SummaryResumen

The Criminal Judgment Appeals Court denied the challenge to an order requiring the demolition of a wall built in 2013 within the protected area of the Gandoca-Manzanillo National Wildlife Refuge and the natural restoration of the site. It held that the distinctive characteristics of environmental matters require a cross-cutting judicial analysis integrating the Political Constitution, the Biodiversity Law, the Forestry Law, the Organic Environmental Law, the Rio Declaration, and binding decisions of the Constitutional Chamber (Sala Constitucional). The applicable principles included legality, lesividad, pro natura, and responsibility. Based on the established facts and expert report No. 0748-ING-2013, the structure stood on public-domain property and caused serious environmental harm, which justified demolition and natural restoration. The court rejected the assertion of possible third-party rights because the land belongs to the State, the construction lacked municipal authorization, and the applicant challenging the order did not explain how it harmed the accused, leaving him without the required subjective standing to seek review.

Because of the distinctive characteristics of environmental matters, judicial analysis must be cross-cutting. The judge must weigh national law (Article 50 of the Political Constitution, Article 11 of the Biodiversity Law (preventive and precautionary criterion—in dubio pro natura), Article 19 of the Forestry Law, and Article 2(d) of the Organic Environmental Law) and supraconstitutional law (the Rio Declaration and Principle 15 of the United Nations Conference on Environment and Development) in accordance with the principles governing the field. That condition alone means that, because the structure was built on public-domain property and caused environmental harm, its demolition and the natural restoration of the site must be ordered. Thus, contrary to the challenger’s assertion, the first-instance judge did have legal authority to rule as she did.

“[...] IV.- Denied. [...] Given the particular characteristics of environmental matters, judicial analysis must be cross-cutting. The adjudicator must weigh national law (Article 50 of the Political Constitution, Article 11 of the Ley de Biodiversidad (preventive and precautionary criteria—in cases of doubt, favor nature (in dubio pro natura)—), Article 19 of the Ley Forestal, and Article 2(d) of the Ley Orgánica del Ambiente) and supra-constitutional law (the Rio Declaration and Principle 15 of the United Nations Conference on Environment and Development) in accordance with the principles governing this field. In this particular case, those are the principles of legality, harmfulness (lesividad), favoring nature (pro natura), and responsibility. Likewise, the judge must adhere to the binding criteria issued by the Constitutional Chamber (Sala Constitucional) on the matter (decision No. 2004-1923 and, in particular, decision No. 12745-2019—which declares Ley N.° 9223 unconstitutional and preserves the protected area of the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo).

According to the facts established, the wall was built in 2013 within the protected area of the Refugio Nacional de Vida Silvestre Gandoca Manzanillo (see expert report No. 0748-ING-2013 issued by the Departamento de Ingeniería Forense). That fact alone entails that, because it was built on public-domain property (bien demanial) and caused environmental damage, its demolition and the restoration of the natural environment must be ordered. Thus, contrary to the challenging party’s assertion, the judge below did have legal authority to rule as she did. The defense argues that third parties affected may hold individual rights (derechos subjetivos), but that argument cannot be entertained because, first, the land on which the wall was built belongs to the State (not to a third party) and, second, the construction had no municipal authorization that might support a finding of good faith; on the contrary, it was found to have caused serious environmental damage.

Furthermore, this Chamber of Appeal observes that the appellant does not state how the ruling affects the accused, which is necessary to establish prejudice; therefore, the appellant would also lack standing to appeal. Finally, without any basis, the challenging party states that the ruling could give rise to civil liability against him, but does not explain why and bases his position merely on disagreement with the ruling. Accordingly, the right of a third party or potential financial harm cannot be invoked, because the person or persons who built that wall within the conservation area did so unlawfully and instead caused environmental damage for which they would be required to pay compensation.[...]”

"[...] IV.- No ha lugar. [...]
