Constitutional challenge (acción de inconstitucionalidad) brought by Allan Astorga Gättgens, holder of identity card No. 3-0252-0451, and Álvaro Sagot Rodríguez, holder of identity card No. 02-0365-0227, seeking a declaration that subsection 4) of Article 3, Article 4 bis, Article 13, subsection 1) of Article 46, and Anexo 2, all of the Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), Decreto Ejecutivo No. 31849-MINAE-S-MOPT-MAG-MEIC de 24 de mayo de 2004, as supplemented and amended by Decreto Ejecutivo No. 37803-MINAE-S-MOPT-MAG-MEIC, de 17 de julio de 2013, are unconstitutional on the grounds that they contravene the right to a healthy and ecologically balanced environment and fail to respect the principles of non-regression in environmental matters, progressivity, objectification, proportionality, sustainable development, and precaution. The representative of the Procuraduría General de la República, the representatives of the Ministerio de Ambiente y Energía, and the Secretaría General de la Secretaría Técnica Nacional Ambiental also participated in the proceedings.
BACKGROUND:
It states that: a) Regarding standing: it notes that the petitioners filed the action alleging protection of the environment as a diffuse interest protected by Article 50 of the Constitution, and that this Chamber admitted it pursuant to the second paragraph of Article 75 of the Ley de la Jurisdicción Constitucional; b) Regarding the merits of the matter: 1. As to the amendment to subsection 5 of Article 13 of Executive Decree number 31849 introduced by the challenged decree, it establishes that, once SETENA receives form D2, it shall register the project’s spatial location using geographic information systems (sistemas de información geográfica, SIG). It states that this advisory body does not know whether SETENA has thematic cartography depicting environmentally fragile areas at a scale of 1:10.000; it further states that the absence thereof would not render the provision unconstitutional.
It adds that this is a technical matter concerning the methodology and appropriate tools for locating land in relation to environmentally fragile areas, the assessment of which does not fall within the jurisdiction of that court, since the use of cartography such as that suggested by the petitioners is a technical decision to be made by the Administration, rather than by this Constitutional Chamber. 2. With regard to the amendment made to subsection 1 of Article 46 of Executive Decree number 31849 by Article 3.1 of the challenged decree, extending the validity of environmental approvals (viabilidades ambientales) from 2 to 5 years, it does not necessarily render the provision unconstitutional. The principle of non-regression in environmental matters (principio de no regresión en materia ambiental)—already recognized by this Chamber in judgment number 13367-2012 of 21 de setiembre del 2012—cannot be understood in absolute terms.
A reduction in a particular level of protection is permissible if there is technical and scientific support guaranteeing that it does not result in a material loss of environmental protection, provided that the standards of proportionality and reasonableness established by this Chamber in its case law are met. It states that, in the present case, merely extending the validity of the environmental approval from 2 to 5 years does not necessarily entail a reduction in the level of protection, even though allowing an additional 3 years to commence a particular activity might suggest otherwise. Changes over time in the circumstances of a particular activity that already has environmental approval may vary greatly depending on the type of activity. In other words, for many activities, a three-year extension may not signify a reduction in the level of protection. The petitioners provide no technical or scientific evidence that would at least suggest that the three-year extension of the environmental approval’s validity is disproportionate or irrational.
Consequently, this advisory body is of the opinion that the amendment introduced by Article 3.1 of Executive Decree number 37803, extending the validity of environmental approvals, does not in itself violate the principle of non-regression, since there is no technical or scientific evidence establishing that it reduces the level of environmental protection, nor is there any evidence indicating that it is a disproportionate and irrational measure. 3. Regarding the changes in classification of certain activities subject to environmental approval. Article 4 of the challenged decree amended the descriptions in Division F.45 of Anexo 2 of Decree number 31849. With respect to land alteration and earthworks (movimientos de tierra), it exempted those involving less than 200 cubic meters from an environmental assessment (evaluación ambiental). With respect to the construction and operation of buildings, it exempted those smaller than 500 square meters from an environmental assessment; and, in the case of industrial and storage buildings not directly related to the operation, it exempted those smaller than 1.000 square meters from environmental assessment.
In other words, in all these cases, the challenged decree reduces the level of environmental protection compared with that established by the amended regulation. Nevertheless, that is not in itself unconstitutional. Article 17 of the Ley Orgánica del Ambiente (LOA), number 7554 of 4 de octubre de 1995, establishes that “…..human activities that alter or destroy elements of the environment or generate waste or toxic or hazardous materials shall require an environmental impact assessment (evaluación de impacto ambiental) by the Secretaría Técnica Nacional Ambiental…”. It further provides that laws and regulations shall specify which activities, works, or projects must undergo an environmental assessment. In other words, the Executive Branch, in exercising its regulatory authority (potestad reglamentaria), may determine which activities require a prior environmental assessment and which do not.
This decision must have a technical and scientific basis and must also satisfy the requirements of reasonableness and proportionality. However, where such decisions modify a prior decision by excluding an activity or categories of an activity from environmental assessment, the technical and scientific basis, as well as proportionality and reasonableness, take on particular importance. This is because ceasing to exercise a previously exercised form of oversight reduces the level of protection already afforded by the provision. In its case law, this Chamber has held that any reduction in the level of environmental protection afforded by a provision must have a technical and scientific basis sufficient to ensure that it will not cause alterations of or impacts on the environment, and it has so held specifically in relation to environmental assessment (see, among others, judgment number 2002-1220 of 6 de febrero de 2002).
Consistent with the foregoing, although the Executive Branch has the authority to make the above amendments, they must have a technical and scientific basis and comply with the standards of proportionality and reasonableness. This means that the Constitutional Chamber must assess the technical and scientific basis, as well as the reasonableness and proportionality, of the decision adopted through the amendment introduced by Article 4. As part of this assessment, particularly regarding its technical and scientific aspects, it must consider whether the amendments made by Article 4 of the challenged decree may be applied regardless of the type of land. From the standpoint of reasonableness and proportionality, this advisory body considers that, given the scope of the amendments, those standards are not violated, taking into account that the Executive Branch seeks to exclude from SETENA’s environmental oversight low-environmental-impact activities that divert that body’s resources and time.
From this perspective, it is therefore a decision adopted to promote greater efficiency in the exercise of SETENA’s powers. Nevertheless, notwithstanding the foregoing, that decision must not compromise the integrity of the environment. However, determining whether it does so requires consideration and assessment of the technical and scientific aspects involved, for which evidence must be introduced into the proceedings to determine whether the decision has a technical and scientific basis. In this regard, the Constitutional Chamber must assess whether constitutional review proceedings are the most appropriate forum for doing so or whether this matter should be examined in ordinary proceedings. 4. Regarding the definition of “activities with very low potential environmental impact (actividades de muy bajo impacto ambiental potencial).” Article 5 of the challenged decree defines what is to be understood by activities with very low potential environmental impact.
This Article merely establishes a definition without attaching any legal consequence to it; accordingly, it is not in itself unconstitutional. Any potential unconstitutionality would not lie in this Article, but rather in the provision attaching a particular legal consequence to it, depending on what that consequence may be. The provision whose constitutionality would have to be assessed would be the one resulting from the association between what this Article provides and the provision establishing a legal consequence in relation to the definition. However, insofar as Article 5 of the challenged regulation contains only a definition, it cannot be unconstitutional because it is not a deontic expression; there is no violation of the principle of objectification (principio de objetivación). 5. Regarding activities already in operation as activities with very low potential environmental impact, Article 6 of the challenged decree specifically establishes that activities already in operation are activities with very low potential environmental impact and exempts them from the environmental assessment conducted by SETENA.
This is a case in which an Article establishes a legal consequence associated with the definition in Article 5 of the challenged decree that may be assessed to determine whether it conforms to the Constitution. In this regard, this advisory body is of the opinion that Article 4 bis, subsection 1), of Decree number 31849 is unconstitutional because it violates the principles contained in Article 50 of the Constitution concerning proper state protection of the environment and the preventive principle (principio preventivo). The cited Article excludes every activity already in operation that obviously lacks environmental approval to operate, even if it operates in accordance with the legal system. This means that activities which, if commenced today, would have to undergo an environmental assessment would remain outside SETENA’s environmental oversight. This circumstance in itself demonstrates the absence of any technical and scientific criterion for exempting them from SETENA’s environmental oversight, which, in addition to expressly contravening Article 17 of the LOA, violates the preventive principle contained in Article 50 of the Constitution, as stated by this Constitutional Court in extensive and consistent case law (see, among others, judgments numbers 2003-6311 of 3 de julio de 2003 and 2008-015760 of 22 de octubre de 2008).
The petitioners are correct in stating that SETENA should conduct an environmental diagnostic study (estudio de diagnóstico ambiental, EDA) with respect to these activities, in accordance with this Chamber’s case law (see judgments numbers 2003-006324 of 4 de julio del 2003 and 2004-04949 of 6 de mayo de 2004). By way of conclusion, the consulted advisory body states that, consequently and in accordance with the foregoing, it considers subsection 1 of Article 4 bis of Decree 31849 of 24 de mayo de 2004 unconstitutional. Furthermore, and also on the basis of the foregoing, it considers subsection 5) of Article 13; subsection 1 of Article 46; subsection 4) of Article 3; and the challenged portion of Anexo 2, all of Executive Decree number 31.849 of 24 de mayo de 2004, not unconstitutional.
Justice Cruz Castro drafts the opinion; and,
CONSIDERING:
I.SUBJECT MATTER OF THE CHALLENGE.- The petitioners indicate that they challenge all amendments made to the Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental EIA (Executive Decree No. 31849-MINAE-S-MOPT-MAG-MEIC of 24 de mayo de 2004), through Executive Decree No. 37803-MINAE-S-MOPT-MAG-MEIC, of 17 de julio de 2013. However, pursuant to the order admitting the action, only Articles 3 subsection 4), 4 bis, 13, 46 subsection 1), and Anexo 2 of the aforementioned Regulation are deemed challenged. They provide:
“Article 3º—Definitions and abbreviations. For purposes of this Regulation, the following definitions and abbreviations are used:
(…)
4. Activities with very low potential environmental impact refers to human activities that, by their nature, do not adversely alter the environment, impair the environmental quality of the surroundings generally or of any of their components, or affect public health, because their atmospheric emissions, wastewater discharges, management of ordinary and special waste, and noise comply with the provisions established in the regulations in force. Furthermore, hazardous products are not used, and waste of that type is not generated.” “Article 4° bis. – Activities, works, or projects that, by their nature, do not require an environmental impact assessment (EIA) before SETENA The activities, works, or projects with very low environmental impact described below shall not be required to process an EIA before SETENA; however, they shall be subject to the environmental controls established by the Municipalities, the Ministerio de Salud, the Ministerio de Agricultura y Ganadería, the Ministerio de Obras públicas y Transportes, the Ministerio de Ambiente y Energía, and other authorities with statutory jurisdiction, as well as to the provisions of the Código de Buenas Prácticas Ambientales, Executive Decree N° 32079 of 14 de setiembre del 2004, published in La Gaceta 217 of 5 de noviembre del 2004, or to any voluntary mechanism for improving environmental performance:
1. Operating activities that are required to renew their permits before other public administrative authorities, such as the Ministerio de Salud, the Ministerio de Agricultura y Ganadería, and the Municipalities, among others.
2. Improvement, reconstruction, and repair activities, works, or projects carried out on public or private infrastructure, as well as minor works defined in Municipal provisions, provided that they are not located in an environmentally fragile area, do not involve construction exceeding 500 m² or earthworks exceeding 200 m³, and do not handle, store, or transfer hazardous products.
3. The construction and operation of buildings of less than 500 m2, and construction projects for industrial and storage buildings of less than 1000 m2 when they are not directly related to their operation, provided that these works are located in an area with land use (uso de suelo) consistent with local planning and are not located in an environmentally fragile area.” “Article 13.—Procedure for a category C activity, work, or project. The procedure to be followed for category C activities, works, or projects is as follows:
1. Submission, in the original and 2 copies, of the requirements specified in the preceding Article 12, at the offices of SETENA or at the offices of the Health Areas of the Ministerio de Salud or of the environmental authority duly authorized by SETENA where the activity, work, or project will be located.
2. At that same time, the person in charge or designated official of SETENA, the office of the Health Area of the Ministerio de Salud, or the environmental authority duly authorized by SETENA shall return to the developer the duly stamped copy, bearing the assigned application number and the CBPA.
3. The person in charge of SETENA, the office of the Health Area of the Ministerio de Salud, or the environmental authority duly authorized by SETENA shall prepare a daily list of all activities, works, or projects received.
4. Once the list has been prepared, if the documents were not received at SETENA’s offices, the person in charge or designated official of the Health Area of the Ministerio de Salud or of the environmental authority duly authorized by SETENA shall, within no more than 5 business days, transmit to SETENA, by the most expeditious means available, a copy of the D2 and its annexes. The developer shall be entitled to send SETENA, by fax, the D2 bearing the corresponding receipt stamp.
“Article 46.—Validity of the environmental approval (license).
If, during its validity period, evident changes have occurred in the exogenous conditions assessed when environmental viability was granted, SETENA may, on its own initiative, require the interested developer to update the environmental assessment instruments (instrumentos de evaluación ambiental) submitted or to provide certification that the environmental conditions initially assessed for the project have not changed with respect to the current exogenous conditions and that the assessment conducted remains valid. This certification shall be issued by the environmental manager (regente) or by a consultant competent in the disciplines involved in the initial assessment and shall be submitted within 30 business days after notification of such request by SETENA. If this certification is not submitted within the specified period, Article 264 of the Ley General de Administración Pública shall apply.
SETENA may, on its own initiative, undertake any measures it deems appropriate to verify whether the exogenous conditions have changed. If the construction or operational phase of activities, works, or projects holding Environmental Viability (Viabilidad Ambiental) does not commence within the established periods, the developer shall, before the period expires, request an extension of its validity from SETENA, providing justification of the valid reasons supporting the request, in accordance with the requirements set forth in Article 258 of the Ley General de la Administración Pública. Such extension shall be granted only if the exogenous conditions have not changed.
Under the amendment introduced by the challenged decree and SETENA Resolution no.583-2008, the construction of single-person dwellings, residential developments (urbanizaciones), and condominiums smaller than 500 square meters is deemed to have a very low environmental impact and does not require completion of the environmental impact assessment (EIA) procedure. Projects are thus being exempted from environmental assessments solely on the basis of their area. This is contrary to this Chamber’s ruling 2003-006311, which states: “… A regulation cannot, without exceeding its authority, introduce provisions that, irrespective of the specific type of work or project that a private party wishes to undertake, establish blanket exemptions from the environmental impact study, because doing so would amount to removing—by regulation—the constitutional status of the State’s duty of environmental oversight and protection.” As can be seen, the purpose of this action is to determine whether the amendments introduced by Executive Decree number 37803 of 17 de julio de 2013 to Executive Decree number 31849 of 24 de mayo de 2004 are unconstitutional because they violate the constitutional principles embodied in Article 50 of the Constitution.
II.STANDING OF THE PETITIONERS IN THIS CASE.- Article 75 of the Ley de la Jurisdicción Constitucional governs the prerequisites for the admissibility of constitutional challenges (acciones de inconstitucionalidad), requiring the existence of a pending administrative or judicial matter in which unconstitutionality has been raised. This requirement does not apply in the cases provided for in the second and third paragraphs of that Article, namely, when the nature of the provision does not cause individual or direct harm; when the action is based on the defense of diffuse interests (intereses difusos) or interests concerning the community as a whole; or when it is filed by the Procurador General de la República, the Contralor General de la República, the Fiscal General de la República, or the Defensor de los Habitantes, in the latter cases within their respective spheres of authority. The possibility exists of bringing an action in defense of “diffuse interests,” which are interests held by groups of people who are not formally organized but are united by a particular social need, a physical characteristic, their ethnic origin, a particular personal or ideological orientation, the consumption of a certain product, and so forth.
In such cases, the interest is dispersed or diluted (diffuse) among an unidentified plurality of persons. This Chamber has identified various rights that it has classified as “diffuse,” including the environment, cultural heritage, protection of the country’s territorial integrity, proper management of public expenditure, and the right to health, among others. Furthermore, the list established by the Sala Constitucional is not exhaustive. Based on the foregoing, it is clear that the petitioners have sufficient standing to challenge the constitutionality of the disputed provisions, without needing a prior matter to serve as the basis for this action. This is because they act in defense of a diffuse interest, namely the right to the environment, and are therefore fully entitled to bring a direct action under paragraph 2° of Article 75 of the Ley de la Jurisdicción Constitucional. This is indeed a matter whose constitutionality may be reviewed through these proceedings.
In addition, the petitioners complied with the requirements established in Articles 78 and 79 of the applicable procedural law (Ley de rito). In conclusion, this action is admissible, and its subject matter and merits must therefore be addressed immediately.
To facilitate review of the challenged provisions, before analyzing each of the arguments presented by the petitioners, the relationship between the precautionary principle in environmental matters, environmental impact studies (estudios de impacto ambiental), and the scope of the principle of non-regression in environmental matters will be clarified.
IV.GENERAL CONSIDERATIONS REGARDING ENVIRONMENTAL IMPACT ASSESSMENTS (Estudios de Impacto Ambiental, EIA) AND THE PRINCIPLE OF NON-REGRESSION (principio de no regresión) IN ENVIRONMENTAL MATTERS, AND WHY NOT EVERY AMENDMENT TO ENVIRONMENTAL REGULATIONS SHOULD BE DEEMED A VIOLATION OF THAT PRINCIPLE.- Before examining each of the petitioners’ arguments, it is necessary to recall the importance of environmental impact assessments and, for the specific case under review, to determine the scope of the principle of non-regression in environmental matters, so as to conclude that not every amendment to environmental regulations—as the petitioners appear to suggest—must be deemed a violation of that principle. Based on recognition of the right to a healthy and ecologically balanced environment, enshrined in Article fifty of the Political Constitution and Principle fifteen of the Rio Declaration, United Nations Conference on Environment and Development, as this Chamber has examined in prior case law (see decision number 2014-004243), the so-called “precautionary principle in environmental matters (principio precautorio en materia ambiental)” or “in dubio pro natura principle (principio in dubio pro natura)” has likewise been recognized.
Observance of this principle requires that all actions by the public administration involving environmentally sensitive matters be undertaken with the appropriate diligence to prevent risks and harm that would be impossible or difficult to remedy. It follows that the administration must have negative certainty that the environment will not be affected under any circumstances; therefore, when there is doubt as to whether a risk may occur, the administration is required not to authorize or carry out the actions in question, or immediately to cease the administrative activity causing the danger. In other words, if it lacks scientific certainty regarding the harmlessness of the activity, the administration must refrain from carrying out activities having a negative environmental impact; where there is scientific uncertainty regarding whether the actions are harmless or beneficial, the administration may not grant authorizations or itself perform acts that create situations of environmental risk.
In this regard, the conduct of environmental impact assessments constitutes a principle that must be duly observed and applied, to the extent that—gradually and progressively, as befits the field of human rights—both legislation and this Chamber’s own case law have defined the importance and necessity of having such assessments duly completed before certain types of works are undertaken. With respect to the principle of progressive realization (principio de progresividad), which the petitioners invoke throughout their arguments, see this Chamber’s ruling no.2012-013367, which states:
“V. Regarding the principles of progressive realization and non-regression in environmental protection. The principle of progressive realization of human rights has been recognized by International Human Rights Law; among other international instruments, it is embodied in Article 2 of the International Covenant on Economic, Social and Cultural Rights, Articles 1 and 26 of the American Convention on Human Rights, and Article 1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights. Under these provisions, the State assumes the obligation progressively to increase, to the extent permitted by its capabilities and development, the levels of human-rights protection, with particular regard for rights that, like the right to the environment (Art. 11 of the Protocol), require numerous affirmative actions by the State to ensure their protection and full enjoyment by all rights holders.
From the principle of progressive realization of human rights and the principle prohibiting the retroactive application of rules to the detriment of vested rights (derechos adquiridos) and settled legal situations (situaciones jurídicas consolidadas), embodied in Article 34 of the Constitution, arises the principle of non-regression or the irreversibility of benefits or protections already attained. This principle constitutes a substantive safeguard of rights—in this case, the right to a healthy and ecologically balanced environment—under which the State is required not to adopt measures or policies, or approve legal rules, that worsen, without reasonable and proportionate justification, the level of rights attained up to that point. This principle does not entail absolute irreversibility, since all States experience domestic situations of an economic, political, or social nature, or situations caused by nature, that adversely affect the achievements attained up to that point and compel them to reconsider and lower the new level of protection.
In such cases, Constitutional Law and the principles under examination require any reduction in levels of protection to be justified in light of the constitutional standards of reasonableness and proportionality. In this regard, the Constitutional Chamber has stated in its case law concerning the right to health: ‘…under the PRINCIPLE OF NON-REGRESSION, measures that diminish the protection of fundamental rights are prohibited. Accordingly, if the Costa Rican State, for the purpose of protecting the right to health and the right to life, has a policy of expanding access to medicines, it may not—and much less through an International Treaty—reduce such access and make it more restrictive under the pretext of protecting trade. (Judgment of the Constitutional Chamber Nº 9469-07).’ With respect to the right to the environment, it stated: ‘The foregoing constitutes an evolving interpretation of environmental protection in accordance with Constitutional Law, which does not permit regression to its detriment.’ (Judgment of the Constitutional Chamber Nº 18702-10)….” It may therefore be concluded that not every amendment to environmental regulations necessarily entails a reduction in the protection of the right to the environment.
Such a conclusion must be substantiated. Likewise, not every amendment that is insufficiently broad should be construed as an unconstitutional omission (inconstitucionalidad por omisión). The fact that a particular outcome is desirable does not render unconstitutional a provision that falls short of it. Indeed, all legal rules are capable of improvement, but their proximity to or departure from an ideal or desirable standard does not make them unconstitutional. In light of the foregoing, each of the petitioners’ claims will now be examined.
V.REGARDING THE CLAIM THAT ARTICLE 3, SUBSECTION 4), OF THE CHALLENGED REGULATIONS IS UNCONSTITUTIONAL (DEFINITION OF ACTIVITIES HAVING VERY LOW POTENTIAL ENVIRONMENTAL IMPACT).- Subsection 4) of Article 3 was added to the challenged Regulations by decree 37803 of 25 de junio del 2013, to include “activities having very low potential environmental impact” among the definitions, as shown in the accompanying table:
General Regulations on Environmental Impact Assessment (EIA) Procedures Decree 31849 of 24 de mayo del 2004 Amendments Decree 37803 of 25 de junio del 2013 Art.3, subsection 4).
“Article 3.— Definitions and abbreviations. For purposes of these Regulations, the following definitions and abbreviations shall be used:
(…) 4. Accreditation (Acreditación): The procedure by which the Public Administration authorizes natural or legal persons, whether public or private, that meet the legal, technical, material-suitability, and professional-suitability requirements established by the regulations in force, to perform specific tasks or provide specific services in full or partial support of compliance with the obligations imposed by the State.” Pursuant to Article 5 of Decreto Ejecutivo N° 37803 of 25 de junio del 2013, a subsection 4 was ordered added to this Article, with the subsequent subsections renumbered accordingly, the text of which would read:
“... 4. Activities having very low potential environmental impact refers to human activities that, by their nature, do not cause adverse alteration of the environment and do not impair the environmental quality of the surroundings generally or of any of their components, nor affect the health of the population, because atmospheric emissions, wastewater discharges, management of ordinary and special waste, and noise comply with the provisions established in the regulations in force. Moreover, hazardous products are not used and waste of this kind is not generated....” Nevertheless, Decreto Ejecutivo N° 38024 of 19 de noviembre del 2013 ordered the sole transitory provision of Decreto N° 37803 amended to establish the following: “...
In the petitioners’ view, the definition of activities having very low potential environmental impact is imprecise and leaves open, as a matter of discretion and subjectivity, the possibility that activities having a greater impact may be included as such, without providing a specific list of those activities. They further argue that the absence of a list of activities considered to have very low potential environmental impact renders the definition contained in the challenged decree unconstitutional insofar as it grants the Administration broad discretion. For its part, the Procuraduría General de la República states in its report that this Article merely establishes a definition without attaching any legal consequence to it and, therefore, is not in itself unconstitutional. Any possible unconstitutionality would not lie in this Article, but rather in the provision attaching a particular legal consequence to it, depending on the nature of that consequence.
The provision whose constitutionality would need to be assessed would be the one resulting from reading this Article together with the provision establishing a legal consequence in relation to the definition. However, insofar as subsection 4) of Article 3 of the challenged Regulations contains only a definition, it cannot be unconstitutional because it is not a deontic expression (expresión deóntica). The challenged Article not only does not grant discretion, but also binds the Administration to a precise definition of what is to be understood by activities having very low potential environmental impact, such that any legal consequence associated with that definition by another Article remains subject to its content. The definition is an indeterminate legal concept (concepto jurídico indeterminado) whose meaning is ultimately for the judge to determine. Consequently, there is no violation of the principle of objective substantiation (principio de objetivación).
The representatives of the Ministerio de Ambiente and SETENA state in this regard that the definition has been applied at least since the year 2004, without diminishing the capacity to protect the environment or causing harm to the regulated party; the provision merely endorses by decree a definition that already existed and had already been applied. Furthermore, that definition was submitted to the Ministerio de Salud for assessment.
In the opinion of this Chamber, a definition per se such as the one being challenged certainly cannot be deemed to render the provision unconstitutional. The challenged article binds the Administration to a definition of what is to be understood as activities with very low potential environmental impact, such that any legal consequence associated with that definition by another article is subject to its content. The fact that the petitioners believe that, rather than a definition, a list of activities deemed to have very low potential environmental impact should have been established is an assessment that does not render the definition contained in the challenged decree unconstitutional, nor does it constitute an unconstitutionality by omission, since the Law of the Constitution does not establish that such a list must exist in a predetermined form. Accordingly, the constitutional challenge to subsection 4 of Article 3 of the challenged Regulations must be dismissed.
VI.REGARDING THE CONSTITUTIONAL CHALLENGE TO ARTICLE 4 BIS OF THE CHALLENGED REGULATIONS (ACTIVITIES, WORKS, OR PROJECTS THAT, BY THEIR NATURE, DO NOT REQUIRE AN ENVIRONMENTAL IMPACT ASSESSMENT (EVALUACIÓN DE IMPACTO AMBIENTAL, EIA) BEFORE SETENA).- Article 4 bis was added to the challenged Regulations by decreto 37803 del 25 de junio del 2013, to include “Activities, works, or projects that, by their nature, do not require an EIA before SETENA,” as shown in the accompanying table:
General Regulations on Environmental Impact Assessment (EIA) Procedures Decreto 31849 del 24 de mayo del 2004 Amendments Decreto 37803 del 25 de junio del 2013 Article 4 Article 4.—Activities, works, or projects subject to an EIA. New activities, works, or projects subject to the process for obtaining environmental viability (license) (viabilidad (licencia) ambiental) before SETENA, pursuant to Article 17 of the Organic Environmental Law (Ley Orgánica del Ambiente), are divided into:
1. Those activities, works, or projects for which a specific law requires completion of the process. Anexo Nº 1, which forms an integral part of these Regulations, lists those activities, works, or projects.
2. The other activities, works, or projects not included in Anexo Nº 1 of the preceding paragraph are arranged according to the general categorization set forth in Anexo Nº 2 of these Regulations.
Article 6 of decreto ejecutivo N° 37803 del 25 de junio del 2013 orders that Article 4 bis be added to these Regulations, with the following text:
“... Article 4 bis.- Activities, works, or projects that, by their nature, do not require an EIA before SETENA The activities, works, or projects with very low environmental impact described below shall not be required to process an EIA before SETENA; however, they shall be subject to the environmental controls established by the Municipalities, the Ministerio de Salud, the Ministerio de Agricultura y Ganadería, the Ministerio de Obras públicas y Transportes, the Ministerio de Ambiente y Energía, and other entities vested with legal authority, as well as to the provisions of the Código de Buenas Prácticas Ambientales, Decreto Ejecutivo N° 32079 del 14 de setiembre del 2004, published in La Gaceta 217 del 5 de noviembre del 2004, or to any voluntary mechanism for improving environmental performance:
1. Activities already in operation that require renewal of their permits before other public administrative authorities, such as the Ministerio de Salud, the Ministerio de Agricultura y Ganadería, and the Municipalities, among others.
2. Improvement, reconstruction, and repair activities, works, or projects carried out on public or private infrastructure, and minor works (obras menores) as defined in municipal provisions, provided that they are not located in an environmentally fragile area (área ambientalmente frágil), do not involve construction works exceeding 500 m² or earthworks (movimientos de tierra) exceeding 200 m³, and do not handle, store, or transfer hazardous products.
3. The construction and operation of buildings measuring less than 500 m2, and construction projects for industrial and storage buildings not directly related to their operation and measuring less than 1000 m2, provided that these works are located in an area where the land use (uso de suelo) complies with local planning provisions and are not situated in an environmentally fragile area...”.
In the petitioners’ view, the activities described as having very low environmental impact in Article 4 bis do not fall within that category, and exempting them from the EIA process undermines the instrument’s effectiveness in preventing environmental damage. They consider it wholly illogical and inconsistent with reality for an activity already in operation to be deemed to have “very low environmental impact,” regardless of its size, the productive activity it conducts, its potential to generate environmental pollution, and the degree of environmental fragility of the site where it is located, merely because permits are processed before entities other than the Secretaría Técnica Nacional Ambiental, which, they argue, do not conduct a comprehensive environmental impact assessment. For its part, the Procuraduría General de la República states in its report that the provision is unconstitutional insofar as it excludes every activity already in operation, because this would place beyond the environmental oversight exercised by SETENA activities that, if commenced today, would be required to undergo environmental assessment.
This circumstance in itself entails the absence of any technical or scientific criterion for exempting them from the environmental oversight exercised by SETENA, which, in addition to expressly contravening Article 17 of the LOA, violates the preventive principle (principio preventivo) contained in Article 50 of the Constitution, as stated by this Constitutional Court in extensive and consistent case law (see, among others, judgments numbers 2003-6311 de 3 de julio de 2003 and 2008-015760 del 22 de octubre de 2008). What would be appropriate in such cases is an environmental diagnostic study (estudio de diagnóstico ambiental, EDA), in accordance with this Chamber’s case law (see judgments numbers 2003-006324 del 4 de julio del 2003 and 2004-04949 de 6 de mayo de 2004). In this regard, the representatives of the Ministerio de Ambiente and SETENA state that an EIA is a predictive instrument that should not be applied to activities already in operation, since its purpose is to anticipate impacts; therefore, it is not feasible, as the petitioners seek, to require an EIA for activities already in operation.
In the opinion of this Chamber, the following distinction must be drawn with respect to the excluded activities: on the one hand, those specified in subsection 1), and on the other, those excluded under the remaining subsections. This is because the petitioners’ arguments are directed specifically at challenging subsection 1). The following clarification is necessary in view of the statements made by the Procuraduría General de la República in its report. That subsection must be understood in conjunction with the first paragraph of the same article; that is, it concerns activities already in operation that have very low environmental impact and that, according to the provision, are indeed not required to process an EIA before SETENA, but that will nevertheless be subject to other environmental controls—as the provision itself states—such as those established by the Municipalities, the Ministerio de Salud, the Ministerio de Agricultura y Ganadería, the Ministerio de Obras públicas y Transportes, the Ministerio de Ambiente y Energía, and other entities vested with legal authority, as well as to the provisions of the Código de Buenas Prácticas Ambientales, Decreto Ejecutivo N° 32079 del 14 de setiembre del 2004, published in La Gaceta 217 del 5 de noviembre del 2004, or to any voluntary mechanism for improving environmental performance.
Thus, the provision itself establishes that, although such activities do not require an EIA, this does not mean that they are exempt from environmental oversight. It should be noted that the petitioners misconstrue the definition: it is not the fact that activities are already in operation that makes them activities with very low environmental impact; rather, the subsection does not refer to every type of activity already in operation, but only to those activities already in operation that are defined as having very low environmental impact. Accordingly, the constitutional challenge to Article 4 bis of the challenged Regulations must be dismissed with respect to subsection 1 of that provision.
VII.REGARDING THE CONSTITUTIONAL CHALLENGE TO SUBSECTION 5 OF ARTICLE 13 OF THE CHALLENGED REGULATIONS (LACK OF CARTOGRAPHY (CARENCIA DE CARTOGRAFÍA)).- Subsection 5) of Article 13 of the challenged Regulations was amended, as shown in the accompanying table:
General Regulations on Environmental Impact Assessment (evaluación de impacto ambiental, EIA) Procedures Decreto 31849 of May 24, 2004 Amendments Decreto 37803 of June 25, 2013 Article 13 Article 13.—Processing of a Category C activity, work, or project. The procedure to be followed for Category C activities, works, or projects is as follows:
(…)
5. Once the D2 has been received, SETENA, through the respective department, shall review the documentation. If there are no errors or omissions in this document (D2), environmental viability (viabilidad ambiental) shall be granted. It must be made clear to the developer that such environmental viability will be obtained provided that SETENA, within a maximum period of 10 days from the time it receives the documentation, does not officially notify the developer that corrections or clarifications must be made, or that the material specified in Article 9(a) must be submitted when the category of the activity, work, or project is not C. If no notification is issued, after the stated periods have elapsed the developer must verify that the activity, work, or project appears in SETENA’s official registry of projects granted Environmental Viability, so that its registration number may be used when processing permits before other authorities.
Article 2 of Decreto Ejecutivo N° 37803 of June 25, 2013 orders the amendment of subsection 5) of this article, which would read as follows:
“... 5.—Once the D2 has been received, SETENA, through the respective Department, shall use Geographic Information System (Sistema de Información Geográfica, SIG) tools to record the project’s spatial location and shall review all documentation associated with the D2 within no more than ten business days. If there are no errors or omissions in this document (D2), it shall proceed to grant environmental viability and include the activity in SETENA’s official registry of projects granted viability, of which the Developer shall be notified by the means designated for receiving notices. If there are observations or requests for clarification, SETENA shall issue the developer a formal request (prevención), once only and in writing, requiring compliance, for which it shall grant no more than ten business days to complete the information; if the deficiencies are not remedied within the stated period, the case file (expediente) shall be closed and archived.
The formal request shall suspend the Administration’s period for issuing a decision; once that period has elapsed, computation of the remaining period established for issuing a decision shall resume....” In the petitioners’ view, entering the spatial location of projects, works, or activities for which Form D2 is submitted into a Geographic Information System (GIS) is insufficient to guarantee their environmental sustainability, because it does not make it possible to determine with certainty whether they are located in any of the designated environmentally fragile areas (áreas ambientalmente frágiles), and because the geographic information system (GIS) used does not contain adequate cartography showing those areas at a scale that allows details to be discerned (1:10.000). All of this violates the precautionary principle (principio precautorio) and the provisions of Articles 21, 50, and 89 of the Constitution.
For its part, the Procuraduría General de la República states in its report that this is a technical matter concerning the appropriate methodology and instruments for locating land in relation to environmentally fragile areas, the assessment of which does not fall within the jurisdiction of this court. The use of cartography such as that suggested is a technical decision for the Administration. The provision alleged to be unconstitutional establishes a means and an instrument for spatially locating the land on which projects subject to environmental assessment (valoración ambiental) will be carried out. This represents an improvement over the situation that existed before the challenged amendment. In this regard, the representatives of the Ministerio de Ambiente and SETENA state that invalidating this provision would instead result in environmental regression; it is true that environmentally fragile areas have not been identified throughout the entire country and that those which have been identified may not have been mapped at more detailed scales, but the information available to SETENA is the information submitted by institutions as official, and it is not SETENA’s function to generate or correct that information.
This Chamber observes that the petitioners’ claim of unconstitutionality (alegato de inconstitucionalidad) concerns not what the provision says, but what it does not say. In other words, it is a claim of unconstitutionality by omission (inconstitucionalidad por omisión), because, in the petitioners’ view, the provision is insufficient. It is apparent that this is a technical matter related to the appropriate methodology and instruments for locating land in relation to environmentally fragile areas, the specification or assessment of which not only falls outside this constitutional jurisdiction, but also cannot be derived from the Law of the Constitution as requiring any particular geographic information system. The use of cartography such as that suggested by the petitioners is a technical decision for the Administration to make. At most, it would be appropriate to determine in amparo proceedings (vía de amparo) whether, in a particular case, that technical decision failed to protect an environmentally fragile area.
As the Procuraduría states in its report, the provision establishes a means and an instrument—the use of a GIS—for spatially locating the land on which projects subject to environmental assessment will be carried out; this, in itself, is an improvement over the situation existing before the challenged amendment. It therefore makes no sense to declare subsection 5 of Article 13 of Decreto Ejecutivo número 31849 unconstitutional, whether to invalidate it or to specify which instrument must be used. Regarding the latter, ordering SETENA to prepare or use cartography containing the environmentally fragile areas—if it does not already do so—would entail making an administrative decision of clearly technical substance, which does not fall to this Sala Constitucional. Accordingly, with respect to the claim that Article 13, subsection 5), of the challenged Regulations is unconstitutional, the action must be dismissed.
VIII.REGARDING THE CLAIM THAT SUBSECTION 1) OF ARTICLE 46 OF THE CHALLENGED REGULATIONS IS UNCONSTITUTIONAL (EXTENSION OF THE VALIDITY OF ENVIRONMENTAL VIABILITY).—The amendment to Article 46 of the challenged Regulations establishes changes to the validity period of environmental viability. It essentially extends the validity of environmental viability approvals from 2 to 5 years, as shown in the accompanying table:

(The preceding subsection was thus amended by artículo 7° del Decreto Ejecutivo N° 32734 del 09 de agosto de 2005).
2. Activities, works, or projects that are in operation and have an approved EIA shall be subject, pursuant to the Ley Orgánica del Ambiente and these Regulations, to an environmental monitoring and follow-up process under the terms established herein.
(*)3. Activities, works, or projects that are in operation and have an approved EIA, and whose development requires an adjustment to the original design, may retain the environmental viability (license) already granted, provided that they comply with the following terms:
a. An environmental technical report on the Environmental Readjustment of the Original Design must be submitted, prepared by the responsible environmental consultant, in the format defined by SETENA.
b. The design adjustment must not entail substantial changes to the original design; that is, such changes must not entail a modification of the Potential Environmental Impact (Impacto Ambiental Potencial, IAP) category approved by SETENA for the original project, such as a change in the activity, works, or project, a change in the location of the project area, and the proposed production process must be similar to that originally proposed.
c. A comparison must be made of the environmental impacts assessed and their measures, together with any necessary expansion thereof when required, so that the project, works, or activity maintains the environmental equilibrium status granted to it during the environmental impact assessment. In addition, when technically justified, the Management Forecast Plan must be adjusted to include the environmental measures resulting from that analysis.
Verification of the change in these conditions shall be endorsed by the Secretaría General through an administrative decision within a maximum of ten business days, for the purpose of maintaining the validity of the Environmental License.
Through artículo 3° del decreto ejecutivo N° 37803 del 25 de junio del 2013, an amendment to this article was ordered, and its text would read:
“... Article 46.—Validity of environmental viability (license).
If, during the validity period, evident changes have occurred in the exogenous conditions assessed when environmental viability was granted, SETENA may, on its own initiative, request that the interested developer update the environmental assessment instruments submitted or provide certification that the environmental conditions initially assessed for the project have not changed in relation to the current exogenous conditions and that the assessment performed remains valid. This certification shall be issued by the environmental manager or a consultant competent in the disciplines involved in the initial assessment and must be submitted within 30 business days following notification of that request by SETENA. If this certification is not submitted within the stated period, the provisions of artículo 264 de la Ley General de Administración Pública shall apply. SETENA may, on its own initiative, take any steps it deems appropriate to verify whether the exogenous conditions have changed.
If the construction or operational phase of activities, works, or projects holding Environmental Viability does not begin within the established periods, the developer must, before the period expires, request an extension of its validity from SETENA, providing justification of the valid reasons supporting the request, in accordance with the requirements set forth in artículo 258 de la Ley General de la Administración Pública. This extension shall be granted only if the exogenous conditions have not changed.
In other words, for many activities, a three-year extension may not signify a reduction in the level of protection. The problem is that this matter requires technical and scientific information to determine the extent to which this extension may result in a reduced level of protection, and such information is absent from these proceedings. The petitioners provide no technical or scientific evidence that would even suggest that extending the validity of environmental viability by three years is disproportionate or irrational. Consequently, that advisory body’s opinion is that the amendment introduced by artículo 3.1 del decreto ejecutivo número 37803, extending the validity of environmental viability approvals, does not in itself violate the principle of non-regression, because no technical or scientific evidence establishes that it reduces the level of environmental protection, nor is there evidence indicating that the measure is disproportionate or irrational.
In this regard, the representatives of the Ministerio de Ambiente and SETENA state that the two-year period was insufficient for a developer to commence activities and was therefore extended to five years, without reducing environmental protection.
In the Chamber’s view, the Procuraduría is correct in its report. The amendment introduced clearly extends the term of environmental viability from two to five years. However, that fact alone does not support the conclusion that it constitutes, per se, a reduction in the level of environmental protection. Moreover, the applicants offer only assessments lacking technical or scientific evidence from which it could be concluded that extending the validity of environmental viability by three years is disproportionate or irrational. Accordingly, with respect to the claim that Article 46, subsection 1), of the challenged Regulations is unconstitutional, the action must be dismissed.
IX.REGARDING THE CLAIM THAT ANEXO 2 IS UNCONSTITUTIONAL (BUILDINGS SMALLER THAN 500 M2 EXCLUDED FROM EIA).—Article 4 of the challenged decree amended the descriptions in Division F.45 of Anexo 2 of decreto número 31849. With respect to land alteration and earthworks (movimientos de tierra), it exempted those involving less than 200 cubic meters from an environmental assessment. With respect to the construction and operation of buildings, it exempted those smaller than 500 square meters from an environmental assessment; and, in the case of industrial and storage buildings not directly related to the operation, it exempted those smaller than 1.000 square meters from environmental assessment. In the applicants’ view, because the construction of single-person dwellings, residential developments, and condominiums smaller than 500 square meters is considered to have a very low environmental impact, it does not require completion of the environmental impact assessment (EIA) procedure.
Projects are thus being exempted from environmental assessments solely on the basis of their area. For its part, the Procuraduría General de la República states that although the Poder Ejecutivo has the authority to make the foregoing amendments, they must have a technical and scientific basis and satisfy the standards of proportionality and reasonableness. This means that the Sala Constitucional must assess the technical and scientific basis, as well as the reasonableness and proportionality, of the decision adopted through the amendment introduced by Article 4. As part of this assessment, particularly regarding its technical and scientific aspects, it must be considered whether the amendments made by Article 4 of the challenged decree may apply irrespective of the type of land. In this respect, the Sala Constitucional must determine whether constitutional review proceedings are the most appropriate forum for doing so or whether this matter should be examined through ordinary proceedings.
In this regard, the representatives of the Ministerio de Ambiente and SETENA state that the amendments to the annex were made in accordance with the framework established by the amendments to 3.1 and 4 bis, which determined that a construction project of approximately 500 m2 entails earthworks of approximately 200 m2, which does not pose significant risks.
This Chamber observes that Decreto N° 31849-MINAE required an environmental assessment (evaluación ambiental) for land modification (modificación del terreno) and earthworks (movimientos de tierra) involving less than 200 metros cúbicos. In the case of the construction and operation of buildings in urban areas, it exempted single-family dwellings and buildings smaller than 300 metros cuadrados from environmental assessment; and it required environmental assessment for all construction of industrial and storage buildings not directly related to the operation. In other words, in all these cases, the challenged decree reduces the level of environmental protection compared with that established by the amended regulation. However, that in itself is not unconstitutional. Determining the cases in which an environmental assessment is or is not required is a matter governed by statutes and regulations, under the general criterion that the human activities that must undergo environmental assessment are those that alter the environment to a sufficiently significant degree to make such an assessment necessary. It falls to the ordinary courts to examine the technical and scientific basis relied upon by the challenged decree in making those amendments. Accordingly, as to the claim that Anexo 2 of the challenged Regulations is unconstitutional, the action must be dismissed.
X.CONCLUSIONS.-
The parties are hereby advised that if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be collected from the court office within a maximum period of 30 business days following notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.
Por tanto:

*130084780007CO* Res: No. 2017-005994 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las once horas y cero minutos de veintiséis de abril de dos mil diecisiete.
Acción de inconstitucionalidad promovida por Allan Astorga Gättgens, portador de la cédula de identidad No. 3-0252-0451, y Álvaro Sagot Rodríguez, portador de la cédula de identidad No. 02-0365-0227, para que se declare inconstitucional el inciso 4) del artículo 3, el artículo 4 bis, el artículo 13, el inciso 1) del artículo 46 y el anexo 2, todos del Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), Decreto Ejecutivo No. 31849-MINAE-S-MOPT-MAG-MEIC de 24 de mayo de 2004, según adición y modificación efectuada por medio del Decreto Ejecutivo No. 37803-MINAE-S-MOPT-MAG-MEIC, de 17 de julio de 2013 por estimarlos contrario a un ambiente sano y ecológicamente equilibrado, así como por irrespetar los principios de no regresión en materia ambiental, de progresividad, objetivación, proporcionalidad, desarrollo sustentable y precautorio. Intervinieron también en el proceso el representante de la Procuraduría General de la República, los representantes del Ministerio de Ambiente y Energía y la Secretaría General de la Secretaría Técnica Nacional Ambiental.
RESULTANDO:
Redacta el Magistrado Cruz Castro; y,
CONSIDERANDO:
I.OBJETO DE LA IMPUGNACIÓN.- Los accionantes indican que impugnan todas las modificaciones realizadas al Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental EIA (Decreto Ejecutivo No. 31849-MINAE-S-MOPT-MAG-MEIC de 24 de mayo de 2004), efectuadas por medio del Decreto Ejecutivo No. 37803-MINAE-S-MOPT-MAG-MEIC, de 17 de julio de 2013. Sin embargo, conforme a la resolución de curso, se tienen como impugnados únicamente los artículos 3 inciso 4), 4 bis, 13, 46 inciso 1) y anexo 2 del Reglamento mencionado. Los cuales disponen:
“Artículo 3º —Definiciones y abreviaciones. Para los efectos del presente reglamento se utilizan las siguientes definiciones y abreviaciones:
(…)
4. Actividades de Muy bajo impacto ambiental potencial, se refiere a las actividades humanas que, por su naturaleza no provocan alteración negativa del ambiente y que no representan una desmejora de la calidad ambiental del entorno en general o de alguno de sus componentes, ni afectación a la salud de la población, debido a que las emisiones atmosféricas, vertidos de aguas residuales, manejo de residuos ordinarios y especiales y ruido se ajustan a las disposiciones establecidas en la regulación vigente. Además, no se utilizan productos peligrosos y no generan residuos de este tipo.” “Artículo 4° bis. – Actividades, obras o proyectos que por su naturaleza no requieren EIA ante la SETENA Las actividades, obras o proyectos de muy bajo impacto ambiental, descritos a continuación, no deberán tramitar ante la SETENA una Evaluación de Impacto Ambiental (EIA), sin embargo, estarán sujetas a los controles ambientales establecidos por las Municipalidades, el Ministerio de Salud, el Ministerio de Agricultura y Ganadería, el Ministerio de Obras públicas y Transportes y el Ministerio de Ambiente y Energía y otras con competencias legales; así como con lo establecido en el Código de Buenas Prácticas Ambientales, Decreto Ejecutivo N° 32079 del 14 de setiembre del 2004, publicado en La Gaceta 217 del 5 de noviembre del 2004, o con cualquier mecanismo voluntario para mejorar el desempeño ambiental:
1. Las actividades en operación que requieran renovar sus permisos ante otras autoridades de la administración pública, como el Ministerio de Salud, el Ministerio de Agricultura y Ganadería y las Municipalidades entre otros.
2. Las actividades, obras o proyectos de mejora, reconstrucción y reparación, que se ejecuten en infraestructura pública o privada y las obras menores definidas en las disposiciones Municipales, siempre y cuando no se encuentren localizadas en un área ambientalmente frágil, no impliquen obras constructivas mayores a los 500 m² o movimientos de tierra superiores a los 200 m³, ni manipulen, almacenen o trasieguen productos peligrosos.
3. La construcción y operación de edificaciones de menos de 500 m2 y los proyectos de construcción de edificios industriales y de almacenamiento cuando no tengan relación directa con su operación de menos de 1000 m2, siempre y cuando estas obras se ubiquen en un área con uso de suelo conforme a lo dispuesto en la planificación local y no se encuentren en un área ambientalmente frágil.” “Artículo 13.—Trámite de la actividad, obra o proyecto, categoría C. El trámite a cumplir por actividades, obras o proyectos de categoría C, es el siguiente:
1. Entrega, en original y 2 copias, de los requisitos indicados en el Artículo 12 anterior, en las oficinas de la SETENA o bien, en las oficinas de las Áreas de Salud del Ministerio de Salud o de la autoridad ambiental debidamente habilitada por la SETENA, donde se ubicará la actividad, obra o proyecto.
2. El encargado o funcionario designado de la SETENA o de la oficina del Área de Salud del Ministerio de Salud o de la autoridad ambiental debidamente habilitada por la SETENA, devolverá en el mismo acto, al desarrollador, la copia debidamente sellada, con la asignación del número de solicitud y el CBPA.
3. El encargado de la SETENA o de la oficina del Área de Salud del Ministerio de Salud o de la autoridad ambiental debidamente habilitada por la SETENA, levantará diariamente una lista de todas las actividades, obras o proyectos recibidos.
4. Una vez levantada la lista, si la recepción de los documentos no fuere en las oficinas de la SETENA, el encargado o funcionario designado del Área de Salud del Ministerio de Salud o de la autoridad ambiental debidamente habilitada por la SETENA, en un plazo no mayor de 5 días hábiles, remitirá a la SETENA, por los medios más expeditos disponibles, copia del D2 con sus anexos. El desarrollador tendrá la potestad de enviar a la SETENA, vía fax, el D2 con el correspondiente sello de recibido.
“Artículo 46.—Vigencia de la viabilidad (licencia) ambiental.
En caso de que durante el plazo de vigencia hayan ocurrido variantes evidentes en las condiciones exógenas que se evaluaron al momento de otorgar la viabilidad ambiental, la SETENA podrá solicitar de oficio al desarrollador interesado una actualización de los instrumentos de evaluación ambiental presentados o una certificación de que las condiciones ambientales que fueron evaluadas inicialmente en el proyecto no han variado con respecto a esas condiciones exógenas actuales y que se mantiene vigente la evaluación realizada. Esta certificación será emitida por el regente o un consultor competente con las disciplinas involucradas en la evaluación inicial y deberá presentarse en el plazo de 30 días hábiles, a partir de la notificación de dicha solicitud por parte de la SETENA. En caso de no presentar en el plazo indicado esta certificación, se aplicará lo dispuesto en el artículo 264 de la Ley General de Administración Pública.
La SETENA podrá realizar de oficio las gestiones que estime pertinentes para verificar si ha existido alguna variación de las condiciones exógenas. En caso de que, en los plazos establecidos, no se inicie la fase constructiva ni operativa de las actividades, obras o proyectos que cuenten con Viabilidad Ambiental el desarrollador deberá requerir, de previo al vencimiento del plazo, una prórroga de su vigencia ante la SETENA con justificación de las razones válidas que motiven la solicitud, conforme con los requisitos señalados en el artículo 258 de la Ley General de la Administración Pública. Esta prórroga solo se otorgará si las condiciones exógenas no han variado.
Con la modificación introducida por el decreto impugnado y la resolución no.583-2008 de SETENA, la construcción de viviendas unipersonales, urbanizaciones y condominios menores a 500 metros cuadrados, al considerarse como de muy bajo impacto ambiental, no requieren la realización del trámite de evaluación de impacto ambiental (EIA). Así se está eximiendo de valoraciones ambientales, únicamente por el área del proyecto. Lo cual es contrario a lo dispuesto por esta Sala en el voto 2003-006311 cuando indica que: “… Un reglamento no puede, sin incurrir en exceso, introducir disposiciones que, con prescindencia del tipo de obra o proyecto concreto que desea realizar el particular, hagan exclusiones genéricas del estudio de impacto ambiental, pues tal proceder implicaría una desconstitucionalización –vía reglamento- de la obligación de vigilancia y tutela que debe cumplir el Estado en el campo ambiental.” Como se observa, esta acción tiene por objeto determinar si las modificaciones introducidas por el decreto ejecutivo número 37803 de 17 de julio de 2013 al decreto ejecutivo número 31849 de 24 de mayo de 2004, son inconstitucionales por violar los principios constitucionales contenidos en el artículo 50 constitucional.
II.SOBRE LA LEGITIMACIÓN DE LOS ACCIONANTES EN ESTE CASO.- El artículo 75 de la Ley de la Jurisdicción Constitucional regula los presupuestos que determinan la admisibilidad de las acciones de inconstitucionalidad, exigiendo la existencia de un asunto pendiente de resolver en sede administrativa o judicial en el que se invoque la inconstitucionalidad, requisito que no es necesario en los casos previstos en los párrafos segundo y tercero de ese artículo, es decir, cuando por la naturaleza de la norma no haya lesión individual o directa; cuando se fundamente en la defensa de intereses difusos o que atañen a la colectividad en su conjunto, o cuando sea presentada por el Procurador General de la República, el Contralor General de la República, el Fiscal General de la República o el Defensor de los Habitantes, en estos últimos casos, dentro de sus respectivas esferas competenciales. La posibilidad de acudir en defensa de "intereses difusos", que son aquellos cuya titularidad pertenece a grupos de personas no organizadas formalmente, pero unidas a partir de una determinada necesidad social, una característica física, su origen étnico, una determinada orientación personal o ideológica, el consumo de un cierto producto, etc. El interés, en estos casos, se encuentra difuminado, diluido (difuso) entre una pluralidad no identificada de sujetos.
Esta Sala ha enumerado diversos derechos a los que les ha dado el calificativo de "difusos", tales como el medio ambiente, el patrimonio cultural, la defensa de la integridad territorial del país, el buen manejo del gasto público, y el derecho a la salud, entre otros. Por otra parte, la enumeración que ha hecho la Sala Constitucional no es taxativa. A partir de lo dicho en el párrafo anterior, es claro que los actores ostentan legitimación suficiente para demandar la inconstitucionalidad de las normas impugnadas, sin que para ello resulte necesario que cuenten con un asunto previo que les sirva de base a esta acción. Lo anterior porque acuden en defensa de un interés difuso, como lo es el derecho al ambiente, por lo que los actores se encuentran perfectamente legitimados para accionar en forma directa, a la luz de lo que dispone el párrafo 2° del artículo 75 de la Ley de la Jurisdicción Constitucional.
Se trata, en efecto, de materia cuya constitucionalidad procede revisar en esta vía. Además, los actores cumplieron los requisitos estipulados en los numerales 78 y 79 de la Ley de rito. En conclusión, la presente acción es admisible, por lo que debe entrarse de inmediato a discutir el objeto y el fondo del asunto.
III.SOBRE LA METODOLOGÍA DE ANÁLISIS DE LA ACCIÓN.- Para facilitar el estudio de la normativa impugnada, antes de analizar cada uno de los argumentos expuestos por los accionantes, se procederá a precisar la relación entre el principio precautorio en materia ambiental, con los estudios de impacto ambiental y los alcances del principio de no regresión en material ambiental.
IV.EN GENERAL SOBRE LOS ESTUDIOS DE IMPACTO AMBIENTAL Y EL PRINCIPIO DE NO REGRESIÓN EN MATERIA AMBIENTAL, Y COMO NO TODA MODIFICACIÓN DE LA NORMATIVA AMBIENTAL DEBE TENERSE COMO VIOLATORIA DE TAL PRINCIPIO.- Antes de examinar cada uno de los argumentos de los accionantes, resulta necesario recordar la relevancia de los Estudios de Impacto Ambiental, y determinar, para este caso concreto de análisis, los alcances del principio de no regresión en materia ambiental, a efectos de concluir que no toda modificación de la normativa ambiental –como parece lo insinúan los accionantes- debe tenerse como violatoria de tal principio. Partiendo del reconocimiento del derecho a un ambiente sano y ecológicamente equilibrado, receptado en el artículo cincuenta de la Constitución Política y el principio número quince de la Declaración de Río, Conferencia de Naciones Unidas sobre el Medio Ambiente y el Desarrollo, tal como lo ha examinado esta Sala en jurisprudencia anterior (véase la resolución número 2014-004243), se ha reconocido igualmente el denominado «principio precautorio en materia ambiental» o «principio in dubio pro natura», cuya observancia implica que todas las actuaciones de la administración pública en temas sensibles al ambiente, sean realizadas con el celo adecuado para evitar riesgos y daños de imposible o difícil reparación.
De lo anterior resulta que la administración debe contar con una certeza de carácter negativo de que no se afectará el ambiente bajo ningún supuesto, de donde resulta que ante la duda del acaecimiento de un riesgo, la administración tiene la obligación de no autorizar o efectuar actuaciones, o cesar de inmediato, la actividad administrativa que causa el peligro. En otras palabras, si carece de certeza científica sobre la inocuidad de la actividad, la administración debe abstenerse de realizar actividades con impacto ambiental negativo; ante la incertidumbre científica sobre la inocuidad o bondad de las actuaciones, la administración está impedida para otorgar autorizaciones o realizar actos propios que originen situaciones de riesgo ambiental. En este sentido, la realización de Estudios de Impacto Ambiental se erige en un principio que debe ser debidamente observado y aplicado, al punto que de manera paulatina y progresiva como corresponde en el ámbito de los derechos humanos- la misma legislación y la propia jurisprudencia de esta Sala, ha perfilado la importancia y necesidad de contar con este tipo de evaluaciones debidamente realizadas de manera previa a la realización de determinado tipo de obras.
Ahora bien, en cuanto al principio de progresividad, que es alegado por los accionantes, en todas sus argumentaciones, véase lo establecido mediante el voto de esta Sala no.2012-013367, cuando se indica:
“V. Sobre los principios de progresividad y no regresión de la protección ambiental. El principio de progresividad de los derechos humanos ha sido reconocido por el Derecho Internacional de los Derechos Humanos; entre otros instrumentos internacionales, se encuentra recogido en los artículos 2 del Pacto Internacional de Derechos Económicos Sociales y Culturales, artículo 1 y 26 de la Convención Americana sobre Derechos Humanos y artículo 1 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en materia de Derechos Económicos, Sociales y Culturales. Al amparo de los estas normas, el Estado asume la obligación de ir aumentando, en la medida de sus posibilidades y desarrollo, los niveles de protección de los derechos humanos, de especial consideración aquellos, que como el derecho al ambiente (art. 11 del Protocolo), requieren de múltiples acciones positivas del Estado para su protección y pleno goce por todos sus titulares.
Del principio de progresividad de los derechos humanos y del principio de irretroactividad de las normas en perjuicio de derechos adquiridos y situaciones jurídicas consolidadas, recogido en el numeral 34 de la Carta Magna, se deriva el principio de no regresividad o de irreversibilidad de los beneficios o protección alcanzada. El principio se erige como garantía sustantiva de los derechos, en este caso, del derecho a un ambiente sano y ecológicamente equilibrado, en virtud del cual el Estado se ve obligado a no adoptar medidas, políticas, ni aprobar normas jurídicas que empeoren, sin justificación razonable y proporcionada, la situación de los derechos alcanzada hasta entonces. Este principio no supone una irreversibilidad absoluta pues todos los Estados viven situaciones nacionales, de naturaleza económica, política, social o por causa de la naturaleza, que impactan negativamente en los logros alcanzados hasta entonces y obliga a replantearse a la baja el nuevo nivel de protección.
En esos casos, el Derecho a la Constitución y los principios bajo examen obligan a justificar, a la luz de los parámetros constitucionales de razonabilidad y proporcionalidad, la reducción de los niveles de protección. En este sentido, la Sala Constitucional ha expresado en su jurisprudencia, a propósito del derecho a la salud: “…conforme al PRINCIPIO DE NO REGRESIVIDAD, está prohibido tomar medidas que disminuyan la protección de derechos fundamentales. Así entonces, si el Estado costarricense, en aras de proteger el derecho a la salud y el derecho a la vida, tiene una política de apertura al acceso a los medicamentos, no puede -y mucho menos por medio de un Tratado Internacional- reducir tal acceso y hacerlo más restringido, bajo la excusa de proteger al comercio. (Sentencia de la Sala Constitucional Nº 9469-07). En relación con el derecho al ambiente dijo: “Lo anterior constituye una interpretación evolutiva en la tutela del ambiente conforme al Derecho de la Constitución, que no admite una regresión en su perjuicio.” (Sentencia de la Sala Constitucional Nº 18702-10)...” De ahí que se pueda concluir que, no cualquier modificación de la normativa ambiental implica necesariamente una disminución de protección del derecho al ambiente.
Ello debe sustentarse. De igual forma, no toda modificación, que no sea lo suficientemente amplia, debe interpretarse como una inconstitucionalidad por omisión. Lo deseable no torna en inconstitucional a la norma que no se acerque a ello. En efecto, todas las normas jurídicas son perfectibles, pero el que se acerquen o alejen de un criterio de perfecto o deseable no las hace inconstitucionales. Con vista en lo anterior, es que se procede al examen de cada uno de los alegatos de los accionantes.
V.SOBRE EL ALEGATO DE INCONSTITUCIONALIDAD DEL ARTÍCULO 3 INCISO 4) DEL REGLAMENTO IMPUGNADO (DEFINICIÓN DE ACTIVIDADES DE MUY BAJO IMPACTO AMBIENTAL POTENCIAL).- El inciso 4) del artículo 3 fue adicionado al Reglamento impugnado mediante el decreto 37803 del 25 de junio del 2013, para incluir dentro de las definiciones a “las actividades de muy bajo impacto ambiental potencial”, tal como se observa en el cuadro adjunto:
Reglamento General sobre los procedimientos de evaluación de impacto ambiental (EIA) Decreto 31849 del 24 de mayo del 2004 Modificaciones Decreto 37803 del 25 de junio del 2013 Art.3 inciso 4).
“Artículo 3º— Definiciones y abreviaciones. Para los efectos del presente reglamento se utilizan las siguientes definiciones y abreviaciones:
(…) 4. Acreditación: Es el procedimiento por el cual la Administración Pública autoriza a personas físicas o jurídicas, públicas o privadas, que cumplen con los requisitos, jurídicos, técnicos y de idoneidad material y profesional exigidos en las normas vigentes, para ejecutar tareas específicas o proveer servicios específicos en el soporte total o parcial del cumplimiento de las obligaciones que impone el Estado.” Mediante el artículo 5° del decreto ejecutivo N° 37803 del 25 de junio del 2013 se ordena adicionar un inciso 4 al presente artículo, corriendo la numeración en uno de los incisos posteriores, cuyo texto sería:
"... 4. Actividades de Muy bajo impacto ambiental potencial, se refiere a las actividades humanas que, por su naturaleza no provocan alteración negativa del ambiente y que no representan una desmejora de la calidad ambiental del entorno en general o de alguno de sus componentes, ni afectación a la salud de la población, debido a que las emisiones atmosféricas, vertidos de aguas residuales, manejo de residuos ordinarios y especiales y ruido se ajustan a las disposiciones establecidas en la regulación vigente. Además, no se utilizan productos peligrosos y no generan residuos de este tipo...". No obstante mediante el decreto ejecutivo N° 38024 del 19 de noviembre del 2013 se ordena modificar el transitorio único único del decreto N° 37803 estableciéndose lo siguiente: "...
En criterio de los accionantes, la definición de las actividades de muy bajo impacto ambiental potencial, no es precisa y deja abierta a la discrecionalidad y subjetividad el que actividades de mayor impacto sean incluidas como tales, sin que se particularice una lista de cuáles son esas actividades. Además que, la carencia de una lista de actividades que se consideren como de muy bajo impacto ambiental potencial provoca la inconstitucionalidad de la definición contenida en el decreto impugnado en el tanto otorga a la Administración un amplio margen de discrecionalidad. Por su parte, la Procuraduría General de la República en su informe indica que lo que establece este artículo es una simple definición sin asociarle consecuencia jurídica alguna, de allí que, en sí misma, no es inconstitucional. Una eventual inconstitucional no radicaría en este artículo sino en aquél que le asocie una determinada consecuencia jurídica, según lo que esta sea.
La norma cuya valoración de constitucionalidad habría que hacer sería la que resulte de la asociación de lo que dispone este artículo y el que establezca una consecuencia jurídica en relación con la definición. Pero, el inciso 4) del artículo 3 del reglamento impugnado, en el tanto contiene una simple definición, no puede ser inconstitucional porque no es una expresión deóntica. El artículo impugnado no sólo no otorga discrecionalidad sino que sujeta a la Administración a una definición precisa de lo que deba entenderse por actividades de muy bajo impacto ambiental potencial, de modo tal que cualquier consecuencia jurídica que otro artículo asocie a dicha definición queda sujeta a dicho contenido. La definición es un concepto jurídico indeterminado que corresponde en última instancia al juez determinar. En consecuencia, no hay violación al principio de objetivación. Los representantes del Ministerio de Ambiente y de SETENA, al respecto indican que, la definición se ha aplicado al menos desde el año 2004, sin que haya representado una disminución de la capacidad de tutelar el ambiente o perjuicio para el administrado, tal norma lo único que hace es refrendar vía decreto una definición que ya existe y se venía aplicando. Además esa definición fue sometida a valoración del Ministerio de Salud.
En criterio de esta Sala, ciertamente no puede considerarse que una definición per se como la que se impugna, torne la norma inconstitucional. El artículo impugnado sujeta a la Administración a una definición de lo que deba entenderse por actividades de muy bajo impacto ambiental potencial, de modo tal que cualquier consecuencia jurídica que otro artículo asocie a dicha definición queda sujeta a dicho contenido. El hecho de que los accionantes consideren que más que una definición debió establecerse una lista de actividades que se consideren como de muy bajo impacto ambiental potencial, es una apreciación que no provoca la inconstitucionalidad de la definición contenida en el decreto impugnado ni tampoco una inconstitucionalidad por omisión, pues no se desprende del Derecho de la Constitución que deba existir tal lista, de forma predeterminada. Así entonces , en cuanto al alegato de inconstitucionalidad del inciso 4 del artículo 3 del Reglamento impugnado, se debe declarar sin lugar la acción.
VI.SOBRE EL ALEGATO DE INCONSTITUCIONALIDAD DEL ARTÍCULO 4 BIS DEL REGLAMENTO IMPUGNADO (ACTIVIDADES, OBRAS O PROYECTOS QUE POR SU NATURALEZA NO REQUIEREN EIA ANTE SETENA).- El artículo 4 bis fue adicionado al Reglamento impugnado mediante el decreto 37803 del 25 de junio del 2013, para incluir “Actividades, obras o proyectos que por su naturaleza no requieren EIA ante SETENA”, tal como se observa en el cuadro adjunto:
Reglamento General sobre los procedimientos de evaluación de impacto ambiental (EIA) Decreto 31849 del 24 de mayo del 2004 Modificaciones Decreto 37803 del 25 de junio del 2013 Artículo 4 Artículo 4º—Actividades, obras o proyectos sujetos a la EIA. Las actividades, obras o proyectos nuevos, que están sujetos a trámite de obtención de viabilidad (licencia) ambiental ante la SETENA , según el artículo 17 de la Ley Orgánica del Ambiente, se dividen en:
1. Aquellas actividades, obras o proyectos para los cuales existe una ley específica que ordena el cumplimiento del trámite. El Anexo Nº 1, que forma parte integral de este reglamento, enumera estas actividades, obras o proyectos.
2. Las demás actividades, obras o proyectos no incluidos en el Anexo Nº 1 del párrafo anterior, aparecen ordenados en la categorización general que se presenta en el Anexo Nº 2 de este reglamento.
Mediante el artículo 6° del decreto ejecutivo N° 37803 del 25 de junio del 2013 se ordena adicionar un artículo 4 bis al presente reglamento, cuyo texto sería:
"... Artículo 4° bis. - Actividades, obras o proyectos que por su naturaleza no requieren EIA ante la SETENA Las actividades, obras o proyectos de muy bajo impacto ambiental, descritos a continuación, no deberán tramitar ante la SETENA una Evaluación de Impacto Ambiental (EIA), sin embargo, estarán sujetas a los controles ambientales establecidos por las Municipalidades, el Ministerio de Salud, el Ministerio de Agricultura y Ganadería, el Ministerio de Obras públicas y Transportes y el Ministerio de Ambiente y Energía y otras con competencias legales; así como con lo establecido en el Código de Buenas Prácticas Ambientales, Decreto Ejecutivo N° 32079 del 14 de setiembre del 2004, publicado en La Gaceta 217 del 5 de noviembre del 2004, o con cualquier mecanismo voluntario para mejorar el desempeño ambiental:
1. Las actividades en operación que requieran renovar sus permisos ante otras autoridades de la administración pública, como el Ministerio de Salud, el Ministerio de Agricultura y Ganadería y las Municipalidades entre otros.
2. Las actividades, obras o proyectos de mejora, reconstrucción y reparación, que se ejecuten en infraestructura pública o privada y las obras menores definidas en las disposiciones Municipales, siempre y cuando no se encuentren localizadas en un área ambientalmente frágil, no impliquen obras constructivas mayores a los 500 m² o movimientos de tierra superiores a los 200 m³ , ni manipulen, almacenen o trasieguen productos peligrosos.
3. La construcción y operación de edificaciones de menos de 500 m2 y los proyectos de construcción de edificios industriales y de almacenamiento cuando no tengan relación directa con su operación de menos de 1000 m2 , siempre y cuando estas obras se ubiquen en un área con uso de suelo conforme a lo dispuesto en la planificación local y no se encuentren en un área ambientalmente frágil...".
En criterio de los accionantes, las actividades descritas como de muy bajo impacto ambiental en el artículo 4 bis no cumplen esa categoría y el hecho de que sean eximidas del trámite de evaluación de impacto ambiental (EIA) debilita la eficiencia del instrumento para prevenir daños ambientales. Consideran que resulta absolutamente ilógico e inconsistente con la realidad que una actividad de operación sea considerada de “muy bajo impacto ambiental”, independientemente de su tamaño, actividad productiva que realiza, condición de generación de contaminación ambiental y el grado de fragilidad ambiental del sitio donde se localiza, por el simple hecho de que se tramitan permisos ante otras entidades diferentes a la Secretaría Técnica Nacional Ambiental, las cuales, argumentan, no tienen un alcance de evaluación de impacto ambiental amplio. Por su parte, en su informe la Procuraduría General de la República considera que, lo dispuesto en tal norma resulta inconstitucional en cuanto excluye toda actividad que ya está en operación, pues ello significa que quedarían fuera del control ambiental que ejerce la SETENA actividades que de estarse iniciado hoy en día deberían ser evaluadas ambientalmente.
Esta circunstancia implica de por sí la ausencia de cualquier criterio técnico y científico para eximirlas del control ambiental que ejerce la SETENA lo cual, además de contravenir expresamente lo que establece el artículo 17 de la LOA, violenta el principio preventivo contenido en el artículo 50 constitucional, según lo señalado por este Tribunal Constitucional en profuso y reiterada jurisprudencia (vid., entre otras, las sentencia números 2003-6311 de 3 de julio de 2003 y 2008-015760 del 22 de octubre de 2008), siendo lo que corresponde en estos casos, sería un estudio de diagnóstico ambiental (EDA), de conformidad con lo que esta Sala ha señalado en su jurisprudencia (vid, sentencias números 2003-006324 del 4 de julio del 2003 y 2004-04949 de 6 de mayo de 2004). Los representantes del Ministerio de Ambiente y de SETENA, al respecto indican que, la evaluación de impacto ambiental es un instrumento predictivo, que no debe aplicarse a actividades en operación, pues lo que busca es anticipar, así que no es factible, como lo pretenden los accionantes, que se le exija una evaluación de impacto ambiental a actividades en operación.
En criterio de esta Sala se debe hacer la siguiente distinción, respecto de las actividades excluidas, por un lado las indicadas en el inciso 1) y por otro lado, las excluidas en el resto de incisos. Ello por cuanto los argumentos de los accionantes se dirigen particularmente a la impugnación del inciso 1). Encontrándose necesario realizar la siguiente aclaración, debido a lo indicado por la Procuraduría General de la República en su informe. Dicho inciso debe entenderse en concordancia con lo establecido en el párrafo primero de dicho artículo, es decir, se trata de actividades en operación de muy bajo impacto ambiental, que ciertamente no requieren –según la norma- tramitar ante la SETENA una Evaluación de Impacto Ambiental (EIA), pero que, sin embargo, estarán sujetas a otros controles ambientales –como la misma norma indica- tales como los establecidos por las Municipalidades, el Ministerio de Salud, el Ministerio de Agricultura y Ganadería, el Ministerio de Obras públicas y Transportes y el Ministerio de Ambiente y Energía y otras con competencias legales; así como con lo establecido en el Código de Buenas Prácticas Ambientales, Decreto Ejecutivo N° 32079 del 14 de setiembre del 2004, publicado en La Gaceta 217 del 5 de noviembre del 2004, o con cualquier mecanismo voluntario para mejorar el desempeño ambiental.
Así que la misma norma es la que establece que, aunque no requieran de un EIA ello no significa que queden excluidas de control ambiental. Nótese que los accionantes confunden la definición, no es que por el hecho de ser actividades en operación ello las haga de muy bajo impacto ambiental, sino que, el inciso no se refiere a cualquier tipo de actividad en operación, sino únicamente a aquellas actividades en operación definidas como de muy bajo impacto ambiental. Así entonces, en cuanto al alegato de inconstitucionalidad del artículo 4 bis del Reglamento impugnado, se debe declarar sin lugar la acción en cuanto al inciso 1 de tal norma.
VII.SOBRE EL ALEGATO DE INCONSTITUCIONALIDAD DEL INCISO 5 DEL ARTÍCULO 13 DEL REGLAMENTO IMPUGNADO (CARENCIA DE CARTOGRAFÍA).- El inciso 5) del artículo 13 del Reglamento impugnado fue reformado, tal como se observa en el cuadro adjunto:
Reglamento General sobre los procedimientos de evaluación de impacto ambiental (EIA) Decreto 31849 del 24 de mayo del 2004 Modificaciones Decreto 37803 del 25 de junio del 2013 Artículo 13 Artículo 13.-Trámite de la actividad, obra o proyecto, categoría C. El trámite a cumplir por actividades, obras o proyectos de categoría C, es el siguiente:
(…)
5. Una vez recibido el D2, la SETENA , por medio del departamento respectivo, revisará la documentación. De no existir errores u omisiones en este documento (D2), momento en el cual se le otorga la viabilidad ambiental. Debe quedar claro al desarrollador que obtendrá tal viabilidad ambiental, en tanto la SETENA , en un plazo máximo de 10 días, contados a partir del momento en que ésta recibe la documentación, no le comunique oficialmente que debe realizar correcciones o aclaraciones, o presentar lo indicado en el Artículo 9 inciso a), cuando la categoría de la actividad, obra o proyecto no corresponde a C. En el caso de que no haya comunicación, el desarrollador deberá verificar, después de transcurridos los plazos indicados, que su actividad, obra o proyecto se encuentre en el registro oficial de la SETENA de proyectos con Viabilidad Ambiental otorgada, a fin de que utilice su número de registro para el trámite de permisos ante otras autoridades. Mediante el artículo 2° del decreto ejecutivo N° 37803 del 25 de junio del 2013 se ordena reformar el inciso 5) del presente artículo, cuyo texto sería:
"... 5.- Una vez recibido el D2, la SETENA , por medio del Departamento respectivo, registrará mediante el uso de herramientas de los Sistemas de Información Geográfica (SIG), la localización espacial del proyecto, revisará toda la documentación asociada al D2, en un plazo no mayor a diez días hábiles. De no existir errores u omisiones en este documento (D2), procederá a otorgar la viabilidad ambiental, e incluir la actividad en el registro oficial de la SETENA de proyectos con viabilidad otorgadas, lo cual será notificado al Desarrollador por el medio señalado para recibir notificaciones. De existir observaciones o aclaraciones, la SETENA realizará una prevención al desarrollador, por una única vez y por escrito para su cumplimiento, para lo cual le dará un plazo no mayor de diez días hábiles para que complete la información; en caso de no subsanar en el plazo indicado se archivará el expediente. La prevención indicada suspende el plazo de resolución de la Administración ; una vez transcurrido éste, continuará el cómputo del plazo restante previsto para resolver...".
En criterio de los accionantes, la inclusión de la localización espacial de los proyectos, obras o actividades que presentan el Formulario D2 en un Sistema de Información Geográfico (SIG) no es suficiente para garantizar su sostenibilidad ambiental, pues esto no permite tener certeza si el mismo se encuentra en alguna de las áreas ambientalmente frágiles establecidas y el sistema de información geográfico (SIG) utilizado no contiene una cartografía adecuada en el cual consten dichas áreas a una escala que permita apreciar detalles (1:10.000). Todo lo cual quebranta el principio precautorio y lo dispuesto en los artículos 21, 50 y 89 constitucionales. Por su parte, la Procuraduría General de la República en su informe indica que, este es un aspecto técnico, relativo a la metodología e instrumentos adecuados para ubicar los terrenos en relación con áreas ambientalmente frágiles, cuya valoración no corresponde a esta jurisdicción.
La utilización de una cartografía como la sugerida es una decisión técnica que corresponde a la Administración. La norma, cuya inconstitucionalidad se alega, establece un medio e instrumento para localizar especialmente los terrenos donde se van a llevar a cabo los proyectos sujetos a valoración ambiental. Lo cual representa una mejora en relación con la situación anterior a la reforma impugnada. Los representantes del Ministerio de Ambiente y de SETENA, al respecto indican que, anular esta norma más bien habría una regresión ambiental, es cierto que las áreas ambientalmente frágiles no están identificadas para todo el país, y que las que están identificadas es posible que no estén levantadas a escalas de mayor detalle, pero la información con que cuenta la SETENA es la que ha sido entregada por las instituciones como oficiales, y no es función de la SETENA generar o corregir dicha información.
Esta Sala observa que, el alegato de inconstitucionalidad de los accionantes, no es por lo que la norma dice, sino por lo que no dice. Es decir, se trata de un alegato de inconstitucionalidad por omisión, pues en criterio de los accionantes lo allí dispuesto resulta insuficiente. Se constata que estamos ante un aspecto técnico relacionado con la metodología y los instrumentos adecuados para ubicar los terrenos en relación con las áreas ambientalmente frágiles, cuya precisión o valoración no sólo no corresponde a esta jurisdicción constitucional, sino que, no se desprende del Derecho de la Constitución un determinado sistema de información geográfico. La utilización de una cartografía como la que sugieren los accionantes es una decisión técnica que corresponde a la Administración tomar. Correspondiendo comprobarse, si acaso, en la vía de amparo, si en un determinado caso, dicha decisión técnica no protegió algún área ambientalmente frágil.
Tal como lo indica en su informe la Procuraduría, la norma establece un medio y un instrumento -la utilización de un SIG- para localizar espacialmente los terrenos donde se van a llevar a cabo los proyectos sujetos a valoración ambiental, lo cual, en sí mismo, es una mejora con respecto a la situación anterior a la reforma que se impugna. De allí que carezca de sentido disponer la inconstitucionalidad del inciso 5 del artículo 13 del decreto ejecutivo número 31849, sea para anularlo o sea para indicar cuál es el instrumento que se debe utilizar. Sobre esto último, ordenar a la SETENA la confección o utilización de una cartografía que contenga las áreas ambientalmente frágiles -si no lo hace ya- implica tomar una decisión administrativa de contenido claramente técnico, lo que no corresponde a esta Sala Constitucional. Así entonces, en cuanto al alegato de inconstitucionalidad del artículo 13 inciso 5) del Reglamento impugnado, se debe declarar sin lugar la acción.
VIII.SOBRE EL ALEGATO DE INCONSTITUCIONALIDAD DEL INCISO 1) DEL ARTÍCULO 46 DEL REGLAMENTO IMPUGNADO (AMPLIACIÓN DE LA VIGENCIA DE LA VIABILIDAD AMBIENTAL.-).- La reforma al artículo 46 del Reglamento impugnado establece variaciones en la vigencia de la vialidad ambiental. Básicamente se amplia la vigencia de las viabilidades ambientales de 2 a 5 años, tal como se observa en el cuadro adjunto:
Reglamento General sobre los procedimientos de evaluación de impacto ambiental (EIA) Decreto 31849 del 24 de mayo del 2004 Modificaciones Decreto 37803 del 25 de junio del 2013 Artículo 46.—Vigencia de la viabilidad (licencia) ambiental.
(Así reformado el inciso anterior por el artículo 7° del Decreto Ejecutivo N° 32734 del 09 de agosto de 2005).
2. Las actividades, obras o proyectos que se encuentren en operación, y cuenten con EIA aprobado estarán sujetos, conforme a lo que establece la Ley Orgánica del Ambiente y el presente reglamento, a un proceso de control y seguimiento ambiental en los términos establecidos en el presente reglamento.
(*)3. Las actividades, obras o proyectos que se encuentren en operación y que cuente con EIA aprobado, y para los cuales, como producto de su desarrollo deba realizarse un ajuste al diseño original, podrán mantener su viabilidad (licencia) ambiental ya otorgada, siempre y cuando se ajusten a los siguientes términos:
a. Que se presente un informe técnico ambiental, elaborado por un consultor ambiental responsable, de Readecuación Ambiental del Diseño Original, según el formato que la SETENA defina.
b. Que el ajuste del diseño, no implique cambios sustanciales al diseño original, es decir que tales cambios, no impliquen una modificación de la categoría de Impacto Ambiental Potencial (IAP), aprobado por la SETENA en el proyecto original, tales como el cambio de la actividad, obra o proyecto, cambio del sitio de ubicación del área de proyecto y que el proceso productivo planteado sea similar al que originalmente se planteó.
c. Que se haga una comparación de los impactos ambientales evaluados y sus medidas y una ampliación necesaria de los mismos, cuando así sea requerido, de forma tal que el proyecto, obra o actividad, mantenga el estatus de equilibrio ambiental que se le otorgó durante la evaluación de impacto ambiental. Además, deberá realizarse el ajuste al Pronóstico Plan de Gestión cuando técnicamente se justifique, con las medidas ambientales producto de dicho análisis.
La verificación del cambio de estas condiciones será avalada por la Secretaría General con base en una resolución administrativa, en un plazo máximo de diez días hábiles, a efecto de mantener la vigencia de la Licencia Ambiental.
Mediante el artículo 3° del decreto ejecutivo N° 37803 del 25 de junio del 2013 se ordena reformar el presente artículo, cuyo texto sería:
"... Artículo 46.-Vigencia de la viabilidad (licencia) ambiental.
En caso de que durante el plazo de vigencia hayan ocurrido variantes evidentes en las condiciones exógenas que se evaluaron al momento de otorgar la viabilidad ambiental, la SETENA podrá solicitar de oficio al desarrollador interesado una actualización de los instrumentos de evaluación ambiental presentados o una certificación de que las condiciones ambientales que fueron evaluadas inicialmente en el proyecto no han variado con respecto a esas condiciones exógenas actuales y que se mantiene vigente la evaluación realizada. Esta certificación será emitida por el regente o un consultor competente con las disciplinas involucradas en la evaluación inicial y deberá presentarse en el plazo de 30 días hábiles, a partir de la notificación de dicha solicitud por parte de la SETENA. En caso de no presentar en el plazo indicado esta certificación, se aplicará lo dispuesto en el artículo 264 de la Ley General de Administración Pública.
La SETENA podrá realizar de oficio las gestiones que estime pertinentes para verificar si ha existido alguna variación de las condiciones exógenas. En caso de que, en los plazos establecidos, no se inicie la fase constructiva ni operativa de las actividades, obras o proyectos que cuenten con Viabilidad Ambiental el desarrollador deberá requerir, de previo al vencimiento del plazo, una prórroga de su vigencia ante la SETENA con justificación de las razones válidas que motiven la solicitud, conforme con los requisitos señalados en el artículo 258 de la Ley General de la Administración Pública. Esta prórroga solo se otorgará si las condiciones exógenas no han variado.
La modificación en el tiempo de las circunstancias de una determinada actividad que ya tiene viabilidad ambiental puede ser muy distinta según el tipo de actividad. Es decir, para muchas actividades una ampliación en tres años puede no significar una disminución en el nivel de tutela. El problema es que este es un tema que requiere de información técnica y científica que permita determinar hasta qué punto esta ampliación puede dar lugar a una disminución en el nivel de protección, de la cual se carece en este proceso. Los recurrentes no aportan elementos técnicos o científicos que por lo menos hagan pensar que la ampliación de la vigencia de la viabilidad ambiental en tres años sea desproporcionada o irracional. En consecuencia, es opinión de ese órgano asesor que la reforma introducida por el artículo 3.1 del decreto ejecutivo número 37803, ampliando la vigencia de las viabilidades ambientales, no es en sí misma violatoria del principio de no regresión, pues no hay elementos técnicos ni científicos que permitan establecer que con ello se disminuye el nivel de tutela ambiental, y porque tampoco haya elementos que indique que se trata de una medida desproporcionada e irracional.
Los representantes del Ministerio de Ambiente y de SETENA, al respecto indican que, el plazo de dos años era insuficiente para que un desarrollador pudiera iniciar las actividades, por lo que se amplía a cinco años, sin que ocurra una disminución en la protección ambiental.
Para esta Sala, la Procuraduría lleva razón en su informe, ciertamente se observa que la reforma introducida amplía el plazo de la viabilidad ambiental de dos a cinco años. Sin embargo, de ese simple hecho no puede llegar a concluirse que ello constituya per se una disminución del nivel de tutela ambiental. Además, los accionantes no aportan más que valoraciones, que no contienen elementos técnicos o científicos, que concluyan que la ampliación de la vigencia de la viabilidad ambiental en tres años sea desproporcionada o irracional. Así entonces , en cuanto al alegato de inconstitucionalidad del artículo 46 inciso 1) del Reglamento impugnado, se debe declarar sin lugar la acción.
IX.SOBRE EL ALEGATO DE INCONSTITUCIONALIDAD DEL ANEXO 2 (EXCLUIDOS DE EIA A CONSTRUCCIONES MENORES DE 500 M2).- El artículo 4 del decreto impugnado modificó las descripciones de la División F.45 del Anexo 2 del decreto número 31849. En lo que tiene que ver con la modificación del terreno y los movimientos de tierra eximió de una evaluación ambiental a aquellos menores de 200 metros cúbicos. En lo que tiene que ver con la construcción y operación de edificaciones eximió de una evaluación ambiental a aquellas menores a 500 metros cuadrados; y, en el caso de los edificios industriales y de almacenamiento no directamente relacionados con la operación, eximió de evaluación ambiental los menores a 1.000 metros cuadrados. En criterio de los accionantes, la construcción de viviendas unipersonales, urbanizaciones y condominios menores a 500 metros cuadrados, al considerarse como de muy bajo impacto ambiental, no requieren la realización del trámite de evaluación de impacto ambiental (EIA).
Así se está eximiendo de valoraciones ambientales, únicamente por el área del proyecto. Por su parte, la Procuraduría General de la República indica que si bien el Poder Ejecutivo tiene la potestad para hacer las anteriores modificaciones, estas deben estar técnica y científicamente fundamentadas y cumplir con los parámetros de proporcionalidad y razonabilidad. Esto significa que la Sala Constitucional debe valorar la fundamentación técnica y científica, así como la razonabilidad y proporcionalidad, de la decisión adoptada con la modificación introducida por el artículo 4. Como parte de esta valoración, sobre todo en sus aspectos técnicos y científicos, está el considerar si las modificaciones hechas por el artículo 4 del decreto impugnado pueden darse al margen del tipo de terreno. En este sentido, la Sala Constitucional debe valorar si el proceso de control de constitucionalidad es el más adecuado para ello o si este tema debe analizarse en la vía ordinaria.
Los representantes del Ministerio de Ambiente y de SETENA, al respecto indican que, los cambios en el anexo se realizan en concordancia con lo establecido en el marco de la modificación del 3.1 y 4 bis, donde se determinó que un proyecto constructivo de alrededor de 500 m2 conlleva un movimiento de tierras aproximado de 200 m2, lo cual no representa mayores riesgos.
Esta Sala observa que, el decreto 31849 exigía una evaluación ambiental para la modificación del terreno y movimientos de tierra menores a 200 metros cúbicos. En el caso de las construcciones y operación de edificaciones en zonas urbanas, exceptuaba de la evaluación ambiental a las viviendas unifamiliares y las edificaciones menores a 300 metros cuadrados; y, exigía evaluación ambiental para las todas construcciones de edificios industriales y de almacenamiento que no tienen relación directa con la operación. Es decir, que en todos estos casos el decreto impugnado reduce el nivel de tutela ambiental en comparación con lo que establecía la regulación modificada. Sin embargo, ello en sí mismo no es inconstitucional. La determinación de en qué casos procede o no una evaluación ambiental es una cuestión determinada por las leyes y los reglamentos, bajo el criterio general de que las actividades humanas que deben ser evaluadas ambientalmente son aquellas que alteran el ambiente en un grado significativo como para que dicha evaluación sea necesaria. Correspondiéndole a la vía ordinaria, examinar el sustento técnico y científico que el decreto impugnado utilizó para proceder con dichas modificaciones. Así entonces, en cuanto al alegato de inconstitucionalidad del anexo 2 del Reglamento impugnado, se debe declarar sin lugar la acción.
X.CONCLUSIONES.-
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara SIN lugar la acción.
