo condiciona la normativa procesal; sin embargo esa misma condición no existe cuando se trata de la restitución del objeto material del delito. Ello es así, conforme lo ha interpretado anteriormente esta misma Sala, porque la restitución no constituye una forma de indemnización en sentido estricto." (Sentencia Nº 52-F 10:35 hrs. 31 enero 1990 de la Sala Tercera de la Corte Suprema de Justicia, reiterado en Voto # 604-F-91, de 9:25 horas del 7 de noviembre de 1.991 y en Sentencia 511-2000 de 9:20 hrs del 19-5-2000).
El derecho al medio ambiente, calificado como un derecho humano de la tercera generación, ha sido reconocido en Costa Rica como un derecho fundamental, pues el artículo 50 de la Constitución Política cuando dispone que: "Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado." y le otorga a los particulares y al Estado el derecho y el deber de garantizar y defender ese derecho en nombre de todos los habitantes, por lo que la comisión del delito convierte a la colectividad en víctima u ofendida con el hecho y desde esa perspectiva adquiere el derecho a la reparación del daño causado. Tratándose de un delito de Infracción a la Ley de Uso y Conservación de Suelos ( No. 7779 de 309 abril de 1998) el artículo 52 de dicha ley establece que: "Quien contamine o deteriore el recurso suelo, independientemente de la existencia de culpa o dolo o del grado de participación, será responsable de indemnizar, en la vía judicial que corresponda, y de reparar los daños causados al ambiente.", de donde se deriva una regulación específica que obliga al infractor a indemnizar los daños y perjuicios o a reparar los daños causados.
Desde la perspectiva procesal, el artículo 140 y 466 del Código Procesal Penal obligan al Juez a disponer la restitución de las cosas al estado anterior al delito, lo cual omite el fallo recurrido como bien lo apunta la Procuraduría en su gestión, por lo que establecido en la sentencia la autoría del hecho por parte del imputado y la lesión al medio ambiente por la apertura de un camino en el bosque hasta el río, es procedente ordenar la restitución del área afectada al estado anterior al hecho, a fin de que el infractor no derive provecho de la ilicitud realizada y se logre restaurar el medio ambiente alterado con su acción en pro de la tutela de los intereses de la colectividad. En sentido similar ha resuelto este Tribunal lo siguiente: "En cuanto a la condición impuesta en sí, esta corte de casación la encuentra racional y proporcionada a los hechos generadores de la condena penal. Obsérvese que el § 28 de la Const.Pol. establece la imposibilidad de intervención legal ante acciones privadas que no causen daño, de donde deriva que el límite de la reacción estatal viene marcado por la magnitud o gravedad de la lesión o peligro causados.
En el presente caso, en que el daño es el cambio del uso del suelo del bosque para dedicarlo a agricultura, la reacción estatal tiene su límite en la reparación del daño, que de todas formas no se completará en los tres años de ejecución condicional de la pena, puesto que el bosque es producto de años y años de nacimiento, desarrollo y muerte de muchos seres vegetales y animales; sin embargo, la exclusión de los cultivos y de todo elemento con que se ha sustituido el bosque, así como el restablecimiento de especies vegetales en la medida adecuada para regenerar lo destruido, son un principio para la reparación que en algunos años se alcanzará. Debe quedar claro que la protección del suelo de los bosques consagrada en los §§ 2, 6, 10.c, 19 y 38.f de la Ley Forestal, 52 de la Ley de Uso, Manejo y Conservación de Suelos, 53, 54 y 55 de la Ley Orgánica del Ambiente, 53 y 54 de la Ley de Biodiversidad, no termina o se suspende cuando por actos de seres humanos (incendios provocados, talas ilegales, etc.) o por hechos de la naturaleza (inundaciones, terremotos, incendios, etc.) el bosque viene a menos; antes por el contrario, ante esas situaciones se impone al Estado mayor agresividad en la recuperación y conservación del bosque.
Pensar que el deber de protección del suelo forestal y de otros elementos del bosque termina por cualquiera de los hechos indicados, se traduciría en la promoción de actividades ilícitas lesivas del medio ambiente, para sustituir la ecología por explotaciones agrícolas o de otra naturaleza, con lo que no habría protección verdadera; es decir, el espacio ocupado por los bosques es irreductible por esas vías (principio de irreductibilidad del bosque). De este modo, cualquiera que lesione el bosque con tala o incendios con el propósito de cambiar el destino del terreno, o cualquiera que pretenda obtener provecho de desastres naturales que dañen el suelo forestal, debe comprender que no hay forma posible de cambiar el destino del suelo, y que el Estado hará cuanto sea para recuperar el bosque. Esto es, en el caso de autos deben desaparecer la actividad agrícola del lugar donde corresponde regenerar el bosque, ya sea que lo haga el condenado en cumplimiento de la cláusula por la que se le otorga casi como incentivo el beneficio de ejecución condicional de la pena, ya sea por la acción del Estado; los funcionarios responsables de la ejecución verán por la eficacia del fallo de mérito.
No hay desproporción o abuso en la condición impuesta por el juzgador. Esta forma de resolver por parte del juez de juicio, reafirma el valor normativo de la Const.Pol., que en sus §§ 50 y 74 garantizan a la humanidad entera, con carácter de irrenunciable, el derecho a un ambiente sano y ecológicamente equilibrado. Amén de lo anterior, la disposición judicial en este caso guarda identidad con la disposición legislativa adoptada en § 52 de la Ley de Uso, Manejo y Conservación de Suelos, N° 7779 de 30 de abril de 1.998…" (Sentencia [Telf3], de 11:54 hrs. del 5 de mayo del 2003 con redacción del Juez [Nombre11]. Este criterio fue reiterado en sentencia 2003-396). Referido al caso que nos ocupa, la sentencia no contempló la restitución de las cosas al estado anterior como ordena la normativa citada, no obstante, por provenir el fallo de un procedimiento abreviado y por ser la restitución una consecuencia directa de la comisión del delito y no requerir acción civil, lo propio es acoger el recurso de casación planteado y resolver en esta sede disponiendo la restitución del área de bosque afectada a su estado anterior a los hechos.
Por tratarse de la construcción de una trocha o camino en la montaña, que implicó infracción a varias normas, no presenta las mismas características que en casos de levantamiento de una infraestructura en que ordenar la demolición constituye una solución, por ello no se observa viable la destrucción del camino; de igual forma no resulta atinente imponer el pago de los daños y perjuicios, toda vez que ello siempre permitiría el uso del camino a cambio del pago con provecho al infractor, por lo que la restitución en este caso debe orientarse hacia la conservación del área de bosque y en atención a ello se dispone el cierre del camino y se prohibe el uso en cualquiera de las formas posibles y se ordena la restitución del bosque mediante la siembra de especies propias para tal fin, cuyo cumplimiento podrá vigilarse por las autoridades administrativas o de ejecución.
POR TANTO:
Se declara con lugar el recurso de casación interpuesto. Se ordena el cierre total del camino a que se refieren la presente causa, se prohibe su uso en cualquiera de sus formas posibles. Se ordena la restitución del bosque mediante la siembra de especies propias para ese fin.- Notifíquese.- Ronald Salazar Murillo Rafael Ángel Sanabria Rojas [Nombre2] Jueces de Casación Penal Dig/Beirute
