At fourteen hours and two minutes on veintinueve de abril de dos mil veintiuno.

Appeal against a criminal judgment (recurso de apelación de sentencia penal) filed in these proceedings against [Nombre1], an adult, born on cinco de abril de mil novecientos cincuenta y tres, holder of identity card number CED1 - -, for the offense of Encroachment upon a Protection Area, to the detriment of Los Recursos Naturales. Judges Christian Fernández Mora and David Fallas Redondo, as well as Judge Ivette Carranza Cambronero, participated in deciding the appeal. The following appeared in the appeal proceedings: [Nombre2], as privately retained defense counsel (defensor particular) for the accused; Ivannia Li Zúñiga, representing the Ministerio Público; and José Humberto Fernández González, representing the Procuraduría General de la República.

Findings:

1. By Judgment number 62-2021 at dieciséis horas diez minutos del cinco de febrero de dos mil veintiuno, the Tribunal del Primer Circuito Judicial de la Zona Sur, Sede Buenos Aires, ruled: “POR TANTO: In accordance with the foregoing, the provisions cited, Articles 39 and 41 of the Constitución Política; Articles 1, 11, 30, 45, and 367 of the Código Penal; sections 1, 2, 6, 8, 9, 111 through 124, 142, 265 through 270, and 341 through 366 of the Código Procesal Penal; Article 58(a) of the Ley Forestal; and section 73.2 of the Código Procesal Civil, this Court hereby acquits the accused, [Nombre1], of all punishment and liability for the offense of Encroachment upon a Protection Area charged against him by the Ministerio Público and the Procuraduría General de la República in its capacity as private prosecutor (Querellante), to the detriment of Los Recursos Naturales. The lifting of any precautionary measure (medida cautelar) ordered against the accused in these proceedings is hereby directed.

The civil damages action (Acción Civil Resarcitoria) filed by the Procuraduría General de la República against the civil defendant (demandada civil), [Nombre1], is denied. No special award of costs is entered with respect to the civil damages action. The costs of the proceedings shall be borne by the State. Pursuant to Article 140 of the Código Procesal Penal, the restoration of the property to its original condition is ordered with respect to the access track, culverts, structures, and buildings within the protection area (área de protección) at [Dirección1], located in the community of Javillo de Potrero Grande de Buenos Aires and owned by Inversiones Anahatta Global, Sociedad de Responsabilidad Limitada. The Judicial Representative of the limited liability company Inversiones Anahatta Global, SRL, is granted a period of three months after service of this judgment to demolish the six culverts, as well as the structures and buildings within the protection area.

The Ministerio de Ambiente y Energía, SINAC, is likewise ordered to conduct an inspection and submit a report to verify compliance with the orders contained in this judgment. Notice shall be given by reading aloud. José Antonio Campos Vargas. Trial Judge ai.” 2. Ricardo Ananías Loaiza Morales, José Humberto Fernández González, and Ivannia Li Zúñiga filed appeals against the foregoing decision.

3. After the corresponding deliberation was conducted in accordance with Article 466 of the Código Procesal Penal, as amended by Ley 8837 published on nueve de diciembre de dos mil once (Creation of an Appeal against the Judgment), the Court considered the issues raised in the appeal.

4. The relevant legal requirements were observed during the proceedings.

Drafted by Judge Fernández Mora; and,

Whereas:

I.Admissibility of the appeals (Admisibilidad de los recursos): Because they satisfy the legal requirements, the appeals filed by Ivannia Li Zúñiga, in her capacity as representative of the Ministerio Público; José Humberto Fernández González, as representative of the State; and Ricardo Ananías Loaiza Morales, in his capacity as privately retained defense counsel for the accused, are admitted for consideration on the merits. A review of the case record establishes that the aforementioned appeals were filed within the statutory period and in accordance with the requirements for the proper and correct consideration of the objections raised by the appellants.

II.The representative of the Ministerio Público raised a first ground for challenge, alleging an erroneous assessment of the evidence and a lack of reasoned evidentiary analysis. She contends that the evidence was not properly analyzed, since the reasoning concerning the testimonial evidence was extremely brief, merely stating in a few lines that witnesses [Nombre3] and [Nombre4] indicated that the defendant [Nombre1] “made forward motions with his hands” and that, specifically, witness [Nombre4] testified that it could be inferred from those movements that the defendant was giving instructions, although, because of the noise from the heavy machinery, they could not determine what those instructions were. She argues that the witnesses’ testimony was assessed in a biased manner because what they described does not constitute ambiguous circumstantial evidence (indicio anfibológico), as the trial judge stated, since there were no other persons at the site and the actions performed by [Nombre1] were directed solely and exclusively at the operator to have the track constructed.

In the second ground for challenge, the appellant alleges that the judgment erroneously applied substantive law because the trial judge reasoned that the accused did not act as an indirect perpetrator (autor mediato) of the act and that it was not possible to establish that the accused had joint functional control of the act (codominio funcional del hecho), because his final action did not involve operating the heavy machinery and he therefore did not have control over the will of the crawler-tractor operator, whose true identity was never investigated and who performed the final act of encroaching upon a protection area (área de protección). According to the appellant, the reasoning of the judgment is contradictory because it states that documentary evidence established that the accused [Nombre1] did not have permits from the Administración Forestal del Estado and that the protection area corresponded to a spring (naciente), but that the accused’s functional control over the events was not proven, even though that circumstance was established through the testimonial evidence.

She requests that the judgment be vacated and that the case be remanded to the trial court for a new trial. As a first ground of appeal, the representative of the Procuraduría General de la República challenges the inadequate reasoning of the judgment on the ground that it violated the rules of sound judicial reasoning (sana crítica). He contends that the adversarial proceedings established that the offense of encroachment upon a protection zone occurred through the construction of an access road from the entrance of the property to the rear of the parcel where a corral is located, and that this road also encroaches upon the protection zone of a permanent spring; that several culverts and a cement-lined well are also present, as are improved Brisanta grass and livestock on the property. He contends that it is untrue that no fact was deemed proven, since the encroachment upon a protection area surrounding the spring and the stream was proven.

Otherwise, it would have been unreasonable to order restoration to the condition existing before the events. He argues that the dispute concerns whether the instructions given by the accused to the machinery operator had to be verbal for the offense to be established, since he issued instructions through signs and hand gestures to direct the construction of the project. He states that the manner in which those instructions were conveyed is immaterial, because gestural instructions were the appropriate means of communication, taking into account the external noise produced by the tractor engine, which made verbal communication impossible. He requests that the judgment be reversed and the matter remanded for new proceedings. Given the manner in which the matter is resolved, these grounds are considered jointly and, sua sponte, are denied because the criminal action was extinguished by the statute of limitations (prescripción), for the following reasons: A) A comprehensive review of the matter shows that the events at issue in these proceedings date from 26 de diciembre de 2012, when it is alleged that the accused [Nombre1], exercising joint functional control of the act with the heavy-machinery operator, who could not be identified during the investigation, gave verbal instructions to encroach upon the protection zone of a permanent spring and a seasonal stream, for which purpose earthworks (movimientos de tierra) were carried out within those protection areas, constructing a track used for grazing livestock and culverts to drain the water surface.

On that same day, officers of the Ministerio del Ambiente y Energía carried out the relevant investigative measures: they prepared the corresponding report, seized the machinery used, and identified the accused [Nombre1], thereby initiating proceedings against him for the offense of encroachment upon a protection zone. Although the judges signing this majority opinion understand that the aforementioned offense is a continuing offense (delito de carácter permanente), because the offense remains in a state of ongoing commission for as long as the encroachment upon the protection zone continues, it must be understood, in accordance with the principle of legality (principio de legalidad), that the limitation period began to run when the proceedings commenced, as provided by article 33 of the Código Procesal Penal, which states: “Once the proceedings have commenced, the periods established in the article preceding the previous one shall be reduced by half for purposes of calculating them in order to suspend or interrupt the limitation period.” In other words, the legislature distinguished between two situations for calculating the limitation period: a) when proceedings have not commenced, in which case the full limitation period runs, as provided by article 31 of the Código Procesal Penal; and b) when proceedings have already commenced, in which case the calculation must be reduced by half for purposes of taking it into account whenever a ground for suspension or interruption of the limitation period must be recorded.

Otherwise, the legislature’s inclusion of the phrase “once the proceedings have commenced” would make no sense, because grounds for interruption and suspension of the limitation period arise only after proceedings have commenced. (In this regard, see the similar position adopted by this same panel in opinion number 2020-443, issued at 10:30 horas del 31 de julio de 2020). This panel cannot accept the proposition that, for continuing offenses, the limitation period does not begin until the continuing conduct ceases, as provided by article 32 of the Código Procesal Penal, because that would render this type of offense not subject to a statute of limitations. In a case such as this one, it would mean that none of the grounds for interrupting or suspending the limitation period operated, because finding that they had operated would require the limitation period to have begun running, which would not occur until the encroaching acts maintaining the continuing criminal result had ended.

It could even lead to the absurd result that the accused might be convicted and complete the sentence imposed on him while the limitation period had still not begun, solely because the acts of occupation continued within the protection zone alleged to have been encroached upon. This Chamber therefore finds that articles 31 and 32 of the Código Procesal Penal refer to calculating the limitation period in matters in which proceedings have not commenced; once proceedings have commenced, it is logical for a different rule to apply, namely article 33 of the Código Procesal Penal, because the State’s law-enforcement apparatus has been put on notice of the existence of an offense and has at its disposal all legal mechanisms necessary to prevent the offense from continuing and being completed, as established by article 67 of the Código Procesal Penal with respect to the role of the judicial police, which acts under the functional direction of the Ministerio Público, in addition to the specific provisions conferred by the various laws upon the Administración Forestal del Estado to prevent the continuation of acts harmful to the environment (Ley Orgánica del Ambiente, Ley Forestal, Ley de Biodiversidad, among others).

Having clarified the foregoing, it must be concluded that, because the limitation period began to run on the same day that the events charged by the Ministerio Público occurred, it ran from that time onward, reduced by half pursuant to the legislature’s express provision. Because the offense of encroachment upon a protection area, under article 58 subsection a) of the Ley Forestal, carries a maximum sentence of three years’ imprisonment, once the limitation period was reduced by half upon commencement of the proceedings, the period for extinguishing the criminal action was eighteen months (article 31 subsection a), in conjunction with article 33 of the Código Procesal Penal). Accordingly, the majority of this Chamber finds that the events adjudicated in these proceedings had become time-barred before the accused was formally advised of the charges for the first time, because his investigatory statement (declaración indagatoria) was taken on 03 de julio de 2014, by which time more than eighteen months had elapsed since the proceedings commenced; the limitation period therefore expired on 26 de junio de 2014.

It should be noted that, in this matter, the majority of this Chamber has interpreted that, because the statute of limitations (prescripción) is a procedural sanction established by law for State inaction, it constitutes a prerequisite for the lawful exercise of the criminal action (acción penal) and, pursuant to subsection c) of Article 178 of the Code of Criminal Procedure, constitutes an absolute defect (vicio de carácter absoluto), which this Chamber may declare sua sponte, as it relates to the authority of the Public Prosecutor’s Office to exercise the criminal action and to its participation in the proceedings. In view of the foregoing, the appeal filed by the prosecution must be denied, and the criminal action must be declared extinguished sua sponte due to the statute of limitations, while upholding the acquittal entered in favor of the accused [Nombre1] regarding the acts attributed to him in these proceedings.

  • B)Even assuming that the majority of this Chamber’s interpretation regarding the effect of the commencement of proceedings on the calculation of the limitation period—automatically reducing the period by half—were not accepted, review of the case file establishes that the final limitation period expired during the intermediate stage (etapa intermedia), which in these proceedings lasted almost five years, as will be explained. It should be noted that both positions proceed from the premise that, even in the case of continuing offenses (delitos permanentes), the legislature has not stated in any provision that the limitation period does not begin to run once proceedings have commenced because, as stated in the preceding section, that would lead to the absurd result that such cases would become imprescriptible, even though various grounds expressly established by law as interrupting the limitation period may arise.

Thus, the judgment challenged here would not have interrupted the limitation period in this case because the restoration of matters to their original condition, as ordered by the a quo court, has not yet been carried out; this would not only be contrary to an express provision of law but would also be nonsensical. As stated, the charged acts date from 26 de diciembre de 2012, and the accused gave his preliminary statement (declaración indagatoria) on 3 de julio de 2014 (folio 59 of the main case file). The first scheduling of the preliminary hearing (audiencia preliminar) occurred on 03 de agosto de 2015 (folio 113), but that proceeding could not be held for various reasons recorded on each occasion, and it therefore had to be rescheduled for 10 de setiembre de 2015 (folio 119); 12 de enero de 2016 (folio 165, which erroneously states that the date is 12 de enero de 2015); 23 de febrero de 2016 (folio 177); and 06 de abril de 2016 (folio 183).

Between each of these events interrupting the limitation period, as established by Article 33, subsection c), of the Code of Criminal Procedure, the final period of dieciocho meses required for the statute of limitations to expire was never exceeded. However, the proceeding was not held on the last occasion for which the parties had been summoned either; instead, following a motion filed by the representative of the Public Prosecutor’s Office on 06 de junio de 2018 (folio 194), the preliminary hearing was rescheduled for 04 de julio de 2018. By then, more than dieciocho meses had elapsed since the most recent scheduling of the preliminary hearing, and the criminal action against the accused [Nombre1] for the acts investigated here had therefore been extinguished since 06 de octubre de 2017. Accordingly, the subsequent scheduling of preliminary hearings and of the oral trial (debate oral) that resulted in the challenged judgment did not interrupt the limitation period for the criminal action, because that period had already expired long before those interrupting events were ordered.

Once that situation has been established, any error that may have existed in the challenged decision is immaterial, since the period established by the legislature for exercising the criminal action had long since elapsed; therefore, the acquittal reached by the a quo court must remain undisturbed. Judge Fallas Redondo partially dissents on this issue.

III.The representative of the Procuraduría General de la República raised a second ground based on an error in procedendo: contradictory and insufficient reasoning in the judgment concerning the civil action for damages (acción civil resarcitoria). He alleges that the accused’s possible strict liability (responsabilidad objetiva) was not analyzed and that, instead, the action was said to be denied because the accused’s guilt could not be established with the required degree of certainty, even though it is insufficient to assert that a criminal acquittal results in a civil judgment absolving the defendant without providing persuasive reasons for that decision. He maintains that the court made statements amounting to unsupported assertions from which it is impossible to discern the reasons why the civil action for damages was denied. The challenged judgment does not explain why the civil action for damages was denied when the offense was proven by the evidence presented; indeed, restoration of matters to their prior condition was ordered because environmental damage, which had been quantified, was being caused.

This ground is denied: The challenged judgment adequately explains that the State’s representative attributed only fault-based civil liability (responsabilidad civil de tipo subjetiva) to the civil defendant, arising from the commission of an unlawful act, and therefore at least the criminal wrong (injusto penal), as the event giving rise to the claimed damage, had to be proven. The appellant’s request that the judgment analyze the possibility of strict liability on the part of the civil defendant is therefore inadmissible because, pursuant to the principle of congruence between the complaint and the judgment (principio de congruencia entre demanda y sentencia), set forth in Article 61.2 of the Code of Civil Procedure, the defendant could never have been held liable on that basis because that type of liability had not been alleged against that party. This Chamber finds neither unsupported assertions devoid of substance nor any failure to explain adequately the reason for the civil judgment absolving the defendant, since the judgment clearly stated: “In the present case, although environmental damage was established, it is not possible to establish the causal link (nexo causal) that would permit civil liability to be attributed to the defendant [Nombre1].

This is so because neither the defendant’s criminal responsibility for these acts nor the allegation that he carried out the earth-removal works (obras de remoción de tierra) and encroachment into the protected spring area (área protegida tipo naciente) by ‘commissioning the works,’ as had been attributed to him, was established. As previously stated, notwithstanding the testimony of the expert witness [Nombre4], as well as the matters described and analyzed in the Environmental Damage Economic Valuation Report, it is not possible to establish a link between obligations that would support an inference of liability for compensation in the present case. This is because, in essence, it is necessary to assess the basis for attributing civil liability that connects the civil defendant to the action filed by the State; in the present case, the Procuradora neither specifically identified the basis for attributing the civil liability she sought nor proved it at trial.

Therefore, an analysis of the civil complaint and the arguments presented in her closing submissions shows that the standard used by the State’s representative was the attribution of fault-based civil liability, on the premise that the damage for which compensation is sought resulted from intentional criminal conduct; accordingly, the criminal or civil wrong must be established in order for the civil defendant to have passive standing (legitimación pasiva).” The statement that environmental damage existed and that restoration of matters to their natural condition had to be ordered does not mean that such damage could be attributed to the civil defendant, because doing so required proof of a causal link between the alleged conduct and the environmental damage in question. That was the basis asserted by the plaintiff in its civil complaint, and it never alleged that the environmental damage resulted from any form of strict liability established by law; consequently, the civil action for damages filed by the Procuraduría General de la República could not be granted. In view of the foregoing, this ground of appeal is denied. Judge Fernández Mora adds a separate note.

IV.Note by Judge Fernández Mora: Regarding the civil action for damages (acción civil resarcitoria), I must point out that, as I have repeatedly done, in my view, the expiration of the criminal action under the statute of limitations (prescripción de la acción penal) entails that of the criminal action, even though the case law (jurisprudencia) of the Sala Tercera has held otherwise, since this is mandated by a provision currently in force within the legal system (ordenamiento jurídico), namely Article 871 of the Civil Code. The arguments of the Sala de Casación asserting that Article 96 of the Criminal Code tacitly repealed (derogó tácitamente) Article 871 of the Civil Code overlook circumstances that must necessarily be considered in light of the rules governing the tacit repeal (derogatoria tácita) of a provision, such as the lex posterior criterion. In this regard, Josep Aguiló states: “Not every normative inconsistency gives rise to repeal due to incompatibility.

Repeal occurs only when the conflicting provisions are ordered by applying the lex posterior criterion. No repeal follows from the application of the lex specialis and lex superior criteria” (Aguiló, Josep. La derogación en pocas palabras. Anuario de Filosofía del Derecho XI, 1994, p. 412). From the foregoing perspective, Article 871 of the Civil Code could not be interpreted as having been tacitly repealed because the Criminal Code, which contained the aforementioned Article 96, was enacted in 1970, since, through a subsequent law, the legislature decided to restore the effects of Article 871 of the Civil Code. That subsequent legal provision is none other than Law No. 4981 of November 8, 1971, which reinstated Title IV, Book I of the 1941 Criminal Code, Article 138 of which provides: “The obligations concerning civil reparation (reparación civil) addressed in this chapter shall be extinguished by the means and in the manner established by the Civil Code for civil obligations,” which necessarily refers to the manner in which a civil action arising from a criminal offense is extinguished (statute of limitations), as stipulated in Article 871 of the Civil Code.

In this regard, it must be borne in mind that tacit repeal due to normative incompatibility (incompatibilidad normativa) does not have the effect of removing a provision from the legal system, but merely renders it inapplicable because of that incompatibility; nevertheless, it remains a provision that is fully in force. Accordingly, even assuming that the Sala de Casación’s interpretation—that Article 871 of the Civil Code was tacitly repealed due to incompatibility between provisions upon the enactment of Article 96 of the Criminal Code—were correct, that provision would not have ceased to be in force, but would merely have been incompatible for a period of slightly more than one year (from May 4, 1970, to November 18, 1971), because the same legislature subsequently decided to restore all of its effects through a new legislative enactment. In this regard, it should be noted that the Sala Constitucional de la Corte Suprema de Justicia, in response to a judicial consultation (consulta judicial) from the Sala de Casación Penal questioning the provisions of Article 871 of the Civil Code, stated: “Whatever limitation period the law may establish, in the case of criminal conduct it is logical that the civil actions arising therefrom, being purely private and therefore secondary to the primary public interest inherent in the criminal action, should share the same fate as the latter with respect to the statute of limitations.

Otherwise, the criminal act could be invoked and judicially proven in civil proceedings (sede civil) for the purpose of obtaining compensation for loss and damage (resarcimiento de los daños y perjuicios), even though the penalty could not be imposed because the criminal action had expired under the statute of limitations, which would be illogical” (Sala Constitucional de la Corte Suprema de Justicia, ruling No. 1993-5029 at 14:36 on 13/10/1993) (Emphasis added). In other words, because Article 871 of the Civil Code is a provision that remains in force and effective and is not constitutionally objectionable (roces de constitucionalidad), it must be effectively applied by the adjudicating judge (juzgador). For this judge, it is clear that there is an exception to the general principle of the ten-year limitation period for bringing a claim in civil proceedings. It is precisely the law that establishes that, in cases of liability arising from a criminal offense, the civil action must expire under the statute of limitations together with the criminal action.

Personally, I consider that interpreting Article 871 of the Civil Code as having been tacitly repealed reflects a determination to afford the victim protection beyond that which the legislature itself expressly decided to grant, for which purpose the Sala de Casación Penal has relied on legal arguments that, although technically correct, are strained when applied to the matter under review. In view of the foregoing, I consider that, in addition to the fact that the appellant (recurrente) never attributed to the civil defendant (demandado civil) any liability other than fault-based liability (responsabilidad subjetiva), the discussion concerning that liability is in any event moot because both the criminal action and the civil action have expired under the statute of limitations; therefore, the judgment under appeal (sentencia impugnada) must be affirmed in that respect.

V.In a third ground of appeal (motivo de impugnación), the State’s representative alleges that the judgment contains contradictory and insufficient reasoning regarding the restoration of things to their natural state (restitución de las cosas a su estado natural), in violation of substantive law. He contends that the judgment violates Article 140 of the Code of Criminal Procedure, the Ley Forestal, Environmental Law, and its pro natura principles. He criticizes the refusal to order the removal of brisanta grass, even though it is an improved grass, as stated by forestry engineer Rolando Rodríguez. That grass was introduced into the protection area (área de protección) of the stream and the spring (naciente), where riparian vegetation (vegetación ribereña), rather than grazing grass, should exist; it is therefore not natural to the area and must be removed, since leaving it in place would allow continued encroachment upon the protection area.

Likewise, the absence of cattle from those protection areas must be ordered, because allowing cattle to remain there would prevent regeneration; moreover, cattle produce feces and urine that may contaminate the water resource through runoff (escorrentía). He requests that the appeal be granted and a new judgment issued correctly applying the corresponding legal provisions. The defendant’s private counsel raised a first ground of appeal based on the improper application and interpretation of Article 140 of the Code of Criminal Procedure and the violation of the constitutional principles of reasonableness and proportionality, as well as due process of law. He argues that the provision underlying the restoration of things to their original state (restitución de las cosas a su estado original) was applied incorrectly because it applies to precautionary or provisional measures (medidas cautelares o provisionales), not to final or dispositive acts.

He states that the Constitutional Chamber’s decisions 2234-2011 of March 21, 2001, 3048-2001 of April 24, 2001, and 2230-06 are mandatorily applicable, rank above the Criminal Code, and consistently hold that Article 140 of the Code of Criminal Procedure may serve only as the basis for precautionary or provisional measures, not definitive or final ones. The violation of those constitutional decisions constitutes a violation of due process and an infringement of the right to justice, for which reason the ruling must be annulled. In a second ground of appeal, defense counsel alleges the improper application and interpretation of Article 142 of the Code of Criminal Procedure and a violation “of the principle of sound rational evaluation of evidence (sana crítica racional),” solely with respect to the order to restore things to their original state. He contends that the order to restore things to their original state disregards evidence of decisive value, rendering it ineffective.

In this case, it is clear that there is no proven fact whatsoever and, by virtue of the principle of congruence between what was proven and what was granted (principio de coincidencia entre lo probado y lo concedido), there is a logical inconsistency because no fact whatsoever was proven; accordingly, the aforementioned restoration should not have been ordered. He asserts that the alleged environmental damage in [Dirección2], in the province of Puntarenas, was never verified by any judicial authority because no such authority ever visited the property to inspect it in situ (in situm), in violation of the principles of commonality and immediacy of evidence (comunidad e inmediatez de la prueba). The numerous field reports and inspections were prepared without the defense being present or invited, and no topographic survey (levantamiento topográfico) was conducted to locate the springs on the property; therefore, there is no certainty whatsoever that those resources are located there, and ordering final physical acts is premature and unlawful.

He considers it serious that the road on a property devoted to cattle ranching should be ordered closed, because that prevents the activity from being carried out. If the closure of the road on a small cattle farm is allowed, what would prevent the closure of other farms, particularly during a pandemic? He reiterates that restoring things to their original state is unlawful because the judicial authority never determined what that original state was, and the statements of two MINAE officials cannot be followed blindly. He requests that the challenged judgment be modified solely with respect to the restoration of things to their original state, by revoking that portion of the operative provisions so that no physical actions are carried out on the property. Because they are closely related, the foregoing grounds are decided jointly and are granted: A review of the reasoning underlying the challenged judgment shows that the trial judge considered Article 140 of the Code of Criminal Procedure to be the provision authorizing the “restoration of things to their natural state,” overlooking the fact that this provision is intended solely as a provisional measure designed to protect the injured party’s rights as a precaution; consequently, the requirements for its application are not the same as those established by Article 103 of the Civil Code.

It is true that the judgment refers to the fundamental right to an ecologically balanced environment, established in Article 50 of the Political Constitution; however, if that were the basis for the measures adopted by the court below (a quo), they would need a legal basis supporting the decision, specifically, the performance of acts detrimental to the property rights of the company that owns the farm where the alleged environmental damage occurred, since a fundamental right such as property may be restricted to protect another fundamental right deemed to be of higher rank, such as environmental protection, only pursuant to the principle of statutory reservation (principio de reserva de ley). The principle of irreducibility of forest ecosystems (principio de irreductibilidad de los ecosistemas boscosos) is an obligation imposed by the legislature upon the State as a framework for action in response to conduct that causes environmental damage.

Thus, the State may not relinquish or abandon its efforts to restore land that formerly comprised forest ecosystems to that condition; however, this does not mean that, automatically, in an acquittal in which it was not possible to establish any person’s subjective or strict civil liability (responsabilidad civil subjetiva u objetiva), the judicial authority must order acts or omissions that necessarily require a technical assessment regarding the best course of action in such cases of environmental damage. In other words, when a judgment acquits specific persons accused of causing that environmental damage, the State is obligated to exercise its statutory administrative powers to comply with Article 45 of the Biodiversity Law, which provides: “The State has the obligation to prevent any risk or danger that threatens the continued existence of ecosystems. It must also prevent, mitigate, or restore environmental damage that threatens life or diminishes its quality,” because the criminal judge’s jurisdiction is limited to the civil reparation (reparación civil) established by Article 103 of the Criminal Code.

In a case such as this one, the judicial authority must clearly identify the provision granting it jurisdiction to order the demolition of buildings, removal of structures or roads, or other measures ordinarily ordered by the courts, when Article 99 of the Organic Environmental Law establishes a series of administrative sanctions (sanciones administrativas) that the Public Administration may impose, including those in subsections d), e), g), and h) of that provision, which provide for the possibility of restricting or ordering the immediate suspension of the acts that gave rise to the complaint; the total or partial, temporary or permanent closure of those activities; the imposition of obligations to compensate for or stabilize the environment or biological diversity; and the modification or demolition of structures or works that harm the environment, among others. In light of the foregoing, in a case such as this one, in which it was not possible to prove the alleged criminal offense, it must be examined why responsibility and jurisdiction for protecting and ensuring the restoration of forest ecosystems following that environmental damage lie with the judicial authority and not solely with the State Forestry Administration.

This Chamber, sitting in a partially different composition, has so held, stating: “If, in the present matter, what was attributed to the defendants was the alteration of the existing forest ecosystem by cutting down a significant number of trees in a protection area and forested area, but within land lawfully possessed by the defendants, it is not appropriate to speak of restitution, because there is no one to whom anything must be returned; rather, what is sought is the natural or induced regeneration of the ecosystem, not civil restitution in the strict sense. Because this is not a case of civil restitution, it is necessary to examine when measures aimed at reversing the environmental damage may be imposed. Such measures must necessarily be subject to statutory reservation, since they impose obligations to act or refrain from acting upon persons accused of damaging the environment, as well as upon the possessors and owners of the properties where such environmental harm occurred, including the obligation to refrain from exercising the various rights arising from ownership.

For that reason, various provisions of the legal system contemplate the possibility of demolishing works that affect the State’s natural heritage, as established by Article 13 of the Maritime-Terrestrial Zone Law, or Article 36 of the Ley Forestal, which authorizes eviction from properties subject to the forestry regime or devoted to forestry activity; Article 55 of the Soil Use and Conservation Law N° 7779, which expressly provides that the State may ‘take the appropriate measures to prevent damage to the soil or, insofar as possible, restore the prior condition when the damage has already occurred’; or the various environmental protection measures established in Article 99 of the Organic Environmental Law, including the demolition of structures or works that damage the environment (subsection h) and the imposition of obligations to compensate for or stabilize the environment or biological diversity (subsection g).

Nevertheless, those provisions establish an administrative procedure (procedimiento administrativo) that must be followed before any of those protective measures may be ordered, because the authorities of the Ministry of Environment and Energy are responsible for providing technical oversight in each case and recommending the most appropriate measures, while due process must be afforded to those who may be affected. In the present matter, there is no technical assessment specifying the measures that must be adopted, because there are no works to demolish, nor was the defendants’ criminal liability for the alleged conduct established such that they could be deemed responsible for fulfilling those environmental protection measures. It is therefore impossible in these proceedings to grant a claim such as that of the Office of the Attorney General of the Republic, which requests that the defendants, in their capacity as owners of the property, be ordered to refrain from any activity that would impede regeneration of the affected area.

In view of the foregoing, the majority of this Court finds that this ground of appeal against the judgment (motivo de apelación de sentencia) must be denied. However, to protect the fundamental right enshrined in Article 50 of the Political Constitution and the precautionary principle (principio precautorio) governing environmental matters, this judgment shall be communicated to the Área de Conservación Amistad Pacífico of the Ministerio del Ambiente y Energía so that it may monitor the area affected in this matter and, if necessary, order the appropriate protective measures (medidas protectoras)” (Voto 2018-101, issued at 10:47 on 28 de febrero de 2018, Judges Fernández Mora and Carranza Cambronero, with Judge Mena Artavia dissenting). That reasoning is fully applicable to the present case, in which, as stated, the responsibility of the accused (imputado) for the acts attributed to him in the criminal proceedings (proceso penal) could not be established; consequently, no civil liability (responsabilidad civil) on his part could be established either.

The trial court’s ruling on the merits (pronunciamiento de fondo del a quo) must therefore clearly set forth the legal and technical reasons supporting an order to restore the site to its natural condition (restitución de las cosas a su estado natural). Specifically, that reasoning should include an analysis of the legal provisions permitting such an order, as well as the appropriate technical analysis establishing the measures necessary to maintain the balance that existed before the environmental damage (daño ambiental). In this regard, the representative of the State is also correct in asserting that the judgment does not adequately explain why it was appropriate to order only the removal of the works that had been carried out, but not the artificial planting of grass for cattle grazing. Because the judgment lacks an adequate basis in this respect, the claims raised must be granted, the judgment must be declared partially ineffective (ineficacia parcial), and a remand trial (juicio de reenvío) must be held before a differently constituted panel of the same court for new proceedings, solely with respect to the restoration of the site to its natural condition.

VI.Partial dissenting opinion of Judge Fallas Redondo: I, the undersigned judge, disagree in several respects with the decision reached by those constituting the majority in this matter.

  • 1)With regard to the statute of limitations (prescripción) applicable to the criminal action (acción penal) (as set forth in argument A of Considerando II of this decision), I depart from the view of my fellow judges because, first, in my opinion, the commencement of criminal proceedings does not, by itself, have any effect interrupting the running of the limitation period. Section 31 of the Código Procesal Penal provides that, if proceedings have not commenced (that is, if no person has been identified as the possible perpetrator of a punishable act), the action becomes time-barred upon expiration of the periods established in that provision. Article 33 of the same code merely establishes which procedural acts interrupt the limitation period once a person has been designated as the accused (imputada). Nothing more. Neither of those provisions attributes any interruptive effect to the commencement of proceedings, that is, to the identification of someone as the possible perpetrator of a punishable act. Under these circumstances, it is not tenable to invoke grammatical interpretation (interpretación gramatical) to conclude that such commencement of proceedings interrupts the running of the limitation period. Likewise, I consider that the technique of strict interpretation (interpretación restrictiva) cannot properly be applied to those articles, because the limit of this type of statutory construction is precisely the statutory text, and neither provision attributes an interruptive effect to the commencement of proceedings. To grant it such an effect in disregard of Articles 31 and 33 of the Código Procesal Penal would alter the substance of those statutory provisions, which I consider to be a function of the Poder Legislativo. Accordingly, I dissent as to this issue, because I find that the criminal action is not time-barred.
  • 2)Regarding argument B of the same Considerando II, I wish to note that the statute-of-limitations defense may be waived (article 35 of the Código Procesal Penal), which means, in my view, that this is not one of the matters on which the Court may rule sua sponte (de oficio). Article 42 of the Código Procesal Penal shows that extinguishment of the criminal action (extinción de la acción penal) may be raised as a preliminary objection (excepción) in the proceedings. It is true that the Court is authorized to resolve “some of” the preliminary objections sua sponte. It should be noted that the law does not state that it may rule sua sponte on “the foregoing issues,” without qualification, but instead uses the expression “some of,” which differs from “all” or “any.” This means that the legislature did not establish that preliminary objections may be decided sua sponte with respect to any of them—or, in other words, that such a ruling is appropriate with respect to all of them—but rather that this type of sua sponte decision is permissible only in cases where action by a party is not required. From my perspective, however, the statute of limitations falls outside the circumstances in which a sua sponte ruling is permissible, precisely because it may be waived (which distinguishes it from other grounds for extinguishing the criminal action). Thus, in my view, the Court may declare the action time-barred only when the interested party to the proceedings (essentially the accused, although nothing would prevent the Ministerio Público from doing so in adherence to the principle of objectivity (principio de objetividad)) raises the corresponding preliminary objection; consequently, the Court may not declare it sua sponte. Regarding this last point, I wish to state that I am not presuming that the accused waived the statute-of-limitations defense. Rather, I am making a different point: due process (debido proceso) presupposes the impartiality of the adjudicatory body, and therefore the general rule is that it should not assume the role of the parties to the proceedings; from this follows the exception that it may act sua sponte only in narrowly defined cases established by law. Based on the foregoing, my view is that because the statute-of-limitations defense may be waived—which means that it is a right subject to the disposition of the interested party—it does not fall within the circumstances in which judicial bodies may act sua sponte and, for that reason, a ruling on it may be issued only when the interested party raises it. In accordance with the foregoing, although I agree with the view that, had the interested party raised the matter, the criminal action would have become time-barred for the reasons given by the majority of this Chamber, the fact remains that no such preliminary objection was ever raised; I therefore find that it may not be declared sua sponte.
  • 3)Furthermore, as a third point, in my view, restoration of conditions to those existing before the commission of a punishable act (restitución de las cosas al estado anterior) may be ordered even if the civil damages action (acción civil resarcitoria) is denied, because restoration does not depend upon that action. Although the heading of section 103 of the Código Penal refers to the “civil consequences” of an unlawful act, this merely indicates that they are noncriminal matters and does not mean that the stated restoration is equivalent to compensation in favor of a specific person. It should be noted that proof of environmental damage (daño ambiental) entails an obligation to restore conditions to their previous state (which differs from awarding compensation for pecuniary or nonpecuniary damage (daño patrimonial o moral)). It bears recalling that this distinction is reflected in article 361 of the Código Procesal Penal, under which a ruling on “restitution and costs” is addressed separately from the ruling that must be made, “when appropriate,” on “matters relating to compensation for loss and damage.” From the foregoing, I infer that, as with costs, a ruling on restitution (restitución)—a term used generally and therefore encompassing both the return of property and the restoration of conditions to those existing before the act—must be made sua sponte. Regarding restoration of conditions to their previous state when environmental damage has occurred, I consider that a sua sponte decision by the Court hearing the matter is indeed appropriate. In environmental matters, the right to a healthy environment (derecho a un ambiente sano) is enshrined in the Constitución Política (article 50), which provides that everyone has an obligation to preserve it and that the State has a duty to guarantee such preservation. Nor may it be overlooked that private property, although constitutionally guaranteed, must also be subject to limitations in the public interest (article 45). It follows that owners of private properties, whether legal entities or natural persons, must also bear the obligation to respect forests and springs (nacientes), among other things, located on those properties. Furthermore, when environmental damage occurs, the person who causes it has an obligation to remedy it, including by restoring conditions to those existing before the damage occurred. That duty to remedy exists even in the absence of intent or fault (dolo o culpa) (that is, this is a strict-liability regime (régimen de responsabilidad objetiva)). This position is supported by sections 2, 98, and 101 of the Ley Orgánica del Ambiente, section 52 of the Ley de Uso, Manejo y Conservación de Suelos, and section 8 of the Ley de Biodiversidad. Accordingly, if evidence establishes a causal link (nexo de causalidad) between any human activity and the damage, the person engaging in that activity must undertake remediation of the damage (in this case, by restoring conditions to their previous state). Therefore, determination of the duty to restore does not depend on either proof of a criminal offense or the viability of a civil damages action.

POR TANTO

The appeal filed by the representative of the Ministerio Público is denied, as are the first and second grounds of the appeal filed by the Procuraduría General de la República. The criminal action is sua sponte declared extinguished by operation of the statute of limitations, and the acquittal of the accused on the charges brought against him in these proceedings is affirmed. Judge Fernández Mora files a separate note. The appeal filed by counsel for the civil defendant is granted, as is the third ground of challenge filed by the representative of the Procuraduría General de la República; the judgment is declared partially ineffective, and a remand trial (juicio de reenvío) is ordered solely to address the restoration of conditions to their natural state as ordered in the judgment. Recurso de apelación de sentencia penal interpuesto en la presente causa seguida contra [Nombre1] , mayor, nacido el cinco de abril de mil novecientos cincuenta y tres, con cédula de identidad número CED1 - - , por el delito de Invasión Área de Protección, en perjuicio de Los Recursos Naturales. Intervienen en la decisión del recurso los jueces Christian Fernández Mora y David Fallas Redondo, así como, la jueza Ivette Carranza Cambronero. Se apersonaron en apelación [Nombre2] , en calidad de defensor particular del imputado; Ivannia Li Zúñiga, en representación del Ministerio Público; y José Humberto Fernández González, en representación de la Procuraduría General de la República.

Resultando:

1. Que mediante sentencia número 62-2021 de las dieciséis horas diez minutos del cinco de febrero de dos mil veintiuno, el Tribunal del Primer Circuito Judicial de la Zona Sur, Sede Buenos Aires, resolvió: "POR TANTO: De conformidad con lo expuesto, normas citadas, artículos 39 y 41 de la Constitución Política; 1, 11, 30, 45, 367 del Código Penal, y numerales 1, 2, 6, 8, 9, 111 a 124, 142, 265 a 270, 341 a 366 del Código Procesal Penal; artículo 58 inciso A de la Ley Forestal; 73.2 del Código Procesal Civil, este Tribunal resuelve absolver de toda pena y responsabilidad al imputado [Nombre1] , en cuanto a un delito de Invasión a Área de Protección, que le venía atribuyendo el Ministerio Público y la Procuraduría General en la República en calidad de Querellante, en perjuicio de Los Recursos Naturales. Se ordena el levantamiento de toda medida cautelar que se haya dictado en contra de la aquí imputada en la presente causa.

Se declara sin lugar la Acción Civil Resarcitoria interpuesta por la Procuraduría General de la República, en contra del demandada civil [Nombre1] . Se resuelve sin especial condena en costas en cuanto a la Acción Civil Resarcitoria. Son los gastos del proceso a cargo del Estado. Asimismo, se ordena al Ministerio de Ambiente y Energía, SINAC, realizar la inspección y rendir el informe a fin de constatar el cumplimento de lo ordenado en la presente sentencia. Notifíquese mediante lectura. José Antonio Campos Vargas. Juez de Juicio ai." 2. Que contra el anterior pronunciamiento, los licenciados Ricardo Ananías Loaiza Morales y José Humberto Fernández González, así como, la licenciada Ivannia Li Zúñiga, interpusieron los recursos de apelación.

3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal, reformado por Ley 8837 publicada el nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), el Tribunal se planteó las cuestiones formuladas en el recurso.

4. Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el Juez Fernández Mora, y;

Considerando:

I.Admisibilidad de los recursos: Por cumplir con los requisitos legales, se admite para su estudio de fondo el recurso incoado por Ivannia Li Zúñiga, en su condición de representante del Ministerio Público; José Humberto Fernández González, como representante del Estado y Ricardo Ananías Loaiza Morales, en su condición de defensor particular del imputado. El estudio del sumario permite establecer que los mencionados recursos fueron presentados dentro del plazo de ley, y de acuerdo a los presupuestos que se requieren para el adecuado y correcto conocimiento de las inconformidades planteadas por los recurrentes.

II.La representante del Ministerio Público, planteo un primer motivo de impugnación en el que alega la errónea valoración de la prueba y falta de fundamentación probatoria intelectiva. Considera que los elementos probatorios no fueron analizados de forma adecuada, pues se realizó una fundamentación sumamente escueta sobre la prueba testimonial, por cuanto indicó en unas cuantas líneas que los testigos [Nombre3] y [Nombre4] indicaron que el encartado [Nombre1] “hacía señales adelante con las manos” y que, específicamente, el testigo [Nombre4] declaró que con ese tipo de movimientos se infería que el encartado giraba instrucciones, aunque por el ruido de la maquinaria pesada, no podían establecer cuáles eran esas instrucciones. Sostiene que se valoró de manera sesgada la declaración de los testigos porque lo referido por estos no constituye un indicio anfibológico, como lo indicó el juzgador, pues no habían más personas en el lugar y las acciones que realizó [Nombre1] iban, única y exclusivamente, dirigidas al operario para hacer la trocha.

En el segundo motivo de impugnación, la recurrente alega que la sentencia aplicó erróneamente la ley sustantiva porque el juzgador argumentó que el imputado no actuó como autor mediato del hecho y no fue posible establecer que el imputado tuviera codominio funcional del hecho, debido a que su acción final no conllevó el conducir la maquinaria pesada y no tendría ese dominio de la voluntad, respecto al operador del tractor de oruga, a quien nunca se le investigó sobre su verdadera identidad y quién realizaba la acción final de invadir un área de protección. Para la recurrente, existen contradicciones en los argumentos de la sentencia, porque se refiere que existe prueba documental que establece que el imputado [Nombre1] no contaba con permisos de la Administración Forestal del Estado, que el área de protección correspondía a una naciente, pero que no se acreditó el dominio funcional del imputado en los hechos, pese a que sí se estableció dicha circunstancia con la prueba testimonial.

Solicita que se anule la sentencia y se ordene el reenvío al tribunal sentenciador para nueva realización del debate. En un primer motivo de apelación, el representante de la Procuraduría General de la República reclama la indebida fundamentación de la sentencia por violación a las reglas de la sana crítica. Considera que se demostró en el contradictorio que el delito de invasión a la zona de protección se dio al construir un camino de acceso desde la entrada de la propiedad hasta el fondo del inmueble donde se encuentra un corral y que también se encuentra invadiendo la zona de protección de una naciente permanente; que además se encuentran varias alcantarillas y un pozo elaborado con cemento, así como zacate brisanta mejorado y ganado en la propiedad. Considera que no es cierto que no se tuviera por probado ningún hecho, pue se probó la invasión de un área de protección de la naciente y de la quebrada.

De lo contrario, sería irrazonable que se ordenara la restitución al estado anterior a los hechos. Sostiene que la discusión corresponde a si las órdenes que daba el imputado al conductor de la maquinaria eran verbales para configurar el delito, pues giraba órdenes con signos y gesticulaciones con las manos para direccionar la construcción de la obra. Indica que la modificación de la forma como se externaron esas órdenes es intrascendente, porque las órdenes gestuales resultaba la forma adecuada para comunicarse, tomando en cuenta el ruido exterior que producía el motor del tractor, lo que imposibilitaba la comunicación verbal. Solicita que se revoque la sentencia y se reenvíe el asunto para nueva sustanciación. Por la forma en que se resuelve, dichos motivos se conocen conjuntamente y, de manera oficiosa, se declaran sin lugar por haberse extinguido la acción penal por prescripción, de conformidad con las siguientes razones: A) De la revisión integral del asunto, se puede apreciar que los hechos que han sido objeto de este proceso datan del día 26 de diciembre de 2012, cuando se atribuye que el imputado [Nombre1] en codominio funcional del hecho con el operador de maquinaria pesada, quien no pudo ser individualizado en la investigación, giró instrucciones verbales para que se invadiera la zona de protección de una naciente permanente y de una quebrada estacional, para lo cual se realizaron movimientos de tierra dentro de las mencionadas áreas de protección, construyendo una trocha que se utiliza para el pastoreo de ganado y alcantarillas para drenar el espejo de agua.

Ese mismo día, los oficiales del Ministerio del Ambiente y Energía realizaron las diligencias de investigación pertinentes, pues realizaron el informe respectivo, decomisaron la maquinaria utilizada e individualizaron al imputado [Nombre1] , iniciando así el proceso por el delito de invasión a una zona de protección en contra de dicho justiciable. Si bien es cierto, quienes suscriben este voto de mayoría, entienden que el mencionado delito constituye un delito de carácter permanente, porque mientras se mantenga el estado invasivo sobre la zona de protección, existe un estado consumativo que se prolonga en el tiempo, debe entenderse, de acuerdo con el principio de legalidad que el plazo de prescripción empezó a correr con el inicio del procedimiento, pues así lo dispone el artículo 33 del Código Procesal Penal, cuando señala: “Iniciado el procedimiento, los plazos establecidos en el artículo trasanterior se reducirán a la mitad para computarlos, a efecto de suspender o interrumpir la prescripción”.

En otras palabras, el legislador ha distinguido dos supuestos para el cómputo de la prescripción: a) cuando no se ha iniciado el procedimiento, en cuyo caso el término de la prescripción corre completo, según lo dispone el artículo 31 del Código Procesal Penal y; b) cuando el procedimiento ya dio inicio, en cuyo caso, el cómputo debe reducirse a la mitad para efectos de tenerlo en cuenta cada vez que deba registrarse una causal de suspensión o interrupción de la prescripción, pues de otra forma, no tendría sentido el que el legislador haya establecido la frase “iniciado el procedimiento”, porque las causales de interrupción y suspensión de la prescripción solo ocurren cuando el procedimiento ya ha iniciado. (Al respecto ver posición similar de esta misma integración colegiada en el voto número 2020-443 de las 10:30 horas del 31 de julio de 2020). Para esta integración colegiada, no podría aceptarse la tesis de que en los delitos permanentes el plazo de prescripción no inicie, sino hasta que cese su permanencia como lo dispone el artículo 32 del Código Procesal Penal, porque eso implicaría que este tipo de delitos resulte imprescriptible, pues en un caso como el que nos ocupa, ello implicaría que ninguna de las causales de interrupción o suspensión de la prescripción hayan operado en este caso, porque para estimar que eso ocurra tendría que haber iniciado el cómputo del plazo de prescripción y eso no se daría hasta que hayan concluido los actos invasivos que mantienen la permanencia del resultado delictivo.

Incluso, podría llegarse al absurdo de que el imputado resulte condenado, haya descontado la pena que se le imponga y todavía el plazo de prescripción no haya iniciado, solo porque los actos de ocupación continúen presentándose en la zona de protección que se acusa como invadida. Es por ello que esta Cámara considera que lo dispuesto por los artículos 31 y 32 del Código Procesal Penal hace alusión al cómputo del plazo de prescripción para aquellos asuntos en los que no ha iniciado el procedimiento, pues cuando este ha iniciado, resulta lógico que la regulación sea distinta y se aplique lo dispuesto por el artículo 33 del Código Procesal Penal, puesto que el aparato represivo del Estado ha sido prevenido sobre la existencia de delito y tiene a su alcance todos los mecanismos legales para impedir la consumación y el agotamiento del delito, tal como establece el artículo 67 del Código Procesal Penal, en cuanto a la función de la policía judicial, quien actúa bajo la dirección funcional del Ministerio Público; además de las regulaciones específicas que brindan las diferentes leyes a la Administración Forestal del Estado para evitar que continúen los actos que perjudiquen el medio ambiente (Ley Orgánica del Ambiente, Ley Forestal, Ley de Biodiversidad, entre otras).

Aclarado lo anterior, debe estimarse que, al haber iniciado el cómputo de la prescripción desde el mismo día en que se dieron los hechos acusados por el Ministerio Público, el cómputo de la prescripción empezó a correr a partir de ese momento, reducido a la mitad por disposición expresa del legislador. Debido a que el delito delito de invasión a un área de protección, según el artículo 58 inciso a) de la Ley Forestal, tiene una pena máxima de tres años de prisión, al reducirse el cómputo de la prescripción a la mitad con el inicio del procedimiento, el plazo para que se extinguiera la acción penal era de dieciocho meses (artículo 31 inciso a) en relación con el 33 del Código Procesal Penal). De acuerdo con lo anterior, para la mayoría de esta Cámara, los hechos juzgados en el presente proceso habían prescrito antes del momento en que al justiciable se le recibió la primera imputación formal de los hechos, pues su declaración indagatoria acaeció el día 03 de julio de 2014, cuando habían transcurrido más de dieciocho meses desde que inició el procedimiento, por lo que la prescripción habría ocurrido el día 26 de junio de 2014.

Cabe señalar que, en este asunto, la mayoría de esta Cámara ha interpretado que, al ser la prescripción una sanción procesal establecida por la ley para la inactividad del Estado, constituye un presupuesto para que la acción penal pueda ser ejercida legalmente y según lo dispuesto por el inciso c) del artículo 178 del Código Procesal Penal, constituye un vicio de carácter absoluto, declarable de manera oficiosa por esta Cámara, al encontrarse relacionado con la iniciativa del Ministerio Público en el ejercicio de la acción penal y su participación en el procedimiento. En virtud de lo anterior, procede declarar sin lugar el recurso incoado por la representación fiscal y decretar oficiosamente la extinción de la acción penal por prescripción, manteniendo la absolutoria dictada en favor del imputado [Nombre1] por los hechos que se le han atribuido en este proceso. B) Aún en el supuesto de que no se compartiera la interpretación que tiene la mayoría de esta Cámara sobre los efectos del inicio del procedimiento sobre el cómputo de la prescripción como reductor automático del plazo a la mitad, el estudio del expediente permite establecer que el plazo fatal de la prescripción sobrevino durante la etapa intermedia, que en este proceso se extendió por casi cinco años, según se verá.

Cabe señalar que en ambas posiciones, se parte de que, incluso en los delitos permanentes, el legislador no ha señalado en norma alguna que el cómputo de la prescripción no inicie cuando ya se ha iniciado el proceso, pues como se dijo en el punto anterior, ello llevaría al absurdo de que dichas causas resulten imprescriptibles, pese a que operen distintas causales expresamente señaladas por la ley como interruptoras de la prescripción. Así, la sentencia aquí impugnada no habría interrumpido la prescripción en este caso porque aún no se ha hecho efectiva la restitución de las cosas a su estado original que se ordenó por parte del a quo, lo cual no solo sería contrario a una disposición expresa de la ley, sino que resultaría en un sinsentido. Como se dijo, los hechos acusados datan del 26 de diciembre de 2012 y al imputado se le recibió declaración indagatoria el 3 de julio de 2014 (folio 59 de el expediente principal).

La primera convocatoria para audiencia preliminar ocurrió el 03 de agosto de 2015 (folio 113), pero dicha diligencia no se pudo realizar por diferentes motivos que constan en cada ocasión, por lo que debió convocarse nuevamente para realizar dicha diligencia el 10 de setiembre de 2015 (folio 119); 12 de enero de 2016 (folio 165, en donde por error se indica que es 12 de enero de 2015); 23 de febrero de 2016 (folio 177) y 06 de abril de 2016 (folio 183). Entre cada uno de esos actos interruptores de la prescripción, establecidos por el artículo 33 inciso c) del Código Procesal Penal, nunca se superó el plazo fatal de dieciocho meses para que ocurriera la prescripción. Sin embargo, la diligencia tampoco se realizó en la última oportunidad para la que se convocó a las partes, sino que, debido a una gestión realizada por el representante del Ministerio Público en fecha 06 de junio de 2018 (folio 194), se señaló nuevamente para audiencia preliminar el día 04 de julio de 2018, oportunidad para la que habían transcurrido más de dieciocho meses desde el último señalamiento para audiencia preliminar, con lo que la acción penal para perseguir al imputado [Nombre1] por los hechos aquí investigados se había extinguido desde el 06 de octubre de 2017.

De acuerdo con lo anterior, los siguientes señalamientos para audiencia preliminar y los realizados para la realización del debate oral que dio origen a la sentencia impugnada, no consiguieron interrumpir la prescripción de la acción penal, pues ese plazo ya había acaecido mucho antes de que se dictaran dichos actos interruptores de la prescripción. Constatada dicha situación, resulta inocuo cualquier yerro que pudiera haber existido en la resolución impugnada, toda vez que el plazo establecido por el legisladora para que se ejerciera la acción penal había transcurrido sobradamente, por lo que la decisión absolutoria a la que arribó el a quo debe mantenerse incólume. El juez Fallas Redondo salva parcialmente su voto sobre este aspecto.

III.El representante de la Procuraduría General de la República, planteó un segundo motivo por error in procedendo: contradictoria e insuficiente fundamentación de la sentencia en cuanto a la acción civil resarcitoria. Acusa que no se analizó la posible responsabilidad objetiva del imputado, sino que se afirmó que se rechazaba por cuanto no se pudo determinar, con la certeza requerida, la culpabilidad del imputado, cuando no basta aseverar que la absolución penal produce la absolución civil sin motiva convincentemente dicha decisión. Sostiene que el tribunal realiza aseveraciones que constituyen afirmaciones dogmáticas, de las cuales no es posible deducir las razones por las que se ha rechazado la acción civil resarcitoria. La sentencia recurrida no explica por qué se declaró sin lugar la acción civil resarcitoria, cuando el delito quedó demostrado, según la prueba evacuada, tanto es así que se ordenó la restitución de las cosas a su estado anterior, porque está causando un daño ambiental que fue cuantificado.

El motivo se declara sin lugar: En la sentencia recurrida se explica con suficiencia que la representación estatal únicamente atribuyó al demandado civil únicamente responsabilidad civil de tipo subjetiva, derivada de la comisión de un acto ilícito, razón por la que debía acreditarse al menos el injusto penal, como hecho generador del daño reclamado. De esa forma, resulta inadmisible la pretensión del recurrente para que se analizara en la sentencia la posibilidad de una responsabilidad objetiva del demandado civil, puesto que, de conformidad con el principio de congruencia entre demanda y sentencia, contemplado por el artículo 61.2 del Código Procesal Civil, al no haberse atribuido ese tipo de responsabilidad a la parte demandada, nunca se hubiese podido condenar por ello. No encuentra esta Cámara que existan aseveraciones dogmáticas sin contenido, o que no se haya explicado con suficiencia la razón de la absolutoria civil, pues de manera clara se indicó: “En el presente caso pese a que se acreditó un daño ambiental no es posible establecer el nexo causal que permitiese atribuirle responsabilidad civil al aquí́ demandado [Nombre1] .

Esto es así toda vez que, no se acreditó la responsabilidad penal del aquí́ demandado en estos hechos ni que este realiza las obras de remoción de tierra e invasión del área protegida tipo naciente por "encargo de las obras" tal cual se le venia atribuyendo. Como se viene indicando, pese a lo declarado por el testigo perito [Nombre4] así como también lo descrito analizado en el Informe de valoración Económica de Daño Ambiental, no es posible establecer un vínculo obligaciones que permita inferir responsabilidad indemnizatoria en el presente caso. Lo anterior porque, en esencia, se debe valorar cuál es la atribución de responsabilidad civil que relaciona al demandado civiles con la demanda incoada por el Estado, siendo que en la especie, la Procuradora no fue concretó específicamente la forma de atribución de la responsabilidad civil que peticionó o logró demostrar en el debate, por ende, realizando un análisis de la demanda civil y de los alegatos expuesto en sus conclusiones, se extrae que el criterio utilizado por la representación estatal es la atribución de responsabilidad civil subjetiva, considerando que el daño que se pretende ser compensado, fue producto de una conducta delictiva dolosa, por lo que se debe acreditar el injusto penal o civil, para así, estar presente en la legitimación pasiva del demandados civil”.

El hecho de que se indique que existió un daño ambiental y se debiera ordenar la restitución de las cosas a su estado natural no es sinónimo de que haya podido atribuírsele al demandado civil dicho daño, pues para ello resultaba indispensable poder acreditar un nexo causal entre la conducta atribuida y el daño ambiental referido, pues así lo estableció la accionante en su demanda civil y nunca estableció que dicho daño ambiental fuese producto de algún tipo de responsabilidad objetiva establecida por la ley, razón por la que no era posible acoger la acción civil resarcitoria incoada por la Procuraduría General de la República. En razón de lo expuesto, se declara sin lugar el presente motivo de impugnación. El juez Fernández Mora, pone nota.

IV.Nota del juez Fernández Mora: Respecto del tema de la acción civil resarcitoria, debo señalar que, al igual que lo he venido haciendo en reiteradas oportunidades, en mi criterio, la prescripción de la acción penal conlleva la de la acción penal, aún cuando la jurisprudencia de la Sala Tercera haya señalado lo contrario, pues así lo dispone una norma vigente del ordenamiento jurídico, como lo es el artículo 871 del Código Civil. Las argumentaciones de la Sala de Casación para afirmar que el artículo 96 del Código Penal derogó tácitamente al artículo 871 del Código Civil soslayan circunstancias cuya consideración resulta imprescindible a la luz de las reglas para la aplicación de la derogatoria tácita de una norma, como lo es el criterio de lex posterior. En ese sentido, Josep Aguiló señala que: "No toda incoherencia normativa da lugar a una derogatoria por incompatibilidad. Sólo hay derogación cuando la ordenación de las normas conflictivas se realiza aplicando el criterio de lex posterior.

De la aplicación de los criterios de lex specialis y de lex superior no se sigue derogación alguna" (Aguiló, Josep. La derogación en pocas palabras. Anuario de Filosofía del Derecho XI, 1994, pág. 412). Desde la anterior perspectiva, no podría interpretarse que el artículo 871 del Código Civil se encuentre derogado tácitamente porque en 1970 se promulgó el Código Penal, que contenía el referido artículo 96, porque mediante una ley posterior, el legislador decidió restituir los efectos del artículo 871 del Código Civil. Esta disposición legal posterior no es otra que la Ley N°4981 del 8 de noviembre de 1971, en donde se restablece la vigencia del Título IV, Libro I del Código Penal de 1941, que en su artículo 138 dispone: "Las obligaciones concernientes a la reparación civil, tratadas en este capítulo, se extinguen por los medios y en la forma que determina el Código Civil, para las obligaciones civiles", lo que necesariamente hace referencia a la forma de extinción de la acción civil (prescripción) procedente de delito que estipula el artículo 871 del Código Civil.

Sobre el particular, debe tenerse presente que la derogatoria tácita por incompatibilidad normativa no tiene la virtud de eliminar una norma del ordenamiento jurídico, sino que solo la vuelve inaplicable por la mencionada incompatibilidad, pero se trata de una norma que mantiene plena vigencia. Por lo anterior, aun en el supuesto de que fuese cierta la interpretación de la Sala de Casación, respecto de que existió una derogación tácita por incompatibilidad de normas del artículo 871 del Código Civil al promulgarse el artículo 96 del Código Penal, dicha norma no habría perdido vigencia alguna, sino que fue incompatible únicamente por un espacio de poco más de un año (del 4 de mayo de 1970 al 18 de noviembre de 1971), ya que, de forma posterior, el mismo legislador decidió restituir en todos sus efectos mediante un nuevo acto de promulgación legislativa. Sobre el particular, debe indicarse que la Sala Constitucional de la Corte Suprema de Justicia, ante una consulta judicial de la Sala de Casación Penal que cuestionaba lo dispuesto por el artículo 871 del Código Civil, indicó: "Pero cualquiera que sea el término de la prescripción que establezca la ley, en el caso de las conductas delictivas lo lógico es que las acciones civiles de ellas derivadas, por ser meramente privadas y, por ende, secundarias en relación con el interés público principal inmerso en la acción penal, corran la misma suerte que ésta en lo que a la prescripción se refiere.

Lo contrario implicaría que el hecho penal pueda ser invocado y probado judicialmente en sede civil, con miras al resarcimiento de los daños y perjuicios, aun cuando la pena no pueda ser impuesta por encontrarse prescrita la acción penal, lo que resulta ilógico" (Sala Constitucional de la Corte Suprema de Justicia, voto N° 1993-5029 de las 14:36 del 13/10/1993) (El resaltado es suplido). En otras palabras, al tratarse el artículo 871 del Código Civil de una norma vigente, eficaz y que tampoco tiene roces de constitucionalidad, debe ser aplicada por el juzgador de forma efectiva. Para este juzgador, resulta claro que existe una excepción al principio general de la prescripción decenal para accionar un reclamo en la vía civil. Es precisamente la ley la que establece que, en el caso de la responsabilidad derivada de un delito, la acción civil debe prescribir junto con la acción penal. En lo particular, considero que interpretar que el artículo 871 del Código Civil se encuentra derogado tácitamente, responde a la determinación de brindar una tutela para la víctima más allá de la que el propio legislador decidió otorgarle expresamente, para lo cual la Sala de Casación Penal ha echado mano de argumentos jurídicos que, aunque técnicamente correctos, resultan forzados para el supuesto de análisis.

En virtud de lo anterior, consideró que además de que el recurrente nunca imputó al demandado civil otra responsabilidad distinta de la subjetiva, en todo caso, la discusión sobre dicha responsabilidad carece de interés al haberse dado tanto la prescripción de la acción penal, como la de la acción civil, por lo que la sentencia impugnada debe confirmarse al respecto.

V.En un tercer motivo de impugnación, el representante del Estado acusa la contradictoria e insuficiente fundamentación de la sentencia en cuanto a la restitución de las cosas a su estado natural, en violación a la ley sustancial. Considera que la sentencia violenta el artículo 140 del Código Procesal Penal, la Ley Forestal, el Derecho Ambiental y sus principios pro natura. Fustiga que se haya rechazado ordenar la eliminación del zacate brisanta, pese a que es un zacate mejorado, tal como lo indicó el ingeniero forestal Rolando Rodríguez. Dicho zacate se introdujo al área de protección de la quebrada y de la naciente, pues ahí debe existir una vegetación de tipo ribereña y no zacate para pastoreo, por lo que no es natural al área y debe ser retirado; dejarlo en el lugar permitiría que se siga invadiendo la zona de protección. De igual manera, debe ordenarse la no presencia de ganado en dichas zonas de protección, porque dejar ganado en dicha zona no permitiría su regeneración; además, el ganado produce excretas y orina, que por escorrentía pueden contaminar el recurso hídrico.

Solicita que se declare con lugar el recurso y se dicte un nuevo fallo, aplicando correctamente las normas jurídicas correspondientes. El defensor particular del imputado planteó un primer motivo de impugnación por indebida aplicación e interpretación del artículo 140 del Código Procesal Penal; quebranto del principio de razonabilidad y proporcionalidad constitucional, así como del debido proceso legal. Sostiene que la norma sobre la cual se funda la restitución de las cosas a su estado original se aplica erróneamente, porque dicha norma es propia de medidas cautelares o provisionales, no de aplicación para actos finales o dispositivos. Refiere que la resoluciones de la Sala Constitucional 2234-2011 del 21 de marzo de 2001, 3048-2001 del 24 de abril de 2001 y 2230-06, resultan de aplicación obligatoria y con rango superior al Código Penal, son contestes en señalar que el artículo 140 del Código Procesal Penal únicamente puede fundar medidas cautelares o provisionales, no definitivas o finales.

El quebranto de los mencionados fallos constitucionales representa una violación al debido proceso y un quebranto al derecho de la justicia, razón por la que la resolución debe ser anulada. En un segundo motivo de impugnación, la defensa del justiciable acusa la indebida aplicación e interpretación del artículo 142 del Código Procesal Penal; quebranto “al principio de la sana crítica racional”, únicamente en relación con la orden de restituir las cosas a su estado original. Considera que la orden de restituir las cosas a su estado original inobserva elementos probatorios de valor decisivo, tornándola ineficaz. En este caso, es claro que no existe hecho demostrado alguno, y en virtud del principio de coincidencia entre lo probado y lo concedido, existe una incongruencia lógica, porque no existe hecho probado alguno, razón por la que no procedía ordenar la restitución mencionada. Afirma que los supuestos daños ambientales de la [Dirección2] de la provincia de Puntarenas, nunca fueron constatados por autoridad judicial alguna, porque nunca se hizo presente al terreno para comprobarlos in situm, violentando el principio de comunidad e inmediatez de la prueba.

Los múltiples informes de campo e inspecciones, se realizaron sin presencia ni invitación de la defensa, tampoco se realizó levantamiento topográfico para ubicar las nacientes en la propiedad, de forma tal que, no existe certeza alguna de que esos recursos se encuentren allí, y resulta prematuro e ilegal ordenar actos materiales finales. Considera grave que se ordene cerrar el camino en una propiedad de vocación ganadera, porque eso impide el desarrollo de la actividad. Si se impide el cierre del camino en una pequeña finca ganadera, qué impide que se cierren las demás fincas, máxime en época de pandemia. Reitera que es ilegal la restauración de las cosas a su estado original, pues nunca se determinó por parte de la autoridad judicial cuál fue ese estado original y no se puede seguir a ciegas lo que dos funcionarios del MINAE han dicho. Solicita que se modifique la sentencia impugnada, únicamente en relación con la restitución de las cosas a su estado original, ordenándose la revocatoria de esa parte dispositiva para que no se realicen las acciones materiales sobre la finca.

Por su estrecha vinculación, los anteriores motivos se resuelven de manera conjunta y se declaran con lugar: De la revisión del fundamento intelectivo del fallo recurrido, se aprecia que el juzgador de mérito estimó que la norma que le permitía la “restitución de las cosas a su estado natural” era la dispuesta por el artículo 140 del Código Procesal Penal, dejando de lado que dicha norma se encuentra prevista únicamente como una medida provisional tendiente a tutelar precautoriamente los derechos del ofendido, por lo que los presupuestos para su aplicación no son los mismos establecidos por el artículo 103 del Código Civil. Es cierto que en la sentencia se hace alusión al derecho fundamental de contar con un ambiente ecológicamente equilibrado, previsto por el artículo 50 de la Constitución Política, pero si ese fuera el fundamento de las disposiciones tomadas por el a quo, deberían encontrar un fundamento legal que diera soporte a la decisión; en específico, el realizar actos en detrimento del derecho de propiedad de la empresa dueña de la finca donde se produjo el daño ambiental acusado, pues únicamente mediante el principio de reserva de ley podría afectarse un derecho fundamental como el de propiedad, para proteger otro derecho fundamental considerado de mayor rango, como lo es la protección del ambiente.

El principio de irreductibilidad de los ecosistemas boscosos corresponde a una obligación que el legislador le ha impuesto al Estado, como forma de actuación frente a los comportamientos que impliquen un daño al medio ambiente. Es así que el Estado no podría renunciar o claudicar en su accionar para que los terrenos que constituían ecosistemas boscosos vuelvan a serlo, pero no significa que, de manera automática, en una sentencia absolutoria, en la que no fue posible establecer ningún tipo de responsabilidad civil subjetiva u objetiva de alguna persona, deba la autoridad jurisdiccional ordenar acciones u omisiones que necesariamente conllevan un criterio técnico, respecto de cuál es la mejor manera de proceder en tales casos de daño ambiental. En otras palabras, cuando exista una sentencia absolutoria contra determinadas personas acusadas de ese daño ambiental, el Estado tendrá la obligación de poner en marcha las potestades legales administrativas para cumplir con lo dispuesto por el artículo 45 de la Ley de Biodiversidad que establece que: “El estado tiene la obligación de evitar cualquier riesgo o peligro que amenace la permanencia de los ecosistemas.

También deberá prevenir, mitigar o restaurar los daños ambientales que amenacen la vida o deterioren su calidad”, pues el juez penal tiene limitadas sus competencias a la reparación civil establecida por el artículo 103 del Código Penal. En un caso como el presente, al autoridad jurisdiccional debe dejar clara cuál es la norma que le brinda competencia para ordenar derribos de edificaciones, remoción de estructuras, caminos u otras disposiciones que habitualmente ordenan los tribunales de justicia, cuando el artículo 99 de la Ley Orgánica del Ambiente establece una serie de sanciones administrativas que puede realizar la Administración Pública, entre las que se encuentran los incisos d), e) g) y h) de dicha norma en donde se estatuye la posibilidad de restringir u ordenar la paralización inmediata de los actos que originaron la denuncia; la clausura total o parcial, temporal o definitiva de dichos actos; la imposición de obligaciones compensatorias o estabilizadoras del ambiente o la diversidad biológica; y la modificación o demolición de construcciones u obras que dañen el ambiente, entre otras.

De acuerdo con lo anterior, debe analizarse en un caso como el presente, en el que no fue posible demostrar el hecho punible atribuido, por qué la responsabilidad y competencia para proteger y tutelar la restauración de los ecosistemas boscosos por ese daño ambiental es del órgano jurisdiccional y no solo de la Administración Forestal del Estado. Así lo ha resuelto esta Cámara en una integración parcialmente distinta, al señalar: “Si en el presente asunto, lo que se le atribuyó a los encartados fue el haber alterado el ecosistema forestal existente al haber talado una importante cantidad de árboles en zona de protección y boscosa, pero dentro de un terreno que legítimamente es poseído por los encartados, no resulta acertado hablar de una restitución, puesto que no hay a nadie a quien devolverle nada, sino que lo que se pretende es conseguir la regeneración natural o inducida del ecosistema, pero no una restitución civil propiamente dicha.

Al no encontrarnos ante un supuesto de restitución civil, cabe analizar cuando es posible sostener que procede establecer medidas tendientes a revertir el daño ambiental producido, lo cual necesariamente debe ser objeto de reserva legal, puesto que dichas medidas implican obligaciones de hacer o de no hacer para los derechos de las personas acusadas de dañar el medio ambiente, pero también para los poseedores y propietarios de los fundos en los que se haya cometido dichos perjuicios ambientales, como lo es la obligación de no ejercer los distintos derechos derivados del dominio. Es por eso que, distintas normas del ordenamiento jurídico contemplan la posibilidad de que se realicen derribos de obras que afecten el patrimonio natural del Estado, como lo estable el artículo 13 de la Ley de la Zona Marítimo Terrestre, o el artículo 36 de la Ley Forestal, que autoriza el desalojo de inmuebles sometidos a régimen forestal o dedicados a la actividad forestal, el artículo 55 de la Ley de uso y conservación del suelos N° 7779, que expresamente dispone que el Estado puede “tomar las medidas pertinentes a fin de evitar daños al suelo o restablecer, en lo posible, la situación anterior, cuando el daño ya se haya producido”, o las diferentes medidas protectoras del ambiente que establece el artículo 99 de la Ley Orgánica del Ambiente, entre las que se incluyen la demolición de construcciones u obras que dañen el ambiente (inciso h) y la imposición de obligaciones compensatorias o estabilizadoras del ambiente o la diversidad biológica (inciso g).

No obstante, en dichas normas se establece un procedimiento administrativo que debe ser cumplido antes de poder disponerse alguna de dichas medidas protectoras, pues son las autoridades del Ministerio del Ambiente y Energía las encargadas de supervisar técnicamente cada caso y recomendar cuáles son las medidas más adecuadas, a lo que debe concederse el debido proceso a los posibles afectados. En el presente asunto, no se cuenta con un criterio técnico que señale cuáles son las medidas que deben adoptarse pues no existen obras que demoler, ni tampoco se logró determinar la responsabilidad penal de los imputados en la conducta acusada, como para establecer que son ellos quienes deben correr con la responsabilidad ambiental de cumplir con dichas medidas protectoras, por lo que resulta imposible en esta sede acceder a una pretensión como la de la Procuraduría General de la República, en la que solicita que se le ordene a los imputados, en su condición de propietarios del fundo, no realizar actividad alguna que impida la regeneración de la zona afectada.

Por lo anterior, es criterio de la mayoría de este Tribunal que lo que corresponde es declarar sin lugar el presente motivo de apelación de sentencia, pero en aras de proteger el derecho fundamental consagrado en el artículo 50 de la Constitución Política y el principio precautorio que rige en materia ambiental, se ordena comunicar esta sentencia al Área de Conservación Amistad Pacífico del Ministerio del Ambiente y Energía, para que le brinde seguimiento a la zona afectada en este asunto y disponga, en caso de ser necesario, las medidas protectoras que correspondan” (Voto 2018-101 de las 10:47 horas del 28 de febrero de 2018, jueces Fernández Mora, Carranza Cambronero, con voto salvado del juez Mena Artavia). Tal criterio es plenamente aplicable en el presente caso, en donde como se indicó, no se logró determinar la responsabilidad del imputado en los hechos que le fueron atribuidos en el proceso penal, por lo que tampoco se logró determinar responsabilidad civil alguna en su contra, resulta necesario que en el pronunciamiento de fondo del a quo, se establezca con claridad las razones legales y técnicas por las que procedía ordenar la restitución de las cosas a su estado natural.

Precisamente, esa argumentación debería pasar por el análisis de las normas legales que permiten tal situación, así como el debido análisis técnico que establece las medidas necesarias para mantener el equilibrio que existía antes del daño ambiental. En ese sentido, también lleva razón el representante del Estado al señalar que no existe un adecuado fundamento en la sentencia para establecer por qué solo procedía ordenar la eliminación de las obras realizadas y no de la plantación artificial de zacate para pastoreo de ganado. Al no apreciarse que exista un adecuado fundamento en ese sentido, procede declarar con lugar los reclamos planteados, disponer la ineficacia parcial del fallo y ordenar la realización de un juicio de reenvío ante otra integración del mismo tribunal para nueva sustanciación, únicamente de lo relacionado con la restitución de las cosas a su estado natural.

VI.Voto parcialmente salvado del juez Fallas Redondo: El suscrito juzgador, discrepo en varios aspectos, de la decisión tomada por quienes conformaron la mayoría de votos en este asunto.

  • 1)En lo que respecta al tema de la prescripción de la acción penal (según se expone en el argumento A del Considerando II de esta resolución), me aparto del criterio de mi compañera y mi compañero, pues, en primer lugar, según mi parecer, el inicio del procedimiento penal no tiene, por sí solo, ningún efecto interruptor del cómputo de la prescripción. Lo que señala el numeral 31 del Código Procesal Penal es que si el procedimiento no ha iniciado (o sea, no se cuenta con una persona señalada como posible autora de un hecho punible), entonces la acción prescribe al cumplirse los plazos establecidos en esa norma. El artículo 33 del mismo cuerpo legal, lo que hace es establecer cuáles actos procesales tienen efecto interruptor de la prescripción, cuando ya se tiene una persona como imputada. Pero nada más. Ninguna de las dos normas indicadas atribuyen al inicio del procedimiento, es decir, al señalamiento de alguien somo posible autor o autora de un hecho punible, un efecto interruptor. En tales condiciones, no es viable invocar la interpretación gramatical para entender que tal inicio del procedimiento significa la interrupción del cómputo de la prescripción. En igual sentido, estimo que tampoco es de recibo aplicar la técnica de la interpretación restrictiva a esos artículos, porque el límite de este tipo de entendimiento de las normas es precisamente su texto y en ninguno de esos numerales se atribuye efecto interruptor al inicio del procedimiento, por lo que otorgárselo en desapego de lo dispuesto en los artículos 31 y 33 del Código Procesal Penal, implica variar contenido de esas disposiciones legales, lo cual considero es función del Poder Legislativo. Así las cosas, salvo mi voto en cuanto a este punto, pues estimo que no ha operado la prescripción de la acción penal.
  • 2)En relación con el argumento B del mismo Considerando II, quiero indicar que la prescripción es renunciable (artículo 35 del Código Procesal Penal), lo cual significa, para mí, que no es uno de los supuestos en que el Tribunal puede pronunciarse de oficio. Véase el artículo 42 del Código Procesal Penal y se podrá apreciar que se prevé que la extinción de la acción penal puede oponerse como excepción en el proceso. Ciertamente se prevé que el Tribunal puede asumir de oficio, la solución de “alguna de” las excepciones. Adviértase que no dice la ley que pueda pronunciarse de oficio sobre “las cuestiones anteriores”, así, a secas, sino que antepone la expresión “alguna de”, lo cual es diferente a "todas" o "cualquiera de". Ello implica que no estableció el legislador que el pronunciamiento de oficio sobre las excepciones pueda hacerse respecto de cualquiera de ellas, o lo que es lo mismo, que proceda en cuanto a todas ellas, sino que sólo cabe tal tipo de decisión de oficio en los casos en los que no se requiere la actuación de parte. Pero resulta, desde mi óptica, que la prescripción está fuera de los supuestos en que cabe pronunciamiento de oficio, precisamente porque es renunciable (lo cual la diferencia de otras causales de extinción de la acción penal), de modo que, para mí, el Tribunal puede declararla sólo cuando el sujeto procesal interesado en ella (esencialmente el imputado, aunque nada obstaría para que el Ministerio Público, en apego al principio de objetividad, lo haga) oponga la excepción respectiva, de modo que no puede declararla de oficio. En relación con esto último, quiero externar que no estoy presumiendo que el imputado haya renunciado a la prescripción, sino que estoy planteando otra cosa: el debido proceso presupone la imparcialidad del cuerpo juzgador y por ello, la regla es que no debe asumir el papel de los sujetos procesales; de allí se sigue la excepción: sólo en casos muy calificados, establecidos en la ley, puede actuar de oficio; partiendo de lo recién expuesto, mi criterio es que dado que la prescripción es renunciable (lo que implica que es un derecho disponible para el sujeto interesado), no está dentro de los supuestos de las actuaciones de oficio de los órganos jurisdiccionales y, por esta razón, sólo se puede emitir pronunciamiento sobre ella cuando el sujeto interesado la alega. De conformidad con lo expuesto hasta aquí, aunque estoy de acuerdo con la tesis de que, de haberse alegado por el sujeto interesado, la acción penal habría prescrito por las razones que da la mayoría de esta Cámara, lo cierto es que nunca se alegó tal excepción, por lo que estimo que no puede ser declarada de oficio.
  • 3)Por otra parte, en tercer lugar, en mi criterio, la restitución de las cosas al estado anterior a la comisión de un hecho punible puede ordenarse aunque se rechace la acción civil resarcitoria, pues no depende de esta. Aún cuando el título del numeral 103 del Código Penal haga alusión a las "consecuencias civiles" de un ilícito, ello sólo es indicativo de que se trata de aspectos no penales, mas no implica que la restitución indicada equivalga a la indemnización a favor de una persona específica. Adviértase que la acreditación de un daño ambiental acarrea la obligación de restituir las cosas al estado anterior (lo cual es diferente a reconocer una indemnización por daño patrimonial o moral). Cabe recordar que esta distinción está recogida en el artículo 361 del Código Procesal Penal, en el que el pronunciamiento sobre "la restitución y las costas" se establece por separado al que debe hacerse "cuando corresponda" sobre "lo relativo a la reparación de los daños y perjuicios". De lo anterior, infiero que al igual que sucede con las costas, el pronunciamiento sobre la restitución (expresión que se hace en general, por lo que abarca la devolución de objetos y el restablecimiento de las cosas al estado anterior al hecho) debe hacerse de oficio. En lo que respecta al restablecimiento de las cosas al estado anterior cuando hay daño ambiental, considero que sí procede la decisión de oficio por parte del Tribunal que conozca el asunto. En materia ambiental, el derecho a un ambiente sano está contemplado en la Constitución Política (artículo 50), la que dispone que es obligación de todos preservarlo y que el Estado tiene el deber de garantizar dicha preservación. tampoco puede dejarse de lado que la propiedad privada, aún cuando está garantizada constitucionalmente, también debe soportar limitaciones de interés social (artículo 45). De allí que la obligación de respetar los bosques y nacientes (entre otros) en los fundos privados, también la deben soportar quienes sean propietarios de los mismos, ya sean personas jurídicas o físicas. Además, en caso de que se dé daño ambiental, quien lo comete tiene la obligación de repararlo, incluso mediante el restablecimiento las cosas al estado anterior al daño. Y ese deber de reparar existe aunque no medie dolo o culpa (es decir, se trata de un régimen de responsabilidad objetiva). Esta posición encuentra respaldo en lo dispuesto en los numerales 2, 98 y 101 de la Ley Orgánica del Ambiente, 52 de la Ley de Uso, Manejo y Conservación de Suelos y 8 de la Ley de Biodiversidad. De allí que si hay elementos de prueba que permitan establecer un nexo de causalidad entre alguna actividad humana y éste, entonces quien incurre en aquella debe asumir la reparación (en este caso, mediante el restablecimiento de las cosas al estado anterior) del daño. Entonces, la determinación de la obligación de restituir no depende ni de la acreditación de un delito, ni tampoco de la procedencia de una acción civil resarcitoria.

POR TANTO

Se declara sin lugar el recurso de apelación incoado por la representante del Ministerio Público, así como los motivos primero y segundo del recurso planteado por la Procuraduría General de la República. De manera oficiosa se declara la extinción de la acción penal por prescripción y se confirma la absolutoria del imputado por los hechos que se le han atribuido en este proceso. El juez Fernández Mora pone nota. Se declara con lugar el recurso de apelación incoado por la defensa del demandado civil, así como el tercer motivo de impugnación incoado por el representante de la Procuraduría General de la República, se dispone la ineficacia parcial del fallo y se ordena la realización de un juicio de reenvío, únicamente para que se discuta lo concerniente a la restitución de las cosas a su estado natural que se dispuso en sentencia.
