SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at eighteen hours and five minutes on diez de mayo del dos mil once.

Amparo action (recurso de amparo) filed by FERMINA MARCELENDA BARBOZA CASTRO, identity card number 0101650750, against the MINISTERIO DE SALUD, the MUNICIPALIDAD DE DESAMPARADOS, and RICARDO RODRÍGUEZ ZÚÑIGA.

Findings:

  1. 1In a brief filed with the Secretariat of the Chamber on 24 de marzo de 2011, the petitioner filed an amparo action against Ricardo Rodríguez Zúñiga, a private-law party, stating that she resides in San Rafael Abajo, Desamparados, adjacent to the Concepción de Alajuelita bus depot, located beside the Shell Service Station. She explains that her property borders an irrigation ditch (acequia), and that when the owner of the adjoining property, Ricardo Rodríguez Zúñiga, acquired it, he told her that he would install piping in the irrigation ditch and place inspection boxes to collect the water flowing into it; however, he has taken no action whatsoever. She states that the respondent diverted the river channel (cauce del río) to gain more space, which has affected her because it destabilizes the land and damages what she has planted, since there is nothing to support the fence she had. She alleges that she sought assistance from the Municipalidad, the Delegación Policial, and the Ministerio de Salud, but the situation has not been resolved.She states that there are foul odors, rats, and insects, and that the water is stagnant, yet no action is being taken to address the problem. She adds that the road in front of her house, which the buses use to exit, is in poor condition and the respondent has not performed the corresponding repairs, which harms the older adults living in her home because of the dust produced. She considers her fundamental rights to have been violated. She requests that the action be granted, with the consequences established by law.
  2. 2Ricardo Rodríguez Zúñiga reports under oath that he is not the owner of the property adjoining the petitioner’s property; rather, it belongs to Sociedad Inversiones Diamo S.A., of which he is a shareholder and representative. He states that it is not true that he offered to install piping in the irrigation ditch for the petitioner, and believes that she may not even know whether a private individual can do so without the involvement of the public authorities. He considers that installing piping in the irrigation ditch would indeed be an appropriate solution to the problems troubling the petitioner; however, he states that these problems are not caused by the company he represents, because the water arrives already contaminated and carries garbage and debris. He states that the competent authorities should ideally install pipes or culverts so that the irrigation ditch is placed underground, with the necessary measures to prevent blockages.He states that it is not true that he changed the course of any river, and that neither he nor Inversiones Diamo S.A. uses the irrigation ditch channel for drainage or any other purpose, except for natural runoff (escorrentía), whereas it has been established that the petitioner uses the irrigation ditch channel to drain her property. Regarding the nuisance alleged by the petitioner due to the condition of the road in front of her house, he maintains that it is false that the road is in poor condition, because the access road is surfaced with gravel but is very well compacted, and that if the competent authorities were to determine that use of that access road causes any harm or nuisance to the petitioner, he or the entities he represents would adopt the necessary measures.
  3. 3Carol Jiménez González, in her capacity as Acting Director of the Área Rectora de Salud de Desamparados, reports under oath that on 11 de diciembre de 2003, the Alcaldesa Municipal de Desamparados sent Dr. Nidia Amador Brenes official letter OF-AM-01-686-03, attaching other related official letters indicating that an erosion process had been confirmed on the Barboza family’s land due to the enlargement and expansion of the adjoining stream channel, and that there was no indication or record that works had been performed to divert or straighten the stream. She adds that the aforementioned official letter, in another official letter attached to it, stated that various types of waste originating upstream could be seen being carried through the irrigation ditch and that there was no indication that the land had been altered by machinery; therefore, it could not be determined whether the channel had been altered.She states that on 1 de marzo de 2004, through official letter DASD-MS-013-04, Dr. Amador Brenes provided the petitioner with report OF UTGV Nº 01-214-03, signed by the Director of the Unidad Técnica de Gestión Vial. She states that on 13 de junio de 2007, a field inspection was conducted at the petitioner’s residence, during which a dye test for wastewater (aguas servidas) was performed, and health order (orden sanitaria) Nº ARSD-UPAH-NHG-049-2007 was issued, directing that the wastewater from Señora Barboza’s residence be disposed of properly and hygienically because it flowed directly onto the neighboring property. She reports that on 1 de abril de 2011, accompanied by another official, she conducted a field inspection in response to this action, issued report ARSD-ING-MSV-023-2011, and verified that the irrigation ditch contained a large quantity of garbage and waste originating upstream and resulting from the illegal discharge of water by residents living along the irrigation ditch.In addition, erosion was observed on the land, apparently resulting from the channel’s natural behavior, and it was confirmed that Señora Barboza’s wastewater was discharged directly into the irrigation ditch. She states that it was not possible to establish that the erosion had been caused by modifications to the course of the irrigation ditch, and that much of the garbage and waste had been carried there by the water. She explains that several residents, including the petitioner, discharge their sewage (aguas residuales) into the channel, and denies, in this regard, that it is attributable to Señor Rodríguez Zúñiga. She considers that this Área Rectora de Salud has taken the necessary administrative actions and requests that the action be denied.
  4. 4Maureen Fallas Fallas, in her capacity as Alcaldesa of the Municipalidad de Desamparados, reports under oath that the petitioner is mistaken in bringing this action against the entity she represents, since the documentation submitted by the petitioner herself shows that timely responses have been provided, dating back to the year 1997, and that as of this date no petition is on record, according to official letter Of.UTGV No. 283-2011 of 4 de enero de 2011. She considers it important to note that the documents submitted by the petitioner contain communications filed by Señora Marta Barboza Castro, which should not cause confusion because she is a different person. She maintains that official letter UIG-029-97 informed the petitioner of an inspection during which the construction of a wall 40 meters long, parallel to her western boundary, was confirmed, possibly for the purpose of supporting gravel fill for a proposed road or access to the Diamo S.A. property, as well as the installation of piping in the irrigation ditch, which was authorized by permit Nº 209 of 7 de febrero 1997.She clarifies that the irrigation ditch in question does not appear on the Abra map sheet, from which it is inferred that it may consist of wastewater. She adds that the petitioner’s most recent request was dated 10 de setiembre de 2009 and was answered through platform proceeding Nº 92429, informing her that no work or earthworks (movimiento de tierra) were observed at the time of the inspection. She considers that the municipal administration has not violated any fundamental right. She requests that the action be denied.

Magistrate Araya Garcia drafts the opinion; and,

Considering:

I.Subject matter of the action.- The petitioner alleges that her property borders an irrigation ditch that produces foul odors, rats, and insects, and that the water is stagnant; she further alleges that the neighbor diverted the channel to gain more space, which has affected her because it destabilized her land. Because of the foregoing, she sought assistance from the Municipalidad de Desamparados and the Ministerio de Salud, but the problem has not been resolved. In addition, the road in front of her house, which the buses use to exit, is in poor condition and he has not performed the corresponding repairs, which harms older adults.

II. Proven facts. The following facts are deemed duly established and relevant to the decision in this matter

  • a)In the years 2003 and 2007, the petitioner filed the respective complaints regarding the irrigation ditch problem with the Ministerio de Salud; the site was inspected, a response was provided to the petitioner, and a health order was issued against her directing her to dispose properly and hygienically of the wastewater from her residence that flows directly onto the neighboring property. (report of the respondent authority) b) On 10 de septiembre del 2009, the petitioner requested an inspection from the respondent Municipalidad, and on 26 de septiembre the petitioner collected the response. (report of the respondent authority) c) The petitioner’s property adjoins the right bank of an irrigation ditch, across from the property of Sociedad Inversiones Diamo S.A. (undisputed fact) d) Various types of waste originating upstream are carried through the irrigation ditch, and residents illegally discharge sewage (aguas negras) into it.

(see report No. ARSD-ING-MSV-023-2001 of 4 de abril de 2011 from the Área Rectora de Salud de Desamparados, submitted by the respondent authority) d) The petitioner discharges the wastewater from her residence directly into the irrigation ditch. (see report No. ARSD-ING-MSV-023-2001 of 4 de abril de 2011 from the Área Rectora de Salud de Desamparados, submitted by the respondent authority) e) A large quantity of garbage, debris, and waste is present at the petitioner’s residence. (see report No. ARSD-ING-MSV-023-2001 of 4 de abril de 2011 from the Área Rectora de Salud de Desamparados, submitted by the respondent authority) f) On 6 de abril de 20011, Ricardo Rodríguez was served with health order No. RSC-DARSD-CJG-092-11 and was granted 25 business days to complete the procedures and obtain the sanitary operating permit (permiso sanitario de funcionamiento) for the commercial establishment.

(documentation submitted by the respondent authority) g) On 6 de abril de 2011, the petitioner was served with health order No. RSD-DARSD-CG-093 and was granted 30 days to channel and discharge graywater (aguas grises) and stormwater (aguas pluviales) into the system authorized by the Ministerio de Salud, and to collect all the garbage at the residence. (report of the respondent authority) h) The emergency plans under Emergency Decrees No. 33373, 34805, 34045 did not include any flood impact on the petitioner’s property or any overflow of the adjoining irrigation ditch. (See official letter UTGVNo. 283-2011 of 4 de abril de 2001 from the Municipalidad de Desamparados)

III.Merits.- In the present case, the Chamber (Sala) finds it established that, adjacent to the petitioner’s (recurrente) residence and the respondent’s (recurrido) commercial premises, there is a drainage ditch (acequia) that carries a large amount of garbage from upstream and has eroded the land. Likewise, it has not been established that the respondent carried out earthworks (movimientos de tierra) for the purpose of diverting the watercourse, or that he discharges garbage or sewage (aguas negras). Nor does the record show that the petitioner recently filed any complaint in this regard with the municipal or health authorities, given that the Municipality’s latest action concerning the reported matter dates from 2009, while that of the Ministerio de Salud occurred as a result of the filing of this proceeding.-

IV.Although the authorities of the Ministerio de Salud have initiated measures to address the problem reported herein, the constitutional requirements concerning compliance with the obligations arising from Article 50 and the right to health, as developed in the Ley General de Salud in Articles 2º, in relation to 285, 287, 288,292, 301 and 313, among others, cannot be deemed satisfied, because to date no effective solution has been provided to the problem reported for years. Moreover, the Municipalidad de Desamparados cannot disregard its duties either; having approved the construction of the residences, it is also responsible for conducting periodic inspections to determine whether sewage, stormwater, and graywater are discharged in accordance with the applicable authorization. The provisions of Article 1 of the Ley de Construcciones are controlling:

“Article 1.- The Municipalities of the Republic are responsible for ensuring that cities and other population centers meet the necessary conditions of safety, sanitation, comfort, and beauty in their public thoroughfares and in the buildings and structures erected on land located therein, without prejudice to the powers granted by law in these matters to other administrative bodies.” Moreover, Article 87 of the same law provides:

“Article 87.- The Municipality shall exercise oversight over work performed within its jurisdiction, as well as over the use being made thereof. Municipal inspectors are its agents, whose mission is to monitor compliance with the provisions of this Regulation.” Lastly, Article 60 of the Ley Orgánica del Ambiente provides:

“Article 60.- Prevention and control of pollution To prevent and control environmental pollution, the State, municipalities, and other public institutions shall give priority, among other matters, to establishing and operating adequate services in areas essential to environmental health, such as:

(…) b) The sanitary disposal of excreta, wastewater (aguas servidas), and stormwater.” The evidence submitted in the case file shows that the conduct alleged by the petitioner is attributable more to her own actions than to those of her neighbor. As established, the protected party (amparada) herself pollutes the drainage ditch by discharging wastewater from her residence, as do other neighbors in the area who dump garbage and sewage. Thus, even the claimant herself could not be relieved of responsibility. However, this does not mean that the Municipality does not also bear its share of responsibility, because despite verifying the reported sanitary problem, which poses a risk to human health and the environment, the respondent Municipal Mayor has taken no action to resolve the problem, of which that official has been aware since 2009. There has therefore been an omission by the Municipality in determining whether the owners of properties in that community have septic tanks and drainage systems, the condition of those facilities, or whether they discharge polluted water into the drainage ditch.

This oversight is required so that the legally appropriate penalties may be imposed after those concerned have been afforded due process and their right to a defense. Consequently, the Municipalidad de Desamparados has taken no action to resolve the stated problem and its potential contribution to the sanitary nuisance repeatedly identified by the petitioner, even though she is also partly responsible for it. Accordingly, this proceeding must be granted against the Municipalidad de Desamparados for the constitutional violation of Articles 50 and 21 of the Constitución Política.

V.With regard to the Ministerio de Salud, the report submitted to this Chamber and the documentary evidence provided establish that, following the complaint filed by the petitioner, the health authority conducted an inspection on 1 de abril de 2010 and determined that the petitioner shares responsibility for the pollution of the drainage ditch, and that the rodents, mosquitoes, and other insects also originate from the garbage accumulated in the protected party’s residence. The officials of the respondent Ministry therefore issued the appropriate health order (orden sanitaria) against the petitioner. However, it was not until notice of this amparo proceeding (amparo) was served that the respondent authority conducted such oversight in the area, even though the prior complaints date from 2003. On this occasion, the Ministerio de Salud determined that additional residences discharge sewage and residual wastewater (aguas residuales) into the river, which clearly creates a very serious problem by placing the health of the community’s residents at risk.

Furthermore, it has been established that, apart from the inspections conducted and the health orders issued for that purpose, the case file contains no evidence of any other action by this authority to provide a comprehensive solution to the problem. Accordingly, this omission also requires that the proceeding be granted as to this institution. In this specific case, the health authorities failed to give the serious water-pollution problem affecting the drainage ditch, caused by the unscrupulous conduct of certain neighbors, the importance it warranted, and they failed to fulfill their obligation to safeguard the population’s right to health. Consequently, such neglect has infringed the fundamental rights of all residents of the area. The respondent authority, like the respondent Municipality, should be reminded of its obligation—as part of the State—to guarantee, defend, and preserve everyone’s right to enjoy a healthy and ecologically balanced environment.

In its particular case, that duty is even clearer, because constitutional protection encompasses and links an ecologically balanced environment to the fundamental right to health, both mental and physical. Ley General de Salud number 5395 establishes, in its Article 1, that the health of the population is a matter of public interest protected by the State and, in its Article 2, that the Executive Branch, through the Ministerio de Salud, is responsible for defining national health policy; regulating, planning, and coordinating all public and private health-related activities; and carrying out those activities assigned to it by law. It likewise establishes that the Ministry shall have the authority to enforce its orders, including with the assistance of law enforcement, in protection of the legal interest it is charged with safeguarding. In a similar case, the Chamber held in Judgment No. 2006-08983, at once horas dieciséis minutos on veintitrés de junio de 2006: “This Constitutional Court finds that the Ministerio de Salud failed to fulfill its obligations to protect the right to health of the protected party and the other residents of the residential development at issue, because it did not exercise its statutory powers to provide a definitive solution to the sanitary problem affecting them and formally reported by them.

Instead, it engaged in insufficient, untimely, and ineffective activity, as demonstrated by the fact that the problem persists because it has not taken any concrete action in exercise of the police power (poder de policía) granted to it by law to enforce its orders. The members of this Constitutional Court are therefore left with the impression that its actions were those of a ‘paper Administration,’ whose activity ends with mere bureaucratic procedures and is simply limited to conducting inspections and issuing recommendations or health orders, without taking any measure to verify compliance and, worse still, without demonstrating any effective action genuinely aimed at definitively resolving the sanitary problem presented, as required to fulfill the public purpose entrusted to it. This harms health and the environment and, consequently, violates constitutional Article 50, a situation that this Chamber finds intolerable.” Based on the foregoing, and there being no reason to depart from the stated criterion or reconsider the matter, the proceeding must be granted with respect to the Ministerio de Salud.

VI.As for possible flooding, these arguments concern an uncertain future event, since the petitioner provides no evidence demonstrating that, in her particular case, the drainage ditch overflowed on previous occasions and flooded her residence. Finally, with regard to the gravel road located in front of the petitioner’s house and the piping of the drainage ditch, these are matters that she must pursue before the appropriate body, which the record does not show she has done to date. The proceeding is therefore denied as to this claim.

Por tanto

The proceeding is granted solely with respect to the alleged pollution of the drainage ditch. Carol Jiménez González, in her capacity as Acting Director of the Área Rectora de Salud de Desamparados, and Maureen Fallas Fallas, in her capacity as Mayor of the Municipalidad de Desamparados, are ordered, within UN AÑO from notice of this judgment, to adopt the necessary measures and definitively resolve the sanitary problem alleged herein, in coordination with the other bodies and entities having specific authority in this matter, particularly the Instituto Costarricense de Acueductos y Alcantarillados. Carol Jiménez González, in her capacity as Acting Director of the Área Rectora de Salud de Desamparados, and Maureen Fallas Fallas, in her capacity as Mayor of the Municipalidad de Desamparados, are advised that failure to comply with this order will constitute the offense of disobedience and that, pursuant to Article 71 of the Ley de esta jurisdicción, any person who receives an order issued in an amparo proceeding that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment from tres meses a dos años or a fine of veinte a sesenta días, provided that the offense is not subject to a more severe penalty.

The STATE and the MUNICIPALIDAD DE DESAMPARADOS are ordered to pay the costs and the damages caused by the facts underlying this judgment, which shall be assessed in proceedings to enforce the judgment before the contentious-administrative jurisdiction (jurisdicción de lo contencioso administrativo). The proceeding is denied as to all other claims asserted. This decision shall be served personally upon Carol Jiménez González, in her capacity as Acting Director of the Área Rectora de Salud de Desamparados, and Maureen Fallas Fallas, in her capacity as Mayor of the Municipalidad de Desamparados, or upon whoever may hold those offices in their stead.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las dieciocho horas y cinco minutos del diez de mayo del dos mil once.

Recurso de amparo interpuesto por FERMINA MARCELENDA BARBOZA CASTRO, cédula de identidad número 0101650750, contra el MINISTERIO DE SALUD, la MUNICIPALIDAD DE DESAMPARADOS y RICARDO RODRÍGUEZ ZÚÑIGA.

Resultando:

  1. 1En memorial presentado en la Secretaría de la Sala el día 24 de marzo de 2011, la recurrente interpone recurso de amparo contra Ricardo Rodríguez Zúñiga, sujeto de derecho privado, indica que es vecina de San Rafael Abajo, Desamparados, contiguo al plantel de autobuses de Concepción de Alajuelita, ubicado a la par de la Estación de Servicio Shell. Explica que su propiedad limita con una acequia, y el dueño de la propiedad colindante Ricardo Rodríguez Zúñiga, al adquirirla, le indicó que entubaría la acequia y que colocaría cajas de registro para recoger las aguas que caían en la misma; sin embargo no ha realizado actividad alguna. Manifiesta que el recurrido corrió el cauce del río para tener más espacio, lo cual le ha afectado por cuanto desestabiliza el terreno y perjudica lo que tiene sembrado, ya que no hay nada que sostenga la cerca que tenía. Alega que recurrió ante la Municipalidad, la Delegación Policial y el Ministerio de Salud, pero la situación no ha sido solucionada.Indica que existen malos olores, ratas, insectos, y las aguas se encuentran estancadas, y no se toma acción alguna para atender el problema. Agrega que la calle que está ubicada frente a su casa por donde salen los autobuses está en mal estado y el recurrido no ha hecho la reparación correspondiente, lo cual perjudica a adultos mayores que habitan en su vivienda, por el polvo que se produce. Considera violentados sus derechos fundamentales. Solicita que se declare con lugar el recurso con las consecuencias de ley.
  2. 2Informa bajo juramento Ricardo Rodríguez Zúñiga, que no es el propietario de la finca que colinda con la recurrente, sino que ésta pertenece a la Sociedad Inversiones Diamo S.A., de la que es accionista y representante. Indica que no es cierto que le ofreciera a la recurrente entubar la acequia, y estima que inclusive desconoce si es posible que eso lo haga un particular sin participación de las autoridades públicas. Considera que entubar la acequia sí sería una solución apropiada a los problemas que aqueja la recurrente, sin embargo señala que estos problemas no son causados por su representada, por cuanto las aguas vienen ya contaminadas y arrastran basura y escombros. Manifiesta que lo deseable es que las autoridades competentes instalen tubería o alcantarillas de manera que la acequia quede bajo tierra, con las previsiones necesarias para los atascos. Señala que no es cierto que haya cambiado el curso de río alguno, y que ni él, ni Inversiones Diamo S.A. utilizan el cauce de la acequia para desaguar ni para ningún otro efecto, salvo la escorrentía natural, mientras que sí se ha acreditado que la recurrente utiliza el cauce de la acequia para desaguar su propiedad.Considera en cuanto a las molestias que señala la recurrente por el estado de la calle frente a su casa, que es falso que se encuentre en mal estado, por cuanto el acceso es de lastre pero muy bien compactado, y que si las autoridades competentes determinaran que el uso de ese acceso provoca alguna afectación o molestia a la recurrente, él o sus representadas adoptarían las medidas necesarias.
  3. 3Informa bajo juramento Carol Jiménez González, en su condición de Directora a.i. del Área Rectora de Salud de Desamparados, que el 11 de diciembre de 2003 la Alcaldesa Municipal de Desamparados le remite a la Dra. Nidia Amador Brenes el oficio OF-AM-01-686-03, donde adjunta otros oficios relacionados que indican que se ha constatado un proceso erosivo del terreno de la familia Barboza a causa del incremento y expansión de la sección del cauce de la quebrada colindante, y que no se cuenta con indicio o registro de que se realizaran obras de desviación o rectificación de la quebrada. Agrega que el oficio supracitado en otro oficio que adjuntaba, señalaba que en la acequia se observa el arrastre de diferentes desechos que provienen de aguas arriba y que no se observa que el terreno haya sido alterado por maquinaria, por lo que no se puede determinar si existió alteración del cauce. Indica que el 1 de marzo de 2004 por medio de oficio DASD-MS-013-04, la Dra. Amador Brenes adjuntó a la recurrente el informe OF UTGV Nº 01-214-03, suscrito por el Director de la Unidad Técnica de Gestión Vial.Señala que el 13 de junio de 2007, se realizó inspección de campo a la vivienda de la recurrente, realizando prueba de coloración por aguas servidas y ordenando mediante orden sanitaria Nº ARSD-UPAH-NHG-049-2007 que se eliminaran adecuada y sanitariamente las aguas servidas de la casa de habitación de Señora Barboza, en virtud de que iban directamente a la propiedad vecina. Informa que el 1 de abril de 2011 acompañada de otro funcionario, realizó inspección de campo en atención al presente recurso, emitiendo el informe ARSD-ING-MSV-023-2011 y constatando que la acequia tiene gran cantidad de basura y desechos provenientes de aguas arriba y producto de las descargas ilegales de agua de los vecinos de la acequia, adicionalmente se notó erosión en el terreno producto aparentemente del comportamiento natural del cauce y se comprobó que la disposición de las aguas servidas de la señora Barboza iba directo a la acequia.Indica que no se logró comprobar que la erosión haya sido causada por modificaciones al curso de la acequia, y que gran cantidad de la basura y desechos corresponden al arrastre de la misma. Expone que varios vecinos, incluida la recurrente, vierten en el cauce sus aguas residuales, y niega en cuanto a este extremo, que sean atribuibles al Señor Rodríguez Zúñiga. Considera que esta Área Rectora de Salud ha realizado los actos administrativos necesarios y solicita se declare sin lugar el recurso.
  4. 4Informa bajo juramento Maureen Fallas Fallas, en su condición de Alcaldesa de la Municipalidad de Desamparados, que no lleva razón la recurrente al dirigir este recurso contra su representada, por cuanto deja de manifiesto la documentación aportada por ella misma, que se le han dado respuestas oportunas, que datan del año 1997 y que a la fecha no consta petición alguna según oficio Of.UTGV No. 283-2011 del 4 de enero de 2011. Estima importante señalar que en documentos aportados por la recurrente aparecen notas presentadas por la señora Marta Barboza Castro, lo que no debe inducir a error pues se trata de una persona diferente. Sostiene que en oficio UIG-029-97 se le informó a la recurrente de una inspección realizada en que se comprobó la construcción de un muro de 40 metros de longitud, paralelo a su lindero oeste, con la finalidad posible de que soportara relleno de lastre de una proyección de calle o acceso, a la propiedad Diamo S.A. y el entubamiento de la acequia, que cuenta con el permiso Nº 209 del 7 de febrero 1997.Aclara que la acequia en mención no consta en la hoja de abra, de lo que se interpreta que posiblemente se conforma por aguas residuales. Agrega que la última petición formulada por la recurrente tuvo fecha de 10 de setiembre de 2009, y se respondió mediante trámite de plataforma Nº 92429, indicándole que a la hora de la inspección no se observó ningún trabajo o movimiento de tierra. Considera que la administración municipal no ha incurrido en violación alguna a derecho fundamental. Solicita se declare sin lugar el recurso.

Redacta el Magistrado Araya Garcia; y,

Considerando:

I.Objeto del recurso.- La recurrente alega que su propiedad limita con una acequia, que produce malos olores, ratas, insectos, y las aguas se encuentran estancada , además que el vecino corrió el cauce para tener más espacio, lo cual la ha afectado por cuanto desestabilizó su terreno. Debido a lo anterior, acudió a la Municipalidad de Desamparados y al Ministerio de Salud, pero el problema no ha sido solucionado. Además, la calle que está ubicada frente a su casa por donde salen los autobuses está en mal estado y no ha hecho la reparación correspondiente, lo cual perjudica a adultos mayores.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • a)Que en el año 2003 y 2007 la recurrente presentó las denuncias respectivas por el problema de la acequia ante el Ministerio de Salud, se inspeccionó el sitio, se le dio respuesta a la recurrente y se giró la orden sanitaria en su contra para que eliminara adecuada y sanitariamente las aguas servidas de su casa de habitación que van directamente a la propiedad vecina. (informe de la autoridad recurrida) b) Que el 10 de septiembre del 2009 la recurrente solicitó a la Municipalidad recurrida una inspección, y el 26 de septiembre la recurrente retiró la respuesta. (informe de la autoridad recurrida) c) Que la propiedad de la recurrente colinda con la margen derecha de una acequia, frente a la propiedad de la Sociedad Inversiones Diamo S.A. (hecho no controvertido) d) Que en la acequia se verifica el arrastre de diferentes desechos que provienen aguas arriba y el lanzamiento ilegal de aguas negras de los vecinos.

( ver informe No. ARSD-ING-MSV-023-2001 del 4 de abril de 2011 del Área Rectora de Salud de Desamparados aportado por la autoridad recurrida) e) Que en ambas márgenes de la acequia consta la erosión en el terreno, pero no se evidencia que el terreno haya sido alterado por maquinaria. (ver informe No. ARSD-ING-MSV-023-2001 del 4 de abril de 2011 del Área Rectora de Salud de Desamparados aportado por la autoridad recurrida) d) Que la recurrente dispone de las aguas servidas de su vivienda directamente a la acequia. (ver informe No. ARSD-ING-MSV-023-2001 del 4 de abril de 2011 del Área Rectora de Salud de Desamparados aportado por la autoridad recurrida) e) Que en la vivienda de la recurrente existe gran cantidad de basura, escombros y desechos. ( ver informe No. ARSD-ING-MSV-023-2001 del 4 de abril de 2011 del Área Rectora de Salud de Desamparados aportado por la autoridad recurrida) f) El 6 de abril de 20011 se notificó a Ricardo Rodríguez la orden sanitaria No. RSC-DARSD-CJG-092-11 y se le otorgó un plazo de 25 días hábiles para realizar los trámites y contar con el permiso sanitario de funcionamiento para el local comercial.

(documentación aportada por la autoridad recurrida) g) El 6 de abril de 2011 se notificó a la recurrente la orden sanitaria No. RSD-DARSD-CG-093 y se le otorgó un plazo de 30 días para canalizar y disponer de las aguas grises y las aguas pluviales al sistema autorizado por el Ministerio de Salud, y recoger toda la basura que hay en la vivienda. (informe de la autoridad recurrida) h) Que en los planes de emergencia de los Decretos de Emergencia No. 33373, 34805, 34045 no se incluyó afectación por inundación en la propiedad de la recurrente, ni el desbordamiento de la acequia colindante. (Ver oficio UTGVNo. 283-2011 del 4 de abril de 2001 de la Municipalidad de Desamparados)

III.Sobre el fondo.- En el presente caso, la Sala tiene por demostrado que contiguo a la vivienda de la recurrente y del local comercial del recurrido, existe una acequia que arrastra gran cantidad de basura proveniente aguas arriba y que ha erosionado el terreno. Asimismo, no se tiene por demostrado que el recurrido haya efectuado movimientos de tierra con la finalidad de desviar el cauce, ni que vierta basura o aguas negras. Además, tampoco consta que recientemente la recurrente haya presentado alguna denuncia al respecto a las autoridades municipales y sanitarias, siendo que la última actuación de la Municipalidad con respecto a lo denunciado data del año 2009 y la del Ministerio de Salud, en virtud de la interposición del presente recurso.-

IV.Si bien es cierto, las autoridades del Ministerio de Salud han iniciado gestiones para enfrentar el problema aquí denunciado, no pueden tenerse por satisfechas las exigencias constitucionales en cuanto al cumplimiento de las obligaciones derivadas del artículo 50 y del derecho a la salud, desarrolladas en la Ley General de Salud en sus artículos 2º, en relación con 285, 287, 288,292, 301 y 313, entre otros en virtud de que a la fecha no ha dado una solución efectiva al problema denunciado desde hace años. Por otra parte, la Municipalidad de Desamparados tampoco puede desentenderse de sus cometidos, y al aprobar las construcciones de las viviendas, también le corresponde realizar las inspecciones periódicas para determinar que la evacuación de aguas negras, pluviales y grises se haga conforme lo autorizado. Es determinante lo dispuesto en el artículo 1 de la Ley de Construcciones, según el cual:

“Artículo 1.- Las Municipalidades de la República son las encargadas de que las ciudades y demás poblaciones reúnan las condiciones necesarias de seguridad, salubridad, comodidad y belleza en sus vías públicas y en los edificios y construcciones que en terrenos de las mismas se levanten sin perjuicio de las facultades que las leyes conceden en estas materias a otros órganos administrativos”.

Por otra parte, el artículo 87 de la misma ley establece que:

“Artículo 87.- La Municipalidad ejercerá vigilancia sobre las obras que se ejecuten en su jurisdicción así como sobre el uso que se les esté dando. Los inspectores municipales son sus agentes, que tienen por misión vigilar la observancia de los preceptos de este Reglamento”.

Por último, el artículo 60 de la Ley Orgánica del Ambiente, dispone que:

“Artículo 60.- Prevención y control de la contaminación Para prevenir y controlar la contaminación del ambiente, el Estado, las municipalidades y las demás instituciones públicas, darán prioridad, entre otros, al establecimiento y operación de servicios adecuados en áreas fundamentales para la salud ambiental, tales como:

(…) b) La disposición sanitaria de excretas, aguas servidas y aguas pluviales”.

De las pruebas aportadas al expedientes se tiene que lo acusado por la recurrente obedece más a sus propias actuaciones que a las del vecino. Según quedó acreditado, la propia amparada contamina la acequia debido a que lanza las aguas servidas de su vivienda, al igual que lo hacen otros vecinos de la zona, que vierten la basura y aguas negras. De manera que no podría exonerarse de responsabilidad incluso a la misma accionante. Ahora bien, ello no implica que la Municipalidad también tiene su cuota de responsabilidad, por cuanto pese a la verificación del problema sanitario denunciado que pone en riesgo la salud humana y al ambiente, el Alcalde Municipal recurrido no ha realizado ninguna acción para solucionar el problema, lo cual es de su conocimiento desde el año dos mil nueve. Se observa entonces, una omisión por parte de la Municipalidad en fiscalizar si los propietarios de inmuebles en esa comunidad cuentan con tanque séptico, drenajes, el estado en que se encuentran o si lanzan las aguas contaminadas a la acequia.

Lo anterior, con el fin de imponer las sanciones que en derecho corresponda una vez otorgado el debido proceso y derecho de defensa que les asiste. En consecuencia, la Municipalidad de Desamparados no ha tomado acción alguna para resolver el problema indicado y su eventual incidencia en el inconveniente sanitario que con insistencia revela la recurrente, a pesar que también es partícipe. En tal virtud, se impone la estimatoria de este recurso contra la Municipalidad de Desamparados por la violación constitucional a los artículos 50 y 21 de la Constitución Política.

V.Con relación al Ministerio de Salud, del informe presentado a esta Sala y la prueba documental aportada, se tiene por verificado que, efectivamente posterior a la denuncia presentada por la recurrente, la autoridad sanitaria realizó una inspección el día 1 de abril de 2010 y se constató que la recurrente es co responsable de la contaminación que presenta la acequia y que los roedores, zancudos y demás insectos, provienen también de la basura que se encuentra acumulada en la vivienda de la amparada, por lo que los funcionarios del Ministerio recurrido giraron la orden sanitaria en contra de la recurrente para lo correspondiente. Sin embargo, no es hasta la notificación de este amparo, que la autoridad recurrida efectúa dicho control en el sector, dado que las anteriores quejas datan del año dos mil tres y en esta ocasión el Ministerio de Salud constató que existen más viviendas que lanzan al río las aguas negras y residuales, lo que evidentemente genera un problema muy serio al poner en riesgo la salud de los habitantes de la comunidad.

Además, queda demostrado que más allá de las inspecciones realizadas y las órdenes sanitarias giradas al efecto, no se desprende del expediente ninguna otra actuación de parte de esta autoridad para dar solución integral al problema y por ende, tal omisión implica también en cuanto a esta institución, la estimación del recurso. En el caso concreto, las autoridades sanitarias no le dieron la importancia que el caso amerita al grave problema de contaminación de aguas que presenta la acequia por la acción inescrupulosa de algunos vecinos y han omitido cumplir con su obligación de velar por el derecho a la salud de la población y por ende, tal desidia ha ocasionado lesiones a los derechos fundamentales de todos los habitantes del lugar. Conviene recordar a la autoridad recurrida, al igual que se hizo con la Municipalidad recurrida, su obligación –como parte del Estado- de garantizar, defender y preservar el derecho de todos a disfrutar de un ambiente sano y ecológicamente equilibrado.

En su caso particular se trata de un deber aún más claro, pues la protección constitucional cubre y vincula el ambiente ecológicamente equilibrado con el derecho fundamental a la salud, tanto en el plano psíquico como en el físico, siendo que la Ley General de Salud número 5395 establece, en su artículo primero, que la salud de la población es un bien de interés público tutelado por el Estado y, en su artículo segundo, que corresponde al Poder Ejecutivo, por medio del Ministerio de Salud, la definición de la política nacional de salud, la normación, planificación y coordinación de todas las actividades públicas y privadas relativas a salud, así como la ejecución de aquellas actividades que le competen conforme a la ley; de igual forma, que tendrá potestades para hacer cumplir sus órdenes incluso con ayuda de la fuerza pública en protección del bien jurídico que está llamado a tutelar. En un caso similar la Sala en sentencia No. 2006-08983 de las once horas dieciséis minutos del veintitrés de junio de 2006, dispuso: “ Estima este Tribunal Constitucional que el Ministerio de Salud ha sido omiso en el cumplimiento de sus obligaciones en tutela del derecho a la salud del amparado y demás vecinos de la urbanización de marras, al no hacer uso de sus potestades legales con el fin de solucionar, definitivamente, el problema sanitario que les afecta y que han denunciado formalmente, pues ha realizado una actividad insuficiente, inoportuna e ineficaz que se comprueba con el hecho de que el problema subsiste, al no haber concretado ninguna acción en ejercicio del poder de policía que le asiste por ley para hacer cumplir sus órdenes.

Queda así en los miembros de este Tribunal Constitucional la percepción de que ha sido la actuación de una “Administración de papel”, que agota su actividad en meros trámites burocráticos, simplemente limitándose a realizar inspecciones y girar recomendaciones u órdenes sanitarias, sin que se tome medida alguna para corroborar que se hayan cumplido y, lo que es peor, sin que se evidencien de su parte acciones eficaces, verdaderamente encaminadas a resolver en definitiva la problemática sanitaria encomendado, lo que redunda en detrimento de la salud y el medio ambiente y, por consiguiente, en violación del artículo 50 constitucional, situación que resulta intolerable para esta Sala”. Partiendo de lo anterior y no existiendo ningún motivo para variar el criterio expuesto, ni reconsiderar la cuestión, se impone declarar con lugar el recurso con respecto al Ministerio de Salud.

VI.En cuanto a posibles inundaciones, estas argumentaciones reflejan un hecho futuro incierto, toda vez que la recurrente no aporta prueba que en su caso concreto, demuestre que en anteriores ocasiones la acequia se haya desbordado y que su vivienda se hubiera inundado. Finalmente, con relación que la calle de lastre que está ubicada frente a la casa de la recurrente, así como el entubamiento de la acequia, son asuntos que deberá gestionarlos ante el órgano respectivo, lo cual a la fecha no consta que lo haya efectuado, por lo que en relación a este extremo se declara sin lugar el recurso.

Por Tanto

Se declara con lugar el recuso únicamente por la acusada contaminación de la acequia. Se ordena a Carol Jiménez González, en su condición de Directora a.i. del Área Rectora de Salud de Desamparados y a Maureen Fallas Fallas, en su condición de Alcaldesa de la Municipalidad de Desamparados, que en el plazo de UN AÑO contado a partir de la comunicación de esta sentencia adopten las medidas necesarias y resuelvan definitivamente el problema sanitario aquí acusado, en coordinación con los demás órganos y entes que tengan competencias específicas en esta materia, en particular, el Instituto Costarricense de Acueductos y Alcantarillados. Se le advierte a Carol Jiménez González, en su condición de Directora a.i. del Área Rectora de Salud de Desamparados y a Maureen Fallas Fallas, en su condición de Alcaldesa de la Municipalidad de Desamparados, que de no acatar la orden dicha incurrirá en el delito de desobediencia y que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena al ESTADO y a la MUNICIPALIDAD DE DESAMPARADOS al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En los demás extremos alegados, se declara sin lugar el recurso.
