Constitutional challenge (acción de inconstitucionalidad) brought by [Nombre16 001], identity card No. [Valor 001], and [Nombre16 002], identity card No. [Valor 002], seeking a declaration that subsections a), b), c), d), f), and g) of Article 8; Articles 9 and 10; subsections a), b), c), d), e), and f) of Article 12; Article 26; and Transitional Provision VII, all of the Ley del Refugio de Vida Silvestre Ostional (Law No. 9348 of 08 de febrero de 2016), are unconstitutional, on the grounds that they are contrary to Articles 7, 11, 21, 41, 50, 73, 89, and 169 of the Political Constitution; the constitutional environmental principles of rational land use, precaution, non-regression, objectification, and the irreducibility of forests (irreductibilidad de los bosques); as well as Article 5 of the Convention on Nature Protection and Wildlife Preservation in the Western Hemisphere, Article 4 of the Convention Concerning the Protection of the World Cultural and Natural Heritage, and Article 4 of the Convention on Wetlands of International Importance Especially as Waterfowl Habitat. The representative of the Office of the Attorney General of the Republic and the representative of the Minister of Environment and Energy also participated in the proceedings.

Findings:

  1. 1By written submission received by the Secretariat of the Chamber at 12:55 hours on 20 de agosto de 2016, the petitioners request that subparagraphs a), b), c), d), f), and g) of Article 8; Articles 9 and 10; subparagraphs a), b), c), d), e), and f) of Article 12; Article 26; and Transitory Provision VII, all of the Ley del Refugio de Vida Silvestre Ostional (Ley No. 9348 de 08 de febrero de 2016), be declared unconstitutional, on the grounds that they are contrary to Articles 7, 11, 21, 41, 50, 73, 89, and 169 of the Constitución Política; the constitutional environmental principles of rational land use, precaution, non-regression, objective substantiation, and non-reduction of forests (irreductibilidad de los bosques); as well as Article 5 of the Convención para la Protección de la Flora, la Fauna y de las Bellezas Escénicas Naturales de los Países de América, Article 4 of the Convención sobre la Protección del Patrimonio Mundial, Cultural y Natural, and Article 4 of the Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas.The petitioners state that Playa Ostional is recognized worldwide for the mass nesting arrival (arribada) of the olive ridley sea turtle (Lepidochelys olivácea). They indicate that the leatherback sea turtle (Dermochelys coriácea) and the black sea turtle (Chelonia mydas agassizii) also nest there. They add that there are several mangrove systems associated with river mouths and that, finally, the Ley del Refugio de Vida Silvestre Ostional (Ley No. 9348 de 08 de febrero de 2016) was published in La Gaceta No. 43, Alcance No. 31, del 2 de marzo de 2016. They contend that the purpose of Ley No. 9348 is to legalize the continued presence of the current occupants of the maritime-terrestrial zone (zona marítimo terrestre) within the refuge’s boundaries by granting concessions (concesiones); however, to achieve that purpose, the degree of environmental protection within the refuge has been unjustifiably reduced without technical support, thereby placing biodiversity and the natural landscape at risk, in violation of the fundamental right to a healthy and ecologically balanced environment.In this regard, they allege that this body of law violates the principle of non-regression in environmental matters because it authorizes activities or land uses (usos de suelo) that do not appear to be environmentally optimal, since, pursuant to Articles 8 and 12 of Ley No. 9348, concessions may be granted for “small-scale sustainable agricultural use,” “recreational residential use,” “cabins,” commercial use to provide “basic support services for communities and visitors,” facilities for “community and social welfare services,” and “research and operation of community projects.” They maintain that there appears to be no valid reason to permit agricultural, commercial, and recreational residential activities on state-owned land located within a wildlife refuge. They explain that legal opinion No. OJ-14-2010, issued by the Procuraduría General de la República, had already questioned the authorization of agricultural use within the refuge.They indicate that the threat posed by agricultural activity to the environment within the refuge was also identified in the Diagnóstico para el Plan General de Manejo del Refugio Nacional de Vida Silvestre Ostional and in legal opinion No. OJ- 84-2015 of the Procuraduría General de la República. They contend that, through the concession mechanism, Ley No. 9348 allows activities other than training, research, and ecotourism to be conducted on state-owned property within the refuge and that such activities—as in the case of agricultural activity—would diminish environmental protection. They insist that activities are being authorized that depart from the comprehensive approach to environmental conservation and protection and, moreover, lack any technical basis demonstrating the need to permit such practices within the refuge, in violation of the fundamental right to a healthy and ecologically balanced environment.They argue that the amendment or repeal of a rule protecting the environment cannot unjustifiably reduce the degree of protection, because doing so would impose a more degraded environment on future generations through a legal rule with regressive content, in violation of the principle of non-regression in environmental matters. In this regard, they contend that Ley No. 9348 allows concessions to operate in a manner similar to that regulated by the Ley sobre la Zona Marítimo Terrestre, which causes the Refugio Nacional de Vida Silvestre Ostional to lose, in practice, the classification, characteristics, and purposes of a wildlife refuge. They indicate that even in the case of mixed refuges, where protection is somewhat lower—pursuant to Article 150 of the Reglamento a la Ley de Conservación de Vida Silvestre and Article 70 of the Reglamento a la Ley de Biodiversidad—only research, training, and ecotourism activities are permitted in state-owned areas.They indicate that this Chamber has held that the environmental protection afforded to a protected zone must not be reduced without justification; however, in this case, the refuge’s protection classification has been lowered without any technical basis justifying it. They state that this Chamber has also addressed the need for technical studies before removing protected status from or reducing a protected area or zone, in accordance with the principle of objective substantiation of environmental protection. They assert that, with respect to Ley No. 9348, there are insufficient technical studies concerning the implementation of this special concession regime within a protected area. They contend that, ultimately, the ecological balance of the system and the health of the environment are being compromised in order to allow persons who have been unlawfully occupying that protected area to remain there.They explain that Ley No. 9348 was enacted to resolve a social problem so that persons living within the refuge’s boundaries would not be evicted; nevertheless, that body of law also authorizes the granting of concessions for purposes other than residential use, including agricultural, commercial, and recreational residential uses, without technical studies justifying them. They assert that, in judgment No. 2009-02020, this Chamber had already indicated that it could not “authorize any activity whatsoever in the Refugio de Vida Silvestre Ostional unless it is directed exclusively toward its protection and research.” They further allege that, before Ley No. 9348 was enacted, no adequate and up-to-date studies had been conducted to determine who owned or occupied land within the refuge, how they obtained their title, and whether they used that land as their residence or lived elsewhere in the country.They state that the Procuraduría General de la República itself, in legal opinion No. OJ-84-2015, referred to the importance of censuses, mapping, and other prior studies capable of establishing the actual land-tenure situation, not only to assess the reasonableness and proportionality of the rule, but also to prevent new persons from invading areas of the maritime-terrestrial zone. They argue that such prior studies were relevant in light of Article 26 of Ley No. 9348, which provides for the existence of privately owned land registered within the refuge’s boundaries. They add that, in legal opinion No. OJ-24-2013, the Procuraduría General de la República noted a possible conflict with the Constitution, insofar as concessions would be allowed in the maritime-terrestrial zone over land containing structures erected without complying with the applicable administrative procedure and without approved environmental feasibility (viabilidad ambiental), while the only requirement imposed is consistency with the regulatory plan (plan regulador).The petitioners allege that the foregoing is troubling because it is foreseeable that the Management Plan (Plan de Manejo) will not serve as a genuine land-use planning instrument, but merely as a formality for permitting unlawful occupation at the expense of environmental protection. They further contend that allowing existing structures to remain, even though they were built without complying with any regulations intended to harmonize them with the area’s natural landscape, violates Article 89 of the Constitution and the international instruments cited above. They state, in conclusion, that the challenged legislation seeks to legalize encroachments upon the public domain that the Administration has permitted or tolerated for years. They indicate that Transitory Provision VII provides that “[f]rom the entry into force of this law, and until the concession applications submitted pursuant to it have been resolved, no eviction proceedings shall be initiated against occupants present in the Refuge at the time this law enters into force.” The petitioners challenge the fact that this transitory provision establishes no maximum period for processing concessions, makes no exception for occupations of areas ineligible for concession, and, because of its broad scope, allows an interpretation under which it applies to evictions and demolitions ordered in judicial proceedings concerning the legality of occupations in the coastal sector.They consider this contrary to Articles 41 and 50 of the Constitución Política. They further state that if, through concessions, activities other than ecotourism and research are permitted within the refuge, including agricultural, commercial, and recreational residential activities, serious harm will be caused to wetlands, as is apparent from the Diagnóstico para el Plan General de Manejo del Refugio Nacional de Vida Silvestre Ostional and legal opinion No. OJ-84-2015 of the Procuraduría General de la República. They object that this violates Article 50 of the Constitution and fails to comply with the international instruments cited above. Article 26 provides that “privately owned land validly registered within the Refuge’s boundaries shall be subject to the land-use planning rules established by the Refuge’s General Management Plan.” They allege that this article is unconstitutional because it omits any requirement to expropriate owners who object to complying with the cited legislation.They also indicate that, in legal opinion No. OJ-014-2010, the Procuraduría General de la República had already warned that persons occupying this land would be placed in a different and more favorable position than others who had likewise encroached upon areas belonging to the State’s public domain, because, in the rest of the country, the Ley de la Zona Marítimo Terrestre recognizes only occupants who entered before 1977 and allows them to remain subject to certain requirements. The petitioners challenge the authorization of schools, secondary schools, public-service offices, and churches within the refuge’s boundaries (Articles 9 and 10 of Ley No. 9348), insofar as this undermines its purpose—environmental conservation—and violates the principle of non-reduction of forests. They allege that the principle of compensation has been violated because, in practice, the size of the protected area is being reduced—since the combined area of privately owned land and concession land devoted to incompatible uses must be subtracted—yet that reduction was not offset by creating new protected areas.

Finally, they allege a violation of legislative due process (debido proceso legislativo), insofar as one of the deputies present in the Plenary during the sessions at which said legislation was approved was Nombre01 (minutes No. 111 of 30 de noviembre de 2015 and No. 126 of 14 de enero de 2016), despite being an occupant of land within the refuge, which compromises his impartiality. This action is admitted because it meets the requirements set forth in Articles 73 to 79 of the Ley de la Jurisdicción Constitucional.

  1. 2To substantiate their standing (legitimación) to bring this action of unconstitutionality (acción de inconstitucionalidad), they state that it derives from the second paragraph of Article 75 of the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional), insofar as the petitioners appear in defense of diffuse interests (intereses difusos), seeking to safeguard the right to a healthy and ecologically balanced environment.
  2. 3By decision issued at 09:41 hours on 24 de agosto del 2016, the action was admitted for consideration, and the Office of the Attorney General of the Republic (Procuraduría General de la República) and the Minister of Environment and Energy were granted an opportunity to be heard.
  3. 4The notices referred to in the second paragraph of Article 81 of the Constitutional Jurisdiction Law were published in issues 181, 182 and 183 of the Judicial Bulletin (Boletín Judicial), dated 21, 22 and 23 de septiembre del 2016.
  4. 5The Office of the Attorney General of the Republic submitted its report. It states that: a) Regarding standing: Pursuant to Articles 50, second paragraph, of the Political Constitution (Constitución Política), and 75, second paragraph, of the Constitutional Jurisdiction Law, as well as this Chamber’s settled case law concerning diffuse interests, the action is admissible because it falls within the legal protection of the environment; b) Regarding the merits of the matter: 1. Regarding the challenged provisions: The purpose of Law No. 9348 of 8 de febrero del 2016 is to establish a specific and differentiated legal framework for the Refugio de Vida Silvestre Ostional, allowing occupants of the maritime-terrestrial zone (zona marítimo terrestre) to remain through the granting of concessions and use permits (permisos de uso) for various activities, as provided in Articles 8, 9, 10, 12 and 26 and Transitory Provision VII thereof. 2.Regarding the petitioners’ arguments: The petitioners consider that only concessions for residential use, ecotourism lodges and infrastructure for scientific research would be constitutional, and they challenge the other uses provided for in the Law, specifically in the articles cited above. 3. Regarding the Granting of Concessions for Activities Other Than Research, Training and Ecotourism: It states that the activities referred to in the constitutional case law in decisions No. 2003-8742 and 2009-2020 are established for wildlife refuges generally in which the State has an interest. It indicates that Article 70(e) of the Regulations to the Biodiversity Law (Reglamento a la Ley de Biodiversidad), Decree No. 34433 of 11 de marzo del 2008, provides that only research, training and ecotourism activities may be conducted on State-owned land within mixed-ownership refuges (refugios de propiedad mixta), limiting the application of the Regulations to the Wildlife Conservation Law (Reglamento a la Ley de conservación de la vida silvestre) to the regulation of activities permitted on the privately owned portion of such refuges.Law No. 9348 modifies this framework, which applies to more than 25 Mixed-Ownership Wildlife Refuges (Refugios Mixtos de Vida Silvestre) in the country, 18 of which are also coastal refuges (according to the provisions creating them), by allowing concessions to be granted on State-owned land within the Refugio de Ostional for small-scale agricultural and livestock use (subparagraph (a) of Articles 8 and 12), residential use (subparagraph (b) of Articles 8 and 12), recreational residential use (Article 8(b) and Article 12(c)), commercial use intended to support basic services (subparagraph (d) of Articles 8 and 12), and community projects and services (subparagraphs (f) and (g) of Article 8 and subparagraph (f) of Article 12). Regarding the merits, it states that, “with respect to the Refugio Nacional de Vida Silvestre Ostional, in compliance with the Precautionary Principle (Principio Precautorio), before it may be declared a community coastal territory and a concession granted—as stated by the consulting members of the Legislative Assembly—an environmental impact study (estudio de impacto ambiental) evaluated by the Environmental Technical Secretariat (Secretaría Técnica Ambiental) is required, so as to establish the type of harm and the measures that must be adopted.Such a study is absent from this legislative initiative, since a refuge cannot be deprived of protection without technical criteria supporting that decision. Therefore, that omission entails a violation of the precautionary principle and the principle of progressive protection (principio de progresividad) within the scope of safeguarding fundamental rights, an issue identified in the procedural defect analyzed in this judgment”; it indicates that the legislative record No. 18939, which gave rise to Law No. 9348, does not show that this requirement was satisfied under the terms established by the Constitutional Chamber (Sala Constitucional) in the aforementioned judgment. 4. Regarding the Granting of Use Permits to Public and Private Institutions: It states that the petitioners, under the heading “VIOLATION OF THE PRINCIPLE OF NON-REDUCTION OF FOREST AREA (PRINCIPIO DE IRREDUCTIBILIDAD DEL BOSQUE),” allege that “there is no justification for schools, secondary schools, public-service offices or churches to exist within the boundaries of the refuge,” and that keeping them there violates the principle of non-reduction of forest area.Articles 9 and 10 of Law No. 9348, however, provide for the granting of use permits to public and private institutions for education, research, the development of community projects and other public services. It adds that these authorizations are temporary and precarious in nature, from which a practical consequence follows: a use permit is an authorization to perform simple acts whose effects do not materially affect the property being used; its purpose is to authorize activities that do not require permanent or large-scale construction or works and that, instead, entail occupation involving easily and quickly removable facilities, such as kiosks, or movable property. Consequently, structures permanently affixed to the land, such as schools, universities and similar buildings, could not be authorized under a use permit. In legal opinion No. OJ-14-2010 of 26 de marzo del 2010, concerning the “Law on the Refugio Nacional de Vida Silvestre Ostional” bill processed under legislative record No. 17512, this Office of the Attorney General warned that permanent structures cannot be used pursuant to a use permit. 5.Regarding the Coexistence of the Public Domain (dominio público) and Private Property in the Refugio Nacional de Vida Silvestre Ostional: As grounds for unconstitutionality, the petitioners allege the “INCOMPATIBILITY ARISING FROM THE EXISTENCE OF PRIVATELY OWNED LAND SUBJECT TO INCOMPATIBLE USES,” challenging the continued presence of registered owners on land within the Refuge, as provided in Article 26, which recognizes only duly registered private property: “Land owned by private parties and validly registered within the boundaries of the Refuge.” That provision must not be read in isolation from Article 29 of the same Law. It adds that this provision does not depart from what is already established in other laws of our legal system and that no unconstitutionality is apparent on the grounds alleged by the petitioners. It must be emphasized that, although the legal system permits mixed-ownership refuges, such authorization is not unconstitutional provided that the continued existence of private property is compatible with the purposes of the protected wilderness area (área silvestre protegida) and constitutionally valid restrictions are imposed upon it, such that private property located within a mixed-ownership refuge cannot be exploited in a manner that endangers the Refuge or the purposes underlying its protection. 6.Regarding the Suspension of Evictions of Occupants While Concession Applications Are Being Decided: Transitory Provision VII is found to infringe the right to the environment enshrined in Article 50 of the Constitution, the principles governing the State’s protection of environmental rights, and the separation of functions and independence among the branches of government, unless it is interpreted, in conformity with the Constitution, as neither preventing the continuation or enforcement of judicial proceedings initiated or conducted under the legislation in force nor suspending evictions in non-concessionable areas or in areas occupied by natural or legal persons who do not qualify for the granting of concessions.
  5. 6Nombre02, in his capacity as Acting Minister of Environment and Energy, submits his report and states that he endorses the opinion issued by the Legal Advisory Office of the Executive Secretariat of SINAC. He therefore requests that this action be dismissed in its entirety. Specifically, said report states: 1. Regarding standing (legitimación): In the case under consideration, the claimants justify their action on the grounds that the challenged provision (norma impugnada)—in their view—violates several environmental principles, such as the principle of rational exploitation of land, the precautionary principle, the principle of non-regression in environmental matters, the principle of objectification, and the principle of the non-reducibility of forests (irreductibilidad del bosque), which imposes upon private parties, municipalities, and, of course, the State the obligation to conduct prior environmental studies before issuing regulations intended to establish territorial planning for an area, particularly where biodiversity may be affected.In other words, the claimants do not base their standing on the allegation that the challenged provisions affect any particular private party, but rather society as a whole; their interest therefore lies in ensuring that the population may enjoy an abstract right held by an indeterminate number of persons who share the same interest, and the Chamber must accordingly determine whether that interest is sufficient to bring the constitutional challenge (acción de inconstitucionalidad). 2. Regarding the merits of the constitutional challenge: the constitutional challenge filed was brought against subsections a, b, c, d, f, and g of Article 8; Articles 9 and 10; subsections a, b, c, d, e, and f of Article 12; Article 26; and Transitory Provision VII, all of the Ley del Refugio Nacional de Vida Silvestre Ostional, Ley N°9348 del 08 de febrero del 2016. 3. Regarding the allegations set forth in the action, the report states that the claimants are correct in asserting that Costa Rica has two beaches where mass nesting by olive ridley sea turtles occurs, one of which is Ostional, located within the Refugio Nacional de Vida Silvestre of the same name.This Refuge was created with the intention of involving the community of Ostional in caring for and managing the olive ridley sea turtle nesting beach, a purpose that remains in effect to this day through a management plan (plan de manejo) entitled “Plan Quinquenal para el Manejo y la Conservación de la tortuga lora en el Refugio Nacional de Vida Silvestre Ostional.” Because of their importance, these ecosystems constitute one of the Refuge’s conservation targets (objetos de conservación), as stipulated in the Plan General de Manejo del Refugio. Their importance is likewise recognized in Ley N°9348, which establishes the regulations necessary to protect this type of ecosystem, as well as the territorial planning (ordenamiento territorial) applicable to the persons residing in the Refugio Mixto de Vida Silvestre de Ostional. It adds that the Refuge does border forest areas, which facilitates the movement of species from one area to another and also provides temporary shelter for many species that use it for reproduction, thereby fulfilling the mission for which it was created.It emphasizes that this new Law was enacted to regularize situations not previously clarified by legislation. It explains that the Ley del Refugio Mixto de Vida Silvestre de Ostional organizes all matters addressed in voto N°02020-2009 of the Sala Constitucional, regulating both environmental matters and the territory occupied by persons living within the Refugio Ostional, whether because they were already there before its creation or because they hold an administrative authorization, in a manner that causes the least possible harm to the resources protected by law. It follows that, when applying the environmental regulations currently in force, the mixed-refuge category (refugio mixto) is better suited to the reality and technical circumstances of Ostional; this matter was also clarified in Article 5 of Ley N°9348 through a provision of superior hierarchical rank and on the basis of the technical reports required under Articles 71 and 72 of the Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo N°34433.Finally, it states that the purpose of Ley N°9348, as set forth in Article 1 thereof, is to establish a special legal regime (régimen jurídico especial) for the Refuge that makes it possible to regulate land uses (usos del suelo), establish a special concessions regime (régimen especial de concesiones), permit the reasonable and sustainable use of its natural resources through the active participation of the communities, and provide legal certainty to those currently occupying land within the Refuge, provided that they comply with the provisions of this Law and its regulations. This special legal regime is based on the technical studies and reports prepared by the Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación and the Universidad de Costa Rica. Therefore, the degree of environmental protection within the Refuge has in no way been diminished or reduced, much less has biodiversity or the landscape been permitted to be placed at risk, since doing so would be contrary to Article 50 of the Constitución Política de Costa Rica and would therefore not be applicable in our role as environmental authorities.Accordingly, the authorizations granted by the Law are technically appropriate and feasible under the Refuge’s management category (categoría de manejo) and the existing technical environmental-planning instruments, such as the Plan General de Manejo. 4. Regarding environmental principles: a. Violation of the constitutional principle of non-regression in environmental matters: first, this principle is neither unlimited nor unrestricted. Moreover, this principle has not been violated, insofar as it is conditioned by the constitutional principles of reasonableness and proportionality, as well as the unequivocal rules of science, technical expertise, expediency, and logic. It adds that this principle has not been violated because all the articles challenged by the claimants are supported by technical reports providing scientific and technical substantiation, are consistent with the management category and proportionate to the protected interest, and do not allow administrative actions to result in the deterioration of natural resources.They therefore cannot be characterized as an arbitrary legislative decision, as the claimants contend, given the existence of numerous technical studies prepared by both the Sistema Nacional de Áreas de Conservación and the Universidad de Costa Rica. b. Violation of the principle of objectification of environmental protection (principio de objetivación de la tutela ambiental) and lack of environmental viability (viabilidad ambiental). The Refuge management category is intended to safeguard the conservation of sea turtles and the protection of their breeding habitats, the conservation and protection of marine-coastal ecosystems, and the sustainable use of natural resources by the organized local communities residing there, as well as to ensure the conservation of the Refuge’s protection objectives. It states that the environmental variable (variable ambiental) was incorporated into the Plan General de Manejo from the outset, in accordance with the guidelines established by SETENA. c. Violation of the principle of objectification due to a lack of land-tenure studies (estudios de tenencia de la tierra).This principle has not been violated, since all corresponding technical studies and reports have been completed. d. Breach of the principle of legality and failure to assess the environmental variable before the Plan General de Manejo. The claimants are incorrect because there are sufficient provisions providing legal support and allowing for the regulation of land uses, a special concessions regime, and the reasonable and sustainable use of natural resources; the Law therefore complies with the body of legality (bloque de legalidad) established in our legal system. e. Violation of the preventive and precautionary principles and failure to protect the mangrove area. It has repeatedly been stated that this Law is necessary to create a special legal regime capable of providing legal certainty for the ecosystems present in the Refuge, based on every citizen’s fundamental right to a healthy and ecologically balanced environment. f. Violation of the principle of the non-reducibility of forests.The enactment of Ley de Ostional N°9348 is in no way intended to reduce the Refuge’s area of operation or territorial extent, nor to lower its degree of protection. It merely applies the classification already established by the Ley de Vida Silvestre and assigns the category that best reflects the Refuge’s actual circumstances, namely the mixed category: first, because there are registered properties within the territory and, second, because it recognizes the existence of human communities within the territory, such as the communities of Ostional, Peladas and Guiones. This is also why schools, secondary schools, churches, and public-service offices are permitted to exist: they were already present at that location, they contribute to social development, and their removal would cause a serious social and environmental impact. For that reason, there is no violation of this principle. It requests that the constitutional challenge be dismissed.
  6. 7[Nombre16 003], [Nombre 004], [Nombre 005], [Nombre 006], [Nombre 007], and others, in their capacities as members of the Consejo Interinstitucional Asesor del Refugio Nacional de Vida Silvestre Ostional (CIMACO), submit a brief and state, in summary, as follows: a) For more than 18 years, CIMACO has worked hand in hand with State institutions, such as SINAC, Municipalidades, and communities neighboring the RNVSO, to ensure the proper management and design of strategies for said refuge. They state that Decreto Ejecutivo N°34590-MINAE created the Consejo Interinstitucional Asesor del Refugio Nacional de Vida Silvestre Ostional and that said Council is an exemplary model for the participatory management of a protected area. b) Regarding participation in the Commission for Ley N°9348: They state that its primary objective has been to obtain a legal framework consistent with reality and compatible with the Refuge’s conservation objectives.They indicate that, since Voto 2020-2009, extensive work has been carried out on 4 bills during 3 administrations, culminating in 2016 with the enactment of ley N°9348 and its corresponding regulations. c) Regarding participation in the Commission for the preparation of the RNVSO Management Plan: They report that its primary objective has been to obtain a scientifically grounded Management Plan serving as an “operational framework,” together with its corresponding regulations, for the management of the Refuge. They state that the plan has been prepared and is currently in the final stage of analysis prior to its subsequent approval. d) Regarding participation in the RNVSO Land Tenure Commission: They indicate that its objective has been to use technical criteria to ensure the lawful occupancy of residents and to guarantee the rights associated with duly registered private property within the RNVSO. e) Regarding participation in the RNVSO Control/Protection Commission: They report that its objective has been to ensure the strategies necessary for the proper management of the Refuge. f) They conclude that CIMACO unanimously approves support for ley N°9348, which is vital to the proper comprehensive management of the RNVSO. They subsequently appear again to address the statements made in the report submitted by the Procuraduría General de la República.
  7. 8By means of the ruling issued at 13:16 hours on 14 de octubre de 2016, the responses to the hearings granted to the Procuraduría General de la República and the Ministro de Ambiente y Energía were deemed submitted. It further states that the representations made by the Consejo Interinstitucional para el Manejo Participativo del Refugio de Vida Silvestre Ostional are deemed submitted and will be resolved at the appropriate procedural stage.
  8. 9Nombre03, in his capacity as Minister of Environment and Energy, files a brief stating that he appears to submit the following additional arguments: 1. Regarding the relationship with sections 8 and 12 of Ley 9348: Ley N°9348 seeks to formalize the social reality surrounding the protected area (área protegida) by providing it with legal support, thereby harmonizing the legal reality with the factual reality, without at any time abandoning the refuge’s conservation objectives. 2. Regarding the land uses (usos de suelo) permitted within the refuge, namely research, training, and ecotourism: Preparation of the Management Plan (Plan de Manejo) is one of the objectives of the law in question, and the possibility of granting concessions (concesiones), and therefore determining such uses, depends on it, as it is the relevant technical planning instrument; and it is through the Management Plan that, in accordance with the environmental impact assessment (evaluación de impacto ambiental) conducted, the areas suitable for the development of each land use are defined. 3.Regarding the lack of technical studies supporting the granting of concessions within Refugio de Vida Silvestre Ostional: the Environmental Impact Study (Estudio de Impacto Ambiental) is one of the environmental impact assessment instruments, but it is not the only one. For the present Law, the technical study prepared by Dr. [Nombre16 008] and others, entitled Informe de Evaluación Ambiental Estratégica del Plan de Manejo Ostional, was conducted; this report is based on environmental fragility indices (Índices de fragilidad ambiental), a methodology officially adopted through Decreto N°32967 de 04 de mayo del 2006. 4. Regarding land-use permits (permisos de uso de suelo) for public and private institutions: They are not considered unconstitutional because a systematic interpretation of the law resolves any question of constitutionality that might arise from Articles 9 and 10. It is evident that those articles do not permit the granting of land-use permits that impair the State’s public domain or contravene the provisions of the Refuge Management Plan.He states that both the regulations and the Management Plan must respect the revocable nature (naturaleza precaria) of the land-use permit and regulate it in accordance with artículo 154 de la Ley General de la Administración Pública, should it ultimately be determined that human presence (presencia antrópica) is viable in those environmentally fragile areas. 5. Regarding the challenged section 26: The purpose of the article is not the expropriation (expropiación) of land within the Refuge, as asserted by the Office of the Attorney General. It must be clear that expropriation is presented as an exceptional avenue or measure to be applied when strictly necessary to fulfill the Refuge’s conservation purposes or objectives, and it should not be used as the first measure. Concessions and land uses must comply with the regulations established by the Law, its implementing regulations, and the respective Management Plan; private properties are therefore clearly subject to the environmental function (función ambiental) incumbent upon them, pursuant to the provisions of the Management Plan and after the corresponding environmental feasibility (viabilidad ambiental) has been granted. If irreconcilable discrepancies arise in this regard, the means of resolving them will be to pursue expropriation pursuant to artículo 29 de la ley.
  9. 10The hearing provided for in artículos 10 y 85 de la Ley de la Jurisdicción Constitucional is dispensed with, on the basis of the authority granted to the Chamber by section 9 thereof, because this decision is deemed sufficiently grounded in evident principles and rules, as well as in the case law of this Court.
  10. 11The statutory requirements have been complied with in the proceedings.

Considering:

I.Preliminary matter. Regarding the statements of Consejo Interinstitucional para el Manejo Participativo del Refugio de Vida Silvestre Ostional.- Pursuant to artículo 83 de la Jurisdicción Constitucional, supporting parties (coadyuvantes) may appear within fifteen days following the first publication. The notices were published on 21, 22 y 23 de setiembre del 2016. Subsequently, on 05 de octubre del 2016, within the fifteen-day period for filing interventions as supporting parties (coadyuvancias), members of Consejo Interinstitucional para el Manejo Participativo del Refugio de Vida Silvestre Ostional appeared to intervene in support of the respondent. As stated, because the intervention was filed within the prescribed period, it is hereby admitted.

II.Subject matter of the challenge.- The petitioners challenge Articles 8 (subsections a, b, c, d, f, and g), 9, 10, 12 (subsections a, b, c, d, e, and f), 26, and Transitory Provision VII, all of Ley del Refugio de Vida Silvestre Ostional (Ley No. 9348 de 08 de febrero de 2016). The challenged articles provide as follows:

“ARTICLE 8.- Granting of concessions.

In the public-domain areas (áreas de naturaleza demanial) of the Refuge, concessions may be granted to current occupants. The following are excluded: a fifteen-meter protection area around the Refuge’s estuaries and mangroves; forests, forest lands, wetland ecosystems, the fifty meters of the public zone of the maritime-terrestrial zone measured from the ordinary high-tide line, areas exposed at low tide, islets, rocky outcrops, and other small areas and natural formations protruding from the sea. The Conservation Area may grant concessions when the study conducted for the specific case technically determines that they are not incompatible with the objectives and scope established in the General Management Plan (Plan general de manejo), for the following uses potentially compatible with the Refuge’s conservation objectives:

  • a)Small-scale sustainable agricultural use.
  • b)Residential and recreational residential use.
  • c)Ecotourism cabins and lodges.
  • d)Commercial use intended to support basic services for communities and visitors.
  • e)Infrastructure for scientific or cultural research and training.
  • f)Facilities for community services and social welfare.
  • g)Research and operation of community projects.” “ARTICLE 9.- Land-use permits for public institutions.

Área de Conservación Tempisque may grant land-use permits within the Refuge to the State and other public entities for the operation of public services, education, research, and any activities that contribute to improving the community’s living conditions, in strict compliance with the General Management Plan and the Refuge’s conservation objectives, in accordance with the regulations to be issued for that purpose, which shall also stipulate all matters concerning terms, extensions, requirements, conditions, and other relevant aspects governing these land-use permits.” “ARTICLE 10.- Land-use permits for private entities Área de Conservación Tempisque may grant land-use permits within the Refuge to private universities, research centers or institutes, and local community organizations for research and the development of community projects, in accordance with the regulations to be issued for that purpose.

Such uses must conform to the Refuge’s conservation objectives and be granted in strict compliance with the General Management Plan. All matters concerning terms, extensions, requirements, conditions, and other relevant aspects governing land-use permits shall be stipulated in the respective regulations.” “ARTICLE 12.- Fees An annual fee (canon) is established for the concession, to be paid by the concession holder and allocated to the maintenance and conservation of the Refuge. This fee shall be calculated using as a parameter the base salary defined in artículo 2 de la Ley N° 7337, de 5 de mayo de 1993, as follows:

  • a)Agricultural use shall pay an annual fee of three percent (3%) of one base salary.
  • b)A residence for residential use of up to one hundred square meters (100 m2) of construction shall pay an annual fee of ten percent (10%) of one base salary. Buildings exceeding one hundred square meters (100 m2) shall pay an annual fee of fifteen percent (15%) of one base salary.
  • c)A residence for recreational residential use of up to one hundred square meters (100 m2) of construction shall pay an annual fee of fifteen percent (15%) of one base salary. Buildings exceeding one hundred square meters (100 m2) shall pay an annual fee of seventeen percent (17%) of one base salary.
  • d)Commercial use shall pay an annual fee of fifteen percent (15%) of one base salary.
  • e)Infrastructure for scientific or cultural research and training shall pay a fee of five percent (5%) of one base salary.
  • f)Research and operation of community projects shall pay a fee of five percent (5%) of one base salary.

The fee shall be deposited into a bank account in the name of Nombre16 of Área de Conservación del Tempisque.” “ARTICLE 26.- Land use on privately owned land.

Privately owned land located within the boundaries of the Refuge shall not be subject to the legal regime governing concessions and fees applicable to State-owned land. Privately owned land validly registered within the boundaries of the Refuge shall, by virtue of the environmental function established in Ley N.° 7788, Ley de Biodiversidad, de 30 de abril de 1998, y sus reformas, be subject to the land-use planning (ordenamiento territorial del uso del suelo) established by the Refuge’s General Management Plan. Consequently, only projects, works, or activities consistent with the Refuge’s zoning (zonificación), its sustainable development regulations (reglamento de desarrollo sostenible), and the technical limitations and potential of each identified zone or subzone may be authorized on such land, all in accordance with this law. Before any activities, works, or projects are undertaken, the requirements established in artículo 82 de la Ley N.° 7317, Ley de Conservación de Vida Silvestre, de 30 de octubre de 1992 must be fulfilled.” “TRANSITORY PROVISION VII.- From the entry into force of this law, and until applications for concessions submitted under it have been resolved, no eviction proceedings shall be initiated against persons occupying the Refuge when this law entered into force.” The petitioners contend that these provisions are unconstitutional because they violate artículos 7, 11, 21, 41, 50, 73, 89 y 169 de la Constitución Política; the constitutional environmental principles of rational land use, precaution, non-regression, objective substantiation, and the permanent protection of forests (irreductibilidad de los bosques); as well as Article 5 of Convención para la Protección de la Flora, la Fauna y de las Bellezas Escénicas Naturales de los Países de América, Article 4 of Convención sobre la Protección del Patrimonio Mundial, Cultural y Natural, and Article 4 of Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas. In this regard, the Chamber observes from the initiating petition that the petitioners enumerate eleven grounds of unconstitutionality. Namely:

-From a reading of all eleven claims, it can be seen that almost all of them (claims 1, 2, 3, 6, 9, 10 and 11) revolve around the same argument. Namely, the unconstitutionality of Articles 8 and 12 of the challenged law because they permit land uses (usos de suelo) incompatible with the environment, thereby violating the principle of non-regression (principio de no regresión) (claim 1), the principle of objective environmental protection (objetivación de la tutela ambiental) (claims 2 and 3), the protection of mangroves (claim 6), legislative due process (debido proceso legislativo) (claim 9), and the principle against reduction of forest areas (principio de irreductibilidad del bosque) (claim 10), because natural areas subject to the special protection regime are being restricted, as well as violating the principle of non-compensation (principio de no compensación) (claim 11). Therefore, the examination of the merits of this issue will consist of determining whether the land uses authorized in Articles 8 and 12 of the challenged law violate Constitutional Law (Derecho de la Constitución).

-The other group of claims (4, 7 and 8) must be rejected because they do not identify the challenged provision individually and, moreover, raise issues of legality rather than constitutionality. Thus, permitting construction without satisfying the requirements (claim 4) and stating that such construction “might” not be in harmony with the environment (claim 7) are issues of legality, and it is for the ordinary courts to determine whether such construction was in fact carried out without satisfying the requirements or is not “in harmony” with the environment. Claim 8, concerning the fact that Article 26 does not include the possibility of expropriation, must likewise be rejected because it is an insufficiently substantiated claim of unconstitutionality by omission (inconstitucionalidad por omisión).

-Finally, claim 5 challenges Transitory Provision VII (Transitorio VII) of the law for failing to establish a time limit for processing concessions and thereby perpetuating the irregular situation of the refuge, in violation of the preventive and precautionary principles in environmental matters (principio preventivo y precautorio en materia ambiental). This claim will also be examined on the merits.

III.The standing (legitimación) of the petitioners.- Article 75 of the Ley de la Jurisdicción Constitucional governs the conditions determining the admissibility of constitutional challenges (acciones de inconstitucionalidad), requiring the existence of a matter pending resolution in administrative or judicial proceedings in which unconstitutionality has been invoked. This requirement is unnecessary in the cases provided for in the second and third paragraphs of that article, that is, when the nature of the provision precludes individual or direct injury; when the challenge is based on the defense of diffuse interests (intereses difusos) or interests concerning the community as a whole; or when it is filed by the Procurador General de la República, the Contralor General de la República, the Fiscal General de la República or the Defensor de los Habitantes, in the latter cases within their respective spheres of authority.

Under the first situation provided for in paragraph 2 of Article 75 of the Ley de la Jurisdicción Constitucional, the challenged provision must not be susceptible to concrete application that would subsequently allow the implementing act to be challenged and used as the underlying proceeding (asunto base). Second, it provides for the possibility of bringing an action in defense of “diffuse interests,” meaning interests held by groups of persons who are not formally organized but are united by a particular social need, a physical characteristic, their ethnic origin, a particular personal or ideological orientation, consumption of a certain product, etc. In these cases, the interest is dispersed or diluted (diffuse) among an unidentified plurality of persons. This Sala has listed various rights that it has characterized as “diffuse,” including the environment, cultural heritage, defense of the country’s territorial integrity, sound management of public expenditure, and the right to health, among others.

Furthermore, the list established by the Sala Constitucional is not exhaustive. Finally, when paragraph 2 of Article 75 of the Ley de la Jurisdicción Constitucional refers to interests “concerning the community as a whole,” it means the legally protected interests (bienes jurídicos) explained above, namely, those vested in the very holders of sovereignty, each of the inhabitants of the Republic. Consequently, this does not mean that any person may appear before the Sala Constitucional to protect any interest whatsoever through a citizen action (acción popular); rather, every individual may act in defense of those interests affecting the entire national community, and no attempt to establish an exhaustive list is valid in this area either. Based on the foregoing, it is clear that the petitioners have sufficient standing to challenge the constitutionality of the contested provisions, without needing a prior proceeding to serve as the basis for this action.

This is because they appear in defense of an interest concerning the national community as a whole: the right to the environment. The petitioners therefore have full standing to bring a direct action under paragraph 2 of Article 75 of the Ley de la Jurisdicción Constitucional. This is indeed a matter whose constitutionality may properly be reviewed through these proceedings. Moreover, they satisfied the requirements stipulated in Sections 78 and 79 of the governing procedural law (Ley de rito). In conclusion, this action is admissible, and the Court must therefore proceed immediately to consider its subject matter and merits.

IV.Methodology for analyzing the action.- To facilitate examination of the challenged legislation, the following recitals (considerandos) will first provide a general analysis of the challenged law and will then analyze the two groups of claims admitted for consideration in this action.

V.General discussion of Law n°9348, “Refugio de Vida Silvestre Ostional,” of 2016 and this Sala’s precedents concerning it.- The protected area under examination was initially declared by Executive Decree (decreto ejecutivo) nro. 13200-A del 15 de diciembre de 1981, for the purpose of protecting turtle nesting and reproduction between río Nosar and Quebrada Rayo in Guanacaste. It was subsequently formally established as a national wildlife refuge (refugio nacional de fauna silvestre) by the sole transitory provision (transitorio único) of Law nro. 6919, “Ley de Conservación de la Fauna Silvestre”, del 17 de noviembre de 1983, which provided that its area would encompass the two hundred meters of the maritime-terrestrial zone (zona marítimo-terrestre) extending from the right bank of the mouth of Río Nosara to Punta India. Its protected area was later expanded by Executive Decree nro. 16531 del 18 de julio de 1985, which established that it would encompass an area of 200 meters, measured from the ordinary high-tide line (pleamar ordinaria), extending from the left bank of the mouth of río Nosara to Punta Guiones.

On 7 de diciembre de 1992, through Law nro. 7317, the Ley de Conservación de la Vida Silvestre was amended, and Transitory Provision I (transitorio I) provided as follows: “The Refugio de Vida Silvestre Ostional is hereby created and, for purposes of this Law, shall be located within the two hundred meters of the maritime-terrestrial zone extending from Punta India to Punta Guiones, Cantón de Nicoya, Provincia de Guanacaste. The Poder Ejecutivo shall demarcate the Refuge within thirty days following publication of this Law.” Through Executive Decree nro. 22551-MIRENEM del 14 de setiembre de 1993, the area of this refuge was expanded again. Thus, prior to the challenged law, the boundaries of the refuge’s protected area had been duly established, without any particular exclusion or special regime, thereby designating the refuge in its entirety as public-domain property (demanio público). Accordingly, the Refugio de Vida Silvestre Ostional was created through Law n°6919, Ley de Conservación de la Fauna Silvestre, el 17 de noviembre de 1983. Its boundaries were expanded through Decree n°16531 del 18 de julio de 1985 and Decree n°22551 del 14 de setiembre de 1993.

During those years, the Sala Constitucional stated, in decisions numbered 2003-008742, 2007-002157 and 2009-002020, that:

“… given that the Refugio de Vida Silvestre Ostional is public-domain property and forms part of the national heritage, no activity may be authorized within it unless directed exclusively toward its protection and research.” … “Likewise, if the owners of land occupied prior to the creation of the Refuge object… the corresponding expropriation must be ordered.” (voto 2003-008742) “Based on the foregoing and the case law quoted, the Sala reiterates that the Área de Conservación Tempisque del Ministerio del Ambiente y Energía may not authorize any activity in the Refugio de Vida Silvestre Ostional unless directed exclusively toward its protection and research; therefore, permitting trenching for the installation of drinking-water pipes along a road within the Refugio de Vida Silvestre directly violates Article 50 of the Constitución Política. Consequently, the petition is granted on the ground that the right to a healthy and ecologically balanced environment has been violated.

The permit granted through official letter 108-05 del doce de agosto del dos mil cinco by the Administrador de la Administración del Refugio Nacional de Vida Silvestre Ostional del Área de Conservación Tempisque del Sistema de Áreas de Conservación del Ministerio de Ambiente y Energía is annulled.” (voto 2007-002157) “… the Refugio Nacional de Vida Silvestre Ostional del Área de Conservación Tempisque… is indisputably public-domain property … forms part of the Patrimonio Forestal de Estado… By virtue of its public-domain nature and its corresponding dedication to safeguarding the flora and fauna of the area, the lands comprising the reserve may not be appropriated by private parties … within refuges such as Ostional, the authorities may authorize only activities directed toward research, protection, training and ecotourism…” (voto 2009-002020) Subsequently, in junio del 2011, Bill n°18.148, “Ley de Territorios Costeros Comunitarios,” was introduced in the Asamblea Legislativa.

According to the bill itself, its purpose was to create the designation of community coastal territories (territorios costeros comunitarios) as a new special category of protection and also to provide a definitive solution concerning land tenure (tenencia de la tierra) in coastal, fishing and island communities, all through a special concession regime (régimen especial de concesiones). After being approved on first reading, this bill was submitted to this Sala for an optional constitutional consultation (consulta facultativa de constitucionalidad) on 30 de mayo del 2013. The text submitted to the Sala Constitucional by several Deputies, published in supplement No. 62 of La Gaceta No. 67 del 8 de abril del 2013, contained provisions analogous to those now challenged, permitting concessions to be granted in the public-domain areas of the Refuge. The consulting Deputies considered that allowing such concessions within the Refuge would change the conditions of protection by reducing the scope of protection, without any technical justification establishing that this possibility was feasible and compatible with the site’s environmental protection; they argued that Articles 50 and 89 of the Constitution were therefore violated.

The Sala Constitucional decided that consultation through decision No. 2013-10158 de las 15:46 horas del 24 de julio del 2013, holding that a law permitting such concessions to be granted within the Refugio de Vida Silvestre Ostional had to be supported in its legislative record by an environmental impact study (estudio de impacto ambiental) approved by SETENA and that the absence of such a study would constitute a fundamental procedural defect (vicio esencial al procedimiento):

“II.- FORMAL ASPECTS: The absence of technical studies determining whether concessions may be granted for the development of human activities when a Wildlife Refuge is designated a Community Coastal Territory (Territorio Costero Comunitario): The only issue raised by the consulting members of the Legislative Assembly regarding form concerns the violation of the procedure established in Articles 36 and 38 of the Ley Orgánica del Ambiente, Ley Nº 7554. They argue that there are no technical studies justifying the appropriateness of granting concessions within a Wildlife Refuge, given the impacts that activities conducted on such lands will undoubtedly have on protected areas (áreas protegidas) … upon analyzing the text of the bill, as well as the various opinions provided by the authorities consulted, this Court observes that the provisions at issue, specifically Articles 45 and 51 of the bill, establish, first, the designation as a Community Coastal Territory and, second, the possibility of granting concessions within the Refuge.

Although Article forty-six of the bill provides for an environmental impact study (estudio de impacto ambiental), that requirement is not equivalent to fulfilling the requirement during the legislative proceedings; there is an important qualitative difference between fulfilling the requirement before the provision is enacted and fulfilling it after its enactment, which is what Article forty-six of the bill provides. The designation of a National Wildlife Refuge, in this case Ostional, as a Community Coastal Territory does affect its management and the regulatory regime governing it, as may be inferred from the provisions contained in Chapter Three of the bill under consultation; its application may have a significant influence on the nature of the refuge, weakening its protection regime, and for this reason a prior environmental impact study is required. There is no doubt that designating a National Wildlife Refuge as a coastal territory may significantly alter the actual and effective condition of the area protected by the refuge. The regime defining the refuge may be deprived of substance.

The bill under discussion lacks technical studies substantiating not only the factual circumstances but also its technical feasibility, as well as its reasonableness and proportionality as standards of constitutionality, principles that every legal provision must observe, particularly when public resources are affected, as in this specific case.

The foregoing allows this Court to concur with the consulting members of the Legislative Assembly that the legislative record (expediente legislativo) contains no technical study analyzing and determining whether environmental protection may be reduced in accordance with the principle of objective environmental protection (principio de objetivación de la tutela ambiental), even though there are both institutions and experts in environmental matters that could have prepared the technical study missing from the bill.

In view of the foregoing, the consultation must be answered by noting the existence of substantial constitutional defects in the processing of the bill, pursuant to Article 101 of the Ley de la Jurisdicción Constitucional…

III. AS TO THE MERITS: …

With respect to the Refugio Nacional de Vida Silvestre Ostional, compliance with the Precautionary Principle (Principio Precautorio) requires that, before its designation as a Community Coastal Territory and the granting of concessions—as stated by the consulting members of the Legislative Assembly—an environmental impact study be conducted and evaluated by Secretaría Técnica Ambiental, demonstrating the type of harm and the measures that must be adopted. Such a study is absent from this legislative initiative, since a refuge cannot cease to be protected without technical criteria supporting that decision. Therefore, this omission entails a violation of the precautionary principle and the principle of progressivity in the scope of protection of fundamental rights (principio de progresividad del ámbito de tutela de los derechos fundamentales), an issue identified in the formal defect analyzed in this judgment.” (Boldface does not appear in the original).

Following this judgment, the bill was shelved by the Asamblea Legislativa. Subsequently, a few months after the cited judgment was issued, in October 2013, expediente n°18.939 was introduced in the legislative process, giving rise to the law challenged in this action. The statement of reasons in the original text described the purpose of that initiative:

“… since 2008, various decisions of the Contraloría General de la República and judgments of the Sala Constitucional have ordered, respectively, the annulment of permits granted to occupants in certain protected wilderness areas (áreas silvestres protegidas) and the eviction of some of those occupants. This situation has arisen in part from restrictive interpretations of the existing legal framework… This initiative seeks to resolve the problem described by creating a special regulatory framework that promotes the harmonious coexistence of the Ostional community with the Refugio Nacional de Vida Silvestre, for the benefit of the environment and human beings…

… this option recently suffered a setback as a result of decision n°2013-10158 of the Sala Constitucional de la Corte Suprema de Justicia, issued at fifteen hours and forty-six minutes on veinticuatro de julio de 2013… In light of this situation, it has become essential to introduce this bill as an independent initiative so as not to further delay the final enactment of the Ley de Territorios Costeros Comunitarios…

The technical studies referenced by the Sala Constitucional are at a highly advanced stage… They will be submitted to the legislative process at the appropriate time during consideration of this initiative.

Accordingly, this proposal incorporates substantial elements of the initiatives previously introduced in order to provide a definitive response to the critical situation of the Ostional community. Although it is being considered as an independent law, it is fully based on the model established by the Ley de Territorios Comunitarios and refers to its most important provisions.” It follows with complete clarity that the initiative was introduced specifically to create a special regime for Ostional, as had been contemplated in the shelved Ley de Territorios Comunitarios bill. That special regime is said to be intended to achieve conservation objectives while allowing people to remain and activities to be conducted within the area, from which it is understood that the special regime is intended to permit activities that are not allowed under the refuge’s protection framework. Ley No. 9348 was thus enacted, establishing a specific and differentiated legal regime for the Refugio de Vida Silvestre Ostional and allowing occupants of the maritime-terrestrial zone (zona marítimo terrestre) to remain through the granting of concessions and use permits (permisos de uso) for various activities.

The purpose of Ley No. 9348 de 8 de febrero del 2016, as established in Article 1 thereof, is to establish a special legal regime for the Refugio de Vida Silvestre Ostional in order to regulate land uses (usos del suelo), establish a special concessions regime, provide for the reasonable and sustainable use of its natural resources through the active participation of the communities, and provide legal certainty to those who currently occupy land within the Refuge, provided that they comply with the provisions of this law and its regulations. Regarding title to the Refuge, its public-domain status (demanio público) is specified by stating that the State shall retain ownership of the lands belonging to it within the Refuge, regardless of their nature, suitability, or current use, and that under no circumstances may their public-domain status (demanialidad) be impaired. Nevertheless, pursuant to this law, the granting of concessions to current occupants who satisfy the required conditions and all other applicable requirements may be authorized.

Land uses may also be authorized on privately owned real property located within the Refuge (Article 3). Article 5 then provides that the Refuge shall be mixed in nature (naturaleza mixta) and shall comprise lands owned by the State or other public entities, as well as lands owned by private parties that have been recorded in the corresponding registry, provided that both forms of ownership are subject to uses compatible with the Refuge’s environmental conservation and protection objectives, under an integrated conservation approach. It follows from all the foregoing that the challenged law introduced provisions to “permit” within the Refugio de Vida Silvestre de Ostional everything that the case law of this Sala had identified as prohibited, by reclassifying it as a mixed refuge and allowing concessions for activities extending beyond research, protection, training, and ecotourism.

Regarding the importance of protecting the Refugio de Vida Silvestre Ostional, it should be noted that turtles and mangroves are among the Refuge’s most important natural resources. The Refugio Nacional de Vida Silvestre Ostional (folio 67) is divided into two distinct parts:

-Ostional and Nosara Beaches, where sea-turtle nesting activity is concentrated. Ostional and Nosara Beaches constitute the world’s most important sea-turtle nesting site.

-Pelada and Guines Beaches, together with Puntas Rayo, Nosara, Pelada and Guiones, where certain coastal ecosystems have been preserved. These areas serve as buffer zones (zonas de amortiguamiento).

It is therefore appropriate to examine below whether this is unconstitutional.

VI.Whether the land uses authorized under Articles 8 and 12 of the challenged law violate the Law of the Constitution (Derecho de la Constitución).- The claimants consider that only concessions for residential use, ecotourism lodges, and scientific-research infrastructure are constitutional, and challenge the other uses contemplated in Articles 8 and 12, such as:

“Small-scale sustainable agricultural use” (subsection a of Art.8).

“Recreational… residential use.” (subsection b of Art.8) “Ecotourism… cabins.” (subsection c of Art.8) “Commercial use intended to support basic services for communities and visitors” (subsection d of Art.8) “Facilities for community and social-welfare services.” (subsection f of Art.8) “Research and operation of community projects.” (subsection g of Art.8) Uses that are reiterated in Article 12, when it refers to the fee (canon) that the concessionaire must pay in order to engage in such uses. They consider that all these uses are incompatible with the environment, that mangroves are being left unprotected, that this is reducing the forest without any compensation, and that, in any event, a legislator who participated in the vote on this law should have recused himself because he owned land there, thereby tainting all its provisions with his vote. In the opinion of the Procuraduría General de la República, the regulations are unconstitutional because, pursuant to the precedents of the Sala Constitucional concerning the Refugio de Vida Silvestre Ostional (judgment number 13-010158), a law permitting the granting of concessions there for activities other than “research, protection, training, and ecotourism” must have, as part of its legislative history, an environmental impact study (estudio de impacto ambiental) approved by SETENA; however, there is no indication in legislative file No. 18939, which gave rise to Ley No. 9348, that this requirement was met.

It states that these provisions would be unconstitutional because they violate Articles 50 and 89 of the Constitution and the principle of the inviolability of the public zone (principio de intangibilidad de la zona pública), unless they are interpreted, in accordance with the Constitution, to mean that the authority conferred therein is subject to the prior conditions contained in Article 11 of the Law, such that estuary areas, mangroves (regardless of their current or former extent), wetland ecosystems, protection areas (áreas de protección), forests, forest lands or lands suited to forestry, the 50 meters measured from the ordinary high-tide line and tidal inlets, areas exposed during low tide, islets, rocky outcrops, and other small areas and natural formations rising above the sea may not be the subject of either a use concession (concesión de uso) or a use permit (permiso de uso). For his part, the Ministro de Ambiente y Energía states in his report that the challenged provision has extensive technical support, since the Área de Conservación prepared the environmental fragility studies (estudios de fragilidad ambiental), occupancy and land-tenure studies, the General Management Plan (Plan General de Manejo), and the biophysical assessments of the Refugio, which provide the basis for Ley N°9348.

He further adds that its legal framework is consistent with Article 82 of the Ley de Conservación de Vida Silvestre, which establishes that, in state-owned and mixed-ownership refuges, only activities defined in the management plan (plan de manejo) prepared by the protected area may be carried out, following submission of the corresponding environmental impact assessments (evaluaciones de impacto ambiental). The transitional provisions (transitorios) establish a series of steps that must be followed before any concession may be granted in the Refugio, as a means of ensuring that all important technical elements have received prior approval. Everything authorized by the articles challenged by the petitioners is supported by technical reports that provide a scientific and technical basis and is consistent with the management category (categoría de manejo) and proportionate to the object of protection.

The Reglamento de Desarrollo Sostenible establishes the conditions and management recommendations for each land use. There are overuse zones classified as zones with a very special condition; corrective measures must be established in these zones. Likewise, the Plan General de Manejo establishes the management objectives and zoning; the characteristics, constraints, and permitted uses are established for each zone. For its part, the supporting intervenor (coadyuvante), the Consejo Interinstitucional para el Manejo Participativo del Refugio de Vida Silvestre Ostional, states that the claim that Articles 8 and 12 of Ley 9348 permit uses that cannot be carried out on state-owned land is unfounded, because it rests on the assumption that the Refugio in question is 100% state-owned, when it is in fact mixed property. Far from reducing the scope of environmental protection, the challenged provisions actually seek to make it effective through land-use planning and regulation, in order to harmonize the conservation purposes of the Refugio with the unavoidable fact that private persons are present within it.

Regarding the lack of a technical report, it states that the prior technical study was prepared by Dr. [Nombre16 008] and is entitled “Informe de Evaluación Ambiental Estratégica del Plan de Manejo Ostional.” Although the Refugio was declared state-owned by this Sala, it has never actually been state-owned but rather mixed, as demonstrated by the existence of private property across a considerable percentage of its territory, established before the Refugio itself was created.

Based on all the foregoing, this Sala finds that unconstitutionality does indeed exist, but not only with respect to the challenged provisions; rather, it extends to the entire law, as explained below.

-The Refugio de Vida Silvestre Ostional is owned by the State, and no public-domain property (propiedad demanial) may be reduced by law without prior technical studies justifying that reduction: The area of forest reserves, protected zones, national parks, wildlife refuges, and biological reserves belonging to the forest estate (patrimonio forestal) may be reduced only by a law of the Republic, following the corresponding technical studies justifying that measure (Article 40 of the Ley Forestal). This is so because the legally protected interest (bien jurídico) is the “forest resource,” a term that “means the protection and preservation of the integrity of the natural environment” (decision number 2233-93 of the Sala Constitucional, issued at nine thirty-six a.m. on the twenty-eighth of May, nineteen ninety-three). In this regard, Article 69 of the Constitución Política refers to the “rational use of land,” the protection of which constitutes a fundamental principle.

The Refugio is defined as state-owned property, and therefore development activities or the exploitation of natural resources may not be carried out there. No law may simply alter that state-owned status by designating it as “mixed” without specific technical support. Its state-owned status does not change merely because a legal provision purports to alter the nature of the Refugio by stating that it is mixed property. Thus, a modification of its nature entails harm to the environment. Indeed, the Refugio de Vida Silvestre Ostional, which is located within the maritime-terrestrial zone (zona marítimo terrestre), is owned by the State. The State has full jurisdiction over it, and therefore private persons may not be permitted to carry out any activity there, such as those authorized by the challenged Articles 8 and 12. The laws concerning the environment (Ley Orgánica del Ambiente, Ley de Conservación de la Vida Silvestre and its Reglamento, Ley Forestal, and Ley de Zona Marítimo Terrestre, for example) did not classify the Refugio de Vida Silvestre Ostional as a mixed-ownership refuge in which development activities or projects, or the exploitation of natural resources, could be authorized.

That was not done until 2013, by the law now being challenged, which, contrary to the case law of this Sala, changed the status of the Refugio from state-owned to mixed in order to permit other uses within it, without a prior technical study justifying that change, as stated above.

-The challenged law, through its various provisions, removes portions of the Refugio de Vida Silvestre Ostional from protected status and reduces its level of protection: As the petitioning party points out, the legislature enacted several provisions that entail removal from protected status (desafectación) of the area to be protected and reduce the level of protection that had been afforded to it. It did so without justification through a technical study, as this Court has repeatedly required. Article 5, for example, changed its legal status from an exclusively public refuge to a mixed refuge, providing that, from that point forward, it would no longer consist solely of State-owned land, but would also include privately owned land recorded in the corresponding registry. Although the provision states that this will occur only if both forms of ownership are subject to uses compatible with its environmental conservation and protection objectives, under an integrated conservation approach, the fact remains that subsequent articles authorize activities for which there is no prior technical study establishing that those activities will not undermine the purpose for which the refuge was established.

Article 8, challenged here, provides that, in “the public-domain areas (áreas de naturaleza demanial) of the Refuge, concessions may be granted to current occupants,” except for those located within a fifteen-meter protection area around the Refuge’s estuaries and mangroves; forests, forest land, wetland ecosystems, the fifty meters of the public area of the maritime-terrestrial zone measured from the ordinary high-tide line, areas exposed during low tide, islets, rocky outcrops, and other small areas and natural formations projecting from the sea. That provision states that the Conservation Area may grant concessions when a study conducted for the specific case technically determines that they are not incompatible with the objectives and scope established in the General Management Plan, for the following uses potentially compatible with the Refuge’s conservation objectives: “a) Small-scale sustainable agricultural and livestock use. b) Residential and recreational residential use. c) Ecotourism cabins and lodges. d) Commercial use intended to support basic services for communities and visitors. e) Infrastructure for scientific or cultural research and training. f) Facilities for community and social-welfare services. g) Research and operation of community projects.” Article 12 even establishes the payment of fees for carrying out those activities.

In other words, under these provisions, the refuge not only loses part of its territory through the change in its legal status and the establishment of privately owned land within it, but various activities other than those established by the Ley Forestal for mixed refuges of this kind are also authorized without a prior technical study assessing their potential environmental impacts, as required by the precautionary principle (principio precautorio) (for example, the agricultural and livestock, residential, and commercial uses contemplated in challenged Article 8). Article 9 of the same law also introduces a new provision authorizing land-use permits (permisos de uso de suelo) for public institutions to provide public services unrelated to the sphere of protection, without any prior technical study likewise justifying why certain protected areas are not only removed from protected status but also subjected to a reduced level of environmental protection.

Previously, none of those activities were permitted, whereas the law now authorizes them without first establishing that they will not cause environmental harm. Similarly, Article 10 of this law allows the Área de Conservación Tempisque to grant land-use permits within the Refuge to private universities, research centers or institutes, and local community organizations for research and the development of community projects. Moreover, these two provisions do not exclude the areas that are excluded from the granting of concessions, as the Procuraduría General de la República correctly states in its report. Indeed, the wetlands, forest areas, forest land or land having that suitability, and the other zones excepted under Articles 8 and 11 of the law are not safeguarded from inclusion in the public area, in violation of Articles 50 and 89 of the Constitution. The challenged law does provide in Article 11 that a General Management Plan must be issued before concessions are granted in the Refuge and must determine that the uses are aligned with the Refuge’s conservation objectives, subject to the environmental and technical limitations and potential of each zone or subzone.

Nevertheless, given the particular circumstances of this case—where, as stated repeatedly, a higher level of regulatory protection already existed, and not only was part of its territory removed from protected status for purposes that even extended beyond environmental protection, but the level of protection afforded to certain areas was also reduced in order to resolve an occupancy problem within this area, a purpose unrelated to that of the refuge—the legal reform was required from the outset to be supported by a technical study justifying such changes and compensating for the existing environmental protection. This Court had already so held with respect to this same refuge when, through legislative consultation (consulta legislativa), it ruled on Bill No. 18.148, “Ley de Territorios Costeros Comunitarios,” in Judgment No. 2013-10158 at 15:46 on July 24, 2013. Nevertheless, once again, no such study is present.

-Lack of technical support: The legislative record No. 18939, which gave rise to Law No. 9348, does not show compliance with the technical-support requirement under the terms previously set forth by this Chamber in the aforementioned ruling 2013-010158. The bill’s statement of reasons clearly shows that the supporting technical reports were not available at that time, stating: “The technical studies referenced by the Constitutional Chamber are at a very advanced stage… They will be submitted to the legislature in due course.” Although the Minister of Environment states in his report that there will be a General Management Plan as a prerequisite for granting concessions and that a specific study will also be conducted in each case, this does not replace the PRIOR technical studies that must serve as the basis for a bill that, in substance, entails reducing the Refugio de Vida Silvestre de Ostional.

This is because such studies are not a mere formality, nor may they be replaced by subsequent or case-specific studies. Rather, allowing land uses beyond those related to the conservation of a Wildlife Refuge (Refugio de Vida Silvestre) undermines the refuge’s essential purpose, reduces the refuge’s area in any event, and thereby violates the right to a healthy environment (derecho al ambiente). Regarding the supporting party’s assertion that the technical report for the law is the report prepared by Dr. [Nombre16 008], entitled “Informe de Evaluación Ambiental Estratégica del Plan de Manejo Ostional,” it must be stated that this Chamber reviewed that report and concludes that it clearly is not the report that provides technical justification for the law, essentially for three reasons: the date of the report, its stated purpose, and its content. That report dates from 2009; the bill was introduced in 2013, and the report was added to the legislative record in June 2015.

A technical report serving as the basis for a bill must be submitted together with the bill. Moreover, it should be noted that when this Chamber reviewed the matter through consultation in its 2013 ruling, nothing was said at that time about this 2009 technical report serving as the basis for the bill. Furthermore, the stated purpose of that report is unrelated to the bill, as it indicates that it is a baseline study for preparing the Refuge’s Management Plan (“The objective of the study is to develop zoning based on Environmental Fragility Indices (Indices de Fragilidad Ambiental, IFA) for the Refugio Nacional de Vida Silvestre Ostional… for the purpose of establishing a technical basis for the Management Plan for this collection of important ecosystems.”). Finally, its content does not address what a technical report supporting a bill that reduces the level of protection of a wildlife refuge should address, because it does not specifically explain why the protection is being reduced, how it is being reduced, or what compensatory measures are being established.

-Environmental public-domain status (demanialidad ambiental) entails a special protection regime: A declaration of public-domain status for environmental reasons entails a special sphere of protection insofar as it establishes a special ownership regime governed by stringent rules of public law and intended to ensure fulfillment of the purpose of safeguarding the right to a healthy and ecologically balanced environment. In view of those foundational reasons and the benefits underlying its teleological dimension, any decision to withdraw such status (desafectación), in whole or in part, or to reconfigure its legal nature requires and mandates appropriate technical analyses that weigh the environmental variable in decision-making, as a consequence of the principles of non-regression, environmental progressivity, precaution, prevention, and pro natura. The special constitutional protection afforded to the environment requires an exhaustive study of the reasons supporting such decisions, in the context of the various levels comprising ecosystems, as well as the relationships between the environment and its anthropological surroundings and, within the latter, the social and economic effects, among others.

Thus, the absence of such technical rigor in changing the nature of environmental public property disregards and violates, even by creating a risk, the substantive content of that right. The same must be noted regarding the permissibility of human activities within those territorial areas without properly weighing the impact that such activities may have on the environment; for this purpose, consideration must be given to the property’s primary use regime, the types of ecosystems converging in that area, and whether special use regimes imposed by legal rules exist. Indeed, changing the use of property that has traditionally been afforded an environmental protection regime requires technical assessments of the consequences that these new human incursions will have on the ecosystem, as well as whether they are compatible with the environment in a context of environmental sustainability. This entails weighing permitted conduct, corrective actions and procedures, mitigation measures, compensatory actions, and other considerations that are absent from this record.

As explained, this deficiency entails substantive violations that this Chamber cannot overlook, given that public assets, conceptually, comprise the body of property that by law—or a higher-ranking rule—is dedicated to a public use and purpose. Although the regime governing their use is not wholly incompatible with exclusive exploitation by third parties, subject to express prior administrative authorization, which must be expressly regulated by statute, where environmental public-domain property is concerned, assessment of this framework of permitted activities requires a meticulous, cautious, and technical analysis in light of the conditions and characteristics of the environment as a protected legal interest and its undeniable significance for contemporary human rights and those of future generations. It is this protective purpose that requires the special technical considerations discussed above, in order to fulfill the constitutional obligation to safeguard the right to a healthy and ecologically balanced environment.

This also entails assessing actions to restore the areas affected by and subject to the impacts of the various ecosystems, as a necessary means of environmental regeneration and strengthening the Natural Heritage of the State (Patrimonio Natural del Estado). This function of public property justifies why its ownership does not lapse through the passage of time, why restoration actions are not subject to time limits, and why registry actions that impair this special property regime may neither be asserted against it nor create a superior right.

-The Refugio de Vida Silvestre Ostional is part of the Natural Heritage of the State: It is clear that the Refugio de Vida Silvestre Ostional is part of the Natural Heritage of the State. The Natural Heritage of the State consists of the forests and forest lands (terrenos forestales) within national reserves, areas declared inalienable, properties registered in its Name16, and those belonging to municipalities, autonomous institutions, and other agencies of the Public Administration. This undoubtedly suggests that, even if persons occupying land before the creation of the Refugio de Vida Silvestre Ostional are located within it, if the land on which they are located forms part of the Refugio, the corresponding expropriation must be ordered. This means that the legislature cannot establish the mixed status of the refuge without any technical basis. On that basis, insofar as the challenged law permits the authorization of activities in the Refugio de Vida Silvestre Ostional that are not directed toward its protection and research, it is unconstitutional.

This unconstitutionality arises both procedurally and substantively. Procedurally, it was established that the legislative record contains no technical study analyzing and determining the possibility of reducing environmental protection under the principle of objectification of environmental protection (principio de objetivación de la tutela ambiental), which constitutes an essential constitutional defect in the processing of the bill under Article 101 of the Ley de la Jurisdicción Constitucional, as this Chamber has previously stated. Furthermore, it is also substantively unconstitutional because, in compliance with the Precautionary Principle (Principio Precautorio), before changing the nature and scope of protection of the Refugio and allowing concessions, an environmental impact study (estudio de impacto ambiental) evaluated by the Secretaría Técnica Ambiental is required, so as to demonstrate the type of harm and the measures that must be adopted.

Such a study is absent from this legislative initiative, since protection could not be withdrawn from a refuge without technical criteria supporting that decision. Accordingly, this omission entails a violation of the precautionary principle and the principle of progressive protection of fundamental rights, an issue identified in the procedural defect analyzed in this judgment. Because this is a procedural defect, the entire law is unconstitutional, not merely the challenged provisions. It is therefore unnecessary to rule on the remaining claims raised by the petitioner, given the consequence involved, namely, the nullity of the entire law challenged here.

Finally, regarding the argument that the law is void because a particular legislator who voted in favor of it had specific interests, this is not a constitutional argument but a matter of legality that may be litigated in criminal proceedings, where it must be determined whether any unlawful act occurred in that regard.

VII.Conclusion.- It has been established that the challenged Law changes the nature of the Refugio de Vida Silvestre de Ostional in a manner that reduces its level of protection by permitting land uses (usos de suelo), and therefore concessions, extending beyond protection, research, training, and ecotourism. It has been established that this was approved without technical studies substantiating the factual circumstances, technical feasibility, and reasonableness and proportionality as constitutional parameters—principles that every legal rule must observe, particularly when public property is affected, as in this specific case. Accordingly, the entirety of Law n°9348 “Refugio de Vida Silvestre Ostional” is declared unconstitutional for lack of a technical basis justifying the authorization of land uses other than research, protection, training, and ecotourism and the resulting impairment of the right to the environment.

Because it lacks this technical criterion, the statutory amendment challenged here is affected by a defect in the legislative procedure that renders it untenable and violates the precautionary principle, the principle of objectification of environmental protection, the principle of environmental non-regression, the rational use of land, and therefore the right to a healthy and ecologically balanced environment, as provided by our Constitución Política, Article 5 of the Convención para la Protección de la Flora, la Fauna y de las Bellezas Escénicas Naturales de los Países de América, Article 4 of the Convención sobre la Protección del Patrimonio Mundial, Cultural y Natural, and Article 4 of the Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas. Consequently, Law n°9348 “Refugio de Vida Silvestre Ostional” is annulled as unconstitutional, and executive decree n°41134 of April 10, 2018 is also annulled by connection.

Accordingly, all regulations safeguarding the Refugio de Vida Silvestre de Ostional remain in force, including the Ley de Conservación de la Fauna Silvestre (Law n°6919 of November 17, 1983) and decrees n°16531 of July 18, 1985 and n°22551 of September 14, 1993.

VIII.Regarding the effects of this ruling granting the action and the nullity of the challenged law with declaratory and retroactive effect.- In view of the substantial procedural defect identified in the processing of legislative bill no. 18.939, and the absence of a technical study justifying the withdrawal of public-purpose designation and reduction in the degree of environmental protection afforded to the Refugio de Vida Silvestre de Ostional, the ruling granting this action entails, as stated, the nullity of the entirety of Law n°9348 “Refugio de Vida Silvestre Ostional” and, by connection, of executive decree n°41134 of April 10, 2018. In this regard, as established by Article 89 of the Ley de la Jurisdicción Constitucional, any other regulatory provision whose nullification is necessary by reason of connection or consequence may be declared void. Furthermore, this annulment has declaratory and retroactive effect as of the date on which the annulled rules entered into force.

The foregoing is without prejudice to any rights acquired in good faith that may have arisen under administrative authorization instruments for activities consistent with the public-domain status of the aforementioned refuge. Instruments purporting to convey ownership that are inconsistent with such public-domain status do not qualify as such rights, including those granted or registered after the refuge was created and declared public-domain property, a status that precludes validating that mode of acquisition. This is because, as this Chamber has stated on several occasions concerning public-domain property, no acquired right may be asserted (see, in this regard, this Chamber’s decisions n°2005-03669, 2000-0698).

IX.Note by Justice Nombre04.- The persistent political will to the detriment of environmental protection. This note seeks to underscore the legislature’s persistent determination to enact a law that is manifestly unconstitutional. The repetition of these legislative decisions disregards constitutional provisions and judgments issued by this Chamber on a matter as significant as environmental protection. Four judgments of the Sala Constitucional were not enough for it to be understood now, through this fifth ruling, that the Refugio de Vida Silvestre Ostional is public-domain property, that it therefore forms part of the State’s national patrimony, and that, consequently, activities beyond protection and research cannot be authorized without technical support—not even by statute. There is no justification for such a clear matter to have required five judgments from this Constitutional court to rectify the questionable will of parliament.

On several occasions, attempts were made to have a statutory provision authorize private parties to appropriate a refuge such as this one, disregarding the fact that such property belongs to citizens now and in the future; likewise, attempts were made to alter the public nature of the refuge. It should be noted that this conduct by the legislature could expose it to administrative liability for persisting in the enactment of unconstitutional legislation. I see no reason that would justify this repeated legislative intent running counter to environmental protection. On some occasions, political will is not aligned with the protection of communal assets of exceptional environmental value; this is what I perceive in the repeated enactment of laws seeking to weaken or eliminate such protection, giving individual greed precedence over the interests of the community. The Chamber will not always be able to intervene to protect community interests; in this case, despite the slowness of judicial intervention, it was possible to protect the environment and reaffirm its preeminence.

X.Additional grounds of Justices Nombre04, Nombre05, and Nombre06, drafted by the first-named.- Although the unconstitutionality found by this Chamber was sufficiently severe to invalidate the entire challenged law, we make the following observations regarding Transitory Provision VII (Transitorio VII) of the law, which is also challenged here. The challenged Transitory Provision VII states that eviction proceedings (procesos de desalojo) against occupants are suspended while applications for concessions submitted under the Law are resolved. In the applicants’ view, this constitutes a violation of Article 50 of the Constitution because it perpetuates the irregular situation in the refuge. For its part, the Procuraduría General de la República states in its report that a violation of the right to the environment, enshrined in Article 50 of the Constitution, can indeed be observed. This is because that transitory provision is understood to mean that no eviction proceedings will be initiated while the Executive Decree containing “the parameters permitting the environmental assessment of the Management Plan for the Refugio Nacional de Vida Silvestre Ostional” is published, the Management Plan is brought into conformity with those guidelines, the Management Plan is approved and published (a period of one year being provided for the foregoing), applications are submitted (for which a period of 6 months from publication of the Management Plan is granted), and applications for concessions are resolved (for which no deadline is established).

This is done without distinguishing cases involving occupation of areas ineligible for concession, such as the public zone, or occupation by persons who do not qualify for concessions, as in the case of commercial corporations or persons who, when the Law entered into force, had occupied the area for fewer than ten years. The Procuraduría states that the unconstitutionality would arise from authorizing, for the specified period plus the time required to issue decisions denying the applications, the use and exploitation of areas ineligible for concession, with respect to which environmental protection requires immediate vacation. It adds in its report that it must also be noted that the 2010 document “Análisis del desarrollo de la distribución de la infraestructura habitacional en las propiedades estatales y privadas del RNVS Ostional” identifies 12 structures in the public zone (folio 634 of the legislative file); the Diagnóstico para el Plan General de Manejo del Refugio Nacional de Vida Silvestre Ostional (2010) lists five corporations that obtained permits for use within the Refuge (folio 1511 of the legislative file); and official letter No. ACT-OR-969-2015 lists 32 complaints concerning the usurpation of Refuge lands, filed between the years 2007 and 2014 (folio 756 of the legislative file).

Additionally, the transitory provision would be unconstitutional if it also suspended evictions and removals or demolitions ordered in judicial proceedings disputing the legality of occupations in this coastal sector, as this would violate the principles of separation of functions and independence among branches of government. Legislative power may not terminate or archive a judicial proceeding except in cases expressly authorized by the Constitution, particularly where the protection of property of collective interest is involved. The advisory body to this jurisdiction concludes that Transitory Provision VII violates the right to the environment enshrined in Article 50 of the Constitution, the principles governing the State’s duty to protect environmental law, and the separation of functions and independence among branches of government, unless it is interpreted, in conformity with the Constitution, as neither preventing the continuation or enforcement of judicial proceedings initiated or conducted under the legislation in force nor suspending evictions in areas ineligible for concession or in areas occupied by natural or legal persons who do not qualify for concessions.

For its part, the supporting intervenor (coadyuvante), the Consejo Interinstitucional para el Manejo Participativo del Refugio de Vida Silvestre Ostional, states that this transitory provision is consistent with the cited ruling of the Chamber, because an immediate eviction carried out before the technical criteria and instruments and the corresponding Management Plan have been approved would contravene what this Chamber ordered in ruling 16892-2009.

In this regard, we consider that the finding of unconstitutionality also applies to Transitory Provision VII, and we accept the arguments of the applicants and the Procuraduría. That transitory provision literally establishes the following:

“TRANSITORY PROVISION VII.- From the entry into force of this law, and until the applications for concessions submitted pursuant to it have been resolved, no eviction proceedings shall be initiated against occupants present in the Refuge when this law enters into force.” The transitory provision under examination establishes a blanket prohibition on commencing eviction proceedings against occupants present in the refuge when the provision entered into force. In other words, this provision seeks to impose the same restriction on eviction even though various circumstances may exist in that sector which, because of their particular characteristics, warrant different solutions. The provision does not distinguish the situation of unlawful occupants located in areas ineligible for concession, evictions already initiated through judicial proceedings, or evictions in areas occupied by natural or legal persons who do not qualify for concessions.

Nor does it weigh the circumstances of occupations that may be protected by a legitimate enabling title (título habilitante); to that extent, it seeks to impose a single solution on dissimilar circumstances, contrary to the constitutional right to equality. Furthermore, by seeking to suspend eviction proceedings against current occupants of the Refuge without establishing any specific deadline and without distinguishing situations such as those noted above, it fosters precarious occupancy (ocupación en precario) for the benefit of irregular occupants, which results, at least temporarily, in a form of legitimization of those occupants and is, undeniably, contrary to the duty to protect the environment. It should be emphasized that, insofar as this constitutes environmental public-domain property (demanio público ambiental), the State is not merely empowered to take immediate protective action to ensure the proper use and safeguarding of the public purpose inherent in this type of legal asset; given the importance of that authority, it is also obligated to undertake such protective, recovery, or restitution measures.

This is indeed established by the very doctrine underlying constitutional canon 50, an authority entailing both a power and a duty (poder-deber) and which is not subject to limitation periods, cannot be waived, and cannot be delegated. Ergo, the a priori relinquishment of recovery actions concerning that area so that it may be devoted to its essential function constitutes a violation of the right to the environment, through the temporary denial or neglect of the legal powers whose exercise is required to fulfill the public purpose. This takes on particular significance when it is considered that the challenged permissiveness is established without being subject to any time limit, leaving its duration dependent upon highly imprecise and uncertain conditions subsequent (condiciones resolutorias), which may ultimately countenance unlawful occupations involving uses incompatible with the purpose of protecting the environmental patrimony that underlies the creation of the Refuge.

It should be noted that, as the Procuraduría states in its report, 12 structures have been identified in the public zone (folio 634 of the legislative file), five corporations that obtained permits for use within the Refuge are listed (folio 1511 of the legislative file), and there are 32 complaints concerning the usurpation of Refuge lands, filed between the years 2007 and 2014. It follows that, without expressly stating so, the challenged transitory provision effectively promotes the repeal of the punitive provisions contained in the Ley de la zona marítimo terrestre, which protect an asset of such importance to the environment. In other words, what is currently regarded as unlawful is being legalized, in violation of the right to the environment and, additionally, of the fundamental principle of separation of powers and judicial independence, because judicial evictions already initiated are disregarded. In light of these arguments, we further consider that Transitory Provision VII violates the right to the environment.

XI. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device or produced through new technologies, these must be collected from the court office within a maximum period of 30 business days from notice of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as pursuant to the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.

The action is GRANTED. Consequently, Law No. 9348, “Ostional Wildlife Refuge,” is annulled in its entirety, as is, by extension, Executive Decree No. 41134-MINAE of April 10, 2018, “Regulations to Law No. 9348 on the Ostional Wildlife Refuge.” The foregoing is due to a substantial procedural defect arising from the lack of technical support. This judgment has declaratory and retroactive effects as of the effective date of the annulled provisions, without prejudice to rights acquired in good faith. Decision No. 2022-022606 OPINION OF JUSTICE Nombre08 With the customary respect, I have decided to include this opinion to clarify an aspect of the majority judgment that, from my perspective, requires clarification.

I concur with the majority’s reasoning for granting the constitutional challenge, as follows:

“[T]he legislative record contains no technical study analyzing and determining whether environmental protection may be reduced pursuant to the principle that environmental protection must be based on objective criteria (principio de objetivación de la tutela ambiental), which constitutes an essential constitutional defect in the consideration of the bill.” This ratio—the requirement of technical studies supporting a legislative initiative aimed at reducing the degree of protection afforded to natural resources—is consistent with my voting record in similar matters (see my dissent from Decision No. 2020-013837, concerning the advisory opinion on the bill approving the “Law for the Sustainable Use of Shrimp Fisheries in Costa Rica”; my dissent from Judgment No. 2020-013836, concerning the constitutional challenge to Law No. 9610 of October 17, 2018, entitled “Modification of the Boundaries of the Lomas de Barbudal Biological Reserve for the Development of the Water Supply Project for the Middle Tempisque River Basin and Coastal Communities”; and my dissent from Judgment No. 2020-18213, concerning the constitutional challenge to Arts. 13 and 14 of Executive Decree No. 38681-MAG-MINAE of October 9, 2014, “Regulations for the Harvesting of Tuna and Related Species in the Exclusive Economic Zone of the Costa Rican Pacific Ocean”).

From my perspective, the fact that the area in question was declared a national wildlife refuge by the public authorities is sufficient to grant this constitutional challenge. This is so irrespective of the nature of the refuge in question and without undertaking an examination of whether that refuge forms part of the State Natural Heritage (Patrimonio Natural del Estado, PNE). In other words, it is not strictly necessary to equate this national refuge with the PNE in order to conclude that the ratio of the decision must be applied. I make this observation so that the Chamber may use these concepts more precisely, since each protected wilderness area (área silvestre protegida) is associated with a specific management category (categoría de manejo), which must be respected in order to address the particular features of the ecosystem under review and the protection intended for it. In this regard, it should be recalled that Art. 32 of the Organic Law on the Environment establishes a classification of the various protected wilderness areas, including forest reserves, protected zones, national parks, biological reserves, wildlife refuges, wetlands, and national monuments.

Accordingly, I consider that the concepts of wildlife refuge and PNE should not necessarily be associated, because the latter is a concept expressly defined by the legislature and was explained in Judgment No. 2021-017783 as follows:

“Inclusion in the PNE is based on certain characteristics and qualities warranting their inclusion in the inventory maintained by MINAE, and it restricts the activities that may be carried out on such lands precisely in order to protect forest resources. In this regard, it is appropriate to quote the relevant provisions of the Ley Forestal, which defines and delimits the characteristics of the PNE:

“Art. 13.- Establishment and administration. The State Natural Heritage shall consist of the forests and forest lands (terrenos forestales) within national reserves, areas declared inalienable, properties registered in Nombre16’s name, and properties belonging to municipalities, autonomous institutions, and other agencies of the Public Administration, except for real property securing credit transactions with the National Banking System that becomes part of its assets.

The Ministry of Environment and Energy shall administer the heritage. Where appropriate, through the Procuraduría General de la República, it shall register the lands in the Public Registry of Property as individually identified properties owned by the State.

Nongovernmental organizations that acquire real property containing forest or suitable for forestry, using funds from donations or the public treasury obtained in the name of Nombre16 of the State, shall transfer such property to the State in the name of Nombre16.

Art. 14.- Non-attachable and inalienable status of the natural heritage. The forest lands and forests constituting the State Natural Heritage, described in the preceding article, shall not be subject to attachment or alienation; possession thereof by private parties shall create no right in their favor, and the State’s action to recover such lands shall not be subject to any statute of limitations. Consequently, they may not be registered in the Public Registry through possessory information proceedings (información posesoria), and both their invasion and occupation shall be punished in accordance with this law.

Art. 16.- Boundaries The Ministry of Environment and Energy shall demarcate, on the ground, the boundaries of the areas comprising the State Natural Heritage. The boundary-demarcation procedure (procedimiento de deslinde) shall be established in the regulations to this law.

Art. 18.- Authorization of activities. Within the natural heritage, the State may conduct or authorize research, training, and ecotourism activities, as well as activities necessary for the use of water for human consumption, in accordance with Article 18 bis of this law, once approved by the Minister of Environment and Energy, who shall determine, where applicable, whether environmental impact assessments (evaluaciones del impacto ambiental) must be conducted, as established by the regulations to this law.

Art. 18 bis Use of water for public supply. The Ministry of Environment and Energy (MINAE) may authorize the use of water from surface sources and the construction, operation, maintenance, and improvement of water-supply systems on real property forming part of the State Natural Heritage, following a declaration by the Executive Branch that such activities are in the public interest, specifically for an urgent public water supply and for the benefit of authorized public-service providers (…)” (Emphasis not in the original).

Consequently, it bears repeating that the administration of protected wilderness areas is governed by the applicable designated management category, and that these areas may not be reduced through regulations or measures below the statutory level; (…)

It must be emphasized that protected wilderness areas are subject to specific rules corresponding to their management category, depending on whether they are a forest reserve, protected zone, biological reserve, etc., and their boundaries are established by the Executive or Legislative Branch in accordance with their specific characteristics and the particular objectives underlying the declaration in question (see Arts. 35 and 36 of the LOA). The same applies to sites declared internationally important under the Ramsar Convention and to the PNE. It must be emphasized that the selection of wetlands for inclusion in the ‘Ramsar List’ is based on their international significance from an ecological, botanical, zoological, limnological, or hydrological standpoint, and their removal from the list may occur only for ‘urgent reasons of national interest’ (Art. 2 of the Ramsar Convention). Finally, as detailed in the provisions quoted immediately above, the PNE is defined by specific characteristics regulated in the Ley Forestal itself, whose Arts. 13, 14, 18, and 18 bis establish its definition, administration, and the specific activities that may be carried out in these areas.” It must be underscored that each protected wilderness area may be associated with a specific management category that establishes particular regulations for its registration, management, and rational use in accordance with the protection afforded to it.

Furthermore, although the PNE consists of the forests and forest lands of national reserves, precisely for that reason it should not necessarily be treated as synonymous with a wildlife refuge, which could conceivably consist solely of marine or wetland ecosystems. It should be noted that, in this specific case, when the boundaries of the Refugio Nacional Vida Silvestre Ostional were expanded, various ecosystems not characterized by forest use were included. In this regard, Art. 2 of Executive Decree No. 22551 of September 14, 1993, “Expansion of the Refugio Nacional Vida Silvestre Ostional,” provides in relevant part as follows:

“Article 2.-For the purpose of regulating the protection and use of natural resources, the Refugio Nacional de Vida Silvestre Ostional shall consist of the following sectors: (a) the Marine Sector, comprising the territorial waters according to the foregoing boundaries; (b) the Ostional Sector, comprising the principal nesting site (sitio de desove) of the olive ridley sea turtle at Playa Ostional; (c) the Estuarine Wetland Sector, consisting of mangrove areas; and (d) the Guiones Sector, comprising Playa Pelada and Playa Guiones.” This confirms that the lands are not necessarily forest lands and, therefore, that they constitute PNE.

Having made this clarification, I reiterate that I concur with the reasons that led this Court to grant the constitutional challenge.

I concur with the Majority regarding the need to provide technical justification for a law intended to remove the protected designation (desafectar) from an area that was originally reserved for specific environmental protection. Although in this case it retained its status as a National Wildlife Refuge (Refugio Nacional de Vida Silvestre), the challenged law changed its property regime from state ownership to mixed ownership, thereby diminishing the level of protection originally afforded to that public-domain property (bien demanial), without support from a technical study. I must clarify, however, that in my view, the technical study or input submitted to and considered by the Legislative Assembly may come from any duly accredited entity or body specializing in the subject matter of the bill under consideration by the Legislative Assembly, provided that it is technically substantiated.

I likewise reaffirm that any activity to be carried out within this type of refuge is indeed subject to the provisions of the Ley Forestal, which currently provides as follows:

“Article 18—Authorization of activities. Within the natural heritage (patrimonio natural), the State may conduct or authorize research, training, and ecotourism activities, as well as activities necessary for the use of water for human consumption, in accordance with Article 18 bis of this law, once approved by the Minister of Environment and Energy, who shall determine, where appropriate, whether environmental impact assessments (evaluaciones del impacto ambiental) must be conducted, as established by the regulations implementing this law.” This is specifically defined in the Management Plans (Planes de Manejo) established by MINAE for that purpose, depending on the type of protected area designated. However, given the particular circumstances of this case—where, as reiterated, greater regulatory protection already existed, and where a law removed the protected designation not only from part of its territory, for purposes that even extended beyond environmental protection, but also reduced the degree of protection afforded to certain areas in order to address an occupancy problem within this area, which is unrelated to its purpose—the legal reform needed to be supported by a technical study that justified those changes and compensated for the existing environmental protection, as this Court had already indicated for this particular case.

Revisión del Documento *160111320007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las trece horas diez minutos del veintiocho de setiembre de dos mil veintidós.

Acción de inconstitucionalidad promovida por [Nombre16 001], cédula de identidad No. [Valor 001] y [Nombre16 002], cédula de identidad No. [Valor 002], para que se declare inconstitucional los incisos a), b), c), d), f) y g) del artículo 8, los ordinales 9 y 10, los incisos a), b), c), d), e) y f) del artículo 12, el numeral 26 y el transitorio VII, todos de la Ley del Refugio de Vida Silvestre Ostional (Ley No. 9348 de 08 de febrero de 2016), por estimarlos contrarios a los artículos 7, 11, 21, 41, 50, 73, 89 y 169 de la Constitución Política, a los principios constitucionales de índole medio ambiental de explotación racional de la tierra, precautorio, no regresión, objetivación e irreductibilidad de los bosques, así como a los ordinales 5 de la Convención para la Protección de la Flora, la Fauna y de las Bellezas Escénicas Naturales de los Países de América, 4 de la Convención sobre la Protección del Patrimonio Mundial, Cultural y Natural y 4 de la Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas. Intervinieron también en el proceso el representante de la Procuraduría General de la República, el representante del Ministro de Ambiente y Energía.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 12:55 horas el 20 de agosto de 2016, las accionantes solicitan que se declare la inconstitucionalidad de los incisos a), b), c), d), f) y g) del artículo 8, los ordinales 9 y 10, los incisos a), b), c), d), e) y f) del artículo 12, el numeral 26 y el transitorio VII, todos de la Ley del Refugio de Vida Silvestre Ostional (Ley No. 9348 de 08 de febrero de 2016), por estimarlos contrarios a los artículos 7, 11, 21, 41, 50, 73, 89 y 169 de la Constitución Política, a los principios constitucionales de índole medio ambiental de explotación racional de la tierra, precautorio, no regresión, objetivación e irreductibilidad de los bosques, así como a los ordinales 5 de la Convención para la Protección de la Flora, la Fauna y de las Bellezas Escénicas Naturales de los Países de América, 4 de la Convención sobre la Protección del Patrimonio Mundial, Cultural y Natural y 4 de la Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas.Señalan, las accionantes que la Playa Ostional se reconoce mundialmente por la arribada de la tortuga lora (Lepidochelys olivácea). Indican que en tal lugar anida, también, la tortuga baula (Dermochelys coriácea) y la tortuga negra (Chelonia mydas agassizii). Añaden que hay varios sistemas de manglares asociados con desembocaduras de ríos y que, finalmente, en La Gaceta No. 43, Alcance No. 31, del 2 de marzo de 2016, se publicó la Ley del Refugio de Vida Silvestre Ostional (Ley No. 9348 de 08 de febrero de 2016). Reclaman que el objetivo de la Ley No. 9348 es legalizar la permanencia de los actuales ocupantes de la zona marítimo terrestre dentro de los límites del refugio, a través del otorgamiento de concesiones; sin embargo, para alcanzar tal fin, se ha disminuido o reducido, de manera injustificada y carente de sustento técnico, el grado de protección ambiental dentro del refugio y con esto se ha puesto en riesgo la biodiversidad y el paisaje natural, en violación del derecho fundamental a un ambiente sano y ecológicamente equilibrado.Alegan, al efecto, que dicho cuerpo normativo infringe el principio de no regresión en materia ambiental, en tanto se autorizan actividades o usos de suelo que no parecen ser ambientalmente óptimos, por cuanto, según lo dispuesto en los artículos 8 y 12 de la Ley No. 9348, se pueden otorgar concesiones para “uso agropecuario sostenible de pequeña escala”, “habitacional recreativo”, “cabinas”, uso comercial para sustentar “servicios básicos de apoyo a las comunidades y visitantes”, instalaciones para “servicios comunales y de bienestar social” e “investigación y operación de proyectos comunales”. Sostienen que no parece existir un motivo válido para permitir actividades agrarias, comerciales y habitacionales recreativas en terrenos estatales, ubicados dentro de un refugio de vida silvestre. Explican que en la opinión jurídica No. OJ-14-2010, emitida por la Procuraduría General de la República, ya se cuestionó el que se autorizara un uso agropecuario dentro del refugio.Indican que, también, en el Diagnóstico para el Plan General de Manejo del Refugio Nacional de Vida Silvestre Ostional y en la opinión jurídica No. OJ- 84-2015 de la Procuraduría General de la República, se señaló la amenaza que supone la actividad agropecuaria para el medio ambiente dentro del refugio. Reclaman que la Ley No. 9348 permite, por medio de la figura de la concesión, que en la propiedad estatal del refugio se realicen actividades distintas a la capacitación, investigación y ecoturismo, que -como en el caso de la actividad agropecuaria- provocarían una disminución a la protección del medio ambiente. Insisten que se están autorizando actividades que se alejan del enfoque integral de conservación y de protección del medio ambiente y, además, que carecen de un fundamento técnico que demuestre la necesidad de permitir este tipo de prácticas dentro del refugio, en violación del derecho fundamental a un ambiente sano y ecológicamente equilibrado.Argumentan que la modificación o derogación de una norma que protege al medio ambiente no puede reducir, injustificadamente, el grado de protección, pues se le estaría imponiendo a las generaciones futuras un medio ambiente más degradado a través de una norma jurídica con un contenido regresivo, en infracción del principio de no regresión en materia ambiental. Reclaman, en tal sentido, que la Ley No. 9348 permite la operación de la figura de la concesión de forma similar a como se regula en la Ley sobre la Zona Marítimo Terrestre, lo que provoca que el Refugio Nacional de Vida Silvestre Ostional pierda, prácticamente, la categoría, características y fines de un refugio de vida silvestre. Indican que, incluso, en el caso de los refugios mixtos, en los que la protección es un tanto menor –de conformidad a lo dispuesto en los artículos 150 del Reglamento a la Ley de Conservación de Vida Silvestre y 70 del Reglamento a la Ley de Biodiversidad-, solo se permiten actividades de investigación, capacitación y ecoturismo en las áreas que pertenecen al Estado.Indican que esta Sala ha sostenido que la disminución de la protección ambiental de una zona protectora no debe hacerse de forma injustificada; sin embargo, en este caso, se ha dado una disminución en la categoría de protección del refugio sin un fundamento técnico que lo justifique. Señalan que esta Sala se ha referido, también, a la necesidad que existan estudios técnicos, de previo a desafectar o reducir un área o zona protegida, en atención al principio de objetivación de la tutela ambiental. Manifiestan que, respecto de la Ley No. 9348, no existen estudios técnicos suficientes relacionados con la implementación de este régimen especial de concesión dentro de un área protegida. Reclama que, en definitiva, con el objetivo de permitir la permanencia de aquellas personas que han venido ocupando, de forma ilegítima, dicha área protegida, se está comprometiendo el equilibrio ecológico del sistema y la sanidad del ambiente.Explican que la citada Ley No. 9348 nace para resolver una problemática social, a efectos de no desalojar a las personas que habitan dentro de los límites del refugio; no obstante, dicho cuerpo normativo autoriza, también, el otorgamiento de concesiones para fines distintos al habitacional, como es el agrícola, comercial y habitacional recreativo, sin que existan estudios técnicos que así lo justifiquen. Afirman que, incluso, mediante sentencia No. 2009-02020, esta Sala ya había indicado que no puede “autorizar actividad alguna en el Refugio de Vida Silvestre Ostional que no tienda si no a su protección e investigación”. Alegan, además, que, de previo a emitirse la Ley No. 9348, no se contó con estudios adecuados y actualizados para determinar quiénes eran los propietarios u ocupantes dentro de los terrenos del refugio, cómo obtuvieron sus títulos y si utilizan tales terrenos para vivir o si viven en otro lugar del país.Señalan que la propia Procuraduría General de la República, en su opinión jurídica No. OJ-84-2015, hizo referencia a la importancia de censos, mapeos y demás estudios previos, que permitieran acreditar la situación real de la tenencia de la tierra, no solo para ponderar la razonabilidad y proporcionalidad de la norma, sino para evitar que nuevas personas procedieran a invadir áreas de la zona marítimo terrestre. Argumentan que la existencia de tales estudios previos era relevante en atención a lo dispuesto en el artículo 26 de la Ley No. 9348, que prevé la existencia de terrenos propiedad de particulares inscritos dentro de los límites del refugio. Agregan que la Procuraduría General de la República, en la opinión jurídica No. OJ-24-2013, señaló la existencia de un posible roce de constitucionalidad, en tanto se estaría permitiendo que se otorguen concesiones en zona marítimo terrestre sobre terrenos que cuentan con construcciones levantadas sin cumplir con el trámite administrativo respectivo y sin contar con la viabilidad ambiental aprobada, en tanto que lo único que se exige es que exista ajuste con el plan regulador.Alegan, las accionantes, que lo anterior resulta preocupante, en tanto se puede prever que el Plan de Manejo no funcionará como verdadero instrumento de planificación territorial, sino que será una mera formalidad para permitir la ocupación ilegítima en disminución de la protección del medio ambiente. Reclaman, además, que permitir la permanencia de construcciones ya existentes, que se edificaron sin respetar regulación alguna para hacerlas armónicas con el paisaje natural de la zona, infringe el artículo 89 constitucional y los instrumentos internacionales ya citados. Señalan que, en conclusión, la normativa cuestionada lo que procura es legalizar las invasiones al dominio público, que durante años han sin permitidas o toleradas por la Administración. Indican que el transitorio VII establece que “[a] partir de la entrada en vigencia de la presente ley, y mientras no sean resueltas las solicitudes de concesión que con base en ella se presenten, no se iniciará ningún proceso de desalojo a ocupantes presentes en el Refugio al momento de la entrada en vigencia de esta”.Cuestionan, las accionantes, que dicho transitorio no indica un tiempo máximo para que se tramiten las concesiones, no hace la salvedad para aquellos casos de ocupaciones sobre áreas no concesionables y, por su amplitud, da cabida a la interpretación que se refiere a desalojos y derribos ordenados en procesos judiciales, donde se discuta la legalidad de ocupaciones en el sector costero. Lo que estiman contraviene los artículos 41 y 50 de la Constitución Política. Señalan, por lo demás, que si se permite –mediante la figura de la concesión- que se realicen actividades distintas del ecoturismo e investigación dentro del refugio, como es el caso de actividades agropecuarias, comerciales y habitacionales recreativas, se estará causando un daño grave a los humedales, como se desprende del Diagnóstico para el Plan General de Manejo del Refugio Nacional de Vida Silvestre Ostional y de la opinión jurídica No. OJ-84-2015 de la Procuraduría General de la República.Reprochan que con esto se lesiona el artículo 50 constitucional y se incumplen los instrumentos internacionales ya citados. El artículo 26 dispone que los “terrenos propiedad de particulares válidamente inscritos dentro de los límites del Refugio, estarán sujetos al ordenamiento territorial del uso del suelo que establezca el Plan general de manejo del Refugio”. Alegan que tal artículo es inconstitucional, toda vez que, es omiso al no prever la obligación de expropiar a los propietarios que se opongan a ajustarse a lo dispuesto en la citada normativa. Indican que, además, en la opinión jurídica No. OJ-014-2010, la Procuraduría General de la República ya advirtió que las personas que se encuentran en estos terrenos quedarían en una situación distinta y más favorable que otros que también han invadido zonas de dominio público del Estado, pues, para el resto del país, la Ley de la Zona Marítimo Terrestre solo reconoce a los ocupantes que ingresaron antes del año 1977 y les permite continuar bajo ciertos requisitos.Cuestionan, las accionantes, que se permita la existencia de escuelas, colegios, oficinas de servicios públicos e iglesias dentro de los límites del refugio (artículos 9 y 10 de Ley No. 9348), en tanto afecta su fin -como lo es la conservación ambiental- e infringe el principio de irreductibilidad de los bosques. Acusan que ha operado una violación al principio de compensación, pues, en la práctica, se está disminuyendo el tamaño del área protegida –ya que se le debe restar la sumatoria de las áreas de los terrenos privados y terrenos concesionados con usos no compatibles-, pero tal disminución no se compensó creando nuevas áreas protegidas. Finalmente, alegan una infracción al debido proceso legislativo, por cuanto, uno de los diputados presentes en el Plenario durante las sesiones de aprobación de dicha normativa fue Nombre01 (actas No. 111 del 30 de noviembre de 2015 y No. 126 del 14 de enero de 2016), pese ser ocupante de un terreno dentro del refugio, lo que compromete su imparcialidad. Esta acción se admite por reunir los requisitos a que se refiere la Ley de la Jurisdicción Constitucional en sus artículos 73 a 79.
  2. 2A efecto de fundamentar la legitimación que ostentan para promover esta acción de inconstitucionalidad, señalan que proviene del párrafo 2º del artículo 75 de la Ley de la Jurisdicción Constitucional, en tanto los accionantes se apersonan en defensa de intereses difusos, en resguardo del derecho a un ambiente sano y ecológicamente equilibrado.
  3. 3Por resolución de las 09:41 horas del 24 de agosto del 2016, se le dio curso a la acción, confiriéndole audiencia a la Procuraduría General de la República, al Ministro de Ambiente y Energía.
  4. 4Los edictos a que se refiere el párrafo segundo del artículo 81 de la Ley de la Jurisdicción Constitucional fueron publicados en los números 181, 182 y 183 del Boletín Judicial, de los días 21, 22 y 23 de septiembre del 2016.
  5. 5La Procuraduría General de la República rindió su informe. Señala que: a) Sobre la legitimación: Al tenor de lo dispuesto en los artículos 50, párrafo segundo, de la Constitución Política, 75, párrafo segundo, de la Ley de la Jurisdicción Constitucional y la reiterada jurisprudencia de esta Sala sobre el tema de los intereses difusos, la acción es admisible, al enmarcarse en la protección jurídica del ambiente.; b) Sobre el fondo del asunto: 1. En cuanto a las normas impugnadas: El objeto de la Ley No. 9348 de 8 de febrero del 2016 es establecer un régimen jurídico específico y diferenciado para el Refugio de Vida Silvestre Ostional, permitiendo la permanencia de los ocupantes de la zona marítimo terrestre a través del otorgamiento de concesiones y permisos de uso para diversas actividades, así consagrado en los artículos 8, 9, 10, 12, 26, y su transitorio VII. 2. En cuanto a los argumentos de las accionantes: Las accionantes estiman que únicamente serían constitucionales las concesiones para uso habitacional, albergues de ecoturismo e infraestructura para investigaciones científicas, cuestionando los otros usos previstos en la Ley, específicamente en los artículos citados supra. 3.En cuanto al Otorgamiento De Concesiones Para El Ejercicio De Actividades Distintas De La Investigación, Capacitación Y Ecoturismo: Manifiesta que, las actividades referidas por la jurisprudencia constitucional en los votos N° 2003-8742 y 2009-2020 se establecen para la generalidad de los refugios en que tiene participación el Estado. Indica que, el artículo 70, inciso e) del Reglamento a la Ley de Biodiversidad, Decreto No. 34433 del 11 de marzo del 2008, dispone que en los terrenos estatales de los refugios de propiedad mixta sólo podrán desarrollarse actividades de investigación, capacitación y ecoturismo, restringiendo la aplicación del Reglamento a la Ley de conservación de la vida silvestre para la regulación de las actividades permitidas en la porción bajo propiedad privada de estos refugios. La Ley No. 9348 modifica este régimen, aplicable a más de 25 Refugios Mixtos de Vida Silvestre del país, 18 de ellos también costeros (según sus normas de creación), permitiendo en los terrenos estatales del Refugio de Ostional el otorgamiento de concesiones para uso agropecuario de pequeña escala (inciso a) de los artículos 8 y 12), habitacional (inciso b) de los artículos 8 y 12), habitacional recreativo (artículo 8, inciso b) y 12, inciso c), comercial destinado a sustentar servicios básicos (inciso d) de los artículos 8 y 12), y proyectos y servicios comunales (incisos f) y g) del artículo 8 e inciso f) del artículo 12.En cuanto al fondo señala que, “respecto al Refugio Nacional de Vida Silvestre Ostional en acatamiento del Principio Precautorio, se requiere de previo a la declaratoria como territorio costero comunitario y a la concesión –tal y como lo señalan las y los diputadas y diputados consultantes– de un estudio de impacto ambiental evaluado por parte de Secretaría Técnica Ambiental, de modo tal que se demuestre el tipo de daño y las medidas que deban adoptarse, estudio que se echa de menos en esta iniciativa de ley, ya que no podría dejar de protegerse un refugio sin criterios técnicos que así lo respalden. Por lo tanto dicha omisión implica una violación del principio precautorio y del principio de progresividad del ámbito de tutela de los derechos fundamentales, aspecto señalado en el vicio de forma analizado en esta sentencia”; indicando que, no se aprecia en el expediente legislativo No. 18939, el cual dio origen a la Ley No. 9348, que ese requisito haya sido cumplido, en los términos establecidos por la Sala Constitucional en la sentencia dicha. 4.En cuanto al Otorgamiento De Permisos De Uso A Instituciones Públicas Y Privadas: Expresa que, las accionantes, bajo el título de “VIOLACIÓN AL PRINCIPIO DE IRREDUCTIBILIDAD DEL BOSQUE”, alegan que “no tiene justificación que dentro de los límites del refugio existan escuelas, colegios, oficinas de servicios públicos o iglesias”, y que, mantenerlas allí, violenta el principio de irreductibilidad del bosque. Sin embargo, los artículos 9 y 10 de la Ley No. 9348 contemplan el otorgamiento de permisos de uso a instituciones públicas y privadas, para educación, investigación, desarrollo de proyectos comunales y otros servicios públicos. Agrega que, estas zonas son de carácter temporal y precario por lo que se desprende una consecuencia práctica: el permiso de uso es una autorización para la realización de actos sencillos cuyos efectos no inciden de manera significativa en el bien usado; su objeto son actividades que no requieren construcciones u obras permanentes o de gran envergadura y, por el contrario, implican una ocupación con instalaciones de fácil y rápida remoción (quioscos, por ejemplo) o bienes muebles, razón por la cual, construcciones con carácter de adherencia permanente al terreno, como escuelas, universidades, etc., no cabrían al amparo de un permiso de uso.En la opinión jurídica No. OJ-14-2010 del 26 de marzo del 2010, relativa al proyecto de “Ley del Refugio Nacional de Vida Silvestre Ostional” tramitado en el expediente legislativo No. 17512, esta Procuraduría advirtió que las construcciones permanentes no son susceptibles de ser aprovechadas a partir de un permiso de uso. 5. En cuanto a la Coexistencia De Dominio Público Y Propiedad Privada En El Refugio Nacional De Vida Silvestre Ostional: Las accionantes plantean como motivo de inconstitucionalidad la “INCOMPATIBILIDAD DE EXISTENCIA DE TERRENOS DE PROPIEDAD PRIVADA CON USOS INCOMPATIBLES”, cuestionando la permanencia de propietarios registrales en los terrenos del Refugio, prevista en el artículo 26, en donde únicamente reconoce las propiedades privadas debidamente inscritas: “Los terrenos propiedad de particulares válidamente inscritos dentro de los límites del Refugio”, y su lectura no debe hacerse aislada del numeral 29 de la misma Ley, agregando que, esta norma no se aparta de lo que ya está dispuesto en otras leyes de nuestro ordenamiento jurídico, y no se aprecia inconstitucionalidad por los motivos alegados por las accionantes.Se debe recalcar que, si bien el ordenamiento permite que haya refugios mixtos, es lo cierto que esa autorización no es inconstitucional en tanto la permanencia de propiedad privada sea compatible con los fines del área silvestre protegida, y se le impongan limitaciones constitucionalmente válidas, de modo que la propiedad privada presente en el Refugio mixto no puede ser explotada en términos que pongan en riesgo el Refugio y los fines que determinan su protección. 6. En cuanto a la suspensión De Los Desalojos De Ocupantes Mientras Se Resuelven Las Solicitudes De Concesión: Se constata una lesión al derecho al ambiente, consagrado en el artículo 50 de la Constitución y a los principios de la tutela del derecho ambiental a cargo del Estado, así como de separación de funciones e independencia entre poderes, por parte del transitorio VII, salvo que se interprete, conforme a la Constitución, que ese transitorio no impide la continuación o ejecución de los procesos judiciales iniciados o tramitados al amparo de la legislación vigente, y que, no suspende los desalojos en las zonas no concesionables o en aquellas que se encuentren ocupadas por personas físicas o jurídicas que no califiquen para el otorgamiento de concesiones.
  6. 6Rinde su informe Nombre02, en su calidad de Ministro a.i. de Ambiente y Energía y señala que avala el criterio externado por la Asesoría Jurídica de la Secretaría Ejecutiva del SINAC. Por lo que solicita se declare sin lugar en todos sus extremos esta acción. En detalle, dicho informe indica: 1. En cuanto a la legitimación: En el caso de estudio las accionantes justifican su proceder en que la norma impugnada –a su criterio-, lesiona varios principios de índole ambiental, tales como el principio de explotación racional de la tierra, el precautorio, así como el principio de no regresión en materia ambiental, el principio de objetivación y el principio de irreductibilidad del bosque, que impone a los particulares, las municipalidades y por supuesto al Estado, la obligación de hacer los estudios ambientales previos antes de emitir normativa tendiente a ordenar territorialmente un espacio y más cuando existe biodiversidad que se puede ver afectada.Es decir, las accionantes no fundamenta su legitimación que lo impugnado afecte a algún sujeto privado en particular, sino a la sociedad en su conjunto, por lo que su interés radica en que se garantice a la población a gozar de un derecho abstracto, a favor de un número indeterminado de personas que tienen el mismo interés, razón por la cual deberá determinar la Sala la procedencia de ese interés para accionar la inconstitucionalidad. 2. Sobre el fondo de la acción de inconstitucionalidad: la petición de inconstitucionalidad interpuesta, fue planteada contra los incisos a, b, c, d, f, y g del artículo 8, los ordinales 9 y 10, los incisos a, b, c, d, e, y f del artículo 12, el numeral 26 y el transitorio VII todos de la Ley del Refugio Nacional de Vida Silvestre Ostional, Ley N°9348 del 08 de febrero del 2016. 3. En cuanto a los alegatos que refiere la acción; indican que es cierto por las accionantes, en el sentido de que en Costa Rica hay dos playas de anidación masiva de tortugas lora, una de ellas es Ostional dentro del Refugio Nacional de Vida Silvestre del mismo nombre.La creación de este Refugio recae en la intención de incorporar a la comunidad de Ostional en el cuido y manejo de la playa de anidación de las tortugas lora, razón que se mantiene hasta la fecha, donde se cuenta con un plan de manejo titulado “Plan Quinquenal para el Manejo y la Conservación de la tortuga lora en el Refugio Nacional de Vida Silvestre Ostional”. Por su importancia estos ecosistemas representan uno de los objetos de conservación del Refugio, según se estipula en el Plan General de Manejo del Refugio. Igualmente su carácter de importancia se rescata en la Ley N°9348 en donde se establece regulación necesaria para la protección en este tipo de ecosistemas, así como el ordenamiento territorial de las personas que habitan en el Refugio Mixto de Vida Silvestre de Ostional. Agrega que, el Refugio si colinda con áreas de bosque lo que facilita el paso de especies de un lado para el otro, y también sirve de albergue temporal de muchas especies que lo utilizan para su reproducción, así cumpliendo con la misión para lo que fue creado.Resalta que, esta nueva Ley se crea para regularizar situaciones no clarificadas por la legislación hasta ahora. Expone que, la Ley del Refugio Mixto de Vida Silvestre de Ostional, viene a ordenar todo lo dispuesto en el voto N°02020-2009, de la Sala Constitucional, regulando tanto la parte ambiental, como la parte territorial ocupada por las personas que viven dentro del Refugio Ostional sea por encontrarse de manera previa a la creación del mismo o por tener alguna autorización administrativa de una manera que cause el menor daño a los recursos protegidos en la legislación. Lo anterior deviene en que al momento de aplicar la normativa ambiental vigente, resulte más ajustada a la realidad y la técnica la categoría de refugio mixto al caso de Ostional; aspecto que además fue clarificado en el numeral 5 de la Ley N°9348 mediante una norma de grado jerárquico superior y con base en los informes técnicos requeridos de conformidad a los artículos 71 y 72 del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo N°34433.Por último señala que, el objeto de la Ley N°9348, visto en su artículo 1 es establecer un régimen jurídico especial para el Refugio que permita regular los usos del suelo, establecer un régimen especial de concesiones, y el aprovechamiento razonable y sustentable de sus recursos naturales mediante la participación activa de las comunidades, y brindar seguridad jurídica a quienes actualmente ocupan terrenos del Refugio, siempre y cuando se ajusten a las disposiciones de esta Ley y su reglamento. Este régimen jurídico especial se fundamenta en los estudios técnicos e informes elaborados por el Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación y la Universidad de Costa Rica. Por lo tanto, de ninguna manera se ha disminuido o reducido el grado de protección ambiental dentro del Refugio, y menos permitir que se ponga en riesgo la biodiversidad y el paisaje, ya que sería contrario a lo indicado en el artículo 50 de la Constitución Política de Costa Rica, y por lo tanto no sería aplicable en nuestro caso como rectores del ambiente, por lo que las autorizaciones dadas en la ley son acordes a la técnica y factibles según la categoría de manejo del Refugio y los instrumentos técnicos de ordenamiento ambiental existentes como lo es el Plan General de Manejo. 4.En cuanto a los principios ambientales: a. violación al principio constitucional de no regresión en materia ambiental; en primero instancia este principio no es ilimitado ni irrestricto. Además, no se lesiona este principio en cuanto se encuentra condicionado por los principios constitucionales de razonabilidad y proporcionalidad así como las reglas univocas de la ciencia, técnica, conveniencia y la lógica. Agrega, que no se violenta este principio porque todos los artículos impugnados por las accionantes tienen informes técnicos que le den sustentos técnicos científicos y son acordes a la categoría de manejo y proporcionales al objeto de tutela y no permite que las actuaciones de la Administración vayan en deterioro de los recursos naturales por lo que no se podría catalogar de una decisión antojadiza del legislador como pretenden las accionantes al existir múltiples estudios técnicos elaborados tanto por el Sistema Nacional de Áreas de Conservación como por la Universidad de Costa Rica. b. Violación al principio de objetivación de la tutela ambiental y falta de viabilidad ambiental.Con la categoría de manejo de Refugio lo que se pretende es tutelar la conservación de las tortugas marinas y la protección de sus habitas de reproducción, la conservación y protección de los ecosistemas marinos- costeros y el uso sostenible de los recursos naturales por parte de las comunidades locales organizadas habilitantes del lugar, así como asegurar la conservación de los objetivos de protección del Refugio. Menciona que, la variable ambiental ha sido incorporad en el Plan General de Manejo desde un inicio, de acuerdo a los lineamientos establecidos por SETENA. c. Violación al principio de objetivación por falta de estudios de tenencia de la tierra. No se violenta está principio en cuanto se han realizado todos los estudios e informes técnicos correspondientes. d. Quebranto al principio de legalidad y falta de valoración de la variable ambiental previa al Plan General de Manejo. No lleva razón las accionantes debido a que hay suficientes normas que dan sustento legal y que permiten regular los usos del suelo, un régimen especial de concesiones, el aprovechamiento razonable y sustentable de sus recursos naturales, por lo cual está ajustada al bloque de legalidad establecido en nuestro ordenamiento jurídico. e. Violación al principio preventivo y precautorio y desprotección de la zona de manglares.En reiteradas ocasiones se ha indicado que la necesidad de esta Ley es crear un régimen jurídico especial que pueda brindar seguridad jurídica a los ecosistemas presentes en dicho Refugio, con base al derecho fundamental de todo ciudadano a un ambiente sano y ecológicamente equilibrado. f. Violación al principio de irreductibilidad de bosque. Con la creación de la Ley de Ostional N°9348 no se busca en ningún momento reducir el área de acción o extensión del Refugio ni rebajar el grado de protección del mismo. Solamente acogiéndonos a la clasificación ya enmarcada por la Ley de Vida Silvestre, darle la clase que más se ajuste a su situación real, cual es la categoría de mixto, primero por poseer fincas inscritas en el territorio y segundo por reconocer la existencia de comunidades humanas inmersas en el territorio, como lo son las comunidades de Ostional, Peladas y Guiones, por ello es que también se permite la existencia de escuelas, colegios, iglesias y oficinas de servicios públicos, porque ya existían en dicho sitio y estas así como contribuyen al desarrollo social y su remoción causaría un grave impacto social y ambiental, por tal razón no existe violación a tal principio. Solicita declara sin lugar la acción de inconstitucionalidad.
  7. 7Presentan escrito, [Nombre16 003], [Nombre 004], [Nombre 005], [Nombre 006], [Nombre 007], y otros en sus calidades de miembros del Consejo Interinstitucional Asesor del Refugio Nacional de Vida Silvestre Ostional (CIMACO), y señalan en resumen que: a) Que CIMACO por más de 18 años ha trabajado de la mano con instituciones del Estado, como SINAC, Municipalidades y Comunidades aledañas al RNVSO, con el fin de procurar el debido manejo y diseño de las estrategias de dicho refugio. Señalan que en el Decreto Ejecutivo N°34590-MINAE se dio la creación del Consejo Interinstitucional Asesor del Refugio Nacional de Vida Silvestre Ostional, y que dicho Consejo es un modelo ejemplar del manejo participativo de un área protegida. b) Sobre la participación en la Comisión de la Ley N°9348: Manifiestan que ha tenido como objetivo principal obtener un marco legal acorde con la realidad y compatible con los objetivos de conservación del refugio.Indican que desde el Voto 2020-2009 se ha trabajado arduamente en 4 proyectos de ley, en 3 administraciones; lo cual culmina en el 2016 con la aprobación de la ley N°9348 y su correspondiente reglamento. c) Sobre la participación de la Comisión de elaboración del Plan de Manejo del RNVSO: Informan que ha tenido como objetivo principal obtener un Plan de Manejo “marco operativo” y sus correspondientes reglamentos basado en fundamento científico para el manejo del refugio. Señalan que el plan está elaborado y se encuentra actualmente en su fase final de análisis para su posterior aprobación. d) Sobre la participación en la Comisión Tenencia de la Tierra del RNVSO: Indican que ha tenido como objetivo garantizar por medio de elementos técnicos, la justa ocupación de habitantes y poder garantizar los derechos de la propiedad privada debidamente inscrita dentro del RNVSO. e) Sobre la participación en la Comisión Control/ Protección del RNVSO: Informan que ha tenido como objetivo garantizar las estrategias para el manejo correcto del refugio. f) Concluyen que CIMACO aprueba bajo una unanimidad el respaldo a la ley N°9348, la cual es vital para el correcto manejo integral del RNVSO. Posteriormente se apersonan nuevamente para referirse a las manifestaciones realizadas en el informe rendido por la Procuraduría General de la República.
  8. 8Mediante resolución de las 13:16 horas del 14 de octubre de 2016 se tuvieron por contestadas las audiencias conferidas a la Procuraduría General de la República, y el Ministro de Ambiente y Energía. Además se indica que se tienen por hechas las manifestaciones del Consejo Interinstitucional para el Manejo Participativo del Refugio de Vida Silvestre Ostional, las cuales serán resueltas en su momento procesal oportuno.
  9. 9Presenta escrito, Nombre03, en su condición de Ministro de Ambiente y Energía y señala que se apersona a realizar los siguientes alegatos adicionales: 1. En cuanto a la relación con los numerales 8 y 12 de la Ley 9348: la Ley N°9348 pretende formalizar, dando sustento legal a la realidad social que rodea el área protegida, armonizando, así la realidad jurídica con la realidad fáctica, sin que en ningún momento se abandonen los objetivos de conservación del refugio. 2. En cuanto a los usos de suelo permitidos dentro del refugio son investigación, capacitación y ecoturismo: La elaboración del Plan de Manejo es uno de los objetivos de la ley en cuestión, y de este depende la posibilidad de otorgar concesiones y por ende la determinación de los mismos al ser la herramienta técnica de ordenamiento correspondiente; y es por medio del Plan de Manejo que se defina, de acuerdo con la evaluación de impacto ambiental realizada, las zonas que son aptas para el desarrollo de cada uno de los usos de suelo. 3.En cuanto a la falta de estudios técnicos que sustenten el otorgamiento de concesiones dentro del Refugio de Vida Silvestre Ostional: el Estudio de Impacto Ambiental es uno de los instrumentos de evaluación de impacto ambiental, pero no es el único. Para la presente Ley se realizó el estudio técnico realizado por el Dr. [Nombre16 008] y otros denominado Informe de Evaluación Ambiental Estratégica del Plan de Manejo Ostional, informe que se encuentra basado en los Índices de fragilidad ambiental, metodología que fue oficializada, mediante Decreto N°32967 de 04 de mayo del 2006. 4. En cuanto a los permisos de uso a instituciones públicas y privadas: No se consideran inconstitucionales en razón de que con una interpretación sistemática de la ley, se solventa cualquier duda de constitucionalidad que pudiera surgir de los artículos 9 y 10. Se evidencia que dichos artículos no permiten el otorgamiento de permisos de uso de suelo que menoscaben el dominio público del Estado, o que vayan en contra de las disposiciones del Plan de Manejo del Refugio.Señala que, tanto el reglamento como el Plan de Manejo deberán respetar la naturaleza precaria del permiso de uso de suelo y regular el mismo de conformidad con el artículo 154 de la Ley General de la Administración Pública, si es que se llega a estimar que es viable la presencia antrópicas en esas zonas ambientales frágiles. 5. Sobre el numeral 26 cuestionado: La finalidad del artículo no radica en la expropiación de tierras dentro del Refugio como lo plantea la Procuraduría. Debe de quedar claro que, la expropiación se presenta como una vía o medida excepcional que ha de ser aplicada cuando sea estrictamente necesario para que se cumplan los fines u objetivos de conservación del Refugio, y no debe echarse mano de ella como primera medida. Las concesiones y los usos de suelo deben sujetarse a las regulaciones que establezca la Ley, sus reglamentos y el respectivo Plan de Manejo, por lo que las propiedades privadas evidentemente están sujetas a la función ambiental que pesa sobre ellas, según las disposiciones del Plan de Manejo y previo otorgamiento de la respectiva viabilidad ambiental; siendo que de encontrarse discrepancias insalvables al respecto pues la vía para resolverlo será optar por la expropiación conforme al artículo 29 de la ley.
  10. 10Se prescinde de la vista señalada en los artículos 10 y 85 de la Ley de la Jurisdicción Constitucional, con base en la potestad que otorga a la Sala el numeral 9 ibídem, al estimar suficientemente fundada esta resolución en principios y normas evidentes, así como en la jurisprudencia de este Tribunal.
  11. 11En los procedimientos se ha cumplido las prescripciones de ley.

Redacta Magistrado Nombre04; y,

Considerando:

I.De previo. Sobre las manifestaciones del Consejo Interinstitucional para el Manejo Participativo del Refugio de Vida Silvestre Ostional.- Conforme al artículo 83 de la Jurisdicción Constitucional, dentro de los quince días posteriores a la primera publicación, podrán apersonarse coadyuvantes. Los edictos salieron publicados el 21, 22 y 23 de setiembre del 2016. Luego, el día 05 de octubre del 2016, dentro del plazo de los quince días para presentar coadyuvancias, miembros del Consejo Interinstitucional para el Manejo Participativo del Refugio de Vida Silvestre Ostional, se apersonan a presentar coadyuvancia pasiva. Siendo, como se dijo, que la coadyuvancia fue presentada dentro del plazo establecido, procede tenerla como admitida.

II.Objeto de la impugnación.- Las accionantes impugnan los artículos 8 (incisos a, b, c, d, f y g) 9, 10, 12 (incisos a, b, c, d, e y f), 26 y el transitorio VII, todos de la Ley del Refugio de Vida Silvestre Ostional (Ley No. 9348 de 08 de febrero de 2016). Los artículos impugnados disponen lo siguiente:

“ARTÍCULO 8.- Otorgamiento de concesiones.

En las áreas de naturaleza demanial del Refugio podrán otorgarse concesiones a ocupantes actuales. Se exceptúan de lo anterior, un área de protección de quince metros alrededor de los esteros y manglares del Refugio; bosques, terrenos forestales, ecosistemas de humedales, los cincuenta metros de la zona pública de la zona marítimo terrestre contados a partir de la pleamar ordinaria, las áreas que quedan al descubierto durante la marea baja, islotes, peñascos y demás áreas pequeñas y formaciones naturales que sobresalgan del mar. El Área de Conservación podrá otorgar concesiones cuando en el estudio que se realice para el caso concreto se determine técnicamente que no son incompatibles con los objetivos y los alcances establecidos en el Plan general de manejo, para los siguientes usos potencialmente compatibles con los objetivos de conservación del Refugio:

  • a)Uso agropecuario sostenible de pequeña escala.
  • b)Uso habitacional y habitacional recreativo.
  • c)Cabinas y albergues de ecoturismo.
  • d)Uso comercial destinado a sustentar servicios básicos de apoyo a las comunidades y visitantes.
  • e)Infraestructura para investigaciones científicas o culturales y capacitación.
  • f)Instalaciones para servicios comunales y de bienestar social.
  • g)Investigación y operación de proyectos comunales.” “ARTÍCULO 9.- Permisos de uso de suelo a instituciones públicas.

El Área de Conservación Tempisque podrá otorgar permisos de uso de suelo dentro del Refugio, al Estado y demás entes públicos, para el funcionamiento de servicios públicos, educación, investigación y todas aquellas actividades que coadyuven al mejoramiento de las condiciones de vida de la comunidad, con estricto apego al Plan general de manejo y los objetivos de conservación del Refugio, de conformidad con el reglamento que al efecto se promulgará, donde se estipulará también todo lo concerniente a plazos, prórrogas, requisitos, condiciones y demás aspectos relevantes para regular estos permisos de uso.” “ARTÍCULO 10.- Permisos de uso de suelo a entidades privadas El Área de Conservación Tempisque podrá otorgar permisos de uso de suelo dentro del Refugio a universidades privadas, centros o institutos de investigación y organizaciones comunales locales, para investigación y desarrollo de proyectos comunales y de acuerdo con el reglamento que al efecto se promulgará.

Dichos usos deben ser conformes con los objetivos de conservación del Refugio y otorgados con estricto apego al Plan general de manejo. Todo lo relativo a plazos, prórrogas, requisitos, condiciones y demás aspectos relevantes para la regulación de los permisos de uso se estipularán en el respectivo reglamento.” “ARTÍCULO 12.- Cánones Se establece un canon anual correspondiente a la concesión, que pagará el concesionario cuyo destino será para el mantenimiento y la conservación del Refugio. Dicho canon se calculará tomando como parámetro el salario base definido en el artículo 2 de la Ley N° 7337, de 5 de mayo de 1993, de la siguiente manera:

  • a)Uso agropecuario, pagará un canon anual de un tres por ciento (3%) de un salario base.
  • b)Vivienda de uso habitacional, hasta de cien metros cuadrados (100 m2) de construcción, pagará un canon anual de un diez por ciento (10%) de un salario base. Para construcciones mayores a cien metros cuadrados (100 m2), pagará un canon anual de un quince por ciento (15%) de un salario base.
  • c)Vivienda de uso habitacional recreativo, hasta de cien metros cuadrados (100 m2) de construcción, pagará un canon anual de un quince por ciento (15%) de un salario base. Para construcciones mayores a cien metros cuadrados (100 m2), pagará un canon anual de un diecisiete por ciento (17%) de un salario base.
  • d)Uso comercial, pagará un canon anual de un quince por ciento (15%) de un salario base.
  • e)Infraestructura para investigaciones científicas o culturales y capacitación, pagará un canon de un cinco por ciento (5%) de un salario base.
  • f)Para investigación y operación de proyectos comunales, pagará un canon de un cinco por ciento (5%) de un salario base.

El canon será depositado en una cuenta bancaria a Nombre16 del Área de Conservación del Tempisque.” “ARTÍCULO 26.- Uso del suelo en terrenos de propiedad privada.

A los terrenos de particulares que estén ubicados dentro de los límites del Refugio no les será aplicable el régimen jurídico de concesiones y cánones correspondiente a los terrenos propiedad del Estado. Los terrenos propiedad de particulares válidamente inscritos dentro de los límites del Refugio, en virtud de la función ambiental establecida en la Ley N.° 7788, Ley de Biodiversidad, de 30 de abril de 1998, y sus reformas, estarán sujetos al ordenamiento territorial del uso del suelo que establezca el Plan general de manejo del Refugio. En consecuencia, solamente podrán autorizarse, en estos terrenos, proyectos, obras o actividades que se ajusten a la zonificación del Refugio, su reglamento de desarrollo sostenible y las limitantes y potencialidades técnicas para cada zona o subzona identificada, todo de conformidad con lo establecido en la presente ley. De previo al desarrollo de actividades, obras o proyectos deberá cumplirse lo establecido en el artículo 82 de la Ley N.° 7317, Ley de Conservación de Vida Silvestre, de 30 de octubre de 1992.” “TRANSITORIO VII.- A partir de la entrada en vigencia de la presente ley, y mientras no sean resueltas las solicitudes de concesión que con base en ella se presenten, no se iniciará ningún proceso de desalojo a ocupantes presentes en el Refugio al momento de la entrada en vigencia de esta.” Estiman las accionantes que tales normas son inconstitucionales en virtud de que violan los artículos 7, 11, 21, 41, 50, 73, 89 y 169 de la Constitución Política, los principios constitucionales de índole medio ambiental de explotación racional de la tierra, precautorio, no regresión, objetivación e irreductibilidad de los bosques, así como a los ordinales 5 de la Convención para la Protección de la Flora, la Fauna y de las Bellezas Escénicas Naturales de los Países de América, 4 de la Convención sobre la Protección del Patrimonio Mundial, Cultural y Natural y 4 de la Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas. Al respecto, del escrito de interposición, observa esta Sala que las accionantes enumeran once alegatos de inconstitucionalidad. A saber:

-De la lectura de todos los once alegatos, se observa que casi todos (alegatos 1, 2, 3, 6, 9, 10 y 11) giran alrededor del mismo argumento. A saber, la inconstitucionalidad de los artículos 8 y 12 de la ley impugnada, por permitir usos de suelo no compatibles con el ambiente, lo cual violenta el principio de no regresión (alegato 1), objetivación de la tutela ambiental (alegato 2 y 3), desprotección de manglares (alegato 6), violación al debido proceso legislativo (alegato 9), el principio de irreductibilidad del bosque (alegato 10) pues se están limitando los espacios naturales sometidos al régimen especial de protección y violación al principio de no compensación (alegato 11). Por lo tanto, el examen de fondo sobre esta cuestión se hará en cuanto a examinar si los usos de suelo de autorizados en los artículos 8 y 12 de la ley impugnada, violentan el Derecho de la Constitución.

-El otro grupo de alegatos (4, 7 y 8) deben ser rechazados por cuanto, no individualizan la norma cuestionada, y además, son argumentos de legalidad y no de constitucionalidad. Así se entiende que permitir construcciones sin cumplir requisitos (alegato 4), indicar que esas construcciones “podrían” no entonar con el ambiente (alegato 7) son cuestiones de legalidad, correspondiendo en la vía ordinaria determinar si en efecto tales construcciones se hicieron sin cumplir requisitos o no “entonan” con el ambiente. En cuanto al alegato 8 referido a que el artículo 26 no incluye la posibilidad de la expropiación, también debe rechazarse por cuanto, es un argumento de inconstitucionalidad por omisión que no está debidamente fundamentado.

-Finalmente, en el alegato 5, se impugna el Transitorio VII de la ley, por no establecer un plazo para la tramitación de las concesiones, y perpetuar con ello la irregularidad del refugio, en violación del principio preventivo y precautorio en materia ambiental. El cual también será analizado por el fondo.

III.La legitimación de las accionantes.- El artículo 75 de la Ley de la Jurisdicción Constitucional regula los presupuestos que determinan la admisibilidad de las acciones de inconstitucionalidad, exigiendo la existencia de un asunto pendiente de resolver en sede administrativa o judicial en el que se invoque la inconstitucionalidad, requisito que no es necesario en los casos previstos en los párrafos segundo y tercero de ese artículo, es decir, cuando por la naturaleza de la norma no haya lesión individual o directa; cuando se fundamente en la defensa de intereses difusos o que atañen a la colectividad en su conjunto, o cuando sea presentada por el Procurador General de la República, el Contralor General de la República, el Fiscal General de la República o el Defensor de los Habitantes, en estos últimos casos, dentro de sus respectivas esferas competenciales. De acuerdo con el primero de los supuestos previstos por el párrafo 2° del artículo 75 de la Ley de la Jurisdicción Constitucional, la norma cuestionada no debe ser susceptible de aplicación concreta, que permita luego la impugnación del acto aplicativo y su consecuente empleo como asunto base.

En segundo lugar, se prevé la posibilidad de acudir en defensa de "intereses difusos", que son aquellos cuya titularidad pertenece a grupos de personas no organizadas formalmente, pero unidas a partir de una determinada necesidad social, una característica física, su origen étnico, una determinada orientación personal o ideológica, el consumo de un cierto producto, etc. El interés, en estos casos, se encuentra difuminado, diluido (difuso) entre una pluralidad no identificada de sujetos. Esta Sala ha enumerado diversos derechos a los que les ha dado el calificativo de "difusos", tales como el medio ambiente, el patrimonio cultural, la defensa de la integridad territorial del país, el buen manejo del gasto público, y el derecho a la salud, entre otros. Por otra parte, la enumeración que ha hecho la Sala Constitucional no es taxativa. Finalmente, cuando el párrafo 2° del artículo 75 de la Ley de la Jurisdicción Constitucional habla de intereses "que atañen a la colectividad en su conjunto", se refiere a los bienes jurídicos explicados en las líneas anteriores, es decir, aquellos cuya titularidad reposa en los mismos detentadores de la soberanía, en cada uno de los habitantes de la República.

No se trata por ende de que cualquier persona pueda acudir a la Sala Constitucional en tutela de cualesquiera intereses (acción popular), sino que todo individuo puede actuar en defensa de aquellos bienes que afectan a toda la colectividad nacional, sin que tampoco en este campo sea válido ensayar cualquier intento de enumeración taxativa. A partir de lo dicho en el párrafo anterior, es claro que los actores ostentan legitimación suficiente para demandar la inconstitucionalidad de las normas impugnadas, sin que para ello resulte necesario que cuenten con un asunto previo que les sirva de base a esta acción. Lo anterior porque acuden en defensa de un interés que atañe a la colectividad nacional en su conjunto, como lo es el derecho al ambiente. Por lo que las actoras se encuentran perfectamente legitimadas para accionar en forma directa, a la luz de lo que dispone el párrafo 2° del artículo 75 de la Ley de la Jurisdicción Constitucional.

Se trata, en efecto, de materia cuya constitucionalidad procede revisar en esta vía. Además, cumplieron los requisitos estipulados en los numerales 78 y 79 de la Ley de rito. En conclusión, la presente acción es admisible, por lo que debe entrarse de inmediato a discutir el objeto y el fondo del asunto.

IV.Sobre la metodología de análisis de la acción.- Para facilitar el estudio de la normativa impugnada, en los considerandos siguientes se realizará primero un análisis general de la ley impugnada, para luego analizar los dos grupos de alegatos admitidos para análisis en esta acción.

V.En general sobre la ley n°9348 “Refugio de Vida Silvestre Ostional” del 2016 y los antecedentes jurisprudenciales de esta Sala en torno a ella.- El área de protección objeto de estudio, fue inicialmente declarada por decreto ejecutivo nro. 13200-A del 15 de diciembre de 1981, con el fin de proteger el desove y reproducción de las tortugas entre el río Nosar y Quebrada Rayo en Guanacaste. Posteriormente, se constituyó como refugio nacional de fauna silvestre propiamente mediante el transitorio único de la ley nro. 6919, “Ley de Conservación de la Fauna Silvestre”, del 17 de noviembre de 1983, estableciendo que su área abarcaría los doscientos metros de la zona marítimo-terrestre que se extiende desde la margen derecha de la desembocadura del Río Nosara hasta la Punta India. Luego, su área de protección fue ampliada por decreto ejecutivo nro. 16531 del 18 de julio de 1985, fijando que este abarcaría un área de 200 metros, contados a partir de la pleamar ordinaria, comprendida desde su margen izquierda de la desembocadura del río Nosara hasta la Punta Guiones.

El 7 de diciembre de 1992, mediante ley nro. 7317, se reformó la Ley de Conservación de la Vida Silvestre y en el transitorio I se dispuso lo siguiente: “Créase el Refugio de Vida Silvestre Ostional que, para los efectos de esta Ley, estará ubicado en los doscientos metros de la zona marítimo terrestre que se extiende desde Punta India hasta Punta Guiones, Cantón de Nicoya, Provincia de Guanacaste. El Poder Ejecutivo demarcará el Refugio dentro de los treinta días siguientes a la publicación de esta Ley”. Por decreto ejecutivo nro. 22551-MIRENEM del 14 de setiembre de 1993, se amplió nuevamente el área de este refugio. De manera que, previo a la ley impugnada, la demarcación de la protección de este refugio había sido debidamente establecida, sin ninguna exclusión o régimen particular en especial, creando el mismo, en su totalidad, como demanio público. Así entonces, el Refugio de Vida Silvestre Ostional fue creado mediante la Ley n°6919, Ley de Conservación de la Fauna Silvestre, el 17 de noviembre de 1983. Ampliados sus límites mediante decreto n°16531 del 18 de julio de 1985 y decreto n°22551 del 14 de setiembre de 1993.

Durante esos años la Sala Constitucional indicó, mediante los votos números 2003-008742, 2007-002157 y 2009-002020, que:

“… en tratándose de que el Refugio de Vida Silvestre Ostional es de dominio público y forma parte del patrimonio nacional, no puede autorizar actividad alguna dentro del mismo que no tienda si no a su protección e investigación.” … “Asimismo, en caso de oposición de los propietarios de los terrenos ocupados con anterioridad a la creación del Refugio… deberá decretarse la correspondiente expropiación.” (voto 2003-008742) “De lo expuesto, y la jurisprudencia transcrita, la Sala reitera que no puede el Área de Conservación Tempisque del Ministerio del Ambiente y Energía autorizar actividad alguna en el Refugio de Vida Silvestre Ostional que no tienda sino a su protección e investigación, por lo que el permitir el zanjeo para la instalación de la tubería de agua potable por un camino dentro del Refugio de Vida Silvestre lesiona directamente el artículo 50 de la Constitución Política. En consecuencia, se declara con lugar el recurso por violación al ambiente sano y ecológicamente equilibrado.

Se anula el permiso otorgado mediante oficio 108-05 del doce de agosto del dos mil cinco por parte del Administrador de la Administración del Refugio Nacional de Vida Silvestre Ostional del Área de Conservación Tempisque del Sistema de Áreas de Conservación del Ministerio de Ambiente y Energía.” (voto 2007-002157) “… el Refugio Nacional de Vida Silvestre Ostional del Área de Conservación Tempisque… resulta indebatible que es un bien de dominio público … forma parte del Patrimonio Forestal de Estado… En función de su naturaleza demanial y su correlativa afectación para el resguardo de la flora y fauna de la zona, los terrenos que integran la reserva no pueden ser apropiados por los particulares … las autoridades sólo podrán autorizar dentro de refugios como el de Ostional, actividades que tiendan a la investigación, protección, capacitación y ecoturismo…” (voto 2009-002020) Posteriormente, en junio del 2011, se presenta a la Asamblea Legislativa el proyecto de ley n°18.148 “Ley de Territorios Costeros Comunitarios” cuyo objetivo, según se dice en el propio proyecto, era crear la figura de territorios costeros comunitarios, como una nueva categoría especial de protección, y además, dar una solución definitiva a la tenencia de la tierra en comunidades costeras, pesqueras e isleñas.

Todo a través de un régimen especial de concesiones. Este proyecto, luego de ser aprobado en primer debate, vino en consulta facultativa de constitucionalidad a esta Sala el 30 de mayo del 2013. El texto consultado por varios Diputados a la Sala Constitucional, publicado en el alcance No. 62 de La Gaceta No. 67 del 8 de abril del 2013, contenía normas análogas a las que son ahora cuestionadas, permitiendo el otorgamiento de concesiones en las áreas de naturaleza demanial del Refugio. Los Diputados consultantes estimaron que, al permitirse esas concesiones dentro del Refugio, se estarían cambiando las condiciones de protección (disminuyendo el ámbito de protección), sin que se hubiera justificado técnicamente que tal posibilidad era factible y compatible con la protección ambiental del sitio, y argumentaron que por esa razón se quebrantaban los artículos 50 y 89 constitucionales. La Sala Constitucional, resolvió dicha consulta, mediante el voto No. 2013-10158 de las 15:46 horas del 24 de julio del 2013, donde se resolvió que una ley que permitiera el otorgamiento de esas concesiones en el Refugio de Vida Silvestre Ostional debía contar, entre sus antecedentes, con un estudio de impacto ambiental aprobado por la Setena, y de no contar con ello, implicaría una vicio esencial al procedimiento:

“II.- SOBRE LOS ASPECTOS DE FORMA: La inexistencia de estudios técnicos que determinen la posibilidad de otorgar concesiones para el desarrollo de actividades humanas al determinarse que un Refugio de Vida Silvestre se convierte en Territorio Costero Comunitario: El único punto que cuestionan los diputados y las diputadas consultantes en cuanto a la forma, se enfoca en la violación al procedimiento dispuesto en los artículos 36 y 38 de la Ley Orgánica del Ambiente, Ley Nº 7554. Alegan que no existen estudios técnicos que justifiquen la pertinencia de otorgar concesiones dentro de un Refugio de Vida Silvestre, dadas las afectaciones que sin lugar a dudas las actividades que realicen en dichos terrenos provocarán sobre las áreas protegidas … al analizar el texto del proyecto, así como los diferentes criterios aportados por las autoridades consultantes, observa este tribunal que los artículos discutidos, específicamente el artículo 45 y 51 del proyecto, establecen en primer lugar la declaratoria de territorio costero comunitario y en segundo lugar la posibilidad de otorgar concesiones dentro del Refugio.

Si bien el artículo cuarenta y seis del proyecto prevé un estudio de impacto ambiental, ese requisito no es igual al cumplimiento de esa exigencia en la sede legislativa; existe una diferencia cualitativa importante si el requisito se cumple antes de la aprobación de la norma o después de su aprobación, que es lo que contiene el artículo cuarenta y seis del proyecto. La declaratoria de un Refugio Nacional de Vida silvestre, en este caso, el de Ostional, como territorio costero comunitario, sí tiene incidencia en su manejo y en el régimen que lo regula, así se infiere de las normas que contiene el capítulo tercero del proyecto consultado; su aplicación puede tener un influjo relevante en la naturaleza del refugio, debilitando su régimen de protección, por esta razón se requiere un estudio de impacto ambiental previo. No hay duda que la declaratoria de territorio costero de un refugio nacional de vida silvestre, sí puede modificar, significativamente, la condición real y efectiva del área protegida por el refugio. Se puede vaciar de contenido el régimen que define el refugio.

El proyecto de ley en discusión carece de estudios técnicos que acrediten no sólo la situación fáctica, sino también la viabilidad técnica, así como la razonabilidad y proporcionalidad como parámetros de constitucionalidad, principios que debe observar toda norma jurídica, principalmente cuando se trata de afectar recursos públicos como sucede en el caso concreto.

Lo anterior permite a este Tribunal coincidir con la posición de los diputados y diputadas consultantes en el sentido que no existe en el expediente legislativo un estudio técnico que analice y determine la posibilidad de reducir la protección ambiental en aplicación del principio de objetivación de la tutela ambiental, a pesar que existen tanto instituciones como expertos en la temática ambiental que podrían haber elaborado el estudio técnico que se echa de menos en el proyecto de ley.

En virtud de lo expuesto, procede evacuar la consulta señalando la existencia de vicios esenciales de inconstitucionalidad en el trámite del proyecto, en los términos del artículo 101 de la Ley de la Jurisdicción Constitucional…

III. EN CUANTO AL FONDO: …

Respecto al Refugio Nacional de Vida Silvestre Ostional en acatamiento del Principio Precautorio, se requiere de previo a la declaratoria como territorio costero comunitario y a la concesión –tal y como lo señalan las y los diputadas y diputados consultantes– de un estudio de impacto ambiental evaluado por parte de Secretaría Técnica Ambiental, de modo tal que se demuestre el tipo de daño y las medidas que deban adoptarse, estudio que se echa de menos en esta iniciativa de ley, ya que no podría dejar de protegerse un refugio sin criterios técnicos que así lo respalden. Por lo tanto dicha omisión implica una violación del principio precautorio y del principio de progresividad del ámbito de tutela de los derechos fundamentales, aspecto señalado en el vicio de forma analizado en esta sentencia.” (La negrita no pertenece al original).

Luego de esta sentencia, el proyecto de ley fue archivado por la Asamblea Legislativa. Posteriormente, pocos meses después de emitida la sentencia indicada, en octubre del año 2013, se presenta a la corriente legislativa el expediente n°18.939, que da origen a la ley que se impugna en esta acción. En la exposición de motivos del texto base se indicó el propósito de esa iniciativa:

“… a partir de 2008 se han producido diversas resoluciones de la Contraloría General de la República y sentencias de la Sala Constitucional que han ordenado, respectivamente, anular permisos otorgados en ciertas áreas silvestres protegidas a sus ocupantes, y el desalojo de una parte de los mismos. Esta situación se generado en parte por interpretaciones restrictivas del marco legal vigente… Mediante la presente iniciativa se pretende resolver el problema descrito, a través de la creación de un marco normativo especial que fomente la coexistencia armónica de la comunidad de Ostional con el Refugio Nacional de Vida Silvestre, para beneficio del ambiente y el ser humano…

… esta opción recientemente sufrió un tropiezo como consecuencia de la resolución de la Sala Constitucional de la Corte Suprema de Justicia n°2013-10158 de las quince horas y cuarenta y seis minutos del veinticuatro de julio de 2013… Ante esta situación, se torna indispensable la presentación del presente proyecto de ley como una iniciativa independiente en aras de no atrasar más la aprobación definitiva de la Ley de Territorios Costeros Comunitarios…

Los estudios técnicos a los que hace referencia la Sala Constitucional se encuentran sumamente avanzados… Oportunamente serán presentados a la corriente legislativa durante el trámite de la presente iniciativa.

Así las cosas, esta propuesta retoma elementos sustanciales de las iniciativas anteriormente presentadas para dar respuesta definitiva a la crítica situación de la comunidad de Ostional. Aunque se tramita como una ley independiente, se fundamenta plenamente el modelo de la Ley de Territorios Comunitarios y remite a sus regulaciones más importantes.” De lo cual se desprende, con toda claridad que, la iniciativa se presentó para crear en concreto, un régimen especial para Ostional, tal como se hacía en el proyecto archivado de Ley de Territorios Comunitarios. Régimen especial que se dice es para alcanzar objetivos de conservación con la presencia de personas y la realización de actividades dentro del área, de lo cual se entiende que ese régimen especial es para permitir actividades que no están permitidas bajo el esquema de protección del refugio. Así resulta aprobada la Ley No. 9348, estableciendo un régimen jurídico específico y diferenciado para el Refugio de Vida Silvestre Ostional, permitiendo la permanencia de los ocupantes de la zona marítimo terrestre a través del otorgamiento de concesiones y permisos de uso para diversas actividades.

El objeto de la Ley No. 9348 de 8 de febrero del 2016, conforme lo establece su artículo 1° es establecer un régimen jurídico especial para el Refugio de Vida Silvestre Ostional, para regular los usos del suelo, un régimen especial de concesiones, el aprovechamiento razonable y sustentable de sus recursos naturales mediante la participación activa de las comunidades, y brindar seguridad jurídica a quienes actualmente ocupan terrenos del Refugio, siempre y cuando se ajusten a las disposiciones de esta ley y sus reglamentos. Sobre el titular del Refugio se indica su demanio público cuando se dice que el Estado mantendrá su dominio sobre las tierras que le pertenecen dentro del Refugio, independientemente de su naturaleza, aptitud o uso actual, y en ninguna circunstancia podrá verse menoscabada esa demanialidad. No obstante, se podrá autorizar, de conformidad con esta ley, el otorgamiento de concesiones a los ocupantes actuales que cumplan con los requisitos y las demás condiciones exigidas.

También, podrán autorizarse usos de suelo en los bienes inmuebles de carácter privado que existan dentro del Refugio (artículo 3). Luego, se indica en el artículo 5 que el Refugio será de naturaleza mixta y estará conformado por terrenos propiedad del Estado o demás entes públicos, y también por terrenos propiedad de particulares que hayan sido inscritos en el registro respectivo, siempre que ambas formas de propiedad sean sometidas a usos compatibles con sus objetivos de conservación y protección ambiental, bajo un enfoque integral de conservación. De todo lo cual se desprende que, la ley impugnada vino a introducir normas para “permitir” en el Refugio de Vida Silvestre de Ostional, todo lo que la jurisprudencia de esta Sala había indicado como prohibido, al pasar a calificarlo como refugio mixto y al permitir concesiones para el desarrollo de actividades que van más allá de la investigación, protección, capacitación y ecoturismo.

Sobre la importancia de la protección del Refugio de Vida Silvestre Ostional debe indicarse que, las tortugas y los manglares, son de las más importantes riquezas del Refugio. El Refugio Nacional de Vida Silvestre Ostional (folio 67) está dividido en dos partes distintas:

-Playas Ostional y Nosara donde se concentra la actividad anidatoria de las tortugas marinas. Las playas Ostional y Nosara representan el sitio más importante para la anidación de tortugas marinas a nivel mundial.

-Playas Pelada y Guines, junto con las Puntas Rayo, Nosara, Pelada y Guiones, donde se han conservado ciertos ecosistemas litorales. Las cuales actúan como zonas de amortiguamiento.

Procede entonces a continuación examinar si ello es inconstitucional.

VI.Sobre si los usos de suelo de autorizados en los artículos 8 y 12 de la ley impugnada, violentan el Derecho de la Constitución.- Las accionantes estiman que solo las concesiones para uso habitacional, albergues de ecoturismo e infraestructura para investigaciones científicas son constitucionales, cuestionando los otros usos previstos en los artículos 8 y 12, tales como:

“Uso agropecuario sostenible de pequeña escala” (inciso a del art.8).

“Uso… habitacional recreativo.” (inciso b del art.8) “Cabinas… de ecoturismo.” (inciso c del art.8) “Uso comercial destinado a sustentar servicios básicos de apoyo a las comunidades y visitantes” (inciso d del art.8) “Instalaciones para servicios comunales y de bienestar social.” (inciso f del art.8) “Investigación y operación de proyectos comunales.” (inciso g del art.8) Usos que son reiterados en el artículo 12, cuando se refiere al canon que deberá pagar el concesionario para realizar dichos usos. Consideran que todos esos usos son incompatibles con el ambiente, que se está desprotegiendo a los manglares, que con ello se está reduciendo el bosque sin ninguna compensación, y que de todas formas, un diputado que participó en la votación de esta ley, por tener un terreno allí, debió abstenerse, viciando todo el articulado con su votación. En criterio de la Procuraduría General de la República, la normativa resulta inconstitucional por cuanto, conforme a los precedentes de la Sala Constitucional relativos al Refugio de Vida Silvestre Ostional (voto número 13-010158), una ley que permita allí el otorgamiento de concesiones para actividades distintas a la “investigación, protección, capacitación y ecoturismo” debe contar, entre sus antecedentes, con un estudio de impacto ambiental aprobado por la Setena, y no se aprecia en el expediente legislativo No. 18939, el cual dio origen a la Ley No. 9348, que ese requisito haya sido cumplido.

Indica que esas normas serían inconstitucionales por quebranto de los artículos 50 y 89 constitucionales y del principio de intangibilidad de la zona pública, salvo que se interprete, conforme a la Constitución, que la competencia allí conferida queda sometida a las condiciones previas contenidas en el artículo 11 de la Ley, de manera que las áreas de esteros, manglares (cualquiera que sea o haya sido su extensión) y ecosistemas de humedal, las áreas de protección, los bosques, terrenos forestales o con esa aptitud, los 50 metros contados a partir de la pleamar ordinaria y de las rías, las áreas que quedan al descubierto durante la marea baja, islotes, peñascos y demás áreas pequeñas y formaciones naturales que sobresalgan del mar, no son susceptibles de ser objeto de una concesión de uso como tampoco de un permiso de uso. Por su parte, en su informe, el Ministro de Ambiente y Energía indica que, la norma objeto de impugnación tiene amplio respaldo técnico, ya que el Área de Conservación elaboró los estudios de fragilidad ambiental, los estudios de la ocupación y de la tenencia de la tierra, el Plan General de Manejo y los diagnósticos biofísicos del Refugio con lo cual se sustenta la base de la Ley N°9348.

Por otro lado agrega que, su régimen se ajusta al artículo 82 de la Ley de Conservación de Vida Silvestre que establece que en los refugios de propiedad estatal y mixtos solamente se permitirá realizar actividades definidas en el plan de manejo elaborado por el área protegida, previa presentación de las evaluaciones de impacto ambiental correspondientes. En los transitorios se establecen una serie de pasos que se deberán de seguir antes de que se pueda dar cualquier concesión en el Refugio, como forma de asegurar que todos los elementos técnicos importantes estén aprobados de previo. Todo lo autorizado en los artículos impugnados por las accionantes tienen informes técnicos que le dan sustento técnico científico y son acordes a la categoría de manejo y proporcionales al objeto de tutela. El Reglamento de Desarrollo Sostenible, para cada uso del suelo se establece la condición y las recomendaciones de manejo.

Hay zonas de sobreuso consideradas como zonas de condición muy especial, en estas es necesario establecer medidas correctivas. Así también, el Plan General de Manejo establece los objetivos de manejo y la zonificación, para cada zona se establecen las características, las limitantes y los usos permitidos. Por su parte, el coadyuvante, el Consejo Interinstitucional para el Manejo Participativo del Refugio de Vida Silvestre Ostional, indica que el alegato referente a que los artículos 8 y 12 de la Ley 9348 permiten usos que no es posible realizar dentro de terrenos estatales es improcedente, ya que se basa en la consideración de que el Refugio en cuestión es propiedad 100% estatal, cuando en realidad es propiedad mixta. Las normas impugnadas, lejos de reducir el alcance de la protección ambiental, en realidad tienden a hacerla efectiva mediante la ordenación y regulación del uso del suelo, con el objeto de armonizar los fines de conservación del Refugio y el hecho ineludible de la presencia de particulares en el mismo.

En cuanto a la carencia de informe técnico indica que, el estudio técnico previo es el realizado por el Dr. [Nombre16 008], denominado “Informe de Evaluación Ambiental Estratégica del Plan de Manejo Ostional”. Aun cuando el Refugio fue declarado como estatal por parte de esta Sala, en realidad, nunca ha sido estatal sino mixto, por la demostrada existencia de propiedad privada en un porcentaje considerable del territorio y que fue constituida desde antes de la creación del mismo.

De todo lo cual, esta Sala determina en efecto la existencia de la inconstitucionalidad, pero no solo de las normas impugnadas, sino de toda la ley, conforme se explica a continuación.

-El Refugio de Vida Silvestre Ostional es propiedad del Estado y ninguna propiedad demanial puede ser reducida por ley si no hay previos estudios técnicos que lo justifiquen: El área de las reservas forestales, zonas protectoras, parques nacionales, refugios de vida silvestre, reservas biológicas del patrimonio forestal, sólo podrá ser reducida por ley de la República, previos estudios técnicos correspondientes que justifiquen esta medida (artículo 40 de la Ley Forestal). Y esto es así en virtud de que el bien jurídico que se protege es el "recurso forestal", término que "significa la protección y preservación de la integridad del medio ambiente natural," (resolución de la Sala Constitucional número 2233-93, de las nueve horas treinta y seis minutos del veintiocho de mayo de mil novecientos noventa y tres). En este sentido, el artículo 69 de la Constitución Política es que habla de "explotación racional de la tierra", constituyéndose un principio fundamental su protección.

El Refugio es definido como propiedad estatal por lo que no se pueden realizar actividades de desarrollo o de explotación de los recursos naturales. Ninguna ley puede cambiar sin más tal naturaleza estatal, indicando que es “mixta”, sin sustento técnico específico. La naturaleza estatal no cambia aunque una norma legal pretenda cambiar la naturaleza del refugio indicando que es de propiedad mixta. Así, pues, una modificación de la naturaleza, implica un daño al medio ambiente. En efecto, el Refugio de Vida Silvestre Ostional que se encuentra ubicado en la zona marítimo terrestre, es propiedad del Estado. Sobre ella, el Estado tiene plena jurisdicción, por lo que no se puede disponer a favor de los particulares la realización de ninguna actividad, como las que se autorizan en los artículos 8 y 12 impugnados. Las leyes que se relacionan con el ambiente (Ley Orgánica del Ambiente, Ley de Conservación de la Vida Silvestre y su Reglamento, la Ley Forestal y la Ley de Zona Marítimo Terrestre, por ejemplo), no previeron al Refugio de Vida Silvestre Ostional como un refugio de propiedad mixta a partir del cual se puedan autorizar actividades o proyectos de desarrollo o de explotación de los recursos naturales.

Ello se hizo hasta el año 2013, por la ley que está siendo ahora impugnada, la cual, en sentido contrario a lo dicho por la Jurisprudencia de esta Sala, lo que hizo fue cambiar la naturaleza del Refugio de estatal a mixta con el fin de permitir otros usos en este Refugio, y sin estudio técnico previo que lo justificara, según se ha dicho.

-La ley impugnada, en sus distintas normas, desafectan y reducen el grado de protección del Refugio de Vida Silvestre Ostional: Tal como apunta la parte accionante, el legislador estableció varias disposiciones que implican una desafectación del área a proteger y reducen el grado de protección que le había sido conferido. Lo anterior, sin que ello haya sido justificado en un estudio técnico, como reiteradamente lo ha señalado este Tribunal. El artículo 5, por ejemplo, cambió su naturaleza jurídica de un refugio de naturaleza meramente pública a uno mixto, estableciendo que, a partir de ese momento, ya no solo estaría conformado por terrenos propiedad del Estado, sino además, por terrenos propiedad de particulares que hayan sido inscritos en el registro respectivo y, aunque la norma advierte que ello ocurrirá siempre que ambas formas de propiedad sean sometidas a usos compatibles con sus objetivos de conservación y protección ambiental, bajo un enfoque integral de conservación, lo cierto es que en artículos posteriores autoriza actividades para las cuales no consta un estudio técnico previo, que haya determinado que, a través de estas, no se vaya a afectar el fin para el cual este fue constituido.

El artículo 8 aquí cuestionado, dispone que, en “las áreas de naturaleza demanial del Refugio podrán otorgarse concesiones a ocupantes actuales”, con excepción de los que estén en un área de protección de quince metros alrededor de los esteros y manglares del Refugio; bosques, terrenos forestales, ecosistemas de humedales, los cincuenta metros de la zona pública de la zona marítimo terrestre contados a partir de la pleamar ordinaria, las áreas que quedan al descubierto durante la marea baja, islotes, peñascos y demás áreas pequeñas y formaciones naturales que sobresalgan del mar. Ese numeral indica que el Área de Conservación puede otorgar concesiones cuando en el estudio que se realice para el caso concreto se determine técnicamente que no son incompatibles con los objetivos y los alcances establecidos en el Plan general de manejo, para los siguientes usos potencialmente compatibles con los objetivos de conservación del Refugio: “a) Uso agropecuario sostenible de pequeña escala. b) Uso habitacional y habitacional recreativo. c) Cabinas y albergues de ecoturismo. d) Uso comercial destinado a sustentar servicios básicos de apoyo a las comunidades y visitantes. e) Infraestructura para investigaciones científicas o culturales y capacitación. f) Instalaciones para servicios comunales y de bienestar social. g) Investigación y operación de proyectos comunales.” Y el artículo 12 incluso establece un pago de cánones para el ejercicio de esas actividades.

Es decir, con esas disposiciones no solo pierde el refugio parte de su territorio al cambiar su naturaleza y establecer que existirán terrenos de naturaleza privada dentro de estos, sino que, además, sin un estudio técnico que verifique los eventuales impactos en el ambiente de previo, como lo exigiría el principio precautorio, son autorizadas actividades diversas a las establecidas por la Ley Forestal para este tipo de refugios de naturaleza mixta (por ejemplo: el uso agropecuario, habitacional, y comercial contemplado en el artículo 8 impugnado). El ordinal 9 de la misma ley, también innova autorizando permisos de uso de suelo a instituciones públicas para brindar servicios públicos que resultan ajenos al ámbito de protección, sin que exista un estudio técnico que, de previo, igualmente justifique porqué no solo son desafectadas ciertas áreas de protección, sino también ha reducido el grado de protección ambiental de estas, pues anteriormente todas esas actividades no eran permitidas, y ahora se autorizan en la ley, sin previamente acreditar que no ocasionarán un daño en el ambiente.

En similar sentido, el numeral 10 de esta ley, abre la posibilidad al Área de Conservación Tempisque para otorgar permisos de uso de suelo dentro del Refugio a universidades privadas, centros o institutos de investigación y organizaciones comunales locales, para investigación y desarrollo de proyectos comunales. Además, en estos dos numerales no se excluyen las áreas que sí se excluyen para el otorgamiento de concesión, tal y como acertadamente lo afirma la Procuraduría General de la República en su informe. En efecto, no se salvaguarda de la zona pública los humedales, área de bosque, forestales o con esa actitud y demás zonas exceptuadas en los artículos 8 y 11 de la ley, lo que quebranta los numerales 50 y 89 de la Carta Fundamental. Ciertamente la ley impugnada establece en el ordinal 11 que se debe emitir un Plan General de Manejo previo al otorgamiento de concesiones en el Refugio, que determine que los usos estuvieran orientados a los objetivos de conservación del Refugio, con las limitantes y potencialidades técnicas ambientales de cada zona o subzona; sin embargo, dadas las particularidades de este caso, donde se reitera, ya existía una protección normativa mayor y se desafectó no solo parte de su territorio, con propósitos incluso diversos a la tutela ambiental, sino que también fue disminuido el grado de tutela que tenía respecto de algunas áreas, a fin de resolver un problema de ocupación dentro de esta área, lo cual es ajeno a su fin, el origen de la reforma legal requería estar sustentada en un estudio técnico que justificara tales cambios y compensara la tutela ambiental existente, conforme ya lo había indicado este Tribunal, respecto a este mismo refugio, al pronunciarse mediante consulta legislativa sobre el proyecto de ley nro. 18.148, “Ley de Territorios Costeros Comunitarios”, en la sentencia nro. 2013-10158 de las 15:46 horas del 24 de julio de 2013. No obstante, nuevamente se echa de menos.

-Ausencia de respaldo técnico: En el expediente legislativo No. 18939 que dio origen a la Ley No. 9348 no se aprecia que se haya sido cumplido con el requisito de respaldo técnico, en los términos ya indicados por esta Sala en el voto mencionado del 2013-010158. Claramente, de la exposición de motivos del proyecto se extrae que, a ese momento, no tenían los informes técnicos de respaldo, cuando se indica: “Los estudios técnicos a los que hace referencia la Sala Constitucional se encuentran sumamente avanzados… Oportunamente serán presentados a la corriente legislativa.” Pese a que el Ministro de Ambiente indica en su informe que habrá un Plan General de Manejo, como un requisito previo para el otorgamiento de las concesiones, y que además habrá un estudio concreto en cada caso, ello no sustituye los estudios técnicos PREVIOS que deben existir como fundamento al proyecto de ley que en el fondo conlleva la reducción del Refugio de Vida Silvestre de Ostional.

Ello por cuanto dichos estudios no son una mera formalidad, ni pueden ser sustituidos por estudios posteriores o concretos, sino que, permitir usos de suelo, más allá de los relacionados con la conservación de un Refugio de Vida Silvestre, es desnaturalizar la razón de ser del refugio, reducir en todo caso el área del refugio, y con ello violentar el derecho al ambiente. Sobre lo indicado por el coadyuvante de que el informe técnico de la ley es el realizado por el Dr. [Nombre16 008], denominado “Informe de Evaluación Ambiental Estratégica del Plan de Manejo Ostional” se debe indicar que esta Sala pudo observar dicho informe, y se concluye que claramente este no es el informe que justifica técnicamente la ley, básicamente por tres razones: la fecha del informe, la justificación y su contenido. Dicho informe data del 2009, el proyecto de ley se presentó en el 2013 y es aportado al expediente legislativo en junio del 2015.

Un informe técnico base de un proyecto de ley se debe presentar adjunto al proyecto de ley. Además, nótese que cuando esta Sala conoció del asunto en consulta, en el voto del 2013, nada se dijo en ese momento sobre este informe técnico del 2009 como base del proyecto de ley. Por lo demás, la justificación de dicho informe no tiene relación con el proyecto, pues lo que se indica es que: Es un estudio base para la elaboración del Plan de Manejo del Refugio (“El objetivo del estudio es desarrollar una zonificación de Indices de Fragilidad Ambiental (IFA) para el Refugio Nacional de Vida Silvestre Ostional… con la finalidad de establecer una base técnica para el Plan de Manejo de este conjunto de importantes ecosistemas.”). Finalmente, su contenido no se refiere a lo que debería referirse un informe técnico que sustente un proyecto de ley que reduzca el nivel de protección de un refugio de vida silvestre, pues no se indica en concreto por qué se reduce, cómo se reduce ni cuáles medidas de compensación se establecen.

-La demanialidad ambiental supone un régimen especial de protección: La declaración de demanialidad por razones ambientales supone una esfera especial de protección, en la medida en que configura un régimen especial de dominio, regulado por normas intensas de derecho público y que procuran el resguardo del cumplimiento de una finalidad de tutela del derecho al ambiente sano y ecológicamente equilibrado. Atendiendo a dichas razones constitutivas y en aras de las bondades que subyacen en su dimensión teleológica, cualquier determinación de desafectación total o parcial, o bien, de recomposición de su naturaleza jurídica, exige e impone los debidos análisis técnicos que ponderen la variable ambiental en la toma de la decisión, como derivación de los principios de no regresión, progresividad del ambiente, precautorio, preventivo y pro-natura. La especial protección constitucional del ambiente impone un exhaustivo estudio de las razones que sustenten ese tipo de determinaciones, en el contexto de los diversos niveles que componen los ecosistemas, así como las relaciones del ambiente con el entorno antropológico y dentro de este, las incidencias sociales, económicas, entre otras.

De esa manera, la ausencia de ese tipo de rigor técnico en la variación de naturaleza del dominio público ambiental deja de lado y quebranta, aún por riesgo, el contenido sustancial de ese derecho. Lo mismo ha de advertirse en lo referente a la permisibilidad de la realización de actividades humanas dentro de esos espacios territoriales, sin la debida ponderación del impacto que aquellas pueden llegar a producir en el medio, para lo cual, es menester la consideración del régimen primario de uso del bien, la tipología de ecosistemas convergentes en esa área, la existencia o no de regímenes especiales de uso impuestos por normas jurídicas. En efecto, la variación de uso de un bien al que tradicionalmente se ha conferido un régimen de protección ambiental, precisa de las valoraciones de orden técnico sobre las consecuencias que esas nuevas incursiones antrópicas llegarán a producir en el ecosistema, así como si son congruentes con el medio, bajo un contexto de sostenibilidad ambiental.

Esto implica ponderar conductas permitidas, acciones y procedimientos correctivos, medidas de mitigación, acciones compensatorias, entre otra serie de consideraciones que se echan de menos en este expediente. Tal falencia, como se ha expuesto, supone lesiones de orden sustancial que esta Cámara no puede inadvertir si se entiende que el patrimonio público, desde el plano conceptual, dice del conjunto de bienes que por ley (o norma superior) se encuentran afectos a un uso y fin público. Si bien su régimen de uso no es totalmente incompatible con la explotación privativa por parte de terceros, previa habilitación administrativa expresa, lo cual, ha de ser regulado de manera expresa por fuente legal, cuando se trata de un demanio ambiental, la valoración de este marco de actividades permitidas exige de un análisis minucioso, cauteloso, técnico, atendiendo a las condiciones y características propias del ambiente, como bien jurídico tutelado y su innegable significancia para el ámbito de los derechos humanos contemporáneos y de generaciones futuras.

Es esa finalidad de protección la que impone el tipo de consideraciones especiales y de orden técnico al que se viene haciendo referencia, en procura de cumplir con la obligación constitucional de velar el derecho a un ambiente sano y ecológicamente equilibrado. Esto implica, además, la valoración de las acciones de recuperación de las zonas de incidencia e impacto de los diversos ecosistemas, como medio necesario para la regeneración ambiental y el fortalecimiento del Patrimonio Natural del Estado. Esa función de la propiedad pública justifica que su titularidad no fenezca por aspectos de temporalidad, que las acciones de recuperación no se encuentren afectas por el decurso del tiempo, así como que no sean oponibles o generen un mejor derecho, las acciones registrales que produzcan un detrimento de ese régimen especial de propiedad.

-El Refugio de Vida Silvestre Ostional es patrimonio natural del Estado: Es claro que el Refugio de Vida Silvestre Ostional es patrimonio natural del Estado. El patrimonio natural del Estado está constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su Nombre16 y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública. Sugiere esto, sin duda alguna, que aunque se ubiquen en el Refugio de Vida Silvestre Ostional personas con terrenos ocupados con anterioridad a su creación, si los terrenos en que se ubican aquellos forman parte del Refugio, deberá decretarse la correspondiente expropiación. Lo que significa que el legislador no puede establecer el carácter mixto del refugio, sin sustento técnico alguno. Sobre esa base, la ley impugnada, en tanto permite autorizar actividades en el Refugio de Vida Silvestre Ostional que no tiendan a su protección e investigación, resulta inconstitucional.

Inconstitucionalidad que resulta, tanto por la forma, como por el fondo. En cuanto a la forma, se constató que no existe en el expediente legislativo un estudio técnico que analice y determine la posibilidad de reducir la protección ambiental en aplicación del principio de objetivación de la tutela ambiental, lo cual constituye un vicio esencial de inconstitucionalidad en el trámite del proyecto, en los términos del artículo 101 de la Ley de la Jurisdicción Constitucional, tal como esta Sala lo ha indicado antes. Además, también resulta en una inconstitucionalidad por el fondo por cuanto, en acatamiento del Principio Precautorio, se requiere de previo a cambiar la naturaleza del Refugio, su ámbito de protección, y a posibilitar concesiones, de un estudio de impacto ambiental evaluado por parte de Secretaría Técnica Ambiental, de modo tal que se demuestre el tipo de daño y las medidas que deban adoptarse, estudio que se echa de menos en esta iniciativa de ley, ya que no podría dejar de protegerse un refugio sin criterios técnicos que así lo respalden.

Por lo tanto dicha omisión implica una violación del principio precautorio y del principio de progresividad del ámbito de tutela de los derechos fundamentales, aspecto señalado en el vicio de forma analizado en esta sentencia. Siendo que, por tratarse de un vicio de forma, la inconstitucionalidad es de toda la ley, y no solamente de las normas impugnadas. Así, carece de interés pronunciarse respecto de los demás extremos alegados por la parte accionante, dadas las consecuencias que ello implica, cuales son, la nulidad de toda la ley aquí impugnada.

Finalmente sobre el argumento de que la ley es nula porque, un diputado concreto que votó a su favor tenía intereses específicos, ello no es un argumento de constitucionalidad, sino de legalidad, que podrá ventilarse en la vía penal donde corresponderá examinar si ha habido algún ilícito al respecto.

VII.Conclusión.- Se comprueba que la Ley impugnada contiene un cambio en la naturaleza del Refugio de Vida Silvestre de Ostional que disminuye su nivel de protección al permitir usos de suelo, y por tanto concesiones, más allá de la protección, investigación, capacitación y ecoturismo. Se comprueba que ello se aprobó sin estudios técnicos que acrediten la situación fáctica, la viabilidad técnica, así como la razonabilidad y proporcionalidad como parámetros de constitucionalidad, principios que debe observar toda norma jurídica, principalmente cuando se trata de afectar bienes públicos como sucede en el caso concreto. Así entonces, se declara la inconstitucionalidad de toda la Ley n°9348 “Refugio de Vida Silvestre Ostional”, por falta de sustento técnico que justifique permitir usos de suelo distintos a la investigación, protección, capacitación y ecoturismo y con ello desproteger el derecho al ambiente.

Al carecer de este criterio técnico, la reforma legal en cuestión aquí impugnada presenta un vicio de procedimiento legislativo que la hace inviable y lesiva del principio precautorio, de objetivación de la tutela ambiental, del principio de no regresión ambiental, de una explotación racional de la tierra y por ende, del derecho a un ambiente sano y ecológicamente equilibrado, tal como dispone nuestra Constitución Política, del ordinal 5 de la Convención para la Protección de la Flora, la Fauna y de las Bellezas Escénicas Naturales de los Países de América, del numeral 4 de la Convención sobre la Protección del Patrimonio Mundial, Cultural y Natural y del artículo 4 de la Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas. En consecuencia, se anula por inconstitucional la Ley n°9348 “Refugio de Vida Silvestre Ostional” y además por conexidad se anula el decreto ejecutivo n°41134 del 10 de abril del 2018.

Quedando entonces, toda la normativa que resguarda el Refugio de Vida Silvestre de Ostional como vigente, en cuenta, la Ley de Conservación de la Fauna Silvestre (Ley n°6919 del 17 de noviembre de 1983) y los decretos n°16531 del 18 de julio de 1985 y n°22551 del 14 de setiembre de 1993.

VIII.Sobre los efectos de esta declaratoria con lugar y la nulidad de la ley impugnada con efectos declarativos y retroactivos.- Ante el vicio de procedimiento sustancial evidenciado en el trámite del proyecto legislativo nro. 18.939, y ante la falta de un estudio técnico que justificara la desafectación y disminución del grado de protección ambiental del Refugio de Vida Silvestre de Ostional, la declaratoria con lugar de esta acción implica, según se dijo, la nulidad de toda la Ley n°9348 “Refugio de Vida Silvestre Ostional” y además por conexidad del decreto ejecutivo n°41134 del 10 de abril del 2018. En este sentido, tal como lo establece el artículo 89 de la Ley de la Jurisdicción Constitucional, se podrá declarar la nulidad de cualquier otra disposición normativa que resulte necesaria por conexión o consecuencia. Además, esta anulatoria opera con efectos declarativos y retroactivos a la fecha de entrada en vigencia de las normas anuladas.

Lo anterior sin perjuicio de eventuales derechos adquiridos de buena fe, que pudieran haberse generado al amparo de títulos de habilitación administrativa para actividades congruentes con el carácter demanial del citado refugio. No ostentan tal condición, los títulos de adquisición de dominio incongruentes con tal demanialidad, como serían aquellos que se hubieren otorgado o inscrito a partir de la creación y de declaratoria de demanialidad del refugio y cuya condición, hace inviable validar esa modalidad adquisitiva. Ello por cuanto, conforme lo ha indicado esta Sala en varias ocasiones sobre bienes de dominio público no procede alegar derecho adquirido alguno (ver al respecto los votos de esta Sala n°2005-03669, 2000-0698).

IX.Nota del Magistrado Nombre04.- La persistente voluntad política en perjuicio de la tutela del ambiente. Esta nota pretende puntualizar la persistente voluntad del legislador en dictar una ley, a todas luces inconstitucional. La reiteración de estas decisiones legislativas ignoran normas constitucionales y fallos que esta Sala ha dictado sobre un tema tan relevante como la protección del ambiente. Cuatro sentencias de la Sala Constitucional no fueron suficiente para que ahora, mediante este quinto fallo, se comprendiera que, el Refugio de Vida Silvestre Ostional es un bien de dominio público, que por ello, forma parte del patrimonio nacional del Estado, y que por tanto, no es posible autorizar, sin sustento técnico -ni siquiera vía legal- actividades más allá de la protección y la investigación. No se justifica que un asunto tan claro, haya requerido cinco sentencias de esta instancia Constitucional, para enmendar una cuestionable voluntad del parlamento.

Se pretendió, en varias ocasiones, que una norma legal autorizara que sujetos particulares se apropiaran de un refugio como este, desconociendo que son bienes de los ciudadanos de ahora y del porvenir; de igual forma, se pretendió variar la naturaleza pública del refugio. Nótese que este proceder del legislador podría hacerlo sujeto de responsabilidad administrativa por persistir en la aprobación de normativa inconstitucional. No aprecio una razón que justifique esta reiterada voluntad legislativa a contrapelo de la tutela del ambiente. En algunas ocasiones la voluntad política no está en sintonía con la protección de bienes comunales de excepcional valor para el ambiente, esto es lo que aprecio en la reiteración de leyes que pretenden debilitar o anular tal tutela, dándole preeminencia a la codicia individual frente a los intereses de la comunidad. No siempre podrá intervenir la Sala para tutelar los intereses comunitarios, en este caso, a pesar de la lentitud de la intervención judicial, se pudo tutelar el ambiente y reivindicar su preeminencia.

X.Razones adicionales de los Magistrados Nombre04, Nombre05 y Nombre06, con redacción del primero.- Pese a que la inconstitucionalidad encontrada por esta Sala resultó tan severa como para anular toda la ley impugnada, procedemos a realizar los siguientes apuntes sobre el Transitorio VII de la ley, también aquí impugnado. El transitorio VII impugnado indica que se suspenden los procesos de desalojo de ocupantes mientras se resuelven las solicitudes de concesión que se presenten al amparo de la Ley. Lo cual, en criterio de los accionantes constituye un quebranto del artículo 50 constitucional, por perpetuar con ello la irregularidad del refugio. Por su parte, la Procuraduría General de la República indica en su informe que, efectivamente se observa una lesión al derecho al ambiente, consagrado en el artículo 50 de la Constitución. Ello por cuanto, de dicho transitorio se entiende que, mientras se publica el Decreto Ejecutivo con “los parámetros que permitan la valoración ambiental del Plan de Manejo del Refugio Nacional de Vida Silvestre Ostional”, se ajusta el Plan de Manejo a esos lineamientos, se aprueba y publica el Plan de Manejo (previéndose para lo anteriormente citado el plazo de un año), se presentan las solicitudes (para lo cual se confiere el plazo de 6 meses a partir de la publicación del Plan de Manejo) y se resuelven las solicitudes de concesión (para lo cual no se establece un plazo); no se iniciarán procesos de desalojo.

Lo anterior, sin diferenciar aquellos casos de ocupaciones sobre áreas no concesionables, como la zona pública o por personas que no califican para el otorgamiento de concesiones, como es el caso de las sociedades mercantiles o personas con menos de diez años de ocupación al momento de la entrada en vigencia de la Ley. Indica la Procuraduría que la inconstitucionalidad provendría en la autorización, por el plazo indicado, más el que transcurra para la resolución denegatoria de las solicitudes, que se utilicen y exploten áreas no concesionables, respecto de las cuales la protección del ambiente impone la desocupación inmediata. Agrega en su informe que, no puede dejar de señalarse que en el documento “Análisis del desarrollo de la distribución de la infraestructura habitacional en las propiedades estatales y privadas del RNVS Ostional” del año 2010, se identifican 12 construcciones en zona pública (folio 634 del expediente legislativo); en el Diagnóstico para el Plan General de Manejo del Refugio Nacional de Vida Silvestre Ostional (2010) se enlistan cinco sociedades anónimas que obtuvieron permiso de uso dentro del Refugio (folio 1511 del expediente legislativo); y en el oficio No. ACT-OR-969-2015 se enumeran 32 denuncias por usurpación a terrenos del Refugio, interpuestas entre los años 2007 y 2014 (folio 756 del expediente legislativo).

Adicionalmente, la norma transitoria sería inconstitucional si suspendiera también los desalojos y derribos o demoliciones ordenados en procesos judiciales donde se discuta la legalidad de ocupaciones en este sector costero, lo cual constituiría un quebranto de los principios de separación de funciones e independencia entre poderes. La potestad legislativa no puede anular o archivar una causa judicial, salvo los casos en los que la Constitución lo autorice, expresamente; con mayor razón, si se trata de la tutela de bienes de interés colectiva. El órgano asesor de esta jurisdicción, concluye que se constata una lesión al derecho al ambiente, consagrado en el artículo 50 de la Constitución y a los principios de la tutela del derecho ambiental a cargo del Estado, así como de separación de funciones e independencia entre poderes, por parte del transitorio VII, salvo que se interprete, conforme a la Constitución, que ese transitorio no impide la continuación o ejecución de los procesos judiciales iniciados o tramitados al amparo de la legislación vigente, y que, no suspende los desalojos en las zonas no concesionables o en aquellas que se encuentren ocupadas por personas físicas o jurídicas que no califiquen para el otorgamiento de concesiones.

Por su parte, el coadyuvante, el Consejo Interinstitucional para el Manejo Participativo del Refugio de Vida Silvestre Ostional, indica que este transitorio se corresponde con el voto de la Sala citado, pues un desalojo inmediato llevado a cabo sin que se hayan aprobado los criterios e instrumentos técnicos y el respectivo Plan de Manejo, iría en contra de lo ordenado por esta Sala en el voto 16892-2009.

Al respecto, consideramos que esta inconstitucionalidad también lo es respecto del transitorio VII, acogiendo los argumentos de los accionantes y la Procuraduría. Dicho transitorio establece literalmente lo siguiente:

“TRANSITORIO VII.- A partir de la entrada en vigencia de la presente ley, y mientras no sean resueltas las solicitudes de concesión que con base en ella se presenten, no se iniciará ningún proceso de desalojo a ocupantes presentes en el Refugio al momento de la entrada en vigencia de esta.” La norma transitoria bajo examen establece un tratamiento genérico de impedimento de instrucción de procesos de desalojo de ocupantes presentes en el refugio al momento de entrada en vigor de la norma. Es decir, ese precepto pretende dar un trato paritario de restricción de desalojo pese a que pueden concurrir en ese sector una serie de hipótesis que, por sus particularidades, merecerían soluciones diversas. La norma no discrimina la situación de ocupantes ilegales por estar en zonas no concesionables, desalojos ya iniciados por la vía judicial, o desalojos en aquellas zonas ocupadas por personas físicas o jurídicas que no califiquen para el otorgamiento de concesiones.

Tampoco pondera las circunstancias de ocupaciones que pudieran encontrarse amparadas a un título habilitante legítimo y en esa medida, pretende dar una solución única a condiciones disímiles, contrario al derecho de igualdad constitucional. Por otro lado, al pretender suspender los procesos de desalojo de los ocupantes presentes del Refugio, sin establecer plazo concreto alguno y sin diferenciar situaciones como las apuntadas, potencia una ocupación en precario en beneficio de ocupantes irregulares, lo que se traduce, al menos de manera transitoria, en una suerte de legitimación de aquellos, lo que resulta, a no negarlo, contrario al deber de tutela del ambiente. Cabe destacar que, en tanto demanio público ambiental, el Estado no solamente se encuentra empoderado a ejercer las acciones de tutela inmediata para garantizar un correcto uso y resguardo del fin público que es inherente a este tipo de bien jurídico, sino, que, ante la relevancia de esa potestad, se encuentra en la obligación de emprender esas acciones de protección, recuperación o restitución.

Así en efecto lo estatuye la doctrina misma del canon 50 constitucional, potestad que conlleva a un poder-deber y que resulta imprescriptible, irrenunciable e indelegable. Ergo, la renuncia, a priori del ejercicio de acciones de recuperación de ese espacio para destinarle a su función esencial, constituye una lesión al derecho al ambiente, por negación o dejadez temporal de los poderes jurídicos que se imponen para la satisfacción del fin público. Esto adquiere especial matiz si se considera que esa permisibilidad reprochada, se establece sin condicionamiento a plazo alguno, dejando su vigencia a condiciones resolutorias altamente imprecisas, inciertas, lo cual, puede llegar a cohonestar ocupaciones ilegítimas que impliquen usos antagónicos con el fin de protección del patrimonio ambiental que da base a la creación del Refugio.

Nótese que como lo indica la Procuraduría en su informe, se identifican 12 construcciones en zona pública (folio 634 del expediente legislativo), se enlistan cinco sociedades anónimas que obtuvieron permiso de uso dentro del Refugio (folio 1511 del expediente legislativo); y existen 32 denuncias por usurpación a terrenos del Refugio, interpuestas entre los años 2007 y 2014. Así se desprende que, sin decirlo expresamente, el transitorio impugnado propicia una derogatoria de las normas punitivas que contiene la Ley de la zona marítimo terrestre y que tutela un bien de tanta relevancia para el medio ambiente. Es decir, se está legalizando lo que hoy se tiene como ilegal, en violación del derecho al ambiente, y además, del principio básico de separación de poderes e independencia judicial, por desconocer desalojos judiciales ya iniciados. Atendiendo a esos argumentos, consideramos además que el Transitorio VII violenta el derecho al ambiente.

XI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara CON lugar la acción. En consecuencia se anula en su totalidad la Ley n°9348 “Refugio de Vida Silvestre Ostional” y por conexidad además el decreto ejecutivo n°41134-Minae del 10 de abril del 2018 “Reglamento a la Ley N° 9348 del Refugio de Vida Silvestre Ostional. Lo anterior por vicio sustancial de procedimiento debido a la falta de sustento técnico. Esta sentencia tiene efectos declarativos y retroactivos a la fecha de entrada en vigencia de las normas anuladas, sin perjuicio de los derechos adquiridos de buena fe. El Magistrado Nombre04, el Magistrado Nombre07 y la Magistrada Nombre08 consignan nota por separado. El Magistrado Nombre04, el Magistrado Nombre05 y el Magistrado Nombre06 consignan razones adicionales. Reséñese esta sentencia en el Diario Oficial La Gaceta y publíquese íntegramente en el Boletín Judicial. Notifíquese al accionante, al Presidente de la Asamblea Legislativa, al Ministro de Ambiente y Energía, a la Procuraduría General de la República y al Consejo Interinstitucional Asesor del Refugio Nacional de Vida Silvestre Ostional (CIMACO).- Nombre09.

Res. n.°2022-022606 NOTA DE LA MAGISTRADA Nombre08 Con el respeto acostumbrado, he decidido incluir esta nota para perfilar un aspecto de la sentencia de la mayoría que, desde mi perspectiva, requiere aclaración.

Coincido con las consideraciones de la mayoría para la estimatoria de la acción de inconstitucionalidad, en el siguiente sentido:

“[N]o existe en el expediente legislativo un estudio técnico que analice y determine la posibilidad de reducir la protección ambiental en aplicación del principio de objetivación de la tutela ambiental, lo cual constituye un vicio esencial de inconstitucionalidad en el trámite del proyecto.” Esta ratio -la exigencia de estudios técnicos que fundamenten una iniciativa parlamentaria que tienda a disminuir el grado de protección otorgado a los recursos naturales- es congruente con mi línea de votación en asuntos similares (ver mi voto salvado a la resolución n.°2020-013837, de la opinión consultiva relativa al proyecto de aprobación de la “Ley para el aprovechamiento sostenible de la pesca de camarón en Costa Rica”; mi voto salvado a la sentencia n.°2020-013836, relativa a la acción de inconstitucionalidad contra la ley n.°9610 de 17 de octubre de 2018, denominada “Modificación de límites de la Reserva Biológica Lomas de Barbudal para el desarrollo del Proyecto de Abastecimiento de Agua para la Cuenca Media del Río Tempisque y Comunidades Costeras”; y mi voto salvado a la sentencia sentencia n.°2020-18213, relativa a la acción de inconstitucionalidad contra los arts. 13 y 14 del decreto ejecutivo n.°38681-MAG-MINAE del 9 de octubre de 2014, “Ordenamiento para el aprovechamiento de atún y especies afines en la zona económica exclusiva del Océano Pacífico Costarricense”).

Desde mi perspectiva, es suficiente con que la zona es cuestión haya sido declarada por las autoridades públicas como un refugio nacional de fauna silvestre para que se declare con lugar esta acción de inconstitucionalidad. Esto, al margen de cuál es la naturaleza del refugio en cuestión y de entrar a realizar un examen sobre si ese refugio forma parte o no del Patrimonio Natural del Estado (PNE). Es decir, no es estrictamente necesario asimilar este refugio nacional con el PNE para entender que se debe aplicar la ratio de la resolución. Hago esta advertencia con el propósito que la Sala sea más precisa en el empleo de los conceptos, pues cada área silvestre protegida tiene asociada una categoría de manejo específica y esto es necesario respetarlo en aras de atender las especificidades del ecosistema bajo examen y la protección que se le procura otorgar. Recuérdese, al respecto, que el art. 32 de la Ley Orgánica del Ambiente establece justamente una clasificación de las distintas áreas silvestres protegidas, dentro de los cuales se encuentran las reservas forestales, zonas protectoras, parques nacionales, reservas biológicas, refugios de vida silvestre, humedales y monumentos nacionales.

En este sentido, es que considero que no cabe asociar necesariamente los conceptos de refugio de vida silvestre con el de PNE, porque este es un concepto expresamente delimitado por el legislador y que fue explicado en la sentencia n.°2021-017783 en los siguientes términos:

“La inclusión en el PNE responde a determinadas características y cualidades que ameritan su inventario por parte del MINAE y restringe las actividades que se pueden llevar a cabo en dichos terrenos, justamente, en aras de proteger el recurso forestal. Sobre el particular, conviene citar en lo conducente lo señalado por la Ley Forestal, norma que es la que define y delimita las cualidades del PNE:

“Art. 13.- Constitución y administración. El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su Nombre16 y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio.

El Ministerio del Ambiente y Energía administrará el patrimonio. Cuando proceda, por medio de la Procuraduría General de la República, inscribirá los terrenos en el Registro Público de la Propiedad como fincas individualizadas de propiedad del Estado.

Las organizaciones no gubernamentales que adquieran bienes inmuebles con bosque o de aptitud forestal, con fondos provenientes de donaciones o del erario, que se hayan obtenido a Nombre16 del Estado, deberán traspasarlos a Nombre16 de este.

Art.14.- Condición inembargable e inalienable del patrimonio natural Los terrenos forestales y bosques que constituyen el patrimonio natural del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley.

Art. 16.- Linderos El Ministerio del Ambiente y Energía delimitará, en el terreno, los linderos de las áreas que conforman el patrimonio natural del Estado. El procedimiento de deslinde se fijará en el reglamento de esta ley.

Art. 18- Autorización de labores. En el patrimonio natural, el Estado podrá realizar o autorizar labores de investigación, capacitación y ecoturismo, así como actividades necesarias para el aprovechamiento de agua para consumo humano, de conformidad con el artículo 18 bis de esta ley, una vez aprobadas por el ministro de Ambiente y Energía, quien definirá, cuando corresponda, la realización de evaluaciones del impacto ambiental, según lo establezca el reglamento de esta ley.

(Así reformado por el artículo 1° de la Ley para autorizar el aprovechamiento de agua para consumo humano y construcción de obras conexas en el Patrimonio Natural del Estado, N° 9590 del 3 de julio de 2018)

Art. 18 bis Aprovechamiento de agua para abastecimiento de poblaciones. El Ministerio de Ambiente y Energía (Minae) podrá autorizar el aprovechamiento de agua proveniente de fuentes superficiales y la construcción, la operación, el mantenimiento y las mejoras de sistemas de abastecimiento de agua, en inmuebles que integran el patrimonio natural del Estado, previa declaración, por el Poder Ejecutivo, de interés público, en específico para un abastecimiento poblacional imperioso y a favor de los entes autorizados prestadores de servicio público (…)” (Lo destacado no corresponde al original).

(…)

En consecuencia, se insiste, en las áreas silvestres protegidas su administración está delimitada por la correspondiente categoría de manejo impuesta, siendo que no puede haber una reducción de estas áreas a través de disposiciones o medidas infra legales; (…)

Es preciso insistir que para las áreas silvestres protegidas se establecen normas específicas correspondientes a su categoría de manejo, según sea una reserva forestal, zona protectora, reservas biológicas, etc. y su delimitación viene dada por disposición del Ejecutivo o del Legislativo de conformidad con sus específicas características y los objetivos concretos que motivaron la declaratoria en cuestión (ver arts. 35 y 36 de la LOA). Lo mismo corresponde señalar en relación con los sitios declarados de importancia internacional conforme la Convención Ramsar y respecto del PNE. Debe insistirse que la selección de los humedales que se inscriban en la “Lista Ramsar” está basada en su interés internacional desde el punto de vista ecológico, botánico, zoológico, limnológico o hidrológico y su retiro de la lista solo podría responder a “motivos urgentes de interés nacional” (art. 2 de la Convención Ramsar).

Finalmente, tal y como se detalló en la normativa recién transcrita, el PNE está delimitado así por unas específicas características reguladas en la propia Ley Forestal y que establece en los arts. 13, 14, 18 y 18 bis su definición, su administración y las actividades específicas y concretas que se pueden llevar a cabo en estas áreas.” Debe subrayarse en lo anterior que cada área silvestre protegida puede ser asociada con una categoría específica de manejo que delimita regulaciones específicas para su inscripción, manejo y aprovechamiento racional acorde con la protección conferida. Además, que el PNE está constituido por los bosques y terrenos forestales de las reservas nacionales, pero justamente por tal motivo es que no necesariamente se debe identificar como si fuera lo mismo que un refugio de vida silvestre, el cual podría estar eventualmente constituido únicamente por ecosistemas de índole marino o de humedal.

Nótese que en el caso concreto, cuando se ampliaron los límites del Refugio Nacional Vida Silvestre Ostional, se incluyeron diversos ecosistemas que no se caracterizan por su vocación boscosa. Al respecto, el art. 2 del por decreto ejecutivo n.°22551 del 14 de setiembre de 1993, “Amplía Refugio Nacional Vida Silvestre Ostional” dispone en lo conducente lo siguiente:

“Artículo 2°-Con el fin de ordenar la protección y aprovechamiento de los recursos naturales, el Refugio Nacional de Vida Silvestre Ostional estará constituido por los siguientes sectores: a) El Sector Marino que comprende las aguas territoriales según la delimitación anterior, b) El Sector Ostional, que comprende el principal sitio de desove de la tortuga lora en la Playa Ostional, c) El Sector Humedal Estuarino que conforman las áreas de manglar y d) El Sector Guiones, que comprende la Playa Pelada y la Playa Guiones”.

Esto confirma que no necesariamente se trata de terrenos forestales y, por lo tanto, que se trata de PNE.

Hecha esta precisión, reitero que coincido con las razones que llevaron a este Tribunal a declarar con lugar la acción de inconstitucionalidad.

Coincido con la Mayoría, en la necesidad de justificar técnicamente una ley que pretenda desafectar una zona que en su momento fue reservada para una determinada protección ambiental. Aun cuando en este caso, se mantuvo la condición de Refugio Nacional de Vida Silvestre, con la ley impugnada se pasó de un régimen de propiedad estatal a uno mixto, demeritando el nivel de tutela que se asignaba originariamente a ese bien demanial, sin estar fundado en un estudio técnico. Ahora bien, debo precisar que, en mi criterio, el estudio o aporte técnico que sea planteado y valorado ante la Asamblea Legislativa, puede provenir de cualquier entidad u órgano debidamente acreditado y especializado en la materia de la que sea objeto el proyecto de ley en estudio ante la Asamblea Legislativa, siempre que esté técnicamente sustentado.

Asimismo, reafirmo que, en efecto, cualquier actividad a realizar dentro de este tipo de refugios queda sujeto a lo establecido por la Ley Forestal, la cual actualmente dispone lo siguiente:

“Artículo 18- Autorización de labores. En el patrimonio natural, el Estado podrá realizar o autorizar labores de investigación, capacitación y ecoturismo, así como actividades necesarias para el aprovechamiento de agua para consumo humano, de conformidad con el artículo 18 bis de esta ley, una vez aprobadas por el ministro de Ambiente y Energía, quien definirá, cuando corresponda, la realización de evaluaciones del impacto ambiental, según lo establezca el reglamento de esta ley”.

Lo cual es definido precisamente en los Planes de Manejo que establece el propio MINAE al respecto, dependiendo del tipo de área de protección asignada. Sin embargo, dadas las particularidades de este caso, donde se reitera, ya existía una protección normativa mayor y, por ley se desafectó no solo parte de su territorio, con propósitos incluso diversos a la tutela ambiental, sino que también fue disminuido el grado de tutela que tenía respecto de algunas áreas, a fin de resolver un problema de ocupación dentro de esta área, lo cual es ajeno a su fin, el origen de la reforma legal requería estar sustentada en un estudio técnico que justificara tales cambios y compensara la tutela ambiental existente, conforme ya lo había indicado este Tribunal para este caso en particular.
