Criminal case 17-000370-0359-PE brought against [Name 001], of legal age, married, born in Cartago on 20 de marzo de 1976, son of [Name 002] and [Name 003], identity card number [Value 001], resident of [...], for the offense of VIOLATION OF LEY FORESTAL committed to the detriment of NATURAL RESOURCES. The Court is composed of Judges Maureen Sancho González and Susana Wittmann Stengel and Judge Christian Fernández Mora. Attorney Adrián Alpízar Alvarado appeared in the appellate proceedings solely in his capacity as public defender for the accused; and,

FINDINGS

I.By judgment number 369-2024 issued at fourteen hours and sixteen minutes on veintisiete de noviembre de dos mil veinticuatro, the Trial Court of the Second Judicial Circuit of Cartago, Turrialba Seat, ruled: “POR TANTO:.In accordance with the reasoning set forth above and Articles 39 and 41 of the Political Constitution; 1, 4, l6, 18 to 20, 30, 45, 50, 60, 61, 71, and 75 of the Criminal Code; 632 and 1045 of the Civil Code; 122, 124, and 125, which are the rules currently in force concerning civil liability, pursuant to Ley Número 4891 del 8 de noviembre de 1971; Decreto Ejecutivo No 41930-JP, Articles 17 and 38, or Fee Schedule for Professional Legal and Notarial Services; and 1, 45, 47, 130, 140, 141 to 145, 265 to 269, 360, 361, 363 to 365, and 367 of the Code of Criminal Procedure, [Name 001] is hereby found criminally responsible as the perpetrator of the offenses of constructing a track in a protected area, encroaching upon a protection zone (zona de protección), and destroying vegetation, in ideal concurrence (concurso ideal), to the detriment of Natural Resources.

Accordingly, he is sentenced to ONE YEAR AND THREE MONTHS’ IMPRISONMENT, to be served at the location designated by the applicable prison regulations, with credit for any time spent in pretrial detention. The civil claim for damages (acción civil resarcitoria) is granted, and the civil defendant, [Name 001], is ordered to pay the Office of the Attorney General of the Republic the following compensation: a) for environmental damage, the sum of six million five hundred seventy-two thousand six hundred thirteen colones, plus the applicable statutory and default interest through enforcement of the judgment; b) as costs of the civil action for attorneys’ fees, the sum of one million four hundred ninety thousand four hundred ten thousand colones and forty colones. The benefit of conditional execution of the sentence (ejecución condicional de la pena) is granted for a term of three years, during which he may not commit another intentional offense punishable by more than six months’ imprisonment; otherwise, the benefit shall be revoked.

SINAC officials, in coordination with the competent Municipality, are authorized to restore the properties recorded under real-property folio numbers 3-88397-000 and 3-19875-000, which constitute a single territorial unit, to their prior condition. Once the judgment becomes final, notice shall be given to the National Institute of Criminology, the Sentence Enforcement Judge, and the Judicial Registry. The respondent to the private prosecution (querellado) is ordered to pay the costs of the private prosecution (querella) in the sum of four hundred eighty-four thousand colones. The procedural expenses shall be borne by the State. The full reading of the judgment is scheduled for sixteen hours on cuatro de diciembre del dos mil veinticuatro. Maureen Víquez Córdoba. II.Both Attorney Adrián Alpízar Alvarado, in his capacity as public defender for the accused, filed an appeal against the aforementioned judgment.

III.By an order issued at 07:13 hours on 13 de enero de 2025 by the Trial Court of Cartago, Turrialba Seat, all parties were summoned, all parties were summoned.

IV.Following the deliberation required by law pursuant to Article 465 of the Code of Criminal Procedure, this panel considered the issues raised in the appeal.

V. The legally prescribed formalities and requirements have been observed in the proceedings

Appellate Judge Sancho González delivers the opinion;

CONSIDERING

I. Admissibility of the appeal

Having analyzed the admissibility requirements, the Court finds that they have been satisfied from an objective standpoint because this is an appeal filed against the judgment on the merits. Moreover, it was filed within the statutory period—the judgment was read in full on 04 de diciembre de 2024, and defense counsel’s appellate brief was filed on 11 de diciembre of that year, within the period of fifteen business days. Furthermore, the appellant has standing to appeal because he is the public defender of the accused, pursuant to Articles 458, 459, and 460 of the Code of Criminal Procedure.

II. Content of the appeal

In the first ground of appeal, the appellant alleges a “violation of due process, the right of defense, and human dignity, due to the FAILURE to conduct the vulnerability assessment (estudio de vulnerabilidad) referred to in Articles 71(g) and 72 of the Criminal Code, in light of my personal circumstances” (sic). He contends that, throughout the ordinary proceedings, the Public Prosecutor’s Office failed to inform the accused that he had the right to request a vulnerability assessment under Articles 71 and 72 of the Criminal Code. This was relevant because he is a farmer without “steady” employment and was therefore eligible for a reduction of his sentence below the statutory minimum. He criticizes the violation of the Brasilia Rules, which require access to justice for persons in vulnerable circumstances, thereby violating the defendant’s dignity. He requests that the judgment be vacated as to the sentence because it was imposed without the assessment that should have been conducted.

The second ground of appeal alleges the “existence of an unavoidable mistake of fact (error de tipo invencible) and a complete lack of intellectual evidentiary reasoning (fundamentación probatoria intelectiva) regarding intentional conduct by the accused in the offenses of which he was convicted, given the absolute material impossibility that the accused or any person could have known of the existence of a permanent spring (naciente permanente) at the scene, since this did not become known until the preparatory stage because the spring had not previously been declared a permanent spring” (transcribed verbatim). He states that the judgment lacks adequate evidentiary reasoning concerning the criminal intent (dolo) required by the statutory offenses of which the -1479328944 accused was convicted, since the -1479328944 accused had no material possibility of knowing that a protection zone existed at the scene because of a permanent spring.

He argues that, based on SINAC expert reports numbers DA-UHCAROC-0128-2017 and DA-UHCROC-0127-2018, it can be inferred that there was a spring that had not been officially declared by the State, which prevented full knowledge of the objective elements of the offense for which he was convicted, as set forth in Article 58(a), in relation to Article 33(a), of Ley Forestal. He adds that a mistake of fact constitutes false knowledge of the objective elements of the offense and that, in this case, the mistake was unavoidable, negated intent, and rendered the charged conduct and the conduct alleged in the private prosecution legally noncriminal (atipicidad). He contends that the court concluded that the convicted person acted negligently (culpa), rather than intentionally, by failing to complete the procedures required to seek authorization from the Administration to construct a road in a protected area. He requests that the judgment be vacated and that a retrial (juicio de reenvío) be ordered for new proceedings.

The third ground of appeal alleges a “violation of due process through infringement of the right of defense and, in particular, of the principle of objective charging (principio de imputación objetiva), arising from the lack of specificity in the charged facts” (sic). The appellant states that a formal accusation must contain a detailed, clear, precise, and circumstantial description of the charged facts, specifying the time and place of their alleged commission, as required by Article 303 of the Code of Criminal Procedure, because without a defined allegation it is practically impossible to present a defense. He contends that all the accused could do was generally deny the accusation at the end of the trial. He partially quotes facts 2, 4, and 5 of the accusation, stating that they contain serious errors regarding the precise conduct attributed because they refer to the period between 01 de abril and 19 de mayo de 2017; fail to state “how it was proven” that the property was recorded in the registry in the names of [Name 002] and [Name 004]; and fail to explain the reason for removing vegetation and widening a road, since according to survey plan no. [Value 003] dated 29 de abril de 2003, an agricultural easement (servidumbre agrícola) existed, in which only the owner of the landlocked estate (fundo enclavado) would have an interest under Article 395 of the Civil Code.

He argues that the private prosecution and accusation were presented incorrectly and imprecisely, and that the absence of an exact date impaired the right of defense because the accused would be required to prove what he did on every day during the period between 1° de abril and 19 de mayo de 2017. He asserts that the principle of charging was violated. He requests that the judgment be vacated and a new trial be held before the trial court.

As the fourth ground of appeal, the appellant alleges “improper and contradictory intellectual reasoning (fundamentación intelectiva) in the judgment because neither the charged facts nor his criminal intent were found proven, and because routine, dogmatic, and superficial arguments were used” (sic). He argues that the judgment contains a serious defect of improper and contradictory intellectual reasoning because the accused was convicted on the ground that he acted negligently rather than intentionally, even though intent is required by the statutory offense. He further argues that the judgment fails to explain the reasoning or evidence supporting the conclusion that the defendant did not complete the applicable procedures to request authorization from the State Administration to construct a road in a protected area and fell trees. He criticizes the judgment as containing no intellectual analysis and as being based on assumptions or conjecture, since the issue of permits was not discussed at trial. He requests that the judgment be vacated and a retrial ordered.

As the fifth ground of appeal, the appellant alleges a “violation of the right of defense through the omission of essential evidence concerning survey plan no. [Value 003] dated 29 de abril del 2003, appearing at folios 41 and 228 of the main case file, which refutes fact 5 of the accusation and private prosecution” (transcribed verbatim). The appellant challenges the appealed judgment’s failure to address survey plan [Value 003], which demonstrated the existence of an agricultural easement over property no. 3-88397-000. Accordingly, excavating slopes, widening roads, and removing vegetation on that easement were lawful and would have been in the interest of the owner of the landlocked estate, not the accused. He argues that, because the survey plan was not evaluated, the judgment did not explain the criteria used to reject the contention that fact 5 of the accusation and facts numbers 4 and 5 of the private prosecution did not constitute criminal offenses. He requests that the judgment be vacated and a retrial ordered.

In the sixth ground of appeal, a “violation of the in dubio pro reo principle (principio in dubio pro reo)” is alleged. The appellant argues that the accused was convicted even though the Public Prosecution Service (Ministerio Público) failed to conduct relevant and useful investigative measures to identify the person responsible for the act, did not assess essential evidence such as plan no. [Valor 003], and therefore did not rebut the presumption of innocence (principio de inocencia). He insists and reiterates that the only person interested in carrying out work on the property was the owner of the enclosed parcel benefiting from an agricultural easement (servidumbre agrícola), who is the accused’s brother, not the accused himself, an aspect that was not assessed in the judgment. He requests that the ground of appeal be upheld and that a judgment of acquittal be entered in favor of the accused.

III. Decision on the appeal

Upon a comprehensive review of the judgment on the merits, issued in written and viewable form beginning at folio 303 of the case file, as required by section 459 of the Code of Criminal Procedure (Código Procesal Penal), this Chamber finds no defects that would invalidate the substance of the decision, as explained below.

As a matter of structural logic, the third ground of appeal will be decided first, because it concerns a claim affecting the content of the charging instruments (piezas acusatorias) and, consequently, the judgment as a whole. The appellant argues that the prosecution’s charging request (requerimiento fiscal) and the State’s private criminal complaint (querella) violate the principle of specific accusation (principio de imputación), because the alleged acts were charged within broad timeframes that preclude the proper exercise of the right to a defense, since this requires the accused to know what he did throughout an extended period, thereby violating that right. The claim is denied. The first point that must be clarified is that the acts alleged in both charging instruments are confined to the period from 1° de abril al 19 de mayo de 2017 (second and fourth alleged acts), and from 1° de mayo de 2017 al 18 de mayo de 2020 (fifth alleged act) in both charging requests.

The analysis of this issue must begin by noting that the principle of specific accusation is an essential foundation of due process (debido proceso), which, according to the case law of the Sala Constitucional, has been conceptualized as “[…] the right to a formal accusation. It must necessarily be afforded to anyone whom the State seeks to subject to proceedings. It is therefore the duty of the Ministerio Público, initially, and subsequently of both the Ministerio Público and the judge, and includes the duties to identify the accused individually; to describe in detail, precisely, and clearly the act of which the person is accused; and to provide a clear legal classification of the act, stating the legal grounds for the accusation and the specific punitive relief sought” (sic, decision no. 1739 at 11:45 hours on 1° de julio de 1992). Accordingly, a proper accusation must contain all the requirements prescribed by section 303 of the Code of Criminal Procedure, namely: a) the information needed to identify the accused; b) a precise and detailed account of the alleged criminal act; c) the grounds supporting the accusation, including the evidence on which it is based; d) citation of the applicable legal provisions; and e) an offer of the evidence to be presented at trial.

Each of these requirements is essential so that the accused clearly understands the act attributed to him and, based on a definition of the circumstances concerning the manner, time, and place of its commission and on disclosure of the body of evidence gathered, can devise a defense strategy enabling him to refute the charges brought by the Ministerio Público or the private prosecutor (parte querellante). Precisely because of its intrinsic relationship with the right to a defense, vague accusations are inadmissible when they prevent the accused from understanding the criminal conduct attributed to him, when he is alleged to have committed it, where he was when the alleged event occurred according to the prosecuting authorities’ theory of the case, and the particular circumstances surrounding the act. This is because the absence of these factors, which constitute the core of the accusation, deprives the defendant of the matters against which he must defend himself and on which the court will rule when issuing its judgment.

In the sub judice, the actions attributed to the accused were placed within two timeframes. The first, lasting one month and 19 days, is in itself a brief period that in no way impairs the defendant’s ability to look back upon that period and, if he wishes, refute the charges against him. It is important to add that this is the period charged on the basis of two fundamental considerations. According to official letter SINAC-ACCVC-OT-598 at folio 9 of the record, which initiated these proceedings, it was on 26 de abril de 2017 that inspectors from the Sistema Nacional de Área de Conservación (hereinafter SINAC) arrived at the site of the events in Las Vueltas de Tucurrique, confirmed the environmental damage, and verified the accused’s presence there. On 19 de mayo de 2017, based on that information, the Organismo de Investigación Judicial (hereinafter OIJ) conducted an inspection of the property.

In addition to confirming the impact on the area’s vegetation near a spring (naciente), the officers interviewed some of the individuals who were working there with machinery. Specifically, [Nombre 005] and [Nombre 006] informed the judicial police that the defendant had hired them to remove vegetation and clear a road, adding that they had already been performing those tasks for several days. It is therefore understandable that the timeframe for alleged acts 2 and 4 in both the prosecution’s charging request and the State’s private criminal complaint begins approximately one month before the SINAC officials’ visit and ends with the inspection conducted by the OIJ. The evidence gathered during the investigation and disclosed to the accused at the time of his examination (indagatoria) enabled him to understand those reference periods, which, as reiterated, encompassed only a few days and therefore did not impair his ability to present an informed defense.

As for the second period specified in alleged act 5 of the two charging instruments, although it is certainly longer—extending from 1° de mayo del 2017 al 18 de mayo de 2020—this Chamber finds that it likewise does not infringe the right to a defense, because that period arises from a specific circumstance. Official letter SINAC-ACCVC-OT-598 at folio 9 of the record states that, when the agency’s officials visited the property on 26 de abril de 2017, they found the accused there and that, from that moment onward, he knew that the authorities had intervened because of the activities involving vegetation removal, tree cutting, and other work at the site. As part of its duties, SINAC followed up on the situation and, following a new complaint, conducted another inspection at the site on 18 de mayo de 2020, as recorded in official letter SINAC-ACC-OT-629-2020 at folio 165 of the case file. During that subsequent proceeding, the technical personnel confirmed that the environmental damage detected on the first occasion had worsened because tractor earthworks (movimientos de tierra), tree cutting, and construction of a track parallel to the watercourse had continued.

This supported the conclusion that, from 2017 onward, the accused had continued to carry out prohibited activities on the property. Accordingly, the timeframe for the acts alleged under section 5 of the accusations is consistent with the evidence, because it concerns a series of physical activities that, by their very nature, cannot be performed on a single specific day. Excavations, road widening, and tree cutting on the scale specified in that report are not performed all at once or at a single moment; rather, they are activities that extend over time because of their inherent characteristics. This Chamber therefore does not find that the manner in which the attributed conduct was charged infringed the right to a defense. Moreover, an important point for purposes of this decision is that the content of alleged act 5 was presented as a continuation of the conduct described in alleged acts 2 and 3.

On that basis, the judgment found the accused criminally liable for three offenses committed in ideal concurrence (concurso ideal), meaning that it found a single course of conduct. Regardless of whether that determination regarding concurrence was correct—and this issue will not be addressed because only defense counsel appealed the judgment, making it pointless to consider whether the charges instead constituted a material concurrence of offenses (concurso material de delitos) because they occurred within timeframes far removed from one another—the fact remains that the accused’s interests were not adversely affected by the trial court’s decision, because the manner in which the allegations were framed ultimately caused him no prejudice. It should be noted here that the principle of specific accusation, as governed by the cited provision—303 of the Code of Criminal Procedure—does not require specification of an exact day for an accusation to be validly brought, because doing so is not possible in every proceeding.

The issue must be assessed on a case-by-case basis through contextualization that is as precise as possible in light of the information contained in the record, as occurred in this case. For these reasons, the claim is rejected.

Now, structurally, it is necessary to resolve the second and fourth grounds of the appeal together below, since they concern related issues, as will be seen. The appellant has asserted in his appeal that the accused was materially unable to know that a protective area (área de protección) existed at the scene because there was a permanent spring (naciente permanente), since it was only through expert reports DA-UHCAROC-0128-2017 and DA-UHCROC-0127-2018 of the Sistema Nacional de Áreas de Conservación that the body of water at the scene was determined to be permanent in nature, and that, before then, it had not been declared as such by the State, which prevented full knowledge of the objective elements of the criminal offense (tipo penal) for which he was sentenced, as set forth in Article 58(a), in relation to Article 33(a), of the Ley Forestal. The argument is unavailing. The appellant confuses the State’s activity of gathering the evidentiary material necessary for criminal proceedings with the material circumstances observable in reality, which ultimately determine whether a body of water qualifies as a spring (naciente) and, if so, whether it is permanent.

On the one hand, as will be seen, one of the normative elements of the criminal offense—namely, the classification of the water resource located on the property where the accused was alleged to have committed the charged acts—was established, as was, at the appellate level, the fact that the defendant knew beyond doubt that this stream was a permanent spring and, therefore, it could be shown that he acted knowingly and willfully in encroaching upon a protective area. The accused was charged with removing vegetation and cutting down 50% of the trees located 10 meters from a permanent spring on a property in Tucurrique de Cartago. The appellant’s challenge maintains that this body of water was determined to be a permanent spring through two official communications issued by the Dirección de Agua del Ministerio de Ambiente y Energía, specifically DA-UHCAROC-0128-2017 dated 22 de mayo de 2017 and DA-UHCAROC-0127-2018 dated 26 de abril de 2018; that is, in the appellant’s view, it was only as a result of those two determinations, both issued after the charged acts, that the body of water at the site acquired the classification required by the criminal offense set forth in Article 58, in relation to Article 33, of the Ley Forestal.

The former provides that: “A term of imprisonment of three months to three years shall be imposed on anyone who: (a) Encroaches upon a conservation or protective area, regardless of its management category, or upon other forest areas or lands subject to the forestry regime, regardless of the area occupied and irrespective of whether they are privately held lands belonging to the State or other Public Administration bodies, or privately owned lands. The perpetrators of or participants in the act shall not be entitled to any compensation for any construction or work they may have carried out on the encroached lands”; while the latter defines a protective area in the following terms: “The following are declared protective areas: (a) Areas bordering permanent springs, defined within a radius of one hundred meters measured horizontally” (emphasis added). Several relevant points follow from the foregoing: it is the law itself that establishes what constitutes a protective area; this derives from the fundamental right to a healthy and ecologically balanced environment, which is expressly recognized in the Constitución Política.

Protective areas are therefore public-interest restrictions on property intended to protect water resources from actions that could affect the natural condition of water sources. On this subject, it should be noted that a protective area is not the same as a protected wildlife area (área silvestre protegida); the latter forms part of the State’s natural heritage and is subject to a different set of regulations, pursuant to Article 3(i) of the same Ley Forestal. Furthermore, under the Ley de Aguas n° 276 of 27 de agosto de 1942 and Article 50 of Ley Orgánica del Ambiente number 7594, water and the channels through which it flows are in the public domain, regardless of where they are located (State-owned lands or private property), because there is an overriding interest in protecting water resources as an integral part of the right to an ecologically healthy environment and, specifically, the right to water as a human necessity that the State must guarantee, which is regarded as a third-generation human right as of the Declaration on the Right to Development adopted by the United Nations General Assembly on 04 de diciembre de 1986.

Accordingly, Article 1º of the Ley de Aguas provides: “The following are waters in the public domain: IV.—Waters of rivers and their direct or indirect tributaries, streams, or springs, from the point at which the first permanent waters emerge until their discharge into the sea or into lakes, lagoons, or estuaries”; Article 2, for its part, establishes: “[t]he waters listed in the preceding article are national property,” while Article 50 of the Ley Orgánica del Ambiente provides: “Water is in the public domain; its conservation and sustainable use are matters of social interest.” There is therefore no doubt that every water source is in the public domain, even when located on privately owned land. Furthermore, according to the Metodologías hidrogeológicas para la evaluación del recurso hídrico, acuerdo número 60-2012 de las ocho horas del doce de junio del dos mil doce of the Ministerio del Ambiente y Telecomunicaciones (MINAET), a spring is an “underground water flow that emerges at the surface due to topographic changes, preferential zones, geological-structural features such as faults, or changes in hydraulic conductivity, fractures, or discontinuities.” Depending on their nature, bodies of water likewise have a protective area around them, the dimensions of which vary according to the type involved.

Thus, the one-hundred-meter parameter established in Article 33 of the Ley Forestal applies to permanent springs. Intermittent springs (nacientes de tipo intermitente) are subject to a smaller parameter regulated by the Ley de Aguas. Having clarified these points, a first conclusion may be reached: the work performed by the Dirección de Agua del Ministerio del Ambiente, reflected in official communications DA-UHCAROC-0128-2017 dated 22 de mayo de 2017 and DA-UHCAROC-0127-2018 dated 26 de abril de 2018, was not the administrative act (acto administrativo) from which the classification of the body of water on the lands at issue as a permanent spring arose; in other words, it was not an act constituting the type of water resource, but merely an evaluative act of verification that became evidentiary under Articles 302 and 303 of the Ley General de la Administración Pública, because water, by operation of law, is public property that private parties may not use or dispose of without State oversight.

The official communications cited by defense counsel were requested by personnel of the Sistema Nacional de Áreas Protegidas (SINAC), the first in support of the complaint they filed against the accused after inspecting the site. The second was requested by the Prosecutor’s Office as part of the evidentiary activity inherent in exercising criminal prosecution. Both were items of evidence that, in view of the requirements of criminal proceedings, were indispensable for establishing the normative element of the charged criminal offense set forth in Article 58(a), in relation to Article 33, of the Ley Forestal; this, however, must not be confused with a declaration regarding the type of water resource involved. In this regard, the Sala Constitucional has stated: “Accordingly, it is clear that treating water as an essential resource and fundamental right necessarily entails protecting its sources and catchment areas, including underground and surface aquifers, as well as springs, wells, and other areas where water resources are located and made available.

Such protection entails establishing so-called protective areas or perimeters, such as that specifically identified in Article 33(a) of the Ley Forestal, which, as noted, establishes a protective radius of 100 meters around permanent springs. That protective area may vary—and ordinary legislation in fact so provides—if the spring is not permanent but instead intermittent or non-permanent. This does not mean that such springs receive no protection whatsoever, but rather that the radii of their protective areas may vary as determined by the regulations and the responsible technical bodies. In other words, the regulations and case law recognize the importance of and need to protect springs, hence the establishment of the radii of their protective areas, whose extent varies according to the type of spring involved, precisely because the corresponding protective-area radius is determined by the type of spring.

This is not, per se, a circumstance giving rise to any unconstitutionality because, as the cited precedent correctly indicates, the particular conditions of each type of spring—aquifer, well, and so forth—define the specific conditions of protection, such that protective areas are specifically established according to the type of spring, water table, or well involved” (see decision n.° 9221 at 11:41 hours on 22 de mayo de 2019, emphasis added). Specifically, the trial judgment concluded that the defendant acted with criminal intent (dolo) because the existence of the water source on the property was evident: the inspections conducted by officers of the Organismo de Investigación Judicial and SINAC technical personnel documented that it was an evident body of water (the reports even contain photographs permitting visual verification), and that evidence also showed that the accused had undertaken no proceeding whatsoever to obtain authorization to carry out work around the spring.

In any event, cutting down trees and conducting earthworks (movimiento de tierra) within the perimeter where the accused performed those activities were prohibited, since they were carried out only 10 meters away, to the extent that material fell into the channel. For precisely that reason, defense counsel’s argument that the accused could not have known the nature of the water source on the property and therefore lacked full knowledge of the objective elements of the criminal offense cannot be accepted; this also rules out the argument that he may have acted under a mistake of fact (error de tipo). Consistent with this conclusion, the fourth ground of appeal must also be rejected. The appellant argues that the judgment does not analyze intent as the subjective element required to establish the criminal offense and adds that the judgment also maintains that the accused acted negligently (culposamente).

This Chamber must note that nowhere in the challenged decision is it stated or suggested that the accused, [Nombre 001], committed any breach of the duty of care (deber de cuidado) giving rise in law to negligent conduct (conducta culposa).

The judgment clearly establishes that, although the properties where trees and vegetation were removed were registered in the names of third parties (one of whom was the accused’s father), it was proven that the defendant was the person who exercised control over them, since he was the one who ordered that the work be carried out at the site, as established through the statements of witnesses [Nombre 005] and [Nombre 007], as well as the aforementioned reports from SINAC and OIJ. Those documents also enabled the trial court to conclude that these activities were carried out without the relevant permits having been granted. This conclusion was not based on an assumption by the judge but emerged clearly from the documentary evidence admitted into the record, specifically reports C.I. 592-SDRT-17 and SINAC-ACCVC-OT-598, and particularly official letter S. M. 265-2017 from the Consejo Municipal de Tucurrique, which states that “in response to the felling and clearing of the spring (naciente) area, on April 28 of the current year, the councilors of this Consejo Municipal proceeded to inspect the site of the events, since no municipal permit of any kind had been issued” (emphasis added). In this respect, the judgment does not contain the errors attributed to it by the appellant; accordingly, the second and fourth grounds of the appeal are denied.

The fifth and sixth grounds of the appeal will now be analyzed jointly because their content is related. As to the fifth, it is alleged that evidence was overlooked (preterición de prueba) in connection with survey plan No. [Valor 003], since it is claimed that the trial judge failed to consider it. Although the sixth argument is presented as a substantive ground based on a violation of the in dubio pro reo principle, it is actually a repetition of the fifth because, once again, the appellant claims that, had the cited survey plan been considered, the defendant would have been acquitted. The claims are rejected: the appellant seeks to establish that, because the properties on which activities harmful to the environment were proven to have been carried out did not belong to the accused but to other persons, and because there is also a landlocked property (fundo enclavado) with an easement (servidumbre), such that it would potentially be the owner of that property who would have an interest in clearing the land in order to use the easement, the defendant cannot be linked to the commission of the offenses for which he was convicted.

This Chamber must make several matters clear: the offenses for which the accused was found responsible do not require, for their establishment, any subjective element other than criminal intent (dolo). Accordingly, the motivations the defendant may have had for cutting down trees and uprooting vegetation around a permanent spring (naciente permanente) were not matters that needed to be determined in order to establish the offenses. It was sufficient to prove, as was in fact done, that the accused, knowing that there was a permanent water spring on the property and without any permit from a competent authority, intentionally arranged for slopes to be excavated, widened a road, removed vegetation, cut down trees, and deposited materials in the watercourse within what he knew to be a protected area (zona de protección). Moreover, the judgment expressly analyzes the contents of the survey plan that defense counsel claims was omitted from the examination of the evidence, explaining that determining who owned the easement shown on the survey plan or who was the registered owner of the property was of little significance because the evidence conclusively established that it was the defendant, [Nombre 001], who exercised control over the land in question: he was found at the site by SINAC personnel, who advised him of his rights and to whom he stated that he owned the property and wished to rehabilitate a peach-palm plantation.

Furthermore, during the inspection conducted by the judicial police, as corroborated at trial by the witness [Nombre 005], it was established that the accused was the person who hired the machinery and gave instructions on how the work on the land was to be performed; in other words, he had control over the act (dominio del hecho) and determined the course of the actions. These circumstances support the conclusion that the judgment did not in any way fail to address the evidence of interest to the defense and that, moreover, the identification of the accused as the person who hired machinery to carry out the activities specified in the charges was established with certainty. The presumption of innocence therefore yielded to proof, beyond a reasonable doubt, that the accused was the perpetrator of the charged acts. Accordingly, the fifth and sixth grounds of appeal raised are denied.

Finally, the first ground of appeal, which alleges a violation of the right of defense because the Prosecutor’s Office did not inform the defendant that he could request a social assessment (dictamen social) to establish his vulnerability for purposes of reducing the minimum sentence for the offenses, is rejected: the first matter that must be noted is that this Chamber is divided as to whether the provisions of artículos 71 inciso g) y 72 del Código Penal must be applied to men sentenced for the commission of an offense. On the one hand, the majority of the panel (Judge Wittmann and Judge Fernández) takes the position that the provisions apply to both men and women pursuant to the ruling of the Sala Constitucional N° 8751-2022, whereas the minority (Judge Sancho) has maintained that they are reserved exclusively for women and men with disabilities. This division of opinion is also reflected in the case law of the Sala Tercera, which, by a majority vote of three to two, has allowed the provision to be extended to situations involving vulnerable men, for example in resolution 2024-0395 issued at 11:15 on 02 de mayo de 2024.

Having made this clarification, this appellate court unanimously finds that the issue is not even open for discussion in the present case, since the applicant’s first obligation was to establish that the cited provisions applied to this particular case, which he failed to do. His application was vague and did not even specify the circumstance under which he considered his client to fall (poverty, disability, care of dependents, violence, etc.), much less its relationship, if any, to the commission of the act. He merely argued that his client was a farmer, without explaining why that occupation, in itself, makes a person vulnerable, and failed to explain why, under the circumstances of the matter under review, it bore any relationship to the offense. This alone is sufficient to dismiss the claimed grievance. Nevertheless, we must add that the appellant also fails to outline the reasons for his assertion that the Prosecutor’s Office had a duty to advise the accused that he could seek a social evaluation, since the obligation he attributes to the agency responsible for the criminal prosecution is not established by any provision.

Finally, it bears emphasizing that the proper exercise of legal representation entails pursuing any applications considered necessary and useful to the interests of the person represented. If defense counsel believed that evidence of this kind was necessary to his theory of the case, he should have requested it from the competent authority in a timely manner. It should be noted that this proceeding dates from 2017, while the ruling of the Sala Constitucional cited by the appellant in support of his position, the aforementioned number 8751, is dated 20 de abril de 2022; he therefore had more than enough time to pursue any request in that regard. In any event, as already stated, the particular circumstances of the case do not even suggest that the defendant, [Nombre 001], was subject to any condition of disadvantage that would require further inquiry. Accordingly, this ground meets the same fate as the preceding grounds and is denied.

Documento PJEDITOR 1 Contra: [Nombre 001] Delito: Infracción Ley Forestal Persona Ofendida: Los Recursos Naturales Res: 2025-137 Tribunal de Apelación de Sentencia Penal de Cartago, Sección Primera. A las nueve horas con dieciséis minutos del catorce de marzo del dos mil veinticinco.

Causa penal 17-000370-0359-PE seguida contra [Nombre 001], mayor, casado, nació en Cartago el 20 de marzo de 1976, hijo de [Nombre 002] y de [Nombre 003], con cédula de identidad número [Valor 001], vecino de [...], por el delito de INFRACCIÓN LEY FORESTAL cometido en perjuicio de LOS RECURSOS NATURALES. Integran el Tribunal las juezas Maureen Sancho González; Susana Wittmann Stengel y el juez Christian Fernández Mora. Se apersonó en sede de apelación el licenciado Adrián Alpízar Alvarado en calidad de defensor público del imputado únicamente, y;

RESULTANDO

I.Que, mediante la sentencia número 369-2024 de las catorce horas con dieciséis minutos del veintisiete de noviembre de dos mil veinticuatro, el Tribunal de Juicio del Segundo Circuito Judicial de Cartago, Sede Turrialba, resolvió: "POR TANTO:.De conformidad con los razonamientos expuestos y artículos 39 y 41 de la Constitución Política; 1, 4, l6, 18 a 20, 30, 45, 50, 60, 61, 71 y 75 del Código Penal; 632 y 1045 del Código Civil, 122, 124, 125, que son reglas vigentes sobre responsabilidad civil, según Ley Número 4891 del 8 de noviembre de 1971. Decreto Ejecutivo No 41930-JP, artículos 17 y 38 o Arancel de Honorarios por Servicios Profesionales de Abogacía y Notariado, 1, 45, 47, 130, 140, 141 a 145, 265 a 269, 360, 361, 363 a 365 y 367 del Código Procesal Penal, se declara a [Nombre 001] autor responsable del delito de Construcción de trocha en zona protegida, invasión de zona de protección y un delito de destrucción de vegetación en concurso ideal en perjuicio de Los Recursos Naturales.

En consecuencia, se le impone la pena de UN AÑO Y TRES MESES DE PRISIÓN, que deberá cumplir donde indiquen los respectivos reglamentos penitenciarios, previo descuento de la preventiva sufrida si la hubiere. Se declara con lugar la acción civil resarcitoria, se condena al demandado civil [Nombre 001], a pagar a favor de la Procuraduría General de la República los siguientes extremos indemnizatorios: a) por concepto de daño ambiental la suma de seis millones quinientos setenta y dos mil seiscientos trece colones, más los intereses legales y moratorios correspondientes hasta la ejecución de sentencia. b) por concepto de costas la acción civil por concepto de honorarios la suma de un millón cuatrocientos noventa mil cuatrocientos diez mil colones con cuarenta colones. Se concede el beneficio de ejecución condicional de la pena por el plazo de tres años, período durante el cual no podrá cometer nuevo delito doloso con pena superior a seis meses de prisión, caso contrario el beneficio le será revocado.

Se autoriza a funcionarios del SINAC en coordinación con la Municipalidad competente, para restaurar las cosas a su estado anterior en la finca inscrita a folio real 3-88397-000 y 3-19875-000 que constituyen una unidad territorial. Firme la sentencia, comuníquese al Instituto Nacional de Criminología, Juez de Ejecución de Pena y Registro Judicial. Se condena al querellado al pago de las costas de la querella en la suma de cuatrocientos ochenta y cuatro mil colones. Son los gastos del proceso a cargo del Estado. Se señala para la lectura integral de la sentencia a las dieciséis horas del cuatro de diciembre del dos mil veinticuatro. Maureen Víquez Córdoba. Juez del Tribunal Penal de Cartago."

II.Que contra el fallo indicado, tanto el licenciado Adrián Alpízar Alvarado en calidad de defensor público del imputado, interpuso recurso de apelación.

III.Que mediante resolución de las 07:13 horas del 13 de enero de 2025 del Tribunal de Juicio de Cartago, sede Turrialba, se emplazó a todas las partes, se emplazó a todas las partes.

IV.Realizada la deliberación de ley según lo dispuesto en el numeral 465 del Código Procesal Penal, esta cámara se planteó las cuestiones formuladas en el recurso.

V. En los procedimientos se han observado las formalidades y prescripciones de ley

Redacta la Jueza de Apelación de Sentencia Sancho González;

CONSIDERANDO

I. Admisibilidad del recurso

Analizados los parámetros de admisibilidad, el Tribunal verifica que se cumple con los mismos tanto desde la perspectiva objetiva, en virtud de que se trata de un recurso incoado en contra de la sentencia de fondo, por otro lado, fue interpuesto dentro del plazo de ley —la lectura integral del fallo se llevó a cabo el 04 de diciembre de 2024 y el libelo de impugnación del defensor fue presentado el 11 de diciembre de ese año, en el plazo de quince días hábiles. Por otro lado, quien impugna se encuentran legitimado para ello por ser el defensor público del sindicado, de conformidad con los numerales 458, 459 y 460 del Código Procesal Penal.

II. Contenido del recurso de apelación

En el primer motivo de apelación, el recurrente alega “violación al debido proceso, al derecho de defensa y a la dignidad humana, por la NO realización del estudio de vulnerabilidad que señala el artículo 71 inciso g) y 72 del Código Penal, debido a mis condiciones personales” (sic). Reclama que el Ministerio Público durante todo el procedimiento ordinario, no le informó al imputado que tenía el derecho de solicitar un estudio de vulnerabilidad con base en los artículos 71 y 72 del Código Penal, lo cual era relevante porque se trata de un agricultor sin trabajo “fijo” y por ello, era acreedor a rebajos de la pena por debajo del mínimo sancionatorio previsto por ley. Fustiga que se vulneraron las reglas de Brasilia que exigen el acceso a la justicia para las personas en condiciones de vulnerabilidad vulnerándose con ello la dignidad del justiciable. Solicita que se anule la sentencia en cuanto a la pena por haberse impuesto la misma sin contar con el estudio que debió haberse practicado.

En el segundo motivo de apelación, se plantea la “existencia de un error de tipo invencible y nula fundamentación probatoria intelectiva respecto a un actuar doloso por parte del imputado en los delitos sentenciados, dada la absoluta imposibilidad material que el imputado o cualquier persona pudiese conocer sobre la existencia de una naciente permanente en el lugar del los hechos, pues ello no se supo hasta en la etapa preparatoria al no estar la naciente declarada previamente como naciente permanente” (la transcripción es textual). Señala que la sentencia adolece de una adecuada fundamentación probatoria respecto del dolo exigido por los tipos penales por los cuales fue sentenciado el -1479328944 imputado ya que el -1479328944 imputado tenía una imposibilidad material de conocer que en el lugar de los hechos existía un área de protección por haber una naciente permanente. Aduce que con base en los informes periciales del SINAC número DA-UHCAROC-0128-2017 y DA-UHCROC-0127-2018, se colige que existía una naciente no declarada por el Estado lo que resulta un obstáculo para el conocimiento pleno de los elementos objetivos del tipo penal sentenciado recogido en el artículo 58 inciso a) en relación con el numeral 33 inciso a) de la Ley Forestal.

Agrega que el error de tipo es un falso conocimiento de los elementos objetivos del delito, que en este caso es invencible, elimina el dolo y produce la atipicidad de la conducta acusada y querellada. Aduce que el tribunal concluyó que el sentenciado actuó con culpa y no con dolo ante la omisión de realizar los trámites para solicitar permisos ante la administración para realizar un camino en una zona protegida. Solicita que se anule el fallo y se disponga del juicio de reenvío para una nueva sustanciación.

En el tercer motivo del recurso se plantea “violación al debido proceso por infracción al derecho de defensa y en especial al principio de imputación objetiva con ocasión de la indeterminación de los hechos acusados” (sic). El recurrente señala que una imputación formal debe contar con una descripción detallada de forma clara, precisa y circunstanciada de los hechos acusados con indicación del espacio temporal y el lugar en donde se atribuye su comisión, ello conforme la exigencia del artículo 303 del Código Procesal Penal, ya que, sin la determinación del hecho, es prácticamente imposible ejercer una defensa. Aduce que el imputado lo único que pudo hacer fue negar la acusación en términos generales, al final del debate. Transcribe parcialmente los hechos 2, 4 y 5 de la acusación señalando que tienen serios yerros en la precisión de las acciones atribuidas porque se refieren al lapso comprendido entre el 01 de abril y el 19 de mayo de 2017, que no se apunta “cómo se demostró” que era una propiedad inscrita registralmente a nombre de [Nombre 002] y [Nombre 004], cuál era la razón de hacer trabajos de eliminación de vegetación y ampliación de un camino pues según el plano n° [Valor 003] del 29 de abril de 2003, había un derecho real de servidumbre agrícola respecto de la cual solo la persona propietaria del fundo enclavado tendría interés con base en el artículo 395 del Código Civil.

Aduce que la querella y la acusación de plantearon de manera equivocada, imprecisa y que la falta de una fecha exacta afecta el derecho de defensa pues el imputado se vería obligado a demostrar lo que hizo durante todos los días del período comprendido entre el 1° de abril y el 19 de mayo de 2017. Reclama como vulnerado el principio de imputación. Solicita que se anule la sentencia con disposición de realizar un nuevo debate ante la sede de instancia.

Como cuarto motivo de apelación, el recurrente alega “indebida y contradictoria fundamentación intelectiva de la sentencia al no tenerse por demostrados los hechos acusados ni su dolo; utilizándose argumentos rutinarios, dogmáticos y superficiales” (sic). Arguye que la sentencia presenta un grave vicio de indebida y contradictoria fundamentación intelectiva porque al imputado se le condenó señalando que actuó con culpa y no con dolo, como es requerido por el tipo penal y que, además , el fallo es omiso respecto a cuál es el razonamiento y con base en cuál prueba se concluye que el justiciable no realizó los trámites respectivos para solicitar los permisos ante la Administración del Estado para realizar un camino en zona protegida y talar árboles. Fustiga que el fallo tiene un nulo trabajo intelectivo y que se basa en suposiciones o conjeturas pues el tema de permisos no fue discutido en el debate. Solicita que se anule la sentencia y se ordene el juicio de reenvío.

Como quinto motivo del recurso, se alega “violación al derecho de defensa por preterición de prueba esencial respecto al el plano n° [Valor 003] de fecha 29 de abril del 2003 visible a folio 41 y 228 del expediente principal, que desvirtúa el hecho 5 de la acusación y querella” (se transcribe de manera literal). Cuestiona el recurrente que la sentencia impugnada omitió referirse al plano [Valor 003] por medio del cual se demostraba la existencia de una servidumbre agrícola sobre la finca n° 3-88397-000, por lo que es válida la realización de excavación de taludes, ampliación de caminos y eliminación de vegetación sobre esa servidumbre y ello, sería de interés del dueño del fundo enclavado y no del sindicado. Aduce que, por la falta de valoración del plano, la sentencia no explicó los criterios seguidos para desvirtuar que el hecho 5 de la acusación y los número 4 y 5 de la querella, son atípicos. Solicita que se anule la sentencia y se disponga el juicio de reenvío.

En el sexto motivo del recurso se plantea “violación al principio in dubio pro reo”. Reclama que el acusado fue condenado pese a que el Ministerio Público no realizó diligencias pertinentes y útiles para identificar al responsable del hecho, no valoró prueba esencial como el plano n° [Valor 003] y que por ello, no fue derribado el principio de inocencia. Insiste y repite que el único interesado en llevar a cabo trabajos en la propiedad lo es el dueño del fundo enclavado con servidumbre agrícola a su favor, que es el hermano del sindicado y no este, aspecto que no fue valorado en el fallo. Solicita se acoja el motivo de apelación y se dicte una sentencia absolutoria en favor del imputado.

III. Resolución del recurso

Analizada de forma integral la sentencia de mérito, dictada en forma escrita y visible a partir del folio 303 del expediente, tal y como dispone el numeral 459 del Código Procesal Penal, esta cámara no encuentra defectos que invaliden el contenido de lo resuelto, como se verá.

Por una cuestión de logicidad estructural, se resolverá en primer lugar el tercer motivo del recurso de apelación, ello porque se trata de un reclamo que tiene incidencia respecto del contenido de las piezas acusatorias y por ende, afecta a la integralidad del fallo. Aduce el recurrente que el requerimiento fiscal y la querella del Estado vulneran el principio de imputación, ya que se acusaron hechos en rangos temporales amplios que imposibilitan un adecuado ejercicio del derecho de defensa, pues obliga al imputado a saber qué hizo a lo largo de un período extenso, lo que conlleva a una violación al derecho de defensa. El reclamo se declara sin lugar: Lo primero que hay que puntualizar es que los hechos de ambas piezas acusatorias se circunscriben en el espacio temporal comprendido del 1° de abril al 19 de mayo de 2017 (hecho segundo y hecho cuarto), y del 1° de mayo de 2017 al 18 de mayo de 2020 (hecho quinto) de ambos requerimientos.

Es menester iniciar el análisis de este extremo, señalando que el principio de imputación es base esencial del debido proceso, el cual, de acuerdo con la jurisprudencia de la Sala Constitucional, se ha conceptualizado como “[…] el derecho a una acusación formal. Necesariamente debe cumplirse a cualquiera que se pretenda someter a un proceso. Es, pues, deber del Ministerio Público, aún inicialmente, y, después, de éste y del juez, y comprende los de individualizar al imputado, describir detallada, precisa y claramente el hecho de que se le acusa, y hacer una clara calificación legal del hecho, señalando los fundamentos de derecho de la acusación y concreta pretensión punitiva” (sic, resolución n.° 1739 de las 11:45 horas de 1° de julio de 1992). Una correcta imputación, debe contener, en consecuencia, todos los requisitos que prevé el artículo 303 del Código Procesal, a saber: a) los datos que sirvan para identificar al imputado; b) la relación precisa y circunstanciada del hecho punible que se atribuya; c) la fundamentación de la acusación, con la expresión de los elementos de convicción que la motivan; d) la cita de los preceptos jurídicos aplicables y, e) el ofrecimiento de la prueba que se presentará en el juicio; cada uno de ellos es esencial para que la persona sindicada conozca claramente el hecho que se le atribuye y a partir de una definición de las circunstancias de modo, tiempo y lugar y del acervo probatorio reunido puesto en su conocimiento, pueda diseñar una estrategia de defensa que le permita refutar los cargos que le atribuye el Ministerio Público o la parte querellante.

Precisamente por la intrínseca relación con el derecho de defensa, es que no son admisibles acusaciones vagas que no permitan a la persona imputada, entender en qué consiste la acción delictiva que se le atribuye, en qué momento se le endilga haberla cometido, en qué lugar se encontraba cuando el evento imputado acaeció según la teoría del caso de los órganos acusadores y las particularidades que rodearon el hecho, pues la carencia de estos factores que constituyen el núcleo de la acusación, son de los que debe defenderse el encartado pues respecto de ellos, versará la decisión judicial, con la emisión de la sentencia. En el sub judice, existen dos rangos temporales en los cuales se fijaron las acciones atribuidas al acusado: el primero, de un mes y 19 días, el que, por sí mismo, es un período breve que no dificulta de ninguna manera la posibilidad de que el encartado se pueda remontar a tal lapso para poder refutar, si lo quiere, los cargos que se le atribuyen.

Es importante agregar que ese es el período acusado sobre la base de dos aspectos fundamentales: según el oficio SINAC-ACCVC-OT-598 de folio 9 de los autos, que es el que da origen a este proceso, fue el día 26 de abril de 2017 que los inspectores del Sistema Nacional de Área de Conservación (en adelante SINAC) se presentaron al sitio de los hechos ubicado en Las Vueltas de Tucurrique, constataron los daños ambientales y verificaron la presencia del imputado en el lugar. Es en fecha 19 de mayo de 2017 que, con base en esa información, el Organismo de Investigación Judicial (en adelante OIJ) practica una inspección en la propiedad y además de constatar la afectación a la vegetación de la zona en las cercanías de una naciente de agua, practican algunas entrevistas a las personas que estaban en el lugar con la maquinaria trabajando y de manera concreta los señores [Nombre 005] y [Nombre 006], informan a la policía judicial que habían sido contratados por el encartado para remover vegetación, limpiar un camino y agregan que en esas tareas llevaban ya varios días trabajando.

Entonces, se entiende que la delimitación temporal de los hechos acusados 2 y 4 tanto en el requerimiento fiscal como en la querella tengan como punto de partida aproximadamente un mes previo a la visita de los personeros del SINAC y como límite, la inspección practicada por el OIJ. Las pruebas que se reunieron en la investigación y que fueron puestas en conocimiento del imputado al momento de la indagatoria, le permitieron entender esos rangos referenciales que, como se reitera, resultan ser de pocos días y, por ende, no cercenan la posibilidad de que el justiciable ejerciera su descargo de manera informada. Ahora bien, el segundo período definido en el hecho 5 de las dos piezas requisitorias, aunque ciertamente más extenso —pues abarca del 1° de mayo del 2017 al 18 de mayo de 2020—, estima esta Cámara que tampoco lesiona el derecho de defensa, toda vez que ese lapso deriva de una circunstancia concreta: se informa en el oficio SINAC-ACCVC-OT-598 de folio 9 de los autos, que cuando los personeros de esa entidad hacen la visita en fecha 26 de abril de 2017, se ubicó en el inmueble al imputado y que a partir de ese momento, conoció de la intervención de las autoridades en razón de las actividades de eliminación de la vegetación, corta de árboles, etc. en el lugar.

El SINAC, como parte de sus deberes, dio seguimiento a la situación y producto de una nueva queja, en fecha 18 de mayo de 2020, hace una nueva inspección en el sitio, tal como se constata en el oficio SINAC-ACC-OT-629-2020 de folio 165 del expediente. En esa nueva diligencia, este personal técnico corroboró que el daño ambiental detectado en la primera oportunidad se había acentuado, pues se siguieron haciendo movimientos de tierra con tractor, corta de árboles, construcción de una trocha paralela al cauce de agua, lo que permitió concluir que desde el 2017, el acusado continuó ejecutando actividades prohibidas en la propiedad. Entonces, la definición del rango temporal de los hechos imputados en el acápite 5 de las acusaciones, guarda congruencia con el contenido de las probanzas, pues se trata de una serie de actividades materiales que, de suyo, no pueden realizarse en un día específico: no se hacen excavaciones, ampliaciones de caminos, corta de árboles en las dimensiones que se especifican en dicho informe, de una sola vez o en un solo momento sino que se trata de actividades que se prolongan en el tiempo por sus propias características.

De esta manera, esta Cámara no encuentra que la forma en que fueron acusadas las conductas atribuidas, lesione el derecho de defensa. Además, hay que puntualizar una cuestión de importancia para la decisión que se toma y es que el contenido del hecho 5 se plasmó como la continuidad de la conducta que se describió en los hechos 2 y 3 y, con base en esto, la sentencia, determinó la responsabilidad penal del imputado por tres delitos cometidos en concurso ideal, es decir, determinó la existencia de una unidad de acción y, con independencia de que aquella determinación concursal sea correcta o no (lo que no se entra a dilucidar porque solamente apeló la sentencia la defensa técnica y por ello sería estéril analizar si más bien lo acusado correspondía a un concurso material de delitos por ubicarse en rangos temporales distante uno de otro), lo cierto del caso es que por esa decisión del a quo no se ha afectado el interés del imputado dado que la forma de imputación, en definitiva, no le ha causado agravio.

Valga aquí señalar que el principio de imputación, conforme lo regulado en la norma de cita ―303 del Código Procesal Penal― no exige una indicación de un día exacto para tener por válidamente planteada la acusación, porque ello no es posible hacerlo en todos los procesos y debe valorarse de manera casuística a partir de una contextualización lo más precisa posible conforme con los insumos existentes en autos, como ocurre en el caso concreto. Por estas razones, se desestima el reclamo planteado.

Ahora bien, estructuralmente resulta necesario resolver de seguido, de manera conjunta los motivos segundo y cuarto del recurso de apelación por tratarse de temas conexos, como se verá. El recurrente ha señalado en su recurso, que el imputado tenía una imposibilidad material de conocer que en el lugar de los hechos existía un área de protección por haber una naciente permanente porque no es sino a partir de los informes periciales del Sistema Nacional de Áreas de Conservación números DA-UHCAROC-0128-2017 y DA-UHCROC-0127-2018, que se determina que el cuerpo de agua existente en el lugar de los hechos era de naturaleza permanente y que, antes de eso, no había sido declarada como tal por el Estado, lo que resulta un obstáculo para el conocimiento pleno de los elementos objetivos del tipo penal por el que fue sentenciado recogido en el artículo 58 inciso a) en relación con el numeral 33 inciso a) de la Ley Forestal.

El alegato no prospera. El recurrente confunde la actividad estatal de recabación del material probatorio necesario para un proceso penal con las circunstancias materiales constatables en la realidad que son, en definitiva, las que determinan si un cuerpo de agua ostenta la categoría de naciente y si, siendo tal, su condición es permanente. Por un lado, la acreditación de uno de los elementos del tipo penal, de tipo normativo, que es la calidad del recurso hídrico que existe en la propiedad en la que se atribuyó que el imputado cometió los hechos acusados, como verá, quedó acreditada y, en segunda instancia, también la circunstancia de que el justiciable conocía, de manera indubitable, que esta quebrada era una naciente de carácter permanente y por ende, podía demostrarse que actuó con el conocimiento y la voluntad de invadir una zona de protección. Al acusado se le atribuyó haber eliminado la vegetación y haber talado el 50% de los árboles existentes a 10 metros de una naciente permanente en una propiedad ubicada en Tucurrique de Cartago.

El cuestionamiento de quien apela, sostiene que la condición de naciente permanente de ese cuerpo de agua fue determinada a través de dos oficios emitidos por la Dirección de Agua del Ministerio de Ambiente y Energía, concretamente los número DA-UHCAROC-0128-2017 de fecha 22 de mayo de 2017 y el DA-UHCAROC-0127-2018 de fecha 26 de abril de 2018, es decir, en criterio de quien recurre, es a partir de esos dos pronunciamientos que tienen fecha posterior a los hechos acusados, que el cuerpo de agua existente en el sitio adquiere la calidad que requiere el tipo penal contenido en el numeral 58 en relación con el 33 de la Ley Forestal, que preceptúan, el primero de ellos que “Se impondrá prisión de tres meses a tres años a quien: a) Invada un área de conservación o protección, cualquiera que sea su categoría de manejo, u otras áreas de bosques o terrenos sometidos al régimen forestal, cualquiera que sea el área ocupada; independientemente de que se trate de terrenos privados del Estado u otros organismos de la Administración Pública o de terrenos de dominio particular.

Los autores o partícipes del acto no tendrán derecho a indemnización alguna por cualquier construcción u obra que hayan realizado en los terrenos invadidos”, mientras que el segundo define qué es un área de protección en los siguientes términos: “Se declaran áreas de protección las siguientes: a) Las áreas que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal” (el énfasis es propio). Se colige de lo indicado, varios aspectos de relevancia: es la misma ley la que preceptúa que es un área de protección, ello deriva del derecho fundamental a un ambiente sano y ecológicamente equilibrado, que está reconocido de manera expresa en la Constitución Política. Las áreas de protección, en consecuencia, son limitaciones de interés público a la propiedad para proteger el recurso hídrico de acciones que puedan afectar el estado natural de las fuentes de agua.

Sobre este tópico, valga apuntar que un área de protección no es lo mismo que un área silvestre protegida, las que forman parte del patrimonio natural del Estado y que están sujetas a otro tipo de regulaciones, conforme lo dispone el inciso i) del numeral 3 de la misma Ley Forestal. Ahora bien, según la Ley de Aguas n° 276 del 27 de agosto de 1942 y el artículo 50 de la Ley Orgánica del Ambiente número 7594, el agua y los cauces por los que esta discurre son de dominio público, independientemente de dónde se encuentren (terrenos del Estado o propiedades privadas) dado que existe un interés superior en proteger el recurso hídrico como parte integrante del derecho a un ambiente ecológicamente sano y al derecho al agua específicamente, como una necesidad humana que el Estado debe garantizar siendo considerada un derecho humano de tercera generación, esto a partir de la Declaración sobre el Derecho al Desarrollo adoptada por la Asamblea General de las Naciones Unidas el 04 de diciembre de 1986.

Así, dispone el artículo 1º de la Ley de Aguas: “Son aguas del dominio público: IV.- Las de los ríos y sus afluentes directos o indirectos, arroyos o manantiales desde el punto en que broten las primeras aguas permanentes hasta su desembocadura en el mar o lagos, lagunas o esteros”; por su parte, el artículo 2 establece: “[l]as aguas enumeradas en el artículo anterior son de propiedad nacional” mientras que la Ley Orgánica del Ambiente dispone en su artículo 50: “El agua es de dominio público, su conservación y uso sostenible son de interés social”. No hay duda, entonces, de que toda fuente de agua es de dominio público, así se encuentren en terrenos propiedad de particulares. Ahora bien, de acuerdo con las Metodologías hidrogeológicas para la evaluación del recurso hídrico, acuerdo número 60-2012 de las ocho horas del doce de junio del dos mil doce del Ministerio del Ambiente y Telecomunicaciones (MINAET), una naciente o manantial es un “flujo de agua subterránea que aflora en la superficie debido a cambios topográficos, zonas preferenciales, rasgos geológicos-estructurales como fallas, o cambios en la conductividad hidráulica, fracturas o discontinuidades”.

Los cuerpos de agua, según su naturaleza, tienen a su vez un área de protección a su alrededor, que cambiará de dimensiones según se trate. Así, el parámetro de cien metros que prevé el artículo 33 de la Ley Forestal, obedece a nacientes de tipo permanente. Las de tipo intermitente, contemplan un parámetro menor, que regula la Ley de Aguas. Puntualizados estos aspectos, es posible arribar a una primera conclusión: la labor que realizó la Dirección de Agua del Ministerio del Ambiente, la que se plasma en los oficios DA-UHCAROC-0128-2017 de fecha 22 de mayo de 2017 y el DA-UHCAROC-0127-2018 de fecha 26 de abril de 2018, no se trata del acto administrativo del que dimana la condición de naciente permanente del cuerpo de agua existente en los terrenos de interés, es decir, no se trata de una actividad constitutiva del tipo de recurso hídrico, sino tan solo de una actividad dictaminadora de constatación que deviene en demostrativa al tenor de lo que establecen los artículos 302 y 303 de la Ley General de la Administración Pública, porque el agua, por disposición de ley, es un bien público del que no pueden disponer los particulares sin la supervisión del Estado.

Los oficios que cita el defensor fueron requeridos por el personal del Sistema Nacional de Áreas Protegidas (SINAC), el primero de ellos, en respaldo de la denuncia que plantearon en contra del imputado una vez realizada una inspección en el sitio. El segundo, por la Fiscalía dentro de la actividad probatoria propia del ejercicio de la acción penal. Ambos, son probanzas que, de cara a las exigencias del proceso penal, resultaban indispensables para acreditar el elemento normativo del tipo penal acusado contenido en el inciso a) del artículo 58 en relación con el 33 de la Ley Forestal pero no debe confundirse ello con una declaratoria del tipo de recurso hídrico de que se trata. Al respecto, ha indicado la Sala Constitucional: “De tal manera, es claro que la consideración del agua como recurso esencial y derecho fundamental, conlleva la necesaria protección de sus fuentes y de las áreas de captación, donde se consideran desde los mantos acuíferos subterráneos y superficiales, así como las nacientes, pozos y demás áreas desde las que se ubica y dispone del recurso hídrico.

Esta protección implica el establecimiento de las denominadas áreas o perímetros de protección, como la señalada, precisamente, en el inciso a) del artículo 33 de la Ley Forestal, la cual, según se ha reseñado, refiere un radio de protección de 100 metros respecto de las nacientes permanentes, área de protección que puede variar, y de hecho así se establece en la legislación ordinaria, si la naciente dista de ser permanente, y, por el contrario, es una naciente de carácter intermitente o no permanente, respecto de las cuales no es que no exista protección alguna, sino que los radios de las áreas de protección pueden ser variables según así se considere por la normativa y las instancias técnicas responsables. Dicho de otro modo, la normativa y la jurisprudencia reconocen la importancia y la necesidad de brindar protección a las nacientes, y de ahí la definición de los radios de las áreas de protección de las mismas, cuya extensión varía dependiendo del tipo de naciente de que se trate, justamente, porque partiendo del tipo de naciente, así será el radio del área de protección correspondiente, sin que ello sea, per se, una situación que genere inconstitucionalidad alguna, pues como bien se indica en el precedente de cita, las propias condiciones de cada tipo de naciente –acuífero, pozo y demás- son las que definen las condiciones particulares de protección, de modo que haya áreas de protección especialmente definidas de acuerdo al tipo de naciente, manto o pozo de que se trate” (ver resolución n.° 9221 de las 11:41 horas del 22 de mayo de 2019, el énfasis es propio).

Precisamente, el fallo de instancia concluye en que la actuación del justiciable fue dolosa porque era evidente la existencia de la fuente de agua en el terreno, ya que, de las inspecciones realizadas por los oficiales del Organismo de Investigación Judicial y el personal técnico del SINAC, quedó documentado que se trataba de un cuerpo hídrico evidente (incluso en los informes se plasman fotografías que así permiten constatarlo visualmente) y porque de tales probanzas derivó que no existía trámite alguno efectuado por el sindicado para realizar trabajos alrededor de la naciente, que en todo caso, en el perímetro que el acusado ejecutó la corta de árboles y el movimiento de tierra, estaban prohibidos, pues se llevaron a cabo apenas a 10 metros de distancia, al punto que existió caída de material al cauce. Precisamente por ello, es que no es atendible el argumento del defensor en cuanto a que el sindicado no podía conocer la naturaleza de la fuente de agua existente en el terreno y que, por ende, ignoraba los elementos objetivos del tipo penal de manera completa, descartando con ello el argumento de que pudo haber actuado bajo un error de tipo.

De la mano de esto, es que el motivo cuarto del recurso de apelación también debe ser desestimado. El alegato del recurrente es que la sentencia no analiza el dolo como elemento subjetivo requerido para acreditar el tipo penal y agrega que el fallo, además, sostiene que el imputado actuó culposamente. Esta Cámara debe apuntar que, en ningún momento, a lo largo de la resolución que se impugna se indica o se hace ver que el sindicado [Nombre 001] haya incurrido en alguna infracción al deber de cuidado que hiciera nacer a la vida jurídica una conducta culposa. La sentencia es clara en establecer que, si bien los inmuebles en los que se hizo la remoción de árboles y de vegetación estaban a nombre de terceros (uno de ellos el padre del acusado), se demostró que el justiciable era quien tenía disposición sobre ellos, pues él fue quien ordenó la ejecución de los trabajos en el lugar, ello acreditado a través de las declaraciones de los testigos [Nombre 005], [Nombre 007] y los informes tanto del SINAC como del OIJ ya aludidos.

También, de tales documentos, fue posible concluir para el tribunal de mérito que esas actividades se realizaron sin que se hubieran otorgado permisos al respecto, lo cual no deviene de una suposición de la juzgadora sino que derivó prístinamente de la prueba documental incorporada, en concreto de los informes C.I. 592-SDRT-17, del SINAC-ACCVC-OT-598 y en particular del oficio S. M. 265-2017 del Consejo Municipal de Tucurrique, en el que se consigna que “en atención a la tala y limpia de área de naciente, el día 28 de abril del año en curso, los regidores de este Consejo Municipal, procedieron a realizar la inspección al sitio de los hechos, puesto que no cuentan con ningún tipo de permiso municipal” (el subrayado se suple). En este sentido, la sentencia no incurre en los yerros que le endilga el recurrente, razón por la que, los motivos segundo y cuarto del recurso, se declaran sin lugar.

Se analizarán, de seguido, los motivos quinto y sexto del recurso de apelación de manera conjunta por conexidad de sus contenidos. En cuanto al quinto, se aduce que existió preterición de prueba en relación con el plano n° [Valor 003], dado que se apunta que no fue valorado por la juzgadora de instancia. Por su parte, aunque el sexto alegato se plantea como un motivo por el fondo por violación al principio in dubio pro reo, en realidad es una repetición del quinto, porque de nueva cuenta, el recurrente reclama que, de haberse valorado el plano de cita, se habría arribado a una sentencia absolutoria en favor del imputado. Los reclamos se rechazan: el recurrente pretende establecer que, dado que las propiedades sobre las que se demostró que se hicieron actividades lesivas para el medio ambiente, no eran propiedad del sindicado sino de otras personas y que, además, hay un fundo enclavado que tiene una servidumbre por lo que sería al titular de ese fundo al que le interesaría, eventualmente, limpiar el terreno para hacer uso de esta, no es posible asociar al justiciable con la comisión de los delitos por los cuales resultó condenado.

Pues bien, esta Cámara debe dejar en claro varios aspectos: los delitos por los cuales fue encontrado responsable el encartado, no prevén elementos subjetivos distintos del dolo para su configuración. Por ende, qué motivaciones pudo tener el imputado para talar árboles y arrancar la vegetación alrededor de una naciente permanente, no es un aspecto que resultase necesario dilucidar para la configuración de los delitos. Bastaba con demostrar, como en efecto se hizo, que el encartado con conocimiento de que en la propiedad hay una naciente permanente de agua, sin contar con permiso alguno de autoridad competente, voluntariamente dispuso excavar taludes, amplió un camino, eliminó vegetación, cortó árboles y depositó materiales en el cauce hídrico dentro de lo que sabía era una zona de protección. Por otra parte, la sentencia de manera expresa analiza el contenido del plano que reclama el defensor que fue omitido del examen de la prueba, explicando que poca trascendencia tenía la determinación de quién era el dueño de la servidumbre que consta en el plano o quién es el dueño registral del inmueble porque la prueba fue categórica en cuanto a que era el imputado [Nombre 001] quien ejercía disposición sobre los terrenos en cuestión: fue encontrado en el lugar por personeros del SINAC, que le advirtieron de sus derechos y ante los que manifestó que era dueño de la propiedad y que quería rehabilitar una plantación de pejibayes.

Por otro lado, en la inspección realizada por la policía judicial, tal como fue corroborado en juicio por el testigo [Nombre 005], se pudo corroborar que quien contrató maquinaria y dio órdenes de cómo ejecutar los trabajos que se hicieron en el terreno, fue el encartado, es decir, él tenía el dominio del hecho y fue quien determinó el curso de las acciones. Estas circunstancias permiten concluir que la sentencia no omitió de modo alguno referirse a la probanza de interés para la defensa pero que, además, la individualización del acusado como la persona que contrató maquinaria para llevar a cabo las actividades indicadas contenidas en las acusaciones fue acreditada con certeza, por lo que la presunción de inocencia cedió ante la demostración, más allá de toda duda razonable, de la autoría del encartado en los hechos acusados. Se declaran, por lo anterior, sin lugar los motivos de apelación quinto y sexto esgrimidos.

Finalmente, en cuanto al primer motivo del recurso de apelación en el que se reclama la violación al derecho de defensa porque la Fiscalía no informó al imputado que podía solicitar un dictamen social para acreditar su vulnerabilidad para los efectos de una reducción de la pena mínima de los delitos, se desestima: una primera cuestión que debe indicarse es que esta Cámara tiene un criterio dividido acerca de la obligatoriedad de aplicar el contenido de los artículos 71 inciso g) y 72 del Código Penal a los hombres sentenciados por la comisión de un delito. Por un lado, la mayoría de la integración (jueza Wittmann y juez Fernández) son de la posición de que las normas resultan aplicables tanto a hombres como a mujeres a partir del fallo de la Sala Constitucional N° 8751-2022, mientras que la minoría (jueza Sancho), ha sostenido que ello está reservado a mujeres y a hombres con discapacidad exclusivamente.

Esta división de criterios es la que también se refleja en la jurisprudencia de la Sala Tercera, que, en voto mayoritario de tres votos contra dos, ha admitido la extensión de la norma a supuestos de vulnerabilidad en hombres, verbigracia en la resolución 2024-0395 de las 11:15 del 02 de mayo de 2024. Ahora bien, hecha esta puntualización, de manera unánime este órgano de alzada estima que ni siquiera es dable esa discusión en el caso que nos ocupa, ya que una primera exigencia que correspondía al petente, era acreditar que las normas de cita eran aplicables al caso concreto, lo cual, no hizo, pues su gestión fue vaga y no especificó ni siquiera el supuesto bajo el cual consideraba que se encontraba su representado (pobreza, discapacidad, cuido de personas a su cargo, violencia, etc.) ni mucho menos, la relación de esta (si es que existía) con la comisión del hecho. Se limitó a esgrimir que se trata de un agricultor sin que haya desarrollado por qué esa ocupación, en sí misma, torna vulnerable a una persona y obvió por qué bajo las circunstancias del asunto bajo estudio, ello tenía alguna relación con el delito.

Esto, basta para descartar el agravio reclamado. No obstante, debemos agregar que tampoco logra esbozar el recurrente las razones por las que afirma que era el deber de la Fiscalía advertir al sindicado que podía optar por una valoración social, pues esa obligación que le atribuye al órgano a cargo de la persecución penal no se encuentra estatuida en norma alguna. Finalmente, valga subrayar que un sano ejercicio de la defensa técnica pasa por promover aquellas gestiones que se estiman necesarias y útiles para los intereses de quien se representa. Si el señor defensor consideraba que una probanza en tal sentido era menester dentro de su teoría del caso, debió gestionarla ante la autoridad competente y de manera oportuna. Véase que esta sumaria data del año 2017 y el voto de la Sala Constitucional que cita el recurrente en respaldo de su postura, el ya aludido número 8751, es de fecha 20 de abril de 2022, de modo que tuvo margen de sobra para impulsar cualquier solicitud al respecto.

En todo caso, como se lleva dicho, las particularidades del caso ni siquiera sugieren alguna condición de desventaja del acusado [Nombre 001] que obligue a ahondar más al respecto, razón por la que, este motivo sigue la misma suerte que los anteriores y se declara sin lugar.

POR TANTO

  1. 1Se admite el recurso de apelación interpuesto por el licenciado Adrián Alpízar Alvarado, defensor público del imputado.
